ACHT NA LIA-CHLEACHTÓIRÍ, 1951.

Léiriú.
1.—(1) San Acht seo—
ciallaíonn “lá ceaptha” pé lá a cheapfas an tAire, le hordú, agus féadfar laethanta éagsúla a cheapadh chun críocha forál éagsúla den Acht seo nó chun feidhm a bheith ag aon fhoráil acu maidir le haicmí éagsúla cásanna;
ciallaíonn “Acht Breataineach 1950” an tAcht a rith an Pharlaimint Bhreataineach agus dár teideal The Medical Act, 1950;
ciallaíonn “an tAire” an tAire Sláinte;
ciallaíonn an bríathar “ordú” ordú le rialacháin arna ndéanamh ag an gComhairle;
ciallaíonn “an Príomh-Acht” Acht na nDochtúirí Leighis, 1927 (Uimh. 25 de 1927);
ciallaíonn “clárú sealadach” clárú de bhuaidh ailt 7 den Acht seo, agus forléireofar “cláraithe go sealadach” dá réir sin.
(2) Forléireofar an tAcht seo agus an Príomh-Acht mar aon ní amháin.
(3) Aon ordú a déanfar ag ceapadh lae chun críocha an Achta seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den dá lá dhéag a shuífeas an Teach sin tar éis an t-ordú a leagadh faoina bhráid, rún a rith ag neamhniú an orduithe, beidh an t-ordú arna neamhniú dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.
Srian le lán-chlárú.
2.—Ar an lá ceaptha ná dá éis ní déanfar aon chlárú ar dhuine sa chlár ach amháin clárú sealadach, mura rud é—
(a) i gcás duine a bheas ag éileamh a chláruithe de bhuaidh míre (a) d'fho-alt (1) d'alt 25 den Phríomh-Acht, arna leasú le halt 12 den Acht seo, go bhfuil sé cláraithe sa Chlár Ginearálta ar shlí seachas de bhuaidh ailt 6 d'Acht Breataineach 1950, nó
(b) i gcás duine a bheas ag éileamh a chláruithe de bhuaidh míre (b) d'fho-alt (1) d'alt 25 den Phríomh-Acht, go raibh sé, roimh an lá ceaptha, i seilbh an diplóma cháiliúcháin, nó chinn amháin ar a laghad de na diplómanna cáiliúcháin, ar dá bhuaidh a bheas sé ag éileamh a chláruithe, nó go bhfuil deimhnithe faoi alt 3 den Acht seo go bhfuil sé tar éis an taithí a bheith aige a sonraítear san alt sin, nó
(c) i gcás duine a bheas ag éileamh a chláruithe de bhuaidh fo-ailt (1) d'alt 26 den Phríomh-Acht, gur deimhin leis an gComhairle go bhfuil sé tar éis an taithí a bheith aige a sonraítear in alt 5 den Acht seo.
Deimhniú ar thaithí in ospidéal ceadaithe.
3.—(1) Ní deonfar deimhniú chun críocha míre (b) d'alt 2 den Acht seo i leith duine ar bith mura mbeidh sé, i ndiaidh scrúdú cáiliúcháin a ghnóthú dhó, tar éis bheith ar fostú, i gcáil dhochtúra chónaithigh, in ospidéal nó i bhforas ceadaithe, nó in ospidéil nó i bhforais cheadaithe, ar feadh pé tréimhse a bheas ordaithe.
(2) Féadfaidh duine a chomhlíonfas an coinníoll a sonraítear i bhfo-alt (1) den alt seo deimhniú d'iarraidh faoin alt seo ar chomhlucht deonta an diplóma cháiliúcháin ar dá bhuaidh atá sé ag éileamh a chláruithe, agus más deimhin leis an gcumhlucht sin—
(a) go raibh an t-iarratasóir, i rith an ama a bhí sé ar fostú amhail mar adúradh, ag gabháil don mhíochaine ar feadh pé tréimhse nó tréimhse íosta a bheas ordaithe agus ag gabhail don mháinliacht ar feadh pé tréimhse nó tréimhse íosta a bheas ordaithe, agus
(b) gur thug sé seirbhís shásúil an fhaid a bhí sé ar fostú amhlaidh,
deonfaid deimhniú i pé foirm a bheas ordaithe gur deimhin leo sin.
