AN tACHT UM LAETHANTA SAOIRE (FOSTAITHE), 1973
[An tiontú oifigiúil]
Léiriú.
1.—(1) San Acht seo—
tá le “saoire bhliantúil” an bhrí a shonraítear in alt 3 (1);
ciallaíonn “fostú” fostú faoi chonradh seirbhíse (cibé acu is conradh sainráite nó intuigthe nó conradh ó bhéal nó i scríbhinn é) nó faoi chonradh printíseachta, agus forléireofar focail ghaolmhara dá réir sin;
ciallaíonn “bliain saoire” bliain a thosóidh aon lú lá d'Aibreán;
ciallaíonn “an tAire” an tAire Saothair;
ciallaíonn “gnáth-ráta seachtainiúil”, maidir le luach saothair—
(a) i gcás íocaíochta ar de réir am-ráta go hiomlán nó de réir tuarastail nó ráta shocair a íoctar í, agus in aon chás íocaíochta eile nach n-athraíonn i ndáil leis an obair a dhéantar—an tsuim (lena n-áirítear aon liúntas nó bónas rialta nach n-athraíonn i ndáil leis an obair a dhéantar, ach gan íocaíocht bhreis-ama a áireamh) is iníoctha in aghaidh gnáth-uaire a chloig oibre seachtainiúla sa tseachtain oibre díreach roimh an tsaoire bhliantúil nó roimh scor den fhostaíocht,
(b) in aon chás eile—suim is comhionann leis an meántuilleamh seachtainiúil (gan pá breis-ama a áireamh) do ghnáthuaire a chloig oibre arna ríomh faoi threoir an tuillimh i leith an ama a oibríodh sna trí sheachtain déag dar chríoch an lá roimh an tsaoire bhliantúil nó roimh scor den fhostaíocht nó, murar oibríodh aon am sna seachtainí sin, sna trí sheachtain déag dar chríoch an lá ar oibríodh go deireanach ar feadh am ar bith roimh an tsaoire bhliantúil nó roimh scor den fhostaíocht:
forléireofar “lá saoire poiblí” de réir an Sceidil;
forléireofar “rialacháin” de réir alt 14 (1);
ciallaíonn “fliuch-am” uaire a chloig breac-dhíomhaointis arb iníoctha sochar forlíontach ina leith faoi alt 28 den Acht Árachais (Breac-Dhíomhaointeas), 1942.
(2) Má fhanann fostaí i ngnóthas tar éis an gnóthas aistriú—
(a) measfar, chun críocha an Achta seo, é a bheith fostaithe ag an bhfostóir nua ó cibé uair acu seo is déanaí, is é sin, an uair a thosaigh a fhostaíocht sa ghnóthas nó an uair a thosaigh—
(i) an bhliain saoire roimhe sin i gcás gur sa chéad leath den dara bliain saoire nó aon bhliain saoire dá héis a tharla an t-aistriú, nó
(ii) an bhliain saoire a tharla an t-aistriú in aon chás eile,
(b) agus saoire bhliantúil a bheith lamháilte dó roimh an aistriú, measfar, chun críocha an Achta seo, gurb é an fostóir nua a lamháil í.
(3) Chun críocha an Achta seo measfar duine i seirbhís údaráis áitiúil a bheith fostaithe ag an údarás áitiúil.
Feidhmiú.
2.—(1) Ach amháin mar a fhoráiltear le rialacháin, ní bheidh feidhm ag an Acht seo maidir le—
(a) eachtar-oibrí,
(b) oibrí talmhaíochta,
(c) maraí,
(d) fostaí teach solais nó long solais,
(e) iascaire,
(f) daoine atá fostaithe ag an Stát nó faoin Stát seachas duine atá fostaithe amhlaidh ar obair thionscail de réir brí an Achta um Choinníollacha Fostaíochta, 1936, nó ar fhodhualgais i gcáil neamhbhunaithe sa státseirbhís,
(g) fostaí is gaol don fhostóir atá á chothabháil ag an bhfostóir agus a chónaíonn i dteach an fhostóra nó ar a fheirm.
(2) Féadfaidh forálacha cumhalda agus forlíontacha (lena n-áirítear forálacha ag modhnú an Achta seo) a bheith i rialacháin chun críocha fho-alt (1).
(3) Féadfaidh rialacháin fostaithe sonraithe a eisiamh ó fheidhm alt 3 nó alt 4.
(4) San alt seo—
ciallaíonn “eachtar-oibrí” fostaí dá dtugtar amach earraí nó ábhair chun iad a chomhdhéanamh, a ghlanadh, a ní, a athrú, a ornáidiú nó a dheisiú nó a oiriúnú lena ndíol ina theach féin nó in áitreabh eile nach bhfuil faoi rialú ná bainistí an duine a thug amach na hábhair nó na hearraí;
ciallaíonn “oibrí talmhaíochta” oibrí talmhaíochta lena mbaineann na hAchtanna um Oibrithe Talmhaíochta (Laethanta Saoire), 1950 go 1969;
ciallaíonn “maraí” máistir nó comhalta den fhoireann ar aon árthach farraige (nach báirse ná bád dríodair), cibé acu ar úinéireacht phoiblí nó phríobháideach di, a bhíonn ag iompar lasta nó paisinéirí;
ciallaíonn “gaol” banchéile, fearchéile, athair, máthair, seanathair, seanmháthair, leasathair, leasmháthair, mac, iníon, garmhac, gariníon, leasmhac, leasiníon, deartháir, deirfiúr, deartháir leasghaolmhar nó deirfiúr leasghaolmhar.
