ACHT DRÉINEÁLA AIRTÉIRIGHE (MION-SCÉIMEANNA), 1928.
Mínithe.
1.—(1) San Acht so—
cialluíonn an focal “an tAire” an tAire Rialtais Áitiúla agus Sláinte Puiblí;
foluíonn an focal “dréineáil” dréineáil le taosca, ina aonar no maraon le slite eile, agus is dá réir sin a léireofar gach focal atá gaolmhar leis;
ní fholuíonn an focal “contae” contae-bhuirg;
cialluíonn an focal “orduithe” orduithe ag an Aire tré rialacháin a bheidh déanta fén Acht so.
(2) I ngach tagairt san Acht so do thailte a dréineáladh no a moltar a dhréineáil, no do thailte a feabhsuíodh no a tairbhíodh le dréineáil no a moltar a fheabhsú no a thairbhiú amhlaidh, folóidh an focal “tailte” tailte, foirgintí agus áitreabhacha de gach saghas.
Achuinghe chun oibreacha dréineála do dhéanamh.
2.—(1) Aon triúr no níos mó, eadhon, sealbhairí tailte atá i mbaol a dtuilithe no a ndíobhála o uisce no is féidir a fheabhsú le dréineáil nách dréineáil iomlán, no daoine gur ar iontaoibh no chun tairbhe dhóibh atá aon tailte den tsórt san ar seilbh ag á sealbhairí, féadfid, aon uair laistigh de chúig bliana tar éis rithte an Achta so ach ní níos déanaí ná san, a iarraidh ar chomhairle na contae no ar chomhairlí fé seach na gcontaethe ina luíonn na tailte sin a chur fé ndeár go ndéanfar oibreacha dréineála fén Acht so chun na tailte sin do dhréineáil no d'fheabhsú.
(2) Gach iarratas fén alt so chun comhairle contae no chun comhairlí fé seach dhá chontae no níos mó is le hachuinghe a tíolacfar chun na comhairle sin no chun gach comhairle fé leith de sna comhairlí sin (fé mar a bheidh) a déanfar é agus beidh gach achuinghe den tsórt san i scríbhinn sa bhfuirm orduithe agus déarfar inti i dtéarmaí generálta cadiad na hoibreacha dréineála a moltar léi a dhéanamh agus beidh ráiteas inti o sna hachuingheoirí nách mó ná míle punt an costas iomlán a bhainfidh leis na hoibreacha dréineála san do dhéanamh chó fada le n-a n-eolas agus le n-a dtuairim.
An chomhairle chontae do bhreithniú na hachuinghe.
3.—(1) Déanfidh gach comhairle chontae dá dtíolacfar achuinghe fén Acht so laistigh de chúig bliana tar éis rithte an Achta so an achuinghe sin do chur fé bhráid an tsuirbheura chontae chun a thuarasgabháil d'fháil ar thréithe generálta na molta a bheidh san achuinghe agus ar an gcostas iomlán is dócha a bhainfidh leis na hoibreacha dréineála a bheidh luaidhte sna molta san do dhéanamh.
(2) Chun tuarasgabháil den tsórt san roimhráite do dhéanamh beidh teideal ag an suirbhéir contae agus ag á chongantóirí chun dul isteach gach tráth réasúnta ar na tailte dá dtagartar san achuinghe agus ar pé tailte eile ina gcomhursanacht san is dó leis-sean no leo-san is gá agus fós in aon áitreabh ar aon tailte den tsórt san agus pé lorgaireachtaí agus nithe do dhéanamh san áit sin a chífar do-san no dhóibh-sean a bheith riachtanach chun an tuarasgabháil sin do dhéanamh.
(3) Ar fháil tuarasgabháil an tsuirbheura chontae ar an achuinghe sin dóibh breithneoidh an chomhairle an achuinghe sin agus an tuarasgabháil sin ag cruinniú gur tugadh fógra seacht lá ar a luíod ina thaobh do gach ball fé leith agus—
(a) maran mó ná míle punt an tsuim adéarfar sa tuarasgabháil sin is dócha a chosnóidh sé ar fad ná hoibreacha dréineála do dhéanamh a bheidh molta san achuinghe sin agus más féidir éifeacht do thabhairt do sna molta a bheidh san achuinghe sin gan aon cheann d'fhorálacha an Achta so do shárú, féadfidh an chomhairle, fé mar is oiriúnach leo, rún do rith á rá go bhfuilid sásta leis na molta atá san achuinghe agus ag socrú ar iad do chur i ngníomh fén Acht so no rún do rith á rá ná fuilid sásta leis na molta san, no
(b) más mó ná míle punt an tsuim adéarfar sa tuarasgabháil sin is dócha a chosnóidh sé ar fad na hoibreacha dréineála do dhéanamh a bheidh molta san achuinghe sin no maran féidir éifeacht do thabhairt do sna molta a bheidh san achuinghe sin gan foráil éigin den Acht so do shárú, féadfidh an chomhairle rún do rith go n-áireofar an achuinghe agus an tuarasgabháil mar achuinghe agus mar thuarasgabháil do dineadh fén Acht Dréineála Airtéirighe, 1925 (Uimh. 33 de 1925) no rún do rith á rá ná fuilid sásta leis na molta san.
(4) Má tíolactar achuinghe do chomhairlí dhá chontae no níos mó fén Acht so féadfidh na comhairlí sin cur le chéile chun an achuinghe sin do bhreithniú agus, in ionad an achuinghe do chur fé bhráid suirbheura chontae gach contae fé leith acu, féadfid an achuinghe do chur fé bhráid suirbheura chontae aon chontae amháin acu agus sa chás san féadfidh gach comhairle acu gníomhú fén alt so do réir tuarasgabháil an tsuirbheura chontae sin.
(5) In ionad an achuinghe sin do chur fé bhráid suirbheura chontae, féadfidh aon chomhairle chontae no roinnt comhairlí contae le chéile an achuinghe sin do chur fé bhráid innealtóra cháilithe éigin eile a ainmneoidh an chomhairle no na comhairlí sin, agus sa chás san déanfar gach tagairt do shuirbhéir chontae san alt so do léiriú agus beidh éifeacht aici mar thagairt don innealtóir cháilithe sin agus íocfar luach saothair an innealtóra cháilithe sin amach as ciste contae na comhairle no, i pé cionúireachtaí a shocróidh an tAire mara gcó-aontuítear ortha, amach as cistí contae uile agus fé seach na gcomhairlí a cheap an t-innealtóir sin.
Tuarasgabhála fén Acht Dréineála Airtéirighe, 1925.
4.—I ngach tuarasgabháil a dhéanfidh suirbhéir contae no innealtóir cáilithe eile, laistigh de chúig bliana tar éis rithte an Achta so, fé alt 3 den Acht Dréineála Airtéirighe, 1925 (Uimh. 33 de 1925), beidh tuarasgabháil ar ce'ca is mó no nách mó ná míle punt an tsuim is dócha a chosnóidh sé ar fad na hoibreacha dréineála do dhéanamh a bheidh luaidhte sna molta le n-a mbaineann an tuarasgabháil agus, maran mó, cé méid is dócha a chosnóidh sé ar fad, agus pé uair adéarfidh aon tuarasgabháil den tsórt san nách mó ná míle punt an tsuim is dócha a chosnóidh sé ar fad na hoibreacha dréineála san do dhéanamh tuigfar gur tíolacadh agus gur dineadh go cuibhe fén Acht so an tuarasgabháil sin agus an achuinghe gur ina thaobh a dineadh an tuarasgabháil sin agus bainfidh an tAcht so leis an gcás dá réir sin.
Scéim dhréineála d'ullamhú.
5.—(1) Pé uair a tíolacfar go cuibhe no a tuigfar gur tíolacadh achuinghe fén Acht so d'aon chomhairle chontae amháin agus a rithfidh an chomhairle sin go cuibhe fén Acht so rún á rá go bhfuil sí sásta leis na molta atá san achuinghe sin agus ag socrú ar iad do chur i ngníomh fén Acht so déanfidh an chomhairle sin scéim dhréineála chun cuspóirí na molta san do chur in éifeacht, d'ullamhú agus (má daingnítear í) do chur i ngníomh do réir an Achta so.
(2) Pé uair a tíolacfar go cuibhe no a tuigfar gur tíolacadh achuinghe fén Acht so do dhá chomhairle chontae no níos mó agus a rithfidh gach comhairle acu go cuibhe fén Acht so rún á rá go bhfuil sí sásta leis na molta atá san achuinghe sin agus ag socrú ar iad do chur i ngníomh fén Acht so, déanfidh na comhairlí sin uile eatorra tré chó-choiste a cheapfid chuige sin fén Acht so scéim dhréineála, chun cuspóirí na molta san do chur in éifeacht, d'ullamhú agus (má daingnítear í) do chur i ngníomh do réir an Achta so.
(3) Ní dhéanfidh aon chomhairle chontae ina haonar aon scéim dhréineála d'ullamhú ná do chur i ngníomh le n-a moltar aon oibreacha dréineála do dhéanamh no aon tailte do dhréineáil no d'fheabhsú lasmuich de chontae na comhairle sin agus ní dhéanfidh aon chó-choiste comhairlí contae aon scéim dhréineála d'ullamhú ná do chur i ngníomh le n-a moltar aon oibreacha dréineála do dhéanamh no aon tailte do dhréineáil no d'fheabhsú lasmuich de chontaethe na gcomhairlí sin.
(4) Ní dhéanfidh aon chomhairle chontae ná có-choiste comhairlí contae aon scéim dhréineála d'ullamhú ná do chur i ngníomh le n-a moltar aon chur isteach ar oibreacha aon cheanntair dhréineála do ceapadh do réir forálacha na Navigation (Ireland) Acts, 1842 to 1857, no na Drainage and Improvement of Lands (Ireland) Acts, 1863 to 1892, no an Achta Dréineála Airtéirighe, 1925 (Uimh. 33 de 1925), no ar thailte, ar chirt agus ar mhaoin eile aon údaráis áitiúla, gan cead an údaráis sin, no ar chomhachta, ar thailte, ar chirt, agus ar mhaoin eile aon chóluchta go mbeidh sé de chúram air gnó loingseoireachta aon abhann do rialú no gur leis aon chanáil, gan cead an chóluchta san.
Eifeacht rún áirithe.
6.—Más rud é, ar bhreithniú achuinghe agus tuarasgabhála dhóibh fén Acht so, go ndéanfidh an chomhairle chontae no na comhairlí contae uile dar tíolacadh an achuinghe sin rún do rith go cuibhe go n-áireofar an achuinghe agus an tuarasgabháil mar achuinghe agus mar thuarasgabháil do dineadh fén Acht Dréineála Airtéirighe, 1925 (Uimh. 33 de 1925), tuigfar gur tíolacadh agus gur dineadh an achuinghe agus an tuarasgabháil go cuibhe fén Acht san agus bainfidh an tAcht san leis an gcás dá réir sin.