(3) Déanfar an t-am a chaith iarratasóir, le linn é a bheith ar fostú mar luaitear i bhfo-alt (1) den alt seo, ag gabháil don asaoideacht, agus nach sia ná pé tréimhse a bheas ordaithe, a chomhaireamh chun críocha míre (a) d'fho-alt (2) den alt seo mar am a caitheadh le míochaine nó mar am a caitheadh le máinlinacht, do réir mar roghnós an t-iarratasóir.
(4) Más rud é, i rith aon tréimhse fostaíochta den tsórt dá dtagartar i bhfo-alt (1) den alt seo, go raibh iarratasóir a bhí ag gabháil don mhíochaine ag gabháil, freisin, don mháinliacht nó don asaoideacht nó dóibh araon, nó go raibh iarratasóir a bhí ag gabháil don mháinliacht ag gabháil, freisin, don asaoideacht, cionroinnfear an tréimhse chun críocha na bhforál sin roimhe seo den alt seo ar pé modh a chinnfeas comhlucht deonta an diplóma cháiliúcháin ar dá bhuaidh atá an t-iarratasóir ag éileamh a chláruithe.
(5) San alt seo—
ciallaíonn “ceadaithe”, maidir le hospidéal nó foras, ceadaithe de thuras na huaire chun críocha an ailt seo ag an gComhairle,
déanfar tagairtí d'fhostaíocht i gcáil dhochtúra chónaithigh d'fhorléiriú mar thagairtí d'fhostaíocht ag cleachtadh míochaine, máinliachta nó asaoideachta, i gcás an duine áirithe a bheith ina chónaí san ospidéal nó sa bhforas ina bhfuil sé ar fostú nó ina chomhgar, agus téarmaí a fhostaíochta dá cheangal air bheith ina chónaí amhlaidh.
(6) Maidir le duine a bheas ag éileamh a chláruithe de bhuaidh diplóma a deonadh ar scrúdú cáiliúcháin a ghnóthú a chuir dhá chomhlucht nó níos mó air i gcomhar, déanfar na tagairtí san alt seo do chomhlucht deonta an diplóma cháiliúcháin d'fhorléiriú mar thagairtí do na comhluchta a chuir an scrúdú cáiliúcháin air, ag gníomhú i gcomhar dóibh.
(7) Faoi réir forál fo-ailt (6) den alt seo, déanfar duine a bheas i seilbh dhá dhiplóma cháiliúcháin, nó níos mó, d'áireamh chun críocha an ailt seo mar dhuine atá ag éileamh a chláruithe de bhuaidh pé ceann de na diplómanna sin is rogha leis.
Forála speisialta maidir le fostaíocht i slánlanna.
4.—(1) Chun críocha ailt 3 den Acht seo, folaíonn “foras” slánlann i gcás (agus sa chás sin amháin)—
(a) inar slánlann é faoin Acht um Chúnamh Phoiblí, 1939 (Uimh. 27 de 1939), nó faoin Acht Sláinte, 1947 (Uimh. 28 de 1947), nó
(b) inar slánlann é den chineál dá dtagartar i bhfo-alt (1) d'alt 3 d'Acht Breataineach 1950.
(2) Ní háireofar fostaíocht i slánlann den tsórt sin mar fhostaíocht chun críocha ailt (3) den Acht seo, mura rud é—
(a) i gcás slánlainne faoin Acht um Chúnamh Phoiblí, 1939, nó faoin Acht Sláinte, 1947, gur fostaíocht í ag soláthar seirbhísí míochaine ginearálta nó fostaíocht ag soláthar seirbhísí othar eachtrach, agus
(b) i gcás slánlainne den tsórt dá dtagartar i bhfo-alt (1) d'alt 3 d'Acht Breataineach 1950, gur ceachtar de na fostaíochta í a sonraítear i bhfo-alt (2) den alt sin.
