ACHT AN OIREACHTAIS (LIÚNTAISÍ DO CHOMHALTAÍ), 1938.
Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Airgeadais;
cialluíonn an abairt “saoráidí taistil”—
(a) pé ní no nithe acu so leanas is oiriúnach don chás, sé sin le rá:—
(i) taisteal céad-ghráid ar bhóithre iarainn gan íoc as do chur ar fáil, no
(ii) an táille do híocadh as taisteal in aon tram, omnibus, no char-a-banc puiblí no cóir iompair phuiblí eile dá samhail sin d'aisíoc, no
(iii) costaisí taistil i ngluaisteán an taistealaí féin d'aisíoc sa mhéid a cheadóidh an tAire ach, i gcás inar bhféidir aon chuid de thurus do tugadh sa ghluaisteán san do thabhairt ar bhóthar iarainn, gan an t-aisíoc san do bheith níos mó, alos na coda san den turus san, ná an costas taistil chéad-ghráid ar an mbóthar iarainn in aghaidh na coda san, agus
(b) na costaisí taistil eile sin (más ann dóibh) gur deimhin leis an Aire gur go réasúnta a chuathas fútha d'aisíoc;
cialluíonn an abairt “Baile Atha Cliath” maidir le comhalta den Oireachtas a bheidh ag taisteal go Baile Atha Cliath no uaidh ar an mbóthar iarainn an stáisiún bóthair iarainn i gcontae-bhuirg Bhaile Atha Cliath ina gcríochnuíonn sé no ina dtosnuíonn sé a thurus.
Liúntas agus saoráidí taistil comhaltaí den Oireachtas.
2.—Fé réir forálacha an Achta so déanfar, amach as airgead ar n-a sholáthar ag an Oireachtas, an liúntas a luaidhtear san Acht so d'íoc le gach comhalta den Oireachtas agus na saoráidí taistil a luaidhtear san Acht so do dheonadh dhó.
Méid an liúntais do chomhaltaí den Oireachtas.
3.—(1) Ar dháta an Achta so do rith agus dá éis sin isé liúntas a bheidh le n'íoc le gach comhalta de Dháil Éireann fén Acht so ná liúntas do réir £40 sa mhí.
(2) Isé liúntas a bheidh le n'íoc le gach comhalta de Sheanad Éireann fén Acht so ná liúntas do réir £30 sa mhí.
(3) Tuigfear gur cuid den tuarastal is iníoctha de thurus na huaire le haon chomhalta den Oireachtas de bhuadh é do shealbhú aon oifige ceaptha an liúntas is iníoctha leis an gcomhalta san fén Acht so agus dá réir sin ní bheidh aon chomhalta den Oireachtas, faid a bheidh tuarastal alos aon oifige den tsórt san á fháil aige, i dteideal aon liúntas eile d'fháil fén Acht so.
(4) Beidh na liúntaisí is iníoctha le comhaltaí den Oireachtas fén Acht so saor o cháin ioncuim (le n-a n-áirmhítear for-cháin) agus ní háirmheofar iad nuair a beifear ag áireamh ioncuim chun crícheanna na nAchtanna Cánach Ioncuim.
(5) An tuarastal is iníoctha de thurus na huaire le comhalta den Oireachtas de bhuadh é bheith ag sealbhú aon oifige ceaptha, beidh an méid sin de, is có-ionann leis an liúntas do bheadh iníoctha leis an gcomhalta san fén Acht so dá mba ná beadh sé ag sealbhú na hoifige sin, saor o cháin ioncuim (le n-a n-áirmhítear for-cháin) agus ní háirmheofar é nuair a beifear ag áireamh ioncuim chun crícheanna na nAchtanna Cánach Ioncuim.
(6) Aon fhoráil atá in aon reacht Briotáineach no in aon reacht de reachtanna Shaorstáit Éireann no atá no bheidh in aon Acht den Oireachtas (ar n-a rith roimh an Acht so do rith no dá éis sin) agus le n-a bhforáltar go ndéanfar aon phinsean is iníoctha amach as an bPrímh-Chiste no amach as airgead ar n-a sholáthar ag an Oireachtas do chur ar fiunraoi no do laigheadú, i bpáirt no go hiomlán, i gcás an pinsinéir do bheith ag fáil íocaíochtaí (pé ainm do bheirtear no bhéarfar ortha sa reacht no san Acht san) amach as airgead ar n-a sholáthar no bheidh le soláthar ag an Oireachtas, ní bhainfe sí, mara n-achtuítear a mhalairt go soiléir inti—
(a) leis na liúntaisí is iníoctha le comhaltaí den Oireachtas fén Acht so, ná
(b) leis an méid sin, den tuarastal is iníoctha de thurus na huaire le comhalta den Oireachtas de bhuadh é bheith ag sealbhú aon oifige ceaptha, is có-ionann leis an liúntas do bheadh iníoctha leis an gcomhalta san fén Acht so dá mba ná beadh sé ag sealbhú na hoifige sin,
ná ní déanfar aon phinsean den tsórt san do chur ar fiunraoi ná do laigheadú ar scór ná alos an liúntais sin no an mhéide sin den tuarastal san.
