1.—(1) San Acht seo ciallaíonn “an Príomh-Acht” an tAcht um Iompar ar Bhóithre, 1933 (Uimh. 8 de 1933), arna leasú leis an Acht um Iompar ar Bhóithre, 1934 (Uimh. 17 de 1934), leis an Acht um Iompar ar Bhóithre, 1935 (Uimh. 23 de 1935), le Cuid VII den Acht Iompair, 1944 (Uimh. 21 de 1944), agus leis an Acht Iompair (Forála Ilghnéitheacha), 1955 (Uimh. 21 de 1955).

(2) Forléireofar an tAcht seo agus an Príomh-Acht mar aon ní amháin.

Iompar marsantais i bhfeithicil fruilithe.

2.—(1) Má déantar feithicil inneallghluaiste d'fhruiliú (ach amháin faoi chomhaontú fruilcheannaigh do réir bhrí an Achta Fost-Cheannaigh, 1946 (Uimh. 16 de 1946)) agus go n-úsáidfear í, le linn tréimhse an fhruilithe, chun marsantas d'iompar, nó chun feithicil ina bhfuil marsantas a tharraingt, measfar gnó iompair marsantais de bhóthar a bheith ar siúl ag fruilitheoir na feithicle agus an marsantas a bheith á iompar aige i gcúrsa an ghnótha sin.

(2) Ní bheidh feidhm ag an alt seo maidir le húsáid sealadach feithicle a bheas fruilithe ag únaer cláraithe feithicle dá samhail, in ionad a fheithicle féin—

(a) chun a earraí féin d'iompar,

ROAD TRANSPORT ACT, 1956.


AN ACT TO AMEND THE ROAD TRANSPORT ACT, 1933, IN RELATION TO THE CARRIAGE OF MERCHANDISE IN HIRED VEHICLES. [26th April, 1956.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

The Principal Act.

1.—(1) In this Act “the Principal Act” means the Road Transport Act, 1933 (No. 8 of 1933), as amended by the Road Transport Act, 1934 (No. 17 of 1934), the Road Transport Act, 1935 (No. 23 of 1935), Part VII of the Transport Act, 1944 (No. 21 of 1944), and the Transport (Miscellaneous Provisions) Act, 1955 (No. 21 of 1955).

(2) This Act shall be construed as one with the Principal Act.

Carriage of merchandise in hired vehicle.

2.—(1) Where a mechanically propelled vehicle is hired (except under a hire-purchase agreement within the meaning of the Hire Purchase Act, 1946 (No. 16 of 1946)) and, during the period of hire, is used for the carriage of, or for drawing a vehicle containing, merchandise, the hirer of the vehicle shall be deemed to be carrying on a merchandise road transport business and to be carrying the merchandise in the course of that business.

(2) This section shall not apply to the temporary use of a vehicle hired by the registered owner of a similar vehicle, in substitution for his own vehicle, for—

(a) the carriage of his own goods,

[GA]

(b) the delivery to his customers of merchandise normally supplied by him in the course of his trade or business, or

[GA]

(c) the delivery to and collection from customers of merchandise which is to be or has been repaired, cleaned, laundered or dyed by him in the normal course of his trade or business,

provided that his own vehicle is not capable of being used for such purposes solely because of the need for repair or overhaul.

Short title.

3.—This Act may be cited as the Road Transport Act, 1956.
