CUID I.

Geim do Chosaint agus do Chaomhna.

[EN]

Saosúr coiscthe do shaghsanna airithe géim.

3.—(1) Ní bheidh sé dleathach do dhuine ar bith géim ar bith de shaghas a luaidhtear sa chéad cholún den Chéad Sceideal a ghabhann leis an Acht so do mharbha ná do thógaint i rith na tréimhse luaidhtear maidir leis an saghas san géim sa dara colún den Chéad Sceideal san.

(2) Ar a iarraidh sin air do mháistir paca gadhar fiadhaigh no do dhuine eile i bhfeighil phaca gadhar fiadhaigh féadfaidh an tAire cead do thabhairt amach don duine sin chun fiadhach do dhéanamh, in aon cheanntar a bheidh luaidhte sa chead san, leis an bpaca gadhar fiadhaigh sin i rith mí na Márta an bhliain do bhéarfar amach an cead san, agus pé uair do bhéarfar amach aon chead den tsórt san amhlaidh ní sárú ar an alt so girrfhithe do thógaint agus do mharbha tré fhiadhach leis an bpaca gadhar fiadhaigh sa cheanntar agus i rith na tréimhse le n-a mbaineann an cead san.

(3) Ar a iarraidh sin air do chlub choimhlinte con údaruithe féadfaidh an tAire cead do thabhairt amach don chlub san chun coimhlintí con do chomóra ar an lá no ar na laethe bheidh luaidhte sa chead san idir an 1adh lá agus an 18adh lá (agus an dá lá san d'áireamh) de mhí na Márta an bhliain do bhéarfar amach an cead san, agus pé uair do bhéarfar amach aon chead den tsórt san ní sárú ar an alt so girrfhithe do thógaint agus do mharbha tré choimhlint idir dhá choin, ar a mhéid, ar n-a scaoile as iallacha i ndiaidh an ghirrfhé i gcoimhlintí con a comórfar lá bheidh luaidhte sa chead san ag an gclub coimhlinte con údaruithe dá dtabharfar amach an cead san.

(4) Gach n-aon a mharbhóidh no a thógfaidh géim ar bith contrárdha don alt so beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

(5) San Acht so agus i ngach Acht a rithfear tar éis an Achta so do rith cialluíonn an abairt “saosúr coiscthe bliantúil,” sa mhéid go mbaineann sí le géim de shaghas ar bith dá luaidhtear sa chéad cholún den Chéad Sceideal a ghabhann leis an Acht so, an tréimhse bhliantúil ina bhfuil sé toirmiscthe leis an Acht so an géim sin do mharbha no do thógaint.

4.—(1) Ní bheidh sé dleathach do dhuine ar bith aon uair den bhliain géim ar bith (seachas malláird, pras-lachain, lachain rua, agus cineáil eile lachan bhfiadhain, géanna dubha, géanna giughrainn, agus cineáil eile géanna fiadhaine) do mharbha ná do thógaint i rith na haimsire idir uair a' chluig tar éis dul fé don ghréin agus uair a' chluig roimh eirghe gréine.

(2) Gach n-aon a mharbhóidh no a thógfaidh géim ar bith contrárdha don alt so beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

Géim do dhíol sa tsaosúr choiscthe.

5.—(1) Ní bheidh sé dleathach do dhuine ar bith aon ghéim do cheannach ná do dhíol ná é do thairisgint, do thaisbeáint ná do chimeád chun a dhíolta le linn aon choda den tsaosúr choiscthe don ghéim sin ach amháin an chéad chúig lá dhe.

(2) Gach n-aon a dhéanfaidh aon ghéim do cheannach no do dhíol no do thairisgint, do thaisbeáint no do chimeád chun a dhíolta contrárdha don alt so, beidh sé ciontach i gcionta fén alt so agus dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar deich bpúint do chur air más géim do cheannach an cionta do rinne agus in aon chás eile fíneáil ná raghaidh thar fiche púnt má sé an chéad chionta aige é agus, má sé an dara cionta aige é no aon chionta ina dhiaidh sin, fíneáil ná raghaidh thar caoga púnt no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná ráithe no an fhíneáil sin agus an phríosúntacht san le chéile.

Orduithe caomhanta maidir le héanacha géim.

6.—(1) Pé uair is deimhin leis an Aire go bhfuil gá speisialta ag aon chineál áirithe d'éanacha géim le n-a chaomhna ar fuaid Shaorstáit Éireann no in aon pháirt áirithe dhe, féadfa sé le hordú (dá ngairmtear ordú caomhanta éanacha géim san Acht se) a thoirmeasc, ar feadh aon tréimhse áirithe nách sia ná bliain o dháta an orduithe, an cineál áirithe sin d'éanacha géim do mharbha ná do thógaint i Saorstát Éireann no in aon pháirt áirithe de Shaorstát Éireann a bheidh luaidhte san ordú.

(2) Ar bheith déanta d'ordú caomhanta éanacha géim fén alt so, féadfaidh an tAire o am go ham le hordú (dá ngairmtear ordú buanuithe san alt so), ar n-a dhéanamh roimh dhul in éag don ordú caomhanta éanacha géim sin no don bhuanú is déanaí do rinneadh air (pe'ca aca é), an t-ordú caomhanta éanacha géim sin do bhuanú go ceann tréimhse ar bith nách sia ná bliain ón dáta ar a raghadh sé in éag mara mbeadh an t-ordú buanuithe agus féadfa sé an t-ordú caomhanta éanacha géim sin do bhuanú amhlaidh maidir le hiomlán an líomatáiste le n-ar bhain an t-ordú san no maidir le haon pháirt áirithe den líomatáiste sin.

(3) Féadfaidh an tAire uair ar bith, le hordú, aon ordú caomhanta éanacha géim no aon ordú buanuithe bheidh déanta aige fén alt so d'atharú i slí ar bith no é do cheiliúra.

(4) Ar bheith déanta d'ordú caomhanta éanacha géim fén alt so ní bheidh sé dleathach do dhuine ar bith, faid a bheidh an t-ordú san i bhfeidhm, éan géim ar bith den chineál le n-a mbaineann an t-ordú san do mharbha ná do thógaint i bpáirt ar bith de Shaorstát Éireann le n-a mbaineann an t-ordú san gan cead, ná ar aon chaoi seachas do réir cheada, o cheannphort Ghárda Síochána an cheanntair ina marbhófar no ina dtógfar an t-éan géim sin: Ach má dheineann ceannphort an Ghárda Síochána go mí-réasúnta cur i gcoinnibh no diúlta an cead san do thabhairt uaidh féadfaidh neach iarrtha na cheada san athchomharc chun an Aire i gcoinnibh na faillí no an diúlttha san Cheannphort an Ghárda Síochána maidir leis an gcead san do thabhairt uaidh agus féadfaidh an tAire cead do thabhairt an t-éan géim sin do mharbha no do thógaint.

(5) Gach n-aon a mharbhóidh no a thógfaidh géim ar bith contrárdha don alt so beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

(6) Gach ordú déanfar fén alt so leagfar fé bhráid gach Tighe den Oireachtas é chó luath agus is féidir é tar éis a dhéanta agus má dheineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfe sé tar éis an t-ordú san do leaga fé n-a bhráid, rún do rith ag cur an orduithe sin i nea-mbrí, beidh an t-ordú san curtha i nea-mbrí dá réir sin gan dochar do dhleathacht éinní do rinneadh fé roimhe sin.

Orduithe caomhanta maidir le girrfhithe.

