3.—(1) O am rithte an Achta so agus dá éis isí an Ard-Chomhairle a cheapfidh an Coimisinéir agus féadfa sí é chur as oifig aon uair.

(2) Dintar leis seo ceapa Liam Uí Mhurchadha mar Phríomh-Choimisinéir do Phóilíneacht Chathrach Bhaile Atha Cliath do dhaingniú chun bheith i bhfeidhm an 5adh lá de Bhealtaine, 1923, agus ón lá san amach, ach go ndéanfa sé agus go sighneoidh sé i bhfianaise Coimisinéara Shíochána faisnéis sa bhfuirm atá sa Chéad Sceideal a ghabhann leis an Acht so, agus fós gur Coimisinéir Phóilíneacht Chathrach Bhaile Atha Cliath a bheidh mar ainm agus mar theideal air o am rithte an Achta so agus dá éis sin, agus go mbainfidh leis na forálacha den Acht so a bhaineann leis an gCoimisinéir.

Ceapa an Choimisinéara. Chonganta.

4.—(1) O am rithte an Achta so agus dá éis isí an Ard-Chomhairle a cheapfidh an Coimisinéir Conganta.

(2) Féadfidh an Ard-Chomhairle an té go bhfuil oifig an Choimisinéara Chonganta anois aige, agus éinne a ceapfar ina dhiaidh seo chun an hoifige sin, do chur as an oifig sin aon uair.

Comhachta an Choimisinéara agus dualgaisí agus feidhmeanna an Choimisinéara Chonganta.

5.—(1) O am rithte an Achta so agus dá éis beidh stiúrú agus cúram generálta Phóilíneacht Chathrach Bhaile Atha Cliath dílsithe sa Choimisinéir fé réir rialachán a dhéanfidh an tAire fén Acht so.

(2) O am rithte an Achta so agus dá éis isiad dualgaisí a bheidh ar an gCoimisinéir Conganta agus isiad feidhmeanna a bheidh aige ná cabhrú leis an gCoimisinéir i stiúrú agus i gcúram Phóilíneacht Chathrach Bhaile Átha Cliath agus, chuige sin, pé feidhmeanna d'fheidhmiú a cheapfidh an Coimisinéir do fé réir rialachán a dhéanfidh an tAire fén Acht so.

(3) Tar éis rithte an Achta so má bhíonn agus aon uair a bheidh an Coimisinéir as láthair go sealadach no, tré bhreoiteacht, gan bheith in án a dhualgaisí do chó-líona, no má bhíonn agus aon uair a bheidh oifig an Choimisinéara folamh, féadfidh an tAire a údarú don Choimisinéir Conganta gach ceann no aon cheann de chomhachta agus de dhualgaisí an Choimisinéara d'fheidhmiú no do chó-líona le linn na nea-láithreachta, an mhíchumais no an fholúntais sin.

An fhaisnéis a dhéanfidh baill Phóilíneacht Chathrach Bhaile Atha Cliath.

6.—(1) Einne a ceapadh roimh rith an Achta so chun bheith mar oifigeach no mar bhall eile de Phóilíneacht Chathrach Bhaile Atha Cliath, ní féidir do an oifig sin do chimeád ná gníomhú inti ar shlí ar bith ar bheith caithte do mhí tar éis rithte an Achta so maran rud é gur thug sé, roimh rith an Achta so, an mionn ba ghá de thurus na huaire do réir dlí d'oifigigh no do bhaill eile (pe'ca aca é) de Phóilíneacht Chathrach Bhaile Atha Cliath a thabhairt no maran rud é go ndéanfa sé agus go sighneoidh sé, i láthair Coimisinéara Shíochána, sara mbeidh an mí sin caithte, faisnéis sa bhfuirm atá sa Chéad Sceideal a ghabhann leis an Acht so.

