ACHT UM IOMPAR AR BHÓITHRE, 1934.
Mínithe.
1.—(1) San Acht so—
cialluíonn an abairt “an Príomh-Acht” an tAcht um Iompar ar Bhóithre, 1933 (Uimh. 8 de 1933);
cialluíonn an abairt “ceadúnuithe go cuibhe” ceadúnuithe go cuibhe i Saorstát Éireann fé alt 13 den Finance Act, 1920, mar atá san leasuithe le hachtacháin ina dhiaidh sin.
(2) Gach focal agus abairt dá dtugann an Príomh-Acht brí áirithe chun crícheanna an Achta san tá leis san Acht so an bhrí tugtar do amhlaidh.
Iompar ar luach saothair.
2.—I gcás feithicle inneall-ghluaiste no feithicle ar n-a tarrac ag feithicil inneall-ghluaiste d'úsáid chun earraí ceannaíochta d'iompar is le húnaer na feithicle inneall-ghluaiste sin, ní tuigfear chun crícheanna an Phríomh-Achta na hearraí ceannaíochta san do bheith á n-iompar ar luach saothair.

3.—Tuigfear feithicil inneall-ghluaiste do bheith ina laraí do réir bhrí an Phríomh-Achta i gcás í do bheith do réir na gcoinníollacha so leanas, sé sin le rá:—
(a) í do bheith ina feithicil a bheidh déanta agus ceaptha chun paisnéirí d'iompar;
(b) í do bheith ina feithicil go n-ionaid suidhte do sheisear paisnéirí ar a mhéid (gan an tiománaí d'áireamh);
(c) í do bheith ina feithicil a bheidh á húsáid de thurus na huaire chun páipéirí nuachta d'iompar ar luach saothair.

5.—Athghairmtear leis seo an tAcht um Iompar ar Bhóithre (Uimh. 2), 1933 (Uimh. 39 de 1933), agus ina ionad san achtuítear leis seo go léireofar fo-alt (1) d'alt 3 den Phríomh-Acht agus go mbeidh éifeacht aige agus go dtuigfear éifeacht do bheith riamh aige fé is dá ndeintí na focail agus na figiúirí “an 1adh lá d'Abrán, 1934,” do chur isteach in ionad na bhfocal “mí tar éis dáta an Achta so do rith” atá anois sa bhfo-alt san.

6.—I gcás únaerachta gnótha iompair earraí ceannaíochta de bhóthar d'aistriú, roimh an lá ceaptha, o dhuine dar tugadh amach deimhniú fé alt 3 den Phríomh-Acht alos an ghnótha san, tuigfear, d'ainneoin éinní atá i bhfo-alt (3) den alt san 3, an duine chun a n-aistreofar an únaeracht san do bheith ina iomparthóir atá ann cheana chun crícheanna an Phríomh-Achta.
Ordú fé alt 5 den Phríomh-Acht do chur ar nea-mbrí.
7.—Dearbhuítear leis seo aon ordú do rinneadh roimh an Acht so do rith fé fho-alt (1) d'alt 5 den Phríomh-Acht do bheith, agus tuigfear é do bheith riamh, gan bhrí gan éifeacht, agus dá réir sin féadfar ordú do dhéanamh fén bhfo-alt san (1) tráth ar bith tar éis an Achta so do rith.
Tosach feidhme ceadúnaisí áirithe earraí ceannaíochta do chur siar.
8.—Gach ceadúnas earraí ceannaíochta do deonadh roimh an lá ceaptha agus adubhairt go dtosnódh an 1adh lá d'Fheabhra, 1934, tosnóidh, d'ainneoin éinní atá in alt 19 den Phríomh-Acht no sa cheadúnas san, ar an lá ceaptha agus leanfaidh i bhfeidhm (mara dtuitidh ar lár no mara gceiliúrtar é roimhe sin fén bPríomh-Acht agus fé réir aon chur-ar-fiunraoi fén Acht san) ar feadh bliana ón lá ceaptha agus raghaidh in éag ansan mara ndeintear é d'athnuachaint fén bPríomh-Acht.

