CUID I
Réamhráiteach agus Ginearálta
Gearrtheideal agus tosach feidhme.
1.—(1) Féadfar an tAcht Geallbhróicéirí, 1964, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh cibé lá a shocrófar chuige sin le hordú ón Aire.
Mínithe.
2.—San Acht seo, ach amháin mar a n-éilíonn an comhthéacs a mhalairt—
ciallaíonn “ceadúnas” ceadúnas faoi alt 8;
ciallaíonn “an tAire” an tAire Dlí agus Cirt;
folaíonn “geallbhróicéir” aon duine a bhfuil gnó á sheoladh aige ina nglacann sé earraí agus airnéisí i ngeall agus go háirithe (ach gan dochar do ghinearáltacht a bhfuil anseo roimhe seo) folaíonn sé duine ar bith—
(a) a fhaigheann nó a ghlacann ó aon duine eile aon earraí nó airnéisí mar urrús ar aisíoc aon suime airgid nach mó ná caoga punt a airleacadh orthu; nó
(b) a cheannaíonn, nó a fhaigheann nó a ghlacann isteach, earraí nó airnéisí agus a íocann nó a airleacann nó a thugann ar iasacht orthu aon suim airgid nach mó ná caoga punt le comhaontú nó comhthuiscint nó faoi chomhaontú nó comhthuiscint, sainráite nó intuigthe nó inbhainte go réasúnach mar thát ó nádúr an idirbhirt, go bhféadfaí na hearraí nó na hairnéisí sin a fhuascailt nó a cheannach ina dhiaidh sin ar théarmaí ar bith;
ciallaíonn “geallearbóir” duine a sheachadfaidh earra de gheall do gheallbhróicéir;
folaíonn “ticéad gill”, ach amháin in alt 14, ticéad gill conartha speisialta;
ciallaíonn “gealltán” earra a geallearbadh do gheallbhróicéir;
ciallaíonn “tréimhse fuascailte” tréimhse, dar tosach an chéad lá tar éis dáta an gheallearbtha, nach dleathach do gheallbhróicéir gealltán a dhíol nó a dhiúscairt laistigh di.
Feidhm.
3.—Baineann an tAcht seo le gach idirbheart a dhéanfar tar éis tosach feidhme an Achta seo maidir le gealltán ar a dtabharfaidh geallbhróicéir iasacht nó airleacan nach mó ná caoga punt do gheallearbóir ach ní bhaineann sé le haon idirbheart eile.
Seirbhísigh, gníomhairí agus ionadaithe do gheallbhróicéirí.
4.—(1) Aon ní a n-údaraítear leis an Acht seo do gheallbhróicéir é a dhéanamh, féadfaidh a sheirbhíseach nó a ghníomhaire é a dhéanamh.
(2) Chun críocha an Achta seo, aon ní a dhéanfaidh nó nach ndéanfaidh seirbhíseach nó gníomhaire do gheallbhróicéir i gcúrsa ghnó an gheallbhróicéara, measfar é a bheith déanta nó gan déanamh, cibé acu é, ag an ngeallbhróicéir.
(3) Beidh éifeacht ag na forálacha den Acht seo a bhaineann le geallbhróicéirí i gcás seiceadóirí agus riarthóirí geallbhróicéirí éagtha, ach ní bheidh seiceadóir ná riarthóir geallbhróicéara éagtha inchurtha go pearsanta faoi aon phionós nach é a ghníomh nó a mhainneachtain féin a thabhaigh é.
Cearta, etc., geallearbóirí a tharchur.
5.—(1) Aon chearta, cumhachtaí, príbhléidí agus sochair a fhorcoimeádtar nó a thugtar do gheallearbóirí leis an Acht seo, measfar iad a bheith forcoimeádta agus tugtha do shannaithe geallearbóirí agus do sheiceadóirí agus riarthóirí geallearbóirí éagtha.
(2) Aon duine a chuirfidh i gcéill do gheallbhróicéir gurb é an sannaí ag geallearbóir é nó gurb é an seiceadóir nó an riarthóir do gheallearbóir éagtha é, déanfaidh sé, má cheanglaíonn an geallbhróicéir air é, an ionstraim faoina bhfuil éileamh á dhéanamh aige a thabhairt ar aird don gheallbhróicéir.
Aisghairm agus foráil shealadach.
6.—(1) Déantar leis seo na hachtacháin atá leagtha amach sa Chéad Sceideal a aisghairm a mhéad a shonraítear sa tríú colún den Sceideal sin.
(2) D'ainneoin aisghairm na n-achtachán sin, leanfaidh na hachtacháin sin, go dtí an 31ú lá d'Iúil, 1965, d'éifeacht a bheith acu chun críche ceadúnas geallbhróicéara a dheonú do dhuine nach sealbhóir ar cheadúnas den sórt sin i dtosach feidhme an Achta seo.
CUID II
Geallbhróicéirí a Cheadúnú
Toirmeasc ar ghnó geallbhróicéara a sheoladh gan cheadúnas.
1842, c. 82.
7.—(1) Ní dhéanfaidh duine gnó geallbhróicéara a sheoladh in áitreabh ar bith mura bhfuil ceadúnas aige atá i bhfeidhm maidir leis an áitreabh sin.
(2) Aon duine is sealbhóir ar cheadúnas geallbhróicéara a deonaíodh faoin Stamp Duties (Ireland) Act, 1842, measfar, fad a shealbhóidh sé an ceadúnas sin, é a bheith ceadúnaithe go cuí chun críche fho-alt (1) den alt seo go dtí an 31ú lá d'Iúil is túisce a thiocfaidh tar éis tosach feidhme an Achta seo.
(3) Aon duine a sháróidh an t-alt seo, beidh sé ciontach i gcion.
Ceadúnas a dheonú.
8.—(1) Déanfaidh na Coimisinéirí Ioncaim, faoi réir forálacha an Achta seo—
(a) ar iarratas a dhéanamh chucu ag iarraidh ceadúnas chun gnó geallbhróicéara a sheoladh in áitreabh áirithe, agus
(b) ar dheimhniú a deonaíodh faoi alt 10 i leith an áitribh sin a bheith tugtha ar aird ag an iarratasóir, agus
(c) ar an dleacht mháil atá le híoc de thuras na huaire de réir dlí ag duine a bheidh ag tógáil amach ceadúnas den sórt sin a bheith íoctha leo ag an iarratasóir,
ceadúnas a dheonú don iarratasóir chun gnó geallbhróicéara a sheoladh san áitreabh sin.
(2) Tiocfaidh ceadúnas i bhfeidhm ar an dáta a shonrófar ann agus rachaidh sé in éag an 31ú lá d'Iúil is túisce a thiocfaidh ina dhiaidh sin.
Ceadúnas a aistriú.
9.—Féadfaidh geallbhróicéir a cheadúnas a aistriú chun duine eile dar deonaíodh deimhniú faoi alt 10 atá i bhfeidhm, ach ní bheidh éifeacht leis an aistriú go dtí go mbeidh an deimhniú tugtha ar aird do na Coimisinéirí Ioncaim agus formhuinithe acu.
Deimhniú a dheonú.
10.—(1) Féadfaidh an Chúirt Dúiche, ar iarratas a dhéanamh chuici, deimhniú a dheonú do dhuine á údarú ceadúnas a dheonú dó, faoi réir forálacha an Achta seo.
(2) Is gá deimhniú ar leith i gcás gach ceadúnais a bheidh á lorg.
(3) Tiocfaidh ceadúnas i bhfeidhm ar an dáta a shonrófar ann agus rachaidh sé in éag an 31ú lá d'Iúil is túisce a thiocfaidh ina dhiaidh sin.
(4) Ní dhiúltófar ceadúnas a thabhairt ach ar fhoras nó forais acu seo a leanas:
(a) nár tugadh ar aird fianaise shásúil ar dheacharachtar an iarratasóra;
(b) gur tugadh fianaise shásúil ar aird nach bhfuil an t-iarratasóir, nó aon duine atá freagrach nó le bheith freagrach i mbainistí a ghnó mar gheallbhróicéir, ina dhuine cuí oiriúnach chun deimhniú a shealbhú;
(c) go bhfuil an t-iarratasóir, nó aon duine atá freagrach nó le bheith freagrach i mbainistí a ghnó mar gheallbhróicéir, dícháilithe le hordú cúirte chun ceadúnas a fháil;
(d) nár shásaigh an t-iarratasóir an Chúirt gur duine diongbháilte ó thaobh airgeadais é;
(e) go bhfuil an t-iarratasóir ina shealbhóir ar cheadúnas geallghlacadóra a deonaíodh faoin Acht um Gheall-Chur, 1931;
(f) go bhfuil an t-iarratasóir ina shealbhóir ar cheadúnas chun deochanna meisciúla a dhíol;
(g) gur ceantálaí an t-iarratasóir; nó
(h) nach bhfuil áitreabh an iarratasóra oiriúnach chun gnó geallbhróicéara a sheoladh ann.
(5) Aon duine a bheidh éagóirithe trí dhiúltú na Cúirte deimhniú a dheonú, féadfaidh sé achomharc a dhéanamh chun na Cúirte Cuarda agus beidh breith na Cúirte sin ar an ábhar ina breith chríochnaitheach agus ní bheidh sí inachomhairc.
(6) Aon uair a dhiúltófar d'iarratas ar dheimhniú agus go dtaiscfear achomharc in aghaidh an diúltaithe, ansin, má bhí ceadúnas ag an iarratasóir an tráth a rinneadh an t-iarratas, féadfaidh na Coimisinéirí Ioncaim, gan aon dleacht a íoc, ach faoi réir cibé coinníollacha is cuí leo a fhorchur, ceadúnas sealadach a eisiúint don iarratasóir in aghaidh cibé tréimhse is cuí leo ach nach rachaidh thar seacht lá glan tar éis an t-achomharc a chinneadh, agus, fad a fhanfaidh sé i bhfeidhm, is ceadúnas de réir bhrí an Achta seo gach ceadúnas sealadach den sórt sin.
Ceadúnas a fhionraí agus a chealú.
11.—(1) Má chiontaítear geallbhróicéir i ngoid, in earraí a goideadh a ghlacadh agus a fhios aige gur goideadh iad, nó in aon chion eile a mbainfidh calaois nó mímhacántacht leis, féadfaidh an chúirt ar os a comhair a ciontaíodh é, i dteannta aon phionóis eile a chuirfear air, a ordú go bhfionrófar a cheadúnas go ceann cibé tréimhse is cuí léi nó go gcealófar é.
(2) Má chiontaítear geallbhróicéir i gcion a luaitear i bhfo-alt (1) den alt seo agus go n-ordóidh an chúirt a cheadúnas a fhionraí nó a chealú agus go ndéanfaidh an geallbhróicéir achomharc i gcoinne an chiontaithe nó, má ciontaíodh é i níos mó ná ceann amháin de na cionta sin, i gcoinne gach ceann de na ciontaithe, féadfaidh an chúirt ar os a comhair a ciontaíodh é, más cuí léi é, oibriú a hordaithe ag fionraí nó ag cealú an cheadúnais a chur ar fionraí le linn éisteacht an achomhairc a bheith ar feitheamh.
(3) Féadfaidh an Chúirt Dúiche, ar iarratas ó chomhalta den Gharda Síochána nach ísle céim ná cigire, ceadúnas a fhionraí go ceann cibé tréimhse is cuí léi, más deimhin léi go bhfuil an geallbhróicéir freisin ag seoladh gnó mar cheantálaí nó ina shealbhóir ar cheadúnas chun deochanna meisciúla a dhíol, nó ar cheadúnas geallghlacadóra a deonaíodh faoin Acht um Gheall-Chur, 1931, nó tar éis gníomhú contrátha d'aon cheann d'fhorálacha an Achta seo.
(4) Aon gheallbhróicéir a mbeidh a cheadúnas curtha ar fionraí faoi fho-alt (3) den alt seo, féadfaidh sé achomharc a dhéanamh chun na Cúirte Cuarda agus beidh breith na Cúirte sin ar an ábhar ina breith chríochnaitheach agus ní bheidh sí inachomhairc.
(5) Aon uair a bheidh ceadúnas curtha ar fionraí faoi fho-alt (3) den alt seo agus go dtaiscfear achomharc i gcoinne na fionraíochta, féadfaidh an Chúirt Dúiche, más cuí léi é, oibriú a hordaithe a fhionraí le linn éisteacht an achomhairc a bheith ar feitheamh.
