An Príomh-Acht.

1.—(1) San Acht so cialluíonn an abairt “an Príomh-Acht” Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926 (Uimh. 39 de 1926).

(2) Déanfar an tAcht so agus an Príomh-Acht do léiriú mar éinní amháin agus, dá réir sin, gach focal agus abairt dá dtugtar brí áirithe leis an bPríomh-Acht no ann, chun crícheanna an Achta san, beidh aige san Acht so an bhrí do bheirtear dó amhlaidh.

(3) I gcás ar bith ina ndearnadh an Príomh-Acht do chur i mbaint le haon oifig no fostaíocht áirithe, no feidhm do thabhairt don Phríomh-Acht maidir le haon bhord no coiste no cólucht eile (corparuithe no neamh-ionchorparuithe), tré Acht ar bith eile, is gus na leasuithe agus fé réir na leasuithe deintear air leis an Acht so bhainfidh an Príomh-Acht leis an oifig no leis an bhfostaiocht san no bheidh feidhm ag an bPríomh-Acht maidir leis an gcólucht san.

Tosach feidhme.

2.—Tiocfaidh an tAcht so i ngníomh an lá san a cheapfaidh an tAire Riaghaltais Aiteamhail agus Sláinte Poiblidhe chuige sin.

Gan an Príomh-Acht do bhaint le banaltraí ná le mná cabhartha.

3.—D'ainneoin éinní atá i bhfo-alt (1) d'alt 2 den Phríomh-Acht, ní bhainfidh an tAcht san le hoifig no fostaíocht bhanaltran fé údarás áitiúil ná le hoifig no fostaíocht mhná cabhartha fé údarás áitiúil, agus déanfar an abairt “oifig le n-a mbaineann an tAcht so” do léiriú, agus beidh éifeacht aici, dá réir sin sa Phríomh-Acht.

Comhacht chun dearbhuithe áirithe do cheiliúradh.

4.—(1) Féadfaidh an tAire tráth ar bith, le haontú na gCoimisinéirí, dearbhú, ar n-a dhéanamh aige (roimh an Acht so do rith no dá éis sin) fé mhír (c) d'fho-alt (1) d'alt 2 den Phríomh-Acht, do cheiliúradh ar fad no maidir le hoifig no fostaíocht áirithe no le hoifigí no fostaíochtaí áirithe.

(2) Pé uair a déanfar aon dearbhú den tsórt san a luaidhtear sa bhfo-alt san roimhe seo den alt so do cheiliúradh fén bhfo-alt san, ansan, gach oifig no fostaíocht gur maidir léi ceiliúrfar an dearbhú san amhlaidh, scuirfidh leis sin de bheith ina hoifig no ina fostaíocht (do réir mar a bheidh) le n-a mbaineann an Príomh-Acht, ach féadfar dearbhú nua do dhéanamh maidir leis an gcéanna tráth ar bith ina dhiaidh sin fé mhír (c) d'fho-alt (1) d'alt 2 den Phríomh-Acht.

Cuid d'alt 5 den Phríomh-Acht d'athghairm.

5.—Athghairmtear leis seo an méid sin d'fho-alt (2) d'alt 5 den Phríomh-Acht dar tosach na focail “no go dtí” agus dar críoch na focail “is túisce thárlóidh”.

Alt 12 den Phríomh-Acht do leasú.

6.—Leasuítear leis seo alt 12 den Phríomh-Acht tré sna focail “de mhí” do scriosadh as fo-alt (2) den alt san agus tré sna focail “de dhá mhí” do chur ina n-ionad san, agus léireofar an t-alt san agus beidh éifeacht aige dá réir sin.

7.—(1) Féadfar Acht na nUdarás nAitiúil (Oifigigh agus Fostaithe) (Leasú), 1940, do ghairm den Acht so.

(2) Féadfar Achtanna na nUdarás nAitiúil (Oifigigh agus Fostaithe), 1926 agus 1940, do ghairm den Phríomh-Acht agus den Acht so le chéile.

LOCAL AUTHORITIES (OFFICERS AND EMPLOYEES) (AMENDMENT) ACT, 1940.

The Principal Act.

1.—(1) In this Act the expression “the Principal Act” means the Local Authorities (Officers and Employees) Act, 1926 (No. 39 of 1926).

(2) This Act shall be construed as one with the Principal Act, and accordingly every word and expression to which a particular meaning is assigned by or in the Principal Act for the purposes of that Act shall, in this Act, have the meaning so assigned to it.

(3) Wherever the Principal Act has been applied by any other Act to any particular office or employment or in relation to any board, committee, or other body (whether corporate or unincorporated), the Principal Act shall apply to such office or employment or in relation to such body with and subject to the amendments thereof effected by this Act.

Commencement.

2.—This Act shall come into operation on such day as the Minister for Local Government and Public Health shall fix for that purpose.

Exclusion of nurses and midwives from the Principal Act.

3.—Notwithstanding anything contained in sub-section (1) of section 2 of the Principal Act, that Act shall not apply to the office or employment of nurse under a local authority or to the office or employment of midwife under a local authority, and the expression “office to which this Act applies” shall, in the Principal Act, be construed and have effect accordingly.

Power to revoke certain declarations.

4.—(1) The Minister may at any time, with the concurrence of the Commissioners, revoke, either wholly or in respect of a particular office or employment or particular offices or employments, a declaration made (whether before or after the passing of this Act) by him under paragraph (c) of sub-section (1) of section 2 of the Principal Act.

(2) Whenever any such declaration as is mentioned in the foregoing sub-section of this section is revoked under that sub-section, every office or employment in respect of which such declaration is so revoked shall thereupon cease to be an office or employment (as the case may be) to which the Principal Act applies, but without prejudice to the making, at any subsequent time, of a new declaration in respect thereof under paragraph (c) of sub-section (1) of section 2 of the Principal Act.

Partial repeal of section 5 of the Principal Act.

5.—So much of sub-section (2) of section 5 of the Principal Act as begins with the words “or the expiration” and ends with the words “first occurs” is hereby repealed.

Amendment of section 12 of the Principal Act.

6.—Section 12 of the Principal Act is hereby amended by the deletion in sub-section (2) of the said section of the words “one month” and the substitution in lieu thereof of the words “two months”, and the said section shall be construed and have effect accordingly.

Short title and collective citation.

7.—(1) This Act may be cited as the Local Authorities (Officers and Employees) (Amendment) Act, 1940.

(2) The Principal Act and this Act may be cited together as the Local Authorities (Officers and Employees) Acts, 1926 and 1940.
