AN tACHT UM BAINC THAISCE, 1958.

Léiriú.
1.—(1) San Acht seo—
ciallaíonn “na hAchta” na Trustee Savings Banks Acts, 1863 to 1920;
ciallaíonn “an tAire” an tAire Poist agus Telegrafa.
(2) Sa mhéid go mbaineann an tAcht seo le Banc Taisce an Phoist, forléireofar é féin agus na Post Office Savings Bank Acts, 1861 to 1920, mar aon ní amháin agus, sa mhéid go mbaineann sé le bainc thaisce iontaobhais, forléireofar é féin agus na hAchta mar aon ní amháin.
Earlaisí a ghlacadh agus a aisíoc.
2.—I gcás aon bhanc taisce iontaobhais, d'ainneoin aon ní sna hAchta nó sna rialacha agus na rialacháin chun an banc a bhainistí—
(a) féadfar taiscí a ghlacadh agus a aisíoc trí sheic nó ionstraim sho-shannta eile nó trí ordú poist nó ordú airgid,
(b) féadfar glacadh agus aisíoc taiscí a dhéanamh laistigh nó lasmuigh de ghnáth-uaire an bhainc sin do ghnó poiblí,
(c) féadfar méid taisce, pé acu le glacadh nó le aisíoc a bheidh sé, a sheachadadh tríd an bpost, agus
(d) chun críocha scéime taisce grúpa a bheidh á hoibriú ag an mbanc in aon áit, féadfaidh iontaobhaí, bainisteoir nó oifigeach íoctha don bhanc taiscí a ghlacadh thar ceann an bhainc san áit sin laistigh nó lasmuigh de ghnáth-uaire an bhainc do ghnó poiblí.

3.—(1) Féadfaidh iontaobhaithe bhainc thaisce iontaobhais, le toiliú an Aire, scéim a ullmhú agus a chur i bhfeidhm de réir a théarmaí chun go ndéanfar, faoi réir pé coinníollacha agus teoranta a forordófar sa scéim, sochair aoisliúntais faoi ghné pinsin nó aisce nó faoi ghné pinsin agus aisce a dheonadh do dhaoine, nó i leith daoine, lena mbaineann an t-alt seo.
(2) Féadfaidh na hiontaobhaithe aon tráth, le toiliú an Aire, scéim faoin alt seo a leasú.
(3) Maidir leis an méid a bheidh i sochair aoisliúntais faoi scéim faoin alt seo agus leis na coinníollacha a ghabhfaidh lena ndeonadh, lena bhforceannadh nó lena bhfionraí is méid é agus is coinníollacha iad a bheidh comhionann ar gach slí, a mhéid is féidir sin, le méid sochar aoisliúntais, agus leis na coinníollacha a ghabhann le deonadh, forceannadh nó fionraí sochar aoisliúntais, faoi na hAchta Aoisliúntas, 1834 go 1956, arna leasú nó arna leathnú le aon achtachán dá éis sin.
(4) Baineann an t-alt seo le—
(a) daoine a ghlacfaidh fostaíocht i mbuan-seirbhís lánaimsire an bhainc tar éis an tAcht seo a rith,
(b) daoine ar fostú i mbuan-seirbhís lán-aimsire an bhainc díreach roimh an Acht seo a rith agus a ghlacfaidh forála scéime faoin alt seo.
(5) Ní dheonfar cúiteamh faoi alt 3 den Savings Banks Act, 1904, do dhuine lena mbaineann an t-alt seo.
(6) Déanfar an costas faoina ngabhfaidh iontaobhaithe ag ullmhú agus ag seoladh scéime faoin alt seo a íoc mar chuid de chostas reatha an bhainc.
Leabhair thaisce gan rialacha iontu a eisiúint.
4.—(1) D'ainneoin aon ní in alt 52 den Trustee Savings Banks Act, 1863, féadfar leabhar taisce nach mbeidh cóip ann de rialacha deimhnithe bhainc thaisce iontaobhais a thabhairt do thaisceoir sa bhanc.
(2) Déanfar cóip de rialacha deimhnithe an bhainc a thabhairt, ar éileamh, do thaisceoir dar tugadh leabhar taisce den tsórt a sonraítear i bhfo-alt (1) den alt seo agus cuirfear cóipeanna de na rialacha sin ar fáil do thaisceoirí in oifig agus i mbrainsoifigí an bhainc.
Deireadh le sriantachtaí leis an méid cuntas a bheidh i mbainc thaisce.
5.—(1) Scoirfidh alt 38 den Trustee Savings Banks Act, 1863 (a thoirmisceas cuntais dhúbailte i mbainc thaisce iontaobhais), fo-alt (2) d'alt 1 den Savings Banks Act, 1887 (a fhorálann go dtoirmiscfidh rialacháin ar dhuine a bheith ina thaisceoir i mbanc taisce iontaobhais agus i mBanc Taisce an Phoist nó dhá chuntas ar leith a bheith aige i mBanc Taisce an Phoist), agus fo-alt (1) d'alt 12 den Savings Banks Act, 1891 (a dhéanann foráil chun méideanna a bheidh taiscthe go mídhleathach a fhorghéilleadh) d'éifeacht a bheith acu.
(2) Féadfaidh an tAire Airgeadais rialacháin a dhéanamh ag foráil an dearbhaithe a hiarrfar ar thaisceoir ar chuntas a oscailt i mbanc taisce iontaobhais agus féadfar ríalacháin a dhéanamh faoi alt 11 den Post Office Savings Bank Act, 1861, ag forordú an dearbhaithe a hiarrfar ar thaisceoir ar chuntas a oscailt i mBanc Taisce an Phoist.

