1.—(1) San Acht seo—

(2) Déanfar tagairtí san Acht seo do mhonaí a eisíodh faoi na hachtacháin aisghairthe a fhorléiriú mar thagairtí do mhonaí a eisíodh faoin Acht Coighneála, 1926, nó faoin Acht sin arna leasú leis an Ordú Comhachta Práinne (Uimh. 140), 1942, nó le hailt 58 agus 60 d'Acht an Bhainc Cheannais, 1942, nó faoi Acht 1950.

2.—(1) An 15ú lá d'Fheabhra, 1971, agus dá éis, beidh ainmluach nó aonad airgid in airgead reatha Éireannach ann ar a dtabharfar an phingin nua agus an céadú cuid de phunt Éireannach a bheidh ann.

(2) Is é an punt Éireannach agus an phingin nua na hainmluachanna nó na haonaid airgid dlíthiúla amháin in airgead reatha Éireannach a bheidh ann cibé lá, agus tar éis cibé lá, a cheapfaidh an tAire le hordú faoin bhfo-alt seo.

(3) An phingin a thabharfar ar an bpingin nua cibé lá, agus tar éis cibé lá, a cheapfaidh an tAire le hordú faoin bhfo-alt seo agus déanfar tagairtí don phingin nua in aon reacht nó ionstraim a dhéanfar faoin gcéanna a fhorléiriú dá réir sin an lá, agus tar éis an lae, a cheapfar faoin bhfo-alt seo.

Monaí cupranicile agus monaí créumha a sholáthar.

3.—(1) Féadfaidh an tAire monaí cupra-nicile agus monaí créumha de na hainmluachanna faoi seach a shonraítear i gcolún (1) den Chéad Sceideal a ghabhann leis an Acht seo a sholáthar, agus féadfaidh sé cibé bearta a dhéanamh is cuí leis chun na monaí sin a sholáthar.

(2) Gach mona a sholáthrófar faoin alt seo beidh an meáchan caighdeánach agus an comhshuíomh caighdeánach ann a shonraítear ina leith i gcolúin (2) agus (3) den Chéad Sceideal sin nó, más mona cupra-nicile é, an meáchan caighdeánach a shonraítear amhlaidh agus cibé comhshuíomh caighdeánach eile a bheidh sonraithe de thuras na huaire le hordú faoi fho-alt (3) den alt seo.

(3) Féadfaidh an tAire, maidir le haon mhonaí cupra-nicile d'ainmluach áirithe a sholáthrófar faoin alt seo, an Chéad Sceideal sin a leasú le hordú trí cibé comhshuíomh caighdeánach eile is oiriúnach leis agus a shonróidh sé san ordú a chur in ionad an chomhshuímh chaighdeánaigh a shonraítear sa Chéad Sceideal sin i leith na monaí sin agus beidh éifeacht dá réir sin ag an gCéad Sceideal sin.

(4) Lamhálfar i leith monaí a sholáthrófar faoin alt seo an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) a luaitear ina leith i gcolún (4) den Chéad Sceideal sin.

(5) (a) Féadfaidh an tAire monaí cupra-nicile agus monaí créumha seachas iad sin dá bhforáiltear sa Chéad Sceideal sin a sholáthar agus féadfaidh sé, le hordú, ainmluachanna, meáchain chaighdeánacha agus comhshuímh chaighdeánacha na monaí sin agus an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomshuíomh caighdeánach) a bheidh le lamháil ina leith a chinneadh.

(b) Féadfaidh an tAire le hordú ordú faoin bhfo-alt seo a leasú nó a chúlghairm.

(c) Ní thiocfaidh aon ordú faoin bhfo-alt seo i bhfeidhm mura ndéanfar agus go dtí go ndéanfar é a dhaingniú le rún ó gach Teach den Oireachtas.

(6) Féadfaidh an tAire, le rialacháin, toisí agus dearadh na n-ainmluach monaí faoi seach a sholáthrófar faoin alt seo a fhorordú agus is de na toisí agus den dearadh a fhorordófar amhlaidh ina leith a bheidh gach mona a sholáthrófar amhlaidh.

