Mínithe.
1.—San Acht so—
cialluíonn an focal “an tAire” an tAire Rialtais Áitiúla agus Sláinte Puiblí;
cialluíonn an focal “an Bord” Bord na bhFiaclóirí a bunuítear leis an Acht so;
cialluíonn an focal “an Clár” an Clár d'Fhiaclóirí do Shaorstát Éireann atá le bunú fén Acht so;
cialluíonn an focal “an Chomhairle Ghenerálta” an General Council of Medical Education and Registration atá bunuithe fé sna hAchtanna Dochtúireachta;

cialluíonn an focal “fiaclóir cláruithe”—
(a) maidir le haon rud atá déanta no le déanamh no le ní do thuitim amach roimh bhunú an chláir, duine atá cláruithe sa Chlár Ghenerálta d'Fhiaclóirí le linn an rud san do bheith á dhéanamh no le déanamh no le linn an ní sin do thuitim amach no, i gcás é do bheith cláruithe amhlaidh aon uair tar éis an 1adh lá d'Eanair, 1922, do scuir de bheith cláruithe amhlaidh ar chúis eile seachas de dheascaibh a bháis no do dheascaibh a chiontuithe i bhfeleontacht, i mí-iompar, i gcoir no i gcionta no de dheascaibh é d'fháil ciontach in iompar náireach no aithiseach maidir le n-a ghairm no de dheascaibh a chlárú do thabhairt chun críche tré chalaois no de dheascaibh a dhéanta tré earráid, agus
(b) maidir le haon rud a bheidh déanta no le déanamh no le ní do thuitim amach tar éis bhunú an chláir, duine a bheidh cláruithe sa chlár le linn an rud san do bheith á dhéanamh no le déanamh no le linn an ní sin do thuitim amach;
cialluíonn an focal “scrúdú tástála” scrúdú i bhfiaclóireacht no i máinliaghacht fhiacal a dintar, chun deimhnithe do dheona go bhfuiltar oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta, ag aon phríomh-scoil no coláiste i Saorstát Éireann ag á bhfuil comhacht de thurus na huaire chun deimhnithe den tsórt san do dheona;
cialluíonn an focal “fiaclóireacht no máinliaghacht fhiacal do chleachta” aon obráid do dhéanamh agus aon chóir, comhairle, oipineon, no freastal do thabhairt is gnáth do mháinliaigh fhiacal no d'fhiaclóir do dhéanamh no do thabhairt uaidh, agus foluíonn sé aon obráid do dhéanamh ar aon duine no aon chóir, comhairle no freastal do thabhairt do sara gcóirítear, sara gcuirtear isteach no sara socruítear fiacla saordha, no chun na críche sin no mar gheall air;
cialluíonn agus foluíonn an focal “tiarnas féin-rialtach” Tiarnas Chanada, an Astráil, Tiarnas Zéalann Nua, Aondacht na hAifrice Theas, agus Tír an Eisc;
ní fholuíonn an focal “sealbhachas Briotáineach” an Bhreatain Mhór ná Tuaisceart Éireann ná na tiarnaisí féin-rialtacha.
An Co-aontú do dhaingniú agus leasuithe ar an dlí dá dhruim.
2.—(1) Daingnítear leis seo an Co-aontú atá curtha síos sa Chéad Sceideal a ghabhann leis an Acht so agus ragha sé in éifeacht ar pé dáta is déanaí acu so a leanas, sé sin le rá, dáta rithte an Achta so agus an dáta ar a ndéanfidh Páirlimint Ríocht Aontuithe na Breataine Móire agus Thuaisceart Éireann reachtúchán do rith mar dhlí chun éifeacht reachtúil do thabhairt don Chó-aontú san.
(2) Chun go mbeadh éifeacht reachtúil ag an gCó-aontú san i Saorstát Éireann achtuítear leis seo—
(a) sa mhéid go bhfuil a théarmaí buiniscionn leis na Dentists Acts, go dtuigfar go ndineann an Có-aontú san leasú no atharú sa mhéid sin ar na hAchtanna san agus go ndintar leis seo na hAchtanna san do leasú agus d'atharú dá réir sin;
(b) go mbeidh agus go leanfidh na Dentists Acts, agus iad leasuithe no atharuithe amhlaidh, i bhfeidhm i Saorstát Éireann sa mhéid go bhforáltar amhlaidh leis an gCó-aontú san no gur gá san chun go mbeadh lánfheidhm agus lán-éifeacht ag an gCó-aontú san i Saorstát Éireann;
(c) go scuirfidh na Dentists Acts, ach amháin sa mhéid go n-achtuítear a mhalairt sa mhír sin roimhe seo, d'éifeacht do bheith acu ar dháta rithte an Achta so.
Có-dhéanamh Bord na bhFiaclóirí.
3.—(1) Déanfar bord ar a dtabharfar Bord na bhFiaclóirí (dá ngairmtear an Bord san Acht so) do bhunú do réir an Achta so chun na feidhmeanna a ceaptar do leis an Acht so do chólíona.
(2) Beidh an Bord ina chólucht chorparáideach agus síorchomharbas aige agus féadfa sé séala do sholáthar do féin agus féadfa sé dul chun dlí agus féadfar dul chun dlí leis fén teideal agus fén ainm sin adubhradh.
(3) Beidh an Bord có-dhéanta de bhaill a hainmneofar agus a toghfar fé seach ag na cóluchtaí agus ag na daoine uile agus fé seach a luaidhtear sa Dara Sceideal a ghabhann leis an Acht so agus, i gcás na mball a toghfar, is as na haicmí uile agus fé seach a luaidhtear sa Dara Sceideal a ghabhann leis an Acht so a toghfar iad.
Téarma oifige baill den Bhord.
4.—(1) Fé réir na bhforálacha den alt so i dtaobh daoine a toghfar no a hainmneofar chun foth-fholúntaisí, marab éag, eirghe as, no teacht fé dhí-cháilíocht roimhe sin do beidh gach ball den Bhord i seilbh a oifige mar bhall den tsórt san ar feadh téarma cúig mblian a háireofar, i gcás na gcéad bhall, o bhunú an Bhúird agus, i gcás gach baill ina dhiaidh sin, ón am a bheidh téarma oifige an té a bhí roimhe caithte.
(2) Ball den Bhord a toghfar no a hainmneofar chun fothfholúntais sa Bhord beidh sé, marab éag, eirghe as, no teacht fé dhí-cháilíocht roimhe sin do, i seilbh oifige ar feadh an iarsma den téarma go mbeadh ag an mball, 'na dtáinig an folúntas tré éag, eirghe as no teacht fé dhí-cháilíocht do, seilbh oifige mara mbeadh a éag, a eirghe as no a theacht fé dhí-cháilíocht.
(3) Nuair a bheidh deire le n-a bhallraíocht tré imeacht aimsire beidh gach ball den Bhord ion-aththoghtha no ion-athainmnithe.
Eirghe as do bhall den Bhord.
5.—(1) Féadfidh ball den Bhord aon uair eirghe as a oifig mar bhall den tsórt san tré leitir do dhíriú agus do chur chun an Bhúird agus raghaidh gach eirghe-as den tsórt san in éifeacht i dtosach an chéad chruinnithe den Bhord a thosnóidh tar éis an t-eirghe-as san d'fháil don Bhord.
Foth-fholúntaisí sa Bhord.
6.—(1) Pé uair a thiocfidh folúntas (dá ngairmtear fothfholúntas san Acht so) i mballraíocht an Bhúird tré éag, eirghe as, no teacht fé dhí-cháilíocht do bhall a hainmníodh cuirfidh an Bord in úil láithreach don chólucht d'ainmnigh an ball san go bhfuil an folúntas san tar éis teacht agus déanfidh an cólucht san, chó luath agus bheidh caoi ann chuige sin, duine d'ainmniú chun an fholúntais sin.
(2) Pé uair a thiocfidh folúntas (dá ngairmtear foth-fholúntas san Acht so) i mballraíocht an Bhúird tré éag, eirghe as, no teacht fé dhí-cháilíocht do bhall a toghadh déanfidh an Bord ag an dara cruinniú eile a bheidh aige tar éis an folúntas san do theacht duine do thogha chun an fholúntais sin.
(3) Déanfar gach éinne a hainmneofar no a toghfar fén alt so chun foth-fholúntais d'ainmniú no do thogha ón aicme daoine (más ann di) go raibh sé ceangailte an ball d'ainmniú no do thogha aisti 'na dtáinig an folúntas tré éag, eirghe as no teacht fé dhí-cháilíocht do.
Uachtarán an Bhúird.
7.—(1) Beidh sé de dhualgas ar an mBord duine dá bhaill do thogha o am go ham fé mar is gá é chun bheith ina Uachtarán ar an mBord.
(2) Beidh gach Uachtarán den Bhord i seilbh oifige mar Uachtarán den tsórt san o dháta a thoghtha chun na hoifige sin go dtí go dtárlóidh pé ní acu so a leanas is túisce a thárlóidh, sé sin le rá:—
(a) a théarma oifige mar bhall den Bhord do bheith caithte,
(b) a scur de bheith ina bhall den Bhord ar aon tslí eile seachas tré n-a théarma oifige do bheith caithte,
(c) a eirghe as oifig Uachtaráin an Bhúird.
Cruinnithe agus nós-imeachta an Bhúird.
8.—(1) Socróidh an Bord amannta agus áiteanna a chruinnithe agus comórfar gach cruinniú den Bhord tar éis a chéad chruinnithe san am agus san áit a socrófar amhlaidh.
(2) Is do réir na rialachán a dhéanfidh an Bord chuige sin fén Acht so a stiúrófar nós-imeachta an Bhúird ag á chruinnithe agus eile.
(3) Trian de bhaill an Bhúird a bheidh mar quorum.
(4) Gach socrú a bheidh le déanamh ag an mBord ag aon chruinniú a bheidh aige is le móráireamh de sna baill den Bhord a bheidh láithreach ag an gcruinniú san agus a vótálfidh ar an socrú san isea a déanfar é.
(5) Gníomhóidh Uachtarán an Bhúird mar Chathaoirleach ar gach cruinniú den Bhord ag á mbeidh sé láithreach agus má bhíonn an tUachtarán as láthair o aon chruinniú den tsórt san déanfidh na baill den Bhord a bheidh láithreach ag an gcruinniú san duine acu féin do thogha chun bheith mar chathaoirleach ar an gcruinniú san.
(6) Pé uair a thárlóidh ag cruinniú den Bhord, maidir le vótanna na mball den Bhord a bheidh láithreach agus a vótálfidh, gur có-ionann an méid díobh a tabharfar i bhfabhar agus an méid díobh a tabharfar i gcoinnibh tairisgeana no rúin, beidh vóta réitigh ag cathaoirleach an chruinnithe sin i dteanta a vóta mar bhall den Bhord.
(7) Féadfidh an Bord gníomhú d'ainneoin folúntas no folúntaisí do bheith ina bhallraíocht.
Céad ainmniú na mball n-ainmnithe den Bhord.
9.—(1) Chó luath agus is féidir é tar éis rithe an Achta so cuirfidh an tAire chun Comhairle na nDochtúirí Leighis fógra i scríbhinn á iarraidh ortha triúr ball den Bhord d'ainmniú.
(2) Trí seachtaine ar a laighead no ceithre seachtaine ar a mhéid tar éis an fógra atá luaidhte sa bhfo-alt san roimhe seo do chur uaidh déanfidh an tAire ainmneacha na mball den Bhord d'ainmnigh Comhairle na nDochtúirí Leighis do chur in úil don Ard-Chomhairle, agus san am gcéanna iarrfa sé ar an Ard-Chomhairle duine den Bhord d'ainmniú.
(3) Nuair a bheidh an Ard-Chomhairle tar éis ball den Bhord d'ainmniú do réir an fho-ailt sin roimhe seo déanfaidh an tAire, tré fhógra i scríbhinn do chur tríd an bpost go dtí gach ball den Bhord a bheidh ainmnithe do réir an ailt seo, am agus áit do cheapa do chéad chruinniú na mball n-ainmnithe den Bhord.
(4) Tiocfidh na baill ainmnithe den Bhord le chéile san am agus san áit a ceapfar fén alt so dá gcéad chruinniú.
Céad chruinniú na mball n-ainmnithe den Bhord.
10.—(1) Déanfidh na baill ainmnithe den Bhord na nithe seo a leanas ag á gcéad chruinniú agus ina dhiaidh sin, sé sin le rá:—
(a) a nós-imeachta do rialáil agus amannta agus áiteanna a gcruinnithe do cheapa, agus
(b) scéim d'ullamhú, le haontú an Aire, chun toghachán do chomóra do réir an ailt seo chun baill toghtha den Bhord do thogha chun bheith i seilbh oifige ar feadh na gcúig mblian díreach tar éis bunú an Bhúird, agus
(c) an toghachán san do chomóra agus ainmneacha na ndaoine a toghfar ann do chur in úil don Aire.
(2) Leis an scéim a hullamhófar fén alt so chun baill toghtha den Bhord do thogha socrófar chun an vótáil sa toghachán san do dhéanamh tríd an bpost agus chun an vótáil sin do bheith sicréideach agus chun an toghachán san do chomóra in am agus i slí go mbeidh sé críochnuithe agus ainmneacha na ndaoine a toghadh ann curtha in úil don Aire laistigh de dhá mhí tar éis céad chruinniú na mball n-ainmnithe den Bhord.
(3) Beirt bhall ainmnithe den Bhord a bheidh mar quorum ag an gcéad chruinniú agus ag gach cruinniú ina dhiaidh sin de sna baill ainmnithe den Bhord.
(4) Na comhachta a tugtar do sna baill ainmnithe den Bhord fén alt so beidh deire leo nuair a bunófar an Bord.
Bunú an Bhúird.
11.—(1) Chó luath agus is féidir é tar éis bheith críochnuithe don toghachán do bhaill toghtha den Bhord a ceangailtear leis an Acht so ar bhaill ainmnithe an Bhúird do chomóra agus tar éis ainmneacha na ndaoine a toghadh sa toghachán san do bheith curtha in úil don Aire ag na baill ainmnithe sin foillseoidh an tAire san Iris Oifigiúil fógra á fhaisnéis go bhfuil an Bord bunuithe ar agus o dháta a bheidh ainmnithe sa bhfógra san agus ag luadh ainmneacha na ndaoine a bheidh toghtha agus ainmnithe an uair sin do réir an Achta so chun bheith ina mbaill den Bhord.
(2) An dáta bheidh le hainmniú sa bhfógra san a foillseofar san Iris Oifigiúil mar dháta chun an Bord do bhunú, beidh sé i ndiaidh ach ní bheidh sé níos mó ná deich lá i ndiaidh foillsiú an fhógra san agus déanfar gach tagairt san Acht so do bhunú an Bhúird mar phonc aimsire do léiriú mar thagairt don dáta a bheidh ainmnithe amhlaidh sa bhfógra san.
