CUID I.

1.—(1) Féadfar an tAcht Stroighne (Leasú), 1938, do ghairm den Acht so.
(2) Féadfar na hAchtanna Stroighne, 1933 agus 1938, do ghairm den Phríomh-Acht agus den Acht so le chéile.
Míniú agus léiriú.
2.—(1) San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht Stroighne, 1933 (Uimh. 17 de 1933).
(2) Léireofar an Príomh-Acht agus an tAcht so mar éinní amháin, agus dá réir sin gach focal no abairt dá dtugtar brí áirithe leis an bPríomh-Acht no ann chun crícheanna an Achta san tá leis san Acht so an brí tugtar dó amhlaidh.
Athghairm.
3.—Na hachtacháin a luaidhtear sa Sceideal a ghabhann leis an Acht so athghairmtear leis seo iad sa mhéid a luaidhtear sa tríú colún den Sceideal san.
Costaisí.
4.—Sa mhéid go gceadóidh an tAire Airgeadais é is amach as airgead a sholáthróidh an tOireachtas a híocfar na costaisí uile fé n-a raghaidh an tAire fén Acht so.

Alt 24 den Phríomh-Acht do leasú.
5.—Leasuítear leis seo alt 24 den Phríomh-Acht tríd an bhfo-alt so leanas do chur isteach ann in ionad fo-ailt (2), agus léireofar an t-alt san agus beidh éifeacht aige dá réir sin, sé sin le rá:—
“(2) Beidh i dteanta gach iarratais ar ordú oibreacha iompair dréacht den ordú bheidh á iarraidh, plean de sna hoibreacha iompair a bheidh beartuithe a dhéanamh agus leabhar eolais don phlean san agus is sa bhfuirm sin ordóidh an tAire bheidh an dréacht, an plean agus an leabhar eolais sin.”

6.—Leasuítear leis seo fo-alt (1) d'alt 25 den Phríomh-Acht tríd an mír nua so leanas do chur ina dheireadh, agus léireofar an t-alt san agus beidh éifeacht aige dá réir sin, sé sin le rá:—
“(c) cóip den dréacht-ordú, den phlean agus den leabhar eolais sin do chur chun na ndaoine sin (más ann dóibh) ordóidh an tAire.”

8.—Leasuítear leis seo alt 28 den Phríomh-Acht sna slite seo leanas, agus léireofar é agus beidh éifeacht aige dá réir sin, sé sin le rá:—
(a) tré sna focail “agus tar éis dó dul i gcomhairle leis an Aire Riaghaltais Aiteamhail agus Sláinte Poiblidhe,” do chur isteach i ndiaidh na bhfocal “an bhreithnithe sin”; agus

Forálacha maidir le hordú oibreacha iompair.
9.—(1) Beidh éifeacht ag na forálacha so leanas maidir le hordú oibreacha iompair a deonfar do shealbhóir cheadúnais déantóireachta stroighne, sé sin le rá:—
(a) beidh san ordú san na forálacha san is dóich leis an Aire is gá no is oiriúnach chun críche an orduithe sin;
(b) gan dochar do gheneráltacht mhíre (a) den fho-alt so—
(i) féadfaidh forálacha bheith san ordú san á údarú don tsealbhóir sin aon talamh do thógaint go héigeanta is dóich leis an Aire is gá do thógaint chun éifeacht do thabhairt don ordú san,
(ii) féadfar leis an ordú san aon chirt, i dtalamh no in uisce no ar an gcéanna no in aon bhóthar puiblí no ar an gcéanna, do dheonadh don tsealbhóir sin is dóich leis an Aire is gá do dheonadh chun éifeacht do thabhairt don ordú san,
