1.—Féadfar an tAcht Toghchán, 1960, a ghairm den Acht seo.
Léiriú.
2.—(1) San Acht seo—
ciallaíonn “an Toghchán Dála” comhalta de Dháil Éireann a thoghadh chun an folúntas a líonadh a tharla de dheasca Seosamh O hAodha d'fháil bháis;
ciallaíonn “na húdaráis áitiúla” na comhairlí contae, na bardais chontae-bhuirge nó buirgí eile, na comhairlí ceantar uirbeacha agus na coimisinéirí bailte a bhfuil a limistéir feidhmiúcháin sa limistéar arb éard é contaetha riaracháin Cheatharlach agus Chill Chainnigh agus contae-bhuirg Phortláirge;
ciallaíonn “na toghcháin áitiúla” na toghcháin chomhaltaí de na húdaráis áitiúla a bheidh ar siúl sa bhliain 1960;
ciallaíonn “an tAire” an tAire Rialtais Áitiúil.
(2) Déanfar aon tagairt san Acht seo do chomhaltaí d'údarás áitiúil a fhorléiriú, nuair is bardas contae-bhuirge nó buirge eile an t-údarás áitiúil atá i gceist, mar thagairt do chomhaltaí na comhairle a bunaíodh le dlí i leith na contae-bhuirge nó na buirge eile sin.
Oibriú Coda II agus laethanta áirithe a shocrú.
3.—(1) Má thairgtear an rit don toghchán Dála tráth nach déanaí ná an 1ú lá de Mheitheamh, 1960, féadfaidh an tAire, le hordú, a dhearbhú go bhfuil Cuid II den Acht seo i ngníomh.
(2) Socróidh ordú faoin alt seo maidir leis an toghchán Dála—
(a) lá a measfar gurb é an lá é a fuair an ceann comhairimh an rit, agus
(b) lá le haghaidh vótaíochta.
(3) Má dhéantar ordú faoin alt seo, tiocfaidh Cuid II den Acht seo i ngníomh ar an ordú a dhéanamh, ach ní thiocfaidh sí i ngníomh ar aon mhodh eile.
CUID II.
Forálacha i dTaobh na Vótaíochta sa Toghchán Dála agus sna Toghcháin Áitiúla.
An rit a fháil i dtoghchán Dála.
4.—Nuair a bheidh éifeacht á thabhairt maidir leis an toghchán Dála do mhír (a) d'fho-alt (2) d'alt 18 den Acht Timpeall Toghchán, 1923, glacfar gur tagairt don lá a bheidh socraithe de bhun mír (a) d'fho-alt (2) d'alt 3 den Acht seo an tagairt atá sa mhír sin don rit a fháil cibé acu a fuair an ceann comhairimh an rit an lá sin nó nach bhfuair.
Lá na vótaíochta sa toghchán Dála.
5.—Má ghlactar vótaíocht sa toghchán Dála, déanfar é an lá a shocrófar de bhun mír (b) d'fho-alt (2) d'alt 3 den Acht seo.
An gnáthlá toghcháin chun críocha na dtoghchán áitiúla.
6.—Glacfar gurb é an lá a shocrófar de bhun mír (b) d'fho-alt (2) d'alt 3 den Acht seo an gnáthlá toghcháin chun críocha na dtoghchán áitiúla.
An ceann comhairimh.
7.—(1) Is é an ceann comhairimh sa toghchán Dála an ceann comhairimh chun críocha na vótaíochtaí sna toghcháin áitiúla.
(2) Aon duine arbh é, mura mbeadh fo-alt (1) den alt seo, an ceann comhairimh é chun críocha na vótaíochtaí sna toghcháin áitiúla, déanfaidh sé, ar an gceann comhairimh sa toghchán Dála á iarraidh sin air, cibé cúnamh maidir leis na vótaíochtaí sin a thabhairt don oifigeach sin a iarrfaidh sé le réasún.
(3) Má bhíonn ceann comhairimh cúnta ann sa toghchán Dála i leith aon limistéir gníomhóidh sé don limistéar sin mar cheann comhairimh cúnta chun críocha na vótaíochtaí sna toghcháin áitiúla agus is iad a dhualgais cibé cuid de dhualgais an chinn chomhairimh chun críocha na vótaíochtaí sna toghcháin áitiúla nach bhfuil an ceann comhairimh faoi cheangal dlí a chomhlíonadh é féin a chomhlíonadh sa limistéar sin.
