1.—(1) Féadfar an tAcht um Laethanta Saoire (Fostaithe), 1961, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh cibé lá a cheapfaidh an tAire le hordú.
Mínithe i gcoitinne.
2.—(1) San Acht seo—
ciallaíonn “Acht 1936” an tAcht um Choinníollacha Fostaíochta, 1936;
ciallaíonn “Acht 1938” Acht na Siopaí (Coinníollacha Fostaíochta), 1938;
ciallaíonn “lá”, maidir le duine a dtosaíonn a sheal oibre lá amháin agus a chríochnaíonn an lá ina dhiaidh sin, tréimhse ceithre huaire is fiche a chloig dar tosach an tráth a thosaíonn an seal oibre;
ciallaíonn “fostú” fostú, faoi chonradh seirbhíse (cibé acu is conradh sainráite nó conradh intuigthe nó conradh i scríbhinn an conradh) nó conradh printíseachta, agus forléireofar focail ghaolmhara dá réir sin;

tá le “siopa” an bhrí chéanna a bhí leis an bhfocal sin in Acht 1938, sular achtaíodh Acht na Siopaí (Coinníollacha Fostaíochta) (Leasú), 1942;
tá le “comhalta den fhoireann”, maidir le siopa, an bhrí chéanna atá leis an abairt sin in Acht 1938, arna leasú le hAlt 2 d'Acht na Siopaí (Coinníollacha Fostaíochta) (Leasú), 1942, agus tá le “obair siopa” an bhrí chéanna atá leis in Acht 1938;
ciallaíonn “gearr-lá”, maidir le hoibrí, lá ar gnách leis an oibrí faoina chonradh seirbhíse níos lú ná lá iomlán a oibriú;
ciallaíonn “seachtain” aon tréimhse seacht lá comhleanúnacha;
ciallaíonn “lá oibre”, maidir le hoibrí, lá—
(a) is lá seachtaine, agus
(b) nach—
(i) lá saoire poiblí,
(ii) lá ar cuid de aon tréimhse ceithre huaire is fiche a chloig comhleanúnacha scíthe a cheanglaítear faoi aon achtachán eile a cheadú don oibrí,
(iii) lá neamh-oibre, ná
(iv) gearr-lá.
(2) Chun críocha an Achta seo measfar duine a bheidh i seirbhís údaráis áitiúil a bheith fostaithe ag an údarás áitiúil.
Oibrithe.
3.—(1) San Acht seo—
ciallaíonn “oibrí” aon duine ceithre bliana déag d'aois nó os a chionn atá fostaithe, seachas duine—
(a) is duine dá dtugtar amach earraí nó ábhair chun iad a chomhdhéanamh, a ghlanadh, a ní, a athrú, a ornáidiú nó a dheisiú nó a oiriúnú lena ndíol ina theach féin nó in áitreabh eile nach bhfuil faoi urláimh nó faoi bhainistí an duine a thug amach na hábhair nó na hearraí,
(b) is oibrí talmhaíochta lena mbaineann an tAcht um Oibrithe Talmhaíochta (Laethanta Saoire), 1950,
(c) is máistir nó comhalta d'fhoireann aon bháid farraige móire (nach báirse ná bád dríbe), cibé acu ar úinéireacht phoiblí nó ar úinéireacht phríobháideach di, a úsáidtear chun lasta nó paisnéirí a iompar,
(d) is fostaí tí solais nó báid solais,
(e) eaglaiseach in Ord Beannaithe,
(f) is comhalta d'ord nó de shámhadh crábhaidh,
(g) is banchéile, fearchéile, athair, máthair, seanathair, seanmháthair, leasathair, leasmháthair, mac, iníon, ua ban-ua, leasmhac, leasiníon, deartháir, deirfiúr, deartháir leasghaolmhar nó deirfiúr leasghaolmhar a fhostóra agus atá á chothabháil ag a fhostóir agus ina chónaí in aontíos leis,
(h) is duine atá fostaithe ag an Stát nó faoin Stát agus nach—
(i) duine atá fostaithe amhlaidh i bpost neamhbhunaithe agus lena mbaineann Acht 1936 d bhua alt 6 den Acht sin,
(ii) duine atá fostaithe amhlaidh i bpost neamh bhunaithe mar ghiolla, doirseoir, teachtaire, faireoir oíche, bean glantacháin, glantóir, nó mar fhear oibre nó le dualgais íochtaracha eile, nó
(iii) duine atá fostaithe amhlaidh i bpost neamhbhunaithe mar cheardaí nó mar oibrí oilte eile,
(i) is duine atá fostaithe mar iascaire, nó
(j) is duine d'aon aicme áirithe de dhaoine fostaithe a ndearbhaítear le hordú a rinneadh faoin alt seo gur aicme eiscthe í chun críocha an ailt seo;
ciallaíonn “oibrí tís” duine—
(a) is oibrí,
(b) nach oibrí tionscail,
(c) nach comhalta d'fhoireann siopa, agus
(d) is duine—
(i) ag a bhfuil teideal faoina chonradh seirbhíse chun lóistín in aisce i dteach a fhostóra nó in áit eile, nó
(ii) a dhéanann obair de chineál pearsanta nó tís i dteach cónaithe nó thart faoi theach cónaithe a fhostóra:
ciallaíonn “oibrí neamh-thís” oibrí nach oibrí tís;
ciallaíonn “oibrí tionscail” oibrí, seachas eachtar-oibrí de réir bhrí Acht 1936, a dhéanann obair thionscail ar thuarastal nó pá nó chun aon cheird nó gairm a fhoghlaim;
I mír (h) den fho-alt seo tá le “post neamhbhunaithe” an bhrí chéanna atá leis in Acht Choimisinéirí na Stát-Sheirbhíse, 1956.
(2) Féadfaidh an tAire, aon uair agus a mhinice is oiriúnach leis, tar éis dó dul i gcomhairle le cibé Airí Stáit nó eagrais fostóirí agus le cibé eagrais oibrithe arb iomchuí leis dul i gcomhairle leo, a dhearbhú le hordú gur aicme eiscthe chun críocha an ailt seo aon aicme áirithe (a shonrófar i cibé slí agus faoi threoir cibé nithe is cuí leis an Aire) daoine fostaithe, agus aon uair a dhéanfar aon ordú den sórt sin ansin an fad a bheidh an t-ordú sin i bhfeidhm is aicme eiscthe chun críocha an ailt seo an aicme daoine fostaithe lena mbainfidh an t-ordú sin.
(3) Féadfaidh an tAire, tar éis dó dul i gcomhairle le cibé Airí Stáit nó eagrais fostóirí agus le cibé eagrais oibrithe arb iomchuí leis dul i gcomhairle leo, rialacháin a dhéanamh á fhoráil—
(a) go measfar gurb oibrí nó oibrithe chun críocha an Achta seo aon duine nó aon aicme nó tuairisc (a shonrófar i cibé modh agus faoi threoir cibé nithe is cuí leis an Aire) daoine;
(b) i gcás aon oibrí nó oibrithe, is oibrí nó oibrithe mar a mhínítear sin san alt seo, nó is oibrí nó oibrithe a meastar gurb oibrí é nó gurb oibrithe iad chun críocha an Achta seo de bhua rialachán faoin alt seo, go measfar, chun na gcríocha sin, gurb oibrí tís nó gurb oibrithe tís nó gurb oibrí neamh-thís nó gurb oibrithe neamh-thís (de réir mar a bheidh) mar a shonrófar sna rialacháin é nó iad.
Aon rialacháin a dhéanfaidh an tAire faoin bhfo-alt seo féadfaidh cibé forálacha fo-ghabhálacha agus iarmartacha nó cibé modhnuithe ar fhorálacha an Achta seo a bheith iontu is dóigh leis an Aire is gá chun lán-éifeacht a thabhairt do na rialacháin.
(4) Féadfaidh an tAire aon ordú a dhéanfar faoin alt seo (lena n-áirítear an fo-alt seo) a chúlghairm nó a leasú.
“Bliain fostaíochta” agus “leathbhliain fostaíochta”.
4.—(1) San Acht seo—
ciallaíonn “bliain fostaíochta”, nuair a úsáidtear an abairt sin maidir le hoibrí, tréimhse trí chéad seasca is cúig lá (gan aon lá arb é an 29ú lá d'Fheabhra é a áireamh) dar tosach an lá deiridh a chuaigh an t-oibrí san fhostaíocht a n-úsáidtear an abairt sin maidir léi nó lá is lá cothrom an lae sin aon bhliain dá éis;
nuair a úsáidtear “chéad leath” maidir le bliain fostaíochta oibrí tís, ciallaíonn sé tréimhse céad ochtó is trí lá dar tosach an chéad lá den bhliain fostaíochta;
nuair a úsáidtear “dara leath” maidir le bliain fostaíochta oibrí tís, ciallaíonn sé an méid sin den bhliain fostaíochta nach cuid de chéad leath na bliana sin.
I gcás ina ndeachaigh oibrí i bhfostaíocht an 29ú lá d'Fheabhra, measfar, chun críocha léirithe an mhínithe ar “bliain fostaíochta”, gurb é an chéad lá ina dhiaidh sin a chuaigh sé san fhostaíocht sin.
(2) I gcás—
(a) ina ndéanfar úinéireacht aon ghnó, cibé acu a sheoltar nó nach seoltar an gnó sin le haghaidh brabúis nó sochair, a aistriú trí ghníomh na bpáirtithe nó trí oibriú an dlí i rith bliain fostaíochta aon oibrí a bhí díreach roimh an aistriú ar fostú ag an duine a bhí ag seoladh an ghnó, agus
(b) go leanfaidh an t-oibrí i ndiaidh an aistrithe de bheith ar fostú ag an duine (dá ngairtear an fostóir nua san fho-alt seo) chun ar aistríodh an úinéireacht, beidh éifeacht ag na forálacha seo a leanas—
(i) chun críocha an Achta seo (lena n-áirítear fo-alt (1) den alt seo ach gan alt 9 (a mhéid a bhaineann sé le cearta oibrithe neamh-thís maidir le laethanta saoire poiblí) den Acht seo a áireamh maidir le haon laethanta saoire roimh an aistriú), measfar an t-oibrí a bheith ar fostú ag an bhfostóir nua amhail ar thosach agus ó thosach na bliana fostaíochta;
(ii) má ceadaíodh saoire bhliantúil don oibrí roimh an aistriú nó, i gcás inarb oibrí tís an t-oibrí agus gur ceadaíodh saoire bhliantúil nó saoire leathbhliantúil dó i rith na bliana fostaíochta, measfar, chun críocha an Achta seo, gur cheadaigh an fostóir nua an tsaoire bhliantúil nó an tsaoire leathbhliantúil.
(3) San alt seo folaíonn “gnó” aon ghairm, oifig, bunachas nó ceird de chineál ar bith.
Míniú ar “lá saoire iomlán”.
5.—Measfar, chun críocha an Achta seo, duine do lamháil lá saoire iomlán lá áirithe d'oibrí a bheidh ar fostú aige, más rud é agus amháin más rud é, nach ligfidh sé don oibrí aon obair a dhéanamh dó an lá sin.
Caiteachas.
6.—Déanfar an caiteachas faoina rachaidh an tAire ag riaradh an Achta seo a íoc, a mhéid a cheadóidh an tAire Airgeadais é, as airgead a sholáthróidh an tOireachtas.
Aisghairm agus leasú iarmartach.
7.—(1) Aisghairtear leis seo alt 7 d'Acht 1936.
(2) Aisghairtear leis seo alt 28, ailt 30 go 32 go huile, agus ailt 36 go 39 go huile d'Acht 1938.
(3) Aisghairtear leis seo an tAcht um Laethanta Saoire (Fostaithe), 1939.
(4) Leasaítear leis seo fo-alt (1) d'alt 49 d'Acht 1936 trí “de réir bhrí an Achta um Laethanta Saoire (Fostaithe), 1961,” a chur isteach i ndiaidh “lá saoire puiblí”.
CUID II
Laethanta Saoire Poiblí.
Laethanta Saoire Poiblí maidir le gach oibrí.
