Comhachta, etc., do dhílsiú sa Bhárdas.

2.—(1) An tOrdú um Chontae-Bhuirg Chorcaighe (Scur), 1924, le n-ar scuireadh comhairle chontae-bhuirg Chorcaighe, fanfa sé i bhfeidhm go dtí an lá ceaptha agus ansan scuirfe sé d'éifeacht do bheith aige.

(2) An mhaoin uile le comhairle chontae-bhuirg Chorcaighe do haistríodh de bhua an Orduithe um Chontae-Bhuirg Chorcaighe (Scur), 1924, chun an té do hainmníodh chuige sin san Ordú san, dílseoidh sí sa Bhárdas ar an lá ceaptha.

(3) Na comhachta, na feidhmeanna agus na dualgaisí le comhairle chontae-bhuirg Chorcaighe atá, de bhua an Orduithe a luaidhtear anso roimhe seo, á bhfeidhmiú agus á gcólíona, ar dháta rithte an Achta so, ag an té do hainmníodh chuige sin san Ordú san, tiocfid chun bheith agus beid, ar an lá ceaptha agus ón lá san amach, ina gcomhachta, ina bhfeidhmeanna agus ina ndualgaisí ag an mBárdas agus gach aon cheann riamh de sna comhachta, de sna feidhmeanna agus de sna dualgaisí a bronnfar agus a forchuirfar ar an gcomhairle sin le forálacha no fé fhorálacha aon Achta a rithfar tar éis rithte an Achta so, tiocfid chun bheith agus beid ina gcomhachta, ina bhfeidhmeanna agus ina ndualgaisí ag an mBárdas ar an dáta agus ón dáta ar a ndéanfar na comhachta, na feidhmeanna agus na dualgaisí sin do bhronna agus d'fhorchur fé seach amhlaidh.

(4) Pé uair a déanfar, le haon Acht no fé aon Acht a rithfar tar éis rithte an Achta so, aon chomhachta, feidhmeanna no dualgaisí do bhronna no d'fhorchur ar chomhairle bhuirge, chontaebhuirge, no bhailecheanntair tiocfidh na comhachta, na feidhmeanna agus na dualgaisí sin, sa mhéid go mbainid le comhairle chontae-bhuirg Chorcaighe, chun bheith agus beid ina gcomhachta, ina bhfeidhmeanna agus ina ndualgaisí ag an mBárdas ar dháta agus o dháta a mbronnta agus a bhforchurtha fé seach amhlaidh.

(5) Déanfidh an chomhairle no an bainisteoir (pe'ca aca é) gach aon cheann riamh de chomhachta, d'fheidhmeanna, agus de dhualgaisí an Bhárdais d'fheidhmiú agus do chólíona don Bhárdas agus thar a cheann fé réir agus do réir forálacha an Achta so.

(6) D'ainneoin éinní atá san Acht um Thoghacháin Áitiúla (Údaráis Scurtha), 1926 (Uimh. 22 de 1926), ní comórfar aon toghachán do bhaill de chomhairle chontae-bhuirg Chorcaighe do réir fo-alt (1) d'alt 2 den Acht san.

Toghacháin bhuirge.

3.—(1) Comórfar toghachán buirge sa bhliain 1929 agus gach bliain ina dhiaidh sin agus i ngach toghachán buirge beidh an Bhuirg ina haon líomatáiste toghacháin amháin.

(2) Toghfar ball is fiche den Chomhairle sa toghachán bhuirge a comórfar sa bhliain 1929, agus, fé réir na bhforálacha den Acht so a bhaineann le daoine a ceapfar chun foth-fholúntaisí, is mar leanas a bheidh téarma oifige na mball a toghfar sa toghachán san, sé sin le rá:—

(a) beidh an chéad sheachtar ball a toghfar amhlaidh i seilbh oifige go dtí an cúigiú lá tar éis an toghacháin bhuirge a comórfar sa bhliain 1932.

(b) beidh an chéad sheachtar ball eile a toghfar amhlaidh i seilbh oifige go dtí an cúigiú lá tar éis an toghacháin bhuirge a comórfar sa bhliain 1931, agus

[EN]

(c) beidh an seachtar ball eile a toghfar amhlaidh i seilbh oifige go dtí an cúigiú lá tar éis an toghacháin bhuirge a comórfar sa bhliain 1932,

(3) Toghfar seachtar ball den Chomhairle i ngach toghachán buirge a comórfar tar éis na bliana 1929.

(4) Sa bhliain 1929 comórfar an toghachán buirge lá a shocróidh an tAire agus gach bliain ina dhiaidh sin comórfar an toghachán buirge pé lá a shocróidh an Bárdas agus nách luatha ná an 23adh lá de Mheitheamh ná nách déanaí ná na ladh lá d'Iúl.

(5) Fé réir na bhforálacha den Acht so a bhaineann leis na daoine a ceapfar chun foth-fholúntaisí, marab éag, eirghe as, no teacht fé dhí-cháilíocht roimhe sin do beidh gach ball den Chomhairle a toghfar i dtoghachán buirge a comórfar aon bhliain tar éis na bliana 1929 i seilbh a oifige mar bhall den tsórt san go dtí an cúigiú lá tar éis an toghacháin bhuirge a comórfar an tríú bliain tar éis na bliana a toghadh é agus, mara n-ath-thoghfar roimhe sin é, imeoidh sé as oifig ansan mar bhall den tsórt san.

(6) Fé réir na bhforálacha san roimhe seo den alt so bainfidh an dlí a bheidh i bhfeidhm de thurus na huaire, i dtaobh comhairleoirí contae-bhuirgí do thogha agus i dtaobh cáilíochta daoine chun a dtoghtha amhlaidh, le gach toghachán buirge agus le cáilíocht daoine chun bheith ina mbaill den Chomhairle sa tslí chéanna ina mbaineann sí le comhairleoirí contae-bhuirgí do thogha agus le cáilíocht daoine chun a dtoghtha amhlaidh.

(7) Ach amháin i gcás dá bhforáltar a mhalairt leis an Acht so bainfidh an dlí a bheidh i bhfeidhm de thurus na huaire, i dtaobh cáilíochta daoine chun bheith ina mbaill d'aon choiste a ceapfar ag comhairle chontae-bhuirge no d'aon chó-choiste a ceapfar i bpáirt ag aon chomhairle den tsórt san, le cáilíocht daoine chun bheith ina mbaill d'aon choiste a ceapfar ag an gcomhairle no d'aon chó-choiste a ceapfar i bpáirt ag an gcomhairle.

(8) Chun crícheanna an dá fho-alt deiridh sin roimhe seo tuigfear connra a dineadh leis an mBárdas do bheith ina chonnra a dineadh leis an gComhairle agus le gach coiste agus có-choiste do ceapadh no do ceapadh i bpáirt ag an gComhairle agus tuigfar connra a dineadh le haon choiste no có-choiste den tsórt san do bheith ina chonnra a dineadh leis an gComhairle, leis.

Foth-fholúntaisí.

4.—(1) San Acht so cialluíonn an focal “foth-fholúntas” fothfholúntas a thiocfidh imeasc ballra na Comhairle tré éag, eirghe as no teacht fé dhí-cháilíocht do bhall di.

(2) Má thagann foth-fholúntas sa Chomhairle tré éag, eirghe as no teacht fé dhí-cháilíocht d'aon bhall di nách ball 'na mairfadh a théarma oifige, mara mbeadh an t-éag, an t-eirghe-as no an teacht fé dhí-cháilíocht san, go dtí an cúigiú lá tar éis an chéad thoghacháin bhuirge a bheadh le comóra fén Acht so tar éis teacht an fhoth-fholúntais sin, toghfar sa toghachán bhuirge sin ball den Chomhairle de bhreis ar an seachtar ball di is gá do réir an Achta so do thogha sa toghachán san, agus marab éag, eirghe as no teacht fé dhí-cháilíocht don bhall bhreise sin roimhe sin beidh sé i seilbh oifige ar feadh iarsma an téarma a bheadh an ball 'na dtáinig an folúntas tré éag, eirghe as no teacht fé dhícháilíocht do i seilbh oifige marar bh'éag, eirghe as ná teacht fé dhí-cháilíocht do.

(3) An duine deiridh a toghfar mar bhall den Chomhairle i dtoghachán buirge in ar gá do réir an ailt seo foth-fholúntas do líona, glacfar é chun an folúntas san do líona agus más gá níos mó ná aon fhoth-fholúntas amháin do líona sa toghachán san déanfar an t-ochtú duine a toghfar ann do ghlaca chun pé ceann de sna folúntaisí sin do líona a bheidh le líona an uair sin go ceann na tréimhse aimsire is sia agus mar sin de.