Céad chruinniú an Bhúird.
12.—(1) Chó luath agus is féidir é tar éis bunú an Bhúird déanfidh an tAire, tré fhógra i scríbhinn do chur tríd an bpost go dtí gach ball den Bhord, am agus áit do cheapa do chéad chruinniú an Bhúird.
(2) Tiocfidh an Bord le chéile san am agus san áit a ceapfar fén alt so dá chéad chruinniú agus leis sin tosnóidh sé ar a dhualgaisí fén Acht so do chólíona agus go sonnrách cromfa sé, ag an gcruinniú san no chó luath agus is féidir é ina dhiaidh sin, ar an gclár do bhunú.
Na baill ainmnithe den Bhord d'ainmniú.
13.—(1) Dhá mhí ar a mhéid no mí ar a laighead roimh gach deire bheidh le téarma oifige na mball n-ainmnithe den Bhord cuirfidh an Bord go dtí gach ceann de sna cóluchtaí 'na bhfuil teideal acu fén Acht so baill den Bhord d'ainmniú leitir ag cur dáta an deire sin in úil don chólucht san agus á iarraidh ar an gcólucht san daoine d'ainmniú chun teacht chun bheith agus chun bheith ina mbaill den Bhord ar theacht don deire sin, pé méid daoine go bhfuil teideal ag an gcólucht san fén Acht so iad d'ainmniú i gcóir na tréimhse cúig mblian dar tosach an deire sin.
(2) Déanfidh gach cólucht a bheidh ag ainmniú baill den Bhord ainm an té a ainmneoidh sé amhlaidh do chur in úil i scríbhinn don Aire, más roimh bhunú an Bhúird an déanfar an t-ainmniú, agus don Bhord más tar éis bunú an Bhúird a déanfar an t-ainmniú, agus ní bheidh aon ainmniú den tsórt san iomlán go dtí go mbeidh ainm an té a hainmneofar curtha in úil don Aire no don Bhord (pe'ca aca é) amhlaidh ag an gcólucht a bheidh ag déanamh an ainmnithe sin.
Toghacháin na mball toghtha den Bhord.
14.—(1) Roimh gach deire bheidh le téarma oifige na mball toghtha den Bhord comórfidh an Bord toghachán do réir an Achta so chun pé méid agus pé aicmí ball toghtha den Bhord a horduítear leis an Acht so do thogha i gcóir na tréimhse cúig mblian dar tosach an deire sin agus comórfidh agus stiúróidh sé an toghachán san i slí go mbeidh sé críochnuithe roimh thosach téarma oifige na mball ach ní níos mó ná dhá sheachtain roimhe.
(2) Gach toghachán a comórfar tar éis bunú an Bhúird chun baill toghtha den Bhord do thogha stiúrófar é do réir scéime a ullamhóidh an Bord, go generálta no i gcóir an toghacháin áirithe sin, le haontú an Aire, agus socrófar le gach scéim den tsórt san chun an vótáil i ngach toghachán a comórfar fúithi do dhéanamh tríd an bpost agus chun an vótáil sin do bheith seicréideach.
Oifigigh agus seirbhísigh an Bhúird.
15.—(1) Ceapfidh an Bord clárathóir (dá ngairmtear an clárathóir san Acht so) agus féadfidh an Bord pé oifigigh agus seirbhísigh eile is dó leis is ceart do cheapa.
(2) Gheobhaidh an clárathóir agus gach oifigeach agus seirbhíseach eile don Bhord pé luach saothair agus beid fé réir pé coiníollacha seirbhíse a ordóidh an Bord.
Dualgaisí an chlárathóra.
16.—(1) Beidh sé de dhualgas ar an gclárathóir an clár do chimeád agus pé iontrála agus scrios amach do dhéanamh ann go n-ordóidh an Bord do le rialacháin a déanfar fén Acht so iad do dhéanamh ann agus chuige sin féadfidh an Bord leis na rialacháin sin comhachta agus dualgaisí an Bhúird fén Acht so maidir leis an gclár do leigint chun an chlárathóra, pé cinn acu a bhaineann le riarachán agus nách gá aon discréid chun iad d'fheidhmiú no a húdaruítear leis an Acht so a leigint chuige amhlaidh.
(2) Gníomhóidh an clárathóir fós mar rúnaí don Bhord agus cólíonfa sé pé dualgaisí eile agus go sonnrách pé dualgaisí, maidir le hullamhú, le clóbhuala, le foillsiú agus le díol clár na bhfiaclóirí, a ordóidh an Bord.
Cuntaisí an Bhúird agus a n-iniúcha.
17.—(1) Cimeádfidh an Bord, i pé fuirm a cheadóidh an tAire tar éis do dul i gcomhairle leis an Aire Airgid, gach cuntas is ceart agus is gnáth ar gach airgead a gheobhaidh no a chaithfidh an Bord.
(2) Iniúchfar cuntaisí an Bhúird uair amháin ar a laighead gach bliain ag iniúchóir a cheapfidh an tAire chuige sin agus isé an tAire a shocróidh táillí an iniúchóra san agus isé an Bord a íocfidh na táillí sin agus fós costaisí generálta na n-iniúcha san.
(3) Chó luath agus is féidir é tar éis gach iniúchta fén alt so ar chuntaisí an Bhúird cuirfidh an Bord fé ndeár na cuntaisí sin agus deimhniú agus tuairisc an iniúchóra ortha do chlóbhuala, d'fhoillsiú, agus do chur ar díol tré n-a gcur isteach san imleabhar ina mbeidh clár na bhfiaclóirí no mar imleabhar fé leith agus díreach tar éis gach foillsithe den tsórt san tíolaicfidh an Bord don Aire agus do gach Tigh den Oireachtas cóip de sna cuntaisí sin agus den deimhniú agus den tuairisc sin ortha mar a bheid clóbhuailte agus foillsithe amhlaidh.
Táillí a bheidh le n-íoc le baill den Bhord.
18.—Iocfidh an Bord le baill an Bhúird táillí ar son bheith láithreach ag á chruinnithe agus costaisí taistil i dtaobh teacht i láthair amhlaidh, pé táillí agus costaisí a shocróidh an Bord le haontú an Aire agus le toiliú an Aire Airgid.
Costaisí an Bhúird agus an Aire.
19.—(1) Is amach as airgead a sholáthróidh an tOireachtas, sa mhéid go gceadóidh an tAire Airgid é, a híocfar gach costas fé n-a raghaidh an Bord i bhfeidhmiú an Achta so go ceann bliana tar éis bunú an chláir.
(2) Isé an Bord a íocfidh, amach as a chuid airgid féin, gach costas fé n-a raghaidh an Bord tar éis bliana tar éis bunú an chláir.
(3) Is amach as airgead a sholáthróidh an tOireachtas, sa mhéid go gceadóidh an tAire Airgid é, a híocfar gach costas fé n-a raghaidh an tAire i bhfeidhmiú an Achta so.
Airgead a gheobhaidh an Bord do chur chun críche.
20.—Iocfidh an Bord, amach as an airgead a gheobha sé i bhfuirm táillí no ar aon tslí eile, na costaisí fé n-a raghaidh Comhairle na nDochtúirí Leighis i bhfeidhmiú a ndualgas fén Acht so (isé an tAire a shocróidh méid na gcostas san mara gcó-aontuítear ortha) agus na costaisí a bheidh ar an mBord agus a cheanglann an tAcht so ar an mBord d'íoc amach as a chuid airgid féin agus cuirfe sé an barrachas (más ann do) a bheidh fágtha den airgead san chun crícheanna a bhaineann le hoideachas agus le lorgaireacht maidir le fiaclóireacht no chun aon chrícheanna puiblí a bhaineann le gairm na fiaclóireachta i pé slí a shocróidh an Bord.
An Bord do dhéanamh rialachán.
21.—Féadfidh an Bord, le rialacháin a dhéanfa sé, gach ní no éinní acu so a leanas d'ordú, sé sin le rá:—
(a) an nós-imeachta a leanfidh an Bord ag á chruinnithe agus eile,
(b) an clár do choinneáil ar siúl agus do chimeád go generálta agus, le haontú an Aire, fuirm an chláir,
(c) an fhuirm agus an modh ar a n-iarrfar go ndéanfaí clárú sa chlár agus an fhianaise bheidh le tabhairt, le linn an iarratais sin, ar theideal an iarratasóra chun a chláruithe amhlaidh,
(d) fé réir forálacha an Achta so agus aontú an Aire, na táillí a bheidh le n-íoc ar son daoine do chlárú agus ar son daoine do chimeád sa chlár,
(e) clár na bhfiaclóirí d'ullamhú, do chlóbhuala, d'fhoillsiú, agus do dhíol go generálta agus, le haontú an Aire, fuirm chlár na bhfiaclóirí,
(f) stiúrú agus nós-imeachta fiosrúchán ar iompar daoine cláruithe adeirtar a bheith ciontach in iompar náireach no aithiseach maidir le n-a ngairm,
(g) sa mhéid go n-údaruítear é leis an Acht so, comhachta agus dualgaisí an Bhúird maidir leis an gclár do leigint chun an chlárathóra,
(h) éinní no aon rud dá dtagartar san Acht so mar ní no mar rud a bheidh orduithe no le hordú le rialacháin a dhéanfidh an Bord agus ná luaidhtear anso roimhe seo go soiléir.
An tAire d'fheidhmiú feidhmeanna an Bhúird.
22.—(1) Más deimhin leis an Aire aon uair, tar éis pé fiosrúchán is oiriúnach leis an Aire do dhéanamh no gan fiosrúchán den tsórt san do dhéanamh, gur theip ar an mBord ar aon ócáid éinní no aon rud do dhéanamh a húdaruítear don Bhord no a ceangailtear air, leis an Acht so, do dhéanamh agus 'na raibh a dhéanamh ag an mBord ar an ócáid sin riachtanach no oiriúnach, dar leis an Aire, chun na feidhmeanna no na dualgaisí a bronntar no a forchuirtar ar an mBord leis an Acht so d'fheidhmiú sa cheart, féadfidh an tAire, le ordú, a ordú don Bhord an ní no an rud san do dhéanamh agus, chun na críche sin, pé nithe no rudaí eile do dhéanamh a chabhruíonn no a bhaineann leis sin agus a luadhfar san ordú san.
(2) Má theipeann ar an mBord na horduithe bheidh in ordú a dhéanfidh an tAire fén alt so do chólíona, féadfidh an tAire féin pé nithe is oiriúnach leis do dhéanamh chun na horduithe a bheidh san ordú san do chólíona agus chuige sin beidh ag an Aire na cirt agus na comhachta a bronntar ar an mBord leis an Acht so agus féadfa sé iad d'fheidhmiú, pé cinn acu is gá chun na horduithe sin do chólíona go cuibhe.
Bunú an chláir.
23.—(1) Chó luath agus is féidir é tar éis bunú an Bhúird ullamhóidh agus bunóidh an Bord clár d'fhiaclóirí ar a dtabharfar “An Clár d'Fhiaclóirí do Shaorstát Éireann” agus dá ngairmtear an clár san Acht so.
(2) Chó luath agus bheidh an Bord i gcothrom chun dáta do cheapa chun an clár do bhunú agus, pé scéal é, fé cheann deich mí ar a mhéid tar éis rithte an Achta so cuirfidh an Bord in úil i scríbhinn don Aire an dáta (nách luatha ná dhá mhí tar éis a churtha in úil amhlaidh ná nách déanaí ná bliain tar éis rithte an Achta so) ar ar mian leo go mbunófí an clár agus leis sin déanfidh an tAire, le fógra a fhoillseoidh sé san Iris Oifigiúil, a fhaisnéis go mbunófar an clár ar an dáta san no ar pé dáta níos déanaí ná san is oiriúnach leis an Aire a luadh sa bhfógra san agus go mbeidh sé bunuithe ón dáta san amach.
(3) Déanfar an fógra a bheidh le foillsiú san Iris Oifigiúil do réir an fho-ailt sin roimhe seo d'fhoillsiú amhlaidh mí ar a laighead roimh an dáta a bheidh luaidhte sa bhfógra san chun an clár do bhunú.
(4) Déanfar gach tagairt san Acht so do bhunú an chláir mar phonc aimsire do léiriú mar thagairt don dáta a fhaisnéisfidh an tAire fén alt so a bheith mar dháta ar a mbunófar an clár agus o n-a mbeidh sé bunuithe.
(5) O bhunú an chláir agus dá éis sin déanfidh an Bord an clár do choinneáil ar siúl agus do chimeád do réir an Achta so agus do réir na rialachán a dhéanfidh an Bord fén Acht so.
(6) Is i pé fuirm a ordóidh an Bord, le haontú an Aire, a bheidh an clár.
Ceartú an chláir.
24.—(1) Chun an clár do chimeád ceart déanfidh an Bord o am go ham fé mar is gá é gach earráid fhocail no chléireachais sa chlár do cheartú, gach iontráil ann a tugadh chun críche tré chalaois no tré mhí-aithris chúise do chur amach as, gach atharú a thiocfidh in eolas dóibh ar sheolta na ndaoine bheidh cláruithe sa chlár d'iontráil ann, agus ainmneacha na ndaoine uile a bheidh tar éis bháis no a bheidh scurtha de bheith i dteideal a n-ainmneacha do chimeád ar an gclár de dheascaibh gan táillí d'íoc do chur amach as an gclár.
(2) Feadfidh an Bord aon uair, ar pé téarmaí agus o pé dáta is dó leo is ceart, ainm éinne, gur cuireadh a ainm amach as an gclár tré earráid ar an scór go raibh sé marbh no gur cuireadh a ainm amach as an gclár mar gheall ar gan táillí d'íoc, do chur thar n-ais sa chlár.
(3) Féadfidh an Bord, le rialacháin a déanfar fén Acht so, gach ceann no aon cheann dá gcomhachta agus dá ndualgaisí fén alt so do leigint chun an chlárathóra ach amháin an chomhacht chun ainm do chur thar n-ais sa chlár.
Fógra ón gclárathóir i dtaobh báis duine chláruithe.
25.—Déanfidh gach clárathóir básanna, ar fháil fhógra dho i dtaobh éinne atá cláruithe sa chlár do bheith tar éis bháis, deimhniú fé n-a láimh do chur láithreach tríd an bpost chun an chlárathóra á dheimhniú go bhfuil an duine sin tar éis bháis agus mion-innste ann ar am agus ar áit bháis an duine sin, agus féadfa sé costas an deimhnithe sin agus costas a churtha chun an chlárathóra d'éileamh mar chostas a bhaineann le n-a oifig mar chlárathóir básanna.
