ACHT AIRÍ AGUS RÚNAITHE (LEASÚ), 1939.
An Príomh-Acht.
1.—San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht Airí agus Rúnaithe, 1924 (Uimh. 16 de 1924).
An Roinn Soláthairtí.
2.—(1) Déanfar agus deintear leis seo Roinn Stáit do bhunú ar a dtabharfar mar ainm agus mar theideal an Roinn Soláthairtí.
(2) Isé cúram na Roinne Soláthairtí riaradh agus gnó na bhfeidhmeanna san a bhaineann leis na nithe seo leanas agus a bheidh dáilithe de thurus na huaire don Roinn sin fén Acht so, sé sin le rá:—
(a) rialáil agus rialú soláthairtí agus seirbhísí atá riachtanach do bheatha na ndaoine;
(b) cothabháil agus soláthar soláthairtí den tsórt san roimhráite ag an Stát no thar a cheann;
(c) soláthar agus oibriú seirbhísí den tsórt san roimhráite ag an Stát no thar a cheann.
(3) An tAire bheidh i bhfeighil na Roinne Soláthairtí bhéarfar mar theideal air an tAire Soláthairtí no (i mBéarla) the Minister for Supplies agus, fén teideal no fén ainm roimhráite sin aige, beidh sé ina chorparáid aon-fhir go síor-chomharbas agus go séala oifigiúil (ar a dtabharfar áird go hoifigiúil agus i gcúrsaí breithiúnais) agus féadfaidh dul chun dlí agus, fé réir fiat an Ard-Aighne do dheonadh, féadfar dul chun dlí leis fén ainm no fén teideal roimhráite sin aige agus féadfaidh talamh do thógaint, do shealbhú, agus do chur de láimh.
(4) Bainfidh an Príomh-Acht (ach amháin alt 1 agus fo-alt (1) d'alt 2 dhe agus na hailt de a hathghairmtear leis an Acht so no le haon Acht eile) leis an Roinn Soláthairtí agus leis an Aire bheidh ina feighil amhail is go mba le halt 1 den Phríomh-Acht do bunófaí an Roinn sin.
Feidhmeanna do dháiliú don Roinn Soláthairtí
3.—(1) Aon uair a mheasfaidh an Riaghaltas gur cheart, ar mhaithe leis an bpuiblíocht, aon fheidhm a bhaineann le ní no nithe dá luaidhtear i bhfo-alt (2) den alt deiridh sin roimhe seo do thaobhú leis an Aire Soláthairtí féadfaidh an Riaghaltas, le hordú no ar pé slí eile is dóich leo is ceart, riaradh agus gnó na feidhme sin do dháiliú don Roinn Soláthairtí agus féadfaid, le hordú no ar shlí eile mar adubhradh, an dáiliú san d'fhoirceannadh más dóich leo agus aon uair is dóich leo é bheith oiriúnach ar mhaithe leis an bpuiblíocht.
(2) Aon uair a déanfaí riaradh agus gnó feidhme do dáilíodh fén Acht so don Roinn Soláthairtí d'áireamh, mara mbeadh an dáiliú san, ar na seirbhísí puiblí bhaineann le Roinn eile Stáit, scuirfidh riaradh agus gnó na feidhme sin, chó fada le méid an dáilithe sin agus faid a mhairfidh an dáiliú san, de bheith ar na seirbhísí puiblí bhaineann leis an Roinn Stáit eile sin.
Aire gan ceannas Roinne.
4.—(1) Ní thiocfaidh d'éinní sna hAchtanna Airí agus Rúnaithe, 1924 agus 1928, no san Acht so, go mbeidh sé riachtanach gach comhalta den Riaghaltas do bheith ina Aire i bhfeighil Roinne Stáit.
(2) Bhéarfar Aire gan ceannas Roinne ar chomhalta den Riaghaltas nach Aire i bhfeighil Roinne Stáit.
(3) Féadfaidh an Riaghaltas, aon uair is dóich leo gur ceart é, ainm no teideal sonnrách ar a dtabharfar áird go hoifigiúil agus i gcúrsaí breithiúnais do cheapadh d'aon Aire áirithe gan ceannas Roinne.