(4) Má éiríonn aon amhras i dtaobh cad iad na dualgais a bheidh le comhlíonadh, de dhroim na bhforálacha atá sa Chuid seo den Acht seo, ag aon cheann comhairimh, ceann comhairimh cúnta, rúnaí contae nó bailechléireach, cinnfidh an tAire an t-amhras.
Ceantair vótaíochta agus áiteanna vótaíochta.
8.—Chun críocha vótaíochta sa toghchán Dála—
(a) glacfar an dáilcheantar ina mbeidh an toghchán Dála ar siúl a bheith roinnte sna ceantair vótaíochta ina mbeidh sé roinnte de thuras na huaire chun críocha na dtoghchán áitiúla, agus
(b) is iad na háiteanna vótaíochta a bheidh ann na cinn a bheidh ceaptha de thuras na huaire mar áiteanna vótaíochta chun críocha na vótaíochtaí sna toghcháin áitiúla.

9.—I gcás ina nglacfar vótaíocht in aon cheann de na toghcháin áitiúla i dtogh-limistéar áirithe agus go nglacfar vótaíocht freisin sa toghchán Dála, beidh éifeacht ag na forálacha seo a leanas maidir leis an vótaíocht chéadluaite agus leis an vótaíocht sa toghchán Dála mar a ghlacfar vótaíocht sa togh-límistéar sin:
(a) is iad na daoine céanna a ghlacfaidh iad agus is ar an modh céanna a ghlacfar iad;
(b) tosóidh siad ar a 9 a chlog a.m. agus coimeádfar ar siúl go leanúnach iad go dtí a 9 a chlog p.m. agus ní níos faide ná sin, mura mbeidh an tAire tar éis a ordú faoi alt 41 den Acht Timpeall Toghchán, 1923, arna leasú le halt 2 den Acht Toghcháin (Leasú), 1946, go gcoimeádfar an vótaíocht sa toghchán Dála ar siúl go dtí 9.30 a chlog p.m. agus sa chás sin coimeádfar ar siúl go leanúnach iad go dtí 9.30 a chlog p.m.;
(c) is é an marc oifigiúil céanna a úsáidfear ar na páipéir bhallóide uile;
(d) tabharfar a pháipéir bhallóide do vótálaí an t-am céanna;
(e) má chuirtear boscaí ballóide faoi leith ar fáil, ní dhéanfaidh sé páipéar ballóide neamhbhailí é a chur sa bhosca ballóide mícheart.

10.—Nuair a thabharfaidh an ceann comhairimh sa toghchán Dála deimhniú uaidh faoi alt 22 den Acht Timpeall Toghchán, 1923, ní hé amháin go n-údaróidh an deimhniú don toghthóir vótáil sa toghchán Dála sin sa stáisiún vótaíochta a shonrófar sa deimhniú ach údaróidh sé freisin dó, má ghlactar vótaíocht maidir le haon cheann de na toghcháin áitiúla agus go mbeidh teideal aige vótáil sa toghchán sin, votáil sa toghchán sin sa stáisiún vótaíochta sin, ar choinníoll—
(a) más toghchán comhaltaí bardais chontae-bhuirge nó buirge eile, comhaltaí comhairle ceantair uirbigh nó coimisinéirí baile an toghchán sin, gur sa chontaebhuirg nó sa bhuirg eile sin, sa cheantar uirbeach nó sa bhaile sin, atá an stáisiún vótaíochta sin, agus

Caiteachais an chinn chomhairimh.
11.—(1) Beidh teideal ag an gceann comhairimh sa toghchán Dála chun a tháillí réasúnacha, nach mó ná na suimeanna a shonraítear sa scála de tháillí uasta a fhorordófar chun críocha an ailt seo, i leith seirbhísí agus caiteachais de na cineálacha uile agus faoi seach a bheidh luaite sa scála agus faoina ndeachaigh sé go cuí chun críocha, nó i leith, an toghcháin Dála agus na dtoghchán áitiúla.
