2.—(1) Ní bheidh sé dleathach do dhuine ar bith, i rith na tréimhse idir an 1adh lá de Mhárta agus an 31adh lá d'Iúl agus an dá lá san d'áireamh (dá ngairmtear an t-am coiscthe san Acht so) in aon bhliain—

(a) éan fiadhain ar bith do lámhach ná tabhairt fé n-a lámhach go feasach agus go toiliúil, ná

[EN]

(b) bád ar bith d'úsáid chun éan fiadhain ar bith do lámhach no chun a chur fé ndeár é do lámhach, ná

(c) dol, gaiste, líon, ná gléas eile ar bith d'úsáid chun éan fiadhain ar bith do thógaint ina bheathaidh no do mharbha no chun tabhairt fé n-a thógaint ina bheathaidh no é do mharbha, ná

(d) éan fiadhain ar bith a tógadh ina bheathaidh no a marbhadh le goirid roimhe sin do dhíol ná do thaisbeaint ná do thairisgint chun a dhíolta ná do bheith ar seilbh aige ná fé n-a chúram ach amháin i rith na gcúig lá déag tosaigh den am coiscthe.

(2) Féadfaidh an tAire le hordú ar n-a dhéanamh ar iarratas chomhairle chontae no chontae-bhuirge an t-am coiscthe maidir leis na héanacha fiadhaine uile no le haon tsaghas no saghasanna áirithe éanacha fiadhaine do chur i bhfaid no d'atharú sa chontae no sa chontae-bhuirg sin agus féadfa sé, le hordú ar bith ina dhiaidh sin ar n-a dhéanamh ar iarratas den tsórt chéanna, aon ordú den tsaghas do céad-luadhadh do leasú no do cheiliúra, agus pé uair a déanfar aon ordú den tsaghas do céad-luadhadh léireofar an t-alt so agus beidh éifeacht aige, faid a bheidh an t-ordú san i bhfeidhm, sa chontae no sa chontae-bhuirg agus maidir leis na héanacha fiadhaine le n-a mbaineann an t-ordú san, fé is da mb'é an t-am coiscthe, mar do cuireadh i bhfaid no mar do hatharuíodh leis an ordú san é, do bheadh luaidhte sa chéad fho-alt den alt so in ionad an ama choiscthe atá luaidhte ann.

(3) Féadfaidh an tAire le hordú ar n-a dhéanamh ar iarratas chomhairle chontae no chontae-bhuirge a thoirmeasc, ar réasúin speisialta bheidh luaidhte san iarratas san, go marbhófaí no go dtógfaí sa chontae no sa chontae-bhuirg sin no in aon pháirt no páirteanna áirithe dhi éan fiadhain ar bith no aon tsaghas no saghsanna áirithe éanacha fiadhaine i rith aon tréimhse no tréimhsí áirithe (seachas an t-am coiscthe agus de bhreis air) de gach bliain agus féadfa sé, le hordú ar bith ina dhiaidh sin ar n-a dhéanamh ar iarratas den tsórt chéanna, aon ordú den tsaghas do céad-luadhadh do leasú no do cheiliúra agus pé uair a déanfar aon ordú den tsaghas do céad-luadhadh léireofar an t-alt so agus beidh éifeacht aige, faid a bheidh an t-ordú san i bhfeidhm, sa chontae, sa chontae-bhuirg, no sa líomatáiste eile agus maidir leis na héanacha fiadhaine le n-a mbaineann an t-ordú san, fé is dá ndeintí an tréimhse no na tréimhsí a luaidhtear san ordú san do luadh sa chéad fho-alt den alt so mar chuid den am choiscthe no mar bhreis no mar bhreiseanna ar an am coiscthe a luaidhtear ann.

(4) Gach duine dhéanfaidh aon ghníomh no ní contrárdha don alt so beidh sé (mara gceaduítear an gníomh no an ní sin de thurus na huaire le hordú fén Acht so) ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear, más rud é agus sa mhéid gur i dtaobh éin fhiadhain ar bith dá luaidhtear sa Chéad Sceideal a ghabhann leis an Acht so do deineadh an cionta, fíneáil ná raghaidh thar púnt do chur air in aghaidh gach éin fhiadhain den tsórt san gur ina thaobh a deineadh an cionta agus más rud é agus sa mhéid gur i dtaobh éanacha fiadhaine ná luaidhtear sa Chéad Sceideal a ghabhann leis an Acht so do deineadh an cionta dlighfear é d'imdhearga agus do scaoile chun siúil ar íoc na gcostas do, má sé an chéad chionta aige é, agus má sé an dara cionta aige é no aon chionta ina dhiaidh sin dlighfear pionós ná raghaidh thar deich scillinge do chur air in aghaidh gach éin fhiadhain den tsórt san gur ina thaobh do deineadh an cionta.