(4) Féadfidh an Chomhairle, más rogha leo féin é, tré rún do rith chuige sin, tar éis fógra seachtaine do gach ball den Chomhairle, socrú ar an bhfoth-fholúntas le n-a mbaineann an rún san do líona tré chó-thogha do réir an fho-ailt seo agus, ar bheith rithte don rún san féadfidh an Chomhairle, ag an gcruinniú ag ar ritheadh an rún san no ag aon chruinniú eile den Chomhairle ina dhiaidh sin, duine do thogha chun an fhoth-fholúntais sin le vótanna móráirimh de sna baill den Chomhairle a bheidh i láthair agus a vótálfidh ag an gcruinniú san.

(5) Gach duine a glacfar do réir forálacha an fho-ailt sin roimhe seo chun foth-fholúntas do líona beidh sé i seilbh oifige go dtí lá comórtha an chéad thoghacháin bhuirge a comórfar fén Acht so tar éis teacht don fhoth-fholúntas a líonfar amhlaidh, marab éag, eirghe as no teacht fé dhí-cháilíocht roimhe sin do.

Có-dhéanamh, etc., na Comhairle Buirge.

5.—(1) Beidh an Chomhairle, aon uair agus o am go ham tar éis an lae cheaptha, có-dhéanta de sna baill di a bheidh toghtha, pe'ca roimh an lá ceaptha é no dá éis sin, do réir forálacha an Achta so agus 'na mbeidh a dtéarmaí oifige gan bheith caithte an uair sin.

(2) An chéad bheirt bhall den Chomhairle a toghfar sa toghachán bhuirge a comórfar sa bhliain 1929 agus an chéad bheirt bhall den Chomhairle a toghfar i ngach toghachán buirge a comórfar tar éis na bliana 1929 beid ina seanóirí.

(3) Gach ball den Chomhairle nách ball a bheidh ina sheanóir de bhua na bhforálacha san roimhe seo den alt so beidh sé ina chomhairleoir.

Céad-chruinniú na Comhairle agus Tiarna Méara do thogha.

6.—(1) Beidh céad-chruinniú na Comhairle ina chruinniú chinn ráithe agus comórfar é um meán lae ar an lá ceaptha.

(2) Déanfidh an Chomhairle ag á gcéad chruinniú agus ag an gcéad chruinniú cinn ráithe a bheidh acu tar éis gach toghacháin bhuirge duine dá mbaill do thogha chun bheith ina Thiarna Mhéara ar Chorcaigh (dá ngairmtear an Tiarna Méara san Acht so).

(3) Fanfidh an Tiarna Méara in oifig go dtí go mbeidh a chomharba toghtha ag an gcruinniú cinn ráithe den Chomhairle ag á bhféadfidh an Chomhairle, ag féachaint d'fhorálacha an fho-ailt sin roimhe seo, Tiarna Méara do thogha agus go dtí go mbeidh déanta ag an gcomharba san an dearbhú, ag glaca le hoifig, gur gá do Thiarna Mhéara thoghtha no do Mhéara thoghtha a dhéanamh do réir na dlí a bheidh i bhfeidhm de thurus na huaire maidir le Tiarna Méara no Méara contaebhuirge do thogha.

(4) Beidh Cléireach an Bhaile ina chathaoirleach ar chéadchruinniú na Comhairle go dtí go mbeidh an Tiarna Méara toghtha agus an dearbhú roimhráite déanta aige.

(5) Ní bheidh teideal ag Cléireach an Bhaile vóta do thabhairt uaidh ar aon cheist a bheidh le socrú ag céad-chruinniú na Comhairle le vóta o bhaill na Comhairle.

(6) An dlí a bheidh i bhfeidhm de thurus na huaire maidir le cruinnithe cinn ráithe de chomhairle chontae-bhuirge do chomóra agus leis na cruinnithe a comórfar amhlaidh, agus le togha, le sealbhaíocht oifige, le comhachta, le dualgaisí, le príbhléidí agus le luach saothair Tiarna Mhéara no Méara chontae-bhuirge, bainfid, fé réir forálacha an ailt seo, le cruinnithe cinn ráithe den Chomhairle do chomóra agus leis na cruinnithe a comórfar amhlaidh agus le togha, le sealbhaíocht oifige, le comhachta, le dualgaisí, le príbhléidí, agus le luach saothair an Tiarna Mhéara.

Nós-imeachta ag cruinnithe.

7.—(1) Fé réir forálacha aon rialachán a bheidh déanta ag an Aire fé aon Acht agus a bheidh i bhfeidhm de thurus na huaire i dtaobh an nós-imeachta a leanfidh údaráis áitiúla maidir leis an ngnó do forchuireadh ortha no do haistríodh chúcha fé aon achtachán stiúrófar nós-imeachta na Comhairle ag á cruinnithe do réir bhuan-orduithe a dhéanfidh an Chomhairle chuige sin.

(2) Deichniúr ball den Chomhairle a bheidh mar quorum ag gach cruinniú den Chomhairle.

(3) Féadfidh an Chomhairle gníomhú d'ainneoin folúntais imeasc a ballra.

Feidhmeanna forchimeádtha.

8.—(1) Feidhmeoidh agus cólíonfidh an Chomhairle féin gach aon cheann riamh de chomhachta, d'fheidhmeanna agus de dhualgaisí an Bhárdais i dtaobh na nithe seo a leanas, sé sin le rá:—

(a) aon ráta do bhuala no aon airgead d'fháil ar iasacht;

[EN]

(b) aon fho-dhlí do dhéanamh, do leasú, no do cheiliúra;

[EN]

(c) aon ordú do dhéanamh agus aon rún do rith 'na ndéanfar dá mbua aon achtachán do chur i ngníomh sa Bhuirg no do chur i mbaint leis an mBuirg agus aon ordú den tsórt san do cheiliúra agus aon rún den tsórt san do chur ar neamh-ní;

(d) an t-iarratas a bheidh le déanamh chun aon údaráis maidir le haon ordú den tsórt san roimhráite do dhéanamh no do cheiliúra;

(e) aon ordú do dhéanamh no do cheiliúra fé alt 5 den Shops Act, 1912 (dá ngairmtear ordú um dhúna san Acht san);

(f) na comhachta a bronntar le halt 5 den Borough Funds (Ireland) Act, 1888, maidir le reachtúchán d'iarraidh no cur ina choinnibh, imeachta dlí do chur ar aghaidh agus cosaint do dhéanamh ionta, agus an ciste buirge, an ráta buirge no neachtar acu na cistí puiblí agus na rátaí puiblí fé chúram an Bhárdais do chur chun na gcrícheanna san;

(2) Fé réir forálacha an ailt seo féadfidh an tAire, le hordú, a cheangal ar an gComhairle féin comhachta, feidhmeanna agus dualgaisí an Bhárdais i dtaobh éinní ná fuil ar na nithe dá dtagartar sa bhfo-alt san roimhe seo d'fheidhmiú agus do chólíona agus ar bheith déanta don ordú san feidhmeoidh agus cólíonfidh an Chomhairle féin na comhachta, na feidhmeanna agus na dualgaisí sin ar an dáta agus ón dáta a bheidh luaidhte chuige sin san ordú san agus leanfid d'iad d'fheidhmiú agus do chólíona amhlaidh faid a bheidh an t-ordú san i bhfeidhm.

(3) Fé réir forálacha an ailt seo féadfidh an tAire ordú do dhin sé fén alt so do cheiliúra.

(4) Ní dhéanfidh ná ní cheiliúrfidh an tAire ordú fén alt so ach amháin ar a iarraidh sin ar an Aire don Chomhairle do réir rúin ón gComhairle—

(a) 'nar thug Cléireach an Bhaile fógra mí ar a laighead ina thaobh i scríbhinn do gach ball den Chomhairle, agus

[EN]

(b) le n-ar vótáil dhá dtrian ar a laighead de bhaill na Comhairle.

[EN]

(5) Ar fháil aon iarratais den tsórt san roimhráite don Aire féadfa sé, roimh ordú do dhéanamh no do cheiliúra (pe'ca aca é) fén alt so, fiosrúchán áitiúil do chur ar siúl, más oiriúnach leis é, i dtaobh aon nithe a chífar do a bhaineann le crích an ordú san do dhéanamh no do cheiliúra (pe'ca aca é) agus bainfidh forálacha Airtiogal 32 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, le gach fiosrúchán áitiúil den tsórt san.

