ACHTAÍTEAR AG AN OIREACHTAS MAR LEANAS:—

1.—(1) San Acht seo—

2.—(1) Más rud é—

(a) go mbronnann ollscoil sa Stát céim thréidliachta, agus

[EN]

(b) go bhfuil an tAire sásta, tar éis dó dul i gcomhairle leis an gComhairle, go ndearnadh na cúrsaí léinn le haghaidh na céime i gcoláiste nó foras eile a cheadaigh sé chuige sin tar éis dó dul i gcomhairle leis an gComhairle, agus

(c) gur dóigh leis an Aire, tar éis dó dul i gcomhairle leis an gComhairle, go dtugann na scrúduithe don chéim leor-ráthaíocht go bhfuil an t-eolas agus an oilteacht is gá chun an tréidliacht a chleachtadh go héifeachtach ag sealbhóirí na céime,

féadfaidh an Rialtas, le hordú, a threorú go gclárófar sa chlár aon duine ar a mbronnfar an chéim, fad a leanfas an t-ordú i bhfeidhm, ar an duine sin dá iarraidh sin sa tslí ordaithe agus d'íoc na táille is gá.

(2) Féadfaidh an Rialtas, le hordú, ordú faoi fho-alt (1) a chúlghairm.

Feidhmeanna formhaoirseachta na Comhairle.

3.—(1) Beidh éifeacht ag na forála seo a leanas den alt seo chun a áirithiú go dtugann na cúrsaí léinn atá le saothrú ag mic léinn le haghaidh céime a bhfuil ordú faoi fho-alt (1) d'alt 2 i bhfeidhm ina leith de thuras na huaire, agus an caighdeán inniúlachta is gá le haghaidh na céime sin, leor-ráthaíocht go bhfuil an t-eolas agus an oilteacht is gá chun an tréidliacht a chleachtadh go héifeachtach ag sealbhóirí na céime; agus beidh de dhualgas ar an gComhairle na cumhachta a bheirtear di leis na forála sin d'fheidhmiú a mhéid is gá chun na críche sin.

(2) Beidh cumhacht ag an gComhairle chun daoine a cheapadh le cuairteanna a thabhairt ar aon choláiste nó foras eile a bhfuil ordú faoi fho-alt (1) d'alt 2 i bhfeidhm ina leith de thuras na huaire agus tuarascáil a thabhairt ar na cúrsaí léinn, an fhoireann, an chóiríocht agus an trealamh atá ar fáil chun tréineáil sa tréidliacht a thabhairt agus ar na socruithe agus na saoráidí eile atá ann le haghaidh na tréineála sin.

(3)  (a)  Féadfaidh an Chomhairle daoine a cheapadh chun bheith i láthair ag scrúduithe le haghaidh céime a bhfuil ordú faoi fho-alt (1) d'alt 2 i bhfeidhm ina leith de thuras na huaire agus chun tuarascáil a thabhairt don Chomhairle i dtaobh leor-chaighdeáin na scrúduithe agus i dtaobh aon nithe eile a bhaineas leis sin agus a dteastóidh tuarascáil ina dtaobh ón gComhairle.

(b) Ní údaróidh aon ní sa bhfo-alt seo do dhuine a ceapfar faoin bhfo-alt seo cur isteach ar stiúrú aon scrúduithe.

(4) Ar aon tuarascáil a tugadh faoin alt seo d'fháil—

[EN]

(a) cuirfidh an Chomhairle cóip di go dtí an ollscoil atá i gceist;

[EN]

(b) féadfaidh an ollscoil, laistigh de mhí tar éis di an chóip d'fháil, nótaí ar an tuarascáil nó agóidí ina coinne a chur chun na Comhairle;

[EN]

(c) a luaithe is féidir tar éis deireadh na míosa sin, cuirfidh an Chomhairle chun an Aire cóip den tuarascáil agus d'aon nótaí uirthi nó agóidí ina coinne a rinneadh go cuí, maraon le tuairimí na Comhairle ar an tuarascáil agus ar aon nótaí nó agóidí den tsórt sin.

