Mínithe.
1.—San Acht so—
cialluíonn an abairt “an tAire” an tAire Riaghaltais Aiteamhail agus Sláinte Poiblidhe;
cialluíonn an focal “carraí” síolta agus abhair leasuithe no síolta amháin no abhair leasuithe amháin, fé mar is gá sa chás;
ní chialluíonn an focal “síolta” ach síolta cruithneachtan, síolta eornan, síolta coirce, agus prátaí síl;
déanfar tagairtí do chomhairle do dhíol carraí agus d'earraí do cheannach o chomhairle do léiriú mar thagairtí fholuíonn idirbhearta ina ndéanfaidh no ina ndearna comhairle socrú le deighleálaidhe chun carraí ina ndeighleálann sé do sholáthar do dhuine go n-údarás ón gcomhairle sin chun na n-earraí sin d'fháil.
Coinhacht do chomhairle chontae chun síolta agus abhair leasuithe do chur ar fáil.
2.—(1) Má rinne no má dheineann comhairle chontac, ar an 1adh lá d'Fheabhra, 1939, no dá éis sin agus roimh an 31adh lá d'Iúl, 1939, no ar an 1adh lá d'Fheabhra, 1940, no dá éis sin agus roimh an 31adh lá d'Iúl, 1940, síolta agus abhair leasuithe no síolta amháin no abhair leasuithe amháin do chur ar fáil chun iad a dháiliú sa chontae sin no in aon chuid áirithe dhi, is dleathach agus is tuigthe gur dhleathach riamh don chomhairle sin aon tsíol agus abhar leasuithe de sna síolta agus na habhair leasuithe no aon tsíol de sna síolta no aon abhar leasuithe de sna habhair leasuithe (do réir mar a bheidh) ar n-a gcur ar fáil amhlaidh do dhíol le sealbhaire no saothruitheoir tailimh ar bith sa chontae sin no sa chuid áirithe sin di agus, maidir le gach cur ar fáil agus le gach díol den tsórt san do rinneadh roimh an Acht so do rith, is tuigthe chun crícheanna an Achta so gur fén Acht so do rinneadh é agus na tagairtí atá san Acht so, do chomhairle chontae do chur earraí ar fáil no d'iad do dhíol earraí agus d'earraí do cheannach o chomhairle chontae, is dá réir sin a léireofar iad.
(2) Pé uair a dhíol no dhíolfaidh comhairle chontae aon earraí le duine ar bith fén Acht so, beidh ag gabháil leis an suim, is iníoctha ag an duine sin leis an gcomhairle sin alos an díola san, ús do réir an ráta san per cent. per annum a cheap no cheapfaidh an chomhairle sin chuige sin, d'ainneoin gan a chó-aontú, agus an díol san á dhéanamh, go n-íocfaí ús.
(3) Pé uair a rinne comhairle chontae sa bhliain 1939 síolta agus abhair leasuithe no síolta no abhair leasuithe do chur ar fáil agus do dhíol fén Acht so, féadfaidh an chomhairle sin a fháil amach cadé méid iomlán na gcostas agus na gcaiteachas (seachas an praghas do thug an chomhairle sin ar na síolta agus na habhair leasuithe sin no ar na síolta san no ar na habhair leasuithe sin, do réir mar a bhí) fé n-a ndeachaidh an chomhairle sin ag cur na n-earraí sin ar fáil agus á ndíol, agus is dleathach dóibh an méid sin do chionroinnt ar na daoine uile agus fé seach le n-ar díoladh na hearraí sin amhlaidh agus leis sin déanfar an tsuim ar n-a cur i leith aon duine aca san de dhruim na cionroinnte sin do chur leis an suim is iníoctha ag an duine sin leis an gcomhairle sin alos na coda de sna hearraí sin do díoladh leis amhlaidh agus beidh sí agus is tuigthe go raibh sí riamh ina cuid den tsuim sin is iníoctha amhlaidh agus beidh sí ionbhainte amach fén Acht so dá réir sin, d'ainneoin gan a chó-aontú, agus an díol san á dhéanamh, go n-íocfaí an tsuim sin.
