1.—San Acht so cialluíonn an focal “an Príomh-Acht” Acht na mBóthar Iarainn, 1924 (Uimh. 29 de 1924), agus gach focal agus abairt a húsáidtear san Acht so agus a húsáidtear, leis, sa Tríú Sceideal a ghabhann leis an bPríomh-Acht ciallóid fé seach san Acht so an ní a chialluid so Phríomh-Acht.
Aiscí d'oifigigh agus do sheirbhísigh áirithe don chuideachtain chó-nasctha.
2.—(1) Maidir le gach oifigeach agus gach seirbhíseach don chuideachtain chó-nasctha do bheadh i dteideal aisce fén gcéad mhír den Tríú Sceideal a ghabhann leis an bPríomh-Acht mara mbeadh oifigeach no seirbhíseach den tsórt san do dhéanamh de, má scarann an chuideachta chó-nasctha le n-a sheirbhísí laistigh de sheacht mbliana tar éis rithte an Phríomh-Achta, agus pe'ca roimh am rithte an Achta so é no dá éis sin, toisc go dtáinig a sheirbhísí do bheith nea-riachtanach de dheascaibh atharuithe riaracháin do tháinig díreach as an gcó-nasca agus as an dtógaint-isteach a dineadh ar chuideachtana leis an bPríomh-Acht, no fé, agus ná taisbeánfidh an chuideachta chó-nasctha iad do theacht de laghdú tráchta, de laghdú ar obair athnuachainte no choinneála-i-dtreo, de thabhairt isteach modhna feabhsuithe chun oibrithe (nách modhna nárbh fhéidir don chuideachtain chó-nascthach no thógtha-isteach, ag á raibh an t-oifigeach no an seirbhíseach ar fostú cheana, iad do thabhairt isteach), no de chúis eile economíochta, beidh sé i dteideal an chuideachta chónasctha d'íoc aisce leis a háireofar do réir an séú cuid de mhéid a thuarastail agus a shochair oifige bhliantúla in aghaidh gach bliana iomláine dá sheirbhís.
(2) Má eiríonn aon aighneas no ceist idir an chuideachta chónasctha agus aon oifigeach no seirbhíseach don chuideachtain chó-nasctha i dtaobh éinní a eireoidh fén alt so, féadfidh an t-oifigeach no an seirbhíseach san athchomharc do dhéanamh chun an bhuan-mholtóra no an bhúird de mholtóirí a luaidhtear i mír (8) den Tríú Sceideal a ghabhann leis an bPríomh-Acht agus bainfidh an mhír sin le haon athchomharc den tsórt san sa tslí chéanna ina mbaineann sí leis na hathchomhairc a luaidhtear inti.
(3) San alt so ní fholuíonn an focal “seirbhís” aon tréimhse sheirbhíse mar phríntíseach céirde ag aon chuideachtain chónascthach no thógtha-isteach.
(4) Chun crícheanna an ailt seo áireofar tuarastal agus sochar oifige bliantúil oifigigh no seirbhísigh do réir ráta an tuarastail no an tsochair oifige a bheidh aige á fháil díreach sara scartar le n-a sheirbhísí agus folóidh a sheirbhís a sheirbhís leis an gcuideachtain chó-nascthach no thógtha-isteach darbh oifigeach no seirbhíseach roimhe sin é chó maith le n-a sheirbhís leis an gcuideachtain chó-nasctha.
(5) San alt so foluíonn tagairtí d'oifigigh don chuideachtain chó-nasctha agus tagairtí do sheirbhísigh don chuideachtain chónasctha, fé seach, oifigigh don chuideachtain chó-nasctha agus seirbhísigh don chuideachtain chó-nasctha do scuir, roimh am rithte an Achta so, de bheith i seirbhís na cuideachtan cónasctha chó maith le pé oifigigh agus seirbhísigh atá fós i seirbhís na cuideachtan có-nasctha le linn rithte an Achta so.
