1.—(1) Féadfar an tAcht Leictreachais (Soláthar) (Leasú), 1945, do ghairm den Acht so.
(2) Féadfar na hAchta Leictreachais (Soláthar), 1927 go 1945, do ghairm de na hAchta Leictreachais (Soláthar), 1927 go 1942, agus den Acht so le chéile.
(3) Léireofar an tAcht so agus na hAchta Leictreachais (Soláthar), 1927 go 1942, mar éinní amháin.
Mínithe.
2.—San Acht so—
ciallaíonn an abairt “an tAire” an tAire Tionnscail agus Tráchtála;
ciallaíonn an abairt “an Bord” Bord Soláthair an Leictreachais;
ciallaíonn an abairt “oibreacha udro-leictreacha” oibreacha chun leictreachas do ghiniúin le cumhacht udrálach;
tá leis na habairtí “stáisiún giniúna”, “córas tiomarnaíochta” agus “córas iomdhála” na bríonna céanna fá seach do bheirtear do na habairtí “stáisiún giniúna”, “cóir iompair” agus “cóir roinneacháin”, fá seach, le halt 1 den Acht Leictreachais (Soláthar), 1927 (Uimh. 27 de 1927), chun críocha an Achta san.

3.—Na costais fána raghaidh an tAire chun an tAcht so do riaradh déanfar (a mhéid a cheadóidh an tAire Airgeadais) iad d'íoc as airgead a sholáthróidh an tOireachtas.
CUID II.
Sceimeanna Udro-Leictreacha.
Scéimeanna udroleictreacha d'ullmhú agus do cheadú.
4.—(1) Is dleathach don Bhord, aon uair a mheasfaid is ceart, scéim d'ullmhú agus do chur fá bhráid an Aire chun leictreachas do ghiniúin le cumhacht udrálach ó uiscí aon abhann áirithe a himiafar agus a cuirfear ar fáil chuige sin trí dhamba agus oibreacha innealtóireachta eile dhéanfaidh an Bord fán Acht so.
(2) Aon uair a dhéanfas an Bord scéim do chur fá bhráid an Aire fán alt so, breithneoidh an tAire an scéim sin agus, tar éis dul i gcomhairle leis an Aire Talmhaíochta i dtaobh na mbeart a bheas le déanamh ag an mBord chun iascaigh do chaomhaint, déanfaidh pé ní acu so leanas a mheasfaidh is ceart, sé sin le rá:—
(a) an scéim sin do cheadú le hordú, nó
(b) an scéim sin do chur thar n-ais go dtí an Bord chun í d'athbhreithniú agus í d'athchur fána bhráid fán alt so, nó
(c) diúltú don scéim sin do cheadú.
(3) San Acht so—
ciallaíonn an abairt “ordú ceadúcháin” ordú arna dhéanamh ag an Aire ag ceadú scéime bheas curtha fána bhráid ag an mBord fán alt so, agus
ciallaíonn an abairt “scéim cheadaithe” scéim arna ceadú ag an Aire le hordú ceadúcháin agus, i gcás aon scéim den tsórt san bheas ceadaithe amhlaidh arna hathrú, ciallaíonn sí an scéim sin arna ceadú amhlaidh,
Scéim cheadaithe do leasú.
5.—(1) Aon uair, le linn scéim cheadaithe do chur i ngníomh, a chífear don Bhord gur gá an scéim sin do leasú in aon tslí, is dleathach don Bhord pé leasú ar an scéim cheadaithe sin d'ullmhú a mheasfaid is ceart agus an leasú san do chur fá bhráid an Aire.
(2) Aon uair a dhéanfas an Bord leasú ar scéim cheadaithe do chur fá bhráid an Aire fán alt so breithneoidh an tAire an leasú san agus, tar éis dul i gcomhairle leis an Aire Talmhaíochta, déanfaidh pé ní acu so leanas a mheasfaidh is ceart, sé sin le rá:—
(a) an leasú san do cheadú le hordú, nó
(b) an leasú san do chur thar n-ais go dtí an Bord chun í d'athbhreithniú agus í d'athchur fána bhráid fán alt so, nó
(c) diúltú don leasú san do cheadú.
(3) Aon uair a dhéanfas an tAire leasú ar scéim cheadaithe do cheadú fan alt so, beidh éifeacht ag an scéim cheadaithe sin agus is tuigthe éifeacht do bheith riamh aici gus an leasú san agus fána réir, agus dá réir sin na tagairtí atá san Acht so do scéim cheadaithe déanfar, maidir leis an scéim cheadaithe sin, iad do léiriú agus beidh éifeacht acu (má cheadaíonn an comhthéacs é) mar thagairtí don scéim cheadaithe sin arna leasú amhlaidh.
Scéimeanna ceadaithe d'fheidhmiú.
6.—(1) A luaithe is caothúil tar éis an tAire do cheadú scéime ceadaithe, déanfaidh an Bord an scéim sin d'fheidhmiú agus do chur i ngníomh.
(2) Chun scéim cheadaithe do chur i ngníomh, is dleathach don Bhord pé méid acu so leanas a mbeidh socrú déanta ina gcóir, go follas nó go folaithe, leis an scéim sin do dhéanamh do réir na scéime sin (fá réir pé breisithe, neamhdhéanta, athruithe, agus claonta do gheobhfar a bheith riachtanach i gcúrsa na hoibre), sé sin le rá:—
(a) uiscí na habhann lena mbainfidh an scéim cheadaithe sin agus uiscí aon abhann nó srutha chothaíos an abha san, agus uiscí aon locha, linne, nó canála uirthi nó i gceangal léi d'imiadh, do stopadh, do chlaonadh, do thógaint, agus d'úsáid;
(b) an abha lena mbainfidh an scéim cheadaithe sin nó aon abha nó sruth a chothaíos an abha san do chladhphortadh, do dhambáil, do dhreidireacht, do dhoimhniú, do leathnú, do dhíriú, do chlaonadh, agus d'athrú ar aon tslí eile;
(c) aon loch, linn, nó uisce eile ar an abhainn lena mbainfidh an scéim cheadaithe sin nó i gceangal léi (go díreach nó go neamh-dhíreach) do chladhphortadh, do dhambáil, do dhreidireacht, agus a leibhéal d'athrú agus baint leis ar aon tslí eile;
(d) aon uisce-chomhla, cora, damba, cladhphort, cé, cuan, áit chalaíochta, tigh bád, nó obair eile dá samhail ar an abhainn lena mbainfidh an scéim cheadaithe sin nó ar aon abhainn nó sruth a chothaíos an abha san nó ar aon loch i gceangal léi do dhíochur, d'athrú, do dheisiú, nó d'athdhéanamh;
(e) uisce-chomhlaí, coraí, dambaí, cladhphoirt agus oibreacha eile dá samhail (lena n-áirítear pasáistí chun iasc do ghabháil suas agus síos tríothu) do dhéanamh agus do chothabháil;
(f) stáisiúin ghiniúna, stáisiúin athracháin, agus stáisiúin agus áiteanna eile do dhéanamh agus do chothabháil chun leictreachas a ginfear de bhun na scéime ceadaithe sin do ghiniúin, d'athrú, do stóráil, nó deighleáil leis ar shlí eile;
(g) inneallra, gléasra, agus fearas do gach stáisiún giniúna, stáisiún athracháin, agus gach stáisiún agus áit eile déanfar fán mír dheiridh sin roimhe seo den fhó-alt so do cheannach, do thógaint ar cíos, nó do sholáthar ar shlí eile agus do chothabháil;
(h) fá réir forál an Achta so, dúnadh, claonadh, díochur, báthadh, nó cur isteach ar shlí eile do dhéanamh ar aon bhóthar nó droichead poiblí;
(i) aon ghníomh nó ní do dhéanamh is gá chun nó i dtaobh aon rud do dhéanamh a n-údaraítear don Bhord leis an bhfó-alt so é dhéanamh.
An Bord do thógaint tailimh, etc.
7.—(1) Chun scéim cheadaithe do chur i ngníomh nó chun éinní do dhéanamh a húdaraítear don Bhord leis an alt deiridh sin roimhe seo a dhéanamh chun na críche sin, féadfaidh an Bord gach ní nó éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) aon talamh do thógaint go buan nó go sealadach agus trí chomhaontú nó go héigeanta;
(b) aon éasáid, cead slí, iascach, ceart iascaireachta, ceart uisce, nó ceart ar bith eile ar aon talamh nó uisce nó maidir leis, do thógaint (go buan nó go sealadach agus trí chomhaontú nó go héigeanta);
(c) foirceannadh, srianadh, nó cur isteach eile do dhéanamh (go buan nó go sealadach agus trí comhaontú nó go héigeanta) ar aon éasáid, cead slí, iascach, ceart iascaireachta, ceart uisce, nó ceart ar bith eile ar aon talamh nó uisce nó maidir leis;
(d) claonadh, dúnadh, díochur, báthadh nó cur isteach eile do dhéanamh (go buan nó go sealadach agus trí chomhaontú nó go héigeanta) ar aon bhóthar, slí, nó droichead príobháideach nó ar aon chanáil nó uisce-bhealach saordha eile nó ar aon uisce-chúrsa saordha;
(e) cur isteach ar aon talamh go buan nó go sealadach agus trí chomhaontú nó go héigeanta.
(2) Aon uair, ar scéim cheadaithe do bheith curtha i ngníomh, a chífear don Bhord ná beidh aon talamh, éasáid cead slí, nó maoin eile bheas tógtha ag an mBord fán Acht so chun críocha na scéime ceadaithe sin ag teastáil chun na gcríoch san, is dleathach don Bhord an mhaoin sin do dhíol, do chur ar léas, nó do chur de láimh ar shlí eile.
Dul isteach ar thalamh, etc., roimh é do leithliú.
8.—(1) Aon uair, tar éis ordú ceadúcháin do bheith déanta agus roimh an leithliú nó fionnadh an phraghais nó an chúitimh do bheith déanta, féadfaidh an Bord (fá réir na bhforál ina dhiaidh seo den alt so) éinní de na nithe seo leanas do dhéanamh, sé sin le rá:—
(a) dul isteach agus seilbh do ghlacadh ar aon talamh nó aon cheart d'fheidhmiú a húdaraítear leis an Acht so don Bhord a thógaint chun an scéim cheadaithe lena mbainfidh an t-ordú ceadúcháin sin do chur i ngníomh;
(b) foirceannadh, srianadh, nó cur isteach eile do dhéanamh ar aon éasáid nó maoin nó ceart eile a n-údaraítear don Bhord leis an Acht so foirceannadh, srianadh, nó cur isteach eile do dhéanamh air chun an scéim cheadaithe sin do chur i ngníomh;
(c) claonadh, dúnadh, díochur, báthadh, nó cur isteach eile do dhéanamh ar aon bhóthar, slí, nó droichead príobháideach, nó ar aon chanáil nó uisce-bhealach saordha eile, nó ar aon uisce-chúrsa saordha, a n-údaraítear don Bhord leis an Acht so claonadh, dúnadh, díochur, báthadh, nó cur isteach eile do dhéanamh air chun an scéim cheadaithe sin do chur i ngníomh.
(2) Aon uair a fheidhmeos an Bord aon chumhacht dá dtugtar don Bhord leis an bhfó-alt deiridh sin roimhe seo den alt so, dlífidh an Bord ús d'íoc, le sealbhaire an tailimh nó únaer na héasáide, an chirt, nó na maoine eile a raghfar isteach air, a feidhmeofar, nó a gcuirfear isteach air de bhíthin an chumhacht san d'fheidhmiú, ar mhéid an phraghais nó an chúitimh is iníoctha fán Acht so leis an sealbhaire nó leis an únaer sin, do réir trí fán gcéad sa bhliain ó dháta an dulta isteach, an fheidhmithe, nó an churtha isteach san go dtí dáta íoctha an phraghais nó an chúitimh sin.
(3) Ní dhéanfaidh an Bord—
(a) dul isteach ná seilbh do ghlacadh ar aon talamh fán alt so gan fógra mí ar a laghad nó, i gcás tighe chomhnaithe ina bhfuil comhnaí, fógra trí mhí ar a laghad do thabhairt i scríbhinn roimh ré do shealbhaire an tailimh sin go bhfuilid ar intinn san do dhéanamh, ná
(b) aon éasáid ná ceart eile d'fheidhmiú ná cur isteach ar aon cheart ná maoin fán alt so gan fógra mí ar a laghad do thabhairt i scríbhinn roimh ré d'únaer na héasáide, an chirt, nó na maoine sin go bhfuilid ar intinn san do dhéanamh.
(4) Féadfar fógra fán bhfó-alt deiridh sin roimhe seo den alt so do sheirbheáil ar dhuine ar bith tríd an bhfógra san do chur leis an bpost réamhíoctha i gclúdach arna dhíriú chun an duine sin ag á ghnáth-sheoladh nó ag an seoladh is déanaí is eol do bheith aige agus is tuigthe gur seirbheáladh é ar an duine sin an uair a déanfaí an clúdach san do sheachadadh i ngnáth-chúrsa an phoist.
(5) Muran féidir, ar aon chúis áirithe, an clúdach a luaitear sa bhfó-alt deiridh sin roimhe seo den alt so do dhíriú mar a foráltar leis an bhfó-alt san, féadfar an clúdach san do dhíriú chun an duine dá mbeidh sé beartaithe i gceachtar slí nó sa dá shlí acu so leanas, sé sin le rá:—
(a) fán tuairisc “an t-únaer” nó “an sealbhaire” (pé acu é) gan a ainm do luadh,
(b) ag an talamh nó ag suíomh na maoine lena mbainfidh an fógra bheas sa chlúdach san.
Léarscála, pleananna, etc., do lóisteáil.
9.—(1) A luaithe is féidir tar éis ordú ceadúcháin do dhéanamh agus ar dháta nach déanaí ná mí roimh thosnú ar aon chuid áirithe do dhéanamh de na hoibreacha is gá chun an scéim cheadaithe lena mbainfidh an t-ordú san d'fheidhmiú nó roimh thosnú, chun na críche sin, ar éinní áirithe do dhéanamh a húdaraítear leis an Acht so don Bhord a dhéanamh nó roimh dhul isteach ar aon talamh nó áitreabh nó feidhmiú do dhéanamh ar aon cheart nó cur isteach ar aon mhaoin (corpartha nó neamhchorpartha) chun na críche sin fán Acht so, cuirfidh an Bord fá ndear léarscála, pleananna, agus leabhair eolais maidir leis an gcuid áirithe sin de na hoibreacha san nó leis an ní áirithe sin nó leis an talamh, an t-áitreabh, an ceart, nó an mhaoin sin (do réir mar bheas) do lóisteáil do réir an ailt seo.
(2) Na léarscála agus na pleananna ceangaltar leis an alt so ar an mBord do lóisteáil maidir le scéim cheadaithe beid líonmhar a ndóthain agus de shaghas is leor chun go dtaspánfaidh ar leorscálaí méid na n-oibreacha ar maidir leo a lóisteálfar iad agus fós an mhaoin go léir, corpartha nó neamhchorpartha, a bheas beartaithe a thógaint chun críocha na n-oibreacha san agus fós gach cur isteach (sa mhéid gur féidir san do thaspáint ar tharraingeoireacht) a bheas beartaithe a dhéanamh chun na críche sin ar aon mhaoin (corpartha nó neamhchorpartha) nó ar aon bhóthar nó droichead poiblí.
(3) Beidh sna leabhair eolais a ceangaltar ar an mBord leis an alt so do lóisteáil maidir le scéim cheadaithe ainmneacha na ndaoine is únaeraí nó únaeraí toimhdean, léasaithe nó léasaithe toimhdean, agus sealbhairí ar an talamh go léir a mbeidh beartaithe é do thógaint nó baint leis ar shlí eile fán Acht so chun críche na n-oibreacha ar maidir leo a lóisteálfar iad agus ar an maoin go léir, corpartha nó neamhchorpartha, (ar a n-áirítear bóithre agus droichid phoiblí) a mbeidh beartaithe cur isteach uirthi in aon tslí fán Acht so chun na críche sin.
(4) Is i bpríomh-oifig an Bhuird i gCathair Bhaile Atha Cliath agus i pé áiteanna eile ordóidh an tAire san ordú ceadúcháin a bhainfeas le scéim cheadaithe a lóisteálfar na léarscála, na pleananna, agus na leabhair eolais a ceangaltar leis an alt so ar an mBord do lóisteáil maidir leis an scéim cheadaithe sin agus coimeádfar ar lóisteáil amhlaidh iad go gcríochnófar an scéim cheadaithe sin agus, faid a bheid ar lóisteáil amhlaidh, beid ar fáil chun a n-iniúchta ag duine ar bith, in aisce, idir a deich a chlog ar maidin agus a ceathair a chlog trathnóna gach lá ach amháin an Satharn, an Domhnach, agus laethanta saoire bainc.
(5) A luaithe is féidir tar éis aon léarscála, pleananna, nó leabhair eolais do lóisteáil de bhun an ailt seo, bhéarfaidh an Bord fógra poiblí i dtaobh na lóisteála san trí fhógrán d'fhoillsiú fá dhó i ngach ceann de dhá nuachtán laethúla nó níos mó léitear i gCathair Bhaile Atha Cliath agus i pé nuachtáin eile (más ann) ordóidh an tAire san ordú ceadúcháin iomchuibhe.
(6) Déarfar i ngach fógra poiblí do bhéarfaidh an Bord de bhun an fhó-ailt deiridh sin roimhe seo den alt so go bhfuil na léarscála, na pleananna, agus na leabhair eolais lena mbainfidh an fógra san ar fáil chun a n-iniúchta ag an bpoiblíocht do réir an ailt seo agus luafar ann na trátha agus na háiteanna ina mbeid ar fáil amhlaidh chun a n-iniúchta.
Leictreachas do ghiniúin agus d'iomdháil.
10.—(1) Nuair a bheas scéim cheadaithe curtha i ngníomh agus na hoibreacha udro-leictreacha dá bhforálfar leis an scéim sin críochnaithe (fá réir pé breisithe, neamhdhéanta, athruithe, agus claonta do gheobhfar bheith riachtanach i gcúrsa na hoibre), déanfaidh an Bord leictreachas do ghiniúin leis na hoibreacha san agus déanfaidh an leictreachas san do thiomarnú agus d'iomdháil go dtí pé áiteanna agus ar pé slí is dóigh leis an mBord is gá chun an leictreachas san do chur ar fáil chun na gcríoch a luaitear sa chéad fhó-alt ina dhiaidh seo den alt so.
(2) Beidh feidhm agus éifeacht ag na forála so leanas maidir le leictreachas (dá ngairmtear an leictreachas san sa bhfó-alt so) arna ghiniúin ag an mBord de bhun an fhó-ailt deiridh sin roimhe seo den alt so, sé sin le rá:—
(a) déanfaidh an Bord úsáid agus feidhm do bhaint as an leictreachas san chun gach críche nó chun pé ceann nó cinn (a mheasfas an Bord is ceart) de na críocha chun a bhféadfaidh an Bord úsáid nó feidhm do bhaint go dleathach as leictreachas (dá ngairmtear an leictreachas eile sin sa bhfó-alt so) arna ghiniúin ag an mBord ar aon tslí eile;
(b) féadfar úsáid agus feidhm do bhaint as an leictreachas san amhlaidh i gcuibhreann, nó i dteannta, nó d'éagmais an leictreachais eile sin go léir nó aon choda dhe;
(c) beidh ag an mBord agus beidh infheidhmithe acu maidir leis an leictreachas san gach cumhacht nó aon chumhacht dá mbeidh dílsithe sa Bhord de thuras na huaire maidir leis an leictreachas eile sin go léir nó aon chuid de do thiomarnú, d'iomdháil, do sholáthar, agus do dhíol;
(d) aon chuid nó coda d'aon chóras tiomarnaíochta nó d'aon chóras iomdhála is leis an mBord de thuras na huaire chun an leictreachas eile sin go léir nó aon chuid de do thiomarnú nó d'iomdháil (pé acu é), féadfar í nó iad d'úsáid chun an leictreachas san do thiomarnú nó d'iomdháil;
(e) aon chuid nó coda d'aon chóras tiomarnaíochta nó d'aon chóras iomdhála dhéanfaidh an Bord chun an leictreachas san do thiomarnú nó d'iomdháil (pé acu é), féadfar í nó iad d'úsáid chun an leictreachas eile sin do thiomarnú nó d'iomdháil.
(3) Chun leictreachas do thiomarnú agus d'iomdháil de bhun fó-ailt (1) den alt so beidh ag an mBord agus beidh infheidhmithe acu gach cumhacht nó aon chumhacht dá ndílsítear iontu leis na hAchta Leictreachais (Soláthar), 1927 go 1942, maidir le leictreachas arna ghiniúin ar shlí seachas de bhun an fhó-ailt sin (1) do thiomarnú agus d'iomdháil.
Iascaigh do chaomhaint.
11.—Nuair a bheas scéim cheadaithe á cur i ngníomh ní bheidh d'oblagáid ar an mBord ná ar aon chonnarthóir a bheas ar fostú ag an mBord na Achta Iascaigh, 1842 go 1944, do chomhlíonadh, ach déanfaidh an Bord nó, i gcás oibreacha bheas á ndéanamh ag connarthóir, cuirfid fá ndear go ndéanfaidh an connarthóir, pé forchúraim do ghlacadh agus pé socruithe do cheapadh a mheasfaidh an Aire Talmhaíochta is leor chun iascaigh do chaomhaint agus díobháil dóibh do sheachaint le linn nó de dhroim an scéim cheadaithe sin do chur i ngníomh, ach déanfaidh an tAire sin, i gcomhairle leis an mBord, deimhin de ná bainfidh dochar mór do na hoibreacha dá bhforálfar leis an scéim cheadaithe sin ná ná cuirfear bac mór orthu ná ná tabharfar méadú mór ar a gcostas de dhroim na forchúraim sin do ghlacadh agus na socruithe sin do cheapadh.
Cumhacht an Bhuird chun loingseoireacht do chosc
12.—(1) Féadfaidh an Bord le hordú, aon uair a mheasfaid is gá san chun scéim cheadaithe do chur i ngníomh go cuibhe nó chun oibreacha arna ndéanamh de bhun scéime ceadaithe d'oibriú, loingseoireacht ar an abhainn, nó ar aon chuid áirithe den abhainn, lena mbainfidh nó lenar bhain an scéim cheadaithe sin do thoirmeasc ar feadh pé tréimhse mheasfaid is gá chun an scéim cheadaithe sin do chur i ngníomh nó na hoibreacha san d'oibriú (pé acu é).
(2) Féadfaidh an Bord ordú do dhéanamh fán bhfó-alt san roimhe seo den alt so d'ainneoin aon achtacháin á dhearbhú gur abha intseolta phoiblí an abha lena mbainfidh an t-ordú san.
(3) Gach ordú dhéanfaidh an Bord fán alt so déarfaidh sé a bheith agus beidh sé ina ordú á thoirmeasc ar dhume ar bith gabháil le haon bhád, báirse, lictéir, nó árthach eile ar an abhainn nó an chuid áirithe den abhainn lena mbainfidh an t-ordú san ar feadh na tréimhse luafar chuige sin san ordú san.
(4) Gach duine shárós aon fhoráil d'ordú arna dhéanamh ag an mBord fán alt so beidh sé ciontach i gcionta fán alt so agus, ar a chiontú ann ar an slí achomair, dlifear fíneáil nach mó ná caoga punt do chur air.
Ceart ag an mBord chun eolais as leabhair rátaí.
13.—(1) Aon uair a theastós eolas as leabhar rátaí nó scríbhinn eile dá shamhail ón mBord chun nó i dtaobh scéim d'ullmhú lena cur fá bhráid an Aire fán Acht so nó chun nó i dtaobh scéim cheadaithe do chur i ngníomh nó chun nó i dtaobh aon chumhacht d'fheidhmiú nó aon dualgas do chomhlíonadh dá mbronntar nó dá gcuirtear ar an mBord leis an gCuid seo den Acht so, déanfaidh an t-údarás áitiúil nó an comhlucht áitiúil eile a mbeidh an leabhar nó an scríbhinn sin ina gcoimeád, ar an mBord dá iarraidh sin orthu,—