An taithí is gá le haghaidh cláruithe (cleachtóirí coigríche).
5.—Is iad na nithe nach foláir an Chomhairle a bheith deimhnitheach ina dtaobh chun críocha míre (c) d'alt 2 den Acht seo—
(a) go raibh an duine atá ag éileamh a chláruithe ar fostú mar luaitear i bhfo-alt (1) d'alt 3 den Acht seo agus go bhfuil na coinníollacha comhlíonta aige a sonraítear i míreanna (a) agus (b) d'fho-alt (2) den alt sin, nó
(b) gur thug an duine sin seirbhís shásúil i gceapachán nó i gceapacháin (laistigh nó lasmuigh den Stát) de shórt is dóigh leis an gComhairle a bheir taithí ar chleachtadh na míochaine agus na máinliachta, nó na míochaine agus na máinliachta agus na hasaoideachta, nach lú réim ná mar is gá le haghaidh deimhnithe faoi alt 3 den Acht seo, nó
(c) go bhfuil taithí den tsórt adúradh faighte ar shlí eile ag an duine sin.
Taithí bhreise ar an míochaine in ionad taithí ar an máinliacht i gcás duine faoi mhíchumas coirp.
6.—(1) Más rud é, ar iarratas chuige sin, go gcruthóidh duine chun sástachta na Comhairle nach féidir nó nárbh fhéidir leis, de dheasca buan-mhíchumais choirp, tosnú, nó críoch a chur, ar aon tréimhse taithí ar chleachtadh na máinliachta nó na hasaoideachta is gá chun críocha aon fhorála acu sin roimhe seo den Acht seo, féadfaidh an Chomhairle, más oiriúnach léi, a ordú go bhféadfaidh an t-iarratasóir, chun na gcríocha sin, taithí ar chleachtadh na míochaine (i dteannta gach ar ghá fairis sin ina chás do réir na bhforál sin) a bheas faighte aige sa tslí chéanna agus in aghaidh na tréimhse céanna nó, do réir mar bheas, in aghaidh na méide den tréimhse sin a bheas gan críochnú, a chomhaireamh ina ionad sin.
(2) Má thugann an Chomhairle ordachán faoin alt seo, bhéarfaidh sí fógra i dtaobh an ordacháin don chomhlucht a dheoin an diplóma cáiliúcháin don duine lena mbaineann an t-ordachán.
(3) Beidh feidhm ag fo-ailt 6 agus 7 d'alt 3 den Acht seo chun críocha an ailt seo amhail mar atá feidhm acu chun críocha an ailt sin.
Clarú sealadach.
7.—(1) Beidh éifeacht ag na forála seo a leanas chun go bhféadfar daoine d'fhostú mar luaitear i bhfo-alt (1) d'alt 3 den Acht seo.
(2) I gcás ina mbeadh teideal ag duine, mura mbeadh an tAcht seo, chun a chláruithe sa chlár de bhuaidh míre (b) d'fho-alt (1) d'alt 25 nó fo-ailt (1) d'alt 26 den Phríomh-Acht, beidh teideal aige, ar an táille ordaithe d'íoc, chun bheith cláraithe sa chlar go sealadach.
(3) I gcás duine a bheith ina shealbhóir ar dhiplóma cáiliúcháin (mar mínítear sin le fo-alt (1) d'alt 36 d'Acht Breataineach 1950) a dheoin ollscoil nó corparáid eile a bhfuil a suí sa Ríocht Aontaithe agus é a bheith cláraithe de bhuaidh ailt 6 d'Acht Breataineach 1950, beidh teideal aige, gan aon táille d'íoc, chun bheith cláraithe sa chlár go sealadach.
Eifeacht chláruithe shealadaigh, etc.
8.—(1) Measfar daoine atá cláraithe go sealadach a bheith cláraithe sa chlár sa mhéid gur gá é—
(a) chun go bhféadfar iad d'fhostú mar luaitear i bhfo-alt (1) d'alt 3 den Acht seo,
(b) ionas go mbeidh feidhm ina gcás ag na forála den Acht seo a bhaineas go sainráite le clárú sealadach,
(c) ionas go mbeidh feidhm ina gcás ag na forála seo a leanas den Phríomh-Acht, eadhon, ailt 15, 22, 23, 28, 29, 30, 31, 33 agus fo-alt (2) d'alt 37.
