1.—(1) Féadfar an tAcht Leictreachais (Soláthar) (Leasú) (Uimh. 2), 1934, do ghairm den Acht so.
(2) Chun crícheanna có-luaidhte folóidh an abairt “na hAchtanna Leictreachais (Soláthar), 1927 go 1934” an tAcht so.
Mínithe agus léiriú.
2.—(1) San Acht so cialluíonn an abairt “an Príomh-Acht” an tAcht Leictreachais (Soláthar), 1927 (Uimh. 27 de 1927).
(2) Déanfar an Príomh-Acht agus an tAcht so do léigheamh agus do léiriú mar aon Acht amháin agus, dá réir sin, tá le habairtí agus le focail a húsáidtear san Acht so agus a húsáidtear freisin sa Phríomh-Acht, tá leo san Acht so na bríonna céanna atá leo fé seach sa Phríomh-Acht.
Costaisí an Aire.
3.—Sa mhéid go gceadóidh an tAire Airgid é is amach as airgead a sholáthróidh an tOireachtas a híocfar gach costas fé n-a, raghaidh an tAire chun an Achta so do chur i bhfeidhm.
CUID II.
Oibreacha Breise do Dheanamh.
Na hoibreacha sceidealta do dhéanamh
4.—(1) D'fhonn forbairt bhreise do dhéanamh ar luchtmhaireacht taiscthe uisce Loch Deirg-dheirc, Loch Ríbh, agus Loch Aillinne ar Abhainn na Sionainne, féadfaidh an Bord na hoibreacha (dá ngairmtear na hoibreacha sceidealta san Acht so) a tuairiscítear go generálta sa Chéad Sceideal a ghabhann leis an Acht so do ghabháil de láimh agus do dhéanamh agus d'oibriú, agus féadfaidh an Bord, chun críche na gabhála de láimh agus an déanta agus an oibrithe sin, na nithe sin uile do dhéanamh is gá no is ceart do réir réasúin chun na críche sin no ghabhann leis an gcéanna.
(2) Féadfaidh an Bord connradh do dhéanamh le duine ar bith chun na hoibreacha uile no aon oibreacha do dhéanamh go n-údaruítear don Bhord leis an alt so iad do ghabháil de láimh agus do dhéanamh, agus féadfaidh an Bord, chuige sin, connartha do dhéanamh.
(3) Pé uair a dhéanfaidh an Bord aon chonnradh fén alt so chun aon cheann de sna hoibreacha sceidealta do dhéanamh féadfaidh an Bord, leis an gconnradh san, ceart do bhronnadh ar an gconnarthóir chun pé cinn de sna hoibreacha sceidealta san do dhéanamh is dóich leis an mBord is cóir agus a luadhfaid sa chonnradh san, agus leis sin beidh ceart ag an gconnarthóir sin (i gcó-réim leis an mBord) chun gach ní no éinní luaidhtear amhlaidh do dhéanamh agus san chó hiomlán is dá mba leis an Acht so do bronnfaí an ceart san air, ach san sa mhéid gur gá é chun an chonnartha san d'fheidhmiú go cuibhe agus sa mhéid sin amháin.
Féadfaidh an Bord talamh, etc., do thógaint go héigeanta.
5.—(1) Chun gach ceann no aon cheann de sna hoibreacha sceidealta do dhéanamh (pe'ca dhéanfaidh an Bord féin na hoibreacha san no dhéanfaid tré chonnarthóir iad) féadfaidh an Bord gach ní no éinní acu so leanas do dhéanamh, sé sin le rá:—
(a) aon tailte no áitreabh do thógaint go héigeanta (pe'ca go buan no go sealadach é);
(b) aon éasáid, cead slí, ceart uisce, ceart iascaigh, no ceart eile ar aon tailte, áitreabh, no uisce, no maidir leis an gcéanna, do thógaint go héigeanta (pe'ca go buan no go sealadach é);
(c) aon éasáid, cead slí, ceart uisce, ceart iascaigh, no ceart eile atá ar bith ar aon tailte, áitreabh, no uisce, no maidir leis an gcéanna, do chríochnú no do shrianadh, no cur isteach do dhéanamh air in aon tslí eile, go héigeanta (pe'ca go buan no go sealadach é);
(d) aon bhóthar, slí no droichead, puiblí no príobháideach, no aon chanáil no bealach uisce saordha eile no aon chúrsa uisce saordha do chasadh, do dhúnadh no d'aistriú, no cur isteach do dhéanamh air in aon tslí eile, go héigeanta (pe'ca go buan no go sealadach é);
(e) cur isteach do dhéanamh go héigeanta ar aon tailte no áitreabh.
(2) Aon uair tar éis an Achta so do rith agus roimh leithliú do dhéanamh no an praghas no an cúiteamh d'fháil amach, ach fé réir fógra mí ar a laighead roimh ré no, i gcás tighe chomhnaithe ina gcomhnuítear, fógra trí mí ar a laighead roimh ré do thabhairt i scríbhinn do shealbhaire na dtailte no an áitreibh no d'únaer na héasáide no na maoine no an chirt eile le n-a mbaineann an scéal, féadfaidh an Bord (agus gach connarthóir go n-údarás chuige sin ón mBord) dul isteach agus seilbh do thógaint ar aon tailte no áitreabh no aon cheart d'fheidhmiú a húdaruítear don Bhord, leis an alt so, a thógaint go héigeanta, no, aon éasáid no maoin no ceart eile go n-údaruítear don Bhord leis an alt so é chríochnú no é shrianadh no cur isteach do dhéanamh air go héigeanta, féadfaid é chríochnú no é shrianadh no cur isteach do dhéanamh air in aon tslí eile, no, aon bhóthar, slí, droichead, bealach uisce, no cúrsa uisce go n-údaruítear don Bhord leis an alt so é chasadh, é dhúnadh, é aistriú, no cur isteach do dhéanamh air go héigeanta, féadfaid é chasadh, é dhúnadh, é aistriú, no cur isteach do dhéanamh air in aon tslí eile.
(3) Pé uair is dóich leis an mBord ná béadh sé economiciúil no go mbeadh sé neamh-oiriúnach toisc aon chúise eile cúiteamh d'íoc as tailte no áitreabh ar bith do chur fé uisce no as cur isteach do dhéanamh ortha ar shlí eile fén alt so, féadfaidh an Bord na tailte no an t-áitreabh san do thógaint go buan fén alt so agus san go héigeanta no tré chó-aontú.
Praghas no cúiteamh d'fháil amach.
6.—(1) Mara gcó-aontuítear ina thaobh, is fén Acquisition of Land (Assessment of Compensation) Act 1919, agus dá réir a socrófar méid an phraghais no an chúitimh a bheidh le n'íoc ag an mBord, as tailte agus as áitreabh a thógfaid go héigeanta (pe'ca go buan no go sealadach é) fén Acht so, leis na daoine uile agus fé seach go bhfuil teideal acu chúcha no go bhfuil estáit no leasanna acu ionta, no, as éasáidí ceadanna slí, ceartanna uisce, ceartanna iascaigh agus ceartanna eile a thógfaid go héigeanta (pe'ca go buan no go sealadach é), no ar a scór san, le húnaer an chéanna, no leis na daoine uile agus fé seach go bhfuil teideal acu chun na dtailte agus an áitreibh, no go bhfuil estáit no leasanna acu sna tailte agus san áitreabh, gur ortha no maidir leo tógfar na ceartanna san amhlaidh.
(2) Mara gcó-aontuítear ina thaobh, is fén Acquisition of Land (Assessment of Compensation) Act, 1919, agus dá réir, agus fé is dá mba phraghas tailimh a tógfaí go héigeanta é, a socrófar méid an chúitimh a bheidh le n'íoc ag an mBord mar gheall ar aon éasáid, ceart uisce, ceart iascaigh, no ceart eile atá ar bith ar aon tailte, áitreabh, no uisce, no maidir leis an gcéanna, do chríochnú no do shrianadh, no mar gheall ar chur isteach do dhéanamh air i slí eile, go héigeanta (pe'ca go buan no go sealadach é) fén Acht so, no mar gheall ar aon bhóthar, slí no droichead príobháideach, no aon chanáil no bealach uisce saordha eile, no aon chúrsa uisce saordha eile, do chasadh, do dhúnadh, no d'aistriú, no cur isteach do dhéanamh air i slí eile go héigeanta (pe'ca go buan no go sealadach é) fén Acht so, no mar gheall ar chur isteach do dhéanamh go héigeanta fén Acht so ar thailte no ar áitreabh ar bith.