(2) Íocfaidh an tAire Airgeadais as an bPríomh-Chiste nó a thoradh fáis méad aon táillí den sórt sin ar chuntas a bheidh le cur faoina bhráid de réir rialachán faoin alt seo, ach féadfaidh an tAire Airgeadais, más oiriúnach leis é, sula ndéanfar íocaíocht, a iarraidh ar an mBreitheamh den Chúirt Chuarda ag a mbeidh dlínse i gcontae riaracháin Chill Chainnigh fómhas a dhéanamh ar an gcuntas agus, air sin, féadfaidh an Breitheamh sin fómhas a dhéanamh ar an gcuntas ar cibé modh agus cibé tráth agus áit is oiriúnach leis, agus an méad is iníoctha leis an gceann comhairimh a chinneadh go críochnaitheach.
(3) Ar a gceann comhairimh d'iarraidh airleacan i leith a tháillí, féadfaidh an tAire Airgeadais, más oiriúnach leis é, airleacan den sórt sin a thabhairt.
(4) I gcás ina ndéanfar iarratas faoin alt seo ar fhómhas, féadfaidh an ceann comhairimh a iarraidh ar an mBreitheamh scrúdú a dhéanamh ar aon éileamh a dhéanfaidh duine ar bith ina aghaidh i leith nithe a bheidh muirearaithe sa chuntas; agus féadfaidh an Breitheamh, tar éis fógra a thabhairt don éilitheoir agus tar éis deis ar a éisteacht a thabhairt dó agus aon fhianaise a thabhairt ar aird, an t-éileamh a mbeidh agóid á dhéanamh ina aghaidh a cheadú nó a dhícheadú nó a laghdú, maraon le costais nó gan costais, agus beidh cinneadh an Bhreithimh ina chinneadh críochnaitheach chun gach críche agus in aghaidh gach duine.
(5) Íocfaidh gach ceann de na húdaráis áitiúla leis an Aire Airgeadais cibé cuid den íocaíocht a dhéanfar de bhun fo-alt (2) den alt seo a chinnfidh an tAire sin is cuí a chionroinnt ar an údarás áitiúil sin.

12.—(1) San alt seo ciallaíonn “na fo-ailt iomchuí” fo-ailt (1) agus (2) d'alt 28 den Acht Timpeall Toghchán, 1923.
(2) A mhéad a bhaineann siad leis an toghchán Dála, beidh feidhm ag na fo-ailt iomchuí maidir le haon duine lena mbaineann na fo-ailt iomchuí maidir leis na toghcháin áitiúla de bhua alt 39 den Acht Rialtais Áitiúil, 1941.
(3) A mhéad a bhaineann siad leis na toghcháin áitiúla de bhua alt 39 den Acht Rialtais Áitiúil, 1941, beidh feidhm ag na fo-ailt iomchuí maidir le haon duine lena mbaineann na fo-ailt iomchuí maidir leis an toghchán Dála.

13.—(1) Aon duine a cheapfar maidir leis an toghchán Dála faoi alt 22 den Acht chun Drochbhearta Toghcháin a Chosc, 1923, mar ghníomhaire pearsanála féadfaidh sé a bheith i láthair sa stáisiún vótaíochta dár ceapadh é d'ainneoin an stáisiún sin a bheith á úsáid freisin chun críocha aon cheann de na toghcháin áitiúla.
(2) Aon duine a cheapfar maidir le haon cheann de na toghcháin áitiúla faoi alt 22 den Acht chun Drochbhearta Toghcháin a Chosc, 1923, arna chur i bhfeidhm le halt 39 den Acht Rialtais Áitiúil, 1941, mar ghníomhaire pearsanála, féadfaidh sé a bheith i láthair sa stáisiún vótaíochta dár ceapadh é d'ainneoin an stáisiún vótaíochta sin a bheith á úsáid freisin chun críocha an toghcháin Dála.
(3) Aon duine a cheapfar maidir leis an toghchán Dála faoi Riail 29 de na Rialacha atá sa Chúigiú Sceideal a ghabhann leis an Acht Timpeall Toghchán, 1923, mar ghníomhaire chun bheith i láthair ag comhaireamh na vótaí, féadfaidh sé a bheith i láthair ag comhaireamh na vótaí sna toghcháin áitiúla.