9.—Deintear leis seo alt 9 den Phríomh-Acht do leasú sna slite seo leanas agus léireofar é agus beidh éifeacht aige dá réir sin, sé sin le rá:—
(a) tré sna focail “earraí ceannaíochta á n-iompar” do chur i bhfo-alt (2) den alt san in ionad na bhfocal “gnó iompair earraí ceannaíochta de bhóthar ar siúl” atá anois sa bhfo-alt san;
(b) tríd an bhfo-alt breise seo leanas do chur isteach i ndiaidh fo-ailt (3) den alt san, sé sin le rá:—
“(4) Má cruthuítear go ndearna duine earraí ceannaíochta d'iompar i bhfuirm iompair earraí ceannaíochta de bhóthar, tuigfear, chun crícheanna an ailt seo, an duine sin d'iompar na n-earraí ceannaíochta san amhlaidh i gcúrsa gnótha iompair earraí ceannaíochta de bhóthar a bhí ar siúl aige.”

10.—Deintear leis seo fo-alt (4) d'alt 12 den Phríomh-Acht do leasú tré sna focail “no cuideachta loingseoireachta” do chur isteach i ndiaidh na bhfocal “seachas cuideachta údaruithe chun earraí ceannaíochta d'iompar” atá anois ann, agus léireofar an fo-alt san agus beidh éifeacht aige dá réir sin.

11.—(1) Má dheineann duine ar bith—
(a) is ceadúnaí, fé cheadúnas earraí ceannaíochta iomparthóra atá ann cheana, dá bhfuil riail-mheáchaint laraí ceaptha, agus
(b) adeir gurb é is únaer laraí no laraithe ar bith do bhí do réir na gcoinníollacha oiriúnacha,
a iarraidh ar an Aire roimh an lá ceaptha ordú do thabhairt uaidh fén bhfo-alt so, féadfaidh an tAire, más deimhin leis bunús do bheith leis an méid adeir an ceadúnaí sin, a ordú an riailmheáchaint laraí don cheadúnaí sin do mhéadú pé meáchaint a cheapfa sé agus nách mó, i gcás gan an méid adeir an ceadúnaí sin do bhaint ach le haon laraí amháin, ná meáchaint an laraí sin gan ualach no nách mó, i gcás an méid adeir an ceadúnaí sin do bhaint le dhá laraí no níos mó, ná meáchaintí iomlána na laraithe sin gan ualach, agus, má bheirtear an t-ordú san amhlaidh, isé is riail-mheáchaint laraí don cheadúnaí sin chun crícheanna an Phríomh-Achta ná an chéad riail-mheáchaint laraí agus í méaduithe amhlaidh.

a iarraidh ar an Aire roimh an lá ceaptha ordú do thabhairt uaidh fén bhfo-alt so, féadfaidh an tAire, más deimhin leis bunús do bheith leis an méid adeir an ceadúnaí sin, a ordú an riail mheáchaint tarraicire don cheadúnaí sin do mhéadú pé meáchaint a cheapfa sé agus nách mó, i gcás gan an méid adeir an ceadúnaí sin do bhaint ach le haon tarraicire amháin, ná meáchaint an tarraicire sin gan ualach no nách mó, i gcás an méid adeir an ceadúnaí sin do bhaint le dhá tharraicire no níos mó, ná meáchaintí iomlána na dtarraicirí sin gan ualach, agus, má bheirtear an t-ordú san amhlaidh, isé is riail-mheáchaint tarraicire don cheadúnaí sin chun crícheanna an Phríomh-Achta ná an chéad riail-mhéachaint tarraicire agus í méaduithe amhlaidh.
(3) Má dheineann duine ar bith—
(a) is ceadúnaí, fé cheadúnas earraí ceannaíochta iomparthóra atá ann cheana, ná fuil aon riail-mheáchaint laraí ceaptha dho, agus
(b) adeir gurb é is únaer laraí no laraithe ar bith do bhí do réir na gcoinníollacha oiriúnacha,
a iarraidh ar an Aire roimh an lá ceaptha ordú do thabhairt uaidh fén bhfo-alt so, féadfaidh an tAire, más deimhin leis bunús do bheith leis an méid adeir an ceadúnaí sin, a ordú gurb é is riailmheáchaint laraí don cheadúnaí sin chun crícheanna an Phríomh-Achta ná pé meáchaint a cheapfa sé agus nách mó, i gcás gan an méid adeir an ceadúnaí sin do bhaint ach le haon laraí amháin, ná meáchaint an laraí sin gan ualach no nách mó, i gcás an méid adeir an ceadúnaí sin do bhaint le dhá laraí no níos mó, ná meáchaintí iomlána na laraithe sin gan ualach, agus, má bheirtear an t-ordú san amhlaidh, isé an mheáchaint a ceapfar amhlaidh is riail-mheáchaint laraí don cheadúnaí sin chun crícheanna an Phríomh-Achta.

