AGRICULTURAL CREDIT ACT, 1982

Definitions.

1.—In this Act—

“the Principal Act” means the Agricultural Credit Act, 1978,

“the Act of 1979” means the Agricultural Credit Act, 1979.

Amendment of section 12 of Principal Act.

2.—Section 12 of the Principal Act is hereby amended by the substitution of the following subsection for subsection (1) (inserted by the Act of 1979):

“(1) Subject to the approval of the Minister, the Corporation may raise or borrow money (including money in a currency other than the currency of the State) in any manner it thinks fit, but the amount of money raised or borrowed and outstanding at any one time shall not exceed £800,000,000.”.

Amendment of section 14 of Principal Act.

3.—Section 14 of the Principal Act is hereby amended by the substitution of the following subsection for subsection (2) (inserted by the Act of 1979):

“(2) The Minister shall not so exercise the powers conferred by subsection (1) that the amount, or the aggregate amount, of principal which he may at any one time be liable to pay on foot of any guarantee or guarantees under that subsection for the time being in force, together with the amount of principal (if any) which the Minister has previously paid on foot of any such guarantees and which has not been paid by the Corporation to the Minister, exceeds £800,000,000.”.

Short title, construction and collective citation.

4.—(1) This Act may be cited as the Agricultural Credit Act, 1982.

(2) The Agricultural Credit Acts, 1978 and 1979, and this Act shall be construed together as one Act and may be cited together as the Agricultural Credit Acts, 1978 to 1982.

2.—Leasaítear leis seo alt 12 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (1) (a cuireadh isteach le hAcht 1979):

“(1) Faoi réir cheadú an Aire, féadfaidh an Chorparáid airgead (lena n-áirítear airgead in airgead reatha seachas airgead reatha an Stáit) a chruinniú nó a fháil ar iasacht ar aon mhodh is oiriúnach léi ach ní rachaidh an méid airgid a chruinneofar nó a gheofar ar iasacht agus a bheidh gan íoc aon tráth áirithe thar £800,000,000.”.

3.—Leasaítear leis seo alt 14 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (2) (a cuireadh isteach le hAcht 1979):

“(2) Ní dhéanfaidh an tAire na cumhachtaí a thugtar le fo-alt (1) a fheidhmiú i slí gur mó ná £800,000,000 an méid, nó an méid comhiomlán, príomhshuime a dhlífidh sé aon tráth áirithe a íoc ar scór aon ráthaíochta nó ráthaíochtaí faoin bhfo-alt sin a bheidh i bhfeidhm de thuras na huaire i dteannta an méid (más aon mhéid é) príomhshuime a bheidh íoctha cheana féin ag an Aire ar scór aon ráthaíochtaí den sórt sin agus nach mbeidh íoctha ag an gCorparáid leis an Aire.”.

4.—(1) Féadfar an tAcht Cairde Talmhaíochta, 1982, a ghairm den Acht seo.

(2) Forléireofar na hAchtanna Cairde Talmhaíochta, 1978 agus 1979, agus an tAcht seo le chéile mar aon Acht amháin agus féadfar na hAchtanna Cairde Talmhaíochta, 1978 go 1982, a ghairm díobh le chéile.
