4.—Déantar leis seo na hachtacháin a luaitear i gcolún (2) den Chéad Sceideal a ghabhas leis an Acht seo d'athghairm a mhéid a sonraítear i gcolún (3) den Sceideal sin.
CUID II.

5.—(1) Féadfaidh an tAire monaí copar-nicil agus umha de na hainmníochta faoi seach a sonraítear i gcolún (1) den Dara Sceideal a ghabhas leis an Acht seo a sholáthar, agus féadfaidh pé bearta is cuí leis a dhéanamh chun na monaí sin a sholáthar.
(2) Gach mona a soláthrófar faoin alt seo beidh sé do réir an mheáchain chaighdeánaigh a sonraítear ina leith i gcolún (2) den Dara Sceideal a ghabhas leis an Acht seo.
(3) (a) Gach mona a soláthrófar faoin alt seo beidh sé do réir an chomhshuímh chaighdeánaigh a sonraítear ina leith i gcolún (3) den Dara Sceideal a ghabhas leis an Acht seo nó, más mona copar-nicil é, do réir pé comhshuímh chaighdeánaigh eile a cuirfear ina ionad sin le hordú faoi mhír (b) den fho-alt seo.
(b) Féadfaidh an tAire, maidir le haon mhonaí copar-nicil d'ainmníocht áirithe a soláthrófar faoin alt seo, an Dara Sceideal a ghabhas leis an Acht seo a leasú le hordú trí pé comhshuíomh caighdeánach eile is cuí leis a chur in ionad an chomhshuímh chaighdeánaigh a sonraítear ansin maidir leis na monaí sin.
(4) Lamhálfar i leith monaí a soláthrófar faoin alt seo an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) a sonraítear ina leith i gcolún (5) den Dara Sceideal a ghabhas leis an Acht seo.
(5) Na hainmníochta monaí a soláthrófar faoin alt seo, beidh acu, faoi seach, luacha codánacha, i leith an phuint Éireannaigh, amhail mar sonraítear i gcolún (4) den Dara Sceideal a ghabhas leis an Acht seo.
(6) Féadfaidh an tAire, le rialacháin, na tuisí agus na dearachta d'ordú le haghaidh na n-ainmníocht monaí faoi seach atá le soláthar faoin alt seo, agus gach mona a soláthrófar faoin alt seo beidh sé do réir na dtuisí agus na dearachta a hordófar amhlaidh ina leith.

6.—(1) San alt seo ní fholaíonn an focal “miotal” ór ná airgead.
(2) (a) Féadfaidh an tAire, aon uair agus a mhinice is oiriúnach leis, a dhearbhú le hordú (dá ngairmtear ordú monaíochta nua san alt seo) go bhfuil sé fóirstineach go soláthrófaí monaí de mhiotal sonraithe nó de mheascán sonraithe miotal, seachas copar-nicil (pé acu a bheas copar nó nicil ann nó nach mbeidh), d'aon ainmníocht shonraithe acu seo a leanas, eadhon, leathchoróin, flóirín, scilling, réal nó leathréal.
(b) Aon ordú monaíochta nua a bhainfeas le monaí d'ainmníocht áirithe, sonróidh sé meáchan caighdeánach agus comhshuíomh caighdeánach na monaí sin agus an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) atá le lamháil ina leith.
(c) Féadfaidh an tAire, le hordú, ordú monaíochta nua a chúlghairm.
(d) Ní thiocfaidh aon ordú faoin bhfo-alt seo i bhfeidhm mura ndaingnítear ná go dtí go ndaingneofar é le rún ó gach Tigh den Oireachtas.
(3) Aon uair a bheas ordú monaíochta nua i bhfeidhm—
(a) féadfaidh an tAire monaí lena mbainfidh an t-ordú a sholáthar agus pé bearta a dhéanamh is cuí leis chun na monaí sin a sholáthar,
(b) ní sholáthróidh an tAire, faoi alt 5 den Acht seo, aon mhonaí copar-nicil arb ionann a n-ainmníocht agus ainmníocht na monaí lena mbainfidh an t-ordú.
(4) Beidh feidhm ag na forála seo a leanas maidir le gach mona a soláthrófar faoin alt seo—
(a) beidh sé do réir an mheáchain chaighdeánaigh agus an chomhshuímh chaighdeánaigh a sonrófar ina leith san ordú monaíochta nua a bhainfeas leis an mona sin, ach lamhálfar ina leith an tualaing (nó an claonadh ón meáchan caighdeánach agus ón gcomhshuíomh caighdeánach) a luafar ina leith san ordú,
(b) beidh aige, i leith an phuint Éireannaigh, an luach codánach céanna a bheadh aige dá mba mhona copar-nicil den ainmníocht chéanna é a soláthraíodh faoi alt 5 den Acht seo.
(5) Féadfaidh an tAire, le rialacháin, na tuisí agus an dearacht d'ordú le haghaidh na n-ainmníocht monaí faoi seach a soláthrófar faoin alt seo, agus gach mona a soláthrófar faoin alt seo beidh sé do réir na dtuisí agus na dearachta a hordófar amhlaidh ina leith.

