CUID I
Réamhráiteach agus Ginearálta
Gearrtheideal agus tosach feidhme.
1.—(1) Féadfar an tAcht um Ghalair Ainmhithe, 1966, a ghairm den Acht seo.
(2) Tiocfaidh an tAcht seo nó aon fhoráil shonraithe den Acht seo i ngníomh cibé lá nó laethanta a cheapfaidh an tAire le hordú.
Léiriú.
2.—(1) San Acht seo, ach amháin mar a n-éilíonn an comhthéacs a mhalairt—
ciallaíonn “aeradróm” aon limistéar talún (lena n-áirítear uisce) ina dtugtar saoráidí chun aerárthaí tuirlingt ann agus imeacht as;
ciallaíonn “ainmhí” ainmhí de chinéal a shonraítear i gCuid I den Chéad Sceideal;
tá le “leigheas ainmhithe” an bhrí a shanntar dó in alt 2 den Acht um Leigheasanna Ainmhithe, 1956;
tá le “limistéar atá dearbhghlan nó saor ó ghalar” an bhrí a shanntar dó in alt 19 (1) (b);
tá le “duine údaraithe” an bhrí a shanntar dó in alt 25;
ciallaíonn “éan” éan de chineál a shonraítear i gCuid II den Chéad Sceideal;
ciallaíonn “conablach” conablach ainmhí nó éin agus folaíonn sé cuid de chonablach, agus feoil, cnámha, seithe, fuil, craiceann, bian, cluimhreach, fionnadh, olann, clúmh, cleiteacha, crúba, adharca, scartach nó cuid eile d'ainmhí nó d'éan, ar leithligh nó eile, nó aon chuid den chéanna;
ciallaíonn “bólacht” tairbh, ba, bulláin, seafaidí agus laonna;
ciallaíonn “galar d'Aicme A” galar a shonraítear de thuras na huaire in Aicme A de Chuid III den Chéad Sceideal;
ciallaíonn “galar d'Aicme B” galar a shonraítear de thuras na huaire in Aicme B de Chuid III den Chéad Sceideal;
tá le “limistéar atá le glanadh” an bhrí a shanntar dó in alt 19 (1) (a);
ciallaíonn “galar” galar a shonraítear i gCuid III den Chéad Sceideal;
ciallaíonn “galraithe” a bheith i ngalar;
ciallaíonn “uibheacha” uibheacha éanlaithe agus folaíonn sé codanna d'uibheacha den sórt sin;
ciallaíonn “farae” féar nó ábhar eile (lena n-áirítear bainne) a úsáidtear mar bheatha d'ainmhithe nó d'éanlaithe;
ciallaíonn “bólacht adharcach” bólacht ar a bhfuil adharca seachas bunanna adharca nó adharca buntúis;
folaíonn “capall” asal agus gach each-ainmhí eile;
ciallaíonn an briathar “allmhairiú”, arna chur chun feidhme maidir le hainmhithe, éanlaithe agus nithe, a thabhairt, ar bhealach ar bith, isteach sa Stát ó áit lasmuigh den Stát;
ciallaíonn “i dteagbháil le”, maidir le hainmhí nó éan galraithe nó faoi amhras galair, a bheith nó tar éis a bheith sa pháirc, sa chró, sa stábla, san fhail, sa loc nó san áit chéanna, nó sa tréad nó san ealt céanna leis, nó ar shlí eile i dteagbháil leis, an ainmhí nó an éan sin;
tá le “áit nó limistéar aicídithe” an bhrí a shanntar dó le halt 14;
caillaíonn “cigire” duine is tréidlia agus atá ceaptha ag an Aire nó ag údarás áitiúil chun bheith ina chigire chun críocha an Achta seo;
ciallaíonn “a chur i dtír”, maidir le hainmhithe, éanlaithe, nó nithe a allmhaireofar, iad a chur i dtír ó long, árthach, aerárthach, nó feithicil, nó iad a thabhairt isteach sa Stát ar aon slí eile;
ciallaíonn “ceadúnas” ceadúnas arna dheonú ag an Aire;
ciallaíonn “easair” tuí nó ábhar eile is gnách a úsáid mar leaba d'ainmhithe nó d'éanlaithe nó thart orthu;
ciallaíonn “údarás áitiúil” comhairle chontae nó chontae-bhuirge;
ciallaíonn “an tAire” an tAire Talmhaíochta agus Iascaigh;
ciallaíonn “ordú ón Aire” ordú arna dhéanamh ag an Aire faoin Acht seo;
ciallaíonn “éanlaithe” éin de chineál a shonraítear i gCuid II den Chéad Sceideal;
ciallaíonn an briathar “forordú” forordú le hordú;
tá le “stáisiún coraintín” an bhrí a shanntar dó le halt 31;
ciallaíonn “rialachán de chuid údaráis áitiúil” rialachán arna dhéanamh ag údarás áitiúil faoin Acht seo;
folaíonn an briathar “loingsiú” iompar d'aer agus iompar i bhfeithicil;
ciallaíonn “faoi amhras” a bheith faoi amhras a bheith galraithe;
ciallaíonn “tréidlia” aon duine atá cáilithe go dleathach chun tréidliacht a chleachtadh sa Stát.
(2) San Acht seo, aon tagairt do Chuid, d'alt nó do Sceideal is tagairt í do Chuid, d'alt nó do Sceideal atá san Acht seo, mura gcuirtear a mhalairt in iúl.
(3) San Acht seo, aon tagairt d'achtachán is tagairt í don achtachán sin arna leasú nó arna leathnú le haon achtachán eile lena n-áirítear an tAcht seo.
Cumhachtaí ginearálta an Aire.
3.—(1) Féadfaidh an tAire orduithe a dhéanamh faoi réir agus de réir forálacha an Achta seo—
(a) i gcoitinne, chun an tAcht seo a fhorghníomhú go cuí nó chun galar a chosc ó leathadh;
(b) go háirithe, chun na gcríocha leithleacha a shonraítear san Acht seo, lena n-áirítear aon ábhar is féidir faoin Acht seo a fhorordú.
(2) Féadfaidh an tAire le hordú aon ordú faoin Acht seo a leasú nó a chúlghairm.
Orduithe a leagan faoi bhráid Tithe an Oireachtais.
4.—Gach ordú a dhéanfaidh an tAire faoin Acht seo leagfar é faoi bhráid gach Tí den Oireachtas a luaithe is féidir é tar éis a dhéanta agus má dhéanann ceachtar Teach acu sin, laistigh den lá is fiche a shuífidh an Teach sin tar éis an t-ordú a leagan faoina bhráid, rún a rith ag neamhniú an ordaithe beidh an t-ordú ar neamhní dá réir sin, ach sin gan dochar do bhailíocht aon ní a rinneadh roimhe sin faoi.
Ceadúnais.
5.—Féadfaidh an tAire ceadúnais a dheonú chun aon cheann de chríocha an Achta seo, coinníollacha a chur ag gabháil le haon cheadúnas den sórt sin, na coinníollacha sin a athrú agus aon cheadúnas den sórt sin a chúlghairm.

6.—Ní bheidh aon dleacht stampa iníoctha agus, ach amháin mar a n-ordaítear a mhalairt, ní éileofar ná ní ghearrfar aon táille ná muirear eile i leith aon cheapacháin, deimhnithe, dearbhaithe, ceadúnais ná ní faoin Acht seo, ná i leith aon iniúchadh nó gníomh eile a dhéanfar sula ndeonófar nó sula ndéanfar deimhniú, dearbhú, ceadúnas, nó ní eile.
Caiteachais.
7.—Íocfar as airgead a sholáthróidh an tOireachtas, a mhéid a cheadóidh an tAire Airgeadais é, na caiteachais faoina rachaidh an tAire ag riaradh an Achta seo.
Airgead a gheobhaidh an tAire a dhiúscairt.
8.—Déanfar airgead a gheobhaidh an tAire faoin Acht seo a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste i cibé slí a ordóidh an tAire Airgeadais.
Aisghairm agus forálacha idirlinne.
9.—(1) Déantar leis seo gach ceann de na hachtacháin atá leagtha amach sa Tríú Sceideal a aisghairm, faoi réir fho-alt (2), a mhéid a shonraítear sa tríú colún den Sceideal sin.
(2) Go dtí go dtiocfaidh an tAcht seo nó aon fhoráil áirithe de i ngníomh, leanfaidh na forálacha comhréire de na hachtacháin aisghairthe i bhfeidhm.
(3) Gach ionstraim nó ní a rinneadh faoi aon achtachán aisghairthe leanfaidh d'éifeacht a bheith aici nó aige agus, sa mhéid go bhféadfaí í nó é a dhéanamh faoin Acht seo, beidh éifeacht aici nó aige ionann is dá mba faoin bhforáil chomhréire den Acht seo a rinneadh í nó é.
(4) Déanfar aon doiciméad a thagraíonn d'aon achtachán aisghairthe a fhorléiriú mar dhoiciméad a thagraíonn don Acht seo nó don fhoráil chomhréire den Acht seo.
Orduithe agus rialacháin do leanúint i bhfeidhm.
10.—Gach ordú agus rialachán a rinneadh faoi achtachán aisghairthe agus a bheidh i bhfeidhm díreach roimh thosach feidhme an Achta seo leanfaidh siad i bhfeidhm agus féadfar iad a leasú nó a chúlghairm ionann is dá mba faoin Acht seo a rinneadh iad.
CUID II
Galar a Rialú agus a Scriosadh
Feidhm
Feidhm an Achta seo.
11.—(1) Faoi réir fho-alt (2), beidh feidhm ag an Acht seo maidir leis na hainmhithe, na héanlaithe agus na galair a shonraítear sa Chéad Sceideal.
(2) Féadfaidh an tAire le hordú, chun gach ceann nó aon cheann de chríocha an Achta seo, an Chéad Sceideal a leasú ionas go dtabharfar faoi fheidhm an Achta seo nó aon cheann áirithe dá fhorálacha aon chineál eile ainmhí, éanlaithe nó galair eile nó chun go n-eisiafar ón bhfeidhm sin aon chineál áirithe ainmhí, éanlaithe nó galair.
Cosc agus Scriosadh
Fógra i dtaobh galair.
12.—(1) Féadfaidh an tAire a fhorordú go dtabharfar fógra i dtaobh galar nó breoiteacht áirithe a bheith, nó i dtaobh a bheith faoi amhras go bhfuil galar nó breoiteacht áirithe, ar ainmhithe nó éanlaithe, cé hiad na daoine a thabharfaidh an fógra agus cén t-údarás dá dtabharfar agus an modh ar a dtabharfar an fógra.
(2) Féadfaidh foráil a bheith in ordú a dhéanfar faoin alt seo chun an tAire nó údarás áitiúil d'íoc táille le tréidlia i leith gach fógra a thabharfaidh sé i dtaobh galair agus féadfar, le toiliú an Aire Airgeadais, méid na táille sin a shonrú san ordú sin.
Orduithe chun galar a chosc nó a bhac.
13.—Féadfaidh an tAire, d'fhonn galar a chosc, a bhac nó a scriosadh, orduithe a dhéanamh chun gach críche nó aon chríche atá leagtha amach sa Dara Sceideal.
Áiteanna agus Limistéir Aicídithe
Forálacha ginearálta maidir le háiteanna agus limistéir aicídithe.
14.—(1) Féadfaidh an tAire an méid seo a leanas a fhorordú—
(a) na cásanna ina mbeidh sé le dearbhú go bhfuil áiteanna agus limistéir aicídithe le galar;
(b) an t-údarás a dhéanfaidh, agus an modh agus na coinníollacha ar a ndéanfar, dearbhuithe chuige sin;
(c) cad é éifeacht agus iarmairtí dearbhuithe den sórt sin;
(d) ré agus buanscor dearbhuithe den sórt sin; agus
(e) nithe eile a bhainfidh le dearbhuithe den sórt sin a dhéanamh.
(2) Féadfaidh an tAire le hordú athrú a dhéanamh ar theorainneacha áite nó limistéir a bheidh dearbhaithe a bheith aicídithe le galar.
(3) Gach áit nó limistéar a dhearbhófar amhlaidh a bheith aicídithe is áit nó limistéar aicídithe é chun críocha an Achta seo.
(4) I gcás ina ndéanfar ordú á dhearbhú nach áit nó limistéar aicídithe feasta áit nó limistéar áirithe, ansin, ón tráth a shonrófar san ordú, scoirfidh an áit nó an limistéar de bheith ina háit nó ina limistéar aicídithe nó de bheith in áit nó i limistéar aicídithe.
(5) Beidh ordú nó fógra den tuairisc seo a leanas—
(a) ordú ón Aire nó ó údarás áitiúil á dhearbhú gurb áit nó limistéar aicídithe áit nó limistéar áirithe, nó á dhearbhú nach áit nó limistéar aicídithe feasta áit nó limistéar áirithe; nó
(b) fógra a seirbheáladh de bhun ordacháin ón Aire nó ó údarás áitiúil de bhua ordaithe a rinneadh faoin alt seo,
ina fhianaise dhochloíte go huile ar an ngalar a bheith ann nó ar dheireadh a bheith leis agus ar aon ábhar eile a chuirfidh an t-ordú nó an fógra ar aghaidh.
Orduithe a bhaineann le háiteanna agus le limistéir aicídithe.
15.—Féadfaidh an tAire orduithe a dhéanamh
(a) d'fhorordú go bhfoilseofar, maidir le háit nó limistéar a dearbhaíodh a bheidh aicídithe, go ndearnadh an dearbhú sin agus do rialáil an fhoilsithe sin;
(b) do thoirmeasc nó do rialáil gluaiseacht ainmhithe agus éanlaithe agus daoine isteach in áit nó limistéar aicídithe nó istigh ann nó amach as;
(c) d'fhorordú agus do rialáil leithlisiú nó deighilt ainmhithe agus éanlaithe a bheidh in áit nó i limisteár aicídithe;
(d) do thoirmeasc nó do rialáil aistriú conablach, uibheacha, farae, easrach, áraistí, locanna, cleathra, aoiligh nó nithe eile isteach in áit nó limistéar aicídithe, istigh ann nó amach as;
(e) d'fhorordú agus do rialáil díthiú, cur, diúscairt nó cóireáil conablach, uibheacha, farae; easrach, áraistí, locanna, cleathra, aoiligh, nó nithe eile, a bheidh in áit nó limistéar aicídithe nó a bheifear tar éis a aistriú amach as;
(f) d'fhorordú agus do rialáil glanadh agus dí-aicídiú áiteanna agus limistéar aicídithe nó codanna den chéanna agus gabhdán nó feithiclí a úsáideadh chun ainmhithe nó éanlaithe a choimeád nó a iompar;
(g) d'fhorordú agus do rialáil dí-aicídiú éadaí daoine ar bheith in áit aicídithe dóibh, agus glacadh réamhchúram in aghaidh galar a leathadh ag daoine den sórt sin.
Cumhacht chun strainséirí a choimeád amach.
16.—Féadfaidh duine a mbeidh ainmhithe, éanlaithe nó uibheacha ar úinéireacht aige nó faoina chúram in áit nó limistéar acídithe fógra a chur suas, ag an mbealach isteach nó in aice an bhealaigh isteach, go dtí foirgneamh, clós nó feirm ina bhfuil nó ar a bhfuil ainmhithe, nó éanlaithe nó uibheacha, á thoirmeasc ar dhaoine dul isteach ann gan an cead a luafar san fhógra, agus air sin ní dleathach d'aon duine nach mbeidh ceart isteach nó ceart slí isteach aige de réir dlí san fhoirgneamh, sa chlós nó san fheirm sin nó air nó thairis dul isteach ann, air nó thairis gan an cead sin.
Marú
Ainmhithe galraithe o mharú agus cúiteamh.
17.—(1) Féadfaidh an tAire a chur faoi deara go marófar—
(a) aon ainmhithe nó éanlaithe a bhfuil, nó a bhfuiltear faoi amhras go bhfuil, aon ghalar d'Aicme A orthu, agus
(b) aon ainmhithe nó éanlaithe atá nó a bhí sa pháirc, sa chró nó san áit chéanna, nó sa tréad nó san ealt céanna, nó i dteagbháil ar shlí eile, le hainmhithe nó éin a bhfuil, nó a bhfuiltear faoi amhras go bhfuil, aon ghalar d'Aicme A orthu, agus is dóigh leis an Aire a bhí ar aon bhealach i gcaoi a n-aicídithe leis an aicíd a bheidh i gceist.
(2) Faoi réir alt 58, íocfaidh an tAire cúiteamh i leith ainmhithe agus éanlaithe (seachas madra nó cat a bhfuil nó atá faoi amhras go bhfuil confadh air) a maraíodh faoin alt seo nó ar ordaíodh a marú ach a bhásóidh sula féidir a marú agus fós i leith conablach agus uibheacha (seachas uibheacha colúr, colm, péacóg, ealaí nó de ghné na siotacafoirmí) a díthíodh thar ceann an Aire mar gheall ar ghalar a bheith ann nó a bheith faoi amhras a bheith ann.
(3) Féadfaidh an tAire ainmhí nó éan a dhlitear a mharú faoin Acht seo ar ordachán ón Aire a fhorcoimeád lena fhaire, lena chóireáil nó lena thástáil, ach sin faoi réir an tAire d'íoc cúitimh mar d'íocfadh sé i gcás ainmhí nó éin a mharú.