Na daoine a bheidh i dteideal a gcláruithe le linn bunú an chláir.
26.—(1) Ach an táille orduithe d'íoc, clárófar sa chlár le linn a bhunuithe—
(a) gach éinne bhí ina fhiaclóir chláruithe díreach roimh bhunú an chláir agus a bhí ina chomhnaí i Saorstát Éireann an uair sin, agus
(b) gach éinne bhí ina fhiaclóir chláruithe díreach roimh bhunú an chláir agus a bhí ina chomhnaí lasmuich de Shaorstát Éireann an uair sin agus a iarrfidh ar an mBord laistigh de mhí roimh an mbunú san go gclárófí sa chlár é.
(2) Chun crícheanna an ailt seo tuigfar duine do bheith ina chomhnaí ag á sheola mar a bheidh sé ráite sa Chlár Ghenerálta d'Fhiaclóirí.
Na daoine a bheidh i dteideal a gcláruithe tar éis bunú an chláir.
27.—(1) Tar éis bunú an chláir beidh ag na daoine seo a leanas, ar dhéanamh an iarratais orduithe agus ar íoc na dtáillí orduithe, teideal (ach i gcás dá bhforáltar a mhalairt leis an alt so) chun a gcláruithe sa chlár, sé sin le rá:—
(a) gach éinne a bheidh le linn an iarratais sin cláruithe sa Chlár Ghenerálta d'Fhiaclóirí, agus
(b) gach éinne a bheidh le linn an iarratais sin i seilbh chéime no cheadúnais i máinliaghacht fhiacal do deonadh ag príomh-scoil no ag coláiste i Saorstát Éireann ag á raibh, le linn deonta na céime no an cheadúnais sin, comhacht chun a dheonta.
(2) Einne gur scrios an Bord a ainm amach as an gclár de dheascaibh é d'fháil ciontach i dtréasún no i bhfeleontacht, i mí-iompar, i gcoir, no i gcionta, no gur scriosadh a ainm amach as le hordú Chomhairle na nDochtúirí Leighis de dheascaibh gur tugadh breith air é bheith ciontach in iompar náireach no aithiseach maidir le n-a ghairm, ní bheidh sé i dteideal a ainm do chur thar n-ais sa chlár do fén alt so de bhíthin a bheith cláruithe sa Chlár Ghenerálta d'Fhiaclóirí agus dá bhíthin sin amháin.
(3) Ní bheidh ag duine ná beidh cláruithe sa chlár cheana féin teideal chun a chláruithe ann fén alt so má dineadh, aon uair roimh a iarratas ar a chlárú amhlaidh, a ainm do scrios amach as an gClár Generálta d'Fhiaclóirí de dheascaibh é d'fháil cion tach i bhfeleontacht, i mí-iompar, i gcoir no i gcionta no de dheascaibh gur tugadh breith air é bheith ciontach in iompar náireach no aithiseach maidir le n-a ghairm.
Na daoine a luaidhtear sa Tríú Sceideal do chlárú.
28.—(1) Bainfidh an t-alt so leis na daoine uile agus fé seach a hainmnítear sa Tríú Sceideal a ghabhann leis an Acht so agus fós le haon duine a chuirfidh ina luighe ar an Aire roimh bhunú an Bhúird, no ar an mBord tar éis bunú an Bhúird, go bhfuil na coiníollacha so a leanas cólíonta aige, sé sin le rá:—
(a) gur shaoránach de Shaorstát Éireann é an 1adh lá d'Eanair, 1928, agus
(b) gur fiaclóireacht do chleachta i Saorstát Éireann ba phrímh-shlí maireachtana dho ar feadh na tréimhse iomláine de dheich mbliana díreach roimh rith an Achta so, agus
(c) ná raibh sé ciontach aon uair in aon choir ná iompar do chuirfadh fé ndeár é chur as an gclár dá mba fhiaclóir cláruithe é an uair sin.
(2) Chun na gcrícheanna a bhaineann leis an alt so do chur i mbaint le duine ba cheárdaí fiaclóireachta roimh rith an Dentists Act, 1921, tuigfar go bhfoluíonn an focal “fiaclóireacht do chleachta” sa bhfo-alt san roimhe seo an obair is gnáth le ceárdaí fiaclóireachta do dhéanamh.
(3) Ar aon cheann de sna scrúduithe i bhfiaclóireacht a hordófar agus a comórfar fén alt so do rith dho agus ar an iarratas orduithe do dhéanamh agus na táillí orduithe d'íoc beidh gach éinne le n-a mbaineann an t-alt so i dteideal a chláruithe sa chlár.
(4) Déanfar dhá scrúdú d'ordú agus do chomóra fén alt so, agus comórfar an chéad cheann acu tar éis bheith caithte do chúig mhí agus roimh bheith caithte do shé mhí o rith an Achta so agus comórfar an dara ceann acu tar éis bheith caithte d'aon mhí dhéag agus roimh bheith caithte do bhliain o rith an Achta so.
(5) Más roimh bhunú an Bhúird a comórfar scrúdú a hordófar agus a comórfar fén alt so isé an tAire a ordóidh agus a chomórfidh é, agus más tar éis bunú an Bhúird a comórfar é isé an Bord a ordóidh agus a chomórfidh é.
(6) Ní oibreoidh éinní san Acht so chun éinne le n-a mbaineann an t-alt so do thoirmeasc ar fhiaclóireacht no ar mháinliaghacht fhiacal do chleachta ná ar a chur in úil ná ar a thabhairt le tuisgint go gcleachtann sé ceachtar acu no go bhfuil sé ullamh ar cheachtar acu do chleachta i rith na tréimhse idir rith an Achta so agus foillsiú tora an dara scrúduithe a comórfar fén alt so.
(7) Gach éinne le n-a mbaineann an t-alt so agus a bheidh cláruithe sa chlár fén alt so agus a bheidh ina chomhnaí i Saorstát Éireann beidh sé, faid a bheidh sé cláruithe amhlaidh agus an comhnaí sin air, i dteideal chun vótáil agus chun a thoghtha i dtoghachán a comórfar do bhaill toghtha an Bhúird tar éis a chláruithe amhlaidh, fé is dá mbeadh sé cláruithe sa chlár de bhua clárú roimhe sin sa Chlár Ghenerálta d'Fhiaclóirí fé alt 3 den Dentists Act, 1921.

29.—Tuigfar chun crícheanna an Achta so gach éinne dá n-ainmnítear sa Cheathrú Sceideal a ghabhann leis an Acht so do bheith cláruithe le linn rithte an Achta so sa Chlár Ghenerálta d'Fhiaclóirí fé alt 3 den Dentists Act, 1921, agus beidh aige dá réir sin go dtí bunú an chláir gach ceart, maidir le cleachta, vótáil, agus eile, a bronntar leis an Acht so ar dhaoine atá cláruithe amhlaidh agus beidh sé leis (ach an táille orduithe d'íoc) i dteideal a chláruithe sa chlár le linn a bhunuithe.
Fiaclóirí coigríche.
30.—(1) Einne a tréineáladh agus a bheidh de thurus na huaire cláruithe mar fhiaclóir, mar mháinliaigh fhiacal, no mar fhiaclóir mháinliaghachta in aon tsealbhachas Briotáineach, tiarnas féinrialtach, no tír choigríoch a bheidh de thurus na huaire admhuithe ag an mBord chun crícheanna an ailt seo, beidh aige, ar dhéanamh an iarratais orduithe agus ar íoc na dtáillí orduithe dho, teideal chun a chláruithe sa chlár.
(2) Féadfidh an Bord, chun crícheanna an ailt seo, aon tsealbhachas Briotáineach, tiarnas féin-rialtach, no tír choigríoch d'admháil ina mbeidh i bhfeidhm, le linn na hadmhála san, reachtúchán—
(a) le n-a socruítear go ndéanfidh údarás puiblí daoine a chleachtann fiaclóireacht do chlárú, agus
(b) le n-a n-éilítear i gcóir an chláruithe sin standard tréineála agus eolais is dó leis an mBord do bheith chó hárd ar a laighead leis an standard tréineála agus eolais is gá chun ceart d'fháil chun bheith cláruithe fén Acht so, agus
(c) le n-a socruítear go gceadófar daoine bheidh cláruithe fén Acht so do chlárú fén reachtúchán san ar théarmaí is dó leis an mBord a bheith i gcó-ionannas réasúnta leis na téarmaí ar a gceaduítear daoine atá cláruithe fén reachtúchán san do chlárú fén Acht so.
(3) Féadfidh an Bord aon uair scur d'aon tsealbhachas Briotáineach, tiarnas féin-rialtach no tír choigríoch d'admháil chun crícheanna an ailt seo a bhí admhuithe amhlaidh roimhe sin.
(4) San Acht so gairmtear fiaclóirí coigríche de dhaoine a bheidh cláruithe sa chlár fén alt so.
Daoine a ciontófar i gcoireanna do scriosa amach as an gclár.
31.—(1) Pé uair a déanfar duine bheidh cláruithe sa chlár do chiontú i Saorstát Éireann i dtréasún no i bhfeleontacht no i mí-iompar no do chiontú lasmuich de Shaorstát Éireann i gcoir no i gcionta do bheadh ina fheleontacht no ina mhí-iompar dá mba i Saorstát Éireann a déanfí é, féadfidh an Bord ainm an duine sin do scriosa amach as an gclár.
(2) Féadfar duine gur scriosadh a ainm amach as an gclár fén alt so do chur thar n-ais sa chlár le hordú ón Ard-Chúirt fén Acht so no aon uair le hordú speisialta ón mBord ach ní har aon tslí eile agus nuair a dhéanfidh an Bord duine do chur thar n-ais sa chlár amhlaidh féadfidh an Bord pé coiníollacha (agus ortha san táille d'íoc nách mó ná an táille do bheadh iníoctha ag an duine sin ar son a chláruithe dá mba mar an gcéad uair do bheadh sé á chlárú an uair sin) is oiriúnach leis an mBord do cheangal le n-a chur thar n-ais amhlaidh.
Daoine a gheobhfar ciontach in iompar náireach no aithiseach do scriosa amach as an gclár.
32.—(1) Féadfidh an Bord aon uair fiosrúchán do chomóra no ball no baill den Bhord do cheapa chun fiosrúchán do chomóra i dtaobh iompair éinne bheidh cláruithe sa chlár agus 'na gcuirfar ina leith é bheith ciontach in iompar náireach no aithiseach maidir le n-a ghairm agus déanfidh an Bord amhlaidh ar iarratas o aon phríomh-scoil no coláiste i Saorstát Éireann ag á mbeidh comhacht de thurus na huaire chun deimhnithe do dheona go bhfuiltar oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta.
(2) Más rud é, de bharr fiosrúcháin a comórfar fén bhfo-alt san roimhe seo no de bharr tuarasgabhála a gheobhaidh an Bord o Bhord Ghenerálta na bhFiaclóirí ar fhiosrúchán a chomór an Bord san, go bhfuighidh an Bord an té 'nar comóradh an fiosrúchán san i dtaobh a iompair do bheith ciontach in iompar náireach no aithiseach maidir le n-a ghairm féadfidh an Bord, más oiriúnach leis é, ainm an duine sin do scriosa amach as an gclár.
(3) Feádfar duine gur scriosadh a ainm amach as an gclár fén alt so do chur thar n-ais sa chlár le hordú ón Ard-Chúirt fén Acht so no aon uair le hordú speisialta ón mBord ach ní har aon tslí eile agus nuair a dhéanfidh an Bord duine do chur thar n-ais sa chlár amhlaidh féadfidh an Bord pé coiníollacha (agus ortha san táille d'íoc nách mó ná an táille do bheadh iníoctha ag an duine sin ar son a chláruithe dá mba mar a gceád uair do bheadh sé á chlárú an uair sin) is oiriúnach leis an mBord do cheangal le n-a chur thar n-ais amhlaidh.
Athchomhaire chun na hArd-Chúirte.
33.—(1) Pé uair a dhiúltóidh an Bord do dhuine do chlárú sa chlár d'iarr é do chlárú ann no a scriosfa sé ainm éinne amach as an gclár déanfidh an Bord fógra i scríbhinn i dtaobh an diúltuithe no an scriosta amach san agus i dtaobh na cúise bhí leis do chur tríd an bpost láithreach chun an duine sin.
(2) Pé uair a dhiúltóidh an Bord no a theipfidh air duine do chlárú sa chlár d'iarr é do chlárú ann no a scriosfa sé ainm éinne amach as an gclár féadfidh an duine sin athchomharc do dhéanamh chun na hArd-Chúirte do réir rialacha cúirte i gcoinnibh an diúltuithe, an teipthe, no an scriosta amach san laistigh de ráithe tar éis do fógra d'fháil ón mBord fén alt so i dtaobh an diúltuithe no an scriosta amach san no, má theip ar an mBord é do chlárú, laistigh de shé mhí tar éis do a iarraidh go gclárófí amhlaidh é agus, ar éisteacht aon athchomhaire den tsórt san di, féadfidh an Ard-Chúirt pé orduithe is dó léi is ceart do thabhairt uaithi agus ortha san ordú go ndéanfí ainm an athchomharcaigh do chlárú no do chur thar n-ais sa chlár chun bheith air ar agus o dháta ordú na Cúirte no ar agus o aon dáta roimhe sin agus orduithe i dtaobh conus a híocfar costaisí an athchomhaire.
(3) Ar éisteacht athchomhaire di fén alt so i gcoinnibh scriosta amach do dineadh mar gheall ar an athchomharcach d'fháil ciontach in iompar náireach no aithiseach maidir le n-a ghairm, féadfidh an Ard-Chúirt, más dó léi gur ceart san a dhéanamh, fianaise do ghlaca agus do bhreithniú o dhaoine údarásacha i ngairm na dochtúireachta no i ngairm na fiaclóireachta i dtaobh cad is iompar náireach no aithiseach ann maidir le gairm.
(4) Pé uair a ordóidh an Ard-Chúirt, de bharr athchomhaire fén alt so, ainm duine do chlárú no do chur thar n-ais sa chlár déanfidh an Bord ainm an duine sin do chlárú no do chur thar n-ais (pe'ca aca é) sa chlár díreach do réir an orduithe sin.
(5) Ní bheidh dul siar ar an mbreith a thabharfidh an Ard-Chúirt de bharr athchomhaire fén alt so agus ní féadfar athchomharc do dhéanamh chun aon Chúirte eile ina coinnibh.