14.—(1) Faid a bheas na hoibreacha go léir a dhéanfaidh an Bord, ag cur scéime ceadaithe i ngníomh dóibh nó chun leictreachas arna ghiniúin leis na hoibreacha san do thiomarnú nó d'iomdháil, in aon-tseilbh agus fá aon-urlámhas an Bhuird, beid saor ó mheisiúnacht i gcóir ráta dhealúis agus fós ó mheisiúnacht i gcóir aon ráta eile ghearrfaidh údarás áitiúil.
(2) San alt so tá leis an abairt “údarás áitiúil” an bhrí do bheirtear di leis an Acht Leictreachais (Soláthar), 1927 (Uimh. 27 de 1927), arna leathnú le fó-alt (2) d'alt 10 den Acht Leictreachais (Soláthar) (Leasú) (Uimh. 2), 1934 (Uimh. 38 de 1934).
(3) Ní bheidh feidhm ná éifeacht ag éinní dá bhfuil san alt so maidir le haon iascach nó ceart iascaireachta thógfaidh an Bord fán Acht so nó dá bhuaidh.
CUID III.
Iascaigh do Thogaint agus do Bhainisti.
Iascaigh agus cearta iascaireachta do thógaint.
15.—Aon uair a déanfar iarratas go cuibhe chun an Bhuird ag lorg cúitimh de bhíthin an Bord do dhéanamh foirceannta, srianta nó cur isteach eile (buan nó sealadach) fán Acht so ar iascach nó ar cheart iascaireachta nó ag lorg cúitimh i ndíobháil d'iascach agus a chinnfeas an Bord, tar éis dul i gcomhairle leis an Aire Talmhaíochta, go mb'oiriúnú, ar chúiseanna eacnamaíochta nó eile, an t-iascach nó an ceart iascaireachta lena mbainfidh an t-iarratas san do thógaint, tógfaidh an Bord trí chomhaontú nó, cheal comhaontuithe, go héigeanta an t-iascach nó an ceart iascaireachta san agus pé talamh, ceada slí, agus cearta eile is dóigh leis an mBord do bheith ag gabháil leis an iascach nó an ceart iascaireachta san nó do bheith riachtanach chun a úsáite.
An Bord do chaomhaint, do bhainistí, etc., iascach.
16.—(1) Aon uair a thógfas an Bord iascach nó ceart iascaireachta fán gCuid seo den Acht so nó rinneadar, roimh dháta an Achta so do rith, iascach nó ceart iascaireachta do thógaint fá Acht Taisc-Iomar na Life, 1936 (Uimh. 54 de 1936), féadfaidh an Bord, más oiriúnach leo é, an t-iascach nó an ceart iascaireachta san do chaomhaint agus chuige sin is dleathach don Bhord an t-iascach nó an ceart iascaireachta san do bhainistí agus do stiúradh agus gach ní agus eadar-bheart do dhéanamh agus gach feidhm do chomhlíonadh is gá nó is ceart chun an chaomhaint, an bhainistí, agus an stiúradh san do dhéanamh nó bhainfeas nó gheobhas leis an gcéanna.
(2) Gan dochar do gheneráltacht na gcumhacht do bheirtear don Bhord leis an bhfó-alt san roimhe seo den alt seo, beidh ag an mBord agus beidh infheidhmithe acu, chun iascach nó ceart iascaireachta do chaomhaint, do bhainistí, agus do stiúradh de bhun an fhó-ailt sin, na cumhachta so leanas, sé sin le rá:—

(b) na cumhachta céanna chun dúnadh, claonadh, díochur, báthadh, nó cur isteach eile do dhéanamh ar bhóithre nó droichid phoiblí do bheirtear dóibh le Cuid II den Acht so chun scéim cheadaithe do chur i ngníomh ach san fá réir na bhforál atá san Acht so i dtaobh dúnadh, claonadh, díochur, báthadh, nó cur isteach eile do dhéanamh ag an mBord ar bhóithre agus droichid phoiblí, agus
(c) cumhacht, le toiliú an Aire, chun iomlán an iascaigh nó an chirt iascaireachta san nó aon chuid den chéanna do leithliú trí léas nó do ligean trí cheadúnas chun pé daoine, ar feadh pé tréimhse, ar pé cíos, agus ar pé téarmaí agus coinníollacha a mheasfaidh an Bord, le toiliú an Aire, do bheith ceart.
(3) Beidh feidhm agus éifeacht ag alt 17 d'Acht Iascaigh na Sionainne, 1935 (Uimh. 4 de 1935), maidir le hairgead a gheobhaidh nó chaithfidh an Bord i bhfeidhmiú a gcumhacht fán alt so fé mar atá feidhm agus éifeacht aige maidir le hairgead a gheobhaidh nó chaithfidh an Bord i gcomhlíonadh na ndualgas a luaitear san alt san 17.
Usáid ioncaim an Bhuird as iascaigh.
17.—(1) An t-ioncam a gheobhaidh an Bord as na dualgais do chomhlíonadh a cuirtear ar an mBord leis an Acht so maidir le hiascaigh agus cearta iascaireachta thógfaidh an Bord fán gCuid seo den Acht so nó fá Acht Taisc-Iomar na Life, 1936 (Uimh. 54 de 1936), déanfar, tar éis na costais uile do ghlanadh fána raghaidh an Bord ag comhlíonadh na ndualgas san agus is inmhuirir le ceart ar ioncam, é d'úsáid chun na gcríoch so leanas san ord so leanas, sé sin le rá:—
(a) chun an t-ús go léir d'íoc is iníoctha sa bhliain reatha leis an Aire Airgeadais nó bheas dlite dhó in aghaidh aon bhliana roimhe sin ar réamhíocanna arna ndéanamh fán Acht so ag an Aire sin leis an mBord i leith na hiascaigh agus na cearta iascaireachta san do thógaint;
(b) chun pé suimeanna, a mheasfaidh an Bord, le haontú an Aire, is ceart do chur i leataoibh i gcóir cúl-chiste, leathnuithe, agus críocha eile dá samhail a bhainfeas le comhlíonadh na ndualgas san;
(c) chun an t-airgead go léir d'íoc is iníoctha sa bhliain reatha leis an Aire Airgeadais nó bheas dlite dhó in aghaidh aon bhliana roimhe sin ar cuntas aisíoctha na réamhíocanna san;
(d) chun leithreasú do dhéanamh chun aon chríche eile mheasfaidh an Bord is ceart.

18.—(1) Gach duine chuirfeas ina luighe ar an mBord nó ar an eadránaí—
(a) go raibh sé ag gabháil de thrádáil nó ar shlí eile ar brabús d'iascaireacht in uiscí aon abhann nó go raibh sé ar fostú ar luach saothair ag duine ar bith chun na hiascaireachta san nó go raibh sé ag gabháil d'iascaireacht amhlaidh agus ar fostú amhlaidh, agus
(b) gur bhain cailliúint bhrabúis nó cailliúint tuillimh dó de dhroim an Bord do dhéanamh aon chur-isteach fán Acht so ar uiscí na habhann san nó ar aon iascach inti nó ar aon cheart iascaireachta uirthi,
beidh teideal aige (fá réir na bhforál ina dhiaidh seo den alt so) chun an Bord d'íoc cúitimh leis sa chailliúint sin bhrabúis nó tuillimh nó bhrabúis agus tuillimh, do réir mar bheas, do bhain dó.
(2) Is mar leanas a háireofar an cúiteamh is iníoctha le haon duine fán alt so, sé sin le rá, in aghaidh gach lán-tsaosúir oscailte iascaireachta a raibh an duine sin ar a fheadh ag gabháil d'iascaireacht nó ar fostú nó ag gabháil d'iascaireacht agus ar fostú mar a luaitear sa bhfó-alt deiridh sin roimhe seo den alt so, gheobhaidh an duine sin suim is ionann agus ceithre oiread an mheán-tuillimh nó na meán-pháighe nó an mheán-tuillimh agus na meán-pháighe do gheibheadh an duine sin sa tseachtain as bheith ag gabháil d'iascaireacht nó bheith ar fostú amhlaidh ar feadh an lán-tsaosúir oscailte iascaireachta díreach sara ndearna an Bord an cur isteach a luaitear sa bhfó-alt san, ach san fá réir na teorann ná beidh an cúiteamh san níos mó in aon chás ná dhá oiread chaogad an mheán-tuillimh nó na meán-pháighe nó an mheán-tuillimh agus na meán-pháighe sin sa tseachtain, pé acu é.
(3) Ní bheidh duine i dteideal cúitimh ar bith fán alt so má cuirtear ina luighe ar an eadránaí go mbeidh an duine sin, toisc an Bord dá gheallúint an duine sin do choimeád ar fostú nó ar aon chúis eile, gan aon chailliúint ná laghdú tuillimh nó fostaíochta do bhaint dó de dhroim an churtha isteach ag an mBord.
(4) Déanfar an ceart chun cúitimh agus méid an chúitimh (más ann) fán alt so do chinneadh fá réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919, fé is dá mba é bheadh sa chúiteamh san an praghas ar thalamh a tógfaí go héigeanta.
Comhaltaí ex-officio de bhuird choimeádaithe do cheapadh.
19.—(1) Ní bheidh feidhm ag alt 6 den Fisheries (Ireland) Act, 1848, arna leasú le halt 7 den Acht Iascaigh, 1925 (Uimh. 32 de 1925), maidir le haon iascach a thógfaidh an Bord fán gCuid seo den Acht so, agus in ionad an ailt sin 6 arna leasú amhlaidh achtaítear leis seo—
(a) má bhíonn agus faid a bheas an Bord ina únaer, ina léasaí, nó ina shealbhaire ar aon iascach den tsórt san do bhí, an 1ú lá d'Eanar, 1931, ina iascach ar leithligh nó ina iascach aon-chirt do réir bhrí an ailt sin 6, beidh feidhm agus éifeacht ag an bhforáil seo leanas, sé sin le rá, más rud é, ar an dáta ar a ngearrfaidh an bord coimeádaithe don cheanntar iascaigh ina mbeidh an t-iascach san an ráta iascaigh d'aon bhliain iascaigh, nach lú ná caoga punt luacháil an iascaigh sin fá na hAchta Luachála, beidh an Bord i dteideal duine amháin d'ainmniú chun bheith, go dtí go ngearrfar amhlaidh an chéad ráta iascaigh eile, ina chomhalta ex-officio, maidir leis an iascach san, de bhord choimeádaithe an cheanntair ina mbeidh an t-iascach san, agus
(b) má bhíonn agus faid a bheas an Bord ina únaer, ina léasaí, nó ina shealbhaire ar dhá iascach nó níos mó den tsórt san sa cheanntar iascaigh céanna a raibh gach ceann fá leith dhíobh, an 1ú lá d'Eanar, 1931, ina iascach ar leithligh nó ina iascach aonchirt do réir bhrí an ailt sin 6, beidh feidhm agus éifeacht ag na forála so leanas, sé sin le rá, más rud é, ar an dáta ar a ngearrfaidh an bord coimeádaithe don cheanntar iascaigh sin an ráta iascaigh d'aon bhliain iascaigh, nach lú ná caoga punt san iomlán luachála na n-iascach san fá na hAchta Luachála, beidh an Bord i dteideal duine amháin d'ainmniú chun bheith, go dtí go ngearrfar amhlaidh an chéad ráta isacaigh eile ina chomhalta ex-officio, maidir leis na hiascaigh sin, de bhord choimeádaithe an cheanntair ina mbeidh na hiascaigh sin.
(2) Má bhíonn an Bord i dteideal, fán bhfó-alt deiridh sin roimhe seo den alt so, dhá chomhalta ex-officio nó níos mó de bhord choimeádaithe d'ainmniú, beidh éifeacht ag na forála so leanas, sé sin le rá:—
(a) beidh an Bord i dteideal pé méid comhaltaí ex-officio (pé acu comhalta amháin nó níos mó ná san é) den bhord choimeádaithe sin d'ainmniú a mheasfas an Bord is ceart, ach gan é bheith níos mó ná an méid iomlán comhaltaí den tsórt san a bheas an Bord i dteideal d'ainmniú fán bhfó-alt san;
(b) gach comhalta ex-officio den bhord choimeádaithe sin ainmneoidh an Bord amhlaidh, ainmneofar é chun aon iascach nó grúpa iascach sonnraithe amháin nó níos mó d'ionadú a mbeidh an Bord i dteideal, fán bhfó-alt san, comhaltaí ex-officio den bhord choimeádaithe sin d'ainmniú ina leith, ach san i slí go ndéanfaidh na comhaltaí ex-officio sin a hainmneofar amhlaidh na hiascaigh nó na grúpaí iascach uile a mbeidh an Bord i dteideal mar adúradh comhaltaí ex-officio den bhord choimeádaithe sin d'ainmniú ina leith d'ionadú eatorthu;
(c) gach comhalta ex-officio den bhord choimeádaithe sin ainmneoidh an Bord amhlaidh, beidh aige agus beidh infheidhmithe aige ag cruinnithe den bhord choimeádaithe sin uimhir de vótanna is ionann agus an uimhir (pé acu ceann amháin nó níos mó é) d'iascaigh nó de ghrúpaí iascach a mbeidh sé ainmnithe fán mír dheiridh sin roimhe seo den fhó-alt so chun iad d'ionadú.
(3) Duine a hainmneofar fán alt so chun bheith ina chomhalta ex-officio de bhord choimeádaithe, beidh aige agus beidh infheidhmithe aige mar chomhalta den tsórt san, fá réir an fhó-ailt deiridh sin roimhe seo den alt so agus gan dochar dó, na cearta agus na príbhléidí uile do bheirtear le halt 6 den Fisheries (Ireland) Act, 1848, do dhuine is comhalta ex-officio de bhord choimeádaithe fán alt san.
Cumhachta oifigeach agus seirbhíseach áirithe don Bhord.
20.—Gach oifigeach nó seirbhíseach don Bhord a bheas údaraithe i scríbhinn ag an Aire Talmhaíochta chun na cumhachta do bheirtear le halt 24 den Acht Iascaigh, 1925 (Uimh. 32 de 1925), d'fheidhmiú, beidh aige agus beidh infheidhmithe aige gach cumhacht nó aon chumhacht dá dtugtar leis an alt san 24 d'oifigeach nó seirbhíseach do bhord choimeádaithe bheas údaraithe i scríbhinn ag an mbord san chun na cumhachta do bheirtear leis an alt san d'fheidhmiú agus chuige sin léireofar an t-alt san 24 agus beidh éifeacht aige fé is dá mbeadh oifigigh agus seirbhísigh don Bhord a bheas údaraithe mar adúradh luaite go follas ann.
Saor-bhearnaí i gcoraí do dhúnadh.
21.—(1) Féadfaidh an tAire Talmhaíochta tráth ar bith le hordú, má mheasann sé gur ceart é, a údarú don Bhord, chun eolas staidrimh d'fháil agus chun taighdeadh eolaíochta do dhéanamh nó chun ceachtar críoch acu san, an tsaor-bhearna, in aon chora shonnraithe is leis an mBord in aon abhainn ina mbeidh iascach nó ceart iascaireachta tógtha ag an mBord fán gCuid seo den Acht so, do dhúnadh pé trátha agus ar feadh pé tréimhsí agus fá réir pé coinníollacha agus i pé slí shonnróidh sé san ordú san.
(2) Aon uair a dhéanfas an tAire Talmhaíochta, le hordú fán alt so, a údarú don Bhord an tsaor-bhearna i gcora do dhúnadh beidh feidhm agus éifeacht ag na forála so leanas, sé sin le rá:—
(a) d'ainneoin éinní atá sna hAchta Iascaigh, 1842 go 1944, is dleathach don Bhord an tsaor-bhearna san do dhúnadh fá réim agus do réir an orduithe sin;
(b) ní bheidh feidhm ag alt 10 den Fisheries (Ireland) Act, 1845, maidir le haon chosc a chuirfidh an Bord sa tsaor-bhearna san fá réim agus do réir an orduithe sin.