(6) Ní dhéanfaidh fionraí, cealú ná neamh-athnuachan ceadúnais, dochar ná difear d'aon cheart chun gealltán a fhuascailt a cuireadh i ngeall roimh dháta an cheadúnais a fhionraí nó a chealú nó a dhul in éag, ná d'aon oibleagáid nó dliteanas (cibé acu de bhua conartha nó de bhua aon fhorála san Acht seo a d'éirigh sé) a bhí ar marthain ar an dáta sin, agus fanfaidh an geallbhróicéir a shealbhaigh an ceadúnas díreach roimh an dáta sin, maidir le haon ghealltán a bheidh ar seilbh aige ar an dáta sin, faoi réir na n-oibleagáidí, na ndliteanas agus na bpionós céanna a bheadh air dá leanadh an ceadúnas i bhfeidhm.
Deimhniú a bhrionnú.
12.—(1) (a) Aon duine a bhrionnóidh deimhniú nó a thairgfidh deimhniú agus a fhios aige é a bheith brionnaithe, beidh sé, gan dochar d'aon achtachán eile, ciontach i gcion.
(b) Ní fhorléireofar mír (a) den fho-alt seo ar dhóigh go bhféadfaí duine a phionósú faoi dhó mar gheall ar aon chion.
(2) Aon cheadúnas a dheonófar de bhun deimhniú a brionnaíodh, beidh sé ar neamhní.
(3) Aon duine a úsáidfidh deimhniú brionnaithe agus a fhios aige é a bheith brionnaithe, beidh sé dícháilithe chun ceadúnas a fháil aon uair ina dhiaidh sin.
Ainm agus fógra a thaispeáint.
13.—(1) Déanfaidh geallbhróicéir—
(a) a ainm agus an focal “Geallbhróicéir” a choimeád ar taispeáint i litreacha móra soléite os cionn an dorais ar an taobh amuigh den áitreabh ina bhfuil gnó geallbhróicéara á sheoladh aige, agus
(b) fógra ar a mbeidh an t-eolas atá leagtha amach sa Dara Sceideal a choimeád ar taispeáint in áit fheiceálach san áitreabh sin agus é clóite i litreacha móra soléite.
(2) Aon gheallbhróicéir a mhainneoidh déanamh de réir ceanglais atá i bhfo-alt (1) den alt seo, beidh sé ciontach i gcion.
CUID III
Gealltáin a Gheallearbadh, a Fhuascailt agus a Dhíol
Ticéid ghill.
14.—(1) Déanfaidh geallbhróicéir, ar ghealltán a ghlacadh i ngeall, ticéad gill a thabhairt don gheallearbóir agus ní ghlacfaidh sé gealltán i ngeall mura dtógfaidh an geallearbóir ticéad gill.
(2) Beidh i dticéad gill na sonraí atá leagtha amach san fhoirm iomchuí i gCuid I nó i gCuid II den Tríú Sceideal.
(3) Aon gheallbhróicéir a mhainneoidh déanamh de réir aon cheanglais san alt seo beidh sé ciontach i gcion.
Conarthaí speisialta agus ticéid ghill chonartha speisialta.
15.—(1) D'ainneoin aon ní san Acht seo, féadfaidh geallbhróicéir conradh speisialta a dhéanamh le geallearbóir i leith gealltáin ar a dtabharfaidh an geallbhróicéir iasacht is mó ná deich bpunt.
(2) (a) Má dhéanann geallbhróicéir conradh speisialta le geallearbóir, tabharfaidh sé don gheallearbóir tráth an gheallearbtha ticéad gill conartha speisialta ina mbeidh na sonraí atá leagtha amach i gCuid III den Tríú Sceideal agus a bheidh sínithe ag an ngeallbhróicéir.
(b) Ní ghlacfaidh geallbhróicéir gealltán i ngeall faoi chonradh speisialta faoin alt seo mura dtógfaidh an geallearbóir ticéad gill conartha speisialta.
(3) Síneoidh an geallearbóir dúblach den ticéad gill conartha speisialta.
(4) Ní bheidh ticéad gill conartha speisialta, ná a dhúblach, inchurtha faoi dhleacht stampa.
(5) Bainfidh forálacha an Achta seo le conradh speisialta faoin alt seo ach amháin sa mhéid go n-eisiafar iad le téarmaí an chonartha.
(6) Aon gheallbhróicéir a mhainneoidh déanamh de réir mhír (a), nó a sháróidh mír (b), d'fho-alt (2) den alt seo, beidh sé ciontach i gcion.
Leabhair agus taifid gheallbhróicéara.
16.—(1) Déanfaidh gach geallbhróicéir i gcúrsa a ghnó—
(a) leabhar gealltán agus leabhar díolacháin a choimeád san fhoirm atá leagtha amach i gCuid I agus i gCuid II, faoi seach, den Cheathrú Sceideal, agus
(b) na doiciméid atá leagtha amach sa Tríú Sceideal a úsáid, de réir mar is gá sa chás, sna foirmeacha a shonraítear ansin.
(2) Déanfaidh gach geallbhróicéir, i gcúrsa a ghnó, na sonraí a shonraítear sa Tríú agus sa Cheathrú Sceideal a thaifeadadh go soiléir soléite, de réir mar is gá sa chás, in aon leabhar nó doiciméad a cheanglaítear air a choimeád nó a úsáid, agus beidh de dhualgas ar gach geallbhróicéir gach fiosrú is gá a dhéanamh chun an fo-alt seo a chomhlíonadh.
(3) Aon gheallbhróicéir a mhainneoidh déanamh de réir aon cheanglais san alt seo beidh sé ciontach i gcion.
Iasachtaí in airgead reatha.
17.—(1) Gach suim a airleacfaidh geallbhróicéir i leith earraí a ghlacfaidh sé i ngeall, beidh sí in airgead reatha atá maith agus dleathach, agus ní dhéanfar suas ná ní shlánófar aon suim den sórt sin trí luach, sochar ná íocaíocht d'aon chineál eile a áireamh inti.
(2) Aon gheallbhróicéir a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion.
(3) Má chiontaítear geallbhróicéir i gcion faoin alt seo, ansin, cibé acu a ghearrfaidh an chúirt pionós nó nach ngearrfaidh—
(a) ordóidh sí go ndéanfaidh an geallbhróicéir an tsuim is iníoctha go cuí a íoc leis an ngeallearbóir in airgead reatha atá maith agus dleathach; agus
(b) féadfaidh sí dá rogha féin a ordú don gheallearbóir an t-iomlán nó aon chuid den luach, den sochar nó den íocaíocht de chineál eile a tugadh don gheallearbóir a aisíoc leis an ngeallbhróicéir nó a thabhairt ar ais dó.
Toirmeasc ar iasacht a roinnt.
18.—(1) Ní dhéanfaidh geallbhróicéir méid na hiasachta a lorgóidh aon iasachtaí a roinnt ina suimeanna is lú ná méid na hiasachta.
(2) Aon gheallbhróicéir a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion.
Srianta ginearálta ar gheallbhróicéir.
19.—(1) Ní dhéanfaidh geallbhróicéir—
(a) go feasach aon ní a ghlacadh i ngeall ó dhuine faoi bhun sé bliana déag d'aois cibé acu thar a cheann féin nó thar ceann duine eile a thairgfidh an duine sin é lena gheallearbadh;
(b) aon ní a ghlacadh i ngeall ó dhuine a dhealraíonn a bheith ar meisce;
(c) aon ní a ghlacadh i ngeall ó dhuine is eol dó a bheith ina ghnáthmheisceoir;
(d) ticéad gill a d'eisigh sé féin nó geallbhróicéir eile a cheannach ná a ghlacadh i ngeall ná a mhalartú;
(e) aon ghealltán a bheidh i ngeall aige féin a cheannach, ach amháin ar ceant a chuirfear ar siúl faoin Acht seo;
(f) aon chonradh ná comhaontú le haon duine a bheidh ag geallearbadh aon earra nó á thairiscint é a gheallearbadh, ná le húinéir aon earra, chun an earra a cheannach, a dhíol nó a dhiúscairt laistigh den tréimhse fuascailte;
(g) aon duine faoi bhun sé bliana déag d'aois a fhostú chun earraí a ghlacadh i ngeall;
(h) aon earra a ghlacadh i ngeall más eol dó, nó má tá cúis réasúnach aige chun bheith in amhras, go mbeadh an geallearbadh ina shárú ar alt 25;
(i) aon arm tine ná aon lón lámhaigh a ghlacadh i ngeall; ná
(j) aon ghealltán a dhíol ná a dhiúscairt ar dhóigh eile ach amháin de réir an Achta seo.
(2) Aon gheallbhróicéir a sháróidh aon fhoráil d'fho-alt (1) den alt seo beidh sé ciontach i gcion.
(3) Má chúisítear geallbhróicéir i rud a ghlacadh i ngeall ó dhuine faoi bhun sé bliana déag d'aois, cibé acu thar a cheann féin nó thar ceann duine eile a thairg an duine sin an rud lena gheallearbadh, is cosaint mhaith dó a shuíomh nach raibh a fhios aige, agus nach raibh aon chúis aige chun bheith in amhras, go raibh an duine faoi bhun sé bliana déag d'aois.
Ús dleathach agus muirir dhleathacha.
20.—(1) Féadfaidh geallbhróicéir ús a mhuirearú ar iasacht ar ghealltán de réir ráta nach mó ná mar a shonraítear i gCuid I den Chúigiú Sceideal.
(2) Féadfaidh geallbhróicéir na muirir a shonraítear i gCuid II, III, IV agus V den Chúigiú Sceideal a éileamh agus a ghlacadh.
(3) Déanfaidh geallbhróicéir, má cheanglaítear sin air an tráth a fhuasclófar aon ghealltán, admháil a thabhairt, a bheidh san fhoirm atá leagtha amach i gCuid IV den Tríú Sceideal, ar mhéid na hiasachta, an úis agus na muirear a íocadh leis.
(4) Má chuireann geallbhróicéir de mhuirear ar iasacht ar ghealltán ús is mó ná mar a cheadaítear le fo-alt (1) den alt seo, nó má ghlacann nó má éilíonn sé muirear is mó ná mar a cheadaítear le fo-alt (2) den alt seo, nó má mhainníonn nó má dhiúltaíonn sé admháil a thabhairt de réir fho-alt (3) den alt seo, beidh sé ciontach i gcion.
Tréimhsí fuascailte.
21.—(1) Faoi réir fho-ailt (3) agus (4) den alt seo, is í tréimhse ar laistigh di a fhéadfar gealltán (seachas gealltán a bheidh déanta suas go hiomlán nó go páirteach d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar) a fhuascailt ó gheallbhróicéir, ná tréimhse sé mhí ón dáta a tugadh an iasacht ach, má íoctar an t-ús ar an iasacht laistigh den tréimhse sin, déanfar an tréimhse ina bhféadfar an gealltán sin a fhuascailt a fhadú tréimhse sé mhí ón dáta ar anuas go dtí é a íocadh an t-ús.
(2) Faoi réir fho-ailt (3) agus (4) den alt seo, is bliain an tréimhse ina bhféadfar gealltán a fhuascailt a bheidh déanta suas go hiomlán nó go páirteach d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar.
(3) Cuirfear leis na tréimhsí a luaitear i bhfo-ailt (1) agus (2) den alt seo tréimhse bhreise seacht lá nach dleathach do gheallbhróicéir gealltán a dhíol ná a dhiúscairt ar a feadh agus a mbeidh an gealltán infhuascailte laistigh di.
(4) I gcás gealltán a geallearbadh ar shuim is mó ná dhá phunt, agus gealltán a bheidh déanta suas, go hiomlán nó go páirteach, d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar fanfaidh an gealltán infhuascailte thairis sin go dtí go ndiúscrófar é mar a fhoráiltear san Acht seo cé go mbeidh an tréimhse fuascailte dulta in éag.