34.—(1) Pé uair a dhéanfidh an Bord fiosrúchán do chomóra no aon bhaill no ball den Bhord do cheapa chun fiosrúchán do chomóra fén Acht so i dtaobh iompair éinne 'na gcuirfar ina leith é bheith ciontach in iompar náireach no aithiseach maidir le n-a ghairm beidh comhacht ag an mBord no ag na baill no ag an mball a ceapfar amhlaidh (pe'ca aca é) fínnithe do ghairm chun teacht i láthair ag an bhfiosrúchán san agus iad do cheistiú fé mhionn agus, chuige sin, na fínnithe sin do chur fé mhionn agus a chur fhiachaint ar na fínnithe sin scríbhinní a bheidh fé n-a gcomhacht no fé n-a gcúram do thabhairt i láthair, sé sin, aon scríbhinní gur dó leis an mBord no leis na baill no leis an mball san (pe'ca aca é) gur gá chun críche an fhiosrúcháin sin iad do thabhairt i láthair.
(2) Gach éinne go dteipfidh air, ar a ghairm go cuibhe don Bhord no d'aon bhaill no ball den tsórt san roimhráite, teacht i láthair ag fiosrúchán a comórfar fén alt so no, ar bheith i láthair do amhlaidh mar fhínné, a dhiúltóidh do mhionn do thabhairt no d'fhianaise do thabhairt uaidh no do scríbhinn fé n-a chomhacht no fé n-a chúram do thabhairt i láthair nuair a héileofar san air fén alt so, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar fíneáil ná raghaidh thar deich bpúint do chur air.
(3) An té go mbeidh a iompar fé scrúdú ag fiosrúchán a comórfar fén alt so beidh teideal aige chun éisteacht d'fháil agus chun fianaise do thabhairt i láthair, agus, más mian leis é, chun ionadaíochta tré atúrnae agus tré abhcóide ag an bhfiosrúchán san.
An clár d'fhiaclóirí.
35.—(1) Déanfidh an Bord gach bliain a chur fé ndeár go gclóbhuailfar, go bhfoillseofar, agus go ndíolfar fén teideal “An Clár d'Fhiaclóirí Shaorstáit Éireann” (dá ngairmtear an clár d'fhiaclóirí san Acht so) liost cruinn, i pé fuirm a ordóidh an Bord le haontú an Aire, d'ainmneacha na ndaoine uile go mbeidh a n-ainmneacha iontrálta sa chlár an chéad lá den bhliain sin.
(2) Le toiliú an Aire féadfidh an Bord, más dó leis gur ceart é, staona ón gclár d'fhiaclóirí d'fhoillsiú an bhliain a bunófar an clár, ach má fhoillsíonn an Bord an clár d'fhiaclóirí an bhliain sin beidh an clár san d'fhiaclóirí ina liost d'ainmneacha na ndaoine uile go mbeidh a n-ainmneacha iontrálta sa chlár an lá tar éis bunú an chláir.
(3) Féadfidh an Bord, le haontú an Aire, ainmneacha fiaclóirí coigríche do chórú i liost fé leith in aon chlár d'fhiaclóirí agus fós féadfa sé, le haontú an Aire, fo-liostaí fé leith do dhéanamh den liost san fé leith agus ainmneacha na ndaoine sin ionta fé seach do tréineáladh agus a bheidh cláruithe i sealbhachaisí Briotáineacha, sna tiarnaisí féin-rialtacha, agus i dtíortha coigríche.
(4) Is ar ord aibítreach sloinnte a déanfar an liost agus gach liost fé leith agus fo-liost d'ainmneacha daoine a bheidh le bheith sa chlár d'fhiaclóirí fén alt so do chórú sa liost, sa liost fé leith, no sa bhfo-liost san, agus ar ord aibítreach ainmneacha baiste i gcás daoine den aon tsloinne amháin, agus beidh ionta, i ndiaidh no os coinne ainm gach éinne den tsórt san, a sheola agus a cháilíochta mar a bheid sa chlár ar an 1adh lá d'Eanair na bliana le n-a mbaineann no, i gcás an chláir d'fhiaclóirí a foillseofar an bhliain a bunófar an clár, mar a bheid sa chlár an lá tar éis bunú an chláir.

(6) Deimhniú a thugann le tuisgint go bhfuil sé sighnithe ag an gclárathóir agus go ndeimhníonn sé go raibh duine áirithe cláruithe go cuibhe sa chlár ar lá no ar laetheanta áirithe no ar feadh iomláine tréimhse áirithe, no go raibh duine áirithe gan bheith cláruithe sa chlár ar lá no ar laetheanta áirithe no ar feadh iomláine tréimhse áirithe, no gur dineadh ainm duine áirithe do scriosa amach as an gclár ar lá áirithe, beidh sé, gan cruthú ar shighniú an té a dheabhruíonn bheith tar éis an deimhniú san do shighniú no gan cruthú gurbh é an té sin an clárathóir agus d'ainneoin aon deifríochta idir an deimhniú san agus an clár d'fhiaclóirí, beidh sé ina fhianaise dho-chlaoite ar na nithe a bheidh deimhnithe sa deimhniú san agus leis an deimhniú san.
Ciontaí agus pionóisí maidir leis an gclár.
36.—(1) Gach éinne a dhéanfidh no a thabharfidh chun críche no a chuirfidh fé ndeár go ndéanfar no go dtabharfar chun críche no a chabhróidh no a ghríosóidh chun go ndéanfar no go dtabharfar chun críche, d'fhonn is go gclárófí é féin sa chlár, aon aithris chúise no dearbhú is eol don duine sin a bheith bréagach no calaoiseach, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar príosúntacht i dteanta no d'éamais daor-oibre do chur air ar feadh aon téarma nách sia ná bliain.
(2) Gach éinne a dhéanfidh no a chuirfidh fé ndeár go ndéanfar no a chabhróidh no a ghríosóidh chun go ndéanfar sa chlár, agus san go toiliúil agus go calaoiseach, aon iontráil is eol don duine sin a bheith bréagach no mí-threorach in aon phonc táchtach, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar príosúntacht i dteanta no d'éamais daoroibre do chur air ar feadh aon téarma nách sia ná bliain.
(3) Gach éinne a dhéanfidh go toiliúil agus go bréagach, tar éis bunú an chláir, a chur in úil no a thabhairt le tuisgint gur duine é atá cláruithe sa chlár, no úsáid do bhaint as aon ainm, teideal, iartheideal no tuairisc (pe'ca i bhfocail no i leitreacha dho no go leathrannach i bhfocail agus go leathrannach i leitreacha) a chuirfidh i dtuisgint é bheith cláruithe amhlaidh, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfar fíneáil ná raghaidh thar cúig púint fhichead do chur air.
Tuairiscí ar dhaoine cláruithe.
37.—(1) Gach éinne a bheidh cláruithe sa chlár beidh sé i dteideal an tuairisc fiaclóir no cleachtóir fiaclóireachta do thabhairt air féin agus an tuairisc sin d'úsáid.
(2) Duine a bheidh cláruithe sa chlár—
(a) ní úsáidfe sé aon ainm seachas an ainm fé n-a mbeidh sé cláruithe sa chlár, ná
(b) ní thabharfa sé air féin ná ní úsáidfe sé, ná ní cheanglóidh sé ar a áitreabh ná ní úsáidfe sé ina thaobh, aon teideal ná tuairisc a bhaineann leis féin, le n-a áitreabh, no leis an obair a dhineann sé no a chuirfe sé roimhe le déanamh, agus 'na mbeidh sé do réir réasúin a mheas go dtabharfadh sé le tuisgint aon status no cáilíocht ghairme do bheith aige seachas cáilíocht no status gairme a bheidh aige dáiríribh agus a cuirfar in úil leis na mion-innste ina thaobh a bheidh iontrálta sa chlár.
(3) Féadfar, más rogha leis an mBord é, ainm éinne a ghníomhóidh contrárdha don alt so do scriosa amach as an gclár.
Scrúduithe tástála.
38.—(1) Gach príomh-scoil no coláiste i Saorstát Éireann ag á bhfuil, ar dháta rithte an Achta so, comhacht chun céimeanna i máinliaghacht do dheona féadfa sé o am go ham scrúduithe (dá ngairmtear “scrúduithe tástála” san Acht so) do chomóra chun daoine do thástáil féachaint a bhfuilid oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta agus chun deimhnithe ar iad do bheith oilte amhlaidh do dheona do sna daoine sin de bharr na scrúduithe sin.
(2) Gach éinne a gheobhaidh o aon phríomh-scoil no coláiste den tsórt san roimhráite, tar éis do scrúdú tástála do rith, deimhniú go bhfuil sé oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta beidh sé (i gcás ina ndeonfar an deimhniú san ag aon phríomh-scoil den tsórt san roimhráite) ina chéimneach den phríomh-scoil sin agus beidh sé (i gcás ina ndeonfar an deimhniú san ag aon choláiste den tsórt san roimhráite) ina cheadúnaí den choláiste sin.
Bord de scrúdóirí.
39.—(1) Déanfidh cólucht rialúcháin gach príomh-scoile no coláiste i Saorstát Éireann dá n-údaruítear leis an Acht so scrúduithe tástála i bhfiaclóireacht no i máinliaghacht fhiacal do chomóra, bord (dá ngairmtear bord de scrúdóirí san Acht so) do cheapa do réir forálacha an ailt seo chun na scrúduithe tástala san do stiúrú agus chun deimhnithe oilteachta do dheona do dhaoine de bharr na scrúduithe sin.
(2) Beidh gach bord do scrúdóirí có-dhéanta agus cimeádfar é có-dhéanta de sheisear ar a laighhead agus ceapfar triúr ar a laighead díobh san as daoine a bheidh cláruithe sa chlár.
(3) Beidh gach ball de bhord de scrúdóirí i seilbh oifige mar bhall den tsórt san ar feadh pé tréimhse a shocróidh cólucht rialúcháin na príomh-scoile no an choláiste a cheapfidh é.
(4) Pé uair a thiocfidh folúntas i mballraíocht bhúird de scrúdóirí féadfidh an cólucht rialúcháin do cheap an bord san agus, nuair is gá é chun líon minimum na mball do chimeád iomlán, déanfa sé an folúntas san do líona.
Scrúduithe tástála do stiúrú.
40.—Beidh sé de dhualgas ar gach bord de scrúdóirí stiúrú do dhéanamh, sa tslí a ordóidh an phríomh-scoil no an cólucht do cheap an bord san de scrúdóirí, ar na scrúduithe tástála, i bhfiaclóireacht no i máinliaghacht fhiacal, a chomórfidh an phríomhscoil no an coláiste sin agus deimhnithe do dheona, sa bhfuirm a ordóidh an phríomh-scoil no an coláiste sin, go bhfuiltar oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta.

41.—Gach príomh-scoil agus coláiste dá n-údaruítear leis an Acht so scrúduithe tástála i bhfiaclóireacht no i máinliaghacht fhiacal do chomóra leigfid isteach chun na scrúduithe sin mar iarrthóir gach éinne a bheidh—
(a) tar éis bliain is fiche d'aois do shlánú, agus
(b) tar éis na coiníollacha do chólíona a bheidh, do réir na rialacha de chuid na príomh-scoile no an choláiste sin a bheidh i bhfeidhm de thurus na huaire, le cólíona ag iarrthóirí, a bheidh istigh ar an scrúdú san.
Eolas ar an gcúrsa stuidéir, etc., do thabhairt do Chomhairle na nDochtúirí Leighis.
42.—(1) Gach príomh-scoil no coláiste dá n-údaruítear leis an Acht so scrúduithe tástála i bhfiaclóireacht no i máinliaghacht fhiacal do chomóra agus deimhnithe do dheona, de bharr na scrúduithe sin, go bhfuiltar oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta, tabharfa sé do Chomhairle na nDochtúirí Leighis o am go ham fé mar agus pé uair a cheanglóidh Comhairle na nDochtúirí Leighis air é, pé eolas a cheanglóidh Comhairle na nDochtúirí Leighis air do thabhairt uaidh i dtaobh na scrúduithe sin agus na ndeimhnithe sin agus an chúrsa stuidéir a bheidh le críochnú ag iarrthóirí a bheidh istigh ar na scrúduithe sin agus go generálta i dtaobh na gcoiníoll a bheidh le cólíona sara ndeonfidh an phríomh-scoil no an coláiste sin deimhnithe den tsórt san roimhráite.
(2) Chun é féin do shásamh i dtaobh éinní no aon ruda 'na mbeidh sé ceangailte ar aon phríomh-scoil no coláiste den tsórt san roimhráite fén bhfo-alt san roimhe seo eolas air do thabhairt do Chomhairle na nDochtúirí Leighis, féadfidh Comhairle na nDochtúirí Leighis duine oiriúnach do cheapa, pe'ca ball de Chomhairle na nDochtúirí Leighis an duine sin no nách ea, chun bheith i láthair ag aon scrúdú tástála a chomórfidh an phríomhscoil no an coláiste sin agus féadfidh gach éinne a ceapfar amhlaidh bheith i láthair ag an scrúdú tástála san.

43.—(1) Más léir do Chomhairle na nDochtúirí Leighis aon uair go bhfuil an standard d'eolas theoiriceach no d'eolas phraiticiúil a héilítear ag aon scrúdú tástála gan bheith de shaghas a chuireann in áirithe go mbeidh ag daoine dá ndeonfar de bharr an scrúduithe sin deimhniú ar iad do bheith oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta an t-eolas is gá chun fiaclóireacht no máinliaghacht fhiacal do chleachta go héifeachtúil, féadfidh Comhairle na nDochtúirí Leighis an méid sin do chur in úil don phríomh-scoil no don choláiste sin i scríbhinn.
(2) An phríomh-scoil no an coláiste a chomórfidh an scrúdú tástála le n-a mbaineann fógra den tsórt san roimhráite, féadfa sé, ar dháta nách déanaí ná mí tar éis do an fógra san d'fháil, pé aithris chúise is oiriúnach leis an bpríomh-scoil no leis an gcoláiste sin do dhéanamh ina thaobh agus féadfa sé an aithris chúise sin do chur chun Comhairle na nDochtúirí Leighis.
(3) Breithneoidh Comhairle na nDochtúirí Leighis gach aithris chúise a dhéanfidh aon phríomh-scoil no coláiste den tsórt san roimhráite léi fén alt so agus más deimhin léi fós tar éis an bhreithnithe sin go bhfuil an standard d'eolas a héilítear ag an scrúdú tástála le n-a mbaineann an aithris chúise sin gan bheith de shaghas a chuireann in áirithe go mbeidh ag daoine dá ndeonfar de bharr an scrúduithe sin deimhniú ar iad do bheith oilte chun fiaclóireacht no máinliaghacht fhiacal do chleachta an t-eolas is gá chun fiaclóireacht no máinliaghacht fhiacal do chleachta go héifeachtúil, féadfidh Comhairle na nDochtúirí Leighis a dhearbhú gurb é a tuairim ná déanfidh seilbh an deimhnithe oilteachta san ón bpríomh-scoil no ón gcoláiste sin an té 'na mbeidh sé ar seilbh aige do chur i dteideal a chláruithe sa chlár.