(2) Einne a ceapfar tar éis rithte an Achta so chun bheith mar oifigeach no mar bhall eile de Phóilíneacht Chathrach Bhaile Atha cliath ní féidir do an oifig sin do chimeád ná gníomhú inti ar shlí ar bith go dtí go ndéanfa sé agus go sighneoidh sé, i láthair Coimisinéara Shíochána, faisnéis sa bhfuirm atá sa Chéad Sceideal a ghabhann leis an Acht so.

Póilíneacht Chathrach Bhaile Atha Cliath do chur ar diúité lasmuich de Cheanntar Póilíneachta Chathair Bhaile Atha Cliath.

7.—(1) Más deimhin leis an Aire ar chomhairle Choimisinéir an Ghárda Síochána no tar éis dul i gcomhairle leis, agus fós tar éis dul i gcomhairle le Coimisinéir Phóilíneacht Chathrach Bhaile Atha Cliath, go bhfuil sé riachtanach no oiriúnach chun deighleáil le buaireamh atá ann no 'na bhfuil súil leis no le cás eile fé leith, no chun an dlí do chur i bhfeidhm níos fearr ar aon tslí eile, baill de Phóilíneacht Chathrach Bhaile Atha Cliath do chur ar diúitéthe póilíneachta leasmuich de Cheanntar Póilíneachta Chathair Bhaile Atha Cliath féadfidh an tAire, le hordú, a údarú agus a ordú go gcuirfar ag cabhrú leis an nGárda Síochana pé méid de bhaill Phóilíneacht Chathrach Bhaile Atha Cliath, i pé áiteanna no líomatáistí i Saorstát Éireann, lasmuich den Cheanntar Phóilíneachta roimhráite, a luadhfa sé san ordú san.

(2) Beidh sé de dhualgas ar gach ball de Phóilíneacht Chathrach Bhaile Atha Cliath a cuirfar ar diúité lasmuich den Cheanntar Phóilíneachta roimhráite gníomhú i dteanta no in ionad an Ghárda Síochána san áit no sa líomatáiste ina gcuirfar ar diúité mar sin iad, agus chuige sin dintar leis seo a údarú do sna baill sin de Phóilíneacht Chathrach Bhaile Atha Cliath agus a chur ortha pé dualgaisí do chó-líona agus pé comhachta d'fheidhmiú atá do réir dlí forchurtha ar bhaill no dílsithe i mbaill den Ghárda Síochána atá ar aon chéim leo san áit sin.

(3) Féadfidh an tAire aon uair, le hordú, rialacháin do dhéanamh chun dualgaisí, freagarthachtaí agus tosaíocht balla de Phóilíneacht Chathrach Bhaile Atha Cliath agus balla den Ghárda Síochána, i gcompráid le n-a chéile, do rialú aon uair a bheidh baill de gach fórsa dhíobh san ar diúitéthe póilíneachta san aon áit no líomatáiste amháin, laistigh no lasmuich den Cheanntar Phóilíneachta roimhráite.

Comhacht don Aire chun rialacháin do dhéanamh.

8.—(1) Féadfidh an tAire, fé réir aontú ón Ard-Chomhairle, rialacháin do dhéanamh i dtaobh gach ní no éinní dhíobh so a leanas, sé sin le rá:—

(a) baill de Phóilíneacht Chathrach Bhaile Atha Cliath do ghlaca isteach, do cheapa agus do liostáil;

[EN]

(b) baill de Phóilíneacht Chathrach Bhaile Atha Cliath d'árdú, do scur, d'ísliú, do bhrise agus do phíonósú;

[EN]

(c) dualgaisí gach céime fé leith de Phóilíneacht Chathrach Bhaile Atha Cliath;

[EN]

(d) coinneáil-suas, tréineáil, smacht, agus éifeachtúlacht Phóilíneacht Chathrach Bhaile Atha Cliath;

[EN]

(e) aon rud no éinní eile a bhaineann le bainistí inmheánach Phóilíneacht Chathrach Bhaile Atha Cliath.

