Mínithe.

1.—(1) San Acht so—

cialluíonn an abairt “Acht 1941” an tAcht Rialtais Áitiúil, 1941 (Uimh. 23 de 1941);

cialluíonn an abairt “ar fionnraighe” na báill den chomhairle no den bhord no den chólucht eile, a n-úsáidtear an abairt sin ina dtaobh, do bheith curtha as oifig fé Chuid IV d'Acht 1941 no é bheith tuigthe de bhuadh ailt 51 den Acht san iad do bheith curtha as oifig amhlaidh, agus is dá réir sin a léireofar focail ghaolmhara;

cialluíonn an focal “coimisinéir” duine ar n-a cheapadh fé alt 48 d'Acht 1941 ina choimisinéir no ina dhuine de na coimisinéirí do chomhairle no do bhord no do chólucht eile bheidh ar fionnraighe;

(2) Is údarás rátaíochta chun crícheanna an Achta so gach cólucht aca so leanas, sé sin le rá:—

(a) bárdas contae-bhuirge no buirge eile,

(b) comhairle chontae,

[EN]

(c) comhairle bhailecheanntair,

[EN]

agus is dá réir sin a léireofar an abart “údarás rátaíochta” san Acht so.

(3) Chun crícheanna an Achta so, is tuigthe fionnraíocht chomhairle no búird no cóluchta eile do leanúint go dtí dáta teachta in oifig do na baill den chólucht san a toghfar i dtoghchán ar n-a chomóradh de bhun ailt 45 d'Acht 1941.

An Príomh-Acht.

2.—(1) San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht um Bainistí Chontae, 1940 (Uimh. 12 de 1940).

(2) Léireofar mar éinní amháin an tAcht so agus an Príomh-Acht agus, dá réir sin, gach abairt agus focal dá gceaptar brí áirithe leis an bPríomh-Acht chun crícheanna an Achta san tá leis san Acht so an bhrí ceaptar dó amhlaidh.

Comhacht chun a dhearbhú cóluchta áirithe do bheith ina gcó-chóluchta.

3.—(1) Féadfaidh an tAire, aon uair is oiriúnach leis é, a dhearbhú le hordú aon bhord no coiste áirithe (seachas údarás piara no cuain no coiste oideachais ghairme beatha) ar gá leath ar a laghad dá bhaill do cheapadh ag dhá údarás rátaíochta no níos mó ar leithligh do bheith ina gcó-chólucht do réir bhrí agus chun crícheanna an Phríomh-Achta.

(2) Féadfaidh an tAire, aon uair is oiriúnach leis é, aon ordú do rinne sé roimhe sin, fén bhfo-alt san roimhe seo den alt so no fén bhfo-alt so, do chúlghairm le hordú.

(3) Aon uair a dhéanfaidh an tAire ordú fé fho-alt (1) den alt so, beidh feidhm agus éifeacht ag na forálacha so leanas, faid a bheidh an t-ordú san i bhfeidhm, maidir leis an mbord no an coiste le n-a mbainfidh an t-ordú san, sé sin le rá:—

(a) beidh an bord no an coiste sin ina chó-chólucht do réir bhrí agus chun crícheanna an Phríomh-Achta fé is dá mbeadh an bord no an coiste sin luaidhte i bhfo-alt (2) d'alt 1 den Acht san, agus léireofar an Príomh-Acht agus beidh éifeacht aige maidir leis an mbord no an coiste sin dá réir sin;

(b) is tuigthe chun crícheanna an Phríomh-Achta gurb é is líomatáiste feidhmiúcháin an bhúird no an choiste sin ná líomatáiste ar n-a chó-dhéanamh de líomatáistí feidhmiúcháin fé seach na n-údarás rátaíochta uile agus fé seach ar gá gurb iad a thoghfadh leath ar a laghad de bhaill an bhúird no an choiste sin;

(c) má thárlann, ar dháta an orduithe sin, gur údarás áitiúil do réir bhrí agus chun crícheanna ailt 72 den Acht Rialtais Áitiúla, 1925 (Uimh. 5 de 1925), an bord no an coiste sin de bhuadh aon achtacháin a bheidh i bhfeidhm an tráth san, beidh an bord no an coiste sin ina údarás áitiúil do réir bhrí agus chun crícheanna Coda IV d'Acht 1941, agus beidh feidhm agus éifeacht dá réir sin ag an gCuid sin den Acht san maidir leis an mbord no an coiste sin.