(5) Gach ollscoil a bheireas céim a bhfuil ordú faoi fho-alt (1) d'alt 2 i bhfeidhm ina leith de thuras na huaire, bhéarfaidh sí don Chomhairle, ar an gComhairle dá iarraidh sin i scríbhinn, pé eolas a bheas sonraithe san iarratas i dtaobh na gcúrsaí léinn agus na scrúduithe le haghaidh na céime.

An comhaontú sa sceideal a dhaingniú.

4.—(1) Daingnítear leis seo an comhaontú atá leagtha amach sa Sceideal a ghabhas leis an Acht seo (dá ngairmtear an comhaontú sceidealta san alt seo) agus beidh feidhm dlí aige.

(2) (a)  Féadfaidh an Rialtas, le hordú, éifeacht a thabhairt d'aon chomhaontú eile a déanfar idir na páirtithe sa chomhaontú sceidealta maidir le tréineáil, clárú agus rialú tréidlia agus nithe a bhaineas leis sin.

(b) Ní bheidh éifeacht ag ordú faoin bhfo-alt seo mura ndaingneofar é le rún ó gach Tigh den Oireachtas ach, ar a dhaingniú amhlaidh, beidh feidhm dlí aige agus beidh éifeacht aige in ionad na bhforál comhréire d'Acht 1931 a sonrófar san ordú.

Cumhacht chun socrú a dhéanamh i dtaobh an Chomhairle d'athchóiriú.

5.—(1) Féadfaidh an Rialtas, le hordú, socrú a dhéanamh i dtaobh an Chomhairle d'athchóiriú chun éifeacht a thabhairt d'aon ordú nó comhaontú a déanfar mar foráltar i bhfo-alt (2) d'alt 4 nó aon uair is deimhin leo, tar éis don Aire agus don Chomhairle dul i gcomhairle le chéile, gur gá sin a dhéanamh.

(2) Ní bheidh éifeacht ag ordú faoi fho-alt (1) mura ndaingneofar é le rún ó gach Tigh den Oireachtas ach, ar a dhaingniú amhlaidh, beidh feidhm dlí aige agus beidh éifeacht aige in ionad na bhforál comhréire d'Acht 1931 a sonrófar san ordú.

(3) Féadfaidh ordú faoi fho-alt (1), go sonrach,—

[EN]

(a) socrú a dhéanamh i dtaobh toghadh comhaltaí tofa na Comhairle, i dtaobh téarma oifige na gcomhaltaí sin a rialú, i dtaobh corrfholúntais a líonadh, agus i dtaobh toghadh agus seilbh oifige Uachtaráin na Comhairle,

(b) an córam do chruinnithe den Chomhairle a shonrú agus an líon íosta de chomhaltaí den Chomhairle a bhféadfar lena vótaí ainmneacha a bhaint den chlár, agus

[EN]

(c) pé socrú eile a dhéanamh is gá chun gnó na Comhairle a sheoladh go cuí agus go héifeachtach.

(4) Má bhíonn an Chomhairle á hathchóiriú faoin alt seo, féachfaidh an Rialtas chuige go mbeidh tromlach comhaltaí na Comhairle ina n-ionadaithe a bheas tofa le vótaí daoine cláraithe a chónaíos sa Stát, agus go mbeidh ar an gComhairle ionadaí amháin don Aire agus ionadaí amháin do gach ollscoil a bheireas céim a bhfuil ordú faoi fho-alt (1) d'alt 2 i bhfeidhm ina leith de thuras na huaire.

6.—D'ainneoin aon ní in Acht 1931, féadfaidh an tAire, ar iarratas nó le comhthoiliú na Comhairle, rialacháin a dhéanamh chun socrú a dhéanamh i dtaobh gach ní nó aon ní acu seo a leanas, go ginearálta nó maidir le haon bhliain nó blianta áirithe—

(a) an tráth a tionólfar cruinniú bliantúil reachtúil na Comhairle;

[EN]

(b) an bhliain arb iníochta ina leith, agus an tráth is iníochta, táillí cláraitheachta agus táillí bliantúla daoine cláraithe;

[EN]

(c) an dáta ar faoina threoir a cuirfear an t-eagrán bliantúil den chlár le chéile,

[EN]

agus beidh éifeacht ag na rialacháin in ionad na bhforál comhréire d'Acht 1931 a sonrófar sna rialacháin.

