ACHT FÓRSAÍ COSANTA (PINSIN) (LEASÚ), 1938.

Mínithe.

1.—San Acht so—

cialluíonn an abairt “an Príomh-Acht” an tAcht Fórsaí Cosanta (Pinsin), 1932 (Uimh. 26 de 1932);

tá leis na habairtí “na Fórsaí” agus “scéim phinsin” na bríonna céanna atá leis na habairtí sin fé seach sa Phríomh-Acht.

Brí na habairte “oifigeach de sna Fórsaí” do leathnú.

2.—Chun crícheanna an Phríomh-Achta deintear leis seo brí na habairte “oifigeach de sna Fórsaí” do leathnú i dtreo go bhfolóidh sí—

(a) duine bhí ina oifigeach de sna Fórsaí tráth ar bith i rith na tréimhse dar tosach an 16adh lá de Mhí na Nodlag, 1932, agus dar críoch an 26adh lá de Dheire Fómhair, 1937, agus do ceapadh, i rith na tréimhse sin agus faid do bhí sé ina oifigeach den tsórt san, chun bheith ina bhall den Ghárda Síochána, agus

(b) duine do fuair bás idir an 16adh lá de Mhí na Nodlag, 1932, agus an 26adh lá de Dheire Fómhair, 1937, agus a bhí, ar dháta a bháis, ag fónamh mar oifigeach de sna Fórsaí, agus

(c) duine do fuair bás an 12adh lá d'Eanar, 1935, agus do thug suas a choimisiún mar oifigeach de sna Fórsaí an 11adh lá d'Eanar. 1935.

Pinsin do bhaintreacha agus do chlainn oifigeacha marbha áirithe do thosnú.

3.—(1) I gcás—

(a) duine do fuair bás idir an 16adh lá de Mhí na Nodlag, 1932, agus an 26adh lá de Dheire Fómhair, 1937, do bheith ar dháta a bháis ag fónamh mar oifigeach de sna Fórsaí, agus

(b) pinsean do dheonadh fé scéim phinsin do bhaintrigh an duine sin no do dhuine chlainne leis,

féadfar a fhoráil leis an scéim phinsin sin go dtosnóidh an pinsean san ar bheith iníoctha amhail ar an lá agus ón lá tar éis an lae ar a bhfuair an duine sin bás.

(2) I gcás—

(a) duine do fuair bás an 12adh lá d'Eanar, 1935, do thabhairt suas a choimisiúin mar oifigeach de sna Fórsaí an 11adh lá d'Eanar, 1935, agus

(b) pinsean do dheonadh fé scéim phinsin do bhaintrigh an duine sin no do dhuine chlainne leis,

féadfar a fhoráil leis an scéim phinsin sin go dtosnóidh an pinsean san ar bheith iníoctha amhail ar an 13adh lá d'Eanar, 1935, agus ón lá san amach.

Leasú cúlghabhálach ar scéimeanna pinsean.

4.—Má deintear scéim phinsin (dá ngairmtear an tseana-scéim san alt so) do leasú le scéim phinsin a ceapfar ina dhiaidh sin féadfar a rá in aon leasú ar an seana-scéim go mbeidh an leasú san i ngníomh ón dáta san (nach luaithe ná dáta na seana-scéime do theacht i bhfeidhm) a luadhfar sa scéim phinsin sin a ceapfar ina dhiaidh sin.

Pinsin do dheonadh.

5.—I gcás ina bhféadfar pinsean no aisce do dheonadh do dhuine ar bith fé scéim phinsin (a tháinig i bhfeidhm roimh an Acht so do rith no thiocfaidh i bhfeidhm dá éis sin) féadfaidh an tAire Cosanta, as a chomhairle féin, an pinsean no an aisce sin do dheonadh (fé réir an Aire Airgeadais do thoiliú leis sin roimh ré) no diúltadh d'é dheonadh.

6.—(1) Féadfar an tAcht Fórsaí Cosanta (Pinsin) (Leasú), 1938, do ghairm den Acht so.

(2) Féadfar na hAchtanna Fórsaí Cosanta (Pinsin), 1932 agus 1938, do ghairm den Phríomh-Acht agus den Acht so le chéile.

DEFENCE FORCES (PENSIONS) (AMENDMENT) ACT, 1938.

Definitions.

1.—In this Act—

the expression “the Principal Act” means the Defence Forces (Pensions) Act, 1932 (No. 26 of 1932);

the expressions “the Forces” and “pension scheme” have the same meanings as those expressions respectively have in the Principal Act.

Extension of meaning of expression “officer of the Forces.”

2.—For the purposes of the Principal Act, the meaning of the expression “officer of the Forces” is hereby extended so as to include—

(a) a person who was an officer of the Forces at any time during the period commencing on the 16th day of December, 1932, and ending on the 26th day of October, 1937, and who, during such period and while he was such officer, was appointed to be a member of the Gárda Síochána, and

(b) a person who died between the 16th day of December, 1932, and the 26th day of October, 1937, and who was, at the date of his death, serving as an officer of the Forces, and

(c) a person who died on the 12th day of January, 1935, and who resigned his commission as an officer of the Forces on the 11th day of January, 1935.

Commencement of pensions to widows and children of certain deceased officers.

3.—(1) Where—

(a) a person who died between the 16th day of December, 1932, and the 26th day of October, 1937, was at the date of his death serving as an officer of the Forces, and

(b) a pension is granted under a pension scheme to the widow or a child of such person,

such pension scheme may provide that such pension shall commence to be payable as on and from the day after the day on which such person died.

(2) Where—

(a) a person who died on the 12th day of January, 1935, resigned his commission as an officer of the Forces on the 11th day of January, 1935, and

(b) a pension is granted under a pension scheme to the widow or a child of such person,

such pension scheme may provide that such pension shall commence to be payable as on and from the 13th day of January, 1935.

Retrospective amendment of pensions schemes.

4.—Where a pension scheme (in this section referred to as the previous scheme) is amended by a subsequent pension scheme, any amendment of the previous scheme may be expressed to be operative from such date (not earlier than the coming into force of the previous scheme) as may be specified in such subsequent pension scheme.

Grant of pensions.

5.—Where a pension or gratuity may be granted to any person under a pension scheme (whether such scheme has come into force before or after the passing of this Act) the Minister for Defence may, in his absolute discretion, either make (subject to the previous consent of the Minister for Finance) such grant or refuse to make such grant.

Short title.

6.—(1) This Act may be cited as the Defence Forces (Pensions) (Amendment) Act, 1938.

(2) The Principal Act and this Act may be cited together as the Defence Forces (Pensions) Acts, 1932 and 1938.