Teideal chun saoire bliantúla.
3.—(1) Beidh fostaí i dteideal saoire le pá (dá ngairtear saoire bhliantúil san Acht seo) i leith bliana saoire ina mbeidh mí cháilitheach amháin ar a laghad de sheirbhís tugtha aige.
(2) Beidh saoire bhliantúil comhionann le trí sheachtain oibre i gcás dhá mhí dhéag cháilitheacha seirbhíse agus, faoi réir an chéad fho-ailt eile, le níos lú ná sin go comhréireach i gcás aon mhí dhéag den sórt sin nó níos lú.
(3) Beidh saoire bhliantúil comhionann freisin le trí sheachtain oibre i gcás an fostaí d'oibriú don fhostóir 1,400 uair a chloig (nó 1,300 uair a chloig i gcás é bheith faoi bhun 18 mbliana d'aois) i gcaitheamh na bliana saoire mura bliain saoire í ina n-athraíonn sé a fhostaíocht.
(4) Aon lá ar lá saoire bliantúla é ar leith ón bhfo-alt seo, áireofar, más lá breoiteachta é a dtabharfar deimhniú ó liachleachtóir cláraithe ina leith, nach lá saoire bliantúla é.
(5) (a) I gcás ocht mí cháilitheacha nó níos mó de sheirbhís a bheith tugtha, ní foláir, faoi réir aon chomhaontú fostaíochta cláraithe, aon ordú rialaithe fostaíochta nó aon chomhaontú le ceardchumann an fhostaí, tréimhse gan bhriseadh comhionann le dhá sheachtain oibre a bheith ar áireamh i saoire bhliantúil.
(b) Nuair a bheifear á fhionnadh, chun críocha an fho-ailt seo, an ionann tréimhse agus dhá sheachtain oibre, ní áireofar gur lá saoire poiblí nó lá breoiteachta aon lá áirithe.
(c) San fho-alt seo tá le “comhaontú fostaíochta cláraithe” an bhrí chéanna atá leis i gCuid III den Acht Caidrimh Thionscail, 1946, agus tá le “ordú rialaithe fostaíochta” an bhrí chéanna atá leis i gCuid IV den Acht sin.
(6) Nuair is chuid de luach saothair cothú, iostas nó cothú agus iostas, féadfaidh an fostaí a roghnú, faoi réir pá dúbailte a thabhairt dó, gan saoire bhliantúil a thógáil.
(7) (a) San alt seo ciallaíonn “mí cháilitheach seirbhíse” aon mhí (Eanáir go Nollaig) inar oibrigh an fostaí cuid nár lú ná 120 uair a chloig (nó 110 n-uaire a chloig i gcás é a bheith faoi bhun 18 mbliana d'aois) don fhostóir.

(i) áireofar lá de shaoire bhliantúil mar lá ar ar oibrigh an fostaí na huaire a chloig a d'oibreodh sé dá mba nach raibh sé ar saoire, agus
(ii) áireofar fliuch-am mar uaire a chloig a oibríodh suas go dtí uasteorainn, i gcás fho-alt (3), 480 uair a chloig sa bhliain saoire nó, i gcás na míre sin roimhe seo, 40 uair a chloig sa mhí.
Teideal i leith laethanta saoire poiblí.
4.—(1) (a) Beidh fostaí i dteideal go bhfaighidh sé i leith lá saoire poiblí—
(i) lá saor le pá an lá sin, nó
(ii) lá saor le pá laistigh de mhí, nó
(iii) lá breise de shaoire bhliantúil, nó
(iv) pá lae breise,
de réir mar a chinnfidh an fostóir.
(b) D'ainneoin lá saoire poiblí do thitim ar lá a n-oibreodh fostaí de ghnáth, dá mba nár lá saoire é, cuid is lú ná lá iomlán, is tagairtí do phá lae iomláin na tagairtí atá san fho-alt seo i leith an lae sin do phá.
(2) (a) I gcás fostaíocht ó lá agus fostaíocht pháirtaimsire, ní foláir don fhostaí, chun bheith i dteideal saoire faoin alt seo, cuid nár lú ná 120 uair a chloig (nó 110 n-uaire a chloig i gcás é a bheith faoi bhun 18 mbliana d'aois) a bheith oibrithe aige don fhostóir sna cúig sheachtain dar chríoch an lá roimh an lá saoire poiblí.
(b) Chun críocha an fho-ailt seo—
(i) áireofar am saor a lamháladh faoin Acht seo mar am a oibríodh,
(ii) áireofar fliuch-am mar uaire a chloig a oibríodh faoi réir uasteorainn caoga uair a chloig.