(2) Gach ordú agus rialachán a dineadh fé alt 5 den Dublin Police Act, 1836, agus atá i bhfeidhm i dtosach feidhm an Achta so, féadfar iad do leasú no d'athghairm le rialacháin a déanfar fén alt so, agus go dtí go ndéanfar iad d'athghairm amhlaidh, agus fé réir aon leasú den tsórt san, leanfid i bhfeidhm in ainneoin athghairm an ailt sin 5.

9.—(1) Dintar leis seo deire do chur le hoifig Chuntasóir Choimisinéirí Phóilíneacht Chathrach Bhaile Atha Cliath, oifig a bunuíodh le hAlt 7 den Dublin Police Act, 1859, agus in ar códhlúthuíodh, tríd an Acht san, oifigí Ghlacadóir agus Rúnaí na gCoimisinéirí roimhráite agus oifig Forfheicire na gCánach.

(2) Gach talamh, foirgint, tionóntachán, agus ionoighreachta agus na daingneáin agus na feistisí ionta, agus gach troscán agus áirnéis i bhfuirm troscáin, a bhí dílsithe sa Chuntasóir roimhráite láithreach roimh rith an Achta so mar Chuntasóir den tsórt san, láithreach tar éis rithte an Achta so agus gan aon leithliú tiocfid chun bheith dílsithe agus beid dílsithe i gCoimisinéirí Oibreacha Puiblí na hÉireann i gcóir gach estáit agus leasa 'na rabhadar fé seach ar seilbh ag an gCuntasóir roimhráite ina gcóir.

(3) Gach airgead, urrús ar airgead, súncáil agus maoin eile (lasmuich de mhaoin den tsórt a haistrítear leis an bhfo-alt san roimhe seo) agus fós gach fiach agus rud-eile-ar-fionnraí, a bhí dílsithe sa Chuntasóir roimhráite no dlite dho, láithreach roimh rith an Achta so, mar Chuntasóir den tsórt san, tiocfid chun bheith dílsithe agus beid dílsithe láithreach tar éis rithte an Achta so, san Oifigeach Cuntais mar a mínítear eisean san Acht so agus i pé cás in ar gá é beidh an dílsiú san fé réir aistriú i leabhra aon chuideachtan, bainc, no corporáide.

(4) Gach fíneáil, pionós, diúité, táille agus airgead eile a héilítear, a horduítear no a húdaruítear a íoc leis an gCuntasóir roimhráite, tré aon achtachán atá i bhfeidhm láithreach roimh rith an Achta so, íocfar leis an Oifigeach Cuntais iad o am rithte an Achta so agus dá éis sin.

(5) Dintar leis seo a éileamh ar an Oifigeach Cuntais no a ordú no a údarú dho (pe'ca aca é) go ndéanfa sé, tar éis rithte an Achta so, gach íoc no aon íoc a héilítear ar an gCuntasóir roimhráite no a horduítear no a húdaruítear do a dhéanamh, tré aon Acht atá i bhfeidhm láithreach roimh rith an Achta so.

Oiriúnú ar achtacháin áirithe.

10.—(1) O am rithte an Achta so agus dá éis déanfar na tagairtí atá in alt 58 den Dublin Police Act, 1842, do Ghlacadóir an Cheanntair Phóilíneachta, do léiriú mar thagairtí don Oifigeach Cuntais mar a mínítear é leis an Acht so, agus beidh éifeacht dá réir sin ag an alt san 58.

(2) O am rithte an Achta so agus dá éis léireofar mar luadh no mar thagairt don Aire Dlí agus Cirt gach luadh no tagairt do Chomisinéir Póilíneachta Chathair Bhaile Atha Cliath, atá in alt 66 den Local Government (Ireland) Act, 1898, no in aon ordú a dineadh fé fhorálacha an ailt sin no chun iad do chur ar aghaidh, agus beidh éifeacht dá réir sin ag an alt san 66 agus ag gach ordú den tsórt san roimhráite.