22.—(1) Toimhdeofar, amhail idir an geallearbóir agus an geallbhróicéir, gurb é an sealbhóir de thuras na huaire ar thicéad gill an duine atá i dteideal an gealltán lena mbaineann an ticéad a fhuascailt agus dá réir sin, faoi réir forálacha an Achta seo, déanfaidh geallbhróicéir, ar thicéad gill a sheachadadh dó agus ar an iasacht agus an t-ús agus aon mhuirir eile is iníoctha faoin Acht seo a íoc leis, an gealltán a sheachadadh don duine a thairgfidh an ticéad, agus coimeádfaidh an geallbhróicéir an ticéad go ceann tréimhse nach lú ná bliain.
(2) Ní bheidh sé de cheangal ar gheallbhróicéir, ach amháin mar a fhoráiltear a mhalairt san Acht seo, gealltán a thabhairt suas mura seachadfar dó an ticéad gill a bhaineann leis.

23.—Aon duine—
(a) a thairgfidh aon earra do gheallbhróicéir i modh gill agus nach bhféadfaidh, nó a dhiúltóidh, cuntas sásúil a thabhairt ar an dóigh ina bhfuair sé seilbh ar an earra;
(b) a thabharfaidh go toiliúil eolas bréagach do gheallbhróicéir faoi úinéireacht earra a thairgfidh sé don gheallbhróicéir i modh gill nó faoina ainm nó a sheoladh féin nó faoi ainm nó seoladh úinéir an earra; nó
(c) a fhuasclóidh gealltán nó a fhéachfaidh lena fhuascailt, nó a thabharfaidh ar dhuine eile gealltán a fhuascailt nó féachaint lena fhuascailt, gan bheith i dteideal é sin a dhéanamh,
beidh sé ciontach i gcion.
Neamhsheachadadh gealltáin do dhuine atá ina theideal.
24.—(1) Aon gheallbhróicéir a dhiúltóidh nó a mhainneoidh gan chúis réasúnach (a mbeidh a cruthú air féin) gealltán a sheachadadh don duine atá ina theideal, beidh sé ciontach i gcion.
(2) Má chúisítear geallbhróicéir i gcion faoin alt seo, féadfaidh an chúirt, más cuí léi é, cibé acu a ghearrfaidh sí nó nach ngearrfaidh sí pionós, a ordú—
(a) go seachadfar an gealltán don duine atá ina theideal,
(b) go n-íocfaidh an duine sin an t-iomlán nó cuid de mhéid na hiasachta nó an úis agus na muirear dleathach eile, nó
(c) go ndéanfar an seachadadh sin agus an íocaíocht sin araon.
Maoin duine eile a gheallearbadh go neamhdhleathach.
25.—(1) Aon duine a dhéanfaidh go feasach aon earra is le duine eile a gheallearbadh gan toiliú an duine eile sin beidh sé ciontach i gcion.
(2) Má chiontaítear duine i gcion faoin alt seo, féadfaidh an chúirt, i dteannta aon fhíneála a ghearrfar, a ordú dó suim nach lú ná luach iomlán an earra, mar a chinnfidh an chúirt é, a íoc le húinéir an earra mar chúiteamh.
Maoin a geallearbadh go neamhdhleathach a sheachadadh don úinéir.
26.—(1) Más rud é—
(a) go gciontóidh aon chúirt duine ar bith faoin Acht seo in aon earraí nó airnéisí de chuid duine eile a gheallearbadh go feasach agus go héagórach le geallbhróicéir, nó
(b) go gciontófar duine ar bith in aon earraí nó airnéisí a ghoid nó a fháil trí chalaois agus gur léir don chúirt go ndearnadh na hearraí nó na hairnéisí a gheallearbadh le geallbhróicéir, nó
(c) gur léir do chúirt i gcúrsa aon imeachtaí go ndearnadh aon earraí nó airnéisí a bheidh os a comhair a gheallearbadh go neamhdhleathach le geallbhróicéir,
féadfaidh an chúirt, dá rogha féin, ar úinéireacht na n-earraí nó na n-airnéisí a chruthú, a ordú go seachadfar don úinéir iad, i dteannta nó d'éagmais an t-iomlán nó cuid de mhéid na hiasachta a fuarthas de bhua an gheallearbtha a bheith le híoc ag an úinéir leis an ngeallbhróicéir.
(2) Sula ndéanfaidh an chúirt ordú faoi fho-alt (1) den alt seo, tabharfaidh sí aird ar aon mhainneachtain ar thaobh úinéir na n-earraí nó na n-airnéisí faoi chúram réasúnach a ghlacadh ag cosaint a mhaoine, ach amháin sa mhéid gur saibhríodh an geallbhróicéir go míchóir.

27.—Más rud é, maidir le gealltán ar iasacht suime is mó ná dhá phunt nó gealltán a bheidh déanta suas, go hiomlán nó go páirteach, d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar—
(a) nach ndéanfaidh an geallbhróicéir an gealltán a dhíol bona fide de réir an Achta seo, nó
(b) go dtaifeadfaidh an geallbhróicéir ina leabhar díolacháin gur díoladh gealltán ar shuim is lú ná an tsuim ar ar díoladh é,
beidh sé ciontach i gcion.
Úinéirí agus geallearbóirí gealltán nach mbeidh ticéid ghill acu.
28.—(1) Aon duine—
(a) a éileoidh gurb é an t-úinéir ar ghealltán é ach nach bhfuil an ticéad gill aige, nó
(b) a éileoidh go bhfuil sé i dteideal ticéad gill a bheith aige, agus a líomhnóidh gur cailleadh, gur ligeadh amú, gur díothaíodh nó gur goideadh an ticéad nó gur baineadh de é trí chalaois,
féadfaidh sé, ar an táille a ordaítear i gCuid V den Chúigiú Sceideal a íoc, a iarraidh ar an ngeallbhróicéir an fhoirm iomchuí do dhearbhú reachtúil atá leagtha amach sa Séú Sceideal a thabhairt dó.
(2) Má thugann an duine ar ais don gheallbhróiceír foirm an dearbhaithe reachtúil agus í comhlánaithe go cuí laistigh de thrí lá (gan aon lá a bhfuil toirmeasc ar an ngeallbhróicéir gnó a dhéanamh air a chur san áireamh) tar éis an fhoirm a thabhairt dó, beidh aige, amhail idir é féin agus an geallbhróicéir, na cearta agus na leigheasanna céanna i leith an ghealltáin a bheidh aige dá dtugadh sé an ticéad gill ar aird.
(3) Déantar leis seo an geallbhróicéir a shlánú—
(a) as diúltú an gealltán a sheachadadh d'aon duine eile go dtí go mbeidh na trí lá sin caite,
(b) as an ngealltán a sheachadadh don duine, mura raibh fógra iarbhír nó fógra inchiallaithe aige go raibh an dearbhú reachtúil bréagach in aon phonc ábhartha, agus
(c) as mainniú an gealltán a sheachadadh don duine láithreach ar fhoirm an dearbhaithe reachtúil a thabhairt ar ais, más é ba chúis leis an mainneachtain a dheacracht a bhí sé an gealltán a aithint toisc gan uimhir an ghealltáin a bheith ar eolas.
(4) Aon gheallbhróicéir a mhainneoidh déanamh de réir iarraidh faoi fho-alt (1) den alt seo beidh sé ciontach i gcion.
Gealltáin neamhfhuascailte.
29.—(1) Ach amháin i gcás gealltáin a bheidh déanta suas, go hiomlán nó go páirteach, d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar, tiocfaidh gealltán a geallearbadh ar shuim nach mó ná dhá phunt chun bheith ina mhaoin de chuid an gheallbhróicéara go hiomlán mura bhfuasclaítear é laistigh den tréimhse fuascailte (lena n-áirítear na seacht lá dá dtagraítear i bhfo-alt (3) d'alt 21).
(2) I gcás gealltáin a geallearbadh ar shuim is mó ná dhá phunt nó gealltáin atá déanta suas, go hiomlán nó go páirteach, d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar, féadfaidh an geallbhróicéir, mura bhfuasclaítear é laistigh den tréimhse fuascailte é a dhiúscairt trína dhíol ar cheant poiblí a chuirfear ar siúl de réir an Achta seo, ach ní fhéadfaidh ar aon dóigh éile.
Gealltáin a dhíol.
30.—(1) Is ceantálaí a ainmneoidh an tAire a stiúrfaidh gach ceant ar ghealltáin gheallbhróicéirí.
(2) Féadfaidh an tAire, chun críche an ailt seo, ceantálaithe a ainmniú do limistéir shonraithe, agus féadfaidh sé ainmniúchán a fhoirceannadh tráth ar bith.
(3) Is in áitreabh an cheantálaí a bheidh ag stiúradh an cheant a stiúrfar gach ceant ar ghealltáin gheallbhróicéirí.
(4) Is de réir na rialachán atá sa Seachtú Sceideal a stiúrfar gach ceant ar ghealltáin gheallbhróicéirí.