(4) Gach ordú dhéanfaidh an tAire fé fho-alt (1) den alt so maidir le bord no coiste atá ar marthain ar dháta an Achta so do rith—

(a) leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus a bheidh caothúil tar éis a dhéanta, agus

[EN]

(b) féadfar é chur ar nea-mbrí ag ceachtar Tigh aca san tré rún ar n-a rith fé cheann an lá is fiche shuidhfidh an Tigh sin tar éis an orduithe sin do leagadh fé n-a bhráid, agus

(c) tiocfa sé i bhfeidhm (mara gcuirtear ar nea-mbrí amhlaidh é) ar bheith caithte don tréimhse gur fé n-a ceann a féadfar é chur ar nea-mbrí amhlaidh no, i gcás dáta do luadh san ordú san chun é theacht i bhfeidhm, ar an dáta san no ar bheith caithte don tréimhse sin, pé aca is déanaighe.

Alt 4 den Phríomh-Acht do leasú.

4.—(1) Maidir leis an gcéad chontae-bhainisteoir do chontae, no do gach ceann fé leith de dhá chontae ghrúpálta, do cheapadh, déanfaidh na Coimisinéirí um Cheapacháin Áitiúla, agus iad ag cólíonadh forálacha fo-ailt (3) d'alt 4 den Phríomh-Acht, áird do thabhairt freisin ar na forálacha ina dhiaidh seo den fho-alt so agus, sa mhéid go bhfuil na forálacha san ina dhiaidh seo buiniscionn le forálacha an fho-ailt sin (3), cólíonfaidh na Coimisinéirí sin na forálacha san ina dhiaidh seo i gcás inar infheidhmithe do na forálacha san, sé sin le rá:—

(a) mara ndéantar éinne do mholadh de bhun míre (a) den fho-alt san (3) agus go mbeidh cólucht amháin no níos mó aca so leanas, sé sin le rá, i gcás an chéad chontae-bhainisteora do chontae aonair, comhairle na contae sin no an bord sláinte do cheanntar shláinte chontae sa chontae sin no, i gcás an chéad chontae-bhainisteora do gach ceann fé leith de dhá chontae ghrúpálta, comhairle cheachtar de na contaethe sin no an bord sláinte do cheanntar shláinte chontae i gceachtar de na contaethe sin, ar fionnraighe le linn an Achta so do rith, ansan agus sa chás san, mara mbeidh ach coimisinéir amháin don chólucht, no do chólucht amháin no níos mó de na cóluchta, bheidh ar fionnraighe amhlaidh ina choimisinéir láithreach agus é ina iarrthóir agus é oiriúnach, molfaidh na Coimisinéirí sin an coimisinéir sin, no má bhíonn beirt daoine no níos mó, a mbeidh gach duine aca ina choimisinéir láithreach do chólucht amháin no níos mó de na cóluchta bheidh ar fionnraighe amhlaidh, ina n-iarrthóirí agus iad oiriúnach molfaidh na Coimisinéirí sin an duine sin díobh a mheasfaid is oiriúnaighe;

(b) mara ndéantar éinne do mholadh de bhun míre (a) den fho-alt san (3) ná de bhun na míre sin roimhe seo den fho-alt so, bhéarfaidh na Coimisinéirí sin áird ar mhír (b) den fho-alt san (3) agus (má bhaineann sí leis an gcás) déanfaid dá réir;

(c) mara ndéantar éinne do mholadh de bhun míreanna (a) no (b) den fho-alt san (3) ná míre (a) den fho-alt so agus go mbeidh duine is coimisinéir láithreach (seachas coimisinéir láithreach le n-a mbainfidh mír (a) den fho-alt so) ina iarrthóir agus é oiriúnach, déanfaidh na Coimisinéirí sin, i gcás gan ach duine amháin den tsórt san do bheith ina iarrthóir agus é oiriúnach, an duine sin do mholadh no, i gcás beirt no níos mó daoine den tsórt san do bheith ina n-iarrthóirí agus iad oiriúnach, an duine sin díobh a mheasfaid is oiriúnaighe do mholadh;