18.—(1) Nuair a mharófar ainmhí nó éan faoin Acht seo ar ordachán ón Aire, is leis an Aire conablach an ainmhí nó an éin agus déanfar é a chur nó a dhíol nó a dhiúscairt ar shlí eile ar ordachán ón Aire, mar a dhlífidh nó mar a cheadóidh staid an ainmhí, an éin nó an chonablaigh agus cúinsí eile.
(2) Má bhíonn, in aon chás, breis ag an tsuim a gheobhaidh an tAire ar chonablach a dhíol faoin alt seo ar an méid a íocadh mar chúiteamh le húinéir an ainmhí nó an éin a maraíodh, íocfaidh an tAire an bhreis sin leis an úinéir, tar éis caiteachais réasúnacha a asbhaint.
(3) Má bhíonn ainmhí nó éan a mharófar faoin Acht seo ar ordachán ón Aire nó ó údarás áitiúil faoi árachas ag úinéir an ainmhí nó an éin, féadfaidh na hárachóirí an méid cúitimh a dámhadh dó faoin Acht seo nó faoi aon ordú faoin Acht seo a asbhaint as an méid airgid is iníoctha faoin árachas sula ndéanfaidh siad aon íocaíocht ina leith.
(4) I gcás ina marófar ainmhí nó éan faoin Acht seo ar ordachán ón Aire, féadfaidh an tAire aon talamh a bheidh ina sheilbh ag úinéir, nó ar áitiú ag úinéir, an ainmhí nó an éin agus a bheidh oiriúnach chun na críche sin nó aon talamh coimín nó neamhfhálta a úsáid chun an conablach a chur.
(5) I gcás inar deimhin le cigire, tar éis cibé fiosruithe a dhéanamh is dóigh leis is gá, nach bhfuil aon talamh den sórt a luaitear i bhfo-alt (4) ar fáil chun conablaigh ainmhithe nó éanlaithe a maraíodh a chur, féadfaidh an tAire aon talamh cóiriúil a bheidh oiriúnach lena aghaidh a úsáid chun na hainmhithe nó na héanlaithe a choimeád agus a mharú ann agus a gconablaigh a chur ann.
(6) (a) Má éilíonn úinéir nó áititheoir aon talún den sórt sin gur bhain caillteanas dó de bharr na húsáide sin, féadfaidh sé, laistigh de dhá mhí ó dháta na húsáide sin, cúiteamh a iarraidh, i scríbhinn, ar an Aire.
(b) I gcás ina ndéanfar iarratas ar chúiteamh go cuí faoin fho-alt seo, cinnfear an t-iarratas de réir cibé ordú a dhéanfaidh an tAire ina thaobh sin.
(c) Má conspóidíonn an t-iarratasóir aon chinneadh den sórt sin socrófar an cinneadh trí eadráin.
Limistéar atá le Glanadh, Limistéar atá Dearbhghlan agus Saor ó Ghalar
Limistéir atá le glanadh, limistéir atá dearbhghlan agus saor ó ghalar.
19.—Féadfaidh an tAire, i gcás inar dóigh leis gur gá sin chun aon ghalar d'Aicme B a scriosadh, orduithe a dhéanamh maidir leis an ngalar sin—
(a) á dhearbhú gur limistéar ina bhfuil an galar le scriosadh limistéar (dá ngairtear san Acht seo limistéar atá le glanadh);
(b) á dhearbhú gur limistéar dearbghlan nó saor ó ghalar limistéar ar deimhin leis an Aire nach bhfuil aon rian nach mór den ghalar ann;
(c) d'fhorordú na gcoinníollacha ar a bhféadfar ainmhithe nó éanlaithe a onnmhairiú agus d'ainmniú na gcalafort nó na n-aeradróm, nó na gcodanna de chalafoirt nó d'aeradróim, nó na gcúrsaí le haghaidh an onnmhairithe sin.
Orduithe maidir le limistéir atá le glanadh, limistéir atá dearbhghlan agus saor ó ghalar.
20.—Féadfaidh an tAire, orduithe a dhéanamh i ndáil le haon limistéar atá le glanadh nó aon limistéar atá dearbhghlan nó saor ó ghalar—
(a) maidir le hainmhithe nó éanlaithe a bhfuil nó a bhfuiltear faoi amhras go bhfuil an galar iomchuí orthu nó go bhféadfaidís an galar iomchuí a thabhairt d'ainmhithe nó d'éanlaithe—
(i) á údarú seilbh a ghlacadh, trí chomhaontú, ar na hainmhithe nó ar na héanlaithe thar ceann an Aire;
(ii) cheal comhaontú, d'áirithiú agus do rialáil aistriú na n-ainmhithe nó na n-éanlaithe amach as an limistéar nó a marú;
(iii) d'áirithiú agus do rialáil leithlisiú agus cothabháil ainmhithe nó éanlaithe fad a bheifear ag feitheamh chun seilbh a ghlacadh orthu thar ceann an Aire nó iad a aistriú amach as an limistéar nó iad a mharú;
(b) d'áirithiú agus do rialáil leithlisiú agus tástáil a dhéanfar ó am go ham ar ainmhithe nó ar éanlaithe a thabharfar isteach ar thalamh nó in áitreabh;
(c) do thoirmeasc nó do shrianadh gluaiseacht ainmhithe agus éanlaithe isteach sa limistéar nó amach as nó tríd nó ann;
(d) d'áirithiú agus do rialáil coimeád taifead i leith ainmhithe nó éanlaithe agus tabhairt ar aird agus iniúchadh na dtaifead sin;
(e) do shonrú foirmeacha fógraí a bheidh le seirbheáil faoi orduithe arna ndéanamh de bhua an ailt seo;
(f) á fhoráil, i gcásanna inar mainníodh ceanglais aon fhógra den sórt sin a chomhlíonadh, chun—
(i) i gcás ina gceanglóidh an fógra ainmhithe nó éanlaithe a aistriú amach as an limistéar nó a mharú— seilbh a ghlacadh ar na hainmhithe nó ar na héanlaithe, iad a dhiúscairt mar is cuí leis an Aire agus an costas a bhainfidh le seilbh a ghlacadh ar na hainmhithe nó ar na héanlaithe agus iad a chothabháil agus a dhiúscairt dá éis sin a ghnóthú (gan dochar d'aon phionós a tabhaíodh);
(ii) in aon chás eile—ceanglais an fhógra a chomhlíonadh ag an Aire nó thar a cheann agus an costas a bhainfidh le comhlíonadh na gceanglas sin a ghnóthú (gan dochar d'aon phionós a tabhaíodh);
(g) do chinneadh, i gcás gabháltas atá go páirteach laistigh agus go páirteach lasmuigh d'aon limistéar atá le glanadh, atá dearbhghlan nó saor ó ghalar, nó atá go hiomlán nó go páirteach laistigh de dhá limistéar nó níos mó den sórt sin, an limistéir lena mbaineann na gabháltais sin;
(h) d'údarú dul isteach ar thalamh nó in áitreabh chun críocha aon ordaithe den sórt sin;
(i) chun aon chríocha a ghabhann nó a bhaineann le haon cheann de na críocha sin roimhe seo.
Rialacháin maidir le leigheasanna ainmhithe.

22.—Íocfaidh an tAire, faoi réir alt 58, cúiteamh i leith ainmhithe agus éanlaithe a nglacfar seilbh orthu thar a cheann de bhun ordú faoi alt 20.
Marú agus cúiteamh i gcásanna eile.
23.—(1) Féadfaidh an tAire, maidir le haon ghalar d'Aicme B, fógra poiblí a thabhairt i cibé slí is oiriúnach leis go bhfuil ar intinn aige ordú a dhéanamh faoinar limistéar atá le glanadh limistéar sonraithe.
(2) Nuair a thabharfar fógra faoin alt seo maidir le limistéar, féadfaidh an tAire, le toiliú an Aire Airgeadais, cúiteamh a íoc i leith ainmhithe nó éanlaithe sa limistéar sin a dteipfidh orthu i dtástáil don ghalar a cheadaigh an tAire agus a mharófar de thoradh socrú idir an tAire agus úinéir na n-ainmhithe nó na n-éanlaithe.
Cláir de thréada agus ealtaí atá dearbhghlan nó saor ó ghalar.
24.—(1) Féadfaidh an tAire, i leith aon ghalar d'Aicme B, clár a bhunú agus a chothabháil de thréada nó d'ealtaí d'aon sórt áirithe ainmhithe nó éanlaithe.
(2) Tabharfar tréada nó ealtaí atá dearbhghlan nó saor ó ghalar nó cibé tuairisc eile a fhorordóidh an tAire ar thréada nó ar ealtaí a chlárófar i gclár.
(3) Ní thabharfaidh duine—
(a) le tuiscint gur tréad nó ealta atá dearbhghlan nó soar ó ghalar tréad nó ealta áirithe nó gur de thuairisc fhorordaithe é mura mbeidh sé ar taifead sa chlár iomchuí nó i dtréad nó ealta atá saor ó ghalar atá i limistéar atá dearbhghlan nó saor ó ghalar, ná
(b) le tuiscint gurb as tréad nó ealta dearbhghlan nó saor ó ghalar aon ainmhí nó éan áirithe nó gur de thuairisc fhorordaithe é mura rud é gurb as tréad nó ealta ó atá ar taifead sa chlár iomchuí nó as tréad nó ealta saor ó ghalar i limistéar atá dearbhghlan nó saor é ghalar.
(4) Aon duine a sháróidh forálacha fho-alt (3) beidh sé ciontach i gcion.
(5) Féadfaidh an tAire orduithe a dhéanamh maidir le clár agus go háirithe foráil maidir le—
(a) teideal an chláir,
(b) iarratas ar chlárú,
(c) cáilíochtaí agus coinníollacha le haghaidh clárú,
(d) ceanglais a bheidh le comhlíonadh chun clárú a choimeád,
(e) clárú a chealú,
(f) coinneáil an chláir agus fianaise ar an ábhar ann.

Cumhachtaí daoine údaraithe agus oifigeach.
25.—(1) Chun galar d'Aicme B a scriosadh, féadfaidh duine údaraithe gach tráth réasúnach, ar a údarás a thaispeáint má iarrtar sin air—
(a) cibé scrúduithe agus tástálacha a dhéanamh maidir le haon ainmhithe nó éanlaithe agus cibé samplaí a thógáil, cibé vaicsín nó séaram a úsáid agus cibé marcanna a chur, is gá le réasún, nó de réir mar a bheidh ceangailte nó forordaithe leis an Acht seo nó ag an Aire;
(b) dul isteach ar aon talamh nó in áitreabh chun an scrúdú, an tástáil, an tsampláil nó an mharcáil sin a dhéanamh;
(c) a cheangal ar aon duine is úinéir nó duine i bhfeighil ainmhithe nó éanlaithe nó is úinéir nó áititheoir nó fostaí ar thailte nó áitreabh a ndeachthas isteach orthu nó ann amhlaidh cibé cabhair a thabhairt nó cibé treoracha a chur i gcrích de réir mar is gá le réasún chun an scrúdú, an tástáil, an tsampláil nó an mharcáil sin a dhéanamh nó cibé eolas a thabhairt is gá le réasún chun scriosadh an ghalair a chur chun cinn nó chun aon ordú faoin Acht seo a riaradh.
(2) San alt seo—
ciallaíonn “duine údaraithe”—
(a) cigire don Aire, nó
(b) tréidlia seachas cigire don Aire,
atá údaraithe i scríbhinn ag an Aire chun na cumhachtaí a thugtar leis an alt seo a fheidhmiú.
(3) Beidh ag oifigeach don Aire nach cigire na cumhachtaí sin de chuid duine údaraithe faoin alt seo a údaróidh an tAire dó i scríbhinn a fheidhmiú.

Ainmhithe nó éanlaithe galraithe faoi bhealach.
26.—Féadfaidh an tAire orduithe a dhéanamh—
(a) lena dtoirmiscfear nó lena rialálfar ainmhithe nó éanlaithe galraithe nó faoi amhras, nó aoileach nó aon ní eile ar dóigh dó galar a leathadh, a sheoladh nó a iompar nó a chur faoi deara iad a sheoladh nó a iompar ar iarnróid, canálacha, aibhneacha nó uiscebhealaí intíre, nó ar mhórbhóithre nó mórbhealaí, nó in árthaí, aerarthaí nó ar shlí eile;
(b) lena dtoirmiscfear nó lena rialálfar ainmhithe nó éanlaithe galraithe nó faoi amhras a cheannaireacht nó a thiomáint nó a chur faoi deara iad a cheannaireacht nó a thiomáint ar mhórbhóithre nó mórbhealaí nó in áit éigin eile;
(c) lena dtoirmiscfear nó lena rialálfar ainmhithe nó éanlaithe galraithe nó faoi amhras a lonnú nó a choimeád ar choimín nó ar thalamh neamhfhálta nó i bpáirceanna nó in áiteanna eile gan dóthain fáil, nó ar thaobhanna mórbhóthar;
(d) lena dtoirmiscfear nó lena rialálfar ainmhithe nó éanlaithe galraithe nó faoi amhras a thaispeáint ar mhargaí nó aontaí, i gclósanna díola, nó in áiteanna poiblí nó príobháideacha eile ina gcuirtear ainmhithe nó éanlaithe ar taispeáint de ghnáth lena ndíol;
(e) do dhéanamh forála i leith ainmhithe agus éanlaithe atá galraithe nó faoi amhras galar a bheith orthu—
(i) le linn dóibh a bheith ar taispeáint lena ndíol nó ar taisealbhadh ar mhargadh, aonach, i gclós díola, in áit taisealfa nó in áit éigin eile, nó
(ii) le linn dóibh a bheith i liasra nó in áit eile sula gcuirtear ar taispeáint iad lena ndíol, nó
(iii) le linn dóibh a bheith faoi bhealach nó i gcúrsa a n-aistriú de thalamh nó d'uisce, nó
(iv) le linn dóibh a bheith ar choimín nó ar thalamh neamhfhálta, nó
(v) le linn dóibh a bheith i seamlas nó in áit ina maraítear ainmhithe nó éanlaithe nó ina gcoimeádtar iad lena marú, nó
(vi) i gcoitinne, le linn dóibh a bheith in áit nach bhfuil ina sheilbh nó á háitiú nó faoina rialú ag úinéir na n-ainmhithe nó na n-éanlaithe;
(f) do dhéanamh forála i leith na n-iarmairtí faoin Acht seo i gcás ainmhithe nó éanlaithe a fháil sna háiteanna agus sna himthoscaí a luaitear san alt seo, i ndáil leis na háiteanna ina bhfaighfear na hainmhithe nó na héanlaithe amhlaidh agus aon ainmhithe nó éanlaithe eile atá nó a bhí nó a bheidh in aon cheann de na háiteanna réamhráite sin agus a raibh siad nó ar dóigh go raibh siad i dteagbháil leo.