7.—Gach mona a soláthrófar faoi alt 5 nó 6 den Acht seo, eiseoidh an tAire tríd an mBanc Ceannais é.

8.—Gach suim a bheas ag teastáil chun monaí a sholáthar a soláthrófar faoi alt 5 nó 6 den Acht seo, íocfar as ciste ginearálta an Bhainc Cheannais í agus féichiúnófar sa chiste sin í ar chúlchiste an airgid reatha.
Fáltais as eisiúint mhonaí a soláthrófar faoi alt 5 nó 6.
9.—Déanfar na fáltais as gach eisiúint mhonaí a soláthrófar faoi alt 5 nó 6 den Acht seo d'íoc isteach i gciste ginearálta an Bhainc Cheannais agus a chur chun creidiúna cúlchiste an airgid reatha sa chiste sin.
Toirmeasc ar dhéanamh agus eisiúint mhonaí.
10.—(1) Ach amháin monaí óir a heiseofar faoi Acht 1927 agus monaí a heiseofar faoin Acht seo, ní déanfar ná ní heiseofar sa Stát aon phíosa miotail nó miotail mheasctha d'aon luach ar bith mar mhona ná mar inchomhartha ar airgead ná mar ní a airbheartaíos go bhfuil a shealbhóir i dteideal aon luach a taispeántar air d'éileamh.
(2) Ní bhaineann fo-alt (1) den alt seo leis an mBanc Ceannais d'eisiúint mhonaí a soláthraíodh, roimh thosach feidhme an Achta seo, faoi Acht 1926 nó faoin Acht sin arna leasú leis an Ordú Cumhachta Práinne (Uimh. 140), 1942 (R. & O. R., Uimh. 6 de 1942), nó le hailt 58 agus 60 d'Acht 1942.
(3) Gach duine a dhéanfas nó a eiseos aon phíosa miotail nó miotail mheasctha contrártha d'fho-alt (1) den alt seo, beidh sé ciontach in oilghníomh agus ar a chiontú ann dlífear fíneáil nach mó ná céad punt a chur air.
Monaí a heisíodh faoi na hachtacháin athghairmthe nó faoin Acht seo a ghlaoch isteach.
11.—(1) Féadfaidh an tAire, le hordú, monaí d'aon dáta nó ainmníocht áirithe, a heisíodh faoi na hAchta athghairmthe nó faoin Acht seo, a ghlaoch isteach.
(2) Beidh feidhm ag na forála seo a leanas maidir le gach ordú faoi fho-alt (1) den alt seo—
(a) forálfar san ordú go dtiocfaidh sé i ngníomh ar dháta áirithe (dá ngairmtear an dáta feidhme sa bhfo-alt seo) nach luaithe ná sé mhí tar éis dáta a dhéanta,
(b) leagfar an t-ordú faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin, roimh an dáta feidhme, rún a rith ag neamhniú an orduithe beidh an t-ordú arna neamhniú dá réir sin.
Dlí-thairiscint.
12.—(1) Má déantar airgead a thairiscint i monaí (seachas monaí umha) a heisíodh faoi na hachtacháin athghairmthe nó faoin Acht seo, beidh an tairiscint sin ina dlí-thairiscint chun suim nach mó ná dachad scilling d'íoc, ach ní bheidh i gcás aon tsuime is mó ná sin.
(2) Má déantar airgead a thairiscint i monaí umha a heisíodh faoi na hachtacháin athghairmthe nó faoin Acht seo, beidh an tairiscint sin ina dlí-thairiscint chun suim nach mó ná scilling d'íoc, ach ní bheidh i gcás aon tsuime is mó ná sin.
(3) Ní bhaineann an t-alt seo le monaí a glaodh isteach faoi Acht 1926, arna leasú le hAcht 1942, nó faoin Acht seo.