(3) Nuair a bheidh aon phraghas no cúiteamh á mheas do réir an ailt seo maidir le haon mhaoin, corpardha no nea-chorpardha, go bhfuiltear á sealbhú no ag baint úsáide no tairbhe aisti in éineacht le haon mhaoin eile, no atá ina cuid d'aon mhaoin eile, bhéarfar aire d'aon tsochar i bhfuirm dréineála no feabhsú ar sholáthar uisce nách miste do réir réasúin súil a bheith le n-a theacht don mhaoin sin de bharr aon oibreacha bheidh déanta ag an mBord no bheidh á déanamh acu no bheid ar tí a dhéanamh fén Acht so.
(4) Gach éileamh ar an bpraghas no ar chúiteamh a bheidh á iarraidh maidir le haon talamh, áitreabh, no ceart a bheidh tógtha go héigeanta, no maidir le haon tailte, áitreabh, ceart, slí, no maoin eile go mbeidh curtha isteach air go héigeanta fén Acht so, déanfar é laistigh de bhliain tar éis don Bhord no do chonnarthóir dul isteach no feidhmiú no cur isteach do dhéanamh, ar na tailte, ar an áitreabh, ar an gceart, ar an slí, no ar an maoin sin mar an gcéad uair fén Acht so, ach amháin go bhféadfar, i gcás curisteach buan ar cheart iascaigh, an t-éileamh do dhéanamh aon uair laistigh de dheich mbliana tar éis críochnú na n-oibreacha le n-a gcuirtear isteach ar an gceart iascaigh amhlaidh.
(5) Bainfidh ailt 69 go 83 den Lands Clauses Consolidation Act, 1845, le haon phraghas no cúiteamh is iníoctha ag an mBord fén alt so agus leis an leithliú chun an Bhúird a déanfar ar mhaoin, corpardha no nea-chorpardha, a thógfaid go héigeanta fén Acht so, agus chun na críche sin tuigfear gurb é an Bord bunathóir an ghnótha.
(6) Ní luighfidh aon aicsean, do réir dlí ná cothruim, i gcoinnibh an Bhúird ná aon chonnarthóra ná i gcoinnibh aon oifigigh ná seirbhísigh don Bhord no d'aon chonnarthóir alos ná i dtaobh aon ghnímh, ní, ná ruda go mbeidh cúiteamh iníoctha mar gheall air de bhuadh an ailt seo.
Oibreacha do dhéanamh in ionad cúitimh.
7.—(1) I gcás duine do bheith i dteideal cúitimh, láithreach no ar ball, maidir le héinní dhéanfaidh an Bord no bheid ar intinn a dhéanamh go dleathach fén Acht so, féadfaidh an Bord pé oibreacha do dhéanamh ar mhaithe leis an duine sin is dóich leis an mBord is ceart agus aontóidh an duine sin a ghlacadh mar shásamh no mar shásamh leathrannach ina éileamh ar an gcúiteamh san.
(2) Féadfaidh an Bord téarmaí agus coinníollacha do chur ag gabháil le hoibreacha do dhéanamh fén alt so, pé téarmaí agus coinníollacha (ar a n-áirmhítear téarmaí maidir le húnaereacht, le seilbh, agus le cúram na n-oibreacha san) ar a gcó-aontóidh an Bord agus an duine gur ar mhaithe leis a déanfar na hoibreacha amhlaidh.
(3) Féadfaidh an tAire Rialtais Áitiúla agus Sláinte Puiblí, tar éis do dul i gcomhairle leis an mBord, a dhearbhú aon oibreacha áirithe déanfar fén alt so do bheith saor, go buan no go ceann tréimhse teoranta, o ráta dealbhais do chur ortha agus fós o aon ráta eile do chur ortha ghearrfaidh údarás áitiúil, agus pé uair a déanfar ordú ar bith den tsórt san beidh na hoibreacha le n-a mbainfidh an t-ordú san saor o rátaí do réir an orduithe sin.
Pleananna, etc., do lóisteáil.
8.—(1) Chó luath agus is féidir é tar éis an Achta so do rith agus ar dháta nách déanaí ná mí roimh thosnú ar aon chuid áirithe de sna hoibreacha sceidealta, no roimh dhul isteach ar aon tailte no áitreabh no roimh fheidhmiú aon chirt no roimh chur isteach ar aon mhaoin, corpardha no nea-chorpardha, fén Acht so chun na críche sin, cuirfidh an Bord fé ndeár mapaí, pleananna, agus leabhra eolais i dtaobh na n-oibreacha san do lóisteáil mar a luaidhtear anso ina dhiaidh seo.
(2) Na mapaí agus na pleananna lóisteálfar fén alt so, ní foláir dóibh bheith líonmhar a ndóthain agus de shaghas is leor chun méid na n-oibreacha sceidealta le n-a mbainfid do thaisbeáint ar scálaí is leor, maraon le gach claonadh agus atharú bheidh beartuithe, agus fós gach maoin, corpardha agus (san áit ina mbeidh san oiriúnach) nea-chorpardha, a bheidh beartuithe a thógaint go héigeanta chun críche na n-oibreacha san agus fós gach cur-isteach (sa mhéid gur féidir a thaisbeáint ar tharraiceoireacht) a bheidh beartuithe a dhéanamh go héigeanta chun na críche sin ar aon mhaoin, corpardha no nea-chorpardha, no ar aon bhóthar no droichead.
(3) Beidh sna leabhra eolais a lóisteálfar fén alt so ainmneacha na ndaoine is únaerí no is únaerí tuairimithe, na ndaoine is léasaithe no is léasaithe tuairimithe, agus na ndaoine is sealbhairí ar gach talamh agus áitreabh go mbeidh beartuithe iad do thógaint no baint leo ar shlí eile go héigeanta fén Acht so chun críche na n-oibreacha sceidealta go lóisteálfar na leabhra eolais sin ina dtaobh agus ar gach maoin, corpardha no nea-chorpardha (maraon le bóithre agus droichid), go mbeidh beartuithe cur isteach ortha in aon tslí go héigeanta fén Acht so chun críche na n-oibreacha san.
(4) Na mapaí, na pleananna agus na leabhra eolais a lóisteálfar fén alt so is i bpríomh-oifig an Bhúird i gCathair Bhaile Atha Cliath a lóisteálfar iad agus fós, i gcás mapaí, pleananna, agus leabhra eolais a bhainfidh le haon cheann de sna hoibreacha sceidealta no le maoin ar bith laisteas den droichead atá ar Abha na Sionainne ag an gceann thuaidh de Loch Deirg-dheirc agus dá ngairmtear Droichead Phort Omna, is in oifig an Bhúird no in áit chaothúil eile i gCathair Luimnigh a lóisteálfar iad, agus i gcás mapaí pleananna, agus leabhra eolais a bhainfidh le haon cheann de sna hoibreacha sceidealta no le maoin ar bith lastuaidh den droichead san, is in áit chaothúil i mbaile Phort Omna a lóisteálfar iad, no i pé áit no áiteanna eile cheapfaidh an Bord le haontú an Aire, agus fanfaidh na mapaí, na pleananna agus na leabhra eolais sin uile ar lóisteáil amhlaidh go dtí go gcríochnófar na hoibreacha sceidealta le n-a mbainfid, agus faid a bheid ar lóisteáil amhlaidh beid ar nochtadh chun a n-iniúchta ag éinne in aisce in áit na lóisteála idir a deich a chlog ar maidin agus a ceathair a chlog um thráthnóna gach lae ach Sathairn, Domhntaí agus laetheanta saoire bainc.
