INDUSTRIAL RELATIONS ACT, 1990
PART I
Preliminary
Short title.
1.—This Act may be cited as the Industrial Relations Act, 1990.
Collective citations and construction.
2.—(1) This Act (other than Part II) and the Industrial Relations Acts, 1946 to 1976, may be cited together as the Industrial Relations Acts, 1946 to 1990, and shall be construed together as one Act.
(2) Part II of this Act and the Trade Union Acts, 1871 to 1982, may be cited together as the Trade Union Acts, 1871 to 1990, and shall be construed together as one Act.
Interpretation.
3.—(1) In this Act—
“the Minister” means the Minister for Labour;
“the Court” means the Labour Court;
“the Commission” means the Labour Relations Commission established by section 24.
(2) In this Act—
(a) a reference to a Part or section is to a Part or section of this Act unless it is indicated that a reference to some other enactment is intended;
(b) a reference to a subsection or paragraph is to the subsection or paragraph of the provision in which the reference occurs, unless it is indicated that a reference to some other provision is intended; and
(c) a reference to any other enactment shall, unless the context otherwise requires, be construed as a reference to that enactment as amended by or under any other enactment, including this Act.
(3) In any enactment other than this Act, a reference to the Trade Disputes Act, 1906 (repealed by this Act) or to any provision thereof shall, without prejudice to section 20 (1) of the Interpretation Act, 1937, be construed as a reference to any relevant provision of Part II of this Act.
Increase of fines.
4.—(1) A person convicted of an offence for which a penalty is provided in any enactment indicated in the First Schedule to this Act at any reference number shall, in lieu of the fine provided in that enactment, be liable to the fine specified in column (3) of that Schedule at that reference number, and that enactment shall be construed and have effect accordingly.
(2) Where it is provided in the First Schedule to this Act at any reference number that a person shall be liable to a daily default fine, he shall be guilty of contravening the relevant enactment on every day on which the contravention continues after conviction of the original contravention and for each such offence he shall be liable to a fine not exceeding the amount specified at that reference number instead of the fine specified for the original contravention.
(3) The provisions of this section shall not apply to any offence committed before the passing of this Act.
Summary proceedings for an offence.
5.—Notwithstanding section 10 (4) of the Petty Sessions (Ireland) Act, 1851, summary proceedings for an offence under the Industrial Relations Acts, 1946 to 1990, may be instituted within one year from the date of the offence.
Expenses.
6.—The expenses incurred in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals.
7.—The enactments referred to in the Second Schedule to this Act are hereby repealed to the extent specified in the third column of that Schedule.
PART II
Trade Union Law
Trade Disputes
Definitions for Part II.
8.—In this Part, save where the context otherwise requires—
“employer” means a person for whom one or more workers work or have worked or normally work or seek to work having previously worked for that person;
“trade dispute” means any dispute between employers and workers which is connected with the employment or non-employment, or the terms or conditions of or affecting the employment, of any person;
“trade union” means a trade union which is the holder of a negotiation licence under Part II of the Trade Union Act, 1941;
“worker” means any person who is or was employed whether or not in the employment of the employer with whom a trade dispute arises, but does not include a member of the Defence Forces or of the Garda Síochána;
“industrial action” means any action which affects, or is likely to affect, the terms or conditions, whether express or implied, of a contract and which is taken by any number or body of workers acting in combination or under a common understanding as a means of compelling their employer, or to aid other workers in compelling their employer, to accept or not to accept terms or conditions of or affecting employment;
“strike” means a cessation of work by any number or body of workers acting in combination or a concerted refusal or a refusal under a common understanding of any number of workers to continue to work for their employer done as a means of compelling their employer, or to aid other workers in compelling their employer, to accept or not to accept terms or conditions of or affecting employment.
Application of provisions of Part II.
9.—(1) Sections 11, 12 and 13 shall apply only in relation to authorised trade unions which for the time being are holders of negotiation licences under the Trade Union Act, 1941, and the members and officials of such trade unions, and not otherwise.
(2) Where in relation to the employment or non-employment or the terms or conditions of or affecting the employment of one individual worker, there are agreed procedures availed of by custom or in practice in the employment concerned, or provided for in a collective agreement, for the resolution of individual grievances, including dismissals, sections 10, 11 and 12 shall apply only where those procedures have been resorted to and exhausted.
(3) Procedures shall be deemed to be exhausted if at any stage an employer fails or refuses to comply with them.
(4) The procedures referred to in subsection (2) may include resort to such persons or bodies as a rights commissioner, the Labour Relations Commission, the Labour Court, an equality officer and the Employment Appeals Tribunal but shall not include an appeal to a court.
Acts in contemplation or furtherance of trade dispute.
10.—(1) An agreement or combination by two or more persons to do or procure to be done any act in contemplation or furtherance of a trade dispute shall not be indictable as a conspiracy if such act committed by one person would not be punishable as a crime.
(2) An act done in pursuance of an agreement or combination by two or more persons, if done in contemplation or furtherance of a trade dispute, shall not be actionable unless the act, if done without any such agreement or combination, would be actionable.
(3) Section 3 of the Conspiracy, and Protection of Property Act, 1875, and subsections (1) and (2) of this section shall be construed together as one section.
Peaceful picketing.
11.—(1) It shall be lawful for one or more persons, acting on their own behalf or on behalf of a trade union in contemplation or furtherance of a trade dispute, to attend at, or where that is not practicable, at the approaches to, a place where their employer works or carries on business, if they so attend merely for the purpose of peacefully obtaining or communicating information or of peacefully persuading any person to work or abstain from working.
(2) It shall be lawful for one or more persons acting on their own behalf or on behalf of a trade union in contemplation or furtherance of a trade dispute, to attend at, or where that is not practicable, at the approaches to, a place where an employer who is not a party to the trade dispute works or carries on business if, but only if, it is reasonable for those who are so attending to believe at the commencement of their attendance and throughout the continuance of their attendance that that employer has directly assisted their employer who is a party to the trade dispute for the purpose of frustrating the strike or other industrial action, provided that such attendance is merely for the purpose of peacefully obtaining or communicating information or of peacefully persuading any person to work or abstain from working.
(3) For the avoidance of doubt any action taken by an employer in the health services to maintain life-preserving services during a strike or other industrial action shall not constitute assistance for the purposes of subsection (2).
(4) It shall be lawful for a trade union official to accompany any member of his union whom he represents provided that the member is acting in accordance with the provisions of subsection (1) or (2) and provided that such official is attending merely for the purpose of peacefully obtaining or communicating information or of peacefully persuading any person to work or abstain from working.
(5) For the purposes of this section “trade union official” means any paid official of a trade union or any officer of a union or branch of a union elected or appointed in accordance with the rules of a union.
Removal of liability for certain acts.
12.—An act done by a person in contemplation or furtherance of a trade dispute shall not be actionable on the ground only that—
(a) it induces some other person to break a contract of employment, or
(b) it consists of a threat by a person to induce some other person to break a contract of employment or a threat by a person to break his own contract of employment, or
(c) it is an interference with the trade, business, or employment of some other person, or with the right of some other person to dispose of his capital or his labour as he wills.
Restriction of actions of tort against trade unions.
13.—(1) An action against a trade union, whether of workers or employers, or its trustees or against any members or officials thereof on behalf of themselves and all other members of the trade union in respect of any tortious act committed by or on behalf of the trade union in contemplation or furtherance of a trade dispute, shall not be entertained by any court.
(2) In an action against any trade union or person referred to in subsection (1) in respect of any tortious act alleged or found to have been committed by or on behalf of a trade union it shall be a defence that the act was done in the reasonable belief that it was done in contemplation or furtherance of a trade dispute.
Secret ballots.
14.—(1) This section shall come into operation two years after the passing of this Act (“the operative date”).
(2) The rules of every trade union shall contain a provision that—
(a) the union shall not organise, participate in, sanction or support a strike or other industrial action without a secret ballot, entitlement to vote in which shall be accorded equally to all members whom it is reasonable at the time of the ballot for the union concerned to believe will be called upon to engage in the strike or other industrial action;
(b) the union shall take reasonable steps to ensure that every member entitled to vote in the ballot votes without interference from, or constraint imposed by, the union or any of its members, officials or employees and, so far as is reasonably possible, that such members shall be given a fair opportunity of voting;
(c) the committee of management or other controlling authority of a trade union shall have full discretion in relation to organising, participating in, sanctioning or supporting a strike or other industrial action notwithstanding that the majority of those voting in the ballot, including an aggregate ballot referred to in paragraph (d), favour such strike or other industrial action;
(d) the committee of management or other controlling authority of a trade union shall not organise, participate in, sanction or support a strike or other industrial action against the wishes of a majority of its members voting in a secret ballot, except where, in the case of ballots by more than one trade union, an aggregate majority of all the votes cast, favours such strike or other industrial action;
(e) where the outcome of a secret ballot conducted by a trade union which is affiliated to the Irish Congress of Trade Unions or, in the case of ballots by more than one such trade union, an aggregate majority of all the votes cast, is in favour of supporting a strike organised by another trade union, a decision to take such supportive action shall not be implemented unless the action has been sanctioned by the Irish Congress of Trade Unions;
(f) as soon as practicable after the conduct of a secret ballot the trade union shall take reasonable steps to make known to its members entitled to vote in the ballot:
(i) the number of ballot papers issued,
(ii) the number of votes cast,
(iii) the number of votes in favour of the proposal,
(iv) the number of votes against the proposal, and
(v) the number of spoilt votes.
(3) The rights conferred by a provision referred to in subsection (2) are conferred on the members of the trade union concerned and on no other person.
(4) Nothing in this section shall constitute an obstacle to negotiations for the settlement of a trade dispute nor the return to work by workers party to the trade dispute.
(5) The First Schedule to the Trade Union Act, 1871, is hereby extended to include the requirement provided for in subsection (2).
Power to alter rules of trade unions.
15.—(1) The committee of management or other controlling authority of a trade union shall, notwithstanding anything in the rules of the union, have power by memorandum in writing to alter the rules of the union so far as may be necessary to give effect to section 14.
(2) In the case of a trade union which is a trade union under the law of another country having its headquarters control situated in that country, the committee of management or other controlling authority referred to in this Part shall have the same meaning as in section 17 (2) of the Trade Union Act, 1975.
Enforcement of rule for secret ballot.
16.—(1) Every trade union registered under the Trade Union Acts, 1871 to 1975, or a trade union under the law of another country shall, not later than the operative date, forward to the Registrar of Friendly Societies a copy of its rules incorporating the provisions referred to in subsection (2) of section 14.
(2) A trade union failing to comply with subsection (2) of section 14 or subsection (1) of this section shall cease to be entitled to hold a negotiation licence under Part II of the Trade Union Act, 1941, and its existing licence shall stand revoked on the operative date.
(3) A body of persons shall not be granted a negotiation licence unless, in addition to fulfilling the relevant conditions specified in section 7 of the Trade Union Act, 1941, and section 2 of the Trade Union Act, 1971, as amended by section 21 of this Act, it complies with subsection (2) of section 14 and for this purpose that subsection shall have effect from the passing of this Act.
(4) A body of persons which is a trade union under the law of another country shall not be granted a negotiation licence unless, in addition to fulfilling the conditions referred to in subsection (3) and section 17 of the Trade Union Act, 1975, it forwards, at the time of application for a negotiation licence, a copy of its rules incorporating the provisions referred to in subsection (2) of section 14 to the Registrar of Friendly Societies.
(5) Where the Registrar of Friendly Societies is satisfied, after due investigation, that it is the policy or practice of a trade union registered under the Trade Union Acts, 1871 to 1975, or a trade union under the law of another country persistently to disregard any requirement of the provisions referred to in subsection (2) of section 14 he may issue an instruction to the trade union to comply with the requirement. Where such an instruction is disregarded, the Registrar of Friendly Societies shall inform the Minister and the Minister may revoke the negotiation licence of the trade union concerned.
Actions contrary to outcome of secret ballot.
17.—(1) Sections 10, 11 and 12 shall not apply in respect of proceedings arising out of or relating to a strike or other industrial action by a trade union or a group of workers in disregard of or contrary to, the outcome of a secret ballot relating to the issue or issues involved in the dispute.
(2) In the case of ballots by more than one trade union, the outcome of a secret ballot referred to in subsection (1) shall mean the outcome of the aggregated ballots.
(3) Where two or more secret ballots have been held in relation to a dispute, the ballot referred to in subsection (1) shall mean the last such ballot.
Non-application of sections 14 to 17 to employers' unions.
18.—Sections 14 to 17 shall not apply to a trade union of employers.
Restriction of right to injunction.
19.—(1) Where a secret ballot has been held in accordance with the rules of a trade union as provided for in section 14, the outcome of which or, in the case of an aggregation of ballots, the outcome of the aggregated ballots, favours a strike or other industrial action and the trade union before engaging in the strike or other industrial action gives notice of not less than one week to the employer concerned of its intention to do so, that employer shall not be entitled to apply to any court for an injunction restraining the strike or other industrial action unless notice of the application has been given to the trade union and its members who are party to the trade dispute.
(2) Where a secret ballot has been held in accordance with the rules of a trade union as provided for in section 14, the outcome of which or, in the case of an aggregation of ballots, the outcome of the aggregated ballots, favours a strike or other industrial action and the trade union before engaging in the strike or other industrial action gives notice of not less than one week to the employer concerned of its intention to do so, a court shall not grant an injunction restraining the strike or other industrial action where the respondent establishes a fair case that he was acting in contemplation or furtherance of a trade dispute.
(3) Notice as provided for in subsection (1) may be given to the members of a trade union by referring such members to a document containing the notice which the members have reasonable opportunity of reading during the course of their employment or which is reasonably accessible to them in some other way.
(4) Subsections (1) and (2) do not apply—
(a) in respect of proceedings arising out of or relating to unlawfully entering into or remaining upon any property belonging to another, or unlawfully causing damage or causing or permitting damage to be caused to the property of another, or
(b) in respect of proceedings arising out of or relating to any action resulting or likely to result in death or personal injury.
(5) Where two or more secret ballots have been held in relation to a dispute, the ballot referred to in subsections (1) and (2) shall be the last such ballot.
Amendment of Trade Union Acts, 1941, 1971 and 1975
Change of deposit consequent on change in number of members.
20.—(1) Within one month after the 31st December each year a trade union which is the holder of a negotiation licence shall send to the Minister a statement of the number of its members on the 31st December and, if it is necessary to increase or reduce a deposit under Part II of the Trade Union Act, 1941, as amended by section 2 of the Trade Union Act, 1971, by any amount in order to make it equal to the appropriate sum, such trade union shall, not later than four months after the 31st December, increase such deposit by such amount or apply for the return out of such deposit of such amount (as the case may require).
(2) Subsection (1) shall take effect on 1st January, 1991.
(3) The “appropriate sum” in subsection (1) shall be the appropriate sum under—
(a) section 7 (2) of the Trade Union Act, 1941, or
(b) section 2 (4) of the Trade Union Act, 1971, or
(c) section 21 (3) or section 21 (4) of this Act,
for the time being, as the case may be.
(4) If, in relation to any trade union required to send a statement under this section, there is a failure to send a statement or there is sent a wilfully false statement, such of the members and officers of the trade union as consent to or facilitate the failure to send a statement or the sending of the false statement and, in the case of a trade union registered under the Trade Union Acts, 1871 to 1975, the trade union itself shall each be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding £500.
(5) Save in pursuance of this section, a trade union shall not, on account of a change in the number of its members, change the amount of a deposit under Part II of the Trade Union Act, 1941, as amended by section 2 of the Trade Union Act, 1971.
(6) Sections 14 and 16 of the Trade Union Act, 1941, shall apply in relation to a deposit made with the High Court under this Act or under the Trade Union Act, 1971, as it applies to a deposit under the Trade Union Act, 1941.
Amendment of section 2 of Trade Union Act, 1971.
21.—(1) In this section “the Act of 1971” means the Trade Union Act, 1971.
(2) Section 2 (1) (b) of the Act of 1971 (which refers to the minimum membership for the grant of a negotiation licence) is hereby amended, in relation to applications for a negotiation licence made after the passing of this Act, by the substitution for “500” of “1,000”.
(3) In respect of a body of persons applying under section 9 (1) of the Trade Union Act, 1941, for a negotiation licence after the passing of this Act, “the appropriate sum” referred to in section 2 (1) (a) of the Act of 1971 shall be the sum appropriate to the number of members of the body in accordance with the Third Schedule to this Act or the sum deposited and kept deposited in the High Court before such passing in accordance with the said section 2 (1) (a) and the Schedule to the Act of 1971, as the case may be.
(4) Whenever after the passing of this Act a trade union is formed consisting wholly or mainly of two or more trade unions which have been amalgamated and each of which, immediately before the amalgamation, had been the holder of a negotiation licence, “the appropriate sum” referred to in the said section 2 (1) (a) shall be such sum as the Minister may determine in respect of the union so formed.
Amalgamations and transfers.
22.—(1) Section 15 of the Trade Union Act, 1975 (which refers to a grant towards expenses of amalgamations or transfers) is hereby amended by the deletion of “were exceptional and”.
(2) Whenever two or more trade unions engage in an unsuccessful attempt to amalgamate or to effect a transfer of engagements from one union to another the Minister may, with the consent of the Minister for Finance, make to one or more of those trade unions out of moneys to be provided by the Oireachtas a grant of such amount as the Minister thinks fit towards such expenses as he is satisfied were incurred, within the period of two years immediately prior to the failure, by that trade union in the course of, or in contemplation of, such attempted amalgamation or transfer.
(3) Where an instrument of amalgamation takes effect the registration of any amalgamating union shall cease to have effect and on the granting of a negotiation licence to the new union any negotiation licence held by an amalgamating union shall cease to have effect.
(4) Where an instrument of transfer of engagements takes effect the registration of any transferor union and any negotiation licence held by such union shall cease to have effect.
PART III
Industrial Relations Generally
“worker”.
23.—(1) In the Industrial Relations Acts, 1946 to 1976, and this Part, “worker” means any person aged 15 years or more who has entered into or works under a contract with an employer, whether the contract be for manual labour, clerical work or otherwise, whether it be expressed or implied, oral or in writing, and whether it be a contract of service or of apprenticeship or a contract personally to execute any work or labour including, in particular, a psychiatric nurse employed by a health board and any person designated for the time being under subsection (3) but does not include—
(a) a person who is employed by or under the State,
(b) a teacher in a secondary school,
(c) a teacher in a national school,
(d) an officer of a local authority,
(e) an officer of a vocational education committee, or
(f) an officer of a school attendance committee.
(2) In subsection (1) “local authority” means—
(a) a council of a county, a corporation of a county or other borough, a council of an urban district, the commissioners of a town, a health board or a port sanitary authority,
(b) a committee or joint committee or board or joint board appointed (whether before or after the passing of this Act) by or under statute to perform the functions or any of the functions of one or more of the bodies mentioned in paragraph (a), and
(c) a committee or joint committee or board or joint board of or appointed by one or more of the bodies mentioned in paragraphs (a) and (b) but not including a vocational education committee, a committee of agriculture or a school attendance committee.
(3) The Minister for Finance may from time to time—
(a) designate for the purpose of subsection (1) any persons (other than established civil servants within the meaning of the Civil Service Regulation Act, 1956) employed by virtue of section 30 (1) (g) of the Defence Act, 1954, or employed by or under the State, and
(b) cancel the designation of any persons under this subsection.
(4) Any person who stands designated by virtue of section 17 (2) (a) of the Industrial Relations Act, 1969, at the passing of this Act shall remain designated for the purpose of subsection (1) unless the designation is cancelled under subsection (3) (b).
(5) The Government may by order amend the definition of “worker” in subsection (1) and may by order revoke or amend any such order.