Ranna d'aistriú chun Airí agus uatha.
5.—(1) Féadfaidh an Taoiseach aon uair deireadh do chur le dáiliú aon Roinne áirithe Stáit don chomhalta áirithe den Riaghaltas a bheidh an uair sin i bhfeighil na Roinne sin agus an Roinn sin do dháiliú do chomhalta eile den Riaghaltas.
(2) I ngach cás ina ndearna an Riaghaltas, an 8adh lá de Mheán Fhómhair, 1939, no dá éis sin, agus roimh dháta an Achta so do rith, dáiliú aon Roinne áirithe Stáit d'aon chomhalta áirithe den Riaghaltas d'fhoirceannadh no Roinn Stáit do dháiliú do chomhalta den Riaghaltas amhlaidh beidh an foirceannadh no an dáiliú san, agus is tuigthe go raibh riamh, bailidhe agus éifeachtúil.
Comhachta iolardha an Riaghaltais maidir le Ranna Stáit.
6.—(1) Is dleathach don Riaghaltas, pé uair is dóich leo gur ceart é, gach ní no aon ní no nithe acu so leanas do dhéanamh le hordú, sé sin le rá:—
(a) ainm aon Roinne Stáit (i nGaedhilg no i mBéarla no ionta araon) d'atharú mar is dóich leo is ceart;
(b) teideal aon Aire i bhfeighil Roinne Stáit (i nGaedhilg no i mBéarla no ionta araon) d'atharú mar is dóich leo is ceart;
(c) riaradh agus gnó aon tseirbhíse puiblí áirithe no aon bhrainse no coda den tseirbhís phuiblí sin d'aistriú o aon Roinn áirithe Stáit go dtí aon Roinn eile Stáit agus gach aistriú oifigeach agus maoine agus gach ní eile do dhéanamh do gheobhaidh leis an aistriú san gnótha agus maoine no a leanfaidh as;
(d) aon chomhacht no dualgas no feidhm áirithe bheidh dílsithe, le haon reacht no ní eile no fé, in aon Aire i bhfeighil Roinne Stáit d'aistriú ón Aire sin chun an Aire i bhfeighil aon Roinne eile Stáit;
(e) cóghléasadh d'ordú d'aon Roinn Stáit agus chuige sin aonaid riaracháin do bhunú sa Roinn Stáit sin;
(f) riaradh agus gnó aon tseirbhíse puiblí, ná beidh dáilithe go soiléir d'aon Roinn áirithe Stáit no gur eirigh aon amhras no ceist no diospóid i dtaobh a dáilithe, do dháiliú do pé Roinn Stáit is dóich leis an Riaghaltas do bheith oiriúnach;
(g) gach oiriúnú do dhéanamh ar achtacháin a mheasfaidh an Riaghaltas a leanann as éinní do rinneadar fé aon mhír acu san roimhe seo den fho-alt so.
(2) Má eiríonn aon amhras, ceist, no diospóid i dtaobh cadé an Roinn Stáit dar dáilíodh riaradh agus gnó aon tseirbhíse puiblí áirithe no aon bhrainse no coda den tseirbhís phuiblí sin no i dtaobh cé hé an tAire inar dílsíodh aon chomhacht, dualgas, no feidhm áirithe, ansan, gan dochar don chomhacht chuige sin do bheirtear don Riaghaltas leis an bhfo-alt san roimhe seo den alt so, isé an Taoiseach do bhéarfaidh breith ar an amhras, ar an gceist, no ar an diospóid sin.
(3) Má rinneadh no má deintear ar ball le reacht aon chomhacht no dualgas no feidhm áirithe do bhronnadh no do chur ar Aire i bhfeighil Roinne Stáit no má haistrítear an céanna chuige fén alt so, is tuigthe gur dáilíodh don Roinn Stáit sin an riaradh agus an gnó bhaineann le feidhmiú no cólíonadh na comhachta no an dualgais no na feidhme sin.
Eagcumas sealadach Airí.
