2.—Baineann an tAcht so le gach talamh a bhí dílsithe i mBord Rialtais Áitiúla na hÉireann, díreach roimh an 6adh lá de Mhí na Nodlag, 1921, fé sna Poor Relief (Ireland) Acts, 1838 to 1914, no chun crícheanna na nAcht san, agus is le Saorstát Éireann anois de bhua Airtiogal 11 den Bhunreacht.

Léasanna agus ceadúnaisí ón Aire.

3.—(1) Más dó leis an Aire gurb é leas na puiblíochta aon talamh le n-a mbaineann an tAcht so do dheona d'éinne ar léas no ar ceadúnas, féadfaidh an tAire fén Acht so agus dá réir le dintiúir fé n-a shéala oifigiúil—

(a) an talamh san do dheona don duine sin ar léas ar pé téarma is dó leis an Aire is ceart agus ná raghaidh thar naoi mbliana déag is cheithre fichid, no

(b) ceadúnas do dheona don duine sin chun an talamh san d'úsáid agus do bheith ar seilbh aige ar pé téarma is dó leis an Aire is ceart agus ná raghaidh thar naoi mbliana déag is cheithre fichid.

(2) Gach léas no ceadúnas a déanfar no a deonfar fén alt so déanfar no deonfar é (maran dó leis an Aire gur cheart, ar mhaithe leis an bpuiblíocht, an léas no an ceadúnas san do dhéanamh no do dheona in aisce) fé réir íocaíocht do dhéanamh leis an Aire, i bhfuirm fhíneála no íocaíochta eile roimh ré no i bhfuirm chíosa no ar an dá shlí sin, i pé airgead is dó leis an Aire is ceart agus ar a socróidh sé leis an duine le n-a ndéanfar no dá ndeonfar an léas no an ceadúnas san.

(3) Déanfar no deonfar gach léas no ceadúnas den tsórt san roimhráite fé réir pé cumhnanta, coiníollacha agus có-aontuithe agus beidh ann pé cumhnanta, coiníollacha agus có-aontuithe (nách cinn chun an léas no an ceadúnas d'athnuachaint) is dó leis an Aire is ceart no is maith chun leasa na puiblíochta no ar aon tslí eile agus ar a socróidh sé leis an duine le n-a ndéanfar no dá ndeonfar an léas no an ceadúnas san.

(4) Aon léas no ceadúnas a déanfar no a deonfar fén alt so ní bhainfe sé le haon mhianaigh ná minearáil ná ní fholóidh sé iad.

4.—(1) Má bhíonn an tAire ar aigne léas no ceadúnas do dhéanamh no do dheona fén Acht so ar aon téarma a raghaidh thar cúig bliana leagfa sé fé bhráid gach Tighe den Oireachtas ráiteas ina dtaisbeánfar cé leis no cé dho go bhfuiltear ar aigne an léas no an ceadúnas san do dhéanamh no do dheona, an mhaoin atáthar ar aigne a chur sa léas no sa cheadúnas san, an fhíneáil no an íocaíocht eile roimh ré (más ann di) agus an cíos (más ann do) atáthar ar aigne a éileamh ar son an léasa no an cheadúnais sin, agus na cumhnanta, na coiníollacha agus na có-aontuithe atáthar ar aigne a chur sa léas no sa cheadúnas san.

(2) Ní déanfar na ní deonfar aon léas ná ceadúnas fén Acht so ar aon téarma a raghaidh thar cúig bliana go dtí—

(a) go ndéanfaidh gach Tigh den Oireachtas, le rún, a údarú an léas no an ceadúnas san do dhéanamh no do dheona tar éis aon cheann de sna forálacha atáthar ar aigne a chur sa léas no sa cheadúnas san d'atharú no gan san d'atharú, no

(b) go mbeidh deire le pe'ca ceann de sna tréimhsí seo leanas is sia, sé sin le rá:—

(i) dhá lá déag tar éis an chéad lá a shuidhfidh ceachtar Tigh den Oireachtas tar éis an ráiteas do réir an ailt seo do bheith leagtha fé bhráid Tithe an Oireachtais, no

(ii) sé lá a shuidhfidh ceachtar Tigh den Oireachtas tar éis an ráiteas san do bheith leagtha amhlaidh fé bhráid na dTithe.

(3) Má húdaruítear le rún a rithfidh ceachtar Tigh den Oireachtas léas no ceadúnas do dhéanamh no do dheona fén Acht so fé réir aon atharú dhéanamh ar na forálacha atáthar ar aigne a chur sa léas no sa cheadúnas san, ní deonfar an léas ná an ceadúnas san ach tar éis agus fé réir an atharú san do dhéanamh ar a fhorálacha.