(4) Pé uair a dhéanfidh Comhairle na nDochtúirí Leighis aon dearbhú den tsort san roimhráite cuirfidh Comhairle na nDochtúirí Leighis in úil i scríbhinn don phríomh-scoil no don choláiste le n-a mbaineann an dearbhú san agus fós don Aire go bhfuil sí tar éis an dearbhú san do dhéanamh.
(5) Ar dháta nách déanaí ná mí tar éis do fógra den tsórt san roimhráite d'fháil, agus tar éis do pé fiosrúchán is oiriúnach leis do dhéanamh sa scéal no gan fiosrúchán do dhéanamh, féadfidh an tAire, le hordú, an dearbhú le n-a mbaineann an fógra san do dhaingniú (ar an dáta agus ón dáta a bheidh luaidhte chuige sin san ordú san) no diúltú d'í do dhaingniú.
(6) Féadfidh an tAire aon uair, más oiriúnach leis é, ordú a dineadh fén alt so do cheiliúra le hordú agus, ar dhéanamh an orduithe cheiliúracháin sin, scuirfidh an t-ordú a ceiliúrfar amhlaidh de bheith i bhfeidhm o dháta an orduithe cheiliúracháin sin, ach ní déanfar aon ordú ceiliúracháin den tsórt san ach amháin ar iarratas Comhairle na nDochtúirí Leighis agus tar éis fógra réasúnta do bheith tugtha don phríomh-scoil no don choláiste le n-a mbaineann an t-ordú a beifear ar aigne a cheiliúra agus tar éis breithniú na nótaí (más ann dóibh) do dhin an phríomhscoil no an coláiste sin no ar iarratas na príomh-scoile no an choláiste sin agus tar éis fógra réasúnta do bheith tugtha do Chomhairle na nDochtúirí Leighis agus tar éis breithniú na nótaí (más ann dóibh) do dhin Comhairle na nDochtúirí Leighis.

44.—(1) Nuair a bheidh Comhairle na nDochtúirí Leighis ag feidhmiú a feidhmeanna fén Acht so beidh triúr ball breise uirthi a ceapfar fén alt so agus na cirt agus na príbhléidí uile atá ag baill de Chomhairle na nDochtúirí Leighis beid ag na baill bhreise sin maidir le feidhmiú na bhfeidhmeanna san ach ní níos sia ná san ná maidir le héinní eile.
(2) Ní foláir na baill bhreise sin de Chomhairle na nDochtúirí Leighis do bheith ina bhfiaclóirí cláruithe agus ina mbaill den Bhord agus isé an Bord a cheapfidh iad.
(3) Beidh gach ball breise den tsórt san de Chomhairle na nDochtúirí Leighis i seilbh oifige mar bhall bhreise den tsórt san ar feadh pé tréimhse a shocróidh an Bord agus nách sia ná cúig bliana maran rud é go dtárlóidh do roimhe sin bás d'fháil, eirghe as, scur de bheith ina fhiaclóir chláruithe, no scur de bheith ina bhall den Bhord.

45.—(1) Fé réir forálacha an ailt seo ní bheidh sé dleathach d'éinne, ar dháta rithte an Achta so ná dá éis sin, fiaclóireacht ná máinliaghacht fhiacal do chleachta ná a chur in úil ná a thabhairt le tuisgint, go díreach ná go nea-dhíreach, go gcleachtann sé í no go bhfuil sé ullamh ar í do chleachta, maran fiaclóir cláruithe an duine sin.
(2) I rith na tréimhse idir rith an Achta so agus bunú an chláir éinne a bheadh, cé nách fiaclóir cláruithe do réir bhrí an Achta so é, i dteideal a chláruithe sa chlár (ach táillí d'íoc) dá mbeadh an clár bunuithe an uair sin, féadfa sé, d'ainneoin éinní ina choinnibh sin atá san alt so, fiaclóireacht agus máinliaghacht fhiacal do chleachta agus a chur in úil agus a thabhairt le tuisgint go gcleachtann sé fiaclóireacht agus máinliaghacht fhiacal.
(3) Ní oibreoidh forálacha na bhfo-alt san roimhe seo chun a thoirmeasc—
(a) ar dhochtúir leighis chláruithe fiaclóireacht no máinliaghacht fhiacal do chleachta, ná
(b) ar cheimiceoir chóg aisíochta, ar dhuine is ceimiceoir agus is drugadóir, ná ar dhrugadóir, a bheidh cláruithe go cuibhe ná ar cheadúnaí phoitigeura fiacal do statha, gan aon anæstetic áitiúil ná generálta do thabhairt, i gcásanna fiaclóireachta nách foláir féachaint chúcha láithreach agus nuair ná beidh fiaclóir cláruithe ná dochtúir leighis cláruithe ar fáil chun an statha san do dhéanamh, ná
(c) ar fhiaclóir chláruithe ceárdaithe no príntísigh do bheith ar fostú aige chun aon obair a dintar do ghnáth i siopa oibre fiaclóireachta do dhéanamh fé mhaoirseacht an fhiaclóra chláruithe sin.
(4) Gach éinne a ghníomhóidh contrárdha don alt so beidh sé ciontach i gcionta fén alt so agus dlighfar fíneáil ná raghaidh thar céad punt do chur air in aghaidh gach cionta fé leith den tsórt san ar a chiontú ann ar an slí achmair.

46.—(1) Fé réir forálacha an ailt seo ní bheidh sé dleathach d'aon chólucht corparáideach fiaclóireacht ná máinliaghacht fhiacal do chleachta.
(2) Ní oibreoidh forálacha an fho-ailt sin roimhe seo chun toirmeasc do dhéanamh ar chleachta fiaclóireachta ná máinliaghachta fiacal—
(a) i rith tréimhse dhá bhlian o dháta rithte an Achta so, ag aon chólucht corparáideach do bhí, ar an 30adh lá d'Abrán, 1927, i dteideal fé aon reacht fiaclóireacht no máinliaghacht fhiacal do chleachta agus do bhí ar an dáta san ag gabháil don chleachta san, ná
(b) ag aon óspideul ná ag aon scoil fhiaclóireachta dá n-údaróidh an Bord fiaclóireacht no máinliaghacht fhiacal do chleachta, ná
(c) ag aon bheirt fhiaclóirí cláruithe no níos mó i bpáirtnéireacht.
(3) Gach cólucht corparáideach a chleachtóidh fiaclóireacht no máinliaghacht fhiacal contrárdha d'fhorálacha an ailt seo beidh sé ciontach i gcionta fén alt so agus dlighfar fíneáil nách mó ná céad punt agus nách lú ná caoga punt do chur air in aghaidh gach cionta fé leith den tsórt san ar a chiontú ann ar an slí achmair.
(4) Beidh an bainisteoir agus fós gach stiúrthóir ar chólucht chorparáideach a chleachtóidh fiaclóireacht no máinliaghacht fhiacal contrárdha d'fhorálacha an ailt seo ciontach i mí-iompar agus ar a chiontú ann ar an slí achmair dlighfar fíneáil nách mó ná céad punt agus nách lú ná caoga punt do chur air.

FIRST SCHEDULE.
Co-aontu idir an Bhreatain Mhoir, Saorstat Éireann agus Tuaisceart Éireann, maidir le claru agus rialu fiacloiri.
Agreement between Great Britain, the Irish Free State and Northern Ireland as to the registration and control of dentists.
1.—In this Agreement,
the expression “the Dentists Acts” means the Dentists Acts, 1878 and 1921, and any Acts amending the same;
the expression “the Dental Board” means the Dental Board established under the Dentists Acts;
the expression “the Medical Acts” means the Medical Act, 1858, and the Medical Act, 1886, and any Acts amending the same;
the expression “the General Medical Council” means the General Council established under the Medical Acts;
the expression “medical authorities” means the bodies and universities who choose members of the General Medical Council;
the expression “the Dentists Register” means the register established under the Dentists Acts;
the expression “the Irish Free State Dental Board” means any Board which may hereafter be established by Act of the Oireachtas of the Irish Free State for the purpose of registering and controlling dentists in the Irish Free State;
the expression “the Irish Free State Dentists Register” means any register of dentists which the Irish Free State Dental Board may by any such Act of the Oireachtas be required to keep;
the expression “the Irish Free State Medical Council” means any council which may hereafter be established by Act of the Oireachtas of the Irish Free State for the purpose of registering and controlling medical practitioners in the Irish Free State;
the word “formerly” shall be construed as referring to times previous to the establishment of the Irish Free State.
2.—(1) The appointment of a member of the Dental Board as constituted after the expiration of the term of office of the first members of that Board required to be made by the Lord Lieutenant of Ireland shall henceforth be made by the Governor of Northern Ireland.
(2) Subject to the provisions of sub-paragraph (1) of this paragraph, the appointment of the appointed members and the election of the elected members of the Dental Board as so constituted as aforesaid shall be made and had in like manner in all respects as the same were formerly required to be made and had respectively.
(3) Nothing in this Agreement shall affect the tenure of office of any member of the Dental Board who holds office at the date on which this Agreement takes effect.
3.—Subject to the provisions of this Agreement and notwithstanding anything contained in the Irish Free State Constitution Act, 1922, or the Irish Free State (Consequential Provisions) Act, 1922, or the Constitution of the Irish Free State (Saorstát Éireann) Act, 1922, passed by the Provisional Parliament of Ireland, or the Adaptation of Enactments Act, 1922, passed by the Oireachtas of the Irish Free State, or any Order made under any of those Acts the constitution of the Dental Board under the Dentists Act and the powers of holding examinations for the purpose of testing the fitness of persons to practise dentistry or dental surgery, and of granting certificates of such fitness for the purpose of registration in the Dentists Register formerly vested in the Dental Board or the medical authorities in Ireland shall be deemed not to have been affected by the establishment of the Irish Free State, and for the purpose of the preparation and keeping of the Dentists Register the Dental Board and the General Medical Council and their respective officers shall have and may exercise in relation to persons, medical authorities and matters in the Irish Free State all such powers, jurisdictions and authorities under the Dentists Acts as the said Board and the said Council had and might exercise under the Dentists Acts for that purpose in relation to persons, medical authorities, and matters respectively in Ireland.
4.—Any person who is or shall be registered in the Dentists Register shall be entitled on payment of such fees as may from time to time be prescribed in that behalf by or in pursuance of any Act of the Oireachtas of the Irish Free State, to be registered in the Irish Free State Dentists Register: Provided that
(a) the fees payable by such persons in respect of such registration shall at no time exceed the fees payable in respect of registration in the Irish Free State Dentists Register by any other person who may be or become entitled to be registered therein, and
(b) no person whose name has been erased from the Irish Free State Dentists Register on account of his having been convicted of a felony, misdemeanour, crime or offence or having been found guilty of infamous or disgraceful conduct in a professional respect shall be entitled to be subsequently registered in the said Register solely by reason of his being registered in the Dentists Register, and
(c) a person not previously registered in the Irish Free State Dentists Register shall not be entitled to be registered therein if his name has been erased from the Dentists Register on account of his having been convicted of a felony, misdemeanour, crime or offence or having been found guilty of infamous or disgraceful conduct in a professional respect.
5. In the event of any examinations of a new university at any time hereafter created in the Irish Free State becoming qualifying examinations in medicine, surgery and midwifery for the purposes of the Medical Acts that university shall have the same powers of holding examinations for the purposes of testing the fitness of persons to practise dentistry or dental surgery, and of granting certificates of such fitness for the purpose of registration in the Dentists Register as if it were a medical authority for the purposes of section 18 of the Dentists Act, 1878.
6. (1) With a view to preventing the holding of simultaneous inquiries—
(a) The Dental Board shall report to the Irish Free State Dental Board every case in which they propose, in connection with the exercise of their disciplinary powers, to hold an inquiry into the conduct in Great Britain or in Northern Ireland of any person registered in the Irish Free State Dentists Register, and the Irish Free State Dental Board shall report to the Dental Board every case in which they propose, in connection with the exercise of their disciplinary powers, to hold an enquiry into the conduct in the Irish Free State of any person registered in the Dentists Register;
(b) The Dental Board upon receipt by them of any such report as aforesaid from the Irish Free State Dental Board, shall have regard to the desirability of postponing inquiry by them into the matter to which such report relates until the inquiry to which such report relates by the Irish Free State Dental Board is completed;
(c) The Irish Free State Dental Board upon receipt by them of any such report as aforesaid from the Dental Board, shall have regard to the desirability of postponing inquiry by them into the matter to which such report relates until the inquiry to which such report relates by the Dental Board is completed.
(2) The Dental Board shall report to the Irish Free State Dental Board every case in which disciplinary action resulting in erasure from the Dentists Register is taken by them against a person registered in the Irish Free State Dentists Register, and the Irish Free State Dental Board shall report to the Dental Board every case in which disciplinary action resulting in erasure from the Irish Free State Dentists Register is taken by them against a person registered in the Dentists Register.
7.—His Majesty's Governments in Great Britain and the Irish Free State respectively shall as soon as possible introduce into their respective Parliaments such legislation as may be necessary to give statutory effect to this Agreement, and this Agreement shall not take effect until such legislation in both such Parliaments shall have been passed into law.

Definitions.
1.—In this Act—
the expression “the Minister” means the Minister for Local Government and Public Health;
the expression “the Board” means the Dental Board constituted by this Act;
the expression “the register” means the Register of Dentists for Saorstát Eireann to be established under this Act;
the expression “the General Council” means the General Council of Medical Education and Registration constituted under the Medical Acts;
the expression “the General Dental Board” means the Dental Board in the United Kingdom as constituted under the Dentists Acts as modified by the Agreement set out in the First Schedule to this Act;
the expression “the General Dentists Register” means the Dentists Register maintained under the Dentists Acts;
the expression “the Medical Council” means the Medical Registration Council constituted under the Medical Practitioners Act, 1927 (No. 25 of 1927);
the expression “registered dentist” means—
(a) in relation to anything done or to be done or an event happening before the establishment of the register, a person who at the time when such thing is done or to be done or such event happens is either registered in the General Dentists Register or, having been so registered at any time after the 1st day of January, 1922, has ceased to be so registered otherwise than by reason of his death or his having been convicted of a felony, misdemeanour, crime, or offence or his having been found guilty of infamous or disgraceful conduct in a professional respect or his registration having been procured by fraud or made by mistake, and
(b) in relation to anything done or to be done or an event happening after the establishment of the register, a person who at the time when such thing is done or to be done or such event happens is registered in the register;
the expression “qualifying examination” means an examination in dentistry or dental surgery held for the purpose of granting certificates of fitness to practise dentistry or dental surgery by any university or college in Saorstát Eireann for the time being having power to grant such certificates;
the expression “practice of dentistry or dental surgery” means the performance of any operation and the giving of any treatment, advice, opinion or attendance usually performed or given by a dental surgeon or dentist and includes the performance of any operation or the giving of any treatment, advice or attendance on or to any person preparatory to or for the purpose of or in connection with the fitting, insertion or fixing of artificial teeth;
the expression “self-governing dominion” means and includes the Dominion of Canada, the Commonwealth of Australia, the Dominion of New Zealand, the Union of South Africa, and New-foundland;
the expression “British possession” does not include Great Britain or Northern Ireland or the self-governing dominions.