(iii) forálfar leis an ordú san, maidir le haon talamh a tógfar amhlaidh no le haon cheart ar thalamh no ar uisce deonfar amhlaidh, go n-íocfaidh an sealbhóir sin cúiteamh leis na daoine uile agus fé seach go mbeidh estáit no leasanna acu sa talamh no san uisce sin, agus forálfar leis gur fé réim agus do réir an Acquisition of Land (Assessment of Compensation) Act, 1919, a bhéarfar breith ar aon cheist maidir le heasaontas i dtaobh cúitimh,
(iv) féadfar gach ceann no aon cheann d'fhorálacha na nAchtanna Clásanna Talmhan, gus na hatharuithe agus na hoiriúnuithe sin ortha is dóich leis an Aire is ceart, d'ionchorprú san ordú san,

(vi) féadfaidh forálacha bheith san ordú san i dtaobh na slí ina mbeidh na hoibreacha iompair sin le hoibriú agus le cothabháil,
(vii) beidh forálacha san ordú san á ordú gan na hoibreacha iompair sin d'úsáid ach chun crícheanna bhainfidh leis an ngnó a húdaruítear leis an gceadúnas déantóireachta stroighne sin agus chun na gcrícheanna eile sin (más ann dóibh) a luadhfar san ordú san,
(viii) beidh san ordú san na forálacha san uile is dóich leis an Aire is ceart chun na puiblíochta i gcoitinne agus aon daoine dá ndéanfaidh an t-ordú san deifir do chaomhnadh,
(ix) féadfar a fhoráil leis an ordú san go mbeidh an sealbhóir sin ciontach i gcionta fén ordú san má sháruíonn sé (tré ghníomh no tré fhaillí) aon fhoráil áirithe den ordú san agus, ar a chiontú ann ar an slí achmair, go ndlighfear pé fíneáil (nach mó ná céad punt) a luadhfar san ordú san alos an chionta san do chur air agus, más cionta leanúnach é, pé fíneáil bhreise (nach mó ná fiche punt) a luadhfar san ordú san alos an chionta san in aghaidh gach lae leanfaidh den chionta san do dhéanamh tar éis a chiontuithe ann,
(x) féadfar aon fhorálacha (ar a n-áirmhítear forálacha peannaideacha) a bheidh in aon achtachán a bhainfidh le bóithre iarainn d'ionchorprú san ordú san gus na hoiriúnuithe agus na hatharuithe sin ortha is dóich leis an Aire is ceart,
(xi) féadfar a fhoráil leis an ordú san gur tré eadrascán a bhéarfar breith ar aon cheisteanna áirithe eireoidh fé,
(xii) féadfaidh na forálacha san, a bhaineann no ghabhann le haon cheann de sna cúrsaí roimhráite agus is dóich leis an Aire is gá agus is ceart, a bheith san ordú san.
(2) Féadfaidh an tAire, fé alt 30 den Phríomh-Acht, aon ordú oibreacha iompair do rinneadh roimh an Acht so do rith do leasú tré aon fhoráil do chur san ordú oibreacha iompair sin a féadfaí go dleathach a chur ann dá mbeadh an t-alt so i bhfeidhm nuair do rinneadh an t-ordú oibreacha iompair sin.
(3) Beidh feidhm dlí ag gach ordú do rinneadh fé Chuid IV den Phríomh-Acht no a déanfar fén gCuid sin IV mar a leasuítear leis an Acht so í.
(4) Na costaisí uile fé n-a raghaidh an tAire i bhfeidhmiú a chomhacht agus a fheidhmeanna fé ordú oibreacha iompair déanfaidh an té dá ndeonfar an t-ordú san iad d'íoc leis an Aire sa mhéid a chinnfidh an tAire Airgeadais.
Rialacháin i dtaobh oibreacha iompair do chothabháil agus d'oibriú.