8.—(1) Faoi réir fhorálacha an ailt seo, is lá saoire poiblí chun críocha an Achta seo gach lá acu seo a leanas maidir le gach oibrí:
(a) Lá Nollag nuair a thiteann sé ar lá seachtaine nó, nuair a thiteann sé ar an Domhnach, an 27ú lá de Nollaig,
(b) Lá Fhéile Stiofáin nuair a thiteann sé ar lá seachtaine nó, nuair a thiteann sé ar an Domhnach, an chéad Luan ina dhiaidh sin,
(c) Lá Fhéile Pádraig nuair a thiteann sé ar lá seachtaine nó, nuair a thiteann sé ar an Domhnach, an chéad Luan ina dhiaidh sin,
(d) Luan Cásca, Luan Cincíse agus an chéad Luan de Lúnasa.
(2) Aon uair aon bhliain áirithe a cheapfar lá faoin Acht Laethanta Saoire Puiblí, 1924, chun bheith ina lá saoire bainc in ionad lá dá dtagraítear i bhfo-alt (1) den alt seo, measfar an bhliain sin an lá a cheapfar amhlaidh a bheith curtha isteach ar fud an fho-ailt sin in ionad an lae a luaitear amhlaidh.
(3) Féadfaidh fostóir aon oibrí ceachtar lá acu seo a leanas a chur in ionad aon lá saoire poiblí (ach amháin Lá Nollag nó Lá Fhéile Pádraig) a thitfidh i mbliain chaileandair—
(a) an lá saoire Eaglaise a thitfidh sa bhliain chaileandair díreach roimh an lá saoire poiblí trí fhógra a thabhairt don oibrí ceithre lá dhéag ar a laghad roimh an lá saoire Eaglaise go bhfuil ar intinn aige an lá sin a chur in ionad an lá saoire poiblí sin, nó
(b) an lá saoire Eaglaise a thitfidh sa bhliain chaileandair sin díreach tar éis an lá saoire poiblí nó, más lá is lá saoire poiblí de bhua mhír (b) d'fho-alt (1) den alt seo an lá saoire poiblí, an 1ú lá d'Eanáir díreach ina dhiaidh sin trí fhógra a thabhairt don oibrí ceithre lá dhéag ar a laghad roimh an lá saoire poiblí go bhfuil ar intinn aige an lá sin a chur in ionad an lá saoire poiblí sin,
agus aon uair a thabharfar fógra den sórt sin, is lá saoire poiblí chun críocha an Achta seo an lá saoire Eaglaise a chuirfear in ionad an lae a gcuirfear é ina ionad amhlaidh.
(4) Chun críocha fho-alt (3) den alt seo is lá saoire Eaglaise gach lá acu seo a leanas:
(i) an 1ú lá d'Eanáir, ach amháin nuair a thiteann sé ar an Domhnach,
(ii) Déardaoin Deascabhála,
(iii) Déardaoin Chorp Chríost,
(iv) an 15ú lá de Lúnasa, ach amháin nuair a thiteann sé ar an Domhnach,
(v) an 1ú lá de Shamhain, ach amháin nuair a thiteann sé ar an Domhnach,
(vi) an 8ú lá de Nollaig, ach amháin nuair a thiteann sé ar an Domhnach.
(5) Féadfaidh an tAire a dhearbhú le hordú nach lá saoire poiblí chun críocha an Achta seo aon cheann de na laethanta a luaitear i bhfo-alt (1) den alt seo agus féadfaidh sé aon lá a cheapadh chun bheith ina lá saoire poiblí chun críocha an Achta seo agus, ar ordú den sórt sin a dhéanamh, measfar gur lá saoire poiblí chun críocha an Achta seo an lá a cheapfar amhlaidh.
(6) Féadfaidh an tAire le hordú lá a cheapadh chun bheith ina lá saoire Eaglaise chun críocha an Achta seo trína chur in ionad nó i dteannta lá a luaitear i bhfo-alt (4) den alt seo agus, ar ordú den sórt sin a dhéanamh, measfar gur lá saoire Eaglaise chun críocha an Achta seo an lá a cheapfar amhlaidh.
(7) Is i scríbhinn a bheidh an fógra a luaitear i bhfo-alt (3) den alt seo agus féadfar é a thabhairt d'aon duine trí chóip den fhógra sin a thabhairt don duine sin go pearsanta nó trí chóip den fhógra sin a chur suas in ionad feiceálach san áit a bhfuil sé fostaithe.
(8) San Acht seo nuair a úsáidtear “lá saoire poiblí” maidir le haon oibrí, forléireofar é de réir na bhforálacha sin roimhe seo den alt seo.
Cearta oibrithe maidir le laethanta saoire poiblí.
9.—(1) I gcás—
(a) oibrí a bheith ar fostú ag duine lá saoire poiblí,
(b) an t-oibrí a bheith tar éis oibriú don duine sin ar feadh na tréimhse cáilithí oibre don oibrí sin mar a mhínítear i bhfo-alt (8) den alt seo aon tráth i rith na tréimhse cúig sheachtain díreach roimh an lá saoire poiblí, agus
(c) (i) lá saoire iomlán a bheith lamháilte ag an duine sin don oibrí an lá saoire poiblí, nó
(ii) gur lá neamhoibre nó gearrlá an lá saoire poiblí agus nach n-oibríonn an t-oibrí don duine sin an lá saoire poiblí,
íocfaidh an duine sin leis an oibrí suim is comhionann le pá lae iomláin in aghaidh an lá saoire poiblí.
(2) I gcás—
(a) oibrí a bheith ar fostú ag duine lá saoire poiblí,
(b) an t-oibrí a bheith tar éis oibriú don duine sin ar feadh na tréimhse cáilithí oibre don oibrí sin mar a mhínítear i bhfo-alt (8) den alt seo aon tráth i rith na tréimhse cúig sheachtain díreach roimh an lá saoire poiblí, agus
(c) an t-oibrí a bheith tar éis oibriú lá saoire poiblí don duine sin,
déanfaidh an duine sin
(i) lá saoire cúitimh a lamháil don oibrí sin in ionad an lá saoire poiblí, nó
(ii) suim is comhionann le dhá oiread pá lae iomláin a íoc leis an oibrí in aghaidh an lá saoire poiblí.
(3) Chun críocha fho-alt (2) den alt seo measfar lá saoire cúitimh in ionad lá saoire poiblí a bheith lamháilte ag duine don oibrí más rud é, agus amháin más rud é,—
(a) go lamhálfaidh sé lá saoire iomlán don oibrí in ionad lá saoire poiblí lá oibre laistigh de mhí i ndiaidh an lá saoire poiblí agus go n-íocfaidh sé leis an oibrí in aghaidh an lae sin suim is comhionann le pá lae iomláin, nó
(b) go lamhálfaidh sé don oibrí, aon tráth i rith bliain fostaíochta an oibrí ar lá di an lá saoire poiblí, lá saoire iomlán an chéad lá oibre díreach tar éis deireadh saoire bhliantúil an oibrí agus go n-íocfaidh sé leis an oibrí in aghaidh an lae sin suim is comhionann le pá lae iomláin.
(4) I gcás—
(a) oibrí a bheith ar fostú ag duine lá saoire poiblí,
(b) an t-oibrí a bheith tar éis oibriú don duine sin ar feadh na tréimhse cáilithí oibre don oibrí sin mar a mhínítear i bhfo-alt (8) den alt seo aon tráth i rith na tréimhse cúig sheachtain díreach roimh an lá saoire poiblí,
(c) an t-oibrí a bheith tar éis oibriú lá saoire poiblí don duine sin,
(d) gan suim is comhionann le dhá oiread pá lae iomláin a bheith faighte ag an oibrí in aghaidh an lá saoire, agus
(e) go bhfoirceannfar fostaíocht an oibrí sula mbeidh saoire chúitimh lamháilte dó in ionad an lá saoire poiblí, íocfaidh an duine sin leis an oibrí ar an bhfoirceannadh sin suim is comhionann le pá lae iomláin i dteannta aon phá a bheidh dlite dó an tráth sin.
(5) I gcás—
(a) ina ndéanfaidh duine saoire chúitimh a lamháil, in ionad lá saoire poiblí, d'oibrí a bheidh ar fostú aige, agus
(b) go scoirfidh an t-oibrí de bheith ar fostú ag an duine sin roimh an lá saoire poiblí,
ní cead don duine sin aon suim i leith na saoire cúitimh a bhaint as an bpá a bheidh dlite don oibrí.
(6) I gcás—
(a) oibrí a bheidh ar fostú ag duine a bheith tar éis oibriú don duine sin ar feadh na tréimhse cáilithí oibre don oibrí sin mar a mhínítear i bhfo-alt (8) den alt seo aon tráth i rith na tréimhse cúig sheachtain díreach roimh lá saoire poiblí, agus
(b) go ndéanfaidh an duine sin seirbhísí an oibrí leis an duine sin a fhoirceannadh roimh an lá saoire poiblí,
íocfaidh an duine sin, ar an bhfoirceannadh sin, leis an oibrí, i dteannta aon phá a bheidh dlite dó an tráth sin,
(i) suim is comhionann le pá lae iomláin, nó
(ii) má ba Lá Nollag an lá saoire sin, suim is comhionann le pá lae iomláin in aghaidh an lae sin, agus a cóimhéid de shuim ina theannta sin in aghaidh Lá Fhéile Stiofáin.
(7) I gcás—
(a) oibrí a bheidh ar fostú ag duine a bheith tar éis oibriú don duine sin ar feadh na tréimhse cáilithí oibre don oibrí sin mar a mhínítear i bhfo-alt (8) den alt seo aon tráth i rith na tréimhse cúig sheachtain díreach roimh an lá saoire ceaptha,
(b) lá (dá ngairtear an lá ionaid san fho-alt seo) a chur in ionad an lá saoire ceaptha faoi alt 8 den Acht seo,
(c) an lá ionaid do theacht i ndiaidh an lá saoire ceaptha, agus
(d) an duine sin d'fhoirceannadh seirbhísí an oibrí don duine sin roimh an lá ionaid,
íocfaidh an duine sin, ar an bhfoirceannadh sin, suim is comhionann le pá lae iomláin leis an oibrí i dteannta aon phá a bheidh dlite dó an tráth sin.
San fho-alt seo ciallaíonn “lá ceaptha” lá is lá saoire poiblí de bhua fho-alt (1) nó fho-alt (2) d'alt 8 den Acht seo.
(8) Is mar seo a leanas a bheidh na tréimhsí cáilitheacha oibre chun críocha fho-ailt (1), (2), (4), (6) agus (7) den alt seo:
(a) i gcás oibrí tionscail faoi ocht mbliana déag d'aois, nó oibrí faoi ocht mbliana déag d'aois agus a bheidh fostaíthe le mianadóireacht, céad fiche uair a chloig ar a laghad,
(b) i gcás oibrí tís, cúig lá is fiche ar a laghad, agus
(c) i gcás aon oibrí eile, céad tríocha is cúig uair a chloig ar a laghad.
Cuirfear san áireamh na laethanta saoire bliantúla nuair a bheifear ag ríomh na dtréimhsí cáilitheacha oibre a mhínítear san fho-alt seo agus measfar an ghnáth-uimhir uaire a chloig a bheadh oibrithe aige an lá sin faoina chonradh seirbhíse a bheith oibrithe ag an oibrí gach lá dá shaoire bhliantúil.
(9) Gach uair a chloig bhreac-fhostaíochta oibrí arb iníoctha sochar forlíontach ina leith faoi alt 28 den Acht Arachais (Breac-Dhíomhaointeas), 1942, measfar gurb uair a chloig í a oibríodh chun críocha an ailt seo suas go dtí caoga uair a chloig ar a mhéid i leith gach tréimhse cáilithí.