(4) Pé uair a rinne no dhéanfaidh comhairle chontae sa bhliain 1940 síolta agus abhair leasuithe no síolta no abhair leasuithe do chur ar fáil agus do dhíol fén Acht so, féadfaidh an chomhairle sin a fháil amach cadé méid iomlán na gcostas agus na gcaiteachas (seachas an praghas do thug an chomhairle sin ar na síolta agus na habhair leasuithe sin no ar na síolta san no ar na habhair leasuithe sin, do réir mar a bhí) fé n-a ndeachaidh an chomhairle sin ag cur na n-earraí sin ar fáil agus á ndíol, agus is dleathach dóibh an méid sin do chionroinnt ar na daoine uile agus fé seach le n-ar díoladh na hearraí sin amhlaidh agus leis sin déanfar an tsuim ar n-a cur i leith aon duine acu san de dhruim na cionroinnte sin do chur leis an suim is iníoctha ag an duine sin leis an gcomhairle sin alos na coda de sna hearraí sin do díoladh leis amhlaidh agus beidh sí agus is tuigthe go raibh sí riamh ina cuid den tsuim sin is iníoctha amhlaidh agus beidh sí ionbhainte amach fén Acht so dá réir sin, d'ainneoin gan a chó-aontú, agus an díol san á dhéanamh, go n-íocfaí an tsuim sin.
(5) Aon tsuim is iníoctha le comhairle chontae alos earraí ar bith do dhíol fén Acht so (le n-a n-áirmhítear an t-ús, agus fós an cion de chostaisí agus de chaiteachaisí, is iníoctha de bhuadh an ailt seo) déanfar, do réir mar is rogha leis an gcomhairle sin, í íoc leis an gcomhairle sin san am agus sa tslí ar ar có-aontuíodh agus na hearraí sin á ndíol no ina dhá tráthchuid chó-ionanna is iníoctha ar na dátaí fé seach ar n-a gceapadh ag an gcomhairle sin chuige sin, agus i gceachtar cás féadfar í bhailiú agus í bhaint amach sa tslí a húdaruítear leis an Acht so.
Suimeanna is iníoctha le comhairlí contae fén Acht so do bhaint amach.
3.—I dteanta aon mhodha eile agus gan dochar d'aon mhodh eile chun aon tsuim do bhaint amach is iníoctha le comhairle chontae alos no i dtaobh na comhairle sin do dhíol earraí fén Acht so, féadfar gach suim den tsórt san ná raibh, i gcás earraí do díoladh sa bhliain 1939, íoctha leis an gcomhairle sin ná bainte amach aca roimh an 1adh lá d'Eanar, 1940, no ná beidh, i gcás earraí do díoladh no díolfar sa bhliain 1940, íoctha ná bainte amach amhlaidh roimh an 1adh lá d'Eanar, 1941, do bhaint amach—
(a) má bhíonn an duine go mbeidh an tsuim sin iníoctha aige rátuithe (seachas mar únaer ar thigh chomhnaithe bheag do réir bhrí an Achta Rialtais Áitiúla (Rátaí ar Thithe Comhnaithe Beaga), 1928 (Uimh. 4 de 1928)) chun an ráta dhealbhais sa chontae sin, tríd an gcomhairle sin do ghearradh ráta speisialta a cuirfear leis an ráta dealbhais agus a baileofar i dteanta an ráta dhealbhais a bheidh ar an tionóntachán gur ina thaobh a bheidh an duine sin rátuithe amhlaidh, agus féadfaidh an chomhairle sin an céanna do bhailiú agus do bhaint amach sa tslí chéanna ina bhféadfaid agus leis na meáin chéanna le n-a bhféadaid ráta déalbhais do bhailiú agus do bhaint amach, no
(b) mara mbeidh an duine go mbeidh an tsuim sin iníoctha aige rátuithe mar adubhradh chun an ráta dhealbhais sa chontae sin, tré ráta speisialta bhuailfidh an chomhairle sin chun crícheanna an ailt seo agus chun a rátófar an duine sin agus a baileofar agus a féadfar a bhaint amach sa tslí chéanna ina bhféadfaid agus leis na meáin chéanna le n-a bhféadfaid an chomhairle sin ráta dealbhais do bhailiú agus do bhaint amach.