(d) mara ndéantar éinne do mholadh de bhun míreanna (a) no (b) den fho-alt san (3) ná aon mhíre aca san roimhe seo den fho-alt so, bhéarfaidh na Coimisinéirí sin áird ar mhír (c) den fho-alt san (3) agus (má bhaineanna sí leis an gcás) déanfaid dá réir;

(e) mara ndéantar éinne do mholadh de bhun míreanna (a), (b), no (c) den fho-alt san (3) ná aon mhíre aca san roimhe seo den fho-alt so, bhéarfaidh na Coimisinéirí sin áird ar mhír (d) den fho-alt san (3) agus déanfaid dá réir.

(2) Chun na gCoimisinéirí um Cheapacháin Áitiúla do roghnú duine, de bhun fo-ailt (3) d'alt 4 den Phríomh-Acht ar n-a leasú leis an alt so, chun iad dá mholadh chun a cheaptha ina chéad chontae-bhainisteoir do chontae no do gach ceann fé leith de dhá chontae ghrúpálta, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—

(a) ní tuigthe duine ar bith do bheith ina rúnaidhe contae do chontae ach an duine (más ann) arb é buanrúnaidhe contae na contae sin é ar dháta an Achta so do rith agus arb é an buan-rúnaidhe sin fós é le linn an roghnuithe sin, ach amháin, i gcás an duine (más ann) arb é an buan-rúnaidhe contae do chontae é ar dháta an Achta so do rith, gur tuigthe chun crícheanna an roghnuithe sin, maidir le hoifig an chéad chontae-bhainisteora don chontae sin no do gach ceann fé leith de dhá chontae ghrúpálta ar ceann aca an chontae sin, gurb é rúnaidhe contae na contae sin é má bhíonn sé, le linn an roghnuithe sin (agus scurtha aige an tráth san de bheith ina bhuanrúnaidhe chontae den tsórt san), i seilbh oifige fé aon chólucht is údarás áitiúil chun crícheanna na nAchtanna Rialtais Áitiúil, 1925 go 1941;

(b) ní tuigthe duine ar bith do bheith ina rúnaidhe do bhord sláinte cheanntair shláinte chontae ach an duine (más ann) arb é an buan-rúnaidhe don bhord san é ar dháta an Achta so do rith agus arb é an buanrúnaidhe sin fós é le linn an roghnuithe sin, ach amháin, i gcás an duine (más ann) arb é an buanrúnaidhe é don bhord sláinte do cheanntar shláinte chontae ar dháta an Achta so do rith, gur tuigthe chun crícheanna an roghnuithe sin, maidir le hoifig an chéad chontae-bhainisteora don chontae ina bhfuil an ceanntar sláinte contae sin no do gach ceann fé leith den dá chontae ghrúpálta ar ceann aca an chontae sin, gurb é an rúnaidhe don bhord sláinte sin é má bhíonn sé, le linn an roghnuithe sin (agus scurtha aige an tráth san de bheith ina bhuanrúnaidhe den tsórt san), i seilbh oifige fé aon chólucht is údarás áitiúil chun crícheanna na nAchtanna Rialtais Áitiúil, 1925 go 1941.

Forálacha i gcás na baill de chomhairle chontae do chur as oifig.

5.—(1) Má thárlann, le linn teacht i bhfeidhm don Phríomh Acht, comhairle chontae (seachas contae Bhaile Atha Cliath) do bheith ar fionnraighe, beidh éifeacht ag na forálacha so leanas maidir leis an gcontae sin, sé sin le rá:—

(a) ní bheidh feidhm ná éifeacht ag alt 90 d'Acht 1941 maidir le ceapadh an chéad chontae-bhainisteora don chontae sin, agus achtuítear leis seo ina ionad san go bhféadfar roghnú agus moladh duine fé alt 4 den Phríomh-Acht, chun a cheaptha chun na hoifige sin, do thionnscnamh agus do chríochnú sara mbeidh deireadh le fionnraíocht chomhairle na contae sin, ach an lá cheapfaidh an tAire fé fho-alt (2) den alt san 4 mar lá gur amhail air agus uaidh a thiocfaidh an duine molfar amhlaidh chun bheith ceaptha ina chéad chontae-bhainisteoir don chontae sin ní bheidh sé níos luaithe ná an lá ar a raghaidh an fhionnraíocht san in éag;