27.—Féadfaidh an tAire orduithe a dhéanamh—
(a) chun gluaiseacht ainmhithe nó éanlaithe ach amháin faoi cheadúnas agus aistriú conablach, farae, easrach, aoiligh, uibheacha agus nithe eile a thoirmeasc, a rialáil nó a shrianadh, chun úsáid uibheacha a thoirmeasc agus a rialáil, agus chun leithlisiú ainmhithe nó éanlaithe a bheifear tar éis a cheannach nó a allmhairiú a fhorordú agus a rialáil;
(b) lena bhforordófar agus lena rialálfar eisiúint agus tabhairt ar aird ceadúnas maidir le gluaiseacht agus aistriú ainmhithe, éanlaithe, uibheacha agus nithe;
(c) lena dtoirmiscfear nó lena rialálfar seoladh margaí, aontaí, taisealbhadh agus díolachán ainmhithe nó éanlaithe agus taispeáint ainmhithe agus éanlaithe acu;
(d) lena bhforordófar agus lena rialálfar glanadh agus dí-aicídiú áiteanna a úsáidtear chun margaí, aontaí, taisealbhadh nó díolacháin ainmhithe nó éanlaithe a sheoladh nó chun ainmhithe a liasradh, agus clósanna, cróite, stáblaí agus áiteanna eile a úsáidtear le haghaidh ainmhithe nó éanlaithe;
(e) lena bhforordófar agus lena rialálfar glanadh agus dí-aicídiú árthach, aerárthach, feithiclí, áiteanna, locanna agus feistis a úsáidtear le hainmhithe nó éanlaithe a iompar nó chun críocha a ghabhann leis sin;
(f) lena bhforordófar agus lena rialálfar na taifid a bheidh le coimeád de cheannach agus díol ainmhithe agus éanlaithe, an tslí ina gcoimeádfar na taifid sin agus na himthoscaí faoina dtabharfar, agus an t-údaras nó an duine dá dtabharfar, an t-ábhar a bheidh sna taifid sin.

28.—D'fhonn leathadh galair a chosc nó díobháil d'ainmhithe agus d'éanlaithe nó fulaingt ag ainmhithe agus ag éanlaithe a chosc féadfaidh an tAire orduithe a dhéanamh—
(a) lena rialálfar i gcoitinne iompar ainmhithe agus éanlaithe agus na coinníollacha faoina gcoimeádfar agus faoina láimhseofar ainmhithe agus éanlaithe ag aontaí, margaí, loganna margaí, liasraí, stáisiúin iarnróid agus áiteanna eile ina dtiomsaítear ainmhithe nó éanlaithe sula ndéantar iad a iompar, a loingsiú, a thaisealbhadh nó a mharú;
(b) lena gceanglófar agus lena rialálfar beatha agus uisce a sholáthar ag stáisiúin iarnróid, aontaí, margaí, loganna margaí, liasraí agus áiteanna ina dtiomsaítear ainmhithe nó éanlaithe le linn dóibh a bheith ag feitheamh lena gcur faoi bhealach, lena loingsiú, lena dtaisealbhadh nó lena marú;
(c) lena bhforordófar an tréimhse a gcaithfear beatha agus uisce a sholáthar d'ainmhithe nó d'éanlaithe a bheidh faoi bhealach nó a bheidh ag feitheamh lena gcur faoi bhealach, lena loingsiú, lena dtaisealbhadh nó lena marú agus na daoine a sholáthróidh an bheatha nó an t-uisce sin;
(d) lena bhforordófar déanamh, toisí agus cóiriú feithiclí agus aerárthach a úsáidtear chun ainmhithe nó éanlaithe a iompar agus déanamh, toisí agus cóiriú áitreabh agus áiteanna ina ndíoltar ainmhithe nó éanlaithe nó ina dtiomsaítear iad ar feitheamh lena gcur faoi bhealach, lena loingsiú nó lena marú;
(e) lena dtoirmiscfear, go hiomlán nó go coinníollach, árthach, feithicil, aerárthach, loc nó lias nó áit éigin eile ar gearradh fíneáil ar aon duine mar gheall ar chion faoin Acht seo ina leith nó i leith a úsáide, a a úsáid chun ainmhithe nó éanlaithe a iompar nó aon chríche a ghabhann leis sin;
(f) lena gceanglófar agus lena rialálfar eolas a chur ar fáil i leith ainmhithe agus éanlaithe a gheobhaidh bás nó a dhíobhílfar faoi bhealach nó in áiteanna ina ndíoltar agus ina gceannaítear ainmhithe nó ina dtiomsaítear iad ar feitheamh lena n-iompar, lena loingsiú, lena dtaisealbhadh nó lena marú.

29.—Féadfaidh an tAire orduithe a dhéanamh—
(a) chun ainmhithe agus éanlaithe a iomprófar de mhuir nó d'aer a chosaint ar fhulaingt gan riachtanas ar feadh an turais agus ar iad a chur i dtír;
(b) chun a áirithiú go mbeidh soláthar cuí beatha agus uisce agus aerú cuí ar fáil ag ainmhithe agus éanlaithe, a iomprófar de mhuir nó d'aer, le linn an turais agus ar iad a chur idtír;
(c) lena bhfordófar agus lena rialálfar déanamh agus feistis na gcodanna d'árthaí nó d'aerárthaí a úsáidtear chun ainmhithe nó éanlaithe a iompar;
(d) lena dtoirmiscfear ainmhithe nó éanlaithe a iompar ar aon árthach nó aerárthach sonraithe ar feadh cibé tréimhse is fóirsteanach leis an Aire;
(e) lena bhfórordofar agus lena rialálfar an fógra a bheidh le tabhairt maidir le hainmhithe nó éanlaithe a bheidh beartaithe a onnmhairiú;
(f) lena bhforordófar agus lena rialálfar na coinníollacha i dtaobh ainmhithe agus éanlaithe a choinneáil, scíth a thabhairt dóibh agus iad a iniúchadh sula n-onnmhaireofar iad;
(g) lena dtoirmiscfear ainmhithe nó éanlaithe a onnmhairiú ach amháin faoi cheadúnas.

Allmhairiú ainmhithe, éanlaithe, etc
30.—(1) Féadfaidh an tAire orduithe a dhéanamh—
(a) lena dtoirmiscfear, ach amháin faoi cheadúnas, nó lena rialálfar ainmhithe nó éanlaithe, nó aon chineál sonraithe ainmhithe nó éanlaithe, nó conablaigh, uibheacha, táirgí ainmhithe nó éanlaithe (lena n-áirítear táirgí déanta as, nó ina mbeidh, táirgí ainmhithe nó éanlaithe, conablaigh nó uibheacha), farae, easair, aoileach nó ní eile a allmhairiú, nó a chur i dtír nó a thabhairt isteach i gcalafort nó in aeradróm sa Stát, i gcoitinne nó ó aon tír shonraithe nó ó aon chuid shonraithe d'aon tír den sórt sin;
(b) lena gceanglófar agus lena rialálfar dí-aicídiú ar dhaoine a thiocfaidh isteach sa Stát, ar a gcuid éadaí agus bagáiste agus cibé eolas a thabhairt i dtaobh a slí bheatha agus a n-imeachtaí roimhe sin de réir mar a theastóidh le réasún ón Aire.
(2) Aon uair a dhéanfar aon ainmhithe, éanlaithe, uibheacha nó earraí eile d'aon chineál ar bith a allmhairiú nó a chur i dtír nó a thabhairt isteach i gcalafort nó in aeradróm sa Stát contrártha d'ordú faoin Acht seo, féadfaidh oifigeach Custam agus Máil nó cigire a cheangal ar aon duine (arb é an t-allmhaireoir nó an carraeir lena mbaineann é) na hainmhithe, na héanlaithe, na huibeacha nó na hearraí eile sin a onnmhairiú laistigh de thréimhse áirithe, agus má mhainníonn an duine sin déanamh de réir an cheanglais sin beidh sé ciontach i gcion agus déanfar na hainmhithe agus na héanlaithe a mharú agus na hearraí a dhíothú mura n-ordóidh an tAire a mhalairt.

31.—D'ainneoin aon ní san Acht seo, féadfaidh an tAire le hordú a cheadú ainmhithe, éanlaithe nó uibheacha a allmhairítear a chur i dtír lena n-iompar láithreach i cibé slí agus faoi réir cibé réamhchúramaí a fhorordóidh sé maidir le háitreabh nó cóiríocht a cheadóidh sé chun críocha coraintín agus dá ngairfear stáisiún coraintín.

32.—Ní dhéanfaidh aon ordú ná rialachán ná ní a dhéanfar de réir forálacha an Achta seo an t-allmhaireoir, an t-onnmhaireoir, ná aon duine eile a mbeidh baint aige le hallmhairiú, le cur i dtír nó le honnmhairiú aon ainmhí, éin, uibheacha nó ní eile a shaoradh ó cheanglais iomchuí na nAchtanna Custam a chomhlíonadh maidir leis an ainmhí, leis an éan, leis na huibheacha nó leis an ní eile lena mbainfidh.

33.—Féadfaidh an tAire orduithe a dhéanamh maidir le hainmhithe, éanlaithe, uibheacha, conablaigh, farae, easair, aoileach nó nithe eile a allmhaireofar—
(a) lena bhforordófar agus lena rialálfar gluaiseacht ainmhithe, éanlaithe, uibheacha, conablach, farae, easrach, aoiligh nó nithe eile a allmhaireofar;
(b) lena bhforordófar agus lena rialálfar coinneáil agus leithlisiú ainmhithe, éanlaithe agus nithe in áitribh áirithe nó i gcodanna áirithe d'áitribh áirithe;
(c) lena bhforordófar agus lena rialálfar marú agus diúscairt ainmhithe agus éanlaithe a allmhaireofar go mídhleathach;
(d) lena bhforordófar go bhféadfar uibheacha, conablaigh, farae, easair, aoileach agus nithe eile a allmhaireofar faoi cheadúnas a dhíothú nó a dhiúscairt ar shlí eile mar a ordóidh an tAire;
(e) lena ndéanfar forordú i dtaobh aon tástáil ghalair nó aon chóireáil ghalair a chur ar aon ainmhí nó éan a allmhaireofar;
(f) lena ndéanfar forordú i dtaobh maoirsiú agus rialú ainmhithe, éanlaithe nó uibheacha i stáisiún coraintín nó i gcúrsa a n-iompar chuige agus i dtaobh a ngluaiseacht, nó toirmeasc a chur lena ngluaiseacht, isteach i stáisiún coraintin nó amach as;
(g) lena ndéanfar forordú i dtaobh marú ainmhithe agus éanlaithe agus díothú uibheacha i stáisiún coraintín i gcás galair, i dtaobh cúiteamh a íoc agus úineireacht na gconablach a chinneadh i gcás ainmhithe agus éanlaithe a mharófar amhlaidh.

34.—Féadfaidh an tAire orduithe a dhéanamh—
(a) lena bhforordófar—
(i) na calafoirt, na haeradróim agus na háiteanna curtha i dtír ina bhféadfar, agus arb iontu amháin a fhéadfar, ainmhithe agus éanlaithe a bheidh á n-allmhairiú a chur i dtír;
(ii) na haeradróim a fhéadfar a úsáid, agus arb iad amháin a fhéadfar a úsáid, ag aerárthach a bheidh ag iompar ainmhithe a bheidh á n-allmhairiú;
(b) lena sonrófar teorainneacha áiteanna curtha i dtír chun críocha an Achta seo, agus
(c) lena sonrófar codanna de chalafoirt nó d'aeradróim.

35.—(1) Féadfaidh an tAire orduithe a dhéanamh—
(a) lena bhforordófar, lena rialálfar agus lena n-áiritheofar cóireáil a chur go tréimhsiúil ar gach uile chaora le dipeáil éifeachtach nó le leigheas éigin eile don ghalar scrathach caorach a úsáid;
(b) lena bhforordófar agus lena rialálfar modh na cóireála sin;
(c) lena bhforálfar nach bhféadfar ach na dipeanna nó na leigheasanna sin a bheidh ceadaithe ag an Aire a úsáid chun críche an ailt seo.
(2) Féadfaidh cigire don Aire agus, má bhíonn sé údaraithe amhlaidh le hordú ón Aire, féadfaidh cigire d'údarás áitiúil, faoi réir ordacháin ón údarás a cheapfaidh an cigire, agus chun críocha aon ordú faoi fho-alt (1), dul isteach in aon áitreabh agus aon chaora ann a scrúdú.
(3) Comhlíonfaidh an t-úinéir agus an duine a bheidh i bhfeighil aon chaora ceanglais réasúnacha uile an chigire maidir le bailiú agus locadh na caorach agus cuirfidh sé gach saoráid réasúnach ar fáil don chigire chun an chaora a scrúdú.
(4) Féadfaidh údarás áitiúil, umair dhipeála iniompair nó, le ceadú an Aire, ionaid dipeála, a chur ar fáil, a fheistiú agus a chothabháil, agus úsáid an chéanna, agus gach fearas agus ábhar a ghabhann de riachtanas leo, a thabhairt don phobal ar cibé téarmaí agus coinníollacha is oiriúnach leis an údarás áitiúil, agus cuirfidh údarás áitiúil aon suimeanna a gheobhaidh siad i leith na húsáide sin chun feidhme lena gcaiteachais faoin Acht seo a ghlanadh.
(5) Ní údáidfear aon ionad dipeála chun críocha an ailt seo má dhéanann an úsáid sin díobháil don uisce in aon sruthán, taiscumar, uiscrian, tobar, linn nó áit ar bith eile a rinneadh nó a úsáidtear chun uisce óil nó le haghaidh tí a chur ar fáil.
CUID III
Feidhmeanna Údarás Áitiúil
Dualgais údarás áitiúil.
36.—Déanfaidh gach údarás áitiúil an tAcht seo agus gach ordú ón Aire a fhorghníomhú agus a chur i bhfeidhm sa mhéid go mbeidh siad le forghníomhú agus le cur i bhfeidhm ag údaráis áitiúla.
Mainneachtain ag údaráis áitiúla.
37.—(1) Má mhainníonn údarás áitiúil aon cheann d'fhorálacha an Achta seo nó d'ordú ón Aire a fhorghníomhú nó a chur i bhfeidhm féadfaidh an tAire le hordú cumhacht a thabhairt do dhuine a ainmneofar san ordú sin na forálacha sin a fhorghníomhú agus a chur i bhfeidhm nó a chur faoi deara go bhforghníomhófar agus go gcuirfear i bhfeidhm iad.
(2) Is caiteachais de chuid an údaráis áitiúil na caiteachais sin faoina rachaidh an tAire nó faoina rachfar thar a cheann faoi aon ordú den sórt sin nó i leith aon mhainneachtana den sórt sin, agus íocfaidh an cuntasóir nó oifigeach cuí éigin de chuid an údaráis áitiúil méid na gcaiteachas sin leis an Aire ar iad a éileamh, agus má mhainnítear iad a íoc féadfaidh duine a cheapfaidh an tAire chun agra a dhéanamh ina leith sin méid na gcaiteachas sin a ghnóthú ón údarás áitiúil.
(3) Chun críocha an ailt seo beidh ordú ón Aire dochloíte maidir le haon mhainneachtain, le méid na gcaiteachas nó le haon ábhar eile a bheidh luaite nó foilsithe ann.
(4) Is forálacha iad forálacha an Achta seo atá gan dochar do cheart nó do chumhacht an Aire, nó aon údaráis eile nó aon duine chun aon imeachtaí eile a thionscnamh chun a cheangal ar údarás áitiúil aon cheann d'fhorálacha an Achta seo nó d'ordú faoi a fhorghníomhú nó a chur i bhfeidhm.