7.—(1) Pé uair a thárlóidh do phearsain a bheidh i seilbh oifige Aire i bhfeighil Roinne Stáit go mbeidh sé, toisc easláinte no toisc gan é bheith in Éirinn no toisc éinní eile, éagcumasach go sealadach ar dhualgaisí na hoifige sin aige do chólíonadh féadfaidh an Riaghaltas, le hordú dhéanfaid roimh an éagcumas sealadach san agus ag coinne leis dóibh no le n-a linn, comhalta eile den Riaghaltas (pe'ca i bhfeighil Roinne Stáit dó no nach eadh) d'ainmniú chun go bhfeidhmeoidh, ar feadh tréimhse áirithe nach sia ná ré an éagcumais shealadaigh sin, oifig na pearsan san dá dtárlóidh amhlaidh go mbeidh sé éagcumasach go sealadach ar dhualgaisí na hoifige sin do chólíonadh.
(2) Aon uair le linn ainmniú fén alt so do bheith i bhfeidhm féadfaidh an Riaghaltas, le hordú, an t-ainmniú san do cheiliúradh agus féadfaid, go sonnrách, an t-ainmniú san do cheiliúradh amhlaidh d'fhonn ainmniú nua do dhéanamh ina ionad.
(3) Comhalta den Riaghaltas a hainmneofar fén alt so chun oifig Aire i bhfeighil Roinne Stáit d'fheidhmiú, isé is Aire i bhfeighil na Roinne sin chun gach críche faid a bheidh ag feidhmiú na hoifige sin de bhun an ainmnithe sin, ach aon uair is oiriúnach leis é féadfaidh an focal “gníomhathach” do chur i ndiaidh an teidil a bheidh aige ina Aire amhlaidh dó no, i mBéarla, an focal “acting” do chur roimh an teideal san.
(4) Má hainmnítear comhalta den Riaghaltas fén alt so chun oifig Aire i bhfeighil Roinne Stáit d'fheidhmiú ní dhéanfaidh san dochar ná deifir do cheapadh ná do shealbhaíocht oifige dhuine bheidh, tráth an ainmnithe sin, ina rúnaí pháirliminte don Aire sin.
(5) I gcás pearsa bheidh éagcumasach go sealadach do réir bhrí an chéad fho-ailt den alt so ar dhualgaisí a oifige do chólíonadh do bheith ina Aire i bhfeighil dhá Roinn Stáit no níos mó féadfar, más dóich leis an Riaghaltas gur ceart é, comhaltaí deifriúla den Riaghaltas d'ainmniú fén alt so chun oifig na pearsan san d'fheidhmiú maidir le gach ceann fé leith no aon cheann fé leith de sna Ranna Stáit sin.
Ceart rúnaithe páirliminte chun éisteacht d'fháil.
8.—(1) Beidh ceart ag rúnaí páirliminte is comhalta de Dháil Éireann chun bheith i láthair agus éisteacht d'fháil i Seanad Éireann.
(2) Beidh ceart ag rúnaí páirliminte is comhalta de Sheanad Éireann bheith i láthair agus éisteacht d'fháil i nDáil Éireann.
Comhachta agus dualgaisí Aire do leigint chun rúnaithe páirliminte.
9.—(1) Is dleathach don Riaghaltas, le hordú ar n-a dhéanamh ar iarratas Aire i bhfeighil Roinne Stáit, comhachta agus dualgaisí uile an Aire sin fé aon Acht áirithe no aon chomhacht reachtúil no dualgas reachtúil áirithe de chuid an Aire sin do leigint chun rúnaí pháirliminte an Aire sin.
