1.—San Acht seo ciallaíonn “an Príomh-Acht” an tAcht Leasa Shóisialaigh, 1952.
Leasú ar an gCéad Sceideal a ghabhann leis an bPríomh-Acht.
2.—(1) Leasaítear leis seo an Chéad Sceideal a ghabhann leis an bPríomh-Acht tríd an mír seo a leanas a chur isteach i ndiaidh mhír 11 (a cuireadh isteach le halt 15 den Acht Leasa Shóisialaigh, 1972) de Chuid I:
“12. Fostaíocht mar mhinistir reiligiúin i gcás maidir leis an duine fostaithe—
(a) go bhfaigheann sé luach saothair trí stipinn, trí thuarastal nó trí íocaíocht dá samhail, agus
(b) gur comhalta é d'aicme daoine a bhfuil an tAire sásta ina leith agus a bhfuil deimhnithe aige ina leith go bhfuil curtha in iúl dó i scríbhinn ag údarás nó comhlacht iomchuí ag gníomhú thar ceann comhaltaí na haicme sin gur de chineál na seirbhísí nó na dualgais a dhéanann na daoine den aicme sin, agus na coinníollacha ceapacháin agus na himthosca iomchuí eile a bhaineann leis an gcéanna, gur míréasúnach, ag féachaint do ghairmeacha eile is fostaíochtaí inárachaithe, nár fhostaíocht inárachaithe fostaíocht comhaltaí ná haicme sin.”
(2) Leasaítear leis seo Cuid II den Chéad Sceideal a ghabhann leis an bPríomh-Acht tríd an mír seo a leanas a chur in ionad mhír 8 (a cuireadh isteach leis na Rialacháin Leasa Shóisialaigh (Áireamh agus Eisiamh i leith Árachais), 1952 (I.R. Uimh. 373 de 1952)):
“8. Fostaíocht seachas fostaíocht a shonraítear i mír 12 de Chuid I den Sceideal seo i gcás inar duine in Ord Beannaithe nó ministir eile reiligiúin nó duine i sámhadh crábhaidh ina chónaí mar chomhalta den sámhadh sin an duine fostaithe.”
Leasuithe ilghnéitheacha ar an bPríomh-Acht de dhroim alt 2.
3.—(1) Leasaítear leis seo alt 12 den Phríomh-Acht tríd an bhfo-alt seo a leanas a chur in ionad fho-alt (1):
“(1) Féadfar le rialacháin forálacha an Achta seo a mhodhnú maidir lena bhfeidhm i gcás—
(a) daoine ar fostú in aon cheann de na fostaíochtaí a shonraítear i míreanna 2, 3, 4, 5, 6, 7 agus 12 de Chuid I den Chéad Sceideal a ghabhann leis an Acht seo, nó
(b) daoine ar fostú i ngnóthas iompair reachtúil, nó
(bb) daoine ar fostú mar mhúinteoirí i scoileanna cuimsitheacha a bhunaigh an tAire Oideachais, nó
(c) daoine ar fostú mar mhúinteoirí i scoileanna náisiúnta faoi na Rialacha agus na Rialacháin do Scoileanna Náisiúnta, nó
(cc) daoine ar fostú mar mhúinteoirí i gcoláistí oiliúna atá aitheanta ag an Aire Oideachais le haghaidh múinteoirí i scoileanna náisiúnta, nó
(d) daoine ar fostú mar mhúinteoirí i meánscoileanna atá aitheanta ag an Aire Oideachais faoi na Rialacha agus an Clár do Mheán-Scoileanna, nó
(dd) daoine ar fostú mar mhúinteoirí i gcoláistí oiliúna tís atá aitheanta ag an Aire Oideachais, nó

(2) Leasaítear leis seo an Dara Sceideal a ghabhann leis an bPríomh-Acht tríd an mír seo a leanas a chur in ionad mhír 1:
“1. Ach amháin sna cásanna dá dtagraítear i míreanna 2, 2A, 3, 3A, 4, 5, 6, 7 agus 8 den Sceideal seo, beidh ranníocaí fostaíochta gnáth-ráta ann mar a leanas:
(a) iníoctha ag an ranníocóir fostaithe: | £1.24 i gcás fear-ranníocóra agus £1.18 i gcás ban-ranníocóra. |
(b) iníoctha ag an bhfostóir: | £1.63 i gcás fear-ranníocóra fhostaithe agus £1.61 i gcás ban-ranníocóra fhostaithe.” |
(3) Leasaítear leis seo an Dara Sceideal a ghabhann leis an bPríomh-Acht tríd an mír seo a leanas a chur isteach i ndiaidh mhír 7 (a cuireadh isteach leis na Rialacháin Leasa Shóisialaigh (Modhnuithe ar Arachas), 1956 (I.R. Uimh. 236 de 1956)):
“8. Más fostaíocht a shonraítear i mír 12 de Chuid I den Chéad Sceideal a ghabhann leis an Acht seo an fhostaíocht, beidh ranníocaí fostaíochta ráta speisialta ann mar a leanas:—

(a) iníoctha ag an ranníocóir fostaithe: | 1.02 |
(b) iníoctha ag an bhfostóir: | 1.46”. |
(4) Leasaítear leis seo an Ceathrú Sceideal a ghabhann leis an bPríomh-Acht tríd an mír seo a leanas a chur in ionad mhír 1:
“1. Sochar míchumais nó sochar dífhostaíochta.
