SOCIAL WELFARE (AMENDMENT) ACT, 1984

Interpretation.

1.—In this Act “the Principal Act” means the Social Welfare (Consolidation) Act, 1981.

Disqualification Part II, Chapter 4.

2.—Section 35 of the Principal Act is hereby amended by the insertion after subsection (2) of the following subsection:

“(2A) A person shall be disqualified for receiving unemployment benefit during any week in which he is employed under a scheme administered by the Department of Labour and known as the Social Employment Scheme.”.

Insurable (occupational injuries) employment.

3.—Section 38 of the Principal Act is hereby amended by the insertion after subsection (11):

“(12) A person employed under a scheme administered by the Department of Labour and known as the Social Employment Scheme shall be deemed, for the purposes of this Part, to be in insurable (occupational injuries) employment.”.

Disqualification Part III, Chapter 2.

4.—Section 142 of the Principal Act is hereby amended by the insertion in subsection (1) after paragraph (d) of the following paragraph:

“or

(e) while he is employed during any week under a scheme administered by the Department of Labour and known as the Social Employment Scheme.”.

Intermittent unemployment.

5.—Section 233 of the Principal Act is hereby amended by the substitution for the definition of “intermittent unemployment” of the following definition:

“‘intermittent unemployment’ means unemployment and consequent loss of wages due to stoppage of work in an insurable employment which—

(a) is unavoidable owing to inclement weather, and

(b) occurs on or before the 6th day of January, 1985,

and the expression ‘intermittently unemployed’ shall be construed accordingly;”.

Liability for contributions.

6.—Section 241 of the Principal Act is hereby amended by the insertion after subsection (4) of the following subsection:

“(5) No weekly contribution shall be payable pursuant to subsection (3) in respect of any calendar week which commences on or after the 7th day of January, 1985.”.

Repayment by Minister of benefit paid by employers.

7.—The Principal Act is hereby amended by the substitution for section 257 of the following section:

“257.—The amount of any supplementary benefit duly paid in accordance with this Part by an employer shall be repaid to him by the Minister out of the Fund on application being made, in such manner as may be prescribed and not later than the 29th day of March, 1985, by the employer for such repayment.”.

Payments into Fund from moneys provided by Oireachtas.

8.—Section 269 of the Principal Act is hereby amended by the insertion after subsection (7) of the following subsections:

“(8) If, in respect of the financial year ending on the 31st day of December, 1985, the Fund is insufficient to discharge the liabilities imposed on it, the amount by which the Fund is so insufficient shall be paid into the Fund out of moneys provided by the Oireachtas and any amount so payable shall be paid in such manner and at such times as the Minister for Finance may determine.

(9) Any income accruing to the Fund after the 31st day of December, 1985, shall be paid into the Exchequer in such manner and at such times as the Minister for Finance may determine.”.

Amendment of Part II of First Schedule to Principal Act (Excepted Employments).

9.—Part II of the First Schedule to the Principal Act is hereby amended by the insertion after paragraph 10 of the following paragraph:

“11.—Employment under a scheme administered by the Department of Labour and known as the Social Employment Scheme.”.

Short title, construction and collective citation.

10.—(1) This Act may be cited as the Social Welfare (Amendment) Act, 1984.

(2) The Social Welfare Acts, 1981 to 1984, and this Act shall be construed together as one.

(3) The collective citation “the Social Welfare Acts, 1981 to 1984” 40 shall include this Act.

1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht Leasa Shóisialaigh (Comhdhlúthú), 1981.

Dícháiliú Cuid II, Caibidil 4.

2.—Leasaítear leis seo alt 35 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (2):

“(2A) Beidh duine dícháilithe chun sochar dífhostaíochta a fháil ar feadh aon seachtaine a mbeidh sé ar fostú faoi scéim a riarann an Roinn Saothair agus dá ngairtear an Scéim Fostaíochta Sóisialta.”.

Fostaíocht inárachaithe (díobhálacha ceirde).