(b) ní bheidh níos mó ná coimisinéir amháin ann don chomhairle sin aon tráth áirithe faid a mhairfidh an fhionnraíocht san;

(c) an duine is coimisinéir de thurus na huaire don chomhairle sin le linn na fionnraíochta san beidh sé freisin ina chontae-bhainisteoir don chontae sin, agus is tuigthe é do cheapadh ina chontae-bhainisteoir don chontae sin ag an Aire fé fho-alt (5) d'alt 4 den Phríomh-Acht agus dá réir sin ní hé is céad chontae-bhainisteoir don chontae sin do réir bhrí an Phríomh-Achta ná an Achta so;

(d) más ceann de dhá chontae ghrúpálta an chontae sin, ní bheidh feidhm ná éifeacht ag fo-alt (2) d'alt 3 den Phríomh-Acht (ar gá dá réir gurb é an t-aon duine amháin a bheidh ina chontae-bhainisteoir do gach ceann fé leith de dhá chontae ghrúpálta) maidir leis an dá chontae ghrúpálta san le linn na fionnraíochta san;

(e) an luach saothair is iníoctha leis an gcoimisinéir do chomhairle na contae sin fé fho-alt (2) d'alt 50 d'Acht 1941 is tuigthe, le linn na fionnraíochta san, é d'fholú a luach saothair alos a dhualgas mar chontaebhainisteoir don chontae sin, agus ní bheidh aon luach saothair breise iníoctha leis alos na ndualgas san fén bhfo-alt san (2) ná fé alt 5 den Phríomh-Acht;

(f) más gá, de dhruim forála den Phríomh-Acht no orduithe ar n-a dhéanamh fén Acht san, contaebhainisteoir conganta do cheapadh don chontae sin no do chontae bheidh in aon-ghrúpa leis an gcontae sin, ní bheidh feidhm ná éifeacht ag alt 90 d'Acht 1941 maidir le ceapadh an chéad chontae-bhainisteora chonganta san, agus achtuítear leis seo ina ionad san go bhféadfar roghnú agus moladh duine fé alt 12 den Phríomh-Acht, chun a cheaptha chun na hoifige sin, do thionnscnamh agus do chríochnú sara mbeidh deireadh le fionnraíocht chomhairle na contae sin, ach an lá cheapfaidh an tAire fé mhír (b) d'fho-alt (3) den alt san 12 mar lá gur amhail air agus uaidh a thiocfaidh an duine molfar amhlaidh chun bheith ceaptha ina chéad chontae-bhainisteoir conganta don chontae sin ní bheidh sé níos luaithe ná an lá ar a raghaidh an fhionnraíocht san in éag.

(2) Má thárlann, le linn teacht i bhfeidhm don Phríomh-Acht, comhairle chontae amháin de dhá chontae grúpálta do bheith ar fionnraighe agus gan comhairle an chinn eile de na contaethe sin do bheith ar fionnraighe, beidh feidhm agus éifeacht ag na forálacha so leanas maidir leis an gceann de na contaethe sin nach ar fionnraighe dá comhairle, sé sin le rá:—

(a) ní bheidh feidhm ná éifeacht ag alt 90 d'Acht 1941 maidir le ceapadh an chéad chontae-bhainisteora don chontae sin nach ar fionnraighe dá comhairle, agus achtuítear leis seo ina ionad san go bhféadfar roghnú agus moladh an duine sin fé alt 4 den Phríomh-Acht, chun a cheaptha chun na hoifige sin, do thionnscnamh agus do chríochnú sara mbeidh deireadh le fionnraíocht chomhairle an chinn eile de na contaethe sin, ach an lá cheapfaidh an tAire fé fho-alt (2) den alt san 4 mar lá gur amhail air agus uaidh a thiocfaidh an duine molfar amhlaidh chun bheith ceaptha ina chéad chontae-bhainisteoir don chontae sin ní bheidh sé níos luaithe ná an lá ar a raghaidh an fhionnraíocht san in éag;

(b) ceapfaidh an tAire, fé fho-alt (5) d'alt 4 den Phríomh-Acht, duine chun bheith ina chontae-bhainisteoir don chontae sin, nach ar fionnraighe dá comhairle, go dtí go gceapfar an chéad chontae-bhainisteoir don chontae sin.