(2) Más rud é, ar bhreithniú achuinghe agus tuarasgabhála dhóibh fén Acht so, go rithfidh comhairle chontae go cuibhe rún á rá ná fuilid sásta leis na molta atá san achuinghe sin cuirfidh rúnaí na comhairle sin an rún san in úil do sna hachuingheoirí.
Fuirm scéime dréineála agus an t-eolas a bheidh inti.
7.—(1) Beidh gach scéim dhréineála sa bhfuirm orduithe agus beidh ceangailte dhi gach mapa, tarraiceoireacht, plean, gcarra, agus sceideal (más ann dóibh) a hordófar agus taisbeánfar inti sa tslí orduithe gach ní agus rud dá dtagartar san Acht so mar ní no mar rud a socrófar leis an scéim dhréineála no adéarfar inti agus gach ní agus rud eile a hordófar.
(2) Luadhfar sa scéim an costas iomlán is dócha a bhainfidh leis an scéim dhréineála do chur i ngníomh agus ní ragha sé thar suim míle punt agus más rud é tar éis scrúdú cuibhe do dhéanamh, gur deimhin leis an gcomhairle chontae no leis an gcó-choiste ar a mbeidh sé de chúram scéim dhréineála d'ullamhú nách féidir scéim do chur le chéile a thabharfidh éifeacht réasúnta do sna molta a bheidh in achuinghe iarrtha na scéime sin agus is féidir a chur i ngníomh ar mhéid is dócha is costas iomlán agus a bheidh gan dul thar suim míle punt, faisnéisfidh an chomhairle no an coiste sin nách féidir na molta san do chur i ngníomh fén Acht so agus leis sin eireofar as gach imeacht fén achuinghe sin ach san gan dochar d'imeachta tré achuinghe fén Acht so ag iarraidh scéime dréineála nua i gcóir na háite céanna.
(3) Má eirítear as scéim dhréineála fén alt so déanfar na costaisí fé n-ar chuaidh an chomhairle chontae no an có-choiste in ullamhú na scéime sin agus ina thaobh sarar heiríodh aisti d'íoc (do réir mar bheidh) amach as ciste contae na comhairle sin no, i pé cionúireachtaí a shocróidh an tAire mara gcó-aontuítear ortha amach as cistí contae uile agus fé seach na gcomhairlí contae a cheap an có-choiste sin.
Fógraí i dtaobh agus agóidí i gcoinnibh na scéime.
8.—Laistigh den aimsir orduithe tar éis ullamhú na scéime dréineála do chríochnú déanfidh an chomhairle chontae no an có-choiste ar a raibh sé de chúram an scéim d'ullamhú—
(a) cóip den scéim dhréineála do lóisteáil in oifig na comhairle contae sin no in oifig gach ceann de sna comhairlí contae a cheap an có-choiste sin (pe'ca aca é) agus fós in áit eacrach ag no in aice le ionad na n-oibreacha dréineála a moltar a dhéanamh fén scéim dhréineála, agus
(b) gach cóip den scéim dhréineála a lóisteálfar amhlaidh do chimeád ar nochta chun a hiniúchta ag éinne gach tráth réasúnta i rith na haimsire a bheidh orduithe chun agóidí i gcoinnibh na scéime do chur chun na comhairle contae no an chó-choiste sin, agus
(c) fógra sa bhfuirm orduithe do sheirbheáil sa tslí orduithe ar gach duine atá ina shealbhaire ar thailte a moltar sa scéim a dhréineáil no a fheabhsú, i dtaobh ullamhú na scéime agus i dtaobh na lóisteála san agus i dtaobh na caoi sin chun cóipeanna dhi d'iniúcha agus i dtaobh na haimsire orduithe (nách giorra ná lá is fiche o sheirbheáil an fhógra) gur laistigh di a féadfar agus i dtaobh na slí ina bhféadfar agóidí i gcoinnibh na scéime do chur chun na comhairle contae no an chóchoiste sin, agus fós a cheangal ar gach sealbhaire den tsórt san leis an bhfógra gcéanna no le fógra fé leith (pe'ca aca a bheidh orduithe), agus san sa bhfuirm agus sa tslí orduithe, a chur in úil don chomhairle chontae no don chó-chiste sin laistigh d'aimsir áirithe (is ionann agus an aimsir chun agóidí do chur chun na comhairle no an choiste sin), agus sa tslí orduithe, ce'ca aontuíonn sé leis an scéim no ná haontuíonn, agus
(d) má moltar leis an scéim dhréineála aon tailte, cirt, no maoin eile do thógaint, fógra sa bhfuirm orduithe do sheirbheáil sa tslí orduithe ar gach duine atá, no atá in ainm bheith, ina únaer no ina léasaí, no atá ina shealbhaire, ar na tailte, ar na cirt agus ar an maoin eile sin, i dtaobh ullamhú na scéime agus i dtaobh na lóisteála san agus i dtaobh na caoi sin chun cóipeanna dhi d'iniúcha agus i dtaobh na haimsire orduithe (nách giorra ná lá is fiche o sheirbheáil an fhógra) gur laistigh di a féadfar agus i dtaobh na slí ina bhféadfar agóidí i gcoinnibh na scéime dréineála do chur chun na comhairle contae no an chó-choiste sin, agus fós, leis an bhfógra gcéanna no le fógra fé leith (pe'ca aca a bheidh orduithe), agus san sa bhfuirm orduithe, a chur in úil do gach éinne atá, no atá in ainm bheith, ina únaer no ina léasaí amhlaidh, no atá ina shealbhaire amhlaidh, go moltar leis an scéim talamh no ceart éigin no maoin éigin eile (maoin a tuairisceofar go hiomlán sa bhfógra) atá dá chuid féin no ar seilbh aige do thógaint.
Scéim dhréineála do dhaingniú.
9.—(1) Má bhíonn an méid suimithe adeirtar sa scéim dhréineála is fiú pé méid, de sna tailte go moltar leis an scéim iad do dhréineáil no d'fheabhsú, atá ar seilbh ag daoine a bheidh tar éis a chur in úil go cuibhe don chomhairle chontae no don chó-choiste (pe'ca aca é) ná haontuíd leis an scéim, má bhíonn sé níos mó ná leath an mhéide iomláin adeirtar sa scéim is fiú na tailte a moltar amhlaidh a dhréineáil no a fheabhsú, diúltóidh an chomhairle chontae no an có-choiste don scéim do dhaingniú, ach maran mó an méid suimithe sin ná leath an mhéide iomláin sin, ansan, tar éis na hagóidí (más ann dóibh) do cuireadh chucha go cuibhe i gcoinnibh na scéime dréineála fén Acht so do bhreithniú agus pé daoine (más ann dóibh) d'éisteacht a cheanglann an t-alt so ortha d'éisteacht, déanfidh an chomhairle chontae no an có-choiste (pe'ca aca é), pé ní acu so is rogha leo, eadhon, an scéim do dhaingniú gan í atharú no an scéim do dhaingniú tar éis pé atharuithe (pe'ca tré chur leis no fágaint ar lár no aon atharú eile é) is oiriúnach leo do dhéanamh uirthi, no diúltú don scéim do dhaingniú.
(2) Bainfidh na forálacha so a leanas le daingniú fén alt so o chomhairle chontae no o chó-choiste ar scéim dhréineála agus le diúltú don daingniú san do dhéánamh, sé sin le rá:—
(a) ní déanfar an daingniú ná an diúltú san ach ag cruinniú den chomhairle chontae no den chó-choiste gur cuireadh fógra seacht lá ar a luighead ina thaobh chun gach baill den chomhairle chontae no den chó-choiste agus fós, sa bhfuirm agus sa tslí orduithe, chun na puiblíochta, á rá go mbreithneofí daingniú na scéime ag an gcruinniú,
(b) sa bhfógra don phuiblíocht i dtaobh an chruinnithe sin, déarfar go bhféadfidh éinne, ar a ngoilleann an scéim dhréineála no atá ina coinnibh bona fide teacht chun an chruinnithe sin agus go n-éistfidh an chomhairle no an coiste é,
(c) gach éinne a thiocfidh chun an chruinnithe sin agus adéarfidh go ngoilleann an scéim dhréineála air no go bhfuil sé ina coinnibh agus 'nar mian leis go n-éistfí é, éistfidh an chomhairle no an coiste é mara bhfeictar dóibh a ghearán no a agóid do bheith suaibhreosach no gan bheith ann ach leathscéal chun toirmisc,
(d) féadfar an cruinniú do chur ar athló o am go ham fémar a bheidh riachtanach no oiriúnach,
(e) mara ndintar daingniú na scéime, tar éis no gan í atharú, do rith ag an gcruinniú san le móráireamh glan de bhaill uile na comhairle contae sin no an chó-choiste sin tuigfar gur dhiúltuigh an chomhairle no an coiste sin don scéim dhréineála do dhaingiú.
(3) Nuair a bheidh scéim dhréineála daingnithe go cuibhe ag comhairle chontae no ag có-choiste, tar éis no gan í atharú seirbheálfidh an chomhairle chontae no an có-choiste sin, laistigh den aimsir orduithe, ar na daoine orduithe agus sa bhfuirm agus sa tslí orduithe fógra go bhfuil an scéim daingnithe.
(4) Nuair a dhiúltóidh comhairle chontae no có-choiste go cuibhe no a tuigfar gur dhiúltuíodar do scéim dhréineála do dhaingniú eireofar as an scéim sin agus ní déanfar a thuille ina taobh ach beidh san gan dochar d'imeachta tré achuinghe rén Acht so ag iarraidh scéime dréineála nua i gcóir na háite céanna.
(5) Na costaisí fé n-a raghaidh comhairle chontae no có-choiste in ullamhú agus i ndaingniú scéime dréineála agus ina dtaobh, déanfar, pe'ca daingneofar an scéim sin fén alt so no ná daingneofar, iad d'íoc (do réir mar bheidh) amach as ciste contae na comhairle sin no, i pé cionúireachtaí a shocróidh an tAire mara gcó-aontuítear ortha, amach as cistí contae uile agus fé seach na gcomhairlí contae a cheap an có-choiste sin.
(6) Beidh daingniú scéime dréineála fén alt so ina fhianaise dho-chlaoite gur cólíonadh maidir leis an scéim sin na nithe is gá do réir an Achta so agus gur dineadh an scéim sin go cuibhe agus go bhfuil sí laistigh de sna comhachta a bronntar leis an Acht so.
(7) Déanfar tagairtí san Acht so do scéim dhréineála maidir le haon rud a bheidh le déanamh no le tuitim amach aon uair tar éis daingniú na scéime sin fén alt so do léiriú mar thagairtí don scéim sin agus í daingnithe amhlaidh.