4.—(1) San alt seo, ní folaíonn “miotal” ór ná airgead.

(2) (a) Féadfaidh an tAire, aon uair agus a mhinice is oiriúnach leis, a dhearbhú le hordú (dá ngairtear ordú monaíochta nua san alt seo) gur foirsteanach go soláthrófaí monaí de mhiotal sonraithe nó de mheascán sonraithe miotal, seachas cupra-nicil (cibé acu a bheidh copar nó nicil ann nó nach mbeidh), d'aon mhona cupra-nicile d'ainmluach sonraithe a údaraítear don Aire le halt 3, nó faoi alt 3, den Acht seo a sholáthar.

(b) Aon ordú monaíochta nua a bhainfidh le monaí d'ainmluach áirithe sonróidh sé meáchan caighdeánach agus comhshuíomh caighdeánach na monaí sin agus an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) a bheidh le lamháil ina leith.

(c) Féadfaidh an tAire le hordú ordú monaíochta nua a leasú nó a chúlghairm.

(d) Ní thiocfaidh aon ordú faoin bhfo-alt seo i bhfeidhm mura ndéanfar agus go dtí go ndéanfar é a dhaingniú le rún ó gach Teach den Oireachtas.

(3) Aon uair a bheidh ordú monaíochta nua i bhfeidhm—

(a) féadfaidh an tAire monaí lena mbainfidh an t-ordú a sholáthar agus cibé bearta a dhéanamh is cuí leis chun na monaí sin a sholáthar,

(b) ní sholáthróidh an tAire, faoi alt 3 den Acht seo, aon mhonaí cupra-nicile arb ionann a n-ainmluach agus na monaí lena mbainfidh an t-ordú.

(4) Gach mona a sholáthrófar faoin alt seo beidh an meáchan caighdeánach agus an comhshuíomh caighdeánach ann a bheidh sonraithe ina leith san ordú monaíochta nua a bhainfidh leis an mona sin, ach lamhálfar ina leith an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) a bheidh luaithe ina leith san ordú.

(5) Féadfaidh an tAire, le rialacháin, toisí agus dearadh na n-ainmluach monaí faoi seach a sholáthrófar faoin alt seo a fhorordú agus is de na toisí agus den dearadh a fhorordófar amhlaidh ina leith a bheidh gach mona a sholáthrófar amhlaidh.

5.—Gach mona a sholáthrófar faoi alt 3 nó 4 den Acht seo eiseoidh an tAire tríd an mBanc Ceannais é.

6.—Gach suim a bheidh ag teastáil chun monaí a sholáthar a sholáthrófar faoi alt 3 nó 4 den Acht seo íocfar as ciste ginearálta an Bhainc Cheannais í agus féichiúnúnófar sa chiste sin í ar chúlchiste an airgid reatha.

7.—Déanfar na fáltais ó mhonaí a eisiúint a sholáthrófar faoi alt 3 nó 4 den Acht seo a íoc isteach i gciste ginearálta an Bhainc Ceannais agus a chur chun creidiúna cúlchiste an airgid reatha as chiste sin.

8.—(1) Má dhéantar airgead a thairiscint, an 15ú lá d'Fheabhra, 1971, nó dá éis, i monaí (seachas monaí créumha) a eisíodh faoin Acht seo, agus ainmluach is mó ná deich bpingin nua ar gach mona acu, beidh an tairiscint sin ina dlíthairiscint suim nach mó ná deich bpunt a íoc, ach ní bheidh i gcás aon suim is mó ná sin.

(2) Má dhéantar airgead a thairiscint, an 15ú lá d'Fheabhra, 1971, nó dá éis sin, i monaí (seachas monaí créumha) a eisíodh faoin Acht seo agus ainmluach nach mó deich bpingin nua ar gach mona acu, beidh an tairiscint sin ina dlíthairiscint suim nach mó ná cúig phunt a íoc, ach ní bheidh i gcás aon suime is mó ná sin.

(4) Ní bhaineann an t-alt seo le monaí a ghlaofar isteach faoin Acht seo.

