AN ACT TO PROVIDE FOR THE ESTABLISHMENT OF AN AUTHORITY TO BE KNOWN AS THE EASTERN REGIONAL HEALTH AUTHORITY, THREE BOARDS TO BE KNOWN RESPECTIVELY AS THE NORTHERN AREA HEALTH BOARD, THE EAST COAST AREA HEALTH BOARD AND THE SOUTH-WESTERN AREA HEALTH BOARD AND AN EXECUTIVE TO BE KNOWN AS THE HEALTH BOARDS EXECUTIVE AND TO DEFINE THEIR FUNCTIONS, TO PROVIDE FOR THE DISSOLUTION OF THE EASTERN HEALTH BOARD AND TO AMEND THE HEALTH ACT, 1970, THE HEALTH (AMENDMENT) (NO. 3) ACT, 1996, AND TO AMEND SECTION 6 OF THE HEALTH (CORPORATE BODIES) ACT, 1961, AND CERTAIN OTHER ENACTMENTS AND TO PROVIDE FOR RELATED MATTERS. PART I

Preliminary

[GA]

Short title, collective citation and construction.

1.—(1) This Act may be cited as the Health (Eastern Regional Health Authority) Act, 1999.

(2) The Health Acts, 1947 to 1996, the Health (Provision of Information) Act, 1997, and this Act may be cited together as the Health Acts, 1947 to 1999, and shall be construed together as one.

[GA]

Interpretation.

2.—(1) In this Act —

[GA]

“the Act of 1993” means the Comptroller and Auditor General (Amendment) Act, 1993;

[GA]

“the Authority” means the Eastern Regional Health Authority established under section 7;

[GA]

“Dublin Corporation” means the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin;

[GA]

“establishment day” means the day appointed by the Minister under section 3 to be the establishment day;

[GA]

“executive function” shall be construed in accordance with section 4 (as amended by section 24) of the No. 3 Act of 1996;

[GA]

“functions” includes powers and duties, and reference to the performance of functions includes, as respects powers and duties, reference to the exercise of the powers and the performance of the duties;

[GA]

“local authority” means—

[GA]

(a) in the case of an administrative county, the council of the county, and

[GA]

(b) in the case of a county borough, the corporation of the county borough;

[GA]

“local electoral area” has the meaning assigned to it by section 13 of the Local Government Act, 1994;

[GA]

“member of the staff” includes an officer and servant;

[GA]

“the Minister” means the Minister for Health and Children;

[GA]

“the No. 3 Act of 1996” means the Health (Amendment) (No. 3) Act, 1996;

[GA]

“prescribed” means prescribed by regulations made by the Minister;

[GA]

“the Principal Act” means the Health Act, 1970;

[GA]

“recognised trade unions and associations” means the trade unions and staff associations recognised by the Authority for the purpose of negotiations which are concerned with the transfers of staff to the Authority as well as remuneration, conditions of employment or working conditions of officers and servants of the Authority;

[GA]

“registered dentist” means a person whose name is entered in the Register of Dentists, other than a person temporarily registered under section 28 of the Dentists Act, 1985;

[GA]

“registered dispensing chemist and druggist” means a person whose name is entered in the register of dispensing chemists and druggists maintained by the Pharmaceutical Society of Ireland;

[GA]

“registered medical practitioner” means person whose name is registered in the General Register of Medical Practitioners, other than a person provisionally registered under section 28 of the Medical Practitioners Act, 1978, or temporarily registered under section 29 of the Medical Practitioners Act, 1978;

[GA]

“registered nurse” means a person whose name is entered in the register of nurses maintained by An Bord Altranais under section 27 of the Nurses Act, 1985;

[GA]

“registered pharmaceutical chemist” means a person whose name is entered in the register of pharmaceutical chemists maintained by the Pharmaceutical Society of Ireland;

[GA]

“registered psychiatric nurse” means a person whose name is entered in the psychiatric division of the register of nurses maintained by An Bord Altranais under section 27 of the Nurses Act, 1985;

[GA]

“reserved function” has the meaning assigned to it by the No. 3 Act of 1996 (as amended by section 24);

[GA]

“services” means health and personal social services which may be provided by a health board;

[GA]

“voluntary body” means a voluntary body which provides or proposes to provide a service similar or ancillary to a service that a health board may provide;

[GA]

“voluntary hospital” means a hospital which is substantially funded by means of an arrangement with the Authority or an Area Health Board under section 10 and the governing body of which is not the Authority or an Area Health Board or any committee of those;

[GA]

“voluntary intellectual disability service provider” means a provider of intellectual disability services which is substantially funded by means of an arrangement with the Authority or an Area Health Board under section 10 and the governing body of which is not the Authority or an Area Health Board or any committee of those;

[GA]

“voluntary service provider” means a voluntary body which provides a service by arrangement with the Authority or an Area Health Board in accordance with section 10.

[GA]

(2) In this Act—

[GA]

(a) a reference to a section or Schedule is to a section of, or Schedule to, this Act, unless it is indicated that reference to some other enactment is intended,

[GA]

(b) a reference to a subsection, paragraph or subparagraph is to the subsection, paragraph or subparagraph of the provision in which the reference occurs, unless it is indicated that reference to some other provision is intended, and

[GA]

(c) a reference to an enactment shall be construed as a reference to that enactment as amended, adapted or extended by or under any subsequent enactment including this Act.

[GA]

Establishment day.

3.—(1) The Minister shall by order appoint a day to be the establishment day for the purposes of this Act.

[GA]

(2) Section 24 of the No. 3 Act of 1996 does not apply to an order made under this section.

[GA]

Laying of regulations before Houses of Cireachtas.

4.—Every order made under section 5 and every regulation made under sections 11(2), 16(1) and 21(14) shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order or regulation is passed by either such House within the next subsequent 21 days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.

Amendment of First and Second Schedules.

5.—(1) The Minister may, after consultation with the Minister for the Environment and Local Government and the local authority concerned, by order amend the First Schedule.

(2) The Minister may, at the request of the Authority and subject to subsection (3), by order amend the Second Schedule by making additions or deletions therefrom.

[GA]

(3) The Minister shall, before deleting reference to a person from the Second Schedule, consult with that person.

[GA]

Repeal and revocation.

6.—(1) The following are hereby repealed, with effect from the establishment day—

(a) subsections (6) and (7) of section 13 of the Principal Act, and

[GA]

(b) section 18 of the Local Government (Dublin) Act, 1993.

[GA]

(2) Regulation 4 of the Health Boards Regulations, 1970 (S.I. No. 170 of 1970), is hereby revoked, with effect from the establishment day.

PARTII

The Eastern Regional Health Authority

[GA]

Establishment of Eastern Regional Health Authority.

7.—(1) There shall stand established on the establishment day a body to be known as the Eastern Regional Health Authority, and in this Act referred to as “the Authority”.

[GA]

(2) The Authority shall be a body corporate with perpetual succession and may sue and be sued in its own name and may acquire, hold and dispose of land and other property.

[GA]

(3) The Authority shall provide itself with a seal and all courts of justice shall take judicial notice of the seal.

[GA]

(4) The functional area of the Authority shall be the county borough of Dublin and the administrative counties South Dublin, Fingal, Dún Laoghaire-Rathdown, Kildare and Wicklow.

[GA]

(5) Subject to this Act, any reference to a health board, however expressed, in any Act, passed before the establishment day, or instrument made before such day under any such Act, shall be construed as including a reference to the Authority.

[GA]

(6) Sections 4, 5 and 26(1) of the Principal Act and section 65 of the Health Act, 1953, shall not apply to the Authority.

[GA]

Functions of Authority.

8.—(1) The Authority shall perform the functions conferred on it under this Act and any other functions which are performable by health board and such other functions as may be provided for by law.

[GA]

(2) The Authority shall, having regard to the resources available and as it sees fit, plan, arrange for and oversee the provision of services in its functional area.

[GA]

(3) In performing its functions under this section, the Authority shall—

[GA]

(a) make arrangements under section 10 with persons for the provision of services,

[GA]

(b) co-ordinate the provision of services,

[GA]

(c) put in place systems, procedures and practices to enable it to monitor and evaluate services provided in accordance with arrangements made under section 10,

[GA]

(d) provide in its annual report an account of measures taken to monitor and evaluate services and an account of the outcomes of such measures,

[GA]

(e) have regard to the advice (if any) tendered to it by each of the three Area Health Boards, and

[GA]

(f) have regard to the right of voluntary bodies who provide services in accordance with arrangements made under section 10 to manage their own affairs in accordance with their independent ethos and traditions.

[GA]

(4) Nothing in this Act shall be construed as prejudicing the performance by the Adelaide and Meath Hospital, Dublin, incorporating the National Children's Hospital of its functions under its Charter.

[GA]

Delegation of functions of Authority.

9.—(1) The Authority shall provide in writing for such of its reserved functions in relation to the provision of services which, immediately before the establishment day, were performed by the Eastern Health Board, to be exerciseable on its behalf, in relation to the functional area of an Area Health Board, by that Area Health Board.

[GA]

(2) Notwithstanding subsection (1), the Authority may, from time to time, and where it considers such action would secure the most beneficial, effective and efficient use of resources, provide in writing for such of its reserved functions as it may determine to be exerciseable on its behalf, in relation to the whole or part of its functional area, by a specified Area Health Board and where the Authority does so, any provision made under subsection (1) in relation those functions shall cease to have effect.

(3) The performance of its functions under subsections (1) and (2) shall be a reserved function of the Authority.

[GA]

Arrangements by Authority for provision of services.

10.—(1) Subject to subsections (2) and (4), the Authority shall, having regard to the resources available to it, make one or more arrangements with one or more persons for the provision of services within its functional area.

[GA]

(2) (a) Subject to section 9(2) and subsection (3), the Authority shall, having regard to the resources available to it, make and carry out an arrangement with each Area Health Board for the provision within the Area Health Board's functional area of services which, immediately before the establishment day, were provided by the Eastern Health Board.

[GA]

(b) The Authority may make arrangements with an Area Health Board for the provision of services other than those specified in paragraph (a).

[GA]

(c) Paragraph (a) shall not be construed as preventing the Authority or an Area Health Board from discontinuing or curtailing any service.

[GA]

(3) The Authority may determine an arrangement or any part thereof made under subsection (2)(a) in relation to the provision of a service and make and carry out an arrangement in lieu thereof with a voluntary body for the provision of the service.

[GA]

(4) An arrangement made under this section shall include the following:

[GA]

(a) a written agreement between the Authority and the person who proposes to provide the services, covering a period of not less than 3 years and not more than 5 years and specifying—

[GA]

(i) the principles by which both parties agree to abide for the duration of the agreement, and

[GA]

(ii) such standards relating to the efficiency, effectiveness and quality of the services to be provided as may be agreed between the parties,

[GA]

and

[GA]

(b) a written agreement, to be renewed annually, between the Authority and the person who proposes to provide the services specifying—

[GA]

(i) the services to be provided, and

[GA]

(ii) the funds to be made available therefor.