Léasanna agus ceadúnaisí o údaráis áitiúla.

5.—(1) Pé uair is dó leis an Aire go raghadh sé chun leasa na puiblíochta an t-údarás áitiúil do dhéanamh no do dheona léasa no ceadúnais ar thalamh le n-a mbaineann an tAcht so agus atá suidhte laistigh de líomatáiste fheidhmiúcháin an údaráis áitiúla san féadfaidh an tAire a údarú don údarás áitiúil sin an léas no an ceadúnas san do dhéanamh no do dheona agus leis sin féadfaidh an t-údarás áitiúil sin an léas no an ceadúnas san do dhéanamh no do dheona fén alt so agus dá réir.

(2) Bainfidh na forálacha so leanas le húdarás áitiúil do dhéanamh no do dheona ceadúnais fén alt so, sé sin le rá:—

(a) déarfaidh léas no ceadúnas den tsórt san gur mar ghníomhaire don Aire do dhein no do dheon an t-údarás áitiúil é;

[EN]

(b) ní déanfar ná ní deonfar aon léas ná ceadúnas den tsórt san ar aon téarma a raghaidh thar cúig bliana;

[EN]

(c) ní bhainfidh aon léas ná ceadúnas den tsórt san le haon mhianaigh ná minearáil ná ní fholóidh sé iad;

[EN]

(d) cuirfear in áirithe i ngach léas no ceadúnas den tsórt san pé cíos le n-a n-aontóidh an tAire;

(e) beidh i ngach léas no ceadúnas den tsórt san pé cumhnanta, coiníollacha agus có-aontuithe (nách cinn chun an léas no an ceadúnas d'athnuachaint) is dó leis an Aire is ceart no is maith chun leasa na puiblíochta no ar aon tslí eile agus ar a socróidh an t-údarás áitiúil sin leis an duine le n-a ndéanfar no dá ndeonfar an léas no an ceadúnas san.

(3) Féadfaidh an tAire, le rialacháin a dhéanfa sé, a ordú cadiad na cásanna inar féidir agus cadiad na téarmaí agus na coiníollacha ar ar féidir d'údaráis áitiúla léasanna no ceadúnaisí ar théarmaí is giorra ná bliain do dhéanamh no do dheona fén alt so agus faid a bheidh na rialacháin sin i bhfeidhm tuigfear, maidir le haon léas a dhéanfaidh no le haon cheadúnas a dheonfaidh údarás áitiúil fén alt so agus dá réir agus do réir na rialachán san ar théarma is giorra ná bliain, gur údaruigh an tAire é fén alt so agus gur aontuigh an tAire leis sa mhéid gur gá do réir an ailt seo an t-aontú san d'fháil.

(4) An t-údarás áitiúil a dhéanfaidh léas no a dheonfaidh ceadúnas fén alt so glacfaid agus baileoid, mar ghníomhaire don Aire, an cíos a cuirfear in áirithe leis an léas no leis an gceadúnas san no a bheidh iníoctha fé agus mara n-íoctar an cíos san féadfid dul chun dlí ina n-ainm féin chun é bhaint amach.

(2) Gach airgead a híocfar leis an Aire Airgid roimh an Acht so do rith chun úsáide an Phrímh-Chiste fé aon léas no ceadúnas den tsórt a luaidhtear sa bhfo-alt san roimhe seo aisíocfar leis an Aire é amach as an bPrímh-Chiste chó luath agus bheidh sé caothúil san do dhéanamh.

8.—(1) I gcás inar dhein comhairle chontae, roimh an Acht so do rith, a thabhairt le tuisgint léas no ceadúnas a dhéanamh no a dheona, ina n-ainm féin no in ainm an Aire, ar thalamh le n-a mbaineann an tAcht so, agus atá suidhte laistigh de líomatáiste fheidhmiúcháin na comhairle sin, ar théarma ná raghaidh thar cúig bliana, ansan, fé réir na comhachta chun deire a chur leis a bronntar ar an Aire anso ina dhiaidh seo, beidh an léas no an ceadúnas san agus tuigfear go raibh sé riamh dleathach agus éifeachtach ar gach slí ach amháin ná beidh brí ná éifeacht ag aon chó-aontú a bheidh sa léas no sa cheadúnas san chun é d'athnuachaint ná ag aon deona mianach no minearál a bheidh ráite sa léas no sa cheadúnas san no a bheidh le tuisgint as.