22.—Féadfaidh an tAire Talmhaíochta, le hordú, athrú do dhéanamh, fé mar is dóigh leis is ceart, ar an saosúr coiscthe seachtainiúil a ceaptar le halt 20 den Salmon Fishery (Ireland) Act, 1863, maidir le haon abhainn a mbeidh an Bord tar éis iascach nó ceart iascaireachta do thógaint inti fán gCuid seo den Acht so, ach ní dhéanfaidh an tAire sin le haon ordú den tsórt san aon tsaosúr coiscthe seachtainiúil den tsórt san d'fhaidiú go dtí níos mó ná dhá uair sheachtód a chloig ná aon tsaosúr coiscthe seachtainiúil den tsórt san do ghiorrú go dtí níos lú ná ocht n-uaire ceathrachad a chloig.

23.—(1) Aon uair a thógfas an Bord iascach nó ceart iascaireachta fán gCuid seo den Acht so, féadfaidh an tAire Talmhaíochta le hordú, má mheasann sé gur ceart é, na nithe seo leanas do dhéanamh, sé sin le rá:—
(a) a ordú cad é an méid uasta ceadúnas iascaireachta le sruth-líonta in uiscí taoide (do réir bhrí na nAcht Iascaigh, 1842 go 1944) na habhann ina mbeidh an t-iascach nó an ceart iascaireachta san a féadfar a thabhairt amach in aon bhliain ina dtosnóidh an saosúr oscailte don iascaireacht san tar éis dáta an orduithe sin;
(b) a ordú cad é an méid uasta ceadúnas iascaireachta le líonta tarrainge nó le saighne sna huiscí taoide sin a féadfar a thabhairt amach in aon bhliain ina dtosnóidh an saosúr oscailte don iascaireacht san tar éis dáta an orduithe sin;
(c) rialacháin do dhéanamh maidir le ceadúnais den tsórt a luaitear i gceachtar de na míreanna san roimhe seo den fhó-alt so do thabhairt amach d'fhonn ceart tosaíochta d'áirithiú do dhaoine ag á raibh ceadúnais sruth-líonta nó ceadúnais líonta tarrainge nó saighne den tsórt san (pé acu é) an bhliain roimh dháta an orduithe sin chun ceadúnais sruth-líonta nó ceadúnais líonta tarrainge nó saighne den tsórt san (pé acu é) do cheannach roimh thosach aon tsaosúir oscailte iascaireachta fá na ceadúnais sin a mbeidh an méid ceadúnas den tsórt san ina aghaidh teoranta leis an ordú san.
(2) Aon uair a dhéanfas an tAire Talmhaíochta ordú fán alt so á ordú cad é an méid uasta ceadúnas d'aon tsórt áirithe a féadfar a thabhairt amach maidir le huiscí taoide aon abhann áirithe in aon tsaosúr oscailte áirithe, ní mó an méid ceadúnas den tsórt san do bhéarfar amach maidir leis na huiscí taoide sin in aon tsaosúr oscailte den tsórt san ná an méid uasta a hordófar amhlaidh.
(3) Ní léireofar éinní dá bhfuil san alt so mar ní dhéanann difir in aon tslí do chumhachta an Aire Thalmhaíochta chun orduithe nó fó-dhlithe do dhéanamh fá na hAchta Iascaigh, 1842 go 1944.
(4) Má ciontaítear duine i gcionta fá na hAchta Iascaigh, 1842 go 1944, nó fán Acht so, ní bheidh an duine sin i dteideal aon chirt tosaíochta chun ceadúnas d'fháil fán alt so.
An Bord do dhéanamh coraí iascaireachta.
24.—(1) Aon uair a dhéanfas an Bord gach iascach (más ann) agus gach ceart iascaireachta (más ann) in abhainn do thógaint fán gCuid seo den Acht so féadfaidh an Bord, le toiliú an Aire Thalmhaíochta agus d'ainneoin éinní atá sna hAchta Iascaigh, 1842 go 1944, cora iascaireachta do dhéanamh san abhainn sin chun críocha gach ceann nó aon cheann de na hiascaigh (más ann) agus de na cearta iascaireachta (más ann) a tógfar amhlaidh agus féadfaid an chora iascaireachta déanfar amhlaidh do chothabháil as san amach.
(2) Aon uair a thógfas an Bord cora iascaireachta fá réim agus de bhuaidh an Achta so féadfaidh an Bord, le toiliú an Aire Thalmhaíochta agus d'ainneoin éinní atá sna hAchta Iascaigh, 1842 go 1944, ceachtar ní acu so leanas do dhéanamh, sé sin le rá:—
(a) an chora iascaireachta san do chothabháil agus, chun críocha na cothabhála san, an chora iascaireachta san d'athdhéanamh nó do dheisiú, nó
(b) cora iascaireachta nua do dhéanamh ar láithreán na corann iascaireachta san nó ar láithreán eile in ionad na corann iascaireachta tógfar amhlaidh agus an chora iascaireachta nua san do chothabháil as san amach.
Toirmeasc ar sciob-líonta.
25.—(1) Féadfaidh an tAire Talmhaíochta, más oiriúnach leis é ar an mBord dá iarraidh sin, toirmeasc do chur, le hordú, ar cheadúnais do thabhairt amach fá na hAchta Iascaigh, 1842 go 1944, chun iascaireachta le sciob-líon in uiscí taoide (do réir bhrí na nAcht san) aon abhann a mbeidh an Bord tar éis iascach nó ceart iascaireachta do thógaint inti fán gCuid seo den Acht so.
(2) Aon uair a bheas ordú déanta ag an Aire Talmhaíochta fán bhfó-alt san roimhe seo den alt so ní déanfar aon cheadúnas do thabhairt amach fá na hAchta Iascaigh, 1842 go 1944, contrártha don ordú san.
CUID IV.
Cuiteamh.
Praghas nó cúiteamh do mheisiúnú.
26.—(1) Déanfar méid an phraghais nó an chúitimh a bheas le n-íoc ag an mBord, as aon talamh a thóghfaidh an Bord (go buan nó go sealadach) fán Acht so, leis na daoine uile agus fá seach a mbeidh teideal acu chuige nó eastáit nó leasa acu ann nó as aon éasáid, cead slí, iascach, ceart iascaireachta, ceart uisce, nó ceart eile nó i leith aon cheann acu san a thógfaidh an Bord (go buan nó go sealadach) fán Acht so lena únaer nó leis na daoine uile agus fá seach a mbeidh teideal acu chun an tailimh nó eastáit nó leasa acu sa talamh ar air nó maidir leis a tógfar an ceart san amhlaidh, do cheapadh, cheal comhaontuithe, fá réim agus de réir an Acquisition of Land (Assessment of Compensation) Act, 1919.
(2) Déanfar méid an chúitimh a bheas le n-íoc ag mBord as foirceannadh nó srianadh nó cur isteach eile (buan nó sealadach) a dhéanfaidh an Bord fán Acht so ar aon éasáid, cead slí, iascach, ceart iscaireachta, ceart uisce, nó ceart eile ar aon talamh nó uisce nó ina leith nó as claonadh, dúnadh, báthadh, díochur, nó cur isteach eile (buan nó sealadach) a dhéanfaidh an Bord fán Acht so ar aon bhóthar, bealach, nó droichead príobháideach nó ar aon chanáil nó uisce-bhealach saordha eile nó ar aon uisce-chúrsa saordha nó as cur isteach (buan nó sealadach) a dhéanfaidh an Bord fán Acht so ar aon talamh, do cheapadh, cheal comhaontuithe, fá réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919, fé is dá mba é bheadh sa chúiteamh san an praghas ar thalamh a tógfaí go héigeanta.
(3) Nuair a bheas aon phraghas nó cúiteamh á mheisiúnú de bhun an ailt seo i leith aon mhaoine, corpartha nó neamhchorpartha, a bheas á sealbhú nó á húsáid nó á teachtadh i dteannta aon mhaoine eile nó is cuid d'aon mhaoin eile, bhéarfar áird ar aon tsochar i bhfoirm siltin nó i bhfoirm feabhsú ar sholáthar uisce a mbeadh sé réasúnach súil a bheith lena theacht don mhaon eile sin de bhíthin aon oibreacha bheas déanta nó á ndéanamh nó ar tí a ndéanta ag an mBord fán Acht so.
(4) Beidh feidhm ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845 (arna oiriúnú nó arna leasú le haon Acht ina dhiaidh sin nó fé) maidir le haon phraghas nó cúiteamh is iníochta ag an mBord fán alt so agus maidir le maoin, corpartha nó neamhchorpartha, a thógfaidh an Bord fán Acht so do leithliú chun an Bhuird, agus chun críche na feidhme sin is tuigthe gurb iad an Bord bunathóirí an ghnóthais.
(5) Ní luighfidh aon aicsean dlí ná cothromais i gcoinne an Bhuird ná aon chonnarthóra ná aon oifigigh ná seirbhísigh don Bhord nó d'aon chonnarthóir i dtaobh ná i leith aon ghnímh, ní, nó ruda a mbeidh cúiteamh iníoctha ina leith de bhuaidh an ailt seo.
An tréimhse chun praghas nó cúiteamh d'éileamh.
27.—(1) Gach éileamh ar an bpraghas le haghaidh nó an cúiteamh i leith aon tailimh, éasáide, cirt, nó maoine eile (corpartha nó neamhchorpartha) a thógfaidh an Bord nó a gcuirfidh an Bord isteach air fán Acht so, déanfar é laistigh de bhliain tar éis don Bhord dul isteach, feidhmiú, nó cur isteach do dhéanamh fán Acht so den chéad uair ar an talamh, ar an éasáid, ar an gceart, nó ar an maoin sin.
(2) Ní bheidh feidhm ná éifeacht ag an bhfó-alt san roimhe seo den alt so maidir le héilithe ar chúiteamh as cur isteach do dhéanamh ar iascach nó ar cheart iascaireachta agus, ina ionad san, is fán gceád alt ina dhiaidh seo déanfar gach éileamh den tsórt san agus beidh feidhm agus éifeacht ag forála an ailt sin maidir leis na héilithe sin.
Cúiteamh i ndíobháil d'iascach.
28.—(1) Fá réir na cumhachta agus gan dochar don chumhacht do bheirtear don Bhord le Cuid III den Acht so chun iascaigh agus cearta iascaireachta do thógaint, dlífidh an Bord cúiteamh (dá ngairmtear cúiteamh i ndíobháil d'iascach san Acht so) d'íoc le gach duine dá mbainfidh cailliúint nó damáiste de dheascaibh díobhála d'iascach nó do cheart iascaireachta bheas ar únaeracht aige i gcás an díobháil sin do theacht le linn oibreacha udro-leictreacha dhéanfaidh an Bord de bhun scéime ceadaithe do bheith á ndéanamh nó trí oibriú generálta na n-oibreacha san nó trí aon mhodh nó cúrsa áirithe oibrithe nó aon mhainneachtain áirithe maidir le hoibriú na n-oibreacha san.
(2) Gach iarratas ar chúiteamh fán alt so, déanfar é i scríbhinn chun an Bhuird laistigh de dheich mbliana tar éis an dáta adeirtear do thárla nó do thosnaigh an díobháil ar ina leith a bheas an cúiteamh san á éileamh.
(3) Ní bheidh aon chúiteamh iníoctha fán alt so—
(a) maidir le díobháil d'iascach nó do cheart iascaireachta thógfaidh an Bord fán Acht so, ná
(b) maidir le díobháil ná beidh aon iarratas ar an gcúiteamh san déanta go cuibhe ina taobh laistigh den am a ceaptar chuige sin leis an bhfó-alt deiridh sin roimhe seo den alt so.
(4) Déanfar an ceart chun cúitimh agus méid an chúitimh (más ann) fán alt so do chinneadh fá réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919, fé is dá mba é bheadh sa chúiteamh san an praghas ar thalamh a tógfaí go héigeanta.
(5) Ní luighfidh aon aicsean dlí ná cothromais i gcoinne an Bhuird ná aon chonnarthóra ná aon oifigigh ná seirbhísigh don Bhord nó d'aon chonnarthóir i dtaobh ná i leith aon díobhála a mbeidh cúiteamh iníoctha fán alt so nó a ndearbhaítear go follas leis an alt so gan cúiteamh do bheith iníoctha fán alt so ina leith.
Oibreacha do dhéanamh in ionad cúiteamh d'íoc.
29.—(1) Má bhíonn teideal, iarbhfír nó ionchasach, ag duine chun cúitimh i leith éinní bheas déanta nó bheas beartaithe a dhéanamh go dleathach ag an mBord fán Acht so, féadfaidh an Bord pé oibreacha do dhéanamh chun tairbhe don duine sin a mheasfaidh an Bord is ceart agus a aontóidh an duine sin do ghlacadh mar shásamh nó mar shásamh leathrannach ina éileamh ar an gcúiteamh san.
(2) Féadfaidh an Bord pé téarmaí agus coinníollacha (lena n-áiritear téarmaí i dtaobh únaerachta, seilbhe, agus stiúrtha na n-oibreacha san) ar a gcomhaontóidh an Bord agus an duine ar chun tairbhe dhó a déanfar na hoibreacha amhlaidh do chur le déanamh aon oibreacha fán alt so.
CUID V.
Cumhachta agus Dualgais Áirithe de chuid an Bhuird.
An Bord do dhéanamh, etc., oibreacha iompair.
30.—(1) (a) Féadfaidh an tAire, ar an mBord dá irraidh sin, ordú (dá ngairmtear ordú oibreacha iompair san alt so) do dhéanamh fán bhfó-alt so á údarú don Bhord na hoibreacha iompair a luafar ann do dhéanamh, do chothabháil agus d'oibriú chun an Bord do chomhlíonadh aon choda dá fheadhmanna fá na hAchta Leictreachais (Soláthar), 1927 go 1942, nó fán Acht so, agus san i pé slí agus fá réir pé srianta agus forál agus ar pé téarmaí mheasfaidh an tAire is ceart agus a luafaidh san ordú;
(b) beidh ag gabháil le gach iarratas ar ordú oibreacha iompair dréacht den ordú bheartaithe, plean de na hoibreacha iompair beartaithe agus leabhar eolais don phlean san, agus beidh an dréacht, an plean agus an leabhar eolais sin i pé foirm ordóidh an tAire;
(c) má déantar iarratas ar ordú oibreacha iompair déanfaidh an Bord, má cheanglann an tAire orthu é,—
(i) cóip den phlean agus den leabhar eolais do bhí ag gabháil leis an iarratas do lóisteáil, agus do chur ar fáil chun a n-iniúchta, do réir ordachán an Aire,
(ii) pé fógraí shonnróidh an tAire chuige sin d'fhoillsiú do réir ordachán an Aire.
(2) Chun na cumhachta do bhéarfar don Bhord le hordú oibreacha iompair d'fheidhmiú, is dleathach don Bhord gach ní nó éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) aon talamh nó aon éasáid, cead slí, nó ceart eile ar aon talamh nó maidir le haon talamh, do thógaint (go buan nó go sealadach agus trí chomhaontú nó go héigeanta);
(b) foirceannadh, srianadh nó cur isteach eile do dhéanamh (go buan nó go sealadach agus trí chomhaontú nó go héigeanta) ar aon éasáid, cead slí, nó ceart eile ar aon talamh nó maidir le haon talamh;
(c) claonadh, dúnadh, díochur, nó cur isteach eile do dhéanamh (go buan nó go sealadach agus trí chomhaontú nó go héigeanta) ar aon bhóthar, slí, nó droichead príobháideach;
(d) fá réir forál an Achta so, dúnadh, claonadh, díochur, nó cur isteach eile do dhéanamh ar aon bhóthar nó droichead poiblí.
(3) Beidh éifeacht ag na forála so leanas maidir le gach ordú oibreacha iompair—
(a) bheidh san ordú pé forála mheasfaidh an tAire is gá nó is oiriúnach chun críocha an orduithe;
(b) gan dochar do gheneráltacht míre (a) den fhó-alt so—
(i) sonnróidh an t-ordú an modh ar a mbeidh na hoibreacha iompair lena mbainfidh an t-ordú le déanamh,
(ii) féadfaidh forála bheith san ordú i dtaobh an mhodha ar a mbeidh na hoibreacha iompair sin le hoibriú agus le cothabháil,
(iii) beidh san ordú forála ag téorannú úsáide na n-oibreacha iompair sin chun críocha bhainfeas le comhlíonadh a fheadhmanna fá na hAchta Leictreachais (Soláthar), 1927 go 1942, nó fán Acht so, ag an mBord, agus chun pé críocha eile (más ann) a sonnrófar san ordú,
(iv) bheidh san ordú na forála uile mheasfaidh an Aire is ceart chun an phoibhlíocht i gcoitinne agus aon daoine lena mbainfidh an t-ordú do chosaint,
