Cumhacht an Aire chun oibreacha a dhéanamh agus ranníoc an áititheora i leith an chostais.

2.—(1) Féadfaidh an tAire, ar áititheoir talún dá iarraidh sin, oibreacha a dhéanamh ar an talamh agus gach ní a dhéanamh is gá chuige sin.

(2) Aon uair a bheartós an tAire oibreacha a dhéanamh ar aon talamh, cuirfidh sé in iúl don áititheoir cineál agus réim na n-oibreacha atá beartaithe agus méid an ranníoca a bheas le déanamh ag an áititheoir i leith costais a ndéanta.

(3) Má ghlacann áititheoir talún le tairiscint an Aire, bhéarfaidh an tAire fógra láithreach do Choimisiún na Talún sa bhfoirm ordaithe, agus déanfaidh Coimisiún na Talún, ach amháin i gcás talún neamhchláraithe faoi bhlianacht cheannaigh nó talún a bheas á sealbhú faoi chomhaontú sealadach le Coimisiún na Talún, nó talún arb é Coimisiún na Talún a húnaer cláraithe, an fógra a chur chun a chláruithe go dtí Clarlann na Talún nó Clarlann na nDintiúirí (pé acu is cuí), agus ní héileofar aon táille ná íocaíocht eile i leith an chláruithe.

(4) (a) Mura gcuire an t-áititheoir in iúl don Aire, ag glacadh le tairiscint an Aire dhó, gur ina bhlianacht is mian leis a ranníoc d'íoc, tiocfaidh an ranníoc chun bheith dlite agus iníoctha leis an Aire ón té is áititheoir de thuras na huaire ar an dáta a ndeimhneoidh an tAire go bhfuil na hoibreacha críochnaithe.

(b) Mura n-íoctar an ranníoc laistigh de thrí mhí tar éis é a theacht chun bheith dlite agus iníoctha, bhéarfaidh an tAire fógra do Choimisiún na Talún i dtaobh na mainneachtana.

Ranníoc an áititheora d'íoc ina bhlianacht.

3.—(1) Beidh feidhm ag an alt seo i gcás—

(a) ina gcuirfidh an t-áititheoir in iúl don Aire, ag glacadh le tairiscint an Aire dhó, gur ina bhlianacht is mian leis a ranníoc d'íoc, nó

[EN]

(b) ina dtarlóidh mainneachtaint faoi fho-alt (4) d'alt 2.

[EN]

(2) In aon chás lena mbaineann an t-alt seo, muirearóidh Coimisiún na Talún ranníoc an áititheora sa tslí ordaithe ar gach leas (lena n-áirítear feo simplí) sa talamh ar comhaontaíodh na hoibreacha a dhéanamh air agus i ngach talamh a sealbhófar ina teannta leis an tionacht chéanna nó faoin tionóntacht chéanna, agus beidh éifeacht ag an muirearú sin amhail ar an dáta agus ón dáta a ndeimhneoidh an tAire go bhfuil na hoibreacha críochnaithe, agus urscaoilfear é trí bhlianacht (dá ngairmtear blianacht mhíntírithe san Acht seo) a bheas iníoctha ar na laethe gála ordaithe agus a ríomhfar do réir ceathair faoin gcéad sa bhliain.

(3) Beidh tosaíocht ag an muirear a bunófar faoin alt seo ar gach muirear agus eire, reachtúil nó eile, ach amháin suimeanna is iníoctha le Coimisinéirí na nOibreacha Poiblí in Éirinn nó le Coimisiún na Talún.

(4) I gcás talamh ar a muirearófar blianacht mhíntírithe a bheith, nó a theacht, faoi bhlianacht cheannaigh, beidh an dá bhlianacht, ar feadh na tréimhse ordaithe, ar comhdhlúthú i dtreo gurb aon bhlianacht cheannaigh amháin iad.