7.—(1) Más oiriúnach agus pé uair is oiriúnach leis an Aire é, féadfaidh le hordú (dá ngairmtear ordú caomhanta girrfhithe san Acht so) a thoirmeasc, go buan no ar feadh tréimhse ar bith a bheidh luaidhte san ordú san, girrfhithe do mharbha ná do thógaint in aon chontae áirithe no in aon pháirt áirithe de chontae bheidh luaidhte san ordú san.

(2) Féadfaidh an tAire uair ar bith, le hordú, ordú caomhanta girrfhithe bheidh déanta aige fén alt so d'atharú i slí ar bith no é do cheiliúra.

(3) Más oiriúnach leis an Aire é féadfaidh, ar a iarraidh sin air do shealbhaire aon tailimh i gcontae no i bpáirt de chontae le n-a mbaineann ordú caomhanta girrfhithe, an talamh san no páirt ar bith dhe do shaora ón ordú san le scríbhinn fé n-a láimh ar feadh pé aimsire agus ar pé coiníollacha is oiriúnach leis, agus ar dheona na saoirse sin amhlaidh ní bheidh baint ar bith ag an ordú san leis an talamh do saoradh amhlaidh faid a bheidh an tsaoirse sin i bhfeidhm.

(4) Ar bheith déanta d'ordú caomhanta girrfhithe fén alt so ní bheidh sé dleathach do dhuine ar bith, faid a bheidh an t-ordú san i bhfeidhm, girrfhithe do mharbha ná do thógaint, sa chontae ná sa pháirt de chontae le n-a mbaineann an t-ordú san, i slí ar bith ach—

(a) tré choimhlint idir dhá choin, ar a mhéid, ar n-a scaoile as iallacha i ndiaidh an ghirrfhé, no

(b) tré fhiadhach le paca gadhar fiadhaigh go mbeidh cead fiadhaigh tugtha amach ag an Aire ina dtaobh fén Acht so.

(5) Gach n-aon a mharbhóidh no a thógfaidh girrfhithe contrárdha don alt so beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

Ceadanna chun girrfhithe d'fhiadhach.

8.—(1) Ar bheith déanta d'ordú caomhanta girrfhithe fén Acht so, ansan, ar a iarraidh sin air do mháistir paca gadhar fiadhaigh no do dhuine eile i bhfeighil phaca gadhar fiadhaigh, féadfaidh an tAire, uair ar bith le linn bheith i bhfeidhm don ordú san, cead (dá ngairmtear san Acht so cead fiadhaigh) do thabhairt amach don duine sin chun girrfhithe d'fhiadhach, sa líomatáiste no in aon pháirt áirithe den líomatáiste le n-a mbaineann an t-ordú san, leis an bpaca san gadhar fiadhaigh agus chun girrfhithe do thógaint agus do mharbha tríd an bhfiadhach san.

(2) Gach cead fiadhaigh do bhéarfar amach fén alt so beidh sé ionaistrithe i dteanta an phaca gadhar fiadhaigh le n-a mbaineann sé agus dá réir sin (mara ndeintear a cheiliúra no a thabhairt suas fén alt so) leanfa sé i bhfeidhm d'ainneoin atharú ar bith do theacht ar únaeracht no ar mháistreacht no ar chimeád an phaca san agus go sonnrách d'ainneoin an té dar tugadh amach an cead san do scur de bheith ina mháistir ar an bpaca san no de bheith i bhfeighil an phaca san.

(3) Féadfaidh an tAire cead fiadhaigh do bhéarfar amach fén alt so do cheiliúra uair ar bith agus féadfaidh máistir an phaca gadhar fiadhaigh le n-a mbaineann an cead, no an té bheidh i bhfeighil an phaca san de thurus na huaire, an cead do thabhairt suas uair ar bith.

Toirmeasc ar ghéim do thógaint le líonta, etc.

9.—(1) Lasmuich de chás dá bhforáltar a mhalairt leis an gCuid seo den Acht so agus fé réir na heisceachta luaidhtear san alt so, ní bheidh sé dleathach do dhuine ar bith éinní acu so leanas do dhéanamh, sé sin le rá:—

(a) géim ar bith do mharbha no do thógaint le haon dol no gaiste no líon, no

[EN]

(b) aon dol no gaiste no líon do chur síos in áit ar bith chun géim do mharbha no do thógaint, no

[EN]

(c) aon dol no gaiste no líon ar bith do chur síos in áit ar bith ina mbíonn géim.

[EN]

(2) Ní bhainfidh an t-alt so le sealbhaire tailimh do chur síos dolaí no gaistí no líonta chun coiníní ar an talamh a bheidh ar seilbh aige do thógaint ná ní bheidh san nea-dhleathach de dhruim an ailt seo.

(3) Gach n-aon a mharbhóidh no a thógfaidh géim ar bith contrárdha don alt so no a dhéanfaidh aon dol no gaiste no líon do chur síos contrárdha don alt so beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

Saoirse chun girrfhithe do thógaint le líon i gcóir coimhlinte con.

10.—(1) D'ainneoin ní ar bith atá in aon alt eile den Acht so, beidh sé dleathach d'aon bhall, gníomhaire, no seirbhíseach do chlub coimhlinte con údaruithe go mbeidh údarás cuibhe aige chuige seo i scríbhinn o oifigeach fhreagarthach don chlub san girrfhithe do thógaint ina mbeathaidh le líonta uair ar bith (ach amháin le linn an tsaosúir choiscthe bhliantúla) chun crícheanna an chlub san agus chun na gcrícheanna san amháin no girrfhithe do thógaint ina mbeathaidh le líonta uair ar bith idir an 15adh lá de Lúnasa bliana ar bith agus an lá deiridh d'Fheabhra na bliana ina dhiaidh sin (agus an dá lá san d'áireamh) chun go n-úsáidfidh an club san iad i gcoimhlintí con agus chuige sin amháin.

(2) D'ainneoin ní ar bith atá in aon alt eile den Acht so, beidh sé dleathach do dhuine ar bith, le cead i scríbhinn o cheannphort Ghárda Síochána an cheanntair ina ndéanfa sé no ina mbeidh sé ar aigne girrfhithe do thógaint, girrfhithe do thógaint ina mbeathaidh le líonta idir an 15adh lá de Lúnasa bliana ar bith agus an lá deiridh d'Fheabhra na bliana ina dhiaidh sin (agus an dá lá san d'áireamh) chuige seo amháin, eadhon, chun a ndíolta le club coimhlinte con údaruithe chun crícheanna an chlub san agus beidh sé dleathach d'oifigeach freagarthach do chlub coimhlinte con údaruithe girrfhithe tógfar amhlaidh do cheannach chun na gcrícheanna san.

(3) Duine ar bith do thóg no adéarfaidh gur thóg sé girrfhithe de bhua saoirse bronntar leis an alt so agus úsáidfidh na girrfhithe sin chun aon chríche seachas chun na críche chun a mbronntar an tsaoirse sin amhlaidh, beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

11.—(1) Féadfaidh ceannphort den Ghárda Síochána cead i scríbhinn do dheona do dhuine ar bith is únaer no is sealbhaire ar thalamh sa cheanntar dar ceannphort amhlaidh é no do dhuine ar bith ag a mbeidh aon-cheart lámhaigh ar aon talamh den tsórt san piasúin, paitriscí, no girrfhithe do thógaint ina mbeathaidh ar an talamh san le líonta uair ar bith chun na piasúin, na paitriscí, no na girrfhithe (pe'ca aca é) ar an talamh san no ar aon talamh eile i Saorstát Éireann do chur i líonmhaire no i bhfeabhas agus chuige sin amháin.

(2) Féadfaidh ceannphort den Ghárda Síochána do bhéarfaidh uaidh aon chead den tsórt a luaidhtear sa bhfo-alt san roimhe seo pé coiníollacha is oiriúnach leis agus a luadhfa sé sa chead san do cheangal den chead san (maidir le téarma an cheada san, an talamh le n-a mbainfidh, an méid éan no girrfhithe a tógfar fé, no éinní eile).

