AN tACHT RIALTAIS ÁITIÚIL (FOIRGNIMH ILSTÓRACHA), 1988

Léiriú.
1.—(1) San Acht seo—
folaíonn “foirgneamh” a chúirtealáiste;
ciallaíonn “Achtanna na gCuideachtaí” Acht na gCuideachtaí, 1963, agus aon achtachán atá le forléiriú in éineacht leis;
ciallaíonn “duine inniúil”—
(a) i ndáil le struchtúr foirgnimh, innealtóir cairte a bhfuil taithí aige ar struchtúr foirgneamh ilstórach a dhearadh nó a mheas faoi threoir cód cleachtais agus caighdeán iomchuí lena n-áirítear na cóid cleachtais agus na caighdeáin a shonraítear sa Chéad Sceideal a ghabhann leis an Acht seo nó faoi threoir cód cleachtais agus caighdeán comhchineálach a aithnítear i mBallstát eile de na Comhphobail Eorpacha, agus
(b) i ndáil le suiteáil gáis i bhfoirgneamh ilstórach, innealtóir cairte a bhfuil taithí aige ar shuiteálacha gáis le haghaidh foirgneamh a dhearadh nó a mheas faoi threoir cód cleachtais agus caighdeán iomchuí lena n-áirítear, más infheidhme iad, na cóid cleachtais agus na caighdeáin a shonraítear sa Dara Sceideal a ghabhann leis an Acht seo nó faoi threoir cód cleachtais agus caighdeán comhchineálach a aithnítear i mBallstát eile de na Comhphobail Eorpacha, agus
(c) i ndáil le dáileadh gáis i gcomharsanacht foirgnimh ilstóraigh nó i ndáil le seirbhísí gáis a sholáthar isteach chun an chéanna, innealtóir cairte a bhfuil taithí aige ar chórais dáilte gáis agus ar sheirbhísí gáis a dhearadh nó a mheas faoi threoir cód cleachtais agus caighdeán iomchuí lena n-áirítear, más infheidhme iad, na cóid cleachtais agus na caighdeáin a shonraítear sa Dara Sceideal a ghabhann leis an Acht seo nó faoi threoir cód cleachtais agus caighdeán comhchineálach a aithnítear i mBallstát eile de na Comhphobail Eorpacha;
ciallaíonn “gás” gás atá píopaithe nó gás i gcoimeádáin ar mó ná 500 millilítear a dtoilleadh;
ciallaíonn “údarás áitiúil”—
(a) i gcás contae, gan aon bhuirg nó ceantar uirbeach sa chontae sin a áireamh, comhairle an chontae,
(b) i gcás contaebhuirge nó buirge eile, bardas na buirge, agus
(c) i gcás ceantair uirbigh, comhairle an cheantair,
agus forléireofar tagairt do limistéar feidhmiúcháin údaráis áitiúil dá réir sin;
ciallaíonn “foirgneamh ilstórach” foirgneamh arb é atá ann nó a n-áirítear ann cúig stór nó níos mó, agus íoslach á mheas mar stór, agus nach foirgneamh é ar críochnaíodh an tógáil air ar an 1ú lá d'Eanáir, 1950, nó roimhe;
folaíonn “úinéir” i ndáil le foirgneamh ilstórach, léasaí ar an bhfoirgneamh nó ar aon chuid de faoi léas a bhfuil sé dá réir freagrach go hiomlán as deisiúcháin agus cothabháil agus duine a dhéanann, cibé acu ina aonar nó i gcomhar le daoine eile, bainisteoireacht ar an bhfoirgneamh nó, in éagmais aon duine den sórt sin, duine a dhéanann, cibé acu ina aonar nó i gcomhar le daoine eile, bainisteoireacht ar aon chuid den fhoirgneamh;
ciallaíonn “forordaithe” forordaithe le rialacháin;
ciallaíonn “daingne” i ndáil le foirgneamh ilstórach, an tréith sin d'fhoirgneamh a chinntíonn, i gcás go mbaineann aon suaitheadh timpisteach don fhoirgneamh, nach dtiteann an déanmhas oiread is a bheadh ar neamhréir le méid an tsuaite;
ciallaíonn “foirgneamh sonraithe” foirgneamh ilstórach a thógtar go hiomlán nó go páirteach trí urláir choincréite réamhtheilgthe a úsáid nach mbrathann a n-oibriú struchtúrach ar idirghníomhaíocht le coincréit in situ atá i gceangal go meicniúil leis an gcomhábhar réamhtheilgthe trína nascadh le treisiúchán boiriceach nó le fiar-chónascairí agus a fhaigheann tacaíocht ó chabhlacha nó ó phainéil choincréite réamhtheilgthe nó ó bhallaí saoirseachta.