(10) Féadfaidh an tAire, aon uair agus a mhinice is cuí leis, rialacháin a dhéanamh a athróidh, maidir le gach aicme nó aon aicme áirithe (a mhíneofar i cibé slí agus faoi threoir cibé nithe is cuí leis an Aire) oibrithe, aon cheann nó gach ceann de na tréimhsí cáilitheacha oibre a mhínítear i bhfo-alt (8) den alt seo trí cibé méid uaire a chloig nó cibé méid laethanta is cuí leis an Aire a chur ina ionad sin, agus, aon uair a bheidh aon rialacháin den sórt sin i bhfeidhm, beidh éifeacht ag forálacha fho-alt (8) den alt seo, maidir leis na hoibrithe nó an aicme nó na haicmí oibrithe lena mbaineann na rialacháin, amhail is dá ndéanfaí an tréimhse cháilitheach nó na tréimhsí cáilitheacha a mhínítear san fho-alt sin (8) a athrú sa tslí a luaitear sna rialacháin.
(11) Má mhainníonn aon duine aon cheann d'fhorálacha an ailt seo a chomhlíonadh maidir le—
(a) cearta oibrí a bheidh ar fostú aige a oibríonn don duine sin lá saoire poiblí, nó
(b) aon suim is iníoctha de réir na bhforálacha sin le hoibrí a bheidh ar fostú aige a íoc leis an oibrí i dteannta aon phá a bheidh dlite dó,
beidh an duine sin ciontach i gcion.
(12) I gcás—
(a) an fostóir do thabhairt íocaíochta d'oibrí faoin alt seo in aghaidh lá saoire poiblí, agus
(b) ina bhfoirceannfar seirbhísí an oibrí roimh an lá saoire poiblí,
ní mheasfar, chun críocha fhorálacha an Achta Leasa Shóisialaigh, 1952, a bhaineann le sochar dífhostaíochta, an t-oibrí a bheith ar fostú ag an bhfostóir sin an lá saoire poiblí sin.
(13) San alt seo ciallaíonn “pá lae iomláin” an méid is iníoctha le hoibrí faoina chonradh serbhíse in aghaidh gnáthlá iomlán oibre.
(14) Chun críocha an ailt seo measfar oibrí tís a bheith tar éis oibriú i bhfostaíocht duine áirithe aon lá a bhí sé ar fáil chun seirbhíse ar an duine sin á iarraidh air ar feadh dhá uair a chloig nó níos mó.
CUID III
Saoire Bhliantúil.
Saoire bhliantúil d'oibrithe neamh-thís.
10.—(1) Déanfaidh gach duine ag a mbeidh oibrí neamh-thís ar fostú, gach bliain fostaíochta de chuid an oibrí a bheidh an t-oibrí ar fostú ag an duine sin go leanúnach nó ó lá go lá, agus a d'oibrigh an t-oibrí san fhostaíocht sin ar feadh—
(a) tréimhse nár lú ná sé chéad déag uair a chloig, nó
(b) i gcás oibrí tionscail faoi ocht mbliana déag d'aois, nó oibrí faoi ocht mbliana déag d'aois a bheidh fostaithe le mianadóireacht, tréimhse nach lú ná cúig chéad déag uair a chloig,
ceithre lá dhéag chomhleanúnacha, ar a n-áirítear dhá Dhomhnach, de laethanta saoire iomlána (dá ngairtear saoire bhliantúil san Acht seo) a lamháil don oibrí cibé tráth is oiriúnach leis an duine sin.
(2) I gcás ina lamhálfar saoire bhliantúil d'oibrí neamhthís, íocfaidh fostóir an oibrí leis an oibrí in aghaidh na saoire bliantúla suim is comhionann le dhá oiread gnáth-phá seachtaine an oibrí.
(3) Más rud é—
(a) i gcás oibrí neamh-thís a bheidh ar fostú ag duine do scor de bheith ar fostú ag an duine sin aon uair seachas i ndeireadh bliain fostaíochta an oibrí,
(b) nár lamháil an duine sin saoire bhliantúil don oibrí sin roimh an scor in aghaidh na coda den bhliain fostaíochta a bhí sé ar fostú amhlaidh,
íocfaidh an duine sin leis an oibrí ar an scor suim is comhionann leis an séú cuid dá ghnáth-phá seachtainiúil in aghaidh gach mí sa chuid sin den bhliain fostaíochta a d'oibrigh sé.
(c) i gcás oibrí tionscail faoi ocht mbliana déag d'aois, nó oibrí faoi ocht mbliana déag d'aois a bheidh fostaithe le mianadóireacht, ar feadh céad fiche uair a chloig ar a laghad an mhí sin, agus
(d) i gcás aon oibrí eile, ar feadh céad tríocha is cúig uair a chloig ar a laghad an mhí sin.
(4) Chun críocha fho-ailt (2) agus (3) den alt seo is éard a bheidh i ngnáth-phá seachtainiúil oibrí—
(a) i gcás ina ríomhtar gnáth-luach saothair an oibrí go hiomlán faoi threoir ama, suim is comhionann leis an méid (gan an pá as obair bhreis-ama a áireamh) a fuair an t-oibrí ón bhfostóir mar thuarastal nó pá in aghaidh na seachtaine, díreach roimh an tsaoire bhliantúil nó an scor, a d'oibrigh an t-oibrí an ghnáthuimhir uaire a chloig an ghnáth-uimhir uasta laethanta faoina chonradh seirbhíse, agus
(b) in aon chás eile, suim is comhionann le méid an mheántuillimh sheachtainiúil (gan an pá as obair bhreis-ama a áireamh) i gcaitheamh na sé mhí díreach roimh an tsaoire bhliantúil nó an scor má bhíonn sé fostaithe an fad sin ag an bhfostóir ach mura mbeidh, ansin aon tréimhse is lú ná sin a bheidh sé fostaithe ag an bhfostóir.
(5) Gach uair a chloig breac-dhífhostaíochta oibrí arb iníoctha sochar forlíontach ina leith faoi alt 28 den Acht Arachais (Breac-Dhíomhaointeas), 1942, measfar gurb uair a chloig í a oibríodh chun críocha an ailt seo suas go dtí dhá céad caoga uair a chloig ar a mhéid aon bhliain fostaíochta de chuid an oibrí.
(6) Féadfaidh an tAire le hordú, aon uair agus a mhinice is cuí leis, rialacháin a dhéanamh a athróidh, maidir le gach aicme nó aon aicme nó aicmí áirithe (a mhíneofar i cibé slí agus faoi threoir cibé nithe is cuí leis an Aire) oibrithe neamh-thís, gach tréimhse nó aon cheann de na tréimhsí sé chéad déag uair a chloig, cúig chéad déag uair a chloig, céad fiche uair a chloig nó céad tríocha is cúig uair a chloig a luaitear i bhfo-ailt (1) agus (3) den alt seo trí cibé uimhir eile uaire a chloig nó cibé uimhir laethanta is cuí leis an Aire a chur ina ionad sin, agus, aon uair a bheidh aon rialacháin den sórt sin i bhfeidhm, beidh éifeacht ag na fo-ailt sin maidir leis na hoibrithe neamh-thís nó an aicme nó na haicmí oibrithe neamh-thís lena mbainfidh na rialacháin, amhail is dá ndéanfaí na tréimhsí sin nó cibé ceann acu dá ndéanfaidh na rialacháin difir a athrú sa tslí a luafar sna rialacháin.
(7) I gcás aon lá neamhoibre nó aon dá lá neamhoibre comhleanúnacha nó níos mó do thitim díreach roimh lá nó díreach i ndiaidh lae a lamháil fostóir lá saoire iomlán d'oibrí neamhthís measfar chun críocha an ailt seo gur lá a lamháil an fostóir lá saoire iomlán don oibrí an lá neamhoibre nó gach lá de na laethanta neamhoibre comhleanúnacha (de réir mar a bheidh) murar oibrigh sé an lá sin don fhostóir.
(8) Ní áireofar mar lá de shaoire bhliantúil lá is lá saoire poiblí nó lá a mheasfar, de bhun an ailt sin díreach roimhe seo den Acht seo, lá saoire iomlán a bheith lamháilte d'oibrí neamhthís, ach má thagann aon lá den sórt sin idir laethanta de shaoire bhliantúil, measfar na laethanta sin a bheith comhleanúnach d'ainneoin an lá sin a theacht amhlaidh.
(9) Bainfidh an t-alt seo leis an mbliain fostaíochta a bheidh ann i dtosach feidhme an Achta seo maidir le gach duine is oibrí neamh-thís ag an tosach feidhme sin, agus beidh éifeacht ag an alt seo maidir leis an mbliain fostaíochta sin agus an duine sin amhail is dá mbeadh an t-alt seo i ngníomh i dtosach na bliana fostaíochta sin, ach sin faoi réir na modhnuithe—
(a) má théann an bhliain fostaíochta sin in éag laistigh de mhí tar éis tosach feidhme an Achta seo, go measfar an t-alt seo a bheith comhlíonta ag an bhfostóir má lamhálann sé don duine sin, tráth nach déanaí ná trí mhí i ndiaidh an bhliain fostaíochta sin dul in éag, cibé saoire bhliantúil a mbeidh sé ina teideal faoin alt seo in aghaidh na bliana fostaíochta sin, agus
(b) má lamháil an fostóir roimh an tosach feidhme sin don duine sin an bhliain fostaíochta sin lá saoire iomlán amháin nó níos mó ba shaoire bhliantúil chun críocha an ailt seo mura mbeadh gur lú ná ceithre lá dhéag iad, nó nach raibh siad comhleanúnach nó, d'eile, gur lú ná ceithre lá dhéag iad agus nach raibh siad comhleanúnach, go measfar gur shaoire bhliantúil chun críocha an ailt seo an tsaoire sin go léir a lamháladh amhlaidh agus nach mbeidh an duine sin i dteideal in aghaidh na bliana fostaíochta sin ach cibé méid (más aon mhéid é) de laethanta saoire iomlána comhleanúnacha i ndiaidh an tosach feidhme sin a bheidh comhionann leis an méid (más aon mhéid é) laethanta a bheidh an méid laethanta saoire sin a lamháladh amhlaidh níos lú ná ceithre lá dhéag.
(10) I gcás é a bheith beartaithe ag duine ag a bhfuil oibrí neamh-thís ar fostú saoire bhliantúil a lamháil don oibrí de bhun an ailt seo—
(a) déanfaidh sé, tráth nach déanaí ná ceithre lá dhéag roimh an lá a bheidh an tsaoire bhliantúil le tosú, fógra a thabhairt ag insint go bhfuil sé ar intinn aige an tsaoire a lamháil agus an lá a thosóidh sí;
(b) má mhainníonn sé mír (a) den fho-alt seo a chomhlíonadh beidh sé ciontach i gcion.
(11) Má lamhálann fostóir oibrí neamh-thís aon bhliain fostaíochta tréimhse de shaoire bhliantúil don oibrí níos luaithe ná na ceithre lá dhéag deiridh (is laethanta is ináirithe mar laethanta den tsaoire bhliantúil chun críocha an ailt seo) den bhliain fostaíochta agus go bhfágfaidh an t-oibrí fostaíocht an fhostóra sula mbeidh deireadh leis an mbliain fostaíochta, ní bheidh an fostóir i dteideal, maidir le saoire bhliantúil a lamháil, an tréimhse fógra is gá chun an fhostaíocht a fhoirceannadh ná an pá ná aon díolaíochtaí eile a mbeidh teideal ag an oibrí chucu an tráth a fhágfaidh sé an fhostaíocht sin a laghdú.

11.—Má mhainníonn fostóir oibrí neamh-thís saoire bhliantúil a lamháil don oibrí in aghaidh bliain fostaíochta an oibrí de réir an Achta seo, beidh éifeacht ag na forálacha seo a leanas:
(a) beidh an fostóir ciontach i gcion, agus
(b) íocfaidh an fostóir (cibé acu a bheidh nó nach mbeidh imeachtaí tionscanta faoi mhír (a) den alt seo) leis an oibrí suim is comhionann leis an méid a dhlífeadh sé, faoi fho-alt (2) d'alt 10 den Acht seo, a íoc leis an oibrí dá mbeadh sé, iarbhír, tar éis an tsaoire bhliantúil a lamháil don oibrí agus gur lamháladh í i rith na gceithre lá dhéag deiridh den bhliain fostaíochta.