(3) D'ainneoin éinní atá in alt 70 den Acht Rialtais Aitúla, 1925 (Uimh. 5 de 1925), féadfar coimisinéir is ball, no ba bhall tráth, de chólucht is fo-chólucht (do réir bhrí Choda IV d'Acht 1941) den chólucht a bhfuil an coimisinéir sin ina choimisinéir dó no ina dhuine de na coimisinéirí dhó do cheapadh chun oifige agus féadfaidh bheith i seilbh oifige an chéad chontae-bhainisteora no aon chontae-bhainisteora eile no an chéad chontae-bhainisteora chonganta no aon chontae-bhainisteora chonganta eile do chontae no do gach ceann fé leith de dhá chontae ghrúpálta no oifige Bainisteora Chathrach Chonganta Bhaile Atha Cliath.

Forálacha i gcás na baill de chólucht toghaidhe do chur as oifig.

6.—I gcás cólucht toghaidhe, ná fuil aon chuid dá líomatáiste feidhmiúcháin laistigh de chontae Bhaile Atha Cliath, do bheith ar fionnraighe le linn teacht i bhfeidhm don Phríomh-Acht, déanfaidh an coimisinéir no na coimisinéirí don chólucht toghaidhe sin feidhmeanna comhallacha an chóluchta thoghaidhe sin. chó maith le feidhmeanna forcoimeádta an chóluchta san. d'fheidhmiú agus do chólíonadh ar feadh na fionnraíochta san. agus ní dhéanfaidh an contae-bhainisteoir a mbeadh na feidhmeanna comhallacha san aige mara mbeadh an t-alt so iad d'fheidhmiú ná do chólíonadh faid a mhairfidh an fhionnraíocht san.

Forálacha i dtaobh contae Bhaile Atha Cliath.

7.—(1) I gcás comhairle chontae Bhaile Atha Cliath do bheith ar fionnraighe le linn teacht i bhfeidhm don Phríomh-Acht, déanfaidh an coimisinéir no na coimisinéirí don chontae sin feidhmeanna comhallacha na comhairle sin, chó maith le n-a feidhmeanna foircoimeádta, d'fheidhmiú agus do chólíonadh ar feadh na fionnraíochta san, agus ní dhéanfaidh Bainisteoir Contae Bhaile Atha Cliath na feidhmeanna comhallacha san d'fheidhmiú ná do chólíonadh faid a mhairfidh an fhionnraíocht san.

(2) I gcás cólucht toghaidhe, a bhfuil a líomatáiste feidhmiúcháin go léir no cuid de laistigh do chontae Bhaile Atha Cliath, do bheith ar fionnraighe le linn teacht i bhfeidhm don Phríomh-Acht, déanfaidh an coimisinéir no na coimisinéirí don chólucht toghaidhe sin feidhmeanna comhallacha an chóluchta thoghaidhe sin, chó maith le feidhmeanna forcoimeádta an chóluchta san, d'fheidhmiú agus do chólíonadh ar feadh na fionnraíochta san, agus ní dhéanfaidh an bainisteoir a mbeadh na feidhmeanna comhallacha san aige mara mbeadh an t-alt so iad d'fheidhmiú ná do chólíonadh faid a mhairfidh an fhionnraíocht san.

(3) An íocaíocht is iníoctha ag comhairle chontae Bhaile Atha Cliath le Bárdas Bhaile Atha Cliath fé fho-alt (3) d'alt 14 den Phríomh-Acht i leith aon bhliana airgeadais áitiúla, a mbeidh aon cheann no an dá cheann de na fo-ailt sin roimhe seo i bhfeidhm le n-a linn no le linn aon choda dhi, laghdófar í an méid sin a chinnfidh an tAire do bheith réasúnach.

COUNTY MANAGEMENT (AMENDMENT) ACT, 1942.