(b) adeir gurb é is únaer tarraicire no tarraicirí ar bith do bhí do réir na gcoinníollacha oiriúnacha,
a iarraidh ar an Aire roimh an lá ceaptha ordú do thabhairt uaidh fén bhfo-alt so, féadfaidh an tAire, más deimhin leis bunús do bheith leis an méid adeir an ceadúnaí sin, a ordú gurb é is riailmheáchaint tarraicire don cheadúnaí sin chun crícheanna an Phríomh-Achta ná pé meáchaint a cheapfa sé agus nách mó, i gcás gan an méid adeir an ceadúnaí sin do bhaint ach le haon tarraicire amháin, ná meáchaint an tarraicire sin gan ualach no nách mó, i gcás an méid adeir an ceadúnaí sin do bhaint le dhá tharraicire no níos mó, ná meáchaintí iomlána na dtarraicirí sin gan ualach, agus, má bheirtear an t-ordú san amhlaidh, isé an mheáchaint a ceapfar amhlaidh is riail-mheáchaint tarraicire don cheadúnaí sin chun crícheanna an Phríomh-Achta.
(5) Pé uair a dhéanfaidh duine ar bith—
(a) is ceadúnaí, fé cheadúnas earraí ceannaíochta iomparthóra atá ann cheana, dá bhfuil riail-mheáchaint laraí ceaptha, agus
(b) adeir—
(i) go bhfuil laraí ar bith (dá ngairmtear an seanalaraí sa bhfo-alt so), go ndearnadh a mheáchaint gan ualach do chur san áireamh nuair do bhí an riail-mheáchaint laraí sin á cinneadh, gan bheith ion-úsáidthe a thuilleadh agus go bhfuiltear tar éis laraí eile (dá ngairmtear an laraí nua sa bhfo-alt so) do chur ina ionad gur mó a mheáchaint gan ualach ná meáchaint an tseana-laraí gan ualach, agus
(ii) go ndearnadh an pláta feithicle (má b'aon cheann é) do tugadh amach alos an tseana-laraí do thabhairt suas ag an stáisiún chun plátaí feithicle do thabhairt amach ag ár tugadh amach é,
a iarraidh ar an Aire ordú do thabhairt uaidh fén bhfo-alt so, féadfaidh an tAire, más deimhin leis bunús do bheith leis an méid adeir an ceadúnaí sin agus gur mar a chéile nách mór acfuinn iompair an laraí nua agus acfuinn iompair an tseana-laraí, a ordú an riail-mheáchaint laraí don cheadúnaí sin do mhéadú meáchaint is có-ionann leis an deifríocht idir meáchaint an laraí nua gan ualach agus meáchaint an tseana-laraí gan ualach, agus, má bheirtear an t-ordú san, isí is riail-mheáchaint laraí don cheadúnaí sin chun crícheanna an Phríomh-Achta ná an chéad riailmheáchaint laraí agus í méaduithe amhlaidh.
(6) Pé uair a dhéanfaidh duine ar bith—
(a) is ceadúnaí, fé cheadúnas earraí ceannaíochta iomparthóra atá ann cheana, dá bhfuil riail-mheáchaint tarraicire ceaptha, agus
(b) adeir—
(i) go bhfuil tarraicire ar bith (dá ngairmtear an seanatharraicire sa bhfo-alt so), go ndearnadh a mheáchaint gan ualach do chur san áireamh nuair do bhí an riail-mheáchaint tarraicire sin á cinneadh, gan bheith ion-úsáidthe a thuilleadh agus go bhfuiltear tar éis tarraicire eile (dá ngairmtear an tarraicire nua sa bhfo-alt so) do chur ina ionad gur mó a mheáchaint gan ualach ná meáchaint an tseana-tharraicire gan ualach, agus
(ii) go ndearnadh an pláta feithicle (má b'aon cheann é) do tugadh amach alos an tseana-tharraicire do thabhairt suas ag an stáisiún chun plátaí feithicle do thabhairt amach ag ár tugadh amach é,
a iarraidh ar an Aire ordú do thabhairt uaidh fén bhfo-alt so, féadfaidh an tAire, más deimhin leis bunús do bheith leis an méid adeir an ceadúnaí sin agus gur mar a chéile nách mór acfuinn tarraiceoireachta an tarraicire nua agus acfuinn tarraiceoireachta an tseana-tharraicire, a ordú an riail-mheáchaint tarraicire don cheadúnaí sin do mhéadú meáchaint is có-ionann leis an deifríocht idir meáchaint an tarraicire nua gan ualach agus meáchaint an tseana-tharraicire gan ualach, agus, má bheirtear an t-ordú san, isí is riail-mheáchaint tarraicire don cheadúnaí sin chun crícheanna an Phríomh-Achta ná an chéad riailmheáchaint tarraicire agus í méaduithe amhlaidh.