(3) Nuair a bheidh aon chead den tsórt a luaidhtear sna fo-ailt sin roimhe seo den alt so tugtha go cuibhe do dhuine ar bith, ní bheidh sé nea-dhleathach don duine sin de dhruim ní ar bith san Acht so piasúin, paitriscí, no girrfhithe (pe'ca aca é) do thógaint fé réim agus do réir an cheada san ná ní bheidh sé ina chionta fén gCuid seo den Acht so an duine sin do thógaint piasún, paitriscí, no girrfhithe (pe'ca aca é) amhlaidh,

12.—(1) Ní bheidh sé dleathach do dhuine ar bith uibhe aon éin ghéim do thógaint ná do lot ná do dhíobháiliú ná nead aon éin den tsórt san do lot ná d'aistriú ná do mhille agus gach duine dhéanfaidh ní ar bith contrárdha don alt so beidh sé ciontach i gcionta fén gCuid seo den Acht so agus féadfar pionós do chur air dá réir sin.

(2) D'ainneoin ní ar bith atá sa bhfo-alt san roimhe seo ní sárú ar an alt so uibhe piasún no paitriscí do thógaint chun go ndéanfar gor ceart ortha agus chuige sin amháin.

Pacáistí ina mbeidh géim do mharcáil.

13.—(1) Gach pacáiste ina mbeidh aon tsaghas géim agus a bheidh ar turus i Saorstát Éireann beidh an focal “géim” marcálta go so-fheicse ar an taobh amuich de agus fós beidh ainm agus seola a chonsighneora marcálta ar an bpacáiste féin no ar dhuillín a bheidh ceangailte dhe.

(2) Gach n-aon a dhéanfaidh pacáiste ar bith ina mbeidh aon tsaghas géim agus ná beidh marcálta sa tslí is gá do réir an ailt seo do chur no do chonsighniú chun a bheirthe ar turus i Saorstát Éireann beidh sé ciontach i gcionta fén alt so.

(3) Gach n-aon a dhéanfaidh pacáiste ar bith ina mbeidh aon tsaghas géim agus ná beidh marcálta sa tslí is gá do réir an ailt seo d'iompar ar luach saothair de thír i Saorstát Éireann no de mhuir o phort ar bith i Saorstát Éireann beidh sé ciontach i gcionta fén alt so mara gcruthuighe sé ná raibh a fhios aige agus nárbh bhféidir go réasúnta go mbeadh a fhios aige go raibh géim sa phacáiste sin.

(4) Gach n-aon a bheidh ciontach i gcionta fén alt so dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é agus. má sé an dara cionta aige é no aon chionta ina dhiaidh sin, fíneáil ná raghaidh thar cúig púint fhichead no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná ráithe no an fhíneáil sin agus an phríosúntacht san le chéile.

(5) Chun críche an ailt seo tuigfear pacáiste do bheith ar turus i Saorstát Éireann agus é á iompar i slí ar bith o aon áitreabh no áit i Saorstát Éireann go haon áitreabh eile no áit eile laistigh no lasmuich de Shaorstát Éireann no nuair a bheidh sé in áit ar bith, puiblí no príobháideach, i gcúrsa no chun críche a iompartha amhlaidh.

Clubanna coimhlinte con d'údarú.

14.—(1) Féadfaidh an tAire, le hordú, a dhearbhú gur club coimhlinte con údaruithe chun crícheanna na Coda so den Acht so aon chlub coimhlinte con a bheidh có-cheangailte den chólucht dá ngairmtear do ghnáth an Irish Coursing Club,

(2) Más rogha leis féin é féadfaidh an tAire uair ar bith, le hordú, ordú ar bith do rinne sé roimhe sin fén bhfo-alt san roimhe seo do cheiliúra.

(3) Faid a bheidh ordú déanfar fén gcéad fho-alt den alt so i bhfeidhm beidh an club coimhlinte con le n-a mbaineann an t-ordú san ina chlub coimhlinte con údaruithe do réir bhrí na Coda so den Acht so.

Cumainn chosanta géim d'údarú.

15.—(1) Féadfaidh an tAire, le hordú, a dhearbhú gur comhlachas údaruithe chun crícheanna an ailt seo aon chumann, comhlachas no club do bunuíodh chun cosaint ghéim do chur ar aghaidh no chun síolrú no tréineáil mhadraí a húsáidtear i bhfiadhach géim do chur ar aghaidh no d'fheabhsú agus féadfaidh uair ar bith, más rogha leis féin é, aon ordú den tsórt san do rinne sé roimhe sin do cheiliúra.

(2) I gcás ina ndearna comhlachas údaruithe tailte ar bith do chur in áirithe, le toil sealbhaire na dtailte sin (fé n-a láimh), chun géim do mharbha no do chosaint no do thógaint ortha agus ina ndearnadh fógra i dtaobh an chur-in-áirithe sin d'fhoillsiú ar dhá ócáid fé leith i bpáipeur nuachta léightear sa cheanntar ina bhfuil na tailte sin suidhte, ansan agus i ngach cás den tsórt san féadfar cúiseamh ar bith sa Chúirt Dúithche, mar gheall ar thairsce ar na tailte sin chun no le linn géim d'fhiadhach, do bhunú ar agra agus in ainm rúnaí an chomhlachais údaruithe sin, agus ní cosaint don chosantóir in aghaidh aon chúisimh den tsórt san (pe'ca in ainm an rúnaí sin no in ainm duine éigin eile do bunuíodh é) ná ina aghaidh cúisimh ar bith i gcionta fén gCuid seo den Acht so maidir le géim do mharbha no do thógaint ar na tailte sin a chruthú go raibh údarás aige o shealbhaire na dtailte sin géim do mharbha no do thógaint ortha.

19.—(1) Féadfar imeachta do bhunú ar agra agus in ainm duine ar bith, oifigiúil no neamh-oifigiúil, mar chúisitheoir, chun cúiseamh do dhéanamh mar gheall ar chionta ar bith fén gCuid seo den Acht so.

20.—(1) Ní dhéanfaidh duine ar bith aon ghéim do dhíol ná do thaisbeáint chun a dhíolta ná do chimeád chun a dhíolta gan é bheith ceadúnuithe go cuibhe fén Acht so é do dhíol amhlaidh, ná in áit ar bith ná beidh sé údaruithe dho le n-a cheadúnas é do dhíol ann.

(2) Duine ar bith a dhéanfaidh, tar éis dhá mhí o thosach feidhme an Achta so, aon ghéim do dhíol no do thaisbeáint chun a dhíolta no do chimeád chun a dhíolta contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus dlighfear, ar a chiontú ann ar an slí achmair, fíneáil ná raghaidh thar deich bpúint do chur air má sé an chéad chionta aige é agus, má sé an dara cionta aige é no aon chionta ina dhiaidh sin, fíneáil ná raghaidh thar cúig púint fhichead no, más rogha leis an gcúirt é, príosúntacht ar feadh téarma ar bith nách sia ná ráithe no an fhíneáil sin agus an phríosúntacht san le chéile.

21.—(1) Ar a iarraidh sin air do dhuine ar bith agus ar íoc na táille is gá do reir dlí don duine sin, féadfaidh Breitheamh den Chúirt Dúithche, fé réir forálacha an ailt seo, ceadúnas (dá ngairmtear ceadúnas díolta géim san Acht so) do thabhairt amach don duine sin chun géim do dhíol i pé áit nó áiteanna, laistigh de dhúthaigh an Bhreithimh sin, a luadhfaidh an t-iarratasóir agus féadfaidh, sa tslí chéanna agus fé réir na bhforálacha roimhráite, aon cheadúnas den tsórt san do thug sé amach d'athnuachaint o am go ham mara mbeidh deire curtha leis fén Acht so.