10.—Má bhíonn ordú oibreacha iompair déanta ag an Aire (pe'ca roimh an Acht so do rith do rinne é no dá éis sin) á údarú do dhuine (dá ngairmtear an duine údaruithe san alt so) saghas áirithe oibreacha iompair do dhéanamh, do chothabháil agus d'oibriú, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) féadfaidh an tAire rialacháin (ná beidh buiniscionn leis an ordú san) do dhéanamh i dtaobh na slí ina mbeidh na hoibreacha iompair sin le cothabháil agus le hoibriú ag an duine údaruithe agus ag aon duine eile bheidh ag oibriú na n-oibreacha san thar ceann an duine údaruithe;
(b) má sháruíonn an duine údaruithe no an duine eile sin na rialacháin sin (tré ghníomh no tré fhaillí) beidh an duine údaruithe ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air agus, más cionta leanúnach é, fíneáil bhreise ná raghaidh thar cúig púint in aghaidh gach lae leanfar den chionta tar éis é chiontú ann.
Rialacháin i dtaobh comhacht leictreachais d'úsáid.
11.—Má bhíonn ordú oibreacha iompair déanta ag an Aire (pe'ca roimh an Acht so do rith do rinne é no dá éis sin) á údarú do dhuine (dá ngairmtear an duine údaruithe san alt so) saghas áirithe oibreacha iompair do dhéanamh, do chothabháil agus d'oibriú agus go mbeidh údaruithe aige leis an ordú san na hoibreacha iompair sin d'oibriú le comhacht leictreachais, beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) féadfaidh an tAire, tar éis dó dul i gcomhairle le Bord Soláthair an Leictreachais, na rialacháin sin is oiriúnach leis do dhéanamh chun a áirithiú go ndéanfaidh an duine údaruithe, agus aon duine eile bheidh ag oibriú na n-oibreacha san thar ceann an duine údaruithe, gach ní ceart réasúnta chun ná beadh úsáid na comhachta leictreachais ina dainséar don phuiblíocht ná ina trúig dhamáiste do mhaoin dhuine ar bith;
(b) ag déanamh rialachán den tsórt san dó, féachfaidh an tAire don chostas a bheidh ar an duine údaruithe dá ndruim agus don deifir a dhéanfaid don duine údaruithe maidir le cúrsaí airgeadais;
(c) má dheineann an duine údaruithe, no aon duine eile bheidh ag oibriú na n-oibreacha iompair sin thar ceann an duine údaruithe, an chomhacht leictreachais sin d'úsáid contrárdha do sna rialacháin sin, beidh an duine údaruithe ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air agus, más cionta leanúnach é, fíneáil bhreise de chúig púint in aghaidh gach lae leanfar den chionta tar éis é chiontú ann;
(d) más dóich leis an Aire go ndearna an duine údaruithe, no aon duine bhí ag oibriú na n-oibreacha iompair sin thar ceann an duine údaruithe, an chomhacht leictreachais sin d'úsáid contrárdha do sna rialacháin sin, pe'ca ciontuíodh an duine údaruithe i gcionta no nár ciontuíodh, no más deimhin leis an Aire gur dainséar don phuiblíocht an chomhacht san d'úsáid, féadfaidh, le hordú, a cheangal ar an duine údaruithe scur de sna comhachta d'fheidhmiú do bronnadh leis an ordú oibreacha iompair sin maidir le comhacht leictreachais d'úsáid agus leis sin scuirfidh an duine údaruithe de sna comhachta san d'fheidhmiú ach amháin le toiliú an Aire agus fé réir na dtéarmaí agus na gcoinníollacha san is oiriúnach leis sin.
CUID III.
Stroighin d'Iomportail.
Stroighin a tuigfear a rinneadh i dtír áirithe.
12.—(1) Chun crícheanna na Coda so den Acht so, tuigfear gur i dtír áirithe do rinneadh stroighin más rud é, agus amháin más rud é—
(a) go mbeidh an cion orduithe dá luachmhaireacht ina luachmhaireacht do tháinig de bharr caiteachais de shaghas orduithe fé n-a ndeachthas sa tír sin maidir le habhair do táirgeadh no obair do rinneadh sa tír sin, no
(b) gur sa tír sin do rinneadh na hoibrithe orduithe do bhain le n-a táirgeadh.
