ACHT OIDEACHAIS GHAIRME BEATHA (LEASÚ), 1936.

An Príomh-Acht.

1.—San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht Oideachais Ghairme Beatha, 1930 (Uimh. 29 de 1930).

Coistí oideachais ghairme beatha do chur tailimh ná beidh ag teastáil de láimh.

2.—(1) Féadfaidh coiste oideachais ghairme beatha, le toiliú an Aire Oideachais, aon talamh a bheidh dílsithe sa choiste sin do dhíol no do chur ar cíos.

(2) An t-airgead uile gheobhaidh coiste oideachais ghairme beatha de bharr talamh do dhíol fén alt so no i bhfuirm fíneála as talamh do chur ar cíos fén alt so, déanfar, sa chéad dul síos, é chur mar chabhair chun íoctha aon airgid cholna a bheidh mar mhuirear ar an gciste oideachais ghairme beatha bheidh á chothabháil ag an gcoiste sin, agus déanfar an farasbarr (más ann dó) den airgead san d'íoc isteach sa chiste sin.

(3) Aon airgead a gheobhaidh coiste oideachais ghairme beatha i bhfuirm chíosa as talamh do chur ar cíos fén alt so, déanfar é d'íoc isteach sa chiste oideachais ghairme beatha bheidh á chothabháil ag an gcoiste sin.

(4) Beidh fo-alt (1) den alt so fé mar a bheadh éifeacht aige agus tuigfear éifeacht do bheith aige ón 21adh lá d'Iúl, 1930.

3.—Deintear leis seo fo-alt (2) d'alt 43 den Phríomh-Acht do leasú tré sna focail “i dtosach na bliana san” do scriosadh amach as gach áit ina bhfuil na focail sin sa bhfo-alt san agus tré sna focail “i dtosach na bliana airgeadais áitiúla díreach roimhe sin” do chur, i ngach cás, in ionad na bhfocal a scriostar amach amhlaidh, agus léireofar an fo-alt san agus beidh éifeacht aige dá réir sin.

Airtiogal 12 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, do chur i mbaint.

4.—Bainfidh Airtiogal 12 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, mar a leasuítear san le haon achtachán ina dhiaidh sin, le coistí oideachais ghairme beatha agus le n-a gcuid ball fé mar a bhaineann sé le comhairlí contae agus le n-a gcuid ball ach san fé réir an atharuithe ná beidh duine, d'ainneoin éinní atá i mír (e) d'fho-airtiogal (4) den Airtiogal san 12, dí-cháilithe, más cáilithe dhó ar gach slí eile, chun é do thogha no do rogha mar bhall, no chun é bheith mar bhall, d'aon choiste oideachais ghairme beatha no d'aon fho-choiste den chéanna de bhíthin é féin no a pháirtnéir d'fháil aon tsochair no buntáiste no do dhéanamh connartha chun aon tsochar no buntáiste d'fháil a thairgeann an coiste sin no aon fho-choiste den chéanna don phuiblíocht i bhfuirm oideachais leanúnaigh agus ceárd-oideachais ná de bhíthin baint do bheith aige féin no ag á pháirtnéir le haon mhargadh no connradh atá ar marthain ar dháta an Achta so do rith agus do rinneadh leis an gcoiste sin no le haon fho-choiste den chéanna ná de bhíthin é féin no a pháirtnéir d'fháil coda de bhrabús aon mhargaidh no connartha den tsórt san no aon oibre atá á déanamh ar an dáta san fé údarás an choiste sin no aon fho-choiste den chéanna.

VOCATIONAL EDUCATION (AMENDMENT) ACT, 1936.

The Principal Act.

1.—In this Act the expression “the Principal Act” means the Vocational Education Act, 1930 (No. 29 of 1930).

Disposal by vocational education committees of surplus land.

2.—(1) A vocational education committee may, with the consent of the Minister for Education, sell or let any land which is vested in such committee.

(2) All moneys received by a vocational education committee on a sale under this section or by way of fine on a letting under this section shall in the first instance be applied towards the payment of any principal moneys which are charged on the vocational education fund maintained by such committee, and the balance (if any) of such moneys remaining shall be paid into such fund.

(3) Any moneys received by a vocational education committee by way of rent on a letting made under this section shall be paid into the vocational education fund maintained by such committee.

(4) Sub-section (1) of this section shall have and be deemed to have had effect as from the 21st day of July, 1930.

Amendment of section 43 of the Principal Act.

3.—Sub-section (2) of section 43 of the Principal Act is hereby amended by the deletion of the words “at the commencement of such year” wherever those words occur in the said sub-section and the substitution in every case of the words “at the commencement of the immediately preceding local financial year” for the words so deleted, and the said sub-section shall be construed and have effect accordingly.

Application of Article 12 of the Schedule to the Local Government (Application of Enactments) Order, 1898.

4.—Article 12 of the Schedule to the Local Government (Application of Enactments) Order, 1898, as amended by any subsequent enactment, shall apply to vocational education committees and their members in like manner as it applies to county councils and their members subject, however, to the modification that, notwithstanding anything contained in paragraph (e) of sub-article (4) of the said Article 12, a person shall not, if otherwise qualified, be disqualified from being elected or chosen or being a member of any vocational education committee or of any sub-committee thereof by reason of his having by himself or his partner received or contracted to receive any benefit or advantage offered to the public in the nature of continuation education and technical education by such committee or any sub-committee thereof, or by reason of his being concerned by himself or his partner in any bargain or contract existing at the date of the passing of this Act entered into with such committee or any sub-committee thereof or his participating by himself or his partner in the profit of any such bargain or contract or of any work being done at the said date under the authority of such committee or any sub-committee thereof.

Repeal.

5.—Section 122 of the Principal Act is hereby repealed.

Short title and citation.

6.—This Act may be cited as the Vocational Education (Amendment) Act, 1936, and the Principal Act and this Act may be cited together as the Vocational Education Acts, 1930 and 1936.