(5) Chun amhrais a sheachaint, dearbhaítear leis seo nach mbeidh blianacht mhíntirithe, ná an chuid de bhlianacht chomhdhlúite a ionadaíos blianacht mhíntírithe, inathscrúduithe faoi Chuid III den Acht Talún, 1933 (Uimh. 38 de 1933).

(6) Aon talamh a bheas faoin muirear a bunófar faoin alt seo agus a bheas á díol nó á dílsiú ag Coimisiún na Talún faoi aon chumhacht reachtúil, díolfar nó dílseofar í faoi réir an mhuirir.

(7) I ngach cás lena mbaineann an t-alt seo, déanfaidh Coimisiún na Talún, ach amháin i gcás talún neamhchláraithe faoi bhlianacht cheannaigh nó talún a sealbhófar faoi chomhaontú sealadach le Coimisiún na Talún, nó talún arb é Coimisiún na Talún a húnaer cláraithe, sonraí an mhuirir a chur chun a gcláruithe go dtí Clarlann na Talún nó Clarlann na nDintiúirí (pé acu is cuí) agus ní héileofar aon táille ná íocaíocht eile i leith an chláruithe.

(8) Aon deimhniú a airbheartós bheith faoi chomhshéala Choimisiún na Talún, is fianaise é go ndearnadh an talamh a tuairiscítear ann a mhuirearú go cuí faoin alt seo do réir téarmaí an deimhnithe.

Forála maidir le blianachta.

4.—(1) Beidh ag Coimisiún na Talún na cearta agus na leigheasanna uile, chun airgead is iníoctha leo i leith blianachta míntírithe a ghnóthú, atá acu faoi na hAchta Talamh-Cheannaigh i gcás airgid is iníoctha leo i leith aon tailte.

(2) Go sonrach, féadfar an t-airgead uile is iníoctha leo i leith blianachta míntírithe a ghnóthú ón duine a bheas iarbhír ag áitiú na talún san am a tosnófar imeachta chun an t-airgead a ghnóthú mar dhliteanas pearsanta ar an duine sin d'ainneoin iomlán an riaráiste nó cuid de d'fhaibhriú chun bheith dlite sar a ndeachaigh an duine sin ag áitiú na talún.

(3) Ní shaorfaidh aon ní san alt seo duine ar bith eile ó dhliteanas i leith aon riaráiste den tsórt sin agus, amhail idir únaerí nó áititheoirí leanúnacha ar an talamh, beidh an t-airgead uile d'íoc áititheoir nó a gnóthaíodh uaidh i leith riaráiste a tháinig trí mhainneachtaint únaera nó áititheora roimhe sin inghnóthuithe ag an únaer d'íoc é, nó ónar gnóthaíodh é, mar fhiach a bhí dlite dhó ón únaer nó on áititheoir a rinne an mhainneachtaint.

(4) Aon deimhniú a airbheartós bheith faoi chomhshéala Choimisiún na Talún, is fianaise é go bhfuil gach suim dlite dhóibh adeirtear ann a bheith dlite dhóibh, agus go bhfuil sí iníoctha ag an duine nó na daoine a bheas ainmhithe sa deimhniú mar dhaoine a dhlíos í d'íoc.

(5) Is muirear ar an gCiste Ráthaíochta faoi na hAchta Talamh-Cheannaigh gach riaráiste blianacht míntírithe agus slánófar don Stát-Chiste as an gCiste Ráthaíochta é.

(6) I gcás talamh a bheith faoi bhlianacht chomhdhlúite nó blianacht mhíntírithe, beidh ag Coimisiún na Talún, chun an bhlianacht a chionroinnt, na cumhachta uile atá acu faoi na hAchta Talamh-Cheannaigh chun cionroinnt a dhéanamh ar aon airgead a muirearaítear ar thalamh nó atá iníoctha as talamh, agus féadfaid, más oiriúnach leo, aon chuid nó coda de thalamh d'urscaoileadh óna thuilleadh dliteanais i leith na blianachta nó aon choda dhi nó aon riaráiste dhi, agus as sin amach déanfar iomlán na blianachta a mhuirearú go haonartha ar iarmhar na talún sin.

