1.—San Acht so cialluíonn an abairt “an Príomh-Acht” Acht na mBóthar Iarainn, 1924 (Uimh. 29 de 1924).

2.—(1) Gach ball seasmhach den bhínse bhóthair iarainn a ceapfar tar éis rithte an Achta so is go ceann bliana a ceapfar é agus a shealbhóidh sé oifig agus raghaidh sé as oifig ansan ach beidh sé ionathcheaptha.

(2) Athghairmtear, leis seo, fo-alt (2) d'alt 13 den Phríomh-Acht ach ní dhéanfidh an athghairm sin dochar ná deifir d'fhaid téarma oifige éinne is ball seasmhach den bhínse bhóthair iarainn fé láthair fé cheapachán a dineadh roimh rith an Achta so ná fós d'incheapthacht aon bhaill den tsórt san fén alt so.

Laigheadú an bhínse bhóthair iarainn go ball amháin.

3.—(1) Féadfidh an Seanascal, tré ordú do dhéanamh ar chomhairle na hArd-Chomhairle aon uair le linn triúr ball seasmhach do bheith ar an mbínse bóthair iarainn, a dhearbhú go bhfuil sé oiriúnach chun leasa na puiblíochta ná déanfaí, ar bheith caithte do sna téarmaí oifige a bheidh á gcaitheamh an uair sin ag na gnáth-bhaill den bhínse bhóthair iarainn, aon ghnáth-bhall do cheapa chun an bhínse bhóthair iarainn agus (gan dochar d'fhorálacha fo-alt (4) d'alt 17 den Phríomh-Acht) go mbeadh an bínse bóthair iarainn có-dhéanta den Chathaoirleach amháin.

(2) Pé uair a déanfar ordú fén bhfo-alt san roimhe seo, ansan ar bheith caithte do sna téarmaí oifige a bheidh á gcaitheamh ar dháta an orduithe sin ag na gnáth-bhaill den bhínse bhóthair iarainn agus go ceann pé tréimhse 'na dhiaidh sin a fhanfidh an t-ordú san gan ceiliúra ní ceapfar aon ghnáth-bhaill den bhínse bhóthair iarainn agus isé an Cathaoirleach an t-aon bhall seasmhach amháin a bheidh ann den bhínse bhóthair iarainn agus (gan dochar d'fhorálacha fo-alt (4) d'alt 17 den Phríomh-Acht) beidh an bínse bóthair iarainn có-dhéanta den Chathaoirleach amháin.

(3) Féadfidh an Seanaseal aon uair, tré ordú do dhéanamh ar chomhairle na hArd-Chomhairle, ordú a bheidh déanta aige roimhe sin fé fho-alt (1) den alt so do cheiliúra.

(4) Gach ordú a déanfar fén alt so foillseofar é san Iris Oifigiúil chó luath agus is féidir é tar éis a dhéanta.

RAILWAYS (AMENDMENT) ACT, 1929.


AN ACT TO REDUCE THE TERM OF OFFICE OF THE STANDING MEMBERS OF THE RAILWAY TRIBUNAL TO A PERIOD OF ONE YEAR AND TO ENABLE THE NUMBER OF STANDING MEMBERS OF THE RAILWAY TRIBUNAL TO BE REDUCED TO ONE. [16th July, 1929.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

The Principal Act.

1.—In this Act the expression “the Principal Act” means the Railways Act, 1924 (No. 29 of 1924).

Term of office of members of railway tribunal.

2.—(1) Every standing member of the railway tribunal appointed after the passing of this Act shall be appointed and hold office for one year and shall then retire, but shall be eligible for re-appointment.

(2) Sub-section (2) of section 13 of the Principal Act is hereby repealed but such repeal shall not prejudice or affect the duration of the term of office of any existing standing member of the railway tribunal under an appointment made before the passing of this Act or the eligibility of any such member for appointment under this section.

Reduction of railway tribunal to one member.

3.—(1) The Governor-General may, by order made on the advice of the Executive Council at any time while there are three standing members of the railway tribunal, declare that it is expedient in the public interest that on the expiration of the terms of office then current of the ordinary members of the railway tribunal no appointment of ordinary members of the railway tribunal should be made and that (without prejudice to the provisions of sub-section (4) of section 17 of the Principal Act) the railway tribunal should consist of the Chairman alone.

(2) Whenever an order is made under the foregoing sub-section then on the expiration of the terms of office of the ordinary members of the railway tribunal current at the date of such order and for so long thereafter as such order remains unrevoked no appointment shall be made of ordinary members of the railway tribunal and the Chairman shall be the only standing member of the railway tribunal and (without prejudice to the provisions of sub-section (4) of section 17 of the Principal Act) the railway tribunal shall consist of the Chairman alone.

(3) The Governor-General may at any time by order made on the advice of the Executive Council revoke an order previously made by him under sub-section (1) of this section.

(4) Every order made under this section shall be published in the Iris Oifigiúil as soon as may be after it is made.

Short title, construction and citation.

4.—(1) This Act may be cited as the Railways (Amendment) Act, 1929.

(2) This Act shall be construed as one with Part II of the Principal Act.

[GA]

(3) The Railways Acts, 1924 and 1926, and this Act may be cited together as the Railways Acts, 1924 to 1929.