(2) Is i scríbhinn a déanfar gach iarratas ar cheadúnas díolta géim do thabhairt amach no d'ath-nuachaint agus beidh sé sa bhfuirm orduithe agus beidh an t-eolas orduithe ann agus, más iarratas ar cheadúnas d'athnuachaint é, déanfar é laistigh de cheithre lá déag roimh dhul in éag no laistigh de mhí tar éis dul in éag don cheadúnas no don athnuachaint is déanaí do rinneadh air, pe'ca aca é.

22.—(1) Is sa bhfuirm orduithe bheidh gach ceadúnas díolta géim agus gach athnuachaint ar aon cheadúnas den tsórt san agus faid a bheidh sé i bhfeidhm oibreoidh sé chun a údarú don té bheidh ainmnithe sa cheadúnas géim do dhíol agus géim do thaisbeáint agus do chimeád chun a dhíolta san áit no sna háiteanna bheidh luaidhte sa cheadúnas san.

(2) Beidh deire le gach ceadúnas díolta géim ar fháil bháis dá shealbhóir no ar a cheiliúra fén Acht so do Bhreitheamh den Chúirt Dúithche agus féadfaidh a shealbhóir deire do chur leis tré é do thabhairt suas.

(3) Fanfaidh gach ceadúnas díolta géim i bhfeidhm go ceann bliana (mara gcuirtear deire leis roimhe sin) o dháta a thabhartha amach agus ní níos sia ná san agus fanfaidh gach athnuachaint ar aon cheadúnas den tsórt san i bhfeidhm go ceann bliana (mara gcuirtear deire leis roimhe sin) ón dáta ar a ndeachaidh an ceadúnas san no an athnuachaint ba dhéanaí roimhe sin air (pe'ca aca é) in éag agus ní níos sia ná san.

Ceadúnaisí díolta géim do cheiliúra.

23.—(1) Ar chiontú sealbhóra cheadúnais díolta géim i gcionta fén Acht so, féadfaidh an Breitheamh den Chúirt Dúithche gur ina láthair a ciontófar an sealbhóir sin amhlaidh an ceadúnas san do cheiliúra agus beidh an ceiliúra san mar bhreis ar aon phionós eile chuirfidh an Breitheamh san ar an sealbhóir sin fén Acht so mar gheall ar an gcionta san.

(2) Má deintear sealbhóir ceadúnais díolta géim do ciontuíodh i gcionta fén Acht so do chiontú arís, laistigh de thréimhse trí mblian ó dháta an chéad chiontuithe, i gcionta fén Acht so (pe'ca den tsaghas chéanna é no nách eadh), ansan an Breitheamh den Chúirt Dúithche gur ina láthair a ciontófar an sealbhóir sin arís amhlaidh, féadfa sé, má cheiliúrann sé an ceadúnas san fén alt so, a dhearbhú ina theanta san nách ceaduithe don tsealbhóir sin, go ceann pé tréimhse nách sia ná cúig bliana agus a luadhfaidh an Breitheamh, ceadúnas díolta géim do bheith ar seilbh aige agus nuair a déanfar an dearbhú san amhlaidh ní bheidh sé ceaduithe don tsealbhóir sin, go ceann na tréimhse luadhfar amhlaidh, ceadúnas díolta géim do bheith ar seilbh aige.

Ceadúnaisí díolta géim d'fhoillsiú.

24.—(1) Déanfaidh gach sealbhóir ceadúnais díolta géim an ceadúnas san no an athnuachaint is déanaí do rinneadh air (pe'ca aca is gá sa chás) do chimeád ar taisbeáint go so-fheicse, san áit no i gceann de sna háiteanna le n-a mbaineann an ceadúnas san, le linn uaireanna gnótha agus, má bhaineann an ceadúnas san le níos mó ná aon áit amháin, cimeádfa sé cóip den cheadúnas no den athnuachaint sin ar taisbeáint amhlaidh i ngach áit acu san ach amháin san áit ina mbeidh an ceadúnas no an athnuachaint sin ar taisbeáint amhlaidh.

(3) Déanfar liostaí de dhaoine ag a mbeidh ceadúnaisí díolta géim d'fhoillsiú pé uaire agus i pé áiteanna agus i pé slí agus fuirm ordóidh an tAire o am go ham.

Beidh ar shealbhóir ceadúnais díolta géim clár do chimeád.

25.—(1) Beidh sé de dhualgas ar gach sealbhóir ceadúnais díolta géim clár do chimeád no a chur fé ndeár clár do chimeád sa bhfuirm orduithe, i ngach áitreabh dá mbeidh luaidhte sa cheadúnas san, den ghéim uile ceannófar agus do gheobhfar san áitreabh san no chun a dhíolta san áitreabh san agus den ghéim uile díolfar no cuirfear de láimh san áitreabh san no a haistreofar ón áitreabh san agus laistigh de shé uaire a' chluig tar éis aon ghéim do cheannach no d'fháil agus laistigh de thrí uaire a' chluig tar éis aon ghéim do dhíol, do chur de láimh, no d'aistriú na mion-innste orduithe do chur sa chlár san maidir leis an ngéim sin do cheannach, d'fháil, do dhíol, do chur le láimh, no d'aistriú (pe'ca aca é) agus maidir leis an té o n-ar ceannuíodh no o n-a bhfuarthas é no le n-ar díoladh no dar tugadh é no maidir leis an áit chun ar haistríodh é (pe'ca aca is gá sa chás).

(2) Ní bhainfidh an t-alt so le hoifigeach freagarthach do chlub coimhlinte con údaruithe agus é ag ceannach girrfhithe fé údarás a bronntar chuige sin leis an Acht so.

27.—(1) Ní bheidh sé dleathach do dhuine ar bith, ach amháin le cead i scríbhinn o cheannphort Ghárda Síochána an cheanntair ina mbeidh an duine sin ina chomhnaí agus do réir téarmaí an cheada san, aon phaitrisc, piasún, no cearc fraoigh d'easportáil go ceann tréimhse dhá bhlian o thosach feidhme agus tar éis tosach feidhme an Achta so ná go ceann aon aimsire chuirfidh an tAire leis an tréimhse sin fén alt so.

(2) Más oiriúnach leis é féadfaidh an tAire uair ar bith agus o am go ham, le hordú, pé méid aimsire is dó leis is ceart do chur leis an tréimhse sin de dhá bhliain a luaidhtear sa bhfo-alt san roimhe seo agus féadfa sé uair ar bith, le hordú, aon ordú den tsort san d'atharú, do leasú no do cheiliúra.

29.—(1) Ball ar bith den Ghárda Síochána agus fós duine ar bith go mbeidh údarás aige ón Aire na comhachta bronntar leis an alt so d'fheidhmiú, údaruítear agus tugtar comhacht do leis seo gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—

GAME PRESERVATION ACT, 1930.


AN ACT TO MAKE BETTER PROVISION FOR THE PRESERVATION OF GAME AND FOR THAT PURPOSE TO MAKE PROVISION FOR THE CONTROL OF GAME DEALERS AND FOR OTHER MATTERS INCIDENTAL OR CONDUCIVE TO THE PRESERVATION OF GAME. [27th May, 1930.] BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—

PRELIMINARY.

Short title.

1.—(1) This Act may be cited as the Game Preservation Act, 1930.

(2) This Act shall come into operation on the 1st day of May, 1930.

Definitions.