(6) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order is passed by either House, within the next twenty-one days on which that House has sat after the order has been laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
The Labour Court and the Labour Relations Commission
Establishment of the Commission.
24.—(1) There shall be a body to be known as the Labour Relations Commission to fulfil the functions assigned to it by this Act.
(2) The Commission shall stand established on such day as the Minister by order appoints.
(3) The Commission shall consist of a chairman and six ordinary members who shall be appointed by the Minister.
(4) The Fourth Schedule to this Act shall apply to the Commission.
Functions of the Commission.
25.—(1) The Commission shall have general responsibility for promoting the improvement of industrial relations and shall—
(a) provide a conciliation service;
(b) provide an industrial relations advisory service;
(c) prepare codes of practice relevant to industrial relations after consultation with unions and employer organisations;
(d) offer guidance on codes of practice and help to resolve disputes concerning their implementation;
(e) appoint equality officers of the Commission and provide staff and facilities for the equality officer service;
(f) select and nominate persons for appointment as rights commissioners and provide staff and facilities for the rights commissioner service;
(g) conduct or commission research into matters relevant to industrial relations;
(h) review and monitor developments in the area of industrial relations;
(i) assist joint labour committees and joint industrial councils in the exercise of their functions.
(2) The Commission may at the request of one or more parties to a trade dispute or on its own initiative offer the parties its appropriate services with a view to bringing about a settlement.
(3) Except where there is specific provision for the direct reference of trade disputes to the Labour Court, trade disputes shall first be referred to the Commission or to its appropriate services.
(4) The Commission may, if it thinks fit, on request or on its own initiative, provide for employers, employers' associations, workers and trade unions such advice as it thinks appropriate on any matter concerned with industrial relations.
(5) The functions referred to in subsection (1) (a), (b) or (d) shall be performed on behalf of the Commission by members of its staff duly appointed by the Commission.
(6) The Commission, a member of the Commission or any of its staff shall not include in any report any information obtained by it in the course of any proceedings before it under this Act as to any trade union or as to the business carried on by any person which is not available otherwise than through evidence given at the proceedings (including conciliation conferences and advisory meetings) without the consent of the trade union or person concerned, nor shall any member of the Commission or any of its staff or any person concerned in the proceedings, without such consent, disclose any such information.
(7) Subsection (6) shall not apply to a report to the Court under section 26 (1) (a) or a notice to the Court under section 26 (3) (a) or a report under section 48 (3).
(8) Subsection (6) is without prejudice to section 8 (2) of the Anti-Discrimination (Pay) Act, 1974, or section 14 of the Industrial Relations Act, 1969.
Investigation of dispute by Court.
26.—(1) The Court shall not investigate a trade dispute unless—
(a) subject to subsection (3), it receives a report from the Commission stating that the Commission is satisfied that no further efforts on its part will advance the resolution of the dispute, and
(b) the parties to the dispute have requested the Court to investigate the dispute.
(2) The report referred to in subsection (1) (a) shall include information on the issues in dispute, the attempts made to resolve the dispute and any other information which the Commission considers of assistance to the Court.
(3) Notwithstanding subsection (1) (a), the Court may investigate a dispute if—
(a) the Chairman of the Commission (or any member or officer of the Commission authorised by him) notifies the Court that in the circumstances specified in the notice the Commission waives its function of conciliation in the dispute, and
(b) the parties to the dispute have requested the Court to investigate the dispute.
(4) The foregoing provisions of this section shall not apply in relation to an investigation of a trade dispute by the Court instituted by it before the establishment of the Commission or an appeal to the Court in relation to a recommendation of a rights commissioner or of an equality officer.
(5) Where the Court, following consultation with the Commission, is of opinion, in relation to a trade dispute which but for this subsection it would be precluded by virtue of subsection (1) from investigating, that there are exceptional circumstances which warrant it so doing, it may investigate the dispute.
Procedure of the Commission.
27.—(1) The Commission may act notwithstanding the existence of not more than two vacancies in its membership.
(2) The Commission may from time to time make rules regulating its own procedure and business (including the fixing of a quorum for its meetings) and shall furnish the Minister with a copy of any such rules as soon as may be after they have been made.
(3) The Commission shall in each year, at such date as the Minister may direct, make a report of its activities to the Minister including such observations as it thinks proper relating to trends and developments in industrial relations including pay and the Minister shall cause copies of the report to be laid before each House of the Oireachtas.
(4) The Commission shall supply to the Minister such information as he may from time to time require regarding its activities.
The chief executive.
28.—(1) There shall be a chief officer of the Commission who shall be known as the chief executive.
(2) The first chief executive shall be appointed by the Minister and each subsequent chief executive shall be appointed by the Minister after consultation with the Commission.
(3) The terms and conditions of service of the post of chief executive shall be determined by the Minister with the consent of the Minister for Finance.
(4) The office of chairman and the post of chief executive may be held by the same person for such period and subject to such conditions as the Minister with the consent of the Minister for Finance may determine.
(5) The chief executive may be removed from office by the Minister for stated reasons.
Superannuation and gratuities for and in respect of the chief executive of the Commission.
29.—(1) The Minister may, with the consent of the Minister for Finance, make a scheme or schemes for the granting of pensions, gratuities and other allowances on cessation of office or death to or in respect of the chief executive of the Commission.
(2) The Minister may, with the consent of the Minister for Finance, at any time amend a scheme made by him under this section.
(3) A scheme made by the Minister under this section shall be carried out by the Minister in accordance with its terms.
(4) If any dispute arises as to the claim of any person to, or the amount of, any pension, gratuity or allowance payable in pursuance of a scheme under this section, such dispute shall be submitted to the Minister who shall refer it to the Minister for Finance, whose decision shall be final.
(5) Every scheme made by the Minister under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and if either House, within the next twenty-one days on which that House has sat after the scheme is laid before it, passes a resolution annulling the scheme, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Grants to the Commission and power to borrow.
30.—(1) In each financial year there may be paid to the Commission out of moneys provided by the Oireachtas a grant of such amount as the Minister, with the consent of the Minister for Finance, may sanction towards the expenses of the Commission in the performance of its functions.
(2) The Commission may, with the consent of the Minister, given with the consent of the Minister for Finance, borrow temporarily by arrangement with bankers such sums as it may require for the purpose of providing for current expenditure.
Accounts and audits.
31.—(1) The Commission shall, in such form as may be approved by the Minister with the consent of the Minister for Finance, keep all proper and usual accounts of all moneys received or expended by it.
(2) Accounts kept in pursuance of this section shall be submitted annually at such times as the Minister, with the consent of the Minister for Finance, directs, by the Commission to the Comptroller and Auditor General for audit and those accounts, when so audited, shall (together with the report of the Comptroller and Auditor General thereon), be presented to the Minister, who shall cause copies of the audited accounts and the report to be laid before each House of the Oireachtas.
Staff of the Commission.
32.—(1) The Minister, with the consent of the Minister for Finance, may appoint such staff as he thinks necessary to assist the Commission in the performance of its functions.
(2) Appointments under this section shall be on such terms as the Minister with the consent of the Minister for Finance determines and shall be subject to the Civil Service Commissioners Act, 1956, and the Civil Service Regulation Acts, 1956 and 1958.
Industrial relations officers and advisory service.
33.—(1) The Commission may appoint members of its staff to act as industrial relations officers.
(2) The industrial relations officers shall perform any duties assigned to them by the Commission through its chairman or its chief executive officer and, in particular, they shall assist in the prevention and settlement of trade disputes.
(3) The Commission may appoint members of its staff, including industrial relations officers, to give advice on matters relating to industrial relations to management and workers or their representatives.
Rights commissioners.
34.—(1) Where the Minister proposes to appoint a rights commissioner under section 13 (1) of the Industrial Relations Act, 1969, he shall request the Commission to submit to him a panel of persons and he shall not appoint as a rights commissioner any person other than a person included in such panel.
(2) The term of office of a rights commissioner appointed in pursuance of subsection (1) shall be a period not exceeding three years.
(3) A rights commissioner may be re-appointed for a further term or terms by the Minister.
The Rights Commissioner Service.
35.—(1) The rights commissioners shall operate as a service of the Commission and references to rights commissioners in the Industrial Relations Act, 1969, the Unfair Dismissals Act, 1977, and the Maternity Protection of Employees Act, 1981, shall be taken to be references to rights commissioners so operating.
(2) A rights commissioner shall be independent in the performance of his functions.
Objections and appeals.
36.—(1) An objection under section 13 (3) (b) (ii) of the Industrial Relations Act, 1969, by a party to a trade dispute to an investigation of the dispute by a rights commissioner shall be of no effect unless it is notified in writing to the commissioner within three weeks after notice of the reference of the dispute to the commissioner has been sent by post to that party.
(2) An appeal to the Court against the recommendation of a rights commissioner shall not be considered unless it is notified in writing to the Court within six weeks after the making of the recommendation.
(3) A rights commissioner, in addition to notifying the Court, shall notify the Minister and the Commission of every recommendation made by him.
(4) The Commission shall not exercise its function of conciliation on a dispute on which a rights commissioner has made a recommendation.
Equality officers.
37.—(1) The Commission may, with the consent of the Minister and the Minister for Finance, appoint members of its staff to be equality officers and a person so appointed shall be known (and is in this Part referred to) as an equality officer.
(2) The equality officers appointed before the establishment of the Commission under the Anti-Discrimination (Pay) Act, 1974, as adapted by section 18 of the Employment Equality Act, 1977, shall, after such establishment, perform their functions as officers of the Commission and not of the Court.
(3) An equality officer shall be independent in the performance of his functions.
(4) Section 6 (1) of the said Act of 1974 shall cease to have effect on the establishment of the Commission but without prejudice to any appointments previously made under that subsection.
(5) References in the Anti-Discrimination (Pay) Act, 1974, and the Employment Equality Act, 1977, to equality officers shall be read as references to equality officers under this section.
Reference of dispute by Minister.
38.—(1) Where the Minister is of the opinion that a trade dispute, actual or apprehended, affects the public interest, he may refer the matter to the Commission or the Court, which shall endeavour to resolve the dispute.
(2) Where the Minister is of the opinion that a trade dispute is a dispute of special importance, he may request the Commission or the Court or another person or body to conduct an enquiry into the dispute and to furnish a report to him on the findings.
Review of joint labour committees.
39.—The Commission shall carry out a periodic review with a view to ascertaining whether, in the opinion of the Commission, new joint labour committees should be established or, as regards existing committees, whether any establishment order requires amendment or any committee should be abolished, and shall send a copy of the review to the Court and to the Minister.
Superannuation and gratuities for and in respect of chairman, deputy chairmen and ordinary members of the Court.
40.—Section 5 of the Industrial Relations Act, 1969, is hereby amended by the substitution for subsection (1) of the following subsection:
“(1) The Minister may, with the consent of the Minister for Finance, make a scheme or schemes for the granting of pensions, gratuities and other allowances on cessation of office or death to or in respect of the chairman, a deputy chairman (whether appointed under section 4 (1) or 4 (4) of this Act or under section 8 (3) of the Industrial Relations Act, 1976) who is required by the Minister to devote the whole of his working time to the duties of the office of deputy chairman, and the ordinary members of the Court.”.
Divisions of Court.
41.—The Minister may amend or revoke an order made by him under section 8 (1) of the Industrial Relations Act, 1976.
Codes of Practice
Codes of practice.
42.—(1) The Commission shall prepare draft codes of practice concerning industrial relations for submission to the Minister, either on its own initiative or at the request of the Minister.
(2) Before submitting a draft code of practice to the Minister, the Commission shall seek and consider the views of organisations representative of employers and organisations representative of workers, and such other bodies as the Commission considers appropriate.
(3) Where the Minister receives a draft code of practice from the Commission he may by order declare that the code, scheduled to the order, shall be a code of practice for the purposes of this Act.
(4) In any proceedings before a court, the Labour Court, the Commission, the Employment Appeals Tribunal, a rights commissioner or an equality officer, a code of practice shall be admissible in evidence and any provision of the code which appears to the court, body or officer concerned to be relevant to any question arising in the proceedings shall be taken into account in determining that question.
(5) A failure on the part of any person to observe any provision of a code of practice shall not of itself render him liable to any proceedings.
(6) The Minister may at the request of or after consultation with the Commission by order revoke or amend a code of practice.
(7) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order is passed by either House within the next twenty-one days on which that House has sat after the order has been laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done there-under.
Functions of Labour Court relating to codes of practice.
43.—(1) The Court may on the application of one or more parties concerned give its opinion as to the interpretation of a code of practice, provided that in the case of an application by one party notice of the application has been given by that party to the other party.
(2) The Court may investigate a complaint that there has been a breach of a code of practice provided that the complaint has been referred to the Court by a party directly involved and that the complaint has first been considered by the Commission in accordance with section 26.
(3) Where the Court has investigated such a complaint, it may make a recommendation setting forth its opinion in the matter and, where appropriate, its view as to the action which a party in breach of the code should take or cease from taking in order to ensure compliance with the code.
Joint Labour Committees
Constitution and proceedings of joint labour committees.
44.—The provisions of the Fifth Schedule to this Act shall have effect with respect to the constitution and proceedings of joint labour committees.
Making of establishment orders.
45.—(1) The day for the holding of an enquiry into an application for an establishment order under section 38 of the Industrial Relations Act, 1946, to be set out in a notice under that section shall be not less than thirty days from the date of publication of the notice or later than sixty days from the receipt of the application by the Court and section 38 (b) (ii) of the section shall stand amended accordingly.
(2) The Court shall make an establishment order, or make known its decision not to do so, within forty-two days of the completion of the enquiry held in accordance with the said section 38.
Exclusion from scope of joint labour committee.
46.—(1) The Court may by order exclude an undertaking to which a registered employment agreement applies from the scope of the functions of a joint labour committee at the request of the employer and the group of workers or their representatives in the undertaking provided that the remuneration and conditions of employment provided for in the registered employment agreement are not less favourable than those provided for in the relevant employment regulation order.
(2) An order under subsection (1) shall cease to have effect if—
(a) the remuneration and conditions of employment provided for in the registered employment agreement become less favourable than those provided for in the relevant employment regulation order, or
(b) the registered employment agreement is revoked.
Report for assistance of joint labour committee.
47.—(1) The Court may, on its own initiative or at the request of a joint labour committee, arrange for the provision of a report on the industry or trade covered by the committee and the position of its workforce, having regard to the purposes for which the committee was established.
(2) A request for a report under subsection (1) may be made by the committee on the application of the chairman with the approval of a majority of the members of the committee.
Proposals for employment regulation order.
48.—(1) Where a joint labour committee has formulated proposals for an employment regulation order, the committee shall publish a notice stating—
(a) the place where copies of the proposals may be obtained;
(b) that representations with respect to the proposals may be made to the committee within the period of twenty-one days after the date of such publication.
(2) The joint labour committee, having considered any representations made to it in accordance with subsection (1), may submit to the Court such proposals as it thinks proper for an employment regulation order.
(3) When proposals for an employment regulation order are submitted to the Court, the chairman of the committee shall submit a report to the Court on the circumstances surrounding their adoption.
(4) The Court may, as it thinks proper, by order give effect to the proposals from such date (subsequent to the date of the order) as the Court specifies in the order.
(5) (a) Where the Court is not satisfied that it should make an order giving effect to the proposals it may submit to the committee amended proposals which it is willing to accept.
(b) The committee may, if it thinks fit, re-submit the amended proposals, with or without modifications, to the Court.
(c) The Court may, as it thinks proper, make an order giving effect to the proposals as so re-submitted from such date (subsequent to the date of the order) as the Court thinks proper and specifies in the order or refuse to make an order.
Enforcement of employment regulation order by inspector by civil proceedings.
49.—(1) An inspector may institute on behalf of a worker civil proceedings for the enforcement of any right of action of the worker against his employer in respect of the failure of the employer to comply with a condition of employment of an employment regulation order and in any such proceedings an order may be made for the payment of costs by the inspector but not by the worker.
(2) The power given by subsection (1) shall not be in derogation of any right of the worker to institute civil proceedings on his own behalf.
Amendment of section 52 (2) (d) of Industrial Relations Act, 1946.
50.—Section 52 (2) (d) of the Industrial Relations Act, 1946 (which refers to failure or refusal to comply with any lawful requirement of an inspector) is hereby amended by the deletion of “wilfully” before “fails”.
Registered Employment Agreements
Records.
51.—(1) The employer of any workers to whom a registered employment agreement applies shall keep such records as are necessary to show that the registered employment agreement is being complied with and shall retain the records for three years.
(2) If an employer fails to comply with a provision of subsection (1) he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500.
(3) If any employer required by this section to keep records keeps or causes to be kept, or produces or causes to be produced or knowingly allows to be produced to an inspector, any record which is false in a material respect knowing it to be false, he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £1,000 or imprisonment for a period not exceeding three months or to both.
Powers of inspection for enforcement of registered employment agreement.
52.—The powers of inspection given to inspectors by section 12 of the Industrial Relations Act, 1969, shall be exercisable for the purpose of enforcing the provisions of section 32 of the Industrial Relations Act, 1946, and section 51 of this Act and the said section 12 and this section shall be construed as one section.
Proof of registered employment agreement and related matters.
53.—(1) A copy of Iris Oifigiúil purporting to contain a notice published by the Court of the registration of an employment agreement shall be prima facie evidence of the making of that agreement.
(2) Prima facie evidence of a registered employment agreement or of the variation of an agreement may be given by the production of a document purporting to be a copy of the agreement or of the variation and to be published by the Court.
(3) A copy of Iris Oifigiúil purporting to contain a notice or list published by the Court under section 31 of the Industrial Relations Act, 1946, shall be prima facie evidence of the contents of the notice or list, including any particulars published therewith.
Enforcement of registered employment agreement by inspector by civil proceedings.
54.—(1) An inspector may, if it appears to him that a sum is due from an employer to a worker to whom a registered employment agreement applies or that the employer has failed to comply with a condition of any such agreement with respect to the worker, institute on behalf of that worker civil proceedings for the recovery of that sum or the enforcement of that condition and in any such proceedings an order may be made for the payment of costs by the inspector but not by the worker.
(2) The power given by subsection (1) shall not be in derogation of any right of the worker to institute civil proceedings on his own behalf.
Amendment of section 12 (2) (d) of Industrial Relations Act, 1969.
55.—Section 12 (2) (d) of the Industrial Relations Act, 1969 (which refers to failure or refusal to comply with a lawful requirement of an inspector) is hereby amended by the deletion of “wilfully” before “fails”.
Failure to Attend Sitting of Court
Evidence of failure to attend sitting of Court.
56.—(1) A document purporting to be sealed with the seal of the Court stating that—
(a) the person named in the document was, by a summons under section 21 of the Industrial Relations Act, 1946, summoned to attend as a witness before the Court on a day and at a place specified in the document,
(b) a sitting of the Court was held on that day and at that place, and
(c) the said person made default in attending the Court in pursuance of the summons,
shall, in a prosecution against the person so named for the alleged default, be received in evidence of the matters so stated without further proof.
(2) Section 18 of the Industrial Relations Act, 1946, shall apply to a document to which subsection (1) relates.