Cumhacht araíonachta bhreise a thabhairt don Chomhairle.

7.—(1) Folóidh cumhacht na Comhairle chun ainm duine a bhaint den chlár do réir ailt 36 d'Acht 1931 cumhacht is infheidhmithe sa tslí chéanna chun a threorú nach mbeidh éifeacht, ar feadh pé tréimhse a sonrófar sa treorú, ag clárú a ainme sa chlár.

(2) Aon uair a bhéarfar treorú mar foráltar i bhfo-alt (1), cuirfidh an Chomhairle chun an duine sin láithreach leis an bpost fógra scríofa i dtaobh éifeacht a chláruithe a bheith ar fionraí agus i dtaobh na cúise a bhí leis.

(3) Aon uair tar éis dó an fógra d'fháil féadfaidh an duine sin a iarraidh ar an gComhairle an fhionraíocht a chealú agus féadfaidh an Chomhairle, ar an iarratas a bhreithniú, diúltú don iarratas nó, le treorú speisialta, géilleadh dhó ar pé coinníollacha is cuí leis an gComhairle.

(4) Féadfaidh duine ar cúis mhíshásaimh leis éifeacht a chláruithe d'fhionraí, nó faid na tréimhse fionraíochta, achomharc a dhéanamh chun na hArd-Chúirte.

(5) Ar aon achomharc den tsórt sin, féadfaidh an Ard-Chúirt pé treoracha is cuí leo a thabhairt san ábhar agus ní bheidh dul thar aon ordú ón gCúirt faoin alt seo.

(6) I ngach cás ina ndéanfar éifeacht chláruithe dhuine sa chlár d'fhionraí faoin alt seo, cuirfidh an Chomhairle an fhionraí agus nádúir ghinearálta na cúise a bhí léi in iúl láithreach don Aire.

Cleachtadh na tréidliachta ag daoine neamhchláraithe.

8.—Gan dochar do ghinearáltacht alt 46 agus 47 d'Acht 1931, measfar, chun críocha an Achta sin, duine ar bith a bhíos, ar luaíocht, ag cóireáil ainmhithe le duine eile, a bheith á chur i gcéill nó á thabhairt le tuiscint go bhfuil sé ag cleachtadh na tréidliachta agus á thabhairt le tuiscint gur tréidlia cláraithe é.

Cumhacht don Chomhairle chun talamh a shealbhú.

9.—Beidh cumhacht ag an gComhairle talamh d'fháil, a shealbhú agus a dhiúscairt.

Bronntanais don Chomhairle.

10.—(1) Féadfaidh an Chomhairle bronntanais airgid, talún agus maoine eile a ghlacadh ar pé iontaobhais agus coinníollacha, más ann, a shonrós na bronntóirí.

(2) Ní ghlacfaidh an Chomhairle bronntanas má bhíonn na coinníollacha a chuirfeas an bronntóir le glacadh an bhronntanais ar neamhréir le feidhmeanna na Comhairle.

Gearrtheideal, forléiriú agus comhlua.

11.—(1) Féadfar Acht na dTréidlia, 1952, a ghairm den Acht seo.

(2) Forléireofar an tAcht seo agus Acht 1931 mar aon ní amháin.

(3) Féadfar Achta na dTréidlia, 1931 agus 1952, a ghairm d'Acht 1931 agus den Acht seo le chéile.

AN SCEIDEAL

Alt 4.

Comhaontú a rinneadh an 20ú lá de Bhealtaine, 1949, maidir le ceapadh nó toghadh comhaltaí breise de Chomhairle Choláiste Ríoga na dTréidlia agus le híoc táillí leis a n gComhairle sin.