(v) féadfaidh aon fhorála (lena n-áirítear forála pionósacha) dá mbeidh in aon achtachán a bhaineas le hiarnróid bheith san ordú, fá réir pé athruithe agus modhnuithe mheasfaidh an tAire is ceart,
(vi) féadfaidh foráil do bheith san ordú i dtaobh aon cheisteanna sonnraithe éireos fé do chinneadh trí eadrán,
(vii) maidir le feidhmiú na gcumhacht do bheirtear don Bhord le fó-alt (2) den alt so, féadfaidh forála sa chéill chéanna leis na forála atá in alt 8 den Acht so bheith san ordú,
(viii) féadfaidh pé forála ghabhas nó bhaineas le héinní de na nithe adúradh, agus a mheasfaidh an tAire is gá agus is ceart, bheith san ordú.
(4) Féadfaidh an tAire, le hordú fán bhfó-alt so, ordú oibreacha iompair do leasú.
(5) Beidh éifeacht reachtúil ag gach ordú déanfar fán alt so.
(6) Má dhéanann an tAire ordú oibreacha iompair, féadfaidh rialacháin (ná beidh ar neamh-réir leis an ordú) do dhéanamh maidir leis an modh ar a mbeidh na hoibreacha iompair lena mbainfidh an t-ordú le cothabháil agus le hoibriú, agus comhlíonfaidh an Bord aon rialachán den tsórt san.
(7) San alt so ciallaíonn an abairt “oibreacha iompair” aon oibreacha is—
(a) iarnród, nó
(b) trambhealach.
An Bord do dhéanamh fearais leictriúil, etc.
31.—(1) Aon uair is dóigh leis an Aire ná fuil agus nach dócha go mbeidh riar leordhóthanach éifeachtúil ar na riachtanais a bheas le linn na huaire sin nó is dócha bheas ina dhiaidh sin sa Stát le haon tsaghais áirithe fearais nó inneallra nó gléasra chun leictreachas do ghiniúin, do thiomarnú, d'iomdháil, nó d'úsáid, á déanamh ag gnóluchta bheas bunaithe go dleathach an uair sin sa Stát, féadfaidh an tAire má mheasann sé gur ceart é, a údarú, fá réir forál an ailt seo, don Bhord an saghas áirithe sin fearais nó inneallra nó gléasra den tsórt san do dhéanamh nó socrú do cheapadh chun é dhéanamh do réir an ailt seo.
(2) Beidh feidhm agus éifeacht ag na forála so leanas maidir leis an Aire do thabhairt aon údaráis den tsórt a luaitear sa bhfó-alt san roimhe seo den alt so don Bhord, sé sin le rá:—
(a) sara dtuga an tAire aon údarás den tsórt san cuirfidh sé fá ndear fógra i dtaobh é bheith ar intinn an t-údarás san do thabhairt d'fhoillsiú san Iris Oifigiúil agus i pé slí eile chífear don Aire a bhéarfas le fios do dhaoine lena mbainfidh an scéal go bhfuil sé ar an intinn sin;
(b) déarfar i ngach fógra den tsórt san cad é an saghas fearais, inneallra, nó gléasra a mbeidh an t-údaras san le baint leis agus go bhféadfaidh duine ar bith, laistigh d'am áirithe (nach giorra ná tríocha lá tar éis dáta an fhógra san d'fhoillsiú san Iris Oifigiúil), agóid (agus na forais atá léi) do chur chun an Aire, i slí sonnrófar, i gcoinne an t-údarás san do thabhairt;
(c) breithneoidh an tAire gach agóid den tsórt san a cuirfear chuige amhlaidh laistigh den am áirithe sin;
(d) ar an am áirithe sin do bheith caite, féadfaidh an tAire, má mheasann sé gur ceart é ag féachaint do na hagóidí sin (más ann), an t-údarás san do thabhairt do réir na hintinne sin aige nó i pé foirm mhodhnaithe mheasfaidh is ceart ag féachaint do na hagóidí sin (más ann);
(e) féadfaidh an tAire pé coinníollacha agus srianta (más ann) a mheasfaidh is ceart do chur ag gabháil le haon údarás den tsórt san.
(3) Nuair a bheas an tAire tar éis údarás fán alt so do thabhairt don Bhord, féadfaidh an Bord, do réir téarmaí an údaráis sin, an fearas, an t-inneallra, nó an gléasra a luafar san údarás san do dhéanamh agus do dhíol iad féin nó féadfaid socrú do cheapadh chun a dhéanta agus a dhíolta ag daoine eile.
(4) Má dhéanann an Bord socrú fán alt so chun daoine eile do dhéanamh agus do dhíol fearais, inneallra, nó gléasra, féadfaidh an Bord, tar éis dul i gcomhairle leis an Aire Airgeadais, gach ní nó éinní acu so leanas do dhéanamh, le toiliú an Aire agus fá réir pé coinníollacha (más ann) fhorchuirfidh sé, sé sin le rá:—
(a) cuideachta theoranta (a chomhlíonfas na forála ina dhiaidh seo den alt so) do bhunú, uathu féin nó i dteannta daoine eile, le haghaidh na déantóireachta agus an díolta san, nó
(b) aon ghnóthas bheas ag gabháil don déantóireacht agus don díol san do thógaint, go hiomlán nó i bpáirt, nó
(c) cabhair i bhfoirm súncála, iasachta, réamhíoca, nó ráthaíochta do thabhairt do dhuine ar bith bheas ag gabháil don déantóireacht agus don díol san.
(5) Beidh feidhm agus éifeacht ag na forála so leanas maidir le gach cuideachta theoranta bhunóidh an Bord (uathu féin nó i dteannta daoine eile) fán alt so, sé sin le rá:—
(a) ní foláir aontú an Aire, arna thabhairt tar éis dó dul i gcomhairle leis an Aire Airgeadais, d'fháil le meamram agus airteagail chomhlachais na cuideachtan san;
(b) forálfaidh na hairteagail chomhlachais sin go mbeidh an Bord i dteideal stiúrthóir amháin ar a laghad ar an gcuideachtain sin do cheapadh as comhaltaí agus oifigigh an Bhuird;
(c) déanfar cuntais na cuideachtan san do chur fá bhráid an Aire gach bliain agus iad d'iniúchadh (ar chostas na cuideachtan san) ag iniúchóir lena n-aontóidh an tAire;
(d) bhéarfaidh an chuideachta sin don Aire pé eolas i dtaobh a gnótha iarrfaidh an tAire ó am go ham.
(6) Beidh an Bord i dteideal, chun críoch a bhfeadhmanna fán alt so, paitinní agus marcanna trádála d'fháil agus do shealbhú agus airgead do chaitheamh ar réamhthaighdeadh.
(7) Má dhéanann agus má dhíolann an Bord féin fearas, inneallra, nó gléasra fán alt so, coimeádfaidh an Bhord cuntais ar leith i dtaobh na déantóireachta agus an díola san agus cuirfidh na cuntais sin (arna n-iniúchadh) fá bhráid an Aire maraon le pé eolas eile i dtaobh na déantóireachta agus an díola san iarrfaidh an tAire.
Leictreachas do cheannach agus do dhíol lasmuigh den Stát.
32.—(1) Na cumhachta reachtúla atá ag an mBord chun leictreachas do cheannach ina uirmhéid agus é d'athdhíol le húsáidirí aonair bainfid leis an mBord do cheannach leictreachais ina uirmhéid ó dhaoine lasmuigh den Stát agus le hathdhíol an leictreachais sin le húsáidirí sa Stát, agus údaróid an céanna.
(2) Na cumhachta reachtúla atá ag an mBord chun leictreachas do dhíol ina uirmhéid bainfid le leictreachas do dhíol ina uirmhéid le príomh-údaráis nó le húdaráis áitiúla nó le daoine eile lasmuigh den Stát, agus údaróid an céanna, agus na cumhachta reachtúla atá ag an mBord chun leictreachas do dhíol le húsáidirí aonair bainfid le leictreachas do dhíol trína iomdháil ar úsáidirí aonair lasmuigh den Stát, agus údaróid an céanna.
(3) Chun gach cumhacht nó aon chumhacht d'fheidhmiú de na cumhachta leathnaithe dílsítear sa Bhord de bhuaidh na bhforál san roimhe seo den alt so, is dleathach don Bhord gach ní nó éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) socruithe do dhéanamh le príomh-údaráis nó le húdaráis áitiúla agus le daoine eile lasmuigh den Stát;
(b) córais tiomarnaíochta agus oibreacha eile do dhéanamh, nó socrú do cheapadh chun a ndéanta, i bpáirt nó go hiomlán lasmuigh den Stát;
(c) gach ní do dhéanamh a bhainfeas nó gheobhas le feidhmiú na gcumhacht leathnaithe sin;
(d) na costais agus an caiteachas, fána raghfar ag feidhmiú na gcumhacht leathnaithe sin nó ag déanamh éinní dá n-údaraítear leis an bhfó-alt so, d'íoc i bpáirt nó go hiomlán.
Dualgais an Bhuird maidir le bóithre agus droichid phoiblí.
33.—(1) I gcás ina gcumhachtaítear don Bhord leis an Acht so dúnadh, claonadh, báthadh, díochur, nó cur isteach eile do dhéanamh ar bhóthar nó droichead poiblí chun aon oibreacha do dhéanamh (pé acu de bhun scéime ceadaithe nó ar shlí eile fán Acht so é), beidh éifeacht ag na forála so leanas, sé sin le rá:—
(a) más gá, chun na hoibreacha san do dhéanamh, an bóthar nó an droichead san do dhúnadh i gcoinne tráchta, ansan, do réir mar a mheasfaid is ceart, déanfaidh an Bord (mura saortar iad uaidh sin fán gcéad fhó-alt ina dhiaidh seo den alt so) agus (faid a bheas an bóthar nó an droichead san dúnta amhlaidh i gcoinne tráchta) cothabhálfaid bóthar nó droichead sealadach is leor chun an méid agus an saghas tráchta d'iompar a bhíos ar an mbóthar nó ar an droichead dúnta san de ghnáth, nó d'eile, sonnróid, le toiliú an Aire Rialtais Áitiúil agus Sláinte Poiblí, cúrsa eile chun a úsáite faid a bheas an bóthar nó an droichead san dúnta amhlaidh i gcoinne tráchta;
(b) déanfaidh an Bord (mura saortar iad uaidh sin fán gcéad fhó-alt ina dhiaidh seo den alt so), ar dhéanamh na n-oibreacha san do chríochnú nó roimhe sin, pé ní de na nithe seo leanas a mheasfaid is ceart, sé sin le rá:—
(i) déanfaid an bóthar nó an droichead dúnta san d'athchóiriú, nó
(ii) tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil agus Sláinte Poiblí, déanfaid buan-bhóthar nó buan-droichead nua is leor chun an cothrom céanna tráchta (maidir le méid agus saghas) d'iompar d'fhéad an bóthar nó an droichead dúnta san d'iompar sarar dúnadh é, agus gan é mórán níos neamh-chaothúla maidir le fána agus cuar ná an bóthar nó an droichead dúnta san, nó
(iii) le toiliú an Aire Rialtais Áitiúil agus Sláinte Poiblí, déanfaid bóthar ionaid nó droichead ionaid láithreach d'fheabhsú (trína athdhéanamh, a neartú, a leathnú, nó eile) i slí gur leor é chun an trácht is dócha bheas air d'iompar agus ná beidh sé morán níos neamh-chaothúla ná an bóthar nó an droichead dúnta san;
(c) má dhéanann an Bord buan-bhóthar agus gur dóigh leis an Aire Rialtais Áitiúil agus Sláinte Poiblí gur feabhas mór ar bhóthar do bhí ann cheana an bóthar san, beidh muirear pé coda de chostas déanta an bhóthair sin ordóidh an tAire sin agus a híoc leis an mBord ar pé údarás áitiúil nó údaráis áitiúla ordóidh an tAire sin agus san (i gcás dhá údarás nó níos mó den tsórt san) i pé cionúireachta ordóidh an tAire sin;
(d) más gá, chun an Bord do dhéanamh bóthair nua, cladhphort nó obair dá shamhail nó droichead do dhéanamh agus gur dóigh leis an Aire Rialtais Áitiúil agus Sláinte Poiblí go mba cheart cuid de chostas chothabhála na hoibre nó an droichid sin (seachas foraghaidh an bhóthair) do bheith ina muirear ar an mBord, beidh muirear agus íoc pé coda den chostas chothabhála san a ordóidh an tAire sin ar an mBord;
(e) má dhéanann an Bord buan-droichead nua agus gur mó de chuid mhaith na buntáistí bheireann an droichead san do phoiblíocht aon chontae nó bailecheanntair ná mar do thug an sean-droichead, pé acu trí shlí chonbharsáide níos fearr do thabhairt dóibh nó trí éinní eile é, deimhneoidh an Bord costas an droichid nua san agus deimhneoidh an tAire Rialtais Áitiúil agus Sláinte Poiblí cad é an chuid den chostas san is dóigh leis ba chóir do réir réasúin do bheith ina muirear ar chomhairle na contae nó an bhailecheanntair sin, agus air sin déanfaidh an chomhairle sin suim is ionann agus an chuid a bheas deimhnithe amhlaidh den chostas san do chruinniú mar chuid de na costais a bhainfeas le bóithre do chothabháil agus íocfaidh an chomhairle sin leis an mBord í;
(f) má éiríonn aon amhras, díospóid, nó ceist i dtaobh cé acu chomhlíon nó nár chomhlíon an Bord na forála iomchuibhe den alt so maidir le haon bhóthar nó droichead sealadach do dhéanamh nó do chothabháil nó aon bhuan-bhóthar nó buan-droichead do dhéanamh nó bóthar nó droichead láithreach d'athchóiriú nó bóthar ionaid nó droichead ionaid láithreach d'fheabhsú (pé acu san é) de bhun an ailt so, nó i dtaobh cé acu bheireann nó ná tugann buan-droichead nua do rinne an Bord do phoiblíocht aon chontae nó bailecheanntair buntáistí is mó de chuid mhaith ná mar do thug an sean-droichead, is é an tAire Rialtais Áitiúil agus Sláinte Poiblí do bhéarfas breith ar an amhras, ar an díospóid, nó ar an gceist sin agus ní bheidh dul thar a bhreith sin.
(2) I gcás ina gcumhachtaítear don Bhord leis an Acht so bóthar nó droichead poiblí do dhúnadh, do bháthadh, nó do dhíochur go buan chun aon oibreacha do dhéanamh (pé acu de bhun scéime ceadaithe nó ar shlí eile fán Acht so é) agus gur deimhin leis an Aire, tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil agus Sláinte Poiblí, ná fuil gá, ag féachaint do chúrsaí uile an cháis, le bóthar nó droichead nua (pé acu é) in ionad an bhóthair nó an droichid do dúnadh, do báthadh, nó do díochuireadh amhlaidh, féadfaidh an tAire, le hordú, a dhearbhú ná beidh feidhm ná éifeacht ag an bhfó-alt san roimhe seo den alt so maidir leis an mbóthar nó an droichead san (pé acu é) agus ar an ordú san do dhéanamh ní bheidh feidhm ná éifeacht ag an bhfó-alt san roimhe seo maidir leis an mbóthar nó an droichead san (pé acu é) agus beidh an Bord saor ó gach oblagáid maidir leis an mbóthar nó an droichead san (pé acu é) a cuirfí orthu, mura mbeadh an t-ordú san, leis an bhfó-alt san roimhe seo.
(3) Féadfaidh an Bord comhaontú leis an údarás áitiúil iomchuibhe chun an t-údarás áitiúil sin do dhéanamh éinní a ceangaltar ar an mBord nó a húdaraítear dóibh le fó-alt (1) den alt so do dhéanamh agus féadfaid freisin comhaontú chun airgead d'íoc leis an údarás áitiúil sin chun nó mar chabhair chun costais dhéanta an ní sin ag an údarás áitiúil sin.
(4) Nuair a bheas athchóiriú bóthair nó droichid dhúnta nó déanamh buan-bhóthair nó buan-droichid nua nó feabhsú bóthair ionaid nó droichid ionaid láithrigh críochnaithe de bhun an ailt seo ag an mBord, bhéarfaidh an Bord i seilbh an údaráis áitiúil iomchuibhe, agus glacfaidh an t-údarás áitiúil sin, an bóthar nó an droichead do hathchóiríodh, do rinneadh, nó do feabhsaíodh amhlaidh (pé acu é), agus air sin beidh an Bord saor go buan (lasmuigh de chás dá bhforáltar a mhalairt go follas leis an alt so) ó gach dliteanas nó freagarthacht maidir leis an mbóthar nó an droichead san (pé acu é) do chothabháil.