(2) Féadfaidh an tAire le hordú, aon am laistigh de shé mhí tar éis an Achta so do rith, deire do chur, o dháta an orduithe sin no o aon dáta is déanaí ná san, le haon léas no ceadúnas a dheineann an t-alt so dleathach, agus leis sin beidh deire leis an léas san no leis an gceadúnas san dá réir sin.

9.—(1) An Có-aontú do Léas (dá ngairmtear an Có-aontú san alt so), fé dháta an chéad lá de Lúnasa, 1923, do deineadh idir an Aire um Rialtas Áitiúil, ar thaobh, agus Andrew A. Watt and Company, Limited, ar an taobh eile, agus tré n-ar aontuigh an tAire sin go ndeonfadh sé, agus tré n-ar aontuigh Andrew A. Watt and Company, Limited, sin go nglacfaidís léas ar an áitreabh a tuairiscítear ann mar “the premises comprising the Infirmary Buildings with the yard and private road thereunto, which premises are hereinafter called the said premises, being part of the old Letterkenny Workhouse, and are situate in the town of Letterkenny and County of Tirconnail,” ar théarma chúig mbliana fichead ón gcéad lá de Lúnasa, 1923, ar chíos bhliantúil £100, daingnítear leis seo é, agus beidh sé agus tuigfear go raibh sé riamh dleathach agus éifeachtach.

10.—Gach airgead do gheobhaidh an tAire, údarás áitiúil no comhairle chontae fén Acht so ar aon talamh déanfaidh an tAire no an t-údarás áitiúil sin no an chomhairle sin (pe'ca aca é) é do chur chun glanta aon fhiacha, fiachaisí, íocaíochtaí no costaisí is iníoctha ag an Aire no ag an údarás áitiúil sin no ag an gcomhairle sin ar an talamh san agus ar aon talamh eile a bheidh ar seilbh fén teideal céanna, agus, sa mhéid ná beidh an t-airgead san ag teastáil chun na fiacha, na fiachaisí, na híocaíochtaí agus na costaisí sin do ghlana, déanfaidh é chur mar chabhair chun íoctha na gcostas fé n-a raghfar i bhfóirithin na mbocht i líomatáiste feidhmiúcháin an údaráis áitiúla gur ina líomatáiste feidhmiúcháin atá an talamh san suidhte.

11.—(1) Beidh sé de dhualgas ar údarás áitiúil gach talamh le n-a mbaineann an tAcht so agus atá suidhte laistigh de líomatáiste fheidhmiúcháin an údaráis áitiúla san do choinneáil in ordú, fé dheisiú agus i dtreo mhaith thionóntachta agus gach íocaíocht a bheidh iníoctha i dtaobh an tailimh sin do ghlana.

(2) Ní oibreoidh an t-alt so chun léasaí ná ceadúnaí fé léas no fé cheadúnas a déanfar fén Acht so do shaora o oblagáid ar bith a cuirfear air leis an léas no leis an gceadúnas san no fé.

Costaisí údarásanna áitiúla.

12.—(1) Gach costas fé n-a raghaidh údarás áitiúil (nách bord caomhnóirí) fén Acht so agus ná híocfar as airgead do gheobhfar fén Acht so íocfar é tríd an ráta dealbhais agus cruinneofar go cothrom é ar fuaid líomatáiste feidhmiúcháin an údaráis áitiúla san.

(2) Gach costas fé n-a raghaidh bord caomhnóirí fén Acht so agus ná híocfar as airgead do gheobhfar fén Acht so íocfar é mar mhuirear ar an aontas agus cruinneofar go cothrom é ar fuaid aontas uile an bhúird chaomhnóirí sin.

STATE LANDS (WORKHOUSES) ACT, 1930.


AN ACT TO MAKE BETTER PROVISION IN RELATION TO THE MAKING OF LEASES AND THE GRANTING OF LICENCES OF CERTAIN LANDS WHICH WERE FORMERLY VESTED IN THE LOCAL GOVERNMENT BOARD FOR IRELAND AND NOW BELONG BY VIRTUE OF ARTICLE 11 OF THE CONSTITUTION TO SAORSTÁT EIREANN, TO CONFIRM CERTAIN LEASES AND LICENCES HERETOFORE MADE OR AGREED TO BE MADE OF PORTIONS OF SUCH LANDS, TO MAKE PROVISION FOR THE MAINTENANCE OF SUCH LANDS AND FOR THE DISCHARGE OF OUTGOINGS PAYABLE IN RESPECT THEREOF AND FOR OTHER PURPOSES CONNECTED WITH THE AFORESAID MATTERS. [15th April, 1930.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:— [GA]

Definitions.