Tá Rialtas a Shoilse i Ríocht Aontaithe na Breataine Móire agus Tuaiscirt Éireann agus Rialtas Phoblacht na hÉireann tar éis comhaontú mar leanas:—

1.   (1) I dteannta na gcomhaltaí de Chomhairle Choláiste Ríoga na dTréidlia (dá ngairmtear an Coláiste anseo ina dhiaidh seo) a sonraítear in ailt a naoi agus a dó dhéag den Veterinary Surgeons Act, 1948 (11 agus 12 Geo. 6 c. 52), beidh cúigear comhaltaí breise (dá ngairmtear na hionadaithe Éireannacha anseo ina dhiaidh seo) ar an gComhairle sin mar leanas, is é sin le rá—

(i) Duine amháin, arna cheapadh ag Aire Talmhaíochta Phoblacht na hÉireann, a bheas (mura dtarlaí roimhe sin é d'éag nó d'éirí as oifig nó é a dhícháiliú nó é a chur as oifig ag an Aire sin) i seilbh oifige go ceann ceithre bliana agus a bheas inathcheaptha;

(ii) Ceathrar arb iad na comhaltaí tofa ginearálta iad, de thuras na huaire, de Chomhairle na dTréidlia i bPoblacht na hÉireann faoi Acht na Máinlia Beithíoch, 1931 (Uimh. 36 de 1931).

(2) Scarfaidh na hionadaithe Éireannacha lena n-oifig mar chomhaltaí de Chomhairle athchóirithe an Choláiste, agus beidh deireadh leis an gClásal seo den Chomhaontú seo, mura n-athnuaitear é, ag an gcéad chruinniú ginearálta bliantúil den Choláiste a tionólfar tar éis foráil a theacht in éifeacht do réir dlithe Phoblacht na hÉireann á fhoráil go ndéanfar duine ar bith a mbronnfaidh Ollscoil i bPoblacht na hÉireann céim tréidliachta air le linn an dlí sin a bheith i bhfeidhm a chlárú do réir an dlí sin i gClár na dTréidlia a bheas á choimeád ag Comhairle na dTréidlia i bPoblacht na hÉireann.

2. (1) Gach duine a bheas de thuras na huaire cláraithe i gClár Tréidlia na Ríochta Aontaithe agus fós i gClár na dTréidlia a bheas á choimeád ag Comhairle na dTréidlia i bPoblacht na hÉireann, déanfaidh sé, i leith gach bliana nó coda de bhliain a bheas sé ina chónaí lasmuigh de límistéir dlínse Rialtas Phoblacht na hÉireann nó (pé áit a mbeidh sé ina chónaí) a bheas ag cleachtadh, nó á thabhairt le tuiscint go bhfuil sé ag chleach tadh, nó go bhfuil sé ullamh chun bheith ag cleachtadh, na tréidliachta lasmuigh den límistéir sin, pé táille bhliantúil (más ann) d'íoc le Comhairle an Choláiste a ordós an Chomhairle sin de bhun ailt a cúig is fiche den Veterinary Surgeons Act, 1948, adúradh, ach sin faoi réir a laghduithe de shuim ghiní amháin i gcás duine ar bith ar íoc Comhairle na dTréidlia i bPoblacht na hÉireann an tsuim sin ina leith le Comhairle an Choláiste i leith na tréimhse sin.

(2) Beidh feidhm, faoi réir a bhfuil ráite roimhe seo, ag forála an ailt sin a cúig is fiche maidir le gach duine den tsórt dá dtagartar sa chlásal seo.

(3) Sa chlásal seo ciallaíonn an focal “bliain” tréimhse dhá mhí dhéag dár tosach an dáta i ngach bliain chaileandair a bheas an táille bhliantúil sin iníoctha le Comhairle an Choláiste.

3. Na forála den Chomhaontú idir Rialtas a Shoilse i Ríocht Aontaithe na Breataine Móire agus Tuaiscirt Éireann agus Rialtas a Shoilse i Saorstát Éireann maidir le clárú agus rialú tréidlia, a daingníodh agus dár tugadh éifeacht reachtúil leis an Veterinary Surgeons (Irish Free State Agreement) Act, 1932 (22 Geo. 5. c. 10), agus le hAcht na Máinlia Beithíoch, 1931, adúradh, faoi seach, beidh acu (faoi réir forál an Veterinary Surgeons Act, 1948, adúradh) éifeacht faoi réir forál an Chomhaontuithe seo.