(7) Is oifig cheaptha chun crícheanna an ailt seo gach oifig acu so leanas, sé sin le rá:—
(a) oifig chomhalta den Riaghaltas;
(b) oifig Rúnaí Páirliminte;
(c) oifig an Ard-Aighne;
(d) oifig Chathaoirligh Dháil Éireann;
(e) oifig Leas-Chathaoirligh Dháil Éireann;
(f) oifig Chathaoirligh Sheanad Éireann;
(g) oifig Leas-Chathaoirligh Sheanad Éireann.
Mion-innste i dtaobh saoráidí taistil do chomhaltaí den Oireachtas.
4.—(1) Isiad saoráidí taistil a bheidh le deonadh do gach comhalta den Oireachtas fén Acht so ná—
(a) i gcás comhalta de Dháil Éireann ná comhnuíonn ina dháilcheanntar—
(i) saoráidí taistil idir Bhaile Atha Cliath agus áit ar bith ina dháilcheanntar,
(ii) saoráidí taistil idir Bhaile Atha Cliath agus a ghnáth-áit chomhnaithe de thurus na huaire,
(iii) ar aon ócáid ar a dtaistealóidh sé díreach o Bhaile Atha Cliath go dtí áit ar bith ina dháilcheanntar, saoráidí taistil o áit ar bith ina dháilcheanntar go dtí an ghnáth-áit chomhnaithe sin,
(iv) ar aon ócáid ar a dtaistealóidh sé díreach ón ngnátháit chomhnaithe sin go dtí n-a dháilcheanntar, saoráidí taistil idir an ghnáth-áit chomhnaithe sin agus, más de bhóthar iarainn a chuaidh sé isteach ina dháilcheanntar ar an ócáid sin, an stáisiún bóthair iarainn ina dháilcheanntar is giorra don phuinte ag á ndeacha sé isteach no, más de bhóthar a chuaidh sé isteach ina dháilcheanntar ar an ócáid sin, an puinte ag á ndeacha sé isteach;
(b) i gcás comhalta de Dháil Éireann a chomhnuíonn ina dháilcheanntar, saoráidí taistil idir Bhaile Atha Cliath agus áit ar bith ina dháilcheanntar;
(c) i gcás comhalta de Sheanad Éireann, saoráidí taistil idir Bhaile Atha Cliath agus a ghnáth-áit chomhnaithe de thurus na huaire;
(d) i gcás aon chomhalta den Oireachtas, saoráidí taistil ón áit agus go dtí an áit is gnáth-áit chomhnaithe dhó de thurus na huaire no o Bhaile Atha Cliath agus go dtí Baile Atha Cliath no, i gcás aon chomhalta de Dháil Éireann, o aon áit agus go dtí aon áit ina dháilcheanntar ar é bheith ag dul ar turuis—
(i) chun bheith i láthair, ar chuireadh o chomhalta den Riaghaltas, ar ócáidí Stáit, no
(ii) ar chuireadh o chomhalta den Riaghaltas, chun oibreacha puiblí táchtacha d'iniúchadh no chun cuairt a thabhairt ar fhundúireachtaí, no ar áiteanna, no ar cheanntair.
(2) Déanfar tagairtí i bhfo-alt (1) den alt so do ghnáth-áit chomhnaithe do léiriú mar thagairtí chialluíonn gnáth-áit chomhnaithe laistigh de sna críocha náisiúnta.
(3) Na saoráidí taistil a bheidh le deonadh do gach comhalta den Oireachtas, cuirfear ar fáil iad agus íocfar asta sa tslí sin agus fé réir na gcoinníollacha san a hordófar o am go ham le rialacháin a dhéanfaidh an tAire (agus údaruítear dó leis seo na rialacháin sin do dhéanamh) tar éis dó dul i gcomhairle le Cathaoirleach Dháil Éireann agus le Cathaoirleach Sheanad Éireann.
