COAST PROTECTION ACT, 1963.


AN ACT TO PROVIDE FOR THE MAKING AND EXECUTION OF COAST PROTECTION SCHEMES AND TO PROVIDE FOR OTHER MATTERS CONNECTED WITH THE MATTERS AFORESAID. [20th May, 1963] BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS:— [GA]

Interpretation.

1.—In this Act—

certificate of completion” means a certificate issued under subsection (1) of section 18;

[GA]

coast protection scheme” means a scheme under section 6;

[GA]

the Commissioners” means the Commissioners of Public Works in Ireland;

[GA]

county” includes county borough and, in relation to a county borough, “council” shall be construed as meaning the corporation of the borough;

[GA]

local authority” means a body which is—

[GA]

(a) the council of a county,

[GA]

(b) the corporation of a county or other borough, or

[GA]

(c) the council of an urban district;

[GA]

promoting authority” means a council who have made a declaration under subsection (3) of section 2, being, in a case in which one of two or more councils of counties has been named pursuant to subsection (4) of that section, the council so named;

[GA]

protected lands” has the meaning specified in paragraph (b) of section 7;

[GA]

reserved function” means—

[GA]

(a) in the case of a corporation of a county borough, a reserved function for the purposes of the enactments relating to the management of that county borough, and

[GA]

(b) in any other case, a reserved function for the purposes of the County Management Acts, 1940 to 1955.

[GA]

Investigation of proposed coast protection works and declaration for promotion of coast protection scheme.

2.—(1) The council of a county may investigate, where they consider it expedient to do so, any proposals for coast protection works within the county.

[GA]

(2) (a) Where an investigation is made under subsection (1) of this section, the council shall cause a report to be prepared and submitted to them on the location and extent of the relevant encroachment of the sea, the extent of the land and other property being damaged or endangered, the works (if any) which may be practicable and desirable to prevent the continuance of the, encroachment and the estimated cost of the works.

(b) In the case of an encroachment of the sea affecting land in two or more counties, the councils of the counties may make an arrangement under which one of the councils causes a single report in relation to the whole of the encroachment to be made and submitted to each of the councils.

[GA]

(3) (a) Where a report is submitted under subsection (2) of this section to the council of a county, the council, if satisfied that land within the county is being progressively; damaged by the continuing encroachment of the sea, as distinct from occasional or abnormal storms, and that the encroachment is liable to endanger the safety of a harbour, the buildings or amenities of a residential area or other valuable property, may declare that the promotion of a coast protection scheme is expedient and that the Commissioners should be asked to carry out a preliminary examination.

(b) Where—

[GA]

(i) the council of a county have considered a report submitted under subsection (2) of this section and have decided not to make a declaration under this subsection, and

[GA]

(ii) the proposals are for coast protection works wholly within an urban district,

[GA]

the council shall send the report to the council of the urban district.

[GA]

(c) Where a report is sent under paragraph (b) of this subsection to the council of an urban district, the council, if satisfied that land within the urban district is being progressively damaged by the continuing encroachment of the sea, as distinct from occasional or abnormal storms, and that the encroachment is liable to endanger the safety of a harbour, the buildings or amenities of a residential area or other valuable property, may, with the consent of the Minister for Local Government and subject to the council of a county having undertaken to make such contribution to the balance referred to in paragraph (b) of section 16 of this Act as that Minister has approved of, declare that the promotion of a coast protection scheme is expedient and that the Commissioners should be asked to carry out a preliminary examination.

(4) If, in the case of encroachment of the sea affecting land in two or more counties, each of the councils of the counties make a declaration under subsection (3) of this section, the councils shall name one council as the authority to promote the coast protection scheme.

[GA]

(5) It shall be lawful for the council of a county and their officers, agents and servants to enter on any lands at all reasonable times and there do all such things as may appear to them to be necessary or expedient for the purposes of the preparation of a report under subsection (2) of this section.

[GA]

(6) The consideration of a report and the making of a declaration under this section shall each be a reserved function.

[GA]

Preliminary examination by the Commissioners.

3.—(1) On receipt by the Commissioners from the promoting authority of—

[GA]

(a) a certified copy of a resolution by the promoting authority for the purposes of subsection (3) of section 2 of this Act,

[GA]

(b) a copy of the report under subsection (2) of section 2 of this Act,

[GA]

(c) an undertaking by the promoting authority that if, after the carrying out by the Commissioners of a preliminary examination of the encroachment of the sea, the Commissioners make a determination under paragraph (a) of subsection (1) of section 4 of this Act or the promoting authority make a declaration under paragraph (a) of subsection (1) of section 5 of this Act, the promoting authority will pay the amount which will become appropriate to be paid by them when a notice under subsection (1) of section 26 of this Act has been served, and

(d) a map or plan showing in sufficient detail the site of the encroachment of the sea and the extent of the land and other property being damaged or liable to be endangered thereby,

[GA]

the Commissioners may undertake a preliminary examination of the encroachment of the sea.

[GA]

(2) In a case in which the encroachment of the sea affects land in two or more counties, the reference in paragraph (a) of subsection (1) of this section to a certified copy of a resolution by the promoting authority for the purposes of subsection (3) of section 2 of this Act shall be construed as a reference to certified copies of resolutions by the councils of those counties for those purposes.

(3) It shall be lawful for the Commissioners and their officers, agents and servants to enter on any lands at all reasonable times and there do all such things as may appear to them to be necessary or expedient for the purposes of the making of a preliminary examination under this section.

Determination by the Commissioners.

4.—(1) On completion of a preliminary examination under section 3 of this Act, the Commissioners shall—

[GA]

(a) determine that the circumstances are not such as to warrant a full examination and the preparation and execution of a coast protection scheme, or

[GA]

(b) determine that the circumstances are such that the preparation and execution of a coast protection scheme is feasible.

[GA]

(2) Where the Commissioners make a determination pursuant to paragraph (a) of subsection (1) of this section, they shall so report to the promoting authority and shall set out in the report in such manner and such detail as they consider necessary the reasons upon which the determination is based.

[GA]

(3) Where the Commissioners make a determination pursuant to paragraph (b) of subsection (1) of this section, they shall inform the promoting authority and at the same time transmit to that authority a report (accompanied by such maps or plans as they may consider necessary) setting out in such manner and detail as they may consider necessary the extent of the land and other property being damaged or liable to be endangered, the works which they consider practicable and desirable to prevent the continuance of the encroachment of the sea and an estimate of the cost of such works.

Further declaration by promoting authority.

5.—(1) Where, pursuant to subsection (3) of section 4 of this Act, the Commissioners report a determination by them that the circumstances are such that the preparation and execution of a coast protection scheme is feasible, the promoting authority, after consideration of the report, shall—

(a) declare that a coast protection scheme is not to be proceeded with, or

[GA]

(b) declare that the Commissioners should be asked to prepare and execute a coast protection scheme.

[GA]

(2) A declaration under paragraph (b) of subsection (1) of this section shall include a declaration that the promoting authority will make in relation to the coast protection scheme—

[GA]

(a) any contribution which may become proper to be made by them under section 16 of this Act, and

[GA]

(b) any payment which may become proper to be made by them consequent upon a notice served under subsection (2) or subsection (3) of section 26 of this Act.

[GA]

(3) The consideration of a report and the making of a declaration under this section shall be a reserved function.

[GA]

Preparation of coast protection scheme.

6.—(1) On receipt by the Commissioners from the promoting authority of a certified copy of a resolution by the promoting authority for the purposes of paragraph (b) of subsection (1) of section 5 of this Act, the Commissioners may, subject to the consent of the Minister for Finance and to any conditions stipulated by him, prepare a scheme for the prevention of the relevant encroachment of the sea and shall send a copy of the scheme to the promoting authority and to any other council who named the promoting authority.

(2) It shall be lawful for the Commissioners and their officers, agents or servants to enter on any lands at all reasonable times and there do all such things as may appear to them to be necessary or expedient for the purposes of the preparation of a scheme under this section.

Matters to be shown in scheme.

7.—A coast protection scheme shall show, either in the body of the scheme or by means of appropriate maps, drawings, plans, sections and schedules annexed thereto—

[GA]

(a) the works proposed to be undertaken pursuant to the scheme and their proposed site,

[GA]

(b) the lands and other property encroached upon or liable to be endangered (in this Act referred to as the protected lands) which such works are intended to protect,

[GA]

(c) the lands proposed to be compulsorily acquired or substantially interfered with, the easements, fisheries, water-rights, navigation-rights and other rights proposed to be compulsorily acquired, restricted, terminated or otherwise interfered with and the roads and bridges (whether public or private) proposed to be diverted, removed or otherwise interfered with,

(d) the reputed proprietors, owners and rated or other occupiers of the several lands proposed to be compulsorily acquired or substantially interfered with and of the several easements, fisheries, water-rights, navigation-rights and other rights and private roads and bridges proposed to be compulsorily acquired, restricted, terminated or otherwise interfered with,

(e) the estimated cost of the works (inclusive of the estimated expenses generally of executing the scheme) and, as respects such cost (inclusive as aforesaid), the percentage thereof (not exceeding eighty) which the Minister for Finance is prepared to contribute thereto.

Declaration by promoting authority on receipt of scheme.

8.—(1) Where the promoting authority receive a copy of a coast protection scheme sent pursuant to subsection (1) of section 6 of this Act, they shall either—

(a) declare that the scheme is not to be proceeded with, or

[GA]

(b) declare that the scheme is to be proceeded with.

[GA]

(2) Where a declaration has been made under paragraph (b) of subsection (1) of this section, the promoting authority shall—

[GA]

(a) publish in Iris Oifigiúil, and in one or more newspapers circulating in the county of the promoting authority and any other county the council of which named the promoting authority pursuant to this Act, a notice stating that the coast protection scheme has been prepared and also stating the place or places at which and the period, not being less than one month, during which a copy of the scheme will be available for inspection in pursuance of this section,

[GA]

(b) cause the copy of the coast protection scheme sent to them by the Commissioners to be exhibited in their principal offices or other convenient place during the period specified in that behalf in the notice referred to in the foregoing paragraph and shall permit the copy to be inspected during office hours by any person claiming to be interested therein.

[GA]

(3) The making of a declaration under this section shall be a reserved function.

[GA]

Notice to reputed proprietors, occupiers, etc.

9.—(1) Where the promoting authority have made a declaration under paragraph (b) of subsection (1) of section 8 of this Act in relation to a coast protection scheme, they shall—

[GA]

(a) serve on any person named in the scheme as a reputed proprietor, owner or rated or other occupier of any land proposed to be compulsorily acquired or substantially interfered with or of any easement, fishery, water-right, navigation-right or other right or of any private road or bridge proposed to be compulsorily acquired, restricted, terminated or otherwise interfered with a notice stating that the scheme has been prepared, specifying the place or places at which and the period during which a copy of the scheme will be available for inspection in pursuance of this Act and informing him that the scheme proposes the compulsory acquisition of or interference with some land, right or other property (which land, right or property and the proposed interference (if any) shall be fully described in the notice) reputed to be owned or occupied by him;

[GA]

(b) serve on every person who is the local authority (not being a council to which a copy of the scheme has been sent in pursuance of subsection (1) of section 6 of this Act) charged with the maintenance of any public road or bridge proposed in the scheme to be diverted, removed or otherwise interfered with a notice informing such authority of the preparation of the scheme and of the diversion, removal or interference proposed in the scheme to be made in respect of such road or bridge, and

[GA]

(c) serve on one or more of the persons who are the trustees of any trust fund for the upkeep of works which may be interfered with by the execution of the scheme a notice stating that the scheme has been prepared and that execution thereof may interfere with those works.

[GA]

(2) A notice served on any person in pursuance of this section shall contain a statement informing him that he may, within two months after the service of the notice on him, send to the promoting authority all such observations (if any) as he thinks proper in regard to the matters to which the notice relates.

[GA]

(3) A person on whom a notice is served in pursuance of this section may, at any time within two months after the service of the notice on him, send to the promoting authority all such observations (if any) in regard to the matters to which the notice relates as he thinks proper.

[GA]

(4) A notice required by this section to be served on any person may be served by registered post and, where the address of such person is not known, the envelope containing the notice may be addressed to him at the lands or the place or situation of the right or property to which the notice relates.

[GA]

Confirmation of scheme.

10.—(1) When the time limited by section 9 of this Act for the sending to the promoting authority of observations in regard to a coast protection scheme, by persons on whom a notice has been served pursuant to that section, has expired, the promoting authority shall examine the observations duly sent and shall furnish to the Commissioners a report setting out those observations and the alterations (if any) (by way of variation, omission or addition) which they propose should be made in the scheme.

(2) Where a report under subsection (1) of this section is furnished to the Commissioners, they shall examine the report and shall either—

[GA]

(a) determine that no alteration is to be made in the scheme, or

[GA]

(b) determine the alterations (by way of variation, omission or addition) which are to be made therein.

[GA]

(3) (a) Where the Commissioners make a determination under subsection (2) of this section, they shall give notice of the determination to the promoting authority and thereupon that authority shall either—

[GA]

(i) declare that the scheme is not to be proceeded with, or

[GA]

(ii) declare that the scheme is to be proceeded with.

[GA]

(b) The making of a declaration under this subsection shall be a reserved function.

[GA]

(4) On receipt by the Commissioners from the promoting authority of a certified copy of a declaration under subparagraph (ii) of paragraph (a) of subsection (3) of this section, the Commissioners shall submit the coast protection scheme, accompanied by a copy of the notice sent pursuant to subsection (3) of this section, to the Minister for Finance.

[GA]

(5) Where a coast protection scheme is submitted under subsection (4) of this section, the Minister for Finance, after consultation with the Minister for Local Government, the Minister for Transport and Power and such other Minister or Ministers as he may consider necessary, may—

[GA]

(a) make an order refusing to confirm the scheme, or

[GA]

(b) make an order confirming the scheme, either without alterations or with such alterations (by way of variation, addition or omission) as he may consider necessary, and shall send a copy of the order to the Commissioners and to the promoting authority.