(6) San Acht so cialluíonn an abairt “feidhmeanna forchimeádtha” comhachta, feidhmeanna agus dualgaisí an Bhárdais gur gá don Chomhairle féin do réir an ailt seo iad d'fheidhmiú agus do chólíona agus foluíonn sé comhachta, feidhmeanna agus dualgaisí eile an Bhárdais gur gá don Chomhairle aon uair, do réir ordú do dineadh fén alt so agus a bheidh i bhfeidhm de thurus na huaire, iad d'fheidhmiú agus do chólíona.

Bainisteoir Chathair Chorcaighe.

9.—(1) Ar an lá ceaptha agus dá éis sin déanfidh duine a bheidh ceaptha chuige sin leis an Acht so no fé agus ar a dtabharfar mar theideal agus mar ainm Bainisteoir Chathair Chorcaighe (dá ngairmtear an Bainisteoir san Acht so) feidhmiú agus cólíona, ar son agus thar ceann an Bhárdais, ar chomhachta, ar fheidhmeanna agus ar dhualgaisí an Bhárdais a bhaineann le hoifigigh agus le seirbhísigh don Bhárdas (agus Cléireach an Bhaile d'áireamh, ach gan an Bainisteoir d'áireamh) do cheapa agus do chur as oifig agus feidhmeoidh agus cólíonfa sé fós comhachta, feidhmeanna agus dualgaisí eile go léir an Bhárdais nách feidhmeanna forchimeádtha.

(2) Gach duine a bheidh ceaptha leis an Acht so no fé chun bheith ina Bhainisteoir beidh sé ina oifigeach don Bhárdas de bhua an cheaptha san.

An Bainisteoir do cheapa, etc.

10.—(1) Déanfar agus dintar leis seo Pilib O Muineacháin, an té chun ar haistríodh comhachta agus dualgaisí agus maoin an Bhárdais de bhua an Orduithe um Chontae-Bhuirg Chorcaighe (Scur), 1924, do cheapa chun bheith ina chéad Bhainisteoir agus glacfidh Pilib O Muineacháin sin oifig mar chéad Bhainisteoir ar an lá ceaptha.

(2) Aireofar oifig an Bhainisteora mar cheann de sna hoifigí le n-a mbaineann Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926 (Uimh. 39 de 1926).

(3) Chó luath agus is féidir é tar éis deire do bheith le tréimhse oifige an chéad Bhainisteora san (pe'ca tré n-a éag, tré n-a eirghe as no tré n-a chur as oifig do réir an ailt seo é) agus o am go hain ina dhiaidh sin fé mar a bheidh gá leis ceapfidh an Chomhairle duine ceart oiriúnach chun bheith ina Bhainisteoir agus is fé réir agus do réir forálacha an Achta san na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926, a déanfar gach ceapa den tsórt san.

(4) Beidh an Bainisteoir i seilbh oifige go héag no go heirghe as do no go dtí n-a chur as oifig.

(5) Ní dhéanfidh an Chomhairle an Bainisteoir do chur ar fiunraoi ná as oifig ach amháin—

(a) tré rún ón gComhairle a rithfar chun a churtha ar fiunraoi no as oifig amhlaidh (pe'ca aca é) le móráireamh nách lú ná dhá dtrian de sna baill den Chomhairle a bheidh i láthair agus a vótálfidh ag cruinniú den Chomhairle, rún gur tugadh fógra seacht lá ar a laighead ina thaobh do gach ball den Chomhairle, agus

(b) le cead an Aire i gcás an Bainisteoir do chur as oifig.

(6) Iocfidh an Chomhairle leis an mBainisteoir pé luach saothair a shocróidh an tAire o am go ham agus cruinneoidh an Chomhairle suim an luach saothair sin tríd an ráta gcéanna tré n-a gcruinneofar tuarastal Chléireach an Bhaile.

(7) Féadfidh an Bainisteoir na nithe agus na rudaí sin uile do dhéanamh, ar a n-áirítear connartha do dhéanamh ar son agus thar ceann an Bhárdais agus séala oifigiúil an Bhárdais do chur ar scríbhinní, is gá chun feidhmithe agus chun cólíonta no a bhaineann le feidhmiú agus le cólíona comhachta, feidhmeanna, agus dualgaisí an Bhárdais nách foláir don Bhainisteoir do réir an Achta so iad d'fheidhmiú agus do chólíona.

(8) Ní chuirfidh an Bainisteoir séala oifigiúil an Bhárdais ar aon scríbhinn ach amháin i láthair an Tiarna Mhéara.

Eolas do thabhairt don Tiarna Mhéara.

11.—(1) Pé uair a iarrfidh an Tiarna Méara air san do dhéanamh cuirfidh an Bainisteoir ar fáil don Tiarna Mhéara gach eolas a bheidh ar seilbh no ar fáil ag an mBainisteoir ar aon ghníomh, ní no rud a bhaineann le haon ghnó no eadarghnó de chuid an Bhárdais a bheidh luaidhte san iarratas san.

(2) I dtosach gach mí cuirfidh an Bainisteoir fé ndeár go n-ullamhófar agus tabharfa sé don Tiarna Mhéara agus do gach ball den Chomhairle cuntas ina dtaisbeánfar chó cruinn agus is féidir é conus a bhí an scéal ag an mBárdas i dtaobh airgeadais i ndeire an mhí roimhe sin.

Tabharfidh an Bainisteoir comhairle don Chomhairle.

12.—Beidh sé de dhualgas ar an mBainisteoir comhairle agus congnamh do thabhairt don Chomhairle go generálta maidir le hiad-san d'fheidhmiú agus do chólíona na bhfeidhmeanna forchimeádtha agus go sonnrách maidir le héinní no le haon rud a bhaineann leis an gComhairle d'fheidhmiú no do chólíona na bhfeidhmeanna forchimeádtha agus 'na n-iarrfidh an Chomhairle comhairle no congnamh ar an mBainisteoir ina thaobh.

13.—Beidh ag an mBainisteoir an ceart céanna do bheadh aige dá mba bhall den Chomhairle é chun bheith i láthair ag cruinnithe den Chomhairle agus chun páirt do thógaint i ndíospóireachtaí ag na cruinnithe sin ach ní bheidh teideal aige vóta do thabhairt uaidh ar aon cheist a tarraiceofar anuas ag aon chruinniú den tsórt san agus a bheidh le socrú le vóta o bhaill na Comhairle.

Smacht, etc., ar oifigigh agus ar sheirbhísigh an Bhárdais.

14.—(1) Déanfidh oifigigh agus seirbhísigh an Bhárdais (agus Cléireach an Bhaile d'áireamh) na dualgaisí a bheidh ortha mar oifigigh agus mar sheirbhísigh den tsórt san do chólíona do réir pé orduithe a thabharfidh an Bainisteoir o am go ham go generálta no maidir le cólíona aon dualgais áirithe no aon tsaghas no saghsanna áirithe dualgaisí no maidir le haon oifigeach no seirbhíseach áirithe don Bhárdas do chólíona aon dualgais den tsórt san agus beidh ag an mBainisteoir agus feidhmeoidh sé smacht agus lán-mhaoirseacht ar na hoifigigh agus ar na seirbhísigh sin agus ar gach gníomh agus imeacht a dhéanfid no a bheidh le déanamh acu go hoifigiúil mar oifigigh agus mar sheirbhísigh don Bhárdas.

(2) Fé réir fóralacha aon Achta no aon rialachán a bheidh déanta ag an Aire fé aon Acht agus a bheidh i bhfeidhm de thurus na huaire i dtaobh seirbhís, luach saothair, príbhléidí, no aois-liúntas (pe'ca aca é) oifigeacha agus seirbhíseacha údaráis áitiúla, breithneoidh agus socróidh an Bainisteoir gach ceist a eireoidh o am go ham i dtaobh seirbhís, luach saothair, príbhléidí agus aois-liúntas oifigeacha agus seirbhíseacha an Bhárdais.

Gníomhóidh an Bainisteoir tré ordú shighnithe.

15.—(1) Gach gníomh no rud a dhéanfidh an Bainisteoir agus gach breith a thabharfa sé chun no i dtaobh é féin d'fheidhmiú no do chólíona aon cheann de chomhachta, d'fheidhmeanna no de dhualgaisí an Bhárdais fén Acht so, eadhon, gníomh no rud no breith go mbeadh sé riachtanach, do réir aon achtacháin no fé, é do dhéanamh no do thabhairt tré rún o chomhairle bhuirge, chontae-bhuirge, no bhailecheanntair dá mb'í an chomhairle sin do dhéanfadh no do thabharfadh é déanfidh no tabharfidh an Bainisteoir tré n-a ordú shighnithe é.