(4) Má bhíonn comhalta de cheachtar Tigh den Oireachtas i dteideal, fé sna forálacha san roimhe seo den Acht so, go ndéanfaí, i bhfuirm saoráidí taistil, costaisí taistil d'aisíoc leis ní déanfar aon íocaíocht alos na gcostaisí taistil sin mara ndeintear, laistigh de chéad lá tar éis dul fé sna costaisí taistil sin, an t-éileamh ortha do lóisteáil, másé Dáil Éireann an Tigh sin, le Cléireach Dháil Éireann no, másé Seanad Éireann an Tigh sin, le Cléireach Sheanad Éireann.
(5) Aon rialacháin do rinneadh fé fho-alt (2) d'alt 3 d'Acht an Oireachtais (Baill d'Ioc), 1923 (Uimh. 18 de 1923), agus a bhí i bhfeidhm díreach roimh dháta an Achta so do rith tuigfear gur fé fho-alt (3) den alt so do rinneadh iad agus féadfar iad do leasú no do cheiliúradh le rialacháin fén bhfo-alt deiridh sin a luaidhtear agus go dtí go gceiliúrfar amhlaidh iad agus fé réir aon leasuithe den tsórt san leanfaid de bheith i bhfeidhm.
An liúntas agus na saoráidí taistil do thosnú.
5.—(1) Isé tráth a thosnóidh an liúntas agus na saoráidí taistil atá le n'íoc agus le deonadh fén Acht so le comhalta agus do chomhalta den Oireachtas is comhalta ar dháta an Achta so do rith ná—
(a) i gcás an comhalta san do bheith ar an dáta san i dteideal, tré Bhuan-Orduithe an Tighe dar comhalta é do chólíonadh, suidhe sa Tigh sin mar chomhalta dhe, amhail ar an dáta san agus ón dáta san amach, agus
(b) in aon chás eile, amhail ar an dáta agus ón dáta ar a dtiocfaidh an comhalta san den chéad uair, tré Bhuan-Orduithe an Tighe dar comhalta é do chólíonadh, chun bheith i dteideal fé sna Buan-Orduithe sin suidhe sa Tigh sin mar chomhalta dhe.
(2) Fé réir forálacha an Achta so isé tráth a thosnóidh an liúntas agus na saoráidí taistil atá le n'íoc agus le deonadh fén Acht so le comhalta agus do chomhalta den Oireachtas a thiocfaidh chun bheith ina chomhalta den Oireachtas tar éis dáta an Achta so do rith ná—
(a) i gcás an comhalta san do theacht, laistigh de thríocha lá tar éis dáta a thoghtha den uair is uair dheiridh aige an tráth san no (más comhalta ainmnithe de Sheanad Éireann é) tar éis dáta a ainmnithe den uair is uair dheiridh aige an tráth san, chun bheith i dteideal, tré Bhuan-Orduithe an Tighe dar comhalta é do chólíonadh, suidhe sa Tigh sin mar chomhalta dhe, amhail ar an dáta san agus ón dáta san amach, agus
(b) in aon chás eile, amhail ar an lá agus ón lá ar a dtiocfaidh an comhalta san den chéad uair, tré Bhuan-Orduithe an Tighe dar comhalta é do chólíonadh, chun bheith i dteideal fé Bhuan-Orduithe an Tighe sin suidhe sa Tigh sin mar chomhalta dhe.
(3) Más rud é—
(a) go dtárlóidh do chomhalta den Oireachtas a thiocfaidh chun bheith ina chomhalta den tsórt san tar éis dáta an Achta so do rith ná féadfa sé, toisc breoiteachta no toisc cúise éigin eile nach é a thoil ná a ghníomh féin ba bhun léi, Buan-Orduithe an Tighe dar comhalta é do chólíonadh i slí go dtiocfadh i dteideal fé sna Buan-Orduithe sin suidhe mar chomhalta den Tigh sin laistigh de thríocha lá tar éis dáta a thoghtha no a ainmnithe chun an Tighe sin den uair is uair dheiridh aige an tráth san, agus
(b) go gcólíonfaidh an comhalta san na Buan-Orduithe sin i slí go mbeidh sé i dteideal fútha suidhe mar chomhalta den Tigh sin an chéad lá shuidhfidh an Tigh sin tar éis deireadh do bheith leis an mbreoiteacht no leis an gcúis eile sin,
ansan agus sa chás san tuigfear, chun crícheanna fo-ailt (2) den alt so, gur chólíon an comhalta san na Buan-Orduithe sin i slí go raibh sé i dteideal fútha suidhe sa Tigh sin mar chomhalta dhe laistigh de thríocha lá tar éis dáta a thoghtha no a ainmnithe chun an Tighe sin den uair is uair dheiridh aige an tráth san.