Uisce-chúrsaí a réiteach.

5.—(1) Féadfaidh an tAire, má chítear dó é a bheith riachtanach chun aon talamh a mhíntíriú go cuí faoi aon oibreacha a bheas á ndéanamh aige, uisce-chúrsa a réiteach nó a dheisiú, agus chuige sin beidh rochtain aige, trína sheirbhísigh agus a ghníomhairí, ar an uisce-chúrsa, agus féadfaidh sé gabháil fan a bhruacha, le sásra nó gan sásra, a mhéid a chífear dó a bheith riachtanach chun é a chur i riocht uisce a tharraingt ba chóir go gnáthdhálach a raghadh tríd, agus féadfaidh pé ní is oiriúnach leis a dhéanamh leis an gcartadh.

(2) Sar a raghaidh sé isteach ar thalamh faoin alt seo, gheobhaidh an tAire toiliú an áititheora (i gcás talún áitithe), nó an únaera (i gcás talún neamh-áitithe), nó bhéarfaidh sé fógra cheithre lá déag ar a laghad i scríbhinn go bhfuil ar intinn aige dul isteach ar an talamh amhlaidh.

(3) Féadfar an fógra dá dtagartar sa bhfo-alt roimhe seo a thabhairt do dhuine in aon tslí acu seo a leanas:—

(a) trína sheachadadh don duine sin,

[EN]

(b) trína fhágaint ag an seoladh mar a mbíonn gnáthchónaí ar an duine sin,

[EN]

(c) trína sheoladh leis an bpost i litir chláraithe réamhíoctha chun an duine sin faoi sheoladh na háite a mbíonn gnáth-chonaí air, nó

[EN]

(d) trína phostáil ag an talamh nó in aice na talún a bheas i gceist.

[EN]

Cúiteamh.

6.—(1) Aon duine dá mbainfidh damáiste mar gheall ar aon chur isteach, a thiocfas d'oibreacha a dhéanamh de bhun an Achta seo, ar aon talamh atá ar únaeracht nó á áitiú aige, nó ar aon éasúint, profit-a-prendre nó aon cheart eile atá aige, beidh sé, faoi réir forál an Achta seo, i dteideal cúiteamh d'íoc leis i leith an damáiste sin ón Aire.

(2) Ní foláir gach éileamh ar chúiteamh faoin alt seo a dhéanamh i scríbhinn chun an Aire roimh dheireadh na tréimhse a thosnós ar dháta tosnuithe na n-oibreacha dá dtáinig an cur isteach lena mbaineann an t-éileamh agus a chríochnós dhá bhliain ina dhiaidh sin nó bliain amháin tar éis na hoibreacha sin a chríochnú (pé acu sin is déanaí).

(3) D'éagmais comhaontuithe ar mhéid aon chúitimh is iníoctha ag an Aire faoin alt seo, cinnfidh an Chúirt Dúiche a mhéid, mura mó ná fiche punt an tsuim a héileofar, nó, in aon chás eile, cinnfear é trí eadráin faoin Acquisition of Land (Assessment of Compensation) Act, 1919 (arna leasú le hachtacháin ina dhiaidh sin) amhail is dá mba é a bhí sa chúiteamh an praghas ar thalamh a tógadh go héigeantach, agus beidh dlínse ag an gCúirt nó ag an eadránaí, pé acu é, chun a chinneadh an bhfuil aon chúiteamh iníoctha i gcúrsaí an cháis.

(4) Nuair a beifear ag cinneadh cúitimh faoin alt seo bhéarfar aird ar aon chosaint nó tairbhe a bheas ag sroicheadh don éilitheoir de chionn na hoibreacha a dhéanamh a mbaineann an t-éileamh leo.