(2) I gcás in ar gá do réir forálacha aon Achta no fútha aon fhógra puiblí do thabhairt sara rithfidh aon chomhairle den tsórt san roimhráite an rún tré n-a mbeidh aon ghníomh no rud den tsórt san le déanamh no aon bhreith den tsórt san le tabhairt no sara gcomórfar aon chruinniú den chomhairle sin ag á mbeidh an rún san le rith tabharfar fógra den tsórt chéanna sara ndéanfidh an Bainisteoir an gníomh no an rud san no sara dtabharfa sé an bhreith sin fén alt so.

(3) Cimeádfidh Cléireach an Bhaile, sa bhfuirm orduithe, clár no cláir ina n-iontrálfa sé, no 'na gcuirfe sé fé ndeár go n-iontrálfar ann, cóip de gach ordú a dhéanfidh an Bainisteoir fén alt so agus breacachán ar an am do dineadh an t-ordú san amhlaidh agus déanfidh Cléireach an Bhaile an clár no na cláir sin do thabhairt i láthair ag gach cruinniú den Chomhairle chun go bhféadfidh baill na Comhairle an céanna d'iniúcha.

(4) Déanfar cóip d'aon ordú den tsórt san roimhráite, a bheidh deimhnithe ag Cléireach an Bhaile agus ag an mBainisteoir a bheith ina chóip dhílis den ordú san, do ghlaca i ngach cúirt mar fhianaise air gur dineadh an t-ordú san agus ar a mbeidh san ordú san mara gcruthuítear a mhalairt.

(5) Déanfar cóip d'aon bhreacachán a bheidh in aon chlár a bheidh á chimeád fén alt so no d'aon iontráil ann a bheidh í féin ina chóip d'aon ordú den tsórt san roimhráite do ghlaca i ngach cúirt, má dheimhníonn Cléireach an Bhaile agus an Bainisteoir gur cóip dhílis í den bhreacachán no den iontráil sin (pe'ca aca é), mar fhianaise air gur dineadh an breacachán san agus ar a mbeidh sa bhreacachán san no (má sé is gá sa chás) gur dineadh an t-ordú le n-a mbaineann an iontráil sin agus ar a mbeidh san ordú san.

Iocaíochta d'údarú.

16.—(1) Féadfidh an Bainisteoir, le hordú fé n-a shighniú féin agus fé chontra-shighniú Chléireach an Bhaile, a údarú go n-íocfar aon íocaíocht amach as cistí an Bhárdais in aghaidh aon chostais no ar scór aon fhiachais fé n-ar chuaidh an Chomhairle no an Bainisteoir thar ceann an Bhárdais i bhfeidhmiú no i gcólíona do dhin an Chomhairle no an Bainisteoir ar aon cheann de chomhachta, d'fheidhmeanna, no de dhualgaisí an Bhárdais is infheidhmithe, no is ionchólíonta acu-san no aige-sean fén Acht so.

(2) Féadfidh an Tiarna Méara, aon uair, a ordú le scríbhinn fé n-a láimh go leagfí fé n-a bhráid chun a shighnithe gach ordú a déanfar fén bhfo-alt san roimhe seo ag údarú aon íocaíochta den tsórt a luaidhtear sa bhfo-alt san i rith a mbeidh gan caitheamh dá théarma oifige no i rith aon tréimhse níos giorra ná san a bheidh luaidhte san ordú san uaidh agus féadfidh an Tiarna Méara, le scríbhinn fé n-a láimh, aon ordú den tsórt san uaidh do cheiliúra aon uair i rith na tréimhse le n-a mbaineann an t-ordú san.

(3) Má thugann agus pé uair a thabharfidh an Tiarna Méara aon ordú den tsórt a luaidhtear sa bhfo-alt san roimhe seo, ansan, faid a bheidh an t-ordú san i bhfeidhm beidh sé riachtanach sighniú an Tiarna Mhéara do bheith ar gach ordú den tsórt a luaidhtear sa chéad fho-alt den alt so chó maith leis an sighniú agus leis an gcontra-shighniú a luaidhtear sa bhfo-alt san ach ní bheidh ar an Tiarna Méara, de dheascaibh a shighniú do bheith ar aon ordú den tsórt san, aon fhreagarthacht ná beadh air dá mba ná tabharfadh sé uaidh aon ordú den tsórt san roimhráite.

Meastachán ar chostaisí agus ráta-chruinniú.

17.—(1) Cuirfidh an Bainisteoir fé ndeár go n-ullamhófar gach bliain san am orduithe agus sa bhfuirm orduithe meastachán (dá ngairmtear an meastachán ar chostaisí san alt so) ag taisbeáint na suimeanna is dó leis is gá chun íoctha costaisí an Bhárdais agus mar sholáthar in aghaidh riachtanaisí an Bhárdais i rith na bliana airgeadais áitiúla dar gcionn.

(2) An meastachán ar chostaisí a hullamhófar gach bliain breithneoidh an Chomhairle é ag cruinniú den Chomhairle (dá ngairmtear ráta-chruinniú na Comhairle san alt so) ag á mbeidh an Bainisteoir i láthair agus a bheidh ann an t-am a bheidh orduithe chuige sin, go generálta no maidir le haon bhliain áirithe, ag an Aire agus 'na mbeidh fógra ceithre lá déag ar a laighead sa bhfuirm orduithe tugtha ina thaobh ag Cléireach an Bhaile do gach ball den Chomhairle.

(3) Cuirfidh Cléireach an Bhaile chun gach baill den Chomhairle gach bliain, ceithre lá déag ar a laighead roimh an dáta ar a mbeidh ráta-chruinniú na Comhairle le bheith ann, cóip den mheastachán ar chostaisí a bheidh le breithniú ag an gcruinniú san.

(4) Déanfidh Cléireach an Bhaile gach bliain, ceithre lá déag ar a laighead roimh an dáta ar a mbeidh ráta-chruinniú na Comhairle le bheith ann, cóip den mheastachán ar chostaisí do hullamhuíodh fén Acht so an bhliain sin do lóisteáil in oifigí na Comhairle chun go bhféadfidh an phuiblíocht í d'iniúcha agus san am gcéanna tabharfa sé fógra puiblí sa tslí agus sa bhfuirm orduithe go bhfuiltear tar éis an meastachán san ar chostaisí do dhéanamh agus go bhfuil sé tar éis cóip de do lóisteáil mar adubhradh.

(5) Féadfidh an phuiblíocht an chóip den mheastachán ar chostaisí do lóisteáladh fén alt so in oifigí na Comhairle d'iniúcha aon uair a bheidh na hoifigí sin ar oscailt chun gnó oifigiúil do dhéanamh agus san gan aon táille ná prémium d'íoc as an iniúcha san.

(6) Tabharfidh Cléireach an Bhaile cóip den mheastachán ar chostaisí ar scilling an chóip do gach duine a iarrfidh air í.

(7) Ag an ráta-chruinniú den Chomhairle a bheidh ann gach bliain breithneoidh an Chomhairle an meastachán ar chostaisí do hullamhuíodh chun go mbreithneoidís ag an gcruinniú san é agus féadfid é do leasú no d'atharú, agus déanfidh an Chomhairle, le rún, glaca leis an meastachán san ar chostaisí tar éis no gan é do leasú no d'atharú agus leis an rún gcéanna no le haon rún ina dhiaidh sin a rithfid ag an gcruinniú san socróid, do réir an mheastacháin sin mar a bheidh glactha acu leis amhlaidh, na rátaí fén bpunt a gearrfar chun na gcrícheanna uile agus fé seach a bheidh luaidhte sa mheastachán san.

(8) Má bheartuíonn an Chomhairle, ag aon ráta-chruinniú den Chomhairle, aon leasú no atharú do dhéanamh ar an meastachán ar chostaisí a bheidh á bhreithniú ag an gcruinniú san agus gur dó leis an mBainisteoir, dá gcuirtí an leasú no an t-atharú san in éifeacht, go ndéanfadh sé dochar mór do dhualgaisí an Bhárdais do chólíona go héifeachtúil no go heconomiciúil déarfidh an Bainisteoir ag an gcruinniú san cadiad na nithe atá aige i gcoinnibh an leasuithe no an atharuithe sin a bheidh beartuithe agus luadhfa sé na réasúin a bheidh leis an gcur-i-gcoinnibh sin agus ar dhéanamh an chur-i-gcoinnibh sin ní dhéanfidh an Chomhairle an leasú no an t-atharú san a bheidh beartuithe ar an meastachán ar chostaisí go ceann ceithre lá déag ón dáta ar ar dineadh an cur-i-gcoinnibh sin agus féadfidh an Chomhairle chun na críche sin an ráta-chruinniú san do chur ar athló.