9.—(1) Féadfar monaí ag a mbeidh ainmluach caoga pingin nua a eisiúint roimh an 15ú lá d'Fheabhra, 1971, agus, roimh an dáta sin—

(a) measfar gur monaí reatha iad agus ainmluach deich scilling a bheith acu, agus

[EN]

(b) beidh siad ina ndlíthairiscint suim nach mó ná deich bpunt a íoc, ach ní bheidh i gcás aon suim is mó ná sin.

(2) Ar mhonaí darb ainmluach caoga pingin nua a eisiúint faoin Acht seo, scoirfidh an Banc Ceannais de nótaí dlíthairiscinte deich scilling darb ainmluach deich scilling a eisiúint faoi alt 45 (1) den Acht Airgid Reatha, 1927.

10.—(1) Féadfar monaí darb ainmluach deich bpingin nua nó cúig phingin nua a eisiúint roimh an 15ú lá d'Feabhra, 1971, agus measfar, roimh an dáta sin, gur monaí iad darb ainmluach flóirín nó scilling, de réir mar a bheidh, a eisíodh de réir forálacha Acht 1950.

(2) An 15ú lá d'Fheabhra, 1971, agus dá éis, na monaí darb ainmluach flóirín nó scilling agus a eisíodh faoin Acht Coighneála, 1926, nó faoi Acht 1950, leanfaidh siad de bheith ina monaí reatha agus measfar gur monaí iad darb ainmluach deich bpingin nua nó cúig phingin nua, de réir mar a bheidh, a eisíodh faoin Acht seo.

Fuascailt monaí a eisíodh faoi na hachtacháin aisghairthe nó faoin Acht seo.

11.—Féadfaidh an Banc Ceannais, más oiriúnach leis sin a dhéanamh, monaí a eisíodh faoi na hachtacháin aisghairthe nó faoin Acht seo a fhuascailt agus déanfar gach suim a bheidh ag teastáil chun na críche sin a íoc as ciste ginearálta an Bhainc Cheannais agus a fhéichiúnú ar chúlchiste an airgid reatha sa chiste sin.

Monaí a eisíodh faoi na hachtacháin aisghairthe nó faoin Acht seo a ghlaoch isteach.

12.—(1) Féadfaidh an tAire, le hordú, monaí d'aon dáta nó ainmluach áirithe, a eisíodh faoi na hachtacháin aisghairthe nó faoin Acht seo, a ghlaoch isteach.

(2) Beidh feidhm ag na forálacha seo a leanas maidir le gach ordú faoi fho-alt (1) den alt seo—

[EN]

(a) forálfar san ordú go dtiocfaidh sé i ngníomh ar dháta áirithe (dá ngairtear an dáta feidhme san fho-alt seo) nach luaithe ná sé mhí tar éis dáta a dhéanta,

[EN]

(b) leagfar an t-ordú faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, roimh an dáta feidhme, rún a rith ag neamhniú an ordaithe beidh an t-ordú ar neamhní dá réir sin.

(3) Beidh éifeacht ag aon ordú a rinneadh faoi alt 11 d'Acht 1950 ionann is dá mba faoin alt seo a rinneadh é agus measfar gur faoin alt seo a rinneadh é.

13.—Féadfaidh an Banc Ceannais na fáltais ó leá monaí a tharraingeofar as cúrsaíocht nó monaí a bheidh ar stoc ag an mBanc Ceannais, agus nach mbeidh ag teastáil chun a n-eisiúna nó a n-atheisiúna, a chur isteach i gcúlchiste an airgid reatha.

14.—(1) Ach amháin monaí a eiseofar faoin Acht seo, ní dhéanfar ná ní eiseofar sa Stát aon phíosa miotail nó miotail mheasctha d'aon luach ar bith mar mhona ná mar inchomhartha ar airgead ná mar ní a airbheartaíonn go bhfuil a shealbhóir i dteideal aon luach a thaispeáintear air a éileamh.

