ACHT NA gCÚIRTEANNA, 1986

Leasú ar an Acht Cúirteanna Breithiúnais, 1936.

1.—(1) Leasaítear leis seo an tAcht Cúirteanna Breithiúnais, 1936—

(a) trí

a chur isteach sa Dara Sceideal i ndiaidh

agus

(b) tríd an mír seo a leanas a chur isteach in alt 33, le héifeacht amhail ar agus ón 1ú lá d'Eanáir, 1986, i ndiaidh mhír (a) d'fho-alt (2):

“(aa) comhdhéanamh Cuarda Ard-Chúirte a athrú trí chontae nó contaetha, contaebhuirg nó contaebhuirgí nó contae nó contaetha agus contaebhuirg nó contaebhuirgí a chur leis an gCuaird nó a bhaint den Chuaird, nó”.

(2)  (a) Meastar leis seo gurb é Gaillimh an baile achomhairc, de réir bhrí Chuid IV den Acht Cúirteanna Breithiúnais, 1936, chun críocha achomharc i gcoinne breithiúnas nó orduithe ón gCúirt Chuarda a tugadh nó a rinneadh i gcaingne nó in ábhair a éistíodh agus a cinneadh, roimh dháta rite an Achta seo, i gContaebhuirg na Gaillimhe nó roimh an 1ú lá d'Eanáir, 1986, sa limistéar arbh í an Chontaebhuirg sin í ar an dáta sin.

(b)  Fógra achomhairc a seirbheáladh roimh an dáta rite sin i leith breithiúnais nó ordú dá dtagraítear i mír (a) den fho-alt seo, ní bheidh sé neamhbhailí toisc amháin nach raibh baile achomhairc, de réir na brí réamhráite, do Chontaebhuirg na Gaillimhe sonraithe, nó nach raibh mír (a) den fho-alt seo i bhfeidhm, tráth na seirbheála sin.

2.—(1) Féadfar Acht na gCúirteanna, 1986, a ghairm den Acht seo.

(2) Féadfar Achtanna na gCúirteanna (Forálacha Forlíontacha), 1961 go 1986, a ghairm d'Achtanna na gCúirteanna (Forálacha Forlíontacha), 1961 go 1985, agus den Acht seo le chéile.

COURTS ACT, 1986

Amendment of Courts of Justice Act, 1936.

1.—(1) The Courts of Justice Act, 1936, is hereby amended by—

(a) the insertion in the Second Schedule of

(b) the insertion in section 33, with effect as on and from the 1st day of January, 1986, of the following paragraph after paragraph (a) of subsection (2):

“(aa) alter the composition of a High Court Circuit by adding to or removing from the Circuit a county or counties, a county borough or county boroughs or a county or counties and a county borough or county boroughs, or”.

(2) (a) Galway is hereby deemed to be the appeal town, within the meaning of Part IV of the Courts of Justice Act, 1936, for the purposes of appeals from judgments or orders of the Circuit Court given or made in actions or matters heard and determined before the passing of this Act in the County Borough of Galway or before the 1st day of January, 1986, in the area that, upon that date, constituted the said County Borough.

(b) A notice of appeal served before such passing in respect of a judgment or order referred to in paragraph (a) of this subsection shall not be invalid by reason only of the fact that an appeal town, within the meaning aforesaid, for the County Borough of Galway did not stand specified, or that paragraph (a) of this subsection was not in force, at the time of such service.

Short title and collective citation.

2.—(1) This Act may be cited as the Courts Act, 1986.

(2) The Courts (Supplemental Provisions) Acts, 1961 to 1985, and this Act may be cited together as the Courts (Supplemental Provisions) Acts, 1961 to 1986.