(d) chun críocha Achta na nGiúirithe, 1927 (Uimh. 23 de 1927), agus
(e) chun críche aon achtacháin nó ionstraime, nó chun aon chríocha eile, a ordós an tAire le hordú,
agus sa mhéid sin amháin.
(2) Gach duine a dhéanfas nó a gheobhas, nó a bhéarfas go ndéanfar nó go bhfaighfear, aon uiríoll, nó a chabhrós nó a neartós le déanamh nó le fáil aon uiríll, chun go ndéanfar clárú sealadach air, is uiríoll is eol dó a bheith bréagach nó calaoiseach, beidh sé ciontach i gcion faoin bhfo-alt seo agus ar a chiontú ann go hachomair dlífear príosúnacht ar feadh aon téarma nach sia ná dhá mhí dhéag a chur air.
(3) Gach duine a bhéarfas le tuiscint nó a chuirfeas in iúl go toiliúil agus go bréagach gur duine é atá cláraithe go sealadach nó a úsáidfeas amhlaidh aon ainm, teideal, breisiú nó tuairisc dá chur i dtuiscint go bhfuil sé cláraithe amhlaidh, beidh sé ciontach i gcion faoin bhfo-alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig puint fhichead a chur air.
(4) Déanfar na tagairtí in ailt 22, 23, 28, 29, 30 agus 33 den Phríomh-Acht do dhuine atá cláraithe sa chlár d'fhorléiriú mar thagairtí a fholaíos tagairtí do dhuine atá cláraithe go sealadach.
(5) Déanfaidh an Chomhairle a cumhachta chun rialacháin a dhéanamh faoi alt 19 den Phríomh-Acht d'fheidhmiú ar shlí a bhéarfas gur i gcuid ar leith den chlár a clárófar daoine a ndéanfar clárú sealadach orthu, agus, ar dhuine a chlárú ar shlí seachas go sealadach, go mbainfear a ainm as an gcuid ar leith den chlár.
(6) Féadfaidh an Chomhairle, más oiriúnach léi, in ionad nó i dteannta an chuid ar leith den chlár dá dtagartar i bhfo-alt (5) den alt seo d'fhoilsiú go bliantúil sa Chlár de Dhochtúirí Leighis na hÉireann, a chur faoi ndear liosta de na daoine a bheas cláraithe go sealadach d'ullmhú faoi dhó ar a laghad gach bliain.
(7) Is sa bhfoirm ordaithe a hullmhófar liosta faoi fho-alt (6) den alt seo agus tiomsófar é i leith dáta a ordós an Chomhairle agus a sonrófar sa liosta agus cuirfidh an Chomhairle faoi ndear go mbeidh cóipeanna den liosta ar fáil lena gceannach ag duine ar bith ar an táille ordaithe d'íoc.
(8) Aon chóip a airbheartós gur cóip í dá dtagartar i bhfo-alt (7) den alt seo agus arb í an chóip is déanaí den tsórt sin í de thuras na huaire, is fianaise in aon chúirt í, go dtí go gcruthófar a mhalairt, go bhfuil gach duine a bhfuil a ainm iontráilte inti cláraithe go sealadach do réir an Achta seo agus nach bhfuil aon duine nach bhfuil a ainm íontráilte inti cláraithe amhlaidh.
(9) Aon deimhniú a airbheartós a bheith sínithe ag an gcláraitheoir agus a dheimhniú go raibh duine áirithe cláraithe go sealadach mar ba chuí, lá nó laethanta sonraithe nó ar feadh tréimhse sonraithe, nó nach raibh duine áirithe cláraithe go sealadach, lá nó laethanta sonraithe nó ar feadh tréimhse sonraithe, nó go ndearnadh ainm duine áirithe a scrios, lá sonraithe, as an gcuid ar leith den chlár dá dtagartar i bhfo-alt (5) den alt seo, beidh sé, gan cruthú ar shíniú an duine a mbeidh airbheartaithe gurb é a shínigh an deimhniú ná cruthú gurb é an cláraitheoir é agus d'ainneoin aon neamhréire idir an deimhniú agus aon liosta faoi fho-alt (6) den alt seo, nó aon chóip den liosta sin, ina fhianaise dochloíte ar na nithe a bheas deimhnithe sa deimhniú.