34.—O dháta agus tar éis dáta na n-oibreacha dá bhforálfar le scéim cheadaithe do chríochnú, is dleathach don Bhord rialú agus, ó am go ham, athrú nó eile do dhéanamh, i pé slí mheasfaidh an Bord do bheith riachtanach chun na hoibreacha san d'oibriú nó do bheith ag gabháil lena n-oibriú, ar leibhéal aon locha, linne, nó uisce eile ar an abhainn nó i gceangal (go díreach nó go neamhdhíreach) leis an abhainn ar a mbeidh na hoibreacha san.

35.—Aon uair a thógfas an Bord go buan fán Acht so aon talamh a bheas, as féin nó i dteannta tailimh eile, fá bhlianacht talamhcheannaigh, íocaíocht in ionad cíosa, nó suim bhliantúil eile (nach é amháin atá inti cíos fá chonnradh tionóntachta) is iníoctha le Coimisiún Talún na hÉireann nó le Coimisinéirí na nOibreacha Poiblí in Éirinn, ansan, amhail ón dáta ar a raghaidh an Bord isteach agus a ghlacfaid seilbh ar an talamh a bheas tógtha amhlaidh—
(a) tiocfaidh chun bheith agus beidh de dhliteanas ar an mBord an tsuim bhliantúil sin, nó pé cuid di chionroinnfidh Coimisiún Talún na hÉireann nó na Coimisinéirí sin (pé acu é) ar an talamh san, d'íoc le Coimisiún Talún na hÉireann nó leis na Coimisinéirí sin (pé acu é) fé is dá n-aistríodh únaer an tailimh sin an talamh san chun an Bhuird ar an dáta san, agus
(b) beidh an Bord i dteideal, más oiriúnach leis an mBord é, an tsuim bhliantúil sin nó an chuid di adúradh d'fhuascailt, agus
(c) beidh d'oblagáid ar an mBord, má cheanglann Coimisiún Talún na hÉireann nó na Coimisinéirí sin (pé acu é) orthu é, an tsuim bhliantúil sin nó an chuid sin di adúradh d'fhuascailt.

36.—Aon uair is dóigh leis an mBord go mbeadh sé neamheacnamúil nó go mbeadh sé neamh-oiriúnach ar aon chúis eile cúiteamh d'íoc as tuiliú nó cur isteach eile do dhéanamh ar aon talamh fán Acht so, féadfaidh an Bord an talamh san do thógaint go buan fán Acht so trí chomhaontú nó go héigeanta.
Cumhacht an Bhuird chun connarthóirí d'fhostú.
37.—(1) Aon uair a húdaraítear don Bhord leis an Acht so aon obair innealtóireachta nó tógála nó aon obair eile ar bith do dhéanamh, féadfaidh an Bord, in ionad an obair sin do dhéanamh iad féin trína n-oifigigh agus a seirbhísigh féin, connradh do dhéanamh le duine ar bith (dá ngairmtear connarthóir san Acht so) chun an duine sin do dhéanamh iomlán na hoibre sin nó aon chuid di agus féadfaidh chun na críche sin pé connartha agus comhaontuithe is gá do dhéanamh.
(2) Aon uair a dhéanfas an Bord connradh fán alt so le duine ar bith chun an duine sin do dhéanamh aon oibre, féadfaidh an Bord, trí aon chonnradh nó comhaontú leis an duine sin, an ceart chun an obair sin do dhéanamh fán Acht so do thairmligean chuige, agus air sin beidh ag an duine sin, i gcomhréim leis an mBord, an ceart chun an obair sin do dhéanamh agus chun pé cumhachta dá dtugtar don Bhord leis an Acht so d'fheidhmiú is gá chun an obair sin do dhéanamh agus a sonnrófar chuige sin sa chonnradh nó sa chomhaontú san.
(3) Na tagairtí atá san Acht so don Bhord do dhéanamh aon oibre nó ruda léireofar iad agus beidh éifeacht acu mar thagairtí fholaíos an obair nó an rud sin do dhéanamh ag connarthóir bheas fostaithe agus údaraithe chuige sin ag an mBord fán alt so.

Reamhiocanna don Bhord as an bPríomh-chiste.
An tAire Airgeadais do thabhairt réamhíocanna don Bhord.
38.—(1) I dteannta na suimeanna a ceangaltar ar na Aire Airgeadais nó a húdaraítear dó leis na hAchta Leictreachtais (Soláthar), 1927 go 1942, do réamhíoc leis an mBord, féadfaidh an tAire Airgeadais, ar mholadh an Aire, pé suimeanna (fá réir na dteorann a forchuirtear leis an gcéad fhó-alt ina dhiaidh seo den alt so) a theastós ón mBord chun aon chríche éireos as comhlíonadh a fheadhmanna fá na hAchta Leictreachais (Soláthar), 1927 go 1942, nó fán Acht so, seachas críocha nó feadhmanna fán Acht so a ndéantar socrú follas ina leith leis an Acht so chun an tAire Airgeadais do thabhairt réamhíocanna nó deontaisí don Bhord, do réamhíoc leis an mBord as an bPríomh-Chiste nó as a thoradh fáis, fé mar iarrfas agus nuair iarrfas an Bord air é.
(2) Ní raghaidh méid iomlán na suimeanna a réamhíocfar leis an mBord fán bhfó-alt san roimhe seo den alt so thar suim seacht milleon agus chúig céad míle punt, agus ní raghaidh an tsuim a réamhíocfar amhlaidh chun aon scéim cheadaithe áirithe do chur i ngníomh thar an tsuim ordóidh an tAire, le toiliú an Aire Airgeadais, chuige sin leis an ordú ceadúcháin a bhainfeas leis an scéim cheadaithe sin nó le hordú ina dhiaidh sin ag leasú an orduithe cheadúcháin sin sa tslí sin.

39.—(1) Féadfaidh an tAire Airgeadais, chun socrú do dhéanamh chun suimeanna do réamhíoc as an bPríomh-Chiste fán Acht so nó chun na suimeanna uile a réamhíocfar amhlaidh nó aon chuid díobh d'aisíoc leis an gCiste sin nó chun aon urrúis do bhéarfar amach fán alt so do ghlanadh sa mhéid ná fuil aon tsocrú eile déanta ina thaobh san, airgead d'fháil ar iasacht tri pé urrúis do thabhairt amach a mheasfaidh is ceart, agus íocfar isteach sa Stát-Chiste na suimeanna uile gheobhfar ar iasacht amhlaidh.
(2) Is ar an bPríomh-Chiste nó ar a thoradh fáis a bheas muirear agus íoc bun-airgid agus úis gach urrúis do bhéarfar amach fán alt so.
An Bord d'aisíoc réamhíocanna a híocfar amach as an bPríomh-Chiste.
40.—(1) Gach suim a réamhíocfar as an bPríomh-Chiste leis an mBord fán Acht so (seachas suimeanna is inaisíoctha leis an bPríomh-Chiste as airgead a sholáthróidh an tOireachtas) beidh sí inaisíoctha ag an mBord pé trátha, i pé slí, agus go n-ús do réir pé ráta ordóidh an tAire Airgeadais, agus gach suim den tsórt san maraon leis an ús uirthi tiocfaidh chun bheith agus beidh láithreach ina céad-mhuirear ar na hoibreacha dhéanfaidh an Bord fán Acht so (ar a n-áirítear oibreacha dhéanfaidh an Bord de bhun scéime ceadaithe) agus ina muirear so-ghluaiste ar an maoin go léir de gach aon tsaghas (ach amháin na hoibreacha san a dhéanfaidh an Bord amhlaidh) a bheas dílsithe sa Bhord nó ar únaeracht ag an mBord ó am go ham.
(2) Ní oibreoidh aon mhuirear so-ghluaiste cruthnaítear leis an bhfó-alt san roimhe seo den alt so chun cosc nó srian do chur leis an mBord do choimhithiú aon mhaoine lena mbainfidh an muirear so-ghluaiste sin nó do dheighleáil léi ar shlí eile i bhfeidhmiú nó i gcomhlíonadh cuibhe cumhacht agus dualgas reachtúil an Bhuird.
(3) Gach muirear (sonnruch nó so-ghluaiste) a cruthnaítear leis an alt so beidh sé arna dhílsiú san Aire Airgeadais agus féadfaidh an tAire sin é d'fhorfheidhmiú do réir foirme cuibhe an dlí aon uair is dóigh leis is ceart san do dhéanamh agus pé acu bheas aon ús nó aon chaipiteal nó aon tráthchuid de chaipiteal a bheas urraithe leis an muirear san dlite agus gan íoc nó ná beidh.
(4) An t-airgead go léir íocfaidh an Bord nó bainfear den Bhord i leith aisíoctha chaipitil nó íoctha úis suime do réamhíocadh leis an mBord fán alt so déanfar é d'íoc isteach sa Stát-Chiste nó do chur chun tairbhe don Stát-Chiste pé tráth agus i pé slí ordóidh an tAire Airgeadais.
CUID VII
Ilghneitheach.
Airgead do sholáthar chun tuath-líomatáistí do leictriú.
41.—(1) Féadfaidh an tAire Airgeadais, ar mholadh an Aire, airgead ná raghaidh a shuim thar cúig mhilleon punt do réamhíoc leis an mBord, fé mar iarrfas agus nuair iarrfas an Bord é, chun tuath-líomatáistí do leictriú.
(2) An t-airgead go léir a réamhíocfar leis an mBord fán bhfó-alt san roimhe seo den alt so is amach as an bPríomh-Chiste nó as a thoradh fáis do bhéarfar agus a híocfar é.
(3) Déanfar leath amháin de mhéid iomlán an airgid a réamhíocfaidh an tAire Airgeadais leis an mBord fán alt so d'aisíoc leis an bPríomh-Chiste, as airgead a sholáthróidh an tOireachtas, pé tráth nó trátha ordóidh an tAire Airgeadais agus aisíocfaidh an Bord leath eile den mhéid iomlán san.
(4) An t-airgead go léir a réamhíocfaidh an tAire Airgeadais leis an mBord fán alt so caithfidh an Bord é ar leathnú an tsoláthair leictreachais chun tuath-líomatáistí.

42.—(1) Ní dleathach do dhuine ar bith, ach amháin le cead i scríbhinn ón mBord agus do réir na gcoinníoll i dtaobh ama, áite, agus modha luafar sa chead san, aon tsubstaint cheimiciúil ná substaint eile (soladach nó leachtach) do chur, do scaoileadh, ná do ligean, go díreach ná go neamhdhíreach, as aon talamh nó áitreabh nó áit ná as aon árthach isteach in aon abhainn a mbeidh stáisiún giniúna á dhéanamh nó á oibriú ag an mBord uirthi nó ar a bruacha ná isteach in aon abhainn nó sruth a chothaíos an abha san ná isteach in aon loch nó linn ná aon chanáil nó uiscebhealach saordha eile ná aon uisce-chúrsa saordha bheas i gceangal leis an abhainn sin, is substaint de shaghas do chreimfeadh, d'ídeodh, do chuirfeadh in aimhréidh, do stopfadh, do bhrisfeadh, nó do dhíobhálfadh ar shlí eile an stáisiún giniúna san nó aon chuid de nó aon oibreacha ghabhas nó bhaineas leis.
(2) Gach duine chuirfeas nó scaoilfeas nó ligfeas, go díreach nó go neamhdhíreach, aon tsubstaint isteach in aon abhainn, sruth, loch, linn, canáil, uisce-bhealach saordha, nó uisce-chúrsa saordha contrártha don fhó-alt san roimhe seo den alt so, agus únaer an tailimh nó an áitribh nó na háite nó máistir agus fós únaer an árthaigh as a gcuirfear, a scaoilfear, nó ligfear an tsubstaint sin amhlaidh, beid ciontach i gcionta fán alt so agus ar a gciontú ann ar an slí achomair dlifear fíneáil nach mó ná caoga punt do chur orthu agus, i gcás cionta leanúnaigh, fíneáil nach mó ná fiche punt in aghaidh gach lae leanfar den chionta.
(3) Is cosaint mhaith ar chúiseamh go ndearnadh cionta fán alt so a chruthú gur ag pointe san abhainn laistíos de stáisiún giniúna an Bhuird nó isteach in uisce ná fuil i gceangal leis an abhainn sin ach ag pointe laistíos den stáisiún san do tharla an cur nó an scaoileadh nó an ligean a ndeirtear gurb é an cionta é agus nár bhféidir, mar gheall ar threo gabhála an uisce agus ar na cúrsaí eile, an tsubstaint adeirtear a cuireadh nó scaoileadh nó ligeadh do dhul isteach ná do thabhairt isteach sa stáisiún san ná in aon chuid de.
(4) Is gan dochar d'fhorála na nAcht Iascaigh, 1842 go 1944, agus forála an Achta um Ile in Uiscí Intseolta, 1926 (Uimh. 5 de 1926), agus ina dteannta, agus ní in ionad na bhforál san, a bheas éifeacht ag na forála san roimhe seo den alt so.

43.—(1) Beidh an Bord agus a n-oifigigh agus a seirbhísigh agus daoine eile bheas údaraithe ag an mBord chuige sin i dteideal dul isteach ar aon talamh chun gach ní nó éinní do dhéanamh air nó ar aon talamh eile a húdaraítear don Bhord a dhéanamh leis an Acht so nó chun aon fhiosrú, iniúchadh, nó scrúdú do dhéanamh roimh éinní den tsórt san do dhéanamh.
(2) Duine ar bith a dhéanfas cosc nó toirmeasc nó cur isteach ar fheidhmiú aon chumhachta ag an mBord nó ag aon oifigeach nó seirbhíseach don Bhord nó ag duine ar bith bheas údaraithe ag an mBord is cumhacht do bheirtear dóibh nó dhó leis an bhfó-alt san roimhe seo den alt so, beidh sé ciontach i gcionta fán alt so agus ar a chiontú ann ar an slí achomair dlífear fíneáil nach mó ná deich bpuint do chur air.

44.—Ní dhéanfaidh an Bord ná aon chonnarthóir a bheas ag déanamh aon oibreacha fán Acht so aon tailte, áitreabhacha, foirgintí, oibreacha, gléasra, abhair ná maoin eile leis an Aire Poist agus Telegrafa do thógaint chucu ná dul isteach orthu ná d'aistriú ná cur isteach orthu ar shlí eile de bhuaidh an Achta so ná ní thógfaidh aon oibreacha ná ní dhéanfaidh aon ní ná rud eile, de bhuaidh an Achta so, is dóigh leis an Aire Poist agus Telegrafa do choiscfeadh, do mhoilleodh, do bhacfadh, nó do dhocharódh ar shlí eile feidhmiú cuibhe seirbhísí poiblí na Roinne Poist agus Telegrafa.

45.—An tuarascáil a ceangaltar le halt 32 den Acht Leictreachais (Soláthar), 1927 (Uimh. 27 de 1927), ar an mBord do dhéanamh gach bliain sroichfidh agus folóidh imeachta an Bhuird fán Acht so ar feadh na bliana lena mbainfidh an tuarascáil sin, agus an oblagáid a forchuirtear ar an mBord leis an alt san 32 chun staidreamh agus tuairisceáin do thabhairt sroichfidh agus folóidh staidreamh agus tuairisceáin maidir le himeachta an Bhuird fán Acht so.

46.—(1) San alt so ciallaíonn an abairt “Acht 1927” an tAcht Leictreachais (Soláthar), 1927 (Uimh. 27 de 1927).
(2) Léireofar an abairt “líne leictreachais” i ngach áit ina bhfuil sí in Acht 1927 agus beidh éifeacht aici agus is tuigthe éifeacht do bheith riamh aici mar abairt a chiallaíos sreang nó sreanga, seolaí, nó meán eile a húsáitear chun leictreachas d'iompar, do thiomarnú, nó d'iomdháil, agus a fholaíos aon fhearas athracháin nó fearas eile bheas i gceangal le haon tsreang nó sreanga, seolaí, nó meán eile den tsórt san, agus a fholaíos freisin aon chásáil, cótáil, clúdach, feadán, píopa, nó díonachán a bheas timpeall aon tsreinge nó sreanganna, seolaí, nó meáin eile den tsórt san nó aon fhearais den tsórt san agus a fholaíos fós aon phosta, cuaille, taca, tógáil, nó déanmhas a bheas ag fulang aon cheann nó cinn de na nithe a luaitear anso roimhe seo.
(3) Léireofar an focal “línte” i ngach áit ina bhfuil sé i bhfó-alt (1) d'alt 51 d'Acht 1927 agus beidh éifeacht aige agus is tuigthe éifeacht do bheith riamh aige mar fhocal a chiallaíos línte leictreachais mar a mínítear san sa bhfó-alt deiridh sin roimhe seo den alt so.
(4) Beidh feidhm agus éifeacht ag na forála so leanas maidir leis an bhfógra ceangaltar le fó-alt (3) d'alt 53 d'Acht 1927 do sheirbheáil ar únaer agus ar shealbhaire tailimh nó foirginte, sé sin le rá:—
(a) in ionad aon fhógra den tsórt san do sheirbheáil go pearsanta ar an únaer nó ar an sealbhaire sin (pé acu é), féadfar é do sheirbheáil air tríd an fógra san do chur leis an bpost réamhíoctha i gclúdach arna dhíriú chun an únaera nó an tsealbhaire sin (pé acu é) ag á ghnáth-sheoladh nó ag an seoladh is déanaí is eol do bheith aige, agus nuair a cuirfear an fógra san amhlaidh is tuigthe gur seirbheáladh é an uair a déanfaí an clúdach san do sheachadadh i ngnáthchúrsa an phoist;
(b) muran féidir, ar aon chúis áirithe, an clúdach a luaitear sa mhír dheiridh sin roimhe seo den fhó-alt so do dhíriú mar a foráltar leis an mír sin, féadfar an clúdach san do dhíriú chun an duine dá mbeidh sé beartaithe i gceachtar slí nó sa dá shlí acu so leanas, sé sin le rá:—

ELECTRICITY (SUPPLY) (AMENDMENT) ACT, 1945.
PART I.
Preliminary and General.
Short title, collective citation, and construction.
1.—(1) This Act may be cited as the Electricity (Supply) (Amendment) Act, 1945.
(2) The Electricity (Supply) Acts, 1927 to 1942, and this Act may be cited together as the Electricity (Supply) Acts, 1927 to 1945.
(3) This Act shall be construed as one with the Electricity (Supply) Acts, 1927 to 1942.
Definitions.
2.—In this Act—
the expression “the Minister” means the Minister for Industry and Commerce;
the expression “the Board” means the Electricity Supply Board;
the expression “hydro-electric works” means works for the generation of electricity by means of hydraulic power;
the expressions “generating station”, “transmission system”, and “distribution system” have the same meanings as are given to them respectively by section 1 of the Electricity (Supply) Act, 1927 (No. 27 of 1927), for the purposes of that Act.
Expenses.
3.—The expenses incurred by the Minister in the administration of this Act shall (to such extent as may be sanctioned by the Minister for Finance) be paid out of moneys provided by the Oireachtas.