[GA]

(5) The Authority may delegate its power to make an arrangement under subsection (1) to an Area Health Board, other than where:

[GA]

(a) the arrangement is with any one of the persons specified in the Second Schedule, or

[GA]

(b) the arrangement is with another Area Health Board.

[GA]

(6) A person (not being an Area Health Board) who provides services in accordance with an arrangement made under this section shall keep, in such form as may be approved by the Authority, all proper and usual accounts and records of all income received or expenditure incurred by it.

[GA]

(7) Accounts kept in pursuance of subsection (6) shall be submitted annually for audit and a copy of the accounts and the auditor's certificate and report thereon shall be presented to the Authority within such period as may be specified by the Authority.

[GA]

(8) The expense of an audit carried out under subsection (7) shall be paid for by the person keeping the accounts.

[GA]

Membership of Authority.

11.—(1) The Authority shall consist of 55 members.

[GA]

(2) Of the members of the Authority—

[GA]

(a) 30 shall be appointed by the local authorities whose functional areas areas included in the functional area of the Authority, of whom—

[GA]

(i) 10 members of Dublin Corporation shall be appointed by Dublin Corporation, and

[GA]

(ii) 4 shall be appointed by each of the councils of the counties of Fingal, South Dublin, Dún Laoghaire-Rathdown, Kildare and Wicklow, and the members appointed by the council of a county shall be members of that council,

[GA]

and the persons so appointed shall, where so prescribed, include such numbers of persons from such local electoral areas as may be prescribed,

[GA]

(b) 13 shall be members of registered professions appointed by election, of whom—

[GA]

(i) 9, including not less than 2 consultants in general hospitals, not less than one consultant psychiatrist, not less than 2 general medical practitioners and not less than one registered medical practitioner with special knowledge or experience in preventive medicine, shall be appointed by election by registered medical practitioners practising in the functional area of the Authority,

[GA]

(ii) one shall be appointed by election by registered dentists practising in the functional area of the Authority,

[GA]

(iii) one shall be appointed by election by registered nurses (other than registered psychiatric nurses) practising in the functional area of the Authority,

[GA]

(iv) one shall be appointed by election by registered psychiatric nurses practising in the functional area of the Authority, and

[GA]

(v) one shall be appointed by election by registered pharmaceutical chemists and registered dispensing chemists and druggists practising in the functional area of the Authority,

[GA]

(c) 9 shall be representative of voluntary service providers, appointed by the Minister, of whom—

[GA]

(i) 3 shall be nominated for appointment by such persons or organisations as the Minister considers to be representative of the voluntary hospitals in the functional area of the Authority,

[GA]

(ii) 3 shall be nominated for appointment by such persons or organisations as the Minister considers to be representative of the voluntary intellectual disability service providers in the functional area of the Authority, and

[GA]

(iii)3 shall be nominated for appointment by such persons or organisations as the Minister considers to be representative of other voluntary service providers in the functional area of the Authority,

[GA]

and

[GA]

(d) 3 shall be appointed by the Minister.

[GA]

(3) The Authority shall hold at least 6 meetings in each year and such other meetings as may be necessary for the performance of its functions.

[GA]

(4) Subject to subsection (3), the rules set out in the Second Schedule (as amended by section 22) to the Principal Act, shall apply in relation to the Authority.

[GA]

Regional Chief Executive.

12.—(1) Subject to subsection (3) and notwithstanding any other enactment, the Authority shall, pursuant to a recommendation from the Local Appointments Commissioners, appoint a person who shall act as the chief executive officer of the Authority and such person shall be known and in this Act referred to as the Regional Chief Executive.

(2) Subject to this Act, any reference to the chief executive officer of a health board in any Act, passed before the establishment day, or instrument made, before such day, under any such Act shall be construed as including a reference to the Regional Chief Executive.

[GA]

(3) Notwithstanding section 15(1) of the Principal Act, the Minister may, before the establishment day, appoint a person who, on the establishment day, shall be deemed to have been appointed to be the Regional Chief Executive and that person shall, unless he or she otherwise dies, resigns or is removed by the Minister, hold the office for a period not exceeding 3 years.

(4) The Minister may remove a person appointed under subsection (3).

[GA]

(5) Section 13(1), (3) and (8) of the Principal Act shall not apply to the Regional Chief Executive.

[GA]

(6) The appointment of the Regional Chief Executive in accordance with subsection (1) shall be a reserved function.

[GA]

Accountability of Regional Chief Executive.

13.—(1) The Regional Chief Executive shall, whenever required by the Committee of Dáil éireann established under the Standing Orders of Dáil éireann to examine and report to Dáil éireann on the appropriation accounts and reports of the Comptroller and Auditor General, give evidence to that committee on—

(a) the regularity and propriety of the transactions recorded or required to be recorded in any book or other record of account subject to audit by the Comptroller and Auditor General which the Authority or the Area Health Boards are required by or under statute to prepare,

[GA]

(b) the economy and efficiency of the Authority and the Area Health Boards in the use of their resources,

[GA]

(c) the systems, procedures and practices employed by the Authority and the Area Health Boards for the purpose of evaluating the effectiveness of their operations, and

[GA]

(d) any matter affecting the Authority or any Area Health Board referred to in a special report of the Comptroller and Auditor General under section 11(2) of the Comptroller and Auditor General (Amendment) Act, 1993, or in any other report of the Comptroller and Auditor General (in so far as it relates to a matter specified in paragraph (a), (b) or (c)) that is laid before Dáil éireann.

(2) In the performance of his or her duties under this section, the Regional Chief Executive shall not question or express an opinion on the merits of any policy of the Government or a Minister of the Government or on the merits of the objectives of such a policy.

PART III

Area Health Boards

[GA]

Establishment of Area Health Boards.

14.—(1) On the establishment day, there shall stand established 3 boards, which shall be known, respectively, as—

(a) the Northern Area Health Board,

[GA]

(b) the East Coast Area Health Board, and

[GA]

(c) the South-Western Area Health Board,

[GA]

and referred to collectively in this Act as “the Area Health Boards”.

[GA]

(2) Each Area Health Board shall be a body corporate with the power to sue and be sued in its own name and may acquire, hold and dispose of land and other property.

[GA]

Each Area Health Board shall provide itself with a seal and all courts of justice shall take judicial notice of the seal.

[GA]

(4) The functional area of each Area Health Board shall be as described in the First Schedule.

[GA]

Functions of Area Health Boards.

15.—(1) An Area Health Board shall perform, with respect to its functional area and on behalf of the Authority, such functions as are specified by the Authority in accordance with section 9(1) and shall carry out such other functions as provided by this Act or as may from time to time be conferred on it by the Authority.

[GA]

(2) An Area Health Board shall, with respect to its functional area—

[GA]

(a) provide, or arrange for the provision of, such services as may be specified in any arrangements entered into with the Authority in accordance with section 10(2),

[GA]

(b) plan and co-ordinate the provision of services, in co-operation with persons providing services in the area and with such other persons as it may see fit, and

[GA]

(c) advise the Authority on the provision of services generally.

[GA]

(3) An Area Health Board shall—

[GA]

(a) carry out its functions subject to any general directions which may be given by the Authority, and

[GA]

(b) co-operate with the Authority and with other Area Health Boards in the co-ordination of services in such manner as the Authority may from time to time determine.

[GA]

(4) Where an Area Health Board makes an arrangement with a person for the provision of services, it shall put in place systems, procedures and practices to enable it to monitor and evaluate the services so provided.

[GA]

(5) An Area Health Board shall, notwithstanding that it is exercising functions on behalf of the Authority under this section, be entitled to enforce any rights acquired and shall be liable in respect of any liabilities incurred (including liabilities in tort) in the exercise of those functions in all respects as if it were acting as a principal, and all proceedings for the enforcement of such rights or liabilities shall be brought by or against the Area Health Board in its own name.

(6) Sections 3 and 4 of the No. 3 Act of 1996 (as amended by section 24) shall apply to an Area Health Board as if it were a health board and references in those sections to a chief executive officer shall be construed for the purposes of this subsection as including references to an area chief executive.

[GA]

Membership of Area Health Boards.

16.—(1) The Minister shall, in accordance with this section, specify in regulations the membership of an Area Health Board.

[GA]

(2) Subject to subsections (4), (5) and (6), the Authority shall appoint the members of the Area Health Boards.

[GA]

(3) The Authority, when appointing a member of an Area Health Board, shall fix such member's period of membership which shall not exceed 5 years.

[GA]

(4) Each member of an Area Health Board shall be a member of the Authority and where a member of an Area Health Board ceases to be a member of the Authority he or she shall also cease to be a member of the Area Health Board.

[GA]

(5) Membership of an Area Health Board shall include at least one member of the Authority who has been appointed by each of the following, namely—

[GA]

(a) the local authorities mentioned in section 11(2)(a),

[GA]

(b) the registered professions mentioned in section 11(2)(b),

[GA]

(c) the Minister, on the nomination of each of the voluntary service providers mentioned in subparagraphs (i), (ii) and (iii) of section 11(2)(c), and

[GA]

(d) the Minister under section 11(2)(d).

[GA]

(6) With respect to each Area Health Board, persons appointed to the Authority under section 11(2)(a) and subsequently appointed by the Authority to an Area Health Board shall exceed the total number of other members of that Area Health Board and be from local electoral areas within the functional area of the Area Health Board.

[GA]

(7) A member of the Authority who has been appointed to the Authority in accordance with section 11(2)(b), other than subparagraph (i), shall be entitled to attend a meeting of an Area Health Board of which he or she is not a member and to participate in the deliberations at such a meeting, but shall not be entitled to vote on any question arising at such a meeting.

(8) The Authority may make payments to a member of an Area Health Board or to a member of the Authority referred to in subsection (7) in respect of travelling and subsistence expenses incurred in attending a meeting of an Area Health Board or otherwise in the pursuance of the business of an Area Health Board in accordance with a scale determined by the Minister, with the consent of the Minister for Finance.

(9) The Authority may, with the consent of the Minister, pay an allowance to the chairman and the vice-chairman of an Area Health Board in respect of expenses (other than expenses referred to in subsection (8)) incurred by him or her in relation to the business of the Area Health Board.

[GA]

(10) Rules 7, 10, 11 (as amended by section 22), 15 and 17 to 32 of the Second Schedule to the Principal Act, shall apply in relation to an Area Health Board and, accordingly, references therein to the board shall be construed as including references to an Area Health Board.

[GA]

(11) An Area Health Board shall hold at least 9 meetings in each year and such other meetings as may be necessary for the performance of its functions.

[GA]

Area chief executives.

17.—(1) Subject to subsection (2), the Authority shall, pursuant to a recommendation from the Local Appointments Commissioners, appoint 3 persons to be chief executive officers of the Area Health Boards, and shall assign them to the 3 Area Health Boards as it sees fit and each of these persons shall be known and in this Act referred to as an area chief executive.

(2) The Minister may, before the establishment day, pursuant to a recommendation from the Local Appointments Commissioners, appoint 3 persons to be area chief executives of the Area Health Boards, and shall assign them to the 3 Area Health Boards as he or she sees fit, and those persons shall be deemed to have been so appointed on the establishment day.