[GA]

(6) (a) Where an order under this section confirms a coast protection scheme with alterations (by way of variation, addition or omission), the order shall have no effect if, within one month after the receipt of a copy of the order, the promoting authority declare that the scheme is not to be proceeded with.

[GA]

(b) The making of a declaration under this subsection shall be a reserved function.

[GA]

(7) Within two months after the receipt of a copy of an order under this section confirming a coast protection scheme, the promoting authority, unless they have made a declaration under subsection (6) of this section, shall serve a copy of the order—

[GA]

(a) on each of the reputed proprietors, owners and rated or other occupiers of the several lands proposed to be compulsorily acquired or substantially interfered with and of the several easements, fisheries, water-rights, navigation-rights and other rights and private roads and bridges proposed to be acquired, restricted, terminated or otherwise interfered with,

[GA]

(b) on every person who is the local authority (not being a council to which a copy of the scheme has been sent in pursuance of subsection (1) of section 6 of this Act) charged with the maintenance of any public road or bridge proposed to be diverted, removed or otherwise interfered with, and

[GA]

(c) on one or more of the persons who are the trustees of any trust fund for the upkeep of works which may be interfered with by the execution of the scheme.

[GA]

(8) A copy required by subsection (7) of this section to be served on any person may be served by registered post and, where the address of such person is not known, the envelope containing the copy may be addressed to him at the lands or the place or situation of the right or property concerned.

[GA]

Powers conferred by order confirming scheme.

11.—(1) Where an order confirming a coast protection scheme has been made under this Act, the order shall operate to confer upon the Commissioners power—

(a) to construct, execute and complete the works specified in the scheme with such additions, omissions, variations and deviations as may be found necessary in the course of the work,

[GA]

(b) to enter on any land and there do all such acts and things as may be necessary for or incidental to the construction, execution or completion of the said works with such additions, omissions, variations and deviations as aforesaid,

[GA]

(c) to acquire compulsorily the several lands, easements, fisheries, water-rights, navigation-rights and other rights proposed in the scheme to be so acquired, and, if the Commissioners think fit so to do, to enter on any such lands or exercise any of such easements, fisheries, water-rights, navigation-rights and other rights before the conveyance or ascertainment of price of such lands, easements or rights,

(d) to interfere substantially with any land proposed in the scheme to be so interfered with and, if the Commissioners so think fit, to enter on and so interfere with such land before any ascertainment of compensation in respect thereof,

[GA]

(e) to restrict, terminate or otherwise interfere with any easements, fisheries, water-rights, navigation-rights or other rights proposed in the scheme to be compulsorily restricted, terminated or interfered with, and to divert, remove or otherwise interfere with any roads or bridges proposed in the scheme to be diverted, removed or interfered with and, if the Commissioners so think fit, to do any of the things aforesaid before any ascertainment of compensation in respect thereof,

(f) to employ contractors to execute all or any part of the said works, and

[GA]

(g) to do all such other acts and things as, in the opinion of the Commissioners, may be necessary or proper for or incidental to the due carrying out of the scheme and are not specifically provided for by this Act.

[GA]

(2) As respects contractors such as are referred to in paragraph (f) of subsection (1) of this section, the order confirming the coast protection scheme shall also operate to confer upon them such of the powers specified in that subsection as may be appropriate for the purposes of their contract.

[GA]

Duties in regard to public roads and bridges.

12.—(1) Where a coast protection scheme confirmed under this Act provides for the diversion, removal, or other interference of or with a road or bridge (in this section referred to as the original road or bridge) the responsibility for the maintenance of which lies on a local authority, the following provisions shall have effect:

[GA]

(a) where the execution of the scheme involves the closing of the original road or bridge to traffic, the Commissioners shall either, as they think proper, construct and (while the original road or bridge is so closed to traffic) maintain a temporary road or bridge sufficient to carry traffic of such quantity and character as normally uses the original road or bridge, or by order made with the consent of the Minister for Local Government prescribe an alternative route to be used while the original road or bridge is so closed to traffic;

(b) the Commissioners shall, before the completion of the execution of the scheme, do whichever of the following things they think proper, that is to say:

[GA]

(i) restore the original road or bridge to its former condition, or

[GA]

(ii) after consultation with the Minister for Local Government, construct a new permanent road or bridge sufficient to carry the like amount (in quantity and character) of traffic as the original road or bridge was able to carry and not substantially less convenient in gradient and curve than the original road or bridge, or

[GA]

(iii) with the consent of the Minister for Local Government, so improve (by reconstruction, strengthening, widening, or otherwise) an existing alternative road or bridge that it will be sufficient to carry the traffic which will be likely to use it and will not be substantially less convenient than the original road or bridge;

[GA]

(c) where the Commissioners construct a permanent new road or bridge or improve an existing alternative road or bridge and such road or bridge confers substantially greater advantages on the public of any county or urban district than the original road or bridge, whether by affording an improved means of communication or otherwise, the Commissioners shall certify the cost of such new road or bridge or of such improvement (as the case may be) and the Minister for Local Government shall certify what part of that cost in his opinion ought reasonably to be borne by the council of that county or urban district, and thereupon a sum equal to the part so certified of that cost shall be paid by that council to the Commissioners;

(d) if any doubt, dispute, or question arises as to whether the Commissioners, in the construction or maintenance of any temporary road or bridge or the restoration of the original road or bridge or the improvement of an existing alternative road or bridge (as the case may be) pursuant to this section, have complied with the relevant provisions of this section, or as to whether a permanent new road or bridge constructed by the Commissioners or an existing alternative road or bridge improved by the Commissioners (as the case may be) confers substantially greater advantages on the public of any county or urban district than the original road or bridge, the doubt, dispute, or question shall be decided by the Minister for Local Government.

(2) The Commissioners may agree with the appropriate local authority for the doing by that authority of anything which the Commissioners are required or authorised by subsection (1) of this section to do, and may further agree to make to that authority payment for or towards the cost of the doing by them of that thing.

[GA]

(3) Where the Commissioners have completed in pursuance of this section the construction of a new permanent road or bridge or the improvement of an existing alternative road or bridge, they shall hand over to the appropriate local authority, and that authority shall accept, the road or bridge so constructed or improved.

[GA]

(4) Nothing in this section shall operate to impose on the Commissioners any duty or responsibility in respect of the maintenance of any new permanent road or bridge constructed by them in pursuance of this section or any road or bridge similarly restored or improved by them.

[GA]

Acquisition of and compensation for lands, rights, etc.

13.—(1) As soon as may be after the date of an order under this Act confirming a coast protection scheme, the Commissioners shall proceed to acquire the several lands, easements, fisheries, water-rights, navigation-rights and other rights proposed in the scheme to be compulsorily acquired, save that it shall not be obligatory on the Commissioners to acquire any land, easement, fishery, water-right, navigation-right or other right proposed in the scheme to be compulsorily acquired as respects which the Commissioners become of opinion that the acquisition thereof is not necessary for the purpose of executing the scheme.

(2) The compensation to be paid by the Commissioners for lands, easements, fisheries, water-rights, navigation-rights and other rights compulsorily acquired in pursuance of subsection (1) of this section to the several persons entitled thereto or having estates or interests therein or entitled to or having estates or interests in the lands over or in respect of which the rights so to be acquired are exercisable shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, as amended by subsequent enactments.

(3) It shall not be obligatory on the Commissioners to make any interference with any land, easement, fishery, water-right, navigation-right, or other right or any road or bridge, proposed in a coast protection scheme to be compulsorily made, as respects which the Commissioners become of opinion that the making thereof is not necessary for the purpose of executing the scheme.

(4) The amount of compensation payable to any person on account of the compulsory substantial interference with any land or the compulsory restriction, termination, or other interference of or with any easement, fishery, water-right, navigation-right, or other right or the diversion, removal, or other interference of or with any private road or bridge under or in pursuance of a coast protection scheme, shall, in default of agreement, be fixed under and in accordance with the Acquisition of Land (Assessment of Compensation) Act, 1919, as amended by subsequent enactments, in like manner as if such compensation were the price of land compulsorily acquired.

(5) Sections 69 to 83 of the Lands Clauses Consolidation Act, 1845, shall apply to any compensation payable by the Commissioners under this section and the conveyance to the Commissioners of any land or right acquired by them under this section, and for the purposes of such application the Commissioners shall be deemed to be the promoters of the undertaking.

(6) No action shall lie at law or in equity against the Commissioners or any officer, agent, or servant of the Commissioners in respect of any act, matter, or thing in respect of which compensation is payable by virtue of this section or the next section.

Compensation for certain interferences with land, etc.

14.—(1) Any person who suffers any loss or damage by reason of any interference (other than an interference to which a notice served pursuant to paragraph (a), (b) or (c) of subsection (1) of section 9 of this Act refers) by the Commissioners during the construction of any works under this Act with any land owned or occupied by him or any easement, fishery, water-right, navigation-right, or other right belonging to him shall, subject to the provisions of this Act, be entitled to be paid by the Commissioners compensation in respect of such loss or damage.

(2) Every claim for compensation under this section shall be made in writing to the Commissioners within one year after the interference to which the claim relates is begun.

[GA]

(3) Compensation under this section shall, in default of agreement, be determined by arbitration pursuant to the Arbitration Act, 1954.

[GA]

Matters to be regarded in assessment of compensation.

15.—When assessing compensation in pursuance of either of the two immediately preceding sections, the arbitrator shall in every case have regard to any benefit to any property (whether it is or is not the property in respect of which the compensation is claimed) of the person claiming the compensation which is occasioned by or may reasonably be expected to arise from the execution of the coast protection scheme in relation to which the compensation is claimed and, in particular, the arbitrator—

(a) shall, in the case of a claim in respect of water-rights, have regard to any alternative water supply provided by the Commissioners, and

[GA]

(b) shall, in the case of a claim in respect of interference with water or a watercourse providing power for a mill or other industrial concern, have regard to the extent to which the power so provided was used for an industrial purpose during the ten years next preceding the date of the confirmation of the coast protection scheme, and shall also have regard to any alternative source of power provided by the Commissioners.

Provision of moneys for carrying out scheme.

16.—The moneys necessary to defray the costs and expenses incurred in executing a coast protection scheme confirmed pursuant to this Act (including the cost of any preliminary examination made by the Commissioners, the cost of the preparation of the scheme and all compensation and other moneys payable and all incidental expenditure) shall, save as otherwise directed by this Act, be provided as follows:

(a) the Minister for Finance shall contribute, out of moneys to be provided by the Oireachtas, the amount which represents such percentage of the said moneys as is equal to the percentage shown, in the scheme as confirmed, as the percentage which the Minister for Finance is prepared to contribute,

[GA]

(b) the balance shall be contributed by the promoting authority.

[GA]

Contributions to amount payable by promoting authority.

17.—(1) There shall be contributions to the balance referred to in paragraph (b) of section 16 of this Act in accordance with the following provisions:

(a) in case the promoting authority is the council of a county, the corporation of any borough (not being a county borough) or council of any urban district in which the whole or any part of the protected lands are situate shall contribute such amount as they may, with the consent of the Minister for Local Government, have agreed upon with the promoting authority,

[GA]

(b) in case the promoting authority is the council of an urban district, any council of a county shall contribute such amount as they may, with the consent of the Minister for Local Government, have agreed upon with the promoting authority,

[GA]

(c) any harbour authority within the meaning of the Harbours Act, 1946, shall contribute such amount as they may, with the consent of the Minister for Transport and Power, have agreed upon with the promoting authority,

[GA]

(d) there shall be a contribution by any owner or occupier of any of the protected lands consisting of the amount received or recovered pursuant to any agreement, between such owner or occupier and the promoting authority, providing for the making by such owner or occupier of a contribution towards such balance,

[GA]

(e) in case the promoting authority was named pursuant to subsection (4) of section 2 of this Act, the other council of a county or each other council of a county who named the promoting authority shall contribute such amount as, in default of agreement with the promoting authority, may be determined by the Minister for Local Government.

[GA]

(2) As respects any such agreement as is referred to in paragraph (a), (b), (c) or (d) of subsection (1) of this section, the promoting authority and the other party stated in the paragraph are hereby authorised, subject to the provisions of the paragraph, to enter into and carry out the agreement and any amount payable thereunder may, in default of being duly paid, be recovered as a simple contract debt in any court of competent jurisdiction.

(3) A harbour authority may, for the purposes of making a contribution under this section, borrow money under section 120 of the Harbours Act, 1946, as amended by section 6 of the Harbours Act, 1947, as if such purposes were purposes in connection with their harbour.

[GA]

(4) Money borrowed pursuant to subsection (3) of this section may be lent by means of an issue from the Local Loans Fund as if such loan constituted a local loan within the meaning of the Local Loans Fund Acts, 1935 to 1961, and was authorised by an Act of the Oireachtas.

[GA]

Certificate of completion.

18.—(1) Where, as respects the works comprised in a coast protection scheme confirmed pursuant to this Act, the Commissioners are satisfied that the works have been completed in accordance with the scheme (with such additions, omissions, variations and deviations as may have been found necessary in the course of the work), the Minister for Finance shall issue a certificate certifying that the works have been completed as aforesaid.

(2) A certificate of completion shall show, either in the body of the certificate or by means of appropriate maps, drawings, plans, sections and schedules annexed thereto—

(a) the works which have been completed,

[GA]

(b) the protected lands, and

[GA]

(c) the total cost of the works.

[GA]

(3) A certificate of completion shall be conclusive evidence that the works shown thereby have been completed in accordance with the relevant coast protection scheme (with such additions, omissions, variations and deviations as may have been found necessary in the course of the work).