(2) Féadfaidh an tAire rialacháin do dhéanamh i dtaobh éinní dá dtagartar i bhfo-alt (1) den alt so mar ní atá orduithe, agus cialluíonn an focal “orduithe” sa bhfo-alt san orduithe leis na rialacháin sin

13.—(1) Ní bheidh sé dleathach do dhuine ar bith aon stroighin d'iomportáil maran rud é—
(a) gur fé réim agus do réir cheadúnais ar n-a thabhairt amach ag an Aire fén gCuid seo den Acht so a hiomportálfar an stroighin sin; no
(b) gur chuige amháin a hiomportálfar an stroighin sin chun í iompar agus chun í easportáil ina dhiaidh sin.
(2) Chun crícheanna fo-ailt (1) den alt so, gach ceadúnas a bheidh deonta ag an Aire fé Chuid V den Phríomh-Acht agus a bhí i bhfeidhm díreach roimh thosach feidhme an Achta so, leanfa sé i bhfeidhm agus tuigfear gur ceadúnas é ar n-a thabhairt amach ag an Aire fén gCuid seo den Acht so.
(3) Má iomportálann duine ar bith aon stroighin contrárdha don alt so beidh an duine sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar céad punt do chur air másé an chéad chionta fén alt so aige é agus fíneáil ná raghaidh thar dhá chéad punt másé an dara cionta fén alt so aige é no aon chionta ina dhiaidh sin.
(4) Stroighin go dtoirmeasctar de bhuadh an ailt seo í d'iomportáil tuigfear í bheith ar na hearraí a háirmhítear agus a tuairiscítear sa Chlár de Thoirmeasctha agus de Shrianta maidir le hEarraí do Theacht Isteach atá in alt 42 den Customs Consolidation Act, 1876, agus beidh feidhm dá réir sin ag na forálacha den Acht san, mar atá san leasuithe no leathnuithe le haon Acht ina dhiaidh sin, a bhaineann le hearraí d'iomportáil a toirmeasctar no sriantar.
Ceadúnaisí iomportála (stroighin).
14.—(1) Ar iarratas o dhuine ar bith, a déanfar sa bhfuirm sin agus ina mbeidh na mion-innste sin ordóidh an tAire, féadfaidh an tAire, más oiriúnach leis é, ceadúnas (dá ngairmtear ceadúnas iomportála (stroighin) sa Chuid seo den Acht so) do thabhairt amach don duine sin chun caindíocht áirithe de stroighin d'iomportáil laistigh de thréimhse áirithe.
(2) Pé uair do bhéarfaidh an tAire ceadúnas iomportála (stroighin) amach chun stroighin d'iomportáil féadfaidh aon choinníoll no coinníollacha acu so leanas do chur ag gabháil leis an gceadúnas san, sé sin le rá:—
(a) coinníoll gur stroighin de shaghas áirithe bheidh sa stroighin sin;
(b) coinníoll gur o thír áirithe a hiomportálfar an stroighin sin;
(c) coinníoll gur stroighin do rinneadh i dtír áirithe bheidh sa stroighin sin;
(d) coinníoll gur i bport no in áit áirithe no de bhealach áirithe a hiomportálfar an stroighin sin;
(e) coinníoll ná déanfar an stroighin sin d'iomportáil i níos mó ná uimhir áirithe de chonsighneachtaí;
(f) pé coinníollacha eile is oiriúnach leis.
(3) Pé uair a chuirfidh an tAire aon choinníollacha ag gabháil le ceadúnas iomportála (stroighin) luadhfaidh na coinníollacha san sa cheadúnas san.
(4) Pé uair a chuirfidh an tAire aon choinníollacha ag gabháil le ceadúnas iomportála (stroighin) féadfaidh an tAire, ar iarratas an cheadúnaí, gach ceann no aon cheann no cinn de sna coinníollacha san do scriosadh amach no d'atharú.
(5) Gach duine dhéanfaidh, chun ceadúnas iomportála (stroighin) d'fháil dó féin no d'éinne eile, aon ráiteas no aithris chúise is eol dó bheith bréagach no mí-threorach in aon phonc táchtach, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar cúig púint fhichead do chur air.
