AN tACHT UM SHUBSTAINTÍ CONTÚIRTEACHA (LEASÚ), 1979

Leasú ar an Acht um Shubstaintí Contúirteacha, 1972.

1.—Leasaítear leis seo an tAcht um Shubstaintí Contúirteacha, 1972, tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (2) d'alt 1:

“(2) Tiocfaidh an tAcht seo i ngníomh cibé lá nó laethanta a cheapfaidh an tAire le hordú nó le horduithe chuige sin go ginearálta nó faoi threoir aon chríche nó forála áirithe, agus féadfar laethanta éagsúla a shocrú amhlaidh chun críocha éagsúla agus le haghaidh forálacha éagsúla.”

2.—(1) Beidh comhairle ann (dá ngairfear an Chomhairle Chomhairleach san alt seo) ar a mbeidh cathaoirleach agus cibé líon gnáthchomhaltaí is iomchuí leis an Aire chun aon nithe a éireoidh maidir le, nó i ndáil le, feidhmiú an Achta um Shubstaintí Contúirteacha, 1972, agus a tharchuirfidh an tAire chun na Comhairle Comhairlí, a bhreithniú agus comhairle a thabhairt don Aire ina dtaobh.

(2) Is é an tAire a cheapfaidh an cathaoirleach agus na gnáthchomhaltaí agus beidh siad i seilbh oifige go ceann cibé tréimhse a chinnfidh an tAire.

(3) Ar an gComhairle Chomhairleach á iarraidh sin agus faoi réir an tAire do thoiliú leis féadfaidh cigire bheith i láthair ag cruinniú den Chomhairle Chomhairleach chun aon fhaisnéis a thabhairt a iarrfaidh an Chomhairle Chomhairleach lena feidhmeanna a chomhlíonadh.

Gearrtheideal, comhlua agus forléiriú.

3.—(1) Féadfar an tAcht um Shubstaintí Contúirteacha (Leasú), 1979, a ghairm den Acht seo.

(2) Féadfar na hAchtanna um Shubstaintí Contúirteacha, 1972 agus 1979, a ghairm den Acht um Shubstaintí Contúirteacha, 1972, agus den Acht seo le chéile agus forléireofar iad le chéile mar aon ní amháin.

DANGEROUS SUBSTANCES (AMENDMENT) ACT, 1979

Amendment of Dangerous Substances Act, 1972.

1.—The Dangerous Substances Act, 1972, is hereby amended by the substitution for subsection (2) of section 1 of the following subsection:

“(2) This Act shall come into operation on such day or days as the Minister may by order or orders appoint therefor either generally or with reference to any particular purpose or provision and different days may be so fixed for different purposes and different provisions.”

Advisory Council.

2.—(1) There shall be a council (in this section referred to as the Advisory Council) consisting of a chairman and such number of ordinary members as the Minister considers appropriate who shall consider and advise the Minister on any matters arising on or in relation to the execution of the Dangerous Substances Act, 1972, which the Minister may refer to the Advisory Council.

(2) The chairman and the ordinary members shall be appointed by the Minister and shall hold office for such period as the Minister may decide.

(3) On the request of the Advisory Council and subject to the consent of the Minister an inspector may attend a meeting of the Advisory Council for the purpose of giving any information which the Advisory Council may request for the purposes of discharging its functions.

Short title, collective citation and construction.

3.—(1) This Act may be cited as the Dangerous Substances (Amendment) Act, 1979.

(2) The Dangerous Substances Act, 1972, and this Act may be cited together as the Dangerous Substances Acts, 1972 and 1979, and shall be construed together as one.