(2) Beidh feidhm agus éifeacht ag na forálacha so leanas maidir le gach leigint chun rúnaí pháirliminte fén alt so, sé sin le rá:—
(a) ar iarratas an Aire gur ar iarratas uaidh do rinneadh í, no gan aon iarratas den tsórt san, féadfaidh an Riaghaltas an leigint sin do cheiliúradh tráth ar bith;
(b) beidh deireadh leis an leigint sin ar éinní no an dá ní acu so leanas do thárlachtaint, sé sin le rá, an tAire, gur ar iarratas uaidh do rinneadh an leigint sin, do scur de bheith ina Aire go mbaineann an leigint sin le n-a chomhachta agus a dhualgaisí no an rúnaí páirliminte chun a ndearnadh an leigint sin do scur de bheith ina rúnaí pháirliminte don Aire sin;
(c) déanfaidh an leigint sin, faid a bheidh sí i bhfeidhm, gach comhacht agus dualgas reachtúil a leigfe sí do thabhairt agus do dhílsiú don rúnaí pháirliminte chun a ndéanfar í;
(d) gach comhacht agus dualgas reachtúil a leigfidh an leigint sin beid infheidhmithe, agus cólíonfar iad, ag an rúnaí páirliminte sin ina ainm féin fé mhaoirseacht agus urlámhas generálta an Aire gur ar iarratas uaidh do rinneadh í agus fé réir aon choinníollacha no srianta luadhfar sa leigint sin;
(e) gach comhacht no dualgas reachtúil a leigfidh an leigint sin leanfaid, d'ainneoin na leiginte sin, de bheith dílsithe don Aire gur ar iarratas uaidh do rinneadh í ach beid có-dhílsithe dhó-san agus don rúnaí pháirliminte sin in éineacht i slí go mbeid infheidhmithe no ionchólíonta ag an Aire sin no ag an rúnaí páirliminte sin;
(f) an tAire gur ar iarratas uaidh do rinneadh í, ní chealóidh ná ní laigheadóidh an leigint sin an fhreagarthacht a bheidh air do Dháil Éireann no a bheidh air mar chomhalta den Riaghaltas maidir le feidhmiú no cólíonadh na gcomhacht agus na ndualgas reachtúil a leigfe sí.
Ainmneacha Gaedhilge Airí agus Rann áirithe.
10.—Gach Aire luaidhtear (fén ainm dob ainm dhleathach dó díreach roimh theacht i ngníomh don Bhunreacht) sa dara colún de Sceideal an Achta so, isí ainm Ghaedhilge bheidh air feasta agus is tuigthe do bheith air o theacht i ngníomh don Bhunreacht an ainm a luaidhtear sa tríú colún den Sceideal san os coinne an luaidhte sin ar an Aire sin sa dara colún san agus, an Roinn Stáit go bhfuil an tAire sin ina feighil, isí ainm Ghaedhilge bheidh uirthi feasta agus is tuigthe do bheith uirthi o theacht i ngníomh don Bhunreacht an ainm a luaidhtear sa cheathrú colún den Sceideal san os coinne an luaidhte sin ar an Aire sin sa dara colún san.

MINISTERS AND SECRETARIES (AMENDMENT) ACT, 1939.
The Principal Act.
1.—In this Act the expression “the Principal Act” means the Ministers and Secretaries Act, 1924 (No. 16 of 1924).
The Department of Supplies.
2.—(1) A Department of State to be styled and known as the Department of Supplies shall be and is hereby established.
(2) The Department of Supplies shall comprise the administration and business in respect of such functions in relation to all or any of the following matters as shall for the time being be allocated under this Act to that Department, that is to say:—
(a) the regulation and control of supplies and services essential to the life of the community;
(b) the maintenance and provision by or on behalf of the State of such supplies as aforesaid;
(c) the provision and operation by or on behalf of the State of such services as aforesaid.
(3) The Minister who has charge of the Department of Supplies shall be styled an t-Aire Soláthairtí or (in English) the Minister for Supplies and shall be a corporation sole under his style or name aforesaid with perpetual succession and an official seal (which shall be officially and judicially noticed) and may sue and, subject to the fiat of the Attorney-General having been granted, be sued under his style or name aforesaid and may acquire, hold, and dispose of land.
(4) The Principal Act (except section 1 and sub-section (1) of section 2 thereof and the sections thereof repealed by this or any other Act) shall apply to the Department of Supplies and the Minister having charge thereof as if that Department had been established by section 1 of the Principal Act.
Allocation of functions to the Department of Supplies.