13.—Féadfaidh an Banc Ceannas, más oiriúnach leis é, monaí a heisíodh faoi na hachtacháin athghairmthe nó faoin Acht seo a thaithcheannach agus déanfar gach suim a bheas ag teastáil chuige sin d'íoc as ciste ginearálta an Bhainc Cheannais agus d'fhéichiúnú ar chúlchiste an airgid reatha sa chiste sin.
Fáltais as leaghadh monaí a dhiúscairt.
14.—Féadfaidh an Banc Ceannais na fáltais as leaghadh monaí a tarraingeofar as cúrsaíocht nó monaí a bheas ar stoc ag an mBanc Ceannais, agus nach mbeidh ag teastáil chun a n-eisiúna nó a n-atheisiúna, a chur isteach i gcúlchiste an airgid reatha.
An luach i leith an phuint Éireannaigh a bheas ag monaí a heisíodh faoi na hachtacháin athghairmthe.
15.—Gach mona a heisíodh faoi na hachtacháin athghairmthe beidh aige, i leith an phuint Éireannaigh, an luach codánach céanna a bheadh aige dá mba mhona den ainmníocht chéanna é a soláthraíodh faoi alt 5 den Acht seo.
Feidhm agus oiriúnú achtachán áirithe.
16.—Gach achtachán a luaitear i gcolún (2) den Tríú Sceideal a ghabhas leis an Acht seo, beidh éifeacht aige do réir na bhforál atá leagtha amach i gcolún (3) den Sceideal sin os coinne lua an achtacháin sin.

17.—Foilseofar gach ordú faoin Acht seo san Iris Oifigiúil a luaithe is féidir tar éis a dhéanta.

Cóipcheart i monaí Eireannacha.
18.—(1) San alt seo, ciallaíonn an abairt “monaí Eireannacha” aon mhonaí acu seo a leanas, eadhon—
(a) monaí a heisíodh faoi na hachtacháin athghairmthe, nó
(b) monaí óir a heisíodh faoi Acht 1927, nó
(c) monaí a heiseofar faoin Acht seo.
(2) An cóipcheart i ngach mona Éireannach agus an cóipcheart san obair ealaíonachta a shainléiríos dearachta aon mhonaí Eireannacha, is cóipcheart suthain a bheas ann agus is leis an Aire é.
(3) D'ainneoin aon ní i bhfo-alt (1) d'alt 155 den Acht Maoine Tionscail agus Tráchtála (Cosaint), 1927 (Uimh. 16 de 1927), má déantar iomlán aon mhona Éireannaigh nó aon chuid de a mhacasamhlú in aon fhoilseachán litríochta nó ealaíon, gan toiliú an Aire, beidh sin ina shárú ar an gcóipcheart sa mhona sin.

19.—(1) Ní dleathach d'aon phearsa (seachas an Banc Ceannais), ach amháin faoi réim agus do réir cheadúnais arna eisiúint ag an Aire, aon mhona a bheas de thuras na huaire ar rith sa Stát nó in aon tír eile a leaghadh ná a bhriseadh ná é d'úsáid ach amháin mar airgead reatha.
(2) Duine ar bith—
(a) a dhéanfas gníomh contrártha don alt seo, nó
(b) nach gcomhlíonfaidh aon choinníoll áirithe a bheas ag gabháil le ceadúnas arna dheonadh faoin alt seo,