31.—Féadfaidh geallbhróicéir, ag ceant a chuirfear ar siúl faoin Acht seo, tairiscint a dhéanamh ar ghealltán a geallearbadh leis agus é a cheannach.
Ceart chun an leabhar díolacháin agus an chatalóg a scrúdú.
32.—(1) An duine ag a mbeidh ticéad gill i léith gealltáin a geallearbadh ar shuim is mó ná dhá phunt nó i leith aon ghealltáin atá déanta suas, go hiomlán nó go páirteach, d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar, féadfaidh sé, tráth ar bith roimh dheireadh dhá mhí dhéag ón dáta a díoladh na hearraí, a iarraidh ar an ngeallbhróicéir lenar geallearbadh na hearraí an leabhar díolacháin agus an chatalóg ina mbeidh taifid an díolacháin a thabhairt ar aird, agus, ar an táille a ordaítear i gCuid IV den Chúigiú Sceideal a íoc, féadfaidh sé na taifid sin a scrúdú.
(2) Aon gheallbhróicéir a mhainneoidh déanamh de réir iarraidh faoi fho-alt (1) den alt seo beidh sé ciontach i gcion.

33.—(1) Má tharlaíonn, i gcás gealltáin a geallearbadh ar shuim is mó ná dhá phunt nó aon ghealltáin atá déanta suas, go hiomlán nó go páirteach, d'ór, d'airgead nó de mhiotal lómhar eile nó d'aon chloch lómhar nó leathlómhar, gur mó an méid a gheofar as an ngealltán a dhíol ná méid na hiasachta a tugadh ar an ngealltán maraon leis an ús agus leis na muirir dhleathacha air agus leis na táillí a d'íoc an geallbhróicéir i leith an díola, féadfaidh sealbhóir an ticéid ghill i leith an ghealltáin, faoi réir forálacha an Achta seo, méid an bharrachais a éileamh ar an ngeallbhróicéir, agus a fháil uaidh, tráth ar bith roimh dheireadh dhá mhí dhéag ó dháta an díolacháin.
(2) Más rud é, áfach, i gcás ina mbeidh barrachas ann den sórt dá dtagraítear i bhfo-alt (1) den alt seo, go ndealróidh sé, ó leabhar díolacháin an gheallbhróicéara, gur tharla, laistigh de shé mhí roimh dháta an díola nó ina dhiaidh, i gcás inar díoladh aon ghealltán eile a gheallearb an geallearbóir céanna, gur lú an méid a fuarthas ar an ngealltán eile sin ná méid na hiasachta air maraon leis an ús agus leis na muirir dhleathacha agus leis na táillí a d'íoc an geallbhróicéir i leith a dhíolta, féadfaidh an geall bhróicéir méid an easnaimh a fhritháireamh in aghaidh mhéid an bharrachais, agus ní dhlífidh sé a íoc le sealbhóir an ticéid ghill ach an fuíollach (más ann).
(3) Aon gheallbhróicéir nach ndéanfaidh, nuair a éileofar air é, an méid a dhlífidh sé a íoc faoin alt seo, le sealbhóir ticéid ghill, a íoc leis an sealbhóir sin, beidh sé ciontach i gcion.

34.—Gach ceantálaí a mhainneoidh déanamh de réir aon cheanglais san Acht seo a bhaineann le gealltáin gheallbhróicéirí a dhíol, nó a ghníomhóidh contrártha d'aon fhoráil san Acht seo a bhaineann leis an díol sin, beidh sé ciontach i gcion.
CUID IV
Forlíontach agus Ilghnéitheach
Fógra ón nGarda Síochána i dtaobh maoine a cailleadh agus a goideadh.
35.—(1) Beidh de dhualgas ar gach Ceannfort den Gharda Síochána fógra i dtaobh aon mhaoine a cailleadh, a goideadh nó a fuarthas nó a diúscraíodh go calaoiseach ar dhóigh eile, agus tuairisc iomlán ar an maoin sin, a thabhairt láithreach do na geallbhróicéirí uile sa cheantar atá faoina chúram.
(2) Má thairgtear nó má thaispeántar do gheallbhróicéir, nó má bhíonn ina sheilbh aige, maoin atá de réir tuairisce a fógraíodh dó faoi fho-alt (1) den alt seo, cuirfidh sé é sin in iúl gan mhoill do chomhalta den Gharda Síochána sa stáisiún Garda Síochána is gaire dó, agus déanfaidh sé gach beart réasúnach chun aon duine a thairg nó a thaispeáin an mhaoin sin a choinneáil agus an mhaoin a urghabháil agus chun an duine agus an mhaoin a chur faoi choimeád comhalta den Gharda Síochána a luaithe is féidir.
(3) Aon gheallbhróicéir a mhainneoidh déanamh de réir ceanglais i bhfo-alt (2) den alt seo, beidh sé ciontach i gcion.

36.—(1) Má dhéanann duine ar bith ticéad gill a rith, a thabhairt ar aird, a thaispeáint nó a thairiscint do gheallbhróicéir a mbeidh amhras réasúnach ar an ngeallbhróicéir gur góchumadh, gur brionnaíodh nó gur athraíodh é, déanfaidh an geallbhróicéir gach beart réasúnach chun an duine a choinneáil agus an ticéad gill a urghabháil agus chun an duine agus an ticéad gill a chur faoi choimeád comhalta den Gharda Síochána a luaithe is féidir.
(2) Aon gheallbhróicéir a mhainneoidh déanamh de réir fho-alt (1) den alt seo beidh sé ciontach i gcion.

37.—(1) Má fheictear do gheallbhróicéir—
(a) go mbaineann amhras leis na himthosca ina dtairgfidh duine earra dó i modh gill, nó
(b) i gcás an duine a bheidh ag iarraidh gealltán a fhuascailt, nach bhfuil aon cheart ná aon éileamh bona fide ó cheart aige chun an gealltán a fhuascailt,
éileoidh an geallbhróicéir ar an duine a insint dó conas a tháinig an t-earra nó an ticéad gill, cibé acu é, ina sheilbh.
(2) Más rud é, i gcás duine a n-éileoidh geallbhróicéir air eolas a thabhairt faoi fho-alt (1) den alt seo, nach féidir leis nó go ndiúltóidh sé cuntas sásúil a thabhairt don gheallbhróicéir ina thaobh féin nó i dtaobh na slí inar tháinig an t-earra nó an ticéad gill a bheidh i gceist ina sheilbh, nó má thugann sé aon eolas is dóigh leis an ngeallbhróicéir a bheith bréagach i dtaobh an earra nó an ticéid ghill nó i dtaobh a ainm nó a sheoladh féin nó ainm nó seoladh úinéir an earra, nó má bhíonn aon chúis eile ag an ngeallbhróicéir chun a bheith in amhras gur goideadh an t-earra nó an ticéad gill nó go bhfuarthas é go neamhdhleathach nó go héagórach ar dhóigh eile, cuirfidh an geallbhróicéir na himthosca in iúl láithreach do chomhalta den Gharda Síochána sa stáisiún Garda Síochána is gaire dó agus déanfaidh sé gach beart réasúnach chun an duine a choinneáil agus an t-earra nó an ticéad gill a urghabháil agus chun an duine agus an t-earra nó an ticéad gill a chur faoi choimeád comhalta den Gharda Síochána a luaithe is féidir.
(3) Aon gheallbhróicéir a mhainneoidh déanamh de réir aon cheanglais san alt seo beidh sé ciontach i gcion.
Daoine a éalóidh ó gheallbhróicéir nó a chuirfidh cosc air.
38.—Duine ar bith—
(a) a éalóidh nó a dhéanfaidh iarracht éalú le linn geallbhróicéir a bheith á choinneáil nó ag iarraidh é a choinneáil de réir an Achta seo, nó
(b) a choiscfidh geallbhróicéir nó a dhéanfaidh iarracht é a chosc le linn dó bheith ag urghabháil rud ar bith nó ag iarraidh é a urghabháil de réir an Achta seo,
beidh sé ciontach i gcion.
Cosaint do gheallbhróicéir.
39.—Má thionscnaítear imeachtaí, cibé acu sibhialta nó coiriúil iad, i gcoinne geallbhróicéara mar gheall ar aon ní a rinne sé i gcúrsa aon duine a choinneáil nó i gcúrsa iarrachta ar é a choinneáil, nó i gcúrsa aon rud a urghabháil nó i gcúrsa iarrachta ar é a urghabháil de réir ceanglais san Acht seo, is cosaint mhaith dó a chruthú gur ar chúiseanna réasúnacha, agus á chreidiúint bona fide gur ghá faoin Acht seo an choinneáil nó an urghabháil a dhéanamh, a rinneadh aon ní a rinneadh amhlaidh.
Gealltáin a stóráil agus cúiteamh i ndamáiste.
40.—(1) Beidh sé de dhualgas ar gach geallbhróicéir gach gealltán a gheallearbfar leis a stóráil ar mhodh cuí ina áitreabh ceadúnaithe go dtí cibé am a dhéanfar gach gealltán a fhuascailt nó a dhiúscairt de réir an Achta seo.
(2) Más deimhin leis an gCúirt Dúiche, ar iarratas ó dhuine atá i dteideal, agus a thairgfidh, gealltán a fhuascailt, gur tharla, mar gheall ar aon ghníomh nó mainneachtain thoiliúil ag an ngeallbhróicéir ar geallearbadh an gealltán leis, gur cailleadh nó gur díothíodh an gealltán, nó gur lú an luach atá air ná mar a bhí nuair a geallearbadh é, féadfaidh sí, más cuí léi é, cúiteamh réasúnach a dhámhachtain don duine sin.
(3) Déanfar méid aon chúitimh a dhámhfar faoi fho-alt (2) den alt seo a bhaint as an tsuim is iníoctha leis an ngeallbhróicéir, nó, de réir mar is gá sa chás, beidh sé le híoc agan ngeallbhróicéir, i cibé slí a ordóidh an Chúirt.
Dliteanas an gheallbhróicéara i gcás damáiste trí thine.
41.—(1) Má dhamáistítear nó má dhíothaítear gealltán trí thine nó de dheasca tine, déanfaidh an geallbhróicéir lenar geallearbadh an gealltán, faoi réir forálacha an Achta seo, má thairgtear an ticéad gill i leith an ghealltáin dó roimh dheireadh na tréimhse ina mbeadh an gealltán infhuascailte, suim is ionann agus leath mhéid na hiasachta a íoc le sealbhóir an ticéid.
(2) Beidh leas inárachaithe ag geallbhróicéir i ngealltán go feadh suim mhéid na hiasachta agus an úis agus na muirear dleathach uirthi agus leath mhéid na hiasachta.
(3) Aon gheallbhróicéir a mhainneoidh déanamh de réir fho-alt (1) den alt seo beidh sé ciontach i gcion.
Athrú neamhúdaraithe ar ghreanadóireachtaí.
42.—(1) Ní athróidh ná ní aghloitfidh duine aon ghreanadóireacht ar aon uaireadóir, ar aon mhír de phláta muintire, ná ar aon earra eile mura n-údaróidh an t-úinéir dó é sin a dhéanamh.
(2) Aon duine a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion.
Gan conarthaí a bheith ar neamhní toisc geallbhróicéir a chiontú.
43.—(1) Faoi réir forálacha an Achta seo, má chiontaítear geallbhróicéir i gcion faoin Acht seo (nach cion faoi na forálacha a bhaineann le ceadúnais) ní bheidh aon chonradh a bheidh déanta aige le geallearbóir nó ar dhóigh eile maidir lena ghnó ar neamhní de bhíthin an chiontaithe amháin, ná ní chaillfidh sé de bhíthin an chiontaithe amháin a lian ná a cheart ar an ngealltán ná ar an iasacht agus an ús agus na muirir dhleathacha uirthi.
(2) Ní chuirfidh aon ní san alt seo srian le hoibriú aon fhorála san Acht seo a fhorálann go ndéanfar aon earraí nó airnéisí a geallearbadh go neamhdhleathach a sheachadadh, le hordú cúirte, don úinéir dleathach.