Confirmation of Agreement and consequential amendments of the law.
2.—(1) The Agreement set forth in the First Schedule to this Act is hereby confirmed and shall take effect on whichever of the following dates is the later, that is to say, the date of the passing of this Act and the date of the passing into law by the Parliament of the United Kingdom of Great Britain and Northern Ireland of legislation to give statutory effect to the said Agreement.
(2) For the purpose of enabling the said Agreement to have statutory effect in Saorstát Eireann it is hereby enacted that—
(a) the said Agreement, in so far as the terms thereof are inconsistent with the Dentists Acts, shall be deemed to amend or modify to that extent those Acts and those Acts are hereby amended and modified accordingly;
(b) the Dentists Acts as so amended or modified shall be and continue in force in Saorstát Eireann so far as is so provided by the said Agreement or is necessary to enable the said Agreement to have full force and effect in Saorstát Eireann;
(c) save as is otherwise enacted in the foregoing paragraph the Dentists Acts shall cease to have effect on the date of the passing of this Act.
Constitution of the Dental Board.
3.—(1) A board to be styled the Dental Board (in this Act referred to as the Board) shall be established in accordance with this Act to fulfil the functions assigned to it by this Act.
(2) The Board shall be a body corporate having perpetual succession and may provide itself with a seal and may sue and be sued under its said style and name.
(3) The Board shall consist of members who shall be nominated and elected respectively by the several bodies and persons specified in the Second Schedule to this Act and, in the case of elected members, shall be elected from the several classes specified in the Second Schedule to this Act.
Term of office of member of the Board.
4.—(1) Subject to the provisions of this section in relation to persons elected or nominated to fill casual vacancies every member of the Board shall, unless he sooner dies, resigns, or becomes disqualified, hold his office as such member for the term of five years reckoned, in the case of the first members, from the establishment of the Board and, in the case of every subsequent member, from the expiration of the term of office of his predecessor.
(2) A member of the Board elected or nominated to fill a casual vacancy in the Board shall, unless he sooner dies, resigns, or becomes disqualified, hold office for the residue of the term for which the member whose death, resignation, or disqualification occasioned the vacancy would have held office if he had not died, resigned, or become disqualified.
(3) Every member of the Board shall on the cesser of his membership by effluxion of time be eligible for re-election or re-nomination.
Resignation of member of the Board.
5.—A member of the Board may at any time resign his office as such member by letter addressed and sent to the Board and every such resignation shall take effect at the commencement of the meeting of the Board commencing next after the receipt of such resignation by the Board.
Casual vacancies in the Board.
6.—(1) Whenever a vacancy (in this Act called a casual vacancy) occurs in the membership of the Board by reason of the death, resignation, or disqualification of a nominated member, the Board shall forthwith notify the body by which such member was nominated of the occurrence of such vacancy and such body shall as soon as conveniently may be nominate a person to fill such vacancy.
(2) Whenever a vacancy (in this Act called a casual vacancy) occurs in the membership of the Board by reason of the death, resignation, or disqualification of an elected member, the Board shall at its next meeting but one after the occurrence of such vacancy elect a person to fill such vacancy.
(3) Every person nominated or elected under this section to fill a casual vacancy shall be nominated or elected from the class of persons (if any) from which the member whose death, resignation, or disqualification occasioned such vacancy was required to be nominated or elected.
President of the Board.
7.—(1) It shall be the duty of the Board to elect from time to time as occasion requires one of its members to be the President of the Board.
(2) Every President of the Board shall hold office as such President from the date of his election to that office until the happenings of whichever of the following events first happens, that is to say:—
(a) the expiration of his term of office as a member of the Board,
(b) his ceasing to be a member of the Board otherwise than by the expiration of his term of office,
(c) his resigning the office of President of the Board.
Meetings and procedure of the Board.
8.—(1) The Board shall fix the times and places of its meetings and every meeting of the Board subsequent to the first meeting thereof shall be held at the time and place so fixed.
(2) The procedure of the Board at its meetings and otherwise shall be conducted in accordance with the regulations in that behalf made by the Board under this Act.
(3) One-third of the members of the Board shall constitute a quorum.
(4) Every decision to be made by the Board at any meeting thereof shall be made by a simple majority of the members of the Board present at such meeting and voting on such decision.
(5) The President of the Board shall act as Chairman of every meeting thereof at which he is present and in the absence of the President from any such meeting the members of the
Board present at such meeting shall elect one of their number to be the chairman of such meeting.
(6) Whenever at a meeting of the Board an equal number of votes of the members of the Board present and voting is cast for and against a proposed motion or resolution the chairman of such meeting shall, in addition to his vote as a member of the Board, have a casting vote.
(7) The Board may act notwithstanding one or more vacancies in its membership.
First nomination of nominated members of the Board.
9.—(1) As soon as may be after the passing of this Act the Minister shall send to the Medical Council a notice in writing requesting them to nominate three members of the Board.
(2) Not less than three nor more than four weeks after the sending of the notice mentioned in the foregoing sub-section the Minister shall communicate to the Executive Council the names of the members of the Board nominated by the Medical Council and shall at the same time request the Executive Council to nominate a member of the Board.
(3) When the Executive Council has nominated a member of the Board pursuant to the foregoing sub-section the Minister shall by notice in writing sent by post to every member of the Board nominated pursuant to this section appoint a time and place for the first meeting of the nominated members of the Board.
(4) The nominated members of the Board shall meet at the time and place appointed under this section for their first meeting.
First meeting of the nominated members of the Board.
10.—(1) The nominated members of the Board shall at their first meeting and thereafter do the following things, that is to say:—
(a) regulate their procedure and appoint the times and places of their meetings, and
(b) prepare with the approval of the Minister a scheme for holding in accordance with this section an election of elected members of the Board to hold office during the five years next after the establishment of the Board, and
(c) hold such election and communicate to the Minister the names of the persons elected thereat.
(2) The scheme to be prepared under this section for the election of elected members of the Board shall provide for the voting thereat being made by post and for such voting being secret and for the holding of such election at such time and in such manner that the same is completed and the names of the persons elected thereat communicated to the Minister within two months after the first meeting of the nominated members of the Board.
(3) Two nominated members of the Board shall constitute a quorum at the first and every subsequent meeting of the nominated members of the Board.
(4) The powers of the nominated members of the Board under this section shall cease on the establishment of the Board.
The establishment of the Board.
11.—(1) As soon as may be after the completion of the election of elected members of the Board required by this Act to be held by the nominated members of the Board and the communication to the Minister by such nominated members of the names of the persons elected at such election the Minister shall publish in the Iris Oifigiúil a notice declaring the Board to be established as on and from a date named in such notice and stating the names of the persons then elected and nominated in pursuance of this Act to be members of the Board.
(2) The date to be named in the said notice published in the Iris Oifigiúil as the date for the establishment of the Board shall be subsequent to but not more than ten days subsequent to the publication of such notice and all references in this Act to the establishment of the Board as a point in time shall be construed as referring to the date so named in such notice.
First meeting of the Board.
12.—(1) As soon as may be after the establishment of the Board the Minister shall by notice in writing sent by post to every member of the Board appoint a time and place for the first meeting of the Board.
(2) The Board shall meet at the time and place appointed under this section for its first meeting and shall thereupon enter on its duties under this Act and in particular shall at such meeting or as soon as may be thereafter proceed to establish the register.
Nomination of the nominated members of the Board.
13.—(1) Not more than two months nor less than one month before every expiration of the term of office of the nominated members of the Board, the Board shall send to each of the bodies entitled under this Act to nominate members of the Board a letter notifying such body of the date of such expiration and requesting such body to nominate such number of persons to become and be members of the Board on such expiration as such body is entitled under this Act to nominate in respect of the period of five years commencing on such expiration.
(2) Every body nominating a member of the Board shall, in the case of a nomination made before the establishment of the Board, communicate to the Minister and, in the case of a nomination made after such establishment, communicate to the Board in writing the name of the person so nominated by it and no such nomination shall be complete until the name of the person nominated has been so communicated to the Minister or the Board (as the case may be) by the body making such nomination.
Elections of elected members of the Board.
14.—(1) Before every expiration of the term of office of the elected members of the Board, the Board shall hold an election in accordance with this Act of such number and classes of elected members of the Board as are prescribed by this Act in respect of the period of five years commencing on such expiration and shall so hold and conduct such election that the same is completed before but not more than two weeks before the commencement of the term of office of the members.
(2) Every election of elected members of the Board held after the establishment of the Board shall be conducted in accordance with a scheme prepared, either generally or for such particular election, by the Board with the approval of the Minister, and every such scheme shall provide for the voting at every election held thereunder being by post and for such voting being secret.
Officers and servants of the Board.
15.—(1) The Board shall appoint a registrar (in this Act referred to as the registrar) and may appoint such other officers and servants as it thinks proper.
(2) The registrar and every other officer and servant of the Board shall receive such remuneration and be subject to such conditions of service as the Board shall direct.
The duties of the registrar.
16.—(1) It shall be the duty of the registrar to keep the register and to make therein such entries and erasures as he shall be directed by the Board by regulations made under this Act to make therein and for that purpose the Board may by such regulations delegate to the registrar such of the powers and duties of the Board under this Act in relation to the register as are of a ministerial character and do not involve the exercise of any discretion or are authorised by this Act to be so delegated.
(2) The registrar shall also act as secretary of the Board and perform such other duties and in particular such duties in relation to the preparation, printing, publication, and sale of the dental register as the Board shall direct.
Accounts of the Board and the audit thereof.
17.—(1) The Board shall keep in such form as shall be approved by the Minister after consultation with the Minister for Finance all proper and usual accounts of all moneys received or expended by the Board.
(2) The accounts of the Board shall be audited at least once in every year by an auditor appointed for the purpose by the Minister and the fees of such auditor shall be fixed by the Minister and such fees and also the expenses generally of such audits shall be paid by the Board.
(3) As soon as may be after every audit under this section of the accounts of the Board the Board shall cause such accounts and the auditor's certificate and report thereon to be printed, published, and put on sale either by inclusion in the volume containing the dental register or as a separate volume and shall immediately after every such publication present to the Minister and to each House of the Oireachtas a copy of such accounts and such certificate and report thereon as so printed and published.
Fees to be paid to members of the Board.
18.—There shall be paid by the Board to the members thereof such fees for their attendance at its meetings and such travelling expenses in connection with such attendances as shall be determined by the Board with the approval of the Minister and the consent of the Minister for Finance.
Expenses of the Board and of the Minister.
19.—(1) All expenses incurred by the Board in the execution of this Act up to the expiration of one year after the establishment of the register shall, to such extent as shall be sanctioned by the Minister for Finance, be defrayed out of moneys to be provided by the Oireachtas.
(2) All expenses incurred by the Board after the expiration of one year after the establishment of the register shall be defrayed by the Board out of its own moneys.
(3) All expenses incurred by the Minister in the execution of this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Application of moneys received by the Board.
20.—The Board shall out of the moneys received by it, whether by way of fees or otherwise, pay the expenses incurred by the Medical Council in the execution of their duties under this Act (the amount of such expenses to be settled in default of agreement by the Minister) and the expenses of the Board which are required by this Act to be defrayed by the Board out of its own moneys and shall allocate the surplus (if any) of such moneys to purposes connected with dental education and research or any public purposes connected with the profession of dentistry in such manner as the Board may determine.
Making of regulations by the Board.
21.—The Board may by regulations made by it prescribe all or any of the following things, that is to say:—
(a) the procedure of the Board at its meetings and otherwise,
(b) the maintenance and keeping generally of the register and, with the approval of the Minister, the form of the register,
(c) the form and mode of application for registration in the register and the evidence to be given on such application of the title of the applicant to be so registered,
(d) subject to the provisions of this Act and the approval of the Minister, the fees to be paid for the registration of persons and for the retention of persons on the register,
(e) the preparation, printing, publication, and sale generally of the dental register and, with the approval of the Minister, the form of the dental register,
(f) the conduct of and proceedings at inquiries into the conduct of registered persons alleged to have been guilty of infamous or disgraceful conduct in a professional respect.
(g) so far as is authorised by this Act, the delegation to the registrar of the powers and duties of the Board in relation to the register,
(h) any matter or thing referred to in this Act as prescribed or to be prescribed by regulations made by the Board and not hereinbefore expressly mentioned.
Exercise by the Minister of the functions of the Board.
22.—(1) If at any time the Minister is satisfied, either after such inquiry as the Minister thinks fit to make or without such inquiry, that the Board has on any occasion failed to do any matter or thing which the Board is authorised or required by this Act to do and the doing of which by the Board on that occasion was in the opinion of the Minister necessary or appropriate for the proper exercise of the functions or the proper discharge of the duties conferred or imposed on the Board by this Act, the Minister may by order direct the Board to do such matter or thing and for that purpose to do such other matters or things ancillary or incidental thereto as may be specified in such order
(2) If the Board fails to comply with the directions contained in an order made by the Minister under this section, the Minister may himself take such steps as he thinks fit to carry out the directions contained in such order and for that purpose the Minister shall have and may exercise such of the rights and powers conferred on the Board by this Act as are necessary for the due compliance with such directions.
The establishment of the register.
23.—(1) As soon as may be after the establishment of the Board, the Board shall prepare and establish a register of dentists to be known as “The Register of Dentists for Saorstát Eireann” and in this Act referred to as the register.
(2) As soon as the Board is in a position to appoint a date for the establishment of the register and in any event not later than ten months after the passing of this Act the Board shall communicate in writing to the Minister the date (not being less than two months after such communication nor more than twelve months after the passing of this Act) on which they desire the register to be established and thereupon the Minister shall by notice published by him in the Iris Oifigiúil declare that the register shall be established as on and from such date or such later date as the Minister may think proper to specify in such notice.
(3) The notice to be published in the Iris Oifigiúil pursuant to the foregoing sub-section shall be so published not less than one month before the date specified therein for the establishment of the register.