Comhacht do chomhairlí contae chun urraíochta do thabhairt.
4.—(1) Is dleathach agus is tuigthe gur dhleathach riamh do chomhairle chontae scéim do dhéanamh agus do thabhairt chun críche á ghabháil le n-a n-ais a urrú d'aon cheannaidhe síolta cheaduithe go n-íocfar go cuibhe leis an gceannaidhe sin an praghas iomlán no cion áirithe den phraghas is iníoctha ag sealbhaire no saothruitheoir tailimh ceaduithe sa chontae sin as síolta agus abhair leasuithe no as síolta amháin no as abhair leasuithe amháin do sholáthair an ceannaidhe sin don tsealbaire no don tsaothruitheoir cheaduithe sin i rith na tréimhse dar thosach an 1adh lá d'Fheabhra, 1939, agus dar chríoch an 31adh lá d'Iúl, 1939.
(2) Is dleathach agus is tuigthe gur dhleathach riamh do chomhairle chontae scéim do dhéanamh agus do thabhairt chun críche á ghabháil le n-a n-ais a urrú d'aon cheannaidhe síolta cheaduithe go n-íocfar go cuibhe leis an gceannaidhe sin an praghas iomlán no cion áirithe den phraghas is iníoctha ag sealbhaire no saothruitheoir tailimh ceaduithe sa chontae sin as síolta agus abhair leasuithe no as síolta amháin no as abhair leasuithe amháin do sholáthair no sholáthróidh an ceannaidhe sin don tsealbhaire no don tsaothruitheoir cheaduithe sin i rith na tréimhse dar tosach an 1adh lá d'Fheabhra, 1940, agus dar críoch an 31adh lá d'Iúl, 1940.
(3) Pé uair a bheidh urraíocht tugtha ag comhairle chontae do cheannaidhe síolta cheaduithe de bhun scéime a húdaruítear le ceachtar de sna fo-ailt deiridh sin roimhe seo den alt so, agus a dhéanfaidh an chomhairle sin, de dhruim faillí an tsealbhaire no an tsaothruitheora le n-a mbainfidh an urraíocht san, aon airgead d'íoc leis an gceannaidhe sin fén urraíocht san, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) má bhíonn aon airgead ionbhainte go dleathach den tsealbhaire no den tsaothruitheoir sin no dá urraí (más ann dóibh) ag an gcomhairle sin mar gheall ar an íocaíocht san do dhéanamh leis an gceannaidhe sin, ansan, i dteanta aon tslí eile chun é bhaint amach agus gan dochar don chéanna, beidh sé ionbhainte amach fén Acht so fé is dá mba shuim é dob iníoctha ag an sealbhaire no ag an saothruitheoir nó ag an urra san (do réir mar a bheidh) alos earraí do dhíolfadh an chomhairle sin leis fén Acht so;
(b) féadfar an urraíocht san do thairgsint i bhfianaise, agus (ar a chruthú gur cólánuíodh go cuibhe í) glacfar í i bhfianaise, in imeachta in aon chúirt ar n-a mbunú ag an gcomhairle sin chun airgead is ionbhainte amach go dleathach amhlaidh mar adubhradh do bhaint den tsealbhaire no den tsaothruitheoir no den urra san d'ainneoin gan forálacha an Stamp Act, 1891, ar n-a leasú no ar n-a oiriúnú le hachtacháin ina dhiaidh sin, do bheith cólíonta maidir leis an urraíocht san.
(4) San alt so cialluíonn an focal “ceaduithe” ceaduithe ag an gcomhairle bheidh i gceist.
Comhacht chun iasachtaí d'fháil.
5.—(1) Féadfaidh comhairle chontae, le ceadú an Aire, an t-airgead san d'fháil ar iasacht is gá chun síolta agus abhair leasuithe no síolta amháin no abhair leasuithe amháin do chur ar fáil fén Acht so fé is dá mbeadh an chríoch san luaidhte in Airteagal 22 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, agus ní déanfar airgead do gheobhfar ar iasacht amhlaidh d'áireamh mar chuid d'fhiacha na comhairle sin chun crícheanna an Airteagail sin.