AN ACT TO AMEND THE COUNTY MANAGEMENT ACT, 1940, IN CERTAIN RESPECTS. [25th June, 1942.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Definitions.

1.—(1) In this Act—

the expression “the Act of 1941” means the Local Government Act, 1941 (No. 23 of 1941);

[GA]

the word “suspended” means that the members of the council, board, or other body, in respect of which that word is used are removed from office under Part IV of the Act of 1941 or are deemed by virtue of section 51 of that Act to be so removed, and cognate words shall be construed accordingly;

[GA]

the word “commissioner” means a person appointed under section 48 of the Act of 1941 to be the commissioner or one of the commissioners for a suspended council, board, or other body;

[GA]

the expression “existing commissioner” means a person who is a sole commissioner at the passing of this Act.

[GA]

(2) Each of the following bodies, that is to say:—

[GA]

(a) the corporation of a county or other borough,

[GA]

(b) the council of a county,

[GA]

(c) the council of an urban district,

[GA]

shall be a rating authority for the purposes of this Act, and the expression “rating authority” shall, in this Act, be construed accordingly.

[GA]

(3) For the purposes of this Act, the suspension of a council, board, or other body shall be deemed to continue until the date of the coming into office of the members of such body elected at an election held in pursuance of section 45 of the Act of 1941.

The Principal Act.

2.—(1) In this Act the expression “the Principal Act” means the County Management Act, 1940 (No. 12 of 1940).

(2) This Act shall be construed as one with the Principal Act, and accordingly every expression and word to which a particular meaning is assigned by the Principal Act for the purposes of that Act shall have that meaning in this Act.

Power to declare certain bodies to be joint bodies.

3.—(1) The Minister may by order, whenever he so thinks fit, declare any particular board or committee (other than a pier or harbour authority or a vocational education committee), not less than half the members of which are required to be appointed by two or more rating authorities severally, to be a joint body within the meaning and for the purposes of the Principal Act.

(2) The Minister may by order, whenever he so thinks fit, revoke any order previously made by him under the foregoing sub-section of this section or under this sub-section.

(3) Whenever the Minister makes an order under sub-section (1) of this section, the following provisions shall, so long as such order continues in force, apply and have effect in relation to the board or committee to which such order relates, that is to say:—

(a) such board or committee shall be a joint body within the meaning and for the purposes of the Principal Act as if such board or committee were mentioned in sub-section (2) of section 1 of that Act, and the Principal Act shall be construed and have effect in relation to such board or committee accordingly;

[GA]

(b) the functional area of such board or committee shall, for the purposes of the Principal Act, be deemed to be the area consisting of the respective functional areas of the several rating authorities by which not less than half the members of such board or committee are required to be appointed;

[GA]

(c) if, at the date of such order, such board or committee is by virtue of any enactment then in force a local authority within the meaning and for the purposes of section 72 of the Local Government Act, 1925 (No. 5 of 1925), such board or committee shall be a local authority within the meaning and for the purposes of Part IV of the Act of 1941, and that Part of that Act shall apply and have effect in relation to such board or committee accordingly.

(4) Every order made by the Minister under sub-section (1) of this section in respect of a board or committee which is in existence at the passing of this Act—

[GA]

(a) shall be laid before each House of the Oireachtas as soon as conveniently may be after it is made, and

[GA]

(b) may be annulled by either such House by resolution passed within the next twenty-one days on which that House has sat after such order is laid before it, and

[GA]

(c) shall (unless so annulled) come into force at the expiration of the time within which it may be so annulled or, where a date is specified in such order for its coming into force, on that date or at the said expiration, whichever is the later.

Amendment of section 4 of the Principal Act.