Is iad na coinníollacha ranníoca i gcás sochair mhíchumais nó sochair dhífhostaíochta:—
(a) go mbeidh sé ranníoc fostaíochta is fiche ar a laghad íoctha i leith an éilitheora in aghaidh na tréimhse ó theacht faoi árachas don éilitheoir go dtí an lá a bhfuil an sochar á éileamh ina aghaidh, agus
(b) go mbeidh ocht ranníoc fostaíochta is daichead ar a laghad íoctha nó creidiúnaithe i leith an éilitheora in aghaidh na bliana ranníoca iomláine deiridh roimh thosach na bliana sochair ar lá di an lá a bhfuil an sochar á éileamh ina aghaidh,
ach, maidir le sochar dífhostaíochta, fágfar ranníocaí fostaíochta faoi mhír 3, 3A nó 8 den Dara Sceideal a ghabhann leis an Acht seo a íocadh i leith an éilitheora as áireamh nuair a bheifear á chinneadh, chun críocha gach coinníll acu sin roimhe seo, cé mhéad ranníoc fostaíochta a íocadh i leith an éilitheora.”
(5) Leasaítear leis seo míreanna 7 agus 9 (a cuireadh isteach le halt 18 den Acht Leasa Shóisialaigh, 1970) den Ceathrú Sceideal a ghabhann leis an bPríomh-Acht tríd an méid seo a leanas a chur in ionad na habairte deiridh i ngach mír acu sin:
“D'fhonn a chinneadh an bhfuil coinníollacha na míre seo comhlíonta—
(i) measfar gur tháinig duine faoi árachas an tráth a tháinig sé i gcéaduair (agus ní tráth ar bith eile) chun bheith ina ranníocóir fostaithe a bhfuil ranníocaí fostaíochta iníoctha ina leith faoi mhíreanna 1, 2, 2A, 3, 3A, 6, 7 nó 8 den Dara Sceideal a ghabhann leis an Acht seo, agus
(ii) déanfar neamhshuim de ranníocaí faoi mhíreanna 4 agus 5 (a cuireadh isteach leis na Rialacháin Leasa Shóisialaigh (Modhnuithe ar Arachas), 1956 (I.R. Uimh. 236 de 1956)) den Dara Sceideal sin.”
Leasú ar alt 3 (3) den Acht Leasa Shóisialaigh (Diobhálacha Ceirde), 1966 (fostaíochtaí eiscthe).
4.—Déantar leis seo alt 3 (3) den Acht Leasa Shóisialaigh (Díobhálacha Ceirde), 1966, a shonraíonn go measfar fostaíochtaí a bheith curtha, chun críche fostaíochtaí inárachaithe (díobhálacha ceirde), leis na fostaíochtaí a sonraítear i gCuid II den Chéad Sceideal a ghabhann leis an bPríomh-Acht gur fostaíochtaí eiscthe iad, a leasú tríd an méid seo a leanas a chur isteach i ndiaidh fhomhír (e) (a cuireadh isteach le halt 15 (2) den Acht Leasa Shóisialaigh, 1972):
“(f) fostaíocht a shonraítear i mír 12 (a cuireadh isteach leis an Acht Leasa Shóisialaigh (Uimh. 3), 1974) de Chuid I den Chéad Sceideal a ghabhann leis an Acht Leasa Shóisialaigh, 1952.”
Gearrtheideal, forléiriú agus comhlua.
5.—(1) Féadfar an tAcht Leasa Shóisialaigh (Uimh. 3), 1974, a ghairm den Acht seo.
(2) Forléireofar an tAcht seo agus na hAchtanna Leasa Shóisialaigh, 1952 go 1974, mar aon ní amháin, agus beidh sé ar áireamh sa chomhlua, na hAchtanna Leasa Shóisialaigh, 1952 go 1974.

SOCIAL WELFARE (NO. 3) ACT, 1974
Definition.
1.—In this Act “the Principal Act” means the Social Welfare Act, 1952.
Amendment of First Schedule to Principal Act.
2.—(1) The First Schedule to the Principal Act is hereby amended by the insertion of the following paragraph after paragraph 11 (inserted by section 15 of the Social Welfare Act, 1972) of Part I:
“12. Employment as minister of religion where the employed person—
(a) is remunerated by stipend, salary or similar payment, and
(b) is a member of a class of persons in respect of which the Minister is satisfied and so certifies that an appropriate authority or body acting on behalf of the members of that class has represented to him in writing that the services rendered or duties performed by the persons in that class and the conditions of appointment and other relevant circumstances pertaining thereto are such that having regard to other occupations which are insurable employments, it is unreasonable that the employment of members of that class should not be insurable employment.”