Hydro-Electric Schemes.
Preparation and approval of hydro-electric schemes.
4.—(1) It shall be lawful for the Board, whenever they so think proper, to prepare and submit to the Minister a scheme for the generation of electricity by means of hydraulic power derived from the waters of any specified river impounded and made available for that purpose by means of a dam and other engineering works to be constructed by the Board under this Act.
(2) Whenever a scheme is submitted to the Minister by the Board under this section, the Minister shall consider such scheme and, after consultation with the Minister for Agriculture as to the steps to be taken by the Board for the protection of fisheries, do whichever of the following things he considers proper, that is to say:—
(a) by order approve of such scheme, or
(b) refer such scheme back to the Board for reconsideration and re-submission to him under this section, or
(c) refuse to approve of such scheme.
(3) In this Act—
the expression “approval order” means an order made by the Minister approving of a scheme submitted to him by the Board under this section, and
the expression “approved scheme” means a scheme approved of by the Minister by an approval order and, in the case of any such scheme so approved of with alteration, means such scheme as so approved of.
Amendment of an approved scheme.
5.—(1) Whenever in the course of carrying out an approved scheme it appears to the Board to be necessary that such scheme should be amended in any respect, it shall be lawful for the Board to prepare such amendment of such approved scheme as they shall think proper and to submit such amendment to the Minister.
(2) Whenever an amendment of an approved scheme is submitted to the Minister by the Board under this section, the Minister shall consider such amendment and, after consultation with the Minister for Agriculture, shall do whichever of the following things he considers proper, that is to say:—
(a) by order approve of such amendment, or
(b) refer such amendment back to the Board for reconsideration and resubmission to him under this section, or
(c) refuse to approve of such amendment.
(3) Whenever the Minister approves under this section of an amendment of an approved scheme, such approved scheme shall have effect and be deemed always to have had effect with and subject to such amendment, and accordingly references in this Act to an approved scheme shall, in relation to the said approved scheme, be construed and have effect (wherever the context so permits) as referring to the said approved scheme as so amended.
Execution of approved schemes.
6.—(1) As soon as conveniently may be after the approval by the Minister of an approved scheme, the Board shall execute and carry out such scheme.
(2) For the purpose of carrying out an approved scheme it shall be lawful for the Board to do, in accordance with such scheme (with such additions, omissions, variations, and deviations as shall be found necessary in the course of the work), such of the following things as are, expressly or by implication, provided for by such scheme, that is to say:—
(a) impound, hold up, divert, take, and use the waters of the river to which such approved scheme relates and the waters of any river or stream tributary to, and of any lake, pond, or canal on or connected with, the said river to which such approved scheme relates;
(b) embank, dam, dredge, deepen, widen, straighten, divert, and otherwise alter the river to which such approved scheme relates or any river or stream tributary to that river;
(c) embank, dam, dredge, alter the level of, and otherwise affect any lake, pond, or other water on or connected (directly or indirectly) with the river to which such approved scheme relates;
(d) remove, alter, repair, or reconstruct any sluice, weir, dam, embankment, quay, harbour, landing place, boathouse, or other similar work in the river to which such approved scheme relates or in any river or stream tributary to that river or any lake connected therewith;
(e) construct and maintain sluices, weirs, dams, embankments, and other similar works (including passages for the ascent and descent of fish);
(f) construct and maintain generating stations, transformer stations, and other stations and places for generating, transforming, storing, or otherwise dealing with electricity generated in pursuance of such approved scheme;
(g) purchase, hire, or otherwise provide and maintain machinery, plant, and equipment for all generating stations, transformer stations, and other stations and places constructed under the next preceding paragraph of this subsection;
(h) subject to the provisions of this Act, close, divert, remove, submerge, or otherwise interfere with any public road or bridge;
(i) do any act or thing which may be necessary for or incidental to the doing of anything which the Board is by this subsection authorised to do.
Acquisition of land, etc., by the Board.
7.—(1) For the purpose of carrying out an approved scheme or doing anything which the Board is authorised by the next preceding section to do for that purpose, the Board may do all or any of the following things, that is to say:—
(a) acquire any land either permanently or temporarily and either by agreement or compulsorily;
(b) acquire (either permanently or temporarily and either by agreement or compulsorily) any easement, way-leave, fishery, fishing right, water-right, or other right whatsoever over or in respect of any land or water;
(c) terminate, restrict, or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any easement, way-leave, fishery, fishing right, water-right, or other right whatsoever existing over or in respect of any land or water;
(d) divert, close, remove, submerge, or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any private road, way, or bridge or any canal or other artificial water-way or any artificial watercourse;
(e) interfere with any land either permanently or temporarily and either by agreement or compulsorily.
(2) Whenever, on the completion of the carrying out of an approved scheme, it appears to the Board that any land, easement, way-leave, or other property acquired by the Board under this Act for the purposes of such approved scheme is not required for those purposes, it shall be lawful for the Board to sell, lease, or otherwise dispose of such property.
Entry on land, etc., before conveyance.
8.—(1) At any time after the making of an approval order and before conveyance or ascertainment of price or compensation, the Board may (subject to the subsequent provisions of this section) do any of the following things, that is to say:—
(a) enter on and take possession of any land or exercise any right which the Board is authorised by this Act to acquire for the purpose of carrying out the approved scheme to which such approval order relates;
(b) terminate, restrict, or otherwise interfere with any easement or other property or right which the Board is authorised by this Act to terminate, restrict, or otherwise interfere with for the purpose of carrying out the said approved scheme;
(c) divert, close, remove, submerge, or otherwise interfere with any private road, way, or bridge or any canal or other artificial water-way, or any artificial water course which the Board is authorised by this Act to divert, close, remove, submerge, or otherwise interfere with for the purpose of carrying out the said approved scheme.
(2) Whenever the Board exercises any of the powers conferred on the Board by the foregoing subsection of this section, the Board shall be liable to pay to the occupier of the land or the owner of the easement, right, or other property entered upon, exercised, or interfered with by the exercise of such power, interest on the amount of the price or compensation payable under this Act to such occupier or owner at the rate of three per cent, per annum from the date of such entry, exercise, or interference until payment of such price or compensation.
(3) The Board shall not—
(a) enter on or take possession of any land under this section without giving to the occupier of such land at least one month's or, in the case of an occupied dwellinghouse, three months' previous notice in writing of their intention so to do, or
(b) exercise any easement or other right or interfere with any right or property under this section without giving to the owner of such easement, right, or property at least one month's previous notice in writing of their intention so to do.
(4) A notice under the next preceding subsection of this section may be served on any person by sending such notice by prepaid post in an envelope addressed to such person at his usual or last known address and shall be deemed to have been served on such person at the time at which such envelope would be delivered in the ordinary course of post.
(5) Where, for any reason, the envelope mentioned in the next preceding subsection of this section cannot be addressed in the manner provided by that subsection, such envelope may be addressed to the person for whom it is intended in either or both of the following ways, that is to say:—
(a) by the description “the owner” or “the occupier” (as the case may be) without stating his name,
(b) at the land or the situation of the property to which the notice contained in such envelope relates.
Deposit of maps, plans, etc.
9.—(1) As soon as may be after the making of an approval order and not later than one month before commencing the construction of any particular part of the works required for the purpose of the execution of the approved scheme to which such order relates or commencing to do for that purpose any particular thing which the Board is authorised by this Act to do or for that purpose entering on any land or premises or exercising any right or interfering with any property (corporeal or incorporeal) under this Act, the Board shall cause maps, plans, and books of reference in relation to such particular part of such works or such particular thing or such land, premises, right, or property (as the case may be) to be deposited in accordance with this section.
(2) The maps and plans required by this section to be deposited by the Board in relation to an approved scheme shall be sufficient in quantity and character to show on adequate scales the extent of the works in relation to which they are deposited and also all property, corporeal or incorporeal, proposed to be acquired for the purpose of such works and also every interference (so far as the same can be shown on a drawing) proposed to be made for the said purpose with any property (corporeal or incorporeal) or any public road or bridge.
(3) The books of reference required by this section to be deposited by the Board in relation to an approved scheme shall contain the names of the owners or reputed owners, lessees or reputed lessees, and occupiers of all land proposed to be acquired or otherwise affected under this Act for the purpose of the works in relation to which they are deposited and of all property, corporeal or incorporeal, (including public roads and bridges)·proposed to be in any way interfered with under this Act for the said purpose.
(4) The maps, plans, and books of reference required by this section to be deposited by the Board in relation to an approved scheme shall be deposited at the head office of the Board in the City of Dublin and at such other places as shall be prescribed by the Minister in the approval order relating to such approved, scheme and shall remain so deposited until the completion of such approved scheme and shall, while so deposited, be open to inspection by any person, free of charge, between the hours of ten o'clock in the morning and four o'clock in the afternoon on every day except Saturdays, Sundays, and bank holidays.
(5) As soon as may be after the deposit of any maps, plans, or books of reference in pursuance of this section, the Board shall give public notice of such deposit by advertisement published twice in each of two or more daily newspapers circulating in the City of Dublin and in such (if any) other newspapers as shall be prescribed by the Minister in the relevant approval order.
(6) Every public notice given by the Board in pursuance of the next preceding subsection of this section shall state that the maps, plans, and books of reference to which such notice relates are open to public inspection in accordance with this section and shall state the times and places at which they are so open to inspection.
Generation and distribution of electricity.
10.—(1) When an approved scheme has been carried out and the hydro-electric works provided for by such scheme have been completed (with such additions, omissions, variations, and deviations as shall have been found necessary in the course of the work), the Board shall generate electricity by means of such works and shall transmit and distribute such electricity to such places and in such manner as shall, in the opinion of the Board, be requisite for making such electricity available for the purposes mentioned in the next following subsection of this section.
(2) The following provisions shall apply and have effect in relation to electricity (in this subsection referred to as the said electricity) generated by the Board in pursuance of the next preceding subsection of this section, that is to say:—
(a) the said electricity shall be used and applied by the Board for all or such one or more (as the Board shall think proper) of the purposes for which electricity (in this subsection referred to as such other electricity) generated by the Board by any other means may lawfully be used or applied by the Board;
(b) the said electricity may be so used and applied in conjunction with, in addition to, or independently of all or any such other electricity;
(c) the Board shall have and may exercise in relation to the said electricity all or any of the powers for the time being vested in the Board in relation to the transmission, distribution, supply, and sale of all or any of such other electricity;
(d) any part or, parts of any transmission system or of any distribution system for the time being owned by the Board for the transmission or distribution (as the case may be) of all or any of such other electricity may be used for the transmission or distribution of the said electricity;
(e) any part or parts of any transmission system or any distribution system constructed by the Board for the transmission or distribution (as the case may be) of the said electricity may be used for the transmission or distribution of such other electricity.
(3) For the purposes of the transmission and distribution of electricity in pursuance of subsection (1) of this section the Board shall have and may exercise all or any of the powers vested in them by the Electricity (Supply) Acts, 1927 to 1942, in relation to the transmission and distribution of electricity generated otherwise than in pursuance of the said subsection (1).
Protection of fisheries.
11.—In the carrying out of an approved scheme it shall not be obligatory on the Board or any contractor employed by the Board to comply with the Fisheries Acts, 1842 to 1944, but the Board shall take and make or, in the case of works executed by a contractor, procure that the contractor shall take and make such precautions and provisions as the Minister for Agriculture may consider adequate for the protection of and avoidance of injury to fisheries during or in consequence of the carrying out of such approved scheme, provided that the said Minister shall, in consultation with the Board, satisfy himself that taking such precautions and making such provisions will not cause substantial detriment to the works provided for by such approved scheme or substantial hindrance to or substantial increase in the cost of such works.
Power of Board to prohibit navigation.
12.—(1) The Board may by order, whenever they think it to be necessary for the due carrying out of an approved scheme or the operation of works constructed in pursuance of an approved scheme, prohibit, during such period as they shall consider to be necessary for the purposes of such carrying out or such operation (as the case may be), navigation in or upon the river, or any particular part of the river, to which such approved scheme relates or related.
(2) An order may be made by the Board under the foregoing subsection of this section notwithstanding any enactment declaring the river to which such order relates to be a public navigable river.
(3) Every order made by the Board under this section shall be expressed and shall operate to prohibit the passage of any person with any boat, barge, lighter, or other vessel in or upon the river or the particular part of the river to which such order relates during the period specified in that behalf in such order.
(4) Every person who contravenes any provision of an order made by the Board under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds.
Right of the Board to information from rate books.
13.—(1) Whenever the Board, for the purpose of or in connection with the preparation of a scheme for submission to the Minister under this Act or for the purpose of or in connection with the carrying out of an approved scheme or the exercise of any of the powers or performance of any of the duties conferred or imposed on the Board by this Part of this Act, requires information from a rate book or other similar document, the local authority or other local body having custody of such book or document shall, at the request of the Board—
(a) permit any officer of the Board authorised in that behalf by the Board to inspect free of charge such book or document and to take free of charge a copy of the whole or any part of such book or document, and
(b) furnish to the Board, upon, payment by the Board of such fee as shall be agreed upon by the Board and such local authority or local body or, in default of such agreement, shall be fixed by the Minister for Local Government and Public Health, a copy of such book or document or of any particular part thereof specified in that behalf by the Board.
Exemption of works from rates.
14.—(1) All works executed by the Board in carrying out an approved scheme or for the transmission or distribution of electricity generated by such works shall, while in the exclusive possession and control of the Board, be exempt from assessment for poor rate and also from assessment for any other rate made by a local authority.
(2) In this section the expression “local authority” has the same meaning as is given to it by the Electricity (Supply) Act, 1927 (No. 27 of 1927), as extended by subsection (2) of section 10 of the Electricity (Supply) (Amendment) (No. 2) Act, 1934 (No. 38 of 1934).
(3) Nothing in this section shall apply or have effect in relation to any fishery or fishing right acquired by the Board under or by virtue of this Act.
PART III.
Acquisition and Management of Fisheries.
Acquisition of fisheries and fishing rights.
15.—Whenever application is duly made to the Board either for compensation on account of the termination, restriction, or other interference (whether permanent or temporary) by the Board under this Act of or with a fishery or fishing right or for compensation for injury to a fishery and the Board, after consultation with the Minister for Agriculture, determines that for economic or other reasons it would be more expedient to acquire the fishery or fishing right to which such application relates, the Board shall acquire by agreement or, in default of agreement, compulsorily such fishery or fishing right and such land, way-leaves, and other rights as are, in the opinion of the Board, ancillary to or necessary for the enjoyment of such fishery or fishing right.
Preservation, management, etc., of fisheries by the Board.
16.—(1) Whenever the Board acquires a fishery or fishing right under this Part of this Act or has before the passing of this Act acquired a fishery or fishing right under the Liffey Reservoir Act, 1936 (No. 54 of 1936), the Board may, if they so think fit, preserve such fishery or fishing right, and for that purpose it shall be lawful for the Board to manage and conduct such fishery or fishing right and to do all such things, carry out all such transactions, and fulfil all such functions as shall be necessary or proper for or incidental or ancillary to such preservation, management, and conduct.
(2) Without prejudice to the generality of the powers conferred on the Board by the foregoing subsection of this section, the Board shall, for the purpose of preserving, managing, and conducting a fishery or fishing right in pursuance of the said subsection, have and may exercise the following powers, that is to say:—
(a) the like powers in relation to the acquisition of land and rights over or in respect of land or water, the like powers of interference with land and rights over or in respect of land or water, and the like powers in relation to private roads, ways, and bridges, and artificial water-ways and water-courses as are conferred on them by Part II of this Act for the purpose of carrying out an approved scheme, and
(b) the like powers of closing, diverting, removing, submerging, or otherwise interfering with public roads or bridges as are conferred on them by Part II of this Act for the purpose of carrying out an approved scheme but subject to the provisions contained in this Act in relation to the closing, diverting, removing, submergence of, or other interference with public roads and bridges by the Board, and
(c) power, with the consent of the Minister, to demise by lease or let by way of licence the whole or any part of such fishery or fishing right to such persons, for such period, at such rent, and on such terms and conditions as the Board shall, with the consent aforesaid, think proper.
(3) Section 17 of the Shannon Fisheries Act, 1935 (No. 4 of 1935), shall apply and have effect in respect of moneys received or expended by the Board in the performance of its powers under this section in like manner as it applies and has effect in relation to moneys received or expended by the Board in the performance of the duties mentioned in the said section 17.
Application of the income of the Board from fisheries.
17.—(1) The income of the Board derived from the performance of the duties imposed on the Board by this Act in relation to fisheries and fishing rights acquired by the Board under this Part of this Act or under the Liffey Reservoir Act, 1936 (No. 54 of 1936), after discharging all expenses incurred by the Board in performing those duties and properly chargeable to income, shall be applied to the following purposes in the following order, that is to say:—
(a) payment of all interest payable in the current year or owing in respect of any previous year to the Minister for Finance on advances made under this Act by the said Minister to the Board in respect of the acquisition of such fisheries and fishing rights;
(b) setting aside such sums as the Board, with the approval of the Minister, shall think proper for reserve fund, extension, and other like purposes relating to the performance of the said duties;
(c) payment of all moneys payable in the current year or owing in respect of any previous year to the Minister for Finance on account of the repayment of the said advances;
(d) appropriation for any other purpose which the Board shall think proper.
Compensation to certain fishery employees and others.
18.—(1) Every person who proves to the satisfaction of the Board or of the arbitrator—
(a) that he was engaged by way of trade or otherwise for profit in fishing in the waters of any river or was employed for reward by any person for such fishing or was both so engaged and so employed, and
(b) that he has suffered loss of profits or loss of earnings by reason of any interference by the Board under this Act with the waters of such river or any fishery therein or fishing right thereover,
shall (subject to the subsequent provisions of this section) be entitled to be paid by the Board compensation in respect of his said loss of profits or earnings or profits and earnings, as the case may be.
