1.—San Acht seo—
ciallaíonn an abairt “Acht 1945” an tAcht Oifigeach Cúirte, 1945 (Uimh. 25 de 1945);
ciallaíonn an abairt “an Príomh-Acht” an tAcht Oifigeach Cúirte, 1926 (Uimh. 27 de 1926).
Cláraitheoir contae do thabhairt suas táillí airithe.
2.—(1) I gcás cumhachta, dualgais, údaráis, cirt agus oblagáidí fo-shirriaim chontae nó chontae-bhuirge a bheith arna n-aistriú, de bhuaidh ailt 54 den Phríomh-Acht, chun cláraitheora chontae, ansin, d'ainneoin aon ní san alt sin, déanfaidh an cláraitheoir contae sin na táillí go léir a gheobhas sé faoi aon ordú arna dhéanamh faoi alt 14 den Acht um Fheidhmiú Orduithe Cúirte, 1926 (Uimh. 18 de 1926), a thabhairt suas don Stát-Chiste.
(2) Measfar an t-alt seo a theacht i ngníomh an lú lá de Mheán Fómhair, 1926, agus beidh éifeacht aige amhail ar an dáta sin agus ón dáta sin.
Deimhnithe stát-sheirbhíse a dheonadh do chléirigh chúirte dúiche láithreacha áirithe agus aiscí a dheonadh do chléirigh chúirte dúiche láithreacha áirithe.
3.—(1) Baineann an t-alt seo—
(a) le duine a bheas, ar dháta an Achta seo a rith, ar fostú ar feadh a chuid ama go léir mar chléireach cúirte dúiche agus nach ndearnadh i leith a phoist mar chléireach cúirte dúiche deimhniú cáilitheachta a dheonadh roimh an dáta sin,
(b) le duine a bheas, ar an dáta sin, ar fostú ar feadh coda dá am mar chléireach cúirte dúiche agus a thiocfas chun bheith ar fostú ar feadh a chuid ama go léir mar chléireach cúirte dúiche.
(2) (a) Féadfaidh Coimisinéirí na Stát-Sheirbhíse, ar mholadh an Aire arna thabhairt le comhthoiliú an Aire Airgeadais, deimhniú cáilitheachta i leith a phoist mar chléireach cúirte dúiche a dheonadh do dhuine ar bith lena mbaineann an t-alt seo.
(b) Aon deimhniú cáilitheachta a deonfar faoi mhír (a) den fho-alt seo, féadfar, le toiliú an Aire Airgeadais, a shainrá ann go bhfuil éifeacht aige ó dháta roimh dháta a dheonta agus, má bhíonn sainráite amhlaidh i ndeimhniú cáilitheachta go bhfuil éifeacht aige ó dháta roimh dháta a dheonta, measfar an duine dá ndeonfar an deimhniú a bheith arna íoc as airgead a sholáthraigh an tOireachtas do réir bhrí ailt 17 den Superannuation Act, 1859, amhail ón dáta a mbeidh sainráite sa deimhniú éifeacht a bheith aige uaidh.
(3) Duine ar bith lena mbaineann an t-alt seo agus nach ndéanfar, ar chúis ar bith, deimhniú cáilitheachta i leith a phoist mar chléireach cúirte dúiche a dheonadh dhó faoi fho-alt (2) den alt seo nó ar shlí eile roimh é d'urscaoileadh, féadfaidh an tAire Airgeadais, as airgead a sholáthrós an tOireachtas, aisce de pé méid (nach mó ná dhá oiread a thuarastail agus a shochar oifige ar feadh na bliana deiridh dá fhostaíocht) is cuí leis an Aire Airgeadais a dheonadh don duine sin ar é d'urscaoileadh.
Ionadaithe do chléirigh chúirte dúiche.
4.—(1) I gcás aon chléireach cúirte dúiche a bheith as láthair go sealadach nó a bheith faoi éagumas sealadach nó i gcás oifig chléirigh chúirte dúiche d'aon cheantar cúirte dúiche a bheith folamh, féadfaidh an tAire, le comhthoiliú an Aire Airgeadais, ionadaí a cheapadh chun oifig an chléirigh chúirte dúiche sin a chomhlíonadh an fhaid a mhairfeas an neamhláithreacht, an t-éagumas nó an folúntas sin, agus aon duine a ceapfar amhlaidh sealbhóidh sé an oifig sin ar pé coinníollacha a chinnfeas an tAire Airgeadais ó am go ham tar éis dó dul i gcomhairle leis an Aire.