12.—(1) Ní dleathach do dhuine is oibrí tionscail nó comhalta d'fhoireann siopa aon obair thionscail nó obair siopa a dhéanamh d'aon duine ar luach saothair i rith aon tréimhse de shaoire bhliantúil.
(2) Má dhéanann duine is oibrí tionscail nó comhalta d'fhoireann siopa aon ní a sháróidh an t-alt seo beidh sé ciontach i gcion.
Saoire bhliantúil oibrithe tís.
13.—(1) Déanfaidh gach duine ag a mbeidh oibrí tís ar fostú, gach bliain fostaíochta de chuid an oibrí a bheidh an t-oibrí ar fostú ag an duine sin go leanúnach nó ó lá go lá agus trí chéad lá ar a laghad a bheith oibrithe aige san fhostaíocht sin, ceithre lá dhéag comhleanúnacha de laethanta saoire iomlána, ar a n-áirítear dhá Dhomhnach, (dá ngairtear saoire bhliantúil freisin san Acht seo) a lamháil don oibrí cibé tráth is oiriúnach leis an duine sin.
(2) I gcás ina lamhálfaidh duine seacht lá comhleanúnacha de laethanta saoire iomlána (dá ngairtear saoire leathbhliantúil san Acht seo) d'oibrí tís a bheidh ar fostú aige an chéad leath de bhliain fostaíochta an oibrí tís agus ina lamhálfaidh sé saoire leathbhliantúil freisin don oibrí an dara leath den bhliain fostaíochta sin, ní bheidh feidhm ag forálacha fho-alt (1) den alt seo maidir leis an oibrí sin an bhliain fostaíochta sin.
(3) I gcás ina lamhálfar saoire bhliantúil nó saoire leathbhliantúil d'oibrí tís, íocfaidh fostóir an oibrí leis an oibrí, in aghaidh na saoire bliantúla nó na saoire leathbhliantúla, suim is comhionann leis an méid a fuair an t-oibrí ón bhfostóir mar thuarastal nó pá in aghaidh—
(a) i gcás ina lamhálfar saoire bhliantúil don oibrí, an dá sheachtain chomhleanúnacha, díreach roimh an tsaoire bhliantúil a d'oibrigh an t-oibrí an ghnáth-uimhir uaire a chloig an uasuimhir laethanta faoina chonradh seirbhíse,
(b) i gcás ina lamhálfar saoire leathbhliantúil don oibrí, na seachtaine díreach roimh an tsaoire leathbhliantúil a d'oibrigh an t-oibrí an ghnáth-uimhir uaire a chloig an uasuimhir laethanta faoina chonradh seirbhíse.
(4) I gcás—
(a) oibrí tís a bheith ar fostú ag duine faoi chonradh seirbhíse a fholaíonn lóistín,
(b) an duine sin do thabhairt fógra don oibrí go bhfuil ar intinn aige saoire bhliantúil nó saoire leathbhliantúil a lamháil don oibrí i rith tréimhse áirithe, agus
(c) an t-oibrí, le toiliú an duine sin, d'fhanacht ag obair don duine sin ar feadh na tréimhse sin,
measfar, má íocann an duine sin, i dteannta an phá in aghaidh na tréimhse sin, leis an oibrí, suim is comhionann le méid an phá, gur lamháladh lá saoire iomlán don oibrí gach lá de na laethanta sa tréimhse sin.
(5) I gcás—
(a) oibrí tís do scor de bheith i bhfostaíocht duine i rith an chéad leath de bhliain fostaíochta an oibrí, agus
(b) céad caoga lá ar a laghad a bheith oibrithe ag an oibrí san fhostaíocht an chéad leath, agus
(c) nár lamháladh saoire bhliantúil ná saoire leathbhliantúil, an chéad leath, don oibrí roimh an scor,
íocfaidh an duine sin leis an oibrí ar an scor suim is comhionann leis an méid a dhlífeadh sé a íoc leis an oibrí faoi fho-alt (3) den alt seo, dá mbeadh sé, iarbhír, tar éis saoire leathbhliantúil a lamháil don oibrí an chéad leath agus gur lamháladh í i rith na seacht lá díreach roimh an scor.
(6) I gcás oibrí tís do scor de bheith i bhfostaíocht duine i rith an dara leath de bhliain fostaíochta an oibrí agus nár lamháladh don oibrí roimh an scor saoire bhliantúil in aghaidh na bliana fostaíochta ná saoire leathbhliantúil in aghaidh an chéad leath den bhliain fostaíochta agus, fós, an dara leath, beidh éifeacht ag na forálacha seo a leanas:
(a) má d'oibrigh an t-oibrí céad caoga lá ar a laghad an chéad leath agus céad caoga lá ar a laghad an dara leath, íocfaidh an duine sin ar an scor leis an oibrí suim is comhionann leis an méid a dhlífeadh sé, faoi fho-alt (3) den alt seo, a íoc leis an oibrí dá mbeadh sé, iarbhír, tar éis saoire bhliantúil a lamháil don oibrí agus gur lamháladh í i rith na gceithre lá dhéag díreach roimh an scor;
(b) más rud é—
(i) gur oibrigh an t-oibrí san fhostaíocht ar feadh tréimhse nár lú ná céad caoga lá an chéad leath, ach ba lú ná céad caoga lá an dara leath, agus
(ii) nár lamháladh saoire leathbhliantúil an chéad leath don oibrí roimh an scor,
íocfaidh an duine sin leis an oibrí ar an scor suim is comhionann leis an méid a dhlífeadh sé, faoi fho-alt (3) den alt seo, a íoc leis an oibrí dá mbeadh sé, iarbhír, tar éis saoire leathbhliantúil a lamháil don oibrí an chéad leath agus gur lamháladh í i rith na seacht lá deiridh den chéad leath;
(c) más rud é—
(i) gur oibrigh an t-oibrí san fhostaíocht ar feadh tréimhse nár lú ná céad caoga lá an chéad leath, ach ba lú ná céad caoga lá an dara leath, agus
(ii) nár lamháladh saoire leathbhliantúil an chéad leath ná an dara leath don oibrí roimh an scor,
íocfaidh an duine sin leis an oibrí ar an scor suim is comhionann leis an méid a dhlífeadh sé, faoi fho-alt (3) den alt seo, a íoc leis an oibrí dá mbeadh sé, iarbhír, tar éis saoire leathbhliantúil a lamháil an dara leath agus gur lamháladh í i rith na seacht lá deiridh den dara leath.
(7) Féadfaidh an tAire, aon uair agus a mhinice is cuí leis, rialacháin a dhéanamh a athróidh, maidir le gach aicme nó aon aicme nó aicmí áirithe (a mhíneofar i cibé slí agus faoi threoir cibé nithe is cuí leis an Aire) oibrithe tís, gach tréimhse nó aon cheann de na tréimhsí trí chéad lá nó céad caoga lá a luaitear i bhfo-alt (1), (5) agus (6) den alt seo trí cibé uimhir laethanta is cuí leis an Aire a chur ina ionad, agus, aon uair a bheidh aon rialacháin mar sin den sórt sin i bhfeidhm, beidh éifeacht ag na fo-ailt sin, maidir leis na hoibrithe tís nó an aicme nó na haicmí oibrithe tís lena mbaineann na rialacháin, amhail is dá ndéanfaí na tréimhsí sin nó cibé tréimhse acu dá ndéanfaidh na rialacháin difir a athrú sa tslí a luafar sna rialacháin.
(8) I gcás aon lá neamh-oibre nó aon dá lá neamh-oibre comhleanúnacha nó níos mó do thitim díreach roimh lá nó díreach i diaidh lae a lamháil an fostóir lá saoire iomlán d'oibrí tís, measfar chun críocha an ailt seo gur lá a lamháil an fostóir lá saoire iomlán don oibrí an lá neamh-oibre nó gach ceann de na laethanta neamh-oibre comhleanúnacha (de réir mar a bheidh), murar oibrigh an t-oibrí an lá sin don fhostóir.
(9) Ní áireofar mar lá de shaoire bhliantúil aon lá is lá saoire poiblí nó lá a measfar, de bhun alt 9 den Acht seo, lá saoire iomlán a bheith lamháilte d'oibrí neamh-thís, ach má thagann aon lá den sórt sin idir laethanta de shaoire bhliantúil, measfar na laethanta sin a bheith comhleanúnach d'ainneoin an lá sin a theacht amhlaidh.
(10) Bainfidh an t-alt seo leis an mbliain fostaíochta a bheidh ann i dtosach feidhme an Achta seo maidir le gach duine is oibrí tís ag an tosach feidhme sin, agus beidh éifeacht ag an alt seo maidir leis an mbliain fostaíochta sin agus an duine sin amhail is dá mbeadh an t-alt seo i ngníomh i dtosach na bliana fostaíochta sin.
(11) I gcás é a bheith beartaithe ag duine ag a bhfuil oibrí tís ar fostú aon laethanta saoire iomlána a dheonú don oibrí de bhun an ailt seo—
(a) déanfaidh sé, tráth nach déanaí ná ceithre lá dhéag roimh an lá a bheidh na laethanta saoire iomlána le tosú, fógra a thabhairt ag insint go bhfuil sé ar intinn aige na laethanta saoire iomlána a dheonú agus an lá thosóidh siad;
(b) má mhainníonn sé mír (a) den fho-alt seo a chomhlíonadh beidh sé ciontach i gcion.
(12) Chun críocha an ailt seo measfar oibrí tís a bheith tar éis oibriú i bhfostaíocht duine áirithe aon lá a bhí sé ar fáil chun seirbhíse ar an duine sin á iarraidh air ar feadh dhá uair a chloig nó níos mó.
Mainneachtain i saoire bhliantúil a lamháil d'oibrí tís.
14.—Má mhainníonn fostóir oibrí tís saoire bhliantúil a lamháil don oibrí in aghaidh bliain fostaíochta an oibrí sin de réir an Achta seo, beidh éifeacht ag na forálacha seo a leanas:
(a) beidh an fostóir ciontach i gcion;
(b) íocfaidh an fostóir (cibé acu a bheidh nó nach mbeidh imeachtaí tionscanta faoi mhír (a) den alt seo) leis an oibrí suim is comhionann leis an méid a dhlífeadh sé, faoi fho-alt (3) d'alt 13 den Acht seo, a íoc leis an oibrí dá mbeadh sé, iarbhír, tar éis saoire bhliantúil a lamháil don oibrí agus gur lamháladh í i rith na gceithre lá dhéag deiridh den bhliain fostaíochta.
Iocaíocht in ionad iostais agus lóistín le linn saoire.
15.—(1) I gcás—
(a) ina lamhálfaidh an fostóir saoire bhliantúil nó saoire leathbhliantúil don oibrí, agus
(b) go raibh an t-oibrí, díreach roimh an tsaoire bhliantúil nó an tsaoire leathbhliantúil, i dteideal cóiríochta mar chuid dá luach saothair,
íocfaidh an fostóir, i dteannta aon suim is iníoctha leis an oibrí faoin Acht seo in aghaidh saoire bhliantúil nó saoire leathbhliantúil, in aghaidh aon lá a thitfidh laistigh den tsaoire bhliantúil nó den tsaoire leathbhliantúil nach bhfaighidh sé cóiríocht, i gcás an t-oibrí a bheith ar fostú i gcontae-bhuirg nó i mbuirg Dhún Laoghaire, suim trí scilling nó, in aon chás eile, suim dhá scilling.
(2) Féadfaidh an tAire, aon uair agus a mhinice is cuí leis, rialacháin a dhéanamh a athróidh an tsuim a íocfaidh fostóir le hoibrí faoi fho-alt (1) den alt seo trí cibé suim eile is cuí leis an Aire a chur in ionad na suime a luaitear san fho-alt sin i leith an oibrí sin, agus, aon uair a bheidh rialacháin den sórt sin i bhfeidhm, beidh éifeacht ag forálacha an fho-ailt sin (1) maidir leis an oibrí lena mbainfidh na rialacháin amhail is dá ndéanfaí an tsuim a luaitear ann i leith an oibrí sin a athrú mar a déarfar sna rialacháin.
