CUID I.

Réamhraiteach agus Ginearálta.

Gearrtheideal, comhlua agus forléiriú.

1.—(1) Féadfar an tAcht Rialtais Áitiúil (Uimh. 2), 1960, a ghairm den Acht seo.

(2) Folóidh an comhlua “na hAchtanna Rialtais Áitiúil, 1925 go 1960” an tAcht seo.

[EN]

(3) Forléireofar le chéile mar aon Acht amháin na hAchtanna Rialtais Áitiúil, 1925 go 1960.

Léiriú.

2.—(1) San Acht seo ciallaíonn “an tAire iomchuí”—

(a) má bhaineann an fáil ar iasacht, an tabhairt ar iasacht nó an tógáil a bheidh i gceist le nithe a bhfuil na feidhmeanna Aire maidir leo dílsithe san aon Aire amháin seachas an tAire Rialtais Áitiúil—an tAire sin,

(b) má bhaineann sé le nithe a bhfuil na feidhmeanna Aire maidir leo dílsithe i mbeirt Airí nó níos mó (nach é an tAire Rialtais Áitiúil ceachtar acu nó aon Aire acu)— cibé Aire de na hAirí sin is mó a mbaineann na nithe sin leis, agus

(c) i ngach uile chás eile—an tAire Rialtais Áitiúil.

(2) Má éiríonn amhras ar bith, maidir le mír (b) den fho-alt roimhe seo, i dtaobh cé acu Aire de bheirt Airí nó níos mó ar mó a mbaineann na nithe sin leis, cinnfidh an tAire Rialtais Áitiúil an t-amhras.

(3) San Acht seo folaíonn “talamh” uisce agus aon eastát nó leas i dtalamh nó in uisce agus aon éasúint nó ceart i dtalamh nó in uisce nó chun talún nó uisce nó thar talamh nó uisce.

(4) Na tagairtí atá san Acht seo d'airgead a fháil iasacht folaíonn siad tagairtí d'airgead a fháil ar athiasacht.

Rialacháin a leagan faoi bhráid Thithe an Oireachtais.

3.—Gach rialachán a dhéanfar faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta, agus má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.

CUID II.

Airgead a Fháil agus a Thabhairt ar Iasacht.

Airgead a fháil ar iasacht.

4.—(1) Faoi réir fho-alt (2) den alt seo agus aon rialachán faoi fho-alt (3) den alt seo—

(a) féadfaidh údarás áitiúil airgead a fháil ar iasacht,

[EN]

(b) féadfar airgead a fháil ar iasacht ar mhodh ar bith is oiriúnach leis an údarás áitiúil, lena n-áirítear, go sonrach, é a fháil ar iasacht trí mhorgáiste, billí malairte a tharraingí, stoc nó bannaí a eisiúint, iasacht sealadach nó rótharraingt,

(c) féadfar an iasacht agus an t-ús nó na díbhinní uirthi a urrú ar ioncam, cistí nó maoin an údaráis áitiúil,

(2) (a) Ní bhfaighfear airgead ar iasacht faoin alt seo, seachas iasacht eiscthe, ach amháin le ceadú an Aire iomchuí.

(b) Féadfaidh an tAire iomchuí, le treorú, aon iasacht a eisceadh ón mír sin roimhe seo, agus forléireofar an tagairt sa mhír sin d'iasacht eiscthe mar thagairt d'iasacht a bheidh eiscthe amhlaidh.

(3) Féadfaidh an tAire Rialtais Áitiúil, tar éis dó dul i gcomhairle leis an Aire Airgeadais, rialacháin a dhéanamh maidir le húdaráis áitiúla d'fháil airgid ar iasacht agus féadfaidh, go sonrach, foráil a bheith sna rialacháin sin maidir le gach ní nó aon ní acu seo a leanas:

(a) foinsí iasachtaí,

[EN]

(b) na tréimhsí chun iasachtaí a aisíoc,

[EN]

(c) iasachtaí a mhuirearú agus urrús ina leith,

[EN]

(d) i gcás morgáistí, a bhfoirm, na cláir a bheidh le coimeád maidir leo, a n-aistriú agus foirm na n-aistrithe sin, agus ceapadh agus cumhachtaí glacadóirí.