[GA]

(4) The following provisions shall have effect in relation to the issue under this section of a certificate of completion:

[GA]

(a) the Minister for Finance shall cause to be published in Iris Oifigiúil, and in one or more newspapers circulating in the county of the promoting authority and any other county the council of which named the promoting authority pursuant to this Act, a notice stating that the Minister for Finance proposes to issue the certificate and that any person may, within two months after the date of the publication of the notice in Iris Oifigiúil, send to the Minister for Finance an objection to the issue of the certificate;

(b) simultaneously with or as soon as may be after the publication of the notice in Iris Oifigiúil, the Minister for Finance shall send to the promoting authority and any other council which named the promoting authority a copy of the notice;

[GA]

(c) the council to whom a copy of the notice has been so sent or any other person may, within two months after the date of the publication of the notice in Iris Oifigiúil, send to the Minister for Finance an objection in writing stating that such council or person objects to the issue of the certificate and the grounds of the objection;

[GA]

(d) the Minister for Finance shall consider any objection sent as aforesaid and shall take such steps in regard thereto as he thinks proper;

[GA]

(e) the certificate shall not be issued less than two months after the date of the publication of the notice in Iris Oifigiúil.

[GA]

(5) The power conferred by paragraph (c) of subsection (4) of this section shall, in the case of a local authority, be a reserved function.

[GA]

Trust funds in respect of existing embankments.

19.—(1) Where, on the issue of a certificate of completion, a trust fund, whether vested in the Public Trustee, the Irish Land Commission or trustees, exists for the maintenance (whether permanently or during a specified period or otherwise) of an existing embankment (either alone or in conjunction with other works), being an embankment the necessity for which or part of which has been obviated by the works to which the certificate of completion relates, such of the following provisions as are applicable shall have effect:

(a) if the necessity for the whole of the existing embankment has been obviated and the trust fund relates to the existing embankment alone, the trust fund shall, as soon as may be after the issue of the certificate of completion, be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance directs;

[GA]

(b) if the necessity for part only of the existing embankment has been obviated and the trust fund relates to the existing embankment alone, the Judicial Commissioner of the Irish Land Commission shall, on the application of the Commissioners and on notice to all parties concerned and having given those parties an opportunity of being heard, apportion the trust fund as between the part of the existing embankment the necessity for which has been obviated and the residue of the existing embankment, and thereupon the portion of the trust fund which is so apportioned to the part of the existing embankment the necessity for which has been obviated shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance directs;

(c) if the necessity for the whole of the existing embankment has been obviated and the trust fund relates to the existing embankment and also to other works, the Judicial Commissioner of the Irish Land Commission shall, on the application of the Commissioners and on notice to all parties concerned and having given those parties an opportunity of being heard, apportion the trust fund as between the existing embankment and the other works, and thereupon the portion of the trust fund which is so apportioned to the existing embankment shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance directs;

(d) if the necessity for part only of the existing embankment has been obviated and the trust fund relates to the existing embankment and also to other works, the Judicial Commissioner of the Irish Land Commission shall on the application of the Commissioners and on notice to all parties concerned and having given those parties an opportunity of being heard, apportion the trust fund as between, on the one hand, the part of the existing embankment the necessity for which has been obviated and, on the other hand, the residue of the existing embankment and the other works, and thereupon the portion of the trust fund which is so apportioned to the part of the existing embankment the necessity for which has been obviated shall be paid into or disposed of for the benefit of the Exchequer in such manner as the Minister for Finance directs;

[GA]

(e) where the trust fund or part thereof is required by any of the foregoing provisions of this subsection to be paid into or disposed of for the benefit of the Exchequer, it shall be lawful for the Public Trustee, the Irish Land Commission or the trustees (as the case may be) to sell, for the purpose of making the payment or disposition, the whole or so much as may be necessary of the investments (if any) then representing the trust fund;

[GA]

(f) where under any of the foregoing provisions of this subsection the whole of the trust fund is required to be paid into or disposed of for the benefit of the Exchequer, whichever of them, the Public Trustee, the Irish Land Commission or the trustees, the trust fund was vested in immediately before the payment or disposal shall, immediately upon the payment or disposal, be discharged by virtue of this Act from the trusts and duties upon which they so held the trust fund (whether by virtue of a deed of trust, a scheme, or otherwise), and any other persons who were, immediately before the payment or disposal, in a fiduciary capacity in relation to the trust fund shall similarly be discharged from the trusts and duties imposed on them by virtue of that capacity;

[GA]

(g) where under any of the foregoing provisions of this subsection a portion only of the trust fund is required to be paid into or disposed of for the benefit of the Exchequer, paragraph (f) of this subsection shall apply and have effect in relation to that portion of the trust fund as if it were the whole of the trust fund, but nothing in this Act shall operate to relieve or discharge in respect of the residue of the trust fund the Public Trustee, the Irish Land Commission or the trustees (as the case may be) or any other person from any trust or duty for the time being imposed on them or him (whether by deed of trust, scheme, or otherwise) in respect of the trust fund so far as the trust or duty relates to the residue of the existing embankment.

(2) In this section—

[GA]

embankment” means an artificial watercourse, drain, embankment or other work constructed for the protection of land, and includes all sluices, sluice-gates, pumps, weirs, watercourses and other works forming part of or essential to the effective operation of any such embankment or work;

[GA]

existing embankment” means an embankment constructed (whether before or after the passing of this Act) for the protection of land purchased under the Land Purchase Acts or the subject of proceedings under those Acts, whether the embankment was constructed before or after such purchase or the institution of proceedings therefor and whether it was constructed by a former landlord or other person or by or under the supervision of the Irish Land Commission.

Maintenance of works.

20.—(1) The works to which a certificate of completion relates shall be maintained in proper repair and effective condition by the Commissioners and the Commissioners may do all such things as may appear to them to be necessary for or incidental to such maintenance.

[GA]

(2) In addition and without prejudice to the general powers conferred on the Commissioners by subsection (1) of this section, it shall be lawful for the Commissioners, for the purposes of maintenance referred to in that subsection, to execute such improvements to works as appear to them to be minor matters properly capable of being regarded as maintenance.

[GA]

(3) It shall be lawful for the Commissioners and their officers, agents and servants to enter on any lands at all reasonable times and there do all such things as may appear to them to be necessary for or incidental to any maintenance or improvements referred to in this section.

[GA]

(4) The Commissioners may employ contractors to effect any maintenance or improvements referred to in this section and the contractors may exercise such of the powers specified in this section as may be appropriate for the purposes of their contract.

[GA]

(5) (a) In this subsection “beach material” has the same meaning as in the Foreshore Act, 1933.

[GA]

(b) A person shall not remove beach material which is beside, or not more distant than one hundred yards from, any works required by this section to be maintained by the Commissioners save under and in accordance with a licence.

[GA]

(c) Licences for the purposes of this subsection may be granted by the Commissioners.

[GA]

(d) A person who contravenes paragraph (b) of this subsection shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding twenty pounds.

[GA]

(e) Where a licence is granted under this subsection in respect of the removal by a person of beach material, the grant shall not operate to remove any obligation which may lie on that person to obtain a licence under the Foreshore Act, 1933, or the State Property Act, 1954, authorising the removal.

[GA]

(6) No action shall lie against the Commissioners, in respect of loss occasioned by the failure of works required by this section to be maintained by the Commissioners, unless it is shown to the satisfaction of the Court that the failure was due solely to neglect by the Commissioners of their obligation to maintain the works.

[GA]

Prohibition on interference with works.

21.—(1) A person shall not pull down, remove or injure any works constructed or in course of construction by the Commissioners under a coast protection scheme or do any act which hinders the efficient operation of any such works.

[GA]

(2) A person who contravenes subsection (1) of this section shall be guilty of an offence and, on summary conviction thereof, shall be liable to a fine not exceeding fifty pounds or, in the discretion of the Court, to imprisonment for a term not exceeding six months or to both such fine and such imprisonment and shall also be liable, in the case of a continuing offence, to a fine not exceeding five pounds for every day during which the offence is continued.

Bye-laws.

22.—(1) Where the Commissioners are required by section 20 of this Act to maintain any works, they may make bye-laws for the protection of the works.

[GA]

(2) No bye-law made under this section shall be of any force or effect unless or until it has been confirmed by the Minister for Finance.

[GA]

(3) Where the Minister for Finance confirms a bye-law made under this section, a notice of the confirmation shall be published in Iris Oifigiúil and in one or more newspapers circulating in the district in which the works to which the bye-law relates are situate,

[GA]

(4) A document purporting to be a copy of a bye-law made under this section and having endorsed on it a certificate purporting to be sealed with the seal of the Commissioners declaring it to be a true copy of the bye-law shall be received in evidence in any proceedings (whether civil or criminal) in any Court as conclusive evidence of the contents of the bye-law and that it was duly made and confirmed in accordance with this section and is in force.

(5) A person who, by act or omission, contravenes a bye-law made under this section and in force shall be guilty of an offence under this section and shall be liable on summary conviction thereof to a fine not exceeding ten pounds.

[GA]

Abandonment of works.

23.—(1) Where the Commissioners are required by section 20 of this Act to maintain any works and they are at any time of opinion that, owing to causes outside their control, the works or any part or parts thereof are no longer capable of being maintained at any reasonable cost, they may apply to the Minister for Finance for an order under this section.

[GA]

(2) Where an application is made by the Commissioners under subsection (1) of this section—

[GA]

(a) the Minister for Finance may, if he is satisfied that the works to which the application relates or any part or parts thereof are, owing to causes outside the control of the Commissioners, no longer capable of being maintained at any reasonable cost, by order authorise the abandonment of the works or such part or parts,

[GA]

(b) the order shall operate to relieve the Commissioners from their obligation to maintain the works or such part or parts thereof,

[GA]

(c) the order may direct the Commissioners to take specified steps to prevent the abandoned works from becoming dangerous or a nuisance,

[GA]

(d) if the order contains any such direction, the Commissioners shall comply therewith.

[GA]

Apportionment of land purchase annuities, etc.

24.—Where land acquired under this Act is subject, in conjunction with other land, to a land purchase annuity or other annual payment payable to the Irish Land Commission or to the Commissioners, the Irish Land Commission or the Commissioners (as the case may be) may apportion the annuity or annual payment in such manner as they consider proper between the land so acquired and the other land or may charge the whole of the annuity or other payment on any part of the land subject thereto in exoneration of the residue of that land.

Payment of certain debts out of compensation.

25.—Where compensation is payable under this Act by the Commissioners to a person and any money is due and owing by that person to a Minister of State, the Revenue Commissioners, the Irish Land Commission or the Commissioners, it shall be lawful for the Commissioners to pay and discharge out of the compensation the money so due and owing by that person and to pay to him only the balance (if any) of the compensation remaining after such payment and discharge.

Payment of certain amounts to the Commissioners.

26.—(1) Where a determination under paragraph (a) of subsection (1) of section 4 or a declaration under paragraph (a) of subsection (1) of section 5 of this Act is made, the Commissioners shall serve on the promoting authority by post a notice stating the amount certified by the Commissioners as being the amount of the costs and expenses incurred by the Commissioners in respect of the preliminary examination and demanding payment by the promoting authority to the Commissioners of one-half of that amount.

(2) Where a declaration under paragraph (a) of subsection (1) of section 8, a declaration under subparagraph (i) of paragraph (a) of subsection (3) or subsection (6) of section 10 or an order under paragraph (a) of subsection (5) of section 10 of this Act is made, the Commissioners shall serve on the promoting authority by post a notice stating the amount certified by the Commissioners as being the amount of the costs and expenses incurred by the Commissioners in relation to the coast protection scheme and demanding payment by the promoting authority to the Commissioners of one-half of that amount.

[GA]

(3) Where the Commissioners carry out maintenance or improvements referred to in section 20 or comply with a direction referred to in paragraph (c) of subsection (2) of section 23 of this Act, they shall serve on the promoting authority by post a notice stating the amount certified by the Commissioners as being the amount of the costs and expenses incurred by the Commissioners in carrying out the maintenance, improvements or direction and demanding payment by the promoting authority to the Commissioners of that amount.

[GA]

(4) The amount demanded by a notice served under this section shall be payable to the Commissioners by the promoting authority and, in default of payment, shall be recoverable as a simple contract debt in any court of competent jurisdiction.

[GA]

(5) (a) Where the Commissioners carry out maintenance or improvements at Rosslare Strand, subsections (3) and (4) of this section shall apply as if the maintenance or improvements were referred to in section 20 of this Act and the council of the county of Wexford were the promoting authority.

[GA]

(b) In the foregoing paragraph—

[GA]

the reference to maintenance at Rosslare Strand shall be construed as a reference to maintenance in proper repair and effective condition of the coast protection works at Rosslare Strand in the county of Wexford which were commenced by the Commissioners in the year 1957;

[GA]

the reference to improvements at Rosslare Strand shall be construed as a reference to any improvements to those works executed by the Commissioners which appear to them to be minor matters properly capable of being regarded as maintenance.

[GA]

(6) If, in a case in which a notice is served under subsection (1) or subsection (2) of this section, the land and other property being damaged or liable to be endangered by encroachment of the sea are situate partly in the functional area of the promoting authority and partly in the functional area of another local authority or the functional areas of other local authorities, the other local authority or each other local authority shall make, to the amount demanded by the notice, a contribution of such amount as may be agreed upon between them and the promoting authority or, in default of agreement, may be fixed by the Minister for Local Government.

(7) If, in a case in which a notice is served under subsection (3) of this section, a local authority or local authorities contributed pursuant to paragraph (a) of subsection (1) of section 17 of this Act, that local authority or each of those local authorities shall make, to the amount demanded by the notice, a contribution of such amount as may be agreed upon between them and the promoting authority or, in default of agreement, may be fixed by the Minister for Local Government.

(8) If, in a case in which a notice is served under subsection (3) of this section, a harbour authority or harbour authorities contributed pursuant to paragraph (c) of subsection (1) of section 17 of this Act, that harbour authority or each of those harbour authorities shall make, to the amount demanded by the notice, a contribution of such amount as may be agreed upon between them and the promoting authority or, in default of agreement, may be fixed by the Minister for Local Government after consultation with the Minister for Transport and Power.

Public inquiries.

27.—(1) Where a report has been submitted under section 2 of this Act, the Minister for Finance, if he considers it necessary, may at any time before the making of the order under subsection (5) of section 10 of this Act, cause a public inquiry to be held by a person appointed by him, in relation to the proposals for coast protection.