THIRD SCHEDULE
Deposits
1. Where the number of members does not exceed 2,000, the deposit shall be £20,000.
2. Where the number of members exceeds 2,000 but does not exceed 5,000, the deposit shall be £20,000 together with £800 for each additional 300 members (or part of 300 members) in excess of 2,000 members.
3. Where the number of members exceeds 5,000 but does not exceed 10,000, the deposit shall be £28,000 together with £800 for each additional 500 members (or part of 500 members) in excess of 5,000 members.

FOURTH SCHEDULE
Labour Relations Commission
1. The Labour Relations Commission shall be a body corporate with perpetual succession and an official seal and power to sue and be sued in its corporate name.
2. The chairman shall be appointed by the Minister after consultation with such organisations as the Minister considers to be representative of workers and of employers and shall be appointed for such period and on such terms and conditions as the Minister determines.
3. Of the ordinary members of the Commission—
(a) two shall be workers' members;
(b) two shall be employers' members; and
(c) two shall be nominated by the Minister.
4. The workers' members shall be the persons nominated for appointment by the Minister by such organisation or organisations as the Minister determines to be representative of trade unions of workers.
5. The employers' members shall be the persons nominated for appointment by the Minister by such organisation or organisations as the Minister determines to be representative of employers.
6. Each ordinary member shall be a part-time member of the Commission and shall be appointed on such terms and conditions as the Minister determines.
7. The chairman and each ordinary member may be paid, out of moneys provided by the Oireachtas, such allowances for expenses as the Minister, with the consent of the Minister for Finance, determines.
8. The chairman or an ordinary member may resign his office by letter addressed to the Minister.
9. The Minister may remove the chairman or an ordinary member from office for stated reasons.
10. (1) Where the chairman or an ordinary member of the Commission is nominated as a member of Seanad Éireann or as a candidate for election to either House of the Oireachtas or to the European Parliament he shall thereupon cease to hold office.
(2) A person who is, for the time being, entitled under the Standing Orders of either House of the Oireachtas to sit therein or who is a member of the European Parliament shall, while he is so entitled or is such a member, be disqualified from becoming the chairman or an ordinary member of the Commission.
11. The seal of the Commission shall be authenticated by the signature of the chairman or an ordinary member authorised by the Commission to act in that behalf and the signature of an officer of the Commission authorised by the Commission to act in that behalf.
12. Judicial notice shall be taken of the seal of the Commission and every document purporting to be an instrument made by the Commission and to be sealed with the seal (purporting to be authenticated in accordance with paragraph 11) of the Commission shall be received in evidence and be deemed to be such instrument without proof unless the contrary is shown.
FIFTH SCHEDULE
Constitution and Proceedings of Joint Labour Committees
1. In this Schedule—
“committee” means a joint labour committee;
“the Acts” means the Industrial Relations Acts, 1946 to 1990.
2. (1) Subject to paragraph 3, a committee shall consist of—
(a) one member (in this Schedule referred to as the independent member) appointed by the Minister and chosen as being an independent person, who shall be chairman of the committee, and
(b) members (in this Schedule referred to as representative members) appointed by the Court being—
(i) such number as the Court thinks fit of persons (in this Schedule referred to as representative (employers) members) who, in the opinion of the Court, represent employers in relation to whom the committee is to operate, and
(ii) an equal number of persons (in this Schedule referred to as representative (workers) members) who, in the opinion of the Court, represent workers in relation to whom the committee is to operate.
(2) Before appointing a representative member of a committee the Court shall, so far as is reasonably practicable, consult any organisation of employers or, as the case may be, workers concerned.
(3) The Minister shall appoint an independent person who shall act as independent member and chairman in the absence of the chairman and references in the Acts to an independent member or the chairman shall include references to a person so acting.
(4) The independent member of a committee shall hold office during the pleasure of the Minister.
(5) Where a representative member of a committee ceases, in the opinion of the Court, to be representative of the employers or, as the case may be, workers whom he was appointed to represent, the Court shall determine his membership.
(6) The Court may, in its discretion, determine the membership of any representative member of a committee.
(7) Where the membership of any representative member of a committee is determined, such member shall cease to be a member of the committee.
3. In the case of the joint labour committee for agricultural workers established under section 4 of the Industrial Relations Act, 1976—
(a) the independent member shall be appointed by the Minister with the consent of the Minister for Agriculture and Food;
(b) the representative (employers) members of the committee shall be appointed by the Court from a panel prepared and presented to the Court by the Minister after consultation with such organisation or organisations representative of agricultural employers as the Minister thinks fit and with the consent of the Minister for Agriculture and Food;
(c) the representative (workers) members of the committee (to a number equal to the number of representative (employers) members) shall be appointed by the Court from a panel prepared and presented to the Court by the Minister after consultation with such organisation or organisations representative of agricultural workers as the Minister thinks fit and with the consent of the Minister for Agriculture and Food;
(d) paragraph 2 (2) shall not apply.
4. The proceedings of a committee shall not be invalidated by reason of any vacancy therein or of any defect in the appointment of a member.
5. In order to constitute a meeting of a committee the independent member and at least one-third of the whole number of the representative members must be present.
6. (1) Subject to the provisions of this paragraph, every member of a committee shall have one vote.
(2) If at any meeting of a committee the group of representative (employers) members present does not equal in number the group of representative (workers) members present—
(a) whichever of the said groups is in the majority may arrange that any one or more of its number shall refrain from voting so as to preserve equality,
(b) if no such arrangement is made, the chairman of the committee may adjourn the voting on any question to another meeting of the committee.
7. (1) A committee shall meet at such places and times as it may from time to time determine to be suitable for the discharge of its functions and may adjourn any of its meetings.
(2) A committee shall, save as otherwise provided by the Acts, adopt such procedure at its meetings and otherwise, as it may determine to be suitable for the discharge of its functions.
8. (1) A committee, with the consent of the Court, may appoint sub-committees to assist it.
(2) A sub-committee of a committee may consist of members of the committee and such other persons as the committee with the concurrence of the Court may appoint.
(3) A district trade committee established under the Trade Boards Acts, 1909 and 1918, established by a committee when it was a trade board shall be deemed to be a sub-committee appointed by the committee under subparagraph (1) of this paragraph.
9. Members of a committee or of a sub-committee, may be paid such remuneration and allowances (including compensation for loss of time) as the Minister, with the consent of the Minister for Finance, may determine.
10. In the case of each joint labour committee existing at the passing of this Act, the independent members shall be entitled to continue in office until the appointment of the independent member of that committee under paragraph 2 (1) (a) or 3, as the case may require.

