ACHTAÍTEAR AG AN OIREACHTAS MAR A LEANAS:—

Alt 2 (1) den Acht Talmhaíochta (Leasú), 1958, a leasú.

1.—(1) Leasaítear leis seo fo-alt (1) d'alt 2 den Acht Talmhaíochta (Leasú), 1958, trí “1965” agus “oiread is fiche” a chur in ionad “1958” agus “cúig oiread déag” faoi seach.

(2) Tiocfaidh an t-alt seo i ngníomh an 1ú lá d'Aibreán, 1965, agus beidh gach gníomh agus gach ní a rinne comhairle contae roimh an lá sin maidir le haon ráta a ghearradh don bhliain airgeadais áitiúil dar tosach an lá sin chomh bailí éifeachtach agus dá mbeadh na forálacha sin roimhe seo den alt seo i bhfeidhm an tráth a rinneadh na gníomhartha nó na nithe sin.

Leasú ar an Dara Sceideal a ghabhann leis an Acht Talmhaíochta, 1931.

2.—(1) Déantar leis seo an Dara Sceideal a ghabhann leis an Acht Talmhaíochta, 1931, a leasú mar a leanas:

(a) cuirfear an Riail seo a leanas in ionad Riail 2:

“2. Is iad a bheidh i ngach coiste talmhaíochta daoine is comhaltaí agus daoine nach comhaltaí den chomhairle agus i gcás na gcomhaltaí d'aon choiste den sórt sin is comhaltaí den chomhairle ní rachaidh a líon—

(a) más ré-uimhir comhaltaí a bheidh ar an gcoiste, thar líon na gcomhaltaí den choiste, nach comhaltaí den chomhairle, nó

(b) más corruimhir comhaltaí a bheidh ar an gcoiste, thar dhuine amháin de bhreis ar líon na gcomhaltaí den choiste nach comhaltaí den chomhairle.”

(b) i Riail 5 cuirfear “comhalta ar bith den chomhairle” in ionad “duine ar bith”;

(c) cuirfear an Riail seo a leanas isteach i ndiaidh Riail 5:

“5A. Gach duine, seachas comhalta den chomhairle, a cheapfar chun bheith ina chomhalta de choiste talmhaíochta, toghfaidh an chomhairle é don cheapachán sin mar gheall ar a bhfuil déanta aige i gcleachtadh na feirmeoireachta nó i bhforbairt na talmhaíochta agus chúrsaí saoil na tuaithe sa cheantar áirithe ina gcónaíonn sé, nó mar gheall ar a bhfuil déanta aige ar mhaithe le hoideachas agus obair chomhairleach sa talmhaíocht nó i ngnóthaí teaghlaigh mhuintir na tuaithe.”

(2) Tiocfaidh an t-alt seo i bhfeidhm maidir le coiste talmhaíochta i dtosach an chéad chruinnithe bhliantúil de chomhairle contae ag a gceaptar comhaltaí an choiste a thionólfar tar éis an chéad toghcháin chúigbhliantúil do chomhaltaí na comhairle sin a dhéanfar tar éis an tAcht seo a rith.

Gearrtheideal agus comhlua.

3.—(1) Féadfar an tAcht Talmhaíochta (Leasú), 1964, a ghairm den Acht seo.

(2) Féadfar na hAchtanna Talmhaíochta, 1931 go 1964, a ghairm de na hAchtanna Talmhaíochta, 1931 go 1958, agus den Acht seo le chéile.

AGRICULTURE (AMENDMENT) ACT, 1964

Amendment of section 2 (1) of Agriculture (Amendment) Act, 1958.

1.—(1) Subsection (1) of section 2 of the Agriculture (Amendment) Act, 1958, is hereby amended by the substitution of “1965” and “twenty-one” for “1958” and “fifteen” respectively.

(2) This section shall come into operation on the 1st day of April, 1965, and all acts and things done before that day by the council of a county in relation to the making of any rate for the local financial year beginning on that day shall be as valid and effectual as if the foregoing provisions of this section were in force at the time those acts or things were done.

Amendment of Second Schedule to Agriculture Act, 1931.

2.—(1) The Second Schedule to the Agriculture Act, 1931, is hereby amended as follows:

(a) the following Rule shall be substituted for Rule 2:

“2. Every committee of agriculture shall be composed both of persons who are and persons who are not members of the council and the members of any such committee who are members of the council shall not in number—

(a) in case the committee consists of an even number of members, exceed, or

(b) in case the committee consists of an odd number of members, exceed by more than one,

the members of the committee who are not members of the council.”

(b) in Rule 5 “member of the council” shall be substituted for “person”;

(c) the following Rule shall be inserted after Rule 5:

“5A. Every person, other than a member of the council, appointed to be a member of a committee of agriculture shall be chosen by the council for such appointment either by reason of his attainments in the practice of farming or the development of agriculture and rural living in the particular locality in which he resides, or by reason of his attainments in the promotion of agricultural or rural home education and advisory work.”

(2) This section shall come into force in relation to a committee of agriculture upon the commencement of the annual meeting of the council of a county by whom the members of the committee are appointed held next after the first quinquennial election of members of the said council held after the passing of this Act.

Short title and collective citation.

3.—(1) This Act may be cited as the Agriculture (Amendment) Act, 1964.

(2) The Agriculture Acts, 1931 to 1958, and this Act may be cited together as the Agriculture Acts, 1931 to 1964.