Iasacht a thabhairt d'údarás áitiúil eile.

5.—(1) Féadfaidh údarás áitiúil, faoi réir cheadú an Aire iomchuí, airgead a thabhairt ar iasacht, ar cibé téarmaí maidir le haisíoc agus le nithe eile is oiriúnach leo, d'údarás áitiúil eile.

(2) Má bhíonn suim, arb é a bheidh inti cuid d'iasacht a thug comhairle contae de bhun an ailt seo do choimisinéirí baile nach ceantar uirbeach agus atá sa chontae, nó ús ar aon iasacht den sórt sin, gan chur isteach san éileamh iomchuí faoi fho-alt (1) d'alt 26 den Acht Rialtais Áitiúil, 1946, measfar í a bheith curtha isteach san éileamh agus beidh éifeacht dá réir sin ag fo-alt (4) d'alt 10 den Acht sin.

(3) Is feidhm fhorcoimeádta iasacht a thabhairt faoin alt seo.

6.—(1) I gcás údarás áitiúil d'fháil airgid ar iasacht trí eisiúint stoic, cruthófar, eiseofar, aistreofar, fuasclófar agus múchfar an stoc agus déileálfar leis i cibé slí, ar cibé téarmaí agus de réir cibé forálacha a bheidh forordaithe ag an Aire Rialtais Áitiúil le rialacháin.

(2) Gan dochar do ghinearáltacht fho-alt (1) den alt seo, féadfaidh foráil a bheith i rialacháin faoin alt seo i dtaobh aon ní acu seo a leanas:

(a) urscaoileadh aon iasachta a chruinneofar tríd an stoc a eiseofar de réir na rialachán,

[EN]

(b) i gcás fiach a chomhdhlúthú, chun na tréimhsí ar laistigh díobh a fhéadfar iasachtaí a urscaoileadh, a shíneadh nó a athrú,

(c) toiliú úinéirí teoranta,

[EN]

(d) feidhm na nAchtanna a bhaineann le dleachtanna stampa agus le seiceanna,

(e) díbhinní nach n-éileofar a dhiúscairt.

(3) Gach rialachán a choimeádtar i bhfeidhm le fo-alt (6) d'alt 87 den Acht Rialtais Áitiúil, 1946, déileálfar leis, gan dochar d'fhorálacha an fho-ailt sin, mar rialacháin faoin alt seo, agus féadfar, dá réir sin, é a leasú nó a chúlghairm le rialacháin faoin alt seo.

Eisiúintí as ciste na n-iasachtaí áitiúla.

7.—Féadfar airgead a gheofar ar iasacht de bhun na Coda seo den Acht seo a thabhairt ar iasacht trí eisiúint as ciste na n-iasachtaí áitiúla ionann is dá mba iasacht áitiúil de réir bhrí Achtanna Ciste na nIasacht Áitiúla, 1935 go 1957, an iasacht sin agus go raibh sí údaraithe le hAcht ón Oireachtas.

8.—I gcás ina ndéanfaidh Aire ranníoc i leith na muirear iasachta maidir le hiasacht a gheobhaidh údarás áitiúil, féadfaidh sé, más cuí leis é agus faoi réir thoiliú an iasachtóra, aon ranníocaí den sórt sin a dhéanamh díreach leis an iasachtóir agus déileálfar leo ansin ionann agus dá mba íocaíochtaí muirear iasachta comhréire iad ón údarás áitiúil.

10.—(1) I gcás—

(a) ina mbeartóidh údarás áitiúil aon talamh, cibé acu laistigh nó lasmuigh dá limistéar feidhmiúcháin dó, a thógáil go héigeantach le haghaidh críocha ar féidir a n-údarú le dlí talamh a thógáil go héigeantach lena n-aghaidh,

(b) gur críocha seachas críocha Achtanna Tithe an Lucht Oibre, 1890 go 1958, na críocha sin nó gur críocha iad nach críocha de chuid na nAchtanna sin ach cuid acu, agus

(c) gur dóigh leis an údarás áitiúil gurbh áisiúil an tógáil a dhéanamh faoi na hAchtanna sin,

féadfaidh an t-údarás áitiúil a chinneadh an tógáil a dhéanamh amhlaidh.