(3) A person appointed under subsection (1) or (2) shall hold office for a period not exceeding 7 years under a contract of service in writing with the Authority upon such terms and conditions (including terms and conditions relating to remuneration and expenses) as may be determined by the Minister, with the consent of the Minister for Finance, and specified in the contract.

(4) An area chief executive shall act as the chief executive officer of the Area Health Board.

[GA]

(5) Where the Authority delegates a function to an Area Health Board in accordance with section 9, the corresponding executive functions of the Regional Chief Executive shall be deemed to have been delegated to the area chief executive of that Area Health Board.

[GA]

(6) The Regional Chief Executive shall delegate in writing to each area chief executive such of his or her functions in relation to the provision of services within the functional area of the relevant Area Health Board which, immediately before the establishment day, were performed by the chief executive officer of the Eastern Health Board.

[GA]

(7) Notwithstanding subsection (6), the Regional Chief Executive may, from time to time, and where he or she considers such action would secure the most beneficial, effective and efficient use of resources, provide in writing for such of his or her functions as he or she may determine to be exerciseable in relation to the whole or part of the Authority's functional area by a specified area chief executive and where the Regional Chief Executive does so, any delegation made under subsection (6) in relation to those functions shall be revoked.

(8) An area chief executive shall exercise the functions delegated to him or her under this section in accordance with such general directions as may from time to time be given by the Regional Chief Executive.

(9) An area chief executive may delegate, in accordance with subsections (2) to (5) of section 16 of the Principal Act, his or her functions to another member of the staff of the Authority who has been assigned to the Area Health Board concerned and references therein to the chief executive officer of a health board shall be construed for the purposes of this subsection as references to an area chief executive.

(10) An area chief executive may be removed from office by the Authority, with the consent of the Minister, in accordance with the terms and conditions of his or her contract of service.

[GA]

(11) The appointment under subsection (1) and the removal under subsection (10) of an area chief executive shall be reserved functions of the Authority.

[GA]

Keeping of accounts and records.

18.—(1) An Area Health Board shall keep all proper and usual accounts of all moneys received or expended by it including an income and expenditure account and balance sheet and, in particular, shall keep all such special accounts as the Authority or the Minister may, from time to time, direct.

(2) An Area Health Board shall prepare annual financial statements in accordance with the accounting standards specified by the Minister for the purposes of section 11(2) of the No. 3 Act of 1996 and shall submit such financial statements to the Comptroller and Auditor General for audit on or before the 1st day of April in the year following the year to which they relate.

[GA]

(3) Upon completion of the audit referred to in subsection (2), the Comptroller and Auditor General shall draw up a report in writing in relation to the financial statements and shall submit a copy of the financial statements together with his or her report thereon to the Authority, which shall submit them to the Minister.

[GA]

(4) The annual financial statements of an Area Health Board shall form part of the consolidated annual accounts of the Authority.

[GA]

(5) The consolidated annual financial statements of the Authority shall be prepared in accordance with accounting standards specified by the Minister and shall be adopted by the Authority and submitted to the Comptroller and Auditor General for audit on or before the 15th day of April in the year following the financial year to which they relate.

[GA]

(6) Subject to subsection (5), the consolidated annual financial statements of the Authority shall be audited in accordance with section 6 of the Act of 1993.

[GA]

(7) The annual financial statements of the three Area Health Boards, together with the reports of the Comptroller and Auditor General thereon, shall be appended by the Minister to the annual financial statements of the Authority (as submitted to the Minister by the Comptroller and Auditor General in accordance with section 6 of the Act of 1993) and the consolidated annual financial statements of the Authority (as submitted to the Minister by the Comptroller and Auditor General in accordance with subsection (6) and section 6 of the Act of 1993) and laid before each House of the Oireachtas.

(8) An area chief executive shall assist the Regional Chief Executive in carrying out his or her duties under section 13 in such manner and at such times as the Regional Chief Executive may from time to time direct.

PART IV

Dissolution of Eastern Health Board and transfer of its staff to Authority

[GA]

Dissolution of Eastern Health Board.

19.—(1) On the establishment day, the Eastern Health Board shall stand dissolved.

[GA]

(2) On the establishment day, all land which, immediately before that day, was vested in the Eastern Health Board and all rights, powers and privileges relating to or connected with that land shall, without any conveyance or assignment, stand vested in the Authority.

[GA]

(3) On the establishment day, all property other than land, including choses-in-action, which, immediately before that day, was the property of the Eastern Health Board shall stand vested in the Authority without any assignment.

[GA]

(4) All rights and liabilities of the Eastern Health Board arising by virtue of any contract or commitment (express or implied) entered into by that body before the establishment day shall on that day stand transferred to the Authority.

[GA]

(5) Every right and liability transferred under subsection (4) may on or after its transfer be sued on, recovered or enforced by or against the Authority in its own name and it shall not be necessary for the Authority to give notice to the person whose right or liability is transferred.

[GA]

(6) Final accounts of the Eastern Health Board shall be drawn up in accordance with the accounting standards specified by the Minister for the purposes of section 11(2) of the No. 3 Act of 1996 and shall be audited by the Comptroller and Auditor General in accordance with section 6 of the Act of 1993.

[GA]

(7) Any legal proceedings pending on the establishment day in any court or tribunal to which the Eastern Health Board is a party shall continue with the substitution of the name of the Authority for that of the Eastern Health Board and shall not abate by reason of such substitution.

[GA]

(8) Any reference to the Eastern Health Board in an order made by a court before the establishment day shall, on the establishment day, be construed as a reference to the Authority.

[GA]

(9) Any resolution passed, order made or notice served by the Eastern Health Board before the establishment day the operation, effect or term of which had not ceased or expired immediately before the establishment day shall, on or after that day, continue in force and have effect as though it was a resolution passed, order made or notice served by the Authority.

[GA]

(10) Any rule or regulation made by the Eastern Health Board which was in force immediately before the establishment day shall, on or after that day, continue in force and have effect as though it was a rule or regulation made by the Authority, and every such rule or regulation may be continued, varied or revoked, and penalties and forfeitures arising thereunder may be recovered and enforced by the Authority.

(11) The Authority may, subject to this Act, in writing transfer to an Area Health Board any land, other property, right or liability transferred to it under this section.

[GA]

Transfer of staff of Eastern Health Board to Authority.

20.—(1) Every person who immediately before the establishment day is a member of the staff of the Eastern Health Board shall, on that day, be transferred to and become a member of the staff of the Authority.

[GA]

(2) Save in accordance with a collective agreement negotiated with any recognised trade unions or staff associations concerned, a person referred to in subsection (1) shall not, while in the service of the Authority, receive a lesser scale of pay or be made subject to less beneficial terms and conditions of service (including those relating to tenure of office) than the scale of pay to which he or she was entitled and the terms and conditions of service (including conditions relating to tenure of office) to which he or she was subject immediately before the establishment day.

(3) Every contract of service, express or implied, which is in force immediately before the establishment day between the Eastern Health Board and any person to whom subsection (1) applies shall continue in force on and after the establishment day, but shall be construed and have effect as if the Authority were substituted therein for the Eastern Health Board and every such contract shall be enforceable by or against the Authority accordingly.

(4) A person transferred to the staff of the Authority under this section or appointed as an officer or servant of the Authority in accordance with section 14(1) of the Principal Act, may be assigned from time to time by the Authority to an Area Health Board.

[GA]

(5) Every person assigned under subsection (4) shall continue to be an officer or servant of the Authority, as the case may be, but shall, while so assigned, be subject to the directions of the area chief executive of the Area Health Board to which he or she is assigned, subject to such arrangements as may be made between the Regional Chief Executive and that area chief executive.

[GA]

(6) For the purposes of any enactment relating to superannuation, the office of an officer who on the establishment day was an officer of the Eastern Health Board shall be deemed not to have been abolished.

PART V

The Health Boards Executive

[GA]

Health Boards Executive.

21.—(1) There shall stand established, on the appointed day, an agency to be known as the Health Boards Executive and in this section referred to as “the Executive”.

[GA]

(2) The Executive shall be a body corporate with the power to sue and be sued.

[GA]

(3) The Executive shall provide itself with a seal and all courts of justice shall take judicial notice of the seal.

[GA]

(4) The Executive shall perform, on behalf of the health boards—

[GA]

(a) such executive functions of the health boards as may be specified, from time to time, by the members of the Executive, and

[GA]

(b) such other executive functions in relation to improving the efficiency and effectiveness of the health and personal social services as the Minister may, from time to time, direct.

[GA]

(5) The members of the Executive shall be the chief executive officers of the health boards and the area chief executives.

[GA]

(6) (a) The expenses of the Executive, in so far as not met from other sources, shall be met by the health boards in such proportions as the members of the Executive may agree upon from time to time, or, failing such agreement, in such proportions as may be determined by the Minister.

[GA]

(b) In default of payment by a health board of the amount payable by it under paragraph (a), the amount involved may be deducted from any moneys payable to the health board by the Minister for any purpose whatsoever and shall be paid to the Executive by the Minister.

[GA]

(7) The Executive shall keep all usual and proper accounts of its income and expenditure and of the sources of such income and of the subject matter of such expenditure and of the assets and liabilities of the Executive.

[GA]

(8) The annual financial statements of the Executive for each year shall be prepared in accordance with accounting standards specified by the Minister and shall be submitted to the Comptroller and Auditor General for audit within 3 months of the end of the year to which they relate and an audit shall be carried out by the Comptroller and Auditor General in accordance with section 5 of the Act of 1993.

(9) Upon completion of the audit under subsection (8), the Comptroller and Auditor General shall draw up a report in writing in relation to the accounts and shall submit a copy of the accounts together with his or her report thereon to the Minister, each health board and the Area Health Boards, and the Minister shall, as soon as may be, cause a copy of the report and a copy of the accounts to which the report relates to be laid before each House of the Oireachtas.

(10) The Executive shall, not later than the 31st day of March in each year, make a report on its activities during the preceding year and shall submit a copy of the report to the Minister, each health board and the Area Health Boards.

[GA]

(11) (a) The Executive may, with the consent of the Minister and the concurrence of the Minister for Finance, appoint such and so many persons to be members of the staff of the Executive as it may determine and in appointing any such person the Executive shall comply with any directions given by the Minister relating to the procedure to be followed.

[GA]

(b) Every member of the staff of the Executive serving in a permanent capacity shall cease to be such a member on attaining the age of 65 years.

[GA]

(c) The Executive shall, with the consent of the Minister and the concurrence of the Minister for Finance, determine the remuneration and conditions of service of each member of its staff.

[GA]

(d) The Executive shall, from time to time, assign such duties as it considers appropriate to each member of the staff of the Executive and each such member shall perform the duties so assigned to him or her.

[GA]

(e) Schemes and regulations made under the Local Government (Superannuation) Act, 1980, shall apply to the members of the staff of the Executive appointed in a permanent capacity as if the Executive were a health board.