Táillí alos ceadúnaisí iomportála (stroighin).
15.—(1) Beidh táille iníoctha leis an Aire alos gach ceadúnais iomportála (stroighin), táille a háirmheofar do réir an mhéide tonna stroighne a húdarófar leis an gceadúnas san d'iomportáil agus do réir pé ráta an tonna cheapfaidh an tAire alos an cheadúnais sin le haontú an Aire Airgeadais agus beidh sé ina choinníoll nach foláir a chólíonadh sara dtabharfar amach an ceadúnas san an táille sin d'íoc.
(2) Beidh feidhm ag na forálacha so leanas maidir leis na táillí uile a híocfar leis an Aire fén alt so, sé sin le rá:—
(a) is in airgead a baileofar na táillí sin agus is sa tslí sin ordóidh an tAire Airgeadais o am go ham a glacfar iad agus déanfar iad d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste do réir orduithe an Aire Airgeadais;
(b) ní bheidh feidhm ag an Public Offices Fees Act, 1879, maidir leis na táillí sin.

16.—(1) Déanfaidh an té is ceadúnaí fé cheadúnas iomportála (stroighin) an ceadúnas san do chur thar n-ais chun an Aire ar dháta nach déanaí ná ocht lá fichead tar éis an dáta ar a mbeidh deireadh leis an tréimhse bheidh luaidhte sa cheadúnas san no an dáta ar a n-iomportálfar an chaindíocht stroighne bheidh údaruithe leis an gceadúnas san d'iomportáil, pé dáta acu san is déanaí.
(2) Má theipeann ar an té is ceadúnaí fé cheadúnas iomportála (stroighin) no má fhaillíonn no má dhiúltann forálacha an ailt seo do chólíonadh beidh an ceadúnaí sin ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar deich bpúint do chur air.
Ceadúnaisí iomportála do cheiliúradh.
17.—Féadfaidh an tAire, ar n-a iarraidh sin don té is ceadúnaí fé cheadúnas iomportála (stroighin) no fé cheadúnas do dheon an tAire fé Chuid V den Phríomh-Acht, an ceadúnas san do cheiliúradh.
Táillí ceadúnais d'aisíoc.
18.—(1) Má cheiliúrann an tAire ceadúnas iomportála aisíocfaidh leis an gceadúnaí an táille d'íoc sé sin alos an cheadúnais sin.
(2) Pé uair a bheidh an chaindíocht stroighne a hiomportálfar fé cheadúnas iomportála níos lugha ná an chaindíocht stroighne bheidh údaruithe leis an gceadúnas san d'iomportáil, aisíocfaidh an tAire leis an té is ceadúnaí fén gceadúnas san oiread den táille do híocadh alos an cheadúnais sin agus a bheidh ar có-réir leis an deifríocht a bheidh idir an chaindíocht stroighne a hiomportálfar fén gceadúnas san agus an chaindíocht stroighne bheidh údaruithe leis an gceadúnas san d'iomportáil.
(3) Más deimhin leis an Aire aon stroighin do hiomportáladh fé cheadúnas iomportála do bheith tagtha chun bheith neamh-oiriúnach chun í úsáid féadfaidh an tAire an táille do híocadh leis alos an cheadúnais sin d'aisíoc leis an gceadúnaí.
(4) San alt so léireofar an abairt “ceadúnas iomportála” mar abairt is ionann agus an abairt “ceadúnas iomportála (stroighin) no ceadúnas do deonadh fé Chuid V den Phríomh-Acht.”

CEMENT (AMENDMENT) ACT, 1938.
PART I.
Preliminary and General.
Short title and citation.
1.—(1) This Act may be cited as the Cement (Amendment) Act, 1938.
(2) The Principal Act and this Act may be cited together as the Cement Acts, 1933 and 1938.
Definition and construction.
2.—(1) In this Act the expression “the Principal Act” means the Cement Act, 1933 (No. 17 of 1933).