(2) I gcás—

[EN]

(a) inar dóigh le húdarás áitiúil go mbeadh aon talamh áirithe, cibé acu laistigh nó lasmuigh dá límistéar feidhmiúcháin dó, oiriúnach, dá dtógfadh siad é, chun hallaí, foirgnimh agus oifigí a chur ar fáil don údarás áitiúil, agus

(b) gur dóigh leis an údarás áitiúil gurbh áisiúil an tógáil a dhéanamh faoi Achtanna Tithe an Lucht Oibre, 1890 go 1958,

féadfaidh an t-údarás áitiúil a chinneadh an tógáil a dhéanamh amhlaidh.

(3) (a) I gcás ina ndéanfaidh údarás áitiúil cinneadh faoi fho-alt (1) nó (2) den alt seo, féadfar a údarú dóibh an talamh a cheannach go héigeantach trí ordú ceannaigh éigeantach dá bhforáiltear le halt 37 d'Acht na dTithe (Forálacha Ilghnéitheacha), 1931, agus le Codanna I agus II den Dara Sceideal a ghabhann leis an Acht sin, arna leasú le hailt 24 agus 25 d'Acht na dTithe (Leasú), 1958.

(b) Chun críocha na míre roimhe seo déanfar tagairtí don Aire, gach áit ina bhfuil an focal sin in alt 37 d'Acht na dTithe (Forálacha Ilghnéitheacha), 1931, agus i gCuid I den Dara Sceideal a ghabhann leis an Acht sin agus in ailt 24 agus 25 d'Acht na dTithe (Leasú), 1958, a fhorléiriú mar thagairtí don Aire iomchuí.

(4) (a) Beidh feidhm ag forálacha alt 17 (arna leasú le fo-alt (2) d'alt 23 d'Acht na dTithe (Forálacha Airgid agus Forálacha Ilghnéitheacha), 1932) agus fho-alt (1) d'alt 41 d'Acht na dTithe (Forálacha Ilghnéitheacha), 1931, maidir le hordú arna dhéanamh de bhua an ailt seo agus déanfar tagairtí don Aire, gach áit ina bhfuil an focal sin san alt sin 17 arna fheidhmiú amhlaidh, a fhorléiriú mar thagairt don Aire iomchuí.

(b) Déantar leis seo forálacha ailt 30, 36, 45 agus 49 d'Acht na dTithe (Forálacha Ilghnéitheacha), 1931, agus forálacha alt 50 den Acht sin, arna modhnú le halt 18 d'Acht na dTithe (Leasú), 1954, a leathnú chun go mbeidh éifeacht acu chun críocha an ailt seo, agus déanfar tagairtí don Aire, gach áit ina bhfuil an focal sin i bhfo-ailt (2) agus (3) den alt sin 45 arna leathnú amhlaidh, a fhorléiriú mar thagairtí don Aire iomchuí.

(c) Beidh feidhm ag forálacha fho-alt (2) d'alt 18 d'Acht na dTithe (Forálacha Ilghnéitheacha), 1931, arna leasú le halt 20 d'Acht na dTithe (Leasú), 1958, maidir le talamh a thógfar trí ordú a dhéanfar de bhua an ailt seo.

(5) Beidh feidhm ag forálacha alt 32 d'Acht na dTithe (Leasú), 1948, maidir leis na costais is iníoctha ag údarás áitiúil maidir le talamh a thógáil trí ordú a dhéanfar de bhua an ailt seo.

(6) (a) I gcás—

[EN]

(i) ina ndéanfar ordú de bhua an ailt seo, agus

[EN]

(ii) go mbeidh ceart slí poiblí thar an talamh, nó thar aon chuid den talamh, lena mbainfidh an t-ordú,

[EN]

féadfaidh an t-ordú a údarú don údarás áitiúil, trí ordú a dhéanfaidh siad tar éis dóibh an talamh sin nó an chuid sin de a thógáil, an ceart slí sin a mhúchadh.