(2) I gcás foirgneamh a bheith suite go páirteach i limistéar feidhmiúcháin údaráis áitiúil amháin agus go páirteach i limistéar feidhmiúcháin údaráis áitiúil eile, measfar, chun críocha an Achta seo, é bheith i limistéir feidhmiúcháin gach údaráis díobh mura ndéanann na húdaráis áitiúla sin, trí chomhaontú eatarthu, údarás amháin díobh a ainmniú chun bheith ina údarás áitiúil maidir leis an bhfoirgneamh. Is é an t-údarás áitiúil a ainmneofar amhlaidh a bheidh ina údarás áitiúil maidir leis an bhfoirgneamh chun críocha an Achta seo, a fhad is a leanfaidh an comhaontú i bhfeidhm.
Dualgais údarás áitiúil.
2.—(1) A luaithe is féidir tar éis thosach feidhme an Achta seo déanfaidh gach údarás áitiúil clár de na foirgnimh ilstóracha go léir ina limistéar feidhmiúcháin a ullmhú agus a chothabháil.
(2) I gcás gach foirgnimh ilstóraigh ar críochnaíodh an tógáil air roimh thosach feidhme an Achta seo déanfaidh an t-údarás áitiúil don limistéar feidhmiúcháin ina bhfuil an foirgneamh suite fógra a sheirbheáil ar dhuine ar dóigh leis an údarás áitiúil gurb úinéir ar an bhfoirgneamh é á cheangal air deimhniú maidir leis an bhfoirgneamh a thabhairt don údarás áitiúil de réir alt 3 den Acht seo.
(3) Ní bheidh feidhm ag fo-alt (2) den alt seo i ndáil le foirgneamh ilstórach ar le húdarás áitiúil é agus atá suite go hiomlán nó go páirteach i limistéar feidhmiúcháin an údaráis áitiúil.
Deimhniú nó dearbhú i ndáil le foirgneamh ilstórach.
3.—(1) Déanfaidh duine ar a seirbheálfaidh údarás áitiúil fógra faoi alt 2 (2) den Acht seo—
(a) deimhniú arna shíniú ag duine inniúil á dheimhniú gur foirgneamh sonraithe nó nach foirgneamh sonraithe an foirgneamh, nó
(b) dearbhú reachtúil arna dhéanamh ag an duine sin á rá nach úinéir ar an bhfoirgneamh é,
a chur faoi bhráid an údaráis áitiúil.
(2) Gach deimhniú a chuirfear faoi bhráid údaráis áitiúil de bhun fho-alt (1) den alt seo agus a bhaineann le foirgneamh sonraithe deimhneofar ann gur mar a leanas don fhoirgneamh i dtuairim an duine inniúil—
(a) gur tógadh an foirgneamh, faoi réir na nósanna imeachta agus na lamháltas a bhaineann le gnáthchleachtas tógála, de réir na gcód cleachtais agus na gcaighdeán iomchuí lena n-áirítear, más infheidhme, na cóid cleachtais agus na caighdeáin a shonraítear sa Chéad Sceideal a ghabhann leis an Acht seo; nó
(b) nach gcuirfear áititheoirí an fhoirgnimh sin ná daoine a thaithíonn é, ná daoine ina chomharsanacht, i mbaol a bhaineann le daingne an fhoirgnimh, ar baol é atá cuid ró-mhór níos mó ná an baol ina mbítear de ghnáth i bhfoirgneamh a tógadh, faoi réir na nósanna imeachta agus na lamháltas a bhaineann le gnáthchleachtas tógála, de réir na gcód cleachtais agus na gcaighdeán iomchuí lena n-áirítear, más infheidhme, na cóid agus na caighdeáin a shonraítear sa Chéad Sceideal a ghabhann leis an Acht seo; nó
(c) go ndearnadh gach beart réasúnach mar atá leagtha amach sa deimhniú (lena n-áirítear, más iomchuí, na bearta a shonraítear sa Tríú Sceideal a ghabhann leis an Acht seo) chun go n-íoslaghdófaí, a mhéid is indéanta é, an baol atá ann damáiste timpisteach a dhéanamh don fhoirgneamh.
Foirgnimh ilstóracha nach raibh críochnaithe roimh thosach feidhme an Achta seo.
4.—(1) I gcás foirgnimh ilstóraigh nach raibh an tógáil air críochnaithe roimh thosach feidhme an Achta seo, beidh sé de dhualgas ar gach duine lena mbaineann an t-alt seo, faoi réir fho-alt (3) den alt seo, deimhniú maidir leis an bhfoirgneamh a chur, de réir alt 3 den Acht seo, faoi bhráid an údaráis áitiúil ar ina limistéar feidhmiúcháin atá an foirgneamh suite, sula n-áitítear an foirgneamh nó aon chuid den fhoirgneamh.