(5) Féadfaidh an tAire le hordú ar n-a dhéanamh ar iarratas chomhairle chontae no chontae-bhuirge a dhearbhú go mbainfidh an t-alt so, laistigh den chontae no den chontae-bhuirg sin no d'aon pháirt no páirteanna áirithe dhi, maidir le haon tsaghas áirithe éanacha fiadhaine ná luaidhtear sa Chéad Sceideal a ghabhann leis an Acht so fé is dá luaidhtí an saghas san éanacha fiadhaine sa Sceideal san, agus nuair a déanfar aon ordú den tsórt san léireofar an t-alt so agus beidh éifeacht aige do réir téarmaí an orduithe sin.

(6) Ní bhainfidh an t-alt so le húnaer ná le sealbhaire aon talmhan ná le héinne go n-údarás uaidh maidir le héanacha fiadhaine ar bith ná luaidhtear sa Chéad Sceideal a ghabhann leis an Acht so do thógaint ina mbeathaidh no do mharbha ar an talamh san.

(7) Duine 'na gcuirfear ina leith éan fiadhain do marbhadh le goirid roimhe sin do dhíol no do thaisbeáint no do thairisgint chun a dhíolta no do bheith ar seilbh aige no fé n-a chúram contrárdha don alt so beidh sé ina leor-chosaint do a chruthú—

(a) gur marbhadh an t-éan fiadhain sin i Saorstát Éireann agus go raibh a mharbha dleathach an uair do rinneadh é agus don duine do rinne é, no

(b) gur marbhadh an t-éan fiadhain sin lasmuich de Shaorstát Éireann, agus má deintear an chosaint seo beidh iomportáil an éin fhiadhain isteach i Saorstát Éireann tar éis bháis do ina fhianaise, go dtí go gcruthófar a mhalairt, ar an éan do mharbha lasmuich de Shaorstát Éireann.

Ceadanna speisialta chun éanacha fiadhaine do thógaint no do mharbha.

3.—(1) Féadfaidh an tAire, le hordú ar n-a dhéanamh ar iarratas chomhairle chontae no chontae-bhuirge, a cheadú, ar réasúin speisialta bheidh luaidhte san iarratas san, go ndéanfaí aon tsaghas áirithe éanacha fiadhaine do thógaint ina mbeathaidh no do mharbha no iad do thógaint ina mbeathaidh agus do mharbha sa chontae no sa chontae-bhuirg sin no in aon pháirt no páirteanna áirithe dhi gach bliain no aon bhliain no blianta áirithe i rith na tréimhse go léir no i rith aon choda áirithe den tréimhse gurb é an t-am coiscthe é, de bhua an Achta so no de bhua ordú do rinneadh fén Acht so, don tsaghas san éanacha fiadhaine sa chontae no sa chontae-bhuirg sin no sa pháirt no sna páirteanna áirithe sin di, agus féadfa sé, le hordú ar bith ina dhiaidh sin ar n-a dhéanamh ar iarratas den tsórt chéanna, aon ordú den tsaghas san do céad-luadhadh do cheiliúra no do leasú.

(2) Féadfaidh an tAire, le hordú ar n-a dhéanamh ar iarratas an Aire Tailte agus Iascaigh, a cheadú, chun iascach do chaomhaint, go ndéanfaí aon tsaghas áirithe éanacha fiadhaine do thógaint ina mbeathaidh no do mharba no iad do thógaint ina mbeathaidh agus do mharbha in aon cheanntar áirithe iascaigh no in aon pháirt no páirteanna áirithe dhe gach bliain no aon bhliain no blianta áirithe i rith na tréimhse go léir no i rith aon choda áirithe den tréimhse gurb é an t-am coiscthe é, de bhua an Achta so no de bhua ordú do rinneadh fén Acht so, don tsaghas san éanacha fiadhaine sa cheanntar iascaigh sin no sa pháirt no sna páirteanna áirithe sin de agus féadfa sé, le ordú ar bith ina dhiaidh sin ar n-a dhéanamh ar iarratas den tsórt chéanna, aon ordú den tsaghas san do céad-luadhadh do cheiliúra no do leasú.