(2) Ní bhaineann fo-alt (1) den alt seo leis an mBanc Ceannais d'eisiúint monaí, roimh Acht 1950 a aisghairm le halt 23 (2) den Acht seo, a soláthraíodh faoin Acht sin nó monaí a soláthraíodh, roimh Acht 1950 a rith, faoin Acht Coighnéala, 1926, nó faoin Acht sin arna leasú leis an Ordú Comhachta Práinne (Uimh. 140), 1942, nó le hailt 58 agus 60 d'Acht an Bhainc Cheannais, 1942.

(3) Gach duine a dhéanfaidh nó a eiseoidh aon phíosa miotail nó miotail mheasctha contrártha d'fho-alt (1) den alt seo, beidh sé ciontach i gcion agus dlífear—

15.—(1) Ní dleathach d'aon duine (seachas an Banc Ceannais), ach amháin faoi réim agus de bhun ceadúnais arna eisiúint ag an Aire, aon mhona a eisíodh faoi na hachtacháin aisghairthe nó faoin Acht seo nó a bheidh de thuras na huaire ar rith in aon tír eile seachas an Stát a leá ná a bhriseadh.

(2) Duine ar bith—

(a) a dhéanfaidh gníomh contrártha don alt seo, nó

(b) nach gcomhlíonfaidh aon choinníoll áirithe a bheidh ag gabháil le ceadúnas arna dheonú faoin alt seo,

16.—(1) Féadfaidh an tAire Tionscail agus Tráchtála, le rialacháin faoin alt seo, socrú a dhéanamh le haghaidh modh nó modhanna ar a ndéanfar préimheanna nó íocaíochtaí eile is iníoctha le carachumann cláraithe nó le cuideachta árachais tionscail faoi chonradh cara-chumainn nó faoi chonradh árachais tionscail, de réir mar a bheidh, agus is leathphingin nó ina bhfuil leathphingin, a athrú ionas go gcuirfear i gcuntas monaí darb ainmluach leathphingin a ghlaoch isteach.

(2) San alt seo—

tá le “cuideachta árachais” agus “gnó árachais tionscail” an bhrí chéanna atá leo san Acht Árachais, 1936, agus tá an bhrí chéanna le “préimh” atá le “praemium” san Acht sin;

ciallaíonn “conradh cara-chumainn” conradh arna dhéanamh ag cara-chumann cláraithe i gcúrsa a ghnó sa Stát, cibé acu atá nó nach bhfuil sé i rialacha an chumainn;

17.—Déanfar gach ordú agus rialachán faoin Acht seo (seachas ordú faoi alt 3 (5), 4 nó 12 den Acht seo) a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir é tar éis a dhéanta agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú nó an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe nó an rialacháin beidh an t-ordú nó an rialachán ar neamhní dá réir sin, ach sin gan dochar d'aon ní a rinneadh roimhe sin faoi.

18.—Foilseofar gach ordú faoin Acht seo san Iris Oifigiúil a luaithe is féidir é tar éis a dhéanta.

Costais an Aire agus an Aire Tionscail agus Tráchtála.

19.—Déantar na costais a thabhóidh an tAire ag riaradh an Achta seo a íoc as airgead a sholáthróidh an tOireachtas agus déanfar costais a thabhóidh an tAire Tionscail agus Tráchtála ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire, as airgead a sholáthróidh an tOireachtas.

20.—Íocfar as cuntas ginearálta an Bhainc Cheannais aon chostais a thabhóidh an Banc Ceannais i ndáil le monaí a eisiúint, a fhuascailt nó a leá.

DECIMAL CURRENCY ACT, 1969


AN ACT TO PROVIDE FOR THE INTRODUCTION OF A DECIMAL CURRENCY IN THE YEAR 1971 AND TO PROVIDE FOR MATTERS CONNECTED WITH SUCH INTRODUCTION AND FOR OTHER MATTERS CONNECTED WITH CURRENCY AND COINAGE. [30th July, 1969] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Definitions.

1.—(1) In this Act—

the Act of 1950” means the Coinage Act, 1950;

[GA]

the Central Bank” means the Central Bank of Ireland;

[GA]

cupro-nickel”, in relation to a coin, means a coin made of a mixture of copper and nickel;

[GA]

the Minister” means the Minister for Finance.