(2) Gach suim a fuarthas ar iasacht fén alt so chun síolta agus abhair leasuithe no síolta amháin no abhair leasuithe amháin do chur ar fáil fén Acht so sa bhliain 1939 aisíocfar í, maraon le hús do réir an ráta ar ar có-aontuíodh, an 31adh lá de Mhárta, 1941, no roimhe sin.
(3) Gach suim a fuarthas no gheobhfar ar iasacht fén alt so chun síolta agus abhair leasuithe no síolta amháin no abhair leasuithe amháin do chur ar fáil fén Acht so sa bhliain 1940 aisíocfar í, maraon le hús do réir an ráta ar ar có-aontuíodh, an 31adh lá de Mhárta, 1942, no roimhe sin.
(4) Is tuigthe gach suim a fuarthas no gheobhfar ar iasacht fén alt so maraon leis an ús uirthi do bheith, o dháta na suime sin d'fháil ar iasacht, ina muirear ar an ráta dealbhais is inghearrtha i gcontae na comhairle do fuair no gheobhaidh an tsuim sin ar iasacht amhlaidh.

6.—Déanfaidh comhairle chontae na costaisí, ar n-a gcur suas ag an gcomhairle sin chun síolta agus abhair leasuithe no síolta amháin no abhair leasuithe amháin do chur ar fáil fén Acht so, do chruinniú tríd an ráta dealbhais mar mhuirear ar an gcontae go hiomlán sa mhéid ná beid bainte de sna daoine uile agus fé seach le n-ar díoladh na hearraí sin.
Geallúna agus urraíochta neastampálta do bheith ionghlactha.
7.—Pé uair a rinne duine ar bith roimh an Acht so do rith, no dhéanfaidh dá éis sin, aon earraí do cheannach o chomhairle chontae fén Acht so agus a rinne no dhéanfaidh an duine sin, roimh na hearraí sin do cheannach no sara leigfí dhó iad do cheannach, geallúint go n-urraíocht o urraí no dá héamais do shighniú, á rá go n-íocfadh sé leis an gcomhairle sin praghas na n-earraí do ceannuíodh amhlaidh, no dul fé fhreagarthacht ar shlí eile san íoc san tré gheallúint den tsórt san, féadfar an gheallúint sin agus fós an urraíocht a bheidh (má bhíonn) inti do thairgsint i bhfianaise, agus (ar a chruthú gur cólánuíodh an céanna go cuibhe) glacfar san i bhfianaise, in imeachta ar n-a mbunú in aon chúirt chun an phraghais sin do bhaint den duine sin no d'aon urra den tsórt san, d'ainneoin gan forálacha an Stamp Act, 1891, ar n-a leasú no ar n-a oiriúnú le hachtacháin ina dhiaidh sin, do bheith cólíonta sa chás.

8.—Ní bheidh duine ar bith dí-cháilithe chun é thogha ná chun é roghnú ná chun é bheith ina bhall de chomhairle chontae no cheanntair, no de bhord choimisinéirí baile, toisc é do cheannach no do chó-aontú go gceannódh sé aon earraí o chomhairle chontae, is earraí ar n-a gcur ar fáil agus ar n-a ndíol ag an gcomhairle sin fén Acht so, no toisc é d'fháil urraíochta (mar chreidmheasóir no mar phrímh-fhéicheamh) ar n-a tabhairt ag comhairle chontae fén Acht so.

SEEDS AND FERTILISERS SUPPLY ACT, 1940.
Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the word “goods” means seeds and fertilisers or seeds only or fertilisers only, as the case may require;
the word “seeds” means only wheat seeds, barley seeds, oat seeds, and seed potatoes;
references to the sale of goods by or to the purchase of goods from a council shall be construed as including transactions in which a council arranges or has arranged for the supply of goods by a dealer in those goods to a person authorised by such council to receive such supply.
Power of county council to provide seeds and fertilisers.