(b) I gcás—

[EN]

(i) ina n-údaróidh ordú a dhéanfar de bhua an ailt seo ceart slí poiblí a mhúchadh, agus

[EN]

(ii) mura mbeadh an mhír seo, nach mbeadh d'oibleagáid ar an Aire a chur faoi deara fiosrúchán áitiúil poiblí a dhéanamh de bhun Chuid I den Dara Sceideal a ghabhann le hAcht na dTithe (Forálacha Ilghnéitheacha), 1931,

beidh d'oibleagáid ar an Aire a chur faoi deara an fiosrúchán a dhéanamh ach amháin nuair is cuí leis gan an t-ordú a dhaingniú.

(7) Féadfar a údarú d'údarás áitiúil, i gcás ina mbeidh cinneadh déanta acu faoi fho-alt (1) den alt seo, talamh a cheannach go héigeantach trí aon ordú amháin a dhéanfar de bhua an ailt seo, is cuma cad é an méid críocha chun a mbeidh an talamh ag teastáil.

(8) I gcás ina mbeartóidh údarás áitiúil ordú a dhéanamh de bhua an ailt seo agus gur lasmuigh dá limistéar feidhmiúcháin don talamh, ní gá dóibh an toiliú dá bhforáiltear in alt 29 d'Acht na dTithe (Leasú), 1952, a fháil.

11.—(1) I bhfo-alt (1) d'alt 10 den Local Government (Ireland) Act, 1898—

(b) go mbeadh an comhlacht, arb é an páirtí eile sa chomhaontú é, údaraithe le dlí, dá bhfeidhmeodh siad nó dá gcomhlíonfadh siad an chumhacht, an fheidhm nó an dualgas, aon ghníomh nó rud a dhéanamh maidir leis an bhfeidhmiú nó an comhlíonadh sin,

beidh údarás ag an údarás áitiúil, ionann is dá mba iad an comhlacht sin iad, an gníomh nó an rud sin a dhéanamh maidir le feidhmiú nó comhlíonadh na cumhachta, na feidhme nó an dualgais.

Cumhacht údaráis áitiúil chun talamh a iniúchadh.

13.—(1) Aon oifigeach nó gníomhaire d'údarás áitiúil a bheidh údaraithe go cuí chuige sin ag an údarás, féadfaidh sé, faoi réir fhorálacha an ailt seo, dul isteach ar aon talamh gach tráth réasúnach idir 9 a.m. agus 6 p.m. chun a fháil amach cé acu atá nó nach bhfuil an talamh oiriúnach lena thógáil ag an údarás.

(2) Aon duine a rachaidh isteach ar thalamh faoin alt seo féadfaidh sé gach ní a dhéanamh ann is gá chun na críche is cúis leis an dul isteach agus, go háirithe, féadfaidh sé suirbhéireacht a dhéanamh, pleananna a dhéanamh, leibhéil a thógáil, tochailt a dhéanamh agus doimhneas na fo-ithreach a scrúdú agus a fháil amach cén saghas í.

(3) Sula dté duine isteach ar aon talamh faoin alt seo, déanfaidh an t-údarás áitiúil arb ar a n-údarás a bheartófar dul isteach toiliú an áititheora (i gcás talamh áitithe) nó (i gcás talamh gan áititheoir) toiliú an úinéara a fháil, nó tabharfaidh siad don úinéir nó don áititheoir (de réir mar a bheidh) fógra ceithre lá déag ar a laghad i scríbhinn i dtaobh é a bheith ar intinn dul isteach.