2.—(1) Féadfar na hAchtanna Caidrimh Thionscail, 1946 go 1990, a ghairm den Acht seo (seachas Cuid II) agus de na hAchtanna Caidrimh Thionscail, 1946 go 1976, le chéile agus forléireofar le chéile iad mar aon Acht amháin.
(2) Féadfar na hAchtanna Ceardchumann, 1871 go 1990, a ghairm de Chuid II den Acht seo agus de na hAchtanna Ceardchumann, 1871 go 1982, le chéile agus forléireofar le chéile iad mar aon Acht amháin.
Léiriú.
3.—(1) San Acht seo—
ciallaíonn “an tAire” an tAire Saothair;
ciallaíonn “an Chúirt” an Chúirt Oibreachais;
ciallaíonn “an Coimisiún” an Coimisiún um Chaidreamh Oibreachais a bhunaítear le halt 24.
(2) San Acht seo—

(3) In aon achtachán seachas an tAcht seo, déanfar aon tagairt don Trade Disputes Act, 1906 (a aisghairtear leis an Acht seo) nó d'aon fhoráil den chéanna a fhorléiriú, gan dochar d'alt 20 (1) den Acht Léiriúcháin, 1937, mar thagairt d'aon fhoráil iomchuí de Chuid II den Acht seo.
Fíneálacha a mhéadú.
4.—(1) Aon duine a chiontófar i gcion dá bhforáiltear pionós in aon achtachán a chuirtear in iúl sa Chéad Sceideal a ghabhann leis an Acht seo ag aon uimhir thagartha dlífear, in ionad na fíneála dá bhforáiltear san achtachán sin, an fhíneáil a shonraítear i gcolún (3) den Sceideal sin ag an uimhir thagartha sin a chur air, agus forléireofar an t-achtachán sin agus beidh éifeacht leis dá réir sin.
(2) I gcás go bhforáiltear sa Chéad Sceideal a ghabhann leis an Acht seo ag aon uimhir thagartha go ndlífear fíneáil mhainneachtana laethúil a chur ar dhuine, beidh sé ciontach i sárú ar an achtachán iomchuí gach lá dá leanfaidh an sárú tar éis a chiontaithe mar gheall ar an sárú bunaidh agus, i leith gach ciona den sórt sin, dlífear fíneáil nach mó ná an méid a shonraítear ag an uimhir thagartha sin a chur air in ionad na fíneála a shonraítear in aghaidh an tsáraithe bhunaidh.
(3) Ní bheidh feidhm ag forálacha an ailt seo maidir le haon chion a dhéanfar roimh dháta an Achta seo a rith.
Imeachtaí achoimre i leith ciona.
5.—D'ainneoin alt 10 (4) den Petty Sessions (Ireland) Act, 1851, féadfar imeachtaí achoimre i leith ciona faoi na hAchtanna Caidrimh Thionscail, 1946 go 1990, a thionscnamh laistigh de bhliain amháin ó dháta an chiona.
Caiteachais.
6.—Déanfar na caiteachais a thabhófar ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais, as airgead a sholáthróidh an tOireachtas.
Aisghairm.
7.—Déantar leis seo na hachtacháin dá dtagraítear sa Dara Sceideal a ghabhann leis an Acht seo a aisghairm a mhéid a shonraítear sa tríú colún den Sceideal sin.

8.—Sa Chuid seo, ach amháin mar a n-éilíonn an comhthéacs a mhalairt—
ciallaíonn “fostóir” duine a n-oibríonn nó ar oibrigh nó a n-oibríonn de ghnáth oibrí amháin nó níos mó dó nó a bhféachann oibrí amháin nó níos mó le hoibriú dó tar éis oibriú roimhe sin don duine sin;
ciallaíonn “aighneas ceirde” aon aighneas idir fostóirí agus oibrithe atá bainteach le fostaíocht nó neamhfhostaíocht, nó le téarmaí nó coinníollacha fostaíochta, aon duine nó le téarmaí nó coinníollacha a dhéanann difear d'fhostaíocht aon duine;

Feidhm fhorálacha Chuid II.
9.—(1) Ní bheidh feidhm ag ailt 11, 12 agus 13 ach amháin i ndáil le ceardchumainn údaraithe ar sealbhóirí ceadúnas margántaíochta faoin Acht Ceárd-Chumann, 1941, iad de thuras na huaire agus le comhaltaí agus le feidhmeannaigh de chuid na gceardchumann sin agus ní in aon chás eile.
(2) Más rud é, i ndáil le fostaíocht nó neamhfhostaíocht oibrí aonair amháin nó le téarmaí nó coinníollacha fostaíochta, nó téarmaí nó coinníollacha a dhéanann difear d'fhostaíocht, oibrí aonair amháin, go bhfuil nósanna imeachta comhaontaithe a mbaintear leas astu de réir nóis nó i gcleachtas san fhostaíocht lena mbaineann, nó a bhforáiltear dóibh i gcomhaontú comhchoiteann, chun gearáin aonair, lena n-áirítear dífhóstuithe, a réiteach, ní bheidh feidhm ag ailt 10, 11 agus 12 ach amháin sa chás go ndeachthas i muinín na nósanna imeachta sin agus go bhfuil siad spíonta amach.
(3) Measfar nósanna imeachta a bheith spíonta amach má mhainníonn nó má dhiúltaíonn fostóir, ag céim ar bith, déanamh dá réir.
(4) Féadfar a áireamh sna nósanna imeachta dá dtagraítear i bhfo-alt (2) úsáid a bhaint as daoine nó comhlachtaí mar choimisinéir um chearta, an Coimisiún um Chaidreamh Oibreachais, an Chúirt Oibreachais, oifigeach comhionannais agus an Binse Achomhairc Fostaíochta ach ní áireofar iontu achomharc chun cúirte.
Gníomhartha d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh.
10.—(1) Aon chomhaontú nó comhar idir beirt nó níos mó chun aon ghníomh a dhéanamh, nó chun déanamh aon ghnímh a thabhairt chun críche, d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh, ní bheidh sé indíotáilte mar chomhcheilg más rud é nach mbeadh gníomh den sórt sin arna dhéanamh ag duine amháin inphionóis mar choir.
(2) Aon ghníomh a dhéanfar de bhun comhaontú nó comhair idir beirt nó níos mó ní bheidh sé, má dhéantar é d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh, inchaingne mura mbeadh an gníomh, dá ndéanfaí é gan aon chomhaontú ná comhar den sórt sin, inchaingne.
(3) Forléireofar le chéile mar aon alt amháin alt 3 den Conspiracy, and Protection of Property Act, 1875, agus fo-ailt (1) agus (2) den alt seo.
Picéadú sítheoilte.
11.—(1) Beidh sé dleathach do dhuine amháin nó níos mó, ag gníomhú thar a gceann féin nó thar ceann ceardchumainn d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh, freastal ag áit, nó i gcás nach indéanta sin, ag na bealaí chuig áit, ina n-oibríonn a bhfostóir nó ina seolann sé gnó, má fhreastalaíonn siad amhlaidh d'aon toisc chun faisnéis a fháil nó a thabhairt go sítheoilte nó chun a áiteamh go sítheoilte ar aon duine oibriú nó staonadh ó obair.
(2) Beidh sé dleathach do dhuine amháin nó níos mó, ag gníomhú thar a gceann féin nó thar ceann ceardchumainn d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh, freastal ag áit, nó i gcás nach indéanta sin, ag na bealaí chuig áit, ina n-oibríonn fostóir nach páirtí san aighneas ceirde nó ina seolann sé gnó más rud é, agus más rud é amháin, go bhfuil sé réasúnach dóibh siúd atá ag freastal amhlaidh a chreidiúint ag tús a bhfreastail agus ar feadh na tréimhse a leanfaidh siad dá bhfreastal go bhfuil an fostóir sin tar éis cuidiú go díreach lena bhfostóir, ar páirtí san aighneas ceirde é, chun an stailc nó an gníomh tionscail eile a shárú, ar choinníoll gur d'aon toisc chun faisnéis a fháil nó a thabhairt go sítheoilte nó chun a áiteamh go sítheoilte ar aon duine oibriú nó staonadh ó obair, a dhéanfar an freastal sin.
(3) Chun amhras a sheachaint, aon ghníomh a dhéanfaidh fostóir sna seirbhísí sláinte chun seirbhísí saolchaomhnaithe a chothabháil le linn stailce nó gnímh tionscail eile, ní cuidiú a bheidh ann chun críocha fho-alt (2).
(4) Beidh sé dleathach d'fheidhmeannach ceardchumainn aon chomhalta dá chumann a bhfeidhmíonn sé ar a shon a thionlacan ar choinníoll go mbeidh an comhalta ag gníomhú de réir fhorálacha fho-alt (1) nó (2) agus ar choinníoll gur d'aon toisc chun faisnéis a fháil nó a thabhairt go sítheoilte nó chun a áiteamh go sítheoilte ar aon duine oibriú nó staonadh ó obair a bheidh an feidhmeannach sin ag freastal.
(5) Chun críocha an ailt seo ciallaíonn “feidhmeannach ceardchumainn” aon fheidhmeannach pá de chuid ceardchumainn nó aon oifigeach de chuid cumainn nó brainse de chumann a thoghfar nó a cheapfar de réir rialacha cumainn.
Deireadh a chur le dliteanas i leith gníomhartha áirithe.
12.—Ní bheidh gníomh a dhéanfaidh duine d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh inchaingne ar an bhforas amháin—
(a) go n-aslaíonn sé duine éigin eile chun conradh fostaíochta a bhriseadh, nó
(b) gurb é atá ann bagairt ó dhuine duine éigin eile a aslú chun conradh fostaíochta a bhriseadh nó bagairt ó dhuine a chonradh fostaíochta féin a bhriseadh, nó
(c) gur cur isteach é ar thrádáil, gnó nó fostaíocht duine éigin eile, nó ar cheart duine éigin eile a chaipiteal nó a shaothar a dhiúscairt mar a thograíonn sé.
Caingne torta in aghaidh ceardchumann a shrianadh.
13.—(1) Ní thabharfaidh aon chúirt aird ar chaingean in aghaidh ceardchumainn, cibé acu is ceardchumann d'oibrithe nó d'fhostóirí, nó in aghaidh a iontaobhaithe nó in aghaidh aon chomhaltaí nó feidhmeannach den chéanna thar a gceann féin agus gach comhalta eile den cheardchumann maidir le haon ghníomh tortach a rinne an ceardchumann nó a rinneadh thar a cheann d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh.
(2) I gcaingean in aghaidh aon cheardchumainn nó duine dá dtagraítear i bhfo-alt (1) maidir le haon ghníomh tortach a líomhnaítear a bheith déanta, nó a bhfaightear amach é bheith déanta, ag ceardchumann nó thar a cheann is cosaint é go ndearnadh an gníomh de réir na tuairime réasúnaí go ndearnadh é d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh.
Rúnbhallóidí.
14.—(1) Tiocfaidh an t-alt seo i ngníomh dhá bhliain tar éis dháta an Achta seo a rith (“an dáta feidhme”).
(2) I rialacha gach ceardchumainn beidh foráil—
(a) nach ndéanfaidh an cumann staile nó gníomh tionscail eile a eagrú ná a cheadú ná páirt a ghlacadh sa chéanna ná tacaíocht a thabhairt don chéanna gan rúnbhallóid, a dtabharfar teideal comhionann chun vótáil inti do gach comhalta a mbeidh sé réasúnach don chumann áirithe a chreidiúint, tráth na ballóide, go n-iarrfar air páirt a ghlacadh sa stailc nó sa ghníomh tionscail eile;
(b) go nglacfaidh an cumann bearta réasúnacha chun a chinntiú go vótálfaidh gach comhalta, a bheidh i dteideal vótáil sa bhallóid, gan aon chur isteach ón gcumann nó ó aon duine dá chomhaltaí, dá fheidhmeannaigh nó dá fhostaithe nó gan srianadh arna fhorchur ag an gcéanna agus, a mhéid is indéanta go réasúnach, go dtabharfar deis chothrom vótála do na comhaltaí sin;
(c) go mbeidh lán-rogha ag coiste bainisteoireachta nó ag údarás rialaithe eile ceardchumainn i ndáil le stailc nó gníomh tionscail eile a eagrú nó a cheadú nó páirt a ghlacadh sa chéanna nó tacaíocht a thabhairt don chéanna d'ainneoin tromlach na ndaoine a vótálann sa bhallóid, lena n-áirítear ballóid chomhiomlán dá dtagraítear i mír (d), a bheith i bhfabhar na stailce nó an ghnímh tionscail eile sin;
(d) nach ndéanfaidh coiste bainisteoireachta nó údarás rialaithe eile ceardchumainn stailc nó gníomh tionscail eile a eagrú ná a cheadú ná páirt a ghlacadh sa chéanna ná tacaíocht a thabhairt don chéanna in aghaidh thoil thromlach a chuid comhaltaí a vótálann i rúnbhallóid, ach amháin, i gcás ballóidí ag níos mó ná ceardchumann amháin, má bhíonn tromlach comhiomlán na vótaí go léir a caitheadh i bhfabhar na stailce nó an ghnímh tionscail eile sin;
(e) má bhíonn an toradh ar rúnbhallóid a sheolfaidh ceardchumann atá cleamhnaithe le Comhar Ceardchumann na hÉireann nó, i gcás ballóidí ag níos mó ná ceardchumann amháin den sórt sin, má bhíonn tromlach comhiomlán na vótaí go léir a caitheadh, i bhfabhar tacú le stailc a bheidh eagraithe ag ceardchumann eile, nach gcuirfear cinneadh i bhfeidhm chun gníomh tacaíochta den sórt sin a dhéanamh mura mbeidh an gníomh ceadaithe ag Comhar Ceardchumann na hÉireann;
(f) go nglacfaidh an ceardchumann, a luaithe is féidir tar éis rúnbhallóid a sheoladh, bearta réasúnacha chun an méid seo a leanas a chur i bhfios dá chomhaltaí a bhí i dteideal vótáil sa bhallóid:
(i) an líon páipéar ballóide a eisíodh,
(ii) an líon vótaí a caitheadh,
(iii) an líon vótaí i bhfabhar an togra,
(iv) an líon vótaí in aghaidh an togra, agus
(v) an líon vótaí millte.
(3) Na cearta a thugtar le foráil dá dtagraítear i bhfo-alt (2) is cearta iad a thugtar do chomhaltaí an cheardchumainn lena mbaineann agus ní d'aon duine eile.
(4) Ní bheidh aon ní san alt seo ina chonstaic ar mhargántaíocht chun aighneas ceirde a shocrú nó ar oibrithe is páirtí san aighneas ceirde d'fhilleadh chun oibre.
(5) Déantar leis seo an Chéad Sceideal a ghabhann leis an Trade Union Act, 1871, a leathnú chun an ceanglas dá bhforáiltear i bhfo-alt (2) a chur san áireamh.
Cumhacht chun rialacha ceardchumann a athrú.
15.—(1) D'ainneoin aon ní i rialacha ceardchumainn beidh cumhacht ag coiste bainisteoireachta nó ag údarás rialaithe eile an chumainn, trí mheabhrán i scríbhinn, rialacha an chumainn a athrú a mhéid is gá chun éifeacht a thabhairt d'alt 14.
(2) Más rud é, i gcás ceardchumainn is ceardchumann faoi dhlí tíre eile, go mbeidh a cheanncheathrú rialaithe aige sa tír sin, beidh an bhrí chéanna leis an gcoiste bainisteoireachta nó leis an údarás rialaithe eile dá dtagraítear sa Chuid seo is atá leis in alt 17 (2) den Acht Ceardchumann, 1975.
Forfheidhmiú na rialach le haghaidh rúnbhallóide.
16.—(1) Cuirfidh gach ceardchumann atá cláraithe faoi na hAchtanna Ceardchumann, 1871 go 1975, nó ceardchumann faoi dhlí tíre eile, tráth nach déanaí ná an dáta feidhme, cóip dá rialacha, ina gcorpraítear na forálacha dá dtagraítear i bhfo-alt (2) d'alt 14, ar aghaidh chuig Cláraitheoir na gCara-Chumann.
(2) Scoirfidh ceardchumann a mhainneoidh fo-alt (2) d'alt 14 nó fo-alt (1) den alt seo a chomhlíonadh de bheith i dteideal ceadúnas margántaíochta a shealbhú faoi Chuid II den Acht Ceárd-Chumann, 1941, agus beidh a cheadúnas láithreach arna chúlghairm ar an dáta feidhme.
(3) Ní dheonófar ceadúnas margántaíochta do chomhlacht daoine mura ndéanann sé, i dteannta na coinníollacha iomchuí a shonraítear in alt 7 den Acht Ceárd-Chumann, 1941, agus alt 2 den Acht Ceardchumann, 1971, arna leasú le halt 21 den Acht seo, a chomhall, fo-alt (2) d'alt 14 a chomhlíonadh, agus chun na críche sin beidh éifeacht leis an bhfo-alt sin ó dháta an Achta seo a rith.
(4) Ní dheonófar ceadúnas margántaíochta do chomhlacht daoine is ceardchumann faoi dhlí tíre eile mura ndéanann sé, i dteannta na coinníollacha dá dtagraítear i bhfo-alt (3) agus in alt 17 den Acht Ceardchumann, 1975, a chomhall, cóip dá rialacha ina gcorpraítear na forálacha dá dtagraítear i bhfo-alt (2) d'alt 14 a chur ar aghaidh, tráth an iarratais ar cheadúnas margántaíochta, chuig Cláraitheoir na gCara-Chumann.
(5) I gcás gur deimhin le Cláraitheoir na gCara-Chumann, tar éis imscrúdú cuí, gurb é polasaí nó cleachtas ceardchumainn atá cláraithe faoi na hAchtanna Ceardchumann, 1871 go 1975, nó ceardchumainn faoi dhlí tíre eile, neamhaird a thabhairt go buan ar aon cheanglas de na forálacha dá dtagraítear i bhfo-alt (2) d'alt 14 féadfaidh sé treoir a thabhairt don cheardchumann an ceanglas a chomhlíonadh. I gcás go dtabharfar neamhaird ar an treoir sin cuirfidh Cláraitheoir na gCara-Chumann é sin in iúl don Aire agus féadfaidh an tAire ceadúnas margántaíochta an cheardchumainn lena mbaineann a chúlghairm.
Gníomhartha contrártha do thoradh rúnbhallóide.
17.—(1) Ní bheidh feidhm ag ailt 10, 11 agus 12 maidir le himeachtaí a thig as nó a bhaineann le stailc nó gníomh tionscail eile ag ceardchumann nó grúpa oibrithe a thugann neamhaird ar thoradh rúnbhallóide a bhaineann leis an gceist nó leis na ceisteanna lena mbaineann an t-aighneas nó atá contrártha don toradh sin.
(2) I gcás ballóidí ag níos mó ná ceardchumann amháin, ciallóidh toradh rúnbhallóide dá dtagraítear i bhfo-alt (1) toradh na mballóidí comhiomlána.
(3) I gcás dhá rúnbhallóid nó níos mó a bheith déanta i ndáil le haighneas, ciallóidh an bhallóid dá dtagraítear i bhfo-alt (1) an bhallóid deiridh den sórt sin.
Neamhfheidhm ailt 14 go 17 maidir le cumainn fostóirí.
18.—Ní bheidh feidhm ag ailt 14 go 17 maidir le ceardchumann fostóirí.