(2) The Principal Act and this Act shall be construed together, and accordingly every word or expression to which a particular meaning is given by or in the Principal Act for the purposes of that Act has, in this Act, the meaning so given to it.
Repeals.
3.—The enactments mentioned in the Schedule to this Act are hereby repealed to the extent specified in the third column of the said Schedule.
Expenses.
4.—All expenses incurred by the Minister under this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
PART II.
Amendment of Part IV of the Principal Act.
Amendment of section 24 of the Principal Act.
5.—Section 24 of the Principal Act is hereby amended by the insertion therein of the following sub-section in lieu of sub-section (2), and the said section shall be construed and have effect accordingly, that is to say:—
“(2) Every application for a transport works order shall be accompanied by a draft of the proposed order, a plan of the proposed transport works and book of reference to such plan, and such draft, plan and book of reference shall be in such form as the Minister may direct.”
Amendment of Section 25 of the Principal Act.
6.—Sub-section (1) of section 25 of the Principal Act is hereby amended by the insertion at the end thereof of the following new paragraph, and the said section shall be construed and have effect accordingly, that is to say:·—
“(c) send to such persons (if any) as the Minister may direct a copy of such draft order, plan and book of reference.”
Amendment of section 26 of the Principal Act.
7.—Section 26 of the Principal Act is hereby amended by the insertion therein of the following sub-section in lieu of sub-section (2), and the said section shall be construed and have effect accordingly, that is to say:—
“(2) The following provisions shall have effect in relation to all fees payable under this section, that is to say:—
(a) such fees shall be collected in money and taken in such manner as the Minister for Finance may from time to time direct, and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the Minister for Finance;
(b) the Public Offices Fees Act, 1879, shall not apply in respect of such fees.”
Amendment of section 28 of the Principal Act.
8.—Section 28 of the Principal Act is hereby amended in the following respects, and shall be construed and have effect accordingly, that is to say:—
(a) by the insertion after the words “such consideration” of the words “and after consultation with the Minister for Local Government and Public Health,”; and
(b) by the substitution of the words “in such manner, subject to such restrictions and provisions and on such terms and conditions as the Minister thinks proper and specifies in such order” for the words “and such order shall have effect accordingly”.
Provisions in relation to transport works order.
9.—(1) The following provisions shall have effect in relation to a transport works order granted to the holder of a cement manufacture licence, that is to say:—
(a) such order shall contain such provisions as the Minister thinks necessary or expedient for the purpose of such order;
(b) without prejudice to the generality of paragraph (a) of this sub-section—
(i) such order may contain provisions authorising such holder to acquire compulsorily any land the acquisition of which is, in the opinion of the Minister, necessary for giving effect to such order,
(ii) such order may grant to such holder any rights in or over land or water, or in or over any public road the grant of which is, in the opinion of the Minister, necessary for giving effect to such order,
(iii) such order shall, in respect of any land so acquired or any right over land or water so granted, provide for the payment of compensation by such holder to the several persons having estates or interests in such land or water, and shall provide that any question of disputed compensation shall be determined under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919,
(iv) such order may incorporate all or any of the provisions of the Lands Clauses Acts, with such modifications and adaptations as the Minister thinks proper,
(v) such order shall specify the manner in which the transport works to which such order relates are to be constructed,
(vi) such order may contain provisions as to the manner in which such transport works are to be operated and maintained,
(vii) such order shall contain provisions limiting the use of such transport works to purposes relating to the business authorised by such cement manufacture licence and to such other purposes (if any) as may be specified in such order,
(viii) such order shall contain all such provisions as the Minister thinks proper for the protection of the public generally and any persons affected by such order,
(ix) such order may provide that where such holder acts in contravention (whether by commission or omission) of any specified provision of such order, such holder shall be guilty of an offence under such order and shall be liable on summary conviction thereof to such fine (not exceeding one hundred pounds) as may be specified in such order in respect of such offence and, in the case of a continuing offence, such further fine (not exceeding twenty pounds) as may be specified in such order in respect of such offence for each day during which such offence is continued after conviction thereof,
(x) such order may incorporate any provisions (including penal provisions) contained in any enactment relating to railways, with such adaptations and modifications as the Minister thinks proper,
(xi) such order may provide for the determination by arbitration of any specified questions arising thereunder,
(xii) such order may contain such provisions ancillary or incidental to any of the matters aforesaid as the Minister considers necessary and proper.