44.—(1) Ar aon chúirt dá ordú sin dó, tiocfaidh geallbhróicéir os comhair na cúirte agus tabharfaidh sé ar aird aon leabhair, aifid nó doiciméid a bheidh á gcoimeád aige faoin Acht seo agus a gceanglóidh an chúirt air iad a thabhairt ar aird.
(2) Gan dochar d'fho-alt (1) den alt seo, glacfar i ngach imeacht dhlíthiúil, cibé acu sibhialta nó coiriúil í, le cóip de thaifead i leabhar gealltán nó i leabhar díolacháin mar fhianaise prima facie ar an taifead sin agus ar na nithe, na hidirbhearta agus na cuntais a bheidh taifeadta ann, má chruthaítear i bhfianaise béil duine éigin a scrúdaigh an chóip leis an mbuntaifead gur scrúdaíodh an chóip amhlaidh agus go bhfuil sí ceart.
(3) Má thagann geallbhróicéir os comhair cúirte ar ordú ón gcúirt, beidh teideal aige chun go n-íocfar caiteachais leis ar scála a fhreagróidh don scála ar dá réir a íoctar de thuras na huaire caiteachais finnéithe a thoghairtear, agus a thagann i láthair, thar ceann an ionchúisimh.
(4) Aon gheallbhróicéir a mhainneoidh déanamh de réir aon cheanglais i bhfo-alt (1) den alt seo, beidh sé ciontach i gcion.

46.—(1) Féadfaidh comhalta den Gharda Síochána dul isteach gach tráth réasúnach in aon áitreabh a bhfuil ceadúnas geallbhróicéara i bhfeidhm ina leith agus an t-áitreabh agus aon earraí ann a iniúchadh, agus féadfaidh sé a iarraidh go dtabharfar ar aird aon leabhair, catalóga, doiciméid nó taifid a choimeádtar san áitreabh agus iad a scrúdú.
(2) (a) Má fhaigheann comhalta den Gharda Síochána, i gcúrsa iniúchta faoin alt seo, aon earra a bhfuil cúis réasúnach aige chun a chreidiúint gur goideadh é, go bhfuarthas go neamhdhleathach é nó gur geallearbadh go neamhdhleathach é, féadfaidh sé an t-earra a urghabháil, a thabhairt leis agus a choinneáil nó an t-earra a ghaibhniú in áitreabh an gheallbhróicéara.
(b) Má thugann comhalta den Gharda Síochána earra leis faoin bhfo-alt seo, tabharfaidh sé admháil ar an earra don gheallbhróicéir.
(c) Má ghaibhníonn comhalta den Gharda Síochána earra faoin bhfo-alt seo, déanfaidh an geallbhróicéir, má iarrann comhalta den Gharda Síochána sin air é, an t-earra a thabhairt ar aird nuair a bheidh an t-iarratas dá bhforáiltear i bhfo-alt (3) den alt seo á éisteacht.
(3) Má choinníonn nó má ghaibhníonn comhalta den Gharda Síochána aon earra faoin alt seo, déanfaidh sé, a luaithe is féidir go réasúnach, iarratas chun na Cúirte Dúiche ar ordú chun an earra a dhiúscairt, agus de thoradh an iarratais sin déanfaidh an Chúirt—
(a) más deimhin léi gur goideadh an t-earra, nó go bhfuarthas go neamhdhleathach é nó gur geallearbadh go neamhdhleathach é, ordú go dtabharfar an t-earra ar ais dá úinéir, agus
(b) in aon chás eile, ordú go dtabharfar an t-earra ar ais don gheallbhróicéir a bheidh i gceist.
(4) Nuair a bheidh ordú chun earra a thabhairt ar ais dá úinéir á dhéanamh ag an gCúirt faoin alt seo, féadfaidh sí a ordú é a thabhairt ar ais amhlaidh i dteannta nó d'éagmais íocaíochta ón úinéir leis an ngeallbhróicéir as an iomlán nó as cuid den iasacht a fuarthas de bhua gheallearbadh an earra agus tabharfaidh sí aird ar aon mhainneachtain ar thaobh an úinéara faoi chúram réasúnach a ghlacadh chun a mhaoin a chosaint, ach amháin sa mhéid gur saibhríodh an geallbhróicéir go míchóir.
(5) Ní fheidhmeoidh comhalta den Gharda Síochána na cumhachtaí a thugtar leis an alt seo mura mbeidh sé údaraithe chuige sin i scríbhinn ag comhalta den Gharda Síochána nach ísle céim ná cigire agus, nuair a bheidh aon chumhachtaí acu sin á bhfeidhmiú aige, tabharfaidh sé an t-údarás ar aird má iarrann aon duine lena mbaineann an scéal air é.
(6) Aon duine—
(a) a choiscfidh nó a bhacfaidh comhalta den Gharda Síochána agus é ag feidhmiú cumhachta a thugtar leis an alt seo, nó
(b) a dhiúltóidh aon leabhar, catalóg, doiciméad nó taifead a bheidh faoina chumhacht nó ina sheilbh nó ar fáil aige a thabhairt ar aird, tar éis comhalta den Gharda Síochána á iarraidh sin air faoin alt seo, nó
(c) nach ndéanfaidh de réir iarraidh faoi mhír (c) d'fho-alt (2) den alt seo,
beidh sé ciontach i gcion.

47.—(1) Aon duine a bheidh ciontach i gcion faoi alt 7, dlífear, ar é a chiontú go hachomair, céad punt de phionós máil a chur air.
(2) Aon duine a bheidh ciontach i gcion faoi alt 12, dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná céad punt nó príosúnacht ar feadh téarma nach faide ná dhá mhí dhéag, nó an fhíneáil sin agus an phríosúnacht sin, a chur air.
(3) Duine a bheidh ciontach i gcion faoi aon alt eile den Acht seo, dlífear, ar é a chiontú go hachomair—

(b) féadfaidh an geallbhróicéir gach gealltán eile a dhíol ar cheant poiblí mar a fhoráiltear le dlí, agus ní fhéadfar ar aon dóigh eile. Féadfar, áfach, na gealltáin sin a fhuascailt tráth ar bith roimh lá an díolacháin.
Barrachas ar Ghealltán a Dhíol
7. Laistigh de dhá mhí dhéag féilire tar éis gealltán a dhíol ar cheant poiblí, féadfaidh an geallearbóir cuntas an díola i leabhar an gheallbhróicéara agus i gcatalóg an cheantálaí a iniúchadh, ar tháille sé phingin a íoc, agus aon bharrachas de thoradh an díola a fháil. Ach in imthosca áirithe féadfar easnamh as díol gealltáin amháin a fhritháireamh i gcoinne barrachais as díol gealltáin eile.
Damáiste do Ghealltán
8. (1) Má dhíothaítear nó má dhamáistítear gealltán trí thine, beidh de cheangal ar an ngeallbhróicéir, má thairgtear an ticéad gill dó roimh dheireadh na tréimhse ina mbeadh an gealltán infhuascailte, suim is ionann agus leath mhéid na hiasachta a íoc.
(2) Má tharlaíonn, trí mhainneachtain, faillí nó mí-iompar toiliúil ar thaobh an gheallbhróicéara, go gcaillfear nó go ndíothófar gealltán, nó gur lú an luach a bheidh air tráth a fhuascailte ná mar a bhí tráth a gheallearbtha, féadfaidh an t-úinéir cúiteamh a iarraidh ar an gCúirt Dúiche agus féadfaidh an Chúirt, más cuí léi é, cúiteamh a dhámhachtain i leith an damáiste, agus bainfear an méid a dhámhfar amhlaidh as an tsuim is iníoctha leis an ngeallbhróicéir, nó, de réir mar is gá sa chás, íocfaidh an geallbhróicéir é ar cibé dóigh a ordóidh an Chúirt.

AN SEACHTU SCEIDEAL
Rialacháin a rialaíonn ceantáil gealltán
1. Cuirfidh an ceantálaí faoi deara go gcuirfear gach gealltán ar taispeáint go poiblí.
2. Foilseoidh sé catalóga maidir leis na gealltáin, ina luafar—
(1) ainm agus áit ghnó an gheallbhróicéara;
(2) an mhí a geallearbadh gach gealltán;
(3) uimhir gach gealltáin mar a taifeadadh í tráth a gheallearbtha i leabhar na ngealltán.