3.—(1) Whenever the Government are of opinion that any function in relation to one or more of the matters mentioned in sub-section (2) of the next preceding section ought in the public interest to be entrusted to the Minister for Supplies, the Government may, by order or by such other means as they think proper, allocate the administration and business in respect of that function to the Department of Supplies, and may by order or other means aforesaid terminate such allocation if and when they are of opinion that it is expedient in the public interest so to do.
(2) Whenever the administration and business of a function allocated under this Act to the Department of Supplies would, but for such allocation, be included in the public services comprised in another Department of State, the administration and business in respect of that function shall, to the extent of such allocation and so long as it continues, cease to be included in the public services comprised in such other Department of State.
Minister without portfolio.
4.—(1) Nothing in the Ministers and Secretaries Acts, 1924 and 1928, or this Act shall render it obligatory for every member of the Government to be a Minister having charge of a Department of State.
(2) A member of the Government who is not a Minister having charge of a Department of State shall be known as a Minister without portfolio.
(3) The Government may, whenever they think proper so to do, assign to any particular Minister without portfolio a specific style or title which shall be judicially and officially noticed.
Transfer of Departments to and from Ministers.
5.—(1) The Taoiseach may at any time terminate the assignment of a particular Department of State to the member of the Government then having charge thereof and assign such Department to another member of the Government.
(2) Every termination of the assignment of a particular Department of State to a particular member of the Government which was effected by the Government on or after the 8th day of September, 1939, and before the passing of this Act and every assignment ofa Department of State to a member of the Government which was similarly effected shall be and be deemed always to have been valid and effectual.
Divers powers of the Government in relation to Departments of State.
6.—(1) It shall be lawful for the Government, whenever they so think proper, to do by order all or any of the following things, that is to say:—
(a) to alter in such way as they think proper the name (whether in the Irish language or the English language or in both those languages) of any Department of State;
(b) to alter in such way as they think proper the title (whether in the Irish language or in the English language or in both those languages) of any Minister having charge of a Department of State;
(c) to transfer the administration and business of any particular public service or of any branch or part of any such public service from any Department of State to any other Department of State and to make all such transfers of officers and property and do all such other things as shall be incidental to or consequential on such transfer of administration and business;
(d) to transfer from any Minister having charge of a Department of State to the Minister having charge of any other Department of State any particular power, duty, or function vested by or under any statute or otherwise in the said first-mentioned Minister;
(e) to prescribe the organisation of any Department of State and for that purpose to create units of administration within such Department of State;
(f) to allocate to such Department of State as appears to the Government to be appropriate the administration and business of any public service which is not expressly allocated to any particular Department of State or in respect of the allocation of which any doubt, question, or dispute has arisen;
(g) to make all such adaptations of enactments as shall appear to the Government to be consequential on anything done by them under any of the foregoing paragraphs of this sub-section.
(2) If any doubt, question, or dispute shall arise as to the Department of State to which the administration and business of any particular public service or of any branch or part of any such public service is allocated or as to the Minister in whom any particularpower, duty, or function is vested, such doubt, question, or dispute shall, without prejudice to the power in that behalf conferred on the Government by the foregoing sub-section of this section, be determined by the Taoiseach.
(3) Whenever any particular power, duty, or function is now or shall hereafter be conferred or imposed by statute on or shall be transferred under this section to a Minister having charge of a Department of State, the administration and business in connection with the exercise, performance, or execution of such power, duty, or function shall be deemed to be allocated to the said Department of State.
Temporary inability of Ministers.
7.—(1) Whenever an individual holding the office of Minister having charge of a Department of State becomes, by reason of ill-health or on account of absence from Ireland or from any other cause, temporarily unable to discharge the duties of his said office, the Government may by order made before and in contemplation of or during such temporary inability nominate another member of the Government (whether having or not having charge of a Department of State) to execute, during a specified period not exceeding the duration of such temporary inability, the office of the said individual who has so become temporarily unable to discharge the duties of that office.
(2) The Government may by order at any time while a nomination under this, section is in force revoke such nomination and, in particular, may so revoke such nomination for the purpose of making a new nomination in lieu thereof.