Scéim dhréineála do chur i ngníomh.
10.—Nuair a bheidh scéim dhréineála daingnithe go cuibhe fén Acht so déanfidh an chomhairle chontae no déanfar tríd an gcóchoiste (pe'ca aca é) d'ullamhuigh an scéim sin an scéim sin (maraon le pé curtha-léi, fágaintí-ar-lár, atharuithe agus claonta amach uaithi a bheidh réasúnta agus a gheobhfar, i gcúrsa na hoibre, a bheith riachtanach) do chur i ngníomh do réir an Achta so.
Talamh do thógaint chun crícheanna scéime dréineála.
11.—(1) Aon chomhairle chontae no có-choiste ar a mbeidh sé de chúram scéim dhréineála do chur i ngníomh fén Acht so, féadfid aon uair tar éis daingniú na scéime sin, tré chó-aontú no go héigeanta agus chun crícheanna na scéime sin, aon tailte, cirt no maoin eile do thógaint adéarfar sa scéim sin a bheith ceaptha le tógaint, agus chun críche na tógainte sin tuigfar go bhfuil ionchorparuithe i ngach scéim dhréineála na hAchtanna Clásanna Talmhan mar atáid leasuithe leis an Dara Sceideal a ghabhann leis an Housing of the Working Classes Act, 1890, le halt 11 den Housing of the Working Classes (Ireland) Act, 1908, le hailt 7 agus 12 den Housing (Ireland) Act, 1919, agus leis an Acquisition of Land (Assessment of Compensation) Act, 1919, agus bainfidh na hAchtanna san leis an gcás dá réir sin.
(2) Gach maoin a thógfidh có-choiste fén alt so leithleofar agus dílseofar í do chomhairle chontae na contae ina luíonn an mhaoin sin, agus is dá réir sin a dreachtófar leithliú na maoine sin no an admháil no an scríbhinn eile le n-a ndéanfar an leithliú agus coinneoidh an chomhairle sin an mhaoin sin ina seilbh ar iontaoibh chu crícheanna na scéime dréineála.
Cáinmheasa ráta dhréineála.
12.—(1) Nuair a bheidh na hoibreacha dréineála uile a bheidh le déanamh fé scéim dhréineála críochnuithe agus a bheidh an scéim curtha i ngníomh go hiomlán, déanfidh an chomhairle chontae no an có-choiste ar a mbeidh sé de chúram fén Acht so an scéim sin do chur i ngníomh a chur fé ndeár go ndéanfidh luachálaí talmhan no suirbhéir talmhan inniúil a cheapfid féachaint ar na tailte a moltar sa scéim a dhréineáil no a fheabhsú agus go ndéanfidh an luachálaí no an suirbhéir sin tuarasgabháil do thabhairt dóibh i dtaobh críochnú na n-oibreacha san agus cur na scéime i ngníomh agus i dtaobh na méideanna do méaduíodh luachanna bliantúla fé seach na dtailte sin tríd an scéim do chur i ngníomh.
(2) Ar bhreithniú na tuarasgabhála san agus ar bheith sásta go bhfuil an scéim dhréineála curtha i ngníomh go hiomlán agus tar éis caoi réasúnta do thabhairt do sna daoine le n-a mbaineann san ar an tuarasgabháil sin d'iniúcha agus ar éisteacht d'fháil ina taobh, déanfidh an chomhairle chontae no an có-choiste a ndeimhniú do thabhairt amach á dheimhniú gur cuireadh an scéim i ngníomh go hiomlán agus ag deimhniú na méideanna fé seach do méaduíodh luachanna bliantúla fé seach na dtailte sin tríd an scéim do chur i ngníomh, ag féachaint do sna tairbhí nách miste bheith ag súil le n-a dteacht do sna tailte sin dá bharr san.
(3) Déanfar sealbhairí na dtailte uile agus fé seach a moltar sa scéim dhréineála a dhréineáil no a fheabhsú do chur fé cháinmheas an ráta dhréineála go rátúil do réir an mhéide (dá ngairmtear an cáinmheas dréineála san Acht so) a dheimhneoidh an chomhairle chontae no an có-choiste amhlaidh a méaduíodh luach bliantúil na dtailte ar seilbh acu tríd an scéim do chur i ngníomh.
(4) Gach deimhniú a thabharfidh có-choiste amach fén alt so deimhneoidh sé i dtaobh contae gach ceann de sna comhairlí contae a cheap an coiste sin méid iomlán na gcáinmheas ndréineála ar thailte sa chontae sin.
(5) Pé uair is gá aon roinnt do dhéanamh ar fhiachas no ar oblagáid, roimh dheimhniú do thabhairt amach fén alt so, idir dhá chomhairle chontae no níos mó, eadhon, roinnt is gá, do réir an Achta so no fén Acht so, do dhéanamh do réir na gcáinmheas ndréineála n-iomlán ar thailte i gcontaethe fé seach na gcomhairlí sin, déanfar an roinnt sin do réir na méideanna iomlána 'na ndéarfar sa scéim súil do bheith le hiad do chur, tré chur na scéime i ngníomh, le luachanna bliantúla tailte a moltar sa scéim a dhréineáil no a fheabhsú sna contaethe sin fé seach agus chó luath agus tabharfar amach an deimhniú san déanfar gach aisíoc agus athcheartú (más ann dóibh) is gá idir na comhairlí sin agus, mara gcó-aontuítear air, socróidh an tAire méid na n-aisíoc agus na n-athcheartuithe sin.
(6) Uair ar bith ar iarratas éinne le n-a mbaineann an scéal féadfidh comhairle chontae no có-choiste do thug deimhniú amach fén alt so an cáinmheas dréineála, fén deimhniú san, ar aon tailte do roinnt ar choda deifriúla de sna tailte sin in aon chás ina bhfeicfar dóibh an roinnt sin do bheith riachtanach agus pé uair a déanfar aon roinnt den tsórt san amhlaidh déanfidh an chomhairle no an có-choiste sin, ar a éileamh san d'éinne agus ar íoc pé táille don duine sin nách mó ná scilling agus a shocróidh siadsan, faisnéis i scríbhinn i dtaobh na roinnte sin do thabhairt amach don duine sin agus (gan cruthúnas ar shighniú ná ar údarás an té a thabharfa sí le tuisgint a thug amach í) beidh gach faisnéis den tsórt san ina fianaise dho-shlaoite i ngach cúirt agus chun crícheanna uile na roinnte sin.
(7) Déanfar deimhniú a thabharfidh comhairle chontae no cóchoiste amach fén alt so do lóisteáil agus do chimeád in oifig na comhairle no an chó-choiste sin (pe'ca aca é) agus, más deimhniú é a thug có-choiste amach amhlaidh, déanfar fós dúbláid de do lóisteáil agus do chimeád in oifig gach ceann de sna comhairlí contae a cheap an coiste sin, agus gach deimhniú den tsórt san agus gach dúbláid den tsórt san de dheimhniú a lóisteálfar amhlaidh beid ar nochta chun a n-iniúchta ag éinne in aisce san oifig ina mbeid lóisteálta amhlaidh gach tráth a bheidh an oifig sin ar oscailt chun gnó do dhéanamh, agus tabharfidh rúnaí comhairle contae 'na mbeidh aon deimhniú no dúbláid den tsórt san lóisteálta amhlaidh ina n-oifig, tabharfa sé d'aon duine, ar a héileamh do agus ar íoc pé táille (nách mó ná scilling) a shocróidh an chomhairle sin, cóip cheart den deimhniú no den dúbláid sin no d'aon chuid de cheachtar acu a luadhfidh an duine sin, agus déanfidh an rúnaí sin, no oifigeach éigin eile don chomhairle chontae sin a ainmneoidh an chomhairle sin chuige sin, a dheimhniú i scríbhinn fé n-a láimh gach cóip a tabharfar amach amhlaidh do bheith ceart agus (pe'ca cóip í do dineadh de dheimhniú do lóisteáladh fén bhfo-alt so no cóip do dineadh de dhúbláid do lóisteáladh amhlaidh agus gan cruthúnas ar shighniú, ar oifig, ná ar údarás an té a thabharfa sí le tuisgint a dheimhnigh amhlaidh í) beidh gach cóip a deimhneofar amhlaidh ina fianaise dho-chlaoite i ngach cúirt agus chun gach críche ar dhéanamh an deimhnithe no na coda dhe 'na dtabharfa sí le tuisgint gur cóip de í agus ar a mbeidh sa deimhniú no sa chuid sin.
Na costaisí a bhainfidh le scéim dhréineála do chur i ngníomh.
13.—(1) Na costaisí fé n-a raghaidh comhairle chontae ag cur scéime dréineála i ngníomh ina haonar, íocfar iad sa chéad dul síos ar pe slí acu so is ceart dar leis an gcomhairle sin, eadhon, amach as an gciste contae no amach as airgead a cruinneofar chuige sin tré iasachtaí d'fháil fén Acht so, no go leathrannach sa chéad shlí agus go leathrannach sa tslí eile.
(2) Na costaisí fé n-a raghaidh có-choiste ag cur scéime dréineála i ngníomh, déanfidh na comhairlí contae a cheap an có-choiste sin iad d'íoc sa chéad dul síos do réir mhéideanna iomlánn na gcáinmheas ndréineála ar thailte ina gcontaethe fé seach, agus an chionúireacht de sna costaisí sin a bheidh le n íoc amhlaidh ag aon cheann de sna comhairlí sin íocfar í ar pé slí acu so is ceart dar leis an gcomhairle sin, eadhon, amach as an gciste contae no amach as airgead a cruinneofar chuige sin tré iasachtaí d'fháil fén Acht so no go leathrannach sa chéad shlí agus go leathrannach sa tslí eile agus in aon chás acu tabharfar iad don chó-choiste sin sa tslí orduithe ar a n-éileamh sa chuma orduithe.
(3) An t-airgead a chaithfidh comhairle chontae fé sna forálacha san roimhe seo den alt so, ag íoc na gcostaisí fé n-a raghfar ag cur scéime dréineála i ngníomh (pe'ca an chomhairle sin ina haonar a chuirfidh an scéim sin i ngníomh no có-choiste a ceapadh go leathrannach ag an gcomhairle sin), aisíocfar é leis an gcomhairle sin amach as na cistí seo a leanas chó fada is raghaid, sé sin le rá, an tsuim do socruíodh sa scéim dhréineála mar shuim a bheadh le cruinniú ag an gcomhairle sin tríd an ráta dréineála chun an t-aisíoc san do dhéanamh, an tsuim do fuair an chomhairle sin ar scór an deontais Stáit dá socruítear san Acht so anso ina dhiaidh seo, agus an rann-íoc contae (más ann do) ón gcomhairle sin, agus is amach as ciste contae na comhairle sin a haisíocfar an chuid eile den airgead san leis an gcomhairle sin.