(5) Nuair a bheas breitheamh den Chúirt Dúiche ag déanamh orduithe faoin alt seo, féadfaidh sé, faoina rogha, a ordú na costais, go dtí trí ghiní ar a mhéid, faoina raghaidh aon pháirtí sna himeachta maidir leis na himeachta (maille le pé caiteachais finnéithe is réasúnach leis an mbreitheamh) a bheith le n-íoc ag aon pháirtí eile sna himeachta.

(6) Más rud é, i gcás iarratais chun na Cúirte Dúiche chun an cúiteamh a chinneadh a bheas le n-íoc ag an Aire faoin alt seo, nach mó an cúiteamh a chinnfeas an Chúirt ná an cúiteamh a thairg an tAire go neamh-choinníollach sar a ndearnadh an t-iarratas, féadfaidh an Chúirt a ordú na costais sin agus na caiteachais finnéithe sin, de chuid an Aire, is réasúnach leis an gCúirt, a bhaint den chúiteamh a chinnfeas an Chúirt.

(7) An dlínse a bheirtear leis an alt seo don Chúirt Dúiche, feidhmeofar í ag an mbreitheamh ar laistigh dá dhúthaigh a rinneadh na hoibreacha nó aon chuid díobh, nó ag an mbreitheamh ar laistigh dá dhúthaigh a tharla an cur isteach nó aon chuid den chur isteach, pé acu sin is rogha leis an éilitheoir.

Rialacháin.

7.—(1) Féadfaidh an tAire Airgeadais rialacháin a dhéanamh i dtaobh ríomh, tréimhse íoca, fuascailt agus diúscairt blianacht faoin Acht seo.

(2) An chumhacht chun rialacha a dhéanamh a bheirtear le fo-alt (1) d'alt 3 den Acht Talún, 1933 (Uimh. 38 de 1933), beidh feidhm aici maidir le rialacha a dhéanamh i dtaobh aon ní dá dtagartar san Acht seo mar ní atá ordaithe.

(3) Aon rialacháin a déanfar faoin alt seo leagfar iad faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a ndéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífeas an Teach sin tar éis na rialacháin a leagadh faoina bhráid, rún a rith ag neamhniú na rialachán, beidh na rialacháin arna neamhniú dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoi na rialachán.

LAND RECLAMATION ACT, 1949.


AN ACT TO AUTHORISE THE MINISTER FOR AGRICULTURE TO CARRY OUT LAND RECLAMATION, FIELD DRAINAGE AND OTHER WORKS FOR THE IMPROVEMENT OF AGRICULTURAL HOLDINGS AND TO PROVIDE FOR THE PAYMENT BY THE OCCUPIERS OF A CONTRIBUTION TOWARDS THE COST OF THOSE WORKS AND FOR OTHER MATTERS RELATING TO THE MATTERS AFORESAID. [30th July, 1949.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

the Land Commission” means the Irish Land Commission;

[GA]

the Minister” means the Minister for Agriculture;

[GA]

prescribed” means prescribed by rules under section 7;

[GA]

purchase annuity” means an annual payment to the Land Commission under the Land Purchase Acts, other than rent under a temporary agreement;

[GA]

temporary agreement” means a letting for temporary convenience, temporary necessity or temporary pasturage or a grazing, conacre or agistment agreement;

[GA]

works” refers to the following or any of them:—

[GA]

(a) field drainage;

[GA]

(b) land reclamation;

[GA]

(c) the construction and improvement of watercourses;

[GA]

(d) the removal of unnecessary fences;

[GA]

(e) the construction of new fences and the improvement of existing ones;

[GA]

(f) improvement of hill grazing;

[GA]

(g) reclamation of estuarine marsh land and of callows;

[GA]

(h) any operations ancillary to the foregoing.

[GA]

Power of Minister to carry out works and occupier's contribution towards cost.

2.—(1) The Minister may, at the request of the occupier of land, carry out works on the land and do all things necessary for this purpose.

[GA]

(2) Whenever the Minister proposes to carry out works on any land, he shall inform the occupier of the nature and extent of the proposed works and the amount of the occupier's contribution towards the cost of carrying them out.