[GA]

(12) For the purpose of the performance of its functions, the Executive may, subject to such terms and conditions (if any) as the Minister may specify—

[GA]

(a) purchase or take on lease any land or other property,

[GA]

(b) sell, exchange, let or otherwise dispose of any land or other property vested in it,

[GA]

(c) make arrangements with another person for the use by the Executive of premises or equipment belonging to that person or for the use by the Executive of the services of employees of that person or body,

[GA]

(d) accept gifts of money, land and other property upon such trusts and conditions, if any, as may be specified by the donor, save that the Executive shall not accept a gift where the conditions attached by the donor to its acceptance are not consistent with the functions of the Executive.

[GA]

(13) (a) The Executive shall not borrow money without the prior consent of the Minister, given with the concurrence of the Minister for Finance,

[GA]

(b) The borrowing of moneys by the Executive shall be subject to such terms and conditions (if any) as may be specified by the Minister with the concurrence of the Minister for Finance.

[GA]

(14) The Minister may make regulations in respect of all or any of the following—

[GA]

(a) the terms and conditions of the membership of the Executive,

[GA]

(b) rules and proceedings at its meetings,

[GA]

(c) the establishment of committees of it,

[GA]

(d) the payment of expenses to its members.

[GA]

(15) The Minister shall by order appoint a day to be the appointed day for the purposes of this section.

[GA]

(16) Notwithstanding section 4(1) (inserted by section 24) of the No. 3 Act of 1996, the chief executive officer of a health board may require the Executive to carry out a function on his or her behalf and, where that officer makes such a requirement, he or she shall, as soon as may be, inform the health board concerned.

[GA]

(17) In this section a reference to a health board includes a reference to the Authority and a reference to a chief executive officer of a health board includes a reference to the Regional Chief Executive.

Amendment of Principal Act, Health (Corporate Bodies) Act, 1961, and No. 3 Act of 1996

[GA]

Amendments to Second Schedule to Principal Act.

22.—The Second Schedule to the Principal Act is hereby amended by—

[GA]

(a) the insertion in Rule 5 after “section 4(2)(a)(ii)” of “or section 11(2)(b) of the Health (Eastern Regional Health Authority) Act, 1999,”,

[GA]

(b) the insertion, after Rule 11(2) of the following:

[GA]

“(2A) Where a member of the board appointed other than by the council of a country or the corporation of a country borough has not, for a consecutive period of 6 months, attended a meeting of the board, he or she shall cease to be such a member and the Minister shall, as soon as may be, appoint a person to fill the vacancy.”,

[GA]

(c) the insertion, after Rule 11(3) of the following:

[GA]

“(4) This Rule shall not apply where a member of the board can demonstrate, to the satisfaction of the chairman of the board, that his or her absence has been due to illness.”,

[GA]

(d) the insertion in Rule 12 after “section 4(2)(a)(ii)” of “or section 11(2)(b) of the Health (Eastern Regional Health Authority) Act, 1999,”, and

[GA]

(e) the insertion in Rule 17 after “an officer or servant of the board” of “or an employee of a voluntary hospital, voluntary intellectual disability service provider or voluntary service provider”.

Amendment of section 6 of Health (Corporate Bodies) Act, 1961.

23.Section 6 of the Health (Corporate Bodies) Act, 1961, is hereby amended by the substitution of the following paragraph for paragraph (d):

“(d) the furnishing from time to time by the body to the Minister, or to such other body as the Minister may specify in the order, of information regarding the performance of its functions and the furnishing of such information to the Minister or to the other body at any other time on request.”.

Amendment of No. 3 Act of 1996.

24.—The No. 3 Act of 1996 is hereby amended—

[GA]

(a) in section 1(1), by the substitution for the definition of “reserved function” of the following definition:

“‘reserved function’ means—

[GA]

(a) a function of a health board specified in a section mentioned in column (3) of the First Schedule opposite the Act mentioned in column (2) of that Schedule, and

[GA]

(b) any function of a health board which is specified as a reserved function in the Health Acts, 1947 to 1999, or any other enactment.”,

[GA]

(b) by the substitution for section 3 of the following section:

[GA]

“3. (1) A reserved function shall be performed directly by a health board.

[GA]

(2) A health board shall not take any decision or give any direction in relation to any function of a health board that is not a reserved function.

[GA]

(3) The chief executive officer shall assist the board in the performance of a reserved function in such manner (if any) as the board may require.”,

[GA]

and

[GA]

(c) the substitution for subsection (1) of section 4 of the following subsection:

[GA]

“(1) A function of a health board that is not a reserved function shall be performed by the chief executive officer unless otherwise provided for and such a function shall be an executive function.”.

the “county of Kildare” means the administrative county of Kildare;

the “county of Wicklow” means the administrative county of Wicklow;

the “city of Dublin” means the county borough of Dublin;

“Dún Laoghaire-Rathdown County” means the administrative county of Dún Laoghaire-Rathdown;

“Fingal County” means the administrative county of Fingal;

“South Dublin County” means the administrative county of South Dublin.

That part of the functional area of the Authority which corresponds with the following:

That part of the city of Dublin which is situated north of the River Liffey, and

Fingal County.

3.—(1) Déanfaidh an tAire, le hordú, lá a cheapadh chun bheith ina lá bunaithe chun críocha an Achta seo.

(2) Níl feidhm ag alt 24 d'Acht Uimh. 3 de 1996 maidir le hordú a dhéanfar faoin alt seo.

Rialacháin a leagan faoi bhráid Thithe an Oireachtais.

4.—Gach ordú a dhéanfar faoi alt 5 agus gach rialachán a dhéanfar faoi ailt 11(2),16(1) agus 21(14), déanfar é a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin laistigh den 21 lá ina dhiaidh sin a shuífidh an Teach sin tar éis an t-ordú nó an rialachán a leagan faoina bhráid rún a rith ag neamhniú an ordaithe nó an rialacháin, beidh an t-ordú nó an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú nó faoin rialachán.

5.—(1) Féadfaidh an tAire, le hordú, tar éis dul i gcomhairle leis an Aire Comhshaoil agus Rialtais Áitiúil agus leis an údarás áitiúil lena mbaineann, an Chéad Sceideal a leasú.

(2) Féadfaidh an tAire, le hordú, ar iarraidh ón Údarás agus faoi réir fho-alt (3), an Dara Sceideal a leasú trí ábhar a chur leis nó a scriosadh as.

(3) Sula ndéanfar tagairt do dhuine a scriosadh as an Dara Sceideal, rachaidh an tAire i gcomhairle leis an duine sin.

Údarás Sláinte Réigiúnach an Oirthir

Údarás Sláinte Réigiúnach an Oirthir a bhunú.

7.—(1) Beidh arna bhunú ar an lá bunaithe comhlacht ar a dtabharfar Údarás Sláinte Réigiúnach an Oirthir agus dá ngairtear “an tÚdarás” san Acht seo.

(2) Beidh an tÚdarás ina chomhlacht corpraithe le comharbas suthain agus féadfaidh sé agairt a dhéanamh, agus beidh sé inagartha, ina ainm féin agus féadfaidh sé talamh agus maoin eile a fháil, a shealbhú agus a dhiúscairt.

(3) Soláthróidh an tÚdarás séala dó féin agus tabharfaidh gach cúirt bhreithiúnais aird bhreithiúnach ar an séala.

(4) Is é a bheidh i limistéar feidhme an Údaráis ná contaebhuirg Bhaile Átha Cliath agus contaetha riaracháin Bhaile Átha Cliath Theas, Fhine Gall, Dhún Laoghaire-Ráth an Dúin, Chill Dara agus Chill Mhantáin.

(5) Faoi réir an Achta seo, aon tagairt do bhord sláinte, cibé caoi a léirítear í, in aon Acht, arna rith roimh an lá bunaithe, nó in aon ionstraim arna déanamh roimh an lá sin faoi aon Acht den sórt sin, forléireofar í mar thagairt a fholaíonn tagairt don Údarás.

(6) Ní bheidh feidhm ag ailt 4, 5 agus 26(1) den Phríomh-Acht agus alt 65 den Acht Sláinte, 1953, maidir leis an Údarás.

Feidhmeannna an Údaráis.

8.—(1) Comhlíonfaidh an tÚdarás na feidhmeanna a thugtar dó faoin Acht seo agus aon fheidhmeanna eile is inchomhlíonta ag bord sláinte agus cibé feidhmeanna eile dá bhforálfar le dlí.

(2) Déanfaidh an tÚdarás, ag féachaint do na hacmhainní a bheidh ar fáil agus de réir mar is cuí leis, soláthar seirbhísí ina limistéar feidhme a phleanáil agus a mhaoirsiú agus socrú a dhéanamh maidir leis an soláthar sin.

(3) Le linn don Údarás a fheidhmeanna a chomhlíonadh faoin alt seo déanfaidh sé—

(a) comhshocraíochtaí faoi alt 10 le daoine chun seirbhísí a sholáthar,

(b) soláthar seirbhísí a chomhordú,

[EN]

(c) córais, nósanna imeachta agus cleachtais a bhunú d'fhonn a chumasú dó faireachán agus meastóireacht a dhéanamh ar sheirbhísí a sholáthraítear de réir comhshocraíochtaí arna ndéanamh faoi alt 10,

(d) cuntas a thabhairt ina thuarascáil bhliantúil maidir leis na bearta a glacadh chun faireachán agus meastóireacht a dhéanamh ar sheirbhísí, mar aon le cuntas ar thorthaí na mbeart sin,

(e) aird a thabhairt ar an gcomhairle (más ann) a thabharfaidh gach ceann de na trí Bhord Sláinte Limistéir dó, agus

[EN]

(f) aird a thabhairt ar cheart comhlachtaí saorálacha a sholáthraíonn seirbhísí de réir comhshocraíochtaí a dhéantar faoi alt 10 a ngnóthaí féin a bhainistiú de réir a n-aetais neamhspleách agus a dtraidisiún neamhspleách.

(4) Ní fhorléireofar aon ní san Acht seo mar ní a dhéanann dochar d'Ospidéal Adelaide agus na Mí, Baile Átha Cliath, ina gcorpraítear Ospidéal Náisiúnta na Leanaí, do chomhlíonadh a fheidhmeanna faoina Chairt.

Feidhmeanna an Údaráis a tharmligean.

9.—(1) Déanfaidh an tÚdarás foráil i scríbhinn maidir leis na feidhmeanna forchoimeádta sin dá chuid i ndáil le soláthar seirbhísí, ar feidhmeanna iad a bhí á gcomhlíonadh, díreach roimh an lá bunaithe, ag Bord Sláinte an Oirthir, a bheith infheidhmithe thar a cheann, i ndáil le limistéar feidhme Boird Sláinte Limistéir, ag an mBord Sláinte Limistéir sin.

(2) D'ainneoin fho-alt (1), féadfaidh an tÚdarás, ó am go ham, agus i gcás inar dóigh leis go n-áiritheodh gníomh den sórt sin an úsáid acmhainní is tairbhiúla, is éifeachtaí agus is éifeachtúla, foráil a dhéanamh i scríbhinn maidir le cibé feidhmeanna forchoimeádta dá chuid a chinnfidh sé a bheith infheidhmithe thar a cheann, i ndáil lena limistéar feidhme iomlán nó i ndáil le cuid de, ag Bord Sláinte Limistéir sonraithe agus i gcás ina ndéanfaidh an tÚdarás amhlaidh, scoirfidh aon fhoráil a dhéanfar faoi fho-alt (1) i ndáil leis na feidhmeanna sin d'éifeacht a bheith léi.