19.—(1) I gcás rúnbhallóid a bheith déanta de réir rialacha ceardchumainn dá bhforáiltear in alt 14. agus gur toradh i bhfabhar stailce nó gnímh tionscail eile an toradh a bheidh uirthi nó, i gcás comhiomlánú ballóidí, an toradh a bheidh ar na ballóidí comhiomlána, agus go dtabharfaidh an ceardchumann, sula nglacfaidh sé páirt sa stailc nó sa ghníomh tionscail eile, fógra seachtaine ar a laghad don fhostóir lena mbaineann go bhfuil sé ar intinn aige déanamh amhlaidh, ní bheidh an fostóir sin i dteideal iarratas a dhéanamh chun aon chúirte ar urghaire ag srianadh na stailce nó an ghnímh tionscail eile mura mbeidh fógra faoin iarratas tugtha don cheardchumann agus dá chomhaltaí is páirtí san aighneas ceirde.
(2) I gcás rúnbhallóid a bheith déanta de réir rialacha ceardchumainn dá bhforáiltear in alt 14, agus gur toradh i bhfabhar stailce nó gnímh tionscail eile an toradh a bheidh uirthi nó, i gcás comhiomlánú ballóidí, an toradh a bheidh ar na ballóidí comhiomlána, agus go dtabharfaidh an ceardchumann, sula nglacfaidh sé páirt sa stailc nó sa ghníomh tionscail eile, fógra seachtaine ar a laghad don fhostóir lena mbaineann go bhfuil sé ar intinn aige déanamh amhlaidh, ní dheonóidh cúirt urghaire ag srianadh na stailce nó an ghnímh tionscail eile má shuíonn an freagróir cás cóir go raibh sé ag gníomhú d'intinn nó de chabhair le haighneas ceirde a chur ar aghaidh.
(3) Féadfar fógra dá bhforáiltear i bhfo-alt (1) a thabhairt do chomhaltaí ceardchumainn trí aird na gcomhaltaí sin a dhíriú ar dhoiciméad a bhfuil an fógra ann agus a mbeidh deis réasúnach ag na comhaltaí é a léamh i gcúrsa a bhfostaíochta nó a mbeidh fáil réasúnach acu air ar shlí éigin eile.
(4) Níl feidhm ag fo-ailt (1) agus (2)—
(a) maidir le himeachtaí a thig as nó a bhaineann le dul isteach go neamhdhleathach ar aon mhaoin de chuid duine eile nó fanacht go neamhdhleathach uirthi nó damáiste a dhéanamh go neamhdhleathach do mhaoin duine eile nó a chur faoi deara nó a cheadú damáiste a dhéanamh do mhaoin duine eile, nó
(b) maidir le himeachtaí a thig as aon ghníomh, nó a bhaineann le haon ghníomh, a bheidh nó is dóigh a bheidh ina thrúig bháis nó díobhála pearsanta.
(5) I gcás dhá rúnbhallóid nó níos mó a bheith déanta i ndáil le haighneas, is í an bhallóid dá dtagraítear i bhfo-ailt (1) agus (2) an bhallóid deiridh acu.

Athrú ar éarlais de dhroim athrú ar líon comhaltaí.
20.—(1) Laistigh de mhí amháin tar éis an 31 Nollaig gach bliain cuirfidh ceardchumann a shealbhaíonn ceadúnas margántaíochta ráiteas faoina líon comhaltaí ar an 31 Nollaig chuig an Aire agus, más gá éarlais a mhéadú nó a laghdú faoi Chuid II den Acht Ceárd-Chumann, 1941, arna leasú le halt 2 den Acht Ceardchumann, 1971, d'aon mhéid chun go mbeidh sí comhionann leis an tsuim iomchuí, déanfaidh an ceardchumann sin, tráth nach déanaí ná ceithre mhí tar éis an 31 Nollaig, an éarlais sin a mhéadú den mhéid sin nó iarratas a dhéanamh (mar a éilíonn an cás) ar an méid sin a fháil ar ais as an éarlais sin.
(2) Glacfaidh fo-alt (1) éifeacht ar an 1 Eanáir, 1991.
(3) Is í “an tsuim iomchuí” i bhfo-alt (1) an tsuim iomchuí—
(a) faoi alt 7 (2) den Acht Ceárd-Chumann, 1941, nó
(b) faoi alt 2 (4) den Acht Ceardchumann, 1971, nó
(c) faoi alt 21 (3) nó alt 21 (4) den Acht seo,

21.—(1) San alt seo ciallaíonn “Acht 1971” an tAcht Ceardchumann. 1971.
(2) Déantar leis seo alt 2 (1) (b) d'Acht 1971 (a thagraíonn don chomhaltas is lú chun ceadúnas margántaíochta a dheonú), a leasú, i ndáil le hiarratais ar cheadúnas margántaíochta a dhéanfar tar éis dháta rite an Achta seo, trí “1,000” a chur in ionad “500”.

Cónascthaí agus aistrithe.
22.—(1) Leasaítear leis seo alt 15 den Acht Ceardchumann, 1975 (a thagraíonn do dheontas i leith caiteachais a bhaineann le cónascthaí nó aistrithe) trí “a bheith neamhghnách agus” a scriosadh.
(2) Aon uair a dhéanann dhá cheardchumann nó níos mó iarracht ar chónascadh nó ar aistriú gealltanas a dhéanamh ó cheardchumann amháin go ceann eile agus go gcliseann ar an iarracht, féadfaidh an tAire, le toiliú an Aire Airgeadais, deontas, ina mbeidh cibé méid is cuí leis an Aire, a thabhairt do cheardchumann amháin nó níos mó de na ceardchumainn sin as airgead a sholáthróidh an tOireachtas, i leith na gcaiteachas sin is deimhin leis a thabhaigh an ceardchumann sin, sa tréimhse dhá bhliain díreach roimh an gcliseadh, i gcúrsa nó in oirchill na hiarrachta cónasctha nó aistrithe sin.
(3) I gcás go nglacfaidh ionstraim chónascacháin éifeacht, scoirfidh clárú aon chumainn cónascacháin d'éifeacht a bheith leis agus ar cheadúnas margántaíochta a dheonú don chumann nua scoirfidh aon cheadúnas margántaíochta a shealbhaíonn cumann cónascacháin d'éifeacht a bheith leis.
(4) I gcás go nglacfaidh ionstraim aistrithe gealltanas éifeacht, scoirfidh clárú aon chumainn is aistreoir agus aon cheadúnas margántaíochta a shealbhaíonn an cumann sin d'éifeacht a bheith leis.