2.—In this Act—

the expression “game birds” means and includes pheasant, partridge, grouse, quail, landrail, plover, snipe, and woodcock and also mallard, teal, widgeon, and other species of wild duck, brent goose, barnacle goose, or other species of wild goose:

the word “hares” includes leverets;

the word “game” includes game birds and hares;

[GA]

the expression “the Minister” means the Minister for Justice;

[GA]

the word “prescribed” means prescribed by regulations made by the Minister under this Act.

PART I.

Preservation and Protection of Game.

[GA]

Close season for various classes of game.

3.—(1) It shall not be lawful for any person to kill or take any game belonging to a class of game mentioned in the first column of the First Schedule to this Act during the period specified in respect of such class of game in the second column of the said First Schedule.

(2) The Minister may, on the application of the master or other person having charge of a pack of harriers, issue to such person a permit to hunt in any district specified in such permit with such pack of harriers during the month of March in the year in which such permit is issued, and whenever any such permit is so issued the taking and killing of hares by hunting with the pack of harriers in the district and during the period to which such permit relates shall not be a contravention of this section.

(3) The Minister may, on the application of a recognised coursing club, issue to such club a permit to hold coursing matches on the day or days specified in such permit between the 1st and the 18th day (both days inclusive) of the month of March in the year in which such permit is issued, and whenever any such permit is so issued the taking and killing of hares by coursing with not more than two dogs let loose from slips in pursuit of the hare at coursing matches held on a day specified in such permit by the recognised coursing club to whom such permit is issued shall not be a contravention of this section.

(4) Every person who kills or takes any game in contravention of this section shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

(5) In this Act and in every Act passed after the passing of this Act the expression “annual close season” in relation to game belonging to any of the classes of game mentioned in the first column of the First Schedule to this Act means the annual period of time within which the killing or taking of such game is prohibited by this Act.

Prohibition against killing game at night.

4.—(1) It shall not be lawful for any person at any time of the year to kill or take any game (other than mallard, teal, widgeon and other species of wild duck, brent goose, barnacle goose and other species of wild goose) during the hours between one hour after sunset and one hour before sunrise.

(2) Every person who kills or takes any game in contravention of this section shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

Sale of game in close season.

5.—(1) It shall not be lawful for any person to buy or sell or offer, expose or keep for sale any game during any part of the close season for such game except the first five days thereof.

(2) Every person who buys or who sells or offers, exposes, or keeps for sale any game in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof where the offence consists only of buying game, to a fine not exceeding ten pounds and in any other case, for a first offence to a fine not exceeding twenty pounds and for a second or any subsequent offence to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.

Protection orders in respect of game birds.

6.—(1) Whenever the Minister is satisfied that any particular species of game bird is in special need of protection in the whole or any particular portion of Saorstát Eireann he may by order (in this Act referred to as a game birds protection order) prohibit for any specified period not exceeding one year from the date of the order the killing or taking of that particular species of game bird in Saorstát Eireann or in any particular portion of Saorstát Eireann specified in the order.

(2) When a game bird protection order has been made under this section, the Minister may from time to time by order (in this section referred to as a continuation order) made before the expiration of such game birds protection order or the last continuation thereof (as the case may be) continue in force such game birds protection order for any period not exceeding one year from the date on which the same would otherwise have expired and may so continue in force such, game birds protection order either in respect of the whole area to which such order applied or in respect of any particular portion of such area.

(3) The Minister may at any time by order vary in any respect or revoke any game birds protection order or any continuation order made by him under this section.

(4) When a game birds protection order has been made under this section, it shall not be lawful for any person while such order continues in force to kill or take any game bird of the species to which such order relates in any part of Saorstát Eireann to which such order applies without or otherwise than in accordance with the permission of the superintendent of the Gárda Síochána for the district in which such game bird is killed or taken: Provided always that if the Superintendent of the Gárda Síochána unreasonably objects or refuses to grant such permission the person so applying may appeal to the Minister against such neglect or refusal of the superintendent of the Gárda Síochána to grant such permission and the Minister may grant permission to kill or take such game bird.

(5) Every person who kills or takes any game in contravention of this section shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

(6) Every order made under this section shall be laid before each House of the Oireachtas as soon as may be after it is made and if either such House within the next twenty-one days on which it has sat after such order is laid before it passes a resolution annulling such order such order shall be annulled accordingly without prejudice to the validity of anything previously done thereunder.

Protection orders in respect of hares.

7.—(1) The Minister may, if and whenever he thinks fit, by order (in this Act referred to as a hares protection order) prohibit either permanently or for any period specified in such order the killing or taking of hares in any particular county or part of a county specified in such order.

(2) The Minister may at any time by order vary in any respect or revoke a hares protection order made by him under this section.

[GA]

(3) The Minister may, if he so thinks fit on the application of the occupier of any land in a county or part of a county to which a hares protection order relates, exempt by writing under his hand for such time and on such conditions as he thinks fit such land or any part thereof from such order, and upon such exemption being so granted such order shall not apply or relate to the land the subject of such exemption so long as such exemption continues in force.

(4) When a hares protection order has been made under this section, it shall not be lawful for any person while such order continues in force to kill or take hares in the county or part of a county to which such order relates by any means other than—

(a) by coursing with not more than two dogs let loose from slips in pursuit of the hare, or

[GA]

(b) by hunting with a pack of harriers or of beagle hounds in respect of which a hunting permit has been issued under this Act by the Minister.

(5) Every person who kills or takes hares in contravention of this section shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

Permits for hunting hares.

8.—(1) When a hares protection order has been made under this Act, the Minister on the application of the master or other person having charge of a pack of harriers or of beagle hounds, may at any time while such order remains in force issue to such person a permit (in this Act referred to as a hunting permit) to hunt hares in the area or any particular part of the area to which such order relates with the said pack of harriers or of beagle hounds and to take and kill hares by means of such hunting.

(2) Every hunting permit issued under this section shall be transferable with the pack of harriers or of beagle hounds to which it relates and shall accordingly (unless revoked or surrendered under this section) continue in force notwithstanding any change in the ownership or in the mastership or custody of such pack and in particular notwithstanding that the person to whom such permit was issued ceases to be the master or person having charge of such pack.

(3) A hunting permit issued under this section may be revoked at any time by the Minister and may be surrendered at any time by the master or other person for the time being having charge of the pack of harriers or of beagle hounds to which the permit relates.

Prohibition of taking game by nets, etc.

9.—(1) Save as is otherwise provided by this Part of this Act, and subject to the exception mentioned in this section, it shall not be lawful for any person to do any of the following things, that is to say:—

(a) to kill or take any game by means of any trap, snare, or net, or

[GA]

(b) to set in any place any trap, snare, or net for killing or taking game, or

[GA]

(c) to set in any place frequented by game any trap, snare, or net whatsoever.

[GA]

(2) This section shall not apply to nor render unlawful the setting by an occupier of land of traps, snares or nets for the taking of rabbits on the land occupied by him.

(3) Every person who kills or takes any game in contravention of this section or sets any trap, snare, or net in contravention of this section shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

Exemption for netting of hares for coursing.

10.—(1) Notwithstanding anything contained in any other section of this Act, it shall be lawful for any member, agent, or servant of a recognised coursing club who is duly authorised in this behalf in writing by a responsible officer of such club to take hares alive by means of nets at any time (other than during the annual close season) solely for the purposes of such club or to take hares alive by means of nets at any time between the 15th day of August in any year and the last day of February in the next following year (both days inclusive) in any year solely for use by such club in coursing matches.

(2) Notwithstanding anything contained in any other section of this Act, it shall be lawful for any person, with the permission in writing of the superintendent of the Gárda Síochána for the district in which he takes or proposes to take hares, to take hares alive by means of nets between the 15th day of August in any year and the last day of February in the next following year (both days inclusive) in any year solely for sale to a recognised coursing club for the purposes of such club and it shall be lawful for a responsible officer of a recognised coursing club to purchase hares so taken for such purposes.