Cúiteamh ar scor d'fhostaíocht.
5.—(1) I gcás—
(a) fostaí do scor de bheith fostaithe, agus
(b) saoire bhliantúil a bheith dlite dó i leith na bliana saoire reatha nó, i gcás an fhostaíocht do scor an chéad leath den bhliain sin, i leith na bliana sin, na bliana saoire roimhe sin nó ina leith araon,
íocfaidh an fostóir cúiteamh leis i leith na saoire bliantúla comhionann leis an gceathrú cuid den ghnáth-ráta seachtainiúil luach saothair in aghaidh gach mí cháilitheach seirbhíse.
(2) I gcás ina scoirfidh fostaíocht ó lá go lá agus an fostaí a bheith, agus gan saoire bhliantúil dlite dó, tar éis oibriú don fhostóir ar feadh cuid nár lú ná 120 uair a chloig (nó 110 n-uaire a chloig i gcás é a bheith faoi bhun 18 mbliana d'aois) sna 30 lá dar chríoch an lá sular scoir an fhostaíocht, íocfaidh an fostóir pá lae agus ceathrú breise leis mar chúiteamh.
(3) I gcás ina scoirfidh an fhostaíocht sna cúig sheachtain dar críoch an lá roimh lá saoire poiblí agus an fostaí a bheith tar éis cuid nár lú ná 120 uair a chloig (nó 110 n-uaire a chloig i gcás é a bheith faoi bhun 18 mbliana d'aois) a bheith oibrithe aige don fhostóir sa chuid den tréimhse sin roimh an scor, íocfaidh an fostóir pá lae breise leis mar chúiteamh i leith an lae saoire phoiblí.
(4) Is le hionadaithe an fhostaí a íocfar an cúiteamh faoin alt seo más é a bhás cúis an scoir.
(5) I gcás cúiteamh a bheith iníoctha faoi fho-alt (3), áireofar, chun críocha forálacha an Achta Leasa Shóisialaigh, 1952, a bhaineann le sochar dífhostaíochta, nach raibh an fostaí i bhfostaíocht an fhostóra an lá saoire poiblí.
Tráthanna agus íocaíocht do shaoire bhliantúil.
6.—(1) Cinnfidh an fostóir na tráthanna a thabharfar saoire bhliantúil tar éis dó riachtanais na hoibre a chur san áireamh agus faoi réir an méid seo a leanas—
(a) go gcuirfidh sé san áireamh na deiseanna sosa agus scíthe atá ann don fhostaí,
(b) comhairle a bheith glactha aige (roimh mhí dar críoch an tráth sin) leis an bhfostaí nó lena cheardchumann, agus
(c) saoire a thabhairt an bhliain saoire ar ina leith a thabharfar í nó sna sé mhí ina dhiaidh sin.
(2) Beidh fostóir a mhainneoidh fo-alt (1) (b) a chomhlíonadh ciontach i gcion.
(3) An pá do shaoire bhliantúil—
(a) is roimh ré a thabharfar é,
(b) is de réir an ghnáth-ráta sheachtainiúil luach saothair a íocfar é, agus
(c) i gcás inar cuid den luach saothair iostas, lóistín nó iostas agus lóistín, áireofar ann, faoi réir rialachán, cúiteamh i leith aon iostas nó lóistín nach bhfuarthas.
Fostóir do mhainniú saoire bhliantáil a thabhairt.
7.—Mura mbeidh an tsaoire bhliantúil tugtha ag fostóir, i gcás fostaí atá fós ar fostú aige tar éis chríochnú na tréimhse inar chóir an tsaoire bhliantúil a thabhairt—
(a) beidh an fostóir ciontach i gcion,
(b) tabharfaidh an fostóir (cibé acu a bheidh nó nach mbeidh imeachtaí tionscanta i leith an chiona sin) don fhostaí, i dteannta aon phá a bheidh dlite, suim is comhionann leis an bpá a bheadh íoctha leis don tsaoire dá mba gur tugadh í sa chaoi go mbeadh deireadh léi ar chríochnú na tréimhse inar chóir í a thabhairt.
Fostóir do mhainniú suim atá dlite a íoc.
8.—(1) Má mhainníonn fostóir, i gcás suim a bheith dlite de d'fhostaí faoin Acht seo, an tsuim sin a íoc—
(a) beidh an fostóir ciontach i gcion,
(b) féadfaidh an fostaí (cibé acu a bheidh nó nach mbeidh imeachtaí tionscanta i leith an chiona) an tsuim a ghnóthú mar fhiach conartha shimplí in aon chúirt dlínse inniúla.
(2) Féadfaidh an chúirt a chiontóidh fostóir i gcion faoin Acht seo a ordú dó, má bhaineann an cion le fostaí a bhfuil suim dlite de dó faoin Acht seo, an tsuim a íoc leis an bhfostaí.
(3) Féadfaidh ceardchumann fostaí imeachtaí de bhun fho-alt (1) (b) a thionscnamh agus a chothú thar ceann an fhostaí.
Cionta.