(5) Chó luath agus is féidir é tar éis aon mhapaí, pleananna, no leabhra eolais do bheith lóisteálta in aon chathair no baile do réir an ailt seo, bhéarfaidh an Bord fógra puiblí i dtaobh na lóisteála san le fógrán a foillseofar fé dhó i ngach ceann de dhá pháipéar nuachta no níos mó a léightear sa chathair no sa bhaile sin, agus déarfaid i ngach fógra den tsórt san go bhfuil na mapaí, na pleananna, agus na leabhra eolais sin ar nochtadh chun a n-iniúchta ag an bpuiblíocht do réir an ailt seo.
Seirbhísí puist agus telegrafa do chaomhaint.
9.—Ní dhéanfidh an Bord ná aon chonnarthóir a bheidh ag déanamh oibreacha fén Acht so, ní dhéanfaid, de bhuadh an Achta so, aon tailte, áitreabh, foirgintí, oibreacha, gléasra, abhair, ná maoin eile leis an Aire Puist agus Telegrafa do thógaint ná d'aistriú, ná dul isteach ortha ná cur isteach ortha ar aon tslí eile ná aon oibreacha do chur suas, ná éinní ná aon rud eile do dhéanamh is dóich leis an Aire Puist agus Telegrafa do bhacfadh, do mhoilleodh, do choiscfeadh no do dhíobhálfadh ar aon tslí eile cólíonadh cuibhe seirbhísí puiblí na Roinne Puist agus Telegrafa.
Beidh na hoibreacha sceidealta saor o rátaí.
10.—(1) Faid a bheidh na hoibreacha sceidealta in aon-tseilbh agus fé aon-stiúradh an Bhúird, beid saor o ráta dealbhais agus fós o aon ráta eile ghearrfaidh údarás áitiúil do chur ortha.
(2) San alt so foluíonn an abairt “údarás áitiúil” (i dteanta an bhrí chuireann an Príomh-Acht léi) aon chólucht daoine go gcomhacht acu fé Acht de Pháirlimint na hÉireann no fé aon Acht áitiúil no pearsanta de Pháirlimint na Ríochta Aontuithe no aon Acht Príobháideach den Oireachtas ráta do chur agus do ghearradh ar thalamh no ar dhaoine alos a mbeith i seilbh thailimh.
Bóithre agus droichid phuiblí do chaomhaint.
11.—Más gá agus nuair is gá, de dhruim aon cheann de sna hoibreacha sceidealta do dhéanamh fén Acht so, aon bhóthar no droichead puiblí do chasadh no d'aistriú no cur isteach air ar shlí eile beidh éifeacht ag na forálacha so leanas, sé sin le rá:—
(a) i gcás gur gá an bóthar no an droichead do dhúnadh in aghaidh tráchta de dhruim na hoibreacha sceidealta do dhéanamh, déanfaidh an Bord, sa tsuidheamh chéanna no i suidheamh éigin eile caothúil, agus coinneoid i dtreo, faid a bheidh an bóthar no an droichead san dúnta amhlaidh in aghaidh tráchta, bóthar no droichead sealadach is leor chun an méid agus an saghas céanna tráchta d'iompar a théigheann ar an mbóthar no ar an droichead san do ghnáth;
(b) ar chríochnú na n-oibreacha sceidealta no roimhe sin cuirfidh an Bord an bóthar no an droichead sa riocht ina raibh sé no, tar éis dul i gcomhairle leis an Aire Rialtais Áitiúla agus Sláinte Puiblí, déanfaid, sa tsuidheamh chéanna no i suidheamh éigin eile caothúil, buan-bhóthar no buan-droichead nua is leor chun an tráchta chéanna (chó fada le méid agus saghas) d'iompar d'fhéadadh an seana-bhóthar no an seana-dhroichead d'iompar, agus gan é puinn níos neamh-oiriúnaí fána agus lúb ná an seana-bhóthar no an seana-dhroichead san;
(c) má dheineann an Bord buan-droichead nua agus gur mó de chuid mhaith na buntáistí bheireann an droichead san do phuiblíocht aon chontae no bailecheanntair ná an seana-dhroichead, tré shlí chonbharsáide níos fearr do thabhairt dóibh no ar aon tslí eile, deimhneoidh an Bord costas an droichid nua san agus deimhneoidh an tAire Rialtais Áitiúla agus Sláinte Puiblí cadé an chuid den chostas san is dóich leis ba chóir, do réir réasúin, do bheith ar chomhairle na contae no an bhailecheanntair sin, agus leis sin déanfaidh an chomhairle sin suim is có-ionann leis an gcuid do deimhníodh amhlaidh den chostas san do chruinniú mar chuid de chostaisí bóithre contae no bailecheanntair (pe'ca aca é) do choinneáil i dtreo, agus íocfaidh an chomhairle sin leis an mBord í;
(d) má eiríonn aon amhrus, aighneas no ceist i dtaobh ce'ca do chólíon no nár chólíon an Bord forálacha an ailt seo agus aon bhóthar no droichead, sealadach no buan, á dhéanamh no á choinneáil i dtreo no á chur ina sheanariocht acu do réir an ailt seo, no i dtaobh ce'ca is mó no nách mó de chuid mhaith na buntáistí atá ag puiblíocht aon chontae no bailecheanntair o bhuandroichead nua do rinne an Bord ná ón seanadhroichead, isé an tAire Rialtais Áitiúla agus Sláinte Puiblí do bhéarfaidh breith ar an amhrus no ar an aighneas no ar an gceist sin agus ní bheidh dul thar an mbreith sin.
Roimh-íocanna ón bPrímh-Chiste leis an mBord.
12.—(1) Féadfaidh an tAire Airgid, fé réir na dteorann a forchuirtear leis an alt so, roimh-íoc do dhéanamh amach as an bPrímh-Chiste no as a thoradh fáis leis an mBord fé mar iarrfaidh agus nuair iarrfaidh an Bord air é sna suimeanna san uile (nách mó san iomlán ná an méid a luaidhtear anso ina dhiadh seo) a dheimhneoidh an tAire Tionnscail agus Tráchtála o am go ham do bheith ag teastáil do réir réasúin agus cirt ón mBord chun críche ar bith eireoidh fén gCuid seo den Acht so.
(2) Ní raghaidh méid iomlán na roimh-íocanna bheidh le n'íoc leis an mBord fén alt so amach as an bPrímh-Chiste no as a thoradh fáis thar suim chúig céad agus triocha míle púnt.
(3) Chun soláthar do dhéanamh chun suimeanna do roimh-íoc amach as an bPrímh-Chiste fén alt so, no chun na suimeanna uile roimh-íocfar amhlaidh no aon chuid díobh d'aisíoc isteach sa Chiste sin, no chun aon urrúsanna do bhéarfar amach fén alt so d'íoc sa mhéid ná beidh aon tsoláthar eile déanta chun a n-íoctha, féadfaidh an tAire Airgid airgead d'fháil ar iasacht tré pé urrúsanna do thabhairt amach is dóich leis is ceart, agus íocfar isteach sa Stát-Chiste gach suim do gheobhfar ar iasacht amhlaidh.
(4) Is ar an bPrímh-Chiste no ar a thoradh fáis a bheidh muirear agus íoc cholann agus ús gach urrúis do bhéarfar amach fén alt so.
(5) Is chun críche na n-oibreacha sceidealta no chun éinní do dhéanamh a húdaruítear don Bhord leis an gCuid seo den Acht so do dhéanamh, agus chuige sin amháin, a chaithfidh an Bord na suimeanna roimh-íocfar fén alt so.
Us d'íoc ar roimh-íocanna as an bPrímh-Chiste.
13.—(1) Íocfaidh an Bord leis an Aire Airgid, ar gach suim a roimh-íocfar leis an mBord amach as an bPrímh-Chiste fén Acht so, ús o dháta roimh-íoctha na suime sin go dtí n-a haisíoc do réir pé ráta cheapfaidh an tAire Airgid agus íocfar an t-ús san amhlaidh tré íocaíochtaí leath-bhliantúla có-ionanna ar pé laetheanta i ngach bliain a cheapfaidh an tAire Airgid o am go ham.