(10) Is do réir mar a hordófar a bheas an fhoirm agus an modh ar a mbeidh clárú sealadach le hiarraidh agus an fhianaise a bheas le tabhairt ag iarratasóir ar chlárú sealadach i dtaobh a theidil chun a chláruithe amhlaidh.
Cuairteoirí chun scoileanna míochaine a cheapadh.
9.—(1) Féadfaidh an Chomhairle daoine, nach comhaltaí den Chomhairle, a cheapadh chun cuairteanna a thabhairt ar áiteanna ina dtugtar teagasc do mhic léinn míochaine i ndáil le haon chúrsa staidéir faoi stiúradh aon chomhluchta nó coláiste a luaitear sa Dara Sceideal a ghabhas leis an bPríomh-Acht.
(2) Beidh de dhualgas ar chuairteoirí a ceapfar faoin alt seo tuarascáil a thabhairt don Chomhairle i dtaobh leorfhiúntais an an teagaisc a bheirtear sna háiteanna ar a dtugaid cuairt agus i dtaobh aon nithe eile maidir leis an teagasc sin a shonrós an Chomhairle, i gcoitinne nó in aon chás áirithe, ach ní chuirfidh aon chuairteoir isteach ar dhéanamh aon teagaisc.
(3) Ar aon tuarascáil d'fháil ó chuairteoir faoin alt seo, cuirfidh an Chomhairle cóip den tuarascáil go dtí an comhlucht nó an coláiste a bheas i gceist, agus, ar aon chóip den tsórt sin d'fháil, féadfaidh an comhlucht nó an coláiste, laistigh de pé tréimhse (nach giorra ná mí) a shonraigh an Chomhairle an tráth a chuir sí an chóip den tuarascáil ar aghaidh, nótaí ar an tuarascáil nó agóidí ina coinne a chur chun na Comhairle.
(4) A luaithe is féidir tar éis deireadh na tréimhse a bheas sonraithe faoi fho-alt (3) den alt seo, cuirfidh an Chomhairle chun an Aire cóip d'aon tuarascáil den tsórt dá dtagartar ann agus d'aon nótaí uirthi nó d'aon agóidí ina coinne a rinneadh go cuí maraon le tuairimí na comhairle ar an tuarascáil agus ar aon nótaí nó agóidí den tsórt sin.
(5) Féadfaidh an Chomhairle pé luach saothair agus caiteachais a chinnfeas an Chomhairle, le haontú an Aire, d'íoc le cuairteoirí a ceapfar faoin alt seo.
Rialacháin.
10.—Féadfaidh an Chomhairle, le toiliú an Aire, rialacháin a dhéanamh i dtaobh aon ní dá dtagartar san Acht seo mar ní atá ordaithe nó le hordú.
Caitheachas na Comhairle.
11.—Íocfaidh an Chomhairle as a cuid airgid féin na caiteachais go léir faoina raghaidh an Chomhairle ag forghníomhú an Achta seo.
Alt 25 den Príomh-Acht a leasú.
12.—Déanfar na tagairtí i mír (a) d'fho-alt (1) d'alt 25 den Phríomh-Acht, agus in Airteagal 4 den Chomhaontú atá leagtha amach sa Chéad Sceideal a ghabhas leis an bPríomh-Acht, do dhuine a bheas cláraithe sa Chlár Ginearálta d'fhorléiriú mar thagairtí nach bhfolaíonn duine a mbeidh a ainm agus a sheoladh iontráilte i liosta ar leith a bheas sa Chlár Ginearálta de bhun ailt 14 den Medical Act, 1886, arna leasú le hAcht Breataineach 1950.