COINAGE ACT, 1950.
PART I.
Preliminary and General.
Short title.
1.—This Act may be cited as the Coinage Act, 1950.
Commencement.
2.—This Act shall come into operation on such day as may be fixed for that purpose by order of the Minister.
Definitions.
3.—In this Act—
the expression “the Act of 1926” means the Coinage Act, 1926 (No. 14 of 1926);
the expression “the Act of 1927” means the Currency Act, 1927 (No. 32 of 1927);
the expression “the Act of 1942” means the Central Bank Act, 1942 (No. 22 of 1942);
the expression “the Central Bank” means the Central Bank of Ireland;
Coins issued under the repealed enactments.
references to coins issued under the repealed enactments shall be construed as references to coins issued under the Act of 1926 or that Act as amended by the Emergency Powers (No. 140) Order, 1942 (S.R. & O., No. 6 of 1942), or by sections 58 and 60 of the Act of 1942;
cupro-nickel
the word “cupro-nickel,” in relation to a coin, means a coin made of a mixture of copper and nickel;
Minister
the expression “the Minister” means the Minister for Finance.
Repeals.
4.—The enactments mentioned in column (2) of the First Schedule to this Act are hereby repealed to the extent specified in column (3) thereof.
PART II.
Coinage, other than gold coinage.
Provision of cupro-nickel and bronze coins.
5.—(1) The Minister may provide cupro-nickel and bronze coins of the several denominations specified in column (1) of the Second Schedule to this Act, and may take such steps as he thinks proper for the provision of such coins.
(2) Every coin provided under this section shall be of the standard weight specified in respect thereof in column (2) of the Second Schedule to this Act.
(3) (a) Every coin provided under this section shall be of the standard composition specified in respect thereof, in column (3) of the Second Schedule to this Act or, if it is a cupro-nickel coin, such other standard composition as may be substituted therefor by an order under paragraph (b) of this subsection.
(b) The Minister may, in respect of any cupro-nickel coins of a particular denomination provided under this section by order amend the Second Schedule to this Act by substituting, for the standard composition specified therein in respect of those coins, such other standard composition as he thinks fit.
(4) There shall be allowed in respect of coins provided under this section the remedy (or variation from the standard weight and standard composition) stated in respect thereof in column (5) of the Second Schedule to this Act.
(5) The several denominations of coins provided under this section shall respectively bear to the Irish pound the fractional values stated in column (4) of the Second Schedule to this Act.
(6) The Minister may by regulations prescribe the dimensions and design of the several denominations of coins to be provided under this section and every coin provided under this section shall be of the dimensions and design so prescribed in respect thereof.
Provision of coins in lieu of cupro-nickel coins.
6.—(1) In this section the word “metal” does not include gold or silver.
(2) (a) The Minister may, whenever and so often as he thinks fit, by order (in this section referred to as a new coinage order) declare that it is expedient to provide coins of a specified metal or a specified mixture of metals, other than cupro-nickel (whether or not including copper or nickel), of any specified denomination, being a half-crown, florin, shilling, sixpence or threepence.
(b) A new coinage order relating to coins of a particular denomination shall specify the standard weight and standard composition of those coins and the remedy (or variation from the standard weight and standard composition) to be allowed in respect thereof.
(c) The Minister may by order revoke a new coinage order.
(d) No order under this subsection shall come into force unless and until it has been confirmed by resolution of each House of the Oireachtas.
(3) Where a new coinage order is in force—
(a) the Minister may provide coins to which the order relates and take such steps as he thinks proper for the provision of such coins,
(b) the Minister shall not provide under section 5 of this Act any cupro-nickel coins of the like denomination as the coins to which the order relates.
(4) The following provisions shall apply to every coin provided under this section—
(a) it shall be of the standard weight and standard composition specified in respect thereof in the new coinage order relating to such coin, but there shall be allowed in respect thereof the remedy (or variation from the standard weight and standard composition) stated in respect thereof in the order,
(b) it shall bear to the Irish pound the same fractional value as it would bear if it were a cupro-nickel coin of the like denomination provided under section 5 of this Act.
(5) The Minister may by regulations prescribe the dimensions and design of the several denominations of coins provided under this section and every coin provided under this section shall be of the dimensions and design so prescribed in respect thereof.
Issue of coins provided under section 5 or 6.
7.—Every coin provided under section 5 or 6 of this Act shall be issued by the Minister through the Central Bank.
Expenses of provision of coins under section 5 or 6.