(2) Má theipeann ar an mBord aon ús áirithe is iníoctha acu fén alt so d'íoc leis an Aire Airgid an t-am a bheidh ceaptha chuige sin fén alt so, íocfaidh an Bord leis an Aire sin ús do réir an ráta bheidh ceaptha ag an Aire sin, ar an ús a bheidh gan íoc amhlaidh, ón am a bheidh ceaptha mar adubhradh go dtí go ndéanfar an céanna d'íoc.
(3) An t-ús uile íocfaidh an Bord leis an Aire Airgid fén alt so íocfar isteach sa Stát-Chiste é ar pé slí ordóidh an tAire sin o am go ham.

Roimh-íocanna as an bPrímh-Chiste d'aisíoc.
14.—(1) Chun soláthar do dhéanamh chun an Bord d'aisíoc na roimh-íoc a híocfar leo amach as an bPrímh-Chiste fén Acht so, íocfaidh an Bord leis an Aire Airgid íocaíochtaí leath-bhliantúla ag tosnú ar pé dáta cheapfaidh an tAire sin tar éis do dul i gcomhairle leis an Aire agus ag leanúint ar feadh pé méid blian agus iad de pé suimeanna agus iníoctha pé tráthanna cheapfaidh an tAire sin tar éis do dul i gcomhairle mar adubhradh, agus féadfar dátaí deifriúla, méideanna deifriúla de bhlianta, suimeanna deifriúla, agus tráthanna deifriúla do cheapadh amhlaidh in aghaidh codacha deifriúla de sna roimh-íocanna san.
(2) Na híocaíochtaí leath-bhliantúla uile agus fé seach íocfaidh an Bord leis an Aire Airgid fén alt so déanfaidh an tAire sin iad do chur mar chistí fiach-laigheaduithe chun aisíoctha na gcodanna uile agus fé seach de sna roimh-íocanna 'na ndéanfar na híocaíochtaí leath-bhliantúla san ina n-aghaidh agus nuair a bheidh lán-líon na n-íocaíocht leath-bhliantúil a ceapfar fén alt so in aghaidh aon chuid de sna roimh-íocanna san (maraon le haon ús a thiocfaidh chun bheith iníoctha fén alt so ar aon cheann de sna híocaíochtaí leath-bhliantúla san) íoctha ag an mBord leis an Aire sin, tuigfear an chuid sin de sna roimh-íocanna san do bheith aisíoctha go hiomlán ag an mBord gan dochar d'fhiachas an Bhúird i leith aon úis a bheidh gan íce ansan ar an gcuid sin de sna roimh-íocanna san.
(3) Má theipeann ar an mBord aon íocaíocht leath-bhliantúil no cuid d'íocaíocht leath-bhliantúil is iníoctha acu leis an Aire Airgid fén alt so d'íoc leis an Aire sin an t-am a bheidh ceaptha chuige sin fén alt so, íocfaidh an Bord leis an Aire sin ús do réir an ráta bheidh ceaptha ag an Aire sin, ar an íocaíocht leathbhliantúil sin no ar an gcuid sin d'íocaíocht leath-bhliantúil, ón am a bheidh ceaptha mar adubhradh go dtí go ndéanfar an céanna d'íoc.
(4) Féadfaidh an tAire Airgid o am go ham atharú do dhéanamh ar an ráta gur dá réir a híocfar ús is iníoctha fén bhfo-alt deiridh sin roimhe seo den alt so.
(5) An t-airgead uile íocfaidh an Bord leis an Aire Airgid fén alt so déanfar é d'íoc isteach sa Stát-Chiste no do chur chun tairbhe don Stát-Chiste i pé slí ordóidh an tAire sin o am go ham.

15.—(1) Gach suim a roimh-íocfar leis an mBord amach as an bPrímh-Chiste fén Acht so agus an t-ús uile agus gach íocaíocht leath-bhliantúil is iníochta ag an mBord fén Acht so ar an suim sin no ina haghaidh agus an t-ús uile is iníoctha ag an mBord fén Acht so ar aon ús no ar aon íocaíocht leath-bhliantúil den tsórt san, tiocfaid chun bheith agus beid—
(a) ina gcéad-mhuirear ar na hoibreacha sceidealta, agus
(b) ina muirear ar oibreacha na Sionainne ná beidh tosach air ach ag na muirir ar na hoibreacha san do cruthnuíodh le halt 16 den Phríomh-Acht, agus
(c) ina muirear so-ghluaiste (ná beidh tosach air ach ag na muirir sho-ghluaiste do cruthnuíodh le halt 16 den Phríomh-Acht) ar gach maoin, de shaghas ar bith (ach amháin oibreacha na Sionainne no na hoibreacha sceidealta) a bheidh dílsithe sa Bhord no ar únaeracht acu o am go ham, ach an muirear so-ghluaiste cruthnuítear leis seo ní oibreoidh chun cosc no srian do chur leis an mBord d'aistriú aon choda den mhaoin sin uatha no do dheighleáil léi ar shlí eile i bhfeidhmiú ceart cuibhe na gcomhacht no i gcólíonadh ceart cuibhe na ndualgaisí bronntar no cuirtear ar an mBord le dlí no bronnfar no cuirfear ar an mBord ina dhiaidh seo.
(2) Na muirir a cruthnuítear leis an alt so beid dílsithe san Aire Airgid agus féadfaidh an tAire sin iad do chur i bhfeidhm do réir fuirme cuibhe na dlí pé uair is dóich leis is ceart san do dhéanamh agus pe'ca bheidh aon ús no íocaíocht leath-bhliantúil a bheidh urruithe le muirear den tsórt san dlite agus gan íoc no ná beidh agus an t-airgead uile bainfear amach de bhuadh aon mhuirir den tsórt san íocfar isteach sa Stát-Chiste é ar pé slí ordóidh an tAire sin.
Deontaisí ón Aire Airgid.
16.—(1) Féadfaidh an tAire Airgid, fé mar iarrfaidh agus nuair iarrfaidh an Bord san air, deontaisí do dheonadh don Bhord, as airgead a sholáthróidh an tOireachtas, de pé suimeanna (nách mó san iomlán ná an méid iomlán a luaidhtear anso ina dhiaidh seo) a dheimhneoidh an tAire Tionnscail agus Tráchtála o am go ham do bheith ag teastáil do réir réasúin agus cirt ón mBord chun aon chríche áirithe chun ar féidir na deontaisí sin do chur fén alt so.
(2) Ní raghaidh méid iomlán na ndeontas a féadfar do dheonadh don Bhord fén alt so thar suim thrí mhíle nóchad púnt.
(3) Gach deontas a dheonfaidh an tAire Airgid fén alt so cuirfidh an Bord é chun pé crícheanna acu so leanas a bheidh luaidhte sa deimhniú san ón Aire Tionnscail agus Tráchtála bhainfidh leis an gcás, sé sin le rá, chun na n-oibreacha sceidealta do dhéanamh no chun éinní eile do dhéanamh a húdaruítear don Bhord leis an gCuid seo den Acht so do dhéanamh.

(3) Pé uair a raghaidh an Bord isteach agus a thogfaid seilbh ar aon tailte no fheidhmeoid aon cheart (pe'ca aca é fén alt so roimh an bpraghas no an cúiteamh d'íoc, íocfaidh an Bord le sealbhaire na dtailte no le húnaer na héasáide no an chirt eile (pe'ca aca é) a bheidh i gceist ús ar mhéid an phraghais no an chúitimh sin, ar bheith ceaptha dho, do réir cheithre púint per cent. per annum ón dáta ar a raghaid isteach no ar a dtógfaid seilbh amhlaidh no ar a bhfeidhmeoid an ceart san (pe'ca aca é) go dtí dáta an leithlithe ón sealbhaire no ón únaer san don Bhord.
An Chéad Sceideal a ghabhann leis an bPríomh-Acht do leasú.