(4) Aon duine dá mbeidh fógra faoin alt seo tugtha ag údarás áitiúil i dtaobh é a bheith ar intinn dul isteach ar thalamh féadfaidh sé, ceithre lá déag ar a dhéanaí tar éis an fógra sin a thabhairt, a iarraidh, tar éis fógra a thabhairt don údarás áitiúil sin, ar an mbreitheamh den Chúirt Dúiche ag a mbeidh dlínse sa cheantar ina bhfuil an talamh ordú a dhéanamh ag toirmeasc an dul isteach, agus, ar an iarratas a éisteacht, féadfaidh an breitheamh, más cuí leis sin, an dul isteach a thoirmeasc ar fad nó coinníollacha a shonrú a dhlífidh an duine a rachaidh isteach déanamh dá réir.

(5) I gcás ina dtoirmiscfidh breitheamh den Chúirt Dúiche faoin alt seo dul isteach ar thalamh a bheidh beartaithe, ní dleathach do dhuine ar bith dul isteach ar an talamh sin faoin alt seo, agus i gcás ina sonróidh breitheamh den Chúirt Dúiche coinníollacha a dhlífidh daoine a rachaidh isteach ar an talamh déanamh dá réir déanfaidh gach duine a rachaidh isteach ar an talamh faoin alt seo de réir na gcoinníollacha a shonrófar amhlaidh.

(6) Aon duine a fhulaingeoidh damáiste trí aon ní a dhéanfar faoin alt seo ar aon talamh agus a dhéanfaidh éileamh, laistigh de shé mhí tar éis an rud sin a dhéanamh, ar chúiteamh i leith an damáiste chun an údaráis áitiúil ar faoina n-údarás a chuathas isteach ar an talamh faoin alt seo, beidh teideal aige go n-íocfaidh an t-údarás leis cúiteamh réasúnach sa damáiste agus, mura n-íocfar an cúiteamh sin leis i gcás comhaontú nó cinneadh a bheith déanta faoin alt seo i dtaobh a mhéid, féadfar é a ghnóthú ón údarás in aon chúirt dlínse inniúla mar fhiach conartha shimplí.

(7) Mura ndéantar comhaontú, déanfar méid aon chúitimh is iníoctha ag údarás áitiúil faoin alt seo a chinneadh, muran mó ná caoga punt an méid a éileofar ina leith, ag an gCúirt Dúiche nó, in aon chás eile, cinnfear é trí eadráin faoin Acquisition of Land (Assessment of Compensation) Act, 1919 (arna leasú le hachtacháin ina dhiaidh sin) ionann agus dá mba luach talún a tógadh go héigeantach an cúiteamh sin.

(8) Gach duine a dhéanfaidh, trí ghníomh nó neamhghníomh, oifigeach nó gníomhaire d'údarás áitiúil a bhac agus é ag feidhmiú go dleathach na gcumhachtaí a thugtar leis an alt seo, beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná cúig phunt a chur air maraon le fineáil bhreise, i gcás ciona leanúnaigh, nach mó ná punt in aghaidh gach lae a leanfar den chion.

AN ACT TO MAKE FURTHER AND BETTER PROVISION IN RELATION TO LOCAL GOVERNMENT AND TO MAKE CERTAIN AMENDMENTS IN THE LAW RELATING TO LOCAL GOVERNMENT AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. [21st December, 1960.] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA][GA]

PART I.

Preliminary and General.

Short title, collective citation and construction.

1.—(1) This Act may be cited as the Local Government (No. 2) Act, 1960.

[GA]

(2) The collective citation “the Local Government Acts, 1925 to 1960” shall include this Act.

[GA]

(3) The Local Government Acts, 1925 to 1960, shall be construed together as one Act.

[GA]

Interpretation.

2.—(1) In this Act “the appropriate Minister” means—

[GA]

(a) if the relevant borrowing, lending or acquisition relates to matters as respects which the Ministerial functions relating to them are vested in a single Minister other than the Minister for Local Government—that Minister,

[GA]

(b) if it relates to matters as respects which the Ministerial functions relating to them are vested in two or more Ministers (neither or none of whom is the Minister for Local Government)—such one of those Ministers as has the greater or greatest interest in the matters, and

[GA]

(c) in all other cases—the Minister for Local Government.

[GA]

(2) If, in relation to paragraph (b) of the foregoing subsection, any doubt arises as to which one of two or more Ministers has the greater or greatest interest, the doubt shall be determined by the Minister for Local Government.