(2) The compensation payable to any person under this section shall be calculated as follows, that is to say, for every complete open fishing season during which such person was engaged or employed or both engaged and employed as mentioned in the next preceding subsection of this section, such person shall receive a sum equal to four times the average weekly earnings or wage or earnings and wage received by such person in respect of such engagement or employment during the complete open fishing season next before the interference by the Board mentioned in the said subsection but subject to the overriding limitation that such compensation shall not in any case exceed fifty-two times the said average weekly earnings or wage or earnings and wage, as the case may be.
(3) A person shall not be entitled to any compensation under this section where it is shown to the satisfaction of the arbitrator that, by reason of an undertaking by the Board to continue the employment of such person or for any other reason, such person will suffer no loss or diminution of earnings or employment in consequence of the interference by the Board.
(4) The right to and the amount (if any) of compensation under this section shall be determined under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, as if such compensation were the price of land compulsorily acquired.
Appointment of ex-officio members of boards of conservators.
19.—(1) Section 6 of the Fisheries (Ireland) Act, 1848, as amended by section 7 of the Fisheries Act, 1925 (No. 32 of 1925), shall not apply in respect of any fishery acquired by the Board under this Part of this Act, and in lieu of the said section 6 as so amended it is hereby enacted that—
(a) if and so long as the Board is the owner, lessee, or occupier of any such fishery which was, on the 1st day of January, 1931, a several or exclusive fishery within the meaning of the said section 6 the following provision shall apply and have effect, that is to say, whenever, on the date on which the fishery rate for any fishery year is struck by the board of conservators for the fishery district in which such fishery is situate, such fishery is valued under the Valuation Acts at not less than fifty pounds, the Board shall be entitled to nominate one person to be, until the next fishery rate is so struck, an ex-officio member, in respect of such fishery of the board of conservators of the district in which such fishery is situate, and
(b) if and so long as the Board is the owner, lessee, or occupier of two or more such fisheries situate in the same fishery district each of which was, on the 1st day of January, 1931, a several or exclusive fishery within the meaning of the said section 6 the following provisions shall apply and have effect, that is to say, whenever, on the date on which the fishery rate for any fishery year is struck by the board of conservators for the said fishery district, such fisheries are valued under the Valuation Acts at valuations amounting in the aggregate to not less than fifty pounds, the Board shall be entitled to nominate one person to be, until the next fishery rate is so struck, an ex-officio member, in respect of such fisheries, of the board of conservators of the district in which such fisheries are situate.
(2) Where the Board is entitled under the foregoing subsection of this section to nominate two or more ex-officio members of a board of conservators, the following provisions shall have effect, that is to say:—
(a) the Board shall be entitled to nominate such number (whether one or more than one) of ex-officio members of such board of conservators as the Board shall think proper, but not exceeding the total number of such members which the Board is entitled under the said subsection to nominate;
(b) every ex-officio member of such board of conservators so nominated by the Board shall be nominated to represent one or more specified fisheries or groups of fisheries in respect of which the Board is entitled under the said subsection to nominate ex-officio members of such board of conservators, but so that the said ex-officio members so nominated shall between them represent all the fisheries or groups of fisheries in respect of which the Board is entitled as aforesaid to nominate ex-officio members of such board of conservators;
(c) every ex-officio member of such board of conservators so nominated by the Board shall have and may exercise at meetings of such board of conservators a number of votes equal to the number (whether one or more than one) of fisheries or groups of fisheries which he is nominated under the next preceding paragraph of this subsection to represent.
(3) A person nominated under this section to be an ex-officio member of a board of conservators shall, subject and without prejudice to the next preceding subsection of this section, have and may exercise as such member all the rights and privileges which are conferred by section 6 of the Fisheries (Ireland) Act, 1848, on a person who is an ex-officio member of a board of conservators under that section.
Powers of certain officers and servants of the Board.
20.—Every officer or servant of the Board authorised in writing by the Minister for Agriculture to exercise the powers conferred by section 24 of the Fisheries Act, 1925 (No. 32 of 1925), shall have and may exercise all or any of the powers conferred by the said section 24 on an officer or servant of a board of conservators authorised in writing by such board to exercise the powers conferred by that section and for that purpose the said section 24 shall be construed and have effect as if officers and servants of the Board authorised as aforesaid were expressly mentioned therein.
Closing of free gaps in weirs.
21.—(1) The Minister for Agriculture may, if he so thinks proper, at any time by order authorise the Board, for the purpose of acquiring statistical information and the purpose of carrying out scientific investigations or for either of those purposes, to close at such times, during such periods, subject to such conditions, and in such manner as he may specify in such order, the free gap in any specified weir owned by the Board in any river in which the Board has acquired a fishery or fishing right under this Part of this Act.
(2) Whenever the Minister for Agriculture by order under this section authorises the Board to close the free gap in a weir, the following provisions shall apply and have effect, that is to say:—
(a) notwithstanding anything contained in the Fisheries Acts, 1842 to 1944, it shall be lawful for the Board to close such free gap under and in accordance with such order;
(b) section 10 of the Fisheries (Ireland) Act, 1845, shall not apply in respect of any obstruction placed in such free gap by the Board under and in accordance with such order.
Variation of weekly close seasons.
22.—The Minister for Agriculture may by order vary as he shall think proper the weekly close season fixed by section 20 of the Salmon Fishery (Ireland) Act, 1863, in respect of any river in which the Board has acquired a fishery or fishing right under this Part of this Act, but the said Minister shall not by any such order increase any such weekly close season to more than seventy-two hours or reduce any such weekly close season to less than forty-eight hours.
Restriction on number of certain fishing licences.
23.—(1) Whenever the Board acquires a fishery or fishing right under this Part of this Act, the Minister for Agriculture may by order, if he so thinks proper, do the following things, that is to say:—
(a) prescribe the maximum number of licences for fishing with drift nets in the tidal waters (within the meaning of the Fisheries Acts, 1842 to 1944) of the river in which such fishery or fishing right is situate which may be issued in any year in which the open season for such fishing begins after the date of such order;
(b) prescribe the maximum number of licences for fishing with draft nets or seines in the said tidal waters which may be issued in any year in which the open season for such fishing begins after the date of such order;
(c) make regulations in relation to the issue of such licences as are mentioned in either of the foregoing paragraphs of this subsection with a view to securing to persons who held such drift net licences or draft net or seine licences (as the case may be) in the year before the date of such order a preferential right to purchase such drift net licences or draft net or seine licences (as the case may be) before the commencement of any open season for fishing under such licences in respect of which the number of such licences is limited by such order.
(2) Whenever the Minister for Agriculture makes under this section an order prescribing the maximum number of licences of any particular kind which may be issued in respect of the tidal waters of any particular river in any particular open season, the number of such licences issued in respect of such tidal waters in any such open season shall not exceed the maximum number so prescribed.
(3) Nothing in this section shall be construed as in any way affecting the powers of the Minister for Agriculture to make orders or bye-laws under the Fisheries Acts, 1842 to 1944.
(4) Where a person is convicted of an offence under the Fisheries Acts, 1842 to 1944, or this Act, such person shall not be entitled to any preferential right to obtain a licence under this section.
Construction of fishing weirs by the Board.
24.—(1) Whenever the Board acquires under this Part of this Act every fishery (if any) and every fishing right (if any) in a river, the Board may, with the consent of the Minister for Agriculture and notwithstanding anything contained in the Fisheries Acts, 1842 to 1944, construct in such river a fishing weir for the purposes of all or any of the fisheries (if any) and fishing rights (if any) so acquired, and may thereafter maintain the fishing weir so constructed.
(2) Whenever the Board acquires under or by virtue of this Act a fishing weir, the Board may, with the consent of the Minister for Agriculture and notwithstanding anything contained in the Fisheries Acts, 1842 to 1944, do either of the following things, that is to say:—
(a) maintain such fishing weir and, for the purposes of such maintenance, reconstruct or repair such fishing weir, or
(b) construct on the site of such fishing weir or on a different site a new fishing weir in lieu of the fishing weir so acquired and thereafter maintain such new fishing weir.
Prohibition of snap nets.
25.—(1) The Minister for Agriculture, if he so thinks fit on the application of the Board, may by order prohibit the issue of licences under the Fisheries Acts, 1842 to 1944, for fishing with a snap net in the tidal waters (within the meaning of those Acts) of any river in which the Board has acquired a fishery or fishing right under this Part of this Act.
(2) Whenever the Minister for Agriculture has made an order under the foregoing subsection of this section, no licence shall be issued under the Fisheries Acts, 1842 to 1944, in contravention of such order.
PART IV.
Compensation.
Assessment of price or of compensation.
26.—(1) The amount of the price or compensation to be paid by the Board for any land acquired (whether permanently or temporarily) by the Board under this Act to the several persons entitled thereto or having estates or interests therein, or for or in respect of any easement, way-leave, fishery, fishing right, water-right, or other right acquired (whether permanently or temporarily) by the Board under this Act to the owner thereof or to the several persons entitled to or having estates or interests in the land over or in respect of which such right is so acquired shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919.
(2) The amount of the compensation to be paid by the Board on account of the termination, restriction or other interference (whether permanent or temporary) by the Board under this Act of or with any easement, way-leave, fishery, fishing right, water-right, or other right over or in respect of any land or water or the diversion, closing, submergence, removal, or other interference (whether permanent or temporary) by the Board under this Act of or with any private road, way, or bridge, or any canal, or other artificial water-way or any artificial water-course or the interference (whether permanent or temporary) with any land by the Board under this Act shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, in like manner as if such compensation were the price of land compulsorily acquired.
(3) Where any price or compensation is being assessed in pursuance of this section in respect of any property, corporeal or incorporeal, which is occupied, used, or enjoyed with or forms part of any other property, regard shall be had to any benefit in the nature of drainage or improvement of water supply which may reasonably be expected to accrue to such other property by reason of any works executed or in the course of execution or about to be executed by the Board under this Act.
(4) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845 (as adapted or amended by or under any subsequent Act) shall apply to any price or compensation payable by the Board under this section and to the conveyance to the Board of property, corporeal or incorporeal, acquired by the Board under this Act, and for the purpose of such application the Board shall be deemed to be the promoters of the undertaking.
(5) No action shall lie at law or in equity against the Board or any contractor or any officer or servant of the Board or of any contractor for or on account of any act, matter, or thing in respect of which compensation is payable by virtue of this section.
Time for claims for price or compensation.
27.—(1) All claims for the price of or compensation in respect of any land, easement, right, or other property (whether corporeal or incorporeal) acquired or interfered with by the Board under this Act shall be made within one year after such land, easement, right, or property is first entered on, exercised, or interfered with by the Board under this Act.
(2) The foregoing subsection of this section shall not apply or have effect in relation to claims for compensation in respect of an interference with a fishery or fishing right, and in lieu thereof every such claim shall be made under the next following section and the provisions of that section shall apply and have effect in relation to such claims.
Compensation for injury to a fishery.
28.—(1) Subject and without prejudice to the power of acquiring fisheries and fishing rights given to the Board by Part III of this Act, the Board shall be liable to pay compensation (in this Act referred to as compensation for injury to a fishery) to every person who suffers loss or damage by reason of an injury to a fishery or fishing right owned by him where such injury is caused during the construction or by the operation generally of hydro-electric works constructed by the Board in pursuance of an approved scheme or by any particular mode or course of or negligence in the operation of such works.
(2) Every application for compensation under this section shall be made in writing to the Board within ten years after the injury, in respect of which such compensation is claimed, is alleged to have happened or begun.
(3) No compensation shall be payable under this section—
(a) in respect of an injury to a fishery or fishing right which is acquired by the Board under this Act, or
(b) in respect of an injury in relation to which no application for such compensation is duly made within the time limited in that behalf by the next preceding subsection of this section.
(4) The right to and the amount (if any) of compensation under this section shall be determined under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, in like manner as if such compensation were the price of land compulsorily acquired.
(5) No action shall lie at law or in equity against the Board or any contractor or any officer or servant of the Board or of any contractor for or on account of any injury in respect of which either compensation is payable under this section or compensation is expressly declared by this section not to be payable under this section.
Execution of works in lieu of compensation.
29.—(1) Where a person is entitled, actually or prospectively, to compensation in respect of anything lawfully done or intended to be done by the Board under this Act, the Board may execute for the benefit of such person such works as the Board shall think proper and such person shall agree to accept in satisfaction or partial satisfaction of his claim for such compensation.
(2) The Board may attach to the execution of any works under this section such terms and conditions (including terms as to the ownership, possession, and control of such works) as shall be agreed upon by the Board and the person for whose benefit the works are so executed.
PART V.
Particular Powers and Duties of the Board.
Construction, etc., of transport works by the Board.
30.—(1) (a) The Minister may, on the application of the Board, make an order (in this section referred to as a transport works order) under this subsection authorising the Board to construct, maintain and operate, for the purposes of the performance by the Board of any of its functions under the Electricity (Supply) Acts, 1927 to 1942, or this Act, the transport works specified therein in such manner, subject to such restrictions and provisions, and on such terms as the Minister thinks proper and specifies in the order;
(b) every application for a transport works order shall be accompanied by a draft of the proposed order, a plan of the proposed transport works and a book of reference to such plan, and such draft, plan and book of reference shall be in such form as the Minister may direct;
(c) where an application is made for a transport works order the Board, if so required by the Minister, shall—
(i) deposit and make available for inspection, in accordance with the directions of the Minister, a copy of the plan and the book of reference which accompanied the application,
(ii) publish, in accordance with the directions of the Minister, such notices as the Minister shall specify in that behalf.
(2) For the purpose of the exercise of the powers conferred on the Board by a transport works order, it shall be lawful for the Board to do all or any of the following things, that is to say:—
(a) acquire (either permanently or temporarily and either by agreement or compulsorily) any land or any easement, way-leave, or other right over or in respect of any land;
(b) terminate, restrict, or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any easement, way-leave, or other right over or in respect of any land;
(c) divert, close, remove, or otherwise interfere with (either permanently or temporarily and either by agreement or compulsorily) any private road, way, or bridge;
(d) subject to the provisions of this Act, close, divert, remove, or otherwise interfere with any public road or bridge.
(3) The following provisions shall have effect in relation to every transport works order—
(a) the order shall contain such provisions as the Minister thinks necessary or expedient for the purposes of the order;
(b) without prejudice to the generality of paragraph (a) of this subsection, the order—
(i) shall specify the manner in which the transport works to which the order relates are to be constructed,
(ii) may contain provisions as to the manner in which the said transport works are to be operated and maintained,
(iii) shall contain provisions limiting the use of the said transport works to purposes relating to the performance by the Board of its functions under the Electricity (Supply) Acts, 1927 to 1942, or this Act and to such other purposes (if any) as may be specified in the order,
(iv) shall contain all such provisions as the Minister thinks proper for the protection of the public generally and any persons affected by the order.
(v) may incorporate any provisions (including penal provisions) contained in any enactment relating to railways, with such adaptations and modifications as the Minister thinks proper,
(vi) may provide for the determination by arbitration of any specified questions arising thereunder,
(vii) may, in relation to the exercise of the powers conferred on the Board by subsection (2) of this section, contain provisions to the like effect as those contained in section 8 of this Act,
(viii) may contain such provisions ancillary or incidental to any of the matters aforesaid as the Minister considers necessary and proper.
(4) The Minister may by order under this subsection amend a transport works order.
(5) Every order under this section shall have statutory effect.
(6) Where the Minister makes a transport works order, he may make regulations (not inconsistent with the order) in relation to the manner in which the transport works to which the order relates are to be maintained and operated, and the Board shall comply with any such regulations.
(7) In this section the expression “transport works” means any works being—
(a) a railway, or
(b) a tramway.
Manufacture of electrical apparatus, etc., by the Board.
31.—(1) Whenever the Minister is of opinion that the then existing or the probable future requirements in the State in respect of any particular class of apparatus, machinery, or equipment for the generation, transmission, distribution, or use of electricity are not being and are not likely to be met sufficiently and efficiently by businesses then lawfully established in the State, the Minister, if he so thinks proper, may, subject to the provisions of this section, authorise the Board to manufacture or arrange for the manufacture of that particular class of such apparatus, machinery, or equipment in accordance with this section.
(2) The following provisions shall apply and have effect in relation to the giving by the Minister to the Board of any such authorisation as is mentioned in the foregoing subsection of this section, that is to say:—
(a) before giving any such authorisation the Minister shall cause notice of his intention to give such authorisation to be published in the Iris Oifigi[html]il and in such other manner as shall appear to the Minister to be calculated to bring his said intention to the knowledge of persons concerned;
(b) every such notice shall state the class of apparatus, machinery, or equipment to which such authorisation is intended to apply and that any person may within a specified time (not being less than thirty days after the publication of such notice in the Iris Oifigi[html]il) send to the Minister in a specified manner an objection (with the grounds therefor) to the giving of such authorisation;
(c) the Minister shall consider every such objection so sent to him within the said specified time;
(d) after the expiration of the said specified time, the Minister may, if he so thinks proper having regard to such objections (if any), give such authorisation either in accordance with his said intention or in such modified form as he shall think proper having regard as aforesaid;
(e) the Minister may attach to any such authorisation such (if any) conditions and restrictions as he shall think proper.
(3) When the Minister has given to the Board an authorisation under this section, the Board may, in accordance with the terms of such authorisation, themselves manufacture and sell the apparatus, machinery, or equipment specified in such authorisation or may arrange for the manufacture and sale thereof by other persons.
(4) Where the Board arranges under this section for the manufacture and sale of apparatus, machinery, or equipment by other persons, the Board, after consultation with the Minister for Finance, may, with the consent of the Minister and subject to such (if any) conditions as he may impose, do all or any of the following things, that is to say:—
(a) promote, either alone or in conjunction with other persons, a limited company (complying with the subsequent provisions of this section) for such manufacture and sale, or
(b) acquire, in whole or in part, any undertaking engaged in such manufacture and sale, or
(c) assist by way of investment, loan, advance, or guarantee any person engaged in such manufacture and sale.
(5) The following provisions shall apply and have effect in relation to every limited company promoted by the Board (either alone or in conjunction with other persons) under this section, that is to say:—
(a) the memorandum and articles of association of such company shall be subject to the approval of the Minister given after consultation with the Minister for Finance;