An Bárdas do cheapa ball de chóluchtaí puiblí áirithe.

18.—(1) Na forálacha atá in aon reacht agus in aon ordú go bhfeidhm reachtúil agus tré n-ar gá éinne do thoghfadh no d'ainmneodh an Bárdas chun bheith ina bhall d'aon chólucht puiblí do bheith ina bhall de chomhairle chontae-bhuirg Chorcaighe, scuirfid, ar an lá ceaptha agus dá éis sin, d'éifeacht do bheith acu sa mhéid go mbainid leis an mBárdas agus ina n-ionad san achtuítear leis seo, maidir le héinne a thoghfidh no a ainmneoidh an Bárdas ar an lá ceaptha no dá éis sin chun bheith ina bhall d'aon chólucht puiblí agus gur ghá dho bheith ina bhall den chomhairle sin mara mbeadh an t-alt so, gurb é pé duine é, pe'ca ball den Chomhairle é no nách ea, is dó leis an mBárdas is oiriúnaighe chun bheith ina bhall den chólucht phuiblí sin mar gheall ar an eolas speisialta no ar an taithí atá aige ar na nithe a riarann an cólucht puiblí sin.

(3) Bíodh nách ball den Chomhairle an Bainisteoir beidh sé cáilithe agus féadfidh an Chomhairle é do cheapa chun bheith ina bhall de chó-choiste bhainistí Ospidéil Mheabhar-Ghalar Cheanntair Chorcaighe no den chólucht phuiblí 'na mbeidh fóirithint na mbocht sa Bhuirg de chúram ortha de thurus na huaire no chun bheith ina bhall den choiste sin agus den chólucht san díreach fé is dá mba bhall den Chomhairle é agus chun críche an cheaptha san tuigfar nách oifig shochair oifig an Bhainisteora do réir bhrí Airtiogal 12 den Local Government (Application of Enactments) Order, 1898.

(4) Má dintar agus nuair a déanfar an Bainisteoir do cheapa fén alt so chun bheith ina bhall de choiste bhainistí Ospidéil Mheabhar-Ghalar Cheanntair Chorcaighe no den chólucht phuiblí 'na mbeidh fóirithint na mbocht sa Bhuirg de chúram ortha de thurus na huaire, beidh duine níos lú ar líon na mball den choiste sin no den chólucht san (pe'ca aca é) nách foláir dóibh do réir dlí bheith ina mbaill den Chomhairle.

Leas-Bhainisteoir.

19.—(1) Má bhíonn agus pé uair a bheidh an Bainisteoir, toisc é bheith breoite, no as láthair ón mBuirg no curtha ar fiunraoi o chólíona a dhualgas, gan bheith ábalta, go sealadach. ar na comhachta agus na feidhmeanna a bronntar air leis an Acht so d'fheidhmiú agus ar na dualgaisí a cuirtar air leis an Acht so do chólíona, féadfar Leas-Bhainisteoir do cheapa fén alt so go dtí go mbeidh deire leis an neamh-ábaltacht san, ach le haontú an Aire féadfar é do chur as oifig fén alt so aon uair le linn na neamh-ábaltachta san.

(2) Más é bheith as láthair ón mBuirg fé ndeár neamh-ábaltacht an Bhainisteora féadfidh an Bainisteoir comhacht ceaptha an Leas-Bhainisteora fén alt so d'fheidhmiú, tar éis dul i gcomhairle leis an Tiarna Méara, roimh an neamh-ábaltacht agus ag coinne léi dho, ach i ngach cás eile, sé sin le rá, más breoiteacht no cur-ar-fiunraoi fé ndeár neamh-ábaltacht an Bhainisteora agus fós más é bheith as láthair ón mBuirg fé ndeár neamh-ábaltacht an Bhainisteora agus ná ceapfar Leas-Bhainisteoir fén alt so roimh an neamh-ábaltacht san no, ar bheith ceaptha amhlaidh do, go gcuirfar as oifig fén alt so é le linn na neamh-ábaltachta san féadfidh an Tiarna Méara ach ní fhéadfidh éinne eile comhacht ceaptha an Leas-Bhainisteora fén alt so d'fheidhmiú aon uair le linn na neamh-ábaltachta san.

(3) I ngach cás féadfidh an Tiarna Méara agus ní fhéadfidh éinne eile comhacht curtha an Leas-Bhainisteora as oifig fén alt so d'fheidhmiú.

(4) Beidh ag an Leas-Bhainisteoir, faid a leanfidh an neamhábaltacht gur ceapadh é dá dheascaibh no go dtí go gcuirfar as oifig níos túisce ná san fén alt so é, comhachta uile an Bhainisteora agus feidhmeoidh agus cólíonfa sé feidhmeanna agus dualgaisí uile an Bhainisteora agus chuige sin léireofar mar thagairt a fholuíonn an Leas-Bhainisteoir gach tagairt san Acht so don Bhainisteoir (lasmuich de sna tagairtí don Bhainisteoir san alt so agus de sna tagairtí san Acht so do cheapa, do shealbhaíocht oifige agus do luach saothair an Bhainisteora).

20.—I ngach aicsean no imeacht eile dlí, síbhialta no coiriúil, a bhunóidh an Bárdas no a bunófar ina choinnibh in aon chúirt dlí no chothruim gníomhóidh an Bainisteoir ar son agus thar ceann an Bhárdais agus féadfa sé gach gníomh, ní no rud do dhéanamh is gá dar leis chun an t-aicsean no an t-imeacht eile sin d'ullamhú agus do chur ar aghaidh no do chosaint ar gach slí díreach fé is dá mb'é féin an gearánaí no an cosantóir (pe'ca aca is gá sa chás) ann agus má bhaineann aon aicsean no imeacht eile den tsórt san leis an gComhairle d'fheidhmiú no do chólíona aon cheann de sna feidhmeanna forchimeádtha gníomhóidh an Bainisteoir le húdarás soiléir na Comhairle agus é ag déanamh aon ghnímh, ní no ruda den tsórt san roimhráite agus tuigfar gur tugadh an t-údarás san do mara gcruthuítear agus go dtí go gcruthófar a mhalairt.

Achtacháin d'oiriúnú.

21.—(1) Féadfidh an tAire, le hordú, pé oiriúnuithe agus atharuithe, a chífar do a bheith riachtanach no oiriúnach chun an tAcht so do chur in éifeacht, do dhéanamh ar aon Acht áitiúil no ordú a bhaineann leis an mBuirg agus atá i bhfeidhm anois no ar aon achtachán, pe'ca roimh rith an Achta so no dá éis sin do ritheadh é, a bhaineann go generálta le buirgí, le contae-bhuirgí, no le bailecheanntair no le comhairlí buirgí, contae-bhuirgí no bailecheanntar, agus ar dhéanamh an orduithe sin bainfidh an t-achtachán gur dineadh an t-ordú ina thaobh leis an mBuirg no leis an gComhairle no neachtar acu leis an mBuirg agus leis an gComhairle (pe'ca aca é), sa mhéid go mbaineann an t-achtachán san leis an mBuirg no leis an mBárdas no neachtar acu leis an mBuirg agus leis an mBárdas, fé réir na n-oiriúnuithe agus na n-atharuithe (más ann dóibh) air do dineadh leis an ordú san.

CORK CITY MANAGEMENT ACT, 1929.


AN ACT TO MAKE PROVISION FOR THE MANAGEMENT OF THE ADMINISTRATIVE AND FINANCIAL BUSINESS OF THE COUNTY BOROUGH OF CORK AND FOR OTHER MATTERS INCIDENTAL TO SUCH MANAGEMENT OR IN CONNECTION THEREWITH. [23rd February, 1929.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTAT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act, save where the context otherwise requires, the following words and expressions shall have the meanings hereinafter assigned to them respectively, that is to say:—

the word “Minister” means the Minister for Local Government and Public Health;

[GA]

the expression “the Corporation” means the Lord Mayor, Aldermen and Burgesses of Cork;

[GA]

the expression “the Borough” means the county borough of Cork;

[GA]

the expression “the Council” means the Council of the Borough as constituted from time to time under this Act;

[GA]

the expression “the Manager” means the Cork City Manager appointed by this Act or by the Council in accordance with the provisions of this Act;

[GA]

the expression “the Town Clerk” means the town clerk of the Borough;

[GA]

the expression “borough election” means an election of members of the Council, and

[GA]

the word “prescribed” means prescribed by the Minister.

[GA]

Vesting of powers, etc., in the Corporation.