(2) Baineann an t-alt seo—
(a) leis an duine a thógann an foirgneamh, más thar a cheann féin a thógann sé é, agus lena chomharbaí i dteideal;
(b) leis an duine ar thar a cheann a thógtar an foirgneamh agus lena chomharbaí i dteideal.
(3) Is leor mar chomhlíonadh ar fho-alt (1) den alt seo aon duine de na daoine lena mbaineann an t-alt seo do chur deimhniú maidir leis an bhfoirgneamh go léir faoi bhráid an údaráis áitiúil.
Ceanglas deimhniú breise a chur faoi bhráid údaráis áitiúil.
5.—Má dheimhnítear i ndeimhniú a chuirtear faoi bhráid údaráis áitiúil faoi alt 3 (2) (c) den Acht seo go mbeidh cibé beart a bheidh leagtha amach sa deimhniú déanta i ndáil le foirgneamh sonraithe, ní dhéanfar aon bheart i ndáil leis an bhfoirgneamh sin a mbeadh d'éifeacht leis go ndéanfaí an beart a bheidh leagtha amach amhlaidh a chealú mura gcuireann úinéir de chuid an fhoirgnimh shonraithe faoi bhráid an údaráis áitiúil, ar ina limistéar feidhmiúcháin atá an foirgneamh suite, deimhniú breise, arna shíniú ag duine inniúil, á dheimhniú go ndearnadh gach beart réasúnach mar atá leagtha amach sa deimhniú sin chun go n-íoslaghdófaí, a mhéid is indéanta é, an baol atá ann damáiste timpisteach a dhéanamh de bhíthin an beart céadluaite a chealú.
Foirgneamh ilstórach ar le húdarás áitiúil é.
6.—(1) Cuirfidh gach údarás áitiúil ar leis foirgneamh ilstórach atá ina limistéar feidhmiúcháin faoi deara deimhniú a ullmhú agus a shíniú ag duine inniúil á dheimhniú an foirgneamh sonraithe an foirgneamh, nó nach ea.
(2) Beidh feidhm ag forálacha ailt 3 (2) agus 5 den Acht seo maidir le deimhniú faoi fho-alt (1) den alt seo amhail is dá mba dheimhniú é a chuirtear faoi bhráid údaráis áitiúil faoin Acht seo.
Cumhacht dul isteach i bhfoirgneamh le hiniúchadh a dhéanamh agus oibreacha agus bearta a sheoladh.
7.—(1) Chun críocha deimhniú a chur ar fáil faoi alt 3, 4, 5 nó 6 den Acht seo beidh úinéir ar an bhfoirgneamh nó ar aon chuid den fhoirgneamh agus a ghníomhaire i dteideal, tar éis fógra 14 lá a thabhairt d'aon úinéir nó áititheoir eile ar an bhfoirgneamh nó ar aon chuid den fhoirgneamh, dul isteach gach tráth réasúnach san fhoirgneamh, nó sa chuid sin den fhoirgneamh, lena mbaineann an fógra—
(a) chun an foirgneamh nó an chuid sin den fhoirgneamh a iniúchadh d'fhonn na sonraí maidir le struchtúr an fhoirgnimh a shuíomh agus chun aon obair a sheoladh is gá chun na críche sin;
(b) chun oibreacha a sheoladh chun cur le daingne an fhoirgnimh; nó
(c) chun gach beart réasúnach a sheoladh chun go n-íoslaghdófaí, a mhéid is indéanta é, an baol atá ann damáiste timpisteach a dhéanamh don fhoirgneamh.
(2) Is é an t-úinéir nó a ghníomhaire a dhéanfaidh slán aon dochar suaite a bhainfidh don fhoirgneamh ar oibreacha nó bearta de bhun an ailt seo is cúis leis.
(3) Beidh an t-úinéir, nó a ghníomhaire, agus é ag feidhmiú a chumhachtaí faoin alt seo, i dteideal cibé daoine nó cibé trealamh a mheasfaidh sé is gá chun cabhrú leis a thabhairt isteach leis san fhoirgneamh nó sa chuid sin den fhoirgneamh lena mbaineann an fógra agus beidh sé i dteideal aon iniúchadh, obair nó beart a sheoladh is gá chun an deimhniú a sholáthar.