18.—(1) Deintear leis seo mír 8 den Chéad Sceideal a ghabhann leis an bPríomh-Acht do leasú tré sna focail “no i gceachtar de sna fórsaí bhí i gcoinnibh a chéile le linn an imreasáin chathardha sna blianta 1922, 1923, 1924, no i gcoinneáil no i bpríosún de dheascaibh na seirbhíse sin” do chur isteach i ndiaidh na bhfocal “Aer-Fhórsa Bhriotáinigh,” agus léireofar alt 61 den Acht san agus an Chéad Sceideal san agus beidh éifeacht acu dá réir sin.
(2) Beidh an t-alt so mar bheadh éifeacht aige agus tuigfear éifeacht do bheith aige o thosach feidhme an Phríomh-Achta.

19.—(1) Pé uair is deimhin leis an Aire, ar iarratas d'fháil ón mBord, go dtiocfadh as foirgintí no cineál áirithe no cineálacha áirithe foirgintí do thógáil fé aon tsreanganna tiomarnaíochta no i ngiorracht faide áirithe dhóibh go mbeadh contabhairt ann go ndéanfaí díobháil don phuiblíocht no do sna foirgintí sin no do shealbhairí na bhfoirgintí sin agus go mbainfeadh costas míréasúnta no roinnt mhaith duaidh theicniúla leis na sreanganna tiomarnaíochta san d'aistriú go dtí ionad eile, féadfaidh an tAire, más oiriúnach leis é, le hordú (dá ngairmtear ordú toirmeasctha tógála san Acht so), a ordú gan aon fhoirgint in aon chor no gan aon fhoirgint de chineál no de chineálacha áirithe do thógáil fé sna sreanganna tiomarnaíochta san no i ngiorracht faide áirithe dhóibh.
(2) Féadfaidh an tAire aon uair, más oiriúnach leis é, leasú no ceiliúradh do dhéanamh, le hordú, ar ordú toirmeasctha tógála ar iarratas an Bhúird no ar iarratas duine ar bith go ndeineann an t-ordú toirmeasctha tógála san deifir dá chuid tailimh.
(3) Pé uair a bheidh an tAire ar aigne ordú toirmeasctha tógála do dhéanamh no ordú do dhéanamh ag leasú no ag ceiliúradh ordú toirmeasctha tógála foillseoidh an tAire, i pé slí is dóich leis is oiriúnaí sa chás, fógra i dtaobh é bheith chun breithnithe do dhéanamh féachaint an ceart an t-ordú san do dhéanamh agus i dtaobh an ama agus na slí ina bhféadfar agóidí i gcoinnibh an orduithe sin agus aithris chúise ina thaobh do chur chuige.
(4) Pé uair a bheidh an tAire ar aigne ordú toirmeasctha tógála do dhéanamh no ordú do dhéanamh ag leasú no ag ceiliúradh ordú toirmeasctha tógála féadfaidh an tAire, más oriúnach leis é, a chur fé ndeár fiosrúchán puiblí do dhéanamh i dtaobh an orduithe sin do dhéanamh.
(5) Ní oibreoidh aon ordú toirmeasctha tógála chun é do dhéanamh nea-dhleathach aon fhoirgint do chríochnú gur tosnuíodh ar í do thógáil roimh dháta déanta an orduithe sin, agus aon ordú le n-a leasófar ordú toirmeasctha tógála ní oibreoidh chun é do dhéanamh nea-dhleathach aon fhoirgint do chríochnú gur tosnuíodh go dleathach ar í do thógáil roimh dháta déanta an orduithe leasúcháin sin.
(6) Má eiríonn aon amhrus, ceist no aighneas i dtaobh ce'ca tosnuíodh no nár tosnuíodh, do réir bhrí an fho-ailt deiridh sin roimhe seo den alt so, ar fhoirgint do thógáil roimh dháta déanta aon orduithe áirithe fén alt so, isé an tAire bhéarfaidh breith ar an amhrus no ar an gceist no ar an aighneas san agus beidh an bhreith sin ina breith dheiridh gan aon dul tháirsí.
(7) Gach duine thógfaidh foirgint ar bith contrárdha d'ordú toirmeasctha tógála, no thosnóidh ar san do dhéanamh no thabharfaidh fé, beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear fíneáil ná raghaidh thar céad púnt do chur air maraon le fíneáil bhreise ná raghaidh thar deich bpúint in aghaidh gach lae fhanfaidh an fhoirgint sin no aon chuid di tógtha amhlaidh.
(8) Na forálacha atá sa Dara Sceideal a ghabhann leis an Acht so beidh éifeacht acu maidir le gach fiosrúchán puiblí chuirfidh an tAire fé ndeár a dhéanamh do réir an ailt seo.
(9) Gach ordú toirmeasctha tógála, agus gach ordú fén alt so le n-a leasófar no le n-a gceiliúrfar ordú toirmeasctha tógála, foillseofar é san Iris Oifigiúil chó luath agus bheidh caoi ann chuige sin tar éis a dhéanta.
(10) San alt so cialluíonn an abairt “sreanganna tiomarnaíochta” sreanganna no línte iompruíonn leictreachas os cionn tailimh agus is cuid den chórus tiomarnaíochta no den chórus roinneacháin.

20.—(1) Ní thógfaidh ná ní dhéanfaidh duine ar bith aon fhoirgint ná déanmhas 'na raghaidh aon chuid de laistigh de ghar-achar aon tsreinge tiomarnaíochta no os a chionn, no 'na mbeidh aon chuid de amhlaidh ar bheith críochnuithe dho, ná ní thosnóidh ar san do thógáil ná do dhéanamh mara mbeidh fógra i scríbhinn tugtha aige don Bhord dhá mhí ar a laighead roimh thosnú dho ar an tógáil no ar an déanamh san á rá é bheith chun an fhoirgint no an déanmhas san do thógáil no do dhéanamh agus ag tabhairt gach eolais oiriúnaigh i dtaobh na foirginte no an déanmhais sin.

(2) Beidh éifeacht ag na forálacha so leanas chun crícheanna an fho-ailt sin roimhe seo den alt so, sé sin le rá:—

PART I.
Preliminary and General.
Short title and citation.
1.—(1) This Act may be cited as the Electricity (Supply) (Amendment) (No. 2) Act, 1934.
(2) For the purposes of collective citation the expression “the Electricity (Supply) Acts, 1927 to 1934” shall include this Act.
Definitions and construction.
2.—(1) In this Act the expression “the Principal Act” means the Electricity (Supply) Act, 1927 (No. 27 of 1927).
(2) The Principal Act and this Act shall be read and construed as one Act, and accordingly expressions and words used in this Act which are also used in the Principal Act have the same meanings in this Act as they respectively have in the Principal Act.
Expenses of the Minister.
3.—All expenses incurred by the Minister in the execution of this Act shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

4.—(1) For the purpose of further developing the waterstorage capacity of Lough Derg, Lough Ree, and Lough Allen on the River Shannon, the Board may undertake, execute and operate the works (in this Act referred to as the scheduled works) generally described in the First Schedule to this Act, and for the purpose of such undertaking, execution and operation the Board may do all such things as are reasonably necessary or proper therefor or incidental thereto.
(2) The Board may contract with any person for the execution of all or any works which the Board is authorised by this section to undertake and execute, and for that purpose the Board may enter into contracts.
(3) Whenever the Board enters under this section into any contract for the execution of any of the scheduled works the Board may by such contract confer on the contractor the right to do such of the said scheduled works as the Board shall think proper and shall specify in such contract, and thereupon such contractor shall have the right (concurrently with the Board) to do all or any of the things so specified as fully as if such right were conferred on him by this Act, but so far as and no further than is necessary for the due execution of such contract.
Board may acquire land, etc., compulsorily.