4. (1) Tiocfaidh an Comhaontú seo (ach amháin clásal 2 dhe seo) in éifeacht ag an gcéad chruinniú ginearálta bliantúil den Choláiste a tionólfar tar éis dáta an Orduithe i gComhairle trína ndéanfaidh a Shoilse foráil, faoi alt a fiche den Veterinary Surgeons Act, 1948, adúradh, chun éifeacht a thabhairt don Chomhaontú seo.

(2) Tiocfaidh clásal 2 den Chomhaontú seo in éifeacht ar an gcéad dáta, i ndiaidh an dáta dá dtagartar sa bhfo-chlásal deiridh roimhe seo, a bheas an táille bhliantúil a luaitear sa chlásal sin 2 iníoctha le Comhairle an Choláiste.

VETERINARY SURGEONS ACT, 1952.


AN ACT TO MAKE FURTHER PROVISION FOR THE TEACHING OF VETERINARY SURGERY AND VETERINARY MEDICINE AND FOR THE REGULATION AND CONTROL OF THE PROFESSION AND TO PROVIDE FOR CERTAIN OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. [7th August, 1952.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Interpretation.

1.—(1) In this Act—

the Act of 1931” means the Veterinary Surgeons Act, 1931 (No. 36 of 1931);

[GA]

the Council” means the Veterinary Council;

[GA]

the Minister” means the Minister for Agriculture;

[GA]

prescribed” means prescribed by regulations made by the Council;

[GA]

the register” means the register of veterinary surgeons maintained by the Council, and the word “registered” shall be construed accordingly;

[GA]

veterinary surgery” includes veterinary medicine.

[GA]

(2) The register shall be known as the Register of Veterinary Surgeons for Ireland.

[GA]

Qualification of holders of veterinary degrees as veterinary surgeons.

2.—(1) Where—

[GA]

(a) a university in the State confers a veterinary degree, and

[GA]

(b) the Minister is satisfied, after consultation with the Council, that the courses of study leading to the degree have been pursued at a college or other institution approved by him for the purpose after consultation with the Council, and

[GA]

(c) it appears to the Minister, after consultation with the Council, that the examinations for the degree are such as sufficiently to guarantee that holders of the degree will have acquired the knowledge and skill needed for the efficient practice of veterinary surgery,

[GA]

the Government may by order direct that any person on whom the degree is conferred during the continuance in force of the order shall, on applying in the prescribed manner and paying the required fee, be registered in the register.

[GA]

(2) The Government may by order revoke an order under subsection (1).

[GA]

Supervisory functions of Council.

3.—(1) The following provisions of this section shall have effect for the purpose of securing that the courses of study to be followed by students for a degree, in the case of which an order under subsection (1) of section 2 is for the time being in force, and the standard of proficiency required for admission thereto, shall be such as sufficiently to guarantee that holders of the degree will have acquired the knowledge and skill needed for the efficient practice of veterinary surgery; and it shall be the duty of the Council to exercise the powers conferred on them by the said provisions so far as is necessary for the purpose aforesaid.

(2) The Council shall have power to appoint persons to visit any college or other institution in the case of which an order under subsection (1) of section 2 is for the time being in force, and to report upon the courses of study, staffing, accommodation and equipment available for training in veterinary surgery and the other arrangements and facilities for such training.

(3) (a) The Council may appoint persons to attend at examinations leading to a degree in the case of which an order under subsection (1) of section 2 is for the time being in force and to report to the Council as to the sufficiency of the examinations and as to such other matters relating thereto as the Council may require.

[GA]

(b) Nothing in this subsection shall authorise a person appointed thereunder to interfere with the conduct of any examination.

[GA]

(4) On receipt of any report made under this section—

[GA]

(a) the Council shall send a copy thereof to the university concerned;

[GA]

(b) the university may within one month of the receipt of the copy make to the Council observations on the report or objections thereto;

[GA]

(c) as soon as may be after the expiration of the said month the Council shall send to the Minister a copy of the report and of any observations thereon or objections thereto duly made, together with the Council's comments on the report and on any such observations or objections.