38.—Féadfaidh an tAire cibé orduithe is oiriúnach leis a dhéanamh á ordú nó á údarú d'údarás áitiúil rialacháin a dhéanamh chun aon cheann de chríocha an Achta seo nó d'aon ordú faoi.

39.—(1) Féadfaidh an tAire orduithe a dhéanamh á ordú nó á údarú i gcás galar nó amhras i dtaobh galar a bheith ann agus faoi réir cibé coinníollacha a fhorordóidh sé, go ndéanfaidh údaráis áitiúla ainmhithe agus éanlaithe a mharú agus conablaigh agus uibheacha nó nithe eile a dhíothú, i gcoitinne nó i gcásanna áirithe, agus go n-íocfaidh údaráis áitiúla cúiteamh, i ngach cás nó in aon chás den sórt sin.
(2) Féadfaidh an tAire le horduithe den sórt sin a ordú nó a údarú go marófar ainmhithe agus éanlaithe a bhfuil galar orthu iarbhír agus freisin ainmhithe nó éanlaithe atá faoi amhras galair nó go bhfuil nó go raibh siad sa pháirc, sa chró nó san áit chéanna nó sa tréad nó san ealta céanna nó go raibh teagbháil acu ar shlí eile le hainmhithe a bhí i ngalar nó go bhfuil nó go raibh siad i mbealach a n-aicídithe le galar.
Rialacháin údarás áitiúil.
40.—(1) Féadfar rialachán de chuid údaráis áitiúil a chruthú—
(a) trí nuachtán a thabhairt ar aird a airbheartaíonn an rialachán a bheith ann mar fhógra, nó
(b) trí chóip den rialachán a airbheartaíonn a bheith deimhnithe mar chóip dhílis ag rúnaí an údaráis áitiúil a thabhairt ar aird.
(2) Glacfar gur go cuí a rinneadh rialachán a chruthófar amhlaidh, mura gcruthófar agus go dtí go gcruthófar a mhalairt.
Feidhmeanna údaráis áitiúil i leith orduithe, etc.
41.—(1) Déanfaidh údarás áitiúil, ar a chostas féin, gach ordú ón Aire agus gach ceadúnas nó ionstraim eile a chuirfidh an tAire chuige le foilsiú, a fhoilsiú i cibé slí a ordóidh an tAire, agus faoi réir agus in éagmais aon ordacháin, trí fhógra i nuachtán a léitear i gceantar an údaráis áitiúil.
(2) Ní dhéanfaidh sé difear do bhailíocht ná d'éifeacht ordú ón Aire nó ceadúnais nó ionstraime eile a eiseoidh an tAire an céanna a fhágáil gan foilsiú nó locht nó mírialtacht a bheith in aon fhoilsiú a dhéanfar air.
CUID IV
Riarachán
Cumhachtaí ginearálta cigirí.
42.—(1) Chun críocha an Achta seo beidh ag cigire na cumhachtaí go léir atá ag comhalta den Gharda Síochána faoin Acht seo san áit a mbeidh an cigire ag gníomhú.
(2) Féadfaidh an cigire tráth ar bith dul isteach ar aon talamh nó in aon áitreabh, cró, loc, nó áit a mbeidh foras réasúnach aige chun a mheas—
(a) go bhfuil galar ann nó go raibh galar ann laistigh de shé lá is caoga, nó
(b) go bhfuil nó go raibh conablach ainmhí nó éin ghalraithe nó faoi amhras ar coinneáil ann, nó go ndearnadh é a chur, a dhíothú nó a dhiúscairt ar shlí eile ann, nó
(c) go bhfaighfear ann aon ainmhí, éan, loc, áit, feithicil nó ní ar mhainnigh aon duine ar aon ócáid forálacha an Achta seo nó ordaithe ón Aire nó rialacháin de chuid údaráis áitiúil a chomhlíonadh ina leith, nó
(d) go bhfuil an tAcht seo nó ordú ón Aire nó rialachán de chuid údaráis áitiúil gan chomhlíonadh ann.
(3) Féadfaidh cigire dul isteach aon uair in aon loc, feithicil, árthach, bád nó aerárthach a mbeidh foras réasúnach aige chun a mheas go bhfuil an tAcht seo nó ordú ón Aire nó rialachán de chuid údaráis áitiúil gan chomhlíonadh ann nó ina leith.
(4) Féadfaidh cigire aon ainmhithe nó éanlaithe a scrúdú ar aon talamh, in aon fhoirgneamh, áit, loc, feithicil, árthach, bád nó aerárthach a rachaidh sé isteach ann faoin alt seo; agus comhlíonfaidh úinéirí aon ainmhithe nó éanlaithe den sórt sin gach ceanglas réasúnach de chuid an chigire agus cuirfidh siad gach saoráid réasúnach ar fáil chun críocha an scrúdaithe sin.
(5) Aon chigire a rachaidh isteach amhlaidh mar a údaraítear leis an alt seo, tabharfaidh sé ráiteas i scríbhinn i dtaobh na bhfáthanna atá aige le dul isteach agus taispeánfaidh sé a cheapachán, má éilíonn úinéir nó áititheoir nó duine éigin eile a bheidh i bhfeighil na talún, an fhoirgnimh, na háite, an loca, na feithicle, an árthaigh, an bháid, nó an aerárthaigh é.
(6) Beidh deimhniú ó chigire nó ó dhuine údaraithe eile á dheimhniú go bhfuil nó go raibh galar a bheidh sonraithe sa deimhniú ar ainmhí nó ar éan, ina fhianaise dhochloíte, chun críocha an Achta seo, ar an ábhar a bheidh sa deimhniú.
(7) Beidh cumhachtaí cigire ar fud an Stáit nó ar feadh na coda de dá mbeidh sé ceaptha go speisialta ag cigire don Aire.
(8) D'ainneoin na bhforálacha sin roimhe seo den alt seo, féadfaidh an tAire le hordú, i gcoitinne nó maidir le haon ainmhithe nó éanlaithe áirithe nó aon ghalair áirithe, cumhachtaí cigirí de chuid údaráis áitiúil faoin Acht seo a shrianadh.
Cumhachtaí chun árthaí, agus aerárthaí a choinneáil.

43.—(1) Más deimhin le cigire de chuid an Aire go bhfuil an tAcht seo nó ordú ón Aire nó rialachán de chuid údaráis áitiúil gan chomhlíonadh ar bord árthaigh i gcalafort nó aerárthaigh in aeradróm ansin, ar uiríoll i scríbhinn chuige sin ón gcigire ina dtabharfar sonraí faoin neamhchomhlíonadh, féadfar an t-árthach nó an t-aerárthach a choinneáil go dtí go n-ordóidh an tAire a mhalairt.
(2) Déanfaidh an t-oifigeach a bheidh ag coinneáil an árthaigh nó an aerárthaigh cóip den uiríoll a sheachadadh láithreach do mháistir an árthaigh, don phíolóta a bheidh i gceannas an aerárthaigh nó don duine eile a bheidh i bhfeighil an árthaigh nó an aerárthaigh agus don oifigeach cuí Custam agus Máil.
(3) Beidh feidhm ag alt 692 den Merchant Shipping Act, 1894, agus ag ailt 64 agus 65 den Acht um Aer-Loingseoireacht agus Aer-Iompar, 1936, de réir mar is cuí, i gcás coinneála den sórt sin amhail is dá mba faoi na hAchtanna sin a údaraíodh nó a ordaíodh é.
Caiteachais chun conablaigh a thiocfaidh faoi thír a chur.
44.—(1) I gcás ina ndéanfar conablach a thiocfaidh faoi thír a chur nó a dhíothú ar ordú ó ghlacadóir raice agus le húdarás ón Aire Iompair agus Cumhachta, is caiteachais de chuid an údaráis áitiúil na caiteachais a bhainfidh leis an gcéanna agus íocfaidh an t-údarás áitiúil iad leis an nglacadóir ar iad a éileamh agus, má mhainnítear iad a íoc, féadfaidh an glacadóir na caiteachais sin mar aon le costais a ghnóthú ón údarás áitiúil.
(2) I gcás ina mbeidh údarás áitiúil tar éis dul faoi aon chaiteachais faoin alt seo chun conablach aon ainmhí, a ndearnadh é féin nó a chonablach a chaitheamh nó a scuabadh thar bord d'aon árthach, a chur nó a dhíothú, dlífidh úinéir an árthaigh na caiteachais sin a aisíoc leis an údarás áitiúil; agus féadfaidh an t-údarás áitiúil na caiteachais sin agus costais a ghnóthú sa tslí chéanna ina ndéantar tarrthálas a ghnóthú.

45.—Féadfaidh an tAire, d'fhonn an tAcht seo a fhorghníomhú, cibé cigirí breise, luachálaithe breise agus daoine breise a cheapadh, ar cibé luach saothair, agus dul faoi cibé caiteachais, faoi réir cheadú an Aire Airgeadais, a mheasfaidh an tAire is gá.
Cumhachtaí agus dualgais an Gharda Síochána.
46.—(1) Déanfaidh an Garda Síochána an tAcht seo, gach ordú ón Aire agus gach rialachán de chuid údaráis áitiúil a fhorghníomhú agus a chur i bhfeidhm.
(2) Má fheictear nó má fhaightear duine, nó má mheastar le réasún é a bheith, ag déanamh ciona faoin Acht seo, féadfaidh comhalta den Gharda Síochána, gan bharántas, é a stopadh agus a choinneáil; agus murab eol don chomhalta sin a ainm agus a sheoladh, féadfaidh an comhalta é a ghabháil gan bharántas; agus féadfaidh an comhalta sin, cibé acu a dhéanfaidh sé nó nach ndéanfaidh sé an duine sin a stopadh nó a choinneáil nó a ghabháil amhlaidh, aon ainmhí, feithicil, bád nó ní lena mbainfidh an cion nó an t-amhras ciona a stopadh, a choinneáil agus a scrúdú agus féadfaidh sé a cheangal go dtabharfar ar ais láithreach é go dtí nó isteach go dtí aon áit nó ceantar ónar aistríodh é go mídhleathach, agus féadfaidh sé an ceanglas sin a fhorghníomhú agus a chur i bhfeidhm.
(3) Má dhéanann aon duine bac nó cosc nó má chabhraíonn sé chun bac nó cosc a chur ar chomhalta den Gharda Síochána agus an tAcht seo nó ordú ón Aire nó rialachán de chuid údaráis áitiúil á fhorghníomhú aige, féadfaidh an comhalta, gan bharántas, an ciontóir a ghabháil.

Cionta agus Imeachtaí Dlíthiúla
Cionta a ionchúiseamh.
47.—Féadfaidh an tAire cion faoin Acht seo a ionchúiseamh.
Cionta nach mbeidh ach fineáil le gearradh ina leith mura ndéanfar an cion athuair laistigh de dhá mhí dhéag.
48.—(1) Má dhéanann aon duine, gan údarás nó leithscéal dleathach a mbeidh a chruthú air féin, aon ní acu seo a leanas, beidh sé ciontach i gcion—
(a) má dhéanann sé aon ní contrártha don Acht seo, nó d'ordú ón Aire nó do rialachán de chuid údaráis áitiúil; nó
(b) más rud é, i gcás ina mbeidh sé faoi cheangal ag an Acht seo nó ag ordú nó rialachán arna dhéanamh faoi, ainmhí nó éan a choimeád ar leithligh a mhéid is féidir é nó fógra i dtaobh galair a thabhairt a luaithe is féidir é, go mainneoidh sé déanamh amhlaidh; nó
(c) má mhainníonn sé aon fhógra, ceadúnas, riail nó ní a thabhairt, a thabhairt ar aird, a urramú nó a dhéanamh a cheanglaítear leis an Acht seo, nó le hordú ón Aire, nó le rialachán de chuid údaráis áitiúil nó ag duine údaraithe a thabhairt, a thabhairt ar aird, a urramú, nó a dhéanamh; nó

(f) má dhiúltaíonn sé cead a thabhairt do chigire nó d'oifigeach nó do dhuine údaraithe eile ag gníomhú dó ag forghníomhú an Achta seo nó ordaithe ón Aire nó rialacháin de chuid údaráis áitiúil dul isteach ar aon talamh nó in aon fhoirgneamh, áit, árthach, loc, feithicil, bád, aerárthach a mbeidh an cigire nó an t-oifigeach i dteideal dul isteach air nó ann nó é a scrúdú nó má chuireann sé bac nó cosc air ag dul isteach nó ag scrúdú dó amhlaidh nó má chuireann sé bac nó cosc in aon slí eile ar chigire nó ar chomhalta den Gharda Síochána a bheidh ag déanamh a dhualgais, nó má chabhraíonn sé le haon bhac nó cosc den sórt sin; nó
(g) má chaitheann sé nó má chuireann sé, nó má chuireann sé faoi deara nó má cheadaíonn sé go gcaithfear nó go gcuirfear, amach in aon abhainn, sruthán, uiscebhealach canálach, nó aon uisce eile, nó amach san fharraige i bhfogas trí mhíle don chladach conablach ainmhí nó éin a fuair bás de ghalar, nó a maraíodh de bhíthin é bheith galraithe nó faoi amhras; nó
(h) má dhiúltaíonn sé nó má mhainníonn sé aon eolas a bheidh aige a thabhairt nuair a cheanglófar go cuí air faoin Acht seo sin a thabhairt nó má thugann sé go toiliúil nó go faillíoch eolas bréagach nó míthreorach.
(2) Aon duine a bheidh ciontach i gcion faoi fho-alt (1) dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £100 a chur air.
(3) Má dhéanann duine a ciontaíodh i gcion faoi aon mhír d'fho-alt (1) cion breise faoin mír chéanna laistigh de dhá mhí dhéag tar éis an chiontaithe sin, dlífear, ar é a chiontú go hachomair agus de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná mí a chur air in ionad na fíneála a dhlitear a chur air faoi fho-alt (2).