(6) San alt so cialluíonn an focal “an chéad mhír den Tríú Sceideal a ghabhann leis an bPríomh-Acht” an mhír, i dtosach an Sceidil sin, dar tosach na focail “Gach éinne a bhí” agus dar críoch na focail “bliana iomláine dá thréimhse seirbhíse.”
Scriosa amach mír (4) den Tríú Sceideal a ghabhann leis an bPríomh-Acht.
3.—Léireofar an Tríú Sceideal a ghabhann leis an bPríomh-Acht agus beidh éifeacht aige fé is dá leigtí ar lár ann an mhír sin anois ann darb uimhir “(4).”
Leasuithe i dtaobh cúitimh i riocht liúntais bhliantúla.
4.—Léireofar an Tríú Sceideal san a ghabhann leis an bPríomh-Acht agus beidh éifeacht aige fé is dá ndintí an mhír de darb uimhir “(5)” do leasú mar leanas, sé sin le rá:—
(a) tríd an gcéad chlás de do scriosa amach, clás dar tosach na focail “Gach sean-oifigeach no seana-sheirbhíseach” agus dar críoch na focail “sé sin le rá,” agus trí fho-mhír (a) dhe do scriosa amach agus an clás agus na ceithre fo-mhíreanna so a leanas do chur in ionad an chláis agus na fo-mhíre a scriostar amach amhlaidh, sé sin le rá:—
Gach sean-oifigeach no seana-sheirbhíseach a leigfidh uaidh, fé mhír (2) den Sceideal so, a oifig no a bheart laistigh de sheacht mbliana tar éis rithte an Phríomh-Achta agus gach sean-oifigeach no seana-sheirbhíseach 'na gcuirfar deire le n-a oifig no le n-a bhirt fén mír sin (2) laistigh den seacht mbliana san toisc go dtáinig a oifig no a bheart do bheith nea-riachtanach de dheascaibh atharuithe riaracháin do tháinig díreach as an gcónasca agus as an dtógaint-isteach a dineadh ar chuideachtana leis an bPríomh-Acht, no fé, agus ná taisbeánfidh an chuideachta chó-nasctha iad do theacht de laghdú tráchta, de laghdú ar obair athnuachainte no choinneála-i-dtreo, de thabhairt isteach modhna feabhsuithe chun oibrithe (nách modhna nárbh fhéidir don chuideachtain chónascthach no thógtha-isteach, ag á raibh an t-oifigeach no an seirbhíseach ar fostú cheana, iad do thabhairt isteach), no de chúis eile economíochta, no 'na scarfar le n-a sheirbhísí laistigh den seacht mbliana san toisc go dtáinig na seirbhísí sin do bheith nea-riachtanach de dheascaibh atharuithe riaracháin den tsórt san roimhráite, no 'na laghdófar a luach saothair no a shochar oifige laistigh den seacht mbliana san ar scór a dhualgaisí do bheith laghduithe de dheascaibh atharuithe riaracháin den tsórt san roimhráite, no 'na mbainfidh aon chailliúint díreach airgid do ar aon tslí eile laistigh den seacht mbliana san de bhíthin atharuithe riaracháin den tsórt san roimhráite (le n-a n-áirítear aon chailliúint in aois-liúntas a bhí in áirithe dho no i liúntaisí eile a bheadh le fáil ar dhul as oifig no ar fháil bháis do agus i liúntaisí dá bhaintrigh no dá chlainn ina dhiaidh, pe'ca do réir dlí dhóibh no do réir ghnáis na cuideachtan có-nascthaí no tógtha-isteach), beidh sé i dteideal an chuideachta chó-nasctha d'íoc cúitimh leis, agus socrófar agus íocfar méid an chúitimh sin ag an gcuideachtain chó-nasctha (fé réir athchomhairc mar a foráltar ina dhiaidh seo anso) do réir na rialacha so a leanas, sé sin le rá:—