(3) A member of the Government who is nominated under this section to execute the office of a Minister having charge of a Department of State shall, while he is exercising that office in pursuance of such nomination, be for all purposes the Minister having charge of the said Department but may, if and whenever it appears to him to be convenient so to do, add the word “gníomhathach” or, in English, prefix the word “acting” to his title as such Minister.
(4) The nomination under this section of a member of the Government to execute the office of a Minister having charge of a Department of State shall not prejudice or affect the appointment or tenure of office of a person holding at the time of such nomination the office of parliamentary secretary to such Minister.
(5) Where an individual who becomes temporarily unable within the meaning of the first sub-section of this section to discharge the duties of his office holds office as Minister in charge oftwo or more Departments of State, different members of the Government may, where the Government so think proper, be nominated under this section to execute the office of such individual in respect of each or any of the said Departments of State.
Right of audience of parliamentary secretaries.
8.—(1) A parliamentary secretary who is a member of Dáil Eireann shall have the right to attend and be heard in Seanad Eireann.
(2) A parliamentary secretary who is a member of Seanad Eireann shall have the right to attend and be heard in Dáil Eireann.
Delegation of Ministerial powers and duties to parliamentary secretaries.
9.—(1) It shall be lawful for the Government, by order made on the request of a Minister having charge of a Department of State, to delegate to the parliamentary secretary to such Minister all the powers and duties of such Minister under any particular Act or any particular statutory power or statutory duty of such Minister.
(2) The following provisions shall apply and have effect in relation to every delegation to a parliamentary secretary under this section, that is to say:—
(a) the Government may at any time revoke such delegation either at the request of the Minister on whose request it was made or without any such request;
(b) such delegation shall terminate on the happening of either or both of the following events, that is to say, the Minister on whose request such delegation was made ceasing to be the Minister to whose powers and duties such delegation relates or the parliamentary secretary to whom such delegation was made ceasing to be parliamentary secretary to the said Minister;
(c) such delegation shall operate, so long as it continues in force, to confer on and vest in the parliamentary secretary to whom it is made every of the statutory powers and duties delegated by such delegation;
(d) every statutory power and duty delegated by such delegation shall be exerciseable and performed by such parliamentary secretary in his own name but subject to the general superintendence and control of the Minister on whose request it was made and subject to any conditions or restrictions stated in such delegation;
(e) every statutory power or duty delegated by such delegation shall, notwithstanding such delegation continue to bevested in the Minister on whose request such delegation was made but shall be so vested concurrently with such parliamentary secretary and so as to be capable of being exercised or performed by either such Minister or such parliamentary secretary;
(f) such delegation shall not remove or derogate from the responsibility of the Minister on whose request it was made to Dáil Eireann or as a member of the Government for the exercise or performance of the statutory powers and duties thereby delegated.
The Irish names of certain Ministers and Departments.
10.—The name in the Irish language of every Minister who is mentioned (by the name which was his lawful name immediately before the coming into operation of the Constitution) in the second column of the Schedule to this Act shall be and be deemed to have been, as from the coming into operation of the Constitution, the name stated in the third column of the said Schedule opposite the said mention of such Minister in the said second column, and the name in the Irish language of the Department of State of which such Minister has charge shall be and be deemed, as from the coming into operation of the Constitution, to have been the name stated in the fourth column of the said Schedule opposite the said mention of such Minister in the said second column.
Repeals.
11.—Sections 11 and 12 of the Principal Act and section 4 of the Ministers and Secretaries (Amendment) Act, 1928 (No. 6 of 1928), are hereby repealed.
Commencement.
12.—This Act shall be deemed to have come into force on the 8th day of September, 1939, and shall have and be deemed to have had effect as on and from that day.
Short title, construction, and citation.
13.—(1) This Act may be cited as the Ministers and Secretaries (Amendment) Act, 1939.
(2) This Act shall be construed as one with the Ministers and Secretaries Acts, 1924 and 1928, and those Acts and this Act may be cited together as the Ministers and Secretaries Acts, 1924 to 1939.