(2) Faid a mhairfeas ceapachán ionadaí a ceapfar faoin alt seo, sealbhóidh agus feidhmeoidh sé cumhachta agus údaráis uile, agus comhlíonfaidh sé dualgais agus feidhmeanna uile, an chléirigh chúirte dúiche darb ionadaí é.
Clárlanna probháide ceantair.
5.—(1) Measfar, chun críocha ailt 9 d'Acht 1945, gur oifig a ghabhas leis an Ard-Chúirt gach clárlann phrobháide cheantair.
(2) Measfar fo-alt (1) den alt seo a theacht i ngníomh an 26ú lá d'Iúil, 1926, agus beidh éifeacht aige amhail ar an dáta sin agus ón dáta sin.
Alt 12 d'Acht 1945 a leasú.
6.—(1) (a) In alt 12 d'Acht 1945, cuirfear an fo-alt seo a leanas in ionad fo-ailt (4)—
“(4) I gcás ordú a dhéanamh faoi fho-alt (2) den alt seo maidir le contae-bhuirg Bhaile Atha Cliath sar a scoirfidh an duine a bheas i seilbh oifige ar dháta an Achta seo a rith mar fho-shirriam do chontae Bhaile Atha Cliath de bheith i seilbh na hoifige sin, ní chuirfidh déanamh an orduithe sin isteach ar oibriú fo-ailt (3) d'alt 23 den Acht Rialtais Áitiúil (Baile Atha Cliath), 1930 (Uimh. 27 de 1930) ná fo-ailt (2) d'alt 9 den Acht Rialtais Áitiúil (Baile Atha Cliath) (Leasú), 1940 (Uimh. 21 de 1940), ach, nuair a bheas feidhm á tabhairt do na forála sin faoi seach ar an duine sin a scor de bheith i seilbh na hoifige sin, cuirfear an focal ‘sirriam’ in ionad an an fhocail ‘fo-shirriam’—
(a) i míreanna (a) agus (b) d'fho-alt (3) den alt sin 23, agus
(b) i bhfo-alt (2) den alt sin 9 san áit deiridh a bhfuil an focal ‘fo-shirriam’ ann.”
(b) Measfar mír (a) den fho-alt seo a theacht i ngníomh an 26ú lá d'Iúil, 1945, agus beidh éifeacht aige amhail ar an dáta sin agus ón dáta sin.
(2) D'ainneoin míre (b) d'fho-alt (6) d'alt 12 d'Acht 1945, is dhá bhliain seachtód an aois chun scor de bheith i seilbh oifige sirriaim i gcás an duine a bheas i seilbh oifige sirriaim do chontaebhuirg Bhaile Atha Cliath ar dháta an Achta seo a rith.

7.—(1) Féadfar an tAcht Oifigeach Cúirte, 1951, a ghairm den Acht seo.
(2) Féadfar na hAchta Oifigeach Cúirte, 1926 go 1951, a ghairm de na hAchta Oifigeach Cúirte, 1926 go 1945, agus den Acht seo le chéile.
(3) Déanfar na hAchta Oifigeach Cúirte, 1926 go 1945, agus an tAcht seo d'fhorléiriú le chéile mar aon Acht amháin.

COURT OFFICERS ACT, 1951.
Definitions.
1.—In this Act—
the expression “the Act of 1945” means the Court Officers Act, 1945 (No. 25 of 1945);
the expression “the Principal Act” means the Court Officers Act, 1926 (No. 27 of 1926).
Surrender by county registrar of certain fees.
2.—(1) Where the powers, duties, authorities, rights and obligations of an undersheriff of a county or county borough are, by virtue of section 54 of the Principal Act, transferred to a county registrar, then, notwithstanding anything contained in that section, all fees received by that county registrar under any order made under section 14 of the Enforcement of Court Orders Act, 1926 (No. 18 of 1926), shall be surrendered by him to the Exchequer.
