1.—San Acht so—
cialluíonn an abairt “an Príomh-Acht” an Diseases of Animals Act, 1894, agus, i ngach cás ina gceaduíonn no ina n-éilíonn an có-théacs é, foluíonn sé na hAchtanna uile (ar a n-áirmhítear an tAcht so) le n-a leasuítear no le n-a leathnuítear an Diseases of Animals Act, 1894;
cialluíonn an abairt “Acht 1934” an tAcht Eanlaithe Clóis (Galair), 1934 (Uimh. 25 de 1934);

2.—(1) Deintear leis seo an míniú atá ar an abairt “éanlaithe clóis” in alt 1 d'Acht 1934 do leasú tré sna focail “lachain, géana” do chur isteach i ndiaidh an fhocáil “turcaithe”, agus is dá réir sin a léireofar an abairt “éanlaithe clóis” in Acht 1934 (le n-a n-áirmhítear Acht 1934 mar a leasuítear é leis an alt so) agus san Acht so.
(2) Cialluíonn an abairt “uibhe éanlaithe clóis” in Acht 1934 (le n-a n-áirmhítear Acht 1934 mar a leasuítear é leis an alt so) agus san Acht so uibhe bheireann éanlaithe clóis.
(3) Leasuítear leis seo alt 2 d'Acht 1934 sna slite seo leanas agus léireofar é agus beidh éifeacht aige dá réir sin, sé sin le rá:—
(a) tré sna focail “a bheidh beartuithe a úsáid mar uibhe guir” do scriosadh amach as mír (c) den alt san agus tré sna focail “i gcoitinne no gus na heisceachtaí sin is oiriúnach leis an Aire Talmhaidheachta” do chur in ionad na bhfocal a scriostar amach amhlaidh;
(b) tríd an mír seo leanas do chur in ionad míre (d) den alt san, sé sin le rá:—
“(d) chun toirmeasc no srianadh agus rialáil do dhéanamh maidir le huibhe éanlaithe clóis, pe'ca laistigh no lasmuich den Stát a táirgfear iad, d'aistriú agus d'úsáid laistigh den Stát”.

3.—(1) Pé uair agus chó minic agus is oiriúnach leis é, féadfaidh an tAire, le hordú (dá ngairmtear ordú fiunraíochta san alt so), a dhearbhú go scuirfidh, aon ordú áirithe bheidh déanta fén bPríomh-Acht de bheith i ngníomh faid a bheidh an t-ordú fiunraíochta san i bhfeidhm, agus pé uair a déanfar ordú fiunraíochta, ansan, ar dháta an orduithe fhiunraíochta san do theacht i bhfeidhm agus ón dáta san amach, scuirfidh an tOrdú fén bPríomh-Acht le n-a mbainfidh an tordú fiunraíochta san de bheith i ngníomh faid a bheidh an t-ordú fiunraíochta san i bhfeidhm.
(2) Féadfaidh an tAire le hordú fén bhfo-alt so ordú fiunraíochta do cheiliúradh, agus leis sin tiocfaidh an tOrdú fén bPríomh-Acht le n-a mbainfidh an t-ordú fiunraíochta san i ngníomh arís ar dháta an orduithe sin a céad-luaidhtear do theacht i bhfeidhm agus beidh sé i ngníomh ón dáta san amach.

4.—(1) Pé uair a hiomportálfar aon ainmhithe, éanlaithe clóis, uibhe éanlaithe clóis no earraí eile de shaghas ar bith contrárdha d'ordú ar n-a dhéanamh fén bPríomh-Acht, féadfaidh oifigeach Custum agus Máil a cheangal ar dhuine ar bith (eadhon, an t-iomportálaí no an t-iompróir a bheidh i gceist) na hainmhithe, na héanlaithe clóis, na huibhe éanlaithe clóis no na hearraí eile sin d'easportáil laistigh d'am áirithe, agus má theipeann ar an duine sin déanamh do réir an cheangail sin beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil chaoga punt do chur air.
(2) Féadfaidh na Coimisinéirí Ioncuim cionta fén alt so do chúiseamh.

DISEASES OF ANIMALS, ACT, 1938.
Definitions.
1.—In this Act—
the expression “the Principal Act” means the Diseases of Animals Act, 1894, and where the context so permits or requires, includes all Acts (including this present Act) amending or extending the Diseases of Animals Act, 1894;
the expression “the Act of 1934” means the Poultry (Diseases) Act, 1934 (No. 25 of 1934);
the expression “the Minister” means the Minister for Agriculture.
Amendment of the Act of 1934.
2.—(1) The definition of the word “poultry” contained in section 1 of the Act of 1934 is hereby amended by the insertion after the word “turkeys”, of the words “ducks, geese”, and the word “poultry” in the Act of 1934 (including the Act of 1934, as amended by this section) and this Act shall be construed accordingly.
(2) The expression “poultry eggs” in the Act of 1934 (including the Act of 1934, as amended by this section) and this Act means eggs of poultry.
(3) Section 2 of the Act of 1934 is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say:—
(a) by the deletion in paragraph (c) of the said section of the words “intended to be used for hatching” and the substitution, in lieu of the words so deleted, of the words “either generally or with such exceptions as the Minister for Agriculture thinks fit”;
(b) by the substitution of the following paragraph in lieu of paragraph (d) of the said section, that is to say:.—
“(d) for prohibiting or restricting and regulating the movement and use within the State of poultry eggs, whether produced within or without the State”.
Suspension of operation of orders under the Principal Act.
3.—(1) The Minister may, whenever and so often as he thinks fit, by order (in this section referred to as a suspensory order) declare that any specified order made under the Principal Act shall, so long as such suspensory order remains in force, cease to be in operation, and whenever a suspensory order is made then, as on and from the date on which such suspensory order comes in force, the Order under the Principal Act to which such suspensory order relates shall, so long as such suspensory order remains in force, cease to be in operation.
(2) The Minister may by order under this sub-section revoke a suspensory order, and thereupon, as on and from the date on which such first-mentioned order comes into force, the Order under the Principal Act to which such suspensory order relates shall again come into operation.
Export of articles imported in contravention of an order under the Principal Act.
4.—(1) Whenever any animals, poultry, poultry eggs or other articles of whatsoever kind are imported in contravention of an order made under the Principal Act, an officer of Customs and Excise may require any person (being the importer or the carrier concerned) to export such animals, poultry, poultry eggs or other articles within a specified time, and if such person fails to comply with such requisition he shall be guilty of an offence under this section and be liable on summary conviction thereof to a fine of fifty pounds.
(2) An offence under this section may be prosecuted by the Revenue Commissioners.
Short title and collective citation.
5.—This Act may be cited as the Diseases of Animals Act, 1938, and the Diseases of Animals (Ireland) Acts, 1894 to 1935, and this Act may be cited together as the Diseases of Animals (Ireland) Acts, 1894 to 1938.