[GA]

(2) The following provisions shall have effect in relation to a public inquiry under this section:

[GA]

(a) the Minister for Finance shall publish in Iris Oifigiúil, and in one or more newspapers circulating in the county of the promoting authority and any other county the council of which named the promoting authority pursuant to this Act, a notice stating that the inquiry will be held at the time (not being less than three weeks after the first publication of the notice) and place specified in the notice,

(b) all persons who in the opinion of the person holding the inquiry are interested therein shall be entitled to appear and be heard (in person or by solicitor or counsel) and adduce evidence at the inquiry,

[GA]

(c) the person holding the inquiry shall have power by notice in writing signed by him to summon witnesses and to require the production of books and other documents, and any person so summoned who fails to attend the inquiry and give evidence thereat and any person who fails or refuses to produce any book or other document the production of which is so required shall be guilty of an offence and shall be liable on summary conviction thereof to a fine not exceeding ten pounds,

(d) all evidence at the inquiry shall be given on oath, which oath, the person holding the inquiry is hereby empowered to administer, and any person who gives false evidence at the inquiry shall be guilty of perjury and be punishable accordingly,

[GA]

(e) the person holding the inquiry shall be entitled to adjourn the inquiry as he thinks fit and shall also have power to inspect and examine, and for that purpose to enter upon, any lands and premises affected by the relevant encroachment of the sea.

[GA]

Expenses of Commissioners.

28.—The expenses incurred by the Commissioners in giving effect to this Act and in the administration thereof shall, to such extent as may be sanctioned by the Minister for Finance, be paid out of moneys provided by the Oireachtas.

Short title.

29.—This Act may be cited as the Coast Protection Act, 1963.

(2) (a) I gcás ina ndéanfar fiosrúchán faoi fho-alt (1) den alt seo, cuirfidh an chomhairle faoi deara go n-ullmhófar agus go gcuirfear faoina mbráid tuarascáil ag insint cá bhfuil an t-ionradh farraige iomchuí agus a mhéid, agus an méid talún agus maoine eile atá á dhamáistiú nó á bhaolú, na hoibreacha (más aon oibreacha é) is indéanta agus is inmhianaithe chun leanúntas an ionraidh a chosc agus an méid a mheastar a chosnóidh na hoibreacha.

(3) (a) I gcás ina gcuirfear tuarascáil faoi bhráid comhairle contae faoi fho-alt (2) den alt seo, féadfaidh an chomhairle, más deimhin leo go bhfuil talamh sa chontae á dhamáistiú go céimníoch ag ionradh leanúnach na farraige, ar leith ó stoirmeacha ócáideacha nó neamhghnácha, agus gur dóigh don ionradh sábháilteacht cuain, na foirgnimh nó na taitneamh achtaí i limistéar cónaithe nó maoin luachmhar eile a bhaolú, a dhearbhú gur fóirstineach scéim chaomhnaithe cósta a bhunú agus gur ceart a iarraidh ar na Coimisinéirí réamhscrúdú a dhéanamh.

(b) I gcás—

(i) ina mbeidh comhairle contae tar éis tuarascáil a cuireadh faoina mbráid faoi fho-alt (2) den alt seo a bhreithniú agus a chinneadh gan dearbhú a dhéanamh faoin bhfo-alt seo, agus

(ii) gur le haghaidh oibreacha caomhnaithe cósta a bheadh, go léir, laistigh de cheantar uirbeach na tograí,

cuirfidh an chomhairle tuarascáil chun comhairle an cheantar uirbigh.

[EN]

(c) I gcás ina gcuirfear tuarascáil chun comhairle cheantair uirbigh faoi mhír (b) den fho-alt seo, féadfaidh an chomhairle, más deimhin leo go bhfuil talamh sa cheantar uirbeach á dhamáistiú go céimníoch ag ionradh leanúnach na farraige, ar leith ó stoirmeacha ócáideacha nó neamhghnácha, agus gur dóigh don ionradh sábháilteacht cuain, foirgnimh nó taitneamhachtaí limistéir chónaithe nó maoin luachmhar eile a bhaolú, féadfaidh siad, le toiliú an Aire Rialtais Áitiúil agus faoi réir comhairle contae do thabhairt gealltanais cibé ranníoc a dhéanamh i leith an iarmhéid dá dtagraítear i mír (b) d'alt 16 den Acht seo a bheidh an tAire tar éis a cheadú, a dhearbhú gur fóirstineach scéim chaomhnaithe cósta a bhunú agus gur ceart a iarraidh ar na Coimisinéirí réamhscrúdú a dhéanamh.

(4) Más rud é, i gcás ionradh farraige a dhéanann difear do thalamh i dhá chontae nó níos mó, go ndéanfaidh gach ceann de chomhairlí na gcontaetha dearbhú faoi fho-alt (3) den alt seo, ainmneoidh na comhairlí comhairle amháin mar an t-údarás a bhunóidh an scéim chaomhnaithe cósta.

(5) Is dleathach do chomhairle contae agus dá n-oifigigh, dá ngníomhairí agus dá seirbhísigh dul isteach ar aon tailte gach tráth réasúnach agus gach ní a dhéanamh ansin is dealraitheach dóibh is gá nó is fóirstineach chun tuarascáil a ullmhú faoi fho-alt (2) den alt seo.

(6) Is feidhm fhorcoimeádta tuarascáil a bhreithniú faoin alt seo agus is feidhm fhorcoimeádta dearbhú a dhéanamh faoin alt seo.

Réamhscrúdú ag an Coimisinéirí.

3.—(1) Nuair a gheobhaidh na Coimisinéirí ón údarás bunaitheoireachta—

(a) cóip dheimhnithe de rún ón údarás bunaitheoireachta chun críocha fo-alt (3) d'alt 2 den Acht seo,

(b) cóip de thuarascáil faoi fho-alt (2) d'alt 2 den Acht seo,

(c) gealltanas ón údarás bunaitheoireachta go n-íocfaidh siad, má dhéanann na Coimisinéirí, tar éis do na Coimisinéirí réamhscrúdú a dhéanamh i dtaobh ionradh farraige, cinneadh faoi mhír (a) d'fho-alt (1) d'alt 4 den Acht seo nó má dhéanann an t-údarás bunaitheoireachta dearbhú faoi mhír (a) d'fho-alt (1) d'alt 5 den Acht seo, an méid a dtiocfaidh sé gur iomchuí dóibh é a íoc nuair a bheifear tar éis fógra faoi fho-alt (1) d'alt 26 den Acht seo a sheirbheáil, agus

(2) I gcás ina ndéanann an t-ionradh farraige difear do thalamh i dhá chontae nó níos mó, déanfar an tagairt i mír (a) d'fho-alt (1) den alt seo do chóip dheimhnithe de rún ón údarás bunaitheoireachta chun críocha fo-alt (3) d'alt 2 den Acht seo a fhorléiriú mar thagairt do chóipeanna deimhnithe de rúin ó chomhairlí na gcontaetha sin chun na gcríocha sin.

(3) Is dleathach do na Coimisinéirí agus dá n'oifigigh, dá ngníomhairí agus dá seirbhísigh dul isteach ar aon tailte gach tráth réasúnach agus gach ní a dhéanamh ansin is dealraitheach dóibh is gá nó is fóirstineach chun réamhscrúdú a dhéanamh faoin alt seo.

Cinneadh ag na Coimisinéirí.

4.—(1) Ar réamhscrúdú faoi alt 3 den Acht seo a bheith críochnaithe—

(a) cinnfidh na Coimisinéirí nach amhlaidh do na himthosca gur ceart lánscrúdú a dhéanamh agus scéim chaomhnaithe cósta a ullmhú agus a chur i bhfeidhm, nó

(b) cinnfidh na Coimisinéirí gurb amhlaidh do na himthosca gurb indéanta scéim chaomhnaithe cósta a ullmhú agus a chur i bhfeidhm.

(2) I gcás ina ndéanfaidh na Coimisinéirí cinneadh de bhun mhír (a) d'fho-alt (1) den alt seo, tabharfaidh siad tuarascáil sa chéill sin don údarás bunaitheoireachta agus leagfaidh siad amach sa tuarascáil sin, i cibé slí agus chomh mion sin agus is dóigh leo is gá, na cúiseanna ar a bhfuil an cinneadh bunaithe.

(3) I gcás ina ndéanfaidh na Coimisinéirí cinneadh de bhun mhír (b) d'fho-alt (1) den alt seo, cuirfidh siad sin in iúl don údarás bunaitheoireachta agus san am céanna cuirfidh siad ar aghaidh chun an údaráis sin tuarascáil (a mbeidh cibé léarscáileanna nó pleananna ina teannta is dóigh leo is gá) ina mbeidh sé leagtha amach, i cibé slí agus chomh mion agus is dóigh leo is gá, an méid talún agus maoine eile atá á dhamáistiú nó i ndóigh a bhaolaithe, na hoibreacha is dóigh leo is indéanta agus is inmhianaithe chun leanúntas ionraidh na farraige a chosc agus an méid a mheastar a chosnóidh na hoibreacha sin.

5.—(1) I gcás ina dtuairisceoidh na Coimisinéirí, de bhun fo-alt (3) d'alt 4 den Acht seo, cinneadh a rinne siad gurb amhlaidh do na himthosca gurb indéanta scéim chaomhnaithe cósta a ullmhú agus a chur i bhfeidhm, déanfaidh an t-údarás bunaitheoireachta, tar éis an tuarascáil a bhreithniú,—

(a) a dhearbhú nach bhfuil scéim chaomhnaithe cósta le cur chun cinn, nó

[EN]

(b) a dhearbhú gur ceart a iarraidh ar na Coimisinéirí scéim chaomhnaithe cósta a ullmhú agus a chur i bhfeidhm.

(2) Aon dearbhú faoi mhír (b) d'fho-alt (1) den alt seo beidh dearbhú ann go ndéanfaidh an t-údarás bunaitheoireachta maidir leis an scéim chaomhnaithe cósta—

(a) aon ranníoc a dtiocfaidh sé gur cuí dóibh é a dhéanamh faoi alt 16 den Acht eo, agus

[EN]

(b) aon íocaíocht a dtiocfaidh sé gur cuí dóibh é a dhéanamh de dhroim fógra a seirbheáladh faoi fho-alt (2) nó fo-alt (3) d'alt 26 den Acht seo.

(3) Is feidhm fhorcoimeádta tuarascáil a bhreithniú agus dearbhú a dhéanamh faoin alt seo.

Scéim chaomhnaithe cósta a ullmhú.

6.—(1) Nuair a gheobhaidh na Coimisinéirí ón údarás bunaitheoireachta cóip dheimhnithe de rún ón údarás bunaitheoireachta chun críocha mhír (b) d'fho-alt (1) d'alt 5 den Acht seo, féadfaidh na Coimisinéirí, faoi réir toiliú an Aire Airgeadais agus aon choinníollacha a chuirfidh sé, scéim a ullmhú chun ionradh iomchuí na farraige a chosc agus cuirfidh siad cóip den scéim go dtí an t-údarás bunaitheoireachta agus go dtí aon chomhairle eile a d'ainmnigh an t-údarás bunaitheoireachta.

(2) Is dleathach do na Coimisinéirí agus dá n-oifigigh, dá ngníomhairí agus dá seirbhísigh dul isteach ar aon tailte gach tráth réasúnach agus gach ní a dhéanamh ansin is dealraitheach dóibh is gá nó is fóirstineach chun scéim faoin alt seo a ullmhú.

Nithe a thaispeánfar i scéim.

7.—Taispeánfaidh scéim chaomhnaithe cósta, i gcorp na scéime nó le léarscáileanna, líníochtaí, pleananna, teascáin agus sceidil iomchuí a bheidh ag gabháil léi—

(a) na hoibreacha a bheartaítear a ghabháil de láimh de bhun na scéime agus an láthair ar a mbeartaítear iad a dhéanamh,

(b) na tailte agus an mhaoin eile ar a bhfuil ionradh déanta nó atá i ndóigh a bhaolaithe (dá ngairtear na tailte caomhnaithe san Acht seo) agus a bhfuil sé beartaithe iad a chaomhnú leis na hoibreacha sin,

(c) na tailte a mbeartaítear iad a ghlacadh, nó cur isteach substainteach a dhéanamh orthu, go héigeantach, na héasúintí, na hiascaigh, na cearta uisce, na cearta loingseoireachta agus na cearta eile a mbeartaítear iad a ghlacadh, a shrianadh nó a fhoirceannadh, nó cur isteach a dhéanamh orthu ar shlí eile, go héigeantach, agus na bóithre agus na droichid (poiblí nó príobháideach) a mbeartaítear iad a choradh, a dhíchur nó cur isteach a dhéanamh orthu ar shlí eile,

Dearbhú ó údarás bunaitheoireachta ar scéim a fháil.

8.—(1) I gcás ina bhfaighidh údarás bunaitheoireachta cóip de scéim chaomhnaithe cósta a cuireadh chucu de bhun fo-alt (1) d'alt 6 den Acht seo—

(a) dearbhóidh siad nach bhfuil an scéim le cur chun cinn, nó

[EN]

(b) dearbhóidh siad go bhfuil an scéim le cur chun cinn.

(2) I gcás ina mbeifear tar éis dearbhú a dhéanamh faoi mhír (b) d'fho-alt (1) den alt seo—

(a) foilseoidh an t-údarás bunaitheoireachta, san Iris Oifigiúil agus i nuachtán amháin nó níos mó a léitear i gcontae an údaráis bhunaitheoireachta agus in aon chontae eile ar ainmnigh a chomhairle an t-údarás bunaitheoireachta de bhun an Achta seo, fógra á insint go bhfuil an scéim chaomhnaithe cósta ullmhaithe agus ag insint freisin na háite nó na n-áiteanna a mbeidh agus an tréimhse, nach giorra ná mí, a bheidh cóip den scéim ar fáil chun a hiniúchta de bhun an ailt seo,

(b) cuirfidh an t-údarás bunaitheoireachta faoi deara an chóip den scéim chaomhnaithe cósta a chuir na Coimisinéirí chucu a chur ar taispeáint ina bpríomhoifigí nó in áit chaothúil eile i gcaitheamh na tréimhse a shonrófar chuige sin san fhógra dá dtagraítear sa mhír sin roimhe seo agus ceadóidh siad an chóip a iniúchadh i rith uaireanna oifige ag aon duine a éileoidh leas a bheith aige sa chéanna.