Caidreamh Tionscail i gCoitinne
“Oibrí”.
23.—(1) Sna hAchtanna Caidrimh Thionscail, 1946 go 1976, agus sa Chuid seo, ciallaíonn “oibrí” aon duine 15 bliana d'aois nó níos mó a bhfuil conradh déanta aige le fostóir nó a oibríonn faoi chonradh d'fhostóir, cibé acu is conradh i ndáil le saothar láimhe, saothar cléireachais nó eile é, cibé acu sainráite nó intuigthe, ó bhéal nó i scríbhinn dó, agus cibé acu is conradh seirbhíse nó printíseachta é nó conradh aon obair nó saothar a dhéanamh go pearsanta lena n-áirítear, go háirithe, altra shíciatrach a bheidh fostaithe ag bord sláinte agus aon duine a bheidh ainmnithe de thuras na huaire faoi fho-alt (3) ach ní fholaíonn sé—
(a) duine atá ar fostú ag an Stát nó faoin Stát,
(b) múinteoir meánscoile,
(c) múinteoir scoile náisiúnta,
(d) oifigeach d'údarás áitiúil,
(e) oifigeach do choiste gairmoideachais, nó
(f) oifigeach do choiste freastail scoile.
(2) I bhfo-alt (1) ciallaíonn “údarás áitiúil”—
(a) comhairle contae, bardas contaebhuirge nó buirge eile, comhairle ceantair uirbigh, coimisinéirí baile, bord sláinte nó údarás sláintíochta calafoirt,
(b) coiste nó comhchoiste nó bord nó comhbhord arna cheapadh (cibé acu roimh nó i ndiaidh dháta rite an Achta seo) le reacht nó faoi reacht chun feidhmeanna nó aon cheann d'fheidhmeanna comhlachta amháin nó níos mó de na comhlachtaí a luaitear i mír (a) a chomhlíonadh, agus
(c) coiste nó comhchoiste nó bord nó comhbhord de chomhlacht amháin nó níos mó, nó arna cheapadh ag comhlacht amháin nó níos mó, de na comhlachtaí a luaitear i míreanna (a) agus (b) ach gan coiste gairmoideachais, coiste talmhaíochta ná coiste freastail scoile a áireamh.
(3) Féadfaidh an tAire Airgeadais ó am go ham—
(a) aon daoine (seachas státseirbhísigh bhunaithe de réir bhrí Acht Rialuithe na Stát-Sheirbhíse, 1956) atá fostaithe de bhua alt 30 (1) (g) den Acht Cosanta, 1954, nó atá fostaithe ag an Stát nó faoi, a ainmniú chun críche fho-alt (1), agus
(b) ainmniú aon daoine faoin bhfo-alt seo a chealú.
(4) Aon duine a bheidh ainmnithe de bhua alt 17 (2) (a) den Acht Caidrimh Thionscail, 1969, ar dháta rite an Achta seo, leanfaidh sé de bheith ainmnithe chun críche fho-alt (1) mura gcealaítear an t-ainmniú faoi fho-alt (3) (b).
(5) Féadfaidh an Rialtas le hordú an míniú ar “oibrí” i bhfo-alt (1) a leasú agus féadfaidh sé, le hordú, aon ordú den sórt sin a chúlghairm nó a leasú.
(6) Gach ordú a dhéanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe, beidh an t-ordú ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.
An Chúirt Oibreachais agus an Coimisiún um Chaidreamh Oibreachais
An Coimisiún a bhunú.
24.—(1) Beidh comhlacht ann ar a dtabharfar an Coimisiún um Chaidreamh Oibreachais chun na feidhmeanna a shanntar dó leis an Acht seo a chomhall.
(2) Beidh an Coimisiún arna bhunú cibé lá a cheapfaidh an tAire le hordú.
(3) Is é a bheidh sa Choimisiún cathaoirleach agus sé ghnáthchomhalta a cheapfaidh an tAire.
(4) Beidh feidhm ag an gCeathrú Sceideal a ghabhann leis an Acht seo maidir leis an gCoimisiún.
Feidhmeanna an Choimisiúin.
25.—(1) Beidh an Coimisiún freagrach i gcoitinne as feabhsú ar chaidreamh tionscail a chur chun cinn agus déanfaidh sé—
(a) seirbhís chomhréitigh a chur ar fáil;
(b) seirbhís chomhairleach caidrimh thionscail a chur ar fáil;
(c) cóid chleachtais i ndáil le caidreamh tionscail a ullmhú tar éis dul i gcomhairle le cumainn agus eagraíochtaí fostóirí;
(d) treoir a thairiscint i dtaobh cód cleachtais agus cuidiú chun aighnis a réiteach maidir lena gcur sin i bhfeidhm;
(e) oifigigh chomhionannais de chuid an Choimisiúin a cheapadh agus foireann agus saoráidí a chur ar fáil don tseirbhís oifigeach comhionannais;
(f) daoine a roghnú agus a ainmniú lena gceapadh mar choimisinéirí um chearta agus foireann agus saoráidí a chur ar fáil don tseirbhís coimisinéirí um chearta;
(g) taighde ar ábhair a bhaineann le caidreamh tionscail a sheoladh nó a choimisiúnú;
(h) athbhreithniú agus faireachán a dhéanamh ar fhorbairtí i réimse an chaidrimh thionscail;
(i) cuidiú le comhchoistí oibreachais agus comhchomhairlí tionscail i bhfeidhmiú a gcuid feidhmeanna.
(2) Féadfaidh an Coimisiún, ar iarraidh ó pháirtí amháin nó níos mó in aighneas ceirde nó ar a thionscnamh féin, a sheirbhísí iomchuí a thairiscint do na páirtithe d'fhonn teacht ar chomhréiteach.
(3) Ach amháin i gcás go mbeidh foráil shonrach ann chun aighnis cheirde a tharchur go díreach chuig an gCúirt Oibreachais, tarchuirfear aighnis cheirde ar dtús chuig an gCoimisiún nó chuig a sheirbhísí iomchuí.
(4) Féadfaidh an Coimisiún, más cuí leis, ar iarraidh nó ar a thionscnamh féin, cibé comhairle is iomchuí leis a chur ar fáil d'fhostóirí, do chomhlachais fostóirí, d'oibrithe agus do cheardchumainn ar aon ábhar a bhaineann le caidreamh tionscail.
(5) Is comhaltaí d'fhoireann an Choimisiúin, a bheidh ceaptha go cuí ag an gCoimisiún, a dhéanfaidh na feidhmeanna dá dtagraítear i bhfo-alt (1) (a), (b) nó (d) a chomhlíonadh thar ceann an Choimisiúin.
(6) Ní dhéanfaidh an Coimisiún, comhalta den Choimisiún ná aon duine dá fhoireann aon fhaisnéis a gheobhaidh sé i gcúrsa aon imeachtaí os a chomhair faoin Acht seo maidir le haon cheardchumann, nó maidir leis an ngnó a sheolann aon duine, nach mbeidh ar fáil in aon slí eile seachas trí fhianaise a thugtar ag na himeachtaí (lena n-áirítear comhdhálacha comhréitigh agus cruinnithe comhairleacha) a chur in aon tuarascáil gan toiliú an cheardchumainn nó an duine lena mbaineann, ná ní dhéanfaidh aon chomhalta den Choimisiún ná aon duine dá fhoireann ná aon duine a bhfuil baint aige leis na himeachtaí, gan toiliú den sórt sin, aon fhaisnéis den sórt sin a nochtadh.
(7) Ní bheidh feidhm ag fo-alt (6) maidir le tuarascáil chuig an gCúirt faoi alt 26 (1) (a) ná le fógra chuig an gCúirt faoi alt 26 (3) (a) ná le tuarascáil faoi alt 48 (3).

Imscrúdú aighnis ag an gCúirt.
26.—(1) Ní dhéanfaidh an Chúirt aighneas ceirde a imscrúdú—
(a) mura rud é, faoi réir fho-alt (3), go bhfaigheann sí tuarascáil ón gCoimisiún á rá go bhfuil an Coimisiún sásta nach gcuideoidh aon iarrachtaí breise dá chuid le réiteach a fháil ar an aighneas, agus
(b) murar iarr na páirtithe san aighneas ar an gCúirt an t-aighneas a imscrúdú.
(2) Folóidh an tuarascáil dá dtagraítear i bhfo-alt (1) (a) faisnéis faoi na saincheisteanna atá faoi aighneas, na hiarrachtaí a rinneadh chun an t-aighneas a réiteach agus aon fhaisnéis eile a mheasfaidh an Coimisiún a bheith mar chuidiú don Chúirt.
(3) D'ainneoin fho-alt (1) (a), féadfaidh an Chúirt aighneas a imscrúdú—
(a) má chuireann Cathaoirleach an Choimisiúin (nó aon chomhalta nó oifigeach de chuid an Choimisiúin a bheidh údaraithe aige) in iúl don Chúirt go ndéanann an Coimisiún, sna himthosca a shonraítear san fhógra, a fheidhm chomhréitigh san aighneas a tharscaoileadh, agus
(b) má iarrann na páirtithe san aighneas ar an gCúirt an t-aighneas a imscrúdú.
(4) Ní bheidh feidhm ag na forálacha sin roimhe seo den alt seo i ndáil le himscrúdú ar aighneas ceirde ag an gCúirt a bheidh tionscanta aici roimh bhunú an Choimisiúin ná i ndáil le hachomharc chuig an gCúirt i ndáil le moladh ó choimisinéir um chearta nó ó oifigeach comhionannais.
(5) Más rud é gurb é tuairim na Cúirte, tar éis dul i gcomhairle leis an gCoimisiún, i ndáil le haighneas ceirde a mbeadh, murach an fo-alt seo, bac uirthi, de bhua fho-alt (1), é a imscrúdú, go bhfuil imthosca eisceachtúla a dhlíonn go ndéanfadh sí amhlaidh, féadfaidh sí an t-aighneas a imscrúdú.
Nós imeachta an Choimisiúin.
27.—(1) Féadfaidh an Coimisiún gníomhú d'ainneoin dhá fholúntas ar a mhéid a bheith ina chomhaltas.
(2) Féadfaidh an Coimisiún rialacha a dhéanamh ó am go ham ag rialáil a nós imeachta agus a ghnó féin (lena n-áirítear córam a shocrú dá chruinnithe) agus tabharfaidh sé cóip d'aon rialacha den sórt sin don Aire a luaithe is féidir tar éis a ndéanta.
(3) Déanfaidh an Coimisiún gach bliain, ar cibé dáta a ordóidh an tAire, tuarascáil faoina ghníomhaíochtaí a thabhairt don Aire, lena n-áirítear cibé tuairimí is cuí leis an gCoimisiún a bhaineann le treochtaí agus forbairtí i gcaidreamh tionscail lena n-áirítear pá agus cuirfidh an tAire faoi deara cóipeanna den tuarascáil a leagan faoi bhráid gach Tí den Oireachtas.
(4) Soláthróidh an Coimisiún cibé faisnéis don Aire a éileoidh sé ó am go ham maidir lena chuid gníomhaíochtaí.
An príomhfheidhmeannach.
28.—(1) Beidh príomhoifigeach don Choimisiún ann ar a dtabharfar an príomhfheidhmeannach.
(2) Is é an tAire a cheapfaidh an chéad phríomhfheidhmeannach agus is é an tAire, tar éis dó dul i gcomhairle leis an gCoimisiún, a cheapfaidh gach príomhfheidhmeannach ina dhiaidh sin.
(3) Déanfaidh an tAire le toiliú an Aire Airgeadais téarmaí agus coinníollacha seirbhíse phost an phríomhfheidhmeannaigh a chinneadh.
(4) Féadfaidh an duine céanna a bheith i seilbh oifig an chathaoirligh agus phost an phríomhfheidhmeannaigh ar feadh cibé tréimhse agus faoi réir cibé coinníollacha a chinnfidh an tAire le toiliú an Aire Airgeadais.
(5) Féadfaidh an tAire an príomhfheidhmeannach a chur as oifig ar chúiseanna sonraithe.
Aoisliúntas agus aiscí le haghaidh agus i leith phríomhfheidhmeannach an Choimisiúin.
29.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, scéim nó scéimeanna a dhéanamh chun pinsin, aiscí agus liúntais eile a dheonú do, nó i leith, phríomhfheidhmeannach an Choimisiúin ar scor dá oifig dó nó ar a bhás.
(2) Féadfaidh an tAire, le toiliú an Aire Airgeadais, scéim a bheidh déanta aige faoin alt seo a leasú tráth ar bith.
(3) Déanfaidh an tAire scéim a bheidh déanta ag an Aire faoin alt seo a chur i gcrích de réir a téarmaí.
(4) Má bhíonn aon aighneas ann i dtaobh éileamh aon duine ar aon phinsean, aisce nó liúntas, nó i dtaobh méid aon phinsin, aisce nó liúntais, is iníoctha de bhun scéime faoin alt seo, cuirfear an t-aighneas sin faoi bhráid an Aire agus tarchuirfidh seisean é chun an Aire Airgeadais, agus is cinneadh críochnaitheach a bheidh ina chinneadhsan.
(5) Déanfar gach scéim a dhéanfaidh an tAire faoin alt seo a leagan faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a déanta agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an scéim a leagan faoina bhráid, rún a rith ag neamhniú na scéime, beidh an scéim ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin scéim.
Deontais don Choimisiún agus cumhacht chun iasacht a fháil.
30.—(1) Gach bliain airgeadais féadfar deontas de cibé méid a cheadóidh an tAire, le toiliú an Aire Airgeadais, a íoc leis an gCoimisiún as airgead a sholáthróidh an tOireachtas i leith chaiteachas an Choimisiúin i gcomhlíonadh a fheidhmeanna.
(2) Féadfaidh an Coimisiún, le toiliú an Aire, arna thabhairt le toiliú an Aire Airgeadais, iasacht de cibé suimeanna a éileoidh sé chun soláthar a dhéanamh do chaiteachas reatha a fháil go sealadach trí chomhshocrú le baincéirí.
Cuntais agus iniúchtaí.
31.—(1) Coimeádfaidh an Coimisiún, i cibé foirm a bheidh ceadaithe ag an Aire le toiliú an Aire Airgeadais, na cuntais go léir is cuí agus is gnách ar an airgead go léir a gheobhaidh sé nó a chaithfidh sé.
(2) Déanfaidh an Coimisiún na cuntais a choimeádfar de bhun an ailt seo a chur faoi bhráid an Ard-Reachtaire Cuntas agus Ciste gach bliain cibé tráthanna a ordóidh an tAire, le toiliú an Aire Airgeadais, lena n-iniúchadh, agus déanfar na cuntais sin, nuair a bheidh siad iniúchta amhlaidh (mar aon le tuarascáil an Ard-Reachtaire Cuntas agus Ciste orthu) a thíolacadh don Aire, agus cuirfidh seisean faoi deara cóipeanna de na cuntais iniúchta agus den tuarascáil a leagan faoi bhráid gach Tí den Oireachtas.
Foireann an Choimisiúin.
32.—(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, cibé foireann a cheapadh a mheasfaidh sé a bheith riachtanach chun cuidiú leis an gCoimisiún a chuid feidhmeanna a chomhlíonadh.
(2) Beidh ceapacháin faoin alt seo ar cibé téarmaí a chinnfidh an tAire le toiliú an Aire Airgeadais agus beidh siad faoi réir Acht Choimisinéirí na Stát-Sheirbhíse, 1956, agus Achtanna Rialaithe na Státseirbhíse, 1956 agus 1958.
Oifigigh chaidrimh thionscail agus seirbhís chomhairleach.
33.—(1) Féadfaidh an Coimisiún comhaltaí dá fhoireann a cheapadh chun gníomhú mar oifigigh chaidrimh thionscail.
(2) Déanfaidh na hoifigigh chaidrimh thionscail aon dualgais a chomhlíonadh a shannfaidh an Coimisiún dóibh trína chathaoirleach nó trína phríomhoifigeach feidhmiúcháin agus cuideoidh siad go háirithe chun aighnis cheirde a chosc agus a réiteach.
(3) Féadfaidh an Coimisiún comhaltaí dá fhoireann, lena n-áirítear oifigigh chaidrimh thionscail, a cheapadh chun comhairle i dtaobh nithe a bhaineann le caidreamh tionscail a thabhairt do lucht bainistíochta agus d'oibrithe nó dá n-ionadaithe.
Coimisinéirí um chearta.
34.—(1) I gcás go mbeartóidh an tAire coimisinéir um chearta a cheapadh faoi alt 13 (1) den Acht Caidrimh Thionscail, 1969, iarrfaidh sé ar an gCoimisiún rolla daoine a chur faoina bhráid agus ní cheapfaidh sé aon duine mar choimisinéir um chearta seachas duine a bheidh ar áireamh ar an rolla sin.
(2) Is tréimhse nach faide ná trí bliana téarma oifige coimisinéara um chearta a cheapfar de bhun fho-alt (1).
(3) Féadfaidh an tAire coimisinéir um chearta a athcheapadh ar feadh téarma nó téarmaí breise.
Seirbhís na gCoimisinéirí um Chearta.
35.—(1) Oibreoidh na coimisinéirí um chearta mar sheirbhís de chuid an Choimisiúin agus glacfar le tagairtí do choimisinéirí um chearta san Acht Caidrimh Thionscail, 1969, san Acht um Dhífhostú Éagórach, 1977, agus san Acht um Chosaint Mháithreachais d'Fhostaithe, 1981, mar thagairtí do choimisinéirí um chearta ag obair dóibh amhlaidh.
(2) Beidh coimisinéir um chearta neamhspleách agus é ag comhlíonadh a chuid feidhmeanna.
Agóidí agus achomhairc.
36.—(1) Ní bheidh aon éifeacht le hagóid faoi alt 13 (3) (b) (ii) den Acht Caidrimh Thionscail, 1969, ag páirtí in aighneas ceirde in aghaidh imscrúdú an aighnis ag coimisinéir um chearta mura gcuirfear in iúl í i scríbhinn don choimisinéir laistigh de thrí seachtaine tar éis fógra faoi tharchur an aighnis chuig an gcoimisinéir a bheith curtha leis an bpost chuig an bpáirtí sin.
(2) Ní bhreithneofar achomharc chun na Cúirte in aghaidh an mholta ó choimisinéir um chearta mura gcuirfear in iúl é i scríbhinn don Chúirt laistigh de shé seachtaine tar éis an moladh a dhéanamh.
(3) Déanfaidh coimisinéir um chearta gach moladh a dhéanfaidh sé a chur in iúl don Aire agus don Choimisiún, chomh maith lena chur in iúl don Chúirt.
(4) Ní fheidhmeoidh an Coimisiún a fheidhm chomhréitigh maidir le haighneas a ndearna coimisinéir um chearta moladh ina leith.
Oifigigh chomhionannais.
37.—(1) Féadfaidh an Coimisiún, le toiliú an Aire agus an Aire Airgeadais, comhaltaí dá fhoireann a cheapadh le bheith ina n-oifigigh chomhionannais agus tabharfar oifigeach comhionannais ar dhuine a cheapfar amhlaidh (agus gairtear sin de sa Chuid seo).
(2) Na hoifigigh chomhionannais a ceapadh roimh bhunú an Choimisiúin faoin Acht in aghaidh Idirdhealú (Pá), 1974, arna oiriúnú le halt 18 den Acht um Chomhionannas Fostaíochta, 1977, déanfaidh siad, tar éis an bhunaithe sin, a bhfeidhmeanna a chomhlíonadh mar oifigigh don Choimisiún agus ní don Chúirt.
(3) Beidh oifigeach comhionannais neamhspleách agus é ag comhlíonadh a chuid feidhmeanna.
(4) Scoirfidh alt 6 (1) den Acht sin 1974 d'éifeacht a bheith leis ar bhunú an Choimisiúin ach sin gan dochar d'aon cheapacháin a rinneadh roimhe sin faoin bhfo-alt sin.
(5) Aon tagairtí san Acht in aghaidh Idirdhealú (Pá), 1974, agus san Acht um Chomhionannas Fostaíochta, 1977, d'oifigigh chomhionannais léifear iad mar thagairtí d'oifigigh chomhionannais faoin alt seo.