(3) In this Act “land” includes water and any estate or interest in land or water and any easement or right in, to or over land or water.

[GA]

(4) References in this Act to borrowing include references to reborrowing.

[GA]

Laying of regulations before Houses of the Oireachtas.

3.—Every regulation made under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly but without prejudice to the validity of anything previously done thereunder.

PART II.

Borrowing and Lending of Money.

[GA]

Borrowing.

4.—(1) Subject to subsection (2) of this section and any regulations under subsection (3) of this section—

(a) a local authority may borrow money,

[GA]

(b) the borrowing may be effected in any manner which the local authority consider suitable, including, in particular, by way of mortgage, drawing of bills of exchange, issue of stock or bonds, temporary loan or overdraft,

[GA]

(c) the loan and the interest or dividends thereon may be secured on the revenues, funds or property of the local authority.

[GA]

(2) (a) Borrowing under this section, other than excepted borrowing, shall not be effected save with the sanction of the appropriate Minister.

[GA]

(b) The appropriate Minister may by direction except any borrowing from the foregoing paragraph, and the reference in that paragraph to excepted borrowing shall be construed as a reference to borrowing so excepted.

(3) The Minister for Local Government may, after consultation with the Minister for Finance, make regulations in relation to borrowing by local authorities and such regulations may, in particular, make provision with respect to all or any of the following matters:

(a) sources of loans,

[GA]

(b) periods for repayment of loans,

[GA]

(c) charging of and security for loans,

[GA]

(d) in the case of mortgages, the form thereof, the registers to be kept in relation thereto, the transfer thereof and the form of such transfers and the appointment and powers of receivers.

Lending to another local authority.

5.—(1) A local authority may, subject to the sanction of the appropriate Minister, lend money, on such terms as to repayment and other matters as they consider proper, to another local authority.

(2) If a sum, which consists either of a portion of a loan advanced pursuant to this section by the council of a county to the commissioners of a town which is not an urban district and which is situated in the county, or of interest on any such loan, is not included in the appropriate demand under subsection (1) of section 26 of the Local Government Act, 1946, it shall be deemed to have been included in the demand and subsection (4) of section 10 of that Act shall have effect accordingly.

(3) Lending under this section shall be a reserved function.

Issue of stock.

6.—(1) Where a local authority borrow by way of an issue of stock, the stock shall be created, issued, transferred, dealt with, redeemed and extinguished in such manner, on such terms and in accordance with such provisions as may be prescribed by the Minister for Local Government by regulations.

(2) Without prejudice to the generality of subsection (1) of this section, regulations under this section may make provision in respect of any of the following matters:

[GA]

(a) the discharge of any loan raised by the stock issued in accordance with the regulations,

[GA]

(b) in the case of consolidation of debt, for extending or varying the times within which loans may be discharged,

[GA]

(c) consent of limited owners,

[GA]

(d) the application of the Acts relating to stamp duties and to cheques,

[GA]

(e) disposal of unclaimed dividends.

[GA]

(3) Every regulation continued in force by subsection (6) of section 87 of the Local Government Act, 1946, shall, without prejudice to the provisions of that subsection, be treated as regulations made under this section and, as so treated, shall be capable of being amended or revoked by regulations under this section.

Issues from local loans fund.

7.—Money borrowed pursuant to this Part of this Act may be lent by means of an issue from the local loans fund as if the loan constituted a local loan within the meaning of the Local Loans Fund Acts, 1935 to 1957, and was authorised by an Act of the Oireachtas.

Payment of contributions to loan charges to lender.

8.—Where a Minister makes contributions to the loan charges in respect of a loan obtained by a local authority, he may, if he so thinks proper and subject to the consent of the lender, make any such contributions directly to the lender and they shall then be treated as corresponding payments of loan charges by the local authority.

General restriction.

9.—A local authority shall not

[GA]

(a) borrow money, or

[GA]

(b) lend money to another local authority,

[GA]

save pursuant to this Part of this Act.

PART III.

Miscellaneous.