9.—(1) Aon duine a bheidh ciontach i gcion faoin Acht seo, dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná cúig phunt is fiche nó, i gcás an dara cion nó cion dá éis sin faoin alt céanna, fíneáil nach mó ná caoga punt a chur air.
(2) Féadfaidh an tAire cion faoin alt seo a ionchúiseamh.
(3) Féadfar ionchúiseamh faoin Acht seo a thionscnamh laistigh de dhá mhí dhéag tar éis an chiona.
(4) I gcás ina gcruthófar, maidir le cion faoin Acht seo ag comhlacht corpraithe, go ndearnadh é le toiliú nó le ceadú, nó gur urasaíodh é trí aon fhaillí de chuid, aon stiúrthóra, bainisteora, rúnaí nó oifigigh eile de chuid an chomhlachta chorpraithe, measfar eisean freisin a bheith ciontach sa chion.
(5) In ionchúiseamh faoin Acht seo is cosaint é a chruthú gur tharla, nó go raibh coinne go dtarlódh, dóiteán, tuile, stoirm, foréigean, cliseadh gléasra nó innealra nó aon éigeandáil eile.
Taifid.
10.—(1) Coimeádfaidh fostóir, agus coinneoidh sé go ceann trí bliana ar a laghad, cibé taifid is gá chun a thaispeáint an bhfuil sé ag comhlíonadh an Achta seo.
(2) Beidh fostóir a sháróidh an t-alt seo ciontach i gcion.
Cigirí.
11.—(1) San alt seo ciallaíonn “cigire” duine arna cheapadh ag an Aire chun bheith ina chigire chun críocha an Achta seo.
(2) Féadfaidh cigire—
(a) dul isteach gach tráth réasúnach in aon áitreabh nó áit a mbeidh cúis réasúnach aige lena cheapadh go bhfuil aon fhostaí ar fostú ann,
(b) aon scrúdú nó fiosrú a dhéanamh ann is gá chun a fháil amach an bhfuiltear ag comhlíonadh an Achta seo,
(c) a cheangal ar fhostóir nó ar a ionadaí aon taifid a thabhairt ar aird a cheanglaíonn an tAcht seo ar an bhfostóir a choimeád agus na taifid a iniúchadh agus cóipeanna a dhéanamh d'iontrálacha iontu,
(d) duine ar bith a mbeidh cúis réasúnach aige chun a chreidiúint gur fostóir nó fostaí é nó gurbh fhostóir nó fostaí é a cheistiú maidir le haon ábhair faoin Acht seo agus a cheangal air freagra a thabhairt ar cibé ceisteanna (seachas ceisteanna a d'inchoireodh é) a chuirfidh an cigre i dtaobh na n-ábhar sin agus dearbhú ar fhírinne na bhfreagraí a shíniú.
(3) Ní bheidh na cumhachtaí a thugtar do chigire le fo-alt (2) (a) infheidhmithe maidir le teach cónaí príobháideach mura ndeimhneoidh an tAire (nó oifigeach don Aire arna cheapadh chuige sin ag an Aire) go bhfuil cúis réasúnach aige chun a chreidiúint go ndearna an fostóir cion faoin alt seo maidir le fostaí atá ar fostú sa teach agus mura ndéanfaidh an cigire, agus é á iarraidh é a ligean isteach sa teach, an deimhniú a thabhairt ar aird.
(4) Aon duine—
(a) a choiscfidh nó a bhacfaidh cigire agus é ag feidhmiú aon chumhachta a thugtar leis an alt seo,
(b) a dhiúltóidh aon taifead a thabhairt ar aird a iarrfaidh cigire air go dleathach a thabhairt ar aird,
(c) a thabharfaidh ar aird aon taifead a bheidh bréagach in aon sonra ábhartha agus a fhios aige é a bheith bréagach, nó a chuirfidh faoi deara é a thabhairt ar aird, nó a cheadóidh go feasach é a thabhairt ar aird, do chigire,
(d) a chuirfidh cosc, nó a fhéachfaidh le cosc a chur, le haon duine ó láithriú os comhair nó óna cheistiú ag cigire, nó
(e) a mhainneoidh go toiliúil nó a dhiúltóidh déanamh de réir aon cheanglais dleathaigh ó chigire faoi fho-alt (2) (d),
beidh an duine sin ciontach i gcion.
(5) Tabharfar deimhniú a cheaptha do chigire agus nuair a bheidh sé á iarraidh go ligfí isteach é in aon áitreabh nó áit, tabharfaidh sé an deimhniú ar aird, má iarrtar air é, don áititheoir agus d'aon duine a bheidh á cheistiú aige.

12.—Ní inghnóthaithe luach saothair i leith obair a dhéanann fostaí le linn saoire bliantúla.
Modhnú.
13.—(1) Féadfar aon fhorálacha de chuid an Achta seo a mhodhnú le rialacháin d'fhonn go gcomhlíonfar aon oibleagáidí idirnáisiúnta atá ar an Stát nó atá socair ag an Stát a ghabháil air féin.