(5) Every university granting a degree in the case of which an order under subsection (1) of section 2 is for the time being in force shall, on a request in writing in that behalf made by the Council, furnish the Council with such information as may be specified in the request as to the courses of study and examinations leading to the degree.

Confirmation of scheduled agreement.

4.—(1) The agreement set forth in the Schedule to this Act (in this section referred to as the scheduled agreement) is hereby confirmed and shall have the force of law.

(2) (a) The Government may by order give effect to any further agreement that may be entered into between the parties to the scheduled agreement in relation to the training, registration and control of veterinary surgeons and matters incidental thereto.

[GA]

(b) An order under this subsection shall not have effect unless it is confirmed by resolution of each House of the Oireachtas but, upon being so confirmed, it shall have the force of law and shall have effect in lieu of the corresponding provisions of the Act of 1931 specified in the order.

Power to provide for reconstitution of Council.

5.—(1) The Government may by order provide for the reconstitution of the Council for the purpose of giving effect to any order or agreement made as provided for in subsection (2) of section 4 or whenever, after consultation between the Minister and the Council, they are satisfied that it is necessary to do so.

(2) An order under subsection (1) shall not have effect unless it is confirmed by resolution of each House of the Oireachtas but, upon being so confirmed, it shall have the force of law and shall have effect in lieu of the corresponding provisions of the Act of 1931 specified in the order.

(3) An order under subsection (1) may, in particular—

(a) provide for the election of elected members of the Council, for regulating the term of office of such members, for filling casual vacancies, and for the election and tenure of office of the President of the Council,

[GA]

(b) specify the quorum for meetings of the Council and the minimum number of members of the Council by whose votes names may be erased from the register, and

[GA]

(c) make such further provision as may be necessary for the proper and efficient conduct of the business of the Council.

[GA]

(4) In reconstituting the Council under this section the Government shall ensure that a majority of the members of the Council shall consist of representatives elected by the votes of registered persons resident in the State, and that the Council shall include one representative of the Minister and one representative of each university granting a degree in the case of which an order under subsection (1) of section 2 is for the time being in force.

Power to provide for certain obligations of Council and registered persons.

6.—Notwithstanding anything in the Act of 1931, the Minister may, at the request or with the concurrence of the Council, make regulations to provide for all or any of the following matters, whether generally or with reference to any particular year or years—

(a) the time at which the annual statutory meeting of the Council is to be held;

[GA]

(b) the year in respect of which and the time at which, registration fees and annual fees of registered persons are to be payable;

[GA]

(c) the date by reference to which the annual issue of the register is to be compiled,

[GA]

and the regulations shall have effect in lieu of the corresponding provisions of the Act of 1931 specified in the regulations.

Additional disciplinary power to Council.

7.—(1) The power of the Council to erase the name of a person from the register in accordance with section 36 of the Act of 1931 shall include a power exercisable in the like manner to direct that during such period as may be specified in the direction registration of his name in the register shall not have effect.

(2) Whenever a direction is given as provided for in subsection (1), the Council shall forthwith send by post to such person notice in writing of the suspension of the effect of his registration and of the reason therefor.

[GA]

(3) At any time after receipt of the notice such person may apply to the Council to remove the suspension and the Council may, on considering the application, either refuse to grant it or by special direction grant it on such conditions as the Council may think fit.

[GA]

(4) A person aggrieved by the suspension of the effect of his registration, or by the period of the suspension, may appeal to the High Court.

[GA]

(5) On any such appeal, the High Court may give such directions in the matter as they think proper and any order of the Court under this section shall be final.

[GA]

(6) In every case in which the effect of a person's registration in the register is suspended under this section, the Council shall immediately notify the Minister of the suspension and the general nature of the reason therefor.

Practice of veterinary surgery by unregistered persons.

8.—Without prejudice to the generality of sections 46 and 47 of the Act of 1931, any person who for reward habitually treats animals the property of another person shall be deemed, for the purposes of that Act, to represent or hold himself out as practising veterinary surgery and to hold himself out as a registered veterinary surgeon.