(3) Is feidhm fhorcoimeádta dearbhú a dhéanamh faoin alt seo.

9.—(1) I gcás ina mbeidh an t-údarás bunaitheoireachta tar éis dearbhú a dhéanamh faoi mhír (b) d'fho-alt (1) d'alt 8 den Acht seo maidir le scéim chaomhnaithe cósta—

(a) seirbheálfaidh siad ar aon duine a bheidh ainmnithe sa scéim mar dhílseánach, úinéir nó áititheoir (rátaithe nó eile) ainme ar aon talamh a mbeartaítear é a ghlacadh, nó cur isteach substainteach a dhéanamh air, go héigeantach, nó ar aon éasúint, iascach, ceart uisce, ceart loingseoireachta nó ceart eile nó ar aon bhóthar nó droichead príobháideach a mbeartaítear é a ghlacadh, a shrianadh, a fhoirceannadh, nó cur isteach eile a dhéanamh air, go héigeantach, fógra ag insint go bhfuil an scéim ullmhaithe, ag sonrú na háite nó na n-áiteanna a mbeidh agus an tréimhse a bheidh, cóip den scéim ar fáil chun a hiniúchta de bhun an Achta seo agus á chur in iúl dó go mbeartaíonn an scéim, maidir le talamh nó ceart éigin nó maoin éigin eile ar uinéir nó áititheoir ainme air é, go nglacfar go héigeantach é nó go gcuirfear isteach go héigeantach air (agus tabharfar tuairisc iomlán san fhógra ar an talamh, an ceart nó an mhaoin agus ar an gcur isteach a bheartaítear (má bheartaítear) a dhéanamh);

(b) seirbheálfaidh siad ar gach duine arb é an t-údarás áitiúil é (nach comhairle ar cuireadh cóip den scéim chucu de bhun fo-alt (1) d'alt 6 den Acht seo) ar a mbeidh cúram cothabhála aon bhóthair nó droichid phoiblí a mbeartaítear sa scéim é a choradh, a dhíchur é nó cur isteach ar shlí eile air fógra ag insint don údarás sin i dtaobh an scéim a ullmhú agus i dtaobh an coradh, an díchur nó an cur isteach a bheartaítear sa scéim a dhéanamh maidir leis an mbóthar nó an droichead sin, agus

(c) seirbheálfaidh siad ar dhuine amháin nó níos mó de na daoine is iontaobhaithe d'aon chiste iontaobhais chun oibreacha a chothabháil a mb'fhéidir go gcuirfí isteach orthu tríd an scéim a chur i bhfeidhm fógra ag insint go bhfuil an scéim ullmhaithe agus go mb'fhéidir go gcuirfeadh a cur i bhfeidhm isteach ar na hoibreacha sin.

(2) Beidh i bhfógra a sheirbheálfar ar aon duine de bhun an ailt seo ráiteas á chur in iúl dó go bhféadfaidh sé, aon tráth laistigh de dhá mhí tar éis an fógra a sheirbheáil air, na tuairimí sin uile (más ann dóibh) is cuí leis i dtaobh na n-ábhar lena mbainfidh an fógra a chur go dtí an t-údarás bunaitheoireachta.

(3) Aon duine ar a seirbheálfar fógra de bhun an ailt seo féadfaidh sé, aon tráth laistigh de dhá mhí tar éis an fógra a sheirbheáil air, na tuairimí sin uile (más ann) is cuí leis i dtaobh na n-ábhar lena mbainfidh an fógra a chur go dtí an t-údarás bunaitheoireachta.

(4) Féadfar fógra a cheanglaítear leis an alt seo a sheirbheáil ar aon duine a sheirbheáil leis an bpost cláraithe agus, mura feasach seoladh an duine sin, féadfar an clúdach ina mbeidh an fógra a dhíriú chuige ag na tailte nó san áit nó san ionad ina bhfuil an ceart nó an mhaoin lena mbainfidh an fógra.

Scéim a dhaingniú.

10.—(1) Ar bheith caite don am a cheaptar le halt 9 den Acht seo chun daoine ar ar seirbheáladh fógra de bhun an ailt sin do chur tuairimí i dtaobh scéim chaomhnaithe cósta chun an údaráis bhunaitheoireachta, scrúdóidh an t-údarás bunaitheoireachta na tuairimí a cuireadh chucu go cuí agus tabharfaidh siad do na Coimisinéirí tuarascáil ina mbeidh na tuairimí sin agus na hathruithe sin (más aon athruithe é) (trí athrú, fágáil ar lár nó breisiú) leagtha amach a bheartaíonn siad ba chóir a dhéanamh ar an scéim.

(2) I gcás ina dtabharfar tuarascáil faoi fho-alt (1) den alt seo do na Coimisinéirí, scrúdóidh siad an tuarascáil agus—

(a) cinnfidh siad nach bhfuil aon athrú le déanamh ar an scéim, nó

[EN]

(b) cinnfidh siad na hathruithe (trí athrú, fágáil ar lár nó breisiú) atá le déanamh ar an scéim.

(3) (a) I gcás ina ndéanfaidh na Coimisinéirí cinneadh faoi fho-alt (2) den alt seo, tabharfaidh siad fógra faoin gcinneadh don údarás bunaitheoireachta agus air sin—

(i) dearbhóidh an t-údarás nach bhfuil an scéim le cur chun cinn, nó

[EN]

(ii) dearbhóidh an t-údarás go bhfuil an scéim le cur chun cinn.

(b) Is feidhm fhorcoimeádta dearbhú a dhéanamh faoin bhfo-alt seo.

(4) Nuair a gheobhfaidh na Coimisinéirí cóip dheimhnithe de dhearbhú faoi fhomhír (ii) de mhír (a) d'fho-alt (3) den alt seo ón údarás bunaitheoireachta, déanfaidh na Coimisinéirí an scéim chaomhnaithe cósta, agus cóip den fhógra a tugadh de bhun fo-alt (3) den alt seo ina teannta, a chur faoi bhráid an Aire Airgeadais.

(5) I gcás ina gcuirfear scéim chaomhnaithe cósta faoi bhráid an Aire Airgeadais faoi fho-alt (4) den alt seo, féadfaidh an tAire Airgeadais, tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil, leis an Aire Iompair agus Cumhachta agus le cibé Aire nó Airí eile is dóigh leis is gá—

(a) ordú a dhéanamh ag diúltú an scéim a dhaingniú, nó

[EN]

(b) ordú a dhéanamh ag daingniú na scéime, gan athruithe nó le cibé athruithe (trí athrú, breisiú nó fágáil ar lár) is dóigh leis is gá, agus cuirfidh sé cóip den ordú chun na gCoimisinéirí agus chun an údaráis bhunaitheoireachta.

(6) (a) I gcás ina ndaingneoidh ordú faoin alt seo scéim chaomhnaithe cósta le hathruithe (trí athrú, breisiú nó fágáil ar lár), ní bheidh aon éifeacht ag an ordú má dhearbhaíonn an t-údarás bunaitheoireachta, laistigh de mhí tar éis cóip den ordú a fháil, nach bhfuil an scéim le cur chun cinn.

(b) Is feidhm fhorcoimeádta dearbhú a dhéanamh faoin bhfo-alt seo.

(7) Laistigh de dhá mhí tar éis cóip d'ordú faoin alt seo a fháil ag daingniú scéim chaomhnaithe cósta, seirbheálfaidh an t-údarás bunaitheoireachta, mura mbeidh siad tar éis dearbhú a dhéanamh faoi fho-alt (6) den alt seo, cóip den ordú—

(a) ar gach duine de dhílseánaigh agus d'úinéirí ainme agus d'áititheoirí rátaithe ainme agus d'áititheoirí ainme eile na dtailte uile agus faoi seach a mbeartaítear iad a ghlacadh, nó cur isteach substainteach a dhéanamh orthu, go héigeantach agus na n-éasúintí, na n-iascach, na gceart uisce, na gceart loingseoireachta agus na gceart eile, uile agus faoi seach, agus na mbóthar agus na ndroichead príobháideach a mbeartaítear iad a ghlacadh, a shrianadh nó a fhoirceannadh nó cur isteach orthu ar shlí eile.

(8) Féadfar cóip a cheanglaítear le fo-alt (7) den alt seo a sheirbheáil ar aon duine a sheirbheáil leis an bpost cláraithe agus, mura feasach seoladh an duine sin, féadfar an clúdach ina mbeidh an chóip a dhíriú chuige ag na tailte nó san áit nó san ionad ina bhfuil an ceart nó an mhaoin lena mbainfidh an chóip.

Cumhachtaí a thabharfaidh ordú a dhaingneoidh scéim.

11.—(1) I gcás ina mbeidh ordú ag daingniú scéim chaomhnaithe cósta déanta faoin Acht seo, oibreoidh an t-ordú chun cumhacht a thabhairt do na Coimisinéirí—

(a) chun na hoibreacha a shonrófar sa scéim a fhoirgniú, a dhéanamh agus a chríochnú faoi réir cibé breisithe, fágáil ar lár, athruithe agus claonta a gheofar a bheith riachtanach i gcúrsa na hoibre,

(b) chun dul isteach ar aon talamh agus gach gníomh agus gach ní a dhéanamh ann is gá chun nó i dtaobh na hoibreacha sin a fhoirgniú, a dhéanamh nó a chríochnú faoi réir na mbreisithe, an fágáil ar lár, na n-athruithe agus na gclaonta a dúradh,

(c) chun na tailte, na héasúintí, na hiascaigh, na cearta uisce, na cearta loingseoireachta agus na cearta eile, uile agus faoi seach, a ghlacadh go héigeantach a mholfar sa scéim a ghlacadh amhlaidh, agus más oiriúnach leis na Coimisinéirí é, dul isteach ar aon tailte acu sin nó aon chuid de na héasúintí, na hiascaigh, na cearta uisce, na cearta loingseoireachta agus na cearta eile sin a fheidhmiú sula ndéanfar na tailte, na héasúintí, na hiascaigh nó na cearta sin a thíolacadh nó a bpraghas a chinneadh,

(d) cur isteach go substainteach ar aon talamh a molfar sa scéim cur isteach air amhlaidh agus, más oiriúnach leis na Coimisinéirí é, dul isteach ar an talamh sin agus cur isteach air amhlaidh sula ndéanfar aon chinneadh maidir le cúiteamh ina thaobh,

(e) chun srianadh, foirceannadh nó cur isteach eile a dhéanamh ar aon éasúintí, iascaigh, cearta uisce, cearta loingseoireachta nó cearta eile a moltar sa scéim srianadh, foirceannadh nó cur isteach a dhéanamh go héigeantach orthu, agus coradh, díchur nó cur isteach ar shlí eile a dhéanamh ar aon bhóithre nó droichid a moltar sa scéim coradh, díchur nó cur isteach a dhéanamh orthu agus, más oiriúnach leis na Coimisinéirí é, aon ní de na nithe réamhráite a dhéanamh sula ndéanfar aon chinneadh maidir le cúiteamh ina thaobh,

(f) chun conraitheoirí a fhostú chun na hoibreacha sin go léir nó aon chuid díobh a dhéanamh, agus

(g) chun gach gníomh agus ní eile a dhéanamh is dóigh leis na Coimisinéirí is gá nó is ceart chun nó i dtaobh an scéim a chur i bhfeidhm go cuí agus nach ndéantar socrú sonrach ina dtaobh leis an Acht seo.

(2) Maidir le conraitheoirí den sórt dá dtagraítear i mír (f) d'fho-alt (1) den alt seo, oibreoidh ordú daingnithe na scéime caomhnaithe cósta freisin chun an chuid sin de na cumhachtaí a thabhairt dóibh a shonraítear san fho-alt sin agus is iomchuí chun críocha a gconartha.

Dualgais maidir le bóithre agus droichid phoiblí.