6.—(1) Féadfar an tAcht um Bainc Thaisce, 1958, a ghairm den Acht seo.

SAVINGS BANKS ACT, 1958.
Interpretation.
1.—(1) In this Act—
“the Acts” means the Trustee Savings Banks Acts, 1863 to 1920;
“the Minister” means the Minister for Posts and Telegraphs.
(2) This Act, so far as it relates to the Post Office Savings Bank, shall be construed as one with the Post Office Savings Bank Acts, 1861 to 1920, and, so far as it relates to trustee savings banks, shall be construed as one with the Acts.
Receipt and repayment of deposits.
2.—In the case of any trustee savings bank, notwithstanding anything contained in the Acts or the rules and regulations for the management of the bank—
(a) deposits may be received and repaid by cheque or other negotiable instrument or by postal or money order,
(b) the receipt and repayment of deposits may be carried out either during or outside the usual hours of the bank for public business,
(c) delivery of the amount of a deposit, either for receipt or repayment, may be made by post, and
(d) for the purposes of a group savings scheme operated by the bank in any place, deposits may be received on behalf of the bank at that place by a trustee, manager or paid officer of the bank, either during or outside the usual hours of the bank for public business.
Superannuation of staff of trustee savings banks.
3.—(1) The trustees of a trustee savings bank may, with the consent of the Minister, prepare and carry out in accordance with its terms a scheme for the granting, subject to such conditions and limitations as may be prescribed in the scheme, of superannuation benefits by way of pension or gratuity or both to or in respect of persons to whom this section applies.
(2) The trustees may at any time, with the consent of the Minister, amend a scheme under this section.
(3) The amount of and conditions in relation to the grant, termination or suspension of superannuation benefits under a scheme under this section shall, as nearly as may be, be equivalent in all respects to the amount of and conditions in relation to the grant, termination or suspension of superannuation benefits under the Superannuation Acts, 1834 to 1956, as amended or extended by any subsequent enactment.
(4) This section applies to—
(a) persons who become employed in the permanent and whole-time service of the bank after the passing of this Act,
(b) persons who are employed in the permanent and whole-time service of the bank immediately before the passing of this Act and who adopt the provisions of a scheme under this section.
(5) A person to whom this section applies shall not be granted compensation under section 3 of the Savings Banks Act, 1904.
(6) The expenses incurred by the trustees in preparing and carrying out a scheme under this section shall be paid as part of the current expenses of the bank.
Issue of deposit books not containing rules.
4.—(1) Notwithstanding anything contained in section 52 of the Trustee Savings Banks Act, 1863, a deposit book which does not contain a copy of the certified rules of a trustee savings bank may be furnished to a depositor in the bank.
(2) A copy of the certified rules of the bank shall be furnished on request to a depositor to whom a deposit book of the kind specified in subsection (1) of this section has been furnished and copies of such rules shall be made available to depositors at the office and branch offices of the bank.
Removal of restrictions on number of accounts in savings banks.
5.—(1) Section 38 of the Trustee Savings Banks Act, 1863 (which prohibits double accounts in trustee savings banks), subsection (2) of section 1 of the Savings Banks Act, 1887 (which provides that regulations shall prohibit a person from being a depositor in both a trustee savings bank and the Post Office Savings Bank or from having two separate accounts in the Post Office Savings Bank), and subsection (1) of section 12 of the Savings Banks Act, 1891 (which provides for the forfeiture of amounts illegally deposited) shall cease to have effect.
(2) Regulations may be made by the Minister for Finance prescribing what declaration shall be required from a depositor on opening an account in a trustee savings bank and regulations may be made under section 11 of the Post Office Savings Bank Act, 1861, prescribing what declaration shall be required from a depositor on opening an account in the Post Office Savings Bank.
Short title and collective citation.
6.—(1) This Act may be cited as the Savings Banks Act, 1958.
(2) The Post Office Savings Bank Acts, 1861 to 1920, and so much of this Act as relates to the Post Office Savings Bank may be cited together as the Post Office Savings Bank Acts, 1861 to 1958.
(3) The Acts and as much of this Act as relates to trustee savings banks may be cited together as the Trustee Savings Banks Acts, 1863 to 1958.