2.—(1) Where the council of a county has provided or shall provide, on or after the 1st day of February, 1939, and before the 31st day of July, 1939, or on or after the 1st day of February, 1940, and before the 31st day of July, 1940, a supply of seeds and fertilisers or of seeds only or of fertilisers only for distribution in such county or in any particular portion thereof, it shall be and be deemed always to have been lawful for such council to sell any of the seeds and fertilisers or seeds or fertilisers (as the case may be) so provided to any occupier or cultivator of land in such county or such particular portion thereof, and every such provision or sale made before the passing of this Act shall be deemed for the purposes of this Act to have been made under this Act and references in this Act to the provision or to the sale of goods by the council of a county and to the purchase of goods from the council of a county shall be construed accordingly.
(2) Whenever the council of a county has sold or shall sell under this Act any goods to any person, the sum payable by such person to such council in respect of such sale shall carry interest at such rate per cent. per annum as may be fixed in that behalf by such council, notwithstanding that no agreement to pay interest was made at the time of such sale.
(3) Whenever the council of a county has in the year 1939 provided and sold under this Act seeds and fertilisers or either of them, such council may ascertain the total amount of the costs and expenses (other than the price paid by such council for such seeds and fertilisers or seeds or fertilisers, as the case may be) incurred by such council in respect of the provision and all sales of such goods and may apportion such amount amongst the several persons to whom such goods were so sold and thereupon the sum so apportioned to any such person shall be added to and form and be deemed always to have formed part of the sum owing to such council by such person in respect of the sale so made to such person and shall be recoverable under this Act accordingly, notwithstanding that no agreement for the payment of such sum was made at the time of such sale.
(4) Whenever the council of a county has, in the year 1940, provided and sold under this Act seeds and fertilisers or either of them, such council may ascertain the total amount of the costs and expenses (other than the price paid by such council for such seeds and fertilisers or seeds or fertilisers, as the case may be) incurred by such council in respect of the provision and all sales of such goods and may apportion such amount amongst the several persons to whom such goods were so sold and thereupon the sum so apportioned to any such person shall be added to and form and be deemed always to have formed part of the sum owing to such council by such person in respect of the sale so made to such person and shall be recoverable under this Act accordingly, notwithstanding that no agreement for the payment of such sum was made at the time of such sale.
(5) Any sum owing to the council of a county in respect of any sale under this Act of any goods (including the interest and proportion of costs and expenses payable by virtue of this section) shall be paid to such council, at the option of such council, either at the time and in the manner agreed on at the time of such sale or by two equal instalments payable on the respective dates appointed for the purpose by such council, and in either case may be collected and recovered in the manner authorised by this Act.
Recovery of sums payable to county councils under this Act.
3.—In addition and without prejudice to any other method of recovering any sum payable to the council of a county in respect or on account of a sale of goods by such council under this Act, every such sum which is not paid to or recovered by such council, in the case of a sale in the year 1939, before the 1st day of January, 1940, or, in the case of a sale in the year 1940, before the 1st day of January, 1941, may—
(a) if the person by whom the same is payable is rated (otherwise than as owner of a small dwelling within the meaning of the Local Government (Rates on Small Dwellings) Act, 1928 (No. 4 of 1928)) to the poor rate in such county, be recovered by the levying by such council of a special rate which shall be added to and collected with the poor rate assessed on the tenement in respect of which such person is so rated, and may be collected and recovered by such council in the same manner and by the same means as poor rate may be collected and recovered by them, or
(b) if the person by whom the same is payable is not rated as aforesaid to the poor rate in such county, be recovered by means of a special rate to be made by such council for the purposes of this section to which such person shall be rated and which shall be collected and may be recovered in the same manner and by the same means as poor rate may be collected and recovered by such council.
Power of county councils to give guarantees.
4.—(1) It shall be and be deemed always to have been lawful for the council of a county to make and carry out a scheme whereby such council undertakes to guarantee to any approved seed merchant the due payment to such merchant of the whole or a specified proportion of the price payable by an approved occupier or cultivator of land in such county for seeds and fertilisers or seeds only or fertilisers only supplied by such merchant to such approved occupier or cultivator during the period beginning on the 1st day of February, 1939, and ending on the 31st day of July, 1939.