49.—(1) Má dhéanann duine aon ní acu seo a leanas, beidh sé ciontach i gcion—
(a) má dhéanann sé, d'fhonn an tAcht seo nó ordú ón Aire nó rialachán de chuid údaráis áitiúil a sheachaint, aon ní ar gá ceadúnas chuige faoin Acht seo, nó faoi ordú ón Aire nó faoi rialachán de chuid údaráis áitiúil, gan ceadúnas a fháil; nó
(b) má dhéanann sé, i gcás inar gá ceadúnas, agus tar éis dó an ceadúnas sin a fháil agus ar an intinn chéanna, an ní a ceadúnaíodh tar éis don cheadúnas dul in éag; nó
(c) má úsáideann sé nó má thairgeann sé mar cheadúnas iomlán, nó ionstraim a airbheartaíonn nó a dheal-raíonn go neamhfhírinneach gur ceadúnas é nó má dhéanann sé iarracht ar ionstraim den sórt sin a úsáid, mura suífidh sé chun sástacht na cúirte nárbh fheasach dó an neamhiomláine nó an bhréag sin agus nach bhféadfadh sé le dúthracht réasúnach fios a fháil faoi; nó
(d) má dhéanann sé ceadúnas, dearbhú, deimhniú, nó ionstraim a rinneadh nó a eisíodh, nó a airbheartaíonn a bheith arna dhéanamh nó arna eisiúint, faoi réim nó chun aon chríche de chuid an Achta seo nó ordú ón Aire nó de rialachán de chuid údaráis áitiúil, a athrú, nó a dhéanamh go bréagach, nó a réamhdhátú, nó a ghóchumadh nó a thairiscint nó a rith, agus a fhios aige gur athraíodh é, gur go bréagach a rinneadh é, nó go ndearnadh é a réamhdhátú nó a ghóchumadh; nó
(e) má dhéanann sé, d'fhonn ceadúnas, deimhniú nó ionstraim a fháil, dearbhú nó raiteas a bheidh bréagach in aon phonc ábhartha, mura suífidh sé chun sástacht na cúirte nárbh eol dó é a bheith bréagach amhlaidh agus nach bhféadfadh sé le dúthracht réasúnach fios a fháil faoi; nó
(f) má fhaigheann sé ceadúnas, deimhniú nó ionstraim den sórt sin, nó má dhéanann sé iarracht a leithéid a fháil, trí dhúmas bréige, mura suífidh sé chun sástacht na cúirte nárbh eol dó é a bheith bréagach, agus nach bhféadfadh sé le dúthracht réasúnach fios a fháil faoi; nó
(g) má dheonaíonn sé nó má eisíonn sé ceadúnas, deimhniú nó ionstraim den sórt sin a bheidh bréagach in aon dáta nó aon phonc ábhartha eile, mura suífidh sé chun sástacht na cúirte nárbh eol dó é a bheith bréagach amhlaidh, agus nach bhfeadfadh sé le dúthracht réasúnach fios a fháil faoi, nó má dheonaíonn sé nó má eisíonn sé ceadúnas, deimhniú nó ionstraim den sórt sin gan údarás dleathach a bheith aige, agus a fhios aige nach bhfuil údarás dleathach aige, é a dheonú nó a eisiúint; nó
(h) má dheonaíonn sé nó má eisíonn sé, le hintinn an tAcht seo nó ordú ón Aire, nó rialachán de chuid údaráis áitiúil, a sheachaint nó a chur ar neamhní, ionstraim a bheidh i bhfoirm cheadúnais, deimhnithe nó ionstraime arna dhéanamh nó arna eisiúint faoin Acht seo nó faoi ordú ón Aire nó faoi rialachán den chuid údaráis áitiúil, chun gluaiseacht ainmhí áirithe nó éin áirithe nó déanamh aon ní áirithe eile a cheadú nó a rialáil, ach a bheidh arna heisiúint bán, is é sin, nach mbeidh sí, sula n-eiseofar í, líonta isteach sa chaoi go sonraíonn sí aon ainmhí áirithe nó aon ní áirithe; nó
(i) má úsáideann sé nó má thairgeann sé ionstraim a eiseofar bán amhlaidh, nó má fhéachann sé le hionstraim den sórt sin a úsáid, chun aon chríche de chuid an Achta seo nó d'ordú ón Aire nó de rialachán de chuid údaráis áitiúil, mura suífidh sé chun sástacht na cúirte nárbh eol dó í a bheith arna heisiúint bán amhlaidh agus nach bhféadfadh sé le dúthracht réasúnach fios a fháil faoi; nó
(j) má fhaigheann sé cúiteamh, nó má fhéachann sé cúiteamh a fháil, ón Aire trí aon chalaois nó dúmas bréige i leith ainmhí nó éan a mharófar nó aon chonablach nó uibheacha a dhíothófar, nó má chabhraíonn sé nó má neartaíonn sé le haon duine in aon chalaois nó dúmas bréige den sórt sin; nó
(k) má bhaineann sé as talamh, nó má chuireann sé faoi deara go mbainfear as talamh, conablach a cuireadh ar ordachán ón Aire nó ó údarás áitiúil nó ó ghlacadóir raice, gan údarás nó leithscéal dleathach a mbeidh a chruthú air féin; nó
(l) más rud é, i gcás ina mbeidh sé toirmiscthe, go hiomlán nó go coinníollach ag an Aire le hordú, árthach, feithicil, aerárthach nó loc nó áit a úsáid chun ainmhithe nó éin a iompar nó chun aon chríche a bhainfidh leis sin, go ndéanfaidh sé, gan údarás nó leithscéal dleathach, a mbeidh a chruthú air féin, aon ní a bheidh toirmiscthe amhlaidh.
(2) Aon duine a bheidh ciontach i gcion faoi fho-alt (1) dlífear, ar é a chiontú go hachomair, fíneáil nach mó ná £100 nó, de rogha na cúirte, príosúnacht ar feadh téarma nach faide ná dhá mhí a chur air.

50.—Aon duine arb éagóir leis ordú a dhéanfaidh an Chúirt Dúiche ar ghearán faoin Acht seo a chinneadh féadfaidh sé achomharc a dhéanamh ina aghaidh chun breitheamh na Cúirte Cuarda arb ina chuairt don teach cúirte inar tugadh cinneadh na Cúirte Dúiche, agus is cinneadh críochnaitheach cinneadh an bhreithimh.
Imeachtaí faoi na hAchtanna Custam i ngeall ar ainmhithe, etc., a chur i dtír nó a loingsiú go mídhleathach.
51.—(1) Má dhéanann aon duine, nó má dhéanann sé iarracht, ainmhí, éan nó ní a chur i dtír nó a loingsiú contrártha don Acht seo nó d'ordú ón Aire, dlífear, faoi réim agus de réir na hAchtanna Custam, na pionóis a chur air a fhorchuirtear ar dhaoine a dhéanann, nó a dhéanann iarracht, earraí a onnmhairiú nó a allmhairiú a bhfuil sé toirmiscthe, faoi réim nó de réir na nAchtanna Custam, iad a allmhairiú nó a onnmhairiú, ach sin gan dochar d'aon imeacht ina aghaidh i leith ciona faoin Acht seo.
(2) Déanfar an t-ainmhí, an t-éan nó an ní arb ina leith a rinneadh an cion a fhorghéilleadh faoi réim agus de réir na nAchtanna Custam mar a dhéantar i gcás earraí a bhfuil sé toirmiscthe faoi réim agus de réir na nAchtanna Custam iad a allmhairiú.

52.—(1) I gcás ina ndéanfar úinéir nó duine a bheidh i bhfeighil ainmhí nó éin a chúiseamh i gcion faoin Acht seo maidir le galar nó aon tinneas a bheidh ar an ainmhí nó ar an éan, toimhdeofar gurbh eol dó an galar nó an tinneas a bheith ann mura suífidh sé chun sástacht na cúirte nach raibh an t-eolas sin aige agus nach bhféadfadh sé le dúthracht réasúnach an t-eolas sin a fháil.
(2) I gcás ina gcúiseofar duine i gcion faoin Acht seo toisc nach ndearna sé aon áit, árthach, feithicil, aerárthach nó ní ba leis féin nó a raibh sé ina fheighil a ghlanadh nó a dhí-aicidiú go cuí, agus go dtógfar toimhde ina aghaidh ó thaobh an ionchúisimh, beidh air a chruthú go ndearnadh an céanna a ghlanadh agus a dhí-aicídiú go cuí.
(3) Measfar gach cion faoin Acht seo a dhéanamh, agus measfar gach cúis ghearáin nó ábhar le haghaidh imeachta faoin Acht seo nó faoi ordú ón Aire nó faoi rialachán de chuid údaráis áitiúil tarlú, in aon áit ina ndearnadh an cion nó inar tharla sé iarbhír, nó in aon áit ina mbeidh an duine a bheidh cúisithe nó a mbeidh gearán déanta ina aghaidh nó a mbeidh imeachtaí tionscanta ina aghaidh an tráth a thionscnófar nó a thosófar an cúiseamh, an gearán nó an imeacht.
Fianú ionstraimí agus a bhfoirm agus a seirbheáil.
53.—(1) In aon imeacht faoin Acht seo ní gá cruthúnas ar cheapachán ná lámhscríbhneoireacht chigire nó oifigigh eile de chuid an Aire nó rúnaí, chigire nó oifigigh eile de chuid údaráis áitiúil.
(2) Ní foláir gach fógra faoin Acht seo nó faoi ordú nó rialachán arna dhéanamh faoin Acht seo a bheith i scríbhinn.
(3) Féadfaidh an tAire orduithe a dhéanamh d'fhorordú agus do rialáil foirm agus modh seirbhéala nó seachadtha fógraí agus ionstraimí eile.
(4) Féadfar aon fhógra nó aon ionstraim eile faoin Acht seo nó faoi ordú ón Aire nó faoi rialachán de chuid údaráis áitiúil a sheirbheáil ar an duine dá ndéanfaidh sé difear, trína sheachadadh dó go pearsanta, nó trína fhágáil dó san áit chónaithe nó ghnó is déanaí is eol a bheith aige nó trína dhíriú chuige leis an bpost i gclúdach réamhíoctha go dtí an áit sin.

54.—(1) Ní dhéanfaidh aon duine, cibé lá a cheapfaidh an tAire le hordú ná tar éis an lae sin, aon bheithígh adharcaca a dhíol, ná a thairiscint ná a thaispeáint lena ndíol ná a onnmhairiú ná a thaispeáint lena n-onnmhairiú.
(2) Féadfaidh an tAire le hordú aon aicme nó cineál áirithe beithíoch a eisceadh ó fheidhm fho-alt (1).
Leasú ar an Acht um Olainn Ghlain, 1947,
55.—Ní bhainfidh ailt 7 agus 8 den Acht um Olainn Ghlain, 1947, (a thoirmeascann dipeanna caorach de chineál áirithe a mhonarú nó déileáil leo) le dipeanna arna gceadú ag an Aire faoi údarás reachtúil.
Orduithe i dtaobh madraí.
56.—Féadfaidh an tAire orduithe a dhéanamh—
(a) lena bhforordófar agus lena rialálfar cur féastrach ar mhadraí agus coimeád madraí faoi smacht;
(b) d'fhorordú coiléar nó úim a bheith ar mhadraí agus ainm agus seoladh an úinéara a bheith greannta ar an gcéanna nó ar phláta nó ar shuaitheantas a bheidh daingnithe den chéanna agus dá rialáil sin;
(c) d'fhonn ciapadh ainmhithe a chosc, do chosc madraí, nó aon chineál madraí, ó bheith ag fanaíocht le linn na n-uaire go léir, nó le linn aon chuid de na huaire, idir luí gréine agus éirí gréine;
(d) d'fhoráil go bhféadfar aon mhadra a mbeidh cion á dhéanamh ina leith, in aghaidh forálacha a rinneadh faoi mhír (b) nó (c), a cheapadh agus déileáil leis mar mhadra fáin faoi na hachtacháin a bhaineann le madraí;

Bainne deighilte a phaistéaradh.
57.—(1) Féadfaidh an tAire rialacháin a dhéanamh faoin Acht Tora Déiríochta, 1924, á cheangal go mbeidh i ngach áitreabh nó in aon áitreabh atá cláraithe i gclár na n-uachtarlann nó i ngach áitreabh nó in aon áitreabh atá cláraithe i gclár na stáisiún deighilte uachtair gléasra chun bainne deighilte a phaistéaradh agus féadfaidh sé, leis na rialacháin sin, a ordú cad é an modh agus cad é an chuma, ar gach slí, ina ndéanfar bainne deighilte a phaistéaradh agus cad iad na taifid a bheidh le coimeád maidir leis sin agus a cheangal go gcoimeádfar na taifid sin chun a n-iniúchta agus go gcuirfear ar fáil iad chun a n-iniúchta.
(2) I gcás ina mbeifear tar éis rialacháin a dhéanamh faoi fho-alt (1) maidir le háitreabh atá cláraithe i gclár na n-uachtarlann, déanfar an bainne deighilte go léir is gá de réir na rialachán sin a phaistéaradh san áitreabh sin a phaistéaradh de réir na rialachán sin.
(3) I gcás go mbeifear tar éis rialacháin a dhéanamh faoi fho-alt (1) maidir le háitreabh atá cláraithe i gclár na stáisiún deighilte uachtair, déanfar an bainne deighilte go léir is gá de réir na rialacháin sin a phaistéaradh san áitreabh sin a phaistéaradh de réir na rialachán sin.
(4) San alt seo ciallaíonn “bainne deighilte” an chuid sin den bhainne a bhíonn fágtha tar éis an gheir nó formhór na geire a bhaint as.
(5) Forléireofar an t-alt seo agus an tAcht Tora Déiríochta, 1924, mar aon ní amháin.
(6) Is alt in ionad alt 4 den Acht um Ghalair Ainmhithe (Eitinn Bhólachta), 1957, a aisghairtear leis an Acht seo an t-alt seo.
Forálacha maidir le cúiteamh.
58.—(1) Beidh feidhm ag forálacha an ailt seo maidir le cúiteamh faoi alt 17 nó 22.
(2) Féadfaidh an tAire le hordú agus le toiliú an Aire Airgeadais—
(a) foráil a dhéanamh do rialáil déanamh agus cinneadh iarratas ag iarraidh cúitimh agus an mhodha ina ndéanfar cúiteamh a mheasúnú agus a íoc;
(b) foráil a chur isteach chun cúiteamh a shocrú trí chomhaontú idir an t-iarratasóir agus an tAire nó, mura gcomhaontófar amhlaidh, ag luachálaí a cheapfaidh an t-iarratasóir agus an tAire trí chomhaontú nó, mura gcomhaontófar amhlaidh, ag luachálaí a cheapfaidh an tAire;
(c) foráil a chur isteach, i gcás ina ndíospóidfidh an t-iarratasóir cinneadh an iarratais, chun go socrófar an díospóid trí eadráin.
(3) I gcás ina gciontófar duine i gcion faoin Acht seo maidir le haon ainmhithe nó éanlaithe a mharófar nó a ngabhfar seilbh orthu, nó conablaigh nó uibheacha a dhíothófar, faoin Acht seo, ansin, mar iarmairt reachtúil de dhroim an chiontaithe sin, ní bheidh sé i dteideal cúiteamh a fháil i leith na n-ainmhithe, na n-éanlaithe, na gconablach nó na n-uibheacha sin.
(4) Más rud é, faoi fho-alt (3), go mbeidh duine curtha ó theideal cúiteamh a fháil, féadfaidh an tAire íocaíocht ex gratia a thabhairt dó, a mbeidh ann méid is cuí leis an Aire, in ionad cúitimh, ag cur aon chaillteanas a bhainfidh don Státchiste i ngeall ar an gcion san áireamh.
(5) Féadfar a fhoráil le hordú faoi fho-alt (2) go gcuirfear breithniú iarratais ag iarraidh cúitimh ar atráth go dtí go dtionscnófar nó go gcinnfear ionchúiseamh i leith cion faoin Acht seo maidir le hainmhithe, éanlaithe, conabhlaigh nó uibheacha is ábhar don iarratas sin.
(6) Féadfar a fhoráil le hordú faoi fho-alt (2) go bhféadfar, nuair a bheidh cúiteamh á mheasúnú, asbhaintí a mheasfar i cibé slí a bheidh forordaithe a dhéanamh i leith aon chaillteanas a bhainfidh don Státchiste nó don iarratasóir féin i ngeall ar gur mhainnigh an t-iarratasóir cúram réasúnach a ghlacadh chun na hainmhithe, na héanlaithe, na conablaigh nó na huibheacha is ábhar don iarratas a chosaint ar an ngalar a bheidh i gceist, nó, i gcás ainmhithe nó éanlaithe a allmhaireofar, nuair a shuífear go raibh siad galraithe nuair a allmhairíodh iad.