5.—(1) For the purpose of executing all or any of the scheduled works (whether the Board executes such works itself or by a contractor) the Board may do all or any of the following things, that is to say:—
(a) compulsorily acquire (either permanently or temporarily) any lands or premises;
(b) compulsorily acquire (either permanently or temporarily) any easement, way-leave, water right, fishing right, or other right over or in respect of any lands, premises, or water;
(c) compulsorily terminate, restrict, or otherwise interfere with (either permanently or temporarily) any easement, way-leave, water right, fishing right, or other right existing over or in respect of any lands, premises, or water;
(d) compulsorily divert, close, remove, or otherwise interfere with (either permanently or temporarily) any public or private road, way, or bridge, or any canal or other artificial water-way or any artificial watercourse;
(e) compulsorily interfere with any lands or premises.
(2) At any time after the passing of this Act and before conveyance or ascertainment of price or compensation, but subject to giving not less than one month's or, in the case of an occupied dwelling house, three months' previous notice in writing to the occupier of the lands or premises or the owner of the easement or other property or right affected, the Board (and every contractor authorised so to do by the Board) may enter on and take possession of any lands or premises or exercise any right which the Board is authorised by this section to acquire compulsorily, or may terminate, restrict, or otherwise interfere with any easement or other property or right which the Board is authorised by this section compulsorily to terminate, restrict, or interfere with, or may divert, close, remove, or otherwise interfere with any road, way, bridge, water-way, or water-course which the Board is authorised by this section compulsorily to divert, close, remove, or interfere with.
(3) Whenever the Board is of opinion that the payment of compensation for the flooding of or other interference with any lands or premises under this section would be uneconomic or for any other reason inexpedient, the Board may acquire permanently such lands or premises under this section either compulsorily or by agreement.
Ascertainment of price or compensation.
6.—(1) The amount of the price or compensation to be paid by the Board for lands and premises compulsorily acquired (whether permanently or temporarily) by it under this Act to the several persons entitled thereto or having estates or interests therein, or for or in respect of easements, way-leaves, water rights, fishing rights and other rights compulsorily acquired (whether permanently or temporarily) by it to the owner thereof or the several persons entitled to or having estates or interests in the lands and premises over or in respect of which such rights are so acquired shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919.
(2) The amount of the compensation to be paid by the Board on account of the compulsory termination, restriction, or other interference (whether permanent or temporary) under this Act of or with any easement, water right, fishing right, or other right existing over or in respect of any lands, premises, or water, or the compulsory diversion, closing, removal, or other interference (whether permanent or temporary) under this Act of or with any private road, way, or bridge or any canal or other artificial water-way or any artificial water-course or the compulsory interference under this Act with any lands or premises shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, in like manner as if such compensation were the price of land compulsorily acquired.
(3) When any price or compensation is being assessed in pursuance of this section in respect of any property, corporeal or incorporeal, which is occupied, used or enjoyed with or forms part of any other property, regard shall be had to any benefit in the nature of drainage or improvement of water supply which may reasonably be expected to accrue to such property by reason of any works executed or in course of execution or about to be executed by the Board under this Act.
(4) All claims for the price of or compensation in respect of any land, premises, or right compulsorily acquired or any lands, premises, right, way, or other property compulsorily interfered with under this Act shall be made within one year after such lands, premises, right, way or property is first entered on, exercised, or interfered with by the Board or a contractor under this Act, save that in the case of permanent interference with a fishery right the claim may be made at any time within ten years after the completion of the works by which the fishery right is so interfered with.
(5) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845, shall apply to any price or compensation payable by the Board under this section and to the conveyance to the Board of property, corporeal or incorporeal, compulsorily acquired by it under this Act, and for the purpose of such application the Board shall be deemed to be the promoter of the undertaking.
(6) No action shall lie at law or in equity against the Board or any contractor or any officer or servant of the Board or any contractor for or on account of any act, matter, or thing in respect of which compensation is payable by virtue of this section.
Execution of works in lieu of compensation.
7.—(1) Where a person is entitled, actually or prospectively, to compensation in respect of anything lawfully done or intended to be done by the Board under this Act, the Board may execute for the benefit of such person such works as the Board thinks proper, and such person agrees to accept in satisfaction or partial satisfaction of his claim for such compensation.
(2) The Board may attach to the execution of any works under this section such terms and conditions (including terms as to the ownership, possession, and control of such works) as may be agreed on by the Board and the person for whose benefit the works are so executed.
(3) The Minister for Local Government and Public Health may, after consultation with the Board, declare that any particular works executed under this section shall be exempt, either permanently or for a limited time, from assessment for poor rate and also from assessment for any other rate made by a local authority, and whenever any such order is made the works to which such order relates shall be exempt from rates in accordance with such order.
Deposit of plans, etc.
8.—(1) As soon as may be after the passing of this Act and not later than one month before commencing any particular part of the scheduled works or, for that purpose, entering on any lands or premises or exercising any right or interfering with any property, corporeal or incorporeal, under this Act, the Board shall cause maps, plans, and books of reference in relation to those works to be deposited as hereinafter mentioned.
(2) The maps and plans to be deposited under this section shall be sufficient in quantity and character to show on adequate scales the extent of the scheduled works to which they relate with all contemplated deviations and variations, and also all property, corporeal and (where appropriate) incorporeal, proposed to be acquired compulsorily for the purpose of such works and also every interference (so far as the same can be shown on a drawing) proposed to be made compulsorily for the said purpose with any property, corporeal or incorporeal, or any road or bridge.
(3) The books of reference to be deposited under this section shall contain the names of the owners or reputed owners, lessees or reputed lessees, and occupiers of all lands and premises proposed to be acquired or otherwise affected compulsorily under this Act for the purpose of the scheduled works in relation to which they are deposited and of all property, corporeal or incorporeal (including roads and bridges), proposed to be in any way interfered with compulsorily under this Act for the purpose of such works.
(4) The maps, plans, and books of reference to be deposited under this section shall be deposited at the head office of the Board in the City of Dublin, and also, in the case of maps, plans, and books of reference relating to any of the scheduled works or to any property south of the bridge crossing the River Shannon at the northern end of Lough Derg and known as Portumna Bridge at the office of the Board or some other convenient place in the City of Limerick, and, in the case of maps, plans, and books of reference relating to any of the scheduled works or to any property north of the said bridge, at a convenient place in the town of Portumna, or at such other place or places as the Board may, with the approval of the Minister, determine, and all such maps, plans, and books of reference shall remain so deposited until the completion of the scheduled works to which they relate, and while so deposited shall be open to inspection by any person free of charge at the place of deposit between the hours of ten o'clock in the morning and four o'clock in the afternoon of every day except Saturdays, Sundays and bank holidays.
(5) As soon as may be after the deposit of any maps, plans or books of reference in any city or town in pursuance of this section, the Board shall give public notice of such deposit by advertisement published twice in each of two or more newspapers circulating in such city or town, and shall in every such notice state that such maps, plans, and books of reference are open to public inspection in accordance with this section.
Protection of postal and telegraphic services.
9.—Neither the Board nor any contractor executing works under this Act shall by virtue of this Act acquire, enter on, remove, or otherwise interfere with any lands, premises, buildings, works, plant, materials, or other property of the Minister for Posts and Telegraphs or erect any works or do any other matter or thing which in the opinion of the Minister for Posts and Telegraphs would obstruct, delay, hinder, or otherwise injuriously affect the due execution of the public services of the Department of Posts and Telegraphs.
Exemption of scheduled works from rates.
10.—(1) The scheduled works shall, while in the exclusive possession and control of the Board, be exempt from assessment for poor rate and also from assessment for any other rate made by a local authority.
(2) In this section the expression “local authority” includes (in addition to the meaning given to it by the Principal Act) any body of persons having power under an Act of the Parliament of Ireland or any local or personal Act of the United Kingdom Parliament or any private Act of the Oireachtas to assess and levy a rate on land or on persons in respect of their occupation of land.
Protection of public roads and bridges.