11.—(1) Má dhineann an tAire laistigh de thrí mhí tar éis rithte an Achta so, a dheimhniú i scríbhinn fé n-a láimh, maidir le haon bhall de Phóilíneacht Chathrach Bhaile Atha Cliath—

(a) gur éirigh sé no gur briseadh é as an bhfórsa póilíneachta san roimh an 11adh lá d'Iúl, 1921, agus

[EN]

(b) go raibh sé ar seirbhís mar bhall d'Fhórsaí Cosanta Shaorstáit Éireann an 7adh lá de Mhí na Samhna, 1923, no roimhe sin, agus

[EN]

(c) gur hath-inbhíodh sa bhfórsa póilíneachta san é roimh rith an Achta so, no laistigh de thrí mhí ina dhiaidh sin, agus

[EN]

(d) gur hath-inbhíodh amhlaidh é ar an scór gur mar gheall ar chúiseanna polaiticiúla amháin d'éirigh sé no a briseadh é as an bhfórsa póilíneachta san mar adubhradh,

tuigfar an ball san den bhfórsa póilíneachta san do bheith as láthair ar cead gan págh ar feadh na tréimhse idir é éirighe no é bhrise as an bhfórsa mar sin agus an t-ath-inbhiú san a dineadh air, agus i gcóir méadú páigh agus i gcóir pinsin beidh teideal aige chun an tréimhse sin do chur le pé tréimhsí seirbhíse, roimh an éirghe-as no roimh an mbrise-as san agus tar éis an athinbhithe sin, 'na mbeadh teideal aige, lasmuich de sin, chun iad d'áireamh i gcóir na nithe sin.

(2) Bainfidh fo-ailt (2), (3) agus (4) d'alt 3 den Acht Aois-Liúntas agus Pinsean, 1923 (Uimh. 34 de 1923), le haon bhall de Phóilíneacht Chathrach Bhaile Atha Cliath 'na dtabharfar amach deimhniú ina thaobh fén alt so ach beidh an deimhniú san in ionad deimhniú fén alt san 3.

DUBLIN POLICE ACT, 1924.


AN ACT TO MAKE PROVISION FOR THE BETTER ADMINISTRATION OF THE DUBLIN METROPOLITAN POLICE AND FOR THAT AND OTHER PURPOSES TO AMEND THE LAW RELATING TO THE SAID POLICE. [28th July, 1924.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

the expression “the Commissioner” means the Commissioner of the Dublin Metropolitan Police;

[GA]

the expression “the Assistant Commissioner” means the Assistant Commissioner of the Dublin Metropolitan Police;

[GA]

the expression “the Accounting Officer” means the public officer to whom the duty of preparing the appropriation account in relation to the Dublin Metropolitan Police is for the time being assigned by the Minister for Finance;

[GA]

the expression “the Minister” means the Minister for Justice.

Change of style and title of Chief Commissioner.

2.—From and after the passing of this Act the Chief Commissioner of the Dublin Metropolitan Police shall be styled and known as the Commissioner of the Dublin Metropolitan Police.

Appointment of Commissioner.

3.—(1) From and after the passing of this Act the Commissioner shall be appointed and may at any time be removed by the Executive Council.

(2) The appointment of William R. E. Murphy to be Chief Commissioner of the Dublin Metropolitan Police is hereby confirmed as on and from the 5th day of May, 1923, subject to his making and subscribing before a Peace Commissioner a declaration in the form contained in the First Schedule to this Act, and subject to the qualifications that from and after the passing of this Act his style and title shall be Commissioner of the Dublin Metropolitan Police, and that the provisions of this Act relating to the Commissioner shall apply to him.

Appointment of Assistant Commissioner.

4.—(1) From and after the passing of this Act the Assistant Commissioner shall be appointed by the Executive Council.

(2) The person now holding the office of Assistant Commissioner, and any person hereafter appointed to that office may at any time be removed from that office by the Executive Council.

Powers of Commissioner and duties and functions of Assistant Commissioner.

5.—(1) From and after the passing of this Act the general direction and control of the Dublin Metropolitan Police shall, subject to regulations made by the Minister under this Act, be vested in the Commissioner.