(2) Más dóigh leis an Aire nach indéanta aon fhoráil áirithe de chuid an Achta seo a chomhlíonadh maidir le haon aicme áirithe fostaithe nó gnóthas, féadfar, le rialacháin, an fhoráil a mhodhnú i leith na haicme sin.
Rialacháin.
14.—(1) Féadfaidh an tAire rialacháin a dhéanamh chun críocha an Achta seo, agus is tagairtí do rialacháin faoin bhfo-alt seo na tagairtí i bhforálacha eile de chuid an Achta seo do rialacháin.
(2) Sula ndéanfaidh an tAire rialacháin chun críocha alt 13 (2), rachaidh sé i gcomhairle le cibé eagraíochtaí fostoirí agus le cibé eagraíochtaí fostaithe ar cuí leis comhairle a ghlacadh leo.
(3) (a) Má bheartaítear rialacháin a dhéanamh chun críocha alt 2, leagfar dréacht díobh faoi bhráid gach Tí den Oireachtas agus ní dhéanfar na rialacháin nó go rithfidh gach Teach rún ag ceadú an dréachta.
(b) Leagfar rialacháin eile faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a ndéanta, agus, má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis na rialacháin a leagan faoina bhráid, rún a rith ag neamhniú na rialachán, beidh siad ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin fúthu.
Caiteachais.
15.—Déanfar na caiteachais a thabhóidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais é, as airgead a sholáthróidh an tOireachtas.
Foirceannadh an Achta um Laethanta Saoire (Fostaithe), 1961, agus foráil idirlinne.
16.—(1) Ní blianta fostaíochta faoin Acht um Laethanta Saoire (Fostaithe), 1961, blianta dar tosach dáta thosach feidhme an Achta seo nó dáta da éis sin, agus ní bheidh feidhm ag an Acht sin maidir le laethanta saoire poiblí faoin Acht seo.
(2) I gcás ina mbeadh feidhm ag fo-alt (4) d'alt 9, ag fo-alt (3) d'alt 10 nó ag fo-alt (5) nó (6) d'alt 13 den Acht um Laethanta Saoire (Fostaithe), 1961, i gcás oibrí i bhfostaíocht ar dháta thosach feidhme an Achta seo dá mba gur scoir an fhostaíocht díreach roimh an tosach feidhme sin, beidh feidhm ag an bhfo-alt sin, mura gcomhaontóidh an t-oibrí agus an fostóir ar a mhalairt, amhail is dá mba gur tharla an scor.

17.—Beidh éifeacht ag na hAchtanna Laetheanta Saoire Puiblí, 1871 go 1924, faoi réir tagairt do na laethanta is laethanta saoire poiblí de bhua mhíreanna 1 agus 2 den Sceideal a ghabhann leis an Acht seo a chur—
(a) in ionad na tagartha atá in alt 1 den Bank Holidays Act, 1871, do na laethanta a luaitear sa Sceideal a ghabhann leis an Acht sin, agus
(b) in ionad na tagartha in alt 1 den Holidays Extension Act, 1875, do na laethanta a luaitear sa Sceideal a ghabhann leis an Acht sin.

18.—(1) Féadfar an tAcht um Laethanta Saoire (Fostaithe), 1973, a ghairm den Acht seo.
(2) Féadfar na hAchtanna um Laethanta Saoire Poiblí, 1871 go 1973, a ghairm de na hAchtanna Laetheanta Saoire Puiblí, 1871 go 1924, agus d'alt 17 den Acht seo le chéile.
(3) Tiocfaidh an tAcht seo i ngníomh an lú lá d'Aibreán, 1974.
AN SCEIDEAL
Laethanta is laethanta saoire poiblí
1. Faoi réir na míreanna sin ina dhiaidh seo is lá saoire poiblí chun críocha an Achta seo gach lá díobh seo a leanas:
(a) Lá Nollag más dálach é nó, mura dálach é, an Mháirt ina dhiaidh sin,
(b) Lá Fhéile Stiofáin más dálach é no. mura dálach é. an lá ina dhiaidh sin,
(c) Lá Fhéile Pádraig más dálach é nó, mura dálach é, an lá ina dhiaidh sin,
(d) Luan Cásca, an chéad Luan de Mheitheamh agus an chéad Luan de Lúnasa,
(e) lá arna cheapadh le rialacháin le bheith ina lá saoire poiblí chun na gcríocha sin.
2. Féadfar, le rialacháin, maidir le haon lá dá dtagraítear i mír l, aon lá eile a chur ina ionad.

HOLIDAYS (EMPLOYEES) ACT, 1973
Interpretation.