(aa) i gcás sean-oifigigh no seana-sheirbhísigh a leigfidh uaidh a oifig no a bheart no 'na gcuirfar deire le n-a oifig no le n-a bhirt no 'na scarfar le n-a sheirbhísí mar adubhradh isé rud a bheidh sa chúiteamh ná liúntas bliantúil a híocfar le n-a bheo leis agus ná raghaidh in aon chás thar dhá dtrian a luach saothair agus a shochair oifige agus, fé réir na teorann san agus fé réir forálacha fo-mhír (d) dhe seo, a háireofar do réir an seascadú cuid dá luach saothair agus dá shochar oifige in aghaidh gach bliana iomláine dá sheirbhís leis an gcuideachtain chó-nasctha no le haon chuideachtain chó-nascthach no thógthaisteach agus breis leis sin do réir líon blianta iomlána a sheirbhíse agus í áirithe do réir an scála so a leanas:—

más deich mbliana seirbhíse no níos mó a thug sé agus níos lú ná cúig bliana déag den tsórt san, breis cúig seascadú dá luach saothair agus dá shochar oifige,
más cúig bliana iomlána seirbhíse no níos mó a thug sé agus níos lú ná deich mbliana den tsórt san, breis trí seascadú dá luach saothair agus dá shochar oifige:
(ab) cnap-shuim a bheidh mar chúiteamh in aon chás eile, ach má dintar athchomharc chun an bhuan-mholtóra no chun na moltóirí féadfidh an moltóir no na moltóirí sin, más oiriúnach leis no leo é, ar éisteacht an athchomhairc sin dóibh, a mhola go bhfuighidh an sean-oifigeach no an seanasheirbhíseach mar chúiteamh (in ionad cnapshuime) liúntas bliantúil a híocfar le n-a bheo leis agus ná raghaidh in aon chás thar dhá dtrian a luach saothair agus a shochair oifige agus a bheidh, fé réir na teorann sáruithighe sin, gan dul thar shuim bhliantúil a háireofí do réir an seascadú cuid dá luach saothair agus dá shochar oifige in aghaidh gach bliana iomláine dá sheirbhís leis an gcuideachtain chó-nasctha no le haon chuideachtain chó-nascthach no thógthaisteach:
((ac) i socrú cineál agus méid an chúitimh a bheidh le mola i gcásanna atá laistigh den bhfo-mhír sin (ab) atá roimhe seo tabharfar aire dá mbaineann leis an gcás agus go sonnrách déanfar breithniú cuibhe ar aon chailliúint den tsórt san roimhráite in aois-liúntas a bhí in áirithe dho no i liúntas eile a bheadh le fáil ar dhul as oifig no ar fháil bháis do:
(ad) i gcás sean-oifigigh no seana-sheirbhísigh a bhí i seirbhís mar phríntíseach céirde le haon chuideachtain chó-nascthach no thógthaisteach, ní háireofar tréimhse na príntíseachta san chun críche na míre seo mar sheirbhís leis an gcuideachtain chó-nascthach no thógtha-isteach san:
agus
(b) tré fho-mhír (b) dhe do scriosa amach agus an fho-mhír seo a leanas do chur in ionad na fo-mhíre a scriostar amach amhlaidh, sé sin le rá:—
(b) (i) má bhí aon tsean-oifigeach no seanasheirbhíseach as láthair go sealadach óna fhostaíocht mar oifigeach no mar sheirbhíseach den tsórt san agus, le linn iomlán na nealáithreachta san, go raibh sé ar seirbhís i bhFórsaí Náisiúnta Shaorstáit Éireann, no in aon fhórsaí mileata eile a bhí ag fónamh fé údarás an Chéad Dháil Éireann, an Dara Dáil Éireann, no Rialtais Shealadaigh na hÉireann, no an Airm, an Chabhlaigh no an Aer-Fhórsa Bhriotáinigh déanfar chun crícheanna an Sceidil seo an nea-láithreacht shealadach san do chomhreamh agus d'áireamh mar chuid dá thréimhse seirbhíse mar oifigeach no mar sheirbhíseach den tsórt san;