(4) Aon duine a cheapfar maidir le haon cheann de na toghcháin áitiúla faoi Riail 28 de na Rialacha atá sa Chúigiú Sceideal a ghabhann leis an Ordú um Thoghcháin Áitiúla, 1942, mar ghníomhaire chun bheith i láthair ag comhaireamh na vótaí, féadfaidh sé a bheith i láthair ag comhaireamh na vótaí sa toghchán Dála.
(5) Aon duine a cheapfar maidir leis an toghchán Dála faoi alt 30 den Acht chun Drochbhearta Toghcháin a Chosc, 1923, mar fho-ghníomhaire féadfaidh sé a bheith i láthair in aon stáisiún vótaíochta a bheidh á úsáid sa toghchán Dála d'ainneoin an stáisiún sin a bheith á úsáid freisin chun críocha aon cheann de na toghcháin áitiúla.
(6) Nuair a bheidh Riail 49 de na Rialacha atá sa Chúigiú Sceideal a ghabhann leis an Acht Timpeall Toghchán, 1923, á cur i bhfeidhm maidir leis an toghchán Dála, déanfar neamhshuim de na focail “do réir an Achta so”.
(7) Nuair a bheidh Riail 48 de na Rialacha atá sa Chúigiú Sceideal a ghabhann leis an Ordú um Thoghcháin Áitiúla, 1942, á cur i bhfeidhm maidir le haon cheann de na toghcháin áitiúla, déanfar neamhshuim de na focail “de bhun an Achta seo”.
Treoracha.
14.—Féadfaidh an tAire, le treoracha, socrú a dhéanamh le haghaidh cibé nithe ar dóigh leis gur gá nó gur fóirstineach socrú a dhéanamh lena n-aghaidh chun éifeacht a thabhairt d'fhorálacha na Coda seo den Acht seo, agus féadfaidh sé, go sonrach, le haon treoir den sórt sin—
(a) cumhachtaí agus dualgais an chinn chomhairimh sa toghchán Dála maidir leis an toghchán sin agus na toghcháin áitiúla, agus cumhachtaí agus dualgais daoine eile a bheidh ar fostú i ndáil le vótaíochtaí sna toghcháin sin, a mhíniú;
(b) cibé modhnuithe a dhéanamh ar na hAchtanna Toghcháin, 1923 go 1959, agus ar na hAchtanna um Thoghcháin Áitiúla, 1927 agus 1953, is dóigh leis is gá chun go bhféadfaidh an toghchán Dála agus na toghcháin áitiúla a bheith ar siúl de réir na Coda seo den Acht seo nó chun críochnú agus cinntiú torthaí na dtoghchán sin a urasú nó a luathú;

(d) foráil a dhéanamh chun go n-úsáidfear na boscaí ballóide céanna nó cinn éagsúla i stáisiún vótaíochta i ndáil leis an toghchán Dála agus le haon cheann de na toghcháin áitiúla.

15.—Beidh éifeacht ag forálacha na Coda seo den Acht seo d'ainneoin aon ní atá in aon Acht eile nó in aon ordú, rialachán nó ionstraim eile arna dhéanamh faoi aon Acht eile.

ELECTIONS ACT, 1960.
PART I.
Preliminary And General.
Short title.
1.—This Act may be cited as the Elections Act, 1960.
Interpretation.
2.—(1) In this Act—
“the Dáil Election” means the election of a member of Dáil Éireann to fill the vacancy caused by the death of Joseph Hughes;
“the local authorities” means the councils of counties, corporations of county or other boroughs, councils of urban districts and commissioners of towns whose functional areas are situate in the area consisting of the administrative counties of Carlow and Kilkenny and the county borough of Waterford;
“the local elections” means the elections of members of the local authorities to be held in the year 1960;
“the Minister” means the Minister for Local Government.
(2) Any reference in this Act to members of a local authority shall, where the local authority in question are a corporation of a county or other borough, be construed as a reference to the members of the council established by law in respect of such county or other borough.
Operation of Part II and fixing of certain days.
3.—(1) If the writ for the Dáil election is moved not later than the 1st day of June, 1960, the Minister may by order declare that Part II of this Act is in operation.
(2) An order under this section shall fix in relation to the Dáil election—
(a) a day to be deemed to be the day of receipt of the writ by the returning officer, and
(b) a day for polling.
(3) If an order is made under this section, Part II of this Act shall come into operation on the making of the order, but it shall not come into operation otherwise.
PART II.