Gearrtheideal agus comhlua.
13.—(1) Féadfar Acht na Lia-Chleachtóirí, 1951, a ghairm den Acht seo.
(2) Féadfar Achta na Lia-Chleachtóirí, 1927 agus 1951, a ghairm den Phríomh-Acht agus den Acht seo le chéile.

MEDICAL PRACTITIONERS ACT, 1951.
Interpretation.
1.—(1) In this Act—
“appointed day” means such day as the Minister may by order appoint, and different days may be appointed for the purposes of different provisions of this Act or for the purposes of the application of any such provision to different classes of cases;
“the British Act of 1950” means the Act of the British Parliament entitled the Medical Act, 1950;
“the Minister” means the Minister for Health;
“prescribed” means prescribed by regulations made by the Council;
“the Principal Act” means the Medical Practitioners Act, 1927 (No. 25 of 1927);
“provisional registration” means registration by virtue of section 7 of this Act, and “provisionally registered” shall be construed accordingly.
(2) This Act shall be construed as one with the Principal Act.
(3) An order appointing a day for the purposes of this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order is passed by either such House within the next twelve days on which that House has sat after the order is laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Restriction on full registration.
2.—On or after the appointed day a person shall not become registered in the register, otherwise than by way of provisional registration, unless—
(a) in the case of a person claiming registration by virtue of paragraph (a) of subsection (1) of section 25 of the Principal Act, as amended by section 12 of this Act, he is registered in the General Register otherwise than by virtue of section 6 of the British Act of 1950, or
(b) in the case of a person claiming registration by virtue of paragraph (b) of subsection (1) of section 25 of the Principal Act, he was before the appointed day possessed of the qualifying diploma, or of one at least of the qualifying diplomas, by virtue of which he claims registration or it is certified under section 3 of this Act that he has had the experience specified in that section, or
(c) in the case of a person claiming registration by virtue of subsection (1) of section 26 of the Principal Act, the Council is satisfied that he has had such experience as is specified in section 5 of this Act.
Certification of experience in approved hospital.
3.—(1) A certificate for the purposes of paragraph (b) of section 2 of this Act shall not be granted in respect of any person unless after passing a qualifying examination he has been engaged in employment in a resident medical capacity in one or more approved hospitals or approved institutions for such period as may be prescribed.
(2) A person satisfying the condition specified in subsection (1) of this section may apply for a certificate under this section to the body granting the qualifying diploma by virtue of which he claims registration, and if that body are satisfied—
(a) that during the time the applicant has been so employed as aforesaid he has been engaged for such period or minimum period as may be prescribed in medicine, and for such period or minimum period as may be prescribed in surgery, and
(b) that his service while so employed has been satisfactory,
they shall grant, in such form as may be prescribed, a certificate that they are so satisfied.
(3) Time during which an applicant, while employed as mentioned in subsection (1) of this section, has been engaged in midwifery, not exceeding such period as may be prescribed, shall be counted for the purposes of paragraph (a) of subsection (2) of this section either as time spent in medicine or as time spent in surgery, as the applicant may elect.
(4) When, during any period of such employment as is referred to in subsection (1) of this section, an applicant who has been engaged in medicine has also been engaged in surgery or in midwifery or both, or an applicant who has been engaged in surgery has also been engaged in midwifery, the period shall be apportioned for the purposes of the foregoing provisions of this section in such manner as may be determined by the body granting the qualifying diploma by virtue of which the applicant claims registration.
(5) In this section—
“approved”, in relation to a hospital or institution, means approved for the time being for the purposes of this section by the Council,
references to employment in a resident medical capacity shall be construed as references to employment in the practice of medicine, surgery or midwifery, where the person in question is resident in the hospital or institution where he is employed or conveniently near thereto, and is by the terms of his employment required to be so resident.
(6) In relation to a person claiming registration by virtue of a diploma granted on passing a qualifying examination held by two or more bodies jointly, the references in this section to the body granting the qualifying diploma shall be construed as references to the bodies by whom the qualifying examination was held, acting jointly.