4.—Gach duine dhéanfaidh éinní acu so leanas, sé sin le rá:—

(b) éan beo ar bith d'úsáid mar bhréagán agus é ceangailte no é feistithe le cuibhreacha no aon fhearaistí eile den tsórt san i slí go ngortófaí é no é dall no ciothramach no gortuithe, no

(c) glaedh glas no substaint ar bith den tsórt san d'úsáid chun éan fiadhain ar bith do thógaint no breith air ina bheathaidh, no chun tabhairt fé san do dhéanamh, no

(d) éan fiadhain ar bith do thógaint no tabhairt fé n-a thógaint le dubhán no le gléas eile den tsórt san,

beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós ná raghaidh thar cúig púint do chur air no más rogha leis an gCúirt é príosúntacht ar feadh aon téarma nách sia ná ceithre lá déag.

Dolaí ar chuaillí, ar chrainn no ar chairn.

5.—Gach duine dhéanfaidh aon dol preabach, gaiste, no gléas eile den tsórt san is dócha do dhéanfadh díobháil d'éan fiadhain ar bith do theangmhódh leis do ghreamú no do shuidheamh no do chur ar inneall ar aon chuaille, crann, no carn cré no cloch, agus gach duine a cheadóidh no a fhuilingeoidh no a chuirfidh fé ndeár go feasach aon dol preabach, gaiste, no gléas eile den tsórt san do ghreamú no do shuidheamh no do chur ar inneall amhlaidh beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós ná raghaidh thar dachad scilling do chur air má sé an chéad chionta aige é, agus pionós ná raghaidh thar cúig púint má sé an dara cionta aige é no aon chionta ina dhiaidh sin.

Toirmeasc ar éanacha do chimeád i gcásaí ró-chumhanga.

6.—(1) Duine ar bith a chimeádfaidh no a choinneoidh éan in aon chás no cimeádán eile ná beidh árd agus fada agus leathan a dhóthain chun leigint don éan san a sciatháin do shíne agus léimt timpeall go saoráideach beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós ná raghaidh thar cúig púint do chur air.

(2) Ní bhainfidh an t-alt so le héanlaithe clóis do réir bhrí an Poultry Act, 1911, ná le héan ar bith a cimeádfar no a coinneofar i gcás no i gcimeádán eile—

(a) le linn a iompartha ar tír no ar uisce, no

[EN]

(b) le linn a thaisbeánta chun críche taisbeántais no comórtais phuiblí maran sia ná dhá uair seachtód a chluig ar fad an t-am a cimeádfar no a coinneofar mar sin é chun a thaisbeánta amhlaidh.

Toirmeasc ar uibheacha do thógaint no do dhíthiú.

7.—(1) Féadfaidh an tAire, le hordú ar n-a dhéanamh ar iarratas chomhairle chontae no chontae-bhuirge, a thoirmeasc ar réasúin a bheidh luaidhte san iarratas san go dtógfaí no go ndítheofaí, go generálta no aon bhliain no blianta áirithe, sa chontae no sa chontae-bhuirg sin no in aon pháirt no páirteanna áirithe dhi uibheacha éin fhiadhain ar bith no uibheacha aon tsaghas no saghsanna áirithe éanacha fiadhaine, agus féadfaidh an tAire, le hordú ar bith ina dhiaidh sin ar n-a dhéanamh ar iarratas den tsórt chéanna, aon ordú den tsaghas san do céadluadhadh do cheiliúra no do leasú.

(2) D'ainneoin go n-athghairmtear an Wild Birds Protection Act, 1894, leis an Acht so, gach ordú do rinneadh fén Acht san agus do bhí i bhfeidhm díreach roimh an Acht so do rith fanfa sé i bhfeidhm agus féadfar a leasú no a cheiliúra ar gach slí díreach fé is dá mba fén alt so a déanfaí é.