Provisions In Relation To The Polls At The DÁIl Election And The Local Elections.
Receipt of writ at Dáil election.
4.—In giving effect in relation to the Dáil election to paragraph (a) of subsection (2) of section 18 of the Electoral Act, 1923, the reference in that paragraph to the receipt of the writ shall be taken to be a reference to the day fixed pursuant to paragraph (a) of subsection (2) of section 3 of this Act whether the writ was or was not received by the returning officer on that day.
Polling day at the Dáil election.
5.—If a poll is taken at the Dáil election, it shall be held on the day fixed pursuant to paragraph (b) of subsection (2) of section 3 of this Act.
Ordinary day of election for purposes of the local elections.
6.—The day fixed pursuant to paragraph (b) of subsection (2) of section 3 of this Act shall be taken as being the ordinary day of election for the purposes of the local elections.
Returning officer.
7.—(1) The returning officer at the Dáil election shall be the returning officer for the purposes of the polls at the local elections.
(2) Any person who would, apart from subsection (1) of this section, be the returning officer for the purposes of the polls at the local elections shall, on being so required by the returning officer at the Dáil election, give to that officer such assistance in relation to those polls as he may reasonably require.
(3) If there is an assistant returning officer at the Dáil election for any area he shall act for that area as assistant returning officer for the purposes of the polls at the local elections and his duties shall be the performance in that area of such of the duties of the returning officer for the purposes of the polls at the local elections as that officer is not required by law to perform in person.
(4) If any doubt arises as to the duties to be performed consequent upon the provisions of this Part of this Act by any returning officer, assistant returning officer, county secretary or town clerk, the doubt shall be determined by the Minister.
Polling districts and polling places.
8.—For the purposes of a poll at the Dáil election—
(a) the constituency in relation to which the Dáil election is held shall be taken as being divided into the polling districts into which it stands divided for the time being for the purposes of the local elections, and
(b) the polling places shall be those which stand appointed for the time being as the polling places for the purposes of the polls at the local elections.
Taking of polls by same persons, etc.
9.—Where a poll is taken at any of the local elections in a particular electoral area and a poll is also taken at the Dáil election, the following provisions shall have effect in relation to the first-mentioned poll and the poll at the Dáil election as taken in that electoral area:
(a) they shall be taken by the same persons and in the same manner;
(b) they shall commence at the hour of 9 o'clock a.m. and shall be kept open continuously until the hour of 9 o'clock p.m. and no longer, unless the Minister has directed under section 41 of the Electoral Act, 1923, as amended by section 2 of the Electoral (Amendment) Act, 1946, that the poll at the Dáil election shall be kept open until the hour of 9.30 o'clock p.m., and in that case they shall be kept open continuously until the hour of 9.30 o'clock p.m.;
(c) the same official mark shall be used for all ballot papers;
(d) a voter shall be handed his ballot papers at the same time;
(e) if separate ballot boxes are provided, the fact that a ballot paper has not been put into the appropriate ballot box shall not invalidate the ballot paper.
Effect of certificate under section 22 of Electoral Act, 1923.
10.—Where a certificate is given under section 22 of the Electoral Act, 1923, by the returning officer at the Dáil election, the certificate, as well as authorising the elector to vote at that Dáil election at the polling station specified in the certificate, shall also authorise him, if a poll is taken in relation to any of the local elections and he is entitled to vote at that election, to vote thereat at that polling station provided that—
(a) in case that election is an election of members of the corporation of a county or other borough, the council of an urban district or the commissioners of a town, that polling station is situated in that county or other borough, urban district or town, and
(b) in any other case, that polling station is situated in the local government electoral area in which he is registered as a local government elector.
Expenses of returning officer.
11.—(1) The returning officer at the Dáil election shall be entitled to his reasonable charges, not exceeding the sums specified in the scale of maximum charges prescribed for the purposes of this section, in respect of services and expenses of the several kinds mentioned in the scale which have been properly incurred by him for the purposes of or in connection with the Dáil election and the local elections.
(2) The amount of any such charges shall be paid by the Minister for Finance out of the Central Fund or the growing produce thereof on an account to be submitted to him in accordance with regulations under this section, but the Minister for Finance may, if he thinks fit, before payment apply to the Judge of the Circuit Court having jurisdiction in the administrative county of Kilkenny for the taxation of the account, and thereupon that Judge may tax the account in such manner and at such time and place as he thinks fit, and finally determine the amount payable to the returning officer.