(7) Subject to the provisions of subsection (6) of this section, a person holding two or more qualifying diplomas shall be treated for the purposes of this section as claiming registration by virtue of such one of those diplomas as he may choose.
Special provisions as to employment in health centres.
4.—(1) For the purposes of section 3 of this Act, “institution” includes a health centre if, and only if, either—
(a) it is a health centre under the Public Assistance Act, 1939 (No. 27 of 1939), or the Health Act, 1947 (No. 28 of 1947), or
(b) it is a health centre such as is referred to in subsection (1) of section 3 of the British Act of 1950
(2) Employment in such a centre shall not be treated as employment for the purposes of section 3 of this Act, unless—
(a) in the case of a centre under the Public Assistance Act, 1939, or the Health Act, 1947, it is either employment in the provision of general medical services or employment in the provision of out-patient services, and
(b) in the case of a centre such as is referred to in subsection (1) of section 3 of the British Act of 1950, it is either of the employments specified in subsection (2) of that section.
Experience required for registration (foreign practitioners.)
5.—The matters as to which the Council must be satisfied for the purposes of paragraph (c) of section 2 of this Act are—
(a) that the person claiming registration has been employed as mentioned in subsection (1) of section 3 of this Act and has satisfied the conditions specified in paragraphs (a) and (b) of subsection (2) thereof, or
(b) that the said person has rendered satisfactory service in an appointment or appointments (whether within or outside the State) such as in the opinion of the Council confer experience of the practice of medicine and surgery, or medicine, surgery and midwifery, not less extensive than that required for a certificate under section 3 of this Act, or
(c) that the said person has otherwise acquired such experience as aforesaid.
Replacement, in case of physical disability, of surgical experience by additional medical experience.
6.—(1) Where on an application in that behalf a person satisfies the Council that, by reason of lasting physical disability, he will be or has been prevented from embarking on, or completing, any period of experience of the practice of surgery or midwifery required for the purposes of any of the foregoing provisions of this Act, the Council may if it thinks fit direct that the applicant may for those purposes count in lieu thereof experience of the practice of medicine (in addition to what would otherwise be required in his case by the said provisions) acquired in the like manner and for the like period or, as the case may be, for so much of that period as will have remained uncompleted.
(2) Where the Council gives a direction under this section, it shall give notice of the direction to the body granting the qualifying diploma to the person to whom the direction relates.
(3) Subsections (6) and (7) of section 3 of this Act shall apply for the purposes of this section as they apply for the purposes of that section.
Provisional registration.
7.—(1) The following provisions shall have effect for enabling persons to be employed as mentioned in subsection (1) of section 3 of this Act.
(2) Where a person would, apart from this Act, be entitled to be registered in the register by virtue of paragraph (b) of subsection (1) of section 25 or subsection (1) of section 26 of the Principal Act, he shall be entitled on payment of the prescribed fee to be registered in the register provisionally.
(3) Where a person is the holder of a qualifying diploma (as defined by subsection (1) of section 36 of the British Act of 1950) granted by a university or other corporation having its seat in the United Kingdom and he is registered by virtue of section 6 of the British Act of 1950, he shall be entitled, without payment of any fee, to be registered in the register provisionally.
Effect of provisional registration, etc.
8.—(1) Persons provisionally registered shall be deemed to be registered in the register so far as is necessary—
(a) to enable them to be employed as mentioned in subsection (1) of section 3 of this Act,
(b) in order that the provisions of this Act relating expressly to provisional registration may be applicable in their case,
(c) in order that the following provisions of the Principal Act, namely, sections 15, 22, 23, 28, 29, 30, 31, 33 and subsection (2) of section 37, may be applicable in their case,
(d) for the purposes of the Juries Act, 1927 (No. 23 of 1927), and
(e) for the purpose of any such enactment or instrument, or such other purposes, as the Minister may by order direct,
but not further.
(2) Every person who, for the purpose of being provisionally registered, makes or procures or causes to be made or procured or aids or abets the making or procuring of any representation which to his knowledge is false or fraudulent shall be guilty of an offence under this subsection and shall be liable on summary conviction thereof to imprisonment for any term not exceeding twelve months.