PAWNBROKERS ACT, 1964
PART I
Preliminary and General
Short title and commencement.
1.—(1) This Act may be cited as the Pawnbrokers Act, 1964.
(2) This Act shall come into operation on such day as may be fixed therefor by order of the Minister.
Definitions.
2.—In this Act, save where the context otherwise requires—
“licence” means a licence under section 8;
“the Minister” means the Minister for Justice;
“pawnbroker” includes any person who carries on the business of taking goods and chattels in pawn and in particular (but without prejudice to the generality of the foregoing) includes any person who—
(a) receives or takes from any other person any goods or chattels by way of security for the repayment of any sum of money not exceeding fifty pounds advanced thereon; or
(b) purchases, or receives or takes in, goods or chattels and pays or advances or lends thereon any sum of money not exceeding fifty pounds with or under an agreement or understanding expressed or implied or from the nature of the transaction to be reasonably inferred that those goods or chattels may be afterwards redeemed or purchased on any terms;
“pawner” means a person delivering an article for pawn to a pawnbroker;
“pawn-ticket”, except in section 14, includes a special contract pawn-ticket;
“pledge” means an article pawned with a pawnbroker;
“redemption period” means a period, commencing on the day next following the date of pawning, within which a pawnbroker may not lawfully sell or dispose of a pledge.
Application.
3.—This Act applies to every transaction entered into after the commencement of this Act in respect of a pledge on which a loan or advance not exceeding fifty pounds is made by a pawnbroker to a pawner but does not apply to any other transaction.
Servants, agents and representatives of pawnbrokers.
4.—(1) Anything authorised by this Act to be done by a pawnbroker may be done by his servant or agent.
(2) For the purposes of this Act, anything done or omitted by a servant or agent of a pawnbroker in the course of the business of the pawnbroker shall be deemed to be done or omitted, as the case may be, by the pawnbroker.
(3) The provisions of this Act relating to pawnbrokers shall have effect in relation to executors and administrators of deceased pawnbrokers, but an executor or administrator of a deceased pawnbroker shall not be personally liable to any penalty not incurred by his own act or default.
Transmission of rights, etc., of pawners.
5.—(1) Any rights, powers, privileges and benefits reserved to or conferred on pawners by this Act shall be deemed to be reserved to and conferred on the assignees of pawners and the executors and administrators of deceased pawners.
(2) Any person representing himself to a pawnbroker to be the assignee of a pawner or the executor or administrator of a deceased pawner shall, if so required by the pawnbroker, produce to him the instrument under which he claims.
Repeals and transitory provision.
6.—(1) The enactments set out in the First Schedule are hereby repealed to the extent specified in the third column of that Schedule.
(2) Notwithstanding the repeal of the said enactments, those enactments shall, until the 31st day of July, 1965, continue to have effect for the purpose of the grant of a pawnbroker's licence to a person who is not at the commencement of this Act the holder of such licence.
PART II
Licensing of Pawnbrokers
Prohibition on carrying on business of a pawnbroker without licence.
7.—(1) A person shall not carry on the business of a pawnbroker at any premises unless he holds a licence which is in force in respect of those premises.
(2) A person who is the holder of a pawnbroker's licence granted under the Stamp Duties (Ireland) Act, 1842, shall, for so long as he holds such licence, be deemed to be duly licensed for the purpose of subsection (1) of this section until the 31st day of July next following the commencement of this Act.
(3) Any person who contravenes this section shall be guilty of an offence.
Grant of licence.
8.—(1) The Revenue Commissioners shall, subject to the provisions of this Act—
(a) upon application being made to them for a licence to carry on the business of a pawnbroker at a particular premises, and
(b) upon the production by the applicant of a certificate granted under section 10 in respect of those premises, and
(c) upon payment to them by the applicant of the excise duty for the time being required by law to be paid by a person taking out such licence, grant to the applicant a licence to carry on the business of a pawnbroker at those premises.
(2) A licence shall come into force on the date specified therein and shall expire on the next following 31st day of July.
Transfer of licence.
9.—A pawnbroker may transfer his licence to another person who has been granted a certificate under section 10 which is in force, but the transfer shall not take effect until the certificate has been produced to and endorsed by the Revenue Commissioners.
Grant of certificate.
10.—(1) The District Court may, upon application being made to it, grant to a person a certificate authorising the grant to him, subject to the provisions of this Act, of a licence.
(2) A separate certificate shall be required in respect of each licence sought.
(3) A certificate shall come into force on the date specified therein and shall expire on the next following 31st day of July.
(4) A certificate shall not be refused except on one or more of the following grounds:
(a) that satisfactory evidence has not been produced of the good character of the applicant;
(b) that satisfactory evidence has been produced that the applicant, or any person responsible or proposed to be responsible for the management of his business as a pawnbroker, is not a fit and proper person to hold a certificate;
(c) that the applicant, or any person responsible or proposed to be responsible for the management of his business as a pawnbroker, is by order of a court disqualified for obtaining a licence;
(d) that the applicant has failed to satisfy the Court that he is a person of financial stability;
(e) that the applicant is the holder of a bookmaker's licence granted under the Betting Act, 1931;
(f) that the applicant is the holder of a licence for the sale of intoxicating liquor;
(g) that the applicant is an auctioneer; or
(h) that the applicant's premises are not suitable for the carrying on of a pawnbroker's business.
(5) Any person aggrieved by the refusal of the Court to grant a certificate may appeal to the Circuit Court and the decision of that Court on the matter shall be final and not appealable.
(6) Whenever an application for a certificate is refused and an appeal from the refusal is lodged, then if the applicant was at the time of making the application the holder of a licence, the Revenue Commissioners may, without payment of any duty but subject to such conditions as they may think fit to impose, issue to the applicant a temporary licence for such period not extending beyond the expiration of seven days after the decision of the appeal as they may think fit, and every such temporary licence shall while it remains in force be a licence within the meaning of this Act.
Suspension and cancellation of licence.
11.—(1) Where a pawnbroker is convicted of larceny, receiving stolen goods knowing them to have been stolen or any other offence involving fraud or dishonesty, the court before which he was convicted may, in addition to any other penalty imposed, order his licence to be suspended for such period as it thinks fit or to be cancelled.
(2) Where a pawnbroker is convicted of an offence mentioned in subsection (1) of this section and the court orders his licence to be suspended or cancelled and the pawnbroker appeals against the conviction or, if he has been convicted of more than one of those offences, against all of the convictions, the court before which he was convicted may, if it thinks fit, suspend the operation of its order suspending or cancelling the licence pending the hearing of the appeal.
(3) The District Court may, on the application of a member of the Garda Síochána not below the rank of inspector, suspend a licence for such period as it thinks fit, if satisfied that the pawnbroker is also carrying on business as an auctioneer or is the holder of a licence to sell intoxicating liquor or of a bookmaker's licence granted under the Betting Act, 1931, or has acted in contravention of any of the provisions of this Act.
(4) A pawnbroker whose licence has been suspended under subsection (3) of this section may appeal to the Circuit Court and the decision of that Court on the matter shall be final and not appealable.
(5) Whenever a licence has been suspended under subsection (3) of this section and an appeal against the suspension is lodged, the District Court may, if it thinks fit, suspend the operation of its order pending the hearing of the appeal.
(6) The suspension or cancellation of, or the failure to renew, a licence shall not prejudice or affect any right to redeem a pledge made before the date of the suspension or cancellation or the expiry of the licence, or any obligation or liability (whether arising by virtue of a contract or of any provision of this Act) subsisting at that date, and the pawnbroker holding the licence immediately before that date shall in respect of any pledge then held by him remain subject to the like obligations, liabilities and penalties as if the licence continued in force.
Forgery of certificate.
12.—(1) (a) A person who forges a certificate or tenders a certificate knowing it to be forged shall, without prejudice to any other enactment, be guilty of an offence.
(b) Paragraph (a) of this subsection shall not be construed so as to enable a person to be punished twice for any offence.
(2) A licence granted in pursuance of a forged certificate shall be void.
(3) Any person who makes use of a forged certificate knowing it to be forged shall be disqualified for obtaining a licence at any time thereafter.
Name and notice to be displayed.
13.—(1) A pawnbroker shall—
(a) keep displayed in large and legible characters over the outer door of the premises in which he carries on the business of a pawnbroker his name and the word “Pawnbroker”, and
(b) keep displayed in a conspicuous place in such premises printed in large and legible characters a notice containing the information set out in the Second Schedule.
(2) A pawnbroker who fails to comply with a requirement of subsection (1) of this section shall be guilty of an offence.
PART III
Pawning, Redemption and Sale of Pledges
Pawn-tickets.
14.—(1) A pawnbroker shall on taking a pledge in pawn give to the pawner a pawn-ticket and shall not take a pledge in pawn unless the pawner takes a pawn-ticket.
(2) A pawn-ticket shall contain the particulars set out in the appropriate form in Part I or Part II of the Third Schedule.
(3) A pawnbroker who fails to comply with any requirement of this section shall be guilty of an offence.
Special contracts and special contract pawn-tickets.
15.—(1) Notwithstanding anything in this Act, a pawnbroker may make a special contract with a pawner in respect of a pledge on which the pawnbroker makes a loan of more than ten pounds.
(2) (a) Where a pawnbroker makes a special contract with a pawner, he shall at the time of the pawning give to the pawner a special contract pawn-ticket which shall contain the particulars set out in Part III of the Third Schedule and shall be signed by the pawnbroker.
(b) A pawnbroker shall not take a pledge in pawn under a special contract under this section unless the pawner takes a special contract pawn-ticket.
(3) A duplicate of the special contract pawn-ticket shall be signed by the pawner.
(4) A special contract pawn-ticket and the duplicate thereof shall not be subject to stamp duty.
(5) The provisions of this Act shall apply to a special contract under this section save so far as excluded by the terms of the contract.
(6) A pawnbroker who fails to comply with paragraph (a), or contravenes paragraph (b), of subsection (2) of this section shall be guilty of an offence.
Pawnbroker's books and records.
16.—(1) Every pawnbroker shall in the course of his business—
(a) keep a pledge book and a sale book in the form set out in Part I and Part II, respectively, of the Fourth Schedule, and
(b) use, as occasion requires, the documents set out in the Third Schedule in the forms therein specified.
(2) Every pawnbroker shall in the course of his business clearly and legibly enter, as occasion requires, in any book or document required to be kept or used by him such, particulars as are specified in the Third and Fourth Schedules and it shall be the duty of every pawnbroker to make all enquiries necessary for the purpose of complying with this subsection.
(3) A pawnbroker who fails to comply with any requirement of this section shall be guilty of an offence.
Loans in current money.
17.—(1) Every sum advanced by a pawnbroker in respect of goods taken in pawn by him shall be in good and lawful current money and no such sum shall be made up or completed by the inclusion of any other kind of value, benefit or payment.
(2) A pawnbroker who contravenes subsection (1) of this section shall be guilty of an offence.
(3) Where a pawnbroker is convicted of an offence under this section, the court, whether or not it imposes a penalty—
(a) shall order the sum properly due to be paid by the pawnbroker to the pawner in good and lawful current money; and
(b) may in its discretion order the pawner to repay or return to the pawnbroker the whole or any part of the other kind of value, benefit or payment given to the pawner.
Division of loan prohibited.
18.—(1) A pawnbroker shall not divide the amount of the loan sought by any borrower into smaller sums.
(2) A pawnbroker who contravenes subsection (1) of this section shall be guilty of an offence.
General restrictions on pawnbroker.
19.—(1) A pawnbroker shall not—
(a) knowingly take anything in pawn from a person under the age of sixteen years whether offered for pawning by that person on his own behalf or on behalf of another person;
(b) take anything in pawn from a person who appears to be intoxicated;
(c) take anything in pawn from a person whom he knows to be a habitual drunkard;
(d) purchase or take in pawn or exchange a pawn-ticket issued by him or by another pawnbroker;
(e) purchase, except at an auction held under this Act, any pledge in pawn with him;
(f) make any contract or agreement with any person pawning or offering to pawn any article, or with the owner of any article, for the purchase, sale or disposition thereof within the redemption period;
(g) employ any person under the age of sixteen years to take goods in pawn;
(h) take in pawn any article where he is aware or has reasonable grounds for suspecting that the pawning would be a contravention of section 25;
(i) take in pawn any firearm or ammunition; or
(j) sell or otherwise dispose of any pledge except in accordance with this Act.
(2) A pawnbroker who contravenes any provision of subsection (1) of this section shall be guilty of an offence.
(3) Where a pawnbroker is charged with taking a thing in pawn from a person under the age of sixteen years whether offered for pawning by that person on his own behalf or on behalf of another person, it shall be a good defence for him to show that he did not know and had no reason to suspect that the person was under the age of sixteen years.
Lawful interest and charges.
20.—(1) A pawnbroker may charge interest on a loan on a pledge at a rate not exceeding that specified in Part I of the Fifth Schedule.
(2) A pawnbroker may demand and take the charges specified in Parts II, III, IV and V of the Fifth Schedule.
(3) A pawnbroker shall, if so required at the time of the redemption of any pledge, give a receipt, which shall be in the form set out in Part IV of the Third Schedule, for the amount of the loan, interest and charges paid to him.
(4) Where a pawnbroker charges on a loan on a pledge interest greater than that permitted by subsection (1) of this section or takes or demands a charge greater than that permitted by subsection (2) of this section or fails or refuses to give a receipt in accordance with subsection (3) of this section, he shall be guilty of an offence.
Redemption periods.
21.—(1) Subject to subsections (3) and (4) of this section, the period within which a pledge (other than a pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone) may be redeemed from a pawnbroker shall be the period of six months from the date on which the loan was made but, if the interest on the loan is paid within that period, the period within which such pledge may be redeemed shall be extended for a period of six months from the date up to which the interest was paid.
(2) Subject to subsections (3) and (4) of this section, the period within which a pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone may be redeemed shall be one year.
(3) There shall be added to the periods mentioned in subsections (1) and (2) of this section a further period of seven days during which a pledge may not be lawfully sold or disposed of by a pawnbroker and shall be redeemable.
(4) A pledge pawned for a sum exceeding two pounds and a pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone shall further continue redeemable until it is disposed of as provided in this Act although the redemption period has expired.
Holder of pawn-ticket person entitled to redeem.
22.—(1) The holder for the time being of a pawn-ticket shall, as between the pawner and the pawnbroker, be presumed to be the person entitled to redeem the pledge to which the ticket relates and, accordingly, subject to the provisions of this Act, a pawnbroker shall, on delivery to him of a pawn-ticket and on payment of the loan and interest and any other charges payable under this Act, deliver the pledge to the person tendering the ticket and the pawnbroker shall retain the ticket for a period of not less than one year.
(2) A pawnbroker shall not, except as otherwise provided in this Act, be bound to deliver up a pledge unless the pawn-ticket in respect of it is delivered to him.
Offences relating to pawning and redeeming.
23.—Any person who—
(a) offers to a pawnbroker any article by way of pawn being unable or refusing to give a satisfactory account of the means by which he came into possession of the article;
(b) wilfully gives false information to a pawnbroker about the ownership of an article offered by him to the pawnbroker by way of pawn or about his name or address or the name or address of the owner of the article; or
(c) redeems or attempts to redeem or procures another person to redeem or attempt to redeem a pledge without being entitled to do so,
shall be guilty of an offence.
Failure to deliver pledge to person entitled.
24.—(1) Any pawnbroker who, without reasonable cause (proof of which shall lie on him), refuses or neglects to deliver a pledge to the person entitled thereto shall be guilty of an offence.