2.—(1) The Cork County Borough (Dissolution) Order, 1924, whereby the council of the county borough of Cork was dissolved shall remain in force until the appointed day and shall then cease to have effect.

(2) All the property of the council of the county borough of Cork which by virtue of the Cork County Borough (Dissolution) Order, 1924, was transferred to the person named in that behalf in the said Order shall on the appointed day vest in the Corporation.

(3) The powers, functions and duties of the council of the county borough of Cork which by virtue of the Order herein before mentioned are at the date of the passing of this Act exercised and performed by the person named in that behalf in the said Order shall as on and from the appointed day become and be powers, functions and duties of the Corporation and all and every of the powers, functions and duties which shall by or under the provisions of any Act passed after the passing of this Act be conferred and imposed on the said council shall as on and from the date on which such powers, functions and duties are so conferred and imposed respectively become and be powers, functions and duties of the Corporation.

(4) Whenever by or under any Act passed after the passing of this Act any powers, functions or duties are conferred or imposed on the council of a borough, county borough, or urban district such powers, functions and duties in so far as they relate to the council of the county borough of Cork, shall as on and from the date on which they are so conferred and imposed respectively become and be powers, functions and duties of the Corporation.

(5) All and every of the powers, functions and duties of the Corporation shall be exercised and performed for and on behalf of the Corporation by the council or the manager (as the case may require) subject to and in accordance with the provisions of this Act.

(6) Notwithstanding anything contained in the Local Elections (Dissolved Authorities) Act, 1926 (No. 22 of 1926), no election of members of the council of the county borough of Cork shall be held in pursuance of sub-section (1) of section 2 of the said Act.

Borough elections.

3.—(1) A borough election shall be held in the year 1929 and in every year thereafter and at every borough election the Borough shall form one electoral area.

(2) Twenty-one members of the Council shall be elected at the borough election to be held in the year 1929 and the term of office of the members elected at that election shall, subject to the provisions of this Act in relation to persons appointed to fill casual vacancies, be as follows, that is to say:—

(a) the first seven members so elected shall hold office until the fifth day after the borough election held in the year 1932,

[GA]

(b) the next seven members so elected shall hold office until the fifth day after the borough election held in the year 1931, and

[GA]

(c) the remaining seven members so elected shall hold office until the fifth day after the borough election held in the year 1930.

[GA]

(3) Seven members of the Council shall be elected at every borough election held after the year 1929.

[GA]

(4) In the year 1929 the borough election shall be held on a day to be fixed by the Minister, and in every subsequent year the borough election shall be held on such day, not being earlier than the 23rd day of June or later than the 1st day of July, as shall be fixed by the Corporation.

(5) Subject to the provisions of this Act in relation to the persons appointed to fill casual vacancies, every member of the Council elected at a borough election held in any year subsequent to the year 1929 shall, unless he sooner dies, resigns, or becomes disqualified hold his office as such member until the fifth day after the borough election held in the third year after the year in which he is elected and, unless previously re-elected, shall then retire from office as such member.

(6) Subject to the foregoing provisions of this section, the law for the time being in force in relation to the election of councillors of county boroughs and to the qualification of persons for such election shall apply to every borough election and to the qualification of persons for membership of the Council in like manner as it applies to the election of councillors of county boroughs and to the qualification of persons for such election.

(7) Save as is otherwise provided by this Act, the law for the time being in force in relation to the qualification of persons for membership of any committee appointed by a council of a county borough or of any joint committee partly appointed by any such council shall apply to the qualification of persons for membership of any committee appointed by the council or of any joint committee partly appointed by the council.

(8) For the purposes of the two next preceding sub-sections a contract with the Corporation shall be deemed to be a contract with the Council and with every committee and joint committee appointed or partly appointed by the Council and a contract with any such committee or joint committee shall be deemed to be also a contract with the Council.

Casual vacancies.

4.—(1) In this Act the expression “casual vacancy” means a vacancy in the membership of the Council caused by the death, resignation or disqualification of a member thereof.

(2) Where a casual vacancy occurs in the Council by reason of the death, resignation or disqualification of any member thereof other than a member whose term of office would, but for such death, resignation or disqualification, have continued until the fifth day following the borough election to be held under this Act next after the occurrence of such casual vacancy there shall be elected at such borough election a member of the Council additional to the seven members thereof otherwise required by this Act to be elected at such election and such additional member shall, unless he sooner dies, resigns or becomes disqualified hold office for the residue of the term for which the member whose death, resignation or disqualification occasioned the vacancy would have held office if he had not died, resigned or become disqualified.

(3) The last person elected as a member of the Council at a borough election at which a casual vacancy is by this section required to be filled shall be chosen to fill such vacancy and where more than one casual vacancy is required to be filled at such election the eighth person elected thereat shall be chosen to fill whichever of those vacancies is then to be filled for the longest period of time and so on.

(4) The Council may in their absolute discretion by resolution passed for that purpose after one week's notice to every member of the Council determine to fill by co-option in accordance with this sub-section the casual vacancy to which such resolution relates, and upon such resolution being passed the Council may either at the meeting at which such resolution was passed or any subsequent meeting thereof elect by the votes of a simple majority of the members of the Council present and voting at such meeting a person to fill such casual vacancy.

(5) Every person chosen in pursuance of the provisions of the foregoing sub-section to fill a casual vacancy shall unless he sooner dies, resigns, or becomes disqualified hold office until the day on which the borough election to be held under this Act next after the occurrence of the casual vacancy so filled is so held.

Constitution, etc., of the Borough Council.

5.—(1) The Council shall at any time and from time to time after the appointed day consist of the members thereof elected whether before or after the appointed day in accordance with the provisions of this Act whose terms of office are then unexpired.

(2) The first two members of the Council elected at the borough election to be held in the year 1929 and the first two members of the Council elected at every borough election held after the year 1929 shall be aldermen.

[GA]

(3) Every member of the Council other than a member who by virtue of the foregoing provisions of this section is an alderman shall be a councillor.

[GA]

First meeting of the Council and election of Lord Mayor.

6.—(1) The first meeting of the Council shall be a quarterly meeting and shall be held at noon on the appointed day.

(2) The Council shall at their first meeting and at the quarterly meeting thereof held next after every borough election elect one of their members to be the Lord Mayor of Cork (in this Act referred to as the Lord Mayor).

(3) The Lord Mayor shall continue in office until his successor shall have been elected at the quarterly meeting of the Council at which having regard to the provisions of the foregoing sub-section a Lord Mayor may be elected by the Council and such successor shall have made the declaration accepting office which is by the law for the time being in force in relation to the election of the Lord Mayor or Mayor of a county borough required to be made by a Lord Mayor-elect or Mayor-elect.

(4) The Town Clerk shall be the chairman of the first meeting of the Council until the Lord Mayor has been elected and has made the declaration aforesaid.

(5) The Town Clerk shall not be entitled to vote on any question which is to be decided at the first meeting of the Council by a vote of the members of the Council.

[GA]

(6) Subject to the provisions of this section, the law for the time being in force in relation to the holding of quarterly meetings of the council of a county borough and to the meetings so held and to the election, tenure of office, powers, duties, privileges and remuneration of the Lord Mayor or the Mayor of a county borough shall apply to the holding of quarterly meetings of the Council and to the meetings so held and to the election, tenure of office, powers, duties, privileges and remuneration of the Lord Mayor.

Procedure at meetings.

7.—(1) Subject to the provisions of any regulations made by the Minister under any Act and for the time being in force respecting the procedure of local authorities in connection with the business imposed on or transferred to them under any enactment the procedure of the Council at its meetings shall be conducted in accordance with standing orders made by the Council for that purpose.

(2) Ten members of the Council shall constitute a quorum at every meeting thereof.

[GA]

(3) The Council may act notwithstanding a vacancy in its membership.

[GA]

Reserved functions.

8.—(1) The Council shall directly exercise and perform all and every of the powers, functions and duties of the Corporation in relation to the following matters, that is to say:—

(a) the making of any rate or the borrowing of any moneys;

[GA]

(b) the making, amending or revoking of any bye-law;

[GA]

(c) the making of any order and the passing of any resolution by virtue of which any enactment is brought into operation in or made to apply to the Borough and the revoking of any such order and the rescinding of any such resolution;

[GA]

(d) the application to be made to any authority in respect of the making or revoking of any such order as aforesaid;

[GA]

(e) the making or revoking of any order under section 5 of the Shops Act, 1912 (in that Act referred to as a closing order);

[GA]

(f) the powers conferred by section 5 of the Borough Funds (Ireland) Act, 1888, in relation to the promotion or the opposing of legislation, the prosecution and defence of legal proceedings, and the application for those purposes of the borough fund, borough rate or other the public funds and rates under the control of the Corporation;

[GA]

(g) the appointment or election of any person to be a member of any public body;

[GA]

(h) parliamentary and local elections;

[GA]

(i) the admission of persons to the freedom of the City of Cork;

[GA]

(j) subject to the provisions of this Act, the appointment, suspension and removal of the Manager and the granting of an allowance or gratuity to the Manager on his ceasing to be the Manager; and

[GA]

(k) the determination of the amount of the salary and remuneration of the Lord Mayor.