(4) Má tharlaíonn, de thoradh aon iniúchta, oibre nó beart a sheoltar de bhun an ailt seo, go sáraítear aon oibleagáidí conarthacha láithreacha atá ar úinéir nó ar áititheoir ar an bhfoirgneamh, nó ar aon chuid den fhoirgneamh, is cosaint leordhóthanach in aon chaingean i dtaobh foghla nó sáraithe conartha mar gheall ar an iniúchadh, an obair nó an beart sin, go raibh an t-iniúchadh, an obair nó an beart riachtanach chun an deimhniú a chur faoi bhráid an údaráis áitiúil.
Fógraí a sheirbheáil.
8.—(1) I gcás go gceanglaítear leis an Acht seo fógra a sheirbheáil ar dhuine, nó a thabhairt dó, díreofar chuig an duine sin é agus féadfar é a sheirbheáil air, nó a thabhairt dó, ar shlí ar bith díobh seo a leanas—
(a) i gcás go mbeidh an fógra dírithe chuig an duine sin faoina ainm, trína thabhairt dó;
(b) tríd an bhfógra a fhágáil ag an seoladh ag a bhfuil gnáthchónaí ar an duine sin nó, i gcás go mbeidh seoladh le haghaidh seirbheála doiciméad tugtha, ag an seoladh sin;
(c) tríd an bhfógra a chur leis an bpost i litir chláraithe réamhíoctha a bheidh dírithe chuig an duine sin ag an seoladh ag a bhfuil gnáthchónaí air nó, i gcás go mbeidh seoladh le haghaidh seirbheála doiciméad tugtha, ag an seoladh sin;
(d) i gcás nach féidir an seoladh ag a bhfuil gnáthchónaí ar an duine sin a fhionnadh ó fhiosrú réasúnach—
(i) tríd an bhfógra a sheachadadh ar dhuine éigin os cionn sé bliana déag d'aois a bheidh ina chónaí nó fostaithe san fhoirgneamh lena mbaineann an fógra, nó
(ii) tríd an bhfógra a dhaingniú in áit fheiceálach ar an bhfoirgneamh lena mbaineann sé nó gar dó.
(2) I gcás go gceanglaítear leis an Acht seo fógra a sheirbheáil ar úinéir foirgnimh nó a thabhairt dó agus nach féidir ainm an duine sin a fhionnadh ó fhiosrú réasúnach, féadfar an fógra a dhíriú chuig “an t-úinéir” gan é a ainmniú.
(3) Chun críocha an ailt seo, measfar gur ina hoifig chláraithe atá gnáthchónaí ar chuideachta atá cláraithe faoi Achtanna na gCuideachtaí, agus measfar gur ina phríomhoifig nó ina phríomháit ghnó atá gnáthchónaí ar gach comhlacht corpraithe eile agus ar gach comhlacht neamhchorpraithe.
(4) Má sheirbheáiltear fógra ar dhuine, nó má thugtar fógra dó, de bhun fho-alt (1) (d) den alt seo, foilseofar cóip den fhógra, laistigh de dhá sheachtain dá éis sin, i nuachtán amháin ar a laghad a léitear sa limistéar is déanaí inarb eol cónaí a bheith ar an duine.
Fógra faoi alt 2 a chomhlíonadh.
9.—(1) I gcás go seirbheálfaidh údarás áitiúil fógra faoi alt 2 den Acht seo ar bhreis is aon duine amháin maidir le foirgneamh áirithe is leor mar chomhlíonadh ar an alt sin aon duine de na daoine sin, arb úinéir é, do chur deimhniú faoi bhráid an údaráis áitiúil maidir leis an bhfoirgneamh go léir.
(2) Is cosaint leordhóthanach ar ionchúiseamh mar gheall ar mhainneachtain déanamh de réir fógra faoi aon fhoráil den Acht seo, an cosantóir do shuíomh—
(a) nach féidir leis déanamh de réir an fhógra gan comhoibriú ó úinéirí eile ar an bhfoirgneamh nó go mbeadh sé míréasúnach a cheangal air é sin a dhéanamh, agus
(b) gur iarr sé an comhoibriú sin agus nach bhfuair sé é.
Cumhacht faisnéis a éileamh maidir le húinéireacht foirgneamh.
10.—Féadfaidh údarás áitiúil, chun a chur ar a gcumas a fháil amach cé leis aon fhoirgneamh, fógra i scríbhinn a thabhairt d'aon duine is áititheoir ar an bhfoirgneamh lena mbaineann nó ar chuid den fhoirgneamh sin nó a fhaigheann go díreach nó go hindíreach cíos i leith an fhoirgnimh nó cuid den fhoirgneamh, á cheangal ar an duine an méid seo a leanas a chur in iúl faoi cheann cibé tréimhse, nach lú ná 21 lá, a bheidh sonraithe san fhógra i scríbhinn—
(a) cén cineál eastáit nó leasa atá aige féin san fhoirgneamh sin, agus
(b) ainm agus seoladh aon duine eile arb eol dó eastát nó leas a bheith aige san fhoirgneamh nó i gcuid den fhoirgneamh nó arb eol dó gur duine é a dhéanann, cibé acu ina aonar nó i gcomhar le daoine eile, an foirgneamh nó aon chuid de a bhainistí nó a rialú.