(3) Every person who wilfully and falsely represents himself to be or holds himself out as being a person who is provisionally registered or uses any name, title, addition or description implying that he is so registered shall be guilty of an offence under this subsection and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds.
(4) The references in sections 22, 23, 28, 29, 30 and 33 of the Principal Act to a person registered in the register shall be construed as including references to a person provisionally registered.
(5) The Council shall so exercise its powers of making regulations under section 19 of the Principal Act as to secure that persons provisionally registered shall be registered in a separate part of the register, and that on a person's becoming registered otherwise than provisionally his name shall be removed from the separate part of the register.
(6) The Council may, if it thinks fit, in lieu of or in addition to, including the separate part of the register referred to in sub section (5) of this section in the annual publication of the Medical Register of Ireland, cause a list of persons provisionally registered to be prepared at least twice in each year.
(7) A list under subsection (6) of this section shall be prepared in the prescribed form and shall be compiled by reference to a date directed by the Council and specified in the list and the Council shall cause copies of the list to be available for purchase by any person on payment of the prescribed fee.
(8) A copy purporting to be a copy referred to in subsection (7) of this section which is for the time being the latest such copy shall be evidence in any court until the contrary is proved that every person whose name is entered therein is provisionally registered in accordance with this Act and that any person whose name is not entered therein is not so registered.
(9) A certificate purporting to be signed by the registrar and to certify that on a specified day or days or during the whole of a specified period a particular person was duly provisionally registered or that on a specified day or days or during the whole of a specified period a particular person was not provisionally registered or that on a specified day the name of a particular person was erased from the separate part of the register referred to in subsection (5) of this section shall, without proof of the signature of the person purporting to sign the certificate or that he was the registrar and notwithstanding any discrepancy between the certificate and any list under subsection (6) of this section or copy thereof, be conclusive evidence of the matters certified by the certificate.
(10) The form and mode of application for provisional registration and the evidence to be given by an applicant for provisional registration of his title to be so registered shall be such as may be prescribed.
Appointment of visitors of medical schools.
9.—(1) The Council may appoint persons, not being members of the Council, to visit places where instruction is given to medical students in connection with any course of study under the direction of any body or college mentioned in the Second Schedule to the Principal Act.
(2) It shall be the duty of visitors appointed under this section to report to the Council as to the sufficiency of the instruction given in the places which they visit and as to any other matters relating to such instruction which may be specified by the Council either generally or in any particular case, but no visitor shall interfere with the giving of any instruction.
(3) On the receipt of any report of a visitor under this section, the Council shall send a copy of the report to the body or college in question, and on receipt of any such copy the body or college may, within such period (not being less than one month) as the Council may have specified at the time it sent the copy of the report, make to the Council observations on the report or objections thereto.
(4) As soon as may be after the expiration of the period specified under subsection (3) of this section, the Council shall send a copy of any such report as is therein referred to and of any observations thereon or objections thereto duly made, together with the Council's comments on the report and on any such observations or objections, to the Minister.
(5) The Council may pay to visitors appointed under this section such remuneration and expenses as the Council, with the approval of the Minister, may determine.
Regulations.
10.—The Council may, with the consent of the Minister, make regulations in relation to any matter referred to in this Act as prescribed or to be prescribed.
Expenses of the Council.
11.—All expenses incurred by the Council in the execution of this Act shall be defrayed by the Council out of its own moneys.
Amendment of Section 25 of Principal Act.
12.—The references, in paragraph (a) of subsection (1) of section 25 of the Principal Act and in Article 4 of the Agreement set out in the First Schedule to the Principal Act, to a person who is registered in the General Register shall be construed as not including a person whose name and address are entered in a separate list which is contained in the General Register in pursuance of section 14 of the Medical Act, 1886, as amended by the British Act of 1950.
Short title and collective citation.
13.—(1) This Act may be cited as the Medical Practitioners Act, 1951.
(2) The Principal Act and this Act may be cited together as the Medical Practitioners Acts, 1927 and 1951.