(3) Any person who, having taken or claiming to have taken hares by virtue of an exemption conferred by this section, uses such hares for any purpose other than the purpose for which such exemption is so conferred shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

Exemption for netting of game birds and hares for re-stocking.

11.—(1) A superintendent of the Gárda Síochána may grant to any owner or occupier of land in the district for which he is such superintendent or to any person having the exclusive right of shooting on any such land permission in writing to take alive on such land, pheasants, partridge, or hares at any time by means of nets solely for the purpose of increasing the number or improving the quality of the pheasants, partridge, or hares (as the case may be) on such land or on any other land in Saorstát Eireann.

(2) A superintendent of the Gárda Síochána giving any such permission as is mentioned in the foregoing sub-section may attach to such permission such conditions (whether as to the duration of such permission, the land to which it relates, the number of birds or hares to be taken thereunder or any other matter) as he shall think fit and shall specify therein.

[GA]

(3) When any such permission as is mentioned in the foregoing sub-sections of this section has been duly given to any person nothing in this Act shall render unlawful the taking of pheasants, partridge or hares (as the case may be) by such person under and in accordance with such permit nor shall such taking of pheasants, partridge or hares (as the case may be) by such person be an offence under this Part of this Act.

Protection of eggs of game birds.

12.—(1) It shall not be lawful for any person to take, destroy, or injure the eggs of any game bird or to destroy, remove or mutilate the nest of any such bird and every person who acts in contravention of this section shall be guilty of an offence under this Part of this Act and shall be punishable accordingly.

(2) Notwithstanding anything contained in the foregoing sub-section, the taking of the eggs of pheasants or partridges solely for the purpose of having the same properly hatched out shall not be a contravention of this section.

Marking of packages containing game.

13.—(1) Every package containing game of any kind in course of transit in Saorstát Eireann shall be marked conspicuously on the outside with the word “game” and shall also have marked thereon or on a label affixed thereto the name and address of the consignor thereof.

[GA]

(2) Every person who shall send or consign for transit in Saorstát Eireann any package containing game of any kind which is not marked in the manner required by this section shall be guilty of an offence under this section.

[GA]

(3) Every person who shall carry for reward by land in Saorstát Eireann or by sea from any port in Saorstát Eireann any package containing game of any kind which is not marked in the manner required by this section shall be guilty of an offence under this section unless he proves that he did not know and could not reasonably have known that such package contained game.

[GA]

(4) Every person guilty of an offence under this section shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty-five pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.

(5) For the purpose of this section a package shall be deemed to be in course of transit in Saorstát Eireann when the same is being carried by any means whatsoever from any premises or place in Saorstát Eireann to any other premises or place within or outside Saorstát Eireann or is in any place, public or private, in the course of or for the purpose of such carriage.

Recognition of coursing clubs.

14.—(1) The Minister may by order declare any coursing club which is affiliated to the organisation commonly called and known as the Irish Coursing Club to be a recognised coursing club for the purposes of this Part of this Act.

[GA]

(2) The Minister may at any time at his absolute discretion by order revoke any order previously made by him under the foregoing sub-section.

[GA]

(3) So long as an order made under the first sub-section of this section continues in force, the coursing club to which such order relates shall be a recognised coursing club within the meaning of this Part of this Act.

[GA]

Recognition of game preservation societies.

15.—(1) The Minister may by order declare any society association, or club formed for the promotion of the preservation of game or for the promotion or improvement of the breeding or training of dogs used in the pursuit of game to be a recognised association for the purposes of this section and may at any time at his absolute discretion revoke any such order previously made by him.

(2) Where any lands have, with the consent of the occupier thereof (given in writing), been reserved by a recognised association for the purpose of killing, taking, or preserving game thereon and notice of such reservation has been published on two separate occasions in a newspaper circulating in the district in which such lands are situate, then and in every such case any prosecution in the District Court in respect of trespass on such lands for the purpose or in the course of the pursuit of game may be instituted at the suit and in the name of the secretary of such recognised association, and it shall not be a defence to any such prosecution (whether instituted in the name of such secretary or in the name of some other person) or to any prosecution for an offence under, this Part of this Act in relation to the killing or taking of game on such lands for the defendant to prove that he was authorised by the occupier of such lands to kill or take game thereon.

(3) In the foregoing sub-section of this section the expression “recognised association” means a society, association, or club in respect of which an order under this section declaring it to be a recognised association for the purposes of this section is for the time being in force.

Trespass in pursuit of game.

16.—Section 10 of the Act of the Parliament of Ireland passed in the year 1787 and entitled “An Act for the preservation of the game” (27 Geo. III ch. 35) is hereby amended by the insertion of the words “rabbits, plover” therein immediately before the word “woodcock” now contained therein, and the said section shall have effect as so amended.

Penalties.

17.—(1) Every person who is guilty of an offence under this Part of this Act shall be liable on summary conviction thereof in the case of a first offence, to a fine not exceeding twenty pounds or, in the case of a second or any subsequent offence whether of the same character as or of a different character from the previous offence or offences, to a fine not exceeding fifty pounds or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine and such imprisonment.

(2) The Justice of the District Court before whom any person is convicted of an offence under this Part of this Act may, in addition to any fine imposed by him under the foregoing sub-section in respect of such offence, make an order directing the forfeiture by such person of any firearm, trap, snare, net or other instrument, engine or contrivance used by such person in the commission of such offence.

(3) Where the person convicted of an offence under this Part of this Act is the holder of a firearm certificate granted to him under the Firearms Act, 1925 (No. 17 of 1925), the Justice of the District Court before whom he is so convicted may, in addition to any other punishment imposed under this section, revoke such firearm certificate and may also declare such person to be incapable of holding a firearm certificate for such period (not exceeding five years from the date of such conviction) as the Justice shall specify, and when such declaration is so made such, person shall be incapable of holding a firearm certificate during the period so specified.

Disposal of forfeited property.

18.—Every firearm, trap, snare, net or other instrument engine or contrivance forfeited under this Part of this Act shall unless the Commissioner of the Gárda Síochána authorises the same to be destroyed be disposed of by sale by the superintendent of the Gárda Síochána for the district in which the offence by which such forfeiture was incurred was committed and the amount realised by such sale shall be paid into or disposed for the benefit of the Exchequer by such superintendent in such manner as the Minister for Finance shall direct.

Prosecution of offences.

19.—(1) Proceedings for the prosecution of any offence under this Part of this Act may be instituted at the suit and in the name of any person, whether official or unofficial, as prosecutor.

[GA]

(2) Where any lands have with the consent of the occupier thereof (given in writing) been reserved by a recognised coursing club for the purpose of killing and taking hares thereon, and notice of such reservation has been published on two separate occasions in a newspaper circulating in the district in which such lands are situate, then and in every such case any prosecution in the District Court in respect of trespass on such lands for the purpose or in the course of the pursuit of hares may be instituted at the suit and in the name of the secretary for the time being of the organization commonly called and known as the Irish Coursing Club, and it shall not be a defence to any such prosecution (whether instituted in the name of the said secretary or in the name of some other person) or to any prosecution for an offence under this Part of this Act in relation to the killing or taking of hares on such lands for the defendant to prove that he was authorised by the occupier of such lands to kill or take hares thereon.

PART II.

Restrictions on the Sale and Purchase of Game.

[GA]

Prohibition of sale of game without licence.

20.—(1) No person shall sell, expose for sale or keep for sale any game without being duly licensed under this Act so to sell the same or at any place where he is not authorised by his licence to sell the same.