4.—(1) In relation to the appointment of the first county manager for a county or for each of two grouped counties, the Local Appointments Commissioners shall, when complying with the provisions of sub-section (3) of section 4 of the Principal Act, have regard also to the subsequent provisions of this sub-section and, in so far as the said subsequent provisions are inconsistent with the provisions of the said sub-section (3), the said Commissioners shall comply with the said subsequent provisions where those provisions are applicable, that is to say:—

(a) if no person is recommended in pursuance of paragraph (a) of the said sub-section (3) and one or more of the following bodies, that is to say, in the case of the first county manager for a single county, the council of such county or the board of health of a county health district in such county or, in the case of the first county manager for each of two grouped counties, the council of either of such counties or the board of health of a county health district in either of such counties, is suspended at the passing of this Act, then and in that case, if only one commissioner for the body or one or more of the bodies so suspended is an existing commissioner and a candidate and suitable, the said Commissioners shall recommend that commissioner, or if two or more persons, each of whom is an existing commissioner for one or more of the bodies so suspended are candidates and suitable, the said Commissioners shall recommend whichever of those persons they consider to be the most suitable;

(b) if no person is recommended in pursuance of paragraph (a) of the said sub-section (3) or in pursuance of the foregoing paragraph of this sub-section, the said Commissioners shall have regard to and (if applicable) comply with paragraph (b) of the said sub-section (3);

[GA]

(c) if no person is recommended in pursuance of paragraphs (a) or (b) of the said sub-section (3) or paragraph (a) of this sub-section and a person who is an existing commissioner (other than an existing commissioner to whom paragraph (a) of this sub-section applies) is a candidate and suitable, the said Commissioners shall, if only one such person is a candidate and suitable, recommend that person or, if two or more such persons are candidates and suitable, recommend whichever of those persons they consider to be the most suitable;

(d) if no person is recommended in pursuance of paragraphs (a) or (b) of the said sub-section (3) or any of the foregoing paragraphs of this sub-section, the said Commissioners shall have regard to and (if applicable) comply with paragraph (c) of the said sub-section (3);

(e) if no person is recommended in pursuance of paragraphs (a), (b), or (c) of the said sub-section (3) or any of the foregoing paragraphs of this sub-section, the said Commissioners shall have regard to and comply with paragraph (d) of the said sub-section (3).

(2) For the purposes of the selection by the Local Appointments Commissioners, in pursuance of sub-section (3) of section 4 of the Principal Act as amended by this section, of a person to be recommended by them for appointment to the office of the first county manager for a county or for each of two grouped counties, the following provisions shall have effect, that is to say:—

(a) no person shall be taken to be the county secretary of a county except the person (if any) who is the permanent county secretary of such county at the passing of this Act and is still such permanent county secretary at the time of such selection, save that the person (if any) who is the permanent county secretary of a county at the passing of this Act shall, for the purposes of such selection in relation to the office of the first county manager for that county or for each of two grouped counties of which that county is one, be deemed to be the county secretary of that county if, at the time of such selection (having then ceased to be such permanent county secretary), he holds an office under any body which is a local authority for the purposes of the Local Government Acts, 1925 to 1941;

[GA]

(b) no person shall be taken to be the secretary to the board of health of a county health district except the person (if any) who is the permanent secretary to such board at the passing of this Act and is still such permanent secretary at the time of such selection, save that the person (if any) who is.the permanent secretary to the board of health for a county health district at the passing of this Act shall, for the purposes of such selection in relation to the office of the first county manager for the county in which such county health district is situate or for each of two grouped counties of which that county is one, be deemed to be the secretary to such board of health if, at the time of such selection (having then ceased to be such permanent secretary), he holds an office under any body which is a local authority for the purposes of the Local Government Acts, 1925 to 1941.

Provisions where the members of a county council are removed from office.

5.—(1) Where, at the commencement of the Principal Act, the council of a county (other than the county of Dublin) is suspended, the following provisions shall have effect in relation to that county, that is to say;—

(a) section 90 of the Act of 1941 shall not apply or have effect in relation to the appointment of the first county manager for the said county, and in lieu thereof it is hereby enacted that the selection and recommendation under section 4 of the Principal Act of a person for such appointment may be proceeded with and completed before the suspension of the council of the said county has ceased, but the day appointed by the Minister under sub-section (2) of the said section 4 as the day as on and from which the person so recommended becomes appointed to the office of such first county manager shall not be prior to the day on which such suspension ceases;

(b) there shall not be more than one commissioner for such council at any one time while such suspension continues;

[GA]

(c) the person who is for the time being the commissioner for such council during such suspension shall also be the county manager for the said county and shall be deemed to have been appointed to be such county manager by the Minister under sub-section (5) of section 4 of the Principal Act and accordingly shall not be the first county manager for the said county within the meaning of the Principal Act or this Act;