DISEASES OF ANIMALS ACT, 1966
PART I
Preliminary and General
Short title and commencement.
1.—(1) This Act may be cited as the Diseases of Animals Act, 1966.
(2) This Act or any specified provision of this Act shall come into operation on such day or days as the Minister may by order appoint.
Interpretation.
2.—(1) In this Act, except where the context otherwise requires—
“aerodrome” means any area of land (including water) where facilities are afforded for landing and departure of aircraft;
“animal” means an animal of a kind specified in Part I of the First Schedule.
“animal remedy” has the meaning assigned to it in section 2 of the Animal Remedies Act, 1956;
“attested or disease-free area” has the meaning assigned to it in section 19 (1) (b);
“authorised person” has the meaning assigned to it in section 25;
“bird” means a bird of a kind specified in Part II of the First Schedule;
“carcase” means the carcase of an animal or bird and includes part of a carcase, and the meat, bones, hide, blood, skin, pelt, hair, fur, wool, feathers, hooves, horns, offal or other part of an animal or bird, separately or otherwise, or any portion thereof;
“cattle” means bulls, cows, bullocks, heifers and calves;
“Class A disease” means a disease for the time being specified in Class A of Part III of the First Schedule;
“Class B disease” means a disease for the time being specified in Class B of Part III of the First Schedule;
“clearance area” has the meaning assigned to it in section 19 (1) (a);
“disease” means a disease specified in Part III of the First Schedule;
“diseased” means affected with a disease;
“eggs” means the eggs of poultry and includes parts of such eggs;
“fodder” means hay or other substance (including milk) used for food of animals or poultry;
“horned cattle” means cattle bearing horns other than stub or rudimentary horns;
“horse” includes ass and all other equines;
“imported” as applied to animals, poultry and things, means brought by any means into the State from outside the State and “importation” shall be construed accordingly;
“in contact with” in relation to a diseased or suspected animal or bird, means being or having been in the same field, shed, stable, sty, pen or other place, or in the same herd or flock as, or otherwise in contact with, that animal or bird;
“infected place or area” has the meaning assigned to it by section 14;
“inspector” means a person being a veterinary surgeon appointed by the Minister or a local authority to be an inspector for the purposes of this Act;
“landing” in relation to imported animals, poultry, or things, means landing them from a ship, vessel, aircraft, or vehicle, or otherwise introducing them into the State;
“licence” means a licence granted by the Minister;
“litter” means straw or other substance commonly used for bedding or otherwise for or about animals or poultry;
“local authority” means the council of a county or county borough;
“Minister” means the Minister for Agriculture and Fisheries;
“order of the Minister” means an order made by the Minister under this Act;
“poultry” means birds of a kind specified in Part II of the First Schedule;
“prescribe” means prescribe by order;
“quarantine station” has the meaning assigned to it by section 31;
“regulation of a local authority” means a regulation made by a local authority under this Act;
“shipping” includes carriage by air and carriage in a vehicle;
“suspected” means suspected of being diseased;
“veterinary surgeon” means any person lawfully qualified to practice veterinary surgery in the State.
(2) In this Act, a reference to a Part, section or Schedule is to a Part, section or Schedule of this Act unless otherwise indicated.
(3) In this Act, a reference to any enactment is to that enactment as amended or extended by any other enactment including this Act.
General powers of Minister.
3.—(1) The Minister may make orders, subject and according to the provisions of this Act—
(a) generally, for the due execution of this Act or for the prevention of the spreading of disease;
(b) in particular, for the several purposes specified in this Act, including any matter which under this Act may be prescribed.
(2) The Minister may by order amend or revoke any order under this Act.
Laying of orders.
4.—Every order made by the Minister under this Act shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the order is passed by either such House within the next twenty-one days on which that House has sat after the order is laid before it, the order shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.
Licences.
5.—The Minister may grant licences for any of the purposes of this Act, attach conditions to any such licence, vary such conditions and revoke any such licence.
Exemption from stamp duty and fees.
6.—No stamp duty shall be payable, on, and, save as otherwise prescribed, no fee or other charge shall be demanded or made for, any appointment, certificate, declaration, licence or thing under this Act, or for any inspection or other act precedent to the granting, making, or doing of a certificate, declaration, licence, or other thing.
Expenses.
7.—The expenses incurred by the Minister in the administration of this Act shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.
Disposal of moneys received by Minister.
8.—Moneys received by the Minister under this Act shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance shall direct.
Repeal and transitional provisions.
9.—(1) Each of the enactments set out in the Third Schedule is, subject to subsection (2), hereby repealed to the extent specified in the third column of that Schedule.
(2) Until such time as this Act or any particular provision of this Act comes into operation, the corresponding provisions of the repealed enactments shall remain in force.
(3) Every instrument made or thing done under any repealed enactment shall continue to have effect and, so far as it could have been made or done under this Act, shall have effect as if made or done under the corresponding provision of this Act.
(4) Any document referring to any repealed enactment shall be construed as referring to this Act or the corresponding provision of this Act.
Continuance of orders and regulations.
10.—Every order and regulation made under a repealed enactment and in force immediately before the commencement of this Act shall continue in force and may be amended or revoked as if made under this Act.
PART II
Control and Eradication of Disease
Application
Application of this Act.
11.—(1) Subject to subsection (2), this Act shall apply to the animals, poultry and diseases specified in the First Schedule.
(2) The Minister may, for all or any of the purposes of this Act, by order amend the First Schedule so as to extend the application of this Act or any of its provisions to any other kind of animal, poultry or disease or to exclude any kind of animal, poultry or disease from such application.
Prevention and Eradication
Notification of disease.
12.—(1) The Minister may prescribe that notice be given of the existence or suspected existence of any particular disease or illness of animals or poultry, the persons by whom the notice is to be given, and the authority to whom and the manner in which it is to be given.
(2) An order made for the purposes of this section may provide for the payment by the Minister or a local authority of a fee to a veterinary surgeon in respect of each notification of disease by him and may, with the consent of the Minister for Finance, specify the amount of such fee.
Orders for prevention or checking of disease.
13.—The Minister may, for the purpose of the prevention or checking or eradication of disease, make orders for all or any of the purposes set out in the Second Schedule.
Infected Places and Areas
General provisions as to infected places and areas.
14.—(1) The Minister may prescribe—
(a) the cases in which places and areas are to be declared to be infected with a disease;
(b) the authority, mode and conditions by and on which declarations in that behalf are to be made;
(c) the effect and consequences of such declarations;
(d) the duration and discontinuance of such declarations; and
(e) other matters connected with the making of such declarations.
(2) The Minister may by order alter the limits of a place or area declared to be infected by disease.
(3) Every place or area so declared infected shall be an infected place or area for the purposes of this Act.
(4) Where an order is made declaring a place or area to be no longer an infected place or area then from the time specified in the order the place or area shall cease to be, or be in, an infected place or area.
(5) An order or notice of the following description—
(a) an order of the Minister or of a local authority declaring a place to be an infected place or area, or declaring a place or area to be no longer an infected place or area; or
(b) a notice served in pursuance of directions of the Minister or of a local authority by virtue of an order made under this section,
shall be conclusive evidence to all intents of the existence or cessation of the disease and of any other matter whereon the order or notice proceeds.
Orders relating to infected places and areas.
15.—The Minister may make orders—
(a) prescribing and regulating the publication, in relation to a place or area declared infected, of the fact of such declaration;
(b) prohibiting or regulating the movement of animals and poultry and persons into, within, or out of an infected place or area;
(c) prescribing and regulating the isolation or separation of animals and poultry being in an infected place or area;
(d) prohibiting or regulating the removal of carcases, eggs, fodder, litter, utensils, pens, hurdles, dung, or other things into, within, or out of an infected place or area;
(e) prescribing and regulating the destruction, burial, disposal, or treatment of carcases, eggs, fodder, litter, utensils, pens, hurdles, dung, or other things, being in an infected place or area, or removed thereout;
(f) prescribing and regulating the cleansing and disinfection of infected places and areas, or parts thereof, and of receptacles or vehicles used for the confinement or conveyance of animals or poultry;
(g) prescribing and regulating the disinfection of the clothes of persons being in an infected place, and the use of precautions against the spreading of disease by such persons.
Power to exclude strangers.
16.—A person owning or having charge of animals, poultry or eggs in an infected place or area may affix, at or near the entrance to a building, enclosure or farm in which the animals, or poultry or eggs are, a notice forbidding persons to enter thereon without the permission mentioned in the notice, and thereupon it shall not be lawful for any person, not having by law a right of entry or way into, on or over that building, enclosure or farm, to enter or go into, on, or over it without that permission.
Slaughter
Slaughter of diseased animals and compensation.
17.—(1) The Minister may cause to be slaughtered—
(a) any animals or poultry affected with any Class A disease or suspected of being so affected, and
(b) any animals or poultry which are or have been in the same field, shed or other place, or in the same herd or flock or otherwise in contact with animals or birds so affected or suspected of being so affected, or which appear to the Minister to have been in any way exposed to the infection concerned.
(2) The Minister shall, subject to section 58, pay compensation for animals and poultry (other than a dog or a cat affected or suspected of being affected with rabies) which have been slaughtered under this section or which have been directed to be slaughtered but die before they can be slaughtered and also for carcases and eggs (other than eggs of pigeons, doves, peafowl, swans or birds of the species psittaciformes) which, consequent upon an outbreak or suspected outbreak of disease, have been destroyed on behalf of the Minister.
(3) The Minister may reserve for observation, treatment or testing, an animal or bird liable to be slaughtered under this Act at the direction of the Minister but subject to payment of compensation by the Minister as in the case of actual slaughter.
General provisions as to disposal of animals, poultry and carcases.
18.—(1) Where an animal or bird has been slaughtered under this Act at the direction of the Minister, the carcase of the animal or bird shall belong to the Minister and shall be buried or sold or otherwise disposed of at the direction of the Minister, as the condition of the animal or bird or carcase and other circumstances may require or admit.
(2) If, in any case, the sum received by the Minister on sale of a carcase under this section exceeds the amount paid for compensation to the owner of the animal or bird slaughtered, the Minister shall pay that excess to the owner, after deducting reasonable expenses.
(3) If the owner of an animal or bird slaughtered under this Act at the direction of the Minister or a local authority, has an insurance on the animal or bird, the amount of compensation awarded to him under this Act or any order made thereunder may be deducted by the insurers from the amount of the money payable under the insurance before they make any payment in respect thereof.
(4) Where an animal or bird has been slaughtered under this Act at the direction of the Minister, the Minister may use for the burial of the carcase any ground in the possession or occupation of the owner of the animal or bird suitable for the purpose, or any common or unenclosed land.
(5) Where an inspector, after making such inquiries as he considers necessary, is satisfied that no such ground as mentioned in subsection (4) is available for the burial of the carcases of slaughtered animals or poultry, the Minister may use for the reception and slaughter of the animals or poultry and the burial of their carcases any convenient ground suitable for the purpose.
(6) (a) Where the owner or occupier of any such ground claims to have suffered loss by reason of such user, he may, within two months after such user, apply in writing to the Minister for compensation.
(b) Where an application for compensation under this subsection is duly made, the application shall be determined in accordance with such order as may be made by the Minister in that regard.
(c) In the event of the applicant disputing any such determination the dispute shall be settled by arbitration.
Clearance, Attested and Disease-Free Areas
Clearance, attested and disease-free areas.
19.—The Minister may, where it appears to him to be necessary for the purpose of the eradication of any Class B disease, make in relation to such disease orders—
(a) declaring an area (in this Act referred to as a clearance area) to be an area in which the disease is to be eradicated;
(b) declaring an area as to which the Minister is satisfied that the disease is virtually nonexistent, to be an attested or disease-free area;
(c) prescribing the conditions under which animals or poultry may be exported, and designating ports or aerodromes, or parts of ports or aerodromes, or routes for such export.
Orders in relation to clearance, attested and disease-free areas.
20.—The Minister may make, in relation to any clearance area or attested or disease-free area, orders—
(a) as to animals or poultry affected or suspected of being affected or capable of affecting animals or poultry with the relevant disease—
(i) authorising the taking of possession, by agreement, of the animals or poultry on behalf of the Minister;
(ii) in default of agreement, securing and regulating the removal out of the area or slaughter of the animals or poultry;
(iii) securing and regulating the isolation and maintenance of the animals or poultry pending their being taken possession of on behalf of the Minister or removed out of the area or slaughtered;
(b) securing and regulating the isolation and testing from time to time of animals or poultry brought on to land or premises;
(c) the prohibition or restriction of the movement of animals and poultry into, out of, through or within the area;
(d) securing and regulating the keeping of records in relation to animals or poultry and the production and inspection of the records;
(e) specifying forms of notices to be served under orders made by virtue of this section;
(f) providing, in cases in which there has been failure to comply with the requirements of any such notice, for—
(i) in case the notice requires removal out of the area or slaughter of animals or poultry—the taking of possession of the animals or poultry, their disposal as the Minister thinks fit and the recovery (without prejudice to any penalty that may have been incurred) of the cost of taking possession of the animals or poultry and of thereafter maintaining them and disposing of them;
(ii) in any other case—the carrying out of the requirements of the notice by or on behalf of the Minister and the recovery (without prejudice to any penalty which may have been incurred) of the cost of carrying out the requirements;
(g) determining, in the case of holdings situate partly within and partly outside any clearance, attested or disease-free area, or situate wholly or partly within two or more such areas, the area to which such holdings belong;
(h) authorising entry on land or premises for the purposes of any such order;
(i) for purposes ancillary or incidental to any of the foregoing purposes.
Regulations as to animal remedies.
21.—Section 7 (1) of the Animal Remedies Act, 1956, shall, notwithstanding subsection (2) of that section, apply to any animal remedy specified in any order of the Minister in relation to any specified Class B disease.
Compensation for animals and poultry taken in clearance, attested and disease-free areas.
22.—The Minister shall, subject to section 58, pay compensation for animals and poultry taken possession of on his behalf pursuant to an order under section 20.
Slaughter and compensation in other cases.
23.—(1) The Minister may, in relation to any Class B disease, give public notice in such manner as he considers suitable of his intention to make an order under which a specified area will be a clearance area.
(2) Where notice is given under this section in relation to an area, the Minister, with the consent of the Minister for Finance, may pay compensation for animals or poultry in that area which, having failed to pass a test for the disease approved by the Minister, are slaughtered by arrangement between the Minister and the owner of the animals or poultry.
Registers of attested or disease-free herds and flocks.
24.—(1) The Minister may for any Class B disease set up and maintain a register of herds or flocks of any particular species of animals or poultry.
(2) Herds or flocks registered in a register shall be known as attested or disease-free herds or flocks or by such other description as the Minister may prescribe.
(3) A person shall not—
(a) hold out a herd or flock as being an attested or disease-free herd or flock or as coming within a prescribed description unless it is either entered in the appropriate register or is a disease-free herd or flock situate in an attested or disease-free area, or
(b) hold out any animal or bird as being of an attested or disease-free herd or flock or as coming within a prescribed description unless it is either of a herd or flock entered in the appropriate register or is of a disease-free herd or flock situated in an attested or disease-free area.
(4) A person who contravenes the provisions of subsection (3) shall be guilty of an offence.
(5) The Minister may make orders in relation to a register, including in particular provision for—
(a) the title of the register,
(b) application for registration,
(c) qualifications and conditions for registration,
(d) requirements to be complied with for retention of registration,
(e) cancellation of registration,
(f) custody of the register and evidence of the contents thereof.
Testing, Marking, Etc.
Powers of authorised persons and officers.
25.—(1) For the purpose of the eradication of a Class B disease, an authorised person, on production, if requested, of his authorisation, may at all reasonable times—
(a) in relation to any animals or poultry, make such examinations, apply such tests, take such samples, use such vaccine or serum and apply such marks as may be reasonably necessary, or as may be required or prescribed by this Act or by the Minister;
(b) enter on any land or premises for the purpose of such examining, testing, sampling or marking;
(c) require any person, being the owner or in charge of animals or poultry or the owner or occupier of or employed on lands or premises so entered, to give such assistance or to carry out such instructions as may be reasonably necessary for the purpose of such examining, testing, sampling or marking or to give such information as may be reasonably necessary in connection with the furtherance of eradication of the disease or for the administration of any order under this Act.
(2) In this section—
“authorised person” means—
(a) an inspector of the Minister, or
(b) a veterinary surgeon other than an inspector of the Minister,
authorised by the Minister in writing to exercise the powers conferred by this section.
(3) An officer of the Minister who is not an inspector shall have such of the powers of an authorised person under this section as he may be authorised in writing by the Minister to exercise.
Movement and Transit
Diseased animals or poultry in transit.
26.—The Minister may make orders—
(a) prohibiting or regulating the sending or carrying of diseased or suspected animals or poultry, or of dung or other thing likely to spread disease, or causing them to be sent or carried, on railways, canals, rivers or inland navigations, or on highways or thoroughfares, or in vessels, aircraft or otherwise;
(b) prohibiting or regulating the leading or driving of diseased or suspected animals or poultry, or the causing of them to be led or driven on highways or thoroughfares or elsewhere;
(c) prohibiting or regulating the placing or keeping of diseased or suspected animals or poultry on common or unenclosed land or in fields or other places insufficiently fenced, or on the sides of highways;
(d) prohibiting or regulating the exposure of diseased or suspected animals or poultry in markets or fairs or saleyards, or other public or private places where animals or poultry are commonly exposed for sale;
(e) making provision for animals and poultry affected or suspected of being affected with disease—
(i) while exposed for sale or exhibited in a market, fair, sale-yard, place of exhibition or other place, or
(ii) while placed in a lair or other place before exposure for sale, or
(iii) while in transit or in course of being moved by land or by water, or
(iv) while being in common or unenclosed land, or
(v) while being in a slaughter-house or place where animals or poultry are slaughtered or are kept with a view to slaughter, or
(vi) generally, while being in a place not in the possession or occupation or under the control of the owner of the animals or poultry;
(f) making provision for the consequences under this Act of animals or poultry being found in the places and in the circumstances mentioned in this section, both in relation to the places in which the animals or poultry are so found and to any other animals or poultry that may be or may have been in any of the said places and with which they were or may have been in contact.
Regulation of movement of animals, fairs, markets, etc.
27.—The Minister may make orders—
(a) prohibiting, regulating or restricting the movement save under licence of animals or poultry and the removal of carcases, fodder, litter, dung, eggs and other things, for prohibiting and regulating the user of eggs and for prescribing and regulating the isolation of animals or poultry newly purchased or imported;
(b) prescribing and regulating the issue and production of licences in regard to the movement and removal of animals, poultry, eggs and things;
(c) prohibiting or regulating the holding of markets, fairs, exhibitions and sales of animals or poultry and the exposure of animals and poultry thereat;
(d) prescribing and regulating the cleansing and disinfection of places used for the holding of markets, fairs, exhibitions or sales of animals or poultry or for lairage of animals, and yards, sheds, stables, and other places used for animals or poultry;
(e) prescribing and regulating the cleansing and disinfection of vessels, aircraft, vehicles, places, pens and fittings, used for animals or poultry or for the carrying of animals or poultry or purposes connected therewith;
(f) prescribing and regulating the records to be kept of purchases and sales of animals and poultry, the manner in which such records are to be kept and the circumstances under which, and the authority or person to whom, the contents of such records are to be made known.
Transport of animals and poultry.
28.—For the purpose of preventing the spread of disease or of preventing injury or suffering to animals and poultry the Minister may make orders—
(a) regulating generally the transport of animals and poultry and the conditions under which animals and poultry are to be kept and handled at fairs, markets, marts, lairs, railway stations and other places where animals or poultry are assembled prior to transport, shipment, exhibition or slaughter;
(b) requiring and regulating the provision of food and water at railway stations, fairs, markets, marts, lairs and places where animals or poultry are assembled awaiting transit, shipment, exhibition or slaughter;
(c) prescribing the period during which food or water must be supplied to animals or poultry in transit or awaiting transit, shipment, exhibition or slaughter and the persons who shall supply such food or water;
(d) prescribing the construction, dimensions and fitting of vehicles and aircraft used for the conveyance of animals or poultry and the construction, dimensions and fittings of premises and places where animals or poultry are sold or assembled while awaiting transit, shipment or slaughter;
(e) prohibiting, absolutely or conditionally, the use, for the carrying of animals or poultry, or for any purpose connected therewith, of a vessel, vehicle, aircraft, pen or lair or other place in respect whereof, or of the use whereof, a penalty has been imposed on any person for an offence under this Act;
(f) requiring and regulating the furnishing of information as to animals and poultry which die or are injured in transit or at places where animals are bought and sold or assembled awaiting transport, shipment, exhibition or slaughter.
Carriage of animals and poultry by sea or air.
29.—The Minister may make orders—
(a) for protecting animals and poultry carried by sea or air from unnecessary suffering during the passage and on landing;
(b) for ensuring for animals and poultry carried by sea or air a proper supply of food and water and proper ventilation during the passage and on landing;
(c) prescribing and regulating the construction and fittings of the parts of vessels or aircraft used for the carriage of animals or poultry;
(d) prohibiting the conveyance of animals or poultry by any specified vessel or aircraft for such time as the Minister may consider expedient:
(e) prescribing and regulating the notice to be given of proposed exports of animals or poultry;
(f) prescribing and regulating the conditions in regard to detention, resting and inspection of animals and poultry prior to export;
(g) prohibiting, except under licence, the export of animals or poultry.
Importation
Import of animals poultry, etc.
30.—(1) The Minister may make orders—
(a) prohibiting, except under licence, or regulating the importation or landing or bringing into a port or aerodrome in the State of animals or poultry or of any specified kind of animal or poultry or of carcases, eggs, animal or poultry products (including products made from or containing animal or poultry products, carcases or eggs), fodder, litter, dung, or other thing, either generally or from any specified country or part of any such country;
(b) requiring and regulating the disinfection of persons entering the State, of their clothing and baggage and the giving of such information concerning their occupation and previous movements as the Minister may reasonably require.
(2) Whenever any animals, poultry, eggs or other articles of whatsoever kind are imported or landed or brought into a port or aerodrome in the State in contravention of an order under this Act, an officer of Customs and Excise or an inspector may require any person (being the importer or the carrier concerned) to export such animals, poultry, eggs or other articles within a specified time, and if such person fails to comply with such requisition he shall be guilty of an offence and the animals and poultry shall be slaughtered and the articles destroyed unless the Minister otherwise directs.
Quarantine stations.
31.—Notwithstanding anything in this Act the Minister may by order permit the landing of imported animals, poultry or eggs for immediate conveyance in such manner and subject to such precautions as he may prescribe to premises or accommodation approved by him for quarantine purposes and to be called a quarantine station.
Saver in relation to Customs Acts.
32.—No order or regulation made or thing done in accordance with the provisions of this Act shall absolve the importer, exporter or other person concerned with the import, landing or export of any animal, bird, eggs or other thing from complying with the relevant requirements of the Customs Acts in regard to the animal, bird, eggs or other thing concerned.
Provision in regard to imported animals, poultry, quarantine, etc.
33.—The Minister may make orders in relation to imported animals, poultry, eggs, carcases, fodder, litter, dung or other things—
(a) prescribing and regulating the movement of imported animals, poultry, eggs, carcases, fodder, litter, dung or other things;
(b) prescribing and regulating the detention and isolation of animals, poultry and things on particular premises or parts of such premises;
(c) prescribing and regulating the slaughter and disposal of animals and poultry illegally imported;
(d) prescribing that eggs, carcases, fodder, litter, dung and other things imported under licence may be destroyed or otherwise disposed of as the Minister may direct;
(e) prescribing for any imported animal or bird any test for disease or treatment for disease;
(f) prescribing for the supervision and control of animals, poultry or eggs whether in, or in the course of conveyance to, a quarantine station and for their movement or the prohibition of their movement either into or out of such station;
(g) prescribing for the slaughter of animals and poultry and the destruction of eggs in a quarantine station in the event of disease, for the payment of compensation and the determination of ownership of the carcases of animals and poultry so slaughtered.
Regulation of ports, aerodromes, landing places and imported animals.
34.—The Minister may make orders—
(a) prescribing—
(i) the ports, aerodromes and landing places at which alone imported animals and poultry may be landed;
(ii) the aerodromes which alone may be used by aircraft carrying imported animals;
(b) defining the limits of landing places for the purposes of this Act, and
(c) defining parts of ports or aerodromes.
Sheep Scab
Prevention of sheep scab.
35.—(1) The Minister may make orders—
(a) prescribing, regulating and securing the periodical treatment of all sheep by effective dipping or by the use of some other remedy for sheep scab;
(b) prescribing and regulating the mode of such treatment;
(c) providing that only such dips or other remedies as are approved by the Minister may be used for the purpose of this section.
(2) An inspector of the Minister and, if so authorised by order of the Minister, an inspector of a local authority, may subject to the directions of the authority appointing the inspector, and for the purposes of any order under subsection (1), enter any premises and examine any sheep thereon.
(3) The owner and the person in charge of any sheep shall comply with all reasonable requirements of the inspector as to the collection and penning of the sheep and afford all other reasonable facilities for the examination of the sheep by the inspector.
(4) A local authority may provide, fit up and maintain portable dipping tanks or, with the sanction of the Minister, dipping places, and afford the use thereof, and of all necessary appliances and materials in connection therewith, to the public upon such terms and conditions as the local authority may think fit, and any sums received by a local authority for such use shall be applied by them towards the discharge of their expenses under this Act.
(5) No dipping place shall be used for the purposes of this section if such use would injuriously affect the water in any stream, reservoir, aquaduct, well, pond or other place constructed or used for the supply of water for drinking or other domestic purposes.
PART III
Functions of Local Authorities
Duties of local authorities.
36.—Each local authority shall execute and enforce this Act and every order of the Minister so far as they are to be executed and enforced by local authorities.
Default of local authorities.
37.—(1) Where a local authority fails to execute or enforce any of the provisions of this Act or of an order of the Minister the Minister may by order empower a person therein named to execute and enforce those provisions or to procure the execution and enforcement thereof.
(2) The expenses incurred under any such order or in respect of any such default by or on behalf of the Minister shall be expenses of the local authority, and the accountant or other proper officer of the local authority shall pay the amount of such expenses to the Minister on demand, and in default of payment a person appointed by the Minister to sue in that behalf may recover the amount of such expenses from the local authority.
(3) For the purposes of this section an order of the Minister shall be conclusive in respect of any default, amount of expenses, or other matter therein stated or appearing.
(4) The provisions of this section are without prejudice to the right or power of the Minister, or any other authority or any person, to take any other proceedings for requiring a local authority to execute or enforce any of the provisions of this Act or of an order thereunder.
Power to authorise the making of regulations by local authorities.
38.—The Minister may make such orders as he thinks fit directing or authorising a local authority to make regulations for any of the purposes of this Act or of an order thereunder.
Slaughter of animals and poultry by local authorities.
39.—(1) The Minister may make orders directing or authorising, in case of the existence or suspected existence of any disease and under such conditions as he may prescribe, the slaughter of animals and poultry and the destruction of carcases and eggs or other things by local authorities, either generally or in particular instances, and for the payment of compensation, in all or any of such cases, by local authorities.
(2) The Minister may by such orders direct or authorise the slaughter both of animals and poultry actually affected with disease and also of animals or poultry suspected of disease or being or having been in the same field, shed or other place or in the same herd or flock or otherwise in contact with animals affected with disease or being or having been otherwise exposed to the infection thereof.
Regulations of local authorities.
40.—(1) A regulation of a local authority may be proved—
(a) by the production of a newspaper purporting to contain the regulation as an advertisement, or
(b) by the production of a copy of the regulation purporting to be certified by the secretary of the local authority as a true copy.
(2) A regulation so proved shall be taken to have been duly made, unless and until the contrary is proved.
Functions of local authority as to orders, etc.
41.—(1) A local authority shall at its own expense publish every order of the Minister and every licence or other instrument sent to it by the Minister for publication, in such manner as the Minister directs, and subject to and in the absence of any direction, by advertisement in a newspaper circulating in the district of the local authority.
(2) The validity or effect of an order of the Minister or licence or other instrument issued by the Minister shall not be affected by want of or defect or irregularity in any publication thereof.
PART IV
Administration
General powers of inspectors.
42.—(1) An inspector shall have, for the purposes of this Act, all the powers which a member of the Garda Síochána has under this Act in the place where the inspector is acting.
(2) The inspector may at any time enter any land, building, shed, pen or place wherein he has reasonable grounds for supposing—
(a) that disease exists or has within fifty-six days existed, or
(b) that the carcase of a diseased or suspected animal or bird is or has been kept, or has been buried, destroyed, or otherwise disposed of, or
(c) that there is to be found any animal, bird, pen, place, vehicle, or thing in respect whereof any person has on any occasion failed to comply with the provisions of this Act or of an order of the Minister or of a regulation of a local authority, or
(d) that this Act or an order of the Minister or a regulation of a local authority has not been or is not being complied with.
(3) An inspector may at any time enter any pen, vehicle, vessel, boat or aircraft in which or in respect whereof he has reasonable grounds for supposing that this Act or an order of the Minister or a regulation of a local authority has not been or is not being complied with.
(4) An inspector may examine any animals or poultry on or in any land, building, place, pen, vehicle, vessel, boat or aircraft entered by him under this section; and the owners of any such animals or poultry shall comply with all reasonable requirements of the inspector and afford all other reasonable facilities for the purpose of such examination.
(5) An inspector, entering as authorised by this section, shall, if required by the owner or occupier or person in charge of the land, building, place, pen, vehicle, vessel, boat, or aircraft state in writing his reasons for entering and produce his appointment.
(6) A certificate of an inspector or other authorised person to the effect that an animal or bird is or was affected with a disease specified in the certificate shall, for the purposes of this Act, be conclusive evidence of the matter certified.
(7) An inspector of the Minister shall have all the powers of an inspector throughout the State or that part thereof for which he may have been specially appointed.
(8) Notwithstanding the foregoing provisions of this section the Minister may by order, either generally or in relation to particular animals and poultry or particular diseases, restrict the powers of inspectors of a local authority under this Act.
Powers to detain vessels and aircraft.
43.—(1) Where an inspector of the Minister is satisfied that this Act or an order of the Minister or regulation of a local authority has not been or is not being complied with on board a vessel in a port or an aircraft in an aerodrome then, on the representation in writing to that effect of the inspector, stating particulars of non-compliance, the vessel or aircraft may be detained until the Minister otherwise directs.
(2) The officer detaining the vessel or aircraft shall forthwith deliver to the master of the vessel, the pilot in command of the aircraft or other person in charge of the vessel or aircraft and the proper officer of Customs and Excise a copy of the representation.
(3) Section 692 of the Merchant Shipping Act, 1894, and sections 64 and 65 of the Air Navigation and Transport Act, 1936, shall, as appropriate, apply in the case of such detention as if it were authorised or ordered under those Acts.
Expenses of burial of carcases washed ashore.
44.—(1) Where a carcase washed ashore is buried or destroyed under the direction of a receiver of wreck with authority from the Minister for Transport and Power, the expenses thereof shall be expenses of the local authority and shall be paid by the local authority to the receiver on demand, and in default of payment shall be recoverable with costs by the receiver from the local authority.
(2) Where a local authority has incurred any expenses under this section on account of the burial or destruction of the carcase of any animal which, or the carcase of which, was thrown or washed from any vessel, the owner of the vessel shall be liable to repay such expenses to the local authority; and the local authority may recover such expenses with costs in the same manner as salvage is recoverable.
Powers to appoint additional inspectors, etc.
45.—The Minister may, for the purpose of the execution of this Act, employ such additional inspectors, valuers and other persons and at such remuneration, and may incur such expenses as, subject to the approval of the Minister for Finance, the Minister thinks necessary.
Powers and duties of the Garda Síochána.
46.—(1) The Garda Síochána shall execute and enforce this Act, every order of the Minister and every regulation of a local authority.
(2) Where a person is seen or found committing, or is reasonably suspected of being engaged in committing, an offence under this Act, a member of the Garda Síochána may without warrant stop and detain him; and, if his name and address are not known to that member, and that person fails to give them to the satisfaction of the member, the member may without warrant arrest him; and the member may, whether so stopping or detaining or apprehending the person or not, stop, detain, and examine any animal, vehicle, boat, or thing to which the offence or suspected offence relates, and require it to be forthwith taken back to or into any place or district from which it was unlawfully removed, and execute and enforce that requisition.
(3) If any person obstructs or impedes or assists to obstruct or impede a member of the Garda Síochána in the execution of this Act or an order of the Minister or a regulation of a local authority, the member may without warrant arrest the offender.
PART V
Offences and Legal Proceedings
Prosecution of offences.
47.—An offence under this Act may be prosecuted by the Minister.
Offences punishable by fine only, unless offence repeated within twelve months.
48.—(1) If a person, without lawful authority or excuse, proof of which shall lie on him, does any of the following things, he shall be guilty of an offence—
(a) if he does anything in contravention of this Act, or of an order of the Minister, or of a regulation of a local authority; or
(b) if, where required by this Act or by an order or regulation made thereunder to keep an animal or bird separate as far as practicable, or to give notice of disease with all practicable speed, he fails to do so; or
(c) if he fails to give, produce, observe, or do any notice, licence, rule, or thing which by this Act, or by an order of the Minister, or by a regulation of a local authority, or by an authorised person he is required to give, produce, observe, or do; or
(d) if he does anything which by this Act or an order of the Minister is made or declared to be not lawful; or
(e) if he does or omits anything, the doing or omission of which is declared by this Act or by an order of the Minister to be an offence; or
(f) if he refuses to an inspector or other officer or authorised person acting in execution of this Act, or of an order of the Minister, or of a regulation of a local authority, admission to any land, building, place, vessel, pen, vehicle, boat or aircraft which the inspector or officer is entitled to enter or examine, or obstructs or impedes him in so entering or examining, or otherwise in any respect obstructs or impedes an inspector or a member of the Garda Síochána in the execution of his duty, or assists in any such obstruction or impeding; or
(g) if he throws or places, or causes or suffers to be thrown or placed, into or in any river, stream, canal navigation, or other water, or into or in the sea within three miles of the shore, the carcase of an animal or bird which has died of disease, or been slaughtered as diseased or suspected; or
(h) if when duly required to do so under this Act or any order made thereunder he refuses or fails to give information within his knowledge or wilfully or negligently gives false or misleading information.
(2) A person who is guilty of an offence under subsection (1) shall be liable on summary conviction to a fine not exceeding £100.
(3) A person who has been convicted of an offence under any paragraph of subsection (1) shall, if within twelve months after such conviction he commits a further offence under the same paragraph, be liable on summary conviction, at the discretion of the court, to imprisonment for a term not exceeding one month in lieu of the fine to which he is liable under subsection (2).
Offences punishable in all cases by fine or imprisonment.
49.—(1) If a person does any of the following things, he shall be guilty of an offence—
(a) if, with intent to evade this Act or an order of the Minister or a regulation of a local authority, he does anything for which a licence is requisite under this Act or an order of the Minister or a regulation of a local authority, without having obtained a licence; or
(b) if, where a licence is requisite, having obtained a licence, he, with the like intent, does the thing licensed after the licence has expired; or
(c) if he uses or offers or attempts to use as such a licence an instrument not being a complete licence, or an instrument untruly purporting or appearing to be a licence, unless he shows to the satisfaction of the court that he did not know of that incompleteness or untruth and that he could not with reasonable diligence have obtained knowledge thereof; or
(d) if he alters or falsely makes or antedates or counterfeits or offers or utters, knowing it to be altered, or falsely made or ante-dated or counterfeited, a licence, declaration, certificate, or instrument made or issued, or purporting to be made or issued, under or for any purpose of this Act or of an order of the Minister or a regulation of a local authority; or
(e) if, for the purpose of obtaining a licence, certificate or instrument, he makes a declaration or statement false in any material particular, unless he shows to the satisfaction of the court; that he did not know of that falsity and that he could not with reasonable diligence have obtained knowledge thereof; or
(f) if he obtains or endeavours to obtain such a licence, certificate or instrument by means of a false pretence, unless he shows to the satisfaction of the court that he did not know of that falsity, and that he could not with reasonable diligence have obtained knowledge thereof; or
(g) if he grants or issues such a licence, certificate or instrument, being false in any date or other material particular, unless he shows to the satisfaction of the court that he did not know of that falsity, and that he could not with reasonable diligence have obtained knowledge thereof, or if he grants or issues such a licence, certificate or instrument, having and knowing that he has no lawful authority to grant or issue it; or
(h) if, with intent to evade or defeat this Act or an order of the Minister, or a regulation of a local authority, he grants or issues an instrument being in form a licence, certificate or instrument made or issued under this Act or an order of the Minister or a regulation of a local authority, for permitting or regulating the movement of a particular animal or bird or the doing of any other particular thing, but being issued in blank, that is to say, not being before the issue thereof so filled up as to specify any particular animal or thing; or
(i) if he uses or offers or attempts to use for any purpose of this Act or of an order of the Minister or of a regulation of a local authority, an instrument so issued in blank, unless he shows to the satisfaction of the court that he did not know of it having been so issued in blank, and that he could not with reasonable diligence have obtained knowledge thereof; or
(j) if he by means of any fraud or false pretence obtains or attempts to obtain, compensation from the Minister in respect of an animal or bird slaughtered or of a carcase or eggs destroyed, or aids or abets any person in any such fraud or false pretence; or
(k) if, without lawful authority or excuse, proof whereof shall lie on him, he digs up, or causes to be dug up, a carcase buried under the direction of the Minister or of a local authority or of a receiver of wreck; or
(l) if, where the Minister has by order prohibited, absolutely or conditionally, the use for the carrying of animals or birds or for any purpose connected therewith of a vessel, vehicle, aircraft or pen or other place, he without lawful authority or excuse, proof whereof shall lie on him, does anything so prohibited.
(2) A person who is guilty of an offence under subsection (1) shall be liable on summary conviction to a fine not exceeding £100 or, at the discretion of the court, to imprisonment for a term not exceeding two months.
Appeals from orders made on complaint.

