ACHT NA gCÚIRTEANNA, 1973

Líon na ngnáthbhreithiúna san Ard-Chúirt.
1.—(1) Seachtar ar a mhéid an líon gnáth-bhreithiúna a bheidh san Ard-Chúirt.
(2) Aisghairtear leis seo fo-alt 4 (2) d'Acht na gCúirteanna (Forálacha Forlíontacha), 1961.
Cáiliochtaí breithiúna na Cúirte Cuarda.
2.—(1) Chun críche cáilíochta le haghaidh ceapacháin—
(a) faoi alt 43 den Acht Cúirteanna Breithiúnais, 1924, mar bhreitheamh den Chúirt Bhreithiúnais Chuarda arna bunú faoi alt 37 den Acht sin, nó
(b) faoi alt 14 den Acht Cúirteanna Breithiúnais, 1936, le gníomhú go sealadach mar bhreitheamh den sórt sin,
measfar gur chleachtadh ag an mBarra i gcónaí seirbhís a thug duine a cheapfar faoin alt sin 14 le gníomhú go sealadach mar bhreitheamh den Chúirt sin.
(2) Chun críche cáilíochta le haghaidh ceapacháin—
(a) faoi alt 17 (2) (a) d'Acht na gCúirteanna (Forálacha Forlíontacha), 1961, mar bhreitheamh den Chúirt Chuarda, nó
(b) faoin alt sin 14 le gníomhú go sealadach mar bhreitheamh den sórt sin,
measfar gur cleachtadh ag an mBarra, agus gurbh ea i gcónaí, seirbhís a thug duine a cheapfar faoin alt sin 14 le gníomhú go sealadach mar bhreitheamh den Chúirt sin.
Gearrtheideal, comhlua agus forléiriú.
3.—(1) Féadfar Acht na gCúirteanna, 1973, a ghairm den Acht seo.
(2) Féadfar Achtanna na gCúirteanna (Forálacha Forlíontacha), 1961 go 1973, a ghairm d'Achtanna na gCúirteanna (Forálacha Forlíontacha), 1961 go 1971, agus den Acht seo le chéile, agus forléireofar iad le chéile mar aon Acht amháin.

COURTS ACT, 1973
Number of ordinary judges of High Court.
1.—(1) The number of ordinary judges of the High Court shall not be more than seven.
(2) Subsection 4 (2) of the Courts (Supplemental Provisions) Act, 1961, is hereby repealed.
Qualification of judges of Circuit Court.
2.—(1) For the purpose of qualification for appointment—
(a) under section 43 of the Courts of Justice Act, 1924, as a judge of the Circuit Court of Justice constituted by section 37 of that Act, or
(b) under section 14 of the Courts of Justice Act, 1936, to act temporarily as such a judge,
service by a person appointed under the said section 14 to act temporarily as a judge of that Court shall be deemed always to have been practice at the Bar.
(2) For the purpose of qualification for appointment—
(a) under section 17 (2) (a) of the Courts (Supplemental Provisions) Act, 1961, as a judge of the Circuit Court, or
(b) under the said section 14 to act temporarily as such a judge,
service by a person appointed under the said section 14 to act temporarily as a judge of that Court shall be deemed to be, and always to have been, practice at the Bar.
Short title, collective citation and construction.
3.—(1) This Act may be cited as the Courts Act, 1973.
(2) The Courts (Supplemental Provisions) Acts, 1961 to 1971, and this Act may be cited together as the Courts (Supplemental Provisions) Acts, 1961 to 1973, and shall be construed together as one Act.