8.—All sums required for the provision of coins provided under section 5 or 6 of this Act shall be defrayed out of the general fund of the Central Bank and debited therein to the currency reserve.
Proceeds of issue of coins provided under section 5 or 6.
9.—The proceeds of every issue of coins provided under section 5 or 6 of this Act shall be paid into the general fund of the Central Bank and carried therein to the credit of the currency reserve.
Prohibition of making or issuing of coins.
10.—(1) Except gold coins issued under the Act of 1927 and coins issued under this Act, no piece of metal or mixed metal of any value whatsoever shall be made or issued in the State as a coin or a token for money or as purporting that the holder thereof is entitled to demand any value denoted thereon.
(2) Subsection (1) of this section does not apply to the issue by the Central Bank of coins provided, before the commencement of this Act, under the Act of 1926 or that Act as amended by the Emergency Powers (No. 140) Order, 1942 (S.R. & O. No. 6 of 1942), or by sections 58 and 60 of the Act of 1942.
(3) Every person who makes or issues any piece of metal or mixed metal in contravention of subsection (1) of this section shall be guilty of a misdemeanour and shall be liable on conviction thereof to a fine not exceeding one hundred pounds.
Calling in of coins issued under the repealed enactments or this Act.
11.—(1) The Minister may by order call in coins issued under the repealed enactments or this Act of any particular date or denomination.
(2) The following provisions shall apply in respect of every order under subsection (1) of this section—
(a) the order shall provide for its coming into operation on a particular date (in this subsection referred to as the operative date) not being earlier than six months after the date of its making,
(b) the order shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order is passed by either such House before the operative date, the order shall be annulled accordingly.
Legal tender.
12.—(1) A tender of money if made in coins (other than bronze coins) issued under the repealed enactments or this Act shall be legal tender for the payment of an amount not exceeding forty shillings but for no greater amount.
(2) A tender of money if made in bronze coins issued under the repealed enactments or this Act shall be legal tender for the payment of an amount not exceeding one shilling but for no greater amount.
(3) This section does not apply to coins called in under the Act of 1926, as amended by the Act of 1942, or this Act.
Redemption of coins issued under repealed enactments or this Act.
13.—The Central Bank may, if it thinks fit so to do, redeem coins issued under the repealed enactments or this Act and all sums required for that purpose shall be defrayed out of the general fund of the Central Bank and debited therein to the currency reserve.
Disposal of proceeds of melting down of coins.
14.—The Central Bank may carry to the currency reserve the proceeds of melting down of coins withdrawn from circulation or of coins held in stock by the Central Bank and not required for issue or re-issue.
Value of coins issued under the repealed enactments in relation to the Irish pound.
15.—Every coin issued under the repealed enactments shall bear to the Irish pound the same fractional value as it would bear if it were a coin of the like denomination provided under section 5 of this Act.
Application and adaptation of certain enactments.
16.—Each enactment mentioned in column (2) of the Third Schedule to this Act shall have effect in accordance with the provisions set out in column (3) of that Schedule opposite the mention of that enactment.
Publication of orders in Iris Oifigiúil.
17.—Every order under this Act shall be published in the Iris Oifigiúil as soon as may be after it is made.
PART III.
Coins Generally.
Copyright in Irish coins.
18.—(1) In this section, the expression “Irish coins” means any coins being—
(a) coins issued under the repealed enactments, or
(b) gold coins issued under the Act of 1927, or
(c) coins issued under this Act.
(2) The copyright in all Irish coins and the copyright in the artistic work defining the designs of any Irish coins shall be perpetual and shall belong to the Minister.
(3) Notwithstanding anything contained in subsection (1) of section 155 of the Industrial and Commercial Property (Protection) Act, 1927 (No. 16 of 1927), the reproduction in any published literary or artistic work without the consent of the Minister of the whole or any part of any Irish coin shall constitute an infringement of the copyright in that coin.
Prohibition on melting down, etc., of coins.
19.—(1) It shall not be lawful for any person (other than the Central Bank) except under and in pursuance of a licence issued by the Minister, to melt down, break up or use otherwise than as currency any coin which is for the time being current in the State or in any other country.
(2) If any person—
(a) acts in contravention of this section, or
(b) fails to comply with any condition attached to a licence granted under this section,
he shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds or, at the discretion of the Court to imprisonment for a term not exceeding two years or to both such fine and imprisonment and, in addition to any other punishment, the Court may order the articles in respect of which the offence was committed to be forfeited.