[GA]

(2) References in this Act to coins issued under the repealed enactments shall be construed as references to coins issued under the Coinage Act, 1926, or that Act as amended by the Emergency Powers (No. 140) Order, 1942, or by sections 58 and 60 of the Central Bank Act, 1942, or under the Act of 1950.

The new decimal currency.

2.—(1) On and after the 15th day of February, 1971, there shall be a denomination or unit of money in Irish currency which shall be known as the new penny and shall be one-hundredth part of an Irish pound.

[GA]

(2) On and after such day as the Minister may appoint by order under this subsection, the Irish pound and the new penny shall be the only legal denominations or units of money in Irish currency.

[GA]

(3) On and after such day as the Minister may appoint by order under this subsection, the new penny shall be known as the penny and references in any statute or instrument made thereunder to the new penny shall, on and after the day appointed under this subsection, be construed accordingly.

Provision of cupro-nickel and bronze coins.

3.—(1) The Minister may provide cupro-nickel and bronze coins of the several denominations specified in column (1) of the First Schedule to this Act, and may take such steps as he thinks proper for the provision of such coins.

[GA]

(2) Every coin provided under this section shall be of the standard weight and standard composition specified in respect thereof in columns (2) and (3) of the said First Schedule or, if it is a cupro-nickel coin, the standard weight so specified and such other standard composition as stands specified for the time being by order under subsection (3) of this section.

[GA]

(3) The Minister may, in respect of any cupro-nickel coins of a particular denomination provided under this section, by order amend the said First Schedule by substituting, for the standard composition specified therein in respect of those coins, such other standard composition as he thinks fit and specifies in the order and the said First Schedule shall have effect accordingly.

[GA]

(4) There shall be allowed in respect of coins provided under this section the remedy (or variation from the standard weight and standard composition) stated in respect thereof in column (4) of the said First Schedule.

[GA]

(5) (a) The Minister may provide cupro-nickel and bronze coins other than those provided for in the said First Schedule and may by order determine the denominations, standard weights and standard compositions of such coins and the remedy (or variation from the standard weight and standard composition) to be allowed in respect thereof.

(b) The Minister may by order amend or revoke an order under this subsection.

[GA]

(c) No order under this subsection shall come into force unless and until it has been confirmed by resolution of each House of the Oireachtas.

[GA]

(6) The Minister may by regulations prescribe the dimensions and design of the several denominations of coins to be provided under this section and every coin so provided shall be of the dimensions and design so prescribed in respect thereof.

Provision of coins in lieu of cupro-nickel coins.

4.—(1) In this section “metal” does not include gold or silver.

[GA]

(2) (a) The Minister may, whenever and so often as he thinks fit, by order (in this section referred to as a new coinage order) declare that it is expedient to provide coins of a specified metal or a specified mixture of metals, other than cupro-nickel (whether or not including copper or nickel), of any specified denomination of cupro-nickel coin which the Minister is authorised by or under section 3 of this Act to provide.

(b) A new coinage order relating to coins of a particular denomination shall specify the standard weight and standard composition of those coins and the remedy (or variation from the standard weight and standard composition) to be allowed in respect thereof.

[GA]

(c) The Minister may by order amend or revoke a new coinage order.

[GA]

(d) No order under this subsection shall come into force unless and until it has been confirmed by resolution of each House of the Oireachtas.

[GA]

(3) Where a new coinage order is in force—

[GA]

(a) the Minister may provide coins to which the order relates and take such steps as he thinks proper for the provision of such coins,

[GA]

(b) the Minister shall not provide under section 3 of this Act any cupro-nickel coins of the like denomination as the coins to which the order relates.

[GA]

(4) Every coin provided under this section shall be of the standard weight and standard composition specified in respect thereof in the new coinage order relating to such coin, but there shall be allowed in respect thereof the remedy (or variation from the standard weight and standard composition) stated in respect thereof in the order.

[GA]

(5) The Minister may by regulations prescribe the dimensions and design of the several denominations of coins provided under this section and every coin so provided shall be of the dimensions and design so prescribed in respect thereof.

Issue of coins provided under section 3 or 4.