(4) All references in this Act to the establishment of the register as a point in time shall be construed as referring to the date declared by the Minister under this section to be the date as on and from which the register shall be established.
(5) From and after the establishment of the register the Board shall maintain and keep the register in accordance with this Act and the regulations made by the Board thereunder.
(6) The register shall be in such form as the Board shall, with the approval of the Minister, prescribe.
Correction of the register.
24.—(1) For the purpose of keeping the register correct the Board shall from time to time as occasion requires correct all verbal or clerical errors in the register, remove therefrom all entries therein procured by fraud or misrepresentation, enter in the register every change which comes to their knowledge in the addresses of the persons registered therein, and remove from the register the names of all persons who shall have died or who by reason of non-payment of fees have ceased to be entitled to have their names retained in the register.
(2) The Board may at any time on such terms and as from such date as they think proper restore to the register the name of any person whose name was erroneously removed from the register on the ground that he was dead or whose name was removed from the register because of non-payment of fees.
(3) The Board may by regulations made under this Act delegate to the registrar all or any of their powers and duties under this section other than the power of restoring a name to the register.
Notification by registrar of death of registered person.
25.—Every registrar of deaths on receiving notice of the death of any person who is registered in the register, shall forthwith send by post to the registrar a certificate signed by him certifying the fact of the death of such person and containing particulars of the time and place of the death of such person, and may charge the cost of such certificate and of the sending thereof to the registrar as an expense of his office of registrar of deaths.
Persons entitled to be registered at the establishment of the register.
26.—(1) Subject to payment of the prescribed fee, there shall be registered in the register at the establishment thereof—
(a) every person who was a registered dentist immediately before the establishment of the register and was then resident in Saorstát Eireann, and
(b) every person who was a registered dentist immediately before the establishment of the register and was then resident outside Saorstát Eireann and applies to the Board within one month before such establishment to be registered in the register.
(2) For the purposes of this section a person shall be deemed to be resident at his address as stated in the General Dentists Register.
Persons entitled to be registered after the establishment of the register.
27.—(1) After the establishment of the register the following persons shall, on making the prescribed application and paying the prescribed fees, be entitled (save as is otherwise provided by this section) to be registered in the register, that is to say:—
(a) every person who is at the time of such application registered in the General Dentists Register, and
(b) every person who is at the time of such application possessed of a degree or licence in dental surgery granted by a university or college in Saorstát Eireann having, at the time of such degree or licence, power to grant the same.
(2) No person whose name shall have been erased from the register by the Board on account of his having been convicted of treason or a felony, misdemeanour, crime, or offence or by direction of the Medical Council on account of his having been judged guilty of infamous or disgraceful conduct in a professional respect shall be entitled to have his name restored to the register under this section solely by reason of his being registered in the General Dentists Register.
(3) A person not previously registered in the register shall not be entitled to be registered therein under this section if at any time before his application for such registration his name has been erased from the General Dentists Register on account of his having been convicted of a felony, misdemeanour, crime, or offence or his having been judged guilty of infamous or disgraceful conduct in a professional respect.
Registration of persons mentioned in Third Schedule.
28.—(1) This section shall apply to the several persons named in the Third Schedule to this Act and also to any person who before the establishment of the Board satisfies the Minister or after the establishment of the Board satisfies the Board that he fulfils the following conditions, that is to say:—
(a) that he was a citizen of Saorstát Eireann on the 1st day of January, 1928, and
(b) that his principal means of livelihood during the whole period of ten years immediately preceding the passing of this Act was the practice of dentistry in Saorstát Eireann, and
(c) that he was not guilty at any time of any crime or conduct which, if he had at that time been a registered dentist, would have caused his removal from the register.
(2) For the purposes of the application of this section to a person who was a dental mechanic before the passing of the Dentists Act, 1921, the expression “practice of dentistry” in the foregoing sub-section shall be deemed to include the work usually performed by a dental mechanic.
(3) Every person to whom this section applies shall on passing either of the examinations in dentistry to be prescribed and held under this section and on making the prescribed application and paying the prescribed fees be entitled to be registered in the register.
(4) Two examinations shall be prescribed and held under this section, the first of which shall be held after the expiration of five months and before the expiration of six months from the passing of this Act and the second of which shall be held after the expiration of eleven months and before the expiration of twelve months from the passing of this Act.
(5) An examination prescribed and held under this section shall if held before the establishment of the Board be prescribed and held by the Minister, and if held after the establishment of the Board shall be prescribed and held by the Board.
(6) Nothing in this Act shall operate to prohibit any person to whom this section applies from practising or representing himself or holding himself out as practising or prepared to practise dentistry or dental surgery during the period between the passing of this Act and the publication of the results of the second examination held under this section.
(7) Every person to whom this section applies who is registered in the register under this section and is resident in Saorstát Eireann shall so long as he is so registered and resident be entitled to vote and be elected at an election of the elected members of the Board held after he is so registered as if he were registered in the register by virtue of a previous registration in the General Dentists Register under section 3 of the Dentists Act, 1921.
Registration of persons mentioned in Fourth Schedule.
29.—Every of the persons named in the Fourth Schedule to this Act shall be deemed for the purposes of this Act to be registered at the passing of this Act in the General Dentists Register under section 3 of the Dentists Act, 1921, and shall accordingly have until the establishment of the register all the rights in relation to practising, voting, and otherwise conferred by this Act on persons so registered and shall also be entitled (subject to payment of the prescribed fee) to be registered in the register at the establishment thereof.
Foreign dental practitioners.
30.—(1) Any person who was trained and is for the time being registered as a dentist, dental surgeon, or surgeon dentist in any British possession, self-governing dominion, or foreign country which is for the time being recognised by the Board for the purposes of this section, shall be entitled, on making the prescribed application and paying the prescribed fees, to be registered in the register.
(2) The Board may recognise for the purposes of this section any British possession, self-governing dominion, or foreign country in which there is in force at the time of such recognition legislation—
(a) providing for the registration by a public authority of persons engaged in the practice of dentistry, and
(b) requiring for such registration a standard of training and knowledge which is in the opinion of the Board not lower than the standard of training and knowledge necessary for obtaining the right to be registered under this Act, and
(c) providing for the admission of persons registered under this Act to registration under such legislation on terms which in the opinion of the Board are reasonably equivalent to the terms on which persons registered under such legislation are admitted to registration under this Act.
(3) The Board may at any time cease to recognise for the purposes of this section any British possession, self-governing dominion, or foreign country previously so recognised.
(4) Persons registered in the register under this section are in this Act referred to as foreign practitioners.
Erasure from the register of persons convicted of crimes.
31.—(1) Whenever a person registered in the register is convicted in Saorstát Eireann of treason or of a felony or a misdemeanour or is convicted outside Saorstát Eireann of a crime or offence which would be a felony or a misdemeanour if committed in Saorstát Eireann the Board may erase the name of such person from the register.
(2) A person whose name has been erased from the register under this section may be restored to the register by order of the High Court under this Act or at any time by special direction of the Board but not otherwise and when a person is so restored to the register by the Board the Board may attach to such restoration such conditions (including the payment of a fee not exceeding the fee which would be payable by such person for registration if he was then being registered for the first time) as the Board thinks fit.
Erasure from the register of persons found guilty of infamous or disgraceful conduct.
32.—(1) The Board may at any time and shall on the application of any university or college in Saorstát Eireann having for the time being power to grant certificates of fitness to practise dentistry or dental surgery hold or appoint one or more members of the Board to hold an inquiry into the conduct of any person registered in the register who is alleged to have been guilty of infamous or disgraceful conduct in a professional respect.
(2) If, as the result of an inquiry held under the foregoing sub-section or as the result of a report received by the Board from the General Dental Board of an inquiry held by such Board, the Board finds that the person in respect of whose conduct such inquiry was held was guilty of infamous or disgraceful conduct in a professional respect the Board may, if it thinks fit, erase the name of such person from the register.
(3) A person whose name has been erased from the register under this section may be restored to the register by order of the High Court under this Act or at any time by special direction of the Board but not otherwise, and when a person is so restored to the register by the Board the Board may attach such conditions (including the payment of a fee not exceeding the fee which would be payable by such person for registration if he was then being registered for the first time) as the Board thinks fit.
Appeals to the High Court.
33.—(1) Whenever the Board refuses to register in the register a person who has applied for such registration or erases the name of any person from the register the Board shall forth with send by post to such person notice in writing of such refusal or erasure and of the reason therefor
(2) Whenever the Board refuses or fails to register in the register a person who has applied for such registration or erases the name of any person from the register such person may within three months after receiving from the Board notice under this section of such refusal or erasure or, in the case of a failure to register, within six months after his application for such registration appeal to the High Court in accordance with rules of court against such refusal, failure, or erasure, and on the hearing of any such appeal the High Court may give such directions as it thinks proper including a direction that the name of the appellant be registered in or restored to the register as on and from the date of the order of the Court or any earlier date and directions as to how the costs of the appeal are to be borne.
(3) On the hearing of an appeal under this section from an erasure on account of the appellant having been found guilty of infamous or disgraceful conduct in a professional respect, the High Court may, if it thinks proper so to do, admit and have regard to evidence of persons of standing in the medical profession or the dental profession as to what is infamous or disgraceful conduct in a professional respect.
(4) Whenever the High Court on an appeal under this section directs the name of a person to be registered in or restored to the register, the Board shall register or restore (as the case may be) the name of such person in or to the register in accordance in all respects with such direction.
(5) The decision of the High Court on an appeal under this section shall be final and shall not be subject to appeal to any other court
Inquiry by Board into allegation of infamous conduct.
34.—(1) Whenever the Board holds or appoints any members or member of the Board to hold an inquiry under this Act into the conduct of any person who is alleged to have been guilty of infamous or disgraceful conduct in a professional respect the Board or the members or member so appointed (as the case may be) shall have power to summon witnesses to attend such inquiry and to examine them on oath and for that purpose to administer an oath to such witnesses and to compel such witnesses to produce any documents in their power or control the production of which the Board or such members or member (as the case may be) considers necessary for the purpose of such inquiry.
(2) Every person who on being duly summoned by the Board or by any such members or member as aforesaid fails to attend an inquiry held under this section or being in attendance thereat as a witness refuses to take an oath or to give evidence or to produce a document in his power or control when required under this section so to do shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
(3) The person whose conduct is the subject of an inquiry held under this section shall be entitled to be heard and adduce evidence and, if he so desires, to be represented by solicitor and counsel at such inquiry.
The dental register.
35.—(1) The Board shall in every year cause to be printed, published, and sold under the title “The Dental Register of Saorstát Eireann” (in this Act referred to as the dental register) a correct list, in such form as shall be prescribed by the Board with the approval of the Minister, of the names of all persons whose names are entered in the register on the 1st day of such year.
(2) The Board may, if it so thinks proper with the consent of the Minister refrain from publishing the dental register in the year in which the register is established, but if the Board does publish the dental register in such year such dental register shall be a list of the names of all persons whose names are entered in the register on the day after the establishment of the register.
(3) The Board may with the approval of the Minister arrange in any dental register the names of foreign practitioners in a separate list and may also with the like approval subdivide such separate list into separate sub-lists containing respectively the names of persons trained and registered in British possessions, the self-governing dominions, and foreign countries.
(4) The list and every separate list and sub-list of names of persons to be contained in the dental register under this section shall be arranged in such list, separate list, or sub-list in alphabetical order of surnames and, in the case of persons having the same surname, in alphabetical order of Christian names, and shall contain after or opposite the name of every such person his address and qualifications as stated in the register on the appropriate 1st day of January or, in the case of the dental register published in the year in which the register is established, on the day after the establishment of the register.
(5) A copy purporting to be a copy printed and published by or for the Board under this section of the dental register which is for the time being the latest dental register so printed and published shall be evidence in any court until the contrary is proved that every person whose name is entered in such dental register is registered in the register under and in accordance with this Act and that any person whose name is not entered in such dental register is not so registered.
(6) A certificate purporting to be signed by the registrar and to certify that on a specified day or days or during the whole of a specified period a particular person was duly registered in the register or that on a specified day or days or during the whole of a specified period a particular person was not registered in the register or that on a specified day the name of a particular person was erased from the register shall without proof of the signature of the person purporting to sign such certificate or that he was the registrar and notwithstanding any discrepancy between such certificate and the dental register be conclusive evidence of the matters certified in and by such certificate.
Offences and penalties in relation to the register.
36.—(1) Every person who for the purpose of being registered in the register makes or procures or causes to be made or procured or aids or abets the making or procuring of any representation or declaration which to the knowledge of such person is false or fraudulent shall be guilty of an offence under this section and shall be liable on summary conviction thereof to imprisonment with or without hard labour for any term not exceeding twelve months.
(2) Every person who wilfully and fraudulently makes or causes to be made or aids or abets the making of any entry in the register which to the knowledge of such person is false or misleading in any material particular shall be guilty of an offence under this section and shall be liable on summary conviction thereof to imprisonment with or without hard labour for any term not exceeding twelve months.
(3) Every person who after the establishment of the register, wilfully and falsely represents himself to be or holds himself out as being a person who is registered in the register or uses any name, title, addition or description (whether expressed in words or by letters or partly in words and partly by letters) implying that he is so registered shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds.
Descriptions of registered persons.
37.—(1) Every person who is registered in the register shall be entitled to take and use the description of dentist or dental practitioner.
(2) A person who is registered in the register shall not—
(a) use any name other than the name in which he is registered in the register, or
(b) take or use, or affix to or use in connection with his premises any title or description relating to himself, his premises, or the work done or proposed to be done by him which is reasonably calculated to suggest that he possesses any professional status or qualification other than a professional qualification or status which he in fact possesses and which is indicated by the particulars relating to him entered in the register.
(3) The name of any person who acts in contravention of this section may, at the discretion of the Board, be erased from the register.
Qualifying examinations.
38.—(1) Every university or college in Saorstát Eireann which has, at the date of the passing of this Act, power to grant degrees in surgery may from time to time hold examinations for the purpose of testing the fitness of persons to practise dentistry or dental surgery (in this Act referred to as “qualifying examinations”) and to grant certificates of such fitness to such persons as a result of such examinations.
(2) Every person who after having passed a qualifying examination obtains from any such university or college as aforesaid a certificate of fitness to practise dentistry or dental surgery shall (where such certificate is granted by any such university as aforesaid) be a graduate of such university and shall (where such certificate is granted by any such college as aforesaid) be a licentiate of such college.
Board of examiners.
39.—(1) The governing body of every university or college in Saorstát Eireann which is authorised by this Act to hold qualifying examinations in dentistry or dental surgery shall appoint in accordance with the provisions of this section a board (in this Act referred to as a board of examiners) for the purpose of conducting such qualifying examinations and granting certificates of fitness to persons as a result of such examinations.