11.—If and whenever the execution of any of the scheduled works under this Act involves the diversion, removal, or other interference with any public road or bridge the following provisions shall have effect, that is to say:—
(a) where the execution of the scheduled works involves the closing of the road or bridge to traffic the Board shall construct and shall maintain while such road or bridge is so closed to traffic a temporary road or bridge in the same or some other convenient situation sufficient to carry traffic of such quantity and character as normally uses such road or bridge;
(b) the Board shall at or before the completion of the scheduled works either restore the road or bridge to its former condition or construct, after consultation with the Minister for Local Government and Public Health, a new permanent road or bridge in the same or some other convenient situation sufficient to carry the like amount (in quantity and character) of traffic as the original road or bridge was able to carry and not substantially less convenient in gradient and curve than such original road or bridge;
(c) where the Board constructs a permanent new bridge and such bridge confers substantially greater advantages on the public of any county or urban district than the original bridge, by affording an improved means of communication or otherwise, the Board shall certify the cost of such new bridge and the Minister for Local Government and Public Health shall certify what part of such cost in his opinion ought reasonably to be borne by the council of such county or urban district, and thereupon a sum equal to the part so certified of such cost shall be raised by such council as part of the expenses of the maintenance of county or urban roads (as the case may be) and shall be paid by such council to the Board;
(d) if any doubt, dispute, or question shall arise as to whether the Board in the construction, maintenance, or restoration of any temporary or permanent road or bridge pursuant to this section has complied with the provisions of this section, or as to whether a permanent new bridge constructed by the Board confers substantially greater advantages on the public of any county or urban district than the original bridge, such doubt, dispute, or question shall be decided by the Minister for Local Government and Public Health, whose decision shall be final.
Advances from the Central Fund to the Board.
12.—(1) The Minister for Finance may, subject to the limitations imposed by this section, advance out of the Central Fund or the growing produce thereof to the Board as and when requested so to do by the Board all such sums (not exceeding in the aggregate the amount hereinafter mentioned) as the Minister for Industry and Commerce shall from time to time certify to be reasonably and properly required by the Board for any purpose arising under this Part of this Act.
(2) The total amount of the advances to be made to the Board under this section out of the Central Fund or the growing produce thereof shall not exceed the sum of five hundred and thirty thousand pounds.
(3) The Minister for Finance may, for the purpose of providing for the advance of sums out of the Central Fund under this section, or for the repayment to that Fund of all or any part of the sums so advanced, or for paying off any securities issued under this section so far as such payment is not otherwise provided for, borrow money by means of the issue of such securities as he thinks proper, and all sums so borrowed shall be paid into the Exchequer.
(4) The principal of and interest on all securities issued under this section shall be charged on and payable out of the Central Fund or the growing produce thereof.
(5) The sums to be advanced under this section shall be expended by the Board solely for the purpose of the scheduled works or the doing of anything which the Board is authorised by this Part of this Act to do.
Payment of interest on advances from the Central Fund.
13.—(1) The Board shall pay to the Minister for Finance on every sum advanced to the Board out of the Central Fund under this Act interest from the date of the advance of such sum until the same is repaid at such rate as shall be appointed by the Minister for Finance and such interest shall be so paid by equal half-yearly payments on such days in every year as the Minister for Finance shall from time to time appoint.
(2) If the Board fails to pay to the Minister for Finance any interest payable by it under this section at the time appointed in that behalf under this section, the Board shall pay to the said Minister interest at the rate appointed by the said Minister on the interest so unpaid from the time appointed as aforesaid until the same is actually paid.
(3) All interest paid to the Minister for Finance by the Board under this section shall be paid into the Exchequer in such manner as the said Minister shall from time to time direct.
(4) The Minister for Finance may from time to time vary the rate at which interest payable under this section is to be paid.
Repayment of advances from the Central Fund.
14.—(1) For the purpose of providing for the repayment by the Board of the advances made to it out of the Central Fund under this Act, the Board shall make to the Minister for Finance half-yearly payments commencing on such date as the said Minister after consultation with the Minister shall appoint and continuing for such number of years and being of such amounts and payable at such times as the said Minister after consultation as aforesaid shall appoint, and different such dates, numbers of years, amounts, and times may be so appointed in respect of different portions of such advances.
(2) The several half-yearly payments to be made to the Minister for Finance by the Board under this section shall be applied by the said Minister as sinking funds for the repayment of the several portions of the advances in respect of which such half-yearly payments are made and when the Board has paid to the said Minister the full number of the half-yearly payments appointed under this section in respect of any portion of such advances (together with any interest which may have become payable under this section in respect of any of such half-yearly payments) such portion of such advances shall be deemed to be fully repaid by the Board without prejudice to the liability of the Board for any interest then unpaid in respect of such portion of such advances.
(3) If the Board fails to pay to the Minister for Finance any half-yearly payment or portion of a half-yearly payment payable by it to the said Minister under this section at the time appointed in that behalf under this section, the Board shall pay to the said Minister interest at the rate appointed by the said Minister on such half-yearly payment or portion of a half-yearly payment from the time appointed as aforesaid until the same is actually paid.
(4) The Minister for Finance may from time to time vary the rate at which interest payable under the foregoing sub-section of this section is to be paid.
(5) All moneys paid by the Board to the Minister for Finance under this section shall be paid into or disposed of for the benefit of the Exchequer in such manner as the said Minister shall from time to time direct.
Charge on scheduled works.
15.—(1) Every sum advanced to the Board out of the Central Fund under this Act and all interest and every half-yearly payment payable by the Board under this Act on or in respect of such sum and all interest payable by the Board under this Act on any such interest or half-yearly payment shall become and be—
(a) a first charge on the scheduled works, and
(b) a charge on the Shannon works puisne only to the charges thereon created by section 16 of the Principal Act, and
(c) a floating charge (puisne only to the floating charges created by section 16 of the Principal Act) on all property of whatsoever nature or kind (other than the Shannon works or the scheduled works) from time to time vested in or owned by the Board, but the floating charge hereby created shall not operate to prevent or restrict the alienation or other dealing by the Board of or with any of such property in the due and proper exercise of the powers or performance of the duties conferred or imposed on the Board by law or which may hereafter be conferred or imposed on the Board.
(2) The charges created by this section shall be vested in the Minister for Finance and may be enforced by that Minister in due form of law whenever he shall think proper so to do and whether any interest or half-yearly payment secured by such charge is or is not due and unpaid and all moneys recovered by virtue of any such charge shall be paid into the Exchequer in such manner as the said Minister shall direct.
Grants by the Minister for Finance.
16.—(1) The Minister for Finance may, as and when requested so to do by the Board, make out of moneys provided by the Oireachtas grants to the Board of such sums (not exceeding in the aggregate the total amount hereinafter mentioned) as the Minister for Industry and Commerce shall from time to time certify to be reasonably and properly required by the Board for any particular purpose to which such grants are applicable under this section.
(2) The total amount of the grants which may be made to the Board under this section shall not exceed the sum of ninety-three thousand pounds.
(3) Every grant made by the Minister for Finance under this section shall be applied by the Board for such of the following purposes as is specified in the relevant certificate of the Minister for Industry and Commerce, that is to say, the execution of the scheduled works or the doing of any other thing which the Board is authorised by this Part of this Act to do.
PART III.
Amendment of the Electricity (Supply) Act, 1927.
Amendment of section 45 of the Principal Act.
17.—(1) Sub-section (5) of section 45 of the Principal Act is hereby amended by the insertion at the end of paragraph (b) thereof of the words “or with this section,” and the said sub-section shall be construed and have effect accordingly.
(2) Whenever the Board has made a special order under section 45 of the Principal Act, the Board may before conveyance or ascertainment of price or compensation (but subject to giving not less than one month's or, in the case of an occupied dwelling house, three months' previous notice in writing to the occupier of the lands or the owner of the easement or other right intended to be acquired under or affected by such order) enter on and take possession of any lands or exercise any right which is the subject of such special order.
(3) Whenever the Board under this section enters on and takes possession of any lands or exercises any right (as the case may be) before payment of the price or compensation, the Board shall pay to the occupier of the lands or owner of the easement or other right affected (as the case may be) interest on the amount of such price or compensation when fixed at the rate of four pounds per cent. per annum from the date of such entry or taking possession or the exercise of such right (as the case may be) until the date of the conveyance from such occupier or owner to the Board.