[GA]

(2) The Minister may, subject to the provisions of this section, by order require that the powers, functions and duties of the Corporation in relation to any matter not included in the matters referred to in the foregoing sub-section shall be exercised and performed directly by the Council and upon such order being made the said powers, functions and duties shall as on and from the date specified in that behalf in such order be exercised and performed directly by the Council and shall continue so to be exercised and performed while such order remains in force.

(3) The Minister may, subject to the provisions of this section, revoke an order made by him under this section.

[GA]

(4) The Minister shall not make or revoke an order under this section save upon the application of the Council made to the Minister in pursuance of a resolution of the Council—

(a) of which not less than one month's notice shall have been given in writing by the Town Clerk to every member of the Council, and

[GA]

(b) for which not less than two-thirds of the members of the Council shall have voted.

[GA]

(5) Upon receipt by him of any such application as aforesaid the Minister, before (as the case may be) making or revoking an order under this section, may, if he thinks fit, hold a local inquiry into any matters which appear to him to be relevant to the purpose of (as the case may be) making or revoking such order and the provisions of Article 32 of the Schedule to the Local Government (Application of Enactments) Order, 1898, shall apply to every such local inquiry.

(6) In this Act the expression “reserved functions” means the powers, functions and duties of the Corporation which are by this section required to be exercised and performed by the Council directly and includes all other powers, functions and duties of the Corporation which are at any time required by an order made under this section and for the time being in force to be exercised and performed by the Council.

The Cork City Manager.

9.—(1) On and after the appointed day a person appointed for the purpose by or under this Act who shall be called and known as the Cork City Manager (in this Act referred to as the Manager) shall exercise and perform for and on behalf of the Corporation the powers, functions and duties of the Corporation in relation to the appointment and removal of officers and servants of the Corporation (including the Town Clerk, but not including the Manager) and shall also exercise and perform all other the powers, functions and duties of the Corporation other than the reserved functions.

(2) Every person appointed by or under this Act to be the Manager shall by virtue of such appointment be an officer of the Corporation.

[GA]

Appointment, etc., of the Manager.

10.—(1) Philip Monahan, the person to whom the powers and duties and the property of the Corporation were transferred by virtue of the Cork County Borough (Dissolution) Order, 1924, shall be and is hereby appointed to be the first Manager and the said Philip Monahan shall take office as the first Manager on the appointed day.

(2) The office of the Manager shall be included in the offices to which the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926), applies.

[GA]

(3) As soon as may be after the termination of the office of the said first Manager (whether by his death, resignation or removal from office in accordance with this section) and from time to time thereafter as occasion may require the Council shall appoint a fit and proper person to be the Manager and every such appointment shall be made subject to and in accordance with the provisions of the said Local Authorities (Officers and Employees) Act, 1926.

(4) The Manager shall hold office until he dies, resigns or is removed from office.

[GA]

(5) The Manager shall not be suspended or removed by the Council save—

[GA]

(a) by a resolution of the Council passed for the purpose of such suspension or such removal (as the case may be) by a majority of not less than two-thirds of the members of the Council present and voting at a meeting thereof of which resolution not less than seven days' notice shall have been given to every member of the Council, and

[GA]

(b) in the case of the removal of the Manager, with the sanction of the Minister.

[GA]

(6) There shall be paid by the Council to the Manager such remuneration as the Minister shall from time to time determine and the amount of such remuneration shall be raised by the Council by the same rate as the rate by which the salary of the Town Clerk is raised.

(7) The Manager may do all such matters and things, including the making of contracts for and on behalf of the Corporation and the affixing of the official seal of the Corporation to documents, as may be necessary for or incidental to the purpose of exercising and performing the powers, functions and duties of the Corporation which are by this Act required to be exercised and performed by the Manager.

(8) The Manager shall not affix the official seal of the Corporation to any document save in the presence of the Lord Mayor.

[GA]

(9) Every reference contained in this Act to the Manager save and except the reference contained in this section to the appointment of the Manager by the Council shall be construed as including the first Manager.

[GA]

Furnishing of information to the Lord Mayor.

11.—(1) The Manager shall, whenever requested by the Lord Mayor so to do, afford to the Lord Mayor all such information as may be in the possession or procurement of the Manager in regard to any act, matter or thing appertaining to or concerning any business or transaction of the Corporation which is mentioned in such request.

(2) At the beginning of every month the Manager shall cause to be prepared and shall furnish to the Lord Mayor and every member of the Council a statement showing as nearly as may be the actual financial position of the Corporation at the end of the previous month.

Manager to advise the Council.

12.—It shall be the duty of the Manager to advise and assist the Council generally in regard to the exercise and performance by them of the reserved functions and in particular in regard to any matter or thing in relation to the exercise or performance by the Council of the reserved functions on or in respect of which the Council requests the advice or assistance of the Manager.

Attendance, etc., of Manager at meetings of the Council.

13.—The Manager shall have the same right to attend meetings of the Council and to take part in discussions at such meetings as if he were a member of the Council, but he shall not be entitled to vote on any question raised at any such meeting which is to be decided by a vote of the members of the Council.

Control, etc., of officers and servants of the Corporation.

14.—(1) The officers and servants of the Corporation (including the Town Clerk) shall perform their duties as such officers and servants in accordance with such directions as the Manager may from time to time give either generally or in regard to the performance of any particular duty or any particular class or classes of duties or in regard to the performance of any such duty by any particular officer or servant of the Corporation and the Manager shall have and exercise control and full supervision of and over such officers and servants and of and over every act and proceeding done or to be done by them in their official capacity of officers and servants of the Corporation.

(2) Subject to the provisions of any Act or any regulations made by the Minister under any Act and for the time being in force in relation to the service, remuneration, privileges, or superannuation (as the case may be) of the officers and servants of a local authority, the Manager shall consider and decide all such questions as may from time to time arise in relation to the service, remuneration, privileges and superannuation of the officers and servants of the Corporation.

Manager to act by signed order.

15.—(1) Every act or thing done and every decision taken by the Manager for the purpose of or in connection with the exercise or performance by him under this Act of any of the powers, functions or duties of the Corporation being an act or thing or a decision which, if done or taken by the council of a borough, county borough, or urban district would be required by or under any enactment to be done or taken by a resolution of such council shall be done or taken by the Manager by his signed order.

(2) Where by or under the provisions of any Act any public notice is required to be given before the passing by any such council as aforesaid of the resolution by which any such act or thing or any such decision is to be done or taken or before the holding of any meeting of such council at which such resolution is to be passed the like notice shall be given before the doing of such act or thing or the taking of such decision under this section by the Manager.

(3) The Town Clerk shall keep in the prescribed form a register or registers in which he shall enter or cause to be entered a copy of every order made under this section by the Manager and a record of the time when such order was so made and the said register or registers shall be produced by the Town Clerk at every meeting of the Council for the inspection of the members thereof.

(4) A copy of any such order as aforesaid which is certified by the Town Clerk and by the Manager to be a true copy of such order shall be received in all courts as evidence of the fact that such order was made and of the contents of such order unless the contrary is shown.

(5) A copy of any record contained in any register kept under this section or of any entry therein which is itself a copy of any such order as aforesaid shall if certified by the Town Clerk and the Manager to be a true copy of such record or such entry (as the case may be) be received in all courts as evidence either (as the case may require) of the fact that such record was made and of the contents thereof or of the fact that the order to which such entry relates was made and of the contents of such order.

Authorisation of payments.

16.—(1) The Manager may by order signed by him and counter-signed by the Town Clerk authorise the making of any payment out of the funds of the Corporation in respect of any expense or on account of any liability incurred by the Council or the Manager on behalf of the Corporation in the exercise or the performance by the Council or the Manager of any of the powers, functions or duties of the Corporation which are exercisable or performable by them or him under this Act.

(2) The Lord Mayor may at any time direct by writing under his hand that every order made under the foregoing sub-section authorising any such payment as is mentioned in that sub-section during the unexpired residue of his term of office or during any lesser period specified in such direction shall be submitted to him for his signature and the Lord Mayor may by writing under his hand revoke any such direction at any time during the period to which the same relates.