1.—In this Act—

[GA]

the expression “the Minister” means the Minister for Local Government and Public Health;

[GA]

the expression “the Act of 1924” means the State Lands Act, 1924 (No. 45 of 1924);

[GA]

the expression “local authority” means and includes a board of guardians, and a board of health and public assistance or other body to which is entrusted the administration of the relief of the poor in a county or county borough under a county scheme under the Local Government (Temporary Provisions) Act, 1923 (No. 9 of 1923); and

[GA]

the word “rent” includes any periodical payment in the nature of rent.

Land to which this Act applies.

2.—This Act applies to all land which immediately before the 6th day of December, 1921 was vested in the Local Government Board for Ireland under or for the purposes of the Poor Relief (Ireland) Acts, 1838 to 1914 and now by virtue of Article 11 of the Constitution belongs to Saorstát Eireann.

Leases and licences by the Minister.

3.—(1) If in the opinion of the Minister it is in the public interest that any land to which this Act applies should be granted by way of lease or licence to any person, the Minister may under and in accordance with this Act by deed under his official seal either—

(a) demise such land to such person by way of lease for such term not exceeding ninety-nine years as the Minister shall think proper, or

[GA]

(b) grant to such person a licence to use and occupy such land for such term not exceeding ninety-nine years as the Minister shall think proper.

[GA]

(2) Every lease or licence made or granted under this section shall (unless the Minister is of opinion that such lease or licence should in the public interest be made or granted free of any payment) be made or granted subject to the payment to the Minister of such moneys, whether by way of fine or other preliminary payment or by way of rent or by both such ways, as the Minister shall think proper and shall agree upon with the person to whom such lease or licence is made or granted.

(3) Every such lease or licence as aforesaid shall be made or granted subject to and shall contain such covenants, conditions, and agreements (other than for the renewal of the lease or licence) as the Minister shall consider proper or desirable in the public interest or otherwise and shall agree upon with the person to whom such lease or licence is made or granted.

(4) No lease or licence made or granted under this section shall relate or extend to or include any mines or minerals.

Laying of statements of leases or licences before the Oireachtas.

4.—(1) Where the Minister proposes to make or grant a lease or licence under this Act for any term exceeding five years he shall lay before each House of the Oireachtas a statement showing the person to whom such lease or licence is proposed to be made or granted, the property proposed to be included in such lease or licence, the fine or other preliminary payment (if any) and the rent (if any) proposed to be charged for such lease or licence, and the covenants, conditions, and agreements proposed to be inserted in such lease or licence.

(2) No lease or licence for any term exceeding five years shall be made or granted under this Act until either—

(a) each House of the Oireachtas has by resolution authorised the making or granting of such lease or licence either with or without modification of any of the proposed provisions of such lease or licence, or

[GA]

(b) the expiration of whichever of the following periods shall be the longer, that is to say:—

[GA]

(i) twelve days after the first day on which either House of the Oireachtas shall sit next after the statement in accordance with this section shall have been laid before the Houses of the Oireachtas, or

[GA]

(ii) six days on which either House of the Oireachtas shall have sat after the said statement shall have been so laid before the Houses.

[GA]

(3) Where a resolution of either House of the Oireachtas authorises the making or granting of a lease or licence under this Act subject to any modification of the proposed provisions of such lease or licence, such lease or licence shall not be granted save with and subject to such modification of its provisions.

Leases and licences by local authorities.

5.—(1) Whenever in the opinion of the Minister it is in the public interest that a local authority should make or grant a lease or licence of land to which this Act applies situate within the functional area of such local authority the Minister may authorise such local authority to make or grant such lease or licence and thereupon such local authority may make or grant such lease or licence under and in accordance with this section.

(2) The following provisions shall apply to the making of a lease or the granting of a licence by a local authority under this section, that is to say:—

(a) every such lease or licence shall be expressed to be made or granted by the local authority as agent for the Minister;

[GA]

(b) no such lease or licence shall be made or granted for any term exceeding five years;

[GA]

(c) no such lease or licence shall relate or extend to or include any mines or minerals;

[GA]

(d) every such lease or licence shall reserve such rent as the Minister shall approve;

[GA]

(e) every such lease or licence shall contain such covenants, conditions and agreements (other than for the renewal of the lease or licence) as the Minister shall consider proper or desirable in the public interest or otherwise and such local authority shall agree upon with the person to whom such lease or licence is made or granted.