12.—(1) I gcás socrú a bheith i scéim chaomhnaithe cósta a bheidh daingnithe faoin Acht seo chun coradh, díchur nó cur isteach eile a dhéanamh ar bhóthar nó droichead (dá ngairtear an bóthar nó an droichead bunaidh san alt seo) a mbeidh freagracht a chothabhála ar údarás áitiúil, beidh éifeacht ag na forálacha seo a leanas:

(a) más gá, chun an scéim a chur i bhfeidhm, an bóthar nó an droichead bunaidh a dhúnadh in aghaidh tráchta, ansin, do réir mar is cuí leis na Coimisinéirí, déanfaidh siad agus (an fad a bheidh an bóthar nó an droichead bunaidh dúnta amhlaidh in aghaidh tráchta) cothabhálfaidh siad bóthar nó droichead sealadach a bheidh dóthanach chun an méid agus an saghas tráchta a iompar a bhíonn ar an mbóthar nó an droichead bunaidh de ghnáth, nó forordóidh siad, le hordú a dhéanfar le toiliú an Aire Rialtais Áitiúil, malairt conaire a úsáidfear le linn an bóthar nó an droichead bunaidh a bheith dúnta amhlaidh in aghaidh tráchta;

(b) déanfaidh na Coimisinéirí, sula mbeidh an scéim curtha i bhfeidhm go hiomlán, cibé ní acu seo a leanas is cuí leo a dhéanamh, is é sin le rá:

(i) an bóthar nó an droichead bunaidh a athchóiriú, nó

[EN]

(ii) tar éis dul i gcomhairle leis an Aire Rialtais Áitiúil, buan-bhóthar nó buan-droichead nua a dhéanamh a bheidh dóthanach chun an cothrom céanna tráchta (maidir le méid agus saghas) a iompar a d'fhéad an bóthar nó an droichead bunaidh a iompar agus gan é mórán níos neamhchaothúla maidir le fána agus cuar ná an bóthar nó an droichead bunaidh, nó

(iii) le toiliú an Aire Rialtais Áitiúil, bóthar ionaid nó droichead ionaid láithreach a fheabhsú (trína athdhéanamh, a neartú, a leathnú, nó eile) i slí go mbeidh sé dóthanach chun an trácht is dóigh a bheidh air a iompar agus nach mbeidh sé mórán níos neamhchaothúla ná an bóthar bunaidh nó an droichead bunaidh;

(c) má dhéanann na Coimisinéirí buan-bhóthar nó buandroichead nua nó má fheabhsaíonn siad bóthar ionaid nó droichead ionaid láithreach agus gur mó de chuid mhaith na buntáistí a thugann an bóthar nó an droichead sin do phobal aon chontae nó cheantair uirbigh ná mar a thug an bóthar bunaidh nó an droichead bunaidh, cibé acu trí shlí chumarsáide níos fearr a thabhairt dóibh nó trí aon ní eile é, deimhneoidh na Coimisinéirí costas an bhóthair nua nó an droichid nua sin nó an fheabhsaithe sin (cibé acu é) agus deimhneoidh an tAire Rialtais Áitiúil an chuid den chostas sin is dóigh leis ba chóir de réir réasúin a bheith ina muirear an chomhairle an chontae nó an cheantair uirbigh sin, agus air sin déanfaidh an chomhairle sin suim is comhionann leis an gcuid a shonrófar amhlaidh den chostas sin a íoc leis na Coimisinéirí;

(d) má éiríonn aon amhras, díospóid, nó ceist i dtaobh cé acu a chomhlíon nó nár chomhlíon na Coimisinéirí na forálacha iomchuí den alt seo maidir le haon bhóthar nó droichead sealadach a dhéanamh nó a chothabháil nó maidir leis an mbóthar bunaidh nó an droichead bunaidh a athchóiriú nó le bóthar ionaid nó droichead ionaid láithreach a fheabhsú (cibé acu é) de bhun an ailt seo, nó i dtaobh cé acu a thugann nó nach dtugann buan-bhóthar nó buan-droichead nua a rinne na Coimisinéirí nó bóthar ionaid nó droichead ionaid láithreach a d'fheabhsaigh na Coimisinéirí (cibé acu é) do phobal aon chontae nó cheantair uirbigh buntáistí is mó de chuid mhaith ná mar a thug an bóthar bunaidh nó an droichead bunaidh, cinnfidh an tAire Rialtais Áitiúil an t-amhras, an díospóid, nó an cheist.

(2) Féadfaidh na Coimisinéirí comhaontú leis an údarás áitiúil iomchuí chun an t-údarás sin do dhéanamh aon ní a cheanglaítear ar na Coimisinéirí nó a údaraítear dóibh le fo-alt (1) den alt seo a dhéanamh, agus féadfaidh siad freisin comhaontú airgead a íoc leis an údarás sin chun nó mar chabhair chun íoctha costas déanta an ní sin acu.

(3) I gcás ina mbeidh na Coimisinéirí tar éis déanamh buanbhóthair nó buan-droichid nua nó feabhsú bóthair ionaid nó droichid ionaid láithrigh a chríochnú de bhun an ailt seo, seachadfaidh siad don údarás áitiúil iomchuí, agus glacfaidh an t-údarás sin, an bóthar nó an droichead a bheidh déanta agus feabhsaithe amhlaidh.

(4) Ní oibreoidh aon ní san alt seo chun aon dualgas nó freagracht a chur ar na Coimisinéirí maidir le cothabháil aon bhuan-bhóthair nó buan-droichid nua a rinne siad de bhun an ailt seo nó aon bhóthair nó droichid a d'athchóirigh siad nó a d'fheabhsaigh siad amhlaidh.

13.—(1) A luaithe is féidir tar éis dáta ordaithe faoin Acht seo ag daingniú scéim chaomhnaithe cósta, cromfaidh na Coimisinéirí ar na tailte, na héasúintí, na hiascaigh, na cearta uisce, na cearta loingseoireachta agus na cearta eile, uile agus faoi seach, a ghlacadh chucu a molfar sa scéim iad a ghlacadh go héigeantach, ach ní bheidh d'oibleagáid ar na Coimisinéirí aon talamh, éasúint, iascach, ceart uisce, ceart loingseoireachta ná ceart eile a ghlacadh chucu a molfar sa scéim é a ghlacadh go héigeantach agus a dtiocfaidh na Coimisinéirí ar an tuairim ina thaobh nach gá é a ghlacadh chucu chun an scéim a chur i bhfeidhm.

(2) An cúiteamh a íocfaidh na Coimisinéirí as tailte, éasúintí, iascaigh, cearta uisce, cearta loingseoireachta agus cearta eile a ghlacfar go héigeantach de bhun fo-alt (1) den alt seo leis na daoine uile agus faoi seach a mbeidh teideal acu chucu nó a mbeidh eastáit nó leasanna acu iontu nó a mbeidh teideal acu chun na dtailte, nó a mbeidh eastáit nó leasanna acu sna tailte, a mbeidh na cearta a bheifear chun a ghlacadh amhlaidh infheidhmithe orthu nó ina leith, déanfar, cheal comhaontú, é a shocrú faoi réim agus de réir an Acquisition of Land (Assessment of Compensation) Act, 1919, arna leasú le hachtacháin ina dhiaidh sin.

(3) Ní bheidh d'oibleagáid ar na Coimisinéirí aon chur isteach a dhéanamh ar aon talamh, éasúint, iascach, ceart uisce, ceart loingseoireachta, ná ceart eile ná ar aon bhóthar ná droichead, a mholfar i scéim chaomhnaithe cósta a dhéanamh go héigeantach agus a dtiocfaidh na Coimisinéirí ar an tuairim ina thaobh nach gá é a dhéanamh chun an scéim a chur i bhfeidhm.

(4) An méid cúitimh is iníoctha le haon duine mar gheall ar chur isteach substainteach a dhéanamh go héigeantach ar aon talamh nó srianadh nó foirceannadh, nó cur isteach eile, a dhéanamh go héigeantach ar aon éasúint, iascach, ceart uisce, ceart loingseoireachta nó ceart eile nó aon bhóthar nó droichead príobháideach a choradh, a dhíchur, nó cur isteach eile a dhéanamh air, faoi réim nó de bhun scéim chaomhnaithe cósta, socrófar é, cheal comhaontú, faoi réim agus de réir an Acquisition of Land (Assessment of Compensation) Act, 1919, arna leasú le hachtacháin ina dhiaidh sin, ionann is dá mba phraghas talún a glacadh go héigeantach an cúiteamh sin.

(5) Beidh feidhm ag ailt 69 go 83 den Lands Clauses Consolidation Act, 1845, maidir le haon chúiteamh is iníoctha ag na Coimisinéirí faoin alt seo agus maidir le haon talamh nó ceart a ghlacfaidh na Coimisinéirí chucu faoin alt seo a thíolacadh dóibh agus chun críocha na feidhme sin measfar gurb iad na Coimisinéirí bunaitheoirí an ghnóthais.

(6) Ní bheidh aon chúis caingne ó thaobh dlí ná cothromais ann i gcoinne na gCoimisinéirí ná aon oifigigh, gníomhaire, ná seirbhísigh do na Coimisinéirí i leith aon ghníomh, ábhair ná ní ar iníoctha cúiteamh ina leith de bhua an ailt seo nó an chéad ailt eile.

Cúiteamh mar gheall ar chur isteach áirithe ar thalamh, etc.

14.—(1) Aon duine a fhulaingeoidh aon chaillteanas nó damáiste mar gheall ar aon chur isteach (seachas cur isteach dá dtagróidh fógra a seirbheáladh de bhun mhír (a), (b) nó (c) d'fho-alt (1) d'alt 9 den Acht seo) ag na Coimisinéirí, le linn aon oibreacha a bheith á ndéanamh faoin Acht seo, ar aon talamh a bheidh ar úinéireacht nó ar áitiú aige nó ar aon éasúint, iascach, ceart uisce, ceart loingseoireachta, nó ceart eile dá chuid beidh sé, faoi réir forálacha an Achta seo, i dteideal go n-íocfaidh na Coimisinéirí cúiteamh leis i leith an chaillteanais nó an damáiste sin.

(2) Gach éileamh ar chúiteamh faoin alt seo déanfar é i scríbhinn chun na gCoimisinéirí laistigh de bhliain tar éis an dáta ar a dtosófar ar an gcur isteach lena mbainfidh an t-éileamh.

(3) Déanfar, cheal comhaontú, cúiteamh faoin alt seo a chinneadh le headráin de bhun an Achta Eadrána, 1954.

Abhair ar a dtabharfar aird le linn cúiteamh a bheith á mheasúnú.

15.—Nuair a bheidh cúiteamh á mheasúnú de bhun ceachtar den dá alt díreach roimhe seo, tabharfaidh an t-eadránaí aird i ngach cás ar aon tairbhe d'aon mhaoin (cibé acu is í an mhaoin í arb ina leith a bheidh an cúiteamh á éileamh nó nach í) leis an duine a bheidh ag éileamh an chúitimh a thiocfaidh, nó a mbeidh coinne réasúnach lena teacht, den scéim chaomhnaithe cósta a chur i bhfeidhm arb ina taobh a bheidh an cúiteamh á éileamh, agus déanfaidh an t-eadránaí, go háirithe—

(a) aird a thabhairt, i gcás éileamh i leith cearta uisce, ar aon soláthar uisce ionaid a chuir na Coimisinéirí ar fáil, agus

(b) aird a thabhairt, i gcás éileamh mar gheall ar chur isteach ar uisce nó ar uisce-chúrsa a sholáthraíonn cumhacht do mhuileann nó do ghnóthas tionscail eile, ar a mhéid a rinneadh an chumhacht a cuireadh ar fáil amhlaidh a úsáid chun críche tionscail sna deich mbliana díreach roimh an dáta a daingníodh an scéim chaomhnaithe cósta, agus aird a thabhairt, freisin, ar aon fhoinse ionaid cumhachta a chuir na Coimisinéirí ar fáil.

Airgead a sholáthar chun scéimeanna a chur i bhfeidhm.

16.—Déanfar an t-airgead a bheidh ag teastáil chun na costais agus na caiteachais a íoc faoina rachfar ag cur scéim chaomhnaithe cósta i bhfeidhm a daingníodh de bhun an Achta seo (lena n-áirítear costas aon réamhscrúdú a rinne na Coimisinéirí, costas na scéime a ullmhú agus an cúiteamh uile agus an t-airgead eile uile is iníoctha agus an caiteachas teagmhasach go léir) a sholáthar, ach amháin mar a ordaítear a mhalairt leis an Acht seo, mar a leanas:

(a) ranníocfaidh an tAire Airgeadais, as airgead a sholáthróidh an tOireachtas, an méid is ionann agus an céatadán sin den airgead sin is comhionann leis an gcéatadán a mbeidh sé ráite sa scéim arna daingniú gurb é an céatadán é atá an tAire Airgeadais ullamh ar a ranníoc,

17.—(1) Déanfar ranníocaí i leith na hiarmhéide dá dtagraítear i mír (b) d'alt 16 den Acht seo de réir na bhforálacha seo a leanas:

(a) i gcás inar comhairle contae an t-údarás bunaitheoir eachta, déanfaidh bardas aon bhuirge (nach contae bhuirg) nó comhairle aon cheantair uirbigh ina bhfuil an t-iomlán nó aon chuid de na tailte caomhnaithe an méid sin a ranníoc a mbeidh comhaontaithe acu air leis an údarás bunaitheoireachta le toiliú an Aire Rialtais Áitiúil,

(b) i gcás inar comhairle ceantair uirbigh an t-údarás bunaitheoireachta, ranníocfaidh aon chomhairle contae cibé méid a mbeidh comhaontaithe acu air leis an údarás bunaitheoireachta le toiliú an Aire Rialtais Áitiúil,

(c) déanfaidh aon údarás cuain de réir bhrí an Achta Cuanta, 1946, an méid sin a ranníoc a mbeidh comhaontaithe acu air leis an údarás bunaitheoireachta le toiliú an Aire Iompair agus Cumhachta,

(d) ranníocfaidh aon duine is úinéir nó áititheoir ar aon chuid de na tailte caomhnaithe suim arb í an tsuim í a fuarthas nó a gnóthaíodh de bhun aon chomhaontú, idir an t-úinéir nó an t-áititheoir sin agus an t-údarás bunaitheoireachta, a dhéanann foráil chun an t-úinéir nó an t-áititheoir sin do dhéanamh ranníoca i leith na hiarmhéide sin,

(e) i gcás inar ainmníodh an t-údarás bunaitheoireachta de bhun fo-alt (4) d'alt 2 den Acht seo, déanfaidh an chomhairle contae eile nó gach comhairle contae eile a d'ainmnigh an t-údarás bunaitheoireachta an méid sin a ranníoc a chinnfidh an tAire Rialtais Áitiúil, cheal comhaontú, leis an údarás bunaitheoireachta.

(2) Maidir le haon chomhaontú den sórt dá dtagraítear i mír (a), (b), (c) nó (d) d'fho-alt (1) den alt seo, údaraítear leis seo, faoi réir forálacha na míre seo, don údarás bunaitheoireachta agus don pháirtí eile a luaitear sa mhír an comhaontú a dhéanamh agus a chur i bhfeidhm agus féadfar aon suim is iníoctha faoin gcomhaontú sin a ghnóthú, mura n-íocfar go cuí í, mar fhiach conartha shimplí in aon chúirt dlínse inniúla.

(3) Féadfaidh údarás cuain, chun críocha ranníoc a dhéanamh faoin alt seo, airgead a fháil ar iasacht faoi alt 120 den Acht Cuanta, 1946, arna leasú le halt 6 den Acht Cuanta, 1947, ionann is dá mba chríocha i ndáil lena gcuan na críocha sin.