[GA]

(3) Where the occupier of land accepts the Minister's proposal, the Minister shall notify the Land Commission forthwith in the prescribed form and the Land Commission shall, except in the case of unregistered land subject to a purchase annuity or land held under a temporary agreement with the Land Commission, or land of which the Land Commission is the registered owner, transmit the notification to the Land Registry or the Registry of Deeds (as the case may require) for registration and no fee or other payment shall be required for registration.

(4) (a) Unless the occupier, in accepting the Minister's proposal, informs the Minister that he wishes to pay his contribution by means of an annuity, the contribution shall become due and payable to the Minister by the occupier for the time being on the date upon which the Minister certifies that the works have been completed.

(b) If the contribution is not paid within three months after it has become due and payable, the Minister shall notify the Land Commission of the default.

[GA]

Payment of occupier's contribution by means of annuity.

3.—(1) This section applies where—

[GA]

(a) the occupier, in accepting the Minister's proposal, informs the Minister that he wishes to pay his contribution by means of an annuity, or

[GA]

(b) default occurs under subsection (4) of section 2.

[GA]

(2) In any case to which this section applies, the occupier's contribution shall be charged by the Land Commission in the prescribed manner upon every interest (including the fee simple) in the land upon which the works are agreed to be carried out and all land held therewith by the same tenure or under the same tenancy, and such charge shall have effect as on and from the date upon which the Minister certifies that the works have been completed, and shall be discharged by means of an annuity (in this Act referred to as a reclamation annuity) payable on the prescribed gale days and calculated at the rate of four per cent. per annum.

(3) The charge created under this section shall take priority over all charges and incumbrances, whether statutory or otherwise, except sums payable to the Commissioners of Public Works in Ireland or the Land Commission.

[GA]

(4) Where land on which a reclamation annuity is charged is or becomes subject to a purchase annuity, the two annuities shall, during the prescribed period, stand consolidated so as to form one purchase annuity.

[GA]

(5) To avoid doubts, it is hereby declared that neither a reclamation annuity nor that portion of a consolidated annuity which represents a reclamation annuity shall be subject to revision under Part III of the Land Act, 1933 (No. 38 of 1933).

[GA]

(6) Land subject to the charge created under this section which is being sold or vested by the Land Commission under any statutory power shall be sold or vested subject to the charge.

[GA]

(7) In every case to which this section applies the Land Commission shall, except in the case of unregistered land subject to a purchase annuity or land held under a temporary agreement with the Land Commission, or land of which the Land Commission is the registered owner, transmit particulars of the charge to the Land Registry or the Registry of Deeds (as the case may require) for registration and no fee or other payment shall be required for registration.

(8) A certificate purporting to be under the common seal of the Land Commission shall be evidence that the land therein described has been duly charged under this section in accordance with the terms of the certificate.

[GA]

Provisions relating to annuities.

4.—(1) The Land Commission shall have all such rights and remedies for the recovery of money payable to them in respect of a reclamation annuity as they have under the Land Purchase Acts in the case of money payable to them in respect of any lands.

[GA]

(2) In particular, all money payable to them in respect of a reclamation annuity shall be recoverable from the person in actual occupation of the land at the time when proceedings for recovery of the money are commenced as a personal liability of that person notwithstanding that the whole or part of the arrears may have accrued due before that person went into occupation of the land.

[GA]

(3) Nothing in this section shall relieve any other person from liability in respect of any such arrears and, as between successive owners or occupiers of the land, all money paid by or recovered from an occupier in respect of arrears caused by the default of a former owner or occupier shall be recoverable by the occupier who has paid it, or from whom it has been recovered, as a debt due to him by the owner or occupier in default.

(4) A certificate purporting to be under the common seal of the Land Commission shall be evidence that every sum stated therein to be due to them is so due and is payable by the person or persons named in the certificate as being liable therefor.

(5) All arrears of reclamation annuities shall be a charge on the Guarantee Fund under the Land Purchase Acts and shall be made good to the Exchequer out of that fund.

