AGRICULTURE (AMENDMENT) ACT, 1980

The Principal Act.

1.—In this Act “the Principal Act” means the Agriculture Act, 1931, as amended by subsequent enactments.

Appointment of committees of agriculture.

2.—(1) Each council of a county shall, at the next meeting of the council held after a date to be determined by the Minister for Agriculture for the purpose of this section, appoint a committee of agriculture for the county in accordance with the provisions of the Second Schedule to the Principal Act.

(2) The term of office of every member of a committee of agriculture so appointed shall commence at the termination of the meeting at which he is appointed and every such member shall, unless he sooner dies, resigns or becomes disqualified, hold office until the next annual meeting of the council at which the council is required by the Principal Act to appoint (other than to fill a casual vacancy) members of such committee.

(3) The term of office of every person who is a member of a committee of agriculture for a county immediately before the commencement of the meeting referred to in subsection (1) of the council of that county, shall end upon such commencement.

Consequential provision.

3.—The meeting referred to in section 2 (1) of each council of a county shall—

(a) for the purposes of the Principal Act, be deemed to be an annual meeting of such council held in an election year and

(b) for the purposes of section 26 (2) of the Agriculture (An Chomhairle Oiliúna Talmhaíochta) Act, 1979, be deemed to be the annual meeting referred to therein.

Short title and collective citation.

4.—(1) This Act may be cited as the Agriculture (Amendment) Act, 1980.

(2) The Agriculture Acts, 1931 to 1974, and this Act may be cited together as the Agriculture Acts, 1931 to 1980.

An Príomh-Acht.

1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht Talmhaíochta, 1931, arna leasú le hachtacháin ina dhiaidh sin.

Coistí talmhaíochta a cheapadh.

2.—(1) Déanfaidh gach comhairle contae, ag an gcéad chruinniú eile den chomhairle a thionólfar tar éis dáta a chinnfidh an tAire Talmhaíochta chun críche an ailt seo, coiste talmhaíochta don chontae a cheapadh de réir fhorálacha an Dara Sceideal a ghabhann leis an bPríomh-Acht.

(2) Tosóidh téarma oifige gach comhalta de choiste talmhaíochta a cheapfar amhlaidh ag deireadh an chruinnithe ag a gceapfar é agus beidh gach comhalta den sórt sin i seilbh oifige, mura túisce a éagfaidh sé, a éireoidh sé as oifig nó a thiocfaidh sé faoi dhícháilíocht, go dtí an chéad chruinniú bliantúil eile den chomhairle a gceanglaítear ar an gcomhairle leis an bPríomh-Acht comhaltaí de choiste den sórt sin a cheapadh aige (seachas chun corrfholúntas a líonadh).

(3) Gach duine ar comhalta de choiste talmhaíochta do chontae é díreach roimh thosach an chruinnithe dá dtagraítear i bhfo-alt (1) de chomhairle an chontae sin críochnóidh a théarma oifige ar thosú don chruinniú sin.

Foráil iarmhartach.

3.—An cruinniú dá dtagraítear in alt 2 (1) de gach comhairle contae—

(a) measfar, chun críocha an Phríomh-Achta, gur cruinniú bliantúil de chuid na comhairle sin é a thionólfar i mbliain toghcháin agus

(b) measfar, chun críocha alt 26 (2) den Acht Talmhaíochta (An Chomhairle Oiliúna Talmhaíochta), 1979, gurb é an cruinniú bliantúil dá dtagraítear ansin é.

Gearrtheideal agus comhlua.

4.—(1) Féadfar an tAcht Talmhaíochta (Leasú), 1980, a ghairm den Acht seo.

(2) Féadfar na hAchtanna Talmhaíochta, 1931 go 1980, a ghairm de na hAchtanna Talmhaíochta, 1931 go 1974, agus den Acht seo le chéile.