38.—(1) Más é tuairim an Aire go ndéanann aighneas ceirde, cibé acu iarbhír nó tuartha é, difear do leas an phobail, féadfaidh sé an cheist a tharchur chuig an gCoimisiún nó chuig an gCúirt a dhéanfaidh iarracht an t-aighneas a réiteach.
(2) Más é tuairim an Aire gur aighneas a bhfuil tábhacht speisialta leis aighneas ceirde, féadfaidh sé a iarraidh ar an gCoimisiún nó ar an gCúirt nó ar dhuine nó ar chomhlacht eile, fiosrúchán a sheoladh maidir leis an aighneas agus tuarascáil a thabhairt dó ar na cinntí.

39.—Déanfaidh an Coimisiún athbhreithniú tréimhsiúil d'fhonn a fhionnadh cibé acu ar cheart, i dtuairim an Choimisiúin, comhchoistí oibreachais nua a bhunú nó, maidir le coistí láithreacha, cibé acu ar gá leasú a dhéanamh ar aon ordú bunaithe, nó ar cheart aon choiste a chur ar ceal agus cuirfidh sé cóip den athbhreithniú chuig an gCúirt agus chuig an Aire.

40.—Leasaítear leis seo alt 5 den Acht Caidrimh Thionscail, 1969, tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (1):
“(1) Féadfaidh an tAire, le toiliú an Aire Airgeadais, scéim nó scéimeanna a dhéanamh chun pinsin, aiscí agus liúntais eile a dheonú, ar scor dá n-oifig nó ar bhás dóibh, don chathaoirleach, do leaschathaoirleach (cibé acu ar ceapadh é faoi alt 4 (1) nó 4 (4) den Acht seo nó faoi alt 8 (3) den Acht Caidrimh Thionscail, 1976) a bheidh faoi cheangal ag an Aire a am oibre go léir a chaitheamh le dualgais oifig leaschathaoirligh, agus do ghnáthchomhaltaí na Cúirte nó i leith na ndaoine sin.”.

41.—Féadfaidh an tAire ordú a bheidh déanta aige faoi alt 8 (1) den Acht Caidrimh Thionscail, 1976, a leasú nó a chúlghairm.
Cóid Chleachtais
Cóid chleachtais.
42.—(1) Ullmhóidh an Coimisiún dréachtchóid chleachtais i dtaobh caidrimh thionscail lena gcur faoi bhráid an Aire, ar a thionscnamh féin nó ar iarraidh ón Aire.
(2) Sula gcuirfidh sé dréachtchód cleachtais faoi bhráid an Aire lorgóidh an Coimisiún agus breithneoidh sé tuairimí ó eagraíochtaí atá ionadaíoch d'fhostóirí agus ó eagraíochtaí atá ionadaíoch d'oibrithe, agus ó cibé comhlachtaí eile a mheasfaidh an Coimisiún is iomchuí.
(3) I gcás go bhfaighidh an tAire dréachtchód cleachtais ón gCoimisiún féadfaidh sé a dhearbhú le hordú gur cód cleachtais chun críocha an Achta seo an cód a bheidh sa sceideal a ghabhann leis an ordú.
(4) In aon imeachtaí os comhair cúirte, na Cúirte Oibreachais, an Choimisiúin, an Bhinse Achomhairc Fostaíochta, coimisinéara um chearta nó oifigigh chomhionannais beidh cód cleachtais inghlactha mar fhianaise agus cuirfear aon fhoráil den chód is dóigh leis an gcúirt, leis an gcomhlacht nó leis an oifigeach áirithe a bheith bainteach le haon cheist a éireoidh sna himeachtaí, san áireamh nuair a bheifear ag cinneadh na ceiste sin.
(5) Má mhainníonn aon duine aon fhoráil de chód cleachtais a urramú ní chuirfidh sé sin ann féin faoi dhliteanas é maidir le haon imeachtaí.
(6) Féadfaidh an tAire ar iarraidh ón gCoimisiún, nó tar éis dó dul i gcomhairle leis, cód cleachtais a chúlghairm nó a leasú le hordú.
(7) Gach ordú a dhéanfar faoin alt seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus má dhéanann ceachtar Teach, laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe, beidh an t-ordú ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú.
Feidhmeanna na Cúirte Oibreachais maidir le cóid chleachtais.
43.—(1) Féadfaidh an Chúirt, ar iarratas ó pháirtí nó páirtithe lena mbaineann, a tuairim a thabhairt maidir le léiriú ar chód cleachtais ar choinníoll, i gcás iarratais ó pháirtí amháin, gur thug an páirtí sin fógra faoin iarratas don pháirtí eile.
(2) Féadfaidh an Chúirt imscrúdú a dhéanamh ar ghearán go ndearnadh sárú ar chód cleachtais ar choinníoll gur tarchuireadh an gearán chun na Cúirte ag páirtí a bhí bainteach go díreach leis agus gur bhreithnigh an Coimisiún an gearán ar dtús de réir alt 26.
(3) I gcás gur imscrúdaigh an Chúirt gearán den sórt sin féadfaidh sí moladh a dhéanamh ag leagan síos a tuairime maidir leis an ábhar agus, más iomchuí, a tuairime maidir leis an mbeart is ceart do pháirtí atá ag sárú an chóid a dhéanamh, nó scor dá dhéanamh, chun a chinntiú go ndéanfar de réir an chóid.

44.—Beidh éifeacht le forálacha an Chúigiú Sceideal a ghabhann leis an Acht seo maidir le comhdhéanamh agus imeachtaí comhchoistí oibreachais.
Orduithe bunaithe a dhéanamh.
45.—(1) An lá chun fiosrúchán dhéanamh i dtaobh iarratais ar ordú bunaithe faoi alt 38 den Acht Caidrimh Thionscail, 1946, a fhógrófar i bhfógra faoin alt sin, is lá é nach mbeidh níos luaithe ná tríocha lá ó dháta foilsithe an fhógra nó nach déanaí ná seasca lá ó lá faighte an iarratais ag an gCúirt agus beidh alt 38 (b) (ii) den alt arna leasú dá réir sin.
(2) Déanfaidh an Chúirt ordú bunaithe, nó cuirfidh sí a cinneadh i bhfios nach bhfuil sí chun an t-ordú sin a dhéanamh, laistigh de dhá lá is daichead ó chríoch an fhiosrúcháin a rinneadh de réir an ailt sin 38.

46.—(1) Féadfaidh an Chúirt le hordú gnóthas lena mbaineann comhaontú fostaíochta cláraithe a eisiamh ó réim feidhmeanna comhchoiste oibreachais ar iarraidh ón bhfostóir agus ón ngrúpa oibrithe nó a n-ionadaithe sa ghnóthas ar choinníoll nach lú fabhar an luach saothair agus na coinníollacha fostaíochta dá bhfhoráiltear sa chomhaontú fostaíochta cláraithe ná iadsin dá bhforáiltear san ordú rialaithe fostaíochta iomchuí.
(2) Scoirfidh ordú faoi fho-alt (1) d'eifeacht a bheith leis—
(a) má thagann an luach saothair agus na coinníollacha fostaíochta dá bhforáiltear sa chomhaontú fostaíochta cláraithe chun bheith ina gcuid is lú fabhar ná iadsin dá bhforáiltear san ordú rialaithe fostaíochta iomchuí, nó
(b) má chúlghairtear an comhaontú fostaíochta cláraithe.
Tuarascáil chun cuidiú le comhchoiste oibreachais.
47.—(1) Féadfaidh an Chúirt, ar a tionscnamh féin nó ar iarraidh ó chomhchoiste oibreachais, socrú a dhéanamh chun tuarascáil a sholáthar mar gheall ar an tionscal nó ar an trádáil a thagann faoi réim an choiste agus ar staid a líon saothair, ag féachaint do na haidhmeanna ar lena n-aghaidh a bunaíodh an coiste.
(2) Féadfaidh an coiste iarraidh a dhéanamh ar thuarascáil faoi fho-alt (1) ar iarratas ón gcathaoirleach le ceadú ó thromlach chomhaltaí an choiste.
Tograí le haghaidh ordaithe rialaithe fostaíochta.
48.—(1) I gcás gur fhoirmigh comhchoiste oibreachais tograí le haghaidh ordaithe rialaithe fostaíochta, foilseoidh an coiste fógra ina luafar—
(a) an áit a bhfaighfear cóipeanna de na tograí;
(b) go bhféadfar uiríll maidir leis na tograí a dhéanamh chuig an gcoiste laistigh den tréimhse lá is fiche tar éis dháta an fhoilsithe sin.
(2) Féadfaidh an comhchoiste oibreachais, tar éis aon uiríll a mheas a rinneadh chuige de réir fho-alt (1), cibé tograí is cuí leis a chur faoi bhráid na Cúirte le haghaidh ordaithe rialaithe fostaíochta.
(3) Nuair a chuirfear tograí le haghaidh ordaithe rialaithe fostaíochta faoi bhráid na Cúirte, cuirfidh cathaoirleach an choiste tuarascáil faoi bhráid na Cúirte maidir leis na himthosca a bhaineann lena nglacadh.
(4) Féadfaidh an Chúirt le hordú, mar is cuí léi, éifeacht a thabhairt do na tograí ó cibé dáta (tar éis dháta an ordaithe) a shonróidh an Chúirt san ordú.
(5) (a) I gcás nach deimhin leis an gCúirt gur cheart di ordú a dhéanamh ag tabhairt éifeachta do na tograí, féadfaidh sí tograí leasaithe a chur faoi bhráid an choiste a mbeidh sí toilteanach glacadh leo.
(b) Féadfaidh an coiste, más cuí leis, na tograí leasaithe, fara nó d'éagmais modhnuithe, a chur faoi bhráid na Cúirte athuair.
(c) Féadfaidh an Chúirt, mar is cuí léi, ordú a dhéanamh ag tabhairt éifeachta do na tograí mar a cuireadh faoina bhráid athuair iad amhlaidh ó cibé dáta (tar éis dháta an ordaithe) is cuí leis an gCúirt agus a shonróidh sí san ordú nó féadfaidh sí diúltú ordú a dhéanamh.
Ordú rialaithe fostaíochta a fhorfheidhmiú ag cigire le himeachtaí sibhialta.
49.—(1) Féadfaidh cigire, thar ceann oibrí, imeachtaí sibhialta a thionscnamh chun aon cheart caingne de chuid an oibrí in aghaidh a fhostóra a fhorfheidhmiú maidir le mainneachtain an fhostóra coinníoll fostaíochta d'ordú rialaithe fostaíochta a chomhlíonadh agus in aon imeachtaí den sórt sin féadfar ordú a dhéanamh chun gurb é an cigire agus nach é an t-oibrí a íocfaidh na costais.
(2) An chumhacht a thugtar le fo-alt (1), ní maolú í ar aon cheart de chuid oibrí imeachtaí sibhialta a thionscnamh thar a cheann féin.