(4) Beidh comhalta den Oireachtas i dteideal saoráidí taistil fén Acht so alos taistil uair amháin go Baile Atha Cliath chun Buan-Orduithe an Tighe dar comhalta é do chólíonadh i slí go dtiocfaidh chun bheith i dteideal fé sna Buan-Orduithe sin suidhe mar chomhalta den Tigh sin, agus beidh sé i dteideal na saoráidí taistil sin ar gach slí díreach fé is dá mba tar éis tosnú dá cheart chun saoráidí taistil fén Acht so a déanfaí an taisteal san.
(5) Pé uair a scuirfear Dáil Éireann beidh duine ar bith ba chomhalta de Dháil Éireann díreach roimh an scur san agus do bhí i mBaile Atha Cliath ar dháta an scurtha san, beidh sé, go ceann trí lá tar éis an scurtha san, i dteideal saoráidí taistil fén Acht so alos taistil uair amháin idir Bhaile Atha Cliath agus aon áit ina sheana-dháilcheanntar no a ghnáth-áit chomhnaithe de thurus na huaire ar gach slí díreach fé is dá mba le linn dó bheith ina chomhalta de Dháil Éireann a déanfaí an taisteal san.
(6) Má eiríonn aon cheist no aighneas i dtaobh ce'ca atá comhalta den Oireachtas i dteideal, no i dtaobh a mhéide atá sé i dteideal, sochair aon cheann de sna trí fo-ailt deiridh sin roimhe seo isé bhéarfaidh breith ar an gceist no ar an aighneas san ná—
(a) i gcás comhalta de Dháil Éireann, Cathaoirleach Dháil Éireann, agus
(b) i gcás comhalta de Sheanad Éireann, Cathaoirleach Sheanad Éireann,
agus beidh gach breith den tsórt san ina breith dheiridh.
Saoráidí taistil comhaltaí de Sheanad Éireann a bheidh i láthair ar a chéad tionól.
6.—D'ainneoin éinní atá in alt 2 d'Acht an Oireachtais (Baill d'Ioc), 1933 (Uimh. 50 de 1933), mar a deintear é d'athbheochaint agus do chur i mbaint le comhaltaí de Sheanad Éireann tré fho-alt (3) d'alt 10 den Acht Bunreachta (Forálacha Iarmartacha), 1937 (Uimh. 40 de 1937), agus d'ainneoin na hathghairme deintear ar an Acht san a céad-luaidhtear leis an Acht so, beidh comhalta de Sheanad Éireann a bhí i láthair ag an gcéad tionól i dteideal saoráidí taistil fé Achtanna an Oireachtais (Baill d'Ioc), 1923 go 1933, d'fháil agus d'íoc leis alos taistil go Baile Atha Cliath lá roimh an gcéad tionól san chun bheith i láthair i Seanad Éireann ar a chéad tionól agus beidh sé i dteideal na saoráidí taistil sin d'fháil agus d'íoc leis amhlaidh ar gach slí díreach fé is dá mba ar lá an chéad tionóil sin a déanfaí an taisteal san.

OIREACHTAS (ALLOWANCES TO MEMBERS) ACT, 1938.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Finance;
the expression “travelling facilities” means—
(a) whichever one or more of the following is appropriate to the case, that is to say:—
(i) the provision of free first-class railway travelling, or
(ii) the repayment of fare paid for travelling in any public tram, omnibus, char-a-banc or similar public conveyance, or
(iii) the repayment of expenses of travelling in the traveller's own motor car to such extent as may be sanctioned by the Minister but, where railway travelling is available over any portion of a journey travelled in such motor car, not exceeding in respect of such portion of such journey the cost of first-class railway travelling over such portion, and
(b) the repayment of such other (if any) travelling expenses as the Minister shall be satisfied were reasonably incurred; the word “Dublin” in its application to a member of the Oireachtas travelling to or from Dublin by rail means the railway station in the county borough of Dublin at which he terminates or commences his journey.
Allowance and travelling facilities of members of the Oireachtas.