(3) Gach duine a dhéanfaidh ubh ar bith do thógaint no do dhíthiú no a ghríosóidh éinne eile chun ubh ar bith do thógaint no do dhíthiú contrárdha d'ordú a déanfar fén alt so no a buanuítear leis an alt so agus a bheidh i bhfeidhm de thurus na huaire beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear pionós ná raghaidh thar púnt do chur air in aghaidh gach uibh den tsórt san do tógadh no do díthíodh amhlaidh.

8.—Gach duine dhéanfaidh éan fiadhain beo ar bith d'aon tsaghas éanacha fiadhaine dá luaidhtear sa Dara Sceideal a ghabhann leis an Acht so d'easportáil no tabhairt fé n-a easportáil no a chuirfidh fé ndeár go n-easportálfar é no go dtabharfar fé n-a easportáil amach as Saorstát Éireann chun a dhíolta beidh sé ciontach i gcionta fén alt so agus ar a chiontú ann ar an slí achmair dlighfear, má sé an chéad chionta aige é, pionós ná raghaidh thar deich scillinge do chur air in aghaidh gach éin fé leith gur ina thaobh a rinneadh an cionta agus má sé an dara cionta aige é no aon chionta ina dhiaidh sin pionós ná raghaidh thar dhá phúnt in aghaidh gach éin fé leith gur ina thaobh a rinneadh an cionta no, in ionad no i dteanta an phionóis dheiridh sin a luaidhtear, príosúntacht ar feadh téarma ar bith nách sia ná ceithre lá déag.

Féadfaidh an chúirt geallbhruide d'ordú.

9.—Nuair a ciontófar duine ar bith i gcionta fén Acht so féadfaidh an chúirt a ordú, mar bhreis ar aon phionós a cuirfear ar an duine sin, go ndéanfar aon dol, líon, gaiste, no éan bréagtha no aon éan fiadhain no aon ubh éin fhiadhain gur ina thaobh a rinneadh an cionta do gheallbhruide agus do chur de láimh fé mar ordóidh an chúirt.

Orduithe d'fhoillsiú.

10.—(1) Gach ordú a dhéanfaidh an tAire fén Acht so foillseofar é san Iris Oifigiúil agus beidh cóip den Iris Oifigiúil ina mbeidh ordú ar bith den tsórt san ina fhianaise ar an ordú san do dhéanamh agus ar a mbeidh ann.

(2) Gach comhairle chontae no chontae-bhuirge go mbeidh i bhfeidhm inti no in aon pháirt di de thurus na huaire ordú ar bith do rinneadh fén Acht so no a buanuítear leis an Acht so (seachas ordú do rinneadh ar iarratas an Aire Tailte agus Iascaigh) bhéarfaidh fógra puiblí gach bliain i dtaobh an orduithe sin i rith na dtrí seachtain roimh thosach na tréimhse den bhliain ina mbeidh an t-ordú san i ngníomh.

(3) Gach fógra puiblí is gá do thabhairt do réir an ailt seo bhéarfar é—

(a) más fógra é i dtaobh ordú bhaineann le hiomlán na contae no na contae-bhuirge, tríd an ordú san d'fhógairt i dhá bpáipéar nuachta léightear sa chontae no sa chontae-bhuirg sin agus a foillsítear i Saorstát Éireann;

(b) más fógra é i dtaobh ordú ná baineann ach le páirt den chontae no den chontae-bhuirg, tríd an ordú san d'fhógairt i dhá bpáipéar nuachta léightear sa pháirt sin no in aice leis an bpáirt sin den chontae no den chontae-bhuirg sin agus a foillsítear i Saorstát Éireann agus tré fhógraí i dtaobh an orduithe sin do chur suas in áiteanna so-fheicsithe sa pháirt sin no in aice leis an bpáirt sin;

(c) i ngach cás, i pé slí eile a mheasfaidh an chomhairle do bheith oiriúnach no a ordóidh an tAire d'fhonn an t-ordú do chur in úil don phuiblíocht.

(4) Féadfaidh an tAire Tailte agus Iascaigh pé fógra puiblí (más ann do) is oiriúnach leis do thabhairt no a chur fé ndeár é do thabhairt i dtaobh ordú ar bith a déanfar fén Acht so ar iarratas uaidh.