Rann-íoc an Stáit chun costas scéime dréineála d'íoc.
14.—(1) Pé uair no uaire, le linn scéim dhréineála do bheith á cur i ngníomh no laistigh de ráithe tar éis críochnú an chur-i-ngníomh san do beith deimhnithe fén Acht so, a ordóidh an tAire Airgid íocfar amach as airgead a sholáthróidh an tOireachtas pé suim (dá ngairmtear an deontas Stáit san Acht so), ar scór na scéime dréineála san, a cheadóidh an tAire Airgid agus nách mó ná pe'ca de sna méideanna so a leanas is lú, sé sin le rá, an ceathrú cuid den chostas iomlán a bhainfidh leis an scéim dhréineála san do chur i ngníomh no suim dhá chéad go leith punt.
(2) Más aon chomhairle chontae amháin a chuirfidh scéim dhréineála i ngníomh íocfar an deontas Stáit ar scór na scéime sin leis an gcomhairle sin agus más có-choiste a chuirfidh scéim dhréineála i ngníomh íocfar an deontas Stáit ar scór na scéime sin leis na comhairlí contae a cheap an có-choiste sin agus san ina gcodacha do réir mhéideanna iomlána na gcáinmheas ndréineála ar thailte ina gcontaethe fé seach.
(3) Gach airgead a gheobhaidh comhairle chontae mar chuid den deontas Stáit ar scór scéime dréineála cuirfidh an chomhairle sin é, chó fada is ragha sé, chun aisíoctha an airgid a sholáth ruigh an chomhairle sin chun íoctha na gcostas fé n-ar chuathas i gcur na scéime sin i ngníomh.
Rann-íoc contae chun costas na scéime dréineála d'íoc.
15.—(1) Má socruítear le scéim dhréineála i dtaobh rann-íoca bhliantúla no rann-íoca eile (dá ngairmtear rann-íoc contae san Acht so) o chomhairle chontae mar chabhair chun íoctha na gcostas fé n-a raghfar i gcur na scéime sin i ngníomh, déanfidh an chomhairle chontae sin an rann-íoc san go cuibhe do réir na scéime sin agus cuirfid suim an rann-íoca san mar chabhair chun aisíoc do thabhairt don chomhairle sin san airgead a sholáthruigh an chomhairle sin chun íoctha na gcostas fé n-ar chuathas i gcur na scéime sin i ngníomh.
(2) Íocfar rann-íoc contae ar pé slí acu so is ceart dar leis an gcomhairle a dhéanfidh an rann-íoc san, eadhon, amach as an gciste contae no amach as airgead a cruinneofar chuige sin tré iasachtaí d'fháil fén Acht so no go leathrannach sa chéad shlí agus go leathrannach sa tslí eile.
Costaisí fé n-a raghaidh comhairle chontae d'aisíoc.
16.—(1) An t-airgead a ceanglófar le scéim dhréineála ar chomhairle chontae do chruinniú tríd an ráta dréineála chun no mar chabhair chun aisíoc do thabhairt don chomhairle sin san airgead a sholáthruigh an chomhairle sin chun íoctha na gcostas fé n-ar chuathas i gcur na scéime sin i ngníomh agus fós gach airgead a ceanglófar ar an gcomhairle sin do sholáthar chun na hoibreacha dréineála a déanfar do réir na scéime sin do chimeád i dtreo, cruinneoidh an chomhairle sin é tré ráta phuntáiste bhliantúil (dá ngairmtear an ráta dréineála san Acht so) a buailfar agus a cuirfar ar shealbhairí uile agus fé seach na dtailte, i gcontae na comhairle sin, do moladh sa scéim sin a dhréineáil no a fheabhsú.
(2) Buailfar an ráta dréineála in aon am amháin agus fé réir an aon athchomhairc amháin leis an ráta dealbhais agus beidh sé inghearrtha, iníoctha, agus ionbhainte amach díreach sa tslí chéanna ina bhfuil agus tré sna meáin chéanna tré n-a bhfuil ráta dealbhais inghearrtha, iníoctha, agus ionbhainte amach.
(3) I gcás duine a cuirfar fé ráta dhréineála fén Acht so ar scór talmhan atá ar seilbh aige do bheith ina shealbhaire ar thalamh eile is cuid den ghabháltas, den fheirm, no den tionóntachán ina bhfuil an talamh um a gcuirfar é fén ráta dhréineála san amhlaidh, féadfar aon tsuim a cuirfar air amhlaidh ar scór an ráta dhréineála san do bhailiú uaidh agus do bhaint de fé is dá mbeadh an tsuim sin curtha air agus iníoctha aige ar scór iomlán an ghabháltais, na feirme, no an tionóntacháin sin do bheith ar seilbh aige.
Oibreacha dréineála do chimeád i dtreo.
17.—(1) Nuair a bheidh scéim dhréineála curtha i ngníomh go hiomlán déanfidh an chomhairle chontae no an có-choiste do chuir i ngníomh í na hoibreacha dréineála do dineadh do réir na scéime do chimeád, as san amach, dea-dheisithe agus i dtreo mhaith agus in ordú ceart éifeachtúil chun oibre.
(2) Más aon chomhairle chontae amháin a chuirfidh scéim dhréineála i ngníomh is amach as an airgead a chruinneoidh an chomhairle sin fén Acht so tríd an ráta dréineála a híocfar na costaisí fé n-a raghaidh an chomhairle sin chun na hoibreacha dréineála do dineadh do réir na scéime do chimeád i dtreo do réir an ailt seo.
(3) Más có-choiste a chuirfidh scéim dhréineála i ngníomh, ansan, an t-airgead a theastóidh ón gcó-choiste sin chun na hoibreacha dréineála do dineadh do réir na scéime sin do chimeád i dtreo déanfidh na comhairlí contae a cheap an có-choiste sin, ar a éileamh sa chuma orduithe, é do thabhairt sa tslí orduithe don chó-choiste sin do réir mhéideanna iomlána na gcáinmheas ndréineála ar thailte ina gcontaethe fé seach amach as an airgead a chruinneoidh na comhairlí sin fé seach fén Acht so tríd an ráta dréineála.
Forálacha i dtaobh ceart móna.
18.—Pé uair a bheidh ar na tailte, a moltar i scéim dhréineála a dhréineáil no a fheabhsú, aon phortach o n-a mbeidh móin á fáil no o n-ar féidir í d'fháil le linn ullamhú na scéime no o n-a bhféadfar móin d'fháil de bharr an scéim sin do chur i ngníomh bainfidh na forálacha so a leanas leis an gcás, sé sin le rá:—
(a) chun crícheanna aon ráitis sa scéim ar luach an phortaigh sin no ar aon mhéadú ar an luach san áireofar luach an phortaigh sin lasmuich d'aon chirt agus fé réir aon cheart (dá ngairmtear cirt mhóna san alt so) chun móin do bhaint agus do bhreith as an bportach san pe'ca go generálta é no chun críche áirithe agus pe'ca de bhua únaeracht an phortaigh sin é no de bhua únaeracht tailte eile no éinní eile;
(b) luadhfar sa scéim luach na gceart móna uile agus fé seach ar an bportach san no ina thaobh agus luadhfar amhlaidh, leis, an méadú go mbeidh súil le n-a theacht ar an luach san de bharr an scéim do chur i ngníomh;
(c) seirbheálfar ar gach duine ag á mbeidh ceart móna ar an bportach san no ina thaobh fógraí den tsórt a ceangailtear leis an Acht so do sheirbheáil ar shealbhairí tailte a moltar sa scéim a dhréineáil no a fheabhsú, agus gach duine ag á mbeidh cirt mhóna den tsórt san beidh aige na cirt chéanna a bronntar ar na sealbhairí sin de bhua an Achta so chun cur i gcoinnibh na scéime no chun a rá ce'ca aontuíd leis an scéim no ná haontuíd;
(d) chun a dhéanamh amach ce'ca is leor no nách leor chun cosc do chur le daingniú na scéime an líon daoine ná haontóidh leis an scéim, ach ní chun aon chríche eile, tuigfar cirt mhóna do bheith ina dtailte a moltar sa scéim a dhréineáil no a fheabhsú agus iad do bheith ar seilbh ag na daoine 'na mbeidh teideal acu chúcha;
(e) sa tuarasgabháil a tabharfar fén Acht so don chomhairle chontae no don chó-choiste ar a mbeidh sé de chúram an scéim do chur i ngníomh, i dtaobh na méideanna do méaduíodh luachanna bliantúla fé seach tailte tríd an scéim do chur i ngníomh, ní háireofar mar chuid de sna méideanna san aon tairbhe d'únaerí ceart móna ar scór na gceart san ach beidh inti mion-innste ar an slí agus ar an méid a tairbhíodh na húnaerí sin ar scór na gceart móna san tríd an scéim do chur i ngníomh agus beidh inti, leis, molta i dtaobh na rann-íoc (dá ngairmtear na cáinmheasa móna san alt so) a cuirfar ar na húnaerí sin ar scór na tairbhe sin mar chabhair chun íoctha an chostais a bhain leis an scéim do chur i ngníomh agus leis na hoibreacha dréineála a dineadh dá réir do chimeád i dtreo;
(f) ní cuirfar éinne fé cháinmheas ráta dhréineála ar scór cirt mhóna;
(g) le linn don chomhairle chontae no don chó-choiste, ar a mbeidh sé de chúram fén Acht so scéim dhréineála do chur i ngníomh, bheith ag socrú na gcáinmheas dréineála ar scór na scéime sin socróid leis na cáinmheasa móna fé n-a gcuirfar agus a íocfidh únaerí na gceart móna fé seach a tairbhítear ar scór na gceart san tríd an scéim do chur i ngníomh agus socróid na cáinmheasa san ar gach slí díreach mar a chífar dóibh is cóir agus is cothrom ag féachaint don tslí agus don mhéid a tairbhítear na húnaerí sin amhlaidh tríd an scéim do chur i ngníomh agus féadfid go sonnrách aon cháinmheas den tsórt san do shocrú mar chnap-shuim is iníoctha ina haon tráthchuid amháin no ina dhá tráthchuid no níos mó i rith tréimhse de mhíosa no de bhlianta no mar shuim bhliantúil no leathbhliantúil de mhéid chinnte no sho-atharuithe is iníoctha i rith roinnt blian;
(h) le deimhniú na comhairle contae no an chó-choiste sin, le n-a ndeimhneofar na méideanna fé seach do méaduíodh luachanna bliantúla fé seach tailte tríd an scéim do chur i ngníomh, deimhneofar fós méideanna na gcáinmheas móna fé seach agus an t-am agus an tslí ina n-íocfidh únaerí na gceart móna fé seach iad, agus beidh na cáinmheasa san iníoctha ag na húnaerí sin leis an gcomhairle chontae no leis an gcó-choiste sin dá réir sin agus baileofar agus bainfar amach iad sa tslí chéanna agus tré sna meáin chéanna díreach ina mbeidh agus le n-a mbeidh an ráta dréineála ionbhailithe agus ionbhainte amach agus isiad na daoine céanna díreach a dhéanfidh san agus, chun críche na bainte amach sin, tuigfar gach cáinmheas móna do bheith curtha agus inghearrtha ar gach talamh atá ar seilbh ag únaer na gceart móna le n-a mbaineann an cáinmheas agus gurb é an talamh é ar a bhfuil na cirt sin infheidhmithe no an talamh le n-a ngabhann no le n-a mbaineann na cirt sin;
(i) más có-choiste a chuirfidh scéim i ngníomh isiad a bhaileoidh gach cáinmheas móna ar scór na scéime sin ná an chomhairle chontae gur ina gcontae a luíonn an talamh ar a bhfuil na cirt mhóna, le n-a mbaineann an cáinmheas móna, infheidhmithe agus íocfar gach cáinmheas móna den tsórt san leis an gcó-choiste sin nuair a bheidh sé bailithe ag an gcomhairle chontae sin;
(j) gach airgead a gheobhaidh an chomhairle chontae no an có-choiste, ar a mbeidh sé de chúram fén Acht so scéim dhréineála do chur i ngníomh, mar chuid de cháinmheasa móna ar scór na scéime sin cuirfidh an chomhairle chontae no an có-choiste sin é chun laigheaduithe an airgid a bheidh le cruinniú ag an gcomhairle sin no don chó-choiste sin tríd an ráta dréineála agus cuirfar amhlaidh é ar pé slí acu so is oiriúnach leis an gcomhairle no leis an gcó-choiste sin, eadhon, mar chabhair chun aisíoctha na gcostas fé n-ar chuathas i gcur na scéime i ngníomh no mar chabhair chun na hoibreacha dréineála, a dineadh do réir na scéime, do chimeád i dtreo no go leathrannach sa chéad shlí agus go leathrannach sa tslí eile agus cuirfar amhlaidh é ar pé slí acu so is rogha leis an gcomhairle sin, eadhon, fé mar agus nuair a gheobhfar é no tré n-a charnáil agus tré tharrac as an gcarn no go leathrannach sa chéad shlí agus go leathrannach sa tslí eile.