Rialacháin.
11.—(1) Féadfaidh an tAire rialacháin a dhéanamh chun críocha an Achta seo.
(2) Gan dochar do ghinearáltacht an méid sin roimhe seo, féadfar socrú a dhéanamh le rialacháin maidir le foirm cláir faoi alt 2 (1) den Acht seo nó foirm aon fhógra nó deimhnithe a bheidh le tabhairt faoi aon fhoráil den Acht seo nó maidir leis an am ar laistigh de a thabharfar aon fhógra nó deimhniú den sórt sin.
(3) Gach rialachán a dhéanfaidh an tAire faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir tar éis a dhéanta agus, má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an rialachán a leagan faoina bhráid, rún a rith ag neamhniú an rialacháin, beidh an rialachán ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoin rialachán.
Cionta.
12.—Aon duine—
(a) a mhainneoidh, gan leithscéal dleathach, deimhniú a cheanglaítear a thabhairt de bhun alt 3 nó 4 den Acht seo a chur faoi bhráid údaráis áitiúil laistigh den am atá forordaithe, nó
(b) a thabharfaidh, go feasach, deimhniú a bheidh bréagach nó míthreorach in aon slí, nó a chuirfidh go feasach deimhniú den sórt sin faoi bhráid údaráis áitiúil, nó
(c) a dhéanfaidh dearbhú reachtúil chun críche alt 3 (1) (b) den Acht seo agus a fhios aige é bheith bréagach nó míthreorach in aon slí, nó
(d) a sháróidh alt 5 den Acht seo, nó
(e) a dhéanfaidh, aon tráth le linn na tréimhse trí mhí tar éis fógra a dhaingniú ar fhoirgneamh nó gar dó de bhun alt 8 (1) (d) (ii) den Acht seo, an fógra a thógáil anuas, a dhamáistiú nó a aghlot gan údarás dleathach, nó
(f) ar údarás áitiúil á cheangal air, trí fhógra i scríbhinn arna thabhairt faoi alt 10 den Acht seo, aon fhaisnéis a thabhairt dóibh, a mhainneoidh an fhaisnéis sin a thabhairt laistigh den tréimhse shonraithe nó a dhéanfaidh go feasach aon ráiteas mícheart maidir leis an bhfaisnéis sin, nó
(g) a dhiúltóidh ligean d'úinéir a mbeidh fógra cuí tugtha aige dó faoi alt 7 den Acht seo, nó do ghníomhaire an úinéara sin, dul isteach san fhoirgneamh nó sa chuid sin den fhoirgneamh lena mbaineann an fógra nó aon duine nó trealamh a thabhairt leis i bhfeidhmiú a chumhachtaí faoin alt sin, nó a chuirfidh cosc nó bac ar an úinéir nó ar a ghníomhaire i bhfeidhmiú na gcumhachtaí sin, nó
(h) a dhiúltóidh nó a mhainneoidh, gan leithscéal dleathach, déanamh de réir iarrata chuige ó aon duine, ar a mbeidh fógra seirbheáilte faoi alt 2 (2) den Acht seo, chun comhoibriú leis an duine sin deimhniú a fháil de réir alt 3 den Acht seo,
beidh an duine sin ciontach i gcion.
Cionta a ionchúiseamh.
13.—Féadfaidh údarás áitiúil cion faoin Acht seo a ionchúiseamh go hachomair.
Pionóis.
14.—(1) Duine a bheidh ciontach i gcion faoi alt 12 (b), (c) nó (d) den Acht seo, dlífear—
(a) ar é a chiontú go hachomair, fíneáil nach mó ná £1,000, nó príosúnacht ar feadh aon téarma nach faide ná 12 mhí nó, de rogha na cúirte, an fhíneáil sin agus an phríosúnacht sin le chéile, a chur air, nó
(b) ar é a chiontú ar díotáil, fíneáil nach mó ná £10,000, nó príosúnacht ar feadh aon téarma nach faide ná trí bliana nó, de rogha na cúirte, an fhíneáil sin agus an phríosúnacht sin le chéile, a chur air.
(2) Duine a bheidh ciontach i gcion faoi aon fhoráil den Acht seo, seachas alt 12 (b), (c) nó (d), dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £1,000 a chur air.