(2) Where a pawnbroker is charged with an offence under this section, the court may, if it thinks fit, whether or not it imposes a penalty, order—
(a) the delivery of the pledge to the person entitled thereto,
(b) the payment by that person of the whole or part of the amount of the loan, interest and other lawful charges, or
(c) both such delivery and payment.
Unlawful pawning of property of another.
25.—(1) A person who knowingly pawns any article which is the property of another person without the consent of that other person shall be guilty of an offence.
(2) Where a person is convicted of an offence under this section, the court may, in addition to any fine imposed, order him to pay to the owner of the article by way of compensation a sum not exceeding the full value of the article as determined by the court.
Delivery to owner of property unlawfully pawned.
26.—(1) Where—
(a) any person is convicted under this Act by any court of knowingly and wrongfully pawning with a pawnbroker any goods or chattels belonging to another person, or
(b) any person is convicted of stealing or of obtaining by means of fraud any goods or chattels and it appears to the court that the goods or chattels have been pawned with a pawnbroker, or
(c) it appears to a court in the course of any proceedings that any goods or chattels before it have been unlawfully pawned with a pawnbroker,
the court, upon proof of the ownership of the goods or chattels may, in its discretion, order the delivery thereof to the owner, either with or without payment by him to the pawnbroker of the whole or part of the amount of the loan obtained by virtue of the pawning.
(2) Before making an order under subsection (1) of this section, the court shall have regard to any failure on the part of the owner of the goods or chattels to exercise reasonable care in the protection of his property, except to the extent that the pawnbroker has been unjustly enriched.
Offences by pawnbroker in relation to certain pledges.
27.—If, with respect to a pledge for a loan of a sum exceeding two pounds or a pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone, a pawnbroker—
(a) does not bona fide in accordance with this Act sell the pledge, or
(b) enters in his sale book a pledge as sold for a lesser sum than that for which it was sold,
he shall be guilty of an offence.
Owners and pawners of pledges not having pawn-tickets.
28.—(1) Any person who—
(a) claims to be the owner of a pledge but does not hold the pawn-ticket, or
(b) claims to be entitled to hold a pawn-ticket and alleges that it has been lost, mislaid, destroyed or stolen or taken from him by fraud,
may, on payment of the fee prescribed in Part V of the Fifth Schedule, request the pawnbroker to supply to him the appropriate form of statutory declaration set out in the Sixth Schedule.
(2) Where the person returns to the pawnbroker the form of statutory declaration duly completed within three days (excluding any day on which the pawnbroker is prohibited from carrying on business) after the form was supplied to him, he shall, as between himself and the pawnbroker, have the same rights and remedies in respect of the pledge as if he had produced the pawn-ticket.
(3) The pawnbroker is hereby indemnified—
(a) for refusing to deliver the pledge to any other person until the said three days have expired,
(b) for the delivering up of the pledge to the person, unless he had actual or constructive notice that the statutory declaration was false in any material particular, and
(c) for failing to deliver the pledge to the person immediately upon the return of the form of statutory declaration, where the failure is due to the difficulty of identifying the pledge by reason of the pledge number not being known.
(4) A pawnbroker who fails to comply with a request under subsection (1) of this section shall be guilty of an offence.
Unredeemed pledges.
29.—(1) Except in the case of a pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semiprecious stone, a pledge pawned for a sum not exceeding two pounds shall, if not redeemed within the redemption period (including the seven days referred to in subsection (3) of section 21), become the pawnbroker's absolute property.
(2) A pledge pawned for a sum exceeding two pounds or made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone may, if not redeemed within the redemption period, be disposed of by the pawnbroker by sale by public auction held in accordance with this Act, but not otherwise.
Sale of pledges.
30.—(1) Every auction of pawnbrokers' pledges shall be conducted by an auctioneer nominated by the Minister.
(2) The Minister may, for the purpose of this section, nominate auctioneers for specified areas and may terminate a nomination at any time.
(3) Every auction of pawnbrokers' pledges shall be conducted in the premises of the auctioneer conducting the auction.
(4) Every auction of pawnbrokers' pledges shall be conducted in accordance with the regulations contained in the Seventh Schedule.
Right of pawnbroker to purchase at auction.
31.—A pawnbroker may, at an auction held under this Act, bid for and purchase a pledge pawned with him.
Right to inspect sale book and catalogue.
32.—(1) The person who holds a pawn-ticket in respect of a pledge pawned for a sum exceeding two pounds or any pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone may, at any time before the expiration of twelve months from the date on which the goods are sold, request the pawnbroker with whom the goods were pawned to produce the sale book and catalogue containing the entries of the sale and may, on payment of the fee prescribed in Part IV of the Fifth Schedule, inspect such entries.
(2) A pawnbroker who fails to comply with a request under subsection (1) of this section shall be guilty of an offence.
Right of pawner to surplus on sale.
33.—(1) Where, in the case of a pledge pawned for a sum exceeding two pounds or any pledge made up wholly or partly of gold, silver or other precious metal or of any precious or semiprecious stone, the amount obtained on the sale of the pledge exceeds the amount of the loan given on the pledge with the addition of the interest and lawful charges thereon and the fees paid by the pawnbroker in respect of the sale, the holder of the pawn-ticket in respect of the pledge, may, subject to the provisions of this Act, demand and obtain the amount of the excess from the pawnbroker at any time before the expiration of twelve months from the date of the sale.
(2) If, however, in a case where there is an excess such as is referred to in subsection (1) of this section, it appears from the pawnbroker's sale book that, within six months before or after the date of the sale, on the sale of any other pledge pawned by the same pawner the amount obtained for such other pledge was less than the amount of the loan thereon with the addition of the interest and the lawful charges and the fees paid by the pawnbroker in respect of its sale, the pawnbroker may set off theamount of the deficit against the amount of the excess and shall be liable to pay only the balance (if any) to the holder of the pawnticket.
(3) A pawnbroker who, on demand, fails to pay to the holder of a pawn-ticket the amount which he is liable to pay to him under this section shall be guilty of an offence.
Offences by auctioneers.
34.—Every auctioneer who fails to comply with any requirement of this Act relating to the sale of pawnbrokers' pledges or acts in contravention of any provision of this Act relating to such sale shall be guilty of an offence.
PART IV
Supplemental and Miscellaneous
Notification by Garda Síochána of lost and stolen property.
35.—(1) It shall be the duty of every Superintendent of the Garda Síochána to notify forthwith and to give a full description to all pawnbrokers within the district to which he is attached of any property lost, stolen or otherwise fraudulently obtained or disposed of.
(2) Where a pawnbroker is offered or shown or has in his possession property of a description notified to him under subsection (1) of this section, he shall without delay inform a member of the Garda Síochána at the nearest Garda Síochána station of the fact and shall take all reasonable steps to detain any person offering or showing such property and seize the property and to deliver the person and the property as soon as practicable into the custody of a member of the Garda Síochána.
(3) A pawnbroker who fails to comply with a requirement of subsection (2) of this section shall be guilty of an offence.
Persons presenting pawn-tickets suspected to be counterfeit.
36.—(1) If any person utters, produces, shows or offers to a pawnbroker a pawn-ticket which the pawnbroker reasonably suspects to have been counterfeited, forged or altered, the pawnbroker shall take all reasonable steps to detain the person and seize the pawn-ticket and to deliver the person and the pawn-ticket as soon as possible into the custody of a member of the Garda Síochána.
(2) A pawnbroker who fails to comply with subsection (1) of this section shall be guilty of an offence.
Duty of pawnbroker in certain suspicious circumstances.
37.—(1) Where it appears to a pawnbroker that—
(a) the circumstances in which a person offers an article to him by way of pawn are suspicious, or
(b) the person attempting to redeem a pledge has no right or bona fide claim of right to redeem the pledge,
the pawnbroker shall require the person to inform him of the means by which the article or the pawn-ticket, as the case may be, came into his possession.
(2) Where a person who is required by a pawnbroker to give information under subsection (1) of this section is unable or refuses to give to the pawnbroker a satisfactory account of himself or of the means by which the article or the pawn-ticket in question came into his possession, or gives any information about the article or pawn-ticket or about his name or address or the name or address of the owner of the article which appears to the pawnbroker to be false, or if the pawnbroker has any other reason to suspect that the article or pawn-ticket has been stolen or otherwise unlawfully or wrongfully obtained, the pawnbroker shall immediately report the circumstances to a member of the Garda Síochána at the nearest Garda Síochána station and shall take all reasonable steps to detain the person and seize the article or pawn-ticket and to deliver the person and the article or pawn-ticket as soon as practicable into the custody of a member of the Garda Síochána.
(3) A pawnbroker who fails to comply with any requirement of this section shall be guilty of an offence.
Persons escaping from or obstructing pawnbroker.
38.—Where any person—
(a) escapes or attempts to escape while a pawnbroker is detaining or attempting to detain him in accordance with this Act, or
(b) obstructs or attempts to obstruct a pawnbroker while he is seizing or attempting to seize any thing in accordance with this Act,
that person shall be guilty of an offence.
Defence for pawnbroker.
39.—Where proceedings, whether civil or criminal, are brought against a pawnbroker in respect of anything done by him in the course of detaining or attempting to detain any person, or seizing or attempting to seize any thing, in accordance with a requirement of this Act, it shall be a good defence for him to prove that anything so done was done upon reasonable grounds and in the bona fide belief that the detaining or seizing was necessary under this Act.
Storing of pledges and compensation for damage.
40.—(1) It shall be the duty of every pawnbroker to store in a proper manner in his licensed premises all pledges pawned with him until such time as each pledge is redeemed or disposed of in accordance with this Act.
(2) The District Court, if satisfied on the application of a person entitled and offering to redeem a pledge that, by reason of any wilful act or default of the pawnbroker with whom the pledge was pawned, the pledge is lost, destroyed or is of less value than it was at the time of pawning, may, if it thinks fit, award to the person reasonable compensation.
(3) Any amount of compensation awarded under subsection (2) of this section shall be deducted from the sum payable to the pawnbroker, or, as the case may require, shall be paid by the pawnbroker, in such manner as the Court may direct.
Liability of pawnbroker in case of damage caused by fire.
41.—(1) Where a pledge is damaged or destroyed by or in consequence of fire, the pawnbroker with whom the pledge was pawned shall, subject to the provisions of this Act, if the pawn-ticket in respect of the pledge is tendered to him before the expiry of the period within which the pledge would have been redeemable, pay to the ticket holder an amount equal to one-half of the amount of the loan.
(2) A pawnbroker shall have an insurable interest in a pledge to the extent of the sum of the amount of the loan and the interest and lawful charges thereon and one-half of the amount of the loan.
(3) A pawnbroker who fails to comply with subsection (1) of this section shall be guilty of an offence.
Unauthorised alteration of engravings.
42.—(1) A person shall not alter or deface any engraving upon any watch, piece of family plate or other article unless he is authorised by the owner to do so.
(2) A person who contravenes subsection (1) of this section shall be guilty of an offence.
Contracts not void on account of conviction of pawnbroker.
43.—(1) Subject to the provisions of this Act, where a pawnbroker is convicted of an offence under this Act (not being an offence under the provisions relating to licences) any contract made by him with a pawner or otherwise in relation to his business shall not be void by reason only of the conviction, nor shall he lose his lien on or right to the pledge or to the loan and the interest and lawful charges thereon by reason only of the conviction.
(2) Nothing in this section shall restrict the operation of any provision of this Act providing for the delivery by order of a court to the lawful owner of any goods or chattels unlawfully pawned.
Attendance of pawnbroker before court and production of books, etc.
44.—(1) A pawnbroker shall, when so ordered by any court, attend before the court and shall produce any books, records or documents kept by him under this Act which he is required by the court to produce.
(2) Without prejudice to subsection (1) of this section, a copy of an entry in a pledge book or sale book shall, in all legal proceedings, whether civil or criminal, be received as prima facie evidence of such entry and of the matters, transactions and accounts therein recorded if it is proved on the oral evidence of some person who has examined the copy with the original entry that the copy has been so examined and is correct.
(3) Where a pawnbroker attends before a court on an order of the court, he shall be entitled to be paid expenses on a scale corresponding to the scale for the time being at which the expenses of witnesses summoned and attending on behalf of the prosecution are paid.
(4) A pawnbroker who fails to comply with any requirement of subsection (1) of this section shall be guilty of an offence.
Frivolous complaints.
45.—The District Court, if satisfied that any complaint in respect of an offence against this Act has been brought before it on insufficient grounds, may order the complainant to pay to the defendant such sum not exceeding ten pounds as the Court may think proper by way of compensation for loss of time and expense.
Power of entry, etc.
46.—(1) A member of the Garda Síochána may enter at all reasonable times any premises in respect of which a pawnbroker's licence is in force and may inspect the premises and any articles therein and may call for the production of and examine any books, catalogues, documents or records kept in the premises.
(2) (a) Where a member of the Garda Síochána finds in the course of an inspection under this section any article which he has reasonable grounds for believing to have been stolen, unlawfully obtained or unlawfully pawned, he may seize, carry away and detain the article or impound the article in the pawnbroker's premises.
(b) Where a member of the Garda Síochána carries away an article under this subsection, he shall give to the pawnbroker a receipt for the article.
(c) Where a member of the Garda Síochána impounds an article under this subsection, the pawnbroker shall, when so requested by a member of the Garda Síochána, produce the article at the hearing of the application provided for by subsection (3) of this section.
(3) Where a member of the Garda Síochána detains or impounds any article under this section, he shall, as soon as is reasonably possible, apply to the District Court for an order for the disposition of the article and, on such application, the Court shall—
(a) if satisfied that the article was stolen, unlawfully obtained or unlawfully pawned, order the return of the article to its owner, and
(b) in any other case, order the return of the article to the pawnbroker concerned.
(4) The Court, when making an order under this section for the return of an article to its owner, may order such return either with or without payment by the owner to the pawnbroker of the whole or part of the amount of the loan obtained by virtue of the pawning of the article and shall have regard to any failure on the part of the owner to exercise reasonable care in the protection of his property, except to the extent that the pawnbroker has been unjustly enriched.
(5) A member of the Garda Síochána shall not exercise the powers conferred by this section unless he is authorised in writing so to do by a member of the Garda Síochána not below the rank of inspector and, when exercising any of such powers, he shall, if requested by any person affected, produce the authorisation.
(6) A person—
(a) who obstructs or interferes with a member of the Garda Síochána in the exercise of a power conferred by this section, or
(b) who, on being called on under this section by a member of the Garda Síochána to produce any book, catalogue, document or record in his power, possession or procurement, refuses to do so, or
(c) who fails to comply with a request under paragraph (c) of subsection (2) of this section,
shall be guilty of an offence.
Penalties for offences.
47.—(1) A person who is guilty of an offence under section 7 shall be liable on summary conviction to an excise penalty of one hundred pounds.
(2) A person who is guilty of an offence under section 12 shall be liable on summary conviction to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeding twelve months or to both such fine and such imprisonment.
(3) A person who is guilty of an offence under any other section of this Act shall be liable on summary conviction to—
(a) a fine not exceeding fifty pounds and, in the case of a continuing offence, a further fine not exceeding two pounds for every day during which the offence is continued, or
(b) imprisonment for a term not exceeding six months, or
(c) both such fine or fines and such imprisonment.