(7) Tuigfear feithicil inneall-ghluaiste, is laraí no tarraicire agus is le ceadúnaí fé cheadúnas earraí ceannaíochta iomparthóra atá ann cheana, tuigfear chun crícheanna an ailt seo san do bheith do réir na gcoinníollacha oiriúnacha má bhíonn an fheithicil sin—
(a) do réir na gcoinníollacha uile seo leanas, sé sin le rá:—
(i) gurbh fheithicil í ba leis an gceadúnaí sin an dáta cinnteach do luadhadh san iarratas ar an gceadúnas san, agus
(ii) gurbh fheithicil í ná raibh ceadúnuithe go cuibhe an dáta san, agus
(iii) gurbh fheithicil í a bhí ceadúnuithe go cuibhe tráth ar bith i rith an dá mhí dhéag chalendair dar chríoch an 1adh lá d'Iúl, 1932; no
(b) do réir na gcoinníollacha so leanas, eadhon—
(i) gurbh fheithicil í do horduíodh roimh an Sadh lá d'Fheabhra, 1933, agus
(ii) gurbh fheithicil í do seachadadh don cheadúnaí roimh an 12adh lá de Mheitheamh, 1933.
(8) Beidh gach iarratas fé aon fho-alt den alt so i scríbhinn, agus luadhfar ann go hiomlán na scóranna is foras don iarratas, agus bhéarfar ann mion-innste iomlána i dtaobh na bhfeithiclí inneall-ghluaiste le n-a mbaineann an t-iarratas, agus beidh ina theanta na leabhair chlárathachta bhaineann leis na feithiclí sin.
(9) Gach duine dhéanfaidh iarratas fé aon fho-alt den alt so déanfaidh, ar an Aire dá cheangal san air, gach eolas breise do thabhairt don Aire theastóidh ón Aire chun an iarratais sin do bhreithniú.
(10) Féadfaidh an tAire a chur mar cheangal, maidir le haon ráiteas fíre cuirfear in aon iarratas fé aon fho-alt den alt so no cuirfear mar fhreagra chun an Aire ar eisean d'iarraidh eolais bhreise fén bhfo-alt deiridh sin roimhe seo, go bhfíorófar an ráiteas san le dearbhú reachtúil o dhuine éigin go n-eolas pearsanta ar an bhfíor a bheidh ann.
(11) Pé uair do bhéarfaidh an tAire ordú uaidh fén alt so ar n-a iarraidh san don duine is ceadúnaí fé cheadúnas earraí ceannaíochta iomparthóra atá ann cheana, déanfaidh an tAire pé leasuithe ar an gceadúnas san is gá chun éifeachta do thabhairt don ordú san.
Táillí ar iarrataisí ar phlátaí feithicle do thabhairt amach.
12.—Féadfar, le rialacháin ar n-a ndéanamh fé fho-alt (6) d'alt 30 den Phríomh-Acht, táillí deifriúla d'ordú alos—
(a) iarrataisí ar phlátaí feithicle fén alt san 30 i gcásanna 'na mbeidh a gcúrsaí do réir na gcoinníollacha so leanas, sé sin le rá:—
(i) feithicil gur tugadh amach pláta feithicle ina taobh do scur de bheith ceadúnuithe go cuibhe, agus
(ii) an pláta feithicle sin do sheachadadh, ar an scur san, do bhall den Ghárda Síochána ag an stáisiún chun plátaí feithicle do thabhairt amach ag ár tugadh amach an pláta feithicle sin, agus
(iii) a iarraidh go cuibhe fé alt 30 den Phríomh-Acht laistigh de naoi mí tar éis an tseachadtha san pláta feithicle do thabhairt amach alos na feithicle sin; agus
(b) iarrataisí ar phlátaí feithicle fén alt san 30 i gcásanna ná beidh a gcúrsaí do réir na gcoinníollacha san.