(b) the said articles of association shall provide that the Board shall be entitled to appoint, from amongst the members and officers of the Board, at least one director of such company;
(c) the accounts of such company shall be submitted annually to the Minister and shall be audited (at the expense of such company) by an auditor approved of by the Minister;
(d) such company shall furnish to the Minister such information in regard to its business as the Minister may from time to time require.
(6) The Board shall be entitled, for the purposes of its functions under this section, to acquire and hold patents and trade marks and to expend moneys on preliminary investigations.
(7) Where the Board itself manufactures and sells apparatus, machinery, or equipment under this section, the Board shall keep separate accounts in respect of such manufacture and sale and shall submit such accounts (when audited) to the Minister together with such other information in respect of such manufacture and sale as the Minister may require.
Purchase and sale of electricity outside the State.
32.—(1) The statutory powers of the Board to buy electricity in bulk and to re-sell it to individual consumers shall extend to and authorise the purchase by the Board of electricity in bulk from persons outside the State and the re-sale of such electricity to consumers within the State.
(2) The statutory powers of the Board to sell electricity in bulk shall extend to and authorise the sale of electricity in bulk to central or local authorities or other persons outside the State and the statutory powers of the Board to sell electricity to individual consumers shall extend to and authorise the sale of electricity by distribution to individual consumers outside the State.
(3) For the purpose of the exercise of all or any of the extended powers vested in the Board by virtue of the foregoing provisions of this section, it shall be lawful for the Board to do all or any of the following things, that is to say:—
(a) to enter into arrangements with central or local authorities and other persons outside the State;
(b) to construct or arrange for the construction of transmission systems and other works wholly or partially outside the State;
(c) to do all such things as shall be incidental or ancillary to the exercise of the said extended powers;
(d) to defray, wholly or partially, the costs and expenses incurred in the exercise of the said extended powers or the doing of anything authorised by this subsection.
Duties of the Board in regard to public roads and bridges.
33.—(1) Where the Board is empowered by this Act to close, divert, submerge, remove, or otherwise interfere with a public road or bridge for the purpose of the execution of any works (whether in pursuance of an approved scheme or otherwise under this Act), the following provisions shall have effect, that is to say:—
(a) where the execution of such works involves the closing of such road or bridge to traffic, the Board (unless relieved therefrom under the next following subsection of this section) shall either, as they shall think proper, construct and (while such road or bridge is so closed to traffic) maintain a temporary road or bridge sufficient to carry traffic of such quantity and character as normally uses the said closed road or bridge, or prescribe, with the consent of the Minister for Local Government and Public Health, an alternative route to be used while such road or bridge is so closed to traffic;
(b) the Board (unless relieved therefrom under the next following subsection of this section) shall, at or before the completion of the execution of such works, do whichever of the following things they shall think proper, that is to say:—
(i) restore the said closed road or bridge, or
(ii) after consultation with the Minister for Local Government and Public Health, construct a new permanent road or bridge sufficient to carry the like amount (in quantity and character) of traffic as the said closed road or bridge was, before its closure, able to carry and not substantially less convenient in gradient and curve than the said closed road or bridge, or
(iii) with the consent of the Minister for Local Government and Public Health, so improve (by reconstruction, strengthening, widening, or otherwise) an existing alternative road or bridge that it will be sufficient to carry the traffic which will be likely to use it and will not be substantially less convenient than the said closed road or bridge;
(c) where the Board constructs a permanent road and such road is, in the opinion of the Minister for Local Government and Public Health, substantially an improvement of a pre-existing road, such local authority or local authorities as the said Minister shall direct shall bear and pay to the Board such portion of the cost of the construction of such road and (in the case of two or more such authorities) in such proportions as the said Minister shall direct;
(d) where the construction of a new road by the Board involves the construction of an embankment or similar work or of a bridge and the Minister for Local Government and Public Health is of opinion that portion of the cost of the maintenance of such work or bridge (other than the road surface) should be borne by the Board, the Board shall bear and pay such portion of the said cost of maintenance as the said Minister shall direct;
(e) where the Board constructs a permanent new bridge and such bridge confers substantially greater advantages on the public of any county or urban district than the original bridge, whether by affording an improved means of communication or otherwise, the Board shall certify the cost of such new bridge and the Minister for Local Government and Public Health shall certify what part of such cost, in his opinion, ought reasonably to be borne by the council of such county or urban district, and thereupon a sum equal to the part so certified of such cost shall be raised by such council as part of the expenses of road maintenance and shall be paid by such council to the Board;
(f) if any doubt, dispute, or question shall arise as to whether the Board, in the construction or maintenance of any temporary road or bridge or the construction of any permanent road or bridge or the restoration of an existing road or bridge or the improvement of an existing alternative road or bridge (as the case may be) pursuant to this section have complied with the relevant provisions of this section, or as to whether a permanent new bridge constructed by the Board confers substantially greater advantages on the public of any county or urban district than the original bridge, such doubt, dispute, or question shall be decided by the Minister for Local Government and Public Health whose decision shall be final and conclusive.
(2) Where the Board is empowered by this Act to close, submerge, or remove permanently a public road or bridge for the purpose of the execution of any works (whether in pursuance of an approved scheme or otherwise under this Act) and the Minister, after consultation with the Minister for Local Government and Public Health, is satisfied that, having regard to all the circumstances of the case, a new road or bridge (as the case may be) in lieu of the road or the bridge so closed, submerged, or removed is not required, the Minister may by order declare that the foregoing subsection of this section shall not apply or have effect in relation to such road or bridge (as the case may be), and upon such order being made the said foregoing subsection shall not apply or have effect in relation to such road or bridge (as the case may be) and the Board shall be relieved from all obligations in relation to such road or bridge (as the case may be) which, but for such order, would be imposed on them by the said foregoing subsection.
(3) The Board may agree with the appropriate local authority for the doing by such local authority of anything which the Board is required or authorised by subsection (1) of this section to do and may further agree to make to such local authority payment for or towards the cost of the doing of such thing by such local authority.
(4) When the Board has completed in pursuance of this section the restoration of a closed road or bridge or the construction of a new permanent road or bridge or the improvement of an existing alternative road or bridge, the Board shall hand over to the appropriate local authority and such local authority shall accept the road or bridge so restored, constructed, or improved (as the case may be), and thereupon the Board shall be permanently relieved (save as is otherwise expressly provided by this section) from all liability or responsibility for the maintenance of such road or bridge (as the case may be).
Power of the Board to alter the levels of lakes, etc.
34.—From and after the completion of the works provided for by an approved scheme, it shall be lawful for the Board to control and from time to time to alter or otherwise affect, in such manner as the Board shall consider necessary for or incidental to the operation of those works, the level of any lake, pond, or other water on or connected (directly or indirectly) with the river in or on which such works are situate.
Powers and duties where acquired land is subject to a land purchase annuity, etc.
35.—Whenever the Board acquires permanently under this Act any land which is subject, either alone or in conjunction with other land, to a land purchase annuity, payment in lieu of rent, or other annual sum (not being merely rent under a contract of tenancy) payable to the Irish Land Commission or to the Commissioners of Public Works in Ireland, the Board shall, as from the date on which the Board enters on and takes possession of the land so acquired—
(a) become and be liable for the payment to the Irish Land Commission or the said Commissioners (as the case may be) of such annual sum, or such portion thereof as shall be apportioned by the Irish Land Commission or the said Commissioners (as the case may be) on such land, as if such land had been transferred to the Board by the owner thereof on that date, and
(b) be entitled, if the Board so thinks fit, to redeem such annual sum or such portion thereof as aforesaid, and
(c) be obliged, if required by the Irish Land Commission or the said Commissioners (as the case may be) so to do, to redeem such annual sum or such portion thereof as aforesaid.
Acquisition of land in lieu of payment of compensation.
36.—Whenever the Board is of opinion that the payment of compensation for the flooding of or other interference with any land under this Act would be uneconomic or for any other reason inexpedient, the Board may acquire such land permanently under this Act either by agreement or compulsorily.
Power of the Board to employ contractors.
37.—(1) Whenever the Board are authorised by this Act to execute any engineering, building, or other work whatsoever, the Board may, in lieu of executing such work themselves by their ( own officers and servants, contract with any person (in this Act referred to as a contractor) for the execution of the whole or any part of such work by such person and may for that purpose enter into such contracts and agreements as may be requisite.
(2) Whenever the Board contract under this section with any person for the execution by him of any work, the Board may, by any contract or agreement with such person, delegate to him the right to execute such work under this Act, and thereupon such person shall have, concurrently with the Board, the right to do such work and to exercise such of the powers conferred on the Board by this Act as are necessary for the purpose of doing such work and are specified in that behalf in such contract or agreement.
(3) References in this Act to the doing of any work or thing by the Board shall be construed and have effect as including the doing of such work or thing by a contractor employed and authorised in that behalf by the Board under this section.
PART VI.
Advances to the Board out of the Central Fund.
Advances to the Board by the Minister for Finance.
38.—(1) In addition to the sums which the Minister for Finance is required or authorised by the Electricity (Supply) Acts, 1927 to 1942, to advance to the Board, the Minister for Finance may, on the recommendation of the Minister, advance to the Board out of the Central Fund or the growing produce thereof as and when requested by the Board so to do such sums (subject to the limitations imposed by the next following subsection of this section) as the Board may require for any purpose arising in the performance of its functions under the Electricity (Supply) Acts, 1927 to 1942, or this Act, other than purposes or functions under this Act in respect of which express provision is made by this Act for advances or grants by the Minister for Finance to the Board.
(2) The total amount of the sums advanced to the Board under the foregoing subsection of this section shall not exceed the sum of seven million, five hundred thousand pounds, and the sum so advanced for the purpose of carrying out any particular approved scheme shall not exceed the sum prescribed in that behalf by the Minister, with the consent of the Minister for Finance, by the approval order relating to that approved scheme or by a subsequent order amending in this respect such approval order.
Provision of money for advances out of the Central Fund.
39.—(1) The Minister for Finance may, for the purpose of providing for the advance of sums out of the Central Fund under this Act or for the repayment to that Fund of all or any part of the sums so advanced or for paying off any securities issued under this section so far as such payment is not otherwise provided for, borrow money by means of the issue of such securities as he thinks proper, and all sums so borrowed shall be paid into the Exchequer.
(2) The principal of and interest on all securities issued under this section shall be charged on and payable out of the Central Fund or the growing produce thereof.
Repayment by the Board of advances out of the Central Fund.
40.—(1) Every sum advanced out of the Central Fund to the Board under this Act (other than sums which are repayable to the Central Fund out of moneys provided by the Oireachtas) shall be repayable by the Board at such times, in such manner, and with interest at such rate as shall be prescribed by the Minister for Finance, and every such sum and the interest thereon shall forthwith become and be a first charge on the works executed by the Board under this Act (including works executed by the Board in pursuance of an approved scheme) and a floating charge on all property of whatsoever kind (other than the said works so executed by the Board) from time to time vested in or owned by the Board.
(2) No floating charge created by the foregoing subsection of this section shall operate to prevent or restrict the alienation or other dealing by the Board of or with any property affected by such floating charge in the due and proper exercise or performance of the statutory powers and duties of the Board.
(3) Every charge (whether specific or floating) created by this section shall be vested in the Minister for Finance and may be enforced by that Minister in due form of law whenever he shall think proper so to do and whether any interest or any capital or instalment of capital secured by such charge is or is not due and unpaid.
(4) All moneys paid by or recovered from the Board in respect of the repayment of the capital of or the payment of the interest on a sum advanced to the Board under this section shall be paid into or disposed of for the benefit of the Exchequer at such time and in such manner as the Minister for Finance shall direct.
PART VII.
Miscellaneous.
Provision of moneys for the electrification of rural areas.
41.—(1) The Minister for Finance may, on the recommendation of the Minister, advance to the Board, as and when requested by the Board so to do, moneys not exceeding the sum of five million pounds for the electrification of rural areas.
(2) All moneys advanced to the Board under the foregoing subsection of this section shall be issued from and paid out of the Central Fund or the growing produce thereof.
(3) One moiety of the total amount of the moneys advanced to the Board under this section by the Minister for Finance shall be repaid to the Central Fund out of moneys provided by the Oireachtas at such time or times as the Minister for Finance shall direct and the other moiety of the said total amount shall be repaid by the Board.
(4) All moneys advanced to the Board by the Minister for Finance under this section shall be expended by the Board in the extension of the supply of electricity to rural areas.
Prohibition of discharge of corrosive matter.
42.—(1) It shall not be lawful for any person, save with the permission in writing of the Board and in accordance with the conditions as to time, place, and manner stated in such permission, to deposit, discharge, or allow to escape, directly or indirectly, from any land, premises, or place or any vessel in or into any river in which or on the banks of which a generating station is being constructed or operated by the Board or in or into any river or stream tributary to such river or in or into any lake or pond or any canal or other artificial water-way or any artificial water-course connected with such river any chemical or other substance (whether solid or liquid) of a nature calculated to corrode, erode, entangle, stop, break, or otherwise injure such generating station or any part thereof or any works subsidiary thereto or connected therewith.
(2) Every person who deposits, discharges, or allows to escape, directly or indirectly, in or into any river, stream, lake, pond, canal, artificial water-way, or artificial water-course any substance in contravention of the foregoing subsection of this section and the owner of the land, premises, or place or the master and also the owner of the vessel from which such substance is so deposited, discharged, or allowed to escape shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds together with, in the case of a continuing offence, a fine not exceeding twenty pounds for every day on which the offence is continued.
(3) It shall be a good defence to a charge of having committed an offence under this section to prove that the deposit, discharge, or allowing to escape which is alleged to constitute the offence took place at a point in the river below the generating station of the Board or in or into water communicating with such river only at a point below such station and that the substance alleged to have been deposited, discharged, or allowed to escape could not, having regard to the direction of flow of the water and the other circumstances, have entered or been carried into the said generating station or any part thereof.
(4) The foregoing provisions of this section shall have effect without prejudice and in addition to and not in substitution for the provisions of the Fisheries Acts, 1842 to 1944, and the provisions of the Oil on Navigable Waters Act, 1926 (No. 5 of 1926).
General power of entry on land by the Board.
43.—(1) The Board and their officers and servants and other persons authorised by the Board in this behalf shall be entitled to enter on any land for the purpose of doing thereon or on any other land all or any of the things which the Board is authorised by this Act to do or making any inquiry, investigation, or examination preliminary to the doing of any such thing.
(2) Any person who shall obstruct, prevent, or interfere with the exercise by the Board or any officer or servant of the Board or any person authorised by the Board of any power conferred on them or him by the foregoing subsection of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Protection of postal and telegraphic services.
44.—Neither the Board nor any contractor executing any works under this Act shall by virtue of this Act acquire, enter on, remove, or otherwise interfere with any lands, premises, buildings, works, plant, materials, or other property of the Minister for Posts and Telegraphs or erect any works or do any other matter or thing which, in the opinion of the Minister for Posts and Telegraphs, would obstruct, delay, hinder, or otherwise injuriously affect the due execution of the public services of the Department of Posts and Telegraphs.
Obligation of the Board to furnish reports and statistics.
45.—The report required by section 32 of the Electricity (Supply) Act, 1927 (No. 27 of 1927), to be made by the Board in each year shall extend to and include the proceedings of the Board under this Act during the year to which such report relates, and the obligation to furnish statistics and returns imposed on the Board by the said section 32 shall extend to and include statistics and returns in relation to the proceedings of the Board under this Act.
Electric lines and the laying thereof.
46.—(1) In this section the expression “the Act of 1927” means the Electricity (Supply) Act, 1927 (No. 27 of 1927).
(2) The expression “electric line” wherever it occurs in the Act of 1927 shall be construed and have effect and be deemed always to have had effect as meaning a wire or wires, conductor, or other means used for the purpose of conveying, transmitting, or distributing electricity and as including any transforming or other apparatus connected with any such wire or wires, conductor, or other means, and as including also any casing, coating, covering, tube, pipe, or insulator surrounding any such wire or wires, conductor, or other means or any such apparatus, and as including also any post, pole, stay, erection, or structure supporting any one or more of the things hereinbefore mentioned.
(3) The word “lines” wherever it occurs in subsection (1) of section 51 of the Act of 1927 shall be construed and have effect and be deemed always to have had effect as meaning electric lines as defined in the next preceding subsection of this section.
(4) The following provisions shall apply and have effect in relation to the notice required by subsection (3) of section 53 of the Act of 1927 to be served on the owner and the occupier of land or a building, that is to say:—
(a) any such notice may, in lieu of being served personally on such owner or such occupier (as the case may be), be served on him by sending such notice by prepaid post in an envelope addressed to such owner or occupier (as the case may be) at his usual or last known address; and when so sent such notice shall be deemed to be served at the time when such envelope would be delivered in the ordinary course of post;
(b) where for any reason the envelope mentioned in the next preceding paragraph of this subsection cannot be addressed in the manner provided by that paragraph, such envelope may be addressed to the person for whom it is intended in either or both of the following ways, that is to say:—
(i) by the description “the owner” or “the occupier” (as the case may be) without stating his name,
(ii) at the land or building to which the notice contained in such envelope relates.
(5) The period of fourteen days mentioned in subsections (4) and (5) of section 53 of the Act of 1927 is hereby reduced to seven days, and for that purpose the words “seven days” are hereby substituted for the words “fourteen days” wherever the latter words occur in either of the said subsections.
Amendment of section 3 of the Electricity (Supply) (Amendment) Act, 1931.
47.—So much of subsection (1) of section 3 of the Electricity (Supply) (Amendment) Act, 1931 (No. 32 of 1931), as requires that sums advanced under that section shall be advanced only on the certificate of the Minister for Industry and Commerce is hereby repealed and in lieu thereof it is hereby enacted that sums advanced under the said section shall be advanced on the recommendation of the Minister for Industry and Commerce.
Restrictions on compulsory acquisition of land held by the Board.
48.—Notwithstanding anything contained in any enactment, no person shall, without the previous consent of the Minister, acquire compulsorily any land or premises held by the Board or acquire, terminate, restrict or otherwise interfere with compulsorily any easement, wayleave or other right whatsoever over or in respect of any such land.