1.—(1) In this Act—
“annual leave” has the meaning specified in section 3 (1);
“employ” means employ under a contract of service (whether the contract is expressed or implied or is oral or in writing) or a contract of apprenticeship, and cognate words shall be construed accordingly;
“leave year” means a year beginning on any 1st day of April;
“the Minister” means the Minister for Labour;
“normal weekly rate”, in relation to remuneration, means—
(a) in a case of payment wholly by a time rate or by a fixed rate or salary, and in any other case of payment not varying in relation to the work done—the sum (including any regular bonus or allowance which does not vary in relation to work done, but excluding pay for overtime) payable in respect of normal weekly working hours in the working week next before annual leave or cesser of employment,
(b) in any other case—a sum equivalent to the average weekly earnings (excluding pay for overtime) for normal working hours calculated by reference to the earnings in respect of the time worked during the thirteen weeks ending on the day before annual leave or cesser of employment or, if no time was worked during those weeks, during the thirteen weeks ending on the day on which time was last worked before annual leave or cesser of employment;
“public holiday” is to be construed in accordance with the Schedule;
“regulations” is to be construed in accordance with section 14 (1);
“wet time” means hours of intermittent unemployment in respect of which supplementary benefit is payable under section 28 of the Insurance (Intermittent Unemployment) Act, 1942.
(2) Where an employee continues in an undertaking after its transfer—
(a) he shall, for the purposes of this Act, be regarded as having been employed by the new employer from either (whichever is the later) the beginning of his employment in the undertaking or the beginning of—
(i) the previous leave year in case the transfer occurs during the first half of the second or any subsequent leave year, or
(ii) the leave year in which the transfer occurs in any other case,
(b) if he has been allowed annual leave before the transfer, it shall, for the purposes of this Act, be regarded as having been allowed by the new employer.
(3) A person in the service of a local authority shall be deemed for the purposes of this Act to be employed by the local authority.
Application.
2.—(1) This Act shall, save as provided by regulations, not apply to—
(a) an outworker,
(b) an agricultural worker,
(c) a seafarer,
(d) a lighthouse or lightship employee,
(e) a fisherman,
(f) persons employed by or under the State other than a person so employed on industrial work within the meaning of the Conditions of Employment Act, 1936 or on subordinate duties in an unestablished capacity in the civil service,
(g) an employee who is a relative of the employer maintained by the employer and dwelling in the employer's house or on his farm.
(2) Regulations for the purposes of subsection (1) may contain ancillary and supplemental provisions (including provisions modifying this Act).
(3) Regulations may exclude specified employees from the application of section 3 or section 4.
(4) In this section—
“outworker” means an employee to whom articles or materials are given out to be made up, cleaned, washed, altered, ornamented or repaired or adapted for sale in his own home or on other premises not under the control or management of the person who gave out the materials or articles;
“agricultural worker” means an agricultural worker to whom the Agricultural Workers (Holidays) Acts, 1950 to 1969, apply;
“seafarer” means a master or a member of the crew of any seagoing vessel (not being a barge or a hopper), whether publicly or privately owned, engaged in the transport of cargo or passengers;
“relative” means a wife, husband, father, mother, grandfather, grandmother, step-father, step-mother, son, daughter, grand-son, grand-daughter, step-son, step-daughter, brother, sister, half-brother or half-sister.
Entitlement to annual leave.
3.—(1) An employee shall be entitled to paid leave (in this Act referred to as annual leave) in respect of a leave year in which he has at least one qualifying month of service.
(2) Annual leave shall be equivalent to three working weeks where there are twelve qualifying months of service and, subject to the next subsection, to proportionately less where there are eleven or fewer such months.
(3) Annual leave shall also be equivalent to three working weeks where the employee works for the employer at least 1,400 hours (or 1,300 hours if under 18 years of age) during the leave year unless it is a leave year during which he changes his employment.
(4) A day which, apart from this subsection, would be a day of annual leave shall, if it is a day of illness in respect of which a certificate of a registered medical practitioner is furnished, be taken as not being a day of annual leave.
(5) (a) Where there are eight or more qualifying months of service, annual leave shall, subject to any registered employment agreement, employment regulation order or agreement with the employee's trade union, include an unbroken period equivalent to two working weeks.
(b) When ascertaining, for the purposes of this subsection, whether a period is equivalent to two working weeks, the fact that a day is a public holiday or a day of illness shall be disregarded.
(c) In this subsection “registered employment agreement” has the same meaning as in Part III of the Industrial Relations Act, 1946, and “employment regulation order” has the same meaning as in Part IV of that Act.
(6) Where board, lodging or board and lodging is part of remuneration, the employee may, subject to being given double pay, elect not to take annual leave.
(7) (a) In this section “qualifying month of service” means any month (January to December) during which the employee has worked for the employer at least 120 hours (or 110 hours if under 18 years of age).
(b) For the purposes of subsection (3) and of the previous paragraph—
(i) a day of annual leave shall be taken as if the employee worked thereon the hours he would have worked if not on leave, and
(ii) wet time shall be taken to be hours worked up to a maximum, in the case of subsection (3), of 480 hours in the leave year or, in the case of the previous paragraph, 40 hours in the month.
Entitlement in respect of public holidays.
4.—(1) (a) An employee shall, in respect of a public holiday, be entitled to—
(i) a paid day off on that day, or
(ii) a paid day off within a month, or
(iii) an extra day's annual leave, or
(iv) an extra day's pay,
as the employer may decide.
(b) Notwithstanding that a public holiday falls on a day on which an employee, if it were not a holiday, would normally work for less than a full day, “paid” and “pay” in this subsection refer, as respects that day, to a full day's pay.