13.—Deintear leis seo fo-alt (1) d'alt 38 den Phríomh-Acht do leasú tré sna focail “tar éis dáta thosnuithe an cheadúnais sin díreach i ndiaidh an deonta san no tar éis an aistrithe sin” do chur in ionad na bhfocal “tar éis an deonta no an aistrithe sin” atá anois ann, agus léireofar an fo-alt san agus beidh éifeacht aige dá réir sin.

14.—Ní ceaduithe aon iarratas do chur chun an Aire fé fho-alt (1) d'alt 51 den Phríomh-Acht i rith na tréimhse de dhá bhliain a thosnóidh i gcionn bliana ón lá ceapfar, le hordú ar n-a dhéanamh tar éis an Achta so do rith fé fho-alt (1) d'alt 5 den Phríomh-Acht, chun bheith mar lá ceaptha chun crícheanna an Achta san.

ROAD TRANSPORT ACT, 1934.
Definitions.
1.—(1) In this Act—
the expression “the Principal Act” means the Road Transport Act, 1933 (No. 8 of 1933);
the expression “duly licensed” means duly licensed in Saorstát Eireann under section 13 of the Finance Act, 1920, as amended by subsequent enactments.
(2) Every word and expression to which a particular meaning is given by the Principal Act for the purposes of that Act has in this Act the meaning so given to it.
Carriage for reward.
2.—Where a mechanically propelled vehicle or a vehicle drawn by a mechanically propelled vehicle is used for the carriage of merchandise the property of the owner of such mechanically propelled vehicle, such merchandise shall not be deemed for the purposes of the Principal Act to be carried for reward.
“Lorry.”
3.—A mechanically propelled vehicle shall be deemed to be a lorry within the meaning of the Principal Act, where the following conditions are complied with, that is to say:—
(a) such vehicle is constructed and designed for the carriage of passengers;
(b) such vehicle has sitting accommodation for not more than six passengers (excluding the driver);
(c) such vehicle is for the time being used for the carriage of newspapers for reward.
“Registration Book.”
4.—The definition of the expression “registration book”contained in section 2 of the Principal Act is hereby amended by the insertion therein of the words “or a copy of the registration particulars of such vehicle issued by the authority by which such vehicle was licensed under the Roads Act, 1920”after the words “the Roads Act, 1920” and the Principal Act and this Act shall be construed and have effect with due regard to the extension of the said expression effected by said amendment.
Amendment of section 3 of the Principal Act.
5.—The Road Transport (No. 2) Act, 1933 (No. 39 of 1933), is hereby repealed and in lieu thereof it is hereby enacted that sub-section (1) of section 3 of the Principal Act shall be construed and have effect and be deemed always to have had effect as if for the words “one month after the passing of this Act” now contained therein there were inserted the words and figures “the 1st day of April, 1934”.
Existing carriers.
6.—Where the ownership of a merchandise road transport business is before the appointed day transferred from a person to whom a certificate under section 3 of the Principal Act has been issued in respect of such business, the person to whom such ownership is transferred shall, notwithstanding anything in sub-section (3) of the said section 3, be deemed to be an existing carrier for the purposes of the Principal Act.
Avoidance of order under section 5 of the Principal Act.
7.—Any order made before the passing of this Act under sub-section (1) of section 5 of the Principal Act is hereby declared to be and shall be deemed always to have been void and of no effect, and accordingly an order may be made under the said sub-section (1) at any time after the passing of this Act.
Postponement of commencement of certain merchandise licences.
8.—Every merchandise licence granted before the appointed day and expressed to commence on the 1st day of February, 1934, shall, notwithstanding anything contained in section 19 of the Principal Act, or in such licence, commence on the appointed day and shall (unless it previously lapses or is revoked under the Principal Act and subject to any suspension under that Act) continue in force for a period of twelve months from the appointed day and shall then expire unless it is renewed under the Principal Act.