[GA]

Extension of compulsory acquisition under Housing of the Working Classes Acts, 1890 to 1958.

10.—(1) Where—

[GA]

(a) a local authority intend to acquire compulsorily any land, whether situate within or outside their functional area, for purposes for which they are capable of being authorised by law to acquire land compulsorily,

[GA]

(b) those purposes are purposes other than the purposes of the Housing of the Working Classes Acts, 1890 to 1958, or are purposes some only of which are purposes of those Acts, and

[GA]

(c) the local authority consider that it would be convenient to effect the acquisition under those Acts,

[GA]

the local authority may decide so to effect the acquisition.

[GA]

(2) Where—

[GA]

(a) a local authority consider that any land, whether situate within or outside their functional area, would, if acquired by them, be suitable for the provision of halls, buildings and offices for the local authority, and

[GA]

(b) the local authority consider that it would be convenient to effect the acquisition under the Housing of the Working Classes Acts, 1890 to 1958,

[GA]

the local authority may decide so to effect the acquisition.

[GA]

(3) (a) Where a local authority make a decision under subsection (1) or (2) of this section, they may be authorised to purchase the land compulsorily by means of a compulsory purchase order as provided for by section 37 of the Housing (Miscellaneous Provisions) Act, 1931, and Parts I and II of the Second Schedule thereto, as amended by sections 24 and 25 of the Housing (Amendment) Act, 1958.

(b) For the purposes of the foregoing paragraph “the Minister”, wherever that expression occurs in section 37 of the Housing (Miscellaneous Provisions) Act, 1931, and Part I of the Second Schedule thereto and in sections 24 and 25 of the Housing (Amendment) Act, 1958, shall be construed as referring to the appropriate Minister.

(4) (a) The provisions of section 17 (as amended by subsection (2) of section 23 of the Housing (Financial and Miscellaneous Provisions) Act, 1932) and subsection (1) of section 41 of the Housing (Miscellaneous Provisions) Act, 1931, shall apply in relation to an order made by virtue of this section and “the Minister”, wherever that expression occurs in the said section 17 as so applied, shall be construed as referring to the appropriate Minister.

(b) The provisions of sections 30, 36, 45 and 49 of the Housing (Miscellaneous Provisions) Act, 1931, and the provisions of section 50 of that Act as modified by section 18 of the Housing (Amendment) Act, 1954, are hereby extended so as to have effect for the purposes of this section, and “the Minister”, wherever that expression occurs in subsections (2) and (3) of the said section 45 as so extended, shall be construed as referring to the appropriate Minister.

(c) The provisions of subsection (2) of section 18 of the Housing (Miscellaneous Provisions) Act, 1931, as amended by section 20 of the Housing (Amendment) Act, 1958, shall apply in relation to land acquired by means of an order made by virtue of this section.

(5) The provisions of section 32 of the Housing (Amendment) Act, 1948, shall apply with respect to the costs payable by a local authority in respect of the acquisition of land by means of an order made by virtue of this section.

[GA]

(6) (a) Where—

[GA]

(i) an order is made by virtue of this section, and

[GA]

(ii) there is a public right of way over the land to which the order relates or any part thereof,

[GA]

the order may authorise the local authority, by order made by them after they have acquired such land or part, to extinguish the right of way.

[GA]

(b) Where—

[GA]

(i) an order made by virtue of this section authorises the extinguishment of a public right of way, and

[GA]

(ii) apart from this paragraph, it would not be obligatory on the Minister to cause a public local inquiry to be held pursuant to Part I of the Second Schedule to the Housing (Miscellaneous Provisions) Act, 1931,

[GA]

it shall be obligatory on the Minister to cause the inquiry to be held save where he thinks fit not to confirm the order.

[GA]

(7) A local authority may, in a case in which they have made a decision under subsection (1) of this section, be authorised to purchase land compulsorily by means of a single order made by virtue of this section irrespective of the number of the purposes for which the land is required.

(8) Where a local authority intend to make an order by virtue of this section and the land is situate outside their functional area, it shall not be necessary for them to obtain the consent provided for by section 29 of the Housing (Amendment) Act, 1952.