Orduithe le leaga fé bhráid gach Tighe den Oireachtas.

11.—Gach ordú dhéanfaidh an tAire fén Acht so leagfar é fé bhráid gach Tighe den Oireachtas chó luath agus is féidir é tar éis a dhéanta agus má dheineann ceachtar Tigh acu san, laistigh den lá is fiche shuidhfidh an Tigh sin ina dhiaidh sin, rún do rith ag cur an orduithe sin ar nea-mbrí beidh an t-ordú san curtha ar nea-mbrí dá réir sin ach beidh san gan dochar do dhleathacht éinní do rinneadh roimhe sin fén ordú san.

Costaisí.

12.—(1) Is amach as airgead a sholáthróidh an tOireachtas, sa mhéid go gceadóidh an tAire Airgid é, a híocfar costaisí ar bith fé n-a raghaidh an tAire no an tAire Tailte agus Iascaigh ag cur an Achta so in éifeacht.

(2) Is tré ráta na mbocht a cruinneofar costaisí ar bith fé n-a raghaidh comhairle chontae-bhuirge ag cur an Achta so in éifeacht agus, i gcás contae, is mar mhuirear ar an gcontae go hiomlán a déanfar san.

Athghairm.

13.—(1) Athghairmtear leis seo na hAchtanna a luaidhtear sa Treas Sceideal a ghabhann leis an Acht so.

(2) Gach ordú do rinneadh fé Acht ar bith a hathghairmtear leis an Acht so agus do bhí i bhfeidhm díreach roimh an Acht so do rith, más rud é agus sa mhéid go leathnuíonn no go srianann sé foráil d'aon Acht athghairmthe den tsórt san no go gcuireann sé léi agus go bhféadfadh an tAire é dhéanamh fén Acht so maidir leis an bhforáil chó-réire den Acht so fanfa sé i bhfeidhm agus beidh éifeacht aige agus féadfar a leasú no a cheiliúra ar gach slí díreach fé is dá ndeineadh an tAire é fén Acht so maidir leis an bhforáil chó-réire sin den Acht so.

Definition of terms.

1.—In this Act—

the expression “the Minister” means the Minister for Justice;

the expression “wild birds” means and includes all wild birds, other than game birds within the meaning of the Game Preservation Act, 1930.

The close time for wild birds.

2.—(1) It shall not be lawful for any person during the period between the 1st day of March and the 31st day of July, both days inclusive (in this Act referred to as the close time) in any year—

(a) knowingly and wilfully to shoot or attempt to shoot any wild bird, or

[GA]

(b) to use any boat for the purpose of shooting or causing to be shot any wild bird, or

[GA]

(c) to use any trap, snare, net, or any other instrument for the purpose of taking alive or killing or attempting to take alive or kill any wild bird, or

[GA]

(d) except during the first fifteen days of the close time, to sell or expose or offer for sale or have in his possession or control any wild bird recently taken alive or killed.

[GA]

(2) The Minister may by order made on the application of the council of a county or a county borough extend or vary in such county or county borough the close time in respect of all wild birds or any particular kinds or kind of wild birds and may by any subsequent order made on the like application amend or revoke any such first-mentioned order, and whenever any such first-mentioned order is made this section shall, while such order remains in force, be construed and have effect in the county or county borough and in respect of the wild birds to which such order relates as if the close time as extended or varied by such order were mentioned in the first sub-section of this section in lieu of the close time actually mentioned therein.

(3) The Minister may by order made on the application of the council of a county or a county borough prohibit, for special reasons stated in such application, the killing or taking in such county or county borough or any particular parts or part thereof of all wild birds or any particular kinds or kind of wild birds during any particular period or periods (other than and in addition to the close time) of every year and may by any subsequent order made on the like application amend or revoke any such first-mentioned order, and whenever any such first-mentioned order is made this section shall, while such order remains in force, be construed and have effect in the county, county borough, or other area and in respect of the wild birds to which such order relates as if the period or periods mentioned in such order were mentioned in the first sub-section of this section as part of or an addition or additions to the close time actually mentioned therein.