3.—Leasaítear leis seo alt 38 den Phríomh-Acht tríd an bhfo-alt seo a chur isteach i ndiaidh fho-alt (11):

“(12) Duine a bheidh ar fostú faoi scéim a riarann an Roinn Saothair agus dá ngairtear an Scéim Fostaíochta Sóisialta measfar, chun críocha na Coda seo, é bheith i bhfostaíocht inárachaithe (díobhálacha ceirde).”.

4.—Leasaítear leis seo alt 142 den Phríomh-Acht tríd an mír seo a leanas a chur isteach i bhfo-alt (1) i ndiaidh mhír (d):

“nó

(e) le linn dó bheith ar fostú ar feadh aon seachtaine faoi scéim a riarann an Roinn Saothair agus dá ngairtear an Scéim Fostaíochta Sóisialta.”.

Breacdhífhostaíocht.

5.—Leasaítear leis seo alt 233 den Phríomh-Acht tríd an míniú seo a leanas a chur in ionad an mhínithe ar “breac-dhífhostaíocht”:

“ciallaíonn ‘breac-dhífhostaíocht’ dífhostaíocht agus cailliúint iarmhartach pá de dheasca saotharstad i bhfostaíocht inárachaithe—

(a) nach féidir a sheachaint mar gheall ar dhoineann, agus

(b) a tharla an 6ú lá d'Eanáir, 1985 nó roimhe,

agus forléireofar an abairt ‘breac-dhífhostaithe’ dá réir sin;”.

Dliteanas i leith ranníocaí.

6.—Leasaítear leis seo alt 241 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur isteach i ndiaidh fho-alt (4):

“(5) Ní bheidh aon ranníoc seachtainiúil iníoctha de bhun fho-alt (3) i leith aon seachtaine féilire a thosóidh an 7ú lá d'Eanáir, 1985 nó dá éis.”.

7.—Leasaítear leis seo an Príomh-Acht tríd an alt seo a leanas a chur in ionad alt 257:

“257.—Déanfaidh an tAire an méid d'aon sochar forlíontach a bheidh íoctha go cuí de réir na Coda seo ag fostóir a aisíoc leis as an gCiste ar an bhfostóir do dhéanamh iarratais i cibé slí a fhorordófar agus tráth nach déanaí ná an 29ú lá de Mhárta, 1985, ag lorg na haisíocaíochta sin.”.

Íocaíochtaí isteach sa Chiste as airgead a sholáthraíonn an tOireachtas.

8.—Leasaítear leis seo alt 269 den Phríomh-Acht trí na fo-ailt seo a leanas a chur isteach i ndiaidh fho-alt (7):

“(8) Más rud é, maidir leis an mbliain airgeadais dar críoch an 31ú lá de Nollaig, 1985, go mbeidh an Ciste neamhdhóthanach chun na dliteanais a fhorchuirtear air a chur i gcrích, déanfar méid is ionann agus an neamhdhóthanacht sin a íoc isteach sa Chiste as airgead a sholáthróidh an tOireachtas agus aon mhéid a bheidh iníoctha amhlaidh íocfar é i cibé modh agus cibé tráthanna a chinnfidh an tAire Airgeadais.

(9) Déanfar aon ioncam a fhaibhreoidh chun an Chiste tar éis an 31ú lá de Nollaig, 1985, a íoc isteach sa Státchiste i cibé modh agus cibé tráthanna a chinnfidh an tAire Airgeadais.”.

9.—Leasaítear leis seo Chuid II den Chéad Sceideal a ghabhann leis an bPríomh-Acht tríd an mír seo a leanas a chur isteach i ndiaidh mhír 10:

“11.—Fostaíocht faoi scéim a riarann an Roinn Saothair agus dá ngairtear an Scéim Fostaíochta Sóisialta.”.

Gearrtheideal, forléiriú agus comhlua.

10.—(1) Féadfar an tAcht Leasa Shóisialaigh (Leasú), 1984 a ghairm den Acht seo.

(2) Déanfar na hAchtanna Leasa Shóisialaigh, 1981 go 1984, agus an tAcht seo a fhorléiriú le chéile mar aon ní amháin.

(3) Folóidh an comhlua “na hAchtanna Leasa Shóisialaigh, 1981 go 1984” an tAcht seo.