(2) From and after the passing of this Act the duties and functions of the Assistant Commissioner shall be to assist the Commissioner in the direction and control of the Dublin Metropolitan Police and to exercise such functions in that behalf as the Commissioner shall, subject to regulations made by the Minister under this Act, assign to him.

(3) If and whenever after the passing of this Act the Commissioner is temporarily absent or is incapacitated by illness from performing his duties, or the office of Commissioner is vacant, the Minister may authorise the Assistant Commissioner to exercise or perform, during such absence incapacity or vacancy, all or any of the powers and duties of the Commissioner.

Declaration to be made by members of the Dublin Metropolitan Police.

6.—(1) No person appointed before the passing of this Act to be an officer or other member of the Dublin Metropolitan Police shall be capable of holding that office, or acting in any way therein after the expiration of one month from the passing of this Act unless he has before the passing of this Act taken the oath for the time being required by law to be taken by officers or other members (as the case may require) of the Dublin Metropolitan Police, or shall before the expiration of the said month make and subscribe before a Peace Commissioner a declaration in the form contained in the First Schedule to this Act.

(2) No person appointed after the passing of this Act to be an officer or other member of the Dublin Metropolitan Police shall be capable of holding that office or acting in any way therein until he shall have made and subscribed before a Peace Commissioner a declaration in the form contained in the First Schedule to this Act.

7.—(1) Whenever the Minister is satisfied, on the advice of or after consultation with the Commissioner of the Gárda Síochána and after consultation with the Commissioner of the Dublin Metropolitan Police, that in order to meet an existing or anticipated disturbance or other special circumstances or otherwise for the better enforcement of law it is necessary or expedient to employ members of the Dublin Metropolitan Police on police duties outside the Police District of Dublin Metropolis, the Minister may by order authorise and direct so many of the members of the Dublin Metropolitan Police to be employed in assisting the Gárda Síochána in such places or areas in Saorstát Eireann outside the Police District aforesaid as he may specify in such order.

(2) It shall be the duty of every member of the Dublin Metropolitan Police employed outside the Police District aforesaid to act in conjunction with or in substitution for the Gárda Siοchána in the place or area in which they are so employed, and for that purpose such members of the Dublin Metropolitan Police are hereby authorised and required to perform such duties and exercise such powers as are by law imposed on or vested in members of the Gárda Síochána of equivalent rank in that place.

(3) The Minister may at any time by order make regulations to govern the relative duties, responsibilities, and precedence of members of the Dublin Metropolitan Police and the Gárda Síochána whenever members of each of those forces are employed on police duties in the same place or area, whether within or outside the Police District aforesaid.

Power of Minister to make regulations.

8.—(1) The Minister may, subject to the approval of the Executive Council, make regulations in relation to all or any of the matters following, that is to say:—

(a) the admission, appointment, and enrolment, of members of the Dublin Metropolitan Police;

[GA]

(b) the promotion, retirement, degradation, dismissal, and punishment of members of the Dublin Metropolitan Police;

[GA]

(c) the duties of the several ranks of the Dublin Metropolitan Police;

[GA]

(d) the maintenance, training, discipline, and efficiency of the Dublin Metropolitan Police;

[GA]

(e) any other matter or thing relating to the internal management of the Dublin Metropolitan Police.

[GA]

(2) All orders and regulations made under section 5 of the Dublin Police Act, 1836, and in force at the commencement of this Act, may be amended or revoked by regulations made under this section, and until so revoked, and subject to any such amendment, shall continue in force notwithstanding the repeal of the said section 5.

Abolition of office of Accountant.

9.—(1) The office of Accountant to the Commissioners of the Dublin Metropolitan Police created by section 7 of the Dublin Police Act, 1859, and in which by that Act were consolidated the offices of Receiver and Secretary to the Commissioners aforesaid and the office of Supervisor of Taxes, is hereby abolished.

