An Príomh-Acht agus Acht 1940.
1.—San Acht so—
cialluíonn an abairt “an Príomh-Acht” an tAcht um Thoghacháin Áitiúla, 1937 (Uimh. 14 de 1937), agus cialluíonn an abairt “Acht 1940” an tAcht um Thoghacháin Áitiúla (Leasú), 1940.
Leiriú agus mínithe.
2.—(1) Déanfar an tAcht so agus an Príomh-Acht maraon le hAcht 1940 do léigheamh agus do léiriú mar éinní amháin.
(2) San Acht so cialluíonn an abairt “an tAire” an tAire Riaghaltas Aiteamhail agus Sláinte Poiblidhe.
(3) Beidh gach cólucht is údarás áitiúil chun crícheanna Coda II den Phríomh-Acht, agus fós (ach sa leasú deintear leis an Acht so ar alt 5 den Phríomh-Acht) comhairle chontae-bhuirge Chorcaighe, ina údarás áitiúil chun crícheanna an Achta so, agus is dá réir sin a léireofar an abairt “údarás áitiúil” san Acht so.

3.—(1) Deintear leis seo alt 5 den Phríomh-Acht, ar n-a leasú le fo-alt (1) d'alt 3 d'Acht 1940, do leasú tré fho-alt (1) den alt san do scriosadh agus tríd an bhfo-alt so leanas do chur san alt san in ionad an fho-ailt a scriostar amhlaidh, sé sin le rá:—
“(1) Déanfaidh an tAire le hordú, roimh an 30adh lá de Mheán Fhómhair, 1942, lá nach déanaighe ná an 30adh lá san de Mheán Fhómhair, 1942, do cheapadh, maidir le gach údarás áitiúil, chun bheith ina lá cheaptha chun crícheanna na Coda so den Acht so alos an údaráis áitiúil sin.”
(2) Déanfar Cuid II den Phríomh-Acht (le n-a n-áirmhítear alt 5 di) do léiriú ag féachaint go cuibhe don leasú dheineann an fo-alt san roimhe seo den alt so ar an alt san 5 agus, chun lánéifeacht do thabhairt don leasú san, déanfar an dáta an 30adh lá de Mheán Fhómhair, 1942, do chur in ionad an dáta an 30adh lá de Mheán Fhómhair, 1941, san áit ina ndeintear de bhuadh fo-ailt (2) d'alt 3 d'Acht 1940, luadh, i bhfo-alt (3) den alt san 5 agus i bhfo-alt (2) d'alt 7 den Phríomh-Acht, ar an dáta san is déanaighe luaidhtear.

4.—(1) Deintear leis seo alt 16 den Phríomh-Acht, ar n-a leasú le fo-alt (1) d'alt 4 d'Acht 1940, do leasú tré fho-alt (1) den alt san do scriosadh agus tríd an bhfo-alt so leanas do chur san alt san in ionad an fho-ailt a scriostar amhlaidh, sé sin le rá:—
“(1) Déanfaidh an tAire le hordú, roimh an 30adh lá de Mheán Fhómhair, 1942, lá nach déanaighe ná an 30adh lá san de Mheán Fhómhair, 1942, do cheapadh chun bheith ina lá cheaptha chun crícheanna na Coda so den Acht so alos na Comhairle.”
(2) Déanfar Cuid III den Phríomh-Acht (le n-a n-áirmhítear alt 16 di) do léiriú ag féachaint go cuibhe don leasú dheineann an fo-alt san roimhe seo den alt so ar an alt san 16.
Forálacha speisialta maidir leis an mbliain 1941.
5.—(1) Maidir le halt 8 no 9 no 10 (do réir mar bheidh) den Acht um Thoghacháin Áitiúla, 1927 (Uimh. 39 de 1927), agus le halt 11 den Acht san, do bhaint le haon údarás áitiúil áirithe, beidh an bhliain 1941, agus is tuigthe í bheith riamh, ina bliain ná comórfar aon toghachán cinn trí mblian chun daoine do thoghadh chun an údaráis áitiúil sin.
(2) I gcás an lá ceaptha maidir le húdarás áitiúil chun crícheanna Coda II den Phríomh-Acht ar n-a leasú leis an Acht so no Coda III den Phríomh-Acht ar n-a leasú leis an Acht so (do réir mar a bheidh) do thuitim sa bhliain 1941:—
(a) déanfar an tagairt atá sa bhfo-alt san roimhe seo don bhliain 1941 do léiriú, maidir leis an údarás áitiúil sin, mar thagairt don chuid den bhliain sin a thagann roimh an lá ceaptha san, agus
(b) maidir le halt 8 no 9 no 10 (do réir mar a bheidh) den Acht um Thoghacháin Áitiúla, 1927 (Uimh. 39 de 1927), agus le halt 11 den Acht san, do bhaint leis an údarás áitiúil sin, is tuigthe an chuid eile den bhliain 1941 do bheith ina bliain ina gcomórfar toghachán cinn trí mblian.
Comhacht chun deacrachtaí do réiteach.
6.—Má eirigh no más deallrathach dar leis an Aire go n-eireoidh aon deacracht, maidir le cruinniú ar bith d'aon údarás áitiúil no d'aon chólucht eile do chomóradh, de bhíthin aon leasuithe dheineann an tAcht so ar an bPríomh-Acht no de bhíthin aon fhorála eile den Acht so, féadfaidh an tAire, le hordú, aon ní no rud do dhéanamh a chífear dó do bheith riachtanach chun gur féidir an cruinniú san do chomóradh no chun an údaráis áitiúil no an chóluchta eile sin do chó-dhéanamh i gceart no chun dleathacht do thabhairt do nós imeachta an údaráis áitiúil no an chóluchta eile sin no chun na deacrachta san do réiteach ar shlí eile (do réir mar a bheidh) agus féadfaidh, leis an ordú san, aon oiriúnuithe no atharuithe is gá do dhéanamh ar aon reacht no ordú no rialachán.