(3) San alt seo ciallaíonn “cóiríocht”—
(a) maidir le hoibrí atá i dteideal iostais agus sin amháin, iostas;
(b) maidir le hoibrí atá i dteideal lóistín agus sin amháin, lóistín;
(c) maidir le hoibrí atá i dteideal iostais agus lóistín, iostas agus lóistín.

16.—Féadfaidh an tAire, tar éis dó dul i gcomhairle le cibé Airí Stáit nó eagrais fostóirí agus le cibé eagrais oibrithe arb iomchuí leis dul i gcomhairle leo, rialacháin a dhéanamh á fhoráil go bhféadfar saoire bhliantúil a lamháil do gach aicme nó d'aon aicme nó aicmí áirithe (a mhíneofar i cibé slí agus faoi threoir cibé nithe is cuí leis an Aire) oibrithe neamh-thís i níos mó ná tréimhse amháin de laethanta comhleanúnacha a shonrófar sna rialacháin, agus féadfaidh na rialacháin aon cheann d'fhorálacha an Achta seo a mhodhnú chun críocha na rialachán.
Laethanta Saora faoi phá a ríomh mar shaoire bhliantúil.
17.—(1) I gcás inar ghnás ag fostóir, díreach roimh thosach feidhme an Achta seo, laethanta saora faoi phá a lamháil d'aon oibrí ina fhostaíocht i dteannta laethanta saoire poiblí agus saoire bhliantúil, agus go leanfar den ghnás sin tar éis tosach feidhme an Achta seo maidir le hoibrí cibé acu ar fostú dó amhlaidh roimh an tosach feidhme sin agus dá éis nó tar éis an tosach feidhme sin, féadfar, chun críocha an Achta seo, na laethanta saora sin faoi phá a áireamh mar laethanta den tsaoire bhliantúil i leith seacht lá ar a mhéid den tsaoire bhliantúil sin.
(2) Chun críocha fho-alt (1) den alt seo measfar lá saor faoi phá a bheith lamháilte ag fostóir d'oibrí má lamhálann sé lá saoire iomlán (ar chúis eile seachas i leith saoire bhreoiteachta) don oibrí a ndéanfaidh sé pá lae iomláin mar a mhínítear i bhfo-alt (13) d'alt 9 den Acht seo a íoc leis an oibrí ina aghaidh.
(3) Féadfaidh an tAire, tar éis dó dul i gcomhairle le cibé Airí Stáit nó eagrais fostóirí agus cibé eagrais oibrithe arb iomchuí leis dul i gcomhairle leo, rialacháin a dhéanamh á fhoráil go bhféadfar an gnás a luaitear i bhfo-alt (1) den alt seo a chur chun feidhme go hiomlán nó go páirteach amhail idir aon fhostóir agus aon oibrí (nó aon aicme nó tuairisc oibrithe a mhíneofar i cibé slí agus faoi threoir cibé nithe is cuí leis an Aire) dá dtagrófar sna rialacháin agus a thoileoidh leis an ngnás sin a chur chun feidhme a mhéid a shonrófar sna rialacháin, agus, ar na rialacháin sin a bheith déanta agus an toiliú sin a bheith tugtha, bainfidh forálacha fho-alt (1) den alt seo leo amhail mar a bhaineann siad leo siúd a luaitear san fho-alt sin (1), ach sin go hiomlán nó go páirteach (de réir mar is iomchuí).
(4) Féadfaidh an tAire aon cheann d'fhorálacha an Achta seo a mhodhnú d'fhonn go mbeidh éifeacht ag forálacha fho-alt (1) den alt seo nó ag na forálacha sin arna gcur chun feidhme le fo-alt (3) den alt seo.
CUID IV
Ilghnéitheach.
Oibrithe do ghnóthú airgid a bheidh dlite de fhostóirí.
18.—(1) Má mhainníonn aon fhostóir oibrí aon airgead a thiocfaidh chun bheith iníoctha ag an bhfostóir leis an oibrí faoi aon fhoráil san Acht seo a íoc leis an oibrí—
(a) beidh an fostóir ciontach i gcion;
(b) féadfaidh an t-oibrí (cibé acu a bheidh nó nach mbeidh imeachtaí tionscanta faoi mhír (a) den fho-alt seo) an t-airgead sin a ghnóthú ón bhfostóir mar fhiach conartha shimplí i gcúirt dlínse inniúla.
(2) Má dhéantar agus nuair a dhéanfar fostóir aon oibrí a chiontú i gcion faoi aon alt den Acht seo maidir leis an oibrí, féadfaidh an chúirt a chiontóidh an fostóir a ordú dó aon airgead a íoc leis an oibrí a bhí dlite don oibrí den fhostóir, tráth an chiontaithe, faoi aon cheann d'fhorálacha an Achta seo.
Cionta ag comhlachtaí corpraithe.
19.—Má dhéanann comhlacht corpraithe cion faoi aon alt den Acht seo agus go gcruthófar go ndearnadh an cion le toiliú nó le haontú, nó gur urasaíodh a dhéanamh trí aon mhainneachtain ar thaobh, aon stiúrthóir, bainisteoir, rúnaí nó oifigeach eile de chuid an chomhlachta chorpraithe, measfar freisin an stiúrthóir, an bainisteoir, an rúnaí nó an t-oifigeach eile sin a bheith ciontach sa chion agus dlífear imeachtaí a thionscnamh ina aghaidh agus é a phionósú dá réir.
Cionta a ionchúiseamh.
20.—(1) Féadfaidh an tAire cion faoi aon alt den Acht seo a ionchúiseamh.
(2) Féadfaidh an t-oibrí nó aon oifigeach de cheardchumann cláraithe ar comhalta de an t-oibrí cion faoi aon alt den Acht seo a dhéanfaidh fostóir an oibrí a ionchúiseamh.
(3) Féadfar ionchúiseamh i leith cion faoi aon alt den Acht seo a thionscnamh laistigh de dhá mhí dhéag tar éis an cion a dhéanamh.
Eigeandáil mar chosaint.
21.—I gcás ina gcúiseofar duine i gcion faoi aon alt den Acht seo, is cosaint mhaith ar an gcúiseamh má chruthaíonn sé chun sástachta na cúirte a bheidh ag triail na cúise gur ghá nó gur chuí go réasúnach an sárú líomhnaithe ar an alt mar gheall ar thine, tuile, stoirm, foréigean, cliseadh gléasra nó innealra, nó aon éigeandáil eile tarlú iarbhír nó bagairt nó coinne réasúnach a bheith ann go dtarlódh sé.
Pionóis i leith cionta.
22.—Gach duine a bheidh ciontach i gcion faoi aon alt den Acht seo, dlífear, ar é a chiontú ann go hachomair, fíneáil nach mó ná cúig phunt is fiche a chur air i gcás inarb é an chéad chion é faoin alt sin agus, fíneáil nach mó ná caoga punt i gcás aon chion eile dá éis faoin alt sin.
Orduithe agus rialacháin a leagan faoi bhráid Thithe an Oireachtais.
23.—Gach ordú agus rialachán a dhéanfaidh an tAire faoin Acht seo leagfar iad faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a ndéanta, agus má dhéanann ceachtar Teach acu sin, laistigh den lá agus fiche a shuífidh an Teach tar éis an t-ordú nó an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe nó an rialacháin, beidh an t-ordú nó an rialachán ar neamhní dá réir sin ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin ordú nó faoin rialachán.
Cumhachtaí cigirí.
24.—(1) San alt seo ciallaíonn “cigire” duine arna cheapadh ag an Aire chun bheith ina chigire chun críocha an ailt seo.
(2) D'fhonn forálacha an Achta seo a chur i bhfeidhm féadfaidh an tAire gach ní nó aon ní acu seo a leanas a dhéanamh:
(a) faoi réir fhorálacha an ailt seo, dul isteach gach tráth réasúnach in aon áitreabh nó áit a bhfuil cúis réasúnach aige chun a mheas go bhfuil aon oibrí ar fostú ann,
(b) cibé scrúdú nó fiosrú is gá a dhéanamh chun a fháil amach cé acu atáthar nó nach bhfuiltear ag comhlíonadh forálacha an Achta seo maidir le haon oibrí a bheidh ar fostú in aon áitreabh nó áit den sórt sin,
(c) a cheangal ar fhostóir aon oibrí nó ar ionadaí an fhostóra sin aon taifid a thabhairt ar aird dó atá de cheangal, faoi ordú taifead, ar an bhfostóir sin a choimeád agus na nithe a bheidh sna taifid sin a iniúchadh agus cóipeanna a dhéanamh díobh,
(d) scrúdú, maidir le haon ábhair faoin Acht seo, a dhéanamh ar aon duine a bhfuil cúis réasúnach aige chun a chreidiúint gurb oibrí nó gurbh oibrí é nó gur fostóir nó gur fhostóir aon oibrí é agus a cheangal ar an duine sin cibé ceisteanna (seachas ceisteanna a fhéadfaidh an duine sin a ionchoiriú) a fhéadfaidh an cigire a chur maidir leis na hábhair sin a fhreagairt agus dearbhú a shíniú go bhfuil na freagraí ar na ceisteanna sin fíor.
(3) Ní bheidh na cumhachtaí a thugtar do chigire le mír (a) d'fho-alt (1) den alt seo infheidhmithe maidir le haon teach cónaithe príobháideach mura ndeimhneoidh an tAire nó oifigeach don Aire arna cheapadh ag an Aire chuige sin go bhfuil cúis réasúnach aige chun a chreidiúint go ndearna fostóir an oibrí cion faoin alt seo maidir le haon oibrí i bhfostaíocht sa teach, agus go dtabharfaidh an cigire an deimhniú ar aird nuair a iarrfaidh sé cead dul isteach sa teach.
(4) Aon duine—
(a) a choiscfidh nó a bhacfaidh cigire i bhfeidhmiú aon cheann de na cumhachtaí a thugtar don chigire leis an alt seo,
(b) a dhiúltóidh aon taifead a thabhairt ar aird a cheanglóidh cigire go dleathach air a thabhairt ar aird,
(c) a thabharfaidh ar aird, nó a chuirfidh faoi deara nó a cheadóidh go feasach go dtabharfar ar aird, do chigire aon taifead a bheidh bréagach in aon phonc ábhartha agus a fhios aige é a bheith bréagach,
(d) a dhéanfaidh aon duine, nó a fhéachfaidh le haon duine, a thoirmeasc ó láithriú os comhair cigire nó óna cheistiú ag cigire, nó
(e) a mhainneoidh nó a dhiúltóidh ceanglas dleathach cigire faoi mhír (d) d'fho-alt (1) den alt seo, a chomhlíonadh,

(5) Tabharfar deimhniú a cheapacháin do gach cigire agus, nuair a iarrfaidh sé cead dul isteach in aon áitreabh nó áit chun críocha an Achta seo, tabharfaidh sé an deimhniú ar aird, má iarrtar sin air, don áititheoir agus d'aon duine a bheidh á scrúdú aige.
Taifid.
25.—(1) Féadfaidh an tAire aon uair agus a mhinice is cuí leis le hordú (dá ngairtear ordú taifead san Acht seo) a cheangal ar fhostóirí oibrithe nó ar aon aicme d'fhostóirí oibrithe taifid a choimeád d'aon ábhar nó ní a measann an tAire gur gá é bheith ar taifead chun an tAcht seo a chur i bhfeidhm agus, más oiriúnach leis, foirm aon taifead den sórt sin a ordú.
(2) Féadfaidh an tAire faoin alt seo orduithe taifead éagsúla a dhéanamh maidir le haicmí éagsúla d'fhostóirí oibrithe.
(3) Féadfaidh an tAire le hordú faoin alt seo aon ordú a rinneadh faoin alt nó faoin bhfo-alt seo a leasú nó a chúlghairm.

HOLIDAYS (EMPLOYEES) ACT, 1961.
PART I
Preliminary
Short title and commencement.
1.—(1) This Act may be cited as the Holidays (Employees) Act, 1961.