19.—(1) Gach éinne—
(a) a bhacfidh go toiliúil comhairle chontae no có-choiste no éinne d'oifigigh no de sheirbhísigh na comhairle no an choiste sin agus iad ag feidhmiú aon chomhachta no ag cólíona aon dualgais dá mbronntar no dá bhforchuirtar ortha leis an Acht so no fé no ag feidhmiú aon chirt a bronntar leis an Acht so chun dul isteach ar thailte, no
(b) a bhacfidh go toiliúil éinne do ceapadh fén Acht so ag comhairle chontae no ag comhairlí contae chun tuarasgabháil do thabhairt chun críche an Achta so agus san le linn an duine sin do bheith ag feidhmiú aon chomhachta dá mbronntar air leis an Acht so, no
(c) a stracfidh anuas, a aistreoidh, no a dhíobhálfidh aon oibreacha a bheidh comhairle chontae no có-choiste a dhéanamh fén Acht so, no
(d) a aistreoidh, a dhíobhálfidh, no a agha-loitfidh aon phionnaí, cuaillí, no marcanna do shocruigh no do dhin comhairle chontae no có-choiste no éinne dá n-oifigigh na dá seirbhísigh chun no le linn aon cheann de sna comhachta d'fheidhmiú no aon cheann de sna dualgaisí do chólíona a bronntar no a forchuirtar ortha leis an Acht so no fé, no
(e) a chaithfidh no a chuirfidh aon fhiaile, clocha, eré no abhar soladach eile no a chuirfidh fé ndeár no a cheadóidh aon abhar soladach den tsórt san do thuitim no do ghabháil isteach in aon chúrsa uisce go bhfuil comhairle chontae no có-choiste ar tí aon oibreacha do dhéanamh no ag déanamh aon oibreacha ina thaobh fén Acht so, agus san i slí is go mbacfar, go gcoiscfar, no go moilleofar na hoibreacha san, no
(f) a chuirfidh no a thógfidh aon iadhtán, corra, no constaic eile in aon chúrsa uisce den tsórt san roimhráite gan cead ón gcomhairle chontae no ón gcó-choiste le n-a mbainfidh san, no
(g) go dteipfidh air aon chúrsa uisce no dréin do chimeád glan agus sciúrtha a dhligheann sé a choinneáil i dtreo agus 'na mbeidh comhairle chontae no có-choiste ar tí oibreacha a bhaineann leis do dhéanamh no á ndéanamh no tar éis a ndéanta fén Acht so, no atá i gceangal, díreach no nea-dhíreach, le haon chúrsa uisce no dréin den tsórt san,
beidh sé ciontach i gcionta fén alt so agus beidh sé inphionósuithe dá réir sin.
(2) Gach éinne a dhéanfidh, tar éis aon oibreacha dréineála a déanfar fén Acht so do bheith críochnuithe—
(a) bac do chur go toiliúil leis an gcomhairle chontae no leis an gcó-choiste ar a mbeidh sé de chúram, de bhua an Achta so, na hoibreacha dréineála san do choinneáil i dtreo, no le haon oifigeach no seirbhíseach d'aon chomhairle no coiste den tsórt san agus iad ag feidhmiú aon chomhachta dá mbeidh acu no ag cólíona aon dualgais dá mbeidh ortha maidir leis na hoibreacha dréineála san, no
(b) aon oibreacha dréineála den tsórt san no aon chuid díobh do straca anuas, d'aistriú, no do dhíobhála ar aon tslí, no
(c) bac do chur le huisce do rith chun aon oibreacha dréineála den tsórt san no triotha no uatha i slí is go ndéanfí a n-oibriú éifeachtúil do chosc no do bhac no go gcuirfí fé ndeár tuile do dhul isteach ar na hoibreacha san no ar thailte a dréineáltar leo,
beidh sé ciontach i gcionta fén alt so agus beidh sé inphionósuithe dá réir sin.

20.—(1) Gach comhairle chontae no có-choiste a bheidh ag coinneáil oibreacha dréineála i dtreo fén Acht so, féadfid fodhlithe do dhéanamh chun gach críche no aon chríche acu so a leanas, sé sin le rá:—
(a) oscailt, dúna, agus oibriú comhlaí uisce, haistí, geataí tuile, agus meaisínteachta eile sna hoibreacha do rialáil,
(b) bainistí agus oibriú na n-oibreacha do rialáil go generálta,
(c) daoine do thoirmeasc ar aon chúrsa uisce a bheidh ag rith chun na n-oibreacha no tríotha no uatha do stopa no do shailiú no abhar soladach do chur ann i slí is go ndéanfí oibriú éifeachtúil na n-oibreacha do chosc no do bhac no go gcuirfí fé ndeár tuile do dhul isteach ar aon tailte a dréineáltar leis na hoibreacha,

21.—(1) Gach airgead a údaruíonn no a orduíonn an tAcht so do chomhairle chontae d'íoc amach as an gciste contae agus fós gach costas fé n-a raghaidh comhairle chontae i bhfeidhmiú an Achta so agus ná dintar aon tsocrú eile leis an Acht so i gcóir a chruinnithe, is tríd an ráta dealbhais, mar mhuirear ar an gcontae iomlán, a cruinneofar iad.
(2) Féadfidh comhairle chontae airgead d'fháil ar iasacht chun crícheanna an Achta so fé Airtiogal 22 den Sceideal a ghabhann leis an Local Government (Application of Enactments) Order, 1898, fé is dá mbeadh na crícheanna san luaidhte san Airtiogal san, agus ní déanfar airgead a gheobhaidh comhairle chontae ar iasacht fén alt so chun crícheanna an Achta so d'áireamh mar chuid d'fhiacha iomlána na comhairle contae sin chun crícheanna an Airtiogail sin.

23.—(1) Féadfidh comhairle chontae no có-choiste a ceapfar fén Acht so pé oifigigh agus pé méid díobh do cheapa a mheasfid o am go ham do bheith ceart chun crícheanna an Achta so.
(2) Iocfidh comhairle chontae no có-choiste leis na hoifigigh a cheapfid fén alt so pé luach saothair a shocróidh an chomhairle no an coiste sin.
(3) Aon oifigeach a ceapfar fén alt so féadfidh an chomhairle no an coiste do cheap é é do chur as a oifig mar oifigeach den tsórt san aon uair.

ARTERIAL DRAINAGE (MINOR SCHEMES) ACT, 1928.
Definitions.
1.—(1) In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the word “drainage” includes drainage by pumping either alone or in conjunction with other means and all cognate words shall be construed accordingly;
the word “county” does not include a county borough;
the word “prescribed” means prescribed by the Minister by regulations made under this Act.
(2) In all references in this Act to lands drained or proposed to be drained, or to lands improved or benefited by drainage or proposed to be so improved or benefited, the word “lands” shall include lands, buildings and premises of every description.
Petition for execution of drainage works.
2.—(1) Any three or more persons being occupiers of lands which are liable to be flooded or injured by water or which are capable of being improved by drainage other than thorough drainage or being persons upon trust for whom or for whose benefit any such lands are held by the occupiers thereof may at any time within five years after the passing of this Act but not later apply to the council of the county or the respective councils of the counties in which such lands are situate to have drainage works executed under this Act for the purpose of draining or improving such lands.
(2) Every application under this section to the council of a county or to the respective councils of two or more counties shall be made by petition presented (as the case may be) to such council or to each of such councils severally and every such petition shall be in writing in the prescribed form and shall state in general terms the drainage works which it is thereby proposed should be executed and shall contain a statement by the petitioners that to the best of their knowledge and belief the total cost of the execution of such drainage works will not exceed one thousand pounds.
Consideration of petition by the county council.
3.—(1) Every county council to whom a petition is presented under this Act within five years after the passing of this Act shall refer such petition to the county surveyor for his report on the general merits of the proposals contained in the petition and the probable total cost of the execution of the drainage works comprised in such proposals.
(2) For the purpose of making such report as aforesaid the county surveyor and his assistants shall be entitled at all reasonable times to enter upon the lands referred to in the petition and such other lands in the neighbourhood thereof as he or they shall think necessary and also any premises on any such lands and there to make such investigations and do such things as shall appear to him or them to be necessary for the purpose of making such report.