5.—Every coin provided under section 3 or 4 of this Act shall be issued by the Minister through the Central Bank.

[GA]

Expenses of provision of coins under section 3 or 4.

6.—All sums required for the provision of coins provided under section 3 or 4 of this Act shall be defrayed out of the general fund of the Central Bank and debited therein to the currency reserve.

[GA]

Proceeds of issue of coins provided under section 3 or 4.

7.—The proceeds of every issue of coins provided under section 3 or 4 of this Act shall be paid into the general fund of the Central Bank and carried therein to the credit of the currency reserve.

[GA]

Legal tender.

8.—(1) A tender of money if made, on or after the 15th day of February, 1971, in coins (other than bronze coins) which are issued under this Act and each of which has a denomination of more than ten new pence shall be legal tender for the payment of an amount not exceeding ten pounds but for no greater amount.

[GA]

(2) A tender of money if made, on or after the 15th day of February, 1971, in coins (other than bronze coins) which are issued under this Act and each of which has a denomination of not more than ten new pence shall be legal tender for the payment of an amount not exceeding five pounds but for no greater amount.

[GA]

(3) A tender of money if made, on or after the 15th day of February, 1971, in bronze coins issued under this Act shall be legal tender for the payment of an amount not exceeding twenty new pence but for no greater amount.

[GA]

(4) This section does not apply to coins called in under this Act.

[GA]

Provisions in relation to coins of fifty new pence.

9.—(1) Coins having a denomination of fifty new pence may be issued before the 15th day of February, 1971, and shall, before that date—

(a) be deemed to be current coins and to have a denomination of ten shillings, and

[GA]

(b) be legal tender for the payment of an amount not exceeding ten pounds but for no greater amount.

[GA]

(2) Upon the issue under this Act of coins having a denomination of fifty new pence, the Central Bank shall cease to issue under section 45 (1) of the Currency Act, 1927, legal tender notes having a denomination of ten shillings.

[GA]

Provisions in relation to coins often or five new pence.

10.—(1) Coins having a denomination of ten new pence or five new pence may be issued before the 15th day of February, 1971, and shall be deemed, before that date, to be coins having a denomination of a florin or a shilling, as the case may be, issued in accordance with the provisions of the Act of 1950.

(2) On and after the 15th day of February, 1971, coins having a denomination of a florin or a shilling issued under the Coinage Act, 1926, or the Act of 1950 shall continue to be current coins and shall be deemed to be coins having a denomination of ten new pence or five new pence, as the case may be, issued under this Act.

Redemption of coins issued under the repealed enactments or this Act.

11.—The Central Bank may, if it thinks fit so to do, redeem coins issued under the repealed enactments or this Act and all sums required for that purpose shall be defrayed out of the general fund of the Central Bank and debited therein to the currency reserve.

Calling in of coins issued under the repealed enactments or this Act.

12.—(1) The Minister may by order call in coins issued under the repealed enactments or this Act of any particular date or denomination.

[GA]

(2) The following provisions shall apply in respect of every order under subsection (1) of this section—

[GA]

(a) the order shall provide for its coming into operation on a particular date (in this subsection referred to as the operative date) not being earlier than six months after the date of its making,

[GA]

(b) the order shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order is passed by either such House before the operative date, the order shall be annulled accordingly.

[GA]

(3) Any order made under section 11 of the Act of 1950 shall have effect as though it had been made under this section and shall be deemed to have been made under this section.

[GA]

Disposal of proceeds of melting down of coins.

13.—The Central Bank may carry to the currency reserve the proceeds of melting down of coins withdrawn from circulation or of coins held in stock by the Central Bank and not required for issue or reissue.

[GA]

Prohibition of making or issuing of coins.

14.—(1) Except coins issued under this Act, no piece of metal or mixed metal of any value whatsoever shall be made or issued in the State as a coin or a token for money or as purporting that the holder thereof is entitled to demand any value denoted thereon.