(2) This section shall be deemed to have come into operation on, and shall have effect as on and from, the 1st day of September, 1926.
Grant of civil service certificates to certain existing district court clerks and gratuities to certain existing district court clerks.
3.—(1) This section applies to—
(a) a person who, on the date of the passing of this Act, is employed during the whole of his time as a district court clerk and in respect of whose situation as a district court clerk a certificate of qualification has not been granted before that date,
(b) a person who, on that date, is employed during part of his time as a district court clerk and who becomes employed during the whole of his time as a district court clerk.
(2) (a) The Civil Service Commissioners may, on the recommendation of the Minister given with the concurrence of the Minister for Finance, grant to any person to whom this section applies a certificate of qualification in respect of his situation as a district court clerk.
(b) A certificate of qualification granted under paragraph (a) of this subsection may, with the consent of the Minister for Finance, be expressed to take effect from a date prior to the date on which it is granted and, when a certificate of qualification is so expressed to take effect from a date prior to the date on which it is granted, the person to whom the certificate is granted shall be deemed to have been paid from moneys provided by the Oireachtas within the meaning of section 17 of the Superannuation Act, 1859, as from the date from which the certificate is expressed to take effect.
(3) Where a person to whom this section applies has for any reason not been granted a certificate of qualification in respect of his situation as a district court clerk under subsection (2) of this section or otherwise before his discharge, the Minister for Finance may, out of moneys provided by the Oireachtas, grant to such person on his discharge a gratuity of such amount (not exceeding twice the amount of his salary and emoluments during the last year of his employment) as the Minister for Finance thinks proper.
Deputies for district court clerks.
4.—(1) In the event of the temporary absence or the temporary incapacity of any district court clerk or in the event of the office of district court clerk for any district court area being vacant, the Minister may, with the concurrence of the Minister for Finance, appoint a deputy to execute the office of such district court clerk during such absence, incapacity or vacancy, and any person so appointed shall hold office on such conditions as the Minister for Finance, after consultation with the Minister, may from time to time determine.
(2) A deputy appointed under this section shall, while his appointment continues, have and exercise all powers and authorities and fulfil all the duties and functions of the district court clerk whose deputy he is.
District probate registries.
5.—(1) Every district probate registry shall, for the purposes of section 9 of the Act of 1945, be deemed to be an office attached to the High Court.
(2) Subsection (1) of this section shall be deemed to have come into operation on, and shall have effect as on and from, the 26th day of July, 1945.
Amendment of section 12 of the Act of 1945.
6.—(1) (a) In section 12 of the Act of 1945, the following subsection shall be substituted for subsection (4)—
“(4) Where an order is made under subsection (2) of this section in respect of the county borough of Dublin before the person holding office on the date of the passing of this Act as undersheriff of the county of Dublin ceases to hold office, the making of the order shall not affect the operation of subsection (3) of section 23 of the Local Government (Dublin) Act, 1930 (No. 27 of 1930), or subsection (2) of section 9 of the Local Government (Dublin) (Amendment) Act, 1940 (No. 21 of 1940), but, in applying those provisions respectively on such person's ceasing to hold that office, the word ‘sheriff’ shall be substituted for the word ‘undersheriff’—
(a) in paragraphs (a) and (b) of subsection (3) of the said section 23, and
(b) in subsection (2) of the said section 9 where the word ‘undersheriff’ last occurs therein.”
(b) Paragraph (a) of this subsection shall be deemed to have come into operation on, and shall have effect as on and from, the 26th day of July, 1945.
(2) Notwithstanding paragraph (b) of subsection (6) of section 12 of the Act of 1945, the age of retirement from the office of sheriff of the person holding the office of sheriff of the county borough of Dublin on the date of the passing of this Act shall be seventy-two years.
Short title, collective citation and construction.
7.—(1) This Act may be cited as the Court Officers Act, 1951.
(2) The Court Officers Acts, 1926 to 1945, and this Act may be cited together as the Court Officers Acts, 1926 to 1951.
(3) The Court Officers Acts, 1926 to 1945, and this Act shall be construed together as one Act.