(3) Upon receiving the report of the county surveyor on such petition the council, at a meeting of which not less than seven days notice has been given to each member, shall consider such petition and such report and—
(a) if the sum stated in such report as the probable total cost of the execution of the drainage works proposed in such petition does not exceed one thousand pounds and effect can be given to the proposals contained in such petition without infringing any of the provisions of this Act, the council may as they think fit either pass a resolution approving of the proposals contained in the petition and determining to carry them out under this Act or pass a resolution disapproving of such proposals, or
(b) if the sum stated in such report as the probable total cost of the execution of the drainage works proposed in such petition exceeds one thousand pounds or effect cannot be given to the proposals contained in such petition without infringing some provision of this Act, the council may either pass a resolution that the petition and report be treated as a petition and report made under the Arterial Drainage Act, 1925, (No. 33 of 1925) or pass a resolution disapproving of such proposals.
(4) Where a petition is presented under this Act to the councils of two or more counties such councils may combine for the purpose of considering such petition and, in lieu of referring the petition to the county surveyor of each such county, may refer the petition to the county surveyor of one such county and in such case every such council may act under this section on the report of such county surveyor.
(5) Any county council or combination of county councils may, in lieu of referring such petition to a county surveyor, refer such petition to some other qualified engineer nominated by such council or councils and in such case all references in this section to a county surveyor shall be construed and have effect as references to such qualified engineer and the remuneration of such qualified engineer shall be paid out of the county fund of the council or in such proportions as, in default of agreement, shall be fixed by the Minister out of the several county funds of the councils by whom he is appointed.
Reports under the Arterial Drainage Act, 1925.
4.—Every report made within five years after the passing of this Act by a county surveyor or other qualified engineer under section 3 of the Arterial Drainage Act, 1925 (No. 33 of 1925) shall include a report as to whether the probable total cost of the execution of the drainage works comprised in the proposals to which the report relates will or will not exceed the sum of one thousand pounds and in the latter case the amount of such probable total cost and whenever any such report states that the probable total cost of the execution of such drainage works will not exceed one thousand pounds such report and the petition in reference to which such report was made shall be deemed to have been duly presented and made under this Act and this Act shall apply accordingly.
Preparation of drainage scheme.
5.—(1) Whenever a petition is duly presented or deemed to have been presented under this Act to one county council only and such council duly passes under this Act a resolution approving of the proposals contained in such petition and determining to carry them out under this Act, such council shall prepare and (subject to confirmation) carry into execution in accordance with this Act a drainage scheme to effect the objects of such proposals.
(2) Whenever a petition is duly presentel or deemed to have been presented under this Act to two or more county councils and every such council duly passes under this Act a resolution approving of the proposals contained in such petition and determining to carry them out under this Act, all such councils shall through and by a joint committee appointed by them for the purpose under this Act jointly prepare and (subject to confirmation) carry into execution in accordance with this Act a drainage scheme to effect the objects of such proposals.
(3) No county council shall prepare or carry out alone any drainage scheme which proposes the execution of any drainage works or the drainage or improvement of any lands outside the county of such council and no joint committee of county councils shall prepare or carry out any drainage scheme which proposes the execution of any drainage works or the drainage or improvement of any lands outside the counties of such councils.
(4) No county council or joint committee of county councils shall prepare or carry out any drainage scheme which proposes any interference with the works of any drainage district constituted in pursuance of the provisions of the Navigation (Ireland) Acts, 1842 to 1857, or the Drainage and Improvement of Lands (Ireland) Acts, 1863 to 1892, or the Arterial Drainage Act, 1925 (No. 33 of 1925), or with the lands, rights, and other property of any local authority without the consent of such authority or with the powers, lands, rights, and other property of any body charged with the control of the navigation of any river or having the ownership of any canal without the consent of such body.
Effect of certain resolutions.
6.—(1) If on the consideration under this Act of a petition and report the county council or all the county councils to which such petition was presented duly passes or pass a resolution that the petition and report be treated as a petition and report made under the Arterial Drainage Act, 1925 (No. 33 of 1925), the petition and report shall be deemed to have been duly presented and made under that Act and that Act shall apply accordingly.
(2) If on the consideration under this Act of a petition and report a county council duly passes a resolution disapproving of the proposals contained in such petition the secretary of such council shall communicate such resolution to the petitioners.
Form and contents of drainage scheme.
7.—(1) Every drainage scheme shall be in the prescribed form and shall have annexed thereto all such (if any) maps, drawings, plans, sections, and schedules as may be prescribed and shall show in the prescribed manner all such matters and things as are referred to in this Act as fixed by or stated in the drainage scheme and all such other matters and things as shall be prescribed.
(2) The probable total cost of carrying out the drainage scheme shall be stated in the scheme and shall not exceed the sum of one thousand pounds and, where the county council or joint committee charged with the preparation of a drainage scheme is satisfied after due investigation that it is not possible to frame a scheme which will give reasonable effect to the proposals contained in the petition for such scheme and can be carried out for a probable total cost not exceeding the sum of one thousand pounds, such council or committee shall declare such proposals incapable of being carried out under this Act and thereupon all proceedings under the said petition shall be abandoned but without prejudice to proceedings by petition under this Act for a new drainage scheme relating to the same locality.
(3) Where a drainage scheme is abandoned under this section the expenses incurred by the county council or joint committee in and about the preparation of such scheme prior to the abandonment thereof shall be paid (as the case may be) out of the county fund of such council or in such proportions as shall, in default of agreement, be determined by the Minister out of the several county funds of the county councils by whom such joint committee is appointed.
Notices of and objections to the scheme.
8.—Within the prescribed time after the completion of the preparation of the drainage scheme the county council or joint committee charged with the preparation thereof shall—
(a) deposit a copy of the drainage scheme in the office of such county council or of every of the county councils by whom such joint committee is appointed (as the case may be) and also in a convenient place at or near the site of the drainage works proposed to be executed under the drainage scheme, and
(b) keep every copy of the drainage scheme so deposited open to inspection by any person at all reasonable hours during the time prescribed for sending objections to the scheme to such county council or joint committee, and
(c) serve in the prescribed manner on all occupiers of lands proposed in the scheme to be drained or improved notice in the prescribed form of the preparation of the scheme and of the said deposit and opportunity of inspection of copies thereof and of the prescribed time (not being less than twenty-one days from the service of the notice) within which and the manner in which objections to the scheme may be sent to such county council or joint committee and also by the same or a separate notice (as may be prescribed) and in the prescribed form and manner require every such occupier to inform such county council or joint committee within a specified time (which shall be the same as the time for sending objections to such council or committee) and in the prescribed manner whether he assents to or dissents from the scheme, and
(d) if the drainage scheme proposes that any lands, rights, or other property should be acquired, serve in the prescribed manner on all owners or reputed owners, lessees or reputed lessees, and occupiers of such lands, rights and other property notice in the prescribed form of the preparation of the scheme and of the said deposit and opportunity of inspection of copies thereof and of the prescribed time (not being less than twenty-one days from the service of the notice) within which and the manner in which objections to the drainage scheme may be sent to such county council or joint committee and also by the same or a separate notice (as may be prescribed) and in the prescribed form inform every such owner or reputed owner, lessee or reputed lessee, or occupier that the scheme proposes the acquisition of some land, right, or other property (which property shall be fully described in the notice) owned, held, or occupied by him.
Confirmation of drainage scheme.
9.—(1) If the aggregate value as stated in the drainage scheme of so much of the lands proposed by the scheme to be drained or improved as are in the occupation of persons who have duly informed the county council or the joint committee (as the case may be) that they dissent from the scheme exceeds one-half of the total value as stated in the scheme of the lands so proposed to be drained or improved the county council or joint committee shall refuse to confirm the scheme but if the said aggregate value does not exceed one-half of the said total value the county council or joint committee (as the case may be) after considering the objections (if any) to the drainage scheme duly sent to them under this Act and hearing such (if any) persons as they are required by this section to hear, shall at their discretion either confirm the scheme without alteration or confirm the scheme with such alteration (whether by way of variation, addition, or omission) as they may think proper to make therein or refuse to confirm the scheme
(2) The following provisions shall apply to the confirmation under this section of a drainage scheme by a county council or joint committee and to the refusal of such confirmation, that is to say:—
(a) such confirmation or refusal shall be made only at a meeting of the county council or joint committee of which not less than seven days notice stating that the confirmation of the scheme will be considered at the meeting has been sent to every member of the county council or joint committee and also in the prescribed form and manner to the public,
(b) the notice to the public of such meeting shall state that any person bona fide aggrieved by or objecting to the drainage scheme may attend such meeting and will be heard by the council or committee,
(c) every person attending such meeting and claiming to be aggrieved by or to object to the drainage scheme and desiring to be heard shall be heard by the council or committee unless his grievance or objection appears to them to be frivolous or merely obstructive,
(d) the meeting may be adjourned from time to time as may be necessary or expedient,
(e) unless the confirmation of the scheme, whether with or without alteration, is passed at such meeting by an absolute majority of all the members of such county council or joint committee the confirmation of the drainage scheme shall be deemed to have been refused by such council or committee.
(3) When a county council or joint committee has duly confirmed a drainage scheme, whether with or without alteration, such county council or joint committee shall within the prescribed time serve on the prescribed persons and in the prescribed form and manner notice of the confirmation of the scheme.
(4) When a county council or a joint committee duly refuses or is deemed to have refused to confirm a drainage scheme such scheme shall be abandoned and no further steps shall be taken in respect thereof but without prejudice to proceedings by petition under this Act for a new drainage scheme relating to the same locality.
(5) The expenses incurred by a county council or a joint committee in and about the preparation and confirmation of a drainage scheme shall, whether such scheme is or is not confirmed under this section, be paid (as the case may be) out of the county fund of such council or in such proportions as shall in default of agreement be determined by the Minister out of the several county funds of the county councils by whom such joint committee is appointed.
(6) The confirmation of a drainage scheme under this section shall be conclusive evidence that the requirements of this Act have been complied with in respect of such scheme and that such scheme has been duly made and is within the powers conferred by this Act.
(7) References in this Act to a drainage scheme in relation to anything to be done or to occur at any time subsequent to the confirmation of such scheme under this section shall be construed as references to such scheme as so confirmed.
Carrying out of drainage scheme.
10.—When a drainage scheme has been duly confirmed under this Act such scheme (with such reasonable additions, omissions, variations and deviations as shall in the course of the work be found necessary) shall be carried out in accordance with this Act by the county council or through and by the joint committee (as the case may be) by whom such scheme was prepared.
Acquisition of land for purposes of drainage scheme.
11.—(1) A county council or joint committee charged with the carrying out of a drainage scheme under this Act may at any time after the confirmation of such scheme acquire, either by agreement or compulsorily, for the purposes of such scheme any lands, rights or other property stated in such scheme as intended to be acquired, and for the purpose of such acquisition every drainage scheme shall be deemed to incorporate the Lands Clauses Acts as amended by the Second Schedule to the Housing of the Working Classes Act, 1890, section 11 of the Housing of the Working Classes (Ireland) Act, 1908, sections 7 and 12 of the Housing (Ireland) Act, 1919, and the Acquisition of Land (Assessment of Compensation) Act, 1919, and those Acts shall apply accordingly.