(d) if the said county is one of two grouped counties, sub-section (2) of section 3 of the Principal Act (which requires one and the same person to be county manager for each of two grouped counties) shall not apply or have effect in relation to the said two grouped counties during such suspension;

[GA]

(e) the remuneration payable to the commissioner for the council of the said county under sub-section (2) of section 50 of the Act of 1941 shall, during such suspension, be deemed to include his remuneration in respect of his duties as county manager for that county, and no additional remuneration shall be payable to him in respect of those duties under the said sub-section (2) or under section 5 of the Principal Act;

(f) if, by reason of a provision of the Principal Act or an order made under that Act, an assistant county manager is required to be appointed for the said county or for a county included in a group with the said county, section 90 of the Act of 1941 shall not apply or have effect in relation to the appointment of such first assistant county manager, and in lieu thereof it is hereby enacted that the selection and recommendation under section 12 of the Principal Act of a person for such appointment may be proceeded with and completed before the suspension of the council of the said county has ceased, but the day appointed by the Minister under paragraph (b) of sub-section (3) of the said section 12 as the day as on and from which the person so recommended becomes appointed to the office of such first assistant county manager shall not be prior to the day on which such suspension ceases.

(2) Where, at the commencement of the Principal Act the council of one of two grouped counties is suspended and the council of the other of those counties is not suspended, the following provisions shall apply and have effect in relation to that one of the said counties the council of which is not suspended, that is to say:—

(a) section 90 of the Act of 1941 shall not apply or have effect in relation to the appointment of the first county manager for the said county the council of which is not suspended, and in lieu thereof it is hereby enacted that the selection and recommendation under section 4 of the Principal Act of a person for such appointment may be proceeded with and completed before the suspension of the council of the other of the said counties has ceased, but the day appointed by the Minister under sub-section (2) of the said section 4 as the day as on and from which the person so recommended becomes appointed to the office of such first county manager shall not be prior to the day on which such suspension ceases;

(b) the Minister shall appoint, under sub-section (5) of section 4 of the Principal Act, a person to be the county manager for the said county of which the council is not suspended until the first county manager for that county has been appointed.

[GA]

(3) A commissioner who is or has been a member of a body which is a subsidiary body (within the meaning of Part IV of the Act of 1941) of the body for which such commissioner is the commissioner or one of the commissioners may, notwithstanding anything contained in section 70 of the Local Government Act, 1925 (No. 5 of 1925), be appointed to and hold the office of the first or any other county manager or assistant county manager for a county or each of two grouped counties, or the office of Dublin Assistant City Manager.

Provisions where the members of an elective body are removed from office.

6.—Where, at the commencement of the Principal Act, an elective body no part of whose functional area is within the county of Dublin, is suspended, the commissioner or commissioners for such elective body shall, during such suspension, exercise and perform the executive functions of such elective body as well as the reserved functions of that body, and the county manager who, but for this section, would have those executive functions shall not exercise or perform them so long as such suspension continues.

Provisions in respect of Dublin county.

7.—(1) If, at the commencement of the Principal Act, the council of the county of Dublin is suspended, the commissioner or commissioners for that county shall, during such suspension, exercise and perform the executive functions of the said council as well as the reserved functions thereof, and the Dublin County Manager shall not exercise or perform the said executive functions so long as such suspension continues.

(2) Where, at the commencement of the Principal Act, an elective body whose functional area is wholly or partly within the county of Dublin is suspended, the commissioner or commissioners for such elective body shall, during such suspension, exercise and perform the executive functions of such elective body as well as the reserved functions of that body, and the manager who, but for this section, would have those executive functions shall not exercise or perform them so long as such suspension continues.

(3) The payment to be made by the council of the county of Dublin to the Corporation of Dublin under sub-section (3) of section 14 of the Principal Act in respect of any local financial year during which, or any part of which, either or both of the foregoing sub-sections is operative shall be reduced by such amount as the Minister shall determine to be reasonable.

Short title and collective citation.

8.—(1) This Act may be cited as the County Management (Amendment) Act, 1942.

(2) The Principal Act and this Act may be cited together as the County Management Acts, 1940 and 1942.