[GA]

(2) Any person who shall, after the expiration of two months from the commencement of this Act, sell, expose for sale or keep for sale any game in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty-five pounds or, at the discretion of the court, to imprisonment for any term not exceeding three months or to both such fine and such imprisonment.

(3) Any person who shall, after the expiration of two months from the commencement of this Act, buy any game from any person whom he knows or has reason to believe to be selling the same in contravention of this section shall be guilty of an offence under this sub-section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.

(4) This section shall not apply to the holder of a firearm certificate the excise duty on which is two pounds selling game either lawfully killed by himself on his own land or land over which he had the right of shooting game or on any such land with his permission by another holder of a firearm certificate the excise duty on which is two pounds, nor shall this section prohibit the disposal by sale or otherwise of hares killed at coursing matches.

Issue of game dealers' licences.

21.—(1) A Justice of the District Court upon an application being made to him by any person and upon payment by such person of the fee required by law may, subject to the provisions of this section, issue to such person a licence (in this Act referred to as a game dealer's licence) for the sale of game at such place or places within the district of such Justice as shall be specified by the applicant and may, in like manner and subject as aforesaid, from time to time renew any such licence issued by him unless the same has been terminated under this Act.

(2) Every application for the issue or renewal of a game dealer's licence shall be made in writing and shall be in the prescribed form and contain the prescribed particulars, and, in the case of an application for a renewal of a licence, shall be made within fourteen days before or within one month after the expiration of the licence or the last renewal thereof, as the case may be.

[GA]

(3) Before granting a game dealer's licence under this section the Justice shall be satisfied that:—

(a) the applicant for such licence is a fit and proper person to receive and hold such licence, and

[GA]

(b) the premises in which such applicant proposes to carry on the business of selling game are suitable for the carrying on of such business, and

[GA]

(c) having regard to the nature of the business heretofore carried on by such applicant, such applicant reasonably requires such licence.

[GA]

Form, effect and duration of game dealers' licences.

22.—(1) Every game dealer's licence and every renewal of any such licence shall be in the prescribed form and while the same remains in force shall operate to authorise the person named in the licence to sell game and to expose and keep game for sale at the place or places specified in such licence.

[GA]

(2) Every game dealer's licence shall terminate on the death of the holder thereof or on revocation under this Act by a Justice of the District Court and may be terminated by surrender by the holder thereof.

[GA]

(3) Every game dealer's licence shall (unless it is previously terminated) continue in force for one year only from the date on which it was issued, and every renewal of any such licence shall (unless it is previously terminated) continue in force for one year only from the date on which such licence or the next previous renewal thereof (as the case may be) expired.

[GA]

Revocation of game dealer's licences.

23.—(1) Upon the conviction for an offence under this Act of the holder of a game dealer's licence, the Justice of the District Court before whom, such holder is so convicted may revoke such licence and such revocation shall be in addition to any other punishment imposed by such Justice under this Act in respect of such offence.

(2) Where the holder of a game dealer's licence who has been convicted of an offence under this Act is, within a period of three years from the date of such conviction, again convicted of an offence under this Act (whether of the same or of a different character) the Justice of the District Court before whom such holder is so again convicted may, if he revokes such licence under this section, also declare such holder to be incapable of holding a game dealer's licence during such period not exceeding five years as the Justice shall specify, and when such declaration is so made such holder shall be incapable of holding a game dealer's licence during the period so specified.

Publication of game dealers' licences.

24.—(1) Every holder of a game dealer's licence shall keep such licence or the last renewal thereof (as the case may require) displayed prominently in the place or one of the places to which such licence relates during business hours and, when such licence relates to more than one place, shall keep a copy of such licence or renewal so displayed in all such places other than the place in which such licence or renewal is so displayed.

(2) Every holder of a game dealer's licence who fails to keep such licence or the last renewal thereof or a copy of such licence or renewal (as the case may require) displayed in accordance with this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.

[GA]

(3) Lists of persons holding game dealer's licences shall be published at such times and places and in such manner and form as the Minister shall from time to time direct.

[GA]

Register to be kept by holder of game dealers' licence.

25.—(1) It shall be the duty of every holder of a game dealer's licence to keep or cause to be kept in every of the premises specified in such licence a register in the prescribed form of all purchases and receipts of game at or for sale on such premises and of all sales, disposals, and removals of game made on or from such premises and within six hours after any such purchase or receipt and within three hours after any such sale, disposal, or removal to enter in such register the prescribed particulars of such purchase, receipt, sale, disposal, or removal (as the case may be) and of the person from whom the same was purchased or received or to whom the same was sold or disposed of or the place to which the same was removed (as the case may require).

(2) The prescribed particulars referred to in the foregoing sub-section shall not include the price paid by the holder of the licence or renewal for any game purchased, received or sold by him but shall include, in the case of game purchased or received from a person who is the holder of a firearm certificate the excise duty in respect of which is two pounds and is not the holder of a game dealer's licence, the number of such firearm certificate.

(3) Every register kept in pursuance of this section may at any time during which the premises to which the register relates are open for the carrying on of business be inspected by any person authorised in that behalf by the Minister or by any member of the Gárda Síochána, and it shall be the duty of the holder of the game dealer's licence in respect of such premises and of every person keeping such register to produce for the inspection of such authorised person or member as aforesaid on demand such register and also all invoices, consignment notes, receipts, or other documents (including copies thereof where the originals are not available) reasonably demanded by such person or member for the purpose of verifying any entry in or explaining any omission from such register.

(4) If any holder of a game dealer's licence—

[GA]

(a) fails to keep or cause to be kept such register as is required by this section, or

[GA]

(b) fails to make or cause to be made in such register within the time hereinbefore mentioned any entry required by this section to be made therein, or

[GA]

(c) fails to produce or cause to be produced on the demand of any person entitled under this section to inspect the same, any register, document, or copy of a document which he is required by this section so to produce, or obstructs any person entitled under this section to inspect any register, document, or copy of a document in the making of such inspection, or

[GA]

(d) wilfully or negligently makes or causes to be made in such register any entry which is false or misleading in any material particular,

[GA]

he shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a fine not exceeding ten pounds and, in the case of a second or any subsequent offence, to a fine not exceeding twenty-five pounds.

[GA]

(5) For the purposes of this section—

[GA]

(a) inspection of a register or document shall include taking copies thereof or extracts therefrom, and

[GA]

(b) a demand for inspection of a register or other document shall be deemed to have been duly made to the holder of a game dealer's licence if such demand is made verbally on the premises to which such licence relates to a person in the employment of such licence holder, and

[GA]

(c) a refusal or failure to produce a register or other document for inspection if made or committed on premises to which, a game dealer's licence relates by a person in the employment of the holder of such licence shall be deemed to have been made or committed by such licence holder.

[GA]

Purchase of game from unlicensed persons.

26.—(1) Every person who shall, after the expiration of two months from the commencement of this Act, purchase any game from any person who is neither the holder of a game dealer's licence nor the holder of a firearm certificate the excise duty in respect of which is two pounds, shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.

(2) This section shall not apply to a responsible officer of a recognised coursing club purchasing hares under an authority in that behalf conferred by this Act.

[GA]

Prohibition against exportation of certain game birds.

27.—(1) It shall not be lawful for any person, save with the permission in writing of the superintendent of the Gárda Síochána for the district in which such person resides and in accordance with the terms of such permission, to export any partridge, pheasant or grouse during the period of two years from and after the commencement of this Act or during any extension of that period made by the Minister under this section.

(2) The Minister may if he so thinks fit at any time and from time to time by order extend by such time as he thinks proper the said period of two years mentioned in the foregoing sub-section and may at any time by order vary, amend or revoke any such order.