(ii) gan dochar d'fhorálacha an chláis sin roimhe seo darb uimhir (b) (i), má bhí aon tsean-oifigeach no seana-sheirbhíseach as láthair óna fhostaíocht mar oifigeach no mar sheirbhíseach den tsórt san ar feadh tréimhse ba lú ná bliain de dheascaibh brainse no roinn d'aon chuideachtain cho-nascthach no thógthaisteach do dhúna no do leath-dhúna de bharr imris chathardha sa bhliain 1922 no 1923, ní tuigfar gur dhin an nea-láithreacht san bearna ina sheirbhís mar oifigeach no mar sheirbhíseach den tsórt san má bhí sí leanúnach ar gach slí eile, ach ní háireofar tréimhse na nea-láithreachta san mar chuid dá sheirbhís mar oifigeach no mar sheirbhíseach den tsórt san mara raibh sé ar seirbhís i bhFórsaí Náisiúnta Shaorstáit Éireann i rith na tréimhse nea-láithreachta san:
agus
(c) tré fho-mhír (d) dhe do scriosa amach agus an fho-mhír seo a leanas do chur in ionad na fo-mhíre a scriostar amach amhlaidh, sé sin le rá:—
(d) más liúntas bliantúil an cúiteamh a socrófar le haon fho-mhír no fé aon fho-mhír acu san roimhe seo agus an t-oifigeach no an seirbhíseach do bheith i dteideal sochair i riocht aois-liúntais is iníoctha amach as aon chiste aois-liúntais no sochair rann-íocach dá dtugadh no dá dtugann cuideachta chónascthach no cuideachta thógtha-isteach no an chuideachta chó-nasctha ranníocanna, ansan, d'ainneoin éinní atá in aon fho-mhír acu san roimhe seo, isé a bheidh sa liúntas bhliantúil sin ná an difríocht idir méid an liúntais bhliantúla do bheadh iníoctha dá mba ná beadh an t-oifigeach no an seirbhíseach i dteideal aon tsochair den tsórt san agus méid bliantúil no luach bliantúil an tsochair sin agus íocfidh an chuideachta chó-nasctha leis an oifigeach no leis an seirbhíseach ina theanta san cnapshuim is ionann le méid iomlán na ranníocanna d'íoc an t-oifigeach no an seirbhíseach aon uair leis an gCiste Aois-liuntais no Sochair.

5.—Más rud é agus sa mhéid go bhfuil an Tríú Sceideal a ghabhann leis an bPríomh-Acht ionchorparuithe ionta no go bhfuil a seasamh ar an Sceideal san, léireofar gach scéim chó nascthachta agus gach scéim thógainte-isteach agus beidh éifeacht acu fé is dá mb'é an sceideal san mar a leasuítear é leis an Acht so do bheadh ionchorparuithe no dá dtagrófí amhlaidh.
Saoirse o dhiúité stampa.
6.—Ní bheidh aon diúité stampa iníoctha ar scór aon chó-aontú a dineadh roimhe seo fén Tríú Sceideal a ghabhann leis an bPríomh-Acht no a déanfar ina dhiaidh seo fén Tríú Sceideal san mar a leasuítear leis an Acht so é no fén Acht so idir an chuideachta chó-nasctha agus aon tsean-oifigeach no seanasheirbhíseach no aon oifigeach no seirbhíseach eile don chuideachtain chó-nasctha ná ar scór aon mhola do dhin an buan-mholtóir roimhe seo fén Tríú Sceideal san no a dhéanfidh an buanmholtóir no na moltóirí ina dhiaidh seo fén Tríú Sceideal san mar a leasuítear leis an Acht so é no fén Acht so.
Baint an Achta.
7.—Rialóidh an Tríú Sceideal a ghabhann leis an bPríomh-Acht mar a leasuítear leis an Acht so é gach éileamh ar chúiteamh fén Tríú Sceideal san nár socruíodh méid an chúitimh ina thaobh le có-aontú a dineadh no le breith a thug an buan-mholtóir roimh an 26adh lá de Mhárta, 1926.
Comhachta an Mholtóra.