50.—A person aggrieved by an order made by the District Court on determining a complaint under this Act may appeal therefrom to the judge of the Circuit Court within whose circuit is situate the courthouse in which the decision of the District Court was given, and the decision of the judge on such appeal shall be final.
Proceedings under Customs Acts for unlawful landing or shipping.
51.—(1) If any person lands or ships or attempts to land or ship an animal, bird or thing in contravention of this Act or of an order of the Minister, he shall be liable, under and according to the Customs Acts, to the penalties imposed on persons importing or exporting or attempting to import or export goods the importation or exportation of which is prohibited by or under the Customs Acts, without prejudice to any proceeding against him for an offence under this Act.
(2) The animal, bird or thing in respect of which the offence is committed shall be forfeited under and according to the Customs Acts in like manner as goods the importation of which is prohibited by or under the Customs Acts.
General provisions as to procedure.
52.—(1) Where the owner or person in charge of an animal or bird is charged with an offence under this Act in relation to disease or to any illness of the animal or bird, he shall be presumed to have known of the existence of the disease or illness, unless he shows to the satisfaction of the court that he had not, and could not with reasonable diligence have obtained, such knowledge.
(2) Where a person is charged with an offence under this Act in not having duly cleansed or disinfected any place, vessel, vehicle, aircraft or thing belonging to him or under his charge, and a presumption against him on the part of the prosecution is raised, it shall lie on him to prove the due cleansing and disinfection thereof.
(3) Every offence under this Act shall be deemed to have been committed, and every cause of complaint or matter for proceeding under this Act or an order of the Minister or a regulation of a local authority shall be deemed to have arisen, either in any place where it actually was committed or arose, or in any place where the person charged or complained of or proceeded against happens to be at the time of the institution or commencement of the charge, complaint or proceeding.
Evidence and form and service of instruments.
53.—(1) In any proceeding under this Act, no proof shall be required of the appointment or handwriting of an inspector or other officer of the Minister or of the secretary or an inspector or other officer of a local authority.
(2) Every notice under this Act or under any order or regulation made under this Act must be in writing.
(3) The Minister may make orders prescribing and regulating the form and mode of service or delivery of notices and other instruments.
(4) Any notice or other instrument under this Act or under an order of the Minister or a regulation of a local authority may be served on the person to be affected thereby, either by delivering it to him personally, or by leaving it for him at his last known place of abode or business, or by sending it through the post in a prepaid envelope addressed to him there.
(5) A notice or other instrument to be served on the occupier of any building, land, or place may, except when sent by post, be addressed to him by the designation of the occupier of that building, land, or place, without naming or further describing him; and where it is to be served on the several occupiers of several buildings, lands, or places, may, except when sent by post, be addressed to them collectively by the designation of the occupiers of those several buildings, lands or places, without further naming or describing them but separate copies thereof being served on them severally.
PART VI
Miscellaneous
Restrictions sale and export of horned cattle.
54.—(1) On and after such day as the Minister may by order appoint, no person shall sell, offer or expose for sale or export or expose for export any horned cattle.
(2) The Minister may by order exempt from the application of subsection (1) any specified class or type of cattle.
Amendment of Clean Wool Act, 1947.
55.—Sections 7 and 8 of the Clean Wool Act, 1947, (which prohibit the manufacture of, and dealings in, certain sheep dips) shall not apply to dips approved by the Minister under statutory authority.
Orders as to dogs.
56.—The Minister may make orders—
(a) prescribing and regulating the muzzling of dogs, and the keeping of dogs under control;
(b) prescribing and regulating the wearing by dogs of a collar or harness with the name and address of the owner inscribed thereon or on a plate or badge attached thereto;
(c) with a view to the prevention of worrying of animals, for preventing dogs, or any kind of dogs, from straying during all or any of the hours between sunset and sunrise;
(d) providing that any dog in respect of which an offence is being committed against provisions made under paragraph (b) or (c), may be seized and treated as a stray dog under the enactments relating to dogs;
(e) prescribing and regulating the seizure, detention and disposal (including slaughter) of stray dogs and of dogs not muzzled, and of dogs not being kept under control, and the recovery from the owners of dogs of the expenses incurred in respect of their detention.
Pasteurising of separated milk.
57.—(1) The Minister may make regulations under the Dairy Produce Act, 1924, requiring that all or any premises registered in the register of creameries or all or any premises registered in the register of cream separating stations shall be equipped with plant for pasteurising separated milk, and may by such regulations prescribe the mode and manner in all respects of pasteurising separated milk required by those regulations to be pasteurised on require the retention of such records for inspection and their being made available for inspection.
(2) Where regulations have been made under subsection (1) in respect of premises registered in the register of creameries, all separated milk required by those regulations to be pasteurised on those premises shall be pasteurised in accordance with such regulations.
(3) Where regulations have been made under subsection (1) in respect of premises registered in the register of cream separating stations, all separated milk required by those regulations to be pasteurised on those premises shall be pasteurised in accordance with such regulations.
(4) In this section “separated milk” means that part of milk remaining after removal therefrom of the fat, or most of the fat.
(5) This section shall be construed as one with the Dairy Produce Act, 1924.
(6) This section is in substitution for section 4 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957, repealed by this Act.
Provisions as to compensation.
58.—(1) The provisions of this section shall apply in relation to compensation under section 17 or 22.
(2) The Minister, with the consent of the Minister for Finance, may by order—
(a) make provision for regulating the making and determination of applications for, and the mode of assessment and payment of, compensation;
(b) include provision for the fixing of compensation by agreement between the applicant and the Minister or, in default of agreement, by a valuer appointed by agreement between the applicant and the Minister or, in default of such agreement, by a valuer appointed by the Minister;
(c) include provision in the event of the applicant disputing the determination of the application, for the settlement of the dispute by arbitration.
(3) Where a person has been convicted of an offence under this Act in relation to any animals or poultry slaughtered or taken possession of, or carcases or eggs destroyed, under this Act then, as a statutory consequence of such conviction, he shall not be entitled to compensation in respect of such animals, poultry, carcases or eggs
(4) Where, under subsection (3) a person is disentitled to compensation, the Minister may make an ex gratia payment to him of such amount as the Minister thinks fit, in lieu of compensation, taking into account, any loss to the Exchequer arising by reason of the offence.
(5) An order under subsection (2) may provide for the post-ponement of consideration of an application for compensation pending the institution or determination of a prosecution for an offence under this Act in relation to animals, poultry, carcases or eggs which are the subject of such application.
(6) An order under subsection (2) may provide that, in assessing compensation, deductions, estimated in such manner as may be prescribed, may be made in respect of any loss to the Exchequer or to the applicant himself arising by reason of the applicant's failure to take reasonable care to protect against the disease in question the animals, poultry, carcases or eggs which are the subject of the application, or, in the case of imported animals or poultry, where they are shown to have been diseased when imported.