(4) Aon airgead a thógfar ar iasacht de bhun fo-alt (3) den alt seo féadfar é a thabhairt ar iasacht trí eisiúint as Ciste na nIasachtaí Áitiúla ionann is dá mba éard a bhí san iasacht sin iasacht áitiúil de réir bhrí Achtanna na nIasachtaí Áitiúla, 1935 go 1961, agus go raibh sí údaraithe le hAcht ón Oireachtas.

Deimhniú déantachta.

18.—(1) I gcás inar deimhin leis na Coimisinéirí, maidir le hoibreacha a bheidh ar áireamh i scéim chaomhnaithe cósta a daingníodh de bhun an Achta seo, go bhfuil na hoibreacha críochnaithe de réir na scéime (faoi réir cibé breisithe, fágáil ar lár, athruithe agus coradh a fuarthas a bheith riachtanach i gcúrsa na hoibre), eiseoidh an tAire Airgeadais deimhniú á dheimhniú go bhfuil na hoibreacha críochnaithe mar a dúrad.

(2) Taispeáinfidh deimhniú déantachta, i gcorp an deimhnithe nó trí léarscáileanna, líníochtaí, pleananna, teascáin agus sceidil iomchuí a bheidh ag gabháil leis—

(a) na hoibreacha a bheidh críochnaithe,

[EN]

(b) na tailte caomhnaithe, agus

[EN]

(c) costas iomlán na n-oibreacha.

[EN]

(3) Beidh deimhniú déantachta ina fhianaise dhochloíte go bhfuil na hoibreacha a thaispeáinfear leis críochnaithe de réir na scéime caomhnaithe cósta iomchuí (faoi réir cibé breisithe, fágáil ar lár, athruithe agus coradh a fuarthas a bheith riachtanach i gcúrsa na hoibre).

(4) Beidh éifeacht ag na forálacha seo a leanas maidir le deimhniú déantachta a eisiúint faoin alt seo:

(a) cuirfidh an tAire Airgeadais faoi deara go bhfoilseofar san Iris Oifigiúil, agus i nuachtán amháin nó níos mó a léitear i gcontae an údaráis bhunaitheoireachta agus in aon chontae eile ar ainmnigh a chomhairle an t-údarás bunaitheoireachta de bhun an Achta seo, fógra á rá go mbeartaíonn an tAire Airgeadais an deimhniú a eisiúint agus go bhféadfaidh aon duine, laistigh de dhá mhí tar éis dáta an fhógra a fhoilsiú san Iris Oifigiúil, agóid i gcoinne an deimhniú a eisiúint a chur chuig an Aire Airgeadais;

(b) an tráth céanna, nó a luaithe is féidir tar éis an trátha, a fhoilseofar an fógra san Iris Oifigiúil, cuirfidh an tAire Airgeadais cóip den fhógra chun an údaráis bhunaitheoireachta agus chun aon chomhairle eile a d'ainmnigh an t-údarás bunaitheoireachta;

(c) féadfaidh an chomhairle chun ar cuireadh cóip den fhógra agus féadfaidh aon duine eile, laistigh de dhá mhí tar éis dáta an fhógra a fhoilsiú san Iris Oifigiúil, agóid i scríbhinn ag insint go bhfuil an chomhairle nó an duine sin ag cur in aghaidh an deimhniú a eisiúint agus foras na hagóide;

(d) breithneoidh an tAire Airgeadais aon agóid a chuirfear mar a dúradh agus déanfaidh sé cibé bearta ina taobh is cuí leis;

(e) ní eiseofar an deimhniú ar dháta is luaithe ná dhá mhí tar éis dáta an fhógra a fhoilsiú san Iris Oifigiúil.

(5) Is feidhm fhorcoimeádta i gcás údaráis áitiúil an chumhacht a thugtar le mír (c) d'fho-alt (4) den alt seo.

Cistí iontaobhais i leith claífort láithreacha.

19.—(1) I gcás ciste iontaobhais a bheith ann ar dháta deimhniú déantachta a eisiúint, cibé acu don Iontaobhaí Poiblí, do Choimisiún Talún na hÉireann nó d'iontaobhaithe a bheidh an ciste sin dílsithe, chun cothabháil a dhéanamh (go buan nó ar feadh tréimhse sonraithe nó eile) ar chlaífort láithreach (cibé acu leis féin nó i dteannta oibreacha eile) is claífort nach bhfuil riachtanas leis féin nó le cuid de feasta de bharr na n-oibreacha lena mbaineann an deimhniú déantachta, beidh éifeacht ag an gcuid de na forálacha seo a leanas is inchurtha chun feidhme:

(a) má bhíonn deireadh curtha leis an riachtanas a bhí leis an gclaífort láithreach uile agus gur leis an gclaífort láithreach amháin a bhainfidh an t-iontaobhas, déanfar, a luaithe is féidir tar éis an deimhniú déan tachta a eisiúint, an ciste iontaobhais a íoc isteach sa Státchiste, nó a chur chun tairbhe don Státchiste, i cibé slí a ordóidh an tAire Airgeadais;

(b) más cuid, agus amháin más cuid, den chlaífort láithreach a mbeidh deireadh curtha leis an riachtanas a bhí léi agus gur leis an gclaífort amháin a bhainfidh an ciste iontaobhais, déanfaidh Coimisinéir Breithiúnais Choimisiún Talún na hÉireann, ar na Coimisinéirí á iarraidh sin agus ar fhógra a bheith tugtha do na páirtithe uile lena mbainfidh agus tar éis caoi a thabhairt do na páirtithe sin ar éisteacht a fháil, an ciste iontaobhais a chionroinnt amhail idir an gcuid den chlaífort láithreach ar cuireadh deireadh leis an riachtanas a bhí léi agus an chuid eile den chlaífort láithreach, agus air sin déanfar an chuid den chiste iontaobhais a chionroinnfear amhlaidh i leith na coda den chlaífort láithreach ar cuireadh deireadh leis an riachtanas a bhí léi a íoc isteach sa Státchiste, nó a chur chun tairbhe don Státchiste, i cibé slí a ordóidh an tAire Airgeadais;

(c) má bhíonn deireadh curtha leis an riachtanas a bhí leis an gclaífort uile agus go mbainfidh an ciste iontaobhais leis an gclaífort láithreach agus le hoibreacha eile freisin, déanfaidh Coimisinéir Breithiúnais Choimisiún Talún na hÉireann, ar na Coimisinéirí á iarraidh sin agus ar fhógra a bheith tugtha do na páirtithe uile lena mbainfidh agus tar éis caoi a thabhairt do na páirtithe sin ar éisteacht a fháil, an ciste iontaobhais a chionroinnt amhail idir an claífort láithreach agus na hoibreacha eile, agus air sin déanfar an chuid den chiste iontaobhais a chionroinnfear amhlaidh i leith an chlaífoirt láithrigh a íoc isteach sa Státchiste, nó a chur chun tairbhe don Státchiste, i cibé slí a ordóidh an tAire Airgeadais;

(e) i gcás ina gceanglaítear le haon cheann de na forálacha roimhe seo den fho-alt seo an ciste iontaobhais nó cuid de a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste, is dleathach don Iontaobhaí Poiblí, do Choimisiún Talún na hÉireann nó do na hiontaobhaithe (de réir mar a bheidh) an t-iomlán nó an chuid sin is gá de na hinfheistíochtaí (más ann) a bheidh in ionannas don chiste iontaobhais a dhíol chun an t-íoc nó an cur chun tairbhe a dhéanamh;

(f) i gcás ina gceanglaítear le haon cheann de na forálacha roimhe seo den fho-alt seo iomlán an chiste iontaobhais a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste beidh, cibé acu, an tIontaobhaí Poiblí, Coimisiún Talún na hÉireann nó na hiontaobhaithe, dá raibh an ciste iontaobhais dílsithe díreach roimh an íoc nó an cur chun tairbhe, arna urscaoileadh, díreach ar an íoc nó an cur chun tairbhe a dhéanamh, de bhua an Achta seo ó na hiontaobhais agus na dualgais ar ar theachtadar amhlaidh an ciste ion taobhais (cibé acu de bhua gníomhas iontaobhais, scéime nó ar shlí eile é), agus aon daoine eile a bhí, díreach roimh an íoc nó an cur chun tairbhe, i gcáil mhuiníneach maidir leis an gciste iontaobhais beidh siad arna n-urscaoileadh mar an gcéanna ó na hiontaobhais agus na dualgais a bheidh forchurtha orthu de bhua na cáile sin;

(g) i gcás inar cuid den chiste iontaobhais a bheidh de cheangal, faoi aon cheann de na forálacha roimhe seo den fho-alt seo, a íoc isteach sa Státchiste nó a chur chun tairbhe don Státchiste, beidh feidhm agus éifeacht ag mír (f) den fho-alt seo maidir leis an gcuid sin den chiste iontaobhais amhail is dá mba é an ciste iontaobhais go léir é, ach ní oibreoidh aon ní san Acht seo chun an tIontaobhaí Poiblí, Coimisiún Talún na hÉireann, nó na hiontaobhaithe (cibé acu é) ná duine ar bith eile a fhuascailt nó a shaoradh, maidir le hiarmhéid an chiste iontaobhais, ó aon iontaobhas nó dualgas a bheidh forchurtha orthu nó air de thuras na huaire (trí ghníomhas iontaobhais, scéim, nó ar shlí eile) maidir leis an gciste iontaobhais sa mhéid go mbainfidh an t-iontaobhas nó an dualgas sin le hiarmhéid an chlaífoirt láithrigh.

(2) San alt seo—

ciallaíonn “claífort” sruthchúrsa, draen, claífort nó obair shaorga eile a rinneah chun talamh a chaomhnú, agus folaíonn sé na loc-chomhlaí, na loc-gheataí, na caidéil, na coraí, na sruthchúrsaí agus na hoibreacha eile go léir is cuid d'aon chlaífort nó obair den saghas sin nó is gá chun é a oibriú go héifeachtúil;

ciallaíonn “claífort láithreach” claífort a rinneadh (roimh dháta an Achta seo a rith nó dá éis sin) chun talamh a chaomhnú a ceannaíodh faoi na hAchtanna Talamh-Cheannaigh nó is ábhar d'imeachtaí faoi na hAchtanna sin, cibé acu roimh an gceannach sin nó roimh imeachtaí a thionscnamh chuige sin nó dá éis sin a rinneadh an claífort agus cibé acu ag sean-tiarna talún nó duine eile nó ag Coimisiún Talún na hÉireann nó faoina maoirseacht a rinneadh é.

20.—(1) Déanfaidh na Coimisinéirí na hoibreacha lena mbainfidh deimhniú déantachta a chothabháil i ndeisriocht ceart agus i staid éifeachtúil agus féadfaidh na Coimisinéirí gach ní a dhéanamh is dóigh leo is gá le haghaidh nó i dtaobh na cothabhála sin.

(2) I dteannta na gcumhachtaí ginearálta a thugtar do na Coimisinéirí le fo-alt (1) den alt seo agus gan dochar do na cumhachtaí sin, is dleathach do na Coimisinéirí, chun críocha na cothabhála dá dtagraítear san fho-alt sin, cibé féabhsuithe a dhéanamh ar oibreacha a bhfeicfear dóibh gurb mion-rudaí iad ar féidir, le ceart, iad a áireamh mar nithe a bhaineann le cothabháil.

(3) Is dleathach do na Coimisinéirí agus dá n-oifigigh, dá ngníomhairí agus dá seirbhísigh dul isteach ar aon tailte gach tráth réasúnach agus gach ní a dhéanamh ansin a fheicfear dóibh is gá le haghaidh nó i dtaobh aon chothabhála nó feabhsuithe dá dtagraítear san alt seo.

(4) Féadfaidh na Coimisinéirí conraitheoirí a fhostú chun aon chothabháil nó feabhsuithe a dhéanamh dá dtagraítear san alt seo agus féadfaidh na conraitheoirí an chuid sin de na cumhachtaí a fheidhmiú a shonraítear san alt seo agus is iomchuí chun críocha a gconartha.

(5) (a) San fho-alt seo tá an bhrí chéanna le “ábhar cladaigh” atá leis san Acht Imeall Trágha, 1933.

(b) Ní dhéanfaidh aon duine, ach amháin faoi réim agus de réir ceadúnais, ábhar cladaigh a thabhairt chun siúil a bheidh in aice le, nó fad nach mó ná céad slat ó, aon oibreacha a cheanglaítear leis an alt seo a chothabháil ag na Coimisinéirí.

(c) Féadfaidh na Coimisinéirí ceadúnais chun críocha an fho-ailt seo a dheonú.

(d) Aon duine a sháróidh mír (b) den fho-alt seo beidh sé ciontach i gcion agus ar a chiontú go hachomair dlífear fíneáil nach mó ná fiche punt a chur air.

(e) I gcás ina ndeonófar ceadúnas faoin bhfo-alt seo i leith duine do thabhairt ábhar cladaigh chun siúil, ní oibreoidh an deonú chun aon oibleagáid a dhíchur a bheidh ar an duine sin ceadúnas a fháil faoin Acht Imeall Trágha, 1933, nó faoin Acht Maoine Stáit, 1954, á údarú an t-ábhar cladaigh sin a thabhairt chun siúil.

(6) Ní bheidh aon ábhar caingne ann i gcoinne na gCoimisinéirí, i leith caillteanas de dheasca oibreacha cliseadh a cheanglaítear leis an alt seo a chothabháil ag na Coimisinéirí, mura gcruthófar chun sástachta na Cúirte gurbh é amháin ba chúis leis an gcliseadh faillí ag na Coimisinéirí ina n-oibleagáid na hoibreacha a chothabháil.

E toirmiscthe baint le hoibreacha.

21.—(1) Ní leagfaidh, ní dhíchuirfidh ná ní dhíobhálfaidh aon duine aon oibreacha a bheidh déanta nó á ndéanamh ag na Coimisinéirí faoi scéim chaomhnaithe cósta ná ní dhéanfaidh aon ghníomh a bhacfaidh oibriú éifeachtúil aon oibreacha den sórt sin.