8.—(1) Beidh comhacht ag an mbuan-mholtóir no ag an mbord de mholtóirí daoine do chur fé mhionn, agus costaisí do mhola mar is toil leis no leo agus a ordú cé leis agus cé aige agus cadé an tslí go n-íocfar na costaisí seo no aon chuid díobh, agus méid na gcostaisí sin do thomhas agus a éileamh go dtabharfar urrús ar chostaisí chun sástachta dho no dhóibh ag aon pháirtí in aon chéim de sna heimeachta a bheidh os a chóir no os a gcóir.
(2) Beidh ag an mbuan-mholtóir no ag an mbord de mholtóirí na comhachta céanna atá ag an Ard-Chúirt chun a chur fhiachaibh ar fhínnithe teacht i láthair no ar dhaoine scríbhinní do thabhairt i láthair.
(3) Féadfidh an buan-mholtóir no an bord de mholtóirí aon uair aon tuathal no earráid chléireachais a thiocfidh i mola de dheascaibh aon tsleamhnú no fágaint ar lár do thárla go cinniúnach do cheartú.
(4) Aon tsuim is iníoctha fé mhola do dhin an buan-mholtóir no na moltóirí beidh sí ina fiacha connartha simplí is ionbhainte amach le haicsean dlí.
(5) Beidh sé dleathach don bhuan-mholtóir no don bhord do mholtóirí, ar n-a iarraidh san ortha ag aon pháirtí in athchomharc, an t-athchomharc san d'éisteacht i gcúirt oscailte.
Gearr-theideal agus léiriú.
9.—Féadfar an tAcht Bóthair Iarainn (Sean-Oifigigh agus Seana-Sheirbhísigh), 1926, do ghairm den Acht so agus léireofar é mar éinní amháin leis an bPríomh-Acht, agus féadfar na hAchtanna Bóthair Iarainn, 1924 agus 1926, do ghairm den Acht san agus den Acht so le chéile.

RAILWAYS (EXISTING OFFICERS AND SERVANTS) ACT, 1926.
Definitions.
1.—In this Act the expression “the Principal Act” means the Railways Act, 1924 (No. 29 of 1924), and all words and expressions used in this Act which are also used in the Third Schedule to the Principal Act shall respectively have the same meaning in this Act as they have in the Principal Act.
Gratuities to certain officers and servants of the amalgamated company.
2.—(1) Every officer and every servant of the amalgamated company who if he had not become such officer or servant would have been entitled to a gratuity under the first paragraph of the Third Schedule to the Principal Act shall, if his services are dispensed with by the amalgamated company within seven years after the passing of the Principal Act and whether before or after the passing of this Act on account of his services having become unnecessary in consequence of changes of administration due directly to the amalgamation and absorption of companies effected by or under the Principal Act and not shown by the amalgamated company to have been caused by decrease of traffic, reduction of renewal or maintenance work, introduction of improved methods of working (other than methods which would not have been feasible for the amalgamating or absorbed company by which the officer or servant was formerly employed), or other economic cause, be entitled to be paid by the amalgamated company a gratuity calculated on the basis of one-sixth of the amount of his annual salary and emoluments for every completed year of his service.
(2) If any dispute or question shall arise between the amalgamated company and any officer or servant of the amalgamated company on any matter arising under this section, such officer or servant may appeal to the standing arbitrator or board of arbitrators mentioned in paragraph (8) of the Third Schedule to the Principal Act and that paragraph shall apply to any such appeal in like manner as it applies to the appeals mentioned therein.
(3) In this section the word “service” does not include any period of service as a trade apprentice with any amalgamating or absorbed company.
(4) For the purposes of this section the annual salary and emoluments of an officer or servant shall be calculated at the rate of the salary or emoluments of which he is in receipt immediately before his services are dispensed with and his service shall include his service with the amalgamating or absorbed company of which he was formerly an officer or servant as well as his service with the amalgamated company.
(5) In this section references to officers of the amalgamated company and references to servants of the amalgamated company respectively include officers of the amalgamated company and servants of the amalgamated company who have before the passing of this Act ceased to be in the service of the amalgamated company as well as such officers and servants who are still in the service of the amalgamated company at the passing of this Act.
(6) In this section the expression “the first paragraph of the Third Schedule to the Principal Act” means the paragraph at the beginning of that Schedule which commences with the words “Every person who” and ends with the words “completed year of his service.”