(2) Part II of the First Schedule to the Principal Act is hereby amended by the substitution of the following paragraph for paragraph 8 (inserted by the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1952 (S.I. No. 373 of 1952)):
“8. Employment other than employment specified in paragraph 12 of Part I of this Schedule where the employed person is a person in Holy Orders or other minister of religion or a person living in a religious community as a member thereof.”
Miscellaneous amendments of Principal Act consequential on section 2.
3.—(1) Section 12 of the Principal Act is hereby amended by the substitution of the following subsection for subsection (1):
“(1) Regulations may modify the provisions of this Act in their application in the case of—
(a) persons employed in any of the employments specified in paragraphs 2, 3, 4, 5, 6, 7 and 12 of Part I of the First Schedule to this Act, or
(b) persons employed in a statutory transport undertaking, or
(bb) persons employed as teachers in comprehensive schools established by the Minister for Education, or
(c) persons employed as teachers in national schools under the Rules and Regulations for National Schools, or
(cc) persons employed as teachers in training colleges recognised by the Minister for Education for teachers in national schools, or
(d) persons employed as teachers in secondary schools recognised by the Minister for Education under the Rules and Programme for Secondary Schools, or
(dd) persons employed as teachers in domestic science training colleges recognised by the Minister for Education, or
(e) persons employed as members of the Army Nursing Service, or
(f) persons employed in voluntary hospitals to which grants are paid from the Hospitals Trust Fund in recoupment of revenue deficits, or
(g) persons employed by voluntary organisations which are providing district nursing services, or
(h) persons employed as members of the Garda Síochána.”
(2) The Second Schedule to the Principal Act is hereby amended by the substitution of the following paragraph for paragraph 1:
“1. Except in the cases referred to in paragraphs 2, 2A, 3, 3A, 4, 5, 6, 7 and 8 of this Schedule, there shall be ordinary rate employment contributions as follows:
(a) payable by the employed contributor: | £1.24 in the case of a male contributor and £1.18 in the case of a female contributor. |
(b) payable by the employer: | £1.63 in the case of a male employed contributor and £1.61 in the case of a female employed contributor.” |
(3) The Second Schedule to the Principal Act is hereby amended by the insertion of the following paragraph after paragraph 7 (inserted by the Social Welfare (Modifications of Insurance) Regulations, 1956 (S.I. No. 236 of 1956)):
“8. In case the employment is an employment specified in paragraph 12 of Part I of the First Schedule to this Act there shall be special rate employment contributions as follows:—
£ | |
(a) payable by the employed contributor: | 1.02 |
(b) payable by the employer: | 1.46”. |
(4) The Fourth Schedule to the Principal Act is hereby amended by the substitution of the following paragraph for paragraph 1:
“1. Disability benefit or unemployment benefit.
The contribution conditions for disability benefit or unemployment benefit are:—
(a) that not less than twenty-six employment contributions have been paid in respect of the claimant in respect of the period between the claimant's entry into insurance and the day for which the benefit is claimed, and
(b) that not less than forty-eight employment contributions have been paid in respect of or credited to the claimant in respect of the last complete contribution year before the beginning of the benefit year which includes the day for which the benefit is claimed,
but, as respects unemployment benefit, employment contributions under paragraph 3, 3A or 8 of the Second Schedule to this Act paid in respect of the claimant shall be disregarded in determining for the purposes of each of the foregoing conditions the number of employment contributions which have been paid in respect of the claimanth.”
(5) Paragraphs 7 and 9 (inserted by section 18 of the Social Welfare Act, 1970) of the Fourth Schedule to the Principal Act are hereby amended by the substitution of the following for the last sentence in each of those paragraphs:
“For the purpose of determining whether the conditions contained in this paragraph are satisfied—
(i) a person shall be treated as having entered into insurance when (and only when) he has become for the first time an employed contributor in respect of whom employment contributions are payable under paragraphs 1, 2, 2A, 3, 3A, 6, 7 or 8 of the Second Schedule to this Act, and
(ii) contributions under paragraphs 4 and 5 (inserted by the Social Welfare (Modifications of Insurance) Regulations, 1956 (S.I. No. 236 of 1956)) of that Second Schedule shall be disregarded.”
Amendment of section 3 (3) of Social Welfare (Occupational Injuries) Act, 1966 (excepted employments).
4.—Section 3 (3) of the Social Welfare (Occupational Injuries) Act, 1966, which specifies employments to be taken to be added for the purpose of insurable (occupational injuries) employment to those specified as being excepted employments in Part II of the First Schedule to the Principal Act, is hereby amended by the insertion of the following after subparagraph (e) (inserted by section 15 (2) of the Social Welfare Act, 1972):
“(f) employment specified in paragraph 12 (inserted by the Social Welfare (No. 3) Act, 1974) of Part I of the First Schedule to the Social Welfare Act, 1952.”
Short title, construction and collective citation.
5.—(1) This Act may be cited as the Social Welfare (No. 3) Act, 1974.
(2) This Act shall be construed as one with the Social Welfare Acts, 1952 to 1974, and shall be included in the collective citation, the Social Welfare Acts, 1952 to 1974.