(3) Is feidhm fhorchoimeádta de chuid an Údaráis comhlíonadh a fheidhmeanna faoi fho-ailt (1) agus (2).

Comhshocraíochtaí ag an Údarás chun seirbhísí a sholáthar.

10.—(1) Faoi réir fho-ailt (2) agus (4), déanfaidh an tÚdarás, ag féachaint do na hacmhainní a bheidh ar fáil dó, comhshocraíocht amháin nó níos mó le duine amháin nó níos mó chun seirbhísí a sholáthar laistigh dá limistéar feidhme.

(2) (a) Faoi réir alt 9(2) agus fho-alt (3), déanfaidh an tÚdarás, ag féachaint do na hacmhainní a bheidh ar fáil dó, comhshocraíocht le gach Bord Sláinte Limistéir, agus cuirfidh sé comhshocraíocht den sórt sin i gcrích, chun seirbhísí a sholáthar laistigh de limistéar feidhme an Bhoird Sláinte Limistéir, ar seirbhísí iad a bhí, díreach roimh an lá bunaithe, á soláthar ag Bord Sláinte an Oirthir.

(b) Féadfaidh an tÚdarás comhshocraíochtaí a dhéanamh le Bord Sláinte Limistéir chun seirbhísí a sholáthar seachas iad sin a shonraítear i mír (a).

(c) Ní fhorléireofar mír (a) mar mhír a chuirfidh cosc ar an Údarás nó ar Bhord Sláinte Limistéir scor d'aon seirbhís nó aon seirbhís a laghdú.

(3) Féadfaidh an tÚdarás comhshocraíocht nó aon chuid de chomhshocraíocht a fhoirceannadh ar comhshocraíocht í arna déanamh faoi fho-alt (2)(a) i ndáil le soláthar seirbhíse agus féadfaidh sé, in ionad na comhshocraíochta sin, comhshocraíocht a dhéanamh agus a chur i gcrích le comhlacht saorálach chun an tseirbhís a sholáthar.

(4) Beidh na nithe seo a leanas san áireamh i gcomhshocraíocht a dhéanfar faoin alt seo:

(a) comhaontú scríofa idir an tÚdarás agus an duine a bheartaíonn na seirbhísí a sholáthar ar comhaontú é lena gclúdófar tréimhse nach lú ná 3 bliana agus nach mó ná 5 bliana agus ina sonrófar—

(i) na prionsabail a gcomhaontóidh an dá pháirtí ina leith go gcloífidh siad leo ar feadh ré an chomhaontaithe, agus

[EN]

(ii) cibé caighdeáin a bhaineann le héifeachtúlacht, éifeachtacht agus cáilíocht na seirbhísí a bheidh le soláthar de réir mar a chomhaontófar idir na páirtithe,

[EN]

agus

[EN]

(b) comhaontú scríofa, a bheidh le hathnuachan in aghaidh na bliana, idir an tÚdarás agus an duine a bheartaíonn na seirbhísí a sholáthar, ar comhaontú é ina sonrófar—

(i) na seirbhísí a bheidh le soláthar, agus

[EN]

(ii) na cistí a bheidh le cur ar fáil le haghaidh na seirbhísí sin.

[EN]

(5) Féadfaidh an tÚdarás a chumhacht chun comhshocraíocht a dhéanamh faoi fho-alt (1) a tharmligean chuig Bord Sláinte Limistéir, seachas:

(a) i gcás ina ndéantar an chomhshocraíocht le haon duine de na daoine a shonraítear sa Dara Sceideal, nó

[EN]

(b) i gcás ina ndéantar an chomhshocraíocht le Bord Sláinte Limistéir eile.

[EN]

(6) Déanfaidh duine (nach Bord Sláinte Limistéir) a sholáthróidh seirbhísí de réir comhshocraíochta arna déanamh faoin alt seo gach cuntas agus taifead is cuí agus is gnách ar gach ioncam a gheobhaidh sé nó ar gach caiteachas a thabhóidh sé a choimeád i cibé foirm a cheadóidh an tÚdarás.

(7) Déanfar cuntais a choimeádfar de bhun fho-alt (6) a chur isteach in aghaidh na bliana lena n-iniúchadh agus déanfar cóip de na cuntais agus de dheimhniú agus tuarascáil an iniúchóra ina leith a thíolacadh don Údarás laistigh de cibé tréimhse a shonróidh an tÚdarás.

(8) Is é an duine a choimeádfaidh na cuntais a íocfaidh as an gcaiteachas a ghabhann le hiniúchadh a dhéanfar faoi fho-alt (7).

Comhaltas an Údaráis.

11.—(1) 55 chomhalta a bheidh ar an Údarás.

(2) Is mar a leanas comhdhéanamh chomhaltaí an Údaráis—

[EN]

(a) déanfaidh na húdaráis áitiúla a n-áirítear a limistéir feidhme i limistéar feidhme an Údaráis 30 díobh a cheapadh, agus as an líon sin—

(i) ceapfaidh Bardas Bhaile Átha Cliath 10 gcomhalta de Bhardas Bhaile Átha Cliath, agus

[EN]

(ii) déanfaidh gach ceann de chomhairlí chontaetha Fhine Gall, Bhaile Átha Cliath Theas, Dhún Laoghaire-Ráth an Dúin, Chill Dara agus Chill Mhantáin 4 a cheapadh, agus beidh na comhaltaí a gceapfaidh comhairle contae iad ina gcomhaltaí den chomhairle sin,

agus beidh ar áireamh sna daoine a cheapfar amhlaidh, i gcás ina bhforordófar amhlaidh, cibé líon daoine as cibé toghlimistéir áitiúla a fhorordófar,

(b) beidh 13 díobh ina gcomhaltaí de ghairmeacha cláraithe arna gceapadh le toghchán agus astu sin—

(i) déanfaidh lia-chleachtóirí cláraithe atá ag cleachtadh i limistéar feidhme an Údaráis 9 díobh a cheapadh le toghchán, agus beidh san áireamh sa líon sin 2 shainchomhairleoir in ospidéil ghinearálta ar a laghad, síciatraí sainchomhairleach amháin ar a laghad, 2 lia-chleachtóir ghinearálta ar a laghad agus lia-chleachtóir cláraithe amháin ar a laghad ag a bhfuil eolas nó taithí speisialta ar mhíochaine choisctheach,

(ii) déanfaidh fiaclóirí cláraithe atá ag cleachtadh i limistéar feidhme an Údaráis duine amháin a cheapadh le toghchán,

(iii) déanfaidh altraí cláraithe (seachas altraí síciatracha cláraithe) atá ag cleachtadh i limistéar feidhme an Údaráis duine amháin a cheapadh le toghchán,

[EN]

(iv) déanfaidh altraí síciatracha cláraithe atá ag cleachtadh i limistéar feidhme an Údaráis duine amháin a cheapadh le toghchán, agus

[EN]

(v) déanfaidh poitigéirí cógaisíochta cláraithe agus poitigéirí agus drugadóirí urghnaimh cláraithe atá ag cleachtadh i limistéar feidhme an Údaráis duine amháin a cheapadh le toghchán,

[EN]

(c) beidh 9 díobh ionadaitheach do sholáthraithe saorálacha seirbhíse, arna gceapadh ag an Aire, agus as an líon sin—

[EN]

(i) déanfaidh cibé daoine nó eagraíochtaí ar dóigh leis an Aire iad a bheith ionadaitheach do na hospidéil shaorálacha i limistéar feidhme an Údaráis 3 a ainmniú lena gceapadh,

[EN]

(ii) déanfaidh cibé daoine nó eagraíochtaí ar dóigh leis an Aire iad a bheith ionadaitheach do na soláthraithe saorálacha seirbhíse míchumais intleachtúil i limistéar feidhme an Údaráis 3 a ainmniú lena gceapadh, agus

(iii) déanfaidh cibé daoine nó eagraíochtaí ar dóigh leis an Aire iad a bheith ionadaitheach do sholáthraithe saorálacha seirbhíse eile i limistéar feidhme an Údaráis 3 a ainmniú lena gceapadh,

agus

[EN]

(d) ceapfaidh an tAire 3.

[EN]

(3) Tionólfaidh an tÚdarás 6 chruinniú ar a laghad gach bliain agus cibé cruinnithe eile is gá chun a fheidhmeanna a chomhlíonadh.

(4) Faoi réir fho-alt (3), beidh feidhm ag na rialacha atá leagtha amach sa Dara Sceideal (arna leasú le halt 22) a ghabhann leis an bPríomh-Acht maidir leis an Údarás.

Príomh-Fheidhmeannach Réigiúnach.

12.—(1) Faoi réir fho-alt (3), agus d'ainneoin aon achtacháin eile, déanfaidh an tÚdarás, de bhun moladh ó na Coimisinéirí um Cheapacháin Áitiúla, duine a cheapadh a ghníomhóidh mar phríomhoifigeach feidhmiúcháin an Údaráis agus tabharfar an Príomh-Fheidhmeannach Réigiúnach ar an duine sin agus gairtear an Príomh-Fheidhmeannach Réigiúnach den duine sin san Acht seo.

(2) Faoi réir an Achta seo, déanfar aon tagairt do phríomhoifigeach feidhmiúcháin boird sláinte in aon Acht, arna rith roimh an lá bunaithe, nó in aon ionstraim arna déanamh roimh an lá sin faoi aon Acht den sórt sin, a fhorléiriú mar thagairt a fholaíonn tagairt don Phríomh-Fheidhmeannach Réigiúnach.

(3) D'ainneoin alt 15(1) den Phríomh-Acht, féadfaidh an tAire, roimh an lá bunaithe, duine a cheapadh agus measfar, ar an lá bunaithe, an duine sin a bheith ceaptha mar Phríomh-Fheidhmeannach Réigiúnach agus déanfaidh an duine sin, mura rud é go n-éagfaidh sé nó sí, go n-éireoidh sé nó sí as oifig nó go gcuirfidh an tAire é nó í as oifig, an oifig a shealbhú ar feadh tréimhse nach faide ná 3 bliana.

(4) Féadfaidh an tAire duine a cheapfar faoi fho-alt (3) a chur as oifig.

(5) Ní bheidh feidhm ag alt 13(1), (3) agus (8) den Phríomh-Acht maidir leis an bPríomh-Fheidhmeannach Réigiúnach.

(6) Is feidhm fhorchoimeádta í an Príomh-Fheidhmeannach Réigiúnach a cheapadh de réir fho-alt (1).