[GA]

(6) Where land is subject to a consolidated annuity or a reclamation annuity the Land Commission shall have for the apportionment of the annuity all the powers which they have under the Land Purchase Acts for the apportionment of any moneys charged on or payable out of land, and they may, if they think fit, discharge any portion or portions of land from any further liability for the annuity or any part thereof or any arrears thereof and thereafter the whole of the annuity shall be exclusively charged on the remainder of such land.

Clearing of watercourses.

5.—(1) The Minister may, where it appears to him to be necessary for the adequate reclamation of any land under any works being carried out by him, clear or repair a watercourse, and, for this purpose, shall, by his servants and agents, have access to the watercourse and may proceed along its banks with or without machinery in so far as appears to him to be necessary so as to render it capable of carrying waters that should normally pass through it, and may dispose of the spoil in such manner as he thinks fit.

(2) Before entering on land under this section the Minister shall either obtain the consent (in the case of occupied land) of the occupier, or (in the case of unoccupied land) of the owner or shall give not less than fourteen days' notice in writing of the intention to make such entry.

[GA]

(3) The notice referred to in the preceding subsection may be given to a person in any of the following ways:—

(a) by delivering it to such person,

[GA]

(b) by leaving it at the address where such person ordinarily resides,

[GA]

(c) by sending it by post in a prepaid registered letter addressed to such person at the address where he ordinarily resides, or

[GA]

(d) by posting it at or near the land concerned.

[GA]

Compensation.

6.—(1) Any person who suffers damage by reason of any interference, caused by the execution of works pursuant to this Act, with any land owned or occupied by him or any easement, profit-a-prendre or other right belonging to him shall, subject to the provisions of this Act, be entitled to be paid compensation in respect of such damage by the Minister.

(2) Every claim for compensation made under this section shall be made in writing to the Minister before the expiration of the period beginning on the commencement of the works which caused the interference to which the claim relates and ending either two years thereafter or one year after the completion of such works (whichever is the later).

(3) In default of agreement, the amount of any compensation payable by the Minister under this section shall, if the amount claimed in respect thereof does not exceed twenty pounds, be determined by the District Court or, in any other case, be determined by arbitration under the Acquisition of Land (Assessment of Compensation) Act, 1919 (as amended by subsequent enactments) as if the compensation were the price of land compulsorily acquired and the court or the arbitrator, as the case may be, shall have jurisdiction to determine whether compensation is, in the circumstances, payable at all.

(4) In determining compensation under this section, regard shall be had to any protection or benefit enuring to the claimant by reason of the execution of the works to which the claim relates.

(5) A justice of the District Court when making an order under this section may at his discretion order the costs, to an amount not exceeding three guineas, incurred in relation to the proceedings by any party thereto (together with such witnesses' expenses as the justice considers reasonable) to be paid by any other party thereto.

(6) Where, in the case of an application to the District Court to determine the compensation to be paid under this section by the Minister, the compensation determined by the Court does not exceed that offered unconditionally by the Minister before the application was made, the Court may order that such costs and witnesses' expenses of the Minister as the Court considers reasonable shall be deducted from the compensation determined by the Court.

(7) The jurisdiction conferred by this section on the District Court shall be exercised, at the election of the claimant, by the justice within whose district the works or any part thereof were executed or by the justice within whose district the interference or any part thereof occurred.

Regulations.

7.—(1) The Minister for Finance may make regulations for the calculation, period of payment, redemption and disposal of annuities under this Act.

(2) The power to make rules conferred by subsection (1) of section 3 of the Land Act, 1933 (No. 38 of 1933), shall extend to the making of rules for any matter referred to in this Act as prescribed.

(3) Regulations under this section shall be laid before each House of the Oireachtas as soon as may be after they are made and if a resolution is passed by either House within the next twenty-one days upon which that House has sat after the regulations have been laid before it annulling the regulations, the regulations shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.

Expenses.

8.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title.

9.—This Act may be cited as the Land Reclamation Act, 1949.