(2) It shall be and be deemed always to have been lawful for the council of a county to make and carry out a scheme whereby such council undertakes to guarantee to any approved seed merchant the due payment to such merchant of the whole or a specified proportion of the price payable by an approved occupier or cultivator of land in such county for seeds and fertilisers or seeds only or fertilisers only supplied by such merchant to such approved occupier or cultivator during the period beginning on the 1st day of February, 1940, and ending on the 31st day of July, 1940.
(3) Whenever the council of a county has given to an approved seed merchant a guarantee in pursuance of a scheme authorised by either of the next preceding sub-sections of this section and, in consequence of the default of the occupier or cultivator to whom such guarantee relates, such council pays any money to such merchant under such guarantee, the following provisions shall have effect, that is to say:—
(a) any money lawfully recoverable by such council from such occupier or cultivator or his sureties (if any) on account of the said payment to such merchant shall (in addition and without prejudice to any other method of recovering the same) be recoverable under this Act as if it were a sum payable by such occupier, cultivator, or surety (as the case may be) in respect of a sale of goods to him by such council under this Act;
(b) such guarantee may be tendered and shall (on proof of due execution) be received in evidence in proceedings in any court by such council to recover money so lawfully recoverable as aforesaid from such occupier, cultivator, or surety notwithstanding that the provisions of the Stamp Act, 1891, as amended or adapted by subsequent enactments, have not been complied with in respect of such guarantee.
(4) In this section the word “approved” means approved of by the council concerned.
Borrowing power.
5.—(1) The council of a county may borrow, with the sanction of the Minister, such moneys as may be necessary for the purpose of the provision under this Act of supplies of seeds and fertilisers or of seeds only or of fertilisers only in like manner as if the said purpose were mentioned in Article 22 of the Schedule to the Local Government (Application of Enactments) Order, 1898, and moneys so borrowed shall not be reckoned as part of the debt of such council for the purposes of that Article.
(2) Every sum borrowed under this section for the purpose of the provision under this Act of supplies of seeds and fertilisers or of seeds only or of fertilisers only in the year 1939 shall be repaid on or before the 31st day of March, 1941, with interest at the rate agreed upon.
(3) Every sum borrowed under this section for the purpose of the provision under this Act of supplies of seeds and fertilisers or of seeds only or of fertilisers only in the year 1940 shall be repaid on or before the 31st day of March, 1942, with interest at the rate agreed upon.
(4) Every sum borrowed under this section and the interest thereon shall be deemed to be charged, as from the date on which such sum is borrowed, on the poor rate leviable in the county of the council by which the same is so borrowed.
Raising of unrecovered expenses.
6.—The expenses incurred by the council of a county in the provision under this Act of supplies of seeds and fertilisers or of seeds only or of fertilisers only shall, in so far as they are not recovered from the several persons to whom such goods are sold, be raised by such council by means of the poor rate as a county-at-large charge.
Admissibility of unstamped undertakings and guarantees.
7.—Whenever (whether before or after the passing of this Act) any person has purchased under this Act any goods from the council of a county and such person has, prior to such purchase or as a condition of being permitted to make such purchase, signed or otherwise become liable on an undertaking (whether with or without a guarantee by sureties) to pay to such council the price of the goods so purchased, such undertaking and the guarantee (if any) included therein may be tendered and shall (on proof of due execution) be received in evidence in proceedings in any court to recover such price from such person or from any such surety, notwithstanding that the provisions of the Stamp Act, 1891, as amended or adapted by subsequent enactments, have not been complied with.
Exemption from disqualification.
8.—No person shall be disqualified for being elected, chosen, or being a member of the council of a county or a district or of the board of commissioners of a town by reason of his having purchased or agreed to purchase from the council of a county any goods provided and sold by such council under this Act or by reason of his having received (whether as creditor or as principal debtor) a guarantee given under this Act by the council of a county.
Validation of certain orders, etc.
9.—All orders made, sanctions given, and things done by the Minister before the passing of this Act in relation to the provision and sale of goods under this Act by the councils of counties or in relation to the making and carrying out by the councils of counties of schemes authorised by this Act for the giving of guarantees by such councils shall be and be deemed always to have been legal and valid for all purposes.
Short title.
10.—This Act may be cited as the Seeds and Fertilisers Supply Act, 1940.