(2) Aon duine a sháróidh fo-alt (1) den alt seo beidh sé ciontach i gcion agus, ar a chiontú ann go hachomair, dlífear fíneáil nach mó ná caoga punt a chur air nó, de rogha na Cúirte, príosúnacht ar feadh téarma nach faide ná sé mhí nó an fhíneáil sin agus an phríosúnacht sin le chéile agus dlífear freisin, i gcás ciona leanúnaigh, fíneáil nach mó ná cúig phunt a chur air in aghaidh gach lae a leanfaidh an cion.

Fodhlíthe.

22.—(1) I gcás ina gceanglaítear ar na Coimisinéirí le hait 20 den Acht seo aon oibreacha a chothabháil féadfaidh siad fodhlíthe a dhéanamh chun na hoibreacha a chosaint.

(2) Ní bheidh aon fheidhm ná éifeacht le haon fhodhlí faoin alt seo mura ndéanfar é, nó go dtí go ndéanfar é, a dhaingniú ag an Aire Airgeadais.

(3) I gcás ina ndaingneoidh an tAire Airgeadais fodhlí a rinneadh faoin alt seo, foilseofar fógra i dtaobh an daingnithe san Iris Oifigiúil agus i nuachtán amháin nó níos mó a léitear sa cheantar ina bhfuil na hoibreacha lena mbaineann an fodhlí.

(4) Aon doiciméad a airbheartóidh gur cóip é d'fhodhlí a rinneadh faoin alt seo agus a mbeidh deimhniú formhuinithe air a airbheartóidh a bheith séalaithe le séala na gCoimisinéirí á dhearbhú gur fíorchóip é den fhodhlí glacfar i bhfianaise é in aon imeachtaí (sibhialta nó coiriúil) in aon Chúirt mar fhianaise dhochloíte ar lánas an fhodhlí agus go ndearnadh agus gur daingníodh go cuí é de réir an ailt seo agus go bhfuil sé i bhfeidhm.

(5) Aon duine a sháróidh, trí ghníomh nó neamhghníomh, fodhlí a rinneadh faoin alt seo agus a bheidh i bhfeidhm beidh sé ciontach i gcion faoin alt seo agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná deich bpunt a chur air.

Oibreacha a thréigean.

23.—(1) I gcás ina gceanglaítear ar na Coimisinéirí le halt 20 den Acht seo aon oibreacha áirithe a chothabháil agus gurb é a dtuairim, aon tráth, nach féidir, ar chúiseanna nach bhfuil neart acu orthu, iad a chothabháil feasta ar chostas réasúnach, féadfaidh siad ordú faoin alt seo a iarraidh ar an Aire Airgeadais.

(2) I gcás ina ndéanfaidh na Coimisinéirí iarratas faoi fho-alt (1) den alt seo—

(a) féadfaidh an tAire Airgeadais, más deimhin leis nach féidir, ar chúiseanna nach bhfuil neart ag na Coimisinéirí orthu, na hoibreacha, nó aon chuid nó codanna áirithe de na hoibreacha, lena mbaineann an t-iarratas a chothabháil feasta ar chostas réasúnach, le hordú a údarú na hoibreacha nó an chuid nó na codanna sin a thréigean,

(b) oibreoidh an t-ordú chun na Coimisinéirí a fhuascailt ó bheith faoi oibleagáid na hoibreacha nó an chuid nó na codanna sin díobh a chothabháil,

(c) féadfaidh an t-ordú a ordú do na Coimisinéirí bearta sonraithe a dhéanamh ionas nach ndéanfaidh dainséir ná núis de na hoibreacha tréigthe.

(d) má bhíonn aon ordú den sórt sin san ordú déanfaidh na Coimisinéirí dá réir.

Blianachtaí talamh-cheannaigh, etc., a chionroinnt.

24.—I gcás talamh a glacadh faoin Acht seo a bheith, i dteannta talún eile, faoi réir blianachta talamh-cheannaigh nó íocaíochta bliantúla eile is iníoctha le Coimisiún Talún na hÉireann nó leis na Coimisinéirí, féadfaidh Coimisiún Talún na hÉireann nó na Coimisinéirí (de réir mar a bheidh) an bhlianacht nó an íocaíocht bhliantúil a chionroinnt i cibé slí is cuí leo idir an talamh a glacadh amhlaidh agus an talamh eile nó féadfaidh siad iomlán na blianachta nó na híocaíochta eile a mhuirearú ar aon chuid áirithe den talamh a bheidh faoi réir an chéanna agus an chuid eile den talamh sin a fhágáil gan muirearú amhlaidh.

Fiacha áirithe a íoc as cúiteamh.

25.—I gcás inarb iníoctha cúiteamh faoin Acht seo ag na Coimisinéirí le duine agus go mbeidh aon airgead dlite den duine sin d'Aire Stáit, do na Coimisinéirí Ioncaim, do Choimisiún Talún na hÉireann nó do na Coimisinéirí, is dleathach do na Coimisinéirí an t-airgead a bheidh dlite amhlaidh den duine sin a íoc agus a ghlanadh as an gcúiteamh agus gan a íoc leis ach an iarmhéid (más ann) den chúiteamh a bheidh fágtha tar éis an íoca agus an ghlanta sin.

Suimeanna áirithe a íoc leis na Coimisinéirí.

26.—(1) I gcás ina ndéanfar cinneadh faoi mhír (a) d'fho-alt (1) d'alt 4 nó dearbhú faoi mhír (a) d'fho-alt (1) d'alt 5 den Acht seo, seirbheálfaidh na Coimisinéirí leis an bpost ar an údarás bunaitheoireachta fógra ag insint gurb í an tsuim atá deimhnithe ag na Coimisinéirí méid na gcostas agus na gcaiteachas faoina ndeachaigh na Coimisinéirí i leith an réamhscrúdaithe agus ag éileamh ar an údarás bunaitheoireachta leath na suime sin a íoc leis na Coimisinéirí.

(2) I gcás ina ndéanfar dearbhú faoi mhír (a) d'fho-alt (1) d'alt 8, dearbhú faoi fhomhír (i) de mhír (a) d'fho-alt (3) nó faoi fho alt (6) d'alt 10 nó ordú faoi mhír (a) d'fho-alt (5) d'alt 10 den Acht seo, seirbheálfaidh na Coimisinéirí leis an bpost ar an údarás bunaitheoireachta fógra ag insint gurb í an tsuim atá deimhnithe ag na Coimisinéirí méid na gcostas agus na gcaiteachas faoina ndeachaigh na Coimisinéirí i ndáil leis an scéim chaomhnaithe cósta agus ag éileamh ar an údarás bunaitheoireachta leath na suime sin a íoc leis na Coimisinéirí.

(3) I gcás ina ndéanfaidh na Coimisinéirí cothabháil nó feabhsuithe dá dtagraítear in alt 20 nó ordú dá dtagraítear i mír (c) d'fho-alt (2) d'alt 23 den Acht seo a chomhlíonadh, seirbheálfaidh siad leis an bpost ar an údarás bunaitheoireachta fógra ag insint gurb í an tsuim atá deimhnithe ag na Coimisinéirí méid na gcostas agus na gcaiteachas faoina ndeachaigh na Coimisinéirí ag déanamh na cothabhála nó na bhfeabhsuithe nó ag comhlíonadh an fhógra, agus ag éileamh ar an údarás bunaitheoireachta an tsuim sin a íoc leis na Coimisinéirí.

(4) Beidh an tsuim a éileofar le fógra a sheirbheálfar faoin alt seo iníoctha leis na Coimisinéirí ag an údarás bunaitheoireachta agus, mura n-íocfar í, beidh sí inghnóthaithe mar fhiach conartha shimplí in aon chúirt dlínse inniúla.

(5) (a) I gcás ina ndéanfaidh na Coimisinéirí cothabháil nó feabhsuithe ag Trá Ros Láir, beidh feidhm ag fo-ailt (3) agus (4) den alt seo ionann is dá mbeadh tagairt don chothabháil nó do na feabhsuithe in alt 20 den Acht seo agus dá mba iad comhairle chontae Loch Garman an t-údarás bunaitheoireachta.

(b) Sa mhír sin roimhe seo—

déanfar an tagairt do chothabháil ag Trá Ros Láir a fhorléiriú mar thagairt do na hoibreacha caomhnaithe cósta ag Trá Ros Láir i gcontae Loch Garman a thosaigh na Coimisinéirí sa bhliain 1957 a chothabhaíl i ndeisriocht ceart agus i staid éifeachtúil;

déanfar an tagairt d'fheabhsuithe ag Trá Ros Láir a fhorléiriú mar thagairt d'aon fheabhsuithe ar na hoibreacha sin a rinne na Coimisinéirí agus a bhfeicfear dóibh gur mion-rudaí iad ar féidir, le ceart, iad a áireamh mar nithe a bhaineann le cothabháil.

(6) Más rud é, i gcás ina seirbheálfar fógra faoi fho-alt (1) nó faoi fho-alt (2) den alt seo, go bhfuil cuid den talamh agus den mhaoin atá á dhamáistiú nó á bhaolú ag ionradh farraige i limistéar feidhmiúcháin an údaráis bhunaitheoireachta agus cuid eile den chéanna i limistéar feidhmiúcháin údaráis áitiúil eile nó i limistéir feidhmiúcháin údarás áitiúla eile, déanfaidh an t-údarás áitiúil eile nó gach ceann de na húdaráis áitiúla eile, a mhéid a éileoidh an fógra, suim a ranníoc a mbeidh inti cibé méid ar a gcomhaon tóidh siad féin agus an t-údarás bunaitheoireachta nó, cheal comhaontú, a shocróidh an tAire Rialtais Áitiúil.

(7) Más rud é, i gcás ina seirbheálfar fógra faoi fho-alt (3) den alt seo, go ndearna údarás áitiúil nó údaráis áitiúla ranníoc de bhun mhír (a) d'fho-alt (1) d'alt 17 den Acht seo, déanfaidh an t-údarás áitiúil sin nó gach ceann de na húdaráis áitiúla sin, a mhéid a éileoidh an fógra, suim a ranníoc a mbeidh inti méid ar a gcomhaontóidh siad féin agus an t-údarás bunaitheoireachta nó, cheal comhaontú, a shocróidh an tAire Rialtais Áitiúil.

(8) Más rud é, i gcás ina seirbheálfar fógra faoi fho-alt (3) den alt seo, go ndearna údarás cuain nó údaráis cuain ranníoc de bhun mhír (c) d'fho-alt (1) d'alt 17 den Acht seo, déanfaidh an t-údarás cuain sin nó gach ceann de na húdaráis cuain sin, a mhéid a éileoidh an fógra, suim a ranníoc a mbeidh inti cibé méid ar a gcomhaontóidh siad féin agus an t-údarás bunaitheoireachta nó, cheal comhaontú, a shocróidh an tAire Rialtais Áitiúil tar éis dó dul i gcomhairle leis an Aire Iompair agus Cumhachta.

Fiosrúcháin phoiblí.

27.—(1) I gcás ina mbeifear tar éis tuarascáil a chur faoi bhráid comhairle contae faoi alt 2 den Acht seo, féadfaidh an tAire Airgeadais, más dóigh leis gur gá é, aon tráth sula ndéanfar an t-ordú faoi fho-alt (5) d'alt 10 den Acht seo, a chur faoi deara fiosrúchán poiblí a sheoladh ag duine a cheapfaidh sé, maidir leis na tograí i dtaobh caomhnú cósta.

(2) Beidh éifeacht ag na forálacha seo a leanas maidir le fiosrúchán poiblí faoin alt seo:

(a) foilseoidh an tAire Airgeadais san Iris Oifigiúil, agus i nuachtán amháin nó níos mó a léitear i gcontae an údaráis bhunaitheoireachta agus in aon chontae eile a ndearna a chomhairle an t-údarás bunaitheoireachta a ainmniú de bhun an Achta seo, fógra á rá go seolfar an fiosrúchán tráth (nach giorra ná trí sheachtain tar éis an fógra a fhoilsiú den chéad uair) agus san áit a shonrófar san fhógra,

(b) beidh gach duine ag a mbeidh, i dtuairim an duine a sheolfaidh an fiosrúchán, leas san fhiosrúchán i dteideal láithriú agus éisteacht a fháil (i bpearsain nó trí aturnae nó abhcóide) agus fianaise a thabhairt ar aird ag an bhfiosrúchán,

(c) beidh ag an duine a sheolfaidh an fiosrúchán cumhacht, trí fhógra i scribhinn a shíneoidh sé, finnéithe a ghairm agus a cheangal leabhair agus doiciméid eile a thabhairt ar aird, agus aon duine a ghairfear amhlaidh agus a mhainneoidh teacht i láthair ag an bhfiosrúchán agus fianaise a thabhairt aige agus aon duine a mhainneoidh nó a dhiúltóidh aon leabhar nó doiciméad eile a thabhairt ar aird a gceanglófar amhlaidh é a thabhairt ar aird beidh sé ciontach i gcion agus ar a chiontú ann go hachomair dlífear fíneáil nach mó ná deich bpunt a chur air,

(d) is faoi mhionn a thabharfar an fhianaise go léir ag fiosrúchán, mionn a chumasaítear leis seo don duine a sheolfaidh an fiosrúchán a chur, agus beidh aon duine a thabharfaidh fianaise bhréagach ag an bhfiosrúchán ciontach i mionnú éithigh agus inphionósaithe dá réir,

(e) beidh an duine a sheolfaidh an fiosrúchán i dteideal an fiosrúchán a chur ar atráth mar is oiriúnach leis agus beidh cumhacht aige freisin iniúchadh agus scrúdú a dhéanamh, agus dul isteach chun na críche sin, ar aon tailte agus áitreabh dá ndéanann ionradh iomchuí na farraige difear.

Caiteachais na gCoimisinéirí.