(2) (a) In the case of day to day and part-time employments, the employee must, for entitlement under this section, have worked for the employer for at least 120 hours (or 110 hours if under 18 years of age) during the five weeks ending on the day before the public holiday.
(b) For the purposes of this subsection—
(i) time off allowed under this Act shall be taken to be time worked,
(ii) wet time shall be taken to be hours worked up to a maximum of 50 hours.
Compensation on cesser of employment.
5.—(1) Where—
(a) an employee ceases to be employed, and
(b) annual leave is due to him in respect of the current leave year or, in case the cesser occurs during the first half of that year, in respect of that year, the previous leave year or both,
the employer shall pay compensation to him in respect of the annual leave consisting of one quarter of the normal weekly rate of remuneration for each qualifying month of service.
(2) Where employment on a day to day basis ceases and the employee, annual leave not being due to him, has, during the 30 days ending on the day before cesser of employment, worked for the employer for not less than 120 hours (or 110 hours if under 18 years of age), the employer shall pay compensation to him consisting of an extra day and a quarter's pay.
(3) Where employment ceases during the five weeks ending on the day before a public holiday and the employee has, during the part of that period before the cesser, worked for the employer for at least 120 hours (or 110 hours if under 18 years of age), the employer shall pay compensation to him in respect of the public holiday consisting of an extra day's pay.
(4) Compensation under this section shall, if the cesser is by the employee's death, be paid to his representatives.
(5) Where compensation is payable under subsection (3), the employee shall, for the purposes of the provisions of the Social Welfare Act, 1952, relating to unemployment benefit, be regarded as not having been, on the public holiday, in the employment of the employer.
Times and pay for annual leave.
6.—(1) Times at which annual leave is given shall be determined by the employer having regard to work requirements and subject—
(a) to his taking into account the opportunities for rest and relaxation available to the employee,
(b) to his having consulted (prior to one month ending at the time) the employee or his trade union, and
(c) to leave being given within the leave year in respect of which it is given or the six months thereafter.
(2) An employer failing to comply with subsection (1) (b) shall be guilty of an offence.
(3) The pay for annual leave shall—
(a) be given in advance
(b) be at the normal weekly rate of remuneration, and
(c) in a case in which board, lodging or board and lodging is part of the remuneration, include, subject to regulations, compensation for any board or lodging not received.
Failure to give annual leave.
7.—If an employer, in the case of an employee whom he continues to employ upon the expiration of the period during which annual leave should have been given, has not given the leave—
(a) the employer shall be guilty of an offence,
(b) the employer shall (whether proceedings have or have not been taken for the offence) give to the employee, in addition to any pay due, a sum equivalent to the pay that would have been paid to him for the leave if it had been given so as to end on the expiration of the period during which it should have been given.
Failure to pay sum due.
8.—(1) If an employer, in a case in which a sum is due by him under this Act to an employee, fails to pay the sum—
(a) the employer shall be guilty of an offence,
(b) the employee may (whether or not proceedings have been taken for the offence) recover the sum as a simple contract debt in any court of competent jurisdiction.
(2) The court by which an employer is convicted of an offence under this Act may order him, if the offence relates to an employee to whom he is liable for a sum under this Act, to pay the sum to the employee.
(3) Proceedings pursuant to subsection (1) (b) may be instituted and maintained on behalf of the employee by his trade union.
Offences.
9.—(1) A person who is guilty of an offence under this Act shall be liable on summary conviction to a fine not exceeding twenty-five pounds or, in the case of a second or subsequent offence under the same section, fifty pounds.
(2) An offence under this Act may be prosecuted by the Minister.
(3) A prosecution under this Act may be instituted within twelve months after the offence.
(4) Where an offence under this Act was committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of the body corporate, he also shall be deemed to have been guilty of the offence.
(5) In a prosecution under this Act, proof of the occurrence or anticipation of fire, flood, storm, violence, a breakdown of plant or machinery, or any other emergency, shall be a defence.
Records.
10.—(1) An employer shall keep, and retain for at least three years, such records as are necessary to show whether he is complying with this Act.
(2) An employer contravening this section shall be guilty of an offence.
Inspectors.
11.—(1) In this section “inspector” means a person appointed by the Minister to be an inspector for the purposes of this Act.
(2) An inspector may—
(a) enter at all reasonable times any premises or place where he has reasonable grounds for supposing that any employee is employed,
(b) make therein any examination or enquiry necessary for ascertaining whether this Act is complied with,
(c) require an employer or his representative to produce any records which the employer is required by this Act to keep and inspect and take copies of entries in the records,
(d) examine with regard to any matters under this Act any person whom he has reasonable cause to believe to be or to have been an employer or employee and require him to answer such questions (other than questions tending to incriminate him) as the inspector may put relative to those matters and to sign a declaration of the truth of the answers.
(3) The powers conferred on an inspector by subsection (2) (a) shall not be exercisable in respect of a private dwelling house unless the Minister (or an officer of the Minister appointed by the Minister for the purpose) certifies that he has reasonable grounds for believing that an offence under this section in relation to an employee employed in the house has been committed by the employer, and the inspector in applying for admission to the house produces the certificate.