Amendment of First Schedule to the Principal Act.
18.—(1) Paragraph 8 of the First Schedule to the Principal Act is hereby amended by the insertion of the words “or in either of the opposing forces during the civil strife in the years 1922, 1923, 1924, or was interned or imprisoned in consequence of such service” after the words “Air Force,” and section 61 of that Act and the said First Schedule shall be construed and have effect accordingly.
(2) This section shall have and be deemed to have had effect as from the commencement of the Principal Act.
Prohibition of building under transmission wires.
19.—(1) Whenever the Minister is satisfied, on the application of the Board, that the erection of buildings or of a particular class or particular classes of buildings under or within a particular distance of any particular transmission wires involves risk of injury to the public or to such buildings or the occupiers thereof and that the removal of such transmission wires to another site would involve unreasonable expense or substantial technical difficulty, the Minister may, if he so thinks fit, by order (in this Act referred to as a building prohibition order) prohibit the erection of any building whatsoever or any building of a specified class or specified classes under or within a specified distance of the said transmission wires.
(2) The Minister may, if he so thinks proper, at any time by order amend or revoke a building prohibition order on the application of the Board or of any person whose land is affected by such building prohibition order.
(3) Whenever the Minister proposes to make a building prohibition order or an order amending or revoking a building prohibition order, the Minister shall publish, in such manner as he shall consider most suitable in the circumstances, notice of his intention to consider the making of such order and of the time and manner in which objections to and representations in respect of such order may be sent to him.
(4) Whenever the Minister proposes to make a building prohibition order or an order amending or revoking a building prohibition order, the Minister may, if he so thinks fit, cause a public inquiry to be held in regard to the making of such order.
(5) No building prohibition order shall operate to make unlawful the completion of any building the erection of which was begun before the date on which such order was made, and no order amending a building prohibition order shall operate to make unlawful the completion of any building the erection of which was lawfully begun before the date on which such amending order was made.
(6) If any doubt, question, or dispute shall arise as to whether the erection of a building was or was not begun, within the meaning of the next preceding sub-section of this section, before the date on which any particular order was made under this section, such doubt, question, or dispute shall be determined by the Minister and his determination thereof shall be final and conclusive,
(7) Every person who shall erect or begin or attempt to erect any building in contravention of a building prohibition order shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding one hundred pounds together with a further fine not exceeding ten pounds for every day during which such building or any part thereof remains so erected.
(8) The provisions contained in the Second Schedule to this Act shall have effect in respect of every public inquiry which the Minister shall cause to be held in pursuance of this section.
(9) Every building prohibition order and every order under this section amending or revoking a building prohibition order shall be published in the Iris Oifigiúil as soon as conveniently may be after it is made.
(10) In this section the expression “transmission wires” means wires or lines carrying electricity above the ground and forming part of the transmission system or of the distribution system.
Notice of intention to erect building.
20.—(1) No person shall erect or construct or begin to erect or construct any building or structure of which any part is within or projects over or will, when such building or structure is completed, be within or project over the relevant area of any transmission wire unless he has, at least two months before beginning such erection or construction, given to the Board notice in writing stating his intention to erect or construct such building or structure and stating all relevant particulars of such building or structure.
(2) Every person who erects or constructs or begins to erect or construct any building or structure in contravention of this section shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding fifty pounds together with a further fine not exceeding one pound for every day during which such building or structure or any part thereof continues to be within or to project over the relevant area of any transmission wire.
(3) In this section the expression “relevant area of any transmission wire” means the area within twenty-five yards on either side of the straight line joining the centres of the bases of any two consecutive posts, pillars, or other erections supporting such transmission wire, and the expression “transmission wire” means a wire or line carrying electricity above ground and forming part of the transmission system or of the distribution system.
Certain payments by the Board.
21.—(1) Whenever any local authority which was an authorised undertaker whose undertaking was acquired by the Board under the Principal Act has refused to pay to any person who was at any time employed by such local authority for the purposes of such undertaking or to the personal representative of any such person the whole or any part of any salary, wages, or remuneration which such local authority might lawfully have paid under sub-section (1) of section 7 of the Local Government Act, 1933 (No. 5 of 1933), the Board may, subject to the provisions of the said section 7 (so far as those provisions are applicable) and of this section, pay to any such person or personal representative the whole or any part (as the case may require) of any of such salary, wages or remuneration.
(2) The following provisions shall have effect for the purposes of the foregoing sub-section of this section, that is to say:—
(a) payment may be made to a person under that sub-section whether he is or is not, at the time of making such payment, an officer or servant of the Board;
(b) every doubt, question, or dispute which shall arise in the carrying of this section into effect shall be determined by the Minister whose determination thereof shall be final.
(3) Every local authority which was an authorised undertaker whose undertaking was acquired by the Board under the Principal Act shall, when requested so to do by the Board, furnish to the Board all information in the possession, power, or procurement of such local authority in relation to every person to whom such payment might lawfully have been made by such local authority under the said sub-section (1) of section 7 of the Local Government Act, 1933 (No. 5 of 1933)
FIRST SCHEDULE.
Works Authorised to be Undertaken.
1. Making provision for controlling the level of the water in Lough Derg between the limits of 110 (one hundred and ten) feet O.D. and 112 (one hundred and twelve) feet O.D., and for that purpose altering the weirs at Parteen Villa and Meelick, raising and extending the embankments between Parteen Villa and Lough Derg and between Lough Derg and Meelick, extending the protective works for the railway line at Killaloe, and executing divers other works.
2. Lowering the level of Lough Ree to a minimum level of 121 (one hundred and twenty-one) feet O.D., and for that purpose executing divers works.
3. Making provision for controlling the level of the water in Lough Allen between the limits of 168 (one hundred and sixty-eight) feet O.D. and 154 (one hundred and fifty-four) feet O.D., and for that purpose dredging new channels and deepening existing channels, removing and reconstructing the weir at the outlet of the said Lough, reconstructing certain bridges, and executing divers other works.
4. Altering or removing and reconstructing divers quays, harbours, landing-stages, boat-houses, roads, bridges and other existing works.
5. Executing all such other works of whatsoever nature which are incidental to, consequential on, or rendered necessary by the doing of all or any of the things mentioned in the several foregoing paragraphs of this Schedule.
SECOND SCHEDULE.
Public Inquiries.
1. The inquiry shall be held by such person and at such time and place as the Minister shall appoint.
2. The Board shall cause notice of the holding of the inquiry to be given in such manner as the Minister shall direct to the public and to such particular persons as the Minister shall specify.
3. The person holding the inquiry shall have all such powers, rights, and privileges for enforcing the attendance of witnesses and examining them on oath (which such person is hereby authorised to administer) or otherwise, and for compelling the production of documents as are vested in the High Court or a Judge thereof in respect of the trial of an action, and a summons signed by such person shall be equivalent to and have the like effect as a formal process issued by the High Court for enforcing the attendance of witnesses or compelling the production of documents, as the case may be.
4. If any person—
(a) on being duly summoned as a witness at the inquiry makes default in attending, or
(b) being in attendance as a witness refuses to take an oath legally required by the person holding the inquiry to be taken, or to produce any document legally required by the person holding the inquiry to be produced by him, or to answer any question to which the person holding the inquiry may legally require an answer, or
(c) does any other thing which would, if the person holding the inquiry were a Court of Justice having power to commit for contempt of court, be contempt of such court,
the person holding the inquiry may certify the offence of that person under his hand to the High Court and that Court may, after such inquiry as it thinks proper to make, punish or take steps for the punishment of that person in like manner as if he had been guilty of contempt of the said Court.
5. A witness before the inquiry held under this Act shall be entitled to the same immunities and privileges as if he were a witness before the High Court.
6. All expenses incurred by the Minister in holding the inquiry shall be paid to the Minister by the Board, and the amount of such expenses shall be fixed by the Minister and when so fixed shall be recoverable by the Minister from the Board as a civil debt in any court of competent jurisdiction.