(3) The Minister may by regulations made by him prescribe the circumstances in and the terms and conditions on which leases or licences for terms of less than one year may be made or granted under this section by local authorities and while such regulations are in force any lease made or licence granted by a local authority under and in accordance with this section and in conformity with such regulations for a term of less than one year shall be deemed to have been authorised by the Minister under this section and to have been approved of by the Minister in so far as such approval is required by this section.

(4) The local authority by whom a lease is made or a licence is granted under this section shall receive and collect, as agent for the Minister, the rent reserved by or payable under such lease or licence and in case of non-payment of such rent may sue for the recovery thereof in their own name.

Cesser of application of Act of 1924.

6.—On the passing of this Act the Act of 1924 shall cease to apply to land to which this Act applies.

Transfer of certain leases and licences made under the Act of 1924.

7.—(1) The benefit of every covenant, condition, and agreement to be performed, observed, or fulfilled on the part of the lessee or the licensee contained in any lease or licence of land to which this Act applies which was made or granted under the Act of 1924 before the passing of this Act is hereby assigned to the Minister and shall henceforth be enforceable at the suit of the Minister.

(2) All moneys paid before the passing of this Act to the Minister for Finance for the use of the Central Fund under any such lease or licence as is mentioned in the foregoing sub-section shall be repaid as soon as conveniently may be out of the Central Fund to the Minister.

(3) The right to receive and recover any moneys accrued due but not paid before the passing of this Act to the Minister for Finance for the use of the Central Fund under any such lease or licence as aforesaid is hereby assigned to the Minister and shall henceforth be enforceable at the suit of the Minister.

Validation of certain leases or licences made by local authorities.

8.—(1) Where before the passing of this Act the council of a county has purported either in its own name or in the name of the Minister to make or grant a lease or licence of land to which this Act applies situate within the functional area of such council for a term not exceeding five years such lease or licence shall, subject to the power of termination hereinafter conferred on the Minister, be and be deemed always to have been valid and good in all respects save that any agreement contained in such lease or licence for the renewal thereof and any grant of mines or minerals expressed or implied in such lease or licence shall be void and of no effect.

(2) The Minister may at any time within six months after the passing of this Act, by order terminate as from the date of such order or any subsequent date any lease or licence validated by this section and thereupon such lease or licence shall terminate accordingly

Confirmation of an Agreement.

9.—(1) The Agreement for a Lease (in this section referred to as the Agreement) dated the 1st day of August, 1923 made between the Minister of Local Government of the one part and Andrew A. Watt and Company, Limited, of the other part, whereby the said Minister agreed to grant and the said Andrew A. Watt and Company, Limited, agreed to take a lease of the premises therein described as “the premises comprising the Infirmary Buildings with the yard and private road thereunto, which premises are hereinafter called the said premises, being part of the old Letterkenny Workhouse, and are situate in the town of Letterkenny and county of Tirconnail,” for a term of twenty-five years from the 1st day of August, 1923 at the yearly rent of £100 is hereby confirmed, and shall be and be deemed always to have been valid and good.

(2) The Minister is hereby authorised and empowered to make a lease of the premises the subject of the Agreement in accordance with the terms of the Agreement, and section 4 (which relates to the laying of statements of leases or licences before the Oireachtas) of this Act shall not apply to the making of such lease.

Application of moneys received under this Act.

10.—All moneys received by either the Minister, a local authority or the council of a county under this Act in respect of any land shall be applied by the Minister or such local authority or council (as the case may be) in discharge of any debts, liabilities, outgoings or expenses payable by the Minister or such local authority or council in respect of such land and any other land held under the same title, and, in so far as the same may not be required for the discharge of such debts, liabilities, outgoings and expenses, in aid of the expenses incurred in the relief of the poor in the functional area of the local authority in whose functional area such land is situate.

Liability of local authority in respect of land to which this Act applies.

11.—(1) It shall be the duty of a local authority to keep and maintain in good tenantable order, repair and condition all land to which this Act applies situate within the functional area of such local authority and to discharge all outgoings payable in respect of such land.

(2) This section shall not operate to relieve a lessee or licensee under a lease or licence made under this Act from any obligation imposed on him by or under such lease or licence.

Expenses of local authorities.

12.—(1) All expenses incurred by a local authority (other than a board of guardians) under this Act and not defrayed out of moneys received under this Act shall be defrayed by means of the poor rate and shall be raised equally over the functional area of such local authority.

(2) All expenses incurred by a board of guardians under this Act and not defrayed out of moneys received under this Act shall be defrayed as a union charge and shall be raised equally over the whole union of such board of guardians.

Short title.

13.—This Act may be cited as the State Lands (Workhouses) Act, 1930.