50.—Leasaítear leis seo alt 52 (2) (d) den Acht Caidrimh Thionscail, 1946 (a thagraíonn do mhainneachtain nó do dhiúltú aon cheanglas dleathach ó chigire a chomhlíonadh) trí “go toiliúil” i ndiaidh “dhiúltós” a scriosadh.
Comhaontuithe Fostaíochta Cláraithe
Taifid.
51.—(1) Coimeádfaidh fostóir aon oibrithe lena mbaineann comhaontú fostaíochta cláraithe cibé taifid is gá chun a thaispeáint go bhfuil an comhaontú fostaíochta cláraithe á chomhlíonadh agus coinneoidh sé na taifid ar feadh trí bliana.
(2) Má mhainníonn fostóir foráil d'fho-alt (1) a chomhlíonadh beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £500 a chur air.
(3) Más rud é, i gcás aon fhostóra a gceanglaítear air leis an alt seo taifid a choimeád, go gcoimeádfaidh sé aon taifead nó go gcuirfidh sé faoi deara aon taifead a choimeád, nó go dtabharfaidh sé aon taifead ar aird nó go gcuirfidh sé faoi deara, nó go gceadóidh sé go feasach, aon taifead a thabhairt ar aird do chigire, ar taifead é atá bréagach i bponc ábhartha agus a fhios aige é a bheith bréagach, beidh sé ciontach i gcion agus ar é a chiontú go hachomair dlífear fíneáil nach mó ná £1,000 nó príosúnacht ar feadh téarma nach faide ná trí mhí, nó iad araon, a chur air.

52.—Beidh na cumhachtaí iniúchta a thugtar do chigirí le halt 12 den Acht Caidrimh Thionscail, 1969, infheidhmithe chun forálacha alt 32 den Acht Caidrimh Thionscail, 1946, agus alt 51 den Acht seo a fhorfheidhmiú agus forléireofar an t-alt sin 12 agus an t-alt seo mar aon alt amháin.
Cruthúnas ar chomhaontú fostaíochta cláraithe agus nithe gaolmhara.
53.—(1) Beidh cóip den Iris Oifigiúil, a n-airbheartaítear ina leith go bhfuil fógra inti a d'fhoilsigh an Chúirt maidir le clárú comhaontaithe fostaíochta, ina fianaise prima facie go ndearnadh an comhaontú sin.
(2) Féadfar fianaise prima facie maidir le comhaontú fostaíochta cláraithe nó maidir le hathrú ar chomhaontú a thabhairt trí dhoiciméad a thabhairt ar aird a n-airbheartaítear ina leith gur cóip den chomhaontú nó den athrú é agus go bhfuil sé foilsithe ag an gCúirt.
(3) Beidh cóip den Iris Oifigiúil, a n-airbheartaítear ina leith go bhfuil fógra nó liosta inti a d'fhoilsigh an Chúirt faoi alt 31 den Acht Caidrimh Thionscail, 1946, ina fianaise prima facie ar ábhair an fhógra nó an liosta, lena n-áirítear aon sonraí a foilsíodh leis an gcéanna.

54.—(1) Féadfaidh cigire, más dóigh leis go bhfuil suim dlite ó fhostóir d'oibrí lena mbaineann comhaontú fostaíochta cláraithe nó gur mhainnigh an fostóir coinníoll d'aon chomhaontú den sórt sin a chomhlíonadh maidir leis an oibrí, imeachtaí sibhialta a thionscnamh thar ceann an oibrí sin chun an tsuim sin a ghnóthú nó chun an coinníoll sin a fhorfheidhmiú agus in aon imeachtaí den sórt sin féadfar ordú a dhéanamh chun gurb é an cigire agus nach é an t-oibrí a íocfaidh na costais.
(2) An chumhacht a thugtar le fo-alt (1), ní maolú í ar aon cheart de chuid oibrí imeachtaí sibhialta a thionscnamh thar a cheann féin.

AN CEATHRÚ SCEIDEAL
An Coimisiún um Chaidreamh Oibreachais
1. Beidh an Coimisiún um Chaidreamh Oibreachais ina chomhlacht corpraithe agus comharbas suthain agus séala oifigiúil aige agus beidh cumhacht agartha aige agus beidh sé inagartha faoina ainm corpraithe.
2. Is é an tAire a cheapfaidh an cathaoirleach tar éis dul i gcomhairle le cibé eagraíochtaí a mheasfaidh an tAire a bheidh ionadaíoch d'oibrithe agus d'fhostóirí agus ceapfar é ar feadh cibé tréimhse agus ar cibé téarmaí agus coinníollacha a chinnfidh an tAire.
3. Ar ghnáthchomhaltaí an Choimisiúin—
(a) beidh beirt ina gcomhaltaí oibrithe;
(b) beidh beirt ina gcomhaltaí fostóirí; agus
(c) ainmneoidh an tAire beirt díobh.
4. Is iad na comhaltaí oibrithe na daoine a bheidh ainmnithe lena gceapadh ag an Aire ag cibé eagraíocht nó eagraíochtaí a chinnfidh an tAire a bheith ionadaíoch do cheardchumainn oibrithe.
5. Is iad na comhaltaí fostóirí na daoine a bheidh ainmnithe lena gceapadh ag an Aire ag cibé eagraíocht nó eagraíochtaí a chinnfidh an tAire a bheith ionadaíoch d'fhostóirí.
6. Beidh gach gnáthchomhalta ina chomhalta páirtaimseartha den Choimisiún agus ceapfar é ar cibé téarmaí agus coinníollacha a chinnfidh an tAire.
7. Féadfar cibé liúntais le haghaidh caiteachas a chinnfidh an tAire, le toiliú an Aire Airgeadais, a íoc leis an gcathaoirleach agus le gach gnáthchomhalta as airgead a sholáthróidh an tOireachtas.
8. Féadfaidh an cathaoirleach nó gnáthchomhalta éirí as a oifig trí litir a bheidh dírithe chun an Aire.
9. Féadfaidh an tAire an cathaoirleach nó gnáthchomhalta a chur as oifig ar chúiseanna sonraithe.
10. (1) I gcás go ndéanfar an cathaoirleach nó gnáthchomhalta den Choimisiún a ainmniú mar chomhalta de Sheanad Éireann nó mar iarrthóir lena thoghadh chun ceachtar Tí den Oireachtas nó chun Parlaimint na hEorpa scoirfidh sé air sin de bheith i seilbh oifige.
(2) Duine a bheidh de thuras na huaire i dteideal faoi Bhuan-Orduithe ceachtar Tí den Oireachtas suí sa Teach sin nó ar comhalta é de Pharlaimint na hEorpa beidh sé, fad a bheidh sé i dteideal amhlaidh nó ina chomhalta den sórt sin, dícháilithe chun bheith ina chathaoirleach nó ina ghnáthchomhalta den Choimisiún.
11. Fíordheimhneofar séala an Choimisiúin le síniú an chathaoirligh nó gnáthchomhalta a bheidh údaraithe ag an gCoimisiún chun gníomhú chuige sin agus le síniú oifigeach don Choimisiún a bheidh údaraithe ag an gCoimisiún chun gníomhú chuige sin.
12. Tabharfar aird bhreithiúnach ar shéala an Choimisiúin agus glacfar i bhfianaise gach doiciméad a airbheartóidh gur ionstraim é a rinne an Coimisiún agus a bheith séalaithe le séala (a airbheartóidh a bheith fíordheimhnithe de réir mhír 11) an Choimisiúin agus measfar gurb é an ionstraim sin é gan chruthúnas mura suífear a mhalairt.
AN CÚIGIÚ SCEIDEAL
Comhdhéanamh agus Imeachtaí Comhchoistí Oibreachais
1. Sa Sceideal seo—
ciallaíonn “coiste” comhchoiste oibreachais;
ciallaíonn “na hAchtanna” na hAchtanna Caidrimh Thionscail, 1946 go 1990.
2. (1) Faoi réir mhír 3, is iad a bheidh ar choiste—
(a) comhalta amháin (dá ngairtear an comhalta neamhspleách sa Sceideal seo) a cheapfaidh an tAire agus a roghnófar mar dhuine a bheidh neamhspleách, a bheidh ina chathaoirleach ar an gcoiste, agus
(b) comhaltaí (dá ngairtear comhaltaí ionadaíocha sa Sceideal seo) a cheapfaidh an Chúirt arb é a bheidh iontu—
(i) cibé líon daoine is cuí leis an gCúirt (dá ngairtear sa Sceideal seo comhaltaí (fostóirí) ionadaíocha) a fheidhmíonn, i dtuairim na Cúirte, ar son fostóirí a mbeidh an coiste le gníomhú i ndáil leo, agus
(ii) comhlíon daoine (dá ngairtear sa Sceideal seo comhaltaí (oibrithe) ionadaíocha) a fheidhmíonn, i dtuairim na Cúirte, ar son oibrithe a mbeidh an coiste le gníomhú i ndáil leo.
(2) Sula gceapfaidh an Chúirt comhalta ionadaíoch de choiste rachaidh sí i gcomhairle le haon eagraíocht fostóirí nó, de réir mar a bheidh, le haon eagraíocht oibrithe, lena mbaineann, a mhéid is féidir go réasúnach.
(3) Ceapfaidh an tAire duine neamhspleách a ghníomhóidh mar chomhalta neamhspleách agus mar chathaoirleach d'uireasa an chathaoirligh agus folóidh tagairtí sna hAchtanna do chomhalta neamhspleách nó don chathaoirleach tagairtí do dhuine a ghníomhóidh amhlaidh.
(4) Beidh an comhalta neamhspleách de choiste i seilbh oifige fad is toil leis an Aire.
(5) I gcás go scoirfidh comhalta ionadaíoch de choiste, i dtuairim na Cúirte, de bheith ionadaíoch do na fostóirí nó, de réir mar a bheidh, do na hoibrithe ar ceapadh é le feidhmiú ar a son, foirceannfaidh an Chúirt a chomhaltas.
(6) Féadfaidh an Chúirt, dá rogha féin, comhaltas aon chomhalta ionadaíoch de choiste a fhoirceannadh.
(7) I gcás go bhfoirceannfar comhaltas aon chomhalta ionadaíoch de choiste scoirfidh an comhalta sin de bheith ina chomhalta den choiste.
3. I gcás an chomhchoiste oibreachais d'oibrithe talmhaíochta a bunaíodh faoi alt 4 den Acht Caidrimh Thionscail, 1976—
(a) ceapfaidh an tAire le toiliú an Aire Talmhaíochta agus Bia an comhalta neamhspleách;
(b) ceapfaidh an Chúirt na comhaltaí (fostóirí) ionadaíocha den choiste ó rolla a bheidh ullmhaithe agus tíolactha don Chúirt ag an Aire tar éis dó dul i gcomhairle le cibé eagraíocht nó eagraíochtaí a bheidh ionadaíoch d'fhostóirí talmhaíochtá is cuí leis an Aire le toiliú an Aire Talmhaíochta agus Bia;
(c) ceapfaidh an Chúirt na comhaltaí (oibrithe) ionadaíocha den choiste (suas go dtí líon ar cóimhéid le líon na gcomhaltaí (fostóirí) ionadaíocha) ó rolla a bheidh ullmhaithe agus tíolactha don Chúirt ag an Aire tar éis dó dul i gcomhairle le cibé eagraíocht nó eagraíochtaí a bheidh ionadaíoch d'oibrithe talmhaíochta is cuí leis an Aire le toiliú an Aire Talmhaíochta agus Bia;
(d) ní bheidh feidhm ag mír 2 (2).
4. Ní chuirfear imeachtaí coiste ó bhail mar gheall ar aon fholúntas ann ná aon locht ar cheapadh comhalta.
5. D'fhonn cruinniú coiste a bheith ann ní mór don chomhalta neamhspleách agus don tríú cuid ar a laghad de líon iomlán na gcomhaltaí ionadaíocha a bheith i láthair.
6. (1) Faoi réir fhorálacha na míre seo, beidh vóta amháin ag gach comhalta de choiste.
(2) Más rud é ag aon chruinniú coiste nach ionann líon an ghrúpa comhaltaí (fostóirí) ionadaíocha a bheidh i láthair agus líon an ghrúpa comhaltaí (oibrithe) ionadaíocha a bheidh i láthair—
(a) féadfaidh cibé grúpa de na grúpaí a dúradh a mbeidh tromlach acu a shocrú go staonfaidh aon duine amháin nó níos mó dá líon ó vótáil chun comhionannas a choimeád,
(b) mura ndéanfar aon socrú den sórt sin, féadfaidh cathaoirleach an choiste an vótáil ar aon cheist a chur ar atráth go dtí cruinniú eile den choiste.
7. (1) Tiocfaidh coiste le chéile ag cibé áiteanna agus tráthanna a chinnfidh sé ó am go ham a bheith oiriúnach chun a fheidhmeanna a chomhall agus féadfaidh sé aon cheann dá chruinnithe a chur ar athló.
(2) Glacfaidh coiste, ach amháin mar a fhoráiltear a mhalairt leis na hAchtanna, le cibé nós imeachta ag a chruinnithe agus in aon chás eile, a chinnfidh sé a bheith oiriúnach chun a fheidhmeanna a chomhall.
8. (1) Féadfaidh coiste, le toiliú na Cúirte, fochoistí a cheapadh chun cuidiú leis.
(2) Féadfaidh comhaltaí den choiste, agus cibé daoine eile a cheapfaidh an coiste le comhthoiliú na Cúirte, a bheith ar fhochoiste de choiste.
(3) Measfar gur fochoiste a cheap an coiste faoi fhomhír (1) den mhír seo coiste trádála ceantair, arna bhunú faoin Trade Boards Acts, 1909 and 1918, a bhunaigh coiste nuair ba bhord trádála é.
9. Féadfar cibé luach saothair agus liúntais (lena n-áirítear cúiteamh i gcailliúint ama) a chinnfidh an tAire, le toiliú an Aire Airgeadais, a íoc le comhaltaí coiste nó fochoiste.
10. I gcás gach comhchoiste oibreachais atá ar marthain ar dháta rite an Achta seo beidh na comhaltaí neamhspleácha i dteideal fanacht in oifig go dtí go gceapfar comhalta neamhspleách an choiste sin faoi mhír 2 (1) (a) nó 3, de réir mar a éileoidh an cás.