2.—Subject to the provisions of this Act, each member of the Oireachtas shall, out of moneys provided by the Oireachtas, be paid the allowance specified in this Act and be granted the travelling facilities specified in this Act.
Amount of allowance to members of the Oireachtas.
3.—(1) The allowance to be paid to each member of Dáil Eireann under this Act shall on and after the date of the passing of this Act be an allowance at the rate of £40 a month.
(2) The allowance to be paid to each member of Seanad Eireann under this Act shall be an allowance at the rate of £30 a month.
(3) The salary for the time being payable to any member of the Oireachtas by virtue of his holding any appointed office shall be deemed to include the allowance payable to such member under this Act, and accordingly no member of the Oireachtas shall, while he is in receipt of a salary in respect of any such office, be entitled to any further allowance under this Act.
(4) The allowances payable to members of the Oireachtas under this Act shall be exempt from income-tax (including sur-tax) and shall not be reckoned in computing income for the purposes of the Income Tax Acts.
(5) So much of the salary for the time being payable to a member of the Oireachtas by virtue of his holding any appointed office as is equal to the allowance which would be payable to such member under this Act if he did not hold that office shall be exempt from income-tax (including sur-tax) and shall not be reckoned in computing income for the purposes of the Income Tax Acts.
(6) No provision in any British statute or in any Saorstát Eireann statute or in any Act of the Oireachtas (whether passed before or after the passing of this Act) whereby any pension payable out of the Central Fund or moneys provided by the Oireachtas is liable to be suspended or abated, wholly or in part, in the event of the pensioner being in receipt of payments (by whatever name called in such statute or Act) out of moneys provided or to be provided by the Oireachtas shall, unless the contrary is expressly enacted therein, apply—
(a) to the allowances payable to members of the Oireachtas under this Act, or
(b) to so much of the salary for the time being payable to a member of the Oireachtas by virtue of his holding any appointed office as is equal to the allowance which would be payable to such member under this Act if he did not hold that office,
nor shall any such pension be suspended or abated in respect of or on account of such allowance or so much of such salary.
(7) Each of the following offices shall be an appointed office for the purposes of this section, that is to say:—
(a) the office of member of the Government;
(b) the office of Parliamentary Secretary;
(c) the office of Attorney-General;
(d) the office of Chairman of Dáil Eireann;
(e) the office of Deputy-Chairman of Dáil Eireann;
(f) the office of Chairman of Seanad Eireann;
(g) the office of Deputy-Chairman of Seanad Eireann.
Particulars of travelling facilities for members of the Oireachtas.
4.—(1) The travelling facilities to be granted to each member of the Oireachtas under this Act shall be—
(a) in the case of a member of Dáil Eireann who does not reside in his constituency—
(i) travelling facilities between Dublin and any place in his constituency,
(ii) travelling facilities between Dublin and his normal place of residence for the time being,
(iii) on any occasion on which he travels direct from Dublin to any place in his constituency, travelling facilities from any place in his constituency to such normal place of residence,
(iv) on any occasion on which he travels direct from such normal place of residence to his constituency, travelling facilities between such normal place of residence and, if he entered his constituency on that occasion by rail, the railway station in his constituency nearest to the point of entrance or, if he entered his constituency on that occasion by road, the point of entrance;
(b) in the case of a member of Dáil Eireann who resides in his constituency, travelling facilities between Dublin and any place in his constituency;
(c) in the case of a member of Seanad Eireann, travelling facilities between Dublin and his normal place of residence for the time being;
(d) in the case of any member of the Oireachtas travelling facilities from and to his normal place of residence for the time being or from and to Dublin or, in the case of any member of Dáil Eireann, from and to any place in his constituency when undertaking journeys—
(i) to attend, on the invitation of a member of the Government, State functions, or
(ii) on the invitation of a member of the Government, to inspect important public works or visit institutions, or places, or districts.
(2) References in sub-section (1) of this section to a normal place of residence shall be construed as meaning a normal place of residence within the national territory.
(3) The travelling facilities to be granted to each member of the Oireachtas shall be provided and paid in such manner and subject to such conditions as shall from time to time be prescribed by regulations made by the Minister (which regulations he is hereby authorised to make) after consultation with the Chairman of Dáil Eireann and the Chairman of Seanad Eireann.
(4) Where a member of either House of the Oireachtas is, under the preceding provisions of this Act, entitled, by way of travelling facilities, to repayment of travelling expenses, no payment in respect of such travelling expenses shall be made unless the claim therefor is, within one hundred days after such travelling expenses were incurred, lodged with, in case such House is Dáil Eireann, the Clerk of Dáil Eireann or, in case such House is Seanad Eireann, the Clerk of Seanad Eireann.