Gearrtheideal agus tosach feidhme.
15.—(1) Féadfar an tAcht Rialtais Áitiúil (Foirgnimh Ilstóracha), 1988, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo i ngníomh ar cibé lá a cheapfaidh an tAire le hordú.

Interpretation.
1.—(1) In this Act—
“building” includes its curtilage;
“the Companies Acts” means the Companies Act, 1963, and any enactment which is to be construed together with it;
“competent person” means—
(a) in relation to the structure of a building, a chartered engineer who has experience in the structural design or appraisal of multi-storey buildings by reference to appropriate codes of practice and standards including the codes of practice and standards specified in the First Schedule to this Act or by reference to equivalent codes of practice and standards recognised in another Member State of the European Communities, and
(b) in relation to the installation of gas in a multi-storey building, a chartered engineer who has experience in the design or appraisal of gas installations for buildings by reference to appropriate codes of practice and standards including, where applicable, the codes of practice and standards specified in the Second Schedule to this Act or by reference to equivalent codes of practice and standards recognised in another Member State of the European Communities, and
(c) in relation to the distribution of gas in the vicinity of, or the provision of gas services into, a multi-storey building, a chartered engineer who has experience in the design or appraisal of gas distribution systems and gas services by reference to appropriate codes of practice and standards including, where applicable, the codes of practice and standards specified in the Second Schedule to this Act or by reference to equivalent codes of practice and standards recognised in another Member State of the European Communities;
“gas” means piped gas or gas in containers exceeding 500 millilitres in capacity;
“local authority” means—
(a) in the case of a county exclusive of any borough or urban district therein, the council of the county,
(b) in the case of a county or other borough, the corporation of the borough, and
(c) in the case of an urban district, the council of the district,
and a reference to the functional area of a local authority shall be construed accordingly;
“multi-storey building” means a building comprising or including five or more storeys, a basement being regarded as a storey, not being a building the construction of which was completed on or before the 1st day of January, 1950;
“owner”, in relation to a multi-storey building, includes a lessee of the building or any part thereof under a lease whereby he is wholly responsible for repairs and maintenance and a person who, alone or with others, manages the building or, if there is no such person, a person who, alone or with others, manages any part of the building;
“prescribed” means prescribed by regulations;
“robustness”, in relation to a multi-storey building, means the characteristic of a building which ensures that any accidental disturbance of the building does not cause a collapse of the structure which is disproportionate to the magnitude of the disturbance;
“specified building” means a multi-storey building which is constructed wholly or in part using precast concrete floors whose structural performance is not dependant on interaction with in situ concrete which is mechanically attached to the precast constituent by bonding to protruding reinforcement or shear connectors and supported on precast concrete frames or precast concrete panels or masonry walls.
(2) Where a building is situate partly in the functional area of one local authority and partly in that of another it shall, for the purposes of this Act, be regarded as being in the functional areas of each of them unless the said local authorities by agreement between them designate one of them to be the local authority in respect of the building. The local authority so designated shall, so long as the agreement remains in force, be the local authority in respect of the building for the purposes of this Act.
Duties of local authorities.
2.—(1) As soon as may be after the commencement of this Act each local authority shall prepare and maintain a register of all multistorey buildings in its functional area.
(2) In the case of every multi-storey building the construction of which was completed before the commencement of this Act the local authority for the functional area in which the building is situate shall serve notice on a person appearing to the local authority to be an owner of the building requiring him to furnish the local authority with a certificate in respect of the building in accordance with section 3 of this Act.
(3) Subsection (2) of this section shall not apply in relation to a multi-storey building which is owned by a local authority and is situate in whole or in part in its functional area.
Certificate or declaration in relation to multistorey building.
3.—(1) A person on whom a notice is served under section 2 (2) of this Act by a local authority shall submit to the local authority—
(a) a certificate signed by a competent person certifying that the building is, or is not, a specified building, or
(b) a statutory declaration made by that person that he is not an owner of the building.
(2) Every certificate submitted to a local authority pursuant to subsection (1) of this section which relates to a specified building shall certify that in the opinion of the competent person—
(a) the building is, subject to the procedures and tolerances of normal building practice, constructed in accordance with the appropriate codes of practice and standards which shall include, where applicable, the codes of practice and standards specified in the First Schedule to this Act; or
(b) the occupiers of, and persons who have recourse to, or are in the vicinity of, such building will not be exposed to risks related to the robustness of the building which would be unduly in excess of those normally present in a building constructed, subject to the procedures and tolerances of normal building practice, in accordance with the appropriate codes of practice and standards which shall include, where applicable, the codes and standards specified in the First Schedule to this Act; or
(c) all reasonable actions as set out in the certificate (which shall include, where appropriate, the actions specified in the Third Schedule to this Act) have been taken to minimise as far as is practicable the risk of accidental damage to the building.