(2) This Act shall come into operation on such day as the Minister may by order appoint.
Definitions generally.
2.—(1) In this Act—“the Act of 1936” means the Conditions of Employment Act, 1936;
“the Act of 1938” means the Shops (Conditions of Employment) Act, 1938;
“day” means, in relation to a person whose spell of work begins on one day and ends on the next, a period of twenty-four hours commencing at the time at which the spell of work begins;
“employ” means employ, under a contract of service (whether the contract is expressed or implied or is oral or in writing) or a contract of apprenticeship, and cognate words shall be construed accordingly;
“industrial work” has the same meaning as in the Act of 1936;
“the Minister” means the Minister for Industry and Commerce;
“month” means any period of thirty consecutive days;
“non-working day” means, in relation to a worker, a day on which the worker does not under his contract of service normally work;”
“offence under any section of this Act” includes an offence under any subsection of a section of this Act;
“shop” has the same meaning as that word had in the Act of 1938, prior to the enactment of the Shops (Conditions of Employment) (Amendment) Act, 1942;
“member of the staff”, in relation to a shop, has the same meaning as that expression has in the Act of 1938, as amended by Section 2 of the Shops (Conditions of Employment) (Amendment) Act 1942, and “shop work” has the same meaning as in the Act of 1938;
“short day” means, in relation to a worker, a day on which the worker under his contract of service normally works for less than a full day;
“week” means any period of seven consecutive days;
“working day” means, in relation to a worker, a day which—
(a) is a week-day, and
(b) is not—
(i) a public holiday,
(ii) a day within which any period of twenty-four consecutive hours of rest required to be allowed to the worker under any other enactment falls,
(iii) a non-working day, or
(iv) a short day.
(2) A person in the service of a local authority shall be deemed for the purposes of this Act to be employed by the local authority.
Workers.
3.—(1) In this Act—
“worker” means any person of the age of fourteen years or upwards who is employed, other than a person who is—
(a) one to whom articles or materials are given out to be made up, cleaned, washed, altered, ornamented or repaired or adapted for sale in his own home or on other premises not under the control or management of the person who gave out the materials or articles,
(b) an agricultural worker to whom the Agricultural Workers (Holidays) Act, 1950 applies,
(c) the master or a member of the crew of any sea-going vessel (not being a barge or a hopper), whether publicly or privately owned, engaged in the transport of cargo or passengers,
(d) a lighthouse or lightship employee,
(e) a clergyman in Holy Orders,
(f) a member of any religious order or community,
(g) the wife, husband, father, mother, grandfather, grandmother, step-father, step-mother, son, daughter, grandson, grand-daughter, step-son, step-daughter, brother, sister, half-brother or half-sister of his employer maintained by and dwelling in the house of his employer,
(h) a person who is employed by or under the State not being—
(i) a person so employed in an unestablished position to whom, by virtue of section 6 of the Act of 1936, that Act applies,
(ii) a person so employed in an unestablished positionas a porter, door-keeper, messenger, night watchman, charwoman, cleaner, or labourer or in other subordinate duties, or
(iii) a person so employed in an unestablished position as an artisan or other skilled labourer,
(i) employed as a fisherman, or
(j) member of any particular class of employed persons declared by an order made under this section to be an excluded class for the purposes of this section;
“domestic worker” means a person who—
(a) is a worker,
(b) is not an industrial worker,
(c) is not a member of the staff of a shop, and
(d) either—
(i) is entitled under his contract of service to free lodgings either in his employer's house or elsewhere, or
(ii) does work of a personal or domestic nature in or about the dwelling house of his employer:
“non-domestic worker” means a worker who is not a domestic worker;
“industrial worker” means a worker, other than an out-worker within the meaning of the Act of 1936, who does industrial work for a salary or wages or for the purposes of learning any trade or calling;
In paragraph (h) of this subsection “unestablished position” has the same meaning as in the Civil Service Commissioners Act, 1956.
(2) The Minister may, whenever and so often as he thinks fit, after consultation with such Ministers of State or employers' organisations and with such workers' organisations as he considers appropriate to be consulted, by order declare that any particular class (defined in such manner and by reference to such things asthe Minister thinks proper) of employed persons shall be an excluded class for the purposes of this section, and whenever any-such order is made then so long as such order is in force the class of employed persons to which such order relates shall be an excluded class for the purposes of this section.
(3) The Minister may, after consultation with such Ministers of State or employers' organisations and with such workers' organisations as he considers appropriate to be consulted, make regulations providing—
(a) that any person or any class or description (defined in such manner and by reference to such things as the Minister thinks proper) of persons shall be deemed to be a worker or workers for the purposes of this Act;
(b) that any worker or workers, whether as so defined in this section, or deemed to be such for the purposes of this Act by virtue of regulations made under this subsection, shall, for those purposes, be deemed to be a domestic worker or domestic workers or a non-domestic worker or non-domestic workers (as the case may be) as specified in the regulations.
Any regulations made by the Minister under this subsection may contain such supplemental and consequential provisions or modifications of the provisions of this Act as he considers necessary for giving full effect to the regulations.
(4) The Minister may revoke or amend any order made under this section (including this subsection).
“Employment year” and “employment half-year”.
4.—(1) In this Act—
“employment year” when used in relation to a worker, means a period of three hundred and sixty-five days (excluding any day which is the 29th day of February) commencing on the day on which the worker last entered the employment in relation to which the expression is used or on any anniversary of that day;
“the first half”, when used in relation to an employment year of a domestic worker, means a period of one hundred and eighty-three days commencing on the first day of the employment year;
“the second half”, when used in relation to an employment year of a domestic worker, means so much of the employment year as is not included in the first half thereof.
Where a worker entered on employment on the 29th day of February, he shall for the purposes of the interpretation of the definition of “employment year”, be deemed to have entered that employment on the next following day.
(2) Where—
(a) the ownership of any business, whether carried on for profit or gain or not, is transferred by act of the parties or by operation of law during the currency of an employment year of any worker who immediately before the transfer was employed by the person carrying on the business, and
(b) the worker continues after the transfer to be employed by the person (in this subsection referred to as the new employer) to whom the ownership is transferred, the following provisions shall have effect—
(i) the worker shall, for the purposes of this Act (including subsection (1) of this section but excluding section 9 (in so far as it relates to rights of non-domestic workers in respect of public holidays) of this Act in respect of any public holidays previous to the transfer), be deemed to have been in the employment of the new employer as on and from the beginning of the employment year;
(ii) if the worker has been allowed before the transfer annual leave or, in case the worker is a domestic worker, annual leave or semi-annual leave during the employment year, the annual leave or semi-annual leave shall, for the purposes of this Act, be deemed to have been allowed by the new employer.
(3) In this section “business” includes any profession, office, establishment or trade of whatsoever kind.
Meaning of “a whole holiday”.
5.—A person shall be deemed, for the purposes of this Act, to allow a worker employed by him a whole holiday on a particular day if, but only if, he does not permit the worker to do on that day any work for him.
Expenses.
6.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Repeals and consequential amendment.
7.—(1) Section 7 of the Act of 1936 is hereby repealed.
(2) Sections 28, sections 30 to 32 inclusive, and sections 36 to 39 inclusive of the Act of 1938 are hereby repealed.
(3) The Holidays (Employees) Act, 1939 is hereby repealed.
(4) Subsection (1) of section 49 of the Act of 1936 is hereby amended by the insertion of “within the meaning of the Holidays (Employees) Act, 1961” after “public holiday”.
PART II
Public holidays
Public Holidays in respect of all workers.
8.—(1) Subject to the provisions of this section, each of the following days shall, in respect of all workers, be for the purposes of this Act, a public holiday;
(a) Christmas Day when it falls on a weekday or, when it falls on a Sunday, the 27th day of December,
(b) St. Stephen's Day when it falls on a weekday or, when it falls on a Sunday, the next following Monday,
(c) St. Patrick's Day when it falls on a weekday or, when it falls on a Sunday, the next following Monday,
(d) Easter Monday, Whit Monday, and the first Monday in August,
(2) Whenever in any year a day is appointed under the Public Holidays Act, 1924, to be a bank holiday instead of a day mentioned in subsection (1) of this section, the day so appointed shall in that year be deemed to be substituted throughout that subsection for the day so mentioned.
(3) The employer of any worker may substitute for any public holiday (other than Christmas Day or St. Patrick's Day) falling in a calendar year either—
(a) the Church holiday falling in the calendar year immediately before the public holiday by giving to the worker not less than fourteen days before the Church holiday notice of his intention to effect the substitution, or
(b) the Church holiday falling in that calendar year immediately after the public holiday or, if the public holiday is a day which is a public holiday by virtue of paragraph (b) of subsection (1) of this section, the 1st day of January next following by giving to the worker not less than fourteen days before the public holiday notice of his intention to effect the substitution,
and whenever such notice is given, the substituted Church holiday shall in respect of the worker be a public holiday for the purposes of this Act instead of the day for which it is so substituted.
(4) For the purposes of subsection (3) of this section each of the following days shall be a Church holiday:
(i) the 1st day of January, except when it falls on a Sunday,
(ii) Ascension Thursday,
(iii) the Feast of Corpus Christi,
(iv) the 15th day of August, except when it falls on a Sunday,
(v) the 1st day of November, except when it falls on a Sunday,
(vi) the 8th day of December, except when it falls on a Sunday.
(5) The Minister may by order declare any of the days mentioned in subsection (1) of this section not to be a public holiday for the purposes of this Act and may appoint any day to be a public holiday for the purposes of this Act and, on such order being made, the day so appointed shall be deemed to be a public holiday for the purposes of this Act.
(6) The Minister may by order appoint a day to be a Church holiday for the purposes of this Act either in substitution for or in addition to a day mentioned in subsection (4) of this section and, on such order being made, the day so appointed shall be deemed to be a Church holiday for the purposes of this Act.
(7) The notice mentioned in subsection (3) of this section shall be in writing and may be given to any person by handing a copy thereof to him personally or by posting a copy thereof in a conspicuous position in the place where he is employed.
(8) In this Act “public holiday”, when used in relation to any worker, shall be construed in accordance with the foregoing provisions of this section.
Rights of workers in respect of public holidays.
9.—(1) Where—
(a) a worker is in the employment of a person on a public holiday,
(b) the worker has worked for such person for the qualifying period of work for that worker defined in subsection (8) of this section at any time during the period of five weeks immediately preceding the public holiday, and
(c) either—
(i) the worker has been allowed by such person a whole holiday on the public holiday, or
(ii) the public holiday occurs on a non-working day or on a short day and the worker does not work for such person on the public holiday,
such person shall pay to the worker in respect of the public holiday a sum equivalent to a full day's pay.
(2) Where—
(a) a worker is in the employment of a person on a public holiday,
(b) the worker has worked for such person for the qualifying period of work for that worker defined in subsection (8) of this section at any time during the period of five weeks immediately preceding the public holiday, and
(c) the worker has worked on the public holiday for such person,
such person shall,
(i) allow to that worker a compensatory holiday in lieu of the public holiday, or
(ii) pay to the worker in respect of the public holiday a sum equivalent to twice the amount of a full day's pay.
(3) For the purposes of subsection (2) of this section a person shall be deemed to have allowed the worker a compensatory holiday in lieu of a public holiday if, but only if he
(a) allows the worker a whole holiday in lieu of a public holiday on a working day before the expiration of one month after the public holiday and pays to the worker in respect thereof a sum equivalent to the amount of a full day's pay, or
(b) allows the worker at any time during the employment year of the worker within which the public holiday occurs a whole holiday on the working day next following the expiration of the worker's annual leave and pays to the worker in respect thereof a sum equivalent to the amount of a full day's pay.
(4) Where—
(a) a worker is in the employment of a person on a public holiday,
(b) the worker has worked for such person for the qualifying period of work for that worker defined in subsection (8) of this section at any time during the period of five weeks immediately preceding the public holiday,
(c) the worker has worked on the public holiday for such person,
(d) the worker has not received in respect of the holiday a sum equivalent to twice the amount of a full day's pay, and
(e) the employment of the worker is terminated before he has been allowed a compensatory holiday in lieu of the public holiday,
such person shall pay to the worker on such termination in addition to any wages then due to him a sum equivalent to a full day's pay.