Interest on Loans
1. On any loan made under this Act in respect of every two shillings lent, for every calendar month during which the pledge remains in pawn _______ one halfpenny.
Note
(1) If the term of the loan is less than one calendar month, it will be charged for as one month.
(2) After the first calendar month, a part of a month exceeding seven days will be charged for as a month and a part of a month not exceeding seven days will not be charged for.
(3) Where the loan is less than two shillings, it will be charged for as two shillings. Where it exceeds two shillings or any even multiple of two shillings, any odd fraction of two shillings will not be charged for.

Redemption and Disposal of Pledges
6. (1) Pledges, other than those made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone must be redeemed within six calendar months and seven days from the date of pawning but, if the interest is paid at any time within the above period, the redemption period will be extended for a further period of six months and seven days from the date up to which the interest is paid. Pledges made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone must be redeemed within one year and seven days from the date of pledging.
(2) At the end of the redemption period—
(a) pledges pawned for two pounds or under, excluding pledges made up wholly or partly of gold, silver or other precious metal or of any precious or semi-precious stone, will become the pawnbroker's own property;
(b) all other pledges may be sold by the pawnbroker by sale by public auction in the manner provided by law and not otherwise. Such pledges may, however, be redeemed at any time before the day of sale.
Surplus on Sale of Pledge
7. Within twelve calendar months after the sale by public auction of a pledge, the pawner may inspect the account of the sale in the pawnbroker's book and in the auctioneer's catalogue, on payment of a fee of six pence and receive any surplus produced by the sale. But a deficit on the sale of one pledge may, in certain circumstances, be set off against a surplus on another.
Damage to Pledge
8. (1) If a pledge is destroyed or damaged by fire, the pawnbroker, if the pawn-ticket is tendered to him before the expiry of the period within which the pledge would have been redeemable, will be bound to pay an amount equal to one-half of the amount of the loan.
(2) If a, pledge, through default, neglect or wilful misbehaviour on the part of the pawnbroker, is lost, destroyed or is of less value at the time of redemption than it was at the time of pawning, the owner may apply to the District Court for compensation and the Court may, if it thinks fit, award compensation in respect of the damage, and the amount so awarded shall be deducted from the sum payable to the pawnbroker, or as the case may require, shall be paid by the pawnbroker in such manner as the Court may direct.
Loss of Pawn-ticket
9. If a pawn-ticket is lost, mislaid or stolen, the pawner should at once apply to the pawnbroker for a form of declaration to be made before a Notary Public, a Commissioner for Oaths or a Peace Commissioner; otherwise the pawnbroker will be bound to deliver the pledge to any person who produces the pawn-ticket to him and claims to redeem the pledge.

1. The maximum rate of interest shall be one halfpenny per month for every two shillings of the loan.
2. For the purposes of paragraph 1—

SEVENTH SCHEDULE
Regulations governing auctioning of pledges
1. The auctioneer shall cause all pledges to be exposed to public view.
2. He shall publish catalogues of the pledges, stating—
(1) the pawnbroker's name and place of business;
(2) the month in which each pledge was pawned;
(3) the number of each pledge as entered at the time of pawning in the pledge book.
3. The pledges of each pawnbroker in the catalogue shall be separate from any pledges of any other pawnbroker.
4. The auctioneer shall insert in a public newspaper circulating in the area in which the pawnbroker's premises are situated an advertisement giving notice of the sale and stating—
(1) the pawnbroker's name and place of business;
(2) the month in which the pledges were pawned.
5. The advertisement shall be inserted at least three clear days before the first day of the sale.
6. Where a pawnbroker bids at a sale, the auctioneer shall not take the bidding in any other form or manner than that in which he takes the biddings of other persons at the same sale; and the auctioneer on knocking down any article to a pawnbroker shall forthwith declare audibly the name of the pawnbroker as purchaser.
7. The auctioneer shall, within fourteen days after the sale, deliver to the pawnbroker a copy of the catalogue, or of so much thereof as relates to the pledges of that pawnbroker, filled up with the amounts for which the several pledges of that pawnbroker were sold, and the copy shall be authenticated by the signature of the auctioneer.
8. The pawnbroker shall preserve every such catalogue for at least twelve months after the auction.