(2) The Minister may amend under section 30 of the Principal Act, any transport works order made before the passing of this Act by inserting in such transport works order any provision which could lawfully have been inserted therein if this section had been in force when such transport works order was made.
(3) Every order made under Part IV of the Principal Act or under the said Part IV as amended by this Act shall have the force of law.
(4) All expenses incurred by the Minister in the exercise of his powers and functions under a transport works order shall, to such extent as may be determined by the Minister for Finance, be paid to the Minister by the person to whom such order is granted.
Regulations in relation to maintenance and operation of transport works.
10.—Where the Minister has (whether before or after the passing of this Act) made a transport works order authorising a person (in this section referred to as the authorised person) to construct, maintain and operate transport works of a particular kind, the following provisions shall have effect, that is to say:—
(a) the Minister may make regulations (not inconsistent with, such order) in relation to the manner in which such transport works are to be maintained and operated by the authorised person and by any other person operating such works on behalf of the authorised person;
(b) if the authorised person or such other person acts in contravention (by omission or commission) of such regulations, the authorised person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and, in the case of a continuing offence, a further fine not exceeding five pounds for each day during which the offence is continued after conviction thereof.
Regulations in relation to use of electrical power.
11.—Where the Minister has (whether before or after the passing of this Act) made a transport works order authorising a person (in this section referred to as the authorised person) to construct, maintain and operate transport works of a particular kind and has by such order authorised such transport works to be operated by electrical power, the following provisions shall have effect, that is to say:—
(a) the Minister may, after consultation with the Electricity Supply Board, make such regulations as he may think fit for securing that the electrical power shall be used by the authorised person and by any other person operating such works on behalf of the authorised person with all reasonable and proper precautions against danger to the public or damage to the property of any person;
(b) in making such regulations the Minister shall have regard to the expense occasioned thereby to the authorised person and to the effect thereof on the financial prospects of the authorised person;
(c) if the authorised person or any other person operating such transport works on behalf of the authorised person uses such electrical power in contravention of such regulations, the authorised person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds and, in the case of a continuing offence, a further fine of five pounds for each day during which the offence is continued after conviction thereof;
(d) if in the opinion of the Minister the authorised or any person operating such transport works on behalf of the authorised person has used such electrical power in contravention of such regulations, whether the authorised person has or has not been convicted of an offence, or the Minister is satisfied that the use of such power is a danger to the public, he may by order require the authorised person to cease to exercise the powers conferred by such transport works order with respect to the use of electrical power and thereupon the authorised person shall cease to exercise such powers except with the consent of the Minister and subject to such terms and conditions as he thinks fit.
PART III.
Importation of Cement.
Cement manufactured in a particular country.
12.—(1) For the purposes of this Part of this Act, cement shall be deemed to have been manufactured in a particular country if, but only if, either—
(a) the prescribed proportion of its value is derived from expenditure of a prescribed kind incurred in that country in respect of materials produced or work done in that country, or
(b) the prescribed operations connected with its production have been carried out in that country.
(2) The Minister may make regulations in relation to any matter referred to in sub-section (1) of this section as prescribed, and the word “prescribed” in the said sub-section means prescribed by such regulations.
Restriction on importation of cement.
13.—(1) It shall not be lawful for any person to import any cement unless—
(a) such cement is imported under and in accordance with a licence issued by the Minister under this Part of this Act; or
(b) such cement is imported for the purposes only of transit and subsequent exportation.
(2) For the purposes of sub-section (1) of this section every licence granted by the Minister under Part V of the Principal Act and in force immediately before the commencement of this Act shall continue in force and be deemed to be a licence issued by the Minister under this Part of this Act.