(2) All lands, buildings, tenements, and hereditaments and the fixtures and fittings therein, and all furniture and chattels in the nature of furniture, which immediately before the passing of this Act were vested in the Accountant aforesaid in his capacity as such Accountant shall forthwith upon the passing of this Act and without any conveyance become and be vested in the Commissioners of Public Works for Ireland for all the estate and interest for which the same were respectively held by the Accountant aforesaid.

(3) All moneys, securities for moneys, investments, and other property (except such property as is transferred by the foregoing sub-section) and also all debts and other choses-in-action which immediately before the passing of this Act were vested in or owing to the Accountant aforesaid in his capacity as such Accountant shall forthwith upon the passing of this Act become and be vested in the Accounting Officer as defined in this Act but subject where necessary to transfer in the books of any company, bank, or corporation.

(4) All fines, penalties, duties, fees, and other moneys which are required, directed, or authorised by any enactment in force immediately before the passing of this Act to be paid to the Accountant aforesaid shall from and after the passing of this Act be paid to the Accounting Officer.

(5) The Accounting Officer is hereby required, directed, or authorised (as the case may be) to make after the passing of this Act every or any payment which the Accountant aforesaid is by any enactment in force immediately before the passing of this Act required, directed, or authorised to make.

Adaptation of certain enactments.

10.—(1) From and after the passing of this Act the references in section 58 of the Dublin Police Act, 1842, to the Receiver of the Police District shall be construed as references to the Accounting Officer as defined by this Act, and the said section 58 shall have effect accordingly.

(2) From and after the passing of this Act every reference to or mention of the Commissioner of Police of Dublin Metropolis contained in section 66 of the Local Government (Ireland) Act, 1898, or in any order made under or in furtherance of the provisions of that section shall be construed as a reference to or mention of the Minister for Justice, and the said section 66 and every such order as aforesaid shall have effect accordingly.

Reinstatement of certain members of the Dublin Metropolitan Police.

11.—(1) If the Minister shall within three months after the passing of this Act certify in writing under his hand that any member of the Dublin Metropolitan Police—

(a) resigned or was dismissed from that police force before the 11th day of July, 1921, and

[GA]

(b) was on or before the 7th day of November, 1923, serving as a member of the Defence Forces of Saorstát Eireann, and

[GA]

(c) was reinstated in the said police force before or within three months after the passing of this Act, and

[GA]

(d) was so reinstated on the ground that he resigned or was dismissed as aforesaid solely for political reasons,

[GA]

such member of the said police force shall, during the period between his said resignation or dismissal and his said reinstatement, be deemed to have been absent on leave without pay, and shall for the purpose of increment of pay and for the purpose of pension be entitled to add such period to such periods of service before such resignation or dismissal and after such reinstatement as he is otherwise entitled to reckon for those purposes.

(2) Sub-sections (2), (3), and (4) of section 3 of the Superannuation and Pensions Act, 1923 (No. 34 of 1923) shall apply to any member of the Dublin Metropolitan Police in respect of whom a certificate is given under this section with the substitution of such certificate for a certificate under the said section 3.

Inquiry into charges against members of the Dublin Metropolitan Police.

12.—(1) It shall be lawful for the Commissioner or for any other member of the Dublin Metropolitan Police not being of lower rank than Inspector nominated for that purpose by the Commissioner, or for any person nominated for that purpose by the Minister to hold an inquiry and to examine on oath into the truth of any charge or complaint of neglect or violation of duty preferred against any member of the Dublin Metropolitan Police, and also by summons under his hand to require the attendance of any witness at such inquiry.

(2) Any person who, having been duly summoned under the foregoing sub-section to attend as a witness at any such inquiry, shall neglect or refuse to attend at such inquiry, or shall refuse to give evidence thereat shall be liable on summary conviction to a fine not exceeding twenty pounds, or to imprisonment with or without hard labour for a period not exceeding three months.

Repeals.

13.—The several Acts specified in the Second Schedule to this Act are hereby repealed to the extent mentioned in the third column of that Schedule.

14.—This Act may be cited as the Dublin Police Act, 1924.