(3) On the request of the returning officer for an advance on account of his charges, the Minister for Finance may, if he thinks fit, make such an advance.
(4) Where an application under this section is made for taxation, the returning officer may apply to the Judge to examine any claim made by any person against him in respect of matters charged in the account; and the Judge, after giving notice to the claimant and after giving him an opportunity to be heard and to tender any evidence, may allow or disallow or reduce the claim objected to, with or without costs, and the determination of the Judge shall be final for all purposes and as against all persons.
(5) Each of the local authorities shall pay to the Minister for Finance such part of the payment made pursuant to subsection (2) of this section as that Minister determines to be proper to be apportioned to that local authority.
(6) The Minister for Finance may by regulations prescribe for the purposes of this section—
(a) a scale of maximum charges, and
(b) the time when and manner and form in which accounts are to be rendered to him.
(7) The returning officer at the Dáil election shall not, by virtue of any enactment other than this section, be entitled to any charges incurred by him for the purposes of or in connection with the Dáil election or any of the local elections.
Infringement of secrecy.
12.—(1) In this section “the relevant subsections” means subsections (1) and (2) of section 28 of the Electoral Act, 1923.
(2) The relevant subsections, as applying in relation to the Dáil election, shall apply to any person to whom the relevant subsections apply in relation to the local elections by virtue of section 39 of the Local Government Act, 1941.
(3) The relevant subsections, as applying in relation to the local elections by virtue of section 39 of the Local Government Act, 1941, shall apply to any person to whom the relevant subsections apply in relation to the Dáil election.
Agents.
13.—(1) A person appointed in relation to the Dáil election under section 22 of the Prevention of Electoral Abuses Act, 1923, as a personation agent may attend at the polling station to which he was appointed notwithstanding that that station is also used for the purposes of any of the local elections.
(2) A person appointed in relation to any of the local elections under section 22 of the Prevention of Electoral Abuses Act, 1923, as applied by section 39 of the Local Government Act, 1941, as a personation agent may attend at the polling station to which he was appointed notwithstanding that that polling station is also used for the purposes of the Dáil election.
(3) A person appointed in relation to the Dáil election under Rule 29 of the Rules contained in the Fifth Schedule to the Electoral Act, 1923, as an agent to attend the counting of the votes may attend the counting of the votes at the local elections.
(4) A person appointed in relation to any of the local elections under Rule 28 of the Rules contained in the Fifth Schedule to the Local Elections Order, 1942, as an agent to attend the counting of votes may attend the counting of votes at the Dáil election.
(5) A person appointed in relation to the Dáil election under section 30 of the Prevention of Electoral Abuses Act, 1923, as a sub-agent may attend at any polling station used at the Dáil election notwithstanding that that station is also used for the purposes of any of the local elections.
(6) In applying Rule 49 of the Rules contained in the Fifth Schedule to the Electoral Act, 1923, in relation to the Dáil election, the words “in pursuance of this Act” shall be disregarded.
(7) In applying Rule 48 of the Rules contained in the Fifth Schedule to the Local Elections Order, 1942, in relation to any of the local elections, the words “in pursuance of this Act” shall be disregarded.
Directions.
14.—The Minister may by directions provide for such matters as he considers it necessary or expedient to provide for in order to give effect to the provisions of this Part of this Act and may, in particular, by any such directions—
(a) define the powers and duties of the returning officer at the Dáil election in relation to that election and the local elections, and of other persons employed in connection with polls at those elections;
(b) make such modifications in the Electoral Acts, 1923 to 1959, and the Local Election Acts, 1927 and 1953, as appear to him to be necessary to enable the Dáil election and the local elections to take place in accordance with this Part of this Act or to facilitate or expedite the completion and ascertainment of the results of those elections;
(c) provide that the ballot papers to be used at the Dáil election shall be distinguishable from those to be used at the local elections;
(d) provide for the use of the same or separate ballot boxes at a polling station in connection with the Dáil election and any of the local elections.
General provision with respect to the effect of Part II.
15.—The provisions of this Part of this Act shall have effect notwithstanding anything contained in any other Act or in any order, regulation or other instrument made under any other Act.