(4) Every person who shall do any act or thing in contravention of this section shall (unless such act or thing is for the time being permitted by an order under this Act) be guilty of an offence under this section and on summary conviction thereof shall, if and so far as the offence was committed in respect of any of the wild birds mentioned in the First Schedule to this Act, be liable to a penalty not exceeding one pound for every such wild bird in respect of which the offence was committed and, if and so far as the offence was committed in respect of wild birds not mentioned in the First Schedule to this Act, be liable in the case of a first offence to be reprimanded and discharged on payment of costs and in the case of a second or any subsequent offence to a penalty not exceeding ten shillings for every such wild bird in respect of which the offence was committed.

(5) The Minister may by order made on the application of the council of a county or a county borough declare that this section shall apply within such county or county borough or any particular part or parts thereof in respect of any particular kind of wild bird not mentioned in the First Schedule to this Act as if that kind of wild bird were mentioned in that Schedule, and on the making of any such order this section shall be construed and have effect in accordance with the terms of such order.

(6) This section shall not apply to the owner or occupier of any land or any person authorised by him taking alive or killing on such land any wild birds not mentioned in the First Schedule to this Act.

[GA]

(7) It shall be a good defence to a charge of selling or exposing or offering for sale or having possession or control in contravention of this section of a wild bird recently killed to prove either—

[GA]

(a) that such wild bird was killed in Saorstát Eireann and that the killing thereof was lawful at the time at which and by the person by whom it was done, or

[GA]

(b) that such wild bird was killed outside Saorstát Eireann, and where this defence is made the fact that the wild bird was imported after death into Saorstát Eireann shall be evidence until the contrary is proved that it was killed outside Saorstát Eireann.

Special permissions to take or kill wild birds.

3.—(1) The Minister may by order made on the application of the council of a county or a county borough permit, for special reasons stated in such application, the taking alive or the killing or both the taking alive and the killing in such county or county borough or any particular part or parts thereof of any particular kind of wild birds in every year or any particular years or year during the whole or any particular part of the period which is by virtue of this Act or an order made under this Act the close time for that kind of wild birds in such county or county borough or such particular part or parts thereof, and may by any subsequent order made on the like application revoke or amend any such first-mentioned order.

(2) The Minister may by order made on the application of the Minister for Lands and Fisheries permit, for the purpose of protecting fisheries, the taking alive or the killing or both the taking alive and the killing in any particular fishery district or any particular part or parts thereof any particular kind of wild birds in every year or any particular years or year during the whole or any particular part of the period which is by virtue of this Act or an order made under this Act the close time for that kind of wild birds in such fishery district or such particular part or parts thereof and may by any subsequent order made on the like application revoke or amend any such first-mentioned order.

Prohibition of the use of live decoy birds, birdlime, &c.

4.—Every person who shall do any of the following things, that is to say:—

(a) use as a scarecrow any live bird which is tethered, or

[GA]

(b) use as a decoy any live bird which is so tethered or is so secured by means of braces or other similar appliances as to cause suffering, or which is blind, maimed or injured, or

[GA]

(c) use bird-lime or any substance of a like nature for the purpose of taking or capturing alive or attempting to take or capture alive any wild bird, or

[GA]

(d) take or attempt to take any wild bird by means of a hook or other similar instrument,

[GA]

shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a penalty not exceeding five pounds or at the discretion of the Court to be imprisoned for any term not exceeding fourteen days.

[GA]

Traps on poles, trees or cairns.

5.—Every person who, on any pole, tree, or cairn of earth or stones, shall affix, place or set any spring-trap, gin, or other similar instrument calculated to cause injury to any wild bird coming in contact therewith and every person who shall knowingly permit or suffer or cause any such spring-trap, gin, or other instrument to be so affixed, placed or set shall be guilty of an offence under this section and shall be liable on summary conviction thereof, in the case of a first offence, to a penalty not exceeding forty shillings and, in the case of a second or subsequent offence, to a penalty not exceeding five pounds.

Prohibition of keeping birds in confined cages.

6.—(1) Any person who shall keep or confine a bird in any cage or other receptacle which shall not measure sufficient in height, length, and breadth to permit such bird freely to stretch its wings and exercise itself shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a penalty not exceeding five pounds.

(2) This section shall not apply to poultry within the meaning of the Poultry Act, 1911, or to any bird kept or contained in a cage or other receptacle—

(a) while being conveyed by land or water, or

[GA]

(b) while being shown for the purpose of public exhibition or competition, if the time during which it is so kept or confined for the purpose of being so shown does not in the whole exceed seventy-two hours.

