IRISH STEEL HOLDINGS LIMITED (AMENDMENT) ACT, 1971

Interpretation and construction.

1.—(1) In this Act “the Principal Act” means the Irish Steel Holdings Limited Act, 1960.

(2) This Act shall be construed as one with the Principal Act.

Amendment of section 9 of Principal Act.

2.—Section 9 of the Principal Act, which imposes a limit on the guarantee by the Minister of the repayment of moneys borrowed by the Company, is hereby amended—

(a) by the substitution in subsection (3) of “£3,000,000” for “£1,000,000” (inserted by the Irish Steel Holdings Limited (Amendment) Act, 1963),

and

(b) by the insertion in subsection (1) after “to the Company” and in subsection (2) after “and the payment of such interest” of “or the due payment by the Company of instalments of moneys owed by the Company and outstanding under a contract entered into by the Company or the interest on any such moneys outstanding or both the payment of such instalments and such interest.”

Construction of section 9 of Principal Act.

3.—(1) For the purposes of section 9 of the Principal Act, the amounts guaranteed by the Minister for Finance under the State Guarantees Act, 1954, in respect of moneys borrowed by the Company shall be deemed to be amounts guaranteed by the Minister under the Principal Act.

(2) In section 9 (5) (c) of the Principal Act “principal” shall be construed as including moneys owed by the Company and outstanding under a contract entered into by the Company, and in sections 12 (b) and 12 (c) of the Principal Act “moneys borrowed” shall be construed as including moneys owed by the Company and outstanding under a contract entered into by the Company.

Short title and collective citation.

4.—(1) This Act may be cited as the Irish Steel Holdings Limited (Amendment) Act, 1971.

(2) The Irish Steel Holdings Limited Acts, 1960 and 1963, and this Act may be cited together as the Irish Steel Holdings Limited Acts, 1960 to 1971.

1.—(1) San Acht seo ciallaíonn “an Príomh-Acht” an tAcht um Ghabháltais Chruach na hÉireann Teoranta, 1960.

(2) Forléireofar an tAcht seo agus an Príomh-Acht mar aon ní amháin.

2.—Déantar leis seo alt 9 de Phríomh-Acht, a fhorchuireann teorainn le ráthú ag an Aire go n-aisíocfar airgead a gheobhaidh an Chuideachta ar iasacht, a leasú—

(a) trí “£3,000,000” a chur i bhfo-alt (3) in ionad “£1,000,000” (a cuireadh isteach leis an Acht um Ghabháltais Chruach na hÉireann Teoranta (Leasú), 1963),

agus

(b) trí “nó féadfaidh sé a ráthú go n-íocfaidh an Chuideachta go cuí tráthchodanna airgid a bheidh dlite den Chuideachta agus gan íoc faoi chonradh a rinne an Chuideachta nó an t-ús ar aon airgead den sórt sin a bheidh gan íoc nó go ndéanfar na tráthchodanna sin agus fós an t-ús sin a íoc” a chur i bhfo-alt (1) i ndiaidh “don Chuideachta a ráthú” agus i bhfo-alt (2) i ndiaidh “agus fós an t-ús sin a íoc”.

3.—(1) Chun críocha alt 9 den Phríomh-Acht, measfar gur suimeanna a ráthaigh an tAire Airgeadais faoin bPríomh-Acht na suimeanna a ráthaigh an tAire Airgeadais faoin Acht Ráthaíocht Stáit, 1954, i leith airgead a fuair an Chuideachta ar iasacht.

(2) In alt 9 (5) (c) den Phríomh-Acht forléireofar an tagairt do phríomhshuim mar thagairt a fholaíonn tagairt d'airgead atá dlite den Chuideachta agus gan íoc faoi chonradh a rinne an Chuideachta, agus in ailt 12 (b) agus 12 (c) den Phríomh-Acht forléireofar an tagairt d'airgead a fuarthas ar iasacht mar thagairt a fholaíonn tagairt d'airgead atá dlite den Chuideachta agus gan íoc faoi chonradh a rinne an Chuideachta.

Gearrtheideal agus comhlua.

4.—(1) Féadfar an tAcht um Ghabháltais Chruach na hÉireann Teoranta (Leasú), 1971, a ghairm den Acht seo.

(2) Féadfar na hAchtanna um Ghabháltais Chruach na hÉireann Teoranta, 1960 go 1971, a ghairm de na hAchtanna um Ghabháltais Chruach na hÉireann Teoranta, 1960 agus 1963, agus den Acht seo le chéile.
