1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht Iascaigh (Comhdhlúthú), 1959.

Toghcháin coimeádaithe áirithe a chur ar athló.

2.—(1) D'ainneoin aon ní sna hAchtanna Iascaigh, 1959 go 1964, beidh éifeacht ag na forálacha seo a leanas:

(a) maidir leis na toghcháin coimeádaithe de bhun ailt 22 agus 27 den Phríomh-Acht a bheadh, mura mbeadh an t-alt seo, le déanamh sa bhliain 1974, déanfar iad ina ionad sin sa bhliain 1975 nó cibé bliain is deireanaí ná sin a shocróidh an tAire le hordú más cuí leis sin a dhéanamh,

(b) maidir leis na toghcháin coimeádaithe de bhun na n-alt sin, seachas na toghcháin a luaitear i mír (a) den fho-alt seo, déanfar iad gach cúigiú bliain chomhleanúnach i ndiaidh na bliana ina ndéanfar na toghcháin a luaitear amhlaidh, agus

(c) forléireofar bliain toghcháin de réir mhíreanna (a) agus (b) den fho-alt seo.

(2) Aon uair a bheartófar ordú faoin alt seo a dhéanamh, cuirfidh an tAire faoi deara dréacht den ordú a leagan faoi bhráid gach Tí den Oireachtas agus ní dhéanfar an t-ordú go dtí go mbeidh rún ag ceadú an dréachta rite ag gach Teach acu sin.

Gearrtheideal, comhlua agus forléiriú.

3.—(1) Féadfar an tAcht Iascaigh (Leasú), 1974, a ghairm den Acht seo.

(2) Féadfar na hAchtanna Iascaigh, 1959 go 1974, a ghairm de na hAchtanna Iascaigh, 1959 go 1964, agus den Acht seo le chéile.

(3) Forléireofar an Príomh-Acht agus an tAcht seo le chéile mar aon ní amháin.

FISHERIES (AMENDMENT) ACT, 1974

Interpretation.

1.—In this Act “the Principal Act” means the Fisheries (Consolidation) Act, 1959.

Elections of certain conservators postponed.

2.—(1) Notwithstanding anything contained in the Fisheries Acts, 1959 to 1964, the following provisions shall have effect:

(a) the elections of conservators pursuant to sections 22 and 27 of the Principal Act which, apart from this section, would fall to be held in the year 1974 shall be held instead either in the year 1975 or in such later year as the Minister, if he thinks fit, by order fixes,

(b) the elections of conservators pursuant to those sections, other than the elections mentioned in paragraph (a) of this subsection, shall be held in each fifth successive year after the year in which the elections so mentioned are held, and

(c) election year shall be construed in accordance with paragraphs (a) and (b) of this subsection.

(2) When an order under this section is proposed to be made, the Minister shall cause a draft of the order to be laid before each House of the Oireachtas and the order shall not be made until a resolution approving of the draft has been passed by each such House.

Short title, collective citation and construction.

3.—(1) This Act may be cited as the Fisheries (Amendment) Act, 1974.

(2) The Fisheries Acts, 1959 to 1964, and this Act may be cited together as the Fisheries Acts, 1959 to 1974.

(3) The Principal Act and this Act shall be construed together as one.