Amendment of section 9 of the Principal Act.
9.—Section 9 of the Principal Act is hereby amended in the following respects and shall be construed and have effect accordingly, that is to say:—
(a) by the substitution in sub-section (2) of the said section of the word “merchandise” for the words “on a merchandise road transport business” now contained therein;
(b) by the insertion after sub-section (3) of the said section of the following additional sub-section, that is to say:—
“(4) Where a person is proved to have carried merchandise by way of merchandise road transport, such person shall for the purposes of this section be deemed to have so carried such merchandise in the course of a merchandise road transport business carried on by him.”
Amendment of section 12 of the Principal Act.
10.—Sub-section (4) of section 12 of the Principal Act is hereby amended by the insertion of the words “or a shipping company”after the words “other than an authorised (merchandise carrying) company” now contained therein, and the said sub-section shall be construed and have effect accordingly.
Variation of standard lorry weights and standard tractor weights.
11.—(1) Where any person—
(a) who is the licensee under a merchandise (existing carrier's) licence for whom there is a standard lorry weight, and
(b) who claims that he is the owner of any lorry or lorries which complied with the appropriate conditions,
applies to the Minister before the appointed day for a direction under this sub-section, the Minister may, if he is satisfied that such claim is well founded, direct that the standard lorry weight for such licensee shall be increased by such weight, not exceeding, in case such claim relates to one lorry only, the unladen weight of such lorry or, in case such claim relates to two or more lorries, the total unladen weights of such lorries, as he may fix, and, if such direction is so given, the standard lorry weight for such licensee for the purposes of the Principal Act shall be the original standard lorry weight as so increased.
(2) Where any person—
(a) who is the licensee under a merchandise (existing carrier's) licence for whom there is a standard tractor weight, and
(b) who claims that he is the owner of any tractor or tractors which complied with the appropriate conditions,
applies to the Minister before the appointed day for a direction under this sub-section, the Minister may, if he is satisfied that such claim is well founded, direct that the standard tractor weight for such licensee shall be increased by such weight, not exceeding, in case such claim relates to one tractor only, the unladen weight of such tractor or, in case such claim relates to two or more tractors, the total unladen weights of such tractors, as he may fix, and, if such direction is so given, the standard tractor weight for such licensee for the purposes of the Principal Act shall be the original standard tractor weight as so increased.
(3) Where any person—
(a) who is the licensee under a merchandise (existing carrier's) licence for whom there is no standard lorry weight, and
(b) who claims that he is the owner of any lorry or lorries which complied with the appropriate conditions,
applies to the Minister before the appointed day for a direction under this sub-section, the Minister may, if he is satisfied that such claim is well founded, direct that the standard lorry weight for such licensee for the purposes of the Principal Act shall be such weight, not exceeding, in case such claim relates to one lorry only, the unladen weight of such lorry or, in case such claim relates to two or more lorries, the total unladen weights of such lorries, as he may fix, and, if such direction is so given, the weight so fixed shall for the purposes of the Principal Act be the standard lorry weight for such licensee.
(4) Where any person—
(a) who is the licensee under a merchandise (existing carrier's) licence for whom there is no standard tractor weight, and
(b) who claims that he is the owner of any tractor or tractors which complied with the appropriate conditions,
applies to the Minister before the appointed day for a direction under this sub-section, the Minister may, if he is satisfied that such claim is well founded, direct that the standard tractor weight for such licensee for the purposes of the Principal Act shall be such weight, not exceeding, in case such claim relates to one tractor only, the unladen weight of such tractor or, in case such claim relates to two or more tractors, the total unladen weights of such tractors, as he may fix, and, if such direction is so given, the weight so fixed shall for the purposes of the Principal Act be the standard tractor weight for such licensee.
(5) Whenever any person—
(a) who is the licensee under a merchandise (existing carrier's) licence for whom there is a standard lorry weight, and
(b) who claims that—
(i) any lorry (in this sub-section referred to as the old lorry), the unladen weight of which was taken into account in determining such standard lorry weight, has become unserviceable and has been replaced by another lorry (in this sub-section referred to as the new lorry) the unladen weight of which exceeds the unladen weight of the old lorry, and
(ii) the vehicle plate (if any) issued in respect of the old lorry has been surrendered at the vehicle plate issuing station at which it was issued,
applies to the Minister for a direction under this sub-section, the Minister may, if he is satisfied that such claim is well founded and that the carrying capacity of the new lorry is substantially the same as that of the old lorry, direct that the standard lorry weight for such licensee shall be increased by a weight equal to the difference between the unladen weight of the new lorry and the unladen weight of the old lorry, and, if such direction is given the standard lorry weight for such licensee for the purposes of the Principal Act shall be the original standard lorry weight as so increased.