Deletion of paragraph (4) of Third Schedule to Principal Act.
3.—The Third Schedule to the Principal Act shall be construed and have effect as if the paragraph numbered “(4)” now contained therein were omitted therefrom.
Amendments in respect of compensation by way of annual allowance.
4.—The said Third Schedule to the Principal Act shall be construed and have effect as if the paragraph thereof numbered “(5)” were amended as follows, that is to say:—
(a) by the deletion of the first clause thereof, which clause begins with the words “Every existing officer or servant” and ends with the words “that is to say,” and the deletion of sub-paragraph (a) thereof and the insertion of the following clause and four sub-paragraphs in lieu of the clause and sub-paragraph so deleted, that is to say:—
Every existing officer or servant who under paragraph (2) of this Schedule relinquishes his office or situation within seven years after the passing of the Principal Act and every existing officer or servant whose office or situation is abolished under the said paragraph (2) within such seven years on account of his office or situation having become unnecessary in consequence of changes of administration due directly to the amalgamation and absorption of companies effected by or under the Principal Act and not shown by the amalgamated company to have been caused by decrease of traffic, reduction of renewal or maintenance work, introduction of improved methods of working (other than methods which would not have been feasible for the amalgamating or absorbed company by which the officer or servant was formerly employed) or other economic cause or whose services are dispensed with within such seven years on account of such services having become unnecessary in consequence of such changes of administration as aforesaid, or whose remuneration or emoluments are reduced within such seven years on the ground that his duties have been diminished in consequence of such changes of administration as aforesaid or who otherwise suffers within such seven years any direct pecuniary loss by reason of such changes of administration as aforesaid (including any loss of prospective superannuation or other retiring or death allowances and allowances to his widow or orphan children whether obtaining legally or by customary practice of the amalgamating or absorbed company) shall be entitled to be paid compensation by the amalgamated company, the amount of such compensation to be determined and paid by the amalgamated company
(subject to appeal as hereinafter provided) in accordance with the following rules, that is to say:—
(aa) in the case of an existing officer or servant who relinquishes his office or situation or whose office or situation is abolished or whose services are dispensed with as aforesaid the compensation shall be an annual allowance to be paid to him during his life not exceeding in any case two-thirds of his remuneration and emoluments, and, subject to that limitation and to the provisions of sub-paragraph (d) hereof, to be calculated at the rate of one-sixtieth of his remuneration and emoluments for every completed year of his service with the amalgamated company or any amalgamating or absorbed company, with an addition thereto based on the number of completed years of his service and calculated according to the following scale:—
if he has twenty or more completed years of service, an addition of ten-sixtieths of his remuneration and emoluments,
if he has fifteen or more completed years of service and less than twenty such years, an addition of seven-sixtieths of his remuneration and emoluments,
if he has ten or more completed years of service and less than fifteen such years, an addition of five-sixtieths of his remuneration and emoluments,
if he has five or more completed years of service and less than ten such years, an addition of three-sixtieths of his remuneration and emoluments:
(ab) in any other case the compensation shall be a lump sum, but if an appeal is taken to the standing arbitrator or arbitrators such arbitrator or arbitrators may if he or they so think fit on the hearing of such appeal, award as compensation (in lieu of a lump sum) an annual allowance to be paid to the existing officer or servant during his life, not exceeding in any case two-thirds of his remuneration and emoluments and, subject to that over-riding limitation, not exceeding an annual sum calculated at the rate of one-sixtieth of his remuneration and emoluments for every completed year of his service with the amalgamated company or any amalgamating or absorbed company:
(ac) in fixing the nature and amount of compensation to be awarded in cases within the foregoing sub-paragraph (ab) all the circumstances of the case shall be taken into consideration and in particular due consideration shall be given to any such loss of prospective superannuation or other retiring or death allowance as aforesaid:
(ad) in the case of an existing officer or servant who has served as a trade apprentice with any amalgamating or absorbed company, the period of such apprenticeship shall not for the purpose of this paragraph be reckoned as service with such amalgamating or absorbed company:
and
(b) by the deletion of sub-paragraph (b) thereof and the insertion of the following sub-paragraph in lieu of the sub-paragraph so deleted, that is to say:—
(b) (i) where any existing officer or servant was temporarily absent from his employment as such officer or servant and during the whole of such absence was engaged in service in the National Forces of Saorstát Eireann, or any military forces serving under the authority of the First Dáil Eireann, the Second Dáil Eireann, or the Provisional Government of Ireland, or the British Army, Navy or Air Force, such temporary absence shall for the purposes of this Schedule be reckoned and included in his period of service as such officer or servant;
(ii) without prejudice to the provisions of the preceding clause numbered (b) (i) where any existing officer or servant was absent from his employment as such officer or servant for a period of less than one year on account of the closing or partial closing of a branch or department of any amalgamating or absorbed company in consequence of civil strife in the years 1922, or 1923, such absence shall not be deemed to have caused an interruption of his service if otherwise continuous as such officer or servant, but the period of such absence shall not be included in his service as such officer or servant unless he was engaged during such period of absence in service in the National Forces of Saorstát Eireann:
and
(c) by the deletion of sub-paragraph (d) thereof and the insertion of the following sub-paragraph in lieu of the sub-paragraph so deleted, that is to say:—
(d) whenever the compensation fixed by or under any of the foregoing sub-paragraphs is an annual allowance and the officer or servant is entitled to benefits by way of superannuation payable out of any contributory superannuation or benefit fund to which an amalgamating or absorbed company or the amalgamated company contributed or contributes, such annual allowance shall notwithstanding anything contained in any of the foregoing sub-paragraphs be the difference between the amount of the annual allowance which would be payable if the officer or servant was not entitled to any such benefits and the annual amount or annual value of such benefits and the officer or servant shall in addition be paid by the amalgamated company a lump sum equal to the total amount of the contributions paid at any time by the officer or servant to the Superannuation or Benefit Fund.
Consequential amendment of amalgamation and absorption schemes.
5.—Every amalgamation scheme and every absorption scheme shall, if and so far as it incorporates or depends on the Third Schedule to the Principal Act, be construed and take effect as if the schedule so incorporated or referred to was that schedule as amended by this Act.
Exemption from stamp duty.
6.—No stamp duty shall be payable in respect of any agreement heretofore made under the Third Schedule to the Principal Act or hereafter to be made under the said Third Schedule as amended by this Act or under this Act between the amalgamated company and any existing officer or servant or any other officer or servant of the amalgamated company nor in respect of any award heretofore made by the standing arbitrator under the said Third Schedule or hereafter to be made by the standing arbitrator or arbitrators under the said Third Schedule as amended by this Act or under this Act.
Application of Act.
7.—The Third Schedule to the Principal Act as amended by this Act shall govern every claim for compensation under the said Third Schedule in respect of which the amount of the compensation was not fixed by agreement made or decision of the standing arbitrator pronounced before the 26th day of March, 1926.
Powers of Arbitrator.
8.—(1) The standing arbitrator or board of arbitrators shall have power to administer oaths, and to award costs in his or their discretion and direct to and by whom and in what manner these costs or any part thereof shall be paid, and to measure the amount of such costs and to require security for costs to be given to his or their satisfaction by any party at any stage of the proceedings before him or them.
(2) The standing arbitrator or board of arbitrators shall have the like powers of enforcing the attendance of witnesses and the production of documents as are possessed by the High Court.
(3) The standing arbitrator or board of arbitrators may at any time correct any clerical mistake or error in an award arising from any accidental slip or omission.
(4) Any sum payable under an award made by the standing arbitrator or arbitrators shall be a simple contract debt recoverable by action at law.
(5) It shall be lawful for the standing arbitrator or board of arbitrators, if so requested by either party to an appeal, to hear such appeal in open court.
Short title and construction.
9.—This Act may be cited as the Railways (Existing Officers and Servants) Act, 1926 and shall be construed as one with the Principal Act, and that Act and this Act may be cited together as the Railways Acts, 1924 and 1926.