(4) If any person—
(a) obstructs or impedes an inspector in the exercise of any power conferred by this section,
(b) refuses to produce any record which an inspector lawfully requires him to produce,
(c) produces, or causes to be produced or knowingly allows to be produced, to an inspector any record which is false in any material respect knowing it to be false,
(d) prevents, or attempts to prevent, any person from appearing before or being questioned by an inspector, or
(e) wilfully fails or refuses to comply with any lawful requirement of an inspector under subsection (2) (d),
such person shall be guilty of an offence.
(5) An inspector shall be furnished with a certificate of his appointment and, on applying for admission to any premises or place, shall, if so required, produce the certificate to the occupier and to any person being examined by him.
Work during annual leave—reward irrecoverable.
12.—Reward for work done by an employee during annual leave shall be irrecoverable.
Modifications.
13.—(1) Regulations may modify any provision of this Act so as to comply with any international obligations which the State has or has decided to assume.
(2) Where the Minister is of opinion that compliance with any provision of this Act would be impracticable in respect of any class of employee or undertaking, regulations may modify the provision in respect of that class.
Regulations.
14.—(1) The Minister may make regulations for the purposes of this Act, and references in other provisions of this Act to regulations are to regulations made under this subsection.
(2) Before making regulations for the purposes of section 13 (2), the Minister shall consult with such employers' organisations and such employees' organisations as he considers appropriate to be consulted.
(3) (a) Where regulations for the purposes of section 2 are proposed, a draft shall be laid before each House of the Oireachtas and the regulations shall not be made until a resolution approving of the draft has been passed by each House.
(b) Other regulations shall be laid before each House of the Oireachtas as soon as may be after they are made, and if a resolution annulling them is passed by either House within the next subsequent twenty-one days on which that House has sat after they are laid before it, they shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Expenses.
15.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Termination of Holidays (Employees) Act, 1961, and transitional provision.
16.—(1) Years beginning on or after the commencement of this Act shall not be employment years under the Holidays (Employees) Act, 1961, and that Act shall not apply in relation to public holidays under this Act.
(2) Where subsection (4) of section 9, (3) of section 10 or (5) or (6) of section 13 of the Holidays (Employees) Act, 1961, would apply in the case of a worker in employment on the commencement of this Act if cesser of the employment had occurred immediately before such commencement, that subsection shall, unless the worker and employer agree otherwise, apply as if the cesser had occurred.
Amendment of Public Holidays Acts, 1871 to 1924.
17.—The Public Holidays Acts, 1871 to 1924, shall have effect subject to the substitution of a reference to the days which, by virtue of paragraphs 1 and 2 of the Schedule to this Act, are public holidays—
(a) for the reference in section 1 of the Bank Holidays Act, 1871, to the days mentioned in the Schedule to that Act, and
(b) for the reference in section 1 of the Holidays Extension Act, 1875, to the days mentioned in the Schedule to that Act.
Short title, collective citation and commencement.
18.—(1) This Act may be cited as the Holidays (Employees) Act, 1973.
(2) The Public Holidays Acts, 1871 to 1924 and section 17 of this Act may be cited together as the Public Holidays Acts, 1871 to 1973.
(3) This Act shall come into operation on the 1st day of April, 1974.
SCHEDULE
Days which are public holidays
1. Each of the following days shall, subject to the subsequent paragraphs, be a public holiday for the purposes of this Act:
(a) Christmas Day if falling on a weekday or, if not, the next Tuesday,
(b) St. Stephen's Day if falling on a weekday or, if not, the next day,
(c) St. Patrick's Day if falling on a weekday or, if not, the next day,
(d) Easter Monday, the first Monday in June and the first Monday in August,
(e) a day appointed by regulations to be a public holiday for those purposes.
2. Regulations may, with respect to any day referred to in paragraph 1, substitute any other day.
3. An employer may substitute for any public holiday (other than Christmas Day or St. Patrick's Day) either—
(a) the Church holiday falling in the same year immediately before the public holiday, or
(b) the Church holiday falling in the same year immediately after the public holiday or, if the public holiday is a day which is a public holiday by virtue of paragraph 1 (b), the 6th day of January next following,
by giving to the employee notice of the substitution not less than fourteen days before the Church holiday (where that holiday is before the public holiday) or before the public holiday (where that holiday is before the Church holiday).
4. Each of the following days shall be a Church holiday for the purposes of paragraph 3:
(a) the 6th day of January, except when falling on a Sunday,
(b) Ascension Thursday,
(c) the Feast of Corpus Christi,
(d) the 15th day of August, except when falling on a Sunday,
(e) the 1st day of November, except when falling on a Sunday,
(f) the 8th day of December, except when falling on a Sunday,
(g) a day appointed by regulations to be a Church holiday for those purposes.
5. Regulations may, with respect to any day referred to in paragraph 4, substitute any other day.
6. A notice under this Schedule may be given by handing a copy to the employee or by posting a copy in a conspicuous position in the place of employment.