(5) Any regulations made under sub-section (2) of section 3 of the Oireachtas (Payment of Members) Act, 1923 (No. 18 of 1923), and in force immediately before the date of the passing of this Act shall be deemed to have been made under sub-section (3) of this section and may be amended or revoked by regulations under the said last mentioned sub-section and until so revoked and subject to any such amendment shall continue in force.
Commencement of allowance and travelling facilities.
5.—(1) The allowance and travelling facilities to be paid and granted under this Act to a member of the Oireachtas who is a member on the date of the passing of this Act shall commence—
(a) in case such member is on that date entitled, by compliance with the Standing Orders of the House of which he is a member to sit in that House as a member thereof, as on and from that date; and
(b) in any other case, as on and from the date on which such member first becomes, by compliance with the Standing Orders of the House of which he is a member, entitled under those Standing Orders to sit in that House as a member thereof.
(2) The allowance and travelling facilities to be paid and granted under this Act to a member of the Oireachtas who becomes a member of the Oireachtas after the date of the passing of this Act shall, subject to the provisions of this Act, commence—
(a) in case such member, within thirty days after the date of his then last election or (if he is a nominated member of Seanad Eireann) his then last nomination, becomes entitled, by compliance with the Standing Orders of the House of which he is a member, to sit in that House as a member thereof, as on and from that date, and
(b) in any other case, as on and from the day on which such member first becomes, by compliance with the Standing Orders of the House of which he is a member, entitled under the Standing Orders of that House, to sit in that House as a member thereof.
(3) If—
(a) a member of the Oireachtas who becomes such member after the date of the passing of this Act is prevented by illness or by some other involuntary and innocent cause from so complying with the Standing Orders of the House of which he is a member as to become entitled under those Standing Orders to sit as a member of the said House within thirty days after the date of his then last election or nomination thereto, and
(b) such member so complies with the said Standing Orders as to be entitled thereunder to sit as a member of the said House on the first day on which such House sits after such illness or other cause has ceased,
then and in that case such member shall be deemed for the purposes of sub-section (2) of this section to have so complied with the said Standing Orders as to have been entitled thereunder to sit in the said House as a member within thirty days after the date of his then last election or nomination thereto.
(4) A member of the Oireachtas shall be entitled to travelling facilities under this Act in respect of travelling once to Dublin for the purpose of so complying with the Standing Orders of the House of which he is a member as to become entitled under the said Standing Orders to sit as a member of such House, and shall be entitled to such travelling facilities in all respects as if such travelling had taken place after the commencement of his right to travelling facilities under this Act.
(5) Whenever Dáil Eireann is dissolved any person who was a member of Dáil Eireann immediately before such dissolution and was in Dublin on the date of such dissolution shall, within three days after such dissolution, be entitled to travelling facilities under this Act in respect of travelling once between Dublin and any place in his former constituency or his normal place of residence for the time being in all respects as if such travelling had taken place while he was a member of Dáil Eireann.
(6) If any question or dispute shall arise as to whether, or the extent to which, a member of the Oireachtas is entitled to the benefit of any of the three immediately preceding sub-sections, such question or dispute shall be determined—
(a) in the case of a member of Dáil Eireann, by the Chairman of Dáil Eireann, and
(b) in the case of a member of Seanad Eireann, by the Chairman of Seanad Eireann,
and every such determination shall be final.
Travelling facilities of members of Seanad Eireann attending on its first assembly.
6.—Notwithstanding anything contained in section 2 of the Oireachtas (Payment of Members) Act, 1933 (No. 50 of 1933), as revived and applied to members of Seanad Eireann by sub-section (3) of section 10 of the Constitution (Consequential Provisions) Act, 1937 (No. 40 of 1937), and the repeal of such first-mentioned Act effected by this Act, a member of Seanad Eireann who was present at the first assembly shall be entitled to receive and be paid travelling facilities under the Oireachtas (Payment of Members) Acts, 1923 to 1933, in respect of travelling to Dublin on a day before such first assembly for the purpose of attending Seanad Eireann on its first assembly, and shall be entitled so to receive and be paid such travelling facilities in all respects as if such travelling had taken place on the day of such first assembly.
Repeals.
7.—The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of that Schedule.
Short title.
8.—This Act may be cited as the Oireachtas (Allowances to Members) Act, 1938.