13.—(1) Déanfaidh an Príomh-Fheidhmeannach Réigiúnach, aon uair a cheanglóidh an Coiste de Dháil Éireann arna bhunú faoi Bhuan-Orduithe Dháil Éireann chun scrúdú a dhéanamh ar na cuntais leithreasa agus ar thuarascálalacha an Ard-Reachtaire Cuntas agus Ciste agus chun tuarascáil a thabhairt orthu do Dháil Éireann, fianaise a thabhairt don choiste sin maidir leis na nithe seo a leanas—

(a) rialtacht agus cuibheas na n-idirbheart a taifeadadh nó a cheanglaítear a thaifeadadh in aon leabhar nó in aon taifead eile cuntais atá faoi réir a iniúchta ag an Ard-Reachtaire Cuntas agus Ciste agus a cheanglaítear, le reacht nó faoi reacht, ar an Údarás nó ar na Boird Sláinte Limistéir a ullmhú,

(b) barainneacht agus éifeachtúlacht an Údaráis agus na mBord Sláinte Limistéir i dtaca le húsáid a n-acmhainní,

[EN]

(c) na córais, na nósanna imeachta agus na cleachtais a úsáideann an tÚdarás agus na Boird Sláinte Limistéir chun éifeachtacht a gcuid oibríochtaí a mheas, agus

[EN]

(d) aon ní a dhéanann difear don Údarás nó d'aon Bhord Sláinte Limistéir dá dtagraítear i dtuarascáil speisialta ón Ard-Reachtaire Cuntas agus Ciste faoi alt 11(2) d'Acht an Ard-Reachtaire Cuntas agus Ciste (Leasú), 1993, nó in aon tuarascáil eile ón Ard-Reachtaire Cuntas agus Ciste (a mhéid a bhaineann sé le ní a shonraítear i mír (a), (b)(c)) a leagtar faoi bhráid Dháil Éireann.

(2) Le linn a dhualgais nó a dualgais a chomhlíonadh faoin alt seo, ní dhéanfaidh an Príomh-Fheidhmeannach Réigiúnach ceist a chur nó tuairim a nochtadh i dtaobh thuillteanais aon bheartais de chuid an Rialtais nó de chuid Aire den Rialtas nó i dtaobh thuillteanais cuspóirí beartais den sórt sin.

CUID III

Boird Sláinte Limistéir

[EN]

Boird Sláinte Limistéir a bhunú.

14.—(1) Ar an lá bunaithe, beidh 3 bhord arna mbunú, ar a dtabharfar, faoi seach—

(a) Bord Sláinte Limistéar an Tuaiscirt,

[EN]

(b) Bord Sláinte Limistéar Chósta an Oirthir, agus

[EN]

(c) Bord Sláinte Limistéar an Iardheiscirt,

[EN]

agus dá gcomhghairtear “na Boird Sláinte Limistéir” san Acht seo.

[EN]

(2) Beidh gach Bord Sláinte Limistéir ina chomhlacht corpraithe agus beidh cumhacht agartha aige, agus beidh sé inagartha, ina ainm féin agus féadfaidh sé talamh agus maoin eile a fháil, a shealbhú agus a dhiúscairt.

(3) Soláthróidh gach Bord Sláinte Limistéir séala dó féin agus tabharfaidh gach cúirt bhreithiúnais aird bhreithiúnach ar an séala.

(4) Is de réir mar a thuairiscítear sa Chéad Sceideal a bheidh limistéar feidhme gach Boird Sláinte Limistéir.

[EN]

Feidhmeanna Bord Sláinte Limistéir.

15.—(1) Déanfaidh Bord Sláinte Limistéir cibé feidhmeanna a shonróidh an tÚdarás de réir alt 9(1) a chomhlíonadh i leith a limistéir feidhme agus thar ceann an Údaráis agus déanfaidh sé cibé feidhmeanna eile a chur i gcrích a fhoráiltear leis an Acht seo nó a thabharfaidh an tÚdarás dó ó am go ham.

(2) Déanfaidh Bord Sláinte Limistéir, i leith a limistéir feidhme—

[EN]

(a) cibé seirbhísí a shonrófar in aon chomhshocraíochtaí a dhéanfar leis an Údarás de réir alt 10(2) a sholáthar nó socrú a dhéanamh chun iad a sholáthar,

[EN]

(b) soláthar seirbhísí a phleanáil agus a chomhordú, i gcomhar le daoine a sholáthraíonn seirbhísí sa limistéar agus le cibé daoine eile is cuí leis, agus

[EN]

(c) comhairle a thabhairt don Údarás maidir le soláthar seirbhísí i gcoitinne.

[EN]

(3) Maidir le Bord Sláinte Limistéir—

[EN]

(a) cuirfidh sé a chuid feidhmeanna i gcrích faoi réir aon ordachán ginearálta a thabharfaidh an tÚdarás, agus

[EN]

(b) comhoibreoidh sé leis an Údarás agus le Boird Sláinte Limistéir eile i dtaca le comhordú seirbhísí i cibé modh a chinnfidh an tÚdarás ó am go ham.

(4) Más rud é go ndéanfaidh Bord Sláinte Limistéir comhshocraíocht le duine chun seirbhísí a sholáthar, déanfaidh sé córais, nósanna imeachta agus cleachtais a bhunú chun a chumasú dó faireachán agus meastóireacht a dhéanamh ar na seirbhísí a sholáthrófar amhlaidh.

(5) D'ainneoin go mbeidh Bord Sláinte Limistéir ag feidhmiú feidhmeanna thar ceann an Údaráis faoin alt seo, beidh sé i dteideal aon chearta a gheobhaidh sé a fhorfheidhmiú agus dlífear de aon dliteanais a thabhóidh sé (lena n-áirítear dliteanais i dtort) le linn na feidhmeanna sin a fheidhmiú ar gach slí amhail is dá mbeadh sé ag gníomhú mar phríomhaí, agus déanfaidh an Bord Sláinte Limistéir gach imeacht le haghaidh fhorfheidhmiú na gceart nó na ndliteanas sin a thionscnamh ina ainm féin nó déanfar gach imeacht den sórt a thionscnamh in aghaidh an Bhoird Sláinte Limistéir ina ainm féin.

(6) Beidh feidhm ag ailt 3 agus 4 d'Acht Uimh. 3 de 1996 (arna leasú le halt 24) maidir le Bord Sláinte Limistéir amhail is dá mba bhord sláinte é agus déanfar tagairtí sna hailt sin do phríomhoifigeach feidhmiúcháin a fhorléiriú chun críocha an fho-ailt seo mar thagairtí a fholaíonn tagairtí do phríomhfheidhmeannach limistéir.

Comhaltas Bord Sláinte Limistéir.

16.—(1) Déanfaidh an tAire, de réir an ailt seo, comhaltas Boird Sláinte Limistéir a shonrú i rialacháin.

(2) Faoi réir fho-ailt (4), (5) agus (6), ceapfaidh an tÚdarás comhaltaí na mBord Sláinte Limistéir.

[EN]

(3) Déanfaidh an tÚdarás, le linn comhalta de Bhord Sláinte Limistéir a cheapadh, tréimhse comhaltais an chomhalta sin a shocrú ar tréimhse í nach faide ná 5 bliana.

(4) Beidh gach comhalta de Bhord Sláinte Limistéir ina chomhalta nó ina comhalta den Údarás agus i gcás ina scoirfidh comhalta de Bhord Sláinte Limistéir de bheith ina chomhalta nó ina comhalta den Údarás scoirfidh sé nó sí freisin de bheith ina chomhalta nó ina comhalta den Bhord Sláinte Limistéir.

(5) Beidh ar áireamh i gcomhaltas Boird Sláinte Limistéir comhalta amháin ar a laghad den Údarás a bheidh ceaptha ag gach ceann acu seo a leanas, eadhon—

(a) na húdaráis áitiúla a luaitear in alt 11(2)(a),

[EN]

(b) na gairmeacha cláraithe a luaitear in alt 11(2)(b),

[EN]

(c) an tAire, ar ainmniú gach ceann de na soláthraithe saorálacha seirbhíse a luaitear i bhfomhíreanna (i), (ii) agus (iii) d'alt 11(2)(c), agus

[EN]

(d) an tAire faoi alt 11 (2)(d).

[EN]

(6) Maidir le gach Bord Sláinte Limistéir, i gcás daoine a cheapfar chuig an Údarás faoi alt 11(2)(a) agus a gceapfaidh an tÚdarás ina dhiaidh sin iad chuig Bord Sláinte Limistéir, beidh líon na ndaoine sin níos mó ná líon iomlán na gcomhaltaí eile den Bhord Sláinte Limistéir sin agus is daoine as na toghlimistéir áitiúla laistigh de limistéar feidhme an Bhoird Sláinte Limistéir a bheidh iontu.

(7) Beidh comhalta den Údarás a cheapfar chuig an Údarás de réir alt 11(2)(b), seachas fomhír (i), i dteideal freastal ar chruinniú de Bhord Sláinte Limistéir nach comhalta de é nó í agus páirt a ghlacadh sna pléití ag cruinniú den sórt sin, ach ní bheidh sé nó sí i dteideal vótáil ar aon cheist a éireoidh ag cruinniú den sórt sin.

(8) Féadfaidh an tÚdarás íocaíochtaí a dhéanamh le comhalta de Bhord Sláinte Limistéir nó le comhalta den Údarás dá dtagraítear i bhfo-alt (7) i leith caiteachas taistil agus cothaithe a thabhófar i dtaca le freastal ar chruinniú de Bhord Sláinte Limistéir nó ar shlí eile i dtaca le gabháil do ghnó Boird Sláinte Limistéir de réir scála a chinnfidh an tAire, le toiliú an Aire Airgeadais.

(9) Féadfaidh an tÚdarás, le toiliú an Aire, liúntas a íoc le cathaoirleach agus le leaschathaoirleach Boird Sláinte Limistéir i leith caiteachas (seachas caiteachais dá dtagraítear i bhfo-alt (8)) a thabhóidh sé nó sí i ndáil le gnó an Bhoird Sláinte Limistéir.

(10) Beidh feidhm ag Rialacha 7, 10, 11 (arna leasú le halt 22), 15 agus 17 go 32 den Dara Sceideal a ghabhann leis an bPríomh-Acht i ndáil le Bord Sláinte Limistéir agus, dá réir sin, déanfar tagairtí sna Rialacha sin don bhord a fhorléiriú mar thagairtí a fholaíonn tagairtí do Bhord Sláinte Limistéir.

(11) Tionólfaidh Bord Sláinte Limistéir 9 gcruinniú ar a laghad gach bliain agus cibé cruinnithe eile is gá chun a chuid feidhmeanna a chomhlíonadh.

Príomhfheidhmeannaigh limistéir.

17.—(1) Faoi réir fho-alt (2), déanfaidh an tÚdarás, de bhun moladh ó na Coimisinéirí um Cheapacháin Áitiúla, 3 dhuine a cheapadh chun bheith ina bpríomhoifigigh feidhmiúcháin de na Boird Sláinte Limistéir, agus déanfaidh sé iad a shannadh chuig na 3 Bhord Sláinte Limistéir de réir mar is cuí leis agus tabharfar príomhfheidhmeannach limistéir ar gach duine de na daoine sin agus gairtear príomhfheidhmeannach limistéir de gach duine acu san Acht seo.

(2) Féadfaidh an tAire, roimh an lá bunaithe, de bhun moladh ó na Coimisinéirí um Cheapacháin Áitiúla, 3 dhuine a cheapadh chun bheith ina bpríomhfheidhmeannaigh limistéir ar na Boird Sláinte Limistéir, agus déanfaidh sé nó sí iad a shannadh chuig na 3 Bhord Sláinte Limistéir de réir mar is cuí leis nó léi, agus measfar gur ar an lá bunaithe a ceapadh na daoine sin amhlaidh.