(3) If and whenever the Lord Mayor gives any such direction as is mentioned in the foregoing sub-section then while such direction remains in force the signature of the Lord Mayor shall be necessary on every such order as is mentioned in the first sub-section of this section in addition to the signature and counter-signature mentioned in that sub-section but the Lord Mayor shall not by reason of the fact of his signature being on any such order incur any liability to which he would not have been liable if he had not given any such direction as aforesaid.

Estimate of expenses and rates meeting.

17.—(1) The Manager shall cause to be prepared in each year at the prescribed time and in the prescribed form an estimate (in this section referred to as the estimate of expenses) showing the amounts which in his opinion will be necessary to meet the expenses and provide for the requirements of the Corporation during the local financial year then next ensuing.

(2) The estimate of expenses prepared in each year shall be considered by the Council at a meeting thereof (in this section referred to as the rates meeting of the Council) at which the Manager shall be present held at the time prescribed in that behalf either generally or in regard to any particular year by the Minister and of which not less than fourteen days' notice in the prescribed form shall have been given by the Town Clerk to every member of the Council.

(3) The Town Clerk shall in each year not less than fourteen days before the date on which the rates meeting of the Council is to be held send to every member of the Council a copy of the estimate of expenses to be considered at the said meeting.

(4) In each year the Town Clerk shall, not less than fourteen days before the date on which the rates meeting of the Council is to be held, deposit in the offices of the Council for inspection by the public a copy of the estimate of expenses prepared under this Act in that year and shall at the same time give public notice in the prescribed manner and form of the fact that such estimate of expenses has been made and that a copy thereof has been deposited by him as aforesaid.

(5) The copy of the estimate of expenses deposited under this section in the offices of the Council may be inspected by the public at any time at which the said offices are open for the transaction of official business and without the payment of any fee or premium for such inspection.

(6) The Town Clerk shall supply to every person making application to him therefor a copy of the estimate of expenses at a cost of one shilling per copy.

[GA]

(7) The Council shall at the rates meeting of the Council held in every year consider and may amend or modify the estimate of expenses prepared for their consideration at such meeting and the Council shall by resolution adopt such estimate of expenses either with or without amendment or modification and shall by the same or any subsequent resolution passed by them at such meeting determine in accordance with such estimate as so adopted the rates in the pound to be levied for the several purposes specified in such estimate.

(8) Where the Council at any rates meeting of the Council propose to make any amendment or modification in or of the estimate of expenses considered at such meeting which in the opinion of the Manager would, if carried into effect, seriously prejudice the efficient or economic performance of the duties of the Corporation the Manager shall at such meeting make his objections to such proposed amendment or modification and shall state the reasons for such objection and, upon such objection being made, the Council shall not make such proposed amendment or modification in or of the estimate of expenses until after the expiration of fourteen days from the date on which such objection was made and the Council may for that purpose adjourn such rates meeting.

Appointment by the Corporation of members of certain public bodies.

18.—(1) On and after the appointed day the provisions contained in any statute and in any order having statutory force whereby any person who is elected or nominated by the Corporation to be a member of any public body is required to be a member of the council of the county borough of Cork shall in so far as those provisions apply to the Corporation cease to have effect and in lieu thereof it is hereby enacted that any person who is on or after the appointed day elected or nominated by the Corporation to be a member of any public body and who but for this section would be required to be a member of the said council shall be such person, whether a member of the Council or not a member of the Council, as the Corporation, by reason of his special knowledge or practical experience of the matters administered by such public body, consider best fitted for membership thereof.

(2) Nothing in the foregoing sub-section shall operate to render unnecessary—

[GA]

(a) the possession by any person who is on or after the appointed day elected or nominated by the Corporation to be a member of any public body of any special qualifications (other than membership of the council of the county borough of Cork) which such person is now required by law to possess, or

[GA]

(b) compliance with the requirements of sub-section (2) of section 9 of the Local Government (Ireland) Act, 1898, so far as the said sub-section (2) as adapted, amended or applied by or under any Act of the Oireachtas relates to membership of the joint committee of management of the Cork District Mental Hospital, or

[GA]

(c) compliance with the provisions of any County Scheme prepared under the Local Government (Temporary Provisions) Act, 1923 (No. 9 of 1923).

(3) The Manager, notwithstanding that he is not a member of the Council, shall be qualified and may be appointed by the Council to be a member of the joint committee of management of the Cork District Mental Hospital or of the public body for the time being entrusted with the relief of the poor in the Borough or a member both of such committee and such body in the same manner as if he were a member of the Council, and for the purpose of such appointment the office of the Manager shall be deemed not to be an office of profit within the meaning of Article 12 of the Local Government (Application of Enactments) Order, 1898.

(4) If and when the Manager is appointed under this section to be a member of the committee of management of the Cork District Mental Hospital or of the public body for the time being entrusted with the relief of the poor in the Borough, the number of members of the said committee or the said body (as the case may be) who are required by law to be members of the Council shall be reduced by one.

Deputy Manager.

19.—(1) If and whenever the Manager is through illness, absence from the Borough, or suspension from performance of his duties, temporarily incapable of exercising the powers and functions and performing the duties conferred and imposed on him by this Act, a Deputy Manager may be appointed under this section for the duration of such incapacity but may with the consent of the Minister be removed under this section at any time during such incapacity.

(2) Where the incapacity of the Manager is due to absence from the Borough, the power of appointing the Deputy Manager under this section may be exercised by the Manager, after consultation with the Lord Mayor, before and in contemplation of the incapacity, but in every other case, that is to say, where the incapacity of the Manager is due to illness or suspension and also where the incapacity of the Manager is due to absence from the Borough and a Deputy Manager is not appointed under this section before such incapacity or having been so appointed is removed under this section during such incapacity, the power of appointing the Deputy Manager under this section shall be exercisable at any time during such incapacity by the Lord Mayor only.

(3) In every case the power of removing the Deputy Manager under this section shall be exercisable by the Lord Mayor only.

(4) The Deputy Manager shall during the continuance of the incapacity on account of which he is appointed or until he is sooner removed under this section have all the powers and shall exercise and perform all the functions and duties of the Manager and for that purpose all references in this Act to the Manager (other than the references to the Manager in this section and the references in this Act to the appointment, tenure of office and remuneration of the Manager) shall be construed as including the Deputy Manager.

(5) There shall be paid by the Council to the Deputy Manager such remuneration (if any) as the Minister shall determine and the amount of such remuneration shall be raised by the Council by means of the same rate as the rate by which the salary of the Town Clerk is raised.

Legal proceedings.

20.—In every action or other legal proceeding, whether civil or criminal, instituted in any court of law or equity by or against the Corporation the Manager shall act for and on behalf of the Corporation and may do all such acts, matters or things as he may consider necessary for the preparation and prosecution or defence of such action or other proceeding in the same manner in all respects as if (as the case may require) he were the plaintiff or the defendant therein and where any such action or other proceeding relates to the exercise or the performance by the Council of any of the reserved functions the Manager shall in the doing of any such act, matter or thing as aforesaid act with the express authority of the Council which authority shall be deemed to have been given unless and until the contrary is shown.

Adaptation of enactments.

21.—(1) The Minister may by order make such adaptations and modifications of and in any local Act or order relating to the Borough and now in force or of and in any enactment whether passed before or after the passing of this Act relating generally to boroughs, county boroughs or urban districts or the councils of boroughs, county boroughs, or urban districts as appear to the Minister to be necessary or expedient for the purpose of carrying this Act into effect and upon such order being made the enactment to which it relates shall in so far as such enactment relates to the Borough or the Corporation or to the Borough and the Corporation apply to the Borough or the Council or the Borough and the Council (as the case may be) subject to the adaptations thereof and the modifications (if any) therein made by such order.

(2) Where it appears to the Minister that any local Act in force at the date of the passing of this Act contains provisions which are similar to or inconsistent with the provisions of this Act the Minister may by order declare that the provisions thereof specified in such order shall not apply in or in relation to the Borough and upon such other being made the provisions specified in that behalf therein shall not apply in or in relation to the Borough.

(3) The provisions of any Act (including any local Act) or of any order in force at the passing of this Act in or in relation to the Borough shall, on and after the passing of this Act, but subject to the provisions of any order adapting or modifying such enactment made by the Minister under this section and for the time being in force, be construed with such modifications as may be necessary to give effect to this Act.

The appointed day.

22.—(1) The Minister may appoint a day to be the appointed day for the purposes of this Act.

(2) All references in this Act to the appointed day shall be construed and have effect as references to the day appointed under this section by the Minister.

Short title.

23.—This Act may be cited as the Cork City Management Act, 1929.