(5) Where—
(a) a worker in the employment of a person is allowed by such person a compensatory holiday in lieu of a public holiday, and
(b) the worker ceases to be in the employment of such person before the public holiday occurs,
such person may not deduct from the wages due to the worker any sum in respect of the compensatory holiday.
(6) Where—
(a) a worker in the employment of a person has worked for such person for the qualifying period of work for that worker defined in subsection (8) of this section at any time during the period of five weeks immediately preceding a public holiday, and
(b) the services of the worker with such person are terminated by such person before the public holiday,
such person shall upon such termination, pay to the worker, in addition to any wages then due to him,
(i) a sum equivalent to a full day's pay, or
(ii) if such holiday was Christmas Day, a sum equivalent to a full day's pay in respect of that day, and an additional such sum in respect of St. Stephen's Day.
(7) Where—
(a) a worker in the employment of a person has worked for such person for the qualifying period of work for that worker defined in subsection (8) of this section at any time during the period of five weeks immediately preceding an appointed holiday,
(b) a day (in this subsection referred to as the substituted day) is substituted under section 8 of this Act for the appointed holiday,
(c) the substituted day occurs after the appointed holiday, and
(d) the services of the worker with such person are terminated by such person before the substituted day,
such person shall upon such termination, pay to the worker, in addition to any wages then due to him, a sum equivalent to a full day's pay.
In this subsection “appointed holiday” means a day which is a public holiday by virtue of subsection (1) or subsection (2) of section 8 of this Act.
(8) The qualifying periods of work for the purposes of subsections (1), (2), (4), (6) and (7) of this section shall be as follows:
(a) in the case of an industrial worker under eighteen years of age, or a worker under eighteen years of age who is employed in mining, not less than one hundred and twenty hours,
(b) in the case of a domestic worker, not less than twenty-five days, and
(c) in the case of any other worker, not less than one hundred and thirty-five hours.
In the calculation of the qualifying periods of work defined in this subsection days of annual leave shall be included and a worker shall be deemed to have worked on each day of his annual leave the normal number of hours which he would have worked on that day under his contract of service.
(9) Each hour of intermittent unemployment of a worker in respect of which supplementary benefit is payable under section 28 of the Insurance (Intermittent Unemployment) Act, 1942, shall be deemed to be an hour worked for the purposes of this section up to a maximum of fifty hours in respect of each qualifying period.
(10) The Minister may, whenever and so often as he thinks proper, make regulations varying in respect of all classes or any particular class (defined in such manner and by reference to such things as the Minister thinks proper) of workers any or all of the qualifying periods of work defined in subsection (8) of this section by substituting therefor either such other number of hours or such number of days as the Minister thinks proper, and wheneverany such regulations are in force, the provisions of subsection (8) of this section shall have effect, in respect of the workers or the class or classes of workers to which the regulations apply, as if the qualifying period or periods defined in the said subsection (8) was or were varied in the manner stated in the regulations.
(11) If any person fails to comply with any of the provisions of this section relating to—
(a) the rights of a worker in his employment who works for such person on a public holiday, or
(b) the payment to a worker in his employment of any sum payable to the worker in accordance with the said provisions in addition to any wages due to him,
such person shall be guilty of an offence.
(12) Where—
(a) a payment is made to a worker under this section by his employer in respect of a public holiday, and
(b) the services of the worker are terminated before the public holiday,
the worker shall not, for the purposes of the provisions of the Social Welfare Act, 1952, which relate to unemployment benefit, be deemed to have been in the employment of such employer on such public holiday.
(13) In this section “a full day's pay” means the amount payable to a worker under his contract of service in respect of a normal full working day.
(14) For the purposes of this section a domestic worker shall be deemed to have worked in the employment of a particular person on any day on which he has been available for service at such person's request for a period of two or more hours.
PART III
Annual leave
Annual leave of non-domestic workers,
10.—(1) Every person who employs a non-domestic worker shall in every employment year of the worker during which he has been in the employment of such person, either continuously or on a day to day basis, and has worked in that employment for—
(a) a period of not less than sixteen hundred hours, or
(b) in the case of an industrial worker under eighteen years of age, or a worker under eighteen years of age who is employed in mining, a period of not less than fifteen hundred hours,
allow at such time as such person thinks fit to the worker fourteen consecutive whole holidays including two Sundays (in this Act referred to as annual leave).
(2) Where a non-domestic worker is allowed annual leave, the employer of the worker shall pay to the worker in respect of the annual leave a sum equivalent to twice the worker's normal weekly wage.
(3) Where—
(a) a non-domestic worker employed by a person ceases, at any time other than the end of an employment year of the worker, to be in the employment of such person,
(b) such person has not allowed the worker before the cesser annual leave in respect of the portion of the employment year during which he was so employed,
such person shall pay to the worker at the cesser a sum equivalent to one-sixth of his normal weekly wages in respect of each month in the said portion of the employment year during which he has worked
(c) in the case of an industrial worker under eighteen years of age, or a worker under eighteen years of age who is employed in mining, for not less than one hundred and twenty hours in that month, and
(d) in the case of any other worker, for not less than one hundred and thirty-five hours in that month.
(4) For the purposes of subsections (2) and (3) of this section the normal weekly wage of a worker shall be—
(a) in case the ordinary remuneration of the worker is wholly calculated by reference to time, a sum equivalent to the amount (exclusive of pay for overtime) which the worker received from the employer as salary or wagesin respect of the week next preceding the annual leave or cesser during which the worker worked the normal number of hours on the normal maximum number of days under his contract of service, and
(b) in any other case, a sum equivalent to the amount of his average weekly earnings (exclusive of pay for overtime) for the six months immediately preceding the annual leave or cesser if he has been so long employed by the employer but if not, then for any less period during which he has been employed by the employer.
(5) Each hour of intermittent unemployment of a worker in respect of which supplementary benefit is payable under section 28 of the Insurance (Intermittent Unemployment) Act, 1942, shall be deemed to be an hour worked for the purposes of this section up to a maximum of two hundred and fifty hours in any employment year of the worker.
(6) The Minister may by order whenever and so often as he so thinks proper, make regulations varying in respect of all or any particular class or classes (defined in such manner and by reference to such things as the Minister thinks proper) of non-domestic workers all or any of the periods of sixteen hundred hours, fifteen hundred hours, one hundred and twenty hours, or one hundred and thirty-five hours mentioned in subsections (1) and (3) of this section by substituting therefor either such other number of hours or such number of days as the Minister thinks proper, and whenever any such regulations are in force, those subsections shall have effect in respect of the non-domestic workers or the class or classes of non-domestic workers to which the regulations apply, as if those periods or such of them as are affected by the regulations were varied in the manner stated in the regulations.
(7) Where any non-working day or any two or more consecutive non-working days falls or fall immediately before or immediately after a day on which an employer has allowed a non-domestic worker a whole holiday, the non-working day or each of the consecutive non-working days (as the case may be) shall, if the worker does not work thereon for the employer, be deemed for the purposes of this section to be a day on which the employer has allowed the worker a whole holiday.
(8) No day which is a public holiday or a day on which a non-domestic worker is deemed, in pursuance of the immediately precedingsection of this Act, to have been allowed a whole holiday shall be reckoned as a day of annual leave, but if any such day intervenes between days of annual leave, those days shall be deemed to be consecutive notwithstanding the intervention.
(9) This section shall apply to the employment year current At the commencement of this Act of every person who is a non-domestic worker at such commencement, and this section shall have effect in respect of that employment year and that person as if this section had been in force at the beginning of that employment year, but subject to the modifications that—
(a) if that employment year expires within one month after the commencement of this Act, the employer of such person shall be deemed to have complied with this section if he allows to such person not later than three months after the expiration of that employment year, such annual leave as he may be entitled to under this section in respect of that employment year, and
(b) if such employer has before such commencement allowed to such person in that employment year one or more whole holidays which would be annual leave for the purposes of this section but for the fact that they were less than fourteen, or were not consecutive, or were both less than fourteen and not consecutive, the said whole holidays so allowed shall be deemed to be annual leave for the purposes of this section and such person shall only be entitled in respect of that employment year to such number (if any) of consecutive whole holidays after such commencement as is equal to the number (if any) of days by which the number of the said holidays so allowed is less than fourteen.
(10) Where a person who employs a non-domestic worker proposes to allow the worker annual leave in pursuance of this section—
(a) he shall, not later than fourteen days before the day on which the annual leave is to commence, give notice of his intention to allow the leave and of the day on which it will begin;
(b) if he fails to comply with paragraph (a) of this subsection, he shall be guilty of an offence.
(11) If the employer of a[html] non-domestic worker allows to the worker- in any employment year a period of annual leave earlier than the last fourteen days (being days which are reckonable as days of annual leave for the purposes of this section) of the employment year and the worker leaves the employment of the employer before the termination of the employment year, the employer shall not be entitled in respect of the allowance of annual leave to reduce the period of notice required for terminating the employment, nor the pay nor other emoluments to which the worker may be entitled at the time of leaving such employment.
Failure to allow annual leave to a non-domestic worker.
11.—If the employer of a non-domestic worker fails to allow annual leave to the worker in respect of an employment year of the worker in accordance with this Act, the following provisions shall have effect:
(a) the employer shall be guilty of an offence, and
(b) the employer shall (whether proceedings have or have not been taken under paragraph (a) of this section) pay to the worker a sum equivalent to the amount which under subsection (2) of section 10 of this Act he would have been liable to pay to the worker if he had in fact allowed the worker the annual leave and it had been allowed during the last fourteen days of the employment year.
Restriction on work during annual leave.
12.—(1) It shall not be lawful for a person who is an industrial worker or a member of the staff of a shop to do for reward for any person any industrial work or shop work during any period of annual leave.
(2) If a person who is an industrial worker or a member of the staff of a shop acts in contravention of this section he shall be guilty of an offence.
Annual leave of domestic workers.
13.—(1) Every person who employs a domestic worker shall, in every employment year of the worker during which he has been in the employment of such person either continuously or on a day to day basis and has worked in that employment for not less than three hundred days, allow at such time as such person thinks fit to the worker fourteen consecutive whole holidays including two Sundays (in this Act also referred to as annual leave).
(2) Where a person allows to a domestic worker in his employment seven consecutive whole holidays (in this Act referred to as semi-annual leave) in the first half of the employment year of the domestic worker and also allows to the worker semi-annual leave in the second half of that employment year, the provisions of subsection (1) of this section shall not apply as regards that worker in that employment year.
(3) Where a domestic worker is allowed annual leave or semiannual leave, the employer of the worker shall pay to the worker in respect of the annual leave or semi-annual leave a sum equivalent to the amount which the worker received from the employer as salary or wages in respect of—
(a) in case the worker is allowed annual leave, the two consecutive weeks next preceding the annual leave during which the worker worked the normal number of hours on the maximum number of days under his contract of service,
(b) in case the worker is allowed semi-annual leave, the week next preceding the semi-annual leave during which the worker worked the normal number of hours on the maximum number of days under his contract of service.
(4) Where—
(a) a domestic worker is employed by a person under a contract of service which includes lodgings,
(b) such person has given to the worker notice of intention to allow to the worker annual leave or semi-annual leave during a particular period, and
(c) the worker, with the consent of such person, remains at work with such person during that period,
such person shall, if, in addition to the wages for that period, he pays to the worker a sum equal to the amount of the wages, be deemed to have allowed to the worker a whole holiday on each of the days falling within that period.
(5) Where—
(a) a domestic worker ceases to be in the employment of a person during the currency of the first half of an employment year of the worker, and
(b) the worker has worked in the employment for not less than one hundred and fifty days in the first half, and
(c) the worker has not before the cesser been allowed during the first half either annual leave or semi-annual leave,
such person shall pay to the worker at the cesser a sum equivalent to the amount which, under subsection (3) of this section, he would have been liable to pay to the worker if he had in fact allowed the worker semi-annual leave during the first half and it had been allowed during the seven days preceding the cesser.