Multi-storey buildings not completed before commencement of this Act.
4.—(1) In the case of a multi-storey building the construction of which is not completed before the commencement of this Act, it shall, subject to subsection (3) of this section, be the duty of every person to whom this section applies to submit to the local authority in whose functional area the building is situate a certificate in respect of the building in accordance with section 3 of this Act before the building or any part of the building is occupied.
(2) This section applies to—
(a) the person by whom the building is constructed if he constructs it on his own behalf and his successors in title;
(b) the person on whose behalf the building is constructed and his successors in title.
(3) It shall be sufficient compliance with subsection (1) of this section for any of the persons to whom this section applies to submit a certificate in respect of the entire building.
Requirement to submit further certificate.
5.—Where a certificate submitted to a local authority under section 3 (2) (c) of this Act certifies that such action as may be set out in the certificate has been taken in relation to a specified building, no action shall be taken in relation to that building which would have the effect of undoing the action so set out unless an owner of the specified building submits to the local authority in whose functional area the building is situate a further certificate, signed by a competent person, certifying that all reasonable actions as set out in that certificate have been taken to minimise, as far as practicable, the risk of accidental damage by reason of the undoing of the first mentioned action.
Multi-storey building owned by local authority.
6.—(1) Every local authority which is the owner of a multi-storey building situate in its functional area shall cause to have prepared and signed by a competent person a certificate certifying whether the building is, or is not, a specified building.
(2) The provisions of sections 3 (2) and 5 of this Act shall apply to a certificate under subsection (1) of this section as if it were a certificate submitted under this Act to a local authority.
Power of entry for inspection and to carry out works and actions.
7.—(1) For the purposes of providing a certificate under section 3, 4, 5 or 6 of this Act an owner of the building or any part thereof and his agent shall be entitled, after the giving of 14 days' notice to any other owner or occupier of the building or of any part of the building, to enter the building or that part of the building to which the notice applies, at all reasonable times, for the purposes of—
(a) inspecting the building or that part of the building to establish the details of the structure of the building and carrying out any work necessary for that purpose;
(b) carrying out works to enhance the robustness of the building; or
(c) carrying out all reasonable actions to minimise as far as is practicable the risk of accidental damage to the building.
(2) The owner or his agent shall make good any disturbance of the building caused by any works or actions pursuant to this section.
(3) The owner or his agent shall be entitled in the exercise of his powers under this section to take with him into the building, or that part of the building to which the notice applies, such persons or equipment as he considers necessary to assist him and to carry out any inspection, work or action that may be necessary for the purposes of providing the certificate.
(4) Where any inspection, work or action carried out pursuant to this section results in the breaking of any existing contractual obligations of an owner or occupier of the building, or any part thereof, it will be a sufficient defence in any action for trespass or for breach of contract arising from such inspection, work or action that the inspection, work or action was necessary for the purposes of submitting the certificate.
Service of notices.
8.—(1) Where a notice is required under this Act to be served on, or given to, a person, it shall be addressed to that person and may be served on, or given to, him in any one of the following ways—
(a) where the notice is addressed to that person by name, by giving it to him;
(b) by leaving the notice at the address at which that person ordinarily resides or, where an address for the service of documents has been given, at that address;
(c) by sending the notice by post in a prepaid registered letter addressed to that person at the address at which he ordinarily resides or, where an address for the service of documents has been given, at that address;
(d) where the address at which that person ordinarily resides cannot be ascertained by reasonable enquiry, by—
(i) delivering the notice to some person over the age of sixteen years residing, or employed, in the building to which the notice relates, or
(ii) affixing the notice in a conspicuous position on or near the building to which it relates.
(2) Where a notice is required by this Act to be served on, or given to, an owner of a building and the name of that person cannot be ascertained by reasonable enquiry, the notice may be addressed to “the owner” without naming him.
(3) For the purposes of this section, a company registered under the Companies Acts shall be deemed to be ordinarily resident at its registered office, and every other body corporate and every unincorporated body shall be deemed to be ordinarily resident at its principal office or place of business.
(4) Where a notice is served on, or given to, a person pursuant to subsection (1) (d) of this section, a copy of the notice shall, within two weeks thereafter, be published in at least one newspaper circulating in the area in which the person is last known to have resided.
Compliance with notice under section 2.
9.—(1) Where notice under section 2 of this Act is served by a local authority on more than one person in respect of a particular building it shall be sufficient compliance with that section for any of those persons, being an owner, to submit a certificate in respect of the entire building.