(3) Duine a cheapfar faoi fho-alt (1)(2), sealbhóidh sé nó sí oifig ar feadh tréimhse nach faide ná 7 mbliana faoi chonradh seirbhíse i scríbhinn leis an Údarás ar cibé téarmaí agus coinníollacha (lena n-áirítear téarmaí agus coinníollacha a bhaineannn le luach saothair agus caiteachais) a chinnfidh an tAire, le toiliú an Aire Airgeadais, agus a shonrófar sa chonradh.

(4) Gníomhóidh príomhfheidhmeannach limistéir mar phríomhoifigeach feidhmiúcháin don Bhord Sláinte Limistéir.

(5) I gcás ina ndéanfaidh an tÚdarás feidhm a tharmligean chuig Bord Sláinte Limistéir de réir alt 9, measfar feidhmeanna feidhmiúcháin comhréireacha an Phríomh-Fheidhmeannaigh Réigiúnaigh a bheith tarmligthe chuig príomhfheidhmeannach limistéir an Bhoird Sláinte Limistéir sin.

(6) Déanfaidh an Príomh-Fheidhmeannach Réigiúnach cibé feidhmeanna dá chuid nó dá cuid i ndáil le soláthar seirbhísí laistigh de limistéar feidhme an Bhoird Sláinte Limistéir iomchuí a tharmligean i scríbhinn chuig gach príomhfheidhmeannach limistéir, ar feidhmeanna iad a bhí, díreach roimh an lá bunaithe, á gcomhlíonadh ag príomhoifigeach feidhmiúcháin Bhord Sláinte an Oirthir.

(7) D'ainneoin fho-alt (6), féadfaidh an Príomh-Fheidhmeannach Réigiúnach, ó am go ham, agus i gcás ina measfaidh sé nó sí go n-áiritheodh gníomh den sórt sin go mbainfí an úsáid is tairbhiúla, is éifeachtaí agus is éifeachtúla as acmhainní, foráil a dhéanamh i scríbhinn go mbeidh cibé feidhmeanna dá chuid nó dá cuid a chinnfidh sé nó sí infheidhmithe i ndáil le limistéar feidhme iomlán an Údaráis nó i ndáil le cuid de ag príomhfheidhmeannach limistéir sonraithe agus i gcás ina ndéanfaidh an Príomh-Fheidhmeannach Réigiúnach amhlaidh, cúlghairfear aon tarmligean a bheidh déanta faoi fho-alt (6) i ndáil leis na feidhmeanna sin.

(8) Déanfaidh príomhfheidhmeannach limistéir na feidhmeanna a tharmligtear chuige nó chuici faoin alt seo a fheidhmiú de réir cibé ordacháin ghinearálta a thabharfaidh an Príomh-Fheidhmeannach Réigiúnach ó am go ham.

(9) Féadfaidh príomhfheidhmeannach limistéir, de réir fho-ailt (2) go (5) d'alt 16 den Phríomh-Acht, a chuid feidhmeanna nó a cuid feidhmeanna a tharmligean chuig comhalta eile d'fhoireann an Údaráis is comhalta a bheidh sannta chuig an mBord Sláinte Limistéir lena mbaineann agus déanfar tagairtí sna fo-ailt sin do phríomhoifigeach feidhmiúcháin boird sláinte a fhorléiriú chun críocha an fho-ailt seo mar thagairtí do phríomhfheidhmeannach limistéir.

(10) Féadfaidh an tÚdarás, le toiliú an Aire, príomhfheidhmeannach limistéir a chur as oifig, de réir théarmaí agus choinníollacha a chonartha seirbhíse nó a conartha seirbhíse.

(11) Is feidhmeanna forchoimeádta de chuid an Údaráis iad príomhfheidhmeannach limistéir a cheapadh faoi fho-alt (1) agus a chur as oifig faoi fho-alt (10).

Cuntais agus taifid a choimeád.

18.—(1) Coimeádfaidh Bord Sláinte Limistéir gach cuntas is cuí agus is gnách ar an airgead go léir a gheobhaidh sé nó a chaithfidh sé, lena n-áirítear cuntas ioncaim agus caiteachais agus clár comhardaithe agus, go háirithe, coimeádfaidh sé na cuntais speisialta sin go léir a ordóidh an tÚdarás nó an tAire, ó am go ham.

(2) Ullmhóidh Bord Sláinte Limistéir ráitis airgeadais bhliantúla de réir na gcaighdeán cuntasaíochta a shonróidh an tAire chun críocha alt 11(2) d'Acht Uimh. 3 de 1996 agus cuirfidh sé na ráitis airgeadais sin faoi bhráid an Ard-Reachtaire Cuntas agus Ciste lena n-iniúchadh ar an 1ú lá d'Aibreán nó roimhe sa bhliain tar éis na bliana lena mbaineann siad.

(3) Déanfaidh an tArd-Reachtaire Cuntas agus Ciste, tar éis an t-iniúchadh dá dtagraítear i bhfo-alt (2) a chríochnú, tuarascáil a tharraingt suas i scríbhinn i ndáil leis na ráitis airgeadais agus déanfaidh sé nó sí cóip de na ráitis airgeadais, mar aon lena thuarascáil nó lena tuarascáil orthu, a chur faoi bhráid an Údaráis agus cuirfidh an tÚdarás faoi bhráid an Aire iad.

(4) Beidh ráitis airgeadais bhliantúla Boird Sláinte Limistéir ina gcuid de chuntais bhliantúla chomhdhlúite an Údaráis.

(5) Déanfar ráitis airgeadais bhliantúla chomhdhlúite an Údaráis a ullmhú de réir caighdeán cuntasaíochta a shonróidh an tAire agus déanfaidh an tÚdarás iad a ghlacadh agus cuirfear faoi bhráid an Ard-Reachtaire Cuntas agus Ciste iad lena n-iniúchadh ar an 15ú lá d'Aibreán nó roimhe sa bhliain tar éis na bliana airgeadais lena mbaineann siad.

(6) Faoi réir fho-alt (5), déanfar ráitis airgeadais bhliantúla chomhdhlúite an Údaráis a iniúchadh de réir alt 6 d'Acht 1993.

(7) Déanfaidh an tAire ráitis airgeadais bhliantúla na dtrí Bhord Sláinte Limistéir, mar aon le tuarascálacha an Ard-Reachtaire Cuntas agus Ciste orthu, a chur i gceangal le ráitis airgeadais bhliantúla an Údaráis (arna gcur faoi bhráid an Aire ag an Ard-Reachtaire Cuntas agus Ciste de réir alt 6 d'Acht 1993) agus le ráitis airgeadais bhliantúla chomhdhlúite an Údaráis (arna gcur faoi bhráid an Aire ag an Ard-Reachtaire Cuntas agus Ciste de réir fho-alt (6) agus alt 6 d'Acht 1993) agus déanfar iad a leagan faoi bhráid gach Tí den Oireachtas.

(8) Cabhróidh príomhfheidhmeannach limistéir leis an bPríomh-Fheidhmeannach Réigiúnach le linn a dhualgais nó a dualgais a chomhall faoi alt 13 i cibé modh agus ag cibé tráthanna a ordóidh an Príomh-Fheidhmeannach Réigiúnach ó am go ham.

CUID IV

Bord Sláinte an Oirthir a Dhíscaoileadh agus a fhoireann a aistriú chuig an Údarás

[EN]

Bord Sláinte an Oirthir a dhíscaoileadh.

19.—(1) Ar an lá bunaithe, beidh Bord Sláinte an Oirthir arna dhíscaoileadh.

[EN]

(2) An talamh uile a bhí dílsithe, díreach roimh an lá bunaithe, do Bhord Sláinte an Oirthir agus gach ceart, gach cumhacht agus gach pribhléid a bhaineann nó a ghabhann leis an talamh sin, beidh siad, ar an lá sin, arna ndílsiú don Údarás gan aon tíolacadh nó sannadh.

(3) Ar an lá bunaithe, gach maoin seachas talamh, lena n-áirítear ábhair i gcaingean, a bhí, díreach roimh an lá sin, ina maoin de chuid Bhord Sláinte an Oirthir, beidh sí arna dílsiú don Údarás gan aon sannadh.

(4) Gach ceart agus dliteanas de chuid Bhord Sláinte an Oirthir a éireoidh de bhua aon chonartha nó gealltanais (sainráite nó intuigthe) a rinne an comhlacht sin roimh an lá bunaithe, beidh sé ar an lá sin arna aistriú chuig an Údarás.

(5) Gach ceart agus dliteanas a aistreofar faoi fho-alt (4), féadfaidh an tÚdarás agra a dhéanamh ina leith, é a ghnóthú nó é a fhorfheidhmiú ina ainm féin, nó féadfar agra a dhéanamh ina leith, é a ghnóthú nó é a fhorfheidhmiú in aghaidh an Údaráis ina ainm féin, agus ní gá don Údarás fógra a thabhairt don duine a n-aistrítear a cheart nó a ceart nó a dhliteanas nó a dliteanas.

(6) Déanfar cuntais chríochnaitheacha Bhord Sláinte an Oirthir a tharraingt suas de réir na gcaighdeán cuntasaíochta a shonróidh an tAire chun críocha alt 11(2) d'Acht Uimh. 3 de 1996 agus déanfaidh an tArd-Reachtaire Cuntas agus Ciste iad a iniúchadh de réir alt 6 d'Acht 1993.

(7) Aon imeachtaí dlí a bheidh ar feitheamh ar an lá bunaithe in aon chúirt nó binse ar páirtí iontu Bord Sláinte an Oirthir, leanfar díobh, ach ainm an Údaráis a chur in ionad ainm Bhord Sláinte an Oirthir agus ní rachaidh siad ar ceal mar gheall ar an gcur in ionad sin.

(8) Déanfar aon tagairt do Bhord Sláinte an Oirthir in ordú arna dhéanamh ag cúirt roimh an lá bunaithe a fhorléiriú, ar an lá bunaithe, mar thagairt don Údarás.

(9) Aon rún a bheidh rite ag Bord Sláinte an Oirthir, aon ordú a bheidh déanta aige nó aon fhógra a bheidh seirbheáilte aige roimh an lá bunaithe, ar rún, ordú nó fógra é nach mbeidh a oibriú, a éifeacht nó a théarma scortha nó caite díreach roimh an lá bunaithe, leanfaidh sé d'fheidhm a bheith aige agus d'éifeacht a bheith leis an lá sin nó dá éis, amhail is dá mba é a bhí ann ná rún a rith an tÚdarás, ordú a rinne sé nó fógra a sheirbheáil sé.

(10) Aon riail nó rialachán a bheidh déanta ag Bord Sláinte an Oirthir agus a bheidh i bhfeidhm díreach roimh an lá bunaithe, leanfaidh sí nó sé d'fheidhm a bheith aici nó aige agus d'éifeacht a bheith léi nó leis, ar an lá sin nó dá éis, amhail is dá mba riail í, nó dá mba rialachán é, a rinne an tÚdarás, agus féadfar gach riail nó rialachán den sórt sin a choimeád i bhfeidhm, a athrú nó a chúlghairm agus féadfaidh an tÚdarás pionóis agus forghéilltí a éiríonn faoin gcéanna a ghnóthú agus a fhorfheidhmiú.