(3) If any person imports any cement in contravention of this section such person shall be guilty of an offence under this section and shall be liable on summary conviction thereof to, in the case of a first offence under this section, a fine not exceeding one hundred pounds or, in the case of a second or any subsequent offence under this section, a fine not exceeding two hundred pounds.
(4) Cement prohibited to be imported by virtue of this section shall be deemed to be included among the goods enumerated and described in the Table of Prohibitions and Restrictions Inwards contained in section 42 of the Customs Consolidation Act, 1876, and the provisions of that Act, as amended or extended by any subsequent Act, applying to the importation of prohibited or restricted goods, shall apply accordingly.
Import (cement) licences.
14.—(1) On the application of any person made in such form and containing such particulars as the Minister may direct, the Minister may, if he thinks fit, issue to such person a licence (in this Part of this Act referred to as an import (cement) licence) to import within a specified period a specified quantity of cement.
(2) Whenever the Minister issues an import (cement) licence to import cement he may attach to such licence any one or more of the following conditions, that is to say:—
(a) a condition that such cement shall be of a specified kind;
(b) a condition that such cement shall be imported from a specified country;
(c) a condition that such cement shall be cement manufactured in a specified country;
(d) a condition that such cement shall be imported at a specified port or place or by a specified route;
(e) a condition that such cement shall not be imported in more than a specified number of consignments;
(f) such other conditions as he thinks fit.
(3) Whenever the Minister attaches any conditions to an import (cement) licence, he shall specify such conditions in such licence.
(4) Whenever the Minister attaches to an import (cement) licence any conditions, the Minister may at the request of the licensee delete or alter all or any one or more of such conditions.
(5) Every person who, for the purpose of obtaining for himself or any other person an import (cement) licence, makes any statement or representation which is to his knowledge false or misleading in any material respect shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding twenty-five pounds.
Fees in respect of import (cement) licences.
15.—(1) There shall be payable to the Minister in respect of every import (cement) licence a fee calculated by reference to the number of tons of cement authorised by such licence to be imported and at such rate per ton as the Minister may, with the concurrence of the Minister for Finance, fix in respect of such licence, and the payment of such fee shall be a condition precedent to the issue of such licence.
(2) The following provisions shall apply in respect of all fees paid to the Minister under this section, that is to say:—
(a) such fees shall be collected in money and taken in such manner as the Minister for Finance may from time to time direct, and shall be paid into or disposed of for the benefit of the Exchequer in accordance with the directions of the Minister for Finance;
(b) the Public Offices Fees Act, 1879, shall not apply in respect of such fees.
Return of import (cement) licences.
16.—(1) The licensee under an import (cement) licence shall, not later than twenty-eight days after the date on which the period specified in such licence expires or the date on which the quantity of cement authorised by such licence to be imported is imported, whichever of the said dates is the later, return such licence to the Minister.
(2) If the licensee under a cement (import) licence fails, neglects, or refuses to comply with provisions of this section, such licensee shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.
Revocation of import licences.
17.—The Minister may, on the application of the licensee under an import (cement) licence or under a licence granted by the Minister under Part V of the Principal Act, revoke such licence.
Repayment of licence fees.
18.—(1) Where the Minister revokes an import licence, he shall repay to the licensee the fee paid by him in respect of such licence.
(2) Whenever the quantity of cement imported under an import licence is less than the quantity of cement authorised by such licence to be imported, the Minister shall repay to the licensee under such licence so much of the fee paid in respect of such licence as is proportionate to the difference between the quantity of cement imported under such licence and the quantity of cement authorised by such licence to be imported.
(3) Where the Minister is satisfied that any cement imported under an import licence has become unfit for use the Minister may repay to the licensee the fee paid by him in respect of such licence.
(4) In this section the expression “import licence” shall be construed as equivalent to the expression “an import (cement) licence or a licence granted under Part V of the Principal Act.”