(2) All property acquired under this section by a joint committee shall be conveyed to and vested in the county council of the county in which such property is situate and the conveyance or the receipt or other document operating as the conveyance of such property shall be framed accordingly and such property shall be held by such council upon trust for the purposes of the drainage scheme.
Assessments to the drainage rate.
12.—(1) When all the drainage works to be executed under a drainage scheme have been completed and the scheme has been fully carried out, the county council or joint committee charged under this Act with the carrying out of such scheme shall cause the lands proposed in the scheme to be drained or improved to be inspected by a competent land valuer or land surveyor appointed by them and a report to be made to them by such valuer or surveyor as to the completion of the said works and the carrying out of the scheme and as to the amounts by which the respective annual values of the said lands have been increased by the carrying out of the scheme.
(2) On consideration of such report and on being satisfied that the drainage scheme has been fully carried out and after affording to the persons concerned a reasonable opportunity of inspecting such report and being heard in regard thereto, the county council or joint committee shall issue their certificate certifying that the scheme has been fully carried out and certifying the respective amounts by which the respective annual values of the said lands have been increased by the carrying out of the scheme having regard to the benefits reasonably to be expected to accrue to such lands therefrom.
(3) The occupiers of the several lands proposed in the drainage scheme to be drained or improved shall be assessed to the drainage rate rateably in proportion to the amount (in this Act referred to as the drainage assessment) by which the annual value of the lands occupied by them is so certified by the county council or joint committee to have been increased by the carrying out of the scheme.
(4) Every certificate issued under this section by a joint committee shall certify in respect of the county of each of the county councils by whom such committee is appointed the total amount of the drainage assessments of lands in such county.
(5) Whenever it is necessary to make, before the issue of a certificate under this section, any division of liability or obligation between two or more county councils which is by or under this Act required to be made in proportion to the total drainage assessments of lands in the respective counties of such councils, such division shall be made in proportion to the total amounts by which the annual values of lands proposed in the scheme to be drained or improved in such counties respectively are stated in the scheme to be expected to be increased by the carrying out of the scheme and so soon as such certificate is issued all (if any) necessary repayments and readjustments shall be made between such councils and the amount of such repayments and readjustments shall in default of agreement be fixed by the Minister
(6) A county council or a joint committee by whom a certificate has been issued under this section may at any time on the application of any person interested apportion the drainage assessment under such certificate of any lands as between different portions of those lands in any case in which such apportionment appears to them to be necessary and whenever any such apportionment is so made such council or committee shall on demand by any person and on payment by such person of such fee not exceeding one shilling as shall be fixed by them issue to such person a declaration in writing of such apportionment and every such declaration shall (without proof of the signature or authority of the person by whom the same purports to have been issued) be conclusive evidence in all courts and for all purposes of such apportionment.
(7) A certificate issued by a county council or a joint committee under this section shall be deposited and kept in the office of such council or committee (as the case may be) and, in the case of a certificate so issued by a joint committee, a duplicate thereof shall also be deposited and kept in the office of every of the county councils by whom such committee is appointed and every such certificate and duplicate certificate so deposited shall be open to inspection by any person free of charge in the office in which the same is so deposited at all times during which such office is open for the transaction of business and the secretary of a county council in whose office any such certificate or duplicate is so deposited shall on demand and on payment of such fee (not exceeding one shilling) as shall be fixed by such council furnish to any person a correct copy of such certificate or duplicate or of any portion thereof specified by such person and such secretary or some other officer of such county council nominated by such council for that purpose shall in writing under his hand certify the correctness of every copy so furnished and every copy so certified shall (whether the same is made from a certificate deposited under this subsection or from a duplicate so deposited and without proof of the signature, office, or authority of the person by whom the same purports to be so certified) be conclusive evidence in all courts and for all purposes of the making and contents of the certificate or portion thereof of which it purports to be a copy.
Expenses of carrying out a drainage scheme.
13.—(1) The expenses incurred by a county council in carrying out alone a drainage scheme shall be defrayed in the first instance either, as such council shall think proper, out of the county fund or out of moneys raised for the purpose by borrowing under this Act or partly in the one way and partly in the other way.
(2) The expenses incurred by a joint committee in carrying out a drainage scheme shall be defrayed in the first instance by the county councils by whom such joint committee is appointed in proportion to the total amounts of the drainage assessments of lands in their respective counties, and the proportion of such expenses to be so defrayed by any of such councils shall be paid either, as such council shall think proper, out of the county fund or out of moneys raised for the purpose by borrowing under this Act or partly in the one way and partly in the other way and shall in any case be furnished to such joint committee on the prescribed demand and in the prescribed manner.
(3) The moneys expended by a county council under the foregoing provisions of this section in defraying the expenses incurred in carrying out a drainage scheme (whether such scheme is carried out by such council alone or by a joint committee partly appointed by such council) shall be repaid to such council out of the following funds so far as they will respectively extend, that is to say, the sum fixed in the drainage scheme as the sum to be raised by such council by means of the drainage rate for the purpose of such repayment, the sum received by such council in respect of the State grant hereinafter in this Act provided for, and the county contribution (if any) of such council, and the residue of such moneys shall be repaid to such council out of the county fund of such council.
State contribution to the cost of drainage scheme.
14.—(1) At such time or times during the carrying out of a drainage scheme or within three months after the completion of such carrying out has been certified under this Act as the Minister for Finance shall direct there shall be paid out of moneys provided by the Oireachtas such sum (in this Act referred to as the State grant) in respect of such drainage scheme as the Minister for Finance shall sanction not exceeding whichever of the following amounts shall be the lesser, that is to say, one-fourth of the total cost of carrying out such drainage scheme or the sum of two hundred and fifty pounds.
(2) Where a drainage scheme is carried out by one county council the State grant in respect of such scheme shall be paid to such council and where a drainage scheme is carried out by a joint committee the State grant in respect of such scheme shall be paid to the county councils by whom such joint committee is appointed in shares proportionate to the total amounts of the drainage assessments of lands in their respective counties.
(3) All moneys received by a county council on foot of the State grant in respect of a drainage scheme shall be applied by such council as a repayment so far as such moneys will extend of the moneys provided by such council to meet the expenses incurred in carrying out such scheme.
County contribution to cost of drainage scheme.
15.—(1) Where a drainage scheme provides for an annual or other contribution (in this Act referred to as a county contribution) by a county council towards the expenses incurred in carrying out such scheme such county council shall duly make such contribution in accordance with such scheme and shall apply the amount of such contribution towards the repayment to such council of the moneys provided by such council to meet the expenses incurred in carrying out such scheme.
(2) A county contribution shall be paid either, as the council making the same shall think proper, out of the county fund or out of moneys raised for the purpose by borrowing under this Act or partly in the one way and partly in the other way.
Repayment of expenses incurred by a county council.
16.—(1) The moneys required by a drainage scheme to be raised by a county council by means of the drainage rate for or towards the repayment to such council of the moneys provided by such council to meet the expenses incurred in carrying out such scheme and also all moneys required to be provided by such council for the maintenance of the drainage works executed in pursuance of such scheme shall be raised by such council by means of an annual poundage rate (in this Act referred to as the drainage rate) made and assessed on the several occupiers of the lands in the county of such council which were proposed in such scheme to be drained or improved.
(2) The drainage rate shall be made at the same time and subject to the same appeal as the poor rate and shall be leviable, payable, and recoverable in the like manner and by the like means in all respects as poor rate is leviable, payable, and recoverable.
(3) Where a person assessed to a drainage rate under this Act in respect of land occupied by him is the occupier of other land forming part of or comprised in the same holding, farm, or tenement as the land in respect of which he is so assessed to such drainage rate, any sum so assessed on him in respect of such drainage rate may be collected and recovered from him in like manner as if such sum were assessed on and payable by him in respect of his occupation of the whole of such holding, farm, or tenement.
Maintenance of drainage work.
17.—(1) When a drainage scheme has been fully carried out the county council or joint committee by which the same was carried out shall thenceforth maintain the drainage works constructed pursuant to the scheme in good repair and condition and proper and efficient working order.
(2) Where a drainage scheme has been carried out by a single county council the expenses incurred by such council in maintaining in accordance with this section the drainage works executed pursuant to the scheme shall be defrayed out of the moneys raised under this Act by such council by means of the drainage rate.
(3) Where a drainage scheme has been carried out by a joint committee the moneys required by such joint committee for maintaining the drainage works executed pursuant to such scheme shall be furnished to such joint committee on the prescribed demand and in the prescribed manner by the county councils by whom such joint committee is appointed in proportion to the total amounts of the drainage assessments of lands in their respective counties out of the moneys raised under this Act by such councils respectively by means of the drainage rate.
Provisions as to turbary rights.