(11) Féadfaidh an tÚdarás, faoi réir an Achta seo, aon talamh, aon mhaoin eile, aon cheart nó aon dliteanas a aistreofar chuige faoin alt seo a aistriú i scríbhinn chuig Bord Sláinte Limistéir.

Foireann Bhord Sláinte an Oirthir a aistriú chuig an Údarás.

20.—(1) Déanfar gach duine a bheidh, díreach roimh an lá bunaithe, ina chomhalta nó ina comhalta d'fhoireann Bhord Sláinte an Oirthir, a aistriú an lá sin chuig foireann an Údaráis agus tiocfaidh sé nó sí, an lá sin, chun bheith ina chomhalta nó ina comhalta d'fhoireann an Údaráis.

(3) Maidir le gach conradh seirbhíse, sainráite nó intuigthe, a bheidh i bhfeidhm díreach roimh an lá bunaithe idir Bord Sláinte an Oirthir agus aon duine a bhfuil feidhm ag fo-alt (1) maidir leis nó léi, leanfaidh sé i bhfeidhm an lá bunaithe agus dá éis, ach forléireofar é agus beidh éifeacht leis amhail is dá gcuirfí an tÚdarás in ionad Bhord Sláinte an Oirthir ann agus beidh gach conradh den sórt sin infhorfheidhmithe ag an Údarás, nó ina choinne, dá réir sin.

(4) Féadfaidh an tÚdarás duine a aistreofar chuig foireann an Údaráis faoin alt seo nó a cheapfar mar oifigeach nó seirbhíseach don Údarás de réir alt 14(1) den Phríomh-Acht a shannadh ó am go ham chuig Bord Sláinte Limistéir.

(5) Leanfaidh gach duine a shannfar faoi fho-alt (4) de bheith ina oifigeach nó ina hoifigeach nó ina sheirbhíseach nó ina seirbhíseach don Údarás, de réir mar a bheidh, ach beidh sé nó sí, le linn a bheith sannta amhlaidh, faoi réir ordacháin phríomhfheidhmeannach limistéir an Bhoird Sláinte Limistéir a mbeidh sé nó sí sannta chuige, ach sin faoi réir cibé comhshocraíochtaí a dhéanfar idir an Príomh-Fheidhmeannach Réigiúnach agus an príomhfheidhmeannach limistéir sin.

(6) Chun críocha aon achtacháin a bhaineann le haoisliúntas, measfar, maidir le hoifig oifigigh a bhí, ar an lá bunaithe, ina oifigeach nó ina hoifigeach do Bhord Sláinte an Oirthir, nár cuireadh deireadh leis an oifig sin.

Feidhmeannacht na mBord Sláinte

Feidhmeannacht na mBord Sláinte.

21.—(1) Beidh arna bunú, ar an lá bunaithe, gníomhaireacht ar a dtabharfar Feidhmeannacht na mBord Sláinte agus dá ngairtear “an Fheidhmeannacht” san alt seo.

(2) Beidh an Fheidhmeannacht ina comhlacht corpraithe agus beidh cumhacht agartha aici agus beidh sí inagartha.

[EN]

(3) Soláthróidh an Fheidhmeannacht séala di féin agus tabharfaidh gach cúirt bhreithiúnais aird bhreithiúnach ar an séala.

(4) Comhlíonfaidh an Fheidhmeannacht, thar ceann na mbord sláinte—

[EN]

(a) cibé feidhmeanna feidhmiúcháin de chuid na mbord sláinte a shonróidh comhaltaí na Feidhmeannachta ó am go ham, agus

[EN]

(b) cibé feidhmeanna feidhmiúcháin eile a ordóidh an tAire ó am go ham ar feidhmeanna iad a bhaineann le héifeachtúlacht agus éifeachtacht na seirbhísí sláinte agus na seirbhísí sóisialta pearsanta a fheabhsú.

(5) Is iad comhaltaí na Feidhmeannachta príomhoifigigh feidhmiúcháin na mbord sláinte agus na príomhfheidhmeannaigh limistéir.

(6) (a) Sa mhéid nach n-íocfar caiteachais na Feidhmeannachta ó fhoinsí eile, íocfaidh na boird sláinte iad i cibé cionúireachtaí ar a gcomhaontóidh comhaltaí na Feidhmeannachta ó am go ham nó, cheal comhaontú den sórt sin, i cibé cionúireachtaí a chinnfidh an tAire.

(b) Mura n-íocfaidh bord sláinte an méid is iníoctha aige faoi mhír (a), féadfar an méid a bheidh i gceist a bhaint as aon airgead a bheidh iníoctha leis an mbord sláinte ag an Aire chun aon chríche ar bith agus íocfaidh an tAire an méid sin leis an bhFeidhmeannacht.

(7) Coimeádfaidh an Fheidhmeannacht gach cuntas is cuí agus is gnách ar a ioncam agus ar a chaiteachas agus ar fhoinsí an ioncaim sin agus ar ábhar an chaiteachais sin agus ar shócmhainní agus ar dhliteanais na Feidhmeannachta.

(8) Déanfar ráitis airgeadais bhliantúla na Feidhmeannachta do gach bliain a ullmhú de réir caighdeán cuntasaíochta a shonróidh an tAire agus cuirfear faoi bhráid an Ard-Reachtaire Cuntas agus Ciste iad lena n-iniúchadh laistigh de 3 mhí ó dheireadh na bliana lena mbaineann siad agus déanfaidh an tArd-Reachtaire Cuntas agus Ciste iniúchadh de réir alt 5 d'Acht 1993.

(9) Déanfaidh an tArd-Reachtaire Cuntas agus Ciste, tar éis an t-iniúchadh faoi fho-alt (8) a chríochnú, tuarascáil a tharraingt suas i scríbhinn i ndáil leis na cuntais agus déanfaidh sé nó sí cóip de na cuntais mar aon lena thuarascáil nó lena tuarascáil orthu a chur faoi bhráid an Aire, faoi bhráid gach boird sláinte agus faoi bhráid na mBord Sláinte Limistéir, agus déanfaidh an tAire, a luaithe is féidir, a chur faoi deara cóip den tuarascáil agus cóip de na cuntais lena mbaineann an tuarascáil a leagan faoi bhráid gach Tí den Oireachtas.

(10) Déanfaidh an Fheidhmeannacht, tráth nach déanaí ná an 31ú lá de Mhárta gach bliain, tuarascáil a thabhairt ar a cuid gníomhaíochtaí le linn na bliana roimhe sin agus cuirfidh sí cóip den tuarascáil faoi bhráid an Aire, faoi bhráid gach boird sláinte agus faoi bhráid na mBord Sláinte Limistéir.

(11) (a) Féadfaidh an Fheidhmeannacht, le toiliú an Aire agus le comhthoiliú an Aire Airgeadais, cibé daoine agus cibé líon daoine a chinnfidh sí a cheapadh chun bheith ina gcomhaltaí d'fhoireann na Feidhmeannachta agus, le linn aon duine den sórt sin a cheapadh, comhlíonfaidh an Fheidhmeannacht aon ordacháin a thabharfaidh an tAire i ndáil leis an nós imeachta a bheidh le leanúint.

(b) Scoirfidh gach comhalta d'fhoireann na Feidhmeannachta a bheidh ag fónamh i gcáil bhuan de bheith ina chomhalta nó ina comhalta den sórt sin ar aois 65 bliana a shlánú.

(c) Déanfaidh an Fheidhmeannacht, le toiliú an Aire agus le comhthoiliú an Aire Airgeadais, luach saothair agus coinníollacha seirbhíse gach comhalta dá foireann a chinneadh.

(d) Déanfaidh an Fheidhmeannacht, ó am go ham, cibé dualgais is cuí léi a shannadh do gach comhalta d'fhoireann na Feidhmeannachta agus comhlíonfaidh gach comhalta den sórt sin na dualgais a shannfar dó nó di amhlaidh.

(e) Beidh feidhm ag scéimeanna agus rialacháin arna ndéanamh faoin Acht Rialtais Áitiúil (Aoisliúntas), 1980, maidir le comhaltaí d'fhoireann na Feidhmeannachta a cheapfar i gcáil bhuan amhail is dá mba bhord sláinte an Fheidhmeannacht.

(12) Chun a dualgais a chomhlíonadh, féadfaidh an Fheidhmeannacht, faoi réir cibé téarmaí agus coinníollacha (más ann) a shonróidh an tAire—

(a) aon talamh nó maoin eile a cheannach nó a thógáil ar léas,

[EN]

(b) aon talamh nó maoin eile a bheidh dílsithe di a dhíol, a mhalartú, a ligean nó a dhiúscairt ar shlí eile,

(c) comhshocraíochtaí a dhéanamh le duine eile maidir leis an bhFeidhmeannacht d'úsáid áitribh nó trealaimh leis an duine sin nó maidir leis an bhFeidhmeannacht d'úsáid seirbhísí fostaithe de chuid an duine sin nó an chomhlachta sin,

(d) glacadh le bronntanais airgid, talún agus maoine eile ar cibé iontaobhais agus coinníollacha, más ann, a shonróidh an deontóir, ach amháin nach nglacfaidh an Fheidhmeannacht le bronntanas i gcás nach bhfuil na coinníollacha a chuirfidh an deontóir ag gabháil lena ghlacadh i gcomhréir le feidhmeanna na Feidhmeannachta.

(13) (a) Ní bhfaighidh an Fheidhmeannacht airgead ar iasacht gan toiliú roimh ré ón Aire, arna thabhairt le comhthoiliú an Aire Airgeadais,

(b) Maidir le hiasachtaí airgid a gheobhaidh an Fheidhmeannacht beidh siad faoi réir cibé téarmaí agus coinníollacha (más ann) a shonróidh an tAire le comhthoiliú an Aire Airgeadais.

(14) Féadfaidh an tAire rialacháin a dhéanamh i leith gach ceann nó aon cheann díobh seo a leanas—

(a) téarmaí agus coinníollacha chomhaltas na Feidhmeannachta,

(b) rialacha agus nósanna imeachta ag a cruinnithe,

[EN]

(c) bunú coistí dá cuid,

(d) caiteachais a íoc lena comhaltaí.

(15) Déanfaidh an tAire, le hordú, lá a cheapadh chun bheith ina lá ceaptha chun críocha an ailt seo.

(16) D'ainneoin alt 4(1) (arna chur isteach le halt 24) d'Acht Uimh. 3 de 1996, féadfaidh príomhoifigeach feidhmiúcháin boird sláinte a cheangal ar an bhFeidhmeannacht feidhm a chomhall thar a cheann nó thar a ceann agus, i gcás ina ndéanfaidh an t-oifigeach sin ceanglas den sórt sin, déanfaidh sé nó sí, a luaithe is féidir, an méid sin a chur in iúl don bhord sláinte lena mbaineann.