Prohibition of taking or destroying eggs.

7.—(1) The Minister may by order made on the application of the council of a county or a county borough prohibit, for reasons stated in such application, the taking or destroying either generally or in any particular years or year in such county or county borough or any particular parts or part thereof of the eggs of any wild bird whatsoever or any particular kinds or kind of wild bird, and the Minister may by any subsequent order made on the like application revoke or amend any such first-mentioned order.

(2) Every order made under the Wild Birds Protection Act, 1894, and in force immediately before the passing of this Act, shall, notwithstanding the repeal of that Act by this Act, continue in force and be capable of amendment or revocation in like manner in all respects as if it had been made under this section.

(3) Every person who shall take or destroy or incite any other person to take or destroy any egg in contravention of an order made under or continued by this section and for the time being in force shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a penalty not exceeding one pound for every such egg so taken or destroyed.

Prohibition of export of wild birds.

8.—Every person who shall export, or attempt to export, or cause to be exported or attempted to be exported, from Saorstát Eireann for the purpose of sale any live wild bird of any of the kinds of wild birds specified in the Second Schedule to this Act shall be guilty of an offence under this section, and shall be liable on summary conviction thereof, in the case of a first offence to a penalty not exceeding ten shillings for each bird in respect of which the offence was committed and, in the case of a second or subsequent offence to a penalty not exceeding two pounds for each bird in respect of which the offence was committed or alternatively or in addition to such last mentioned penalty to be imprisoned for any term not exceeding fourteen days.

Court may order forfeiture.

9.—When any person is convicted of an offence under this Act the court may, in addition to any penalty that may be imposed, order any trap, net, snare, or decoy bird or any wild bird or any wild bird's egg in respect of which the offence was committed to be forfeited and disposed of as the court may direct.

Publication of orders.

10.—(1) Every order made by the Minister under this Act shall be published in the Iris Oifigiúil and a copy of the Iris Oifigiúil containing any such order shall be evidence of the same having been made and of the contents thereof.

(2) Every council of a county or county borough in which or in any part of which any order made under or continued by this Act (other than an order made on the application of the Minister for Lands and Fisheries) is for the time being in force shall, in every year, give public notice of such order during the three weeks preceding the commencement of the period of the year during which such order operates.

[GA]

(3) Every public notice required by this section to be given shall be given—

[GA]

(a) in the case of a notice relating to an order applying to the whole of the county or county borough, by advertising such order in two newspapers circulating in such county or county borough and published in Saorstát Eireann;

[GA]

(b) in the case of a notice relating to an order applying to part only of the county or county borough, by advertising such order in two newspapers circulating in or near such part of such county or county borough and published in Saorstát Eireann and fixing notices of such order in conspicuous places in or near such part;

[GA]

(c) in every case, in such other manner as the council shall think expedient or the Minister shall direct with a view to making the order known to the public.

[GA]

(4) The Minister for Lands and Fisheries may give or cause to be given such (if any) public notice of any order made under this Act upon his application as he may think fit.

[GA]

Orders to be laid before each House of the Oireachtas.

11.—Every order made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made, and if a resolution is passed by either such House within the next subsequent twenty-one days on which that House has sat annulling such order, such order shall be annulled accordingly, but without prejudice to the validity of anything previously done under such order.

Expenses.

12.—(1) Any expenses incurred by the Minister or by the Minister for Lands and Fisheries in carrying this Act into effect shall, to such extent as shall be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

(2) Any expenses incurred by the council of a county borough in carrying this Act into effect shall be raised by means of the poor-rate and, in the case of a county, as a county-at-large charge.

Repeals.

13.—(1) The Acts mentioned in the Third Schedule to this Act are hereby repealed.

(2) Every order made under any Act repealed by this Act and in force immediately before the passing of this Act shall, if and so far as it extends, restricts, or adds to a provision of any such repealed Act and could be made by the Minister under this Act in respect of the corresponding provision of this Act, continue in force and have effect and be capable of being amended or revoked in like manner in all respects as if it had been made by the Minister under this Act in respect of the said corresponding provision of this Act.

Short title.

14.—This Act may be cited as the Wild Birds Protection Act, 1930.