18.—Whenever the lands proposed in a drainage scheme to be drained or improved include any bog land from which turf is at the preparation of such scheme being or capable of being obtained or from which turf will as a result of the execution of such scheme be capable of being obtained the following provisions shall apply, that is to say:—
(a) for the purposes of any statement contained in the scheme of the value of such bog land or of any increase of such value, the value of such bog land shall be taken exclusive of and subject to any rights (in this section referred to as turbary rights) of cutting and removing turf from such bog land whether generally or for a particular purpose and whether in virtue of ownership of such bog land or of ownership of other lands or otherwise;
(b) the value of the several turbary rights over or in respect of such bog land shall be stated in the scheme and the increase in such value expected to arise from the carrying out of the scheme shall also be so stated;
(c) the like notices shall be served on all persons having turbary rights over or in respect of such bog land as are by this Act required to be served on occupiers of lands proposed in the scheme to be drained or improved and every person having such turbary rights shall have the like rights of making objections to and of expressing assent to or dissent from the scheme as are conferred on such occupiers by virtue of this Act;
(d) for the purpose of determining whether the number of dissents from the scheme is or is not sufficient to prevent the confirmation of the scheme, but for no other purpose, turbary rights shall be deemed to be lands proposed in the scheme to be drained or improved and to be in the occupation of the persons entitled thereto;
(e) the report to be made under this Act to the county council or joint committee charged with the carrying out of the scheme as to the amounts by which the respective annual values of lands have been increased by the carrying out of the scheme shall not include in such amounts any benefit to the owners of turbary rights in respect of such rights but shall contain particulars of the manner in and extent to which such owners have been benefited in respect of such turbary rights by the carrying out of the scheme and shall also contain recommendations as to the contributions (in this section referred to as the turbary assessments) towards the cost of the carrying out of the scheme and the maintenance of the drainage works constructed pursuant thereto to be assessed on such owners in respect of such benefit;
(f) no person shall be assessed to a drainage rate in respect of a turbary right;
(g) the county council or joint committee charged under this Act with the carrying out of a drainage scheme shall, when fixing the drainage assessments in respect of such scheme, also fix the turbary assessments to be assessed on and paid by the respective owners of turbary rights benefited in respect of such rights by the carrying out of the scheme and shall fix such assessments in all respects as appears to them to be just and equitable having regard to the manner in and extent to which such owners are so benefited by the carrying out of the scheme and in particular may fix any such assessment as a lump sum payable in one instalment or in two or more instalments over a period of months or years or as an annual or a half-yearly sum of fixed or variable amount payable over a number of years;
(h) the certificate of such county council or joint committee certifying the respective amounts by which the respective annual values of lands have been increased by the carrying out of the scheme shall also certify the amounts of the several turbary assessments and the time and manner of payment thereof by the respective owners of turbary rights, and such assessments shall be payable by such owners to such county council or joint committee accordingly and shall be collected and recovered in the like manner and by the like persons and means in all respects as the drainage rate is collectable and recoverable and, for the purpose of such recovery, every vurbary assessment shall be deemed to be assessed and leviable on all land which is in the occupation of the owner of the turbary rights to which the assessment relates and is either the land on which such rights are exercisable or the land to which such rights are appendant or appurtenant;
(i) where a scheme has been carried out by a joint committee, every turbary assessment in respect thereof shall be collected by the county council in whose county is situate the land over which the turbary rights to which the turbary assessment relates are exercisable and every such turbary assessment when collected by such county council shall be paid to such joint committee;
(j) all moneys received on foot of turbary assessments in respect of a drainage scheme by the county council or joint committee charged under this Act with the carrying out of such scheme shall be applied by such county council or joint committee in reduction of the moneys to be raised by such council or for such committee by means of the drainage rate and shall be so applied either towards repayment of the expenses incurred in carrying out the scheme or towards the maintenance of the drainage works executed in pursuance of the scheme or partly in the one way and partly in the other way as such council or committee shall think fit and shall be so applied at the discretion of such council either as and when received or by accumulating and resorting to the accumulations or partly in the one way and partly in the other way.
Offences and penalties in relation to drainage works.
19.—(1) Every person who—
(a) shall wilfully obstruct a county council or joint committee or any of the officers or servants of such council or committee in the exercise of any of the powers or the performance of any of the duties conferred or imposed on them by or under this Act or the exercise of any right of entry on lands conferred by this Act, or
(b) shall wilfully obstruct any person appointed under this Act by a county council or county councils to make a report for the purpose of this Act in the exercise of any of the powers conferred on him by this Act, or
(c) shall pull down, remove, or injure any works in course of construction by a county council or joint committee under this Act, or
(d) shall remove, injure, or deface any pegs, poles, or marks placed or made by a county council or joint committee or any of their officers or servants for the purpose or in the course of the exercise of any of the powers or the performance of any of the duties conferred or imposed on them by or under this Act, or
(e) shall throw or put any weeds, stones, soil, or other solid matter or shall cause or permit any such solid matter to fall or pass into any watercourse in respect of which any works are about to be or are in course of being constructed by a county council or joint committee under this Act so as to cause any obstruction, hindrance, or delay to such works, or
(f) shall place or erect any dam, weir, or other obstruction in any such watercourse as aforesaid without the consent of the county council or joint committee concerned, or
(g) shall fail to keep clean and scoured any watercourse or drain which he is liable to maintain and in respect of which works are about to be or are in course of being or have been constructed by a county council or joint committee under this Act or which communicates directly or indirectly with any such watercourse or drain,
shall be guilty of an offence under this section and be punishable accordingly.
(2) Every person who after any drainage works constructed under this Act are completed—
(a) shall wilfully obstruct the county council or joint committee charged by virtue of this Act with the maintenance of such drainage works or any officer or servant of any such council or committee in the exercise of any of their powers or the performance of any of their duties in relation to such drainage works, or
(b) shall pull down, remove, or in anywise injure any such drainage works or any part thereof, or
(c) shall obstruct the flow of water to, through, or from any such drainage works in such manner as to prevent or hinder the efficient operation thereof or to cause flooding of such works or lands drained thereby,
shall be guilty of an offence under this section and shall be punishable accordingly.
(3) Every person convicted by a court of summary jurisdiction of an offence under this section shall be liable to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment, and shall also in the case of a continuing offence be liable to a fine (in addition to any such fine as aforesaid) not exceeding five pounds for every day during which the offence continues.
(4) For the purposes of this section drainage works shall be deemed to be in course of construction until the drainage scheme under which the same are constructed is fully carried out.
Bye-laws in relation to drainage works.
20.—(1) Every county council or joint committee maintaining drainage works under this Act may make bye-laws for all or any of the purposes following, that is to say:—
(a) regulating the opening, closing, and working of sluices, hatches, flood-gates, and other machinery comprised in the works,
(b) regulating generally the management and operation of the works,
(c) prohibiting persons from obstructing, polluting, or putting solid matter into any watercourse flowing to, through, or from the works so as to prevent or hinder the efficient operation of the works or to cause flooding of any lands drained by the works,
(d) prohibiting any injury or damage to the works by any person or any interference therewith by unauthorised persons,
(e) prescribing the penalties which may be inflicted on persons found by a court of summary jurisdiction to be guilty of contravening the bye-laws but so that no such penalty shall exceed a fine of twenty-five pounds together with, in the case of a continuing offence, a further fine of five pounds for every day during which the offence continues or, in any case and at the discretion of the court, imprisonment for a term of three months.
(2) No bye-law made under this section shall be of any force or effect unless and until confirmed by the Minister, and every such bye-law when so confirmed shall come into operation on the date prescribed in that behalf by the Minister when confirming the same or, if no such date is so prescribed, immediately upon such confirmation.
(3) Any person found guilty by a court of summary jurisdiction of contravening any bye-law made under this section may be sentenced by such court to suffer any penalty not exceeding the penalty prescribed by such bye-law in respect of such contravention or, where no penalty is so prescribed, not exceeding a fine of twenty-five pounds together with, in the case of a continuing offence, a further fine of five pounds for every day during which the offence continues or, in any case and at the discretion of the court, imprisonment for any term not exceeding three months.
Raising of moneys by county councils.
21.—(1) All moneys which a county council is by this Act authorised or directed to pay out of the county fund and also all expenses incurred by a county council in the execution of this Act and the raising of which is not otherwise provided for by this Act shall be raised by means of the poor rate as a county-at-large charge.
(2) A county council may borrow money for the purposes of this Act under Article 22 of the Schedule to the Local Government (Application of Enactments) Order, 1898, in like manner as if those purposes were mentioned in that Article, and money borrowed under this section by a county council for the purposes of this Act shall not be reckoned as part of the total debt of such county council for the purposes of the said Article.
(3) A county council borrowing money under this section may borrow such money from the Commissioners of Public Works in Ireland and those Commissioners may if they think fit lend such money to such county council under the Public Works (Ireland) Acts, 1831 to 1886 and notwithstanding anything in those Acts such loan may be made for such term as the said Commissioners think fit.
Appointment of joint committees of county councils.
22.—(1) Every joint committee appointed under this Act by two or more county councils for the purpose of preparing and (if confirmed) carrying out a drainage scheme and maintaining the drainage works constructed pursuant to such scheme shall be so appointed in such proportions and shall consist of such total number of members and of such number of members of each of such councils and such number (if any) of persons who are not members of any such council as the Minister shall direct.
(2) The Minister may prescribe the time of election (including the first election) of members of such joint committees as aforesaid, the period for which such members shall hold office, the method of filling casual vacancies in their number, the disqualification of members who cease to be or become disqualified to be members of the council by which they were appointed, and the conduct of the business of such joint committees.
(3) The accounts of every such joint committee shall be separately kept and shall be audited by an auditor appointed by the Minister and the following enactments, that is to say, sections 11 to 15 of the Local Government (Ireland) Act, 1871, sub-section (2) of section 63 of the Local Government (Ireland) Act, 1898, sections 20 and 21 of the Local Government (Ireland) Act, 1902, and section 61 of the Local Government Act, 1925 (No. 5 of 1925) as amended or adapted by or under any subsequent enactment shall apply to the audit and auditor of the accounts of such joint committees in the same manner as such enactments as so amended or adapted apply to the audit and auditor of the accounts of the public bodies specified therein.
(4) Legal proceedings had or taken by a joint committee appointed under this section shall be had or taken in the names jointly of the county councils by whom such committee is appointed and legal proceedings had or taken against any such joint committee shall be had or taken against such councils jointly.
(5) Nothing in this section shall authorise a joint committee appointed under this section to raise any moneys which are by this Act required or authorised to be raised by a county council.
Appointment of officers.
23.—(1) A county council or a joint committee appointed under this Act may appoint such and so many officers as they shall from time to time think proper for the purposes of this Act.
(2) There shall be paid by a county council or joint committee to the officers appointed by them under this section such remuneration as may be determined by such council or committee.
(3) Any officer appointed under this section may at any time be removed from his office as such officer by the council or committee by which he was appointed.
Powers of entry on lands.
24.—(1) Every county council or joint committee preparing or carrying out a drainage scheme or maintaining drainage works under this Act and their officers and servants shall be entitled at all reasonable times to enter for the purposes of such preparation, carrying out, or maintaining on any lands to which such scheme is intended to or does relate or on which such drainage works have been constructed and on any other lands in the neighbourhood thereof entry on which appears to them to be necessary for such purposes.
(2) Every county council or joint committee which or the officers or servants of which enter on any lands under this section shall be liable to pay to the occupier of such lands reasonable compensation for the damage (if any) done to such lands by such entry or by the execution thereon of the purpose for which such entry was made, and the right to and amount of such compensation shall in default of agreement be determined by the District Court on the application of either party and the costs of such application shall be borne by such party or parties as the court shall in its discretion direct.
Inquiries by the Minister.
25.—(1) The Minister may hold or cause to be held such inquiries as he considers necessary or expedient for the purposes of this Act.
(2) Article 32 of the Local Government (Application of Enactments) Order, 1898, shall apply to every inquiry held under this section.
Regulations.
26.—(1) The Minister may by order make regulations in regard to any matter or thing which is referred to in this Act as prescribed or which the Minister is authorised by this Act to prescribe.
(2) Every regulation made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either House of the Oireachtas within the next subsequent twenty-one days on which that House has sat annulling such regulation such regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under such regulation.
Saving for State and public property.
27.—Nothing in this Act shall authorise any acquisition of or interference with any property, real or personal, vested in Saorstát Eireann or in a Minister head of a Department of State or in a board or body exercising any functions of government or public administration or any restriction of or other interference with any power vested by statute in a Minister head of a Department of State or in any such board or body as aforesaid.
Short title.
28.—This Act may be cited as the Arterial Drainage (Minor Schemes) Act, 1928.