(6) Where a domestic worker ceases to be in the employment of a person during the currency of the second half of an employment year of the worker and the worker has not before the cesser been allowed either annual leave in respect of the employment year or semi-annual leave in respect of both the first half of the employment year and the second half, the following provisions shall have effect:
(a) if the worker has worked in the employment for not less than one hundred and fifty days in the first half and also for not less than one hundred and fifty days in the second half, such person shall on the cesser pay to the worker a sum equivalent to the amount which, under subsection (3) of this section, he would have been liable to pay to the worker if he had in fact allowed the worker the annual leave and it had been allowed during the fourteen days preceding the cesser;
(b) if—
(i) the worker has worked in the employment for not less than one hundred and fifty days in the first half, but for less than one hundred and fifty days in the second half, and
(ii) the worker has before the cesser not been allowed semi-annual leave during the first half,
such person shall pay to the worker on the cesser a sum equivalent to the amount which, under subsection (3) of this section, he would have been liable to pay to the worker if he had in fact allowed the worker semi-annual leave during the first half and it had been allowed during the last seven days of the first half;
(c) if—
(i) the worker has worked in the employment for less than one hundred and fifty days in the first half, but for not less than one hundred and fifty days in the second half, and
(ii) the worker has not been allowed before the cesser semi-annual leave during the first half or the second half,
such person shall pay to the worker on the cesser a sum equivalent to the amount which, under subsection (3) of this section, he would have been liable to pay to the worker if he had in fact allowed the worker semi-annual leave during the second half and it had been allowed during the last seven days of the second half.
(7) The Minister may, whenever and so often as he so thinks proper, make regulations varying in respect of all or any particular class or classes (defined in such manner and by reference to such things as the Minister thinks proper) of domestic workers all or any of the periods of three hundred days or one hundred and fifty days mentioned in subsections (1), (5) and (6) of this section by substituting therefor such other number of days as the Minister thinks proper, and whenever any such regulations are in force, those subsections shall have effect, in respect of the domestic workers or the class or classes of domestic workers to which the regulations apply, as if those periods or such of them as are affected by the regulations were varied in the manner stated in the regulations.
(8) Where any non-working day or any two or more consecutive non-working days falls or fall immediately before or after a day on which an employer has allowed a domestic worker a whole holiday, the non-working day or each of the consecutive non-working days (as the case may be) shall, if the worker does not work thereon for the employer, be deemed for the purposes of this section to be a day on which the employer has allowed the worker a whole holiday.
(9) No day which is a public holiday or a day on which a non-domestic worker is deemed, in pursuance of section 9 of this Act, to have been allowed a whole holiday shall be reckoned as a day of annual leave, but if any such day intervenes between days of annual leave, those days shall be deemed to be consecutive notwithstanding the intervention.
(10) This section shall apply to the employment year current at the commencement of this Act of every person who is a domestic worker at such commencement, and this section shall have effect in respect of that employment year and that person as if this section had been in force at the beginning of that employment year.
(11) Where a person who employs a domestic worker proposes to grant the worker any whole holidays in pursuance of this section-—
(a) he shall, not later than fourteen days before the day on which the whole holidays are to commence, give notice of his intention to grant the whole holidays and of the day on which they will begin;
(b) if he fails to comply with paragraph (a) of this subsection, he shall be guilty of an offence.
(12) For the purposes of this section a domestic worker shall be deemed to have worked in the employment of a particular person on any day on which he has been available for service at such person's request for a period of two or more hours.
Failure to allow annual leave to a domestic worker.
14.—If the employer of a domestic worker fails to allow annual leave to the worker in respect of an employment year of such worker in accordance with this Act, the following provisions shall have effect:
(a) the employer shall be guilty of an offence;
(b) the employer shall (whether proceedings have or have not been taken under paragraph (a) of this section) pay to the worker a sum equivalent to the amount which, under subsection (3) of section 13 of this Act he would have been liable to pay to the worker if he had in fact allowed the worker the annual leave and it had been allowed during the last fourteen days of the employment year.
Payment in lieu of board and lodgings during leave.
15.—(1) Where—
(a) a worker is allowed by his employer annual leave or semi-annual leave, and
(b) the worker was, immediately before such annual leave or semi-annual leave, entitled as part of his remuneration to accommodation,
the employer shall, in addition to any sum payable to the worker under this Act in respect of the annual leave or semi-annual leave, pay to the worker, in respect of any day falling within the annual leave or semi-annual leave during which he does not receive accommodation, in case the worker is employed in a county borough or the borough of Dun Laoghaire, the sum of three shillings or, in any other case, the sum of two shillings.
(2) The Minister may, whenever and so often as he thinks proper, make regulations varying the sum which an employer shall pay to a worker under subsection (1) of this section by substituting for the sum mentioned in that subsection in respect of that worker such other sum as the Minister thinks proper, and whenever any such regulations are in force, the provisions of the said subsection (1) shall have effect, in relation to the worker to whom the regulations apply, as if the sum mentioned therein in respect of that worker was varied as stated in the regulations.
(3) In this section “accommodation”means—
(a) in relation to a worker who is entitled to board only, board;
(b) in relation to a worker who is entitled to lodgings only, lodgings;
(c) in relation to a worker who is entitled to board and lodgings, board and lodgings.
Annual leave of non-domestic workers in one or more than one period of consecutive days.
16.—The Minister may, after consultation with such Ministers of State or employers' organisations and with such workers' organisations as he considers appropriate to be consulted, make regulations providing that all or any particular class or classes (defined in such manner and by reference to such things as the Minister thinks proper) of non-domestic workers may be allowed their annual leave in more than one period of consecutive days specified in the regulations, and the regulations may modify any of the provisions of this Act for the purposes of the regulations.
Reckoning of days off with pay as annual leave.
17.—(1) Where, immediately before the commencement of this Act, it was the practice of an employer to allow to any worker employed by him days off with pay in addition to public holidaysand annual leave, and that practice is continued after the commencement of this Act in respect of a worker whether so employed before and after, or after such commencement, such days off with pay may, for the purposes of this Act, be reckoned as days of annual leave in respect of not more than seven days of such annual leave.
(2) For the purposes of subsection (1) of this section an employer shall be deemed to have allowed a worker a day off with pay if he allows to the worker a whole holiday (otherwise than in respect of sick leave) for which he pays the worker a full day's pay as defined in subsection (13) of section 9 of this Act.
(3) The Minister may, after consultation with such Ministers of State or employers' organisations and with such workers' organisations as he considers appropriate to be consulted, make regulations providing that the practice mentioned in subsection (1) of this section may be applied either wholly or in part as between any employer and any worker (or any class or description of workers defined in such manner and by reference to such things as the Minister thinks proper) referred to in the regulations who consent to the application of such practice to the extent specified in the regulations, and upon the regulations being made and such consent being given, the provisions of subsection (1) of this section shall apply to them as they do to those referred to in the said subsection (1), but wholly or in part (as may be appropriate).
(4) The Minister may by regulations modify any of the provisions of this Act for the purpose of enabling the provisions of subsection (1) of this section or those provisions as applied by subsection (3) of this section to have effect.
PART IV
Miscellaneous
Recovery by workers of moneys due by employers.
18.—(1) If the employer of any worker fails to pay to the worker any moneys which become payable by the employer to the worker under any provision contained in this Act-—
(a) the employer shall be guilty of an offence;
(b) the worker may (whether proceedings have or have not been taken under paragraph (a) of this subsection) recover from the employer such moneys as a simple contract debt in a court of competent jurisdiction.
(2) If and whenever the employer of any worker is convicted of an offence under any section of this Act in relation to the worker, the court by which the employer is convicted may order him to pay to the worker any moneys which were due to him under any of the provisions of this Act by the employer at the time of the conviction.
Offences by bodies corporate.
19.—Where an offence under any section of this Act was committed by a body corporate and is proved to have been so committed with the consent or approval of, or to have been facilitated by any neglect on the part of, any director, manager, secretary or other officer of the body corporate, the director, manager, secretary or other officer shall also be deemed to have been guilty of the offence and shall be liable to be proceeded against and punished accordingly.
Prosecution of offences.
20.—(1) An offence under any section of this Act may be prosecuted by the Minister.
(2) An offence under any section of this Act committed by the employer of a worker may be prosecuted by the worker or by any official of a registered trade union of which the worker is a member.
(3) A prosecution for an offence under any section of this Act may be instituted within twelve months after the commission of the offence.
Emergency as defence.
21.—Where a person is charged with an offence under any section of this Act, it shall be a good defence to the charge if he proves to the satisfaction of the court before which the offence is tried that the alleged contravention of the section was rendered necessary or reasonably proper by the actual occurrence or the threat or reasonable anticipation of fire, flood, storm, violence, a breakdown of plant or machinery, or any other emergency.
Penalties for offences.
22.—Every person who is guilty of an offence under any section of this Act shall be liable on summary conviction thereof, in the case of a first offence under that section, to a fine not exceeding twenty-five pounds and, in the case of any subsequent offence under that section, to a fine not exceeding fifty pounds.
Laying of orders and regulations before Houses of the Oireachtas.
23.—Every order and regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution annulling the order or regulation is passed by either such House within the next subsequent twenty-one days on which that House has sat after the order or regulation is laid before it, the order or regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done under the order or regulation.
Powers of inspectors.
24.—(1) In this section “inspector” means a person appointed by the Minister to be an inspector for the purposes of this section.
(2) An inspector may for the purposes of enforcing the provisions of this Act do all or any of the following things:
(a) subject to the provisions of this section, enter at all reasonable times any premises or place where he has reasonable grounds for supposing that any worker is employed,
(b) make such examination or enquiry as may be necessary for ascertaining whether the provisions of this Act are complied with in respect of any worker employed in any such premises or place,
(c) require the employer of any worker or the representative of such employer to produce to him any records which such employer is required by a records order to keep and inspect and take copies of entries in such records,
(d) examine with regard to any matters under this Act any person whom he has reasonable cause to believe to be or to have been a worker or the employer of any worker and require such person to answer such questions (other than questions tending to incriminate such person) as the inspector may put touching such matters and to sign a declaration of the truth of the answers to such questions.
(3) The powers conferred on an inspector by paragraph (a) of subsection (1) of this section shall not be exercisable in respect of any private dwelling house unless the Minister or an officer of the Minister appointed by the Minister for the purpose certifiesthat he has reasonable grounds for believing that an offence under this section in relation to any worker employed in the house has been committed by the employer of the worker, and the inspector on applying for admission to the house produces the certificate.
(4) If any person—
(a) obstructs or impedes an inspector in the exercise of any of the powers conferred on the inspector by this section,
(b) refuses to produce any record which an inspector lawfully requires him to produce,
(c) produces, or causes to be produced or knowingly allows to be produced, to an inspector any record which is false in any material respect knowing it to be false,
(d) prevents, or attempts to prevent, any person from appearing before or being questioned by an inspector, or
(e) wilfully fails or refuses to comply with any lawful requirement of an inspector under paragraph (d) of subsection (1) of this section,
such person shall be guilty of an offence.
(5) Every inspector shall be furnished with a certificate of his appointment and, on applying for admission to any premises or place for the purposes of this Act, shall, if so required, produce the certificate to the occupier and to any person being examined by him.
Records.
25.—(1) The Minister may whenever and so often as he thinks fit by order (in this Act referred to as a records order) require records to be kept by employers of workers or any class of employers of workers of any matter or thing a record of which is in the opinion of the Minister necessary for the enforcement of this Act and, if he so thinks fit, prescribe the form of any such records.
(2) The Minister may under this section make different records orders in respect of different classes of employers of workers.
(3) The Minister may by order under this section amend or revoke any order made under this section or subsection.
(4) The Minister may, if he so thinks fit, by any order made under this section specify the place or places where the records required by the order shall be kept and make such provisions as to the production and inspection of the records as he may think fit.
(5) If whenever a records order is in force any employer fails, neglects or refuses to comply with the requirements of the order, or makes in any record which he is required by the order to keep any entry which is false in any material respect knowing it to be false, the employer shall be guilty of an offence.