Amendment of section 10 of Local Government (Ireland) Act, 1898.

11.—(1) In subsection (1) of section 10 of the Local Government (Ireland) Act, 1898—

(a) “A county council” shall be construed as referring to any local authority,

[GA]

(b) “county” shall, in both places where that word occurs without qualification, be construed as referring to the functional area of the local authority in question, and

[GA]

(c) “powers and duties” shall be construed as referring to all such powers, functions and duties as may at any material time stand exercisable or performable by the local authority in question.

[GA]

(2) In subsection (2) of the said section 10 “A county council” shall be construed as referring to any local authority.

[GA]

Extension of certain authorisations.

12.—Where—

[GA]

(a) consequent upon an agreement under section 59 of the Local Government Act, 1955, a power, function or duty becomes exercisable or performable by a local authority, and

[GA]

(b) the body which is the other party to the agreement would, if they exercised or performed the power, function or duty, be authorised by law to do any act or thing in relation to such exercise or performance,

[GA]

the local authority shall be authorised to do that act or thing in relation to the exercise or performance by them of the power, function or duty as if they were that body.

[GA]

Power of local authority to inspect land.

13.—(1) An officer or agent of a local authority who is duly authorised in that behalf by the authority may, subject to the provisions of this section, enter on any land at all reasonable times between the hours of 9 a.m. and 6 p.m. for the purpose of ascertaining whether the land is or is not suitable for acquisition by the authority.

(2) A person entering on land under this section may do thereon all things reasonably necessary for the purpose for which the entry is made and, in particular, may survey, make plans, take levels, make excavations, and examine the depth and nature of the subsoil.

[GA]

(3) Before a person enters under this section on any land, the local authority on whose authority the entry is proposed to be made shall either obtain the consent (in the case of occupied land) of the occupier or (in the case of unoccupied land) the owner or shall give to the owner or occupier (as the case may be) not less than fourteen days' notice in writing of the intention to make the entry.

(4) A person to whom a notice of intention to enter on land has been given under this section by a local authority may, no later than fourteen days after the giving of such notice, apply, on notice to such local authority, to the justice of the District Court having jurisdiction in the district in which the land is situate for an order prohibiting the entry, and, upon the hearing of the application, the justice may, if he so thinks proper, either wholly prohibit the entry or specify conditions to be observed by the person making the entry.

(5) Where a justice of the District Court prohibits under this section a proposed entry on land, it shall not be lawful for any person to enter under this section on the land, and where a justice of the District Court specifies under this section conditions to be observed by persons entering on land, every person who enters under this section on the land shall observe the conditions so specified.

(6) A person who suffers damage by anything done under this section on any land and, within six months after such thing is done, makes to the local authority on whose authority the land was entered under this section a claim for compensation in respect of the damage shall be entitled to be paid by the authority reasonable compensation for the damage and, in default of being paid such compensation when the amount thereof has been agreed upon or has been determined under this section, to recover it from the authority in any court of competent jurisdiction as a simple contract debt.

(7) In default of agreement, the amount of any compensation payable by a local authority under this section shall, if the amount claimed in respect thereof does not exceed fifty pounds, be determined by the District Court or, in any other case, be determined by arbitration under the Acquisition of Land (Assessment of Compensation) Act, 1919 (as amended by subsequent enactments) as if the compensation were the price of land compulsorily acquired.

(8) Every person who, by act or omission, obstructs an officer or agent of a local authority in the lawful exercise of the powers conferred by this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding five pounds together with, in the case of a continuing offence, a further fine not exceeding one pound for every day on which the offence is continued.

Annual contributions to County Councils General Council.

14.—(1) The council of a county may, subject to such limits as may be fixed from time to time by the Minister for Local Government, make annual contributions to the funds of the County Councils General Council.

(2) Subsection (1) of this section shall come into operation on the 1st day of April, 1961, and no payment by way of subscription shall be made after that day under section 16 of the Local Government (Ireland) Act, 1902, as amended by section 78 of the Local Government Act, 1925.