(2) It shall be a sufficient defence to a prosecution for failure to comply with a notice under any provision of this Act for the defendant to show that—
(a) he is unable to comply with the notice without the cooperation of other owners of the building or it would be unreasonable to require him to do so, and
(b) he has sought and failed to obtain such cooperation.
Power to require information as to the ownership of buildings.
10.—A local authority may, for the purpose of enabling them to ascertain the ownership of a building, give any person who is an occupier of the building concerned or part of that building or who, either directly or indirectly, receives rent in respect of the building or part of the building, a notice in writing requiring him to state within such period, being not less than 21 days, as may be specified in the notice in writing—
(a) the nature of his own estate or interest in that building, and
(b) the name and address of any other person known to him as having an estate or interest in the building or part of the building or as a person who, alone or with others, manages or exercises control over the building or any part thereof.
Regulations.
11.—(1) The Minister may make regulations for the purposes of this Act.
(2) Without prejudice to the generality of the foregoing, regulations may provide for the form of a register under section 2 (1) of this Act, or of any notice or certificate to be given under any provision of this Act or for the time within which any such notice or certificate shall be given.
(3) Every regulation made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the regulation is passed by either such House within the next twenty-one days on which that House has sat after the regulation is laid before it, the regulation shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Offences.
12.—Any person—
(a) who, without lawful excuse, fails to submit to a local authority within the time prescribed a certificate required to be furnished pursuant to section 3 or 4 of this Act, or
(b) who knowingly gives a certificate which is false or misleading in any respect, or knowingly submits such a certificate, or
(c) who knowingly makes a statutory declaration for the purpose of section 3 (1) (b) of this Act which is false or misleading in any respect, or
(d) who contravenes section 5 of this Act, or
(e) who, at any time during the period of three months after a notice is affixed on or near a building pursuant to section 8 (1) (d) (ii) of this Act removes, damages or defaces the notice without lawful authority, or
(f) who, having been required by a local authority by a notice in writing given under section 10 of this Act to give them any information, fails to give that information within the specified period or knowingly makes any misstatement in respect thereof, or
(g) who refuses to allow an owner who has given him due notice under section 7 of this Act, or the agent of that owner, to enter the building or the part of the building to which the notice relates or to take any person or equipment with him in the exercise of his powers under that section, or who obstructs or impedes the owner or his agent in the exercise of such powers, or
(h) who refuses or fails, without lawful excuse, to comply with a request made to him by any person on whom a notice under section 2 (2) of this Act has been served, to cooperate with that person, in obtaining a certificate in accordance with section 3 of this Act,
shall be guilty of an offence.
Prosecution of offences.
13.—An offence under this Act may be prosecuted summarily by a local authority.
Penalties.
14.—(1) A person who is guilty of an offence under section 12 (b), (c) or (d) of this Act shall be liable—
(a) on summary conviction, to a fine not exceeding £1,000, or to imprisonment for any term not exceeding 12 months or, at the discretion of the court, to both such fine and such imprisonment, or
(b) on conviction on indictment, to a fine not exceeding £10,000, or to imprisonment for any term not exceeding three years, or, at the discretion of the court, to both such fine and such imprisonment.
(2) A person who is guilty of an offence under any provision of this Act other than section 12 (b), (c) or (d) shall be liable on summary conviction to a fine not exceeding £1,000.
Short title and commencement.
15.—(1) This Act may be cited as the Local Government (Multi-Storey Buildings) Act, 1988.
(2) This Act shall come into operation on such day as the Minister by order appoints.

THIRD SCHEDULE
Actions to Ensure that there is no Undue Risk of Accidental Damage to a Multi-Storey Building
1. The protection of important members of a building against vehicular impact by the provision of bollards, crash barriers or other appropriate means.
2. The checking, testing and, if necessary, remedying of the condition of gas installations.
3. The carrying out of leak surveys in and around, and within the vicinity of, the building and the repairing of gas leaks, if any.
4. The checking and, if necessary, remedying of the ventilation systems for lift shafts and service ducts in the building.
5. The checking and, if necessary, remedying of the ventilation system for rooms containing gas appliances in the building.
6. The sealing of service entries through building walls below ground level.
7. The ventilation or filling of voids under the building.
8. The ensuring that any gas service in a void in the building is located in a ventilated sleeve or, if necessary, the removal of gas service from the void.
9. The cessation of, and the restriction on, the use or storage in the building in containers exceeding 500 millilitres in capacity of petroleum spirit, within the meaning of section 20 of the Dangerous Substances Act, 1972.
10. The cessation of, and the restriction on, the use or storage in the building of gas in containers exceeding 500 millilitres in capacity.
11. The cutting-off of gas supplies to the building.