[GA]

(2) Subsection (1) of this section does not apply to the issue by the Central Bank, before the repeal of the Act of 1950 effected by section 23 (2) of this Act, of coins provided under that Act or of coins provided, before the passing of the Act of 1950, under the Coinage Act, 1926, or that Act as amended by the Emergency Powers (No. 140) Order, 1942, or by sections 58 and 60 of the Central Bank Act, 1942.

(3) Every person who makes or issues any piece of metal or mixed metal in contravention of subsection (1) of this section shall be guilty of an offence and shall be liable—

[GA]

(a) on summary conviction to a fine not exceeding one hundred pounds, or

[GA]

(b) on conviction on indictment to a fine not exceeding five hundred pounds.

[GA]

Prohibition of melting down, etc., of coins.

15.—(1) It shall not be lawful for any person (other than the Central Bank) except under and in pursuance of a licence issued by the Minister to melt down or break up any coin which has been issued under the repealed enactments or this Act or which is for the time being current in any country other than the State.

[GA]

(2) If any person—

[GA]

(a) acts in contravention of this section, or

[GA]

(b) fails to comply with any condition attached to a licence under this section,

[GA]

he shall be guilty of an offence and shall be liable—

[GA]

(i) on summary conviction to a fine not exceeding one hundred pounds or at the discretion of the court to imprisonment for a term not exceeding one year or to both such fine and such imprisonment, or

[GA]

(ii) on conviction on indictment to a fine not exceeding five hundred pounds or at the discretion of the court to imprisonment for a term not exceeding two years or to both such fine and such imprisonment

[GA]

and, in addition to any other punishment, the court may order the articles in respect of which the offence was committed to be forfeited.

[GA]

Payments under friendly society and industrial assurance company contracts.

16.—(1) The Minister for Industry and Commerce may by regulations under this section provide for a method or methods by which premiums or other payments which are payable to a registered friendly society or an industrial assurance company under a friendly society contract or an industrial assurance contract, as the case may be, and which consist of or include a halfpenny shall be varied to take account of the calling in of coins of the denomination halfpenny.

(2) In this section—

[GA]

assurance company”, “industrial assurance business” and “premium” have the same meanings as in the Insurance Act, 1936;

[GA]

friendly society contract” means a contract made by a registered friendly society in the course of its business in the State, whether contained in the rules of the society or not;

[GA]

industrial assurance company” means an assurance company which carries on industrial assurance business in the State;

[GA]

industrial assurance contract” means a contract of assurance made by a person carrying on industrial assurance business in the course of his industrial assurance business in the State;

[GA]

registered friendly society” means a society registered in the State under the Friendly Societies Acts, 1896 to 1953.

Laying of orders and regulations before Houses of Oireachtas.

17.—Every order and regulation under this Act (other than an order under section 3 (5), 4 or 12 of this Act) shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order or regulation is passed by either House within the next twenty-one days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.

Publication of orders in Iris Oifigiúil.

18.—Every order under this Act shall be published in Iris Oifigiúil as soon as may be after it is made.

Expenses of Minister and Minister for Industry and Commerce.

19.—The expenses incurred by the Minister in the administration of this Act shall be paid out of moneys provided by the Oireachtas and expenses incurred by the Minister for Industry and Commerce in the administration of this Act shall, to such extent as may be sanctioned by the Minister, be paid out of moneys provided by the Oireachtas.

Expenses of Central Bank.

20.—Any expenses incurred by the Central Bank in connection with the issue, redemption or melting down of coins shall be defrayed out of the general fund of the Central Bank.

Application of section 57 of Copyright Act, 1963, to coins issued under this Act.

21.Section 57 of the Copyright Act, 1963, shall apply to coins issued under this Act.

[GA]

Application and adaptation of certain enactments.

22.—Each enactment mentioned in column (2) of the Second Schedule to this Act shall have effect in accordance with the provisions set out in column (3) of that Schedule opposite the mention of that enactment.

Repeals.

23.—(1) Sections 10, 11, 13, 14, 16 and 19 of and the Third Schedule to the Act of 1950 are hereby repealed.

(2) The Act of 1950 (so far as unrepealed) is hereby repealed as on and from such date as the Minister may appoint by order under this section.

Short title.

24.—This Act may be cited as the Decimal Currency Act, 1969.