7.—(1) Féadfar an tAcht um Thoghacháin Áitiúla (Leasú), 1941, do ghairm den Acht so.

LOCAL ELECTIONS (AMENDMENT) ACT, 1941.
The Principal Act and the Act of 1940.
1.— In this Act—
the expression “the Principal Act” means the Local Elections Act, 1937 (No. 14 of 1937), and the expression “the Act of 1940” means the Local Elections (Amendment) Act, 1940.
Construction and definitions.
2.—(1) This Act shall be read and construed as one with the Principal Act and the Act of 1940.
(2) In this Act the expression “the Minister” means the Minister for Local Government and Public Health.
(3) Every body which is a local authority for the purposes of Part II. of the Principal Act and also (except in the amendment made by this Act of section 5 of the Principal Act) the council of the county borough of Cork shall be a local authority for the purposes of this Act, and the expression “local authority” shall be construed accordingly in this Act.
Amendment of sections 5 and 7 of the Principal Act.
3.—(1) Section 5 of the Principal Act, as amended by sub-section (1) of section 3 of the Act of 1940, is hereby amended by the deletion of sub-section (1) of that section and the insertion in the said section of the following sub-section in lieu of the sub-section so deleted, that is to say:—
“(1) The Minister shall, before the 30th day of September, 1942, by order appoint in respect of every local authority a day not later than the 30th day of September, 1942, to be the appointed said day for the purposes of this Part of this Act in respect of such local authority.”
(2) Part II of the Principal Act (including section 5 thereof) shall be construed with due regard to the amendment made in the said section 5 by the foregoing sub-section of this section and, for the purpose of giving full effect to that amendment, the date the 30th day of September, 1942, shall be substituted for the date the 30th day of September, 1941, where the latter date is, by virtue of sub-section (2) of section 3 of the Act of 1940, mentioned in sub-section (3) of the said section 5 and in sub-section (2) of section 7 of the Principal Act.
Amendment of Section 16 of the Principal Act.
4.—(1) Section 16 of the Principal Act, as amended by sub-section (1) of section 4 of the Act of 1940, is hereby amended by the deletion of sub-section (1) of that section and the insertion in the said section of the following sub-section in lieu of the sub-section so deleted, that is to say:—
“(1) The Minister shall, before the 30th day of September, 1942, by order appoint a day not later than the said 30th day of September, 1942, to be the appointed day for the purposes of this Part of this Act in respect of the Council.”
(2) Part III of the Principal Act (including section 16 thereof) shall be construed with due regard to the amendment made in the said section 16 by the foregoing sub-section of this section.
Special provisions in relation to the year 1941
5.—(1) In the application in relation to any local authority of section 8, 9 or 10 (as the case may be) of the Local Elections Act, 1927 (No. 39 of 1927), and of section 11 of that Act, the year 1941 shall be and shall be deemed always to have been a year in which no triennial election to such local authority is held.
(2) Where the appointed day in relation to a local authority for the purposes of Part II of the Principal Act as amended by this Act or Part III of the Principal Act as amended by this Act (as the case may be) falls in the year 1941:—
(a) the reference in the foregoing sub-section to the year 1941 shall, in relation to such local authority, be construed as a reference to the part of such year prior to the said appointed day, and
(b) for the purposes of the application in relation, to such local authority of section 8, 9 or 10 (as the case may be) of the Local Elections Act, 1927 (No. 39 of 1927), and of section 11 of that Act, the remaining part of the year 1941 shall be deemed to be a year in which a triennial election is held.
Power to resolve difficulties.
6.—Where any difficulty has arisen or is, in the opinion of the Minister, likely to arise in regard to the holding of any meeting of any local authority or other body by reason of any amendment of the Principal Act made by this Act or by reason of any other provision of this Act, the Minister may by order do any matter or thing which shall appear to him to be necessary (as the case may be) to enable such meeting to be held, or to constitute properly such local authority or other body, or to validate the procedure of such local authority or other body, or otherwise to resolve such difficulty, and may by such order make any necessary adaptations or modifications of any statute, order, or regulation.
Short title and collective citation.
7.—(1) This Act may be cited as the Local Elections (Amendment) Act, 1941.
(2) The Principal Act, the Act of 1940, and this Act may be cited together as the Local Elections Acts, 1937 to 1941.