Power to Council to hold land.

9.—The Council shall have power to acquire, hold and dispose of land.

Gifts to Council.

10.—(1) The Council may accept gifts of money, land and other property upon such trusts and conditions, if any, as may be specified by the donors.

(2) The Council shall not accept a gift if the conditions attached by the donor to its acceptance are inconsistent with the functions of the Council.

[GA]

Short title, construction and collective citation.

11.—(1) This Act may be cited as the Veterinary Surgeons Act, 1952.

[GA]

(2) This Act shall be construed as one with the Act of 1931.

[GA]

(3) The Act of 1931 and this Act may be cited together as the Veterinary Surgeons Acts, 1931 and 1952.

SCHEDULE.

Section 4.

Agreement made the 20th day of May, 1949, with respect to the appointment or election of additional members of the Council of the Royal College of Veterinary Surgeons and the payment of fees to the said Council.

His Majesty's Government in the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Ireland have agreed as follows:—

1. (1) In addition to the members of the Council of the Royal College of Veterinary Surgeons (hereinafter referred to as the College) specified in sections nine and twelve of the Veterinary Surgeons Act, 1948 (11 and 12 Geo. 6 c. 52), there shall be five additional members (hereinafter referred to as the Irish representatives) of the said Council, consisting of the following persons, that is to say—

(i) One person, appointed by the Minister for Agriculture of the Republic of Ireland, who (unless he sooner dies, resigns, becomes disqualified or is removed from office by the said Minister) shall hold office for four years and shall be eligible for re-appointment;

(ii) Four persons who are for the time being the general elected members of the Veterinary Council in the Republic of Ireland under the Veterinary Surgeons Act, 1931 (Number 36 of 1931).

(2) The Irish representatives shall vacate office as members of the reconstituted Council of the College, and this Clause of this Agreement, unless renewed, shall terminate, at the annual general meeting of the College held next after provision has become effective in accordance with the laws of the Republic of Ireland whereby any person on whom a veterinary degree is conferred by a University in the Republic of Ireland during the continuance in force of such law shall in accordance with such law be registered in the Veterinary Register kept by the Veterinary Council in the Republic of Ireland.

2. (1) All persons for the time being registered both in the United Kingdom Register of Veterinary Surgeons and in the Veterinary Register kept by the Veterinary Council in the Republic of Ireland shall, in respect of every year or part of a year during which they reside outside the area of jurisdiction of the Government of the Republic of Ireland or (wherever residing) practise, or hold themselves out as practising or as being prepared to practise, veterinary surgery outside the said area, pay to the Council of the College such annual fee (if any) as the said Council may prescribe in pursuance of section twenty-five of the said Veterinary Surgeons Act, 1948, but subject to a deduction of the sum of one guinea in the case of any person in respect of whom that sum is paid by the Veterinary Council in the Republic of Ireland to the Council of the College in respect of the same period.

(2) The provisions of the said section twenty-five shall apply, subject as aforesaid, to all such persons as are referred to in this clause.

(3) In this clause the word “year” means a period of twelve months commencing on the date in each calendar year on which the said annual fee is payable to the Council of the College.

3. The provisions of the Agreement between His Majesty's Government in the United Kingdom of Great Britain and Northern Ireland and His Majesty's Government in the Irish Free State as to the registration and control of veterinary surgeons, confirmed and given statutory effect by the Veterinary Surgeons (Irish Free State Agreement) Act, 1932 (22 Geo. 5. c. 10), and the said Veterinary Surgeons Act, 1931, respectively, shall (subject to the provisions of the said Veterinary Surgeons Act, 1948) have effect subject to the provisions of this Agreement.

4. (1) This Agreement (except clause 2 hereof) shall take effect at the annual general meeting of the College held next after the date of the Order in Council whereby His Majesty makes provision, under section twenty of the said Veterinary Surgeons Act, 1948, for the purpose of giving effect to this Agreement.

(2) Clause 2 of this Agreement shall take effect at the first date on which the annual fee therein mentioned is payable to the Council of the College occurring next after the date referred to in the last foregoing sub-clause.