[GA]

(3) Every order made by the Minister under this section extending the said period of two years shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which such House has sat after the order is laid before it annulling such order such order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.

(4) Every permission given under this section for the exporting of any partridge, pheasant, or grouse shall be in writing in the prescribed form and shall be given in duplicate and one such duplicate shall be retained by the exporter and the other such duplicate shall be affixed by the exporter to the box, case, or wrapping in which the partridge, pheasant or grouse the subject of such permission is exported.

(5) Any officer of Customs and Excise may detain and seize any partridge, grouse or pheasant being or attempted to be exported in contravention of this section and for that purpose may open any packet containing or suspected by him of containing any such partridge, grouse or pheasant, and the provisions of the Customs Consolidation Act, 1876, in relation to the condemnation and disposal of goods seized under that Act shall apply to all partridges, grouse and pheasants seized under this Act in like manner as if they had been seized under that Act.

(6) This section shall have effect as though it were included in the Customs Consolidation Act, 1876, and that Act and any Act amending or extending that Act shall apply accordingly, and if any articles the export of which is prohibited by this section are exported in contravention of this section or are brought to any quay or other place for the purpose of being so exported or are waterborne to be so exported, the exporter or his agent shall be liable to the same penalty as that to which a person is liable under section 186 of that Act for illegally importing prohibited goods.

(7) Any officer of the Minister for Posts and Telegraphs may detain and examine and if necessary open for that purpose any postal packet addressed to a place outside Saorstát Eireann and containing or suspected by him of containing any partridge, grouse or pheasant being or attempted to be exported in contravention of this section, and if a postal packet so detained contains any such partridge, grouse or pheasant, the officers of the said Minister shall dispose of such packet and its contents in accordance with the instructions of the Minister for Justice or a superintendent of the Gárda Síochána.

PART III.

Miscellaneous and General.

[GA]

Prohibition against burning of gorse, etc.

28.—(1) It shall not be lawful for any person save with the permission in writing of the superintendent of the Gárda Síochána for the district to burn or otherwise destroy between the 1st day of April and the 14th day of July (both days inclusive) in any year any gorse, furze, whin, heath, fern or greg-ling growing on any lands not then cultivated or in course of cultivation.

(2) Nothing in this section shall be construed as applying to or rendering unlawful the cutting or grubbing of isolated bushes or clumps of gorse, furze, or whin in the ordinary course of good husbandry or the mowing of any fern in the like course of good husbandry.

[GA]

(3) Any person who burns or otherwise destroys any gorse, furze, whin, heath, fern or greg-ling in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.

[GA]

Powers of inspection, examination and detention.

29.—(1) Any member of the Gárda Síochána and also any person authorised by the Minister to exercise the powers conferred by this section is hereby authorised and empowered to do all or any of the following things, that is to say:—

(a) to stop and search any person conveying or believed to be conveying game of any kind and to inspect any game which such person is found to be conveying and for that purpose to open and search any vehicle or package in which such game is or may be or is believed to be conveyed and to enter on any land for the purpose of doing all or any of the things mentioned in this paragraph;

[GA]

(b) at all reasonable times to enter upon and have free access to the interior of—

[GA]

(i) any premises in which game is or is believed to be sold, or kept, exposed, or stored for sale, or

[GA]

(ii) the premises of any person engaged in the business of carrying goods for reward, or

[GA]

(iii) any pier, quay, wharf, jetty, dock or dock premises, or

[GA]

(iv) any ship, boat, railway waggon, motor lorry, cart, or other vessel or vehicle used for the conveyance of goods;

[GA]

(c) to examine all game found in any place which he is authorised by the next foregoing paragraph of this section to enter and for that purpose to open any package found in such place and containing or believed to contain game;

[GA]

(d) to stop, enter and search on any river, lake or estuary, or the shores thereof or any part of the sea or the shores thereof any boat, punt, corach, or other vessel used or believed to be used for the purpose of killing or taking game or containing or suspected of containing any game illegally killed or taken and to examine all game found therein and for that purpose to open any package which contains or is suspected of containing any such game as aforesaid;

(e) to take, remove, and detain in his custody any game (either together with or without any package in which the same may be contained) found in the course of the exercise of any of the powers conferred by this section in respect of which an offence under this Act is being or is suspected of being committed or which has been or is suspected of having been illegally killed or taken;

[GA]

(f) to take, remove, and detain in his custody any trap, snare, net or other instrument used in taking game which is liable or is believed to be liable to forfeiture under this Act;

[GA]

(g) to demand and take the name and address of the person having custody of any game or other article which he is authorised under this section to examine and also to demand and take from such person the name and address of the owner of such game or other article.

[GA]

(2) Where any person detains in his custody under the authority of this section any game or other article he shall as soon as conveniently may be take such steps as may be proper to have the person guilty or believed to be guilty of the offence committed or believed to have been committed in relation to such game or other article dealt with according to law.

[GA]

(3) Where any person detains in his custody under the authority of this section any dead game and such game is likely to become unfit for human food before the matter can be conveniently dealt with by any court, such person shall produce such game to a peace commissioner and, if authorised so to do by such peace commissioner, shall destroy such game.

[GA]

(4) A peace commissioner to whom any dead game is produced in pursuance of this section shall, if he is of opinion that the game ought in the circumstances to be destroyed, give to the person producing the game a certificate in writing describing the game and any marks, peculiarities, or other particulars thereof pointed out to him by such person and authorising such person to destroy the game, which certificate shall be conclusive evidence in every court of all such matters of fact as aforesaid stated therein.

(5) No person shall be liable for any loss or damage occasioned by or in the course of the exercise of any of the powers conferred on him by this section unless such loss or damage was caused by such person wantonly or maliciously.

[GA]

(6) Every person who shall obstruct or impede any person in the exercise of any of the powers conferred on him by this section or shall refuse to give his own name and address or the name and address of any other person (so far as the same is known to him) when lawfully demanded under this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.

Powers of holders of certain firearm certificates.

30.—Any holder of a firearm certificate the excise duty on which is two pounds may require any person whom he finds carrying a shotgun on lands other than those owned by such person to produce for the inspection of such holder and to permit such holder to inspect and read the firearm certificate authorising such person to carry such shotgun and if such person fails or refuses to produce such last-mentioned firearm certificate or fails or refuses to permit such holder to inspect and read such firearm certificate such person shall (unless he satisfies the court that the carrying by him of such shotgun without having a firearm certificate authorising him so to do was in the circumstances not unlawful) be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds.

Consultative Council.

31.—(1) The Minister may establish by order a Consultative Council for the purpose of giving advice and assistance to the Minister in connection with any matter in relation to the making of regulations under, or otherwise carrying into execution, the provisions of this Act, or any other matter affecting the preservation and propagation of game or any other matter affecting the game industry.

(2) The said Consultative Council, if and when appointed, shall consist of such persons (being persons having experience or special knowledge in relation to the matters on which the Council may give advice or assistance to the Minister) as the Minister shall from time to time nominate to be members thereof, and shall include representatives of both Houses of the Oireachtas and of the General Council of County Councils.

(3) Each member of the said Consultative Council shall, unless he previously dies or resigns, retain his membership for two years only from the date of his nomination, but shall be eligible for re-nomination.

[GA]

(4) The said Consultative Council shall meet whenever summoned by the Minister and also on such occasions as the Council may from time to time determine.

Regulations.

32.—The Minister may by order make regulations prescribing any matter or thing which is referred to in this Act as prescribed or to be prescribed.

Expenses.

33.—All expenses of carrying this Act into effect shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys to be provided by the Oireachtas.

Repeals.

34.—The enactments specified in the Second Schedule to this Act are hereby repealed to the extent mentioned in the third column of the said Schedule.