(6) Whenever any person—
(a) who is the licensee under a merchandise (existing carrier's) licence for whom there is a standard tractor weight, and
(b) who claims that—
(i) any tractor (in this sub-section referred to as the old tractor), the unladen weight of which was taken into account in determining such standard tractor weight, has become unserviceable and has been replaced by another tractor (in this sub-section referred to as the new tractor) the unladen weight of which exceeds the unladen weight of the old tractor, and
(ii) the vehicle plate (if any) issued in respect of the old tractor has been surrendered at the vehicle plate issuing station at which it was issued,
applies to the Minister for a direction under this sub-section, the Minister may, if he is satisfied that such claim is well founded and that the tractive capacity of the new tractor is substantially the same as that of the old tractor, direct that the standard tractor weight for such licensee shall be increased by a weight equal to the difference between the unladen weight of the new tractor and the unladen weight of the old tractor, and if such direction is given the standard tractor weight for such licensee for the purposes of the Principal Act shall be the original standard tractor weight as so increased.
(7) A mechanically propelled vehicle, being a lorry or a tractor, the property of a licensee under a merchandise (existing carrier's) licence shall be deemed for the purposes of this section to comply with the appropriate conditions if such vehicle either—
(a) complies with all the following conditions, that is to say:—
(i) was the property of such licensee on the critical date specified in the application for such licence, and
(ii) was not duly licensed on that date, and
(iii) was duly licensed at any time during the twelve calendar months ending on the 1st day of July, 1932; or
(b) complies with the following conditions, namely—
(i) was ordered before the 8th day of February, 1933, and
(ii) was delivered to the licensee before the 12th day of June, 1933.
(8) Every application under any sub-section of this section shall be in writing, shall state fully the grounds on which the application is based, and shall give full particulars of the mechanically propelled vehicles to which the application relates, and shall be accompanied by the registration books relating to such vehicles.
(9) Every person who makes an application under any sub-section of this section shall, when required by the Minister so to do, furnish to the Minister all such further information as the Minister may require for the consideration of such application.
(10) The Minister may require any statement of fact made in any application under any sub-section of this section or made to the Minister in response to a request for further information under the immediately preceding sub-section to be verified by the statutory declaration of some person having personal knowledge of the fact so stated.
(11) Whenever the Minister gives a direction under this section on the application of the licensee under a merchandise (existing carrier's) licence, the Minister shall make such amendments in such licence as may be necessary to give effect to such direction.
Fees on application for issue of vehicle plates.
12.—Regulations made under sub-section (6) of section 30 of the Principal Act may prescribe different fees in respect of—
(a) applications for vehicle plates under the said section 30 in cases where the following conditions are complied with, that is to say:—
(i) a vehicle in respect of which a vehicle plate has been issued ceases to be duly licensed, and
(ii) such vehicle plate is on such cesser delivered to a member of the Gárda Síochána at the plate issuing station at which such vehicle plate was issued, and
(iii) an application is duly made under section 30 of the Principal Act within nine months after such delivery for the issue of a vehicle plate in respect of such vehicle; and
(b) applications for vehicle plates under the said section 30 in cases where the said conditions are not complied with.
Amendment of section 38 of the Principal Act.
13.—Sub-section (1) of section 38 of the Principal Act is hereby amended by the substitution of the words “after the date on which such licence commenced next following such grant or after such transfer” for the words “after such grant or transfer” now contained therein, and the said sub-section shall be construed and have effect accordingly.
Restriction on applications under sub-section (1) of section 51 of the Principal Act.
14.—No application may be sent to the Minister under sub-section (1) of section 51 of the Principal Act during the period of two years commencing at the expiration of one year after the day appointed by order made after the passing of this Act under sub-section (1) of section 5 of the Principal Act to be the appointed day for the purposes of that Act.
Short title.
15.—This Act may be cited as the Road Transport Act, 1934.