(2) Every board of examiners shall consist of and be maintained at not less than six persons of whom not less than three shall be appointed from persons who are registered in the register.
(3) Every member of a board of examiners shall hold office as such member for such period as the governing body of the university or college by which he is appointed shall determine.
(4) Whenever a vacancy occurs in the membership of a board of examiners the governing body by which such board was appointed may and, when necessary for the maintenance of the minimum membership, shall fill such vacancy.
Conduct of qualifying examinations.
40.—It shall be the duty of every board of examiners to conduct in the manner directed by the university or body by which such board of examiners is appointed the qualifying examinations in dentistry or dental surgery held by such university or college and to grant in the form directed by such university or college certificates of fitness to practise dentistry or dental surgery.
Admission to qualifying examinations.
41.—Every university and college which is authorised by this Act to hold qualifying examinations in dentistry or dental surgery shall admit as a candidate at such examinations every person who has—
(a) attained the age of twenty-one years, and
(b) fulfilled the conditions required by the rules for the time being in force of such university or college to be fulfilled by candidates for such examination.
Information as to course of study, etc., to be furnished to Medical Council.
42.—(1) Every university or college which is authorised by this Act to hold qualifying examinations in dentistry or dental surgery and to grant as a result of such examinations certificates of fitness to practise dentistry or dental surgery shall from time to time as and whenever so required by the Medical Council, furnish to the Medical Council such information as the Medical Council may require relating to such examinations and such certificates and the course of study to be completed by candidates for such examinations and generally the conditions to be fulfilled before such certificates as aforesaid are granted by such university or college.
(2) For the purpose of satisfying itself upon any matter or thing relating to which any such university or college as aforesaid is required under the foregoing sub-section to furnish information to the Medical Council, the Medical Council may appoint a fit and suitable person whether such person is or is not a member of the Medical Council to attend any qualifying examination held by such university or college and every person so appointed may attend such qualifying examination.
Declaration of insufficiency of qualifying examinations.
43.—(1) If at any time it appears to the Medical Council that the standard of theoretical or practical knowledge required at any qualifying examination is not such as to guarantee the possession by persons to whom a certificate of fitness to practise dentistry or dental surgery may be granted as a result of such examination of the knowledge requisite for the efficient practice of dentistry or dental surgery the Medical Council may notify in writing such university or college to that effect.
(2) The university or college by which the qualifying examination to which such notification as aforesaid relates is held may, not later than one month after the receipt thereof, make such representations thereon as such university or college may think fit and may forward such observations to the Medical Council.
(3) The Medical Council shall consider every representation made to it under this section by any such university or college as aforesaid and, if still satisfied after such consideration that the standard of knowledge required at the qualifying examination to which such representation relates is not such as to guarantee the possession by persons to whom a certificate of fitness to practise dentistry or dental surgery may be given as a result of such examination of the knowledge requisite for the efficient practice of dentistry or dental surgery may declare that in its opinion the possession of such certificate of fitness of such university or college shall not entitle the possessor thereof to be registered in the register.
(4) Whenever the Medical Council makes any such declaration as aforesaid the Medical Council shall notify in writing the university or college to which such declaration relates and also the Minister of the fact that such declaration has been made.
(5) The Minister, not later than one month after the receipt by him of such notification as aforesaid, and either after such inquiry into the matter as he may think fit to make or without inquiry, may by order confirm (as on and from the date specified in that behalf in such order) or refuse to confirm the declaration to which such notification relates.
(6) The Minister may at any time, if he thinks fit so to do, by order revoke an order made under this section and upon such order of revocation being made the order so revoked shall as from the date of such order of revocation cease to be in force but no such order of revocation shall be made save either on the application of the Medical Council and after reasonable notice to the university or college to which the order proposed to be revoked relates and consideration of the observations (if any) made by such university or college or on the application of such university or college and after reasonable notice to the Medical Council and consideration of the observations (if any) made by the Medical Council.
Additional members of the Medical Council.
44.—(1) The Medical Council when exercising its functions under this Act shall include three additional members appointed under this section and such additional members shall, in relation to the exercise of such functions but no further or otherwise, have all the rights and privileges of members of the Medical Council.
(2) The said additional members of the Medical Council shall be registered dentists and members of the Board and shall be appointed by the Board.
(3) Every such additional member of the Medical Council shall, unless he sooner dies, resigns, ceases to be a registered dentist, or ceases to be a member of the Board, hold office as such additional member for such period not exceeding five years as the Board shall determine.
Prohibition of practice of dentistry by unregistered persons.
45.—(1) Subject to the provisions of this section it shall not be lawful for any person on or after the date of the passing of this Act to practise or to represent or hold himself out whether directly or by implication as practising or being prepared to practise dentistry or dental surgery unless such person is a registered dentist.
(2) During the period between the passing of this Act and the establishment of the register any person who, though not a registered dentist within the meaning of this Act, would be entitled (subject only to the payment of fees) to be registered in the register if the register were then established may notwithstanding anything to the contrary contained in this section practise dentistry and dental surgery and may represent and hold himself out as practising dentistry and dental surgery.
(3) The provisions of the foregoing sub-sections shall not operate to prohibit—
(a) the practice of dentistry or dental surgery by a registered medical practitioner, or
(b) the extraction of a tooth without the application of any local or general anaesthetic by a duly registered pharmaceutical chemist, chemist and druggist, or druggist or a licentiate apothecary in dental cases which are urgent and where a registered dentist or a registered medical practitioner is not available for the purpose of such extraction, or
(c) the employment of mechanics or apprentices by a registered dentist to carry out under the supervision of such registered dentist any work which is usually done in a dental workshop.
(4) Every person who acts in contravention of this section shall be guilty of an offence under this section and shall be liable in respect of each such offence on summary conviction thereof to a fine not exceeding one hundred pounds.
Prohibition of practice of dentistry by bodies corporate.
46.—(1) Subject to the provisions of this section, it shall not be lawful for any body corporate to engage in the practice of dentistry or dental surgery.
(2) The provisions of the foregoing sub-section shall not operate to prohibit the practice of dentistry or dental surgery—
(a) during a period of two years from the date of the passing of this Act by any body corporate which was on the 30th day of April, 1927 entitled under any statute to engage and was on that date actually engaged in the practice of dentistry or dental surgery, or
(b) by any hospital or by any dental school which is authorised by the Board to engage in the practice of dentistry or dental surgery, or
(c) by any two or more registered dentists in partnership.
(3) Every body corporate which engages in the practice of dentistry or dental surgery in contravention of the provisions of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof in respect of each such offence to a fine not exceeding one hundred pounds and not less than fifty pounds.
(4) The manager and also every director of a body corporate which engages in the practice of dentistry or dental surgery in contravention of the provisions of this section shall be guilty of a misdemeanour and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds and not less than fifty pounds.
Prosecution of offences.
47.—Every offence under any section of this Act may be prosecuted at the suit of the Board.
Short title.
48.—This Act may be cited as the Dentists Act, 1928.

FIRST SCHEDULE.

Agreement between Great Britain, the Irish Free State and Northern Ireland as to the registration and control of dentists.
1.—In this Agreement,
the expression “the Dentists Acts” means the Dentists Acts, 1878 and 1921, and any Acts amending the same;
the expression “the Dental Board” means the Dental Board established under the Dentists Acts;
the expression “the Medical Acts” means the Medical Act, 1858, and the Medical Act, 1886, and any Acts amending the same;
the expression “the General Medical Council” means the General Council established under the Medical Acts;
the expression “medical authorities” means the bodies and universities who choose members of the General Medical Council;
the expression “the Dentists Register” means the register established under the Dentists Acts;
the expression “the Irish Free State Dental Board” means any Board which may hereafter be established by Act of the Oireachtas of the Irish Free State for the purpose of registering and controlling dentists in the Irish Free State;
the expression “the Irish Free State Dentists Register” means any register of dentists which the Irish Free State Dental Board may by any such Act of the Oireachtas be required to keep;
the expression “the Irish Free State Medical Council” means any council which may hereafter be established by Act of the Oireachtas of the Irish Free State for the purpose of registering and controlling medical practitioners in the Irish Free State;
the word “formerly” shall be construed as referring to times previous to the establishment of the Irish Free State.
2.—(1) The appointment of a member of the Dental Board as constituted after the expiration of the term of office of the first members of that Board required to be made by the Lord Lieutenant of Ireland shall henceforth be made by the Governor of Northern Ireland.
(2) Subject to the provisions of sub-paragraph (1) of this paragraph, the appointment of the appointed members and the election of the elected members of the Dental Board as so constituted as aforesaid shall be made and had in like manner in all respects as the same were formerly required to be made and had respectively.
(3) Nothing in this Agreement shall affect the tenure of office of any member of the Dental Board who holds office at the date on which this Agreement takes effect.
3.—Subject to the provisions of this Agreement and notwithstanding anything contained in the Irish Free State Constitution Act, 1922, or the Irish Free State (Consequential Provisions) Act, 1922, or the Constitution of the Irish Free State (Saorstát Eireann) Act, 1922, passed by the Provisional Parliament of Ireland, or the Adaptation of Enactments Act, 1922, passed by the Oireachtas of the Irish Free State, or any Order made under any of those Acts the constitution of the Dental Board under the Dentists Act and the powers of holding examinations for the purpose of testing the fitness of persons to practise dentistry or dental surgery, and of granting certificates of such fitness for the purpose of registration in the Dentists Register formerly vested in the Dental Board or the medical authorities in Ireland shall be deemed not to have been affected by the establishment of the Irish Free State, and for the purpose of the preparation and keeping of the Dentists Register the Dental Board and the General Medical Council and their respective officers shall have and may exercise in relation to persons, medical authorities and matters in the Irish Free State all such powers, jurisdictions and authorities under the Dentists Acts as the said Board and the said Council had and might exercise under the Dentists Acts for that purpose in relation to persons, medical authorities, and matters respectively in Ireland.
4.—Any person who is or shall be registered in the Dentists Register shall be entitled on payment of such fees as may from time to time be prescribed in that behalf by or in pursuance of any Act of the Oireachtas of the Irish Free State, to be registered in the Irish Free State Dentists Register: Provided that
(a) the fees payable by such persons in respect of such registration shall at no time exceed the fees payable in respect of registration in the Irish Free State Dentists Register by any other person who may be or become entitled to be registered therein, and
(b) no person whose name has been erased from the Irish Free State Dentists Register on account of his having been convicted of a felony, misdemeanour, crime or offence or having been found guilty of infamous or disgraceful conduct in a professional respect shall be entitled to be subsequently registered in the said Register solely by reason of his being registered in the Dentists Register, and
(c) a person not previously registered in the Irish Free State Dentists Register shall not be entitled to be registered therein if his name has been erased from the Dentists Register on account of his having been convicted of a felony, misdemeanour, crime or offence or having been found guilty of infamous or disgraceful conduct in a professional respect.
5. In the event of any examinations of a new university at any time hereafter created in the Irish Free State becoming qualifying examinations in medicine, surgery and midwifery for the purposes of the Medical Acts that university shall have the same powers of holding examinations for the purposes of testing the fitness of persons to practise dentistry or dental surgery, and of granting certificates of such fitness for the purpose of registration in the Dentists Register as if it were a medical authority for the purposes of section 18 of the Dentists Act, 1878.
6. (1) With a view to preventing the holding of simultaneous inquiries—
(a) The Dental Board shall report to the Irish Free State Dental Board every case in which they propose, in connection with the exercise of their disciplinary powers, to hold an inquiry into the conduct in Great Britain or in Northern Ireland of any person registered in the Irish Free State Dentists Register, and the Irish Free State Dental Board shall report to the Dental Board every case in which they propose, in connection with the exercise of their disciplinary powers, to hold an enquiry into the conduct in the Irish Free State of any person registered in the Dentists Register;
(b) The Dental Board upon receipt by them of any such report as aforesaid from the Irish Free State Dental Board, shall have regard to the desirability of postponing inquiry by them into the matter to which such report relates until the inquiry to which such report relates by the Irish Free State Dental Board is completed;
(c) The Irish Free State Dental Board upon receipt by them of any such report as aforesaid from the Dental Board, shall have regard to the desirability of postponing inquiry by them into the matter to which such report relates until the inquiry to which such report relates by the Dental Board is completed.
(2) The Dental Board shall report to the Irish Free State Dental Board every case in which disciplinary action resulting in erasure from the Dentists Register is taken by them against a person registered in the Irish Free State Dentists Register, and the Irish Free State Dental Board shall report to the Dental Board every case in which disciplinary action resulting in erasure from the Irish Free State Dentists Register is taken by them against a person registered in the Dentists Register.
7.—His Majesty's Governments in Great Britain and the Irish Free State respectively shall as soon as possible introduce into their respective Parliaments such legislation as may be necessary to give statutory effect to this Agreement, and this Agreement shall not take effect until such legislation in both such Parliaments shall have been passed into law.

SECOND SCHEDULE.
1. During the five years next after the establishment of the Board the members of the Board shall be nominated and elected as follows, that is to say:—
(a) one member shall be nominated by the Executive Council,
(b) three members shall be nominated by the Medical Council,
(c) two members, who shall be registered dentists resident in Saorstát Eireann and registered or formerly registered in the General Dentists Register under section 3 of the Dentists Act, 1921, shall be elected by the registered dentists so resident and so registered or formerly registered,
(d) four members, who shall be registered dentists resident in Saorstát Eireann and registered or formerly registered in the General Dentists Register otherwise than under section 3 of the Dentists Act, 1921, shall be elected by the registered dentists so resident and so registered or formerly registered.
2. After the expiration of five years from the establishment of the Board the members of the Board shall during the ten years next after such expiration be nominated and elected as follows, that is to say:—
(a) one member shall be nominated by the Executive Council,
(b) three members shall be nominated by the Medical Council.
(c) one member, who shall be a registered dentist resident in Saorstát Eireann and registered in the register by virtue of a previous registration in the General Dentists Register under section 3 of the Dentists Act, 1921, shall be elected by the registered dentists so resident and registered,
(d) four members, who shall be registered dentists resident in Saorstát Eireann and registered in the register otherwise than by virtue of a previous registration in the General Dentists Register under section 3 of the Dentists Act, 1921, shall be elected by the registered dentists so resident and registered.
3. After the expiration of fifteen years from the establishment of the Board the members of the Board shall be nominated and elected as follows, that is to say:—
(a) one member shall be nominated by the Executive Council,
(b) three members shall be nominated by the Medical Council,
(c) five members, who shall be registered dentists resident in Saorstát Eireann, shall be elected by the registered dentists so resident.