SECOND SCHEDULE
Purposes for which orders may be made by the Minister under section 13.
1. Securing and regulating effective isolation on land or premises and prohibition or restriction of movement into or out of land or premises or part thereof of animals or poultry affected or suspected of being affected or capable of infecting animals or poultry with a disease.
2. Securing and regulating the cleansing and disinfection of premises and removal therefrom and subsequent disposal of dung, litter, fodder or any other thing, and exclusion of any animals and birds therefrom.
3. Securing and regulating the cleansing and disinfection of vehicles, places, pens, fittings and receptacles used for animals and poultry.
4. Securing and regulating repair or reconstruction of houses used for the housing of animals and poultry, or of boundary fences.
5. Prescribing modes of cleansing and disinfection.
6. Prescribing and regulating the marking of animals and poultry and prohibition of effacement, obliteration, alteration or removal of any such marking.
7. Prescribing and regulating the seizure, detention and disposal of diseased or suspected animals or poultry, carcases or eggs exposed, carried, kept or otherwise dealt with in contravention of an order of the Minister; and for prescribing the liability of the owner or consignor or consignee of any such animals, poultry, carcases or eggs in the matter of the expenses connected with the seizure, detention or disposal thereof.
8. Securing a proper supply of water and food to animals and poultry during any detention thereof.
9. Prescribing and regulating the destruction, burial, disposal, or treatment of carcases of animals and poultry dying while diseased or suspected, or slaughtered by or on behalf of the Minister or a local authority and of the carcases of animals, poultry and (as the case may be) eggs or animals or poultry which had been in contact with such carcases.
10. Prohibiting or regulating the digging up of carcases which have been buried.
11. Prescribing and regulating the disinfection of the clothes of persons coming in contact with or employed about diseased or suspected animals or poultry and the use of precautions against the spreading of disease by such persons.
12. Prohibiting or regulating or restricting the sale, use or movement of any kind of fodder, litter or other material whereby disease might be spread.
13. Prescribing and regulating the treatment of diseased or suspected animals or poultry, or animals or poultry which appear to the Minister to be in any way exposed to the infection of disease.
14. Prohibiting the exposure for public sale or exhibition or the export of diseased or suspected animals or birds except under and in accordance with a licence.
15. Prescribing and regulating the treatment to be applied in relation to any land (including ponds, streams or watercourses thereon or adjacent thereto) for the purpose of preventing or checking the spread of disease or of eradicating disease.
16. Requiring, prescribing and regulating the taking from animals and poultry or any particular categories of animals and poultry of samples, as appropriate of blood, urine, faeces, or other bodily discharges, semen, saliva, milk, eggs, hair, wool, fur, feathers, mucus, skin or other tissue and, in the case of carcases of animals or poultry, the taking of samples from such carcases and the subjection of any samples so taken to such tests as may be necessary to establish or confirm the existence of disease, and the submission of reports on such tests.
17. Requiring, prescribing, regulating and prohibiting the application to or the injection into animals and poultry of any substance with a view to the carrying out of such tests as may be necessary to establish or confirm the existence of disease and the submission of reports on such tests.
18. Requiring, specifying or regulating any other tests of animals and poultry for the purpose of establishing or confirming the existence of disease.
19. Prohibiting, except with the consent of the Minister, tests of animals and poultry, other than such tests as are prescribed, specified or regulated by an order of the Minister.
20. Requiring, specifying, regulating and prohibiting (except with the consent of the Minister) the treatment of animals or poultry with serum or vaccine.
21. Prescribing in relation to any particular disease, that persons may not engage in the business of dealing in animals or poultry unless authorised by a licence issued in that behalf by the Minister and subject to such conditions as may be set out in such licence.
